[0:04:58] Trustee Stamford (probable): West Bay, and Gambier Harbor.

[0:05:03] Trustee Stamford (probable): Eastbourne Community Water System is being moved to Stage 3

[0:05:08] Trustee Stamford (probable): water restrictions.

[0:05:10] Trustee Stamford (probable): Although that community is used to having the Eastbourne and Zonkitz,

[0:05:15] Trustee Stamford (probable): although that community is used to having water restrictions I suspect this is earlier than normal

[0:05:22] Trustee Stamford (probable): and I'm just trying to find out a bit more they have been informed as a

[0:05:30] Trustee Stamford (probable): service service they have a service with the regional district so they have been informed

[0:05:38] Trustee Stamford (probable): as individuals as part of that function that's coming into effect um i'm just uh one of the new

[0:05:47] Trustee Stamford (probable): things that's happening on the sunshine coast is uh government response to the lack of fairy

[0:05:55] Trustee Stamford (probable): advisory committees has come up the gibsons um community of gibsons has come up with a standing

[0:06:02] Trustee Stamford (probable): committee for a way of responding to Route 3.

[0:06:06] Trustee Stamford (probable): So I've joined that, partly because Route 13 doesn't have a ferry advisory committee

[0:06:12] Trustee Stamford (probable): anymore, and I want to focus on the parking, access to the terminal, anything to do with

[0:06:18] Trustee Stamford (probable): the terminal, and anything to do with other connecting routes to Route 3, including Route

[0:06:24] Trustee Stamford (probable): 13 and Route 7.

[0:06:26] Trustee Stamford (probable): So I'm hoping to get more traction on that.

[0:06:29] Trustee Stamford (probable): It's a way of bringing ideas together for how to move ahead with the ongoing

[0:06:35] Trustee Stamford (probable): BC Ferries debacle.

[0:06:37] Trustee Stamford (probable): And I will be working, I'm talking to Susan Yates on Gabriola to see how we

[0:06:45] Trustee Stamford (probable): can coordinate with their efforts as well.

[0:06:50] Trustee Stamford (probable): One of the other things we're doing on the mainland is OCP harmonization.

[0:06:57] Trustee Stamford (probable): So on the mainland, the South China Coast mainland, there are seven official community plans.

[0:07:03] Trustee Stamford (probable): We're trying to harmonize them into one.

[0:07:06] Trustee Stamford (probable): That's an ongoing process.

[0:07:08] Trustee Stamford (probable): It's iterative.

[0:07:10] Trustee Stamford (probable): There's a lot to pack in because unlike this island, there are requirements for Bill 44, which is housing requirements and densities.

[0:07:20] Trustee Stamford (probable): So how do we fit those regulations into our official community plan and land use bylaws?

[0:07:26] Trustee Stamford (probable): us that's one of our challenges with that um another uh looking at other things five six and

[0:07:33] Trustee Stamford (probable): then i'll just i could go on for hours but i don't want to bore you because a lot of it is just more

[0:07:39] Trustee Stamford (probable): to do with the mainland the only other thing is good news the sunshine coast regional hospital

[0:07:47] Trustee Stamford (probable): district which i am a member of as a part of the scrd board you're also a member of the

[0:07:55] Trustee Stamford (probable): the hospital district, we've just released over a million dollars to the hospice, the Mossy Rock

[0:08:03] Trustee Stamford (probable): Hospice Project in Roberts Creek. And that is locally generated project, very local because

[0:08:10] Trustee Stamford (probable): there's members of Gambier that have been working on that project. But it's really exciting. It's

[0:08:18] Trustee Stamford (probable): It's going to be a beautiful facility that will help provide more support

[0:08:24] Trustee Stamford (probable): for those end-of-life scenarios and move people that are currently

[0:08:28] Trustee Stamford (probable): inappropriately housed in hospitals into a more conducive environment.

[0:08:34] Trustee Stamford (probable): So we're really excited about that.

[0:08:35] Trustee Stamford (probable): I thought it'd be good to end on something positive.

[0:08:38] Trustee Stamford (probable): And I'm happy to – any questions, Joe?

[0:09:05] Trustee Patrick (probable): So that's the purpose for tomorrow. They're not proposing any changes to the document at this time, but to take some time to really understand what agencies said to us when they responded.

[0:09:18] Trustee Patrick (probable): And then Trust Council next will meet September 9th through 11th.

[0:09:23] Trustee Patrick (probable): It's virtual.

[0:09:24] Trustee Patrick (probable): It's online.

[0:09:25] Trustee Patrick (probable): Usually it's on the 9th of late afternoon is the public comment period.

[0:09:32] Trustee Patrick (probable): You're always welcome to watch three days of meetings if you have nothing else better to do, but everything is recorded.

[0:09:38] Trustee Patrick (probable): But the agenda is usually out a week in advance, and you can see what's on, and you can always come in and out if you've got something of interest.

[0:10:57] Trustee Patrick (probable): British Columbia land use planning agreement. The public engagement process for the proposed

[0:11:03] Trustee Patrick (probable): order recently concluded and we recognize that community members may continue to have questions

[0:11:08] Trustee Patrick (probable): about the proposal and the potential implications.

[0:11:12] Trustee Patrick (probable): However, this matter is outside the jurisdiction

[0:11:15] Trustee Patrick (probable): of the Islands Trust,

[0:11:16] Trustee Patrick (probable): and it is not a matter before the Local Trust Committee.

[0:11:20] Trustee Patrick (probable): The proposed land use objective order

[0:11:22] Trustee Patrick (probable): is being considered by the province

[0:11:24] Trustee Patrick (probable): under the provincial legislation.

[0:11:26] Trustee Patrick (probable): It described by the province the proposed objectives

[0:11:29] Trustee Patrick (probable): are intended to guide forest stewardship

[0:11:32] Trustee Patrick (probable): and resource management activities

[0:11:34] Trustee Patrick (probable): within the identified planning area,

[0:11:36] Trustee Patrick (probable): including the protection of indigenous cultural values, old-growth forests, biodiversity, watershed health, and environmental values.

[0:11:45] Trustee Patrick (probable): Because the Islands Trust is not a decision-maker for this process, individuals wishing to provide feedback or seek further information are encouraged to contact the province directly.

[0:20:07] Planner (probable): The property is located within DPA number 3, which requires a DP due to the presence of a watercourse on the property.

[0:20:16] Planner (probable): So the applicants provided an environmental assessment.

[0:20:19] Planner (probable): The assessment reviewed the on-site pond and ditches and identified them as man-made ephemeral features that are not connected to fish-bearing waters.

[0:20:28] Planner (probable): The assessment recommended maintaining a 2-meter buffer from these features to protect water quality and minimize potential impacts during construction.

[0:20:35] Planner (probable): Staff reviewed the proposal and are satisfied that it meets the guidelines for DEA 3.

[0:20:42] Planner (probable): The proposed addition is located outside of the recommended buffer area and the environmental measures identified in the assessment address the intent of the riparian protection requirements.

[0:20:52] Planner (probable): The applicant is also requesting two variances through DVP.

[0:31:50] Voice 4: and we haven't submitted for any building revision changes through the SCRP either.

[0:31:55] Voice 4: Again, just having in fact the plan for making the exact same building permit. We have a

[0:32:00] Voice 4: two-way building permit here and structural drawings here as well. Those structural drawings

[0:32:04] Voice 4: they said to replace as required and unfortunately as we removed different aspects and got further

[0:32:11] Voice 4: the demolition each area that the structural engineer required us to change that included

[0:32:36] Voice 4: is not new to us. To the point where even though that wouldn't be today's staff report,

[0:32:46] Voice 4: the deck and the housing or the house itself to be renovated, even though on the original

[0:32:53] Voice 4: DBP it says roofline operation, that wasn't the extent of what we applied for.

[0:33:20] Voice 3: Weiner. My brother Joey and I own the property at Bay Street. And thank you for hearing us

[0:33:30] Voice 3: today. This is our family that sits on Black Beach, where the family has spent years. So

[0:33:37] Voice 3: we're new back to the island, but we were part of the AAU's generation on the island, so we spent

[0:33:44] Voice 3: many years growing up on the beach and in this house. The beach off is an old dwelling that has

[0:33:51] Voice 3: been there for the better part of the century. So although it's going through a reclassification,

[0:33:57] Voice 3: this structure has been there for a long time.

[0:34:02] Voice 3: It's been added on to piece by piece over decades

[0:34:06] Voice 3: and reached the point where it needed real work

[0:34:09] Voice 3: to be safe and to last.

[0:34:12] Voice 3: So we did this the way you are supposed to.

[0:34:15] Voice 3: We brought in architects, engineers,

[0:34:18] Voice 3: surveyor, geotechnical.

[0:34:20] Voice 3: We applied it to Islands Trust

[0:34:22] Voice 3: for a development variance permit

[0:34:23] Voice 3: for a small route line alteration

[0:34:25] Voice 3: that triggered the site encroachment.

[0:34:30] Voice 3: This committee approved it unanimously in 2025.

[0:34:34] Voice 3: We applied to the SCRD for a building permit, and it was issued.

[0:34:39] Voice 3: Then we built to the approved drawings and permits.

[0:34:45] Voice 3: In fact, the SCRD inspected and approved our work as we went

[0:34:52] Voice 3: and allowed us to continue with the construction.

[0:34:57] Voice 3: During construction, their engineers opened up the old structure

[0:35:01] Voice 3: and found conditions that no one could see from the outside.

[0:35:05] Voice 3: The building needed more structural work

[0:35:08] Voice 3: to meet current seismic and building code requirements

[0:35:11] Voice 3: on a structure this old.

[0:35:14] Voice 3: We did not improvise.

[0:35:15] Voice 3: We followed the engineer's direction.

[0:35:17] Voice 3: We kept current, and we kept building under our permit

[0:35:21] Voice 3: and under SCRD oversight and inspection.

[0:35:26] Voice 3: What did not change is the thing

[0:35:28] Voice 3: that we understood matters to this committee.

[0:35:31] Voice 3: The home sits on the same footprint in the same place set back from the water.

[0:35:40] Voice 3: We reduced the building's footprint from what was there before.

[0:35:47] Voice 3: We removed all non-conforming features and the home will meet current building seismic

[0:35:53] Voice 3: and energy goals.

[0:35:56] Voice 3: Every commitment we made to this committee about how the home would sit on the land we

[0:36:05] Voice 3: We understand that the structural work done during construction has raised a question about how the

[0:36:12] Voice 3: home is classified and that is why we are here with the complete application and the supporting

[0:36:19] Voice 3: letters from our architect and structural engineer and our geotechnical engineer. We have also brought

[0:36:24] Voice 3: letters from our neighbours who know this home and the shoreline and who support what we have done

[0:36:32] Voice 3: and plan to do. We are not here to ask the committee to overlook anything. We are here

[0:36:43] Voice 3: to ask you to look at what we actually built a family home in the same footprint, sat back from

[0:36:51] Voice 3: the water, built a code on a property that is held at home for generations. We followed the approvals

[0:36:58] Voice 3: you and SCRD gave us, we followed what our engineers required, we followed what the

[0:37:03] Voice 3: inspectors asked of us. I'd also ask you to look closely at your own staff report,

[0:37:12] Voice 3: what it actually says and what it doesn't. Every technical question was tested. Is this home safe

[0:37:20] Voice 3: from flooding? Yes. Is the slope stable? Yes. Does it meet today's seismic and structural code? Yes.

[0:37:28] Voice 3: Nothing in the report says the home is unsafe or built wrong or a risk to anyone on this shoreline

[0:37:33] Voice 3: finding what's left in that report isn't a finding it's a question it asks for more study more time

[0:37:42] Voice 3: more process on a home that has already been engineered inspected and tested against every

[0:37:47] Voice 3: standard your own report puts in front of it we're not asking you to overlook a risk we're asking

[0:37:56] Voice 3: you not to wait on a question that already has an answer when this committee thinks about what

[0:38:05] Voice 3: belongs on the shoreline to ask you to listen to the people who actually live on it. I think it's

[0:38:12] Voice 3: 49 of our neighbours here on Gambier, most all of the residents on Grove Road as well,

[0:38:20] Voice 3: endorsed letters supporting the project. Some have called this shoreline home for over 40 years,

[0:38:48] Voice 3: exactly what was built there they're telling you in their own words that this home was a beach

[0:39:10] Voice 3: understands what the shoreline could look like better than the people who spent their lives on it

[0:47:44] Trustee Stamford (probable): One of the things that I've been looking at is in the community or in the area on Gambier, there are several properties, several homes that are right on the edge.

[0:48:00] Trustee Stamford (probable): And I know the owners won't touch them because they don't want to have to deal with that 75% rebuild requirement, knowing they're never going to match it.

[0:48:13] Trustee Stamford (probable): build what's different in this situation is it's a very small property so the other areas i've been

[2:20:27] Voice 5: on Gambier. That's staking out a political position that goes beyond the usual calculus

[2:20:36] Voice 5: for land planning. It's also appropriate because that's in fact what DRIPA directs us to do.

[2:20:43] Voice 5: So I don't

[2:20:44] Voice 5: have a problem with the broad policy direction expressed by the proposed language.

[2:20:52] Voice 5: My concern is that I have some unease and again that may be more my problem than anybody else's.

[2:21:02] Voice 5: it may have something to do with the way I think about things and my habit of applying critical

[2:21:11] Voice 5: analysis to everything, whether it deserves it or not. I'm worried a little bit, not a lot,

[2:21:18] Voice 5: but a little bit about the risk that what we're saying with this proposed OCP amendment

[2:21:25] Voice 5: risks being misunderstood as setting the stage for some kind of program that would give precedence to

[2:21:33] Voice 5: first nation interests over those of it doesn't do that okay no like

[2:21:42] Voice 5: please um i i i'm i'm aiming for some clarity here it doesn't do that a fair and reasonable

[2:21:52] Voice 5: reading of what we've just done today is that it's about recognizing and respecting first

[2:21:58] Voice 5: nations interests full stop there's nothing wrong with that it's overdue how that will shake

[2:22:06] Voice 5: out in terms of concrete action is another matter and very much subject to the LTC's

[2:22:12] Voice 5: obligation to be fair to everyone.

[2:22:14] Voice 5: And I'm confident it will be.

[2:22:15] Voice 5: And I'm confident that going forward, that we are going to operate firmly within the

[2:22:21] Voice 5: boundaries of our jurisdiction and what our mandate is, that we're not going to do some

[2:22:24] Voice 5: crazy radical stuff.

[2:22:26] Voice 5: We just, that's not what we do.

[2:22:28] Voice 5: Where I'm coming from here is, and the way I see the problem is that we are living in

[2:22:35] Voice 5: a time where willful misunderstanding is a thing. It's routinely deployed in the service of, let's

[2:22:45] Voice 5: be honest, intolerance. That's the environment that we're operating in. So we need to do the

[2:22:52] Voice 5: right thing. And I think we did that today. But we have to be sensitive about the environment

[2:22:59] Voice 5: that we're operating in um my concern and again as i said before uh that may be my over sensitivity

[2:23:08] Voice 5: and anxiety about these things is i i'm concerned that we not feed into the bad faith and that's

[2:23:14] Voice 5: what it is that's out there because frankly um if we don't notice that it's growing we're not

[2:23:21] Voice 5: paying attention and we've got to manage that i'd feel a lot better if what we were saying in this

[2:23:27] Voice 5: was framed in language that did more to acknowledge reconciliation as part of a larger plan

[2:23:35] Voice 5: to recognize and bring together the interests of all Gambier Island residents and people with

[2:23:42] Voice 5: interest in it and I think over the long term we will do that this is just the first stage

[2:23:48] Voice 5: when the OCP is completed I think it will and I'm pretty confident the direction will be to have

[2:23:55] Voice 5: that kind of more holistic balanced um expression of a future for the island but you know again i'm

[2:24:05] Voice 5: a little anxious about the i guess the tactics of it at this stage uh but i am confident over

[2:24:11] Voice 5: the long run that we're going to be looking at an ocp that is going to set the stage for

[2:24:15] Voice 5: land planning that's positive for everybody as i keep trying to tell you maybe i'm overthinking it

[2:24:21] Voice 5: but the reason I'm doing that is reconciliation is too important for us to to bobble it we need

[2:24:30] Voice 5: to be sensitive to the risks around us I've gotten around I've gotten my head around that that's why

[2:24:37] Voice 5: I'm supporting this I'm not opposing this and I'm not trying to qualify my support of it I'm just

[2:24:43] Voice 5: kind of at this stage taking the opportunity to kind of send the message out to ourselves

[2:24:53] Voice 5: ourselves and to the staff that we need to be sensitive about the environment we're in,

[2:24:57] Voice 5: but also to the community in general, that we're being careful here. We're not being careless.

[2:25:03] Voice 5: We're not being thoughtless about the interests of other people. We know what they're thinking.

[2:25:07] Voice 5: We know what their concerns are. We're on it. And I take a lot of comfort from the fact that

[2:25:12] Voice 5: Trustee Sanford, who is more attuned than anybody else to the interests of her community,

[2:25:17] Voice 5: is more than okay with this first step. She's been leading it. Because, you know,

[2:25:23] Voice 5: among other things, and as we've discussed today,

[2:25:26] Voice 5: first reading is by its nature provisional.

[2:25:28] Voice 5: We'll be hearing from Denver residents,

[2:25:31] Voice 5: we're gonna listen and whoever's on the LTC

[2:25:35] Voice 5: at that time is gonna listen because that's the job.

[2:25:42] Voice 5: I think it would have been helpful for me
