[0:01:36] Trustee Rogers (probable): I want to welcome everybody to the regular meeting of the Galeano Local Trust Committee.
[0:01:44] Trustee Rogers (probable): It's, as everybody will know, it's a beautiful day, not across the Coast Salish,
[0:01:52] Trustee Rogers (probable): traditional territories, Coast Salish people and across the local trust area.
[0:01:58] Trustee Rogers (probable): It's not the crazy heat that we had a week ago, so thankfully we didn't have this meeting a week ago, but we're doing it today.
[0:02:06] Trustee Rogers (probable): I want to welcome you all and of course want to start with a reminder or a recognition and acknowledgement of the fact that we are meeting across the territories of the Coast Salish peoples.
[0:02:22] Trustee Rogers (probable): peoples. I'm joining you from the traditional territories of the Squamish, Tsleil-Waututh
[0:02:29] Trustee Rogers (probable): and Musqueam peoples. I'm in Vancouver today, and I know that some of our staff are joining
[0:02:36] Trustee Rogers (probable): from the territories of the WSAMC speaking peoples and across Vancouver. And then those
[0:02:42] Trustee Rogers (probable): of you on Galeano, of course, are in the traditional territory of the First Nations and other Coast
[0:02:48] Trustee Rogers (probable): Salish peoples who have lived in this area for millennium. We are on a daily basis reminded of the
[0:02:58] Trustee Rogers (probable): history that this country has of its malfeasance of treatment of First Nations and Indigenous
[0:03:08] Trustee Rogers (probable): peoples. I know most of the people that I know, and I'm guessing everybody on this call and many
[0:03:16] Trustee Rogers (probable): Many of you are thinking and listening on a daily basis regarding how that impacts in your life, how you can how you can act, what steps you can take, what learning you can do.
[0:03:35] Trustee Rogers (probable): My approach mostly is learning and listening and listening and listening and learning and and then how to figuring out how to take action.
[0:03:45] Trustee Rogers (probable): There's lots of resources around, both on social media and elsewhere, related to what steps you can take. So I encourage you to do so and to think about your role in reconciliation as we move forward.
[0:04:01] Trustee Rogers (probable): So, with that, I'll just leave that and encourage people to do that.
[0:04:10] Trustee Rogers (probable): And, yeah.
[0:04:11] Trustee Rogers (probable): So, I'm also, just before we start, I'm just thinking of the people across British Columbia that are dealing with the multitude of fires.
[0:04:21] Trustee Rogers (probable): and of course the people in the First Nation community
[0:04:23] Trustee Rogers (probable): of Lytton, of the Lytton First Nation
[0:04:25] Trustee Rogers (probable): and the community itself, the town of Lytton itself
[0:04:29] Trustee Rogers (probable): and how they're dealing with the struggles from the fires
[0:04:35] Trustee Rogers (probable): when there's fires, mostly in the interior
[0:04:37] Trustee Rogers (probable): but all across the province.
[0:04:41] Trustee Rogers (probable): And it's obviously a stark reminder of our failure
[0:04:45] Trustee Rogers (probable): to deal with climate change issues as in the past
[0:04:48] Trustee Rogers (probable): and our challenge ahead to try and mitigate
[0:04:52] Trustee Rogers (probable): and adapt to what is to come.
[0:04:58] Trustee Rogers (probable): So this is a continuation of our electronic meetings.

[0:05:07] Trustee Rogers (probable): because you follow the news,
[0:05:09] Trustee Rogers (probable): the public health emergency orders have been lifted.

[0:05:30] Trustee Rogers (probable): we'll be talking about that with the trustees that's going to look like on galliano but for
[0:05:35] Trustee Rogers (probable): the moment this meeting is being held electronically uh we are across zoom it's being broadcast so you

[0:08:57] Voice 7: Okay, good afternoon everyone. I wanted to do the introduction today because of the many
[0:09:04] Voice 7: comments I've received about the tenor of our meetings. This must be a safe place for everyone.
[0:09:10] Voice 7: It is also a workplace of staff and trustees and as with all workplaces we're entitled to have
[0:09:17] Voice 7: a work environment that is safe and respectful. It also needs to be safe for everyone who attends
[0:09:22] Voice 7: the meetings. And I've heard from many that they're very uncomfortable with the level of
[0:09:28] Voice 7: animosity at times and what they perceive as personal attacks. I think that the COVID
[0:09:34] Voice 7: restrictions and possibly the heat wave have affected how we relate to one another. Several
[0:09:40] Voice 7: years ago, we started the tradition at the community hall of a break in the LTC meetings
[0:09:45] Voice 7: or in other CIMs in order to have refreshments and to have a chance to talk informally among
[0:09:50] Voice 7: ourselves. Without that I think we have lost some connections and civility.
[0:09:57] Voice 7: Staff and trustees are trying their best. You may not always agree with your
[0:10:02] Voice 7: trustees, we don't always agree with each other, but I think that when we have
[0:10:06] Voice 7: civil discourse we can hear each other better and that the discussions can be
[0:10:11] Voice 7: more comprehensive and thoughtful. Galliano residents are definitely
[0:10:15] Voice 7: passionate and engaged and this is great. We appreciate all the views of this
[0:10:20] Voice 7: community sometimes not the way in which they're delivered so please remember to speak only during
[0:10:27] Voice 7: the times allotted to you address the trustees if you have a question that staff needs to answer
[0:10:33] Voice 7: the trustees will ask staff to respond this is not an open forum for you to address other members of
[0:10:39] Voice 7: the community and you can do that elsewhere so please speak to the issues use language that is
[0:10:44] Voice 7: is honest, accurate and direct and focuses on facts
[0:10:48] Voice 7: and please speak respectfully.
[0:10:51] Voice 7: So thank you for your cooperation

[0:11:25] Trustee Rogers (probable): to defer an issue related to the galley application

[0:11:34] Trustee Rogers (probable): which I'm proposing to put in as 13.4,

[0:14:15] Voice 7: Okay. It's been a busy month
[0:14:18] Voice 7: for everybody. The Southern Gulf Island Forum met with electronically with Robert Lewis Manning,
[0:14:26] Voice 7: who is the president of the Chamber of Shipping. And the issue was regarding anchorages. And
[0:14:32] Voice 7: And there was quite a lot of discussion.
[0:14:37] Voice 7: There's not a lot of progress to report at the moment, but we did talk about, he talked about that there are other areas that might be suitable for anchorages that would have less impact.
[0:14:51] Voice 7: They're further from the port, which means the transportation of pilots and so on is a little bit extended.
[0:14:59] Voice 7: But also people raised the issue of mooring buoys rather than dragging anchors in Trincomalee in particular.
[0:15:09] Voice 7: And so those are things that are being looked at.
[0:15:14] Voice 7: He did mention, though, that the federal government had no amendments to the Canada Marine Act.
[0:15:22] Voice 7: And so that was a little bit of a surprise to the shipping people.
[0:15:25] Voice 7: Anyway, it was, it was a productive discussion and he certainly took away the concerns that people have been raising on all the islands about the anchorages, the noise, the light, the dragging anchors, etc.
[0:15:38] Voice 7: et cetera. I've also done a number of site visits and many conversations with residents regarding
[0:15:47] Voice 7: the trust policy statement and also just reading massive amounts of submissions on the trust
[0:15:56] Voice 7: policy statement. That's all.

[0:16:03] Voice 15: Yeah. So just to update the trust policy
[0:16:06] Voice 15: statement um special trust council meetings coming up on the public input session that's
[0:16:13] Voice 15: on wednesday evening and then with the trust council discussion on thursday um i encourage
[0:16:19] Voice 15: people to educate themselves and read the proposals i will be posting the link on the
[0:16:24] Voice 15: both of our social media pages and it's also available on the islands trust web page

[0:16:46] Trustee Rogers (probable): So I have two things I'd like to just talk about briefly. The first is about
[0:16:55] Trustee Rogers (probable): local trust committee meetings and what we do with the ending of the public health
[0:17:03] Trustee Rogers (probable): emergency declaration from the from the province um i've said and uh and i think it's correct it's
[0:17:13] Trustee Rogers (probable): going to be um actually more challenging to come out of public health emergency in terms of our
[0:17:18] Trustee Rogers (probable): meeting process than it was to go in and and the reason is because when we went in we really didn't
[0:17:25] Trustee Rogers (probable): have any options i mean we had to figure it out uh we found the technology and we figured it out
[0:17:31] Trustee Rogers (probable): and we did it and we started this process to allow for continued community engagement with the trust
[0:17:39] Trustee Rogers (probable): with the LTC and indeed the trust general. As we come out of this then we have to figure out
[0:17:49] Trustee Rogers (probable): what it presuming all goes according to the projections. What is this going to look like?
[0:17:56] Trustee Rogers (probable): I mean, one option is to simply go back to the way we used to do business or always have done business, which is to have in-person meetings on the islands, etc.
[0:18:09] Trustee Rogers (probable): My sense is, however, that two things.
[0:18:14] Trustee Rogers (probable): One is there are going to be people who will still not be comfortable meeting in person as we move forward.
[0:18:20] Trustee Rogers (probable): And second of all, the technology has now allowed numbers of people to attend that would not otherwise be able to attend in person.
[0:18:32] Trustee Rogers (probable): For example, if you're an applicant and living in Delta, you could attend the meeting without having to get on a ferry and come to the meeting.
[0:18:39] Trustee Rogers (probable): um we we are not quite sure what that's going to look like because at trust council in june
[0:18:45] Trustee Rogers (probable): uh a proposal to um to set up a hybrid system that would require effectively the hiring of
[0:18:53] Trustee Rogers (probable): another person uh was voted down um and mostly about the fact of putting another staff person
[0:19:01] Trustee Rogers (probable): on not because people didn't want some form of hybrid meeting meeting but how we administer it
[0:19:06] Trustee Rogers (probable): is going to be challenging um and so that hasn't yet been figured out uh and uh just so everybody
[0:19:14] Trustee Rogers (probable): knows but we're working on it as we try and look at when we're coming out of the pandemic and how
[0:19:20] Trustee Rogers (probable): we can both if there's a way we can both broadcast meetings and allow people to participate that way
[0:19:27] Trustee Rogers (probable): and also to um and to also do in-person uh meetings so people can come and and participate
[0:19:35] Trustee Rogers (probable): as they have are used to doing and I we've had a lot of feedback that people feel that
[0:19:39] Trustee Rogers (probable): that meetings in person are are more effective in a better way for people to understand the
[0:19:45] Trustee Rogers (probable): issues that are facing the trust or our local trust committee and so we're we're working on
[0:19:52] Trustee Rogers (probable): on that process uh and it's but it's not a simple fix because we have uh we have uh locations that
[0:19:59] Trustee Rogers (probable): have better wi-fi than other locations we have we don't the technology has to be bought and
[0:20:04] Trustee Rogers (probable): installed and someone has to operate it etc not like as a municipal council that has one meeting
[0:20:10] Trustee Rogers (probable): hall that they need to put the the uh the technology into and then everybody can come
[0:20:16] Trustee Rogers (probable): to that meeting hall and you always have the technology available it's it's much more common
[0:20:20] Trustee Rogers (probable): so i i just wanted to say that to the people on galeano uh the folks in galeano is to we're
[0:20:28] Trustee Rogers (probable): working on that but it'd be interesting to and i've heard people say they should be you know
[0:20:33] Trustee Rogers (probable): know, they prefer in-person meetings and that's fine. But I'm guessing there's folks out there.
[0:20:38] Trustee Rogers (probable): And if you have a point of view about that, don't hesitate to write us and tell us that as we go
[0:20:43] Trustee Rogers (probable): forward and trying to figure out what that technology might look like. The other thing I
[0:20:47] Trustee Rogers (probable): wanted to say was about the trust policy statement, and you've heard both trustees talk about it
[0:20:53] Trustee Rogers (probable): briefly. There has been a lot of chatter and a lot of communication and a lot of it, a lot of
[0:21:03] Trustee Rogers (probable): of emails and a discussion about the trust policy statement.
[0:21:08] Trustee Rogers (probable): I just want to make sure everybody understands
[0:21:11] Trustee Rogers (probable): exactly where we're at in the renewal
[0:21:14] Trustee Rogers (probable): of a trust policy statement
[0:21:16] Trustee Rogers (probable): that has not been updated since 1994.
[0:21:21] Trustee Rogers (probable): This trust council committed early in its term
[0:21:24] Trustee Rogers (probable): carrying on the work from last trust council
[0:21:26] Trustee Rogers (probable): to do an update of the trust policy statement.
[0:21:30] Trustee Rogers (probable): and uh we engage we committed some resources and did some of what i would call what i would call
[0:21:37] Trustee Rogers (probable): general public engagement asking people for their point of view about what they think the trust
[0:21:42] Trustee Rogers (probable): should focus on what it's what it's do the trustees work very diligently on the various
[0:21:48] Trustee Rogers (probable): areas and we came down to focusing on updating three in three areas one was climate change the
[0:21:54] Trustee Rogers (probable): second was was reconciliation and indigenous rights and the third was healthy communities
[0:21:59] Trustee Rogers (probable): and particularly housing issues.
[0:22:02] Trustee Rogers (probable): All of those were voted upon by trust council
[0:22:04] Trustee Rogers (probable): as being the focus.
[0:22:06] Trustee Rogers (probable): They're all in our strategic plan
[0:22:08] Trustee Rogers (probable): and they're all work that we have directly done.

It's been to Trust Council in June, and at least the first draft was. And then it's been back to Trust Programs Committee and made available, of course, through that process to everyone in the public.
[0:22:53] Trustee Rogers (probable): it um so i you know in some ways it feels like this process from internal has been going on for
[0:23:01] Trustee Rogers (probable): two and a half years i understand that that people a number of people in the various community island
[0:23:07] Trustee Rogers (probable): communities and there's quite a few now say that this is news to them uh clearly we didn't engage
[0:23:13] Trustee Rogers (probable): a large portion of the uh of the population of the various islands and we had committed to and
[0:23:19] Trustee Rogers (probable): are committed to a much another robust and prolonged engagement period whatever happens
[0:23:27] Trustee Rogers (probable): on July that we understand that even if this document is given first reading it's subject
[0:23:34] Trustee Rogers (probable): to change and it's already been amended a number of times since the draft was was introduced so
[0:23:42] Trustee Rogers (probable): So this is not either a secretive or an unknown process that we're going through.
[0:23:50] Trustee Rogers (probable): It's very much a process that's similar to what you might see at any level of government
[0:23:54] Trustee Rogers (probable): as they try and make substantive amendments or updates to a particular policy or a particular
[0:24:00] Trustee Rogers (probable): bylaw.
[0:24:01] Trustee Rogers (probable): I should also point out that, of course, the trust policy statement is the overriding document
[0:24:05] Trustee Rogers (probable): for the trust as a whole, but it's local trust committees that decide when and when, how
[0:24:11] Trustee Rogers (probable): how to amend their OCPs and their land use bylaws.
[0:24:15] Trustee Rogers (probable): The trust council cannot do that.
[0:24:19] Trustee Rogers (probable): They can just set the terms
[0:24:20] Trustee Rogers (probable): under which something gets met.
[0:24:22] Trustee Rogers (probable): Having said that, we're looking forward to a lot of comment.

[0:25:10] Trustee Rogers (probable): with the development of communities and housing issues

[0:25:14] Trustee Rogers (probable): is where the land use planning organization.

[0:28:43] Voice 1: The Islands Trust has done a commendable job of carrying out the original mandate set out in 1974.
[0:28:50] Voice 1: At that time, the biggest community concerns in the Gulf Islands were commercial logging, large housing subdivisions and uncontrolled population growth.
[0:28:59] Voice 1: growth. Nearly 50 years have passed and today we find ourselves facing new but no less challenging
[0:29:05] Voice 1: pressures when it comes to preserving and protecting this unique bioregion we call home
[0:29:10] Voice 1: and that First Nations have called home for thousands of years. Preserving and protecting
[0:29:16] Voice 1: for the benefit of the residents of the trust means that we are required to be just as innovative
[0:29:21] Voice 1: as those people who dreamed up the trust in 1974 to now reaffirm and reimagine how the mandate is
[0:29:29] Voice 1: executed given the realities of our world in 2021 and the coming decades. I urge you to continue
[0:29:36] Voice 1: your work in addressing all of the major issues facing us as communities of the trust area and
[0:29:43] Voice 1: this includes the climate emergency, biodiversity loss, reconciliation and affordable and workforce
[0:29:51] Voice 1: housing. It is my sense that the three of you acknowledge and understand the interconnectedness
[0:29:57] Voice 1: of the social justice issues before.
[0:30:00] Voice 1: us and the ones that are being considered right now, climate, reconciliation, and the housing

[0:32:25] Voice 5: that she wanted to sell a bunch of her personal possessions and have the money go to affordable
[0:32:30] Voice 5: housing. There have been a few people in the community come forward to do that. And this
[0:32:35] Voice 5: particular one turned into quite a huge fundraising spree that went to place over one weekend and
[0:32:42] Voice 5: raised $16,000 in three days. And so we've decided to repeat it. And we just finished another one
[0:32:49] Voice 5: this weekend that brought in a little over $5,000. We're going to continue with that all year. And I
[0:32:55] Voice 5: I just wanted to let you know that, to know about it,
[0:32:58] Voice 5: because I think it shows a tremendous amount of support
[0:33:02] Voice 5: for both projects as they go forward.
[0:33:06] Voice 5: So that's one thing.
[0:33:08] Voice 5: The other thing is, has more maybe to do
[0:33:12] Voice 5: with the Islands Trust Policy Statement,
[0:33:14] Voice 5: and I'm happy to speak there as well.
[0:33:17] Voice 5: But we all know we're in a huge global climate crisis.
[0:33:22] Voice 5: crisis. And as with the pandemic, we're all in it together. There's no one on this planet
[0:33:29] Voice 5: who will not be affected in one way or another by climate change. And I think it's really important
[0:33:35] Voice 5: that we recognize that as with the pandemic, we need to share the burden of that and not ask those
[0:33:41] Voice 5: who are already struggling to make ends meet, to shoulder it for us. I don't know how many of you
[0:33:49] Voice 5: tuned into Greta Thunberg's speech at the fifth Austrian World Summit climate conference this
[0:33:55] Voice 5: past weekend. It's one of the biggest environmental climate summits in the world. And their
[0:34:02] Voice 5: agenda this time was, or their theme this time, was healthy planet, healthy people.
[0:34:10] Voice 5: And Greta Thunberg says, the distant zero emissions targets could be a great start if
[0:34:16] Voice 5: if they weren't full of gaps and loopholes,
[0:34:18] Voice 5: and then goes on to saying that one of those
[0:34:20] Voice 5: is ignoring the crucial aspect of equity.
[0:34:23] Voice 5: And I just like to point out that I absolutely agree
[0:34:28] Voice 5: with the way that you three are moving
[0:34:31] Voice 5: with the trust policy statement.
[0:34:33] Voice 5: As Greta Thunberg acknowledges,
[0:34:36] Voice 5: equity is an essential part of solving the climate crisis.

[0:39:39] Voice 4: in this portion of the meeting.

[0:39:48] Trustee Rogers (probable): is it generic information about commercial water licenses?

[0:40:08] Voice 4: of the trustees who may or may not be aware of this information I certainly was not
[0:40:13] Voice 4: and it concerns something called precedence of rights or first in time first in right it's
[0:40:22] Voice 4: commonly referred to as fit for and it pertains to domestic groundwater users who have deemed
[0:40:29] Voice 4: rights under section 22.8 of the Water Sustainability Act, known as WSA, W-S-A, and it gives priority
[0:40:39] Voice 4: for diversion and use of water from the source, in our case on Galliano aquifers, according
[0:40:47] Voice 4: to the date that water was first used.
[0:40:50] Voice 4: It provides a means supposedly to give seniority rights to water users with the older dates
[0:40:57] Voice 4: to precedence before those who are more junior or in fact newer users and provides the ability
[0:41:05] Voice 4: for the province to invoke temporary protection orders to curtail water use beginning with those
[0:41:12] Voice 4: most junior users on a water source. Now we have learned directly from the water authorization
[0:41:21] Voice 4: people and they have stated this in writing that fit for is challenging so this is the first in
[0:41:30] Voice 4: time first in right since there are variables that can influence water availability such as
[0:41:37] Voice 4: the adequacy and maintenance status of any property owner's particular works and pumping
[0:41:43] Voice 4: interference from other neighboring wells and they've stated in response to questions put to
[0:41:49] Voice 4: them and i'm quoting here from the water authorization people the ministry people
[0:41:56] Voice 4: the onus of the burden of proof is borne by the person whose well is claimed to be dry so this
[0:42:02] Voice 4: would be the senior user this would typically need to be accompanied by a consulting professionals
[0:42:08] Voice 4: report that can clearly demonstrate that the reason for a dry well was due to pumping from
[0:42:15] Voice 4: from a specific neighboring well.
[0:42:18] Voice 4: And they go on to say that this is why they use
[0:42:21] Voice 4: a precautionary approach in their analysis.
[0:42:24] Voice 4: But further to that, they state that since deemed rights
[0:42:28] Voice 4: are considered from the date of first use of water,
[0:42:32] Voice 4: if groundwater is not yet being used on these lots,
[0:42:37] Voice 4: then no deemed rights exist.
[0:42:40] Voice 4: So just to put that into perhaps
[0:42:44] Voice 4: a little more normal wording it means that if if someone has a property that they've had for some
[0:42:51] Voice 4: time with a well but they have not uh used that well they would actually not have any first in
[0:43:00] Voice 4: time first in right protection um according to the water sustainability act um because they have not
[0:43:10] Voice 4: use their well so a commercial water license that was granted well after they purchased their
[0:43:16] Voice 4: property um there would be they would not be protected in in any way whatsoever um and i just
[0:43:25] Voice 4: want to add that further to that we've also learned that there is no right of appeal once a
[0:43:31] Voice 4: commercial water license is is issued so i that's really uh the information i wanted to bring to
[0:43:39] Voice 4: to your attention because the Water Sustainability Act
[0:43:42] Voice 4: was only approved as I understand it in 2016.
[0:43:47] Voice 4: So a lot of this information is quite untested
[0:43:52] Voice 4: and unknown in fact.
[0:43:55] Voice 4: And I think this is important for anyone on Galliano
[0:43:59] Voice 4: who may actually be looking at an adjoining property,
[0:44:05] Voice 4: applying for a commercial water license
[0:44:07] Voice 4: to know so
[0:44:09] Trustee Rogers (probable): let me let me just finish that that we that the trust has done a fair amount of work
[0:44:14] Trustee Rogers (probable): on this and spent a lot of information around what you're talking about and it's the whole
[0:44:19] Trustee Rogers (probable): process is set up to encourage two things one is to require commercial water license but second
[0:44:24] Trustee Rogers (probable): forget people who register their wells because if they don't register their wells it's possible
[0:44:29] Trustee Rogers (probable): they could learn their lose their first and try first and right section and so there's this is
[0:44:35] Trustee Rogers (probable): is an ongoing attempt by the province to try and get a handle on the licensing and registration
[0:44:41] Trustee Rogers (probable): of wells so that they can keep track of them all. And that's the reason for all of that. So thank
[0:44:47] Trustee Rogers (probable): you for the, and there's quite a bit, if you actually talk to William Shulbaugh, he did a
[0:44:52] Trustee Rogers (probable): fair amount of, he can send you, he did a fair amount of analysis of that. And it's not just
[0:44:59] Trustee Rogers (probable): on Galliano, it's on, it's all across the province.

[0:45:04] Voice 4: that registering your well doesn't offer you any protection if you have not in fact used your well
[0:45:10] Voice 4: so in the case of properties that you know where the the plan is to perhaps build a home on that
[0:45:17] Voice 4: property if they have actually registered their well but never used that well they will not be
[0:45:22] Voice 4: protected and and the the ministry staff are very clear that even for people who've registered their
[0:45:29] Voice 4: well the enforcement is very problematic okay

[1:00:46] Voice 13: schedule a public hearing in march uh the um directed staff to sorry they didn't direct
[1:00:54] Voice 13: staff to host a public hearing, they directed staff to waive a public hearing in March due to
[1:01:01] Voice 13: the introduction of COVID and so there were two outstanding issues with the application
[1:01:10] Voice 13: before staff were directed to move forward with completing the notifications for that
[1:01:17] Voice 13: waiving of the public hearing. One was demonstrating proof of water so the original
[1:01:22] Voice 13: application as you recall was uh uh with uh seeking a an easement with the adjacent neighbor's
[1:01:31] Voice 13: well for access to uh potable water and that agreement subsequently fell apart and so miss
[1:01:38] Voice 13: gavro then has done a bunch of work to redrill the well on her property and do a bunch of upgrades
[1:01:45] Voice 13: and well testing to demonstrate proof of water and the other key piece that was outstanding with
[1:01:51] Voice 13: respect to the application was driveway access and so ensuring that the minimum width of her driveway
[1:02:01] Voice 13: would meet building permit and other standards with respect to highway access permits with the
[1:02:08] Voice 13: Ministry of Transportation. So those two outstanding issues Lisa has been working diligently to address
[1:02:15] Voice 13: and the staff report describes what has been done
[1:02:20] Voice 13: to address those issues.
[1:02:23] Voice 13: And we are now at a point where with COVID wrapping up
[1:02:27] Voice 13: and seeking some direction on how to move forward,
[1:02:32] Voice 13: staff in the report are recommending
[1:02:34] Voice 13: that you rescind that previous resolution
[1:02:36] Voice 13: and undertake a public hearing
[1:02:41] Voice 13: as a good public policy to do so, but there are some extenuating circumstances in this case
[1:02:49] Voice 13: where consideration of continuing to waive the public hearing could be done, but it wouldn't
[1:02:55] Voice 13: save that much time with respect to getting it across the line to final approval. So I think

[1:04:24] Voice 13: an active page ad as per your standing resolution with respect to public hearings
[1:04:29] Voice 13: staff could pull all that together potentially for september 5th but it would be a lot of
[1:04:34] Voice 13: work to do so especially with kind of limited timelines and holidays and such coming up
[1:04:41] Voice 13: uh on and the other option with respect to uh if you continue to waive the public hearing which is
[1:04:49] Voice 13: allowed in the local government act in these cases where the ocp is consistent with the
[1:04:55] Voice 13: rezoning proposal. So the OCP, the Galliano Island OCP, in this case, that particular property is
[1:05:02] Voice 13: designated as commercial and it's zoned as residential. So moving it into a commercial
[1:05:08] Voice 13: zoning would be consistent with your OCP. And so that's where that statute allows.
[1:05:15] Voice 13: You do need to give third reading in a public meeting as opposed to RWM. So you couldn't fast
[1:05:22] Voice 13: track it through rwm if you um so what if you waive the public hearing staff uh would uh prepare
[1:05:30] Voice 13: the statutory notifications for september 5th and you would uh need to consider then
[1:05:38] Voice 13: third reading at that meeting with the statutory notifications for waiving a public hearing
[1:05:43] Voice 13: complete which uh the statutory notifications essentially require that notice be given between
[1:05:49] Voice 13: three and ten days before LTC considers third reading so staff would uh stagger the the notice
[1:05:57] Voice 13: to late August and so there's really only uh um some time and work savings and I guess it gives
[1:06:06] Voice 13: if you're waiving the public hearing it signals I guess some uh increased certainty to the applicant
[1:06:12] Voice 13: which I know they are seeking at this time uh given you know the financial and other pressures
[1:06:17] Voice 13: that are upon them with COVID, so waiving the public hearing given the OCP is consistent
[1:06:25] Voice 13: and given at least we haven't heard any dissenting views and no issues, it seems unlikely that
[1:06:33] Voice 13: any new major issues or opposition would be raised at a public hearing anyways, so I think
[1:06:39] Voice 13: staff could be supportive of LTC considering that choice to at least provide the applicant
[1:06:46] Voice 13: into a little bit more certainty and
[1:06:49] Voice 7: and as i understand that this is no longer a restaurant
[1:06:52] Voice 7: but a takeout is that correct

[1:17:46] Voice 16: So other than the septic system, there's no other development proposed with this application.
[1:17:51] Voice 16: And so the location, the size, and the configuration of the property are such that
[1:17:56] Voice 16: any new development would be within DPA2 and require a DP or an exemption. And when the land
[1:18:05] Voice 16: use bylaw property line and natural boundary setback regulations are applied any development
[1:18:12] Voice 16: would also require variants so and that's indicated on figure 2 which is on page 43
[1:18:21] Voice 16: of the of the agenda which indicates setback lines and the location of the DPA
[1:18:28] Voice 16: so the the sighting of the new field and tanks is in the same area or the same site as the existing
[1:18:35] Voice 16: or the old system and the purpose of for the replacement is to improve the situation and
[1:18:41] Voice 16: avoid potential environmental impacts of a failing system so this type of system is
[1:18:47] Voice 16: called a type 2 system so the existing system would be a conventional or type 1 which is
[1:18:53] Voice 16: basically just straightforward tank and then dispersal into a septic field this has secondary
[1:19:00] Voice 16: secondary treatment, the highest would be type three which is practically full treatment
[1:19:06] Voice 16: which is dispersed into where the effluent is essentially drinkable.
[1:19:12] Voice 16: So just referencing separately, the development permit is for measures for the protection
[1:19:18] Voice 16: of the sensitive marine ecosystem and construction management for the proposal.
[1:19:23] Voice 16: As shown in Figure 2, almost the entire property is within DPA 2.
[1:19:29] Voice 16: The owners retain a coronis environmental to undertake an environmental assessment as required,
[1:19:35] Voice 16: and make recommendations for mitigation in accordance with the DPA guidelines.
[1:19:41] Voice 16: That report inventories the physical conditions on the property,
[1:19:45] Voice 16: and assesses potential impacts from the proposal and makes recommendations for mitigation and
[1:19:52] Voice 16: monitoring and it confirms that the entire property as is in a previously disturbed state
[1:19:58] Voice 16: the impact assessment focuses on concerns with the subsurface excavation required
[1:20:05] Voice 16: that could potentially cause damage to large anchoring roots of adjacent trees as well as
[1:20:13] Voice 16: of potential for accelerated erosion of the adjacent bank which is already having some
[1:20:19] Voice 16: erosion due to wave action below. So the report makes the recommendations of the report have all
[1:20:28] Voice 16: been included as conditions in the draft GP as have other conditions which are consistent with
[1:20:35] Voice 16: the guidelines. So and the report makes a conclusion that by following their mitigation
[1:20:42] Voice 16: and mitigation measures, potential impacts can be avoided, and then it goes on to speak to restoration and removal of invasive species, and that the sensitive any impacts to the ecosystem could be avoided.
[1:20:59] Voice 16: In addition, an engineer's report was submitted for the design and construction of the system by BWD Engineering, which is attachment 4, starting on page 80.
[1:21:14] Voice 16: And that is basically under a professional reliance scheme, this is a submission to Island Health for the new system.
[1:21:22] Voice 16: Just quickly addressing the development variance permit, that is to consider siting variances for the septic system and for two existing sheds that are non-conforming on the property, and the variances would bring the property into conformity.
[1:21:37] Voice 16: The constraints on the property mean that no other locations on the property would meet soil and setback conditions under health regulations to replace the system.
[1:21:50] Voice 16: and the legal survey that was submitted as part of the application indicated that the two sheds
[1:21:55] Voice 16: don't meet the current siting regulations from numerous setbacks and in order to bring everything
[1:22:02] Voice 16: to compliance they were included just for as a note the dwelling and the deck were constructed
[1:22:07] Voice 16: with a building permit in 1971 and therefore they have what's termed as legal non-conforming status
[1:22:14] Voice 16: status and I will speak to a concern that was raised in just a few minutes after I finished
[1:22:20] Voice 16: the rest of this on that note. Rationale is for the necessary replacement of the system on the
[1:22:27] Voice 16: property and the lack of an ability to put the system anywhere else. That's for this obviously
[1:22:34] Voice 16: for the septic system and for the two sheds is to bring it into compliance. In terms of assessing
[1:22:40] Voice 16: The location of the new system should not be impactful given that it's subsurface and it's replacing a pre-existing situation and similarly the two sheds, as they are existing, they should have minimal impact on neighboring properties of the public realm.
[1:23:02] Voice 16: uh in terms of consultation dvp notices were circulated to surrounding properties and residents
[1:23:08] Voice 16: there were no responses received to that notification however we did receive a piece
[1:23:14] Voice 16: of correspondence over the weekend which was processed today and sent to the local trust
[1:23:19] Voice 16: committee and the applicant that letter cited essentially three different concerns the first
[1:23:29] Voice 16: would be the decommissioning or there's an indication there's indication on the submission
[1:23:34] Voice 16: for the engineering report that the well would be decommissioned this is not an absolute in so
[1:23:44] Voice 16: much as it's a bit of a chicken and the egg scenario where there's a requirement for the
[1:23:51] Voice 16: new septic system to be put in place before they can actually test to ensure that the existing
[1:23:57] Voice 16: well isn't going to be further impacted, doing the testing right now would be, it would only be
[1:24:05] Voice 16: indicative of what's happening with the existing system. So the improvement, with the improvement
[1:24:11] Voice 16: done, the plan is to have a geohydrologist do an assessment on the system with the new functioning
[1:24:19] Voice 16: septic system. And if necessary, it would be decommissioned. And the proposal from the property
[1:24:24] Voice 16: owner or the owner is to actually if that's required to install a rainwater catchment and
[1:24:31] Voice 16: cistern system. Secondly there was a question of infill below on the lower floor of or I guess
[1:24:41] Voice 16: you'd say the basement area of the house. As I noted the house has legal non-conforming status
[1:24:47] Voice 16: and that's for the envelope of the house. We did when we received the application we had
[1:24:52] Voice 16: numerous communications with the applicant trying to determine what had been built and when um but
[1:24:59] Voice 16: notwithstanding it it what it appears to have happened has been built in there was that area
[1:25:05] Voice 16: was infilled in the past and what had happened more recently before this property owner bought
[1:25:11] Voice 16: it was that it was actually renovated to bring it up to better standard and um but it does not
[1:25:19] Voice 16: appear that there's been any increase in the building envelope therefore it would not require
[1:25:23] Voice 16: any variance and further because it's a work on a pre in a previously disturbed area it wouldn't
[1:25:32] Voice 16: trigger a DP as well so my understanding as well sorry I in speaking to the applicant this morning
[1:25:40] Voice 16: he was going to try and contact the engineer to seek clarification also on the number of bedrooms
[1:25:45] Voice 16: which was a third issue um uh in the house relative to the the filing and um that may

[1:49:32] Voice 16: which is commonly known as the Woodstone Manor property,
[1:49:36] Voice 16: this is a development permit,
[1:49:38] Voice 16: which is for measures to retroactively authorize
[1:49:41] Voice 16: land alteration tree removal and the construction of a building which is a shed and a pond within
[1:49:48] Voice 16: development permit area one which is riparian areas development permit area three which is
[1:49:53] Voice 16: tree cutting and removal and development permit area five which is sensitive ecosystem
[1:49:57] Voice 16: the permit also the application also authorizes remediation for the unpermitted activities with
[1:50:07] Voice 16: restoration works within the same DPAs. So referring to figure two which is on page 115
[1:50:13] Voice 16: of the report, the activities that were that were undertaken without a permit were the clearing of
[1:50:22] Voice 16: a landing area approximately 750 meters squared where all vegetation was removed.
[1:50:29] Voice 16: Subsequently grasses and herbaceous plants were re-established or re-established naturally.
[1:50:35] Voice 16: However, this spring the owner removed the berm and spread the soils over the landing area, which was actually a recommendation of the QEP report, which I'll talk about below.
[1:50:45] Voice 16: A berm was constructed. Again, that was as part of the recommendations of the QEP and which has subsequently been done recently by the owners, that has been now removed.
[1:50:59] Voice 16: Roadway was constructed approximately 110 meters long within Development Permit Area 1.
[1:51:05] Voice 16: A small ditch was constructed to convey water from the landing area southeast towards the wetland.
[1:51:11] Voice 16: And a pond with rip-rack bank approximately 25 meters squared that is storm water fed and naturally stagnant was built.
[1:51:19] Voice 16: And then a small wooden shed 2.3 meters by 1.2 meters was built adjacent to the pond.
[1:51:25] Voice 16: within the entire property under DPA 3 the property owner felled trees and cleared windfall
[1:51:32] Voice 16: and that was approximately 150 trees and the large majority of those were windfall
[1:51:37] Voice 16: the restoration works that are prescribed include the planting of replacement trees
[1:51:42] Voice 16: shrubs and grasses and land alteration to remove some of the features
[1:51:47] Voice 16: an environmental impact assessment and restoration plan was submitted
[1:51:52] Voice 16: as well as a subsequent addendum that established what's called the Streamside Protection and Enhancement Area, or SPIA, which is for the riparian areas.
[1:52:01] Voice 16: And the combined report starts on page 1 and 26 of the agenda.
[1:52:06] Voice 16: So the report is organized into a site inventory and impact assessment for each of the three DPAs.
[1:52:13] Voice 16: Just to go quickly through them for DPA 1, the riparian area, as I indicated, there was a subsequent submission.
[1:52:21] Voice 16: because it's retroactive under the riparian areas protection act that can't be approved
[1:52:27] Voice 16: therefore there was no submission to the province of an assessment report and also there was no
[1:52:35] Voice 16: spia which would have been part of that in the initial report by the biologists so in order to
[1:52:41] Voice 16: meet the guidelines staff requested that that be undertaken by the QEP and they worked with
[1:52:47] Voice 16: the province that spia is it's called the acronym was set at 15 meters from the boundary of the
[1:52:54] Voice 16: wetland and that's shown in figure three of the report so the impacts to the riparian area were
[1:53:00] Voice 16: assessed to be possible sedimentation entering the area and the ditch may have altered localized
[1:53:06] Voice 16: draining neither of those two impacts were substantiated for a dpa5 which is sensitive
[1:53:12] Voice 16: ecosystem. The impacts are stated to be potential loss of foraging migratory corridor and breeding
[1:53:21] Voice 16: opportunities for several at-risk species within the DPA. Impacts were also assessed to be reduced
[1:53:33] Voice 16: because of the degraded nature of the wetland where to the east of the property and it concluded
[1:53:40] Voice 16: that the works were unlikely to have any direct negative impacts on rare or at-risk species.
[1:53:47] Voice 16: It did talk about or sorry note the potential loss of habitat from felled trees
[1:53:52] Voice 16: as well as lost migration options on the landing for amphibians and it noted that hydrological
[1:54:01] Voice 16: impacts were minimal. Tree cutting removal in as I said there was 150 trees removed,
[1:54:07] Voice 16: removed 90% of those were windfall and the volume that was removed was assessed between
[1:54:15] Voice 16: 11 and 25 meters squared noted that most of them were young trees Douglas fir and Hawthorne
[1:54:21] Voice 16: and that they also stated that no Gary Oaks were removed in the clearing so as I said
[1:54:29] Voice 16: restoration was part of the of the report and that's all these are shown in figure three and
[1:54:39] Voice 16: include the planting of a minimum of 100 trees and shrubs overall it recommends the culverting
[1:54:45] Voice 16: of the room sorry the road to promote natural drainage the removal of the berm which I've
[1:54:50] Voice 16: spoken about and the filling in of the ditch and seeding and planting of those areas as well as
[1:54:56] Voice 16: the landing area restoration in the areas outside of the landing include planting of trees and
[1:55:02] Voice 16: shrubs and placing woody debris it does recommend that the road pond and small shed should remain
[1:55:10] Voice 16: as they'd have minimal impacts or have minimal impacts on sensitive ecosystems again there's
[1:55:17] Voice 16: made recommendations for monitoring in the report the dpa checklist was attached
[1:55:24] Voice 16: And all of the conditions, sorry, all the recommendations from the report were included as conditions in the Draft DP.
[1:55:33] Voice 16: In addition, Section 3 of the Draft DP has conditions for security of 125% of the estimated restoration work which was provided by the QEP.
[1:55:46] Voice 16: So the recommendation is that the Galliano Local Trust Committee approve issuance of
[1:55:52] Voice 16: DP 2021.1 as the restoration works meet the objectives and guidelines of the DPA

[2:33:42] Voice 13: reports the submission from the province the technical memo from the province with respect
[2:33:49] Voice 13: back to their license as well as their water management plan. William and I have come to
[2:33:56] Voice 13: the conclusion that their pump testing of their source well, there's two samples that have been
[2:34:04] Voice 13: done by them and many other tests done in the past 10-15 years that all pretty much come to
[2:34:10] Voice 13: the same conclusions around two to four gallons per minute. So our conclusion is that no more
[2:34:14] Voice 13: pump testing of the source well is required we did talk they have now installed reinstalled the data
[2:34:21] Voice 13: logger and i talked to the applicant about the need to collect that data at least until
[2:34:26] Voice 13: you start to see that consistent spike in recharge and the understanding that once that is done
[2:34:35] Voice 13: they will provide a professional report or a letter from their hydrogeologist and staff will
[2:34:43] Voice 13: review that and provide additional advice or recommendations to ltc and then ltc will be in
[2:34:49] Voice 13: a position to decide if they want to do more water sampling or or whatever other discussions they may
[2:34:57] Voice 13: want to lead with water so that's on the waterfront on the water management planning front we've
[2:35:04] Voice 13: provided detailed comments from them and so they're taking those comments and adjusting them
[2:35:09] Voice 13: One of the recommendations we made was for an increase in emergency storage from the current 21,000 to 80,000 litres, and they've agreed to look at that and apply that to their plan, just to provide more emergency water in the case of issue with supply, a short term issue with supply.
[2:35:32] Voice 13: fly anyways is really what all that would be doing. And so the other outstanding piece is
[2:35:39] Voice 13: the ecological assessment and the number of recommendations in it that the applicant is
[2:35:44] Voice 13: making some amendments to their drawings and such to consider those changes or those suggested
[2:35:54] Voice 13: changes. With respect to the bylaws, I'm just actually kind of multitasking here working on
[2:36:01] Voice 13: on the draft by-law for this application.
[2:36:04] Voice 13: And once that's done, LTC did give direction
[2:36:08] Voice 13: with respect to the content of the draft by-law
[2:36:10] Voice 13: at the last meeting.
[2:36:12] Voice 13: So once we have a draft by-law in hand,
