ISLANDS TRUST COUNCIL 
BYLAW NO. 80

A bylaw to designate the Gambier Island Local Trust Area as an area for which 
 Natural Area Protection Tax Exemptions may be provided.

WHEREAS pursuant to Section 49.2 of the Islands Trust Act the Islands Trust Council may, for the 
purpose of carrying out the object of the Trust, designate all or part of a local trust area as an area 
for which tax exemptions may be provided under Part 7.1 of the Act; and 
 
WHEREAS  the  Sunshine  Coast  Regional  District  Board,  on  September  28,  1999  entered  into  a  
Protocol  Agreement  with  Islands  Trust  Council  to  implement  the  Natural  Area  Protection  Tax  
Incentive Program in the Gambier Island Local Trust Area; and  
 
WHEREAS  the  Sunshine  Coast  Regional  District  Board  on November  28,  2002  approved  an 
administrative  Letter  of  Understanding  to  implement  the  new  legislation  of  Part  7.1  of  the  Islands 
Trust Act;  
 
NOW THEREFORE the Islands Trust Council, in open meeting assembled, enacts as follows: 
 
Citation 
1. This  bylaw  may  be  cited  for  all  purposes  as  "Islands  Trust  Council  designation  of  the  Gambier  
Island Natural Area Protection Tax Exemption Area, Bylaw No. 80, 2001." 
 
Area 
2. The  designation  is  of  the  entire  Gambier  Island  Local  Trust  Area  as  shown  on  Schedule  “A”  as  
attached to and forming part of this Bylaw. 
 
Severability 
3. If  any  section,  subsection,  sentence,  clause  or  phrase  of  this  bylaw  is  for  any  reason  held  to  be  
invalid by a decision of a court of competent jurisdiction, the decision shall not affect the validity of 
the remaining portions of the bylaw.
