Legal Non-Conforming FAQ – July 2022 CHAIRPERSON’S OPENING STATEMENT The following is an example of an opening statement to be made by the Chairperson of the Local Trust Committee at the beginning of a Public Hearing. “This Public Hearing is being convened pursuant to Section 465 of the Local Government Act in order to consider the following proposed bylaw(s): Proposed Bylaw No. 122 – cited as “South Pender Island Land Use Bylaw No. 114, 2016, Amendment No. 2, 2021". All persons who believe that their interest in property is affected by the proposed bylaw(s) will be given a reasonable opportunity to be heard or to present written submissions respecting matters contained in the proposed bylaw(s). Those wishing to speak should commence their presentation by clearly stating their name and address. Members of the Local Trust Committee may, if they wish, ask questions of you following your presentation. However, the main function of the Local Trust Committee members is to listen to the views of the public. It is not the function of Committee members to debate the merits of the proposed bylaw(s) with individual citizens. Everyone will be given a reasonable opportunity to be heard and none should feel discouraged from presenting his or her views. In considering the proposed bylaw(s), the Local Trust Committee has received documents, which may influence its decision. Those documents are available for review during this hearing, on our website, and as indicated in the public hearing notice. Any person who wishes to present a written submission to the Local Trust Committee may do so and all written submissions must be received by the Local Trust Committee before the close of the hearing.
