[0:01:32] Trustee Elliott: um for october 23rd 2023 and i'd just like to welcome everybody here thank you to the two

[0:01:42] Trustee Elliott: members of the public who come to join us uh local trustees uh trustee peterson trustee laroni and

[0:01:50] Trustee Elliott: myself chair uh toby elliott from gabriel island uh we'd like to acknowledge as we do at every

[0:01:56] Trustee Elliott: meeting that we are meeting and we live work and play on the ancestral unceded territory of many

[0:02:03] Trustee Elliott: Coast Salish peoples in particular the Penelakut and I'm so sorry my brain just went welcome

[0:02:21] Trustee Elliott: and coyote um so we have an agenda before us and i have a suggestion that we reorder

[0:02:31] Trustee Elliott: the agenda just a little bit um i wanted to after the report section um and in fact 3.3 the electoral

[0:02:43] Trustee Elliott: area director's report um will have to happen after noon we're going to move that down to

[0:03:45] Trustee Elliott: yeah okay so great so following trustee reports uh 3.2 chair's report we'll move

[0:03:52] Trustee Elliott: into one item of new business 11.1 by law enforcement on the skidi and then into four

[0:03:58] Trustee Elliott: town hall with the rest of the agenda proceeding is there anything else to amend or add to the

[0:04:05] Trustee Elliott: agenda no okay well then i'll take it by general consent that we've adopted the agenda as amended

[0:04:27] Trustee Elliott: thank you. Okay, so we'll move into reports. We have our two trustees here which I'm sure ready with the report and we'd like to go first.

[0:04:42] Voice 8: So since our last local trust committee in July, I've attended meetings of trust council

[0:04:48] Voice 8: committees, the trust programs committees, continuing to work on the updating the policy

[0:04:53] Voice 8: statement and the stewardship education speaker series with topics to include groundwater

[0:05:00] Voice 8: stewardship and wildfire mitigation.

[0:05:03] Voice 8: Financial planning committee has had its first look at business cases for the 24-25 budget,

[0:05:10] Voice 8: some ongoing process uh the governance committee brought some items to the september council

[0:05:17] Voice 8: uh one is around an interpretation of the island's trust uh mandate from the act which section three

[0:05:27] Voice 8: uh continuing work on the strategic slash corporate planning designing the corporate

[0:05:33] Voice 8: corporate planning process work continues and visioning process was also brought to trust

[0:05:39] Voice 8: council and at trust council in september uh trust council agreed on a common interpretation

[0:05:47] Voice 8: of the section three uh mandate which essentially states that all elements uh listed in that the

[0:05:55] Voice 8: mandate um uh must be weighed uh and can all of them considered and when one takes precedence

[0:06:03] Voice 8: there should be rationale provided trust council also endorsed the recommendations from the office

[0:06:08] Voice 8: of the ombudsperson report on uh by law enforcement and referred the matter to the regional planning

[0:06:15] Voice 8: committee to develop a charter and work plan as a member of the executive committee i attended

[0:06:22] Voice 8: the union of bc municipalities conference in september i attended sessions on reconciliation

[0:06:28] Voice 8: reconciliation implementing the UN Declaration of Rights of Indigenous Peoples I met with mid-level

[0:06:35] Voice 8: staff from the Ministry of Transport in a small talk series to discuss ferries and roads and the

[0:06:44] Voice 8: executive met with the Minister of Municipal Affairs requesting more regular meetings which

[0:06:49] Voice 8: was well received and also met with the Minister of Transportation to request uh more meetings as

[0:06:55] Voice 8: well and the establishment of a task force between islands trust and the ministry work on island

[0:07:02] Voice 8: specific issues as laid out in a long standing letter of understanding the minister responded

[0:07:08] Voice 8: positively to that and i followed this up with an email to minister fleming this week

[0:07:14] Voice 8: addressing concerns about the automatic renewal of the western pacific marine ferry contract in

[0:07:19] Voice 8: the spring um mentioned how there was no public consultation done before issuing of the request

[0:07:27] Voice 8: for proposal in 2019 and the contract states of the annual meetings with the community

[0:07:34] Voice 8: west pacific marine and bc ferries and how there have been none to date and requested that his

[0:07:40] Voice 8: office look into the matters in a timely manner let the residents of luskegee and the ridership

[0:07:45] Voice 8: of route 55 i know their concerns are being heard and will be addressed and i have copies of that

[0:07:51] Voice 8: letter if anyone would like to read it that's it for me wow

[0:07:56] Trustee Elliott: that was a very comprehensive report

[0:08:03] Trustee Elliott: there was so much that happened in september

[0:08:07] Voice 8: it was a busy busy time

[0:08:08] Trustee Elliott: great summary

[0:08:11] Trustee Elliott: all right all right i'm going to be free doesn't let me anything left to say

[0:08:29] Trustee Elliott: i've been working on um some of my other stuff that i do with the honest trust so i'm a

[0:08:38] Trustee Elliott: a stress representative for the shellfish aquaculture management advisory committee

[0:08:42] Trustee Elliott: and i'm working on getting some smaller farms involved in that because the people who are

[0:08:48] Trustee Elliott: representing the industry are just the really really big ones i think it's important to have

[0:08:52] Trustee Elliott: small business small community you know family-run stuff presented represented and yeah we went and

[0:08:59] Trustee Elliott: did the island sports meeting on our calendar which was incredible to see it apart for the

[0:09:04] Trustee Elliott: islands and always so helpful to me. I'm also on a regional planning committee and we have been

[0:09:14] Trustee Elliott: focusing very strongly on housing and figuring that out on islands and doing studies and

[0:09:20] Trustee Elliott: hopefully moving forward with stuff that will actually help and as Tim said there's still a

[0:09:27] Trustee Elliott: ton of area issues it's not really our jurisdiction but I think we both try to do what we can because

[0:09:31] Trustee Elliott: because, yeah, I mean, the ferry just got back two days ago, and there's already a bath

[0:09:37] Trustee Elliott: on the surface, so it's just, yeah, problem after problem, and that just about sums it

[0:09:45] Trustee Elliott: up.

[0:09:49] Trustee Elliott: Thank you, Trustee Laroni, and so, so for my chair's report, Trustee Peterson, you covered

[0:09:59] Trustee Elliott: a lot of the relevant material thank you for that executive committee uh has indeed worked through

[0:10:05] Trustee Elliott: the business cases that um need to advance the work of the Adams Trust so those have been forwarded

[0:10:11] Trustee Elliott: to financial planning and so this is sort of the beginning of the vetting process uh the financial

[0:10:17] Trustee Elliott: planning cycle um we'll meet one more time this year for financial planning committee and then

[0:10:25] Trustee Elliott: see a draft budget in december and that'll get went and worked on until march when the

[0:10:33] Trustee Elliott: final must be approved um i guess what i could just fill in the reconciliation learning group

[0:10:42] Trustee Elliott: i would say um i'm very keen to to uh i'm very pleased to announce that we had our first meeting

[0:10:50] Trustee Elliott: on october 2nd which is the national day for truth and reconciliation stat holiday

[0:10:55] Trustee Elliott: day and it's being led ably by our new senior indigenous relations advisor robin keffi

[0:11:03] Trustee Elliott: and uh so that was a great first meeting of trustees it's a learning group not a committee

[0:11:08] Trustee Elliott: so there are no um report notes or notes for our own internal learning and to discuss items

[0:11:16] Trustee Elliott: related to reconciliation protocol development and um relationship building in the truck area

[0:11:23] Trustee Elliott: From Council, as Trustee Peterson mentioned, was on Pender Island, the Penders this year,

[0:11:32] Trustee Elliott: and the visioning process was really interesting.

[0:11:36] Trustee Elliott: It turns out Islands Trust Conservancy has a vision statement.

[0:11:40] Trustee Elliott: Many organizations have a vision statement, and the Islands Trust has never been able

[0:11:45] Trustee Elliott: to land one, and so we didn't quite get there.

[0:11:50] Trustee Elliott: We almost did, but we need a little more input from particularly First Nations and from staff

[0:11:58] Trustee Elliott: so that we don't just create a vision that is us ourselves for the trust area,

[0:12:03] Trustee Elliott: but it's inclusive of the many perspectives and voices of people who call this area home.

[0:12:12] Trustee Elliott: So that Gibraltar Island, I don't know if you're following anything that we're doing there,

[0:12:18] Trustee Elliott: but we've launched our preliminary process to the OCP review which will hopefully happen next year

[0:12:25] Trustee Elliott: and this is also a visioning process and we've done sort of an innovative, our staff have

[0:12:30] Trustee Elliott: presented an innovative approach to community meetings in which groups can apply for funds

[0:12:39] Trustee Elliott: to host their own meetings to talk about their vision for the community for the next 25 years

[0:12:45] Trustee Elliott: As we've never had this sort of application process before, and it's inspired a lot of keen interest in groups, but also non, you know, non structured groups, people that just want to gather together and talk about their vision.

[0:13:00] Trustee Elliott: So, I think this is the first time that I've witnessed, anyways, the Islanders Trust is able to sort of put funding out there so that groups can meet in a way that makes sense to them and has got their vision for communities.

[0:13:14] Trustee Elliott: So, that's been a really positive sort of framework, and I hope we can build on that for other trust communities.

[0:13:24] Trustee Elliott: And I think that's it for my report.

[0:13:26] Trustee Elliott: There has been a lot.

[0:13:28] Trustee Elliott: But Southern Gulf Islands, I did go to Southern Gulf.

[0:13:31] Trustee Elliott: No, that's not relevant here.

[0:13:32] Trustee Elliott: Never mind.

[0:13:34] Trustee Elliott: Okay, that's it for now.

[0:13:36] Trustee Elliott: I think we'll wait, as I said, for afternoon for the Electoral Area Director to report.

[0:13:44] Trustee Elliott: And so if we could move into the item of new business, 11.1 bylaw enforcement on Laskete.

[0:13:52] Trustee Elliott: And we have staff manager Warren Dingman here who can answer questions and speak to the process about an item of bylaw enforcement concern that has been lately raised in the community.

[0:14:08] Trustee Elliott: And so we're going to do this before the town hall because there's certain things we need to make clear and what we can speak to and what we're not able to speak to when there's litigation involved.

[0:14:18] Trustee Elliott: involved so would you mind reading your the press release that you've got um

[0:14:24] Voice 8: well I just got this

[0:14:27] Voice 8: document um

[0:14:29] Trustee Elliott: okay

[0:14:32] Voice 8: so um this is just a short uh one pager on bylaw enforcement on mesquite I've

[0:14:39] Voice 8: got some copies here if anyone would like one um mesquite like other jurisdictions is required to

[0:14:45] Voice 8: have bylaws the two most important are the list of the official community plan bylaw number 77

[0:14:52] Voice 8: and the land use bylaw number 78. these bylaws can be reviewed on the ski page of the island's

[0:14:59] Voice 8: trust website and include the dates of any revisions bylaw 77 was last amended in september

[0:15:05] Voice 8: 2012 and bylaw number 78 in january 2019 when bylaws 77 and 78 were created it was with public

[0:15:17] Voice 8: engagement and the community provided input if the public feels that any bylaw is no longer

[0:15:21] Voice 8: serving the community and should be brought to the attention of the local trust committee

[0:15:24] Voice 8: for consideration of amendment or possibly resentment a public process would then follow

[0:15:30] and public input would be considered including potentially

[0:15:34] Voice 8: including a formal public hearing

[0:15:37] islands trust council

[0:15:38] Voice 8: has adopted the bylaw compliance and enforcement policy to guide

[0:15:42] the work of its bylaw compliance and enforcement team the

[0:15:45] Voice 8: enforcement of bylaws is the complaint

[0:15:47] Voice 8: driven process if there's been a complaint by law compliance and enforcement officers investigate

[0:15:52] Voice 8: and if there's a violation of the zoning regulations work with the landowner on

[0:15:56] Voice 8: compliance options a full-on investigation is undertaken if a confirmation of the local trust

[0:16:03] Voice 8: committee bylaws bound to exist then the property owner will be asked to take steps to comply with

[0:16:08] Voice 8: the bylaw depending on the specific circumstances the bylaw compliance and enforcement officer will

[0:16:14] Voice 8: negotiate a reasonable plan and time for voluntary compliance this compliance plan may accommodate

[0:16:21] Voice 8: unusual circumstances such as seasonal or financial constraints or personal situation which

[0:16:27] Voice 8: means a property owner is given extra time to comply if voluntary compliance is not occurring

[0:16:34] Voice 8: the bylaw compliance and enforcement officer may either issue a bylaw violation ticket if the local

[0:16:39] Voice 8: trust community has adopted such a system or recommend that a local trust can be approved

[0:16:44] Voice 8: legal action to acquire a court order to gain compliance so

[0:16:48] Trustee Elliott: can i pause you here so does the

[0:16:51] Trustee Elliott: Does the LTC have a by-law violation of this?

[0:16:54] Voice 8: That's the very next line on this.

[0:16:57] Voice 8: It is important to note that LISKETI does not have a by-law enforcement notification by-law.

[0:17:03] Voice 8: Many local trust areas do.

[0:17:05] Voice 8: Some do not.

[0:17:06] Voice 8: By-law enforcement notification by-laws allow for fines for violations.

[0:17:10] Voice 8: They're sometimes used as an intermediate step between voluntary compliance and court action.

[0:17:16] Voice 8: In 2012, the LISKETI Local Trust Committee considered such a by-law,

[0:17:20] Voice 8: but ultimately decided not to proceed uh the bylaw compliance and enforcement team investigates

[0:17:26] Voice 8: alleged contraventions of the land use bylaws of the local trust committees comprising the islands

[0:17:34] Voice 8: trust the local trust committee and local trustees are not involved in any way with specific

[0:17:38] Voice 8: investigations except when the bylaw compliance and enforcement officer recommends the local

[0:17:43] Voice 8: trust committee approved to approve legal action enforcement through the court is a last resort

[0:17:50] Voice 8: to enforce bylaws this step is avoided until all other compliance attempts have not been successful

[0:17:55] Voice 8: decision to whether to approve legal action is taken in camera a meeting which is not open to

[0:18:01] Voice 8: the public and i do have copies of this for anyone that wants to could

[0:18:05] Trustee Elliott: you yeah does anyone want a

[0:18:07] Trustee Elliott: coffee for that thanks so much trustee peterson uh so this was um a great effort to lay out the

[0:18:17] Trustee Elliott: process of bylaw enforcement beyond trust and specifically on the seating and i do recognize

[0:18:25] Trustee Elliott: there are concerns in the community about a specific case that's been made public and

[0:18:33] Trustee Elliott: And the challenge is that, unfortunately,

[0:18:36] Trustee Elliott: the LTC is not able to comment directly on any submitted notice of claim

[0:18:43] Trustee Elliott: if there is legal action being undertaken,

[0:18:46] Trustee Elliott: nor can we hear from the public about a matter that is before the courts

[0:18:52] Trustee Elliott: or going before the courts.

[0:18:54] Trustee Elliott: So I just wanted to advise everybody,

[0:18:57] Trustee Elliott: thank you for that great summary of bylaw enforcement and how it works.

[0:19:01] Trustee Elliott: we can get into it more with um manager warren dingman as to the timeline and bylaw communications

[0:19:10] Trustee Elliott: to the in this particular case to the defendants regarding a requirement for rezoning

[0:19:15] Trustee Elliott: so perhaps warren if you could speak to that but just advising everybody this is not a back and

[0:19:23] Trustee Elliott: forth question and answer this is for the ltc to clarify the process but we cannot speak directly

[0:19:30] Trustee Elliott: directly about this particular case and nor can we hear from the public during the town hall so

[0:19:36] Trustee Elliott: that's why I wanted to have it ahead of the town hall just to advise you okay um is there anything

[0:19:45] Trustee Elliott: that you can add um to our understanding of this situation so

[0:19:51] Voice 2: in terms of um violent enforcement

[0:19:54] Voice 2: enforcement action on Mesquitee you have six open files with really five of those being on

[0:20:02] Voice 2: Holder and bands for one reason or another no new complaints or no reason to move forward no

[0:20:10] Voice 2: evidence to move forward on enforcement there is a 2019 file regarding a a dock in Scotty Bay

[0:20:19] Voice 2: that was installed without the rezoning or the required zoning being in place with all of your

[0:20:30] Voice 2: private docks on the skeedy and i believe there's 10 of them that are listed in the land use bylaw

[0:20:37] Voice 2: they're all permitted specifically within the land use bylaw with direct references to locations

[0:20:46] Voice 2: locations and size and BC lands file number for each of those docks. And so any new dock

[0:20:55] Voice 2: that was being installed would require a land use bylaw amendment or rezoning to specifically permit

[0:21:04] Voice 2: that dock. So there was a dock installed or it began to be installed in 2019. We received the

[0:21:12] Voice 2: written complaint about the installation of that dock and we opened a file and early 2020

[0:21:22] Voice 2: demand letter was sent to the property owner from our legal counsel after initial efforts to gain

[0:21:29] Voice 2: compliance were not successful. There was a back and forth with their legal counsel at the time and

[0:21:35] Voice 2: so the demand letter was sent when those attempts initial attempts were unsuccessful. After the

[0:21:40] Voice 2: demand letter was sent there was a rezoning application submitted for consideration by

[0:21:45] Voice 2: the previous local trust committee and they ultimately declined to proceed no further in

[0:21:51] Voice 2: the fall of 2020 as it was not consistent with the the skinny island official community plan

[0:21:59] Voice 2: and so once that rezoning application did proceeded no further there was correspondence from

[0:22:07] Voice 2: planning staff stating that it could not proceed and that the dock was still not permitted or

[0:22:13] Voice 2: unlawful there were then in 2021 another demand letter from islands trust from staff regarding

[0:22:22] Voice 2: the non-permitted or unlawful dock and that achieved no results in 2022 i spoke with the

[0:22:31] Voice 2: property owner about the dock remaining in place and the fact that it was not permitted

[0:22:37] Voice 2: And the property owner indicated that he would apply for rezoning once a new local trust committee was in place.

[0:22:46] Voice 2: There was elections in the fall of 2022, and then a new local trust committee, the current one, came into being.

[0:22:54] Voice 2: And, you know, there was still no new rezoning application.

[0:22:58] Voice 2: application so with that the the new local trust committee was asked to proceed with legal action

[0:23:05] Voice 2: and to ensure that it protected its rights and to try and gain compliance and so finally that

[0:23:13] Voice 2: claim was filed and now the two parties both have legal counsel and the property owners legal

[0:23:22] Voice 2: council is speaking with island stress legal counsel and it is before the courts and any

[0:23:28] Voice 2: claims need to be sorted out between legal counsel and ultimately the courts if necessary

[0:23:36] Voice 2: and i will add that a new rezoning application has now been forwarded to island's trust and that is

[0:23:43] Voice 2: in process and so if that is a completed application and it proceeds as per policies

[0:23:53] Voice 2: it'll be before the local trust committee for consideration and the local trust committee can

[0:23:58] Voice 2: this current trust committee can fully review the proposal to keep that doc in place and then

[0:24:06] Voice 2: depending on that decision the local trust committee will determine whether or not it

[0:24:11] Voice 2: wants to pursue its notice of claim in court for anyone who actually wishes to see that notice of

[0:24:17] Voice 2: claim it is a public document it can be obtained from the court registry you can go online

[0:24:22] Voice 2: line pay a fee and you can get your own copy of the notice of claim if you want to see specifics

[0:24:29] Voice 2: of what has been filed by islands trust and i believe

[0:24:37] Voice 9: that's the complete timeline up to this

[0:24:41] Voice 2: date i can take you know some questions if you wish thank

[0:24:47] Trustee Elliott: you warren that is that's very clear

[0:24:49] Trustee Elliott: and i appreciate you taking us through that um trustees do you have any questions just one for

[0:24:57] Voice 8: For public clarification, when was the date when a new application could have been filed, and when was that, and how long ago was that?

[0:25:12] Voice 2: I believe it's a development procedure bylaw. It requires a wait of one year. That's bylaw 35.

[0:25:19] Voice 2: And so I believe it was either October or November of 2020 that the applicant was told that the file was closed and it would proceed no further.

[0:25:34] Voice 2: So by one year later, 2021, October or November, they could have begun the process to reapply

[0:25:43] Voice 9: for

[0:25:45] Voice 2: the rezoning to make

[0:25:46] Voice 6: the dock lawful.

[0:25:48] Voice 6: Thank you for that. Okay. Well,

[0:25:59] Trustee Elliott: I appreciate that there is a large amount of community conversation going around this.

[0:26:07] Trustee Elliott: When might we expect sort of news as you say this is going through the courts and councils talking to council on both sides?

[0:26:17] Trustee Elliott: what role does the community have in sort of having their perspectives weighed let's say

[0:26:27] Trustee Elliott: on this this issue is it when a new application is made if a new application is made it goes

[0:26:34] Trustee Elliott: through a public hearing process and that will come before the LTC at a future date

[0:26:39] Trustee Elliott: yes

[0:26:42] Voice 2: if this rezoning application is complete and it proceeds on a normal timeline it'll go before

[0:26:48] Voice 2: just as the previous one did, it'll go before the LTC for consideration and they will consider

[0:26:53] Voice 2: whether or not they want to move forward with any necessary hearings and public input as far

[0:27:01] Voice 2: as whether or not, you know, the LTC and members of the community wish to see a doc, that doc

[0:27:08] Voice 2: remain in place.

[0:49:51] Voice 9: question is are you trustees responsible for this bucket because I believe you are

[0:49:57] Voice 9: and i could be wrong but you make the decisions about this committee and if you are how is it

[0:50:03] Voice 9: that you allowed the budget to be decreased so substantially despite the fact that we already

[0:50:11] Voice 9: knew you would need that money and last time i brought myself here said well you know sometimes

[0:50:35] Trustee Elliott: I would not have weighed in on that, especially as a new chair or new trustee.

[0:50:42] Trustee Elliott: Typically, we're not in all the four other LTCs plus Gabriola that I'm a part of.

[0:50:49] Trustee Elliott: um the actual spends may be over or under completely depends on how many meetings are

[0:50:57] Trustee Elliott: called how many staff come out and i think if you'll recall we had four staff attending

[0:51:04] Trustee Elliott: the january meeting or the january february or march meeting there was three or four staff

[0:51:13] Trustee Elliott: because we're in a transition from one planner to the next so the previous planner had to hand

[0:51:18] Trustee Elliott: things off we have a new regional planning manager who typically makes rounds director

[0:51:23] Trustee Elliott: all those things add up to the cost but that is not borne by listidi local taxpayers it is spread

[0:51:30] Trustee Elliott: across the whole organization because equity matters and populations with smaller tax bases

[0:51:38] Trustee Elliott: are not asked to pay for all those expenses so budgets are done to the best of their ability but

[0:51:45] Trustee Elliott: But as we've seen, it costs more to bring out staff, and that's probably why the budget was just, the actuals were higher than anticipated.

[1:17:28] Voice 4: in 2021. And then in July of this year, 2023, the LTC passed resolution 2023.08 after a staff

[1:17:40] Voice 4: memorandum which explained

[1:17:44] Voice 4: the language could be integrated. Because of the resolution,

[1:17:49] Voice 4: the current resolution, if the LTC elects to do this, we do need a resolution from the LTC in

[1:21:24] Voice 8: how uh essentially how powerless the community is in the face of the federal regulator without

[1:21:31] Voice 8: in the absence of anything it goes back to their default process which is almost no consultation

[1:21:37] Voice 8: so anyway i'm in support of this i'm happy to

[1:22:59] active work done research or have a procedure in the active updates recently on the OCP my question

[1:23:07] Voice 8: is and I know procedurally we have to put the OCP on hold and prioritize this and then once this is

[1:23:15] Voice 8: done that we would build OCP we could make it the battle priority again I'm just wondering

[1:23:21] Voice 8: um if staff has any idea about how long it might take to get this particular piece of work done

[1:23:31] Voice 8: because if it's if it's quick enough that it's not going to actually impede the ocp process

[1:23:40] i'm happy to do that but if it's going to make any significant delay into the ocp

[1:23:47] Voice 8: then I wouldn't want to do that.

[1:23:48] Voice 8: But given that we have only eight meetings a year,

[1:25:23] Voice 8: meeting procedures bylaws allowed to be finished um as a minor project because it was started

[1:25:31] Voice 8: started before the move to the major-minor project model. I'm experiencing some difficulty

[1:25:42] with the way that's set up for an

[1:25:46] Voice 8: island like Mesquitee because it's essentially the way

[1:25:49] Voice 8: that it's set up now is that we don't have a major project and we only have a minor project,

[1:25:54] Voice 8: we can only have one project um so i guess my and we've we've other than adoption we've done

[1:26:03] Voice 8: the meeting procedures by law as of today probably before you logged on but we we

[1:26:08] Voice 8: sent it off to the executive committee with those resolutions so my question is if we were to

[1:26:14] Voice 8: i just i don't want to make this a big hassle for staff procedurally to put the ocp on hold

[1:26:21] Voice 8: get this done then bring the ocp back um so i was just kind of wondering what if we can get a sense

[1:26:29] Voice 8: of uh if we decided to proceed with this which i think is a good idea the sooner the better as far

[1:26:35] Voice 8: as i'm concerned um but i wouldn't want to significantly delay the ocp project um so i'm

[1:26:42] Voice 8: just looking for some staff advice on what the timing might be like around that right so through

[1:26:49] Voice 5: So through the chair, I can't recall the details of this OCPLUV review in terms of

[1:26:56] Voice 5: the timing of the steps. But I think if that project is in a phase where it's waiting back

[1:27:06] Voice 5: for response, or there's time there that allows for us to move to the next item on

[1:27:12] Voice 5: on Liskiti's list, that can happen. So I think that would be totally reasonable to do without

[1:27:21] Voice 5: causing any delay to the OCP LUB review. I

[1:27:30] Trustee Elliott: to staff around the OCP review because it wasn't advancing. And I think we requested

[1:27:42] Trustee Elliott: requested a high level overview of the scope of the chain potential changes to the LUB that had

[1:27:53] Trustee Elliott: been drafted as a result of this community process and the APC um drafted an OCP um the amendments

[1:28:03] Trustee Elliott: so i believe work had begun but i'm not sure if the delay is because of staff capacity or

[1:28:13] Trustee Elliott: or waiting for referrals to come back and

[1:28:18] Voice 5: that's through the chair that's what i'll need to check

[1:28:20] Voice 5: back with planner bow on is where that's sitting um and if there is time because it's waiting for

[1:29:11] Planner McCargar: So he's sort of in the middle of doing a technical analysis on the OCP and he hasn't completed that process yet.

[1:29:21] Planner McCargar: but once that's completed, which I believe it's nearing the finish, then the report would go back

[1:29:27] Planner McCargar: to the LTC with his technical analysis. And I think he was also hoping to include the land use

[1:29:35] Planner McCargar: bylaw amendments that would be required as a result of the OCP changes that are being proposed.

[1:29:40] Planner McCargar: So it's a fairly large chunk of work that I know he's in the midst of, he just returned from

[1:31:48] Voice 11: regional district's going to be updating its community wildfire resilience plan and the

[1:31:54] Voice 11: previous plan didn't have much on Liskiti if anything it was mostly mainland focused so

[1:31:59] Voice 11: adding Liskiti and the other islands getting more information on the details will be very good and

[1:32:05] Voice 11: part of that is essentially a risk assessment to look at what's called wildland urban interface

[1:32:10] Voice 11: interface and there's a the information package shows a map of wildland urban interface the

[1:32:16] Voice 11: interface really refers to everywhere there's residences and businesses and structures next

[1:32:21] Voice 11: to wildfire and Liskety Island is a big part of all the wildland urban interface in the regional

[1:32:26] Voice 11: district that about half of the island is considered the WUI so that plan we'll look at

[1:32:33] Voice 11: we'll kind of quantify that a bit more and then come up with recommendations of what might be done

[1:32:38] Voice 11: to help reduce that risk and of course that may be you know providing information that might be

[1:32:44] Voice 11: useful for the island's trust and the ltc and it might also have some land use implications if

[1:32:49] Voice 11: you know if there are suggestions of what might be done to to take that into account on private

[1:32:55] Voice 11: land and crown land depending on where it is but that's the main thing i want to report on and

[1:33:01] Voice 11: glad you allowed me to say it thank you
