Certified copies of the Board of Variance Establishment and Procedure Bylaw are available from the Islands Trust Office 200 - 1627 Fort Street, Victoria, BC V8R 1H8 Consolidated: May 2 2005 1 NORTH PENDER ISLAND LOCAL TRUST COMMITTEE BOARD OF VARIANCE ESTABLISHMENT AND PROCEDURE BYLAW NO. 157, 2004 ************************************************************************************************************** A Bylaw to establish and to set out procedures for a Board of Variance for the Southern Gulf Islands of the Islands Trust, which includes the Local Trust Committees of Galiano, Mayne, Saturna, North Pender and South Pender Island pursuant to Section 899 of the Local Government Act. *************************************************************************************************************** TITLE 1. This Bylaw may be cited as “North Pender Island Local Trust Committee Board of Variance Establishment and Procedure Bylaw No. 157, 2004” ESTABLISHMENT OF THE BOARD 2. Three persons shall be appointed to the Board of Variance (The Board). BL#165 3. The appointment of the Board of Variance shall be by resolution of the Local Trust Committee (LTC). 4. The Board shall by resolution appoint one of the appointed members as the Chair. 5. The Chair may appoint a member of the Board as Acting Chair to preside in the absence of the Chair. BL#165 6. By separate resolution of the LTC, the Chair or any other member of the Board, may be removed from the Board. 7. At the time of their appointment, the members shall be appointed to a three year term. 8. A quorum of the Board for all hearings, pursuant to the provisions of this Bylaw, shall be two (2) or more members. 9. Advertising for members of the Board shall be done through the newspaper and at the usual posting place in each Local Trust Area. 10. A person who is a member of the advisory planning commission, a Trustee of the Islands Trust or an officer or employee of the Islands Trust is not eligible to be appointed to the Board. PROCEDURES OF THE BOARD Secretary to the Board 11. The Director of Local Planning Services or their representative is appointed as the Secretary to the Board. 12. The Secretary, in addition to receiving applications and preparing agendas on behalf of the Board, must: 2 BL#165 a) Maintain a record of all of the decisions of the Board; and, BL#165 b) Ensure that such records are available for inspection by the public during the normal business hours of the office. 13.
