[0:00:36] Trustee Fast (probable): is a meeting of the islands trust which is has uh meets across many places i'm not sure where

[0:00:43] Trustee Fast (probable): you're all uh zooming in from today and uh if you feel like um mentioning that i'll give you a chance

[0:00:50] Trustee Fast (probable): to speak in a moment i'm just going to introduce the uh meeting today it's being held electronically

[0:03:50] Trustee Fast (probable): and um uh let's go ahead then 3.1 this is uh the main um topic on our agenda today meeting

[0:03:59] Trustee Fast (probable): procedure bylaw number 155 uh please take it away heather yeah

[0:04:04] Voice 2: so um essentially uh we're

[0:04:08] Voice 2: bringing your meeting procedures bylaw to you to amend it so that it is consistent with new

[0:04:13] Voice 2: provincial regulations that allow for all of your meetings to be electronic for you to attend those

[0:04:19] Voice 2: electronically. We just need to amend the local bylaw to allow for that. So the bylaw before you

[0:04:26] Voice 2: will, the proposal is to amend sections that would allow that. There's also some added sections that

[0:04:34] Voice 2: are regarding decorum, delegation, and public participation. Those have been added as well

[0:04:40] Voice 2: because we're opening up your meeting procedures by-law and those are things staff have recognized

[0:04:46] Voice 2: to be useful in meeting procedures by-laws. You are the last LTC to be discussing this in the

[0:04:55] Voice 2: north and so there has been some discussion about those new sections regarding public participation

[0:05:02] Voice 2: and delegations and some concern that, you know, you be discussing adding those sections

[0:05:10] Voice 2: without public participation or, you know, people being able to speak at the meeting

[0:05:15] Voice 2: regarding those.

[0:05:16] Voice 2: So one of the alternatives is to remove those sections, and those are sections 18 through

[0:05:23] Voice 2: 40, to kind of postpone discussion about that at another time.

[0:05:29] Voice 2: if you remove those sections it doesn't change the ability for you to

[0:05:32] Voice 2: still have electronic meetings all of that stays the same but we are recommending that you keep

[0:05:39] Voice 2: those sections in part because they're useful but also because um you know bylaw amendments

[0:05:44] Voice 2: take time it becomes this another project right that yeah that we have to go through so um so

[0:05:51] Voice 2: that's that the recommendations that we have in the staff report one through four are associated

[0:05:56] Voice 2: with first, second, and third reading of the bylaw

[0:05:59] Voice 2: and moving that on to the executive committee for approval.

[0:06:04] Voice 2: It doesn't require a public hearing

[0:06:06] Voice 2: because it's an administrative bylaw.

[0:06:10] Voice 2: Recommendation number five has also had a lot of discussion

[0:06:12] Voice 2: across the trust now

[0:06:15] Voice 2: with the executive committee yesterday, I think.

[0:06:18] Voice 2: But the recommendation is essentially recognizing

[0:06:23] Voice 2: recognizing that while updating the meeting procedures by law would allow for you to,

[0:06:29] Voice 2: from a legal perspective, to conduct electronic meetings, there's some recognition that we aren't

[0:06:36] Voice 2: necessarily fully staffed to an extent that we can resource fully hybrid meetings.

[0:06:43] Voice 2: And so there is a recommendation there from me that you have Trust Council consider adding staffing resources to next year's budget.

[0:06:58] Voice 2: So the discussion in the northern region has, there's, there have been resolutions from each LTC that is some iteration of this.

[0:07:08] Voice 2: some were not quite ready to ask for a full FTE and so they said you know maybe we can just ask

[0:07:15] Voice 2: for some resources of some sort funds maybe but maybe not an FTE and there was a recognition that

[0:07:23] Voice 2: whatever is considered it has to start with the financial planning committee so so the the latter

[0:07:31] Voice 2: iterations of the resolution said we recommend that the fpc consider adding resources to next

[0:07:41] Voice 2: year's budget for electronic meetings so that's sort of the latest iteration um i didn't watch

[0:07:47] Voice 2: the executive committee meeting yesterday i don't know if you if chair fast or trustee writers want

[0:07:53] Voice 2: to speak to that but um i think there was some discussion about it anyway um that's the summary

[0:07:58] Voice 2: and glad to answer any questions um

[0:08:09] Trustee Fast (probable): um let people know that i went through our um meeting our public participation guidelines that

[0:08:17] Trustee Fast (probable): we did a couple of years ago and uh these um i've marked it up in red anyway if anybody's got

[0:08:22] Trustee Fast (probable): any questions i compared them we did um in terms of public process we did um look at these through

[0:08:30] Trustee Fast (probable): to public meetings. And so I don't I just wanted to put that out there that I've got notes if

[0:08:38] Trustee Fast (probable): anybody's interested. And I can tell you what's different and, and that we did discuss delegations

[0:08:45] Trustee Fast (probable): and town hall public comments and things like that in session. So that's just my input there.

[0:09:18] Trustee Fast (probable): asks to be a delegation um it's got the town hall uh this is an opportunity to uh public comments

[0:09:26] Trustee Fast (probable): that kind of thing delegations correspondents and applicants just so everybody knows what to expect

[0:09:31] Trustee Fast (probable): and they feel invited uh to participate in in the meetings um kate louise your camera has just gone

[0:11:02] Trustee Fast (probable): like i can i can walk through the changes i marked up in red the differences between um

[0:11:09] Trustee Fast (probable): what's in front of us in the bylaw and uh and what we had decided as a local trust committee before

[0:11:17] Trustee Fast (probable): or what i think might be more efficient is we just adopt what's in the um

[0:11:24] Trustee Fast (probable): draft bylaw if people agree and then we can we can deal with these guidelines

[0:11:31] Trustee Fast (probable): guidelines again later in public. Anyway, there's just a couple of suggestions.

[0:11:36] Trustee Fast (probable): Could

[0:11:36] Trustee Rogers (probable): you explain that last option? Because how do we deal with the guidelines if we now have a

[0:11:40] Trustee Rogers (probable): bylaw?

[0:11:43] Trustee Fast (probable): The bylaw doesn't include anything about applicants. We might want to adjust these to fit

[0:11:57] Trustee Fast (probable): fit with what's over there in the bylaw or we might like to adjust the bylaw to fit with what

[0:12:05] Trustee Fast (probable): we decided earlier

[0:12:06] Trustee Rogers (probable): which is which

[0:12:08] Trustee Rogers (probable): is leads us to the same issue that the vire pm said is that we

[0:12:13] Trustee Rogers (probable): then have to amend the bylaw later anyway yeah

[0:12:17] Trustee Fast (probable): so that's why i'm thinking we could adopt it today

[0:12:19] Trustee Fast (probable): and then just these guidelines are simple.

[0:12:27] Trustee Rogers (probable): So Kate Lee, I'm sorry, did you have a question?

[0:12:30] Trustee Rogers (probable): Cause I have some context.

[0:12:31] Trustee Stamford (probable): Please go ahead.

[0:12:33] Trustee Stamford (probable): I'm just thinking that I, sorry,

[0:12:36] Trustee Stamford (probable): I should have looked at the guidelines.

[0:12:37] Trustee Stamford (probable): I forgot that we had asked those.

[0:12:39] Trustee Stamford (probable): Is there anything that is completely in contravention

[0:12:44] Trustee Stamford (probable): between the two?

[0:12:46] Trustee Fast (probable): I'll run through the sheet here.

[0:12:49] Trustee Fast (probable): The differences is that delegations have up to five minutes to speak in the draft bylaw, whereas our guidelines, we said 10 minutes per each delegation to speak.

[0:13:04] Trustee Fast (probable): The bylaw has a 15-minute delegation period, whereas we didn't have a specific period in these guidelines, but then that's what staff would do when they put the agenda together.

[0:13:17] Trustee Fast (probable): other um that's the big one the other one is uh the um bylaw specifies three minutes per person

[0:13:31] Trustee Fast (probable): in the public comments town hall um and we didn't have a uh anything about timing for

[0:13:42] Trustee Fast (probable): we just had a 10 minute period oh okay um

[0:13:49] Trustee Stamford (probable): but in all these cases as a committee we can adjust

[0:13:53] Trustee Stamford (probable): adjust those times and for a specific situation yes

[0:13:58] Trustee Fast (probable): I believe in the bylaw it says um if everybody

[0:14:01] Trustee Fast (probable): agrees if it's unanimous that's all we

[0:14:04] Trustee Rogers (probable): can do so we can only adjust them once we're in the meeting

[0:14:08] Trustee Rogers (probable): though yeah yeah is the is the challenge I have let me um this is the if you don't mind the context

[0:14:20] Trustee Rogers (probable): context of this is a little complicated and it's become challenging and it actually ended

[0:14:30] Trustee Rogers (probable): up in the executive committee not agreeing on them.

[0:14:36] Trustee Rogers (probable): We think that a number of the

[0:14:41] Trustee Rogers (probable): local trust committees were a little surprised to see

[0:14:47] Trustee Rogers (probable): all of these procedures, bylaws starting in Section 18 and running through Section 40,

[0:14:53] Trustee Rogers (probable): included in this because the intent, the understanding was, including my understanding at that time,

[0:15:00] Trustee Rogers (probable): was that these special meetings were to deal with the electronic nature of the meetings.

[0:15:04] Trustee Rogers (probable): And I don't want to indicate who, where it came from, but as an efficiency staff perspective,

[0:15:13] Trustee Rogers (probable): the idea became well let's include a bunch of stuff that was developed on and for salt spring

[0:15:19] Trustee Rogers (probable): in a public process let's include all those in the bylaw so they were because that was the most

[0:15:26] Trustee Rogers (probable): recent meeting procedure bylaw that was was done so they were those four sections of the bylaw were

[0:15:33] Trustee Rogers (probable): extracted and dropped into all of these bylaws all of the southern gulf islands have removed

[0:15:40] Trustee Rogers (probable): those sections and said we're not prepared we're happy to do a meeting procedures bylaw

[0:15:51] Trustee Rogers (probable): however and of course to adopt the electronic meetings

[0:15:54] Trustee Rogers (probable): portions which are the ones before section 18 and after 40

[0:15:59] Trustee Rogers (probable): but we want to have an ability to have public commentary upon what our our codes of conduct

[0:16:10] Trustee Rogers (probable): would look like just like we did on gambier we we discussed it openly in public meetings and

[0:16:16] Trustee Rogers (probable): had some commentary and some redrafting and back and forth etc etc um and so they removed them

[0:16:22] Trustee Rogers (probable): so to gabriola and then all of the other local trust committees in the north

[0:16:29] Trustee Rogers (probable): um put them in as per with a couple of minor amendments i think on denman so we've got this

[0:16:35] Trustee Rogers (probable): sort of split process that's going on right now where some local trust committees are are adopting

[0:16:43] Trustee Rogers (probable): all of these and it seems to depend on who the vice chair is to some extent and i'm not being

[0:16:48] Trustee Rogers (probable): facetious because i i was sort of one that thought this should not be done in this in this way

[0:16:56] Trustee Rogers (probable): and sue allen thought and peter chair luckham thought it was fine the way it was and laura

[0:17:01] Trustee Rogers (probable): Anyway, so I'm sort of still of the view, even though I think it's a minimal impact in Gambier local trust area, as it would have been on Bolinas when Chelsea where we don't have a lot of public input that like a public people at our regular meetings.

[0:17:26] Trustee Rogers (probable): We get a lot when there's a big issue on the table, but we don't get a lot normally, is that we shouldn't do this in this fashion.

[0:17:36] Trustee Rogers (probable): It's sort of a matter of principle, in my view, is that we should not be putting into a bylaw how the meeting is conducted.

[0:17:48] Trustee Rogers (probable): Plus there's some section there that I just don't think should apply in our way.

[0:17:51] Trustee Rogers (probable): like section 40 just doesn't doesn't make any sense to most local trust communities except

[0:17:58] Trustee Rogers (probable): salt spring um so i have have taken the position up until now that they should be removed and then

[0:18:05] Trustee Rogers (probable): put on ask to be brought back when we can discuss them line by line give us a chance to redraft them

[0:18:11] Trustee Rogers (probable): and we do have our procedures policy in place that we can fall back on until we decide to

[0:18:19] Trustee Rogers (probable): include them into the bylaw and i recall in fact rpm cower that that was always intended to be the

[0:18:26] Trustee Rogers (probable): next step of the once we decided the policy was to then amend the bylaw to include them in in the um

[0:18:34] Trustee Rogers (probable): in the bylaw or a form of them in the bylaw but once they're in they're sort of then it'll be

[0:18:42] Trustee Rogers (probable): more i think it'll be more difficult to get them out so i'm sort of of the view that we just we

[0:18:47] Trustee Rogers (probable): don't put them in given that we have the procedure that's even though i don't think it makes a big

[0:18:53] Trustee Rogers (probable): practical difference in this local trust area and i know that chair fast and i don't agree on this

[0:19:00] Trustee Rogers (probable): and um because we we've had a chance to go around it um yes uh we talked about not about this issue

[0:19:10] Trustee Rogers (probable): but about how the other issue that the RPM brought up

[0:19:16] Trustee Rogers (probable): about number five and the motion number five

[0:19:20] Trustee Rogers (probable): at executive committee.

[0:19:22] Trustee Rogers (probable): And I can explain what that conversation was about

[0:19:25] Trustee Rogers (probable): because interestingly, the director and the CAO

[0:19:29] Trustee Rogers (probable): have recommended that we not do what that motion number five.

[0:19:33] Trustee Rogers (probable): So they've actually wrote a report saying

[0:19:36] Trustee Rogers (probable): they don't recommend we add a position

[0:19:38] Trustee Rogers (probable): at this point in time.

[0:19:41] Trustee Rogers (probable): So we've got this, it's this odd scenario where we have a number of different points of view. And we talked about it a lot at the executive committee yesterday about what to do about staffing and effectively we came down to the point where we're going to make it through the next six weeks using current staff and we'll figure it out after that.

[0:20:04] Trustee Rogers (probable): and i'm paraphrasing a little bit but that's sort of where i think very nice chair fast or chair

[0:20:09] Trustee Rogers (probable): fast you degree that's sort of where we ended up at the end of the day the cao said we'll make it

[0:20:14] Trustee Rogers (probable): work for the next 21 meetings which was six weeks and we'll we'll electronically and then we'll

[0:20:22] Trustee Rogers (probable): figure out what to do going forward and i think the hope is we'll be back into the vice chair

[0:20:26] Trustee Rogers (probable): model again that we'll be back in the in person but then but we'll see anyway it's complicated

[0:20:31] Trustee Rogers (probable): and it's it and that's all of the context from my perspective i'm not particularly in favor of

[0:20:38] Trustee Rogers (probable): putting provisions like this in a special meeting called to deal with the electronic thing and so

[0:20:45] Trustee Rogers (probable): it's more a matter of principle than it is a matter of the the actual although i went through

[0:20:50] Trustee Rogers (probable): it last night and found probably seven or eight of them that i i would like to amend um i don't

[0:20:57] Trustee Rogers (probable): like the 15-minute timeline, I think the chair should have a discretion, not whoever the deputy

[0:21:03] Trustee Rogers (probable): secretary is. I guess that's Becky at this moment. Is that her title? I think the chair should have

[0:21:08] Trustee Rogers (probable): the discretion to decide whether people should be heard or not. I think that putting in strict

[0:21:16] Trustee Rogers (probable): timelines is always problematic in my view. I think we should be a little bit more flexible

[0:21:21] Trustee Rogers (probable): and that the chair should have some discretion to do that before the meeting actually starts,

[0:21:27] Trustee Rogers (probable): rather than wait for the three of us to get together and make that decision.

[0:21:32] Trustee Rogers (probable): So there's some things I'd like to tweak in it and take out and change.

[0:21:37] Trustee Rogers (probable): So that's my view. But we can spend the time doing that right now.

[0:21:41] Trustee Rogers (probable): But I think that should be a public process, frankly.

[0:21:47] Trustee Fast (probable): you, Dan. And now that we're back to the Gambier Local Trust Committee and the COVID situation that has put us into this electronic meeting situation where we have to cope, I'm wondering, Kate Louise, do you have any thoughts?

[0:22:07] Trustee Fast (probable): thoughts? Are you willing to pass, for example, big chunks of this to allow us to have electronic

[0:22:14] Trustee Fast (probable): meetings? Or would you be interested in just going ahead with it? Or what's your take, Kate Louise?

[0:22:23] Trustee Fast (probable): I've sent around the, by the way, the guidelines are in your email. Okay.

[0:22:30] Trustee Stamford (probable): a special, like I'm six and one half of this and the other, as always, because it's a special

[0:22:35] Trustee Stamford (probable): meeting it's not the same process as we would and i thought the whole point of special meeting

[0:22:40] Trustee Stamford (probable): was more administrative straightforward type of items um as much as possible um

[0:22:48] Trustee Stamford (probable): i think it's kind of weird that you compared us uh trustee rogers to bolinas from chelsea when

[0:38:55] Voice 2: that. And there's a comment period that ends on February
