[0:01:01] Voice 9: I'm elected on Laskete Island,

[0:01:03] Voice 9: and I'm chair of the Hornby Island Local Trust Committee.

[0:01:06] Voice 9: Today, I'm joined by Hornby Island trustees,

[0:01:09] Voice 9: Grant Scott and Alex Allen.

[0:01:11] Voice 9: And together, we make up the Hornby Island

[0:01:14] Voice 9: Local Trust Committee.

[0:01:17] Voice 9: I'm advised that Daniel Arbor,

[0:01:22] Voice 9: the Comox Valley Regional District Director,

[0:01:28] Voice 9: is going to be joining us today uh did not see him yet but welcome and um hopefully he is able

[0:02:41] Voice 9: our staff have the right to a safe and respectful workplace.

[0:02:44] Voice 9: workplace and so with that um call the meeting to order we have uh an agenda before us and uh

[0:02:57] Voice 9: looking for approval of the agenda trustees anything um I'll note for the public that we have

[0:03:08] Voice 9: a uh 15-minute public comment period and we've discussed that after the um after Pat Maloney the

[0:03:18] Voice 9: The consultants portion is done, we'll get the staff report

[0:03:21] Voice 9: and then we'll, if there's still more people

[0:03:23] Voice 9: that didn't get a chance to speak in the first section,

[0:03:26] Voice 9: we'll provide some more opportunity

[0:03:28] Voice 9: after the staff report is presented.

[0:03:32] Voice 9: So I'll take it then by general consent,

[0:03:43] Voice 9: And so that brings us right into the public comment period.

[0:03:50] Voice 9: As I noted, we have a fairly short

[0:03:53] Voice 9: uh public comment period available and we have quite a number of people joining us

[0:04:00] Voice 9: so i'll look for a show of hands um for those who'd like to speak and um please make it brief

[0:04:09] Voice 9: know that we have lots of people that may want to speak and we'll try and get to everyone that

[0:04:15] Voice 9: we can today um so i'm just going to ask um will i the first hand i saw up there is a phone number

[0:04:51] Voice 1: I'd like to quote, first of all, from a staff report a year ago saying, if no action

[0:04:57] Voice 1: is taken, the housing crisis will elevate to a critical level.

[0:05:00] Voice 1: Without updating the OCP to strengthen the various policies and objectives that impact

[0:05:05] Voice 1: the conditions of housing, Holmby Island will no longer be able to provide healthy social,

[0:05:10] Voice 1: economic, environmental, and cultural conditions for its residents.

[0:05:13] Voice 1: Furthermore, the island will no longer be able to maintain its character.

[0:05:16] Voice 1: more importantly if no action is taken we will fail to implement the trust council's mandate

[0:05:21] Voice 1: of preserving and protecting Hornby Island that came from a March 2022 staff report in December

[0:05:27] Voice 1: of 21 the local trust committee requested that the APC provide recommendations for the OCP and LUB

[0:05:34] Voice 1: in March 22 it was decided that a contract planner would draft and process bylaw amendments based on

[0:05:43] Voice 1: on recommendations from the APC

[0:05:44] Voice 1: and take them through the legislative process.

[0:05:47] Voice 1: In May 22, the APC provided recommendations

[0:05:51] Voice 1: and the LTC recommended staff develop a project charter

[0:05:55] Voice 1: with a work plan based on the APC recommendations.

[0:05:59] Voice 1: In June, the LTC endorsed the project charter

[0:06:06] Voice 1: to work on incorporating recommendations

[0:06:09] Voice 1: the APC, and supposedly the consultant was to be hired in July 2022, leading to first

[0:06:22] Voice 1: reading of bylaws in November 2022, and a public hearing in February 2023, and third

[0:06:33] Voice 1: reading in April 2023, which is where we are now.

[0:06:37] Voice 1: So a year has gone by just about since the APC made its recommendations, and no work

[0:06:43] Voice 1: has been done by the contractor on processing those recommendations and drafting land use

[0:06:49] Voice 1: bylaws.

[0:06:50] Voice 1: Instead, there's a different set of recommendations that have barely referenced what the Conservable

[0:06:55] Voice 1: Work, the APC, did, or even in the public consultation, the APC recommendations were

[0:07:01] Voice 1: not referenced.

[0:07:02] Voice 1: And so I'm suggesting that years gone by without much progress being made

[0:07:07] Voice 1: and that you go back to square one and in your recommendations to staff,

[0:07:12] Voice 1: you ask again for bylaws to be drafted based on the ABC recommendations.

[0:07:18] Voice 1: In my experience when I was a trustee,

[0:07:20] Voice 1: the public usually doesn't engage until it has something concrete to react to,

[0:07:24] Voice 1: and that's the whole point of having draft bylaws is there's something concrete to react to.

[0:07:31] Voice 1: and I think the ABC recommendations

[0:07:33] Voice 1: drafted into bylaw

[0:07:35] Voice 1: is where things should be going

[0:07:37] Voice 1: and of course the consultant's report

[0:07:38] Voice 1: can be referenced in that

[0:07:39] Voice 1: it has something of value in there

[0:07:42] Voice 1: but as I read it

[0:07:43] Voice 1: I see it

[0:07:45] Voice 1: I won't go into analyzing

[0:07:47] Voice 1: I'll put that in writing right now

[0:07:49] Voice 1: but anyway

[0:07:49] Voice 1: my strong suggestion

[0:07:51] Voice 1: is that the local trust committee

[0:07:54] Voice 1: ask staff to draft bylaws

[0:07:56] Voice 1: based on the ABC recommendations

[0:08:33] Voice 3: okay i i also want to encourage the um trustees to direct staff to prioritize the drafting of the

[0:08:39] Voice 3: bylaws there's some i work with the hornby housing network and there's funding opportunities out

[0:08:44] Voice 3: there that are based on having a housing strategy and without having our bylaws in place it's really

[0:08:49] Voice 3: hard to develop a housing strategy so i strongly encourage the um trustees to direct the staff to

[0:08:56] Voice 3: get those bylaws drafted for us thank you thank

[0:09:02] Voice 9: you for that uh next up we have john grayson

[0:09:19] Voice 10: you i'm just going to quote um the last paragraph of a letter sent on february 27th

[0:09:26] Voice 10: to the ltc from high seek i'm the vice chair of high seek high seek wholeheartedly supports

[0:09:33] Voice 10: island's trust in prioritizing and facilitating the creation of affordable housing and supports

[0:09:40] Voice 10: the LTC in prioritizing this. We strongly encourage the LTC to shift their focus away

[0:09:47] Voice 10: from the divisive and ineffective STVR conversation and move toward the issues

[0:09:55] Voice 10: that need to be solved to protect our island's community and economy. And that is primarily

[0:10:01] Voice 10: long-term affordable housing the focus should be on affordable housing thank you thank you very

[0:10:11] Voice 9: much and next we have uh sheila mcdonald thanks

[0:10:17] Voice 5: so much well i'm going to follow up that by saying

[0:10:20] Voice 5: that the letter from heise which i am also a board member of uh was presented to us as a draft

[0:10:27] Voice 5: there were several comments and that letter did not receive a unanimous support and it was sent

[0:10:32] Voice 5: without any kind of a vote or a decision to send so while some of the sentiments in it are supported

[0:10:39] Voice 5: by the group as a whole not all I would also like to say that it is possible for the LTC to focus on

[0:10:47] Voice 5: affordable housing or housing needs in general on a continuum but that we also need to have action

[0:10:54] Voice 5: taken on the STVR language the APC's recommendation should be the foundation of that and I will like

[0:11:01] Voice 5: to point out that when the consultation was done and this um the bylaw making it a permitted uh

[0:11:09] Voice 5: activity was approved we had not foreseen we did not foresee many factors that now mean we are in

[0:11:16] Voice 5: a crisis situation that would be benefited by having the breaks put for a period of time on

[0:11:22] Voice 5: short-term vacation rentals as noted by the consultant there needs to be some kind of an

[0:11:28] Voice 5: assessment done. But in the meantime, there needs to be a halt. And we see, as the APC suggests,

[0:11:35] Voice 5: the only valid methodology for that halt right now is to remove them as a permitted activity

[0:11:42] Voice 5: until circumstances change. The things that I see we did not foresee were an explosion

[0:11:48] Voice 5: of Airbnb and social media to advertise these opportunities. In the day when people were just

[0:11:57] Voice 5: Just making a rental and going through written material, it was not under the same pressures.

[0:12:04] Voice 5: We did not foresee the global change in the flow of capital that meant the lower mainland became an extreme case of rising costs and people selling out of there and bringing the dollars to create such incredibly intense effects on us.

[0:12:20] Voice 5: And we did not perceive the climate change. Of course, some of us did. But most people seem to still believe that it is not important. But we are seeing absolute impacts and unpredictability in our climate. And something that definitely on this island does contribute to increased use of scarce resources during the summer months needs to pause for a while.

[0:12:45] Voice 5: So I encourage the trustees to focus on affordable housing, but also to take the steps that give us leeway until we can catch up on year-round rentals and other forms of affordable housing, put the brakes on the expansion of the STVR sector using the tools you have,

[0:13:09] Voice 5: of but also committing to work towards licensing

[0:13:12] Voice 5: and other measures that would be effective management

[0:13:15] Voice 5: to allow that sector to thrive on an equal playing field.

[0:13:19] Voice 5: Thank you.

[0:13:29] Voice 11: Hi, it's Ray Terry and I'm with the district

[0:13:31] Voice 11: from the president district.

[0:13:33] Voice 11: History was formed in 2019 to help members to operate

[0:13:37] Voice 11: in a way that supports the community and our Island home.

[0:13:41] Voice 11: Our vision is to be an association supporting

[0:13:43] Voice 11: supporting and thriving sustainable,

[0:13:45] Voice 11: environmentally conscious Ormby Island,

[0:13:48] Voice 11: now and for future generations.

[0:13:51] Voice 11: We have heard clearly that there are long held concerns

[0:13:55] Voice 11: and questions about the impact

[0:13:56] Voice 11: short-term vacation rentals have

[0:13:58] Voice 11: on the carrying capacity of our island.

[0:14:00] Voice 11: We want to be clear that we support making real improvements

[0:14:03] Voice 11: in the understanding of short-term vacation rentals

[0:14:06] Voice 11: in our community, their impact and their management.

[0:14:10] Voice 11: We support the current land use by all

[0:14:12] Voice 11: and official community plan.

[0:14:14] Voice 11: They were created and validated by the community

[0:14:18] Voice 11: and the trust council.

[0:14:19] Voice 11: They still reflect what the majority in our community

[0:14:23] Voice 11: want their property rights to include.

[0:14:25] Voice 11: We also agree there's a need to enhance the land use bylaw

[0:14:30] Voice 11: and the official community planning,

[0:14:31] Voice 11: adding the official community plan expectations

[0:14:35] Voice 11: regarding short-term vacation rentals operation

[0:14:37] Voice 11: to the land use bylaw requiring proper water

[0:14:41] Voice 11: and septic system for all hornbeam dwellings including all short-term vacation rentals

[0:14:47] Voice 11: requiring all new dwellings including short-term vacation rentals to have a rainwater harvesting

[0:14:52] Voice 11: component in their water systems. Histra is always expected to work with the LTC and our community

[0:14:58] Voice 11: in that spirit. We have developed an overview of what is needed to meet the requirements for

[0:15:03] Voice 11: land use by-law and official community plan compliance in partnership with Islands Trust

[0:15:07] Voice 11: trust staff. It was sent to all our association members last week and will be on the website

[0:15:12] Voice 11: very soon. So let's come together, gather the facts, not fiction, but the facts that we need

[0:15:18] Voice 11: so that we can all be on the page and ensure current bylaws are enforced and supported and

[0:15:24] Voice 11: work together to build our community from common ground. We urge that alongside with the bylaw

[0:15:30] Voice 11: improvements we support and encourage the LTC shifts at focus and energy to the critical issues

[0:15:36] Voice 11: of affordable housing and water sustainability.

[0:15:39] Voice 11: Resolving these areas will help our whole community

[0:15:42] Voice 11: strengthen and thrive.

[0:16:01] Voice 16: just for those of you who are not on Hornby.

[0:16:04] Voice 16: I was recently acclaimed as HIRA president,

[0:16:07] Voice 16: and this is not an official HIRA opinion or statement so that we're all clear.

[0:16:13] Voice 16: Okay, 1990s, I first started to be aware of Hornby Island through print media and through

[0:16:19] Voice 16: everything around me in Alberta. We have been coming to this island since then and pursuing

[0:16:27] Voice 16: vacation rentals since then. By restricting STVRs with a blanket ban, it's going to push it

[0:16:33] Voice 16: underground and then certain things that are already in place and land use will be shifted

[0:16:41] Voice 16: into a gray market and that's just my opinion so by slamming the brakes off on um right now

[0:16:51] Voice 16: is not the best way that we can look at it and i think we need to keep this conversation happening

[0:16:57] Voice 16: and I implore the Islands Trust Local Council

[0:17:01] Voice 16: to make a decision that works the best for all of us

[0:17:05] Voice 16: and not just the different groups that are advocating

[0:17:08] Voice 16: for one hard side or the other hard side.

[0:17:12] Voice 16: Thank you very much.

[0:17:27] Voice 17: My name's Eulala Mills.

[0:17:28] Voice 17: my mother was opal clark and my family and i have been a part of this community for 55 years

[0:17:34] Voice 17: as visitors part-time and full-time community members we've been active members of the

[0:17:39] Voice 17: community organizations and boards and in our neighborhood we have deep roots here

[0:17:45] Voice 17: in late 2019 at the age of 92 my mother fell broke her hip and had to move from her beloved home

[0:17:53] Voice 17: Her care needs were extensive and costly. We were faced with two choices to help manage the cost of

[0:17:59] Voice 17: her care. Sell her home, the place she expected to be a legacy for our family for generations,

[0:18:05] Voice 17: or participate in the short-term vacation rental. She deserved the best we could do for her and

[0:18:11] Voice 17: having the legal right to offer a short-term vacation rental allowed us to give her that.

[0:18:15] Voice 17: that. Many, likely most of the STVRs on Hornby are people in our community who love the community

[0:18:22] Voice 17: and want to remain part of it for generations. It would have broken my mother's heart and her

[0:18:29] Voice 17: spirit if we'd been forced to sell her home. Having legal short-term vacation rental in full

[0:18:34] Voice 17: compliance with the bylaws and community plan, exercising the legal property rights they have

[0:18:39] Voice 17: today we have today and remaining a valued part of our community is an opportunity for families

[0:18:47] Voice 17: like mine whose parents have been deep held long-term members of the community and who need

[0:18:54] Voice 17: help in their old age. I urge you to make the focus of your work the critical issues of affordable

[0:19:01] Voice 17: housing and water sustainability. I urge you to continue to allow families like mine to protect

[0:19:08] Voice 17: to protect our parents' legacies.

[0:19:09] Voice 17: Thank you for your time.

[0:19:30] Voice 21: I'm not representing anybody myself.

[0:19:32] Voice 21: I think the issue of short-term rentals

[0:19:36] Voice 21: and affordable housing are really unrelated,

[0:19:38] Voice 21: and it's a red herring.

[0:19:39] Voice 21: and I don't really see any good critical analysis that would suggest restricting short-term rentals

[0:19:46] Voice 21: would in any way enhance availability of affordable housing. People are comparing it to Vancouver.

[0:19:53] Voice 21: It's a totally different scenario. People here who engage in short-term rentals also use their

[0:19:58] Voice 21: properties. They use short-term rentals to supplement income. That's not the case in Vancouver

[0:20:03] Voice 21: where whole bunches of condos are held for Airbnb.

[0:20:07] Voice 21: And yes, it has an effect on rental supply.

[0:20:10] Voice 21: There's only two ways to increase affordable housing,

[0:20:13] Voice 21: and that's to increase product by building it

[0:20:17] Voice 21: or by increasing the supply of rental housing.

[0:20:21] Voice 21: One of the principal problems we have today

[0:20:23] Voice 21: is that there is no legal way to rent a residence

[0:20:28] Voice 21: for a period of time.

[0:20:31] Voice 21: section 49 of the residential tenancy act was recently amended and you cannot have a fixed

[0:20:37] Voice 21: term tenancy and require the tenant to move out at the end of that term at the end of the term

[0:20:43] Voice 21: it converts to a month-to-month tenancy and if you want them out you have to give them six months

[0:20:47] Voice 21: notice pay them two months rent and there's a penalty of 12 months rent if you move if you don't

[0:20:53] Voice 21: occupy the house for six months as a result there's no legal way to have a short-term rental

[0:21:01] Voice 21: on a nine-month rental on hornbeam which used to be the case and was was of some assistance in

[0:21:08] Voice 21: helping people who need to rent for really advocate that if focus on affordable housing

[0:21:18] Voice 21: is a separate issue try and change that regulation it does not require an act of parliament it

[0:21:23] Voice 21: requires a regulatory change at the residential tansy branch and to exempt the islands from that

[0:21:30] Voice 21: requirement and i certainly believe that there will be people on the island who would look to

[0:21:36] Voice 21: rent their houses out in the for a period of time if they had that opportunity to do so

[0:21:41] Voice 21: legally in accordance with legislation thank you uh

[0:21:47] Voice 9: thank you for that so i there are still a couple

[0:21:50] Voice 9: a couple of hands up, but we're going to go into the consultant section here next. And so please

[0:27:46] Voice 12: astounded at how many middens are here this is a guy from the ark branch so that's the primary tool

[0:27:52] Voice 12: that we need that identify where middens are burial grounds culturally modified trees etc

[0:27:58] Voice 12: where the cultural features are around the island so that when a development permit comes in we will

[0:28:04] Voice 12: have the tools to be able to make an initial recommendation and pass that on to comox first

[0:28:10] Voice 12: First Nation that identifies what the what the issues might be there so that we can, I think,

[0:28:17] Voice 12: assist them in a way that they want to to be able to look at these development permits so we don't

[0:28:24] Voice 12: get caught in the situation we got we got caught in down in the thatch there. So I'll just leave

[1:12:55] Voice 18: to 40 years I have friends on the island we've used the services excellent services on the island

[1:13:01] Voice 18: so I'm pleased to see that you're not making a decision today because I think the long-term

[1:13:06] Voice 18: impacts for people like us our family um could be significant and not favorably so um so uh

[1:13:16] Voice 18: the issues before you i think that are critically important and not necessarily related to

[1:13:21] Voice 18: affordability as has been said before around short-term rentals um are are significant um

[1:13:30] Voice 18: Our property, for example, would not be viable, and I've learned not even legal today, for long-term housing.

[1:13:38] Voice 18: Although we were approached by locals who needed a place to stay, they did find something that was longer term.

[1:13:46] Voice 18: But, you know, I'd love to be able to do that, for us to be able to do that legally in the long term and still use it as a vacation property is, of course, problematic.

[1:13:56] Voice 18: attic um for years we uh we do not advertise by the way for years we used wind and wind and waves

[1:14:04] Voice 18: as our property manager managers uh francis has now retired of course and we took a break during

[1:14:11] Voice 18: covid um and since then we've kept it pretty much in-house we don't advertise we're not running a

[1:14:19] Voice 18: business we're simply allowing family and friends to use our property and it's worked very well that

[1:14:26] Voice 18: way so um please don't lump us in with the people who are running this as a business that that's not

[1:14:33] Voice 18: us we're very committed to and have long-term connections to the island um if the bylaws became

[1:14:40] Voice 18: more restrictive um and unreasonably so and i understand why you're why you're looking at

[1:14:46] Voice 18: certain aspects of those then our family would probably have to consider selling because we

[1:14:51] Voice 18: We really need that income from the rentals just to pay the property taxes, among other things.

[1:15:00] Voice 18: And as far as I understand, our property is in compliance with all the requirements around sewage and water and everything,

[1:15:08] Voice 18: except we do not have a rainwater harvesting system.

[1:15:12] Voice 18: So the other thing is, I think those are the main points that I wanted to make.

[1:15:20] Voice 18: please don't forget about us we are very connected to the island my children have really you know

[1:15:27] Voice 18: been coming here since they were very small and it's important to us your the issues identified

[1:15:34] Voice 18: already of course are important too so that's mainly what I wanted to say I've not fully gone

[1:15:42] Voice 18: through the report so I appreciate the extra time to have to be able to review that or to the or to

[1:15:49] Voice 18: or to review the consultant's report either.

[1:15:52] Voice 18: Just one other thing I wanted to say

[1:15:56] Voice 18: is that the consultant is correct

[1:15:59] Voice 18: about keeping archeological or cultural sites

[1:16:04] Voice 18: out of the public domain.

[1:16:06] Voice 18: I worked for the heritage branch for a number of years,

[1:16:09] Voice 18: the provincial heritage branch,

[1:16:11] Voice 18: and often in collaboration with the archeology folks.

[1:16:17] Voice 18: and why that information is not in the public domain so um and it's not likely to be so in the

[1:16:23] Voice 18: foreseeable future so anyway that's basically what i want to say and i will i hope that you

[1:16:30] Voice 18: will consider my comments and the um i guess the implications for our family and people like us on

[1:17:32] Voice 6: move on to retirement income and less monies and if I haven't been doing it already am I going to

[1:17:37] Voice 6: be locked out of it or does that mean I have to rush out there and start it now so I'd like some

[1:17:42] Voice 6: people to put some thought into that that there's people like myself and including my daughter who's

[1:17:47] Voice 6: having difficulty with an increased mortgage to make payments so she's seriously looking at

[1:17:51] Voice 6: vacation rentals and moving in with mom and dad for the summer so um it's not just hey let's cap

[1:17:56] Voice 6: it off and stay where we are i think we have to think about the long term i i want to i definitely

[1:18:01] Voice 6: strongly agree with trustee allen's statement that we need some consults consultation in person

[1:18:07] Voice 6: my phone has dropped off three times since i've been on this call and i was on um one of the two

[1:18:13] Voice 6: consultants calls and i just didn't feel like if you're not face to face with your neighbor you're

[1:18:17] Voice 6: You're not consulting the same.

[1:18:18] Voice 6: And I really value that face-to-face time

[1:18:21] Voice 6: and would look forward to at least a couple of sessions

[1:18:24] Voice 6: here on Hornby where people can participate

[1:18:26] Voice 6: and speak, you know, the pros and cons

[1:18:29] Voice 6: and I get to hear everybody's opinion

[1:19:01] Voice 6: and there was some very good relationships with people.

[1:19:04] Voice 6: I've seen a few of those and I think that's to do.

[1:19:08] Voice 6: The interesting thing from my perspective,

[1:19:11] Voice 6: so I'm actively involved with people

[1:19:13] Voice 6: on both Hornby and Denman Island.

[1:19:14] Voice 6: Denman Island does not allow vacation rentals, and they have the same lack of housing that we do.

[1:19:20] Voice 6: So I don't see that vacation rentals as being the fix-all for fixing the affordable housing aspect of it.

[1:19:27] Voice 6: I think there's more things that need to be done.

[1:19:29] Voice 6: And I just keep reminding myself it's not any different over there, and they don't allow it to house it different here.

[1:22:10] Voice 2: discussing tonight which of the options that professional presented that we

[1:22:15] Voice 2: would be discussing moving forward so it appears that the trustees are not happy

[1:22:22] Voice 2: with the report my conclusion would be because we're not discussing those

[1:22:26] Voice 2: options and if we're going back to a year ago and going back to the APC or

[1:22:31] Voice 2: local discussions again and throwing the report out with the baby. I would like to be part of

[1:22:39] Voice 2: those discussions. I think that it's really important to have a very wide conversation

[1:22:46] Voice 2: about this. These are legal zoning bylaws that people expect, perhaps even have purchased

[1:22:54] Voice 2: property on Hornby or own property on Hornby, expecting that they've got a future with this

[1:23:01] Voice 2: with these bylaws and to change the bylaws when people don't know that some of their future

[1:23:08] Voice 2: options will be taken away um i find uh not right without a much more discussion if the if this

[1:23:19] Voice 2: consultant's report where discussion occurred it's been occurring publicly several times with

[1:23:25] Voice 2: that consultant um then i think that we're right back to where we were a year ago um that now we

[1:23:33] Voice 2: have to open those discussions up more widely again um so i guess i am offering some uh to be

[1:23:41] Voice 2: part of that um but i would only be interested in being part of it if it was a very wide discussion

[1:23:48] Voice 2: and homeowners understood that there uh would be losing some of their property rights

[1:23:53] Voice 2: into the future. I have a vacation rental. I am not pacified by the fact that you're not killing

[1:24:00] Voice 2: me, that I can continue vacation rentaling. Lord knows I actually don't really want to continue

[1:24:07] Voice 2: vacation rentaling, but I want my children to have that option. I want long-time community members

[1:24:13] Voice 2: through generational succession to be able to hold on to their family homes, people like Pam

[1:24:19] Voice 2: Pam Copley. I'm sorry, Pam, if I'm saying your name wrong. People like you, Layla. I just think

[1:24:25] Voice 2: they've contributed so much to our community, these long-term families, the Grahams, the

[1:24:31] Voice 2: Dr. Ross's family, Bev Bowen's family. I mean, it goes on about the contributions these families

[1:24:38] Voice 2: made. And for them to have to sell their property to a rich person from somewhere else who can

[1:24:44] Voice 2: afford real estate prices on hornby it's distressing to me so i i do hope that's

[1:24:50] Voice 2: considered and it's just not all about me it's about my friends and neighbors so um thank you

[1:31:38] Voice 13: simply wouldn't be able to afford to do it we love Hornby we love the property and we love the

[1:31:42] Voice 13: opportunity to share its wonders with visitors to the island we also appreciate this that this is

[1:31:51] Voice 13: our opportunity to support the island economy in many ways and at many levels from management to

[1:31:56] Voice 13: to maintenance, gardeners, cleaners, and other services, and to the artists, artisans, restaurants,

[1:32:01] Voice 13: and grocery stores, and many other businesses all around the island. So that's all to say that I

[1:32:07] Voice 13: have quite a bit of experience in terms of short-term vacation rentals. And it seems to me

[1:32:14] Voice 13: that one thing that we are lacking at this point in terms of making good decisions is some really

[1:32:21] Voice 13: really good data that we can rely on, that we can agree on, and that would help all of us

[1:32:29] Voice 13: to, I think, be on a level playing field in terms of making our decisions.

[1:32:37] Voice 13: You know, I think that there are ways of cherry-picking facts or what we might call evidence

[1:32:46] Voice 13: uh to support any point of view that we might have but the thing is that what we need is a

[1:32:53] Voice 13: really good process uh and i would recommend that as part of this process that the appropriate

[1:33:00] Voice 13: bodies set aside budgets and time to gathering of hard data to determine you know just simply

[1:33:07] Voice 13: the number of stvr stvrs on the island what where are the guests coming from what is the nature of

[1:33:14] Voice 13: of the businesses that are being run. And so that we can really have good evidence, all of us

[1:33:22] Voice 13: together, so that we can look at that and it will help us all to make good decisions. That people

[1:33:29] Voice 13: can look back on in 20 years or 50 years time and say, they made good decisions. And part of the

[1:33:35] Voice 13: reason that they were able to do that was that they collected the data and they really had a

[1:33:40] Voice 13: a good understanding from having done that

[1:33:42] Voice 13: of what they were deciding.

[1:34:39] Voice 11: But when it comes to short-term vacation rentals,

[1:34:41] Voice 11: people say they use the resources. They use too much of the resources. Do they? Do we have facts

[1:34:49] Voice 11: for that? If they use too much water, do they have facts? The ferries, they say that short-term

[1:34:53] Voice 11: vacation rentals overload the ferries. Do we have facts on that? Like, do we have a number? Do we

[1:34:58] Voice 11: have a count? Because if short-term vacation rentals use too much water and we have the facts

[1:35:03] Voice 11: of that, I'm all in favor, man, of making huge changes. Right now, if anybody's looked at the

[1:35:10] Voice 11: water system on Hornby, it's low. Below the 20-year level has been all winter. There is no

[1:35:17] Voice 11: short-term vacation rentals running during the winter. So where's the water going? The government

[1:35:22] Voice 11: is concerned about this, right? They say the summer is stable. Now they're concerned about

[1:35:27] Voice 11: the winter months. Like what is going on, right? Water stewardship put a great course on the other

[1:35:34] Voice 11: a few weeks ago about how, you know, the water, the ditches, the E. coli, the sewer system. It

[1:35:39] Voice 11: It was a great information. Right. But we need everybody.

[1:35:43] Voice 11: If they're saying, well, we're not here to kill the short term vacation rentals, then how does this fix the water issue?

[1:35:50] Voice 11: If if the same numbers are still going to run for a while.

[1:36:43] Voice 10: I would just simply, I've been on the APC twice over the last 22 years, and I just want to point out that the tradition way back when was when an APC did its job, it was dissolved, and then when a new project came on, a new one was advertised to participate.

[1:37:04] Voice 10: And I suspect if we follow the LTC tradition of once an LAPC has done its job and you advertise again for a new one, I think this could be viewed as a huge new opportunity for community consultation.

[1:37:22] Voice 10: And yet you will have many, many people that represent a wide demographic representation of everybody that's concerned about these issues on Hornley.

[1:37:33] Voice 10: So I would recommend carrying out some procedure of true community consultation that relates to hard data and getting the facts on the table before we knee jerk into drafting bylaws.

[1:38:05] Voice 5: so much. I think just a point of clarification, I was involved with the local trust committee as a minute taker for a very long time, and then I was on the APC at a point with Tom Nott as chair.

[1:38:22] Voice 5: was a great experience, a mixed group. That comment, that practice of the APC being dissolved

[1:38:29] Voice 5: after its job is done, absolutely, no, no, not true. It was not a practice. It's not something

[1:38:35] Voice 5: that I recollect happening. The APC is elected for whatever term the LTC determines. And usually,

[1:38:42] Voice 5: sometimes it runs in kind of sync with the elections. But I don't think we could consider

[1:38:49] Voice 5: necessarily that there's something going on when we are not disbanding this particular APC.

[1:38:55] Voice 5: And I do hope that if there are vacancies on it, you'll be able to fill it with some good people

[1:39:00] Voice 5: that take a neutral and an interested evidence-based, what we focused on was trying to

[1:39:06] Voice 5: ground truth. All these lots that we have divided up in capacity, they actually don't reflect what's

 There were approximately thirty-eight (38) members of the public and no 
members of the media in attendance. 
 
1. CALL TO ORDER 
Chair Peterson called the meeting to order at 4:02 pm. He acknowledged that the meeting was 
being held in territory of the Coast Salish First Nations. He introduced himself, Trustees, Staff, 
Recorder and welcomed Consultant Maloney and members of the public. He noted that the 
meeting was being recorded and livestreamed. 
 
2. APPROVAL OF AGENDA 
Trustees discussed that members of the public may have further comments and questions after 
the presentations of the Consultant’s and Staff reports. 
 
Trustees considered the following addition to the agenda:

3. PUBLIC COMMENTS 
 Upcoming bylaws should be drafted by Islands Trust staff based on Advisory Planning 
Commission (APC) recommendations as originally planned so that members of the public 
have something concrete to react to. The Consultants’ recommendations have some value 
but do not adequately reference the previous work of the APC.

 Trustees should direct Staff to prioritise the drafting of bylaws to take advantage of the 
funding opportunities identified by the Hornby Housing Network as being available to 
communities that have a solid Housing Strategy. 
 Speaking as the Vice Chair of the Hornby Island Economic Enhancement Corporation 
(HICEEC), read from a February 27, 2023 HICEEC letter to the Local Trust Committee (LTC) 
that asks Trustees to focus on affordable housing rather than the divisive topic of Short 
Term Vacation Rentals (STVR)s. 
 Another board member of HICEEC commented that the letter just referenced by previous 
speaker did not receive unanimous support by the board but was sent anyways. STVR 
expansion needs to be reassessed based on the unforeseen external forces such as the 
explosion of Airbnbs through social media; increasing property values; and climate change. 
 Speaking as the President of Hornby Island Short Term Rentals Association (HISTRA), spoke 
on supporting that all dwellings be expected to adhere to water and septic regulations and 
that current bylaws be enhanced to include rainwater catchment; and that affordable 
housing be supported. 
 Putting a brake on STVRs will drive the sector into a grey market. 
 STVRs are essential for many long-term elderly residents and their families to maintain their 
properties and legacies.  
 Vancouver urban STVRs, which are often bought primarily for that purpose and thus do take 
away long term rental opportunities, are not the same as Hornby rural STVRs whose owners 
are also using their properties. 
 There is presently no legal way to rent a residence to a tenant for a fixed term as per recent 
amendments to Section 49 of the Residential Tenancy Act. If you want a tenant to move out, 
you must give them a 6 month notice and pay them 2 months of rent; and, there is a penalty 
of 12 month’s rent if the owner does not then occupy the residence for 6 months. The 
Islands should be exempted from these requirements because many property owners would 
rent spaces out for fixed terms in their off-season; this used to be common practice on 
Hornby Island. 
 
4. BUSINESS ITEMS 
4.1 Hornby Island Official Community Plan Review Project - Consultant's Report March 30, 
 2023 
The Consultant offered to answer Trustees’ questions regarding the recently completed 
44-page report titled “Hornby Island Official Community Plan Engagement Summary 
report,” dated March 2023 that is a comprehensive review of the subject areas of 
Riparian Areas; Indigenous Language; Affordable Housing; and Short Term Vacation 
Rentals. 
 
Trustees noted or asked the following: 
 When would be best to engage with K’ómoks First Nation (KFN) regarding 
proposed indigenous language changes in the Hornby Island Official Community 
Plan (OCP)?

o Consultant Maloney supported early in-person First Nations 
engagement. 
o Planner Zupanec added that K’ómoks First Nations engagement would 
be expected before first reading of any proposed bylaws. 
 A map of indigenous cultural features on Hornby Island is not available; such a 
map would provide Trustees with the tools to examine development permits 
properly. 
o The Consultant responded that First Nations are very hesitant to 
provide public maps of their sacred cultural areas for fear of damage; 
but they know immediately upon receipt of an application if the 
proposed development area is an important cultural site. 
 A new riparian study would not seem to be worth the cost; and most people on 
Hornby do understand the riparian regulations. 
o The Consultant responded that some members of the public are 
confused as to why some ditches would be considered riparian areas.  
 The APC is tasked with making recommendations, they are not decision makers; 
also, it is unfair to single out the APC as being biased when all committees and 
individuals have bias; also, the recent work of the APC was not sufficiently 
recognized in the Consultant’s report. 
 A recently compiled initial rough draft flow chart of potential accommodation 
sites on Hornby showed that there are approximately 2019-person 
accommodation spots currently advertised, yet only approximately 1300 
residents. 
 The rural character of Hornby Island seems to be diminishing as numbers of 
STVRs increase. 
 Whatever the LTC decides regarding STVRs, existing ones will be able to 
continue. 
 
The Chair expressed concern that the use of the word ‘traditional’ in reference to First 
Nations, as used in the Consultant’s Report within the phrase ‘traditional indigenous 
lands ‘at the top of page 38 under Advocacy Policy 3.1.9, has connotations and should 
be used carefully.  
A Trustee thanked the Consultant for her work on this challenging project. 
4.2 Hornby Island Official Community Plan Review Project - Staff Report (to be 
distributed) 
The Planner presented the staff report that asks Trustees to review the updated draft 
Project Charter for the Official Community Plan (OCP) and Land Use Bylaw (LUB) review 
project and to provide direction for staff on possible amendments to the project 
workplan that could impact budgeting for the 2023/2024 fiscal year.

A Trustee suggested that giving the APC the opportunity to draft the bylaws could be 
less costly, faster, and more relevant than sending the project back to Planning Staff and 
Consultants. 
o The Planner responded that the Consultant contract had ended; and further 
consultant engagement was at the discretion of the LTC. A lead planner has been 
appointed to the current project and their drafting of bylaws is the most cost-
effective approach.

It was MOVED and SECONDED, 
that Hornby Island Local Trust Committee defer the Official Community Plan/Land 
Use Bylaw Review Project final report and draft project charter until the May 5, 
2023 regular business meeting.

4.3 Public Comment 
Members of the public noted the following: 
 We allow family and friends to use our property, are compliant with bylaws, and do 
not advertise, so please do not lump us in with commercial STVRs. The small 
amount of money made by our visitors pays the property taxes and without this 
income we would have to sell.  
 Having worked for the Provincial Heritage Branch for some years, I am aware that 
the Consultant is correct in noting that Indigenous Cultural Sites maps need to be 
kept out of the public domain for the reasons given. 
 Worrying about future income, if I do not rush out now and start an STVR will I be 
permanently locked out of the opportunity? 
 We need some future public meetings in person. My phone service has dropped 3 
times at this meeting. 
 The Provincial Government needs to be lobbied to amend the regulations so that 
fixed term rental opportunities can be brought back to Hornby. Many residents used 
to rent their house out for 11 months and use it for 1 month over the summer. 
 Denman Island does not allow STVRs; but they have the same problems with 
affordable housing that Hornby has. 
 I appreciate the Consultant for acting as a fresh perspective, professional individual 
that could gather information and create options for Trustees. Trustees do not seem 
happy with the report. I am not pacified by my rights being maintained as an 
existing STVR operator because I want these rights for my children and other long-
term residents and elders who have contributed so much to our community, some 
of whom may be forced to sell their properties if they are not permitted to have an 
STVR. 
 I support the timely drafting of bylaws by Planning Staff because until we have these 
bylaws, the community will keep going in circles.

 How was the APC constituted and would you consider a democratic process to 
create a new APC that is more broadly representative? The LTC seems to really lean 
on the APC. 
o The Chair noted the statutory process that governs the APC appointments 
by the LTC. It is a time commitment. Numbers of applicants may be many or 
few. 
o A Trustee noted that the LTC does not have to follow APC 
recommendations. An advertisement is put out for the APC and the LTC 
receives applications. Recently we appointed two young members because 
young people have been long underrepresented on the APC.  
 We support the Island economy through our vacation rentals. We need a budget to 
collect good data for making good decisions.  
 We have no facts on how many STVRs there are. The Bylaw Enforcement Manager 
says 112 but a few years ago it was 152; by these numbers, STVRs have come down. 
Are there facts that STVRs use too much water or take up too much ferry space? 
Currently, the water system on Hornby is low and has been low all winter even 
though STVRs do not operate during the winter, so where is the water going? How 
will stopping STVRs fix water issues? 
o A Trustee noted that the data was unclear. There seems to be 114 known 
STVRs. The Bylaw Enforcement Manager is also not clear on STVR numbers 
because of multiple advertising platforms and that many do not advertise. 
 Traditionally, when an APC finished a project it was dissolved until a new project 
came up and a new APC was advertised for. If we went back to this there would be 
greater community representation on the APC. We need very broad community 
consultation before drafting bylaws. 
 I, as a past minute-taker, do not recollect that the APC was dissolved after a project.  
o The Chair clarified that APC members were appointed for a 2-year term. 
 
A Trustee thanked everyone for participating today and noted that the STVR issue was very 
complicated and that there needed to be some limits on them yet to be determined. 
5. UPCOMING MEETING 
5.1 Next Regular Meeting Scheduled for Friday, May 5, 2023 at 11:30 am at Room to Grow
