[0:00:17] Voice 2: I'd like to begin by acknowledging that we're fortunate to be able to gather today across the traditional territory of the Coast Salish peoples.

[0:00:26] Voice 2: this is a special meeting to consider readings of bylaw 537 and there's we will get to the agenda

[0:00:34] Voice 2: but so far thus far there's no other business on today's agenda my name is tim peterson i'm

[0:00:41] Voice 2: elected on mesquite island and i'm the chair of this local trust committee joined by trustees

[0:00:48] Voice 2: jamie harris and laura patrick and together we're the south spring island local trust committee

[0:00:54] Voice 2: Committee. With us today we have staff Sarah Sugar taking minutes, Regional Planning Manager

[0:01:02] Voice 2: Chris Hutton and Rob Pingel our Legislative Clerk. This meeting is an official forum for

[0:01:11] Voice 2: the Local Trust Committee to make decisions about land use planning matters and to discuss

[0:01:14] Voice 2: relevant business and it's also a place of employment and our staff have a right to a

[0:01:19] Voice 2: safe and respectful workplace so with that we do have an agenda um before us and i'll look to

[0:01:32] Voice 2: trustees and see if there's any changes desired to today's agenda not seeing any i will then

[0:01:43] Voice 2: take it by consent we'll adopt the agenda as presented um so we do have a section uh public

[0:01:53] Voice 2: comments section starting there at item number three and hopefully everyone's

[0:01:59] Voice 2: had a chance to look through those and the other ones we might have received

[0:02:04] Voice 2: over the last few days anything we need to know from staff's perspective mr.

[0:02:11] Voice 1: chair there was a body of correspondence that was received that should have been

[0:02:17] Voice 1: transferred to you in the in the web dev so you you've all received it and it

[0:02:23] Voice 1: It will be published in the correspondence folder on the website, similar to the correspondence

[0:02:29] Voice 1: that we received the date.

[0:02:30] Voice 1: We also just in the last hour or so received a letter from a lawyer out of Victoria representing

[0:02:38] Voice 1: a local group, wanting some clarification and indicating their interpretation of some

[0:02:49] Voice 1: of the legislation in the um regarding regarding this uh this agenda today there's nothing of great

[0:02:59] Voice 1: consequence here um except that the the two main um substantial asks here are um that bylaw uh

[0:03:09] Voice 1: number 537 be referred to first nations following a first reading uh and that if a response received

[0:03:16] Voice 1: to the referral justified moving forward with the bylaw ensure that a public hearing

[0:03:20] Voice 1: on the bylaw is duly advertised and held. As LTC at the December 14th meeting

[0:03:28] Voice 1: made its determinations to not hold a public hearing and to proceed with consideration of

[0:03:35] Voice 1: first reading today, that's where we're at pretty much with regard to the second point

[0:03:39] Voice 1: in terms of ensuring that a public hearing is held. So that letter, like the rest of the

[0:03:46] Voice 1: the correspondence will be published

[0:03:48] Voice 1: to the correspondence section of the website.

[0:03:50] Voice 1: And I believe it has been shared in the web dev

[0:03:52] Voice 1: as well with you all.

[0:04:27] Voice 1: So, Mr. Chair, in December LTC asked us to, as previously mentioned, LTC

[0:04:37] Voice 1: resolved to not hold a public hearing for the consideration of Local Trust Committee By-law

[0:04:45] Voice 1: number 537 relating to accessory dwelling units um and asked that staff proceed to schedule um

[0:04:56] Voice 1: a uh a special meeting so the report here is essentially uh we we've issued the notice we

[0:05:03] Voice 1: we modified the by advertisement twice and as well as through uh the many other communications

[0:05:09] Voice 1: channels that we use to notify of meetings,

[0:05:12] Voice 1: including social media.

[0:05:15] Voice 1: We have presented recommendations here

[0:05:17] Voice 1: that suggest that this by-law can be read up to three times,

[0:05:23] Voice 1: as well as provided a summary of how this by-law complies

[0:05:28] Voice 1: with the Island Trust Policy Statement

[0:05:31] Voice 1: and recommend that the outcome of this LTC

[0:05:37] Voice 1: does move those recommendations

[0:05:40] Voice 1: and approve that they forward this on to the executive committee for approval

[0:05:46] Voice 1: there's a there's a summary here pretty much just going through the the policy statement

[0:05:52] Voice 1: the ocp was addressed through the previous report and the the rationale is presented there

[0:05:58] Voice 1: the only alternative is to dip the bylaw and proceed no further at this time

[0:06:04] Voice 1: and that's about it the bylaw is there you will

[0:06:07] Voice 1: note a slight change in in wording usually when

[0:06:10] Voice 1: we're at this stage we're calling it a proposed bylaw so the file has not been read a first time

[0:06:14] Voice 1: so at this point it's just a draft bylaw okay

[0:06:19] Voice 2: thank you for that and before i get into questions

[0:06:22] Voice 2: from trustees i just want to i saw some attendees hands up and i just want to um let the attendees

[0:06:29] Voice 2: know that we don't have a town hall section uh scheduled in to this uh meeting today and so

[0:07:13] Trustee Patrick (probable): is considerably scaled back

[0:07:16] Trustee Patrick (probable): from what the bylaw that we had been previously considering.

[0:07:21] Trustee Patrick (probable): I know there are some concerns out there

[0:07:24] Trustee Patrick (probable): that the spot zoning is part of this process.

[0:07:27] Trustee Patrick (probable): It is not.

[0:07:28] Trustee Patrick (probable): I'm hopeful that staff will be developing

[0:07:32] Trustee Patrick (probable): a potential spot zoning pilot,

[0:07:37] Trustee Patrick (probable): but that would come separately

[0:07:39] Trustee Patrick (probable): and through its own approval process that we would see.

[0:07:43] Trustee Patrick (probable): see um uh i know that the this this version pretty close uh except it had schedule i rather than the

[0:07:55] Trustee Patrick (probable): uh reduced uh schedule m that we have uh was shared with with um um i know shared with us

[0:08:03] Trustee Patrick (probable): with the say out um a year ago january 30th a year ago and that staff in the march report

[0:08:12] Trustee Patrick (probable): had reported that, you know, the statement that's in the report says the Say Out First Nation had

[0:08:19] Trustee Patrick (probable): indicated opposition to proposed bylaw 530 citing concerns with possible environmental impact

[0:08:24] Trustee Patrick (probable): and that the bylaw as proposed is inconsistent with the living capacity per the OCP. Upon

[0:08:30] Trustee Patrick (probable): consultation with the administration of Say Out First Nation, the proposed bylaw 530 has been

[0:08:37] Trustee Patrick (probable): been revised to scale back substantially to address their concerns. So I feel comfortable that

[0:08:50] Trustee Patrick (probable): we have more than addressed concerns that were raised, and that the more permissive version

[0:09:00] Trustee Patrick (probable): of the bylaw has been referred out twice to the full list of First Nations that have

[0:09:07] Trustee Patrick (probable): have concerns as well as all agencies and so forth that have commented back. So this being

[0:09:13] Trustee Patrick (probable): a substantially scaled back version, I think we have received adequate consideration and have

[0:09:23] Trustee Patrick (probable): showed that we've taken it into account in developing this version. So I am

[0:09:30] Trustee Patrick (probable): I'm more than satisfied to move forward today with this bylaw, at least introducing the language that we need in the land use bylaw.

[0:09:42] Trustee Patrick (probable): And I'm hopeful that we will have a spot zoning process created in the future that will help us consider how to expand this, as well as the OCP conversations that will hopefully come up with permanent solutions.

[0:10:14] Voice 3: this forward today I'm I would much rather see that this go the way of

[0:10:25] Voice 3: spot zoning seem to be going getting into the murky waters no particulars

[0:10:33] Voice 3: ironed out yet i'm afraid that um this this bylaw as it is now will not um do anything to help us

[0:10:43] Voice 3: out with our housing crisis that we have going on so i proceeding any further is just wasting time

[0:10:49] Voice 3: and uh procedural time uh taxpayers dollars um i would much rather see us amend the ocp the

[0:10:57] Voice 3: housing portion of it to be in line with something along the lines of bylaw 530 in its initial form

[0:11:04] Voice 3: If a motion will be entertained, I would put forward the alternative to defeat the bylaw

[0:11:11] Voice 3: and proceed no further at this time.

[0:11:18] Voice 2: Just wanting to get a little bit of clarity, so if I'm understanding correctly, your preference

[0:13:22] Trustee Patrick (probable): confidence that we'll be able to reach a spot zoning pilot that's my reasons okay

[0:13:36] Voice 2: okay thank you for that um i'm gonna i'm uh i i had a rebuttal uh okay just a moment i was just

[0:13:47] Voice 2: gonna make a brief comment here and i'll come back i apologize i didn't know if you saw my

[0:13:51] Voice 2: hand yeah thank you um yeah that's you know electronic funness here but we'll just try and

[0:13:58] Voice 2: and be patient and um so yeah i mean i'm inclined to vote against this as well i i think that uh i

[0:14:06] Voice 2: i tend to concur with trustee patrick on this uh my sense is that um even doing our very best

[0:14:14] Voice 2: we will not be able to get um accessory dwelling units at all um started for a considerable amount

[0:14:24] Voice 2: of time and given the small nature of this the fact that it's uh not in conflict with the goals

[0:14:31] Voice 2: of the ocp um being few i my sense is it's better to um get this moving and have some uh availability

[0:14:43] Voice 2: rather than that rather than wait for the larger project so those are my comments uh over to you

[0:14:50] Voice 3: guess i would um my reply to that and to what trustee patrick had stated um is that

[0:14:59] Voice 3: in going forward with this and this form really is not going to have any impact the initial bylaw

[0:15:07] Voice 3: 530 was already such a um a drop in the bucket as to what was needed to be done that this is you

[0:15:15] Voice 3: know a much more um severe um in my view uh um you know poor use of uh staff time and taxpayers

[0:15:27] Voice 3: fairs dollars when we could actually dual vote it in a much quicker and more efficient way if we

[0:15:32] Voice 3: were just to amend the housing section of the OCP and whatever else by the proportion of the OCP to

[0:15:37] Voice 3: fit with the initial bylaw 530 which wouldn't take long as we've heard from some staff saying

[0:15:42] Voice 3: what was two months so that's why I'm wanting to proceed with this as how I have stated in the

[0:15:51] Voice 3: last motion okay

[0:18:54] Trustee Patrick (probable): always interested in the larger bylaw because I didn't think, I was pretty certain that the

[0:19:02] Trustee Patrick (probable): take-up wasn't going to be extensive because we've seen it on North Pender. We've seen secondary

[0:19:07] Trustee Patrick (probable): suites legal over the entire island. I think one has been built and Gabriola as well. Very few have

[0:19:15] Trustee Patrick (probable): have been built, but like I said, this bylaw, I believe, does provide us a step in the right

[0:19:28] Trustee Patrick (probable): direction and allows us to get on with the conversations that we need to. I think people

[0:19:37] Trustee Patrick (probable): are fatigued and tired of hearing about this conversation, and so this allows us to move on

[0:19:46] Trustee Patrick (probable): and focus on the other work.

[0:19:50] Trustee Patrick (probable): We did a survey on housing back last term.

[0:19:55] Trustee Patrick (probable): A postcard was mailed out to everybody,

[0:19:57] Trustee Patrick (probable): all mailing address.

[0:19:59] Trustee Patrick (probable): We had over 504 people respond to the survey,

[0:20:03] Trustee Patrick (probable): which was pretty darn good for Salt Spring.

[0:20:05] Trustee Patrick (probable): And we had really strong support

[0:20:08] Trustee Patrick (probable): for the different forms of accessory dwelling units,

[0:20:13] Trustee Patrick (probable): in particular the suites associated

[0:20:15] Trustee Patrick (probable): with an accessory structure. This bylaw gives us that language and introduces that.

[0:20:24] Trustee Patrick (probable): This bylaw is more than consistent with the OCP because it only applies to a subset of an area

[0:20:33] Trustee Patrick (probable): that's already approved for secondary suites. So it's providing an option for a form, but no more

[0:20:41] Trustee Patrick (probable): more than what's already envisioned and allowed by our regulations today.

[0:20:50] Trustee Patrick (probable): Right now, almost our entire secondary rental market on this island

[0:20:57] Trustee Patrick (probable): is served through illegal forms of housing,

[0:21:00] Trustee Patrick (probable): and that's just not responsible governance.

[0:21:03] Trustee Patrick (probable): We need to start providing some pathways for people to have legal housing,

[0:21:10] Trustee Patrick (probable): having to rely on a resolution that says

[0:21:12] Trustee Patrick (probable): we won't we won't enforce our regulations um and not having a path forward to like i said it's just

[0:21:20] Trustee Patrick (probable): not responsible um we've been working and talking about this for over two years and he said this at

[0:21:32] Trustee Patrick (probable): least gets the language into the land use bylaws which is some is a like i said step in the right

[0:21:39] Trustee Patrick (probable): direction. I'm very interested and hope that we can persist in working with staff to find a spot

[0:21:48] Trustee Patrick (probable): zoning pilot program. It was our staff themselves in the October staff report that had introduced

[0:21:53] Trustee Patrick (probable): this concept. And I think we should successfully be able to get there. And that would have its

[0:22:03] Trustee Patrick (probable): own decision making process. I'm absolutely confident that bylaw 537 is consistent with the

[0:22:10] Trustee Patrick (probable): with the trust policy statement as well as the OCP.

[0:22:16] Trustee Patrick (probable): And I am, like I said, I feel that the nations

[0:22:26] Trustee Patrick (probable): have had the opportunity and also all referral agencies

[0:22:29] Trustee Patrick (probable): to comment on the regulations and that we have taken

[0:22:34] Trustee Patrick (probable): their feedback into consideration with this version.

[0:22:37] Trustee Patrick (probable): version. And I think that's all I have.

[0:22:45] Voice 2: Thank you, Trustee Patrick. I'll just add that in general,

[0:22:52] Voice 2: I concur in terms of the scale of this. I think all of us will recognize that this is

[0:23:02] Voice 2: It is not the ultimate fix or solution for Salt Spring, but it is one minor part that in its present scale does have the opportunity to advance in terms of its compliance with the policy statement and the OCP and land use bylaws.

[0:23:26] Voice 2: and uh thus she shouldn't face any uh hurdles at uh executive committee approval and uh i

[0:23:36] Voice 2: hoping that uh this is just one small step um towards uh where things need to go and i

[0:23:46] Voice 2: also feel like um yes that's spent a lot of the last year on this uh we can

[0:23:54] Voice 2: and essentially get this finished up

[0:23:57] Voice 2: and move on to the other work.

[0:23:59] Voice 2: I think that'd be a positive thing.

[0:24:01] Voice 2: Trustee Harris, I see your hand.

[0:24:33] Voice 3: comments I've heard today from my fellow trustee you know I'm shocked and saddened by some of the

[0:24:41] Voice 3: language I'll continue to be against and moving forward with this today thank you

[0:36:47] Voice 1: rather than having each bylaw go to, you know, having a planner that works just for the EC to read each item brought for decision from all of these LTCs.

[0:37:01] Voice 1: Each LTC provides, you know, their staff provides the analysis and LTC concurs that and sends that along with the package.

[0:37:13] Voice 1: package. So this is sort of LTC saying, we've considered it, this is our interpretation of it,

1. CALL TO ORDER 
 
 Chair Peterson called the meeting to order at 1:34 p.m. He welcomed everyone to a Special meeting 
of the Salt Spring Island Local Trust Committee and introduced himself, the Trustees and staff. Chair 
Peterson humbly stated gratitude to live and work in Coast Salish First Nations territory.

RPM  Hutton  reported additional correspondence  items regarding  Draft Bylaw  537 – Accessory 
Dwelling  Units were  received  and would be  added  to  the  Islands  Trust  website. RPM  Hutton 
reported a letter from legal counsel regarding Draft Bylaw 537 has been received and circulated to 
Trustees.

 Section 5.2.5 change from “maybe” to “yes”;   
 Section 5.8.6 change from “yes” to “no”; and 
 Add  the  following  reason  within the  “Policy  Statement  Compliance”  section:  “The 
current  official  community  plan  and  regulatory  bylaws  do  not  address  Salt  Spring 
Island’s  projected  housing  needs to  sustain  a  healthy  community.  There  is  an 
opportunity to address this deficiency within the funded official community plan and 
land use bylaw review project. 
 
Trustee Harris expressed concerns regarding determining whether Draft Bylaw 537 is in 
compliance with the Islands Trust Policy Statement Directives Only Checklist, requested 
that the item be deferred to provide more time to consider the proposed amendments 
and requested that his comments be recorded. 
 
SS-2024-006 
It was MOVED and SECONDED, 
 To amend the motion as follows:  
 Remove “Section 5.8.6 change from “yes” to “no””; and  
 Remove  “Add the  following  reason  within  the  “Policy  Statement  Compliance” 
section: “The current official community plan and regulatory bylaws do not address 
Salt Spring Island’s projected housing needs to sustain a healthy community.  There 
is  an  opportunity  to  address  this  deficiency  within  the  funded  official  community
