[0:00:41] Voice 11: I can't be with you all, but glad that your local trustees are in the room. And just want

[0:00:49] Voice 11: to note we've got a number of staff with us today supporting electronically. So we'll

[0:00:57] Voice 11: get into introductions in a bit. But before we begin, I want to acknowledge as always

[0:01:01] Voice 11: that we are meeting in the territories of many Coast Salish First Nations

[0:01:05] Voice 11: and peoples across the Trust area.

[0:01:09] Voice 11: South Pender is located in the traditional territory of the WSATNICH

[0:01:13] Voice 11: and Tsinchatlan-speaking peoples,

[0:01:15] Voice 11: and we are always grateful to recognize

[0:01:18] Voice 11: and be in right relationship with the First Peoples

[0:01:25] Voice 11: and consider how their stewardship and knowledge can inform our decisions

[0:03:05] Voice 9: been away for the last three weeks so he couldn't prepare anything for this

[0:03:53] Trustee Evans (probable): I don't have much to say. I've been dealing with family issues so I've not

[0:03:58] Trustee Evans (probable): really had a chance to be involved in the majority of my normal work so apologies to the community

[0:04:04] Trustee Evans (probable): but I'll be back on track soon.

[0:04:09] Voice 7: I don't really have a report per se but what's kind of going

[0:04:13] Voice 7: on in my mind is wondering how we accomplish work and I'm a bit frustrated that we're not

[0:04:21] Voice 7: free to do the work that we need to do so I'll leave it vague for now sorry

[0:04:36] Voice 11: apologies I'm on a browser system and a new computer so I'm switching sometimes

[0:04:42] Voice 11: between windows it's a bit unfamiliar yes unfortunately my computer chose to

[0:04:54] Voice 11: report um but i can and it's a bit of a scramble so we are preparing for june a trust council

[0:05:03] Voice 11: quarterly meeting which will be held electronically um and so trustees will be able to join from

[0:05:11] Voice 11: wherever they are and i think for consideration on that agenda oh my gosh we just we haven't seen

[0:05:19] Voice 11: seen this yet at Executive Committee, but we did have a preview. The Trust Policy Statement,

[0:05:28] Voice 11: public comments, the What We Heard report is coming to a Committee of the Whole meeting

[0:05:35] Voice 11: on May 13th, and so all of Trust Council will be able to discuss that. There's substantial

[0:05:44] Voice 11: engagement lots of and lots and lots of feedback so it's uh taking quite some time but that's

[0:05:50] Voice 11: already on a public agenda for the may 13th meeting if the public wants to view it and see

[0:05:56] Voice 11: what the consultants have pulled together and also staff all most of the referrals as well from

[0:06:03] Voice 11: all the ltcs and the other referral agencies are included in that report it's about 300 pages

[0:06:08] Voice 11: so lots of reading and the next steps will likely be debated at June Trust

[0:06:15] Voice 11: Council meeting so that's pretty much the substantial work before us I think

[0:06:24] Voice 11: I'll leave it there if anybody has any questions about executive committee work

[0:06:28] Voice 11: you can always reach out to me so we don't have an electoral area directors

[0:06:35] Voice 11: report so we'll move into our public participation periods forgive me I'm

[0:06:44] Voice 11: just going to need a bit of a script before we go into it in light of sort of

[0:06:53] Voice 11: public discourse in in British Columbia generally right now we are we've revised

[0:07:02] Voice 11: revised our standards or our expectations for public comment during our meetings.

[0:07:10] Voice 11: There's nothing about what has happened in South Pender that's given rise to that, but I do have a

[0:07:15] Voice 11: bit of a script that, if you'll bear with me, I'm going to read through just so that we are all on

[0:07:20] Voice 11: the same page for our LTCs. As chair, together with our local trustees, it is my responsibility

[0:07:27] Voice 11: to ensure that this meeting is a respectful, inclusive, and culturally safe space for staff,

[0:07:34] Voice 11: trustees, and all attendees, including those who may be watching online. So our standards are that

[0:07:40] Voice 11: we will speak respectfully. There's no place in our meetings for racism, stereotypes, or comments

[0:07:45] Voice 11: that target Indigenous peoples or any other individuals or groups in our community. Second,

[0:07:51] Voice 11: Second, we will acknowledge concerns without causing harm.

[0:07:54] Voice 11: Residents are absolutely entitled to ask questions and express uncertainty.

[0:07:59] Voice 11: Indigenous community members are equally entitled to share their experiences and expectations of respectful partnership.

[0:08:06] Voice 11: Both can occur here without harm, dismissal or targeting.

[0:08:11] Voice 11: Third, we will uphold cultural safety.

[0:08:14] Voice 11: We recognize that public processes have not always felt fair or safe or welcoming.

[0:08:21] Voice 11: for Indigenous peoples, and we are committed to doing better. That includes giving space to

[0:08:27] Voice 11: Indigenous voices, being mindful of how language affects people, and addressing harmful comments

[0:08:33] Voice 11: if they arise. And finally, we'll keep our conversation constructive. Every participant

[0:08:40] Voice 11: brings valuable perspectives, lived experience and knowledge. All voices deserve to be heard

[0:08:45] Voice 11: and heard respectfully. So our expectations for public comment, we ask you to direct your

[0:08:53] Voice 11: comments to the committee, not to staff or to the audience. We can ask questions of staff if we need

[0:08:58] Voice 11: clarification or request that staff answer a question. Please speak to issues not about

[0:09:05] Voice 11: individuals. Be clear, concise and respectful and refrain from clapping, wooing or other

[0:09:11] Voice 11: disruptions i know that's not an issue here um so please if you wish to address the local trust

[0:09:17] Voice 11: committee uh raise your hand and i'll have the trustees in the room keep a um list of speakers

[0:09:25] Voice 11: and please state your first and last name and the topic that you wish to address okay

[0:09:31] Voice 13: so i had

[0:09:41] Voice 5: I have a question and just wondering what's going on with the agenda we had at our last

[0:09:50] Voice 5: meeting discuss the short-term vacation rental issue it's been on our books for quite some

[0:09:54] Voice 5: time and I see it's totally absent in the agenda so and it seems odd that we would leave

[0:10:01] Voice 5: the project in the midst of the discussion so just going back and reviewing what was going on

[0:10:06] Voice 13: I

[0:10:06] Voice 5: know at the meeting of May 2nd 2005 there was a motion passed by our trustees to

[0:10:16] Voice 5: remove the short-term rental policy and regulations from the future project report to the active

[0:10:23] Voice 5: project and to they asked staff to report back with options for short-term vacation rental

[0:10:29] Voice 5: policies and regulated the minor project draft project chart that was made 2005 2025 sorry then

[0:10:38] Voice 5: next meeting september 25th 2025 on the works project program report there was a staff

[0:10:49] Voice 5: planner reported that the community information meeting and public hearing mark the final stages

[0:10:55] Voice 5: of land use by a minor project and that staff have provided a draft project charter for short-term

[0:11:01] Voice 5: vacation rentals to the local trust committee that was september 2005. the december meeting

[0:11:07] Voice 5: i think it was supposed to be discussed on there but there uh was not discussed if i'm uh i think

[0:11:14] Voice 5: it didn't make it i can't remember the reason uh why but also i think what happened there was some

[0:11:20] Voice 5: When the strike came on, two months of strike with staff not being available, I think that nothing happened at that meeting.

[0:11:30] Voice 5: But finally, it came back onto the meeting agenda in February.

[0:11:34] Voice 5: And if you look at the minutes that you'll be discussing today, there's quite a lengthy report of what was going on and some of the options with that.

[0:11:43] Voice 5: So we had expected, at least I had expected, because it affects me and a few of others who are in this room, that this is a project that we think needs to be completed.

[0:11:53] Voice 5: And we don't understand why it's totally, at least I don't understand why it's totally disappeared.

[0:12:00] Voice 5: And it's not put on the agenda.

[0:12:02] Voice 5: There's got to be some discussion here.

[0:12:04] Voice 5: And I don't know if that's a discussion you're talking about later.

[0:12:06] Voice 5: But very odd process here.

[0:12:10] Voice 5: And really, I can say at this point, I just find it highly unusual that we're in this kind of situation when we have one project left that they've been on the books for some time.

[0:12:21] Voice 5: Our trustees are interested in pursuing that project.

[0:12:24] Voice 5: They have budget left for it.

[0:12:26] Voice 5: Half budget was left to discuss this project.

[0:12:29] Voice 5: And all of a sudden, it's disappeared into thin air.

[0:12:33] Voice 5: We need an explanation.

[0:12:38] Trustee Evans (probable): That will be the translation.

[0:12:40] Voice 11: Yes, thank you.

[0:12:41] Voice 11: will be discussing that at 17.2, the work

[0:12:45] Voice 11: for the rest of the year. So thank you for those comments, Ms. Perch.

[0:12:50] Voice 11: And is there anybody else who wishes to address us?

[0:12:58] Voice 4: I'm just wondering what the plan is for the

[0:13:03] Voice 4: beach access, which they use to build

[0:13:06] Voice 4: the dip, which is beautiful, by the way.

[0:13:11] Voice 4: what is the agenda for doing something with that or leaving it or so everybody know with what

[0:13:21] Voice 7: i missed what what do you want

[0:13:24] Voice 4: it's the the uh took out the well

[0:13:27] Voice 7: the barge dog or whatever

[0:13:32] Trustee Evans (probable): believe that's outside of our jurisdiction

[0:13:34] Trustee Evans (probable): so we can't do anything with that ourselves that is with the ministry of transportation

[0:13:41] Trustee Evans (probable): but as i understand it because it's only accessible during a king high tide that it's

[0:13:51] Trustee Evans (probable): not usable no

[0:13:52] Voice 4: it's not usable i just want to tell you i heard when they were doing it they

[0:13:56] Voice 4: were going to it's not being used for me and that is my beloved street so

[0:14:04] Voice 7: um we are allowed to

[0:14:08] Voice 7: advocate to other agencies so it would be helpful for us to know what your position is what would

[0:14:14] Voice 7: you like to see there well

[0:14:17] Voice 4: it i can remember when they we had parks board come and they put in that

[0:14:22] Voice 4: beach access there was i think eight of us on the street there at that time and we we didn't really

[0:14:30] Voice 4: want it there there was no point in putting it there there was no beach down there it's not like

[0:14:35] Voice 4: the one i have beside my house which is the dry rocks there beautiful but there was absolutely

[0:14:44] Voice 4: probably dangerous and but no they have the money and they put it in and there you go so you would

[0:14:53] Voice 7: like to have it decommissioned is that well

[0:14:56] Voice 4: i mean it's just a gravel driveway there now with a

[0:14:59] Voice 4: a yellow gate across it, so

[0:15:01] Voice 4: I mean, is it going to stay

[0:15:03] Voice 4: there for the rest of time?

[0:15:30] Voice 7: they may not listen to us but you know if we have an opportunity we will speak up thanks

[0:15:39] Voice 3: john karchuk um so we didn't do our official beach cleanup this year

[0:15:44] Voice 3: lots of us do unofficial people and it's almost one area that's uh warranted uh the summer season

[0:15:57] Trustee Evans (probable): that is uh not uh um a trustee issue that's

[0:16:01] Trustee Evans (probable): something that I personally organize. I've been dealing with family issues this year so I haven't

[0:17:04] Voice 6: My respect to First Nations and my thank you to Trustee Evans for doing all the work.

[0:17:12] Voice 6: Trustee Faulk had proposed a wonderful idea at the beginning. It's too bad it didn't happen

[0:17:17] Voice 6: because of time, but you had proposed a group solar energy effort. And I hope that the elements

[0:17:29] Voice 6: that have occurred in the past four years

[0:17:30] Voice 6: have not discouraged you to continue that effort.

[0:17:33] Voice 6: And Trustee Elliott, my admiration

[0:17:35] Voice 6: for your small house home efforts.

[0:17:40] Voice 6: I think it will resolve a lot of poverty issues.

[0:17:45] Voice 6: And I think as a group,

[0:17:48] Voice 6: there's a lot of things that stresses the population.

[0:17:53] Voice 6: information, and when I hear, you know, short-term rental issues, I feel that it really is not

[0:18:07] Voice 6: worth it to take away from people what they had to give them a way to live.

[0:18:11] Voice 6: I don't think that it should be pursued for new people who come back, but the people who

[0:18:17] Voice 6: have been here for a year and have made a living off that, we don't want more.

[0:18:21] Voice 6: And so I think that we should focus our energy into welcoming First Nations with new ideas.

[0:18:37] Voice 6: The solar idea was an excellent one, and we need a provider for that.

[0:18:42] Voice 6: Freshwater or rainwater treatment is another excellent idea, and we need a provider for that.

[0:18:49] Voice 6: And so there's room for new businesses, there's room for new providers that we all share as a community, rather than each having our own already very rich businesses.

[0:19:03] Voice 6: businesses um there's um you know more serious money into the salish sea with regards to fishing

[0:19:13] Voice 6: licenses and whatever that are more allocated to overly rich people rather than our first nations

[0:19:22] Voice 6: and i think that's something that we should have time to put a letter into our government

[0:19:31] Voice 6: So there are other things to do to really welcome First Nations on board.

[0:19:37] Voice 6: I think small, tiny homes have minimum impact on the ground.

[0:19:46] Voice 6: We know that it's not the trees that stay above us, really,

[0:19:51] Voice 6: but mostly the food in the ground and the way that the trees connect to the ground.

[0:19:58] Voice 6: And so by, you know, opening our minds to all these parties that provide First Nations a lot of opportunities, it also allows us to leave what most of us have worked 30, 40 years of our lives very hard to put together.

[0:20:20] Voice 6: And so I don't think anything should be taken away.

[0:20:24] Voice 6: There is a report that came out of the survey for the policy statement, and this is a plea

[0:20:38] Voice 6: for staff to reconsider how they accepted that report.

[0:20:45] Voice 6: The report represents the voice of 2,000 people, which is not innocuous, but not 30,000 people

[0:20:54] Voice 6: And there is a content warning in it that this report includes material that may be distressing, particularly for Indigenous readers, as it summarizes public feedback that contains anti-Indigenous racism.

[0:21:09] Voice 6: Just to tell you my experience, I'm obviously a mixed person.

[0:21:15] Voice 6: in 300 years, and, you know, four years ago, trying to be a treetop pilot in a man's world.

[0:21:29] Voice 6: I've met with discrimination. I know what it's like. It's nothing to ignore. But if we write it

[0:21:40] Voice 6: in reports like this, we perpetuate the problem. We need to focus on the positive that we have

[0:21:48] Voice 6: managed to share together and um you know the trustees have been great in meetings at highlighting

[0:21:54] Voice 6: the positive little steps that have happened and i don't think statements like that should

[0:22:00] Voice 6: have been entered in such a report by staff if if if i may say that okay

[0:22:06] Voice 11: so may i may i just um

[0:22:08] Voice 11: pause for a moment here ma'am um the trustees have not had a chance to discuss that report

[0:22:16] Voice 11: And this local trust committee is not really the place to debate it. You have expressed your views about a staff report that has not yet been considered by council. And so perhaps you could direct your comments to trustees through email if you want them to convey a certain message.

[0:22:39] Voice 11: but this is not really something under the local trust committee's jurisdiction this is a broader

[0:22:44] Voice 11: trust council issue that we still have yet to discuss so if we can thank you for your comments

[0:22:52] Voice 11: and ask that you connect directly with your trustees if you have sort of a position that

[0:22:58] Voice 11: you'd request that they advance at that body i'm

[0:23:02] Trustee Evans (probable): just going to if i can i'm just going to explain

[0:23:04] Trustee Evans (probable): think is there are new residents here as well. So the way that our government is, or the way that

[0:23:10] Trustee Evans (probable): we operate and govern, is we have our local trust committee here, which consists of the two locally

[0:23:17] Trustee Evans (probable): elected and the chair. And then we have trust council body, which deals with the greater

[0:23:21] Trustee Evans (probable): federated business of all of the trust area. And that belongs at the trust council level.

[0:23:28] Trustee Evans (probable): While we're in this room, we're here to debate South Pender land use bylaw issues.

[0:23:35] Trustee Evans (probable): Anything else outside of this, please feel free to contact us after the meeting or in person or any other way.

[0:23:44] Trustee Evans (probable): We can take that as a member of Trust Council for the Trust Council meeting.

[0:23:56] Voice 7: And we were considering whether our local trust committee should support the policy statement at our last meeting, and we said we wouldn't.

[0:24:08] Voice 7: And we used comments such as yours, written comments from others, as kind of part of the rationale for why we felt it wasn't right to support it at this point.

[0:24:21] Voice 7: We can't get that information unless you come to us with it.

[0:24:25] Voice 7: So please, I appreciate you bringing it here.

[0:24:28] Voice 7: I think it is appropriate.

[0:24:30] Trustee Evans (probable): But that was part of the referral process, which we have now.

[0:24:34] Voice 11: Yeah, and it's about not re-debating a question that's already been considered by the body

[0:24:39] Voice 11: and you've already rendered a decision.

[0:24:41] Voice 11: So I don't think there's anything further that we need to consider right now, but you

[0:24:47] Voice 11: can certainly take this from constituents and have your own meetings and bring those

[0:24:52] Voice 11: perspectives to council.

[0:25:12] Voice 15: vacation rental I've been renting since 2004 and I bring a lot of money and a lot of people

[0:25:22] Voice 15: that come here and and make them so happy and they just think south pender is the greatest place to

[0:25:29] Voice 15: be and to take that opportunity away is um is disrespectful to uh to the whole island and to

[0:34:14] Voice 1: sign at the T-junction, which the Chamber of Commerce

[0:34:18] Voice 1: added to, so it now also says, in addition to welcome to Pender Island, it says Steas,

[0:34:30] Voice 1: recognizing the Sunchop and name for our island, and Iquan Stachel, which means we are glad that

[0:34:37] Voice 1: you have arrived. And then on the grounds of the community hall, there's a three-panel

[0:34:44] Voice 1: installation it's been up for a few weeks now but it was officially unveiled yesterday

[0:34:50] Voice 1: um and there were oh probably uh 20 or so people from wasanich including parents teachers

[0:35:03] Voice 1: uh school children and um teachers and school children from the pender island school

[0:35:11] Voice 1: were also present so they got a chance to meet each other and then there was a large section

[0:35:18] Voice 1: of the community that put on pretty good lunch I have to say for about 60 people

[0:35:25] Voice 1: and so I was very happy to be a part of organizing that on the NHS revitalization

[0:35:37] Voice 1: project and also as a member of the Pender Island State's Truth and Reconciliation Circle.

[0:35:48] Voice 1: What we witnessed there was the welcoming back to their original homeland for some of

[0:35:59] Voice 1: the people who now are living on reserves on the Saanich Peninsula and a recognition

[0:36:07] Voice 1: that their responsibility to care for their island

[0:36:12] Voice 1: on lands has been restricted and we are looking for ways to support their

[0:36:22] Voice 1: presence here in terms of how they used to relate to the island which was

[0:36:27] Voice 1: through hunting fishing and gathering food and medicines as formerly and which

[0:36:34] Voice 1: is protected under the Douglas treaty rights. What happened was some very wonderful performances

[0:36:44] Voice 1: of the Pender Island children with their teacher Ben McConkey played guitars and sang and

[0:36:51] Voice 1: the children from the Wissanich school danced and drummed. The teachers who were supposed to

[0:37:01] Voice 1: come with them were ill and so parents came and they did the singing and drumming and you know it

[0:37:09] Voice 1: was just it was just very lovely and some of the elders were there and they spoke told stories for

[0:37:21] Voice 1: the children and the chamber of commerce people were also there and they videoed the whole thing

[0:37:31] Voice 1: So at some point, hopefully, the community will be able to see that video.

[0:37:37] Voice 1: The important thing about witnessing something like this, it's a privilege to witness a significantly historical event like this.

[0:37:49] Voice 1: But with it goes a responsibility, and that responsibility is to tell other people about what took place there.

[0:37:59] Voice 1: And so I've just got something very brief here today, which I will just read quickly.

[0:38:12] Voice 1: On May 7th, the Wissanage Elders Council returned to their stay as homeland for an important cultural event, the unveiling of the three-panel installation at the Pender Community Hall.

[0:38:23] Voice 1: Hall. The three panels illustrate the cultural roots of the Musanerj people in Kleklatjes,

[0:38:30] Voice 1: the Southern Gulf Islands, and speaks to some of the important truths that precede reconciliation.

[0:38:37] Voice 1: The event also included recognition of the Newsday's welcome sign at the T-Junction.

[0:38:44] Voice 1: Seattle Hereditary Chief Eric Kalki welcomed the large gathering at a midday feast at the

[0:38:51] Voice 1: the community hall, catered by the Procletus Reconciliation Team and the Sabeas Truth and

[0:38:57] Voice 1: Reconciliation Circle. The unveiling was preceded by a traditional blessing in St. Jonathan from

[0:39:04] Voice 1: Elder John Elliot Jacinton, and followed by a cultural dance and song presentation by students

[0:39:10] Voice 1: from the Favela New Tribal School. The Pender Grade 3-4 students also participated in the program.

[0:39:18] Voice 1: Saoud elder Belinda Claxton, Celilia, explained the importance of building respectful relationships between our communities.

[0:39:29] Voice 1: Celilia shared an important traditional story for the youth of the importance of respect for nature that nourishes us all.

[0:39:38] Voice 1: all. Project coordinator Peter Paré introduced artist Addie Elliott, who shared some of the

[0:39:45] Voice 1: inspiration that went into the creation of the panels, and it speaks to the importance of salmon

[0:39:55] Voice 1: in their lives. This project was supported by a grant from the Real Estate Foundation of BC

[0:40:04] Voice 1: and additional support from the Victoria Foundation

[0:40:07] Voice 1: and the Pender Chamber of Commerce.

[0:40:11] Voice 1: The project is one of a series of cultural installations on Steyas

[0:40:15] Voice 1: to illustrate the important cultural history of the Steynish people

[0:40:19] Voice 1: in their traditional unceded homeland.

[0:41:25] Voice 11: staff like working with the staff is just it's one of the joys of of my work here at islands trust

[0:41:31] Voice 11: All the letters have gone out to First Nations in the Trust area.

[0:41:37] Voice 11: I believe it was February, inviting engagement on the Conservancy's five-year plan, which is a statutory obligation.

[0:41:47] Voice 11: We must return a plan to the Minister of Municipal Affairs and Housing by December 2027.

[0:41:56] Voice 11: seven so this has been a long-awaited project and we are on the way so we have

[0:42:05] Voice 11: had some responses from about five First Nations wanting to engage and further

[0:42:13] Voice 11: that want more information and so this is really going to shape how

[0:42:21] Voice 11: how conservation is undertaken in the Trust Area in the future.

[0:42:26] Voice 11: The Minister has asked us to engage on the philosophy of conservation

[0:42:30] Voice 11: and embedding Indigenous knowledge and Indigenous perspectives

[0:42:35] Voice 11: and cultural heritage as part of the unique attributes

[0:42:42] Voice 11: that are to be protected through our Nature Conservancy Program.

[0:42:47] Voice 11: That's a really big focus.

[0:42:49] Voice 11: So I want to commend staff for their very careful and diligent and enthusiastic approach to this work.

[0:42:57] Voice 11: It's going to be really wonderful to see how the conversation shapes conservation in the future.

[0:45:29] Voice 9: rental project was placed on the project list last year, at which point the LTC directed

[0:45:39] Voice 9: staff to bring forward a project charter. The project charter, if I'm not mistaken,

[0:45:47] Voice 9: and I don't have it in front of me, but please put your hand up if this information is incorrect,

[0:45:55] Voice 9: but was placed on the September 2025 agenda. But unfortunately, due to time constraints,

[0:46:03] Voice 9: the LTC could not get to that item. And the intention was that the short-term vacation

[0:46:09] Voice 9: rental reviewing that draft project charter would be moved to the November LTC meeting.

[0:46:17] Voice 9: Due to the BCGAU strike, unfortunately, a number of LTC meetings had to be cancelled,

[0:46:24] Voice 9: and one of those was the South Pender November LTC meeting.

[0:46:31] Voice 9: A special meeting was scheduled for South Pender, but that was strictly just to discuss the policy statement.

[0:46:39] Voice 9: So ultimately, for 2025, the draft project charter for the short-term vacation rental project was not reviewed by the LTC, nor were there any decisions, unfortunately, due to time constraints and then the BCGAU strike.

[0:46:57] Voice 9: Staff brought forward a staff report to the February meeting of this year, and direction from staff was to proceed no further with this project based on recommendations from the Director of Planning Services and the CAO from the Trust Council in December.

[0:47:17] Voice 9: At the February meeting, the LTC gave direction to staff to still request a budget consideration for this project, and that to be directed to the CAO and to the director for special permission to move forward with this project.

[0:47:36] Voice 9: project. The LTC did receive an email from the Director of Planning Services and after

[0:47:43] Voice 9: discussion with the CAO, the Director mentioned that staff are not approving resources for

[0:47:52] Voice 9: this project to move forward for the fiscal of 2026-2027. So at this point, without approval

[0:48:00] Voice 9: of resources and budget, staff are recommending...

[0:48:03] Voice 9: Can I interrupt?

So the newly elected LTC can review this and then make a decision on which project they'd like to move forward with in the next fiscal.

[0:49:31] Trustee Evans (probable): out of your report there. At the December Trust Council meeting, a motion was made based on a

[0:49:51] Trustee Evans (probable): initiate any new projects going forward for this fiscal year because there were too many projects

[0:49:58] Trustee Evans (probable): and staff were there was not enough staff resources to complete all the projects that were

[0:50:05] Trustee Evans (probable): on so this is a way to identify and prioritize the projects through trust council that need to

[0:50:11] Trustee Evans (probable): get completed by the end of this term that with that motion going forward it is to free up staff

[0:50:21] Trustee Evans (probable): resources during an election year because staff resources get used significantly during that

[0:50:27] Trustee Evans (probable): period. These were some of the reasonings behind it. And I'm just going to sort of like, I see

[0:50:36] Trustee Evans (probable): Toby Elliott's got her hand up. So I'll let you fill in some of the blanks here. And I'm trying

[0:50:41] Trustee Evans (probable): to just keep this at the higher level before I get into my items. Yeah,

[0:50:55] Voice 11: a minor project ltcs of course can request and through the project charter it's endorsed the

[0:51:07] Voice 11: for approval it's it's usually resourcing that is the challenge um and that's simply because we

[0:51:14] Voice 11: We share planners across the trust area.

[0:51:16] Voice 11: We share, it's not that, you know,

[0:51:20] Voice 11: the South Pender planner is only working

[0:51:22] Voice 11: on South Pender projects.

[0:51:23] Voice 11: She has a number of other projects to do.

[0:51:26] Voice 11: And as chair, I've seen how this plays out

[0:51:29] Voice 11: in actually much larger projects as well.

[0:51:31] Voice 11: There was an example, Liskiti Island,

[0:51:35] Voice 11: they had a significant major project

[0:51:37] Voice 11: of an OCP review that they've been waiting for.

[0:51:40] Voice 11: It's been almost one and a half terms

[0:51:42] Voice 11: forms to start. There was budget allocated in 2025-26, with the understanding that it could

[0:51:52] Voice 11: only start once another major project had concluded. And because of timing of the staff,

[0:52:00] Voice 11: sorry, not the staff, the BCGEU strike, that has really impacted a lot of the work and pushed a lot

[0:52:08] Voice 11: of projects much later and impacted sort of the sequencing. So for the example that I used the

[0:52:16] Voice 11: LISC-ED major OCP review was not even able to be started even though there was budget allocated

[0:52:22] Voice 11: last year and so that's an example of we just don't have the staff resources to accomplish

[0:52:28] Voice 11: everything and it is up to the director's discretion and the CAO to allocate staff

[0:52:33] Voice 11: resources to where they are needed. And so, and again, with the Trust Council direction to not

[0:52:40] Voice 11: start any new work, this project was deemed as new work. So there's a number of factors that

[0:52:47] Voice 11: unfortunately has contributed to this. And I'm really sensitive to, you know, the fact that this

[0:52:53] Voice 11: is very much needed by the South Penner community and desired. But I do want to point out that there

[0:52:58] Voice 11: there is a system that exists through the temporary use permit system.

[0:53:04] Voice 11: So it's not a great place to land in to have a standing resolution

[0:53:10] Voice 11: not to enforce on these existing STVRs.

[1:05:00] Voice 9: of notices or legislative requirements, like a notice of forced reading, the meeting coordinator

[1:05:06] Voice 9: who has to then schedule their time, the minute taker or a planning team assistant. So there are

[1:05:13] Voice 9: are many other factors or resources beyond just the planners. In terms of budget, when we're

[1:05:19] Voice 9: working for a budget for a project, we're looking at the meeting costs for, say, like a special

[1:05:25] Voice 9: meeting, hall costs, meeting, or pardon me, costs for the notice of first reading, or a public

[1:05:34] Voice 9: hearing, or any other community information meeting. So that's the answer in terms of the

[1:05:39] Voice 9: the budgetary requirements. I understand that Trustee Evans, you have a kind of a clear path

[1:05:47] Voice 9: of how to solve the problem, which certainly could be the solution. But there's also with

[1:05:52] Voice 9: any project, you have to build in the public course, not the correspondence, but the public

[1:06:00] Voice 9: engagement process as well. So although there may be a clear path the LTC may have, we still have

[1:06:06] Voice 9: have to build in and i'm sure you would agree with those engagement pieces as well so that does

[1:07:37] Voice 9: this LTC is actually we'll have plenty of time to do that but I just wanted to say that I

[1:07:44] Voice 9: understand and I hear your frustration with how this project kind of got stuck if you will so

[1:31:18] Voice 11: this is a priority enforcement issue we want you to prioritize this in the gabriella local trust

[1:31:25] Voice 11: area it's illegal short-term vacation rentals that do not have a tup that's a problem here

[1:31:33] Voice 11: the ltc can also give direction to not enforce in this area or to bring those you know if there's

[1:31:40] Voice 11: two complaints so we can actually finesse and maybe this is a consideration for next meeting

[1:31:45] Voice 11: Look at that standing resolution again, see if it meets the LTC's needs, and maybe do some public communications, send that, you know, ask staff to do a write up of what the standing resolution is and bylaw enforcement's interpretation of that, so that those operators have the assurance, this is not going to be an issue.

[1:32:15] Voice 11: complaints where there's health and safety issues. So that's

[1:32:47] Trustee Evans (probable): vacation rentals validly operating as of April 30th 2024 when that regulation came into effect

[1:32:54] Trustee Evans (probable): and that enforcement on any short-term vacation rental be by written complaint only so there has

[1:33:01] Trustee Evans (probable): to be a written complaint and then that gets deferred so if there is a written complaint

[1:33:09] Trustee Evans (probable): it is deferred and not enforced upon yep

[1:43:10] Voice 11: all need to be protected and there's significant cultural and archaeological um assets and material

[1:43:18] Voice 11: that is is largely concentrated on the shoreline so it's much larger than the south pender ltc i'm

[1:43:24] Voice 11: hoping that it can be a major project through something like regional planning committee

[1:43:28] Voice 11: because it affects everyone in the trust area and we need to have a coherence in how we handle

[1:43:35] Voice 11: handle applications, how those are referred, what kind of information is needed.

[1:43:39] Voice 11: But I think as it stands, there's no structures allowed in the setback.

7. PUBLIC PARTICIPATION PERIOD 
A member of the public noted the short-term rental project was moved from the Future 
Projects list to the Active Projects list in May 2025, appeared on the September 2025 
agenda but was deferred, and was discussed at the February, 2026 meeting; however, it is 
now absent from the agenda.  
A Trustee noted the matter will be discussed later in the agenda. 
A member of the public asked what the plan is for the beach access at the Dip. 
A Trustee replied the matter is not within their jurisdiction; however, there is 
potential to advocate for remediation of the area if an opportunity arrives. 
A member of the public asked if an official beach clean up would occur this year. 
A Trustee stated the clean up is not organized by the Local Trust Committee, but by a 
trustee in their capacity as a community member and they had not had time to 
organize it this year. 
A member of the public spoke to the importance of focussing on new businesses and issues 
to support First Nations and spoke to the staff report regarding feedback on the draft Trust 
Policy Statement. 
Three members of the public spoke in support of short-term vacation rentals that provide 
accommodations for visitors.

feast to celebrate the installation of a three-panel piece illustrating the cultural

17. NEW BUSINESS 
17.1 2025/26 Annual Report - Request for Decision 
SP-2026-021

that South Pender Island Local Trust Committee approves the attached text 
for inclusion in the 2025/26 Annual Report for approval by Trust Council and 
submission to the Minister of Housing and Municipal Affairs.

17.2 South Pender Work Program for 2026/2027 – Discussion 
Island Planner Stockdill provided a summary of the activity regarding the Short-Term 
Vacation Rental minor project to date and highlighted the following: 
• The project was moved from the Future Projects list to the Active Projects list in 
2025 at which time the Local Trust Committee directed staff to bring forward a 
Project Charter 
• The Project Charter was placed on the September, 2025 agenda but was 
deferred due to time constraints and the intention was to move the item to the 
November, 2025 meeting 
• The November, 2025 meeting was cancelled due to the British Columbia 
General Employees’ Union (BCGEU) strike 
• A Special Meeting was held in December, 2025 to discuss the draft Trust Policy 
Statement 
• A staff report was brought forward at the February, 2026 meeting with a 
recommendation to proceed no further based on a decision of Trust Council to 
not provide budget to initiate any new work for the period ending March, 2027 
• The Local Trust Committee gave direction to staff to request the project move 
forward 
• The Director of Planning Services denied the project request based on the 
decision of Trust Council and limited staff resources 
• The Local Trust Committee can move the project back to the Future Projects list 
for consideration of the next Local Trust Committee 
Discussion ensued and the following comments were noted: 
• It is not automatically assumed that every Local Trust Committee will have a 
minor project 
• There are other Local Trust Committees that have not had a major or minor 
project this term or have completed their work and don’t have any on the table

• A project is scoped through the Local Trust Committee and then goes back for 
approval and is approved, or not, based on staff capacity 
• The BCGEU strike has impacted sequencing of projects and it is up to the 
Director of Planning Services and Chief Administrative Officer to allocate staff 
resources 
• The Local Trust Committee understands and supports the reasoning and 
process but believes considerations need to be taken when no work is on the 
table 
• The matter will continue to be pursued as a Trustee does not believe a locally 
elected group can be told they can not do any work at all 
• There is a standing resolution to defer bylaw enforcement on legally operating 
short-term vacation rentals and a system to operate through a Temporary Use 
Permit 
• Trustees will gage community interest in the suggestion that the Bylaw 
Compliance and Enforcement manager speak to this issue at the next meeting 
• The Planner detailed the various staff resources that are required for project 
work 
• The Planner indicated in the first four months of a term, staff bring back the 
Future Project list and discussion occurs regarding what direction the new Local 
Trust Committee would like to proceed with before any work begins 
SP-2026-022 
It was MOVED and SECONDED 
that South Pender Island Local Trust Committee considers that the 
proposed minor project, in a reduced scope, to amend the Land Use Bylaw 
to permit those legally operated short-term vacation rentals prior to 
November 5, 2021 is considered critical and request that, if staff resourcing 
becomes available, that the project be reconsidered.

It was reiterated that the standing resolution regarding the deferment of bylaw 
enforcement on short-term vacation rentals stands for those that are legally 
operating as of April, 2024.  
18. UPCOMING MEETINGS 
18.1 Next Regular Meeting Scheduled for August 28, 2026 at the Fire Hall, Pender 
Island 
19. PUBLIC PARTICIPATION PERIOD  
A member of the public expressed that the explanation of limited staff does not make 
sense, significant taxes are paid for land use planning services, and they are disappointed 
that the minor project is not moving forward.  
A member of the public asked if there is any work for the Advisory Planning Commission and 
a Trustee replied not at this time. 
A member of the public asked if the Advisory Planning Commission has any input regarding 
the seawall issue when other organizations are involved and the Local Trust Committee 
explained the process and purpose of the Commission.

A member of the public stated Trustees might wish to consider policy with regard to 
shoreline infrastructure that isn’t currently addressed in the Land Use Bylaw. 
A Trustee responded that our current bylaws address this issue and no additional policy is 
required.
