[0:01:33] Voice 5: local trust committee we also have later today a community information meeting starting at one
[0:01:41] Voice 5: o'clock and with a broadcast at two o'clock if anybody wants to wish with a presentation on the
[0:01:47] Voice 5: various items on the water project but before we start uh i'd like to take a moment to acknowledge
[0:01:55] Voice 5: uh that we're meeting in the traditional territories of the post-salish peoples and
[0:01:59] Voice 5: it's particularly it's always a good reminder when given what's going on in canada right now
[0:02:05] Voice 5: the uh the papal apology and how that's playing out across the country uh related to the
[0:02:11] Voice 5: residential schools and we're reminded of course that this area was uh in no no way immune from
[0:02:18] Voice 5: those those horrendous tragedies there was it was very activism schools in this area and we have
[0:02:25] Voice 5: uh that's always been reminded for us to remember the history uh in relation to this and also i'm
[0:02:31] Voice 5: reminded of the work being done in galliano with the um uh the waters we waters they get the right
[0:02:38] Voice 5: waters we call home uh project on this island uh it's delving into it so uh that was acknowledgement
[0:02:45] Voice 5: and we're grateful to be able to live and work here um this meeting is being broadcast uh live

[0:04:11] Voice 5: the galley for the living initiative society project um and so we're just here to receive
[0:04:20] Voice 5: receive a staff report and we have an agenda that was put before us um uh which is only
[0:04:25] Voice 5: having one business item uh trustee wolverton is there anything you wish to add

[0:05:09] Voice 7: that has been planning for your September 6th community information meeting and your September 27th public hearing.
[0:05:19] Voice 7: Prior to that, staff recommended that the local trust community receive some of the outstanding documents
[0:05:26] Voice 7: that were still being worked on, and so that's something we're going to be doing today.
[0:05:31] Voice 7: So in the staff report and attachments, we were looking forward to the housing agreements,
[0:05:37] Voice 7: The housing agreement has undergone legal review, both by Babs Trust Legal Council and
[0:05:42] Voice 7: the Advocates Legal Council, and it is now agreed on, so unless the Local Trust Committee
[0:05:50] Voice 7: has any further changes.
[0:05:54] Voice 5: Yeah, I'm actually going to stop you, and I'm actually going to ask Stapp to stop, because
[0:05:59] Voice 5: Pat's trying to take minutes, and if there's a rustling of the paper in the background,

[0:06:22] Voice 7: ahead sir so the housing agreement being presented in the staff report is uh in the staff's
[0:06:28] Voice 7: view uh more or less the final draft because that's the right structure that's agreed upon
[0:06:32] Voice 7: by the local trust committee and unless the local trust committee has any significant concerns or
[0:06:40] Voice 7: any other further changes staff will be bringing that forward to the community commission and
[0:06:47] Voice 7: barring any unforeseen changes from that the public hearing and presenting it after the public
[0:06:54] Voice 7: hearing for potential consideration of the first second degree because it is in the history of the
[0:06:59] Voice 7: final requires accepting the housing agreement covenants or the application has broken up the
[0:07:09] Voice 7: covenant language into two separate covenants one are permanent terms a covenant that would
[0:07:17] Voice 7: carry with the the in perpetuity with the life of the project the second is what they mean
[0:07:23] Voice 7: as temporary returns and those are returns that are more related to construction pre and post
[0:07:30] related construction requires and the applicant can seek to discharge that covenant from the title
[0:07:37] once construction
[0:07:38] Voice 7: is completed with that there's
[0:07:42] Voice 1: still some work going
[0:07:43] Voice 7: back and forth with the
[0:07:44] Voice 7: applicants it's here there's still some back and forth with the applicant to fine-tune the
[0:07:49] Voice 7: covenant but from staff's perspective all the major items that have been discussed and considered
[0:07:56] Voice 7: by the local trust today are included in that covenant and i think there just needs some
[0:08:02] additional work with the applicant to
[0:08:08] Voice 7: finalize some of the more technical aspects of those
[0:08:13] Voice 7: covenants and that work is ongoing and the plan will be to bring that back to the public hearing
[0:08:25] Voice 7: right with the cia august here with all of this coming up but uh
[0:08:34] Voice 7: accept those documents and that was technically worked out and presented to you the third piece
[0:08:47] Voice 7: of work has been the outstanding septic report so the original septic report recommended one spot
[0:08:52] Voice 7: for one of the dispersal fields and ecological assessment by Mr. Erickson and that dispersal field
[0:09:01] Voice 7: will not be considered due to some ecological concerns. So the executive professional has done further work
[0:09:08] Voice 7: and has identified a different area for the dispersal field that is acceptable to the professional
[0:09:14] Voice 7: and so that is presented to you as well. One thing that isn't included in here that it
[0:09:21] Voice 7: should be is that the applicants has also received their water lessons approval so i just forwarded
[0:09:28] that to both of you and so obviously that's a big
[0:09:33] Voice 7: that's really all i have to present

[0:09:46] Voice 5: um just to be clear for anybody watching and uh here the plan is to have a
[0:09:55] Voice 5: a cim on on september the 6th is that right is that today that's tuesday that's

[0:10:07] Voice 5: then to have the plan would then be to have a
[0:10:10] Voice 5: public hearing on september the 27th it's a special tuesday meeting it's also fine

[0:10:27] Voice 3: moved from October to Oh, I

[0:10:37] Voice 7: on those days to time period of the regular meeting agenda or you could see I have a public

[0:11:01] Voice 7: to consider a meeting meeting as there does seem to be quite a bit piling up on the september 6th
[0:11:08] Voice 7: agenda with the potential for your community awards you'll also have a public hearing in the
[0:11:14] Voice 7: cam on the district block project you have a number of pieces of correspondence that are on
[0:11:18] Voice 7: another there's also a deferral of the discussion around the advance of dl86 that would be brought
[0:11:28] Voice 7: forward um so potentially a temporary use permit for mr walkers but i'm not sure that's going to
[0:11:40] Voice 7: be okay
[0:11:42] Voice 5: so let's um let's do this in some early fashion because we would like to talk about the
[0:11:48] Voice 5: bit the documents you sent us and we could talk about the schedule of the various items and
[0:11:54] Voice 5: whether any of them wish to go and i think i don't know if there's anything else trustee wolverton
[0:11:58] Voice 5: that you'd like to bring up but perhaps we could start with the actual documents themselves and
[0:12:03] Voice 5: i think you had a couple of questions um

[0:12:12] Voice 3: okay um so planner smith on page eight under permitted housing operator it looks like there's
[0:12:20] Voice 3: been a uh a typo in there okay um then um i noticed on in 2.1 subsection b neither the
[0:12:35] Voice 3: lands nor any building thereon may be subdivided without prior approval of the ltc such approval
[0:12:42] Voice 3: shall not be unreasonably withheld and i i recognize that that's probably a standard for
[0:12:50] Voice 3: some covenants but i also note that in the cim um the original cim with galley that
[0:12:58] Voice 3: they the presenters also said galleon proposes not to subdivide the property so i would prefer
[0:13:05] Voice 3: if that were removed
[0:13:06] Voice 7: i know you're not involved in the givers application so what uh the lawyer
[0:13:13] Voice 7: lawyer. So this is essentially the same template that was the
[0:13:18] Voice 7: proposal. But the lawyer that reviewed the first one is away.
[0:13:25] Voice 7: So a new lawyer reviewed this one. And in fact, that was struck
[0:13:29] Voice 7: from the years. So

[0:13:40] Voice 3: I was also going to bring up the release as well. But I
[0:13:43] Voice 3: I wanted to, under 2.2, minimum construction requirements,

[0:13:53] Voice 3: to the same standard in terms of layout, skill, and materials.

[0:14:01] Voice 3: You know, that seemed to be kind of an odd comment,
[0:14:09] Voice 3: just that, you know, they're obviously not going to be the same layout
[0:14:14] Voice 3: because they're they're different sized units and so on so i i wasn't i thought it just seemed a

[0:17:25] Voice 5: the release section wasn't necessary and i believe it was taken out if you need motions for us to
[0:17:30] Voice 5: to do this or you can just simply ask that you work on removing 3.6 and amending 2.1b okay

[0:21:44] Voice 5: system. And it was done in a way that I think was to provide assurances to neighbors and
[0:21:55] Voice 5: also to the local trust committee that the subject system would not only be installed
[0:22:00] Voice 5: to a certain level, but also be paid at a certain level. And we understand that there
[0:22:05] Voice 5: of course are um uh there are other sewerage uh act requirements that are out there as well
[0:22:13] Voice 5: um but they but they're not part of a public process so i wanted i wanted to propose i
[0:22:19] Voice 5: provided the language to um uh to the planner and to jane to trustee wolverton that uh that
[0:22:26] Voice 5: the planner explored with the applicant inserting that language in the covenant as well i thought
[0:22:32] Voice 5: the rest of the covenant is fine and it's great but i would ask i would want to suggest that they
[0:22:37] Voice 5: explore inserting that language into the the ongoing covenant not the construction
[0:22:42] Voice 5: at least that's the way i would read it anyway but wherever it's appropriate

Open House – 1pm-2pm 2. Presentation – Groundwater Sustainability Implementation Project Chair Rogers called the meeting to order at 1:05 pm. Chair Rogers acknowledged that the meeting was being held in traditional territory of the Coast Salish First Nations. Chair Rogers explained that meeting was being held in person and live streamed via Zoom to increase accessibility. Planner Chadwick commented: this meeting is an opportunity to provide the community with information related to options for the proposed watershed protection development permit boundaries and provide an opportunity for the community to ask questions; Development Permit Areas (DPA) are a tool that can be used to protect the absorption and retention of freshwater by protecting vegetation coverage in critical areas; and 3 options based on lot boundaries have been identified. William Shuba detailed: presentation focus is on groundwater resources; understanding the science has been a long process, working with government agencies, water districts etc. to develop proposed policies; groundwater is a unique amenity that sustains ecosystems, community: need plan for future: comes from rain, snow and fog (meteoric water); and the focus of the presentation is recharge. Groundwater Recharge Mapping groundwater regions are water management units: largely based on water sheds; rains – high elevations – flows down to lower areas: more rain in north end of island; ecosystem role in groundwater recharge potential considered; plants funnel water to ground; Islands Trust website: Freshwater Project section for more information; Low discharge equals high recharge; well managed, productive and healthy forests provide better water collection/retention, healthy soils; Groundwater Solutions Report on IT website; reference to www.groundwatervisible.org – stories and photos; and changing climate and increased societal stresses – need to plan for future. Planner Chadwick spoke to: Development Permit Areas (DPA) designed to protect groundwater and recharge; reviewed groundwater recharge to identify DPA options; number of exemptions proposed e.g., hydrologist report, repair and maintenance, removal of dangerous trees; public comment encouraged today through to September 9; bylaw amendment: map to identify boundaries, bylaw will include exemptions; next step is for the Local Trust Committee (LTC) to decide on groundwater recharge DPA boundaries; 2, 5, 10 and 20 hectare options; methodology used to identify boundaries is on website; cautionary Principle: protect more rather than less – climate is changing – science is going to change; recharge areas defined by topography and geology; proposed DPA bylaw in keeping with IT object/Policy Statement acknowledgement of First Nations knowledge and culture; and all reports and documents are on IT website. Questions: Public member: highly beneficial to identify recharge areas – was climate change a factor in considerations? William Shuba spoke to the education factor of projects/maps; importance of land stewardship; DPA relates to climate change: demand management component; Galiano Local Trust Committee Community Information Meeting July 26, 2022 ADOPTED Page 3 of 4 regions likely to hold as defined by topology and supported by ecosystems; healthy forests increase recharge: demand impact; and DPA first step. Planner Chadwick added science is there – know it will change and need to protect more. Public member: question regarding interconnectivity of island and weather stations. William Shuba identified that the island is all one type of geological unit and groundwater flows along spaces between stratas. There are unique dynamics of geological layers. There are weather stations throughout the province with data looked at year to year and averaged over 20 years. Public member: stated recharge on west side of island/discharge on east while flow is north to south and questioned significance of isolation of recharge and discharge areas. William Shuba spoke to discharge areas and wet areas. Critical recharge areas are typically down axis of island – resting on bedding planes – flows down or springs up according to hydrostatic pressures. Public member: related sensitivity of east side: preferential recharge areas – appreciation of information given. Questioned value of focusing on areas with shortages or saline intrusion first. William Shuba stated populated regions will be reviewed: high density areas have most recharge: number of areas protected as Parks. Planner Chadwick added there are a number of parts o the project and areas with shortages have bee identified and will be looked at further in the future. Public member: spoke to importance of forest management. Comments – great to identify recharge and protect however should be cautious regulating prior to being aware of demand on particular area. Why rules that don’t fit situation? Planner Chadwick referred again to the Cautionary Principle – look forward and plan Public member: Comments – look at all areas: areas may become inhabitable: importance of an objective analysis. Asked for explanation as to how exemptions would be applied. Planner Chadwick explained there would be a full analysis of the area and proposed site. Reports from professionals would be considered.
