[0:06:18] Voice 1: variance permit would be an avenue um for the applicant to take which is um the case for this
[0:06:24] Voice 1: application. And as was mentioned before, CRD issued a stop work order in 2022 for the
[0:06:33] Voice 1: accessory building. It's noted on the site plan as a studio. And that's specifically what we're
[0:06:40] Voice 1: going to be discussing today. There are some other compliance issues on the property, which we'll
[0:06:46] Voice 1: discuss at that point that we've been working with applicant to address. So hopefully that
[0:06:53] Voice 1: answers your question that's

[0:07:00] Voice 6: a little bit concerned because work hasn't stopped

[0:13:41] Voice 1: can get going then. Good afternoon, Chair Elliott, Trustee Maud and Trustee Dodds. Just a quick introduction. My name is Charlie Kaproff and I'm a Planner 1 with Islands Trust. Nice to meet you. I've met some of you before.
[0:13:56] Voice 1: The development variance application being presented to you today is MADVP 2022.2, which is located at 750 Stewart Drive, and it seeks to vary the main island land use bylaw number 146 to permit the under construction accessory building, which is referred to as a studio on the site plan within 0.1 meters of the three meter interior side lot line and to vary the height to permit an additional one meter of building height.
[0:14:21] Voice 1: and so if the applicant's partner wants to speak after or if you trustees have any questions
[0:14:29] Voice 1: yeah feel free to ask then the DVP application is proceeding as we discussed as a result of the
[0:14:36] Voice 1: CRD stop work order for the initial construction of the aforementioned building in 2022
[0:14:42] Voice 1: the owner is then applied for a preliminary plan review with Islands Trust where it was determined
[0:14:46] Voice 1: determined via site inspection and review of application documents that the building was within the interior side lot setback and exceeded the permitted accessory building height.
[0:14:56] Voice 1: And so the applicant is here today seeking variance to utilize the existing concrete pad which was poured by a previous owner for the accessory building.
[0:15:05] Voice 1: And they've selected this location, due to its proximity to the principal dwelling and, you know, having this foundation already been poured.
[0:15:12] Voice 1: And the additional height is required due to kind of the topography and how the steep slope nature of the property.
[0:15:21] Voice 1: The building specific to this application is partially constructed and owners would like to finish construction before the exposed wood is impacted by winter weather.
[0:15:31] Voice 1: So during the notice period, a complaint was which we discussed was received from the public, which was circulated to trustees, saying the applicant has continued work.
[0:15:40] Voice 1: work. So I cannot really speak to what has or has not occurred on the property. But the applicants
[0:15:46] Voice 1: are going through this variance process, which is at the discretion of the LTC to either approve or
[0:15:50] Voice 1: deny to bring the structures into compliance. And the owner intends to submit a future DVP
[0:15:58] Voice 1: application to address additional structures on the property. And it's a proposed workshop. And
[0:16:05] Voice 1: they indicated that they have started taking steps to address some disturbance
[0:16:10] Voice 1: to the bank in the foreshore area.
[0:16:13] Voice 1: So the recommendation to approve the DVP request
[0:16:16] Voice 1: considers the variance being sought as relatively minor.
[0:16:19] Voice 1: The accessory building is being constructed
[0:16:21] Voice 1: on the existing foundation that is minor encroachment
[0:16:25] Voice 1: and there's minimal visual impact with additional height
[0:16:27] Voice 1: and a letter of support was included in the package
[0:16:30] Voice 1: from the adjacent neighbor.
[0:16:33] Voice 1: Yeah, so the staff recommendation
[0:16:37] Voice 1: is to support the variance and that's it.
[0:16:42] Voice 7: i could remove the motion so we can discuss the motion so i'll move that the main local
[0:16:46] Voice 7: trust committee approved issuance of development variance permit application m a dvp 2022.2
[0:16:55] Voice 7: okay any discussion well i want to say i i was on the site so i've seen the site open
[0:17:01] Voice 7: and and and i you know i understand the dilemma first off for the person with the structure if
[0:17:08] Voice 7: they've gone ahead after the stop work but to leave the structure that was there open without
[0:17:13] Voice 7: the roof on and knowing that the variance application was in and the time that it takes
[0:17:19] Voice 7: to get an approval because we have a net since November I can sort of see why the applicant
[0:17:25] Voice 7: would have gone ahead to put the roof on to protect it it is a minor variance it's one meter
[0:17:29] Voice 7: higher than what the regulations say and it's point something in terms of the setback very very
[0:17:36] Voice 7: very minor. It's like 0.1 of a meter. So the dilemma is I don't believe that variances are
[0:17:42] Voice 7: ever meant to be punitive. Variances are there. They're there because when the CRD originally had
[0:17:49] Voice 7: all the responsibility for the islands, they adopted flat bylaws in terms of heights, setbacks,
[0:17:55] Voice 7: all of that. So variances to me have always been about how the impact of this variance is going to
[0:18:01] Voice 7: be on the neighbor or neighbors so if a neighbor and the area it's in first off if the neighbor
[0:18:08] Voice 7: has no problem and knowing the lay of the land there no one can see that this particular structure
[0:18:13] Voice 7: it's different we have turned down and i've been a trustee for a long time 99.9 of all
[0:18:19] Voice 7: variances are approved unless there's an issue with the impact visually or even aesthetically
[0:18:26] Voice 7: or the enjoyment of the neighborhood property.
[0:18:29] Voice 7: For us to deny a permit because somebody started a structure
[0:18:33] Voice 7: without making sure that it was not in the setback
[0:18:37] Voice 7: or the fact that they continued on to put the roof on,
[0:18:41] Voice 7: which, you know, and the applicants here can speak to that.
[0:18:44] Voice 7: But I just want to be clear, because when I started,
[0:18:47] Voice 7: people somehow saw variances as a punitive idea,
[0:18:50] Voice 7: and they simply are not.
[0:18:54] Voice 7: I
[0:18:54] Trustee Maude: don't have much to add to it.
[0:18:55] Trustee Maude: i could concur with what trustee dodd said it's it's it's part of the process um and and certainly
[0:19:03] if the applicant wants to speak to the
[0:19:04] Trustee Maude: construction state of place that that really is between the
[0:19:07] Trustee Maude: applicant and the crd uh we're not with the trust so i'm happy to comment on it i'm

[0:19:16] Voice 6: for 28 years as a builder new to main island um yes the structure was exposed for the last year
[0:19:24] Voice 6: um i think charlie if you can hear me we do have an email that had just said you know we could
[0:19:32] Voice 6: button up the structure to not expose the walls anymore so i i took that as let's
[0:19:40] Trustee Maude: get it to
[0:19:41] Trustee Maude: roofing put a roofing membrane on it and you know leave it until the whole process
[0:19:47] Trustee Maude: comes into play we did let the structure sit for a year and one month um

[0:19:54] Voice 6: then i'd be basically ripping the walls down again because there is there is moisture for the
[0:20:02] Voice 6: launch here um

[0:20:05] Voice 6: i want to comply and play by the rules and i think that that really so yes we
[0:20:16] Voice 6: have put a roof on the structure and yes we have put a membrane on the roof in order to protect it

[0:20:34] Voice 7: the the foreshore where the registered archaeological
[0:20:38] Voice 7: site was located was there actual archaeological um matter that was uncovered and when we talk
[0:20:47] Voice 7: about recovering the foreshore or sort of repairing it right what's the agreement or
[0:20:54] Voice 7: the intent with that work so
[0:20:55] Trustee Maude: we retained a an archaeological firm out of victoria um
[0:21:00] Trustee Maude: so

[0:21:13] Trustee Maude: there was mitten mitten
[0:21:15] Voice 6: that was found yeah um we had a conservation officer come and
[0:21:21] Voice 6: communicate the stuff that communicated um the his big question was it was the responsibility
[0:21:32] Voice 6: of a realtor to be able to communicate to us that it was a registered archaeological
[0:21:37] Voice 6: site. We did a for sale by owner year and a half, two years now. So again, it wasn't
[0:21:48] done maliciously. It was an archaeological site. We've now retained an archaeological
[0:21:54] firm to provide an impact assessment on what was done.
[0:21:59] Voice 6: The foreshore scenario again was
[0:22:02] Voice 6: last november when everything was receding with the torrential downforce we took it upon ourselves
[0:22:08] to to bring in rock and it's hard to explain unless you've seen the site but we backfilled
[0:22:17] where it was receding and now we've talked to the conservation or um to
[0:22:25] Voice 6: under hill
[0:22:33] Voice 6: so we're going to put a whole green plan in place get an impact assessment from the firm
[0:22:42] Voice 6: and then proceed as as planned uh as directed okay
[0:22:50] Voice 7: this was just a chance find as you were
[0:22:55] Voice 7: doing work from the studio um
[0:22:57] Voice 6: no there was a complaint oh
[0:22:59] Voice 7: okay they're totally except i can

[0:23:01] Voice 7: they're totally that the studio is uphill considerably but at the time when we had the
[0:23:07] Voice 7: massive floods in november right of 2021 um and there's a huge drainage gesture there is that
[0:23:14] Voice 7: about the time when everything you went in to try it yep

[0:23:19] Voice 7: after
[0:23:20] Voice 6: that i i you know
[0:23:28] Voice 6: it's all visible there so it's hydro right away beside us and then it's beach access

[0:24:10] Voice 1: But it is of sort of due diligence to identify all the different things on the property and sort of subsequent steps that will be taken kind of thing.

[0:43:06] Voice 2: ocp review is also something the ltc could potentially consider for the term or any other

[0:44:35] Voice 7: done a project called climate change adaption we have done many projects that actually have led
[0:44:42] Voice 7: to climate change improvements housing options flex housing certainly certainly is one of them
[0:44:50] Voice 7: the water even secondary suites we've tied rainwater collection into secondary suites into
[0:44:55] Voice 7: our housing we have tried to densify our populations to reduce travel so i think that
[0:45:02] Voice 7: the housing on one hand is is very important but i also think that we do link it very much to issues
[0:45:09] Voice 7: around climate change so i'd like to see that one stay at the top of the list and be our major
[0:45:16] Voice 7: project with a focus on the idea that the other important thing I think about we started out
[0:45:21] Voice 7: four years ago with what I call the tiny homes initiative and what I was looking at was people
[0:45:27] Voice 7: reducing their environmental footprint flex housing is about shrinking the structures on
[0:45:33] Voice 7: your land and preserving more of your land as undisturbed area so I think that's a really big
[0:45:39] Voice 7: a big start. We aren't in a situation in rural community to have bus systems or everyone
[0:45:45] Voice 7: riding bicycles. The bicycle trail through Village Bay to the ferries has been taken
[0:45:52] Voice 7: 80 trees out in order to put in so I'm not really a huge fan of chopping down trees for
[0:45:58] Voice 7: bypass. But I do think that individually everybody can shrink their footprint in the future now.
[0:46:04] Voice 7: now so so that's housing is good and housing actually and new of course new construction
[0:46:10] Voice 7: will be to a much higher standard

[1:05:19] Voice 7: to get it there and it's just amazing what they've done what they've accomplished and at some point

[1:05:31] Voice 7: a huge bonus of course for main island which didn't have a designated daycare area and we're

[1:05:47] Voice 7: public that was there i would say there was probably more with gray hair than
[1:05:52] Voice 7: but but what that what that means you know the fact is that this is a community a community
[1:05:58] Voice 7: that recognizes the importance of daycare of kids wants their community to be a whole complete
[1:06:05] Voice 7: clean community and that was really exciting just a lot of

[1:06:09] Voice 7: the kids were having a ball it's great um i've had a whole bunch of zoom meetings about deer

[1:06:32] Voice 7: Now, hopefully into a permanent team, a representative from the Main Island Conservancy, which right now is Malcolm Ingalls, and the Main Island Parks, which is Michael Kilpatrick.
[1:06:42] Voice 7: So right now we have a core group of five of us working with Adam Olson, who is very supportive.
[1:06:49] Voice 7: We're having another one in person, first time on Wednesday to talk about strategic asks for Adam to take back to the legislature.

[1:07:05] Voice 7: we didn't bring them here to actually take responsibility funding trying mostly like i
[1:07:11] Voice 7: want my first nations hunters back crd is working on a management plan for us so in-house management
[1:07:19] Voice 7: plan and that was with the help of paul brandt who bent their ear instead of get on with it so
[1:07:24] Voice 7: So all funding for fallow deer will flow through the CRD.
[1:07:28] Voice 7: The trust doesn't have the mechanism to have money,

[1:12:48] Voice 7: which has to go to the ministry for approval they did a three-year interim plan so that's

[1:12:55] Voice 3: yeah and i can share we there was a significant donation of
[1:12:59] Voice 3: on link island which is in the gabriola lta area and uh the swift family i was at the celebration
[1:13:09] Voice 3: a couple of weeks ago and the swift family who's mostly from california but their
[1:13:14] Voice 3: children came up for this celebration and the way that they spoke about

[1:13:21] Voice 7: just in their family's dna to care for a whole ecological system and so they told the
[1:13:30] Voice 3: story of uh i think when their parents were visiting and looking at property and the real
[1:13:36] Voice 3: estate agent you know brought them to lake island and said look at the subdivision potential and
[1:13:41] Voice 3: look at what you could do with it they sat on the cliff and look
[1:13:47] Voice 7: at the nesting owls and everything
[1:13:49] Voice 7: thing and they said no that's not going to happen they bought the whole
[1:13:52] Voice 7: island and then 25 40 years
[1:13:55] Voice 7: later donated it to the conservancy in its entirety so it's a really significant um spot a
[1:14:03] Voice 7: very special um jewel so that's going to be the source of some really good research and
[1:14:10] Voice 7: learning and it's just good to know that that's conserved

[1:15:40] Trustee Maude: first nations title the one that really hit me um in the fall was mossy mountains like one
[1:15:49] uninspired name for for a piece of land subsider preservation and i really hope that the the
[1:15:57] conservancy will go back
[1:15:59] Trustee Maude: and sort of on all their properties um and and maybe like reach out to the
[1:16:06] Trustee Maude: First Nations and give some traditional naming. Because I think that's the ultimate respect you

[1:16:19] Trustee Maude: to me, Lake Highland means nothing to me. And there's a First
[1:16:22] Trustee Maude: Nation story to be told there.

[1:25:38] Voice 2: of their electoral areas but over the years they have chosen not to have building inspection
[1:25:46] Voice 2: service on denman and hornby island um liskiti doesn't have a building inspection service and
[1:25:53] Voice 2: nor has the liskiti ltc adopted a sighting and use permit system either so it's so for the first
[1:26:01] Voice 2: prerequisite is that the regional district doesn't have building inspection service or doesn't issue
[1:26:05] Voice 2: of building permits at a minimum um and if that precondition is in place then local trust
[1:26:14] Voice 2: committees could consider whether or not by bylaw to institute a siting and use permit
[1:26:19] Voice 2: system as a
[1:26:22] Voice 2: partial very much a partial replacement for building inspection
[1:26:27] Trustee Maude: so the question would be is it appropriate to make a motion um that our trust staff
[1:26:34] and
[1:26:35] Trustee Maude: liaise with crd staff to see if there's a road forward but
[1:26:41] Voice 7: the crd has built the authorization to
[1:26:44] Voice 7: do building permits but
[1:26:44] Trustee Maude: that's a possibility that they might want to receive that oh

[1:26:50] Voice 7: also all the all the southern islands have to be in agreement that and their communities that that's
[1:26:56] Voice 7: what they actually want so it's a bigger question it's just it's a small winch and a big door it is

[1:27:05] Voice 2: so so the answer yeah this is that if the crd um for the
[1:27:11] Voice 2: electoral area of the southern gulf islands were to cease to provide building inspection services
[1:27:17] Voice 2: they there's steps that they would have to go through to do that so there would be lots of
[1:27:23] Voice 2: lead time and understanding that this was taking place then we would come forward to all five
[1:27:29] Voice 2: five southern local trust committees and say are you interested in replacing the what we do now for
[1:27:37] Voice 2: the regional districts in terms of sort of preliminary building permit reviews replacing
[1:27:42] Voice 2: that with a formal citing and use permit um mechanism once the CRD has withdrawn its building
[1:27:51] Voice 2: permit service. So really, it's the CRD that would have to, and it would not be a brief process for
[1:28:02] Voice 2: them to withdraw that service.
[1:28:04] Trustee Maude: I guess that's the thing. The suggestion from their side was
[1:28:09] Trustee Maude: it was up to us to sort of open the door. Well, I
[1:28:13] Voice 7: think that we as a trust committee would have to
[1:28:17] Voice 7: to write a request to the CRD to look into
[1:28:21] Voice 7: or to examine the concept of removing building permits.
[1:28:27] Voice 7: And I think before we do that,
[1:28:28] Voice 7: we need to actually get a stronger indication
[1:28:31] Voice 7: in our community.
[1:28:34] Voice 7: So we actually need to go out and find out
[1:28:36] Voice 7: if our builders and our homeowners actually want that.
[1:28:40] Voice 7: And also whether our other local trust committee support.
[1:28:45] Voice 7: So I think we need to pass a motion.

Documents will be readied for signatures of LTC Chair and Mayne Island Housing Society (MIHS). MA-2023-003 It was Moved and Seconded, that the Mayne Island Local Trust Committee Bylaw No. 182 cited as “Mayne Island Housing Agreement Bylaw No. 182, 2022” be adopted. Discussion Next step to bring the community awareness of the status of the project; Do this by posting the information to the Islands Trust web page; and also prepare a mailout to owners within identified project area; Add road names to the map for clarification; Add landmarks to better identify areas. MA-2023-006 It was Moved and Seconded, that the Mayne Island Local Trust Committee request staff to post the Flexible Housing information flyer to the Mayne Island webpage and mail it to property owners in the pilot area and make some extra copies to be laminated for posting and handouts. REPORTS 12.1 Work Program Reports (attached) 12.1.1 Local Trust Committee Work Program Review RPM Kojima spoke to report which gives more detail to projects completed during the past term and projects on-going. Trustees should review the Future Projects List and remove any initiatives it considers out-of-date or any it no longer supports or add any new initiatives they may want to consider. There is a summary of applications from past term. LTC may want to consider a Special Meeting for strategic planning for current term. 12.1.2 Active Projects Report Dated Jan 2023 Discussion Housing Options Project should continue; Climate Change Adaption: The LTC has engaged in projects that address climate change. These include: secondary suites regulation requiring water catchment cisterns, flexible housing considering water availability and requiring cisterns for water catchment. All projects will have a climate mitigation and adaptation lens. Update Land Use Bylaw (LUB); Having only one project criteria is frustrating; Foreshore and Contractors Yards review is important; part of LUB review in addition to Paved Surfaces and Patios; Mayne Island Local Trust Committee Regular Business Meeting January 30, 2023 ADOPTED Page 5 of 8 Share with community what has been done that indirectly addresses Climate Change Adaption; Transition process: Housing project scoping can be done as a minor project and include community engagement, develop plan and development of business casefor Trust Council. The LTC may want to schedule a community education opportunity, in the spring, for 1 hour prior to a regular LTC meeting with the Housing Project as the special focus. Exciting cross-islands strategies are being considered. Pulling together projects to identify how to adapt for other islands. Financial Planning is challenging. It is critical to work together. 12.7 Trustee Report Trustee Dodds spoke to the recent official opening of the Child Care/Family Centre which was attended by the Minister of State for Child Care. The Minister was very impressed with centre and the centre is seen as a great benefit for the island. There is to be a zoom meeting regarding fallow deer to identify strategic “asks” for MLA Adam Olsen to take back to government. This item is now with the CRD for a strategic plan. Meeting with North Pender and Galiano regarding the Flexible Housing Project. Mayne Island Local Trust Committee Regular Business Meeting January 30, 2023 ADOPTED Page 6 of 8 The Community Chat was well attended. CRD Director Brent attended and spoke to transportation referendum and trail and building permits. Trustee Maude recognized the efforts of the Early Childhood Association in acquiring the day care for the island. This is a major achievement and the Minister spoke very highly of it. The Community Chat was successful and the emphasis is on how important it is to communicate and work together within the community to accomplish things. 12.8 Electoral Area Director's Report CRD Director Brent attended the opening of the Child Care Centre. 12.9 Islands Trust Conservancy Report Date Nov 2022 Chair Elliot reported that Linda Adams had been elected as Chair and the Conservancy is working on a three year Strategic Plan. There was a significant donation by the Swift family of Link Island. 13. NEW BUSINESS 13.1 Letter from W ̱ SANEC Leadership Council Staff regarding Draft 2021 Islands Trust Policy Statement Amendments The letter raised a number of important points for inclusion in Policy Statement: 1. IT Conservancy to title areas/properties with traditional names; 2. Develop relationships/respectful to Nation who has entitlement to site(s); 3. Protocol agreements; and 4. Need to address all first Nations. Chair Elliot expressed appreciation to the Council Staff. 13.2 Fallow Deer - Trustee Dodds reported MLA Adam Olsen is trying to bring the issue before the government. We need to work together in order to have a stronger voice. 13.3 Advisory Planning Commission (APC) Appointments RPM Kojima informed the LTC that APC could have one more member to make it easier in getting a quorum for meetings. MA-2023-007 It was Moved and Seconded, that Mayne Island Local Trust Committee request staff to advertise for one additional member for the Advisory Planning Commission for a three-year term. CARRIED Mayne Island Local Trust Committee Regular Business Meeting January 30, 2023 ADOPTED Page 7 of 8 13.4 CRD Siting and Use Discussion: There is a different building process in place for Hornby and Denman that does not require building permits and it is less onerous; IT staff could work with CRD to determine viability of changing process for Mayne island; IT Act unique for siting and use: strictly for area where building permits are not in use; There are a number of areas with building inspection permits; Partial replacement; If CRD ceased to provide building inspection then it would be up to the LTCs regarding replacement with siting and use permits; This is a lengthy process and would have to be initiated by CRD; and Need to learn community interest. MA-2023-008 It was Moved and Seconded, that the Mayne Island Local Trust Committee request Trustee Maude to write to Saturna Island, South Pender Island, North Pender Island and Galiano Island Local Trust Committees to request their thoughts on Mayne Island Local Trust Committee asking Capital Regional District to identify interest in implementing Siting and Use Permits in the event Capital Regional District should discontinue use of Building Permits.
