[0:03:18] Trustee Patrick: and we're going to be following some protocols here and so forth.

[0:03:22] Trustee Patrick: So I appreciate everyone's patience as we go through process because public hearings in particular are very formal and I must follow some key scripts.

[0:03:30] Trustee Patrick: But before we get into the public hearing, we're going to have what's called a community information meeting and staff will present, give us a staff report, followed by that, there will be an opportunity for you to ask questions.

[0:03:40] Trustee Patrick: this is not part of the public hearing but we'll review that again where you can ask some questions

[0:03:44] Trustee Patrick: and get some answers and then we'll have the public hearing which is where you can state your

[0:03:49] Trustee Patrick: opinions um and and and uh on the items so at first we have a staff report and invite the planner

[0:03:56] Trustee Patrick: smith thank

[0:04:02] Planner: you chair patrick i'm just going to share my screen here and i'll just walk through

[0:04:07] Planner: i uh there's a post-public hearing staff report on the agenda today for ltc to consider after the

[0:04:14] Planner: public hearing there's no specific staff report for uh the community information meeting but what

[0:04:21] Planner: i will do is walk through briefly the october 15 staff report and then just walk through the

[0:04:27] Planner: bylaw itself briefly and the contents of the public hearing binder which will just take a

[0:04:31] Planner: few minutes and then i'll pass it back over to you for any questions that the audience might have

[0:04:39] Planner: so i'll share my screen here you can all see the staff report there

[0:04:55] Planner: yeah so just on october 15 2020 staff presented bylaws 129 and 130 to the local trust committee

[0:05:04] Planner: to be given first reading and to seek direction regarding scheduling a community information

[0:05:11] Planner: meeting and a public hearing which is where we're at today and so at that meeting

[0:05:16] Planner: um ltc gave the bylaws first reading and also gave staff direction to schedule these meetings so

[0:05:25] Planner: in essence the bylaw amendments the national park zones that were transferred to the federal

[0:05:32] Planner: government to create the national park reserve lands on saturn island as well as a number of

[0:05:39] Planner: other islands and the southern gulf islands at the time that they were transferred while

[0:05:45] Planner: while zoning no longer applies to those federal lands,

[0:05:51] Planner: the previous zoning was never amended

[0:05:55] Planner: within the land use by-law

[0:05:57] Planner: or the land use designation in the OCP

[0:05:59] Planner: to acknowledge that those lands are no longer zoned

[0:06:04] Planner: as rural residential or a number of other uses

[0:06:09] Planner: that are no longer occurring.

[0:06:10] Planner: So that's, in essence, the changes. And now I'm just going to jump here to the actual bylaw itself. So the OCP amendments, essentially, the OCP and land use amendments essentially create new land use designations to identify those as National Park Reserve and National Park Reserve marine lands.

[0:06:38] Planner: and they capture all of those properties within those within those that transfer and so I'm just

[0:06:46] Planner: going to scroll through a number of maps here and if anyone has any particular questions they can

[0:06:50] Planner: certainly ask that we can return to a map but this is the OCP land use designation amendments

[0:06:57] Planner: and then we you can see there's a reference map for all of them and then the land use bylaw

[0:07:08] Planner: follows the same pattern with creating national park and national park marine zones with the

[0:07:16] Planner: associated land uses and of course these are all just for reference as they

[0:07:24] Planner: don't actually apply to the federal government and so that's the bylaw and as you can see they've

[0:07:31] Planner: both been given first reading on October 15th and then just back up to the binders so

[0:07:37] Planner: So the public hearing binder, we have sent it out for referral to both potentially affected agencies and First Nations.

[0:07:48] Planner: First Nations received both a preliminary letter and the standard referral and no responses were received to any of those referrals.

[0:07:57] Planner: We've had no responses received to the public hearing and no formal submissions.

[0:08:06] Planner: I did receive one phone call from a member of the public who had a few questions and was generally supportive of the changes.

[0:08:13] Planner: And so, nothing more to add. I'll pass it back to you, Chair Patrick.

[0:11:43] Trustee Patrick: proposed bylaw number 129 cited as saturn island official community plan bylaw number 70 2000

[0:11:51] Trustee Patrick: amendment number 1 2020 and proposed bylaw number 130 cited as the land use bylaw number 119 2018

[0:12:00] Trustee Patrick: amendment number 1 2020 all persons who believe that they their interest in the property is um

[0:12:08] Trustee Patrick: is affected by the proposed bylaws will be given a reasonable opportunity to be heard

[0:12:14] Trustee Patrick: and to present written submissions respecting matters contained in the proposed bylaws.

[0:12:19] Trustee Patrick: Anyone who has sent a letter on this matter is already on the public record. It isn't necessary

[0:12:24] Trustee Patrick: to also make an oral presentation, although I certainly welcome it. To ensure everyone's heard,

[0:12:31] Trustee Patrick: Third, I will not maintain a clock, but I will encourage you to move along if you're dominating the speaking time, and you can always come back and speak a second and third time if necessary.

[0:12:46] Trustee Patrick: Those wishing to speak are encouraged to commence their presentations by stating their name and address.

[0:12:51] Trustee Patrick: However, you're not required to state your name and address, but such information is helpful to the local trust committee in determining the relationship you might have with these bylaws.

[0:13:10] Trustee Patrick: the merits of the proposed bylaws everyone will be given a reasonable opportunity to be heard and

[0:13:16] Trustee Patrick: none should feel discouraged from presenting his or her views to ensure we hear from the

[0:13:22] Trustee Patrick: range of views we need and to make everyone feel safe speaking their mind i ask please

[0:13:28] Trustee Patrick: that well I guess we're not in an audience so in this case I don't have to worry about asking you

[0:13:35] Trustee Patrick: to not clap or when people are speaking and considering the proposed bylaws the local trust

[0:13:42] Trustee Patrick: committee has received correspondence reports that may influence its decision and those documents

[0:13:47] Trustee Patrick: are available for reviewing in the binder that is available on the website any person who wishes to

[0:13:54] Trustee Patrick: to present a written submission would have to do so soon

[0:21:23] Planner: federal lands uh rezoning the lands will provide better clarity and consistency with the uh bylaws

[0:21:29] Planner: of Saturna Island as to the ongoing use of the lands we were undertook referrals

[0:21:36] Planner: to both First Nations and agencies and no responses were received and there's

[0:21:40] Planner: been no public opposition to the proposed amendments prior to and now

[0:25:56] Voice 1: thank you very much um i just forwarded uh kind of an email that

[0:26:01] Voice 1: more or less summarized the issue so that uh um robert has it for his records and i think

[0:26:05] Voice 1: brad you already have it so the genesis of this was last uh late last summer early fall

[0:26:11] Voice 1: there began to be conflicts over parking in um in and around the ferry dock uh the government dock

[0:26:18] Voice 1: the main commercial center uh around the dock um and uh the rcmp became involved there's a

[0:26:26] Voice 1: new detachment on pender uh not being aware that all the no parking signs placed in lyle harbor

[0:26:34] Voice 1: were actually placed um at the behest of previous road managers uh by neighbors requests so they

[0:26:40] Voice 1: they were the the community understanding was they were not legal they were parking

[0:26:45] Voice 1: parking signs meant for somebody else, not the individuals who park next to them.

[0:26:49] Voice 1: The RCMP, of course, having a hard time enforcing that situation, were pulling their hair out

[0:26:56] Voice 1: a little bit. The letters were written to the local trust committee asking for some

[0:27:02] Voice 1: clarity on the situation. Of course, it's the Ministry of Transportation Infrastructure

[0:27:06] Voice 1: Property, the roadway. It's not something the trust zones or is ordinarily involved

[0:27:12] Voice 1: involved with but in talking with planner Smith it does seem that the issue was more sort of

[0:27:17] Voice 1: coordination of transportation at this transportation hub and so what we ended up

[0:27:23] Voice 1: doing was just as a you know taking a first stab at at facilitating a multi-party meeting to see

[0:27:31] Voice 1: if so there could be a resolution that made sense that as in allowed parking safely but in a way

[0:27:37] Voice 1: that was enforceable um so we we pulled a meeting together just as a trial and the rcmp the rose

[0:27:44] Voice 1: area managed so the the detachment uh uh the sergeant in charge of the detachment kim bruce

[0:27:50] Voice 1: came her uh constable uh the rhodes area manager um they actually brought two individuals from icbc

[0:27:57] Voice 1: which was interesting and that that actually will lead to a point i'll make in a moment

[0:28:02] Voice 1: And Brad kindly came and BC Ferries had their terminal manager, Paul and myself, of course, and the business owners, the community hall is in the area.

[0:28:17] Voice 1: So there was a group of about 14, 12 of us, I think, who congregated outside and observed the lay of the land and what the issues were, what some solutions might be.

[0:28:27] Voice 1: and so in talking through there are obvious solutions everything from light bc ferries

[0:28:32] Voice 1: paying for line painting to more clearly delineate their property the idea where the private property

[0:28:39] Voice 1: is versus public property for waiting for the ferry uh icbc talked about funding not a widening

[0:28:48] Voice 1: of the road but basically like a repurposing of the shoulder making it safer paid i'm not

[0:28:54] Voice 1: payment i'm not sure anyway so so it looks like a plan if a plan is put in place that they then

[0:29:00] Voice 1: obviously this can be put in front of the community uh there's support ministry of

[0:29:05] Voice 1: transportation has as they say no funding uh to support activities related to parking because

[0:29:11] Voice 1: that's not their you know area of operation but this is why kindly the rcmp brought icbc which

[0:29:17] Voice 1: is great so the request is made is obviously somebody has to stick handle all of these parties

[0:29:23] Voice 1: parties, because there's no natural other body that would do so, and we're proposing

[0:29:29] Voice 1: that that be the Islands Trust. Obviously, there's no funding request coming to the Islands

[0:29:34] Voice 1: Trust. It's a question of assigning staff time on behalf of the local trust committee

[0:29:41] Voice 1: by Planner Smith to, in essence, coordinate ICBC, RCMP and Ministry of Transportation

[0:29:47] Voice 1: to come up with a plan that works for the government dock and for the ferry dock and

[0:29:51] Voice 1: and the flow plane and accommodates all these users.

[0:29:55] Voice 1: And so the idea is that we elevate this to a priority now.

[0:30:00] Voice 1: We are on the way to removing a couple of items from our priorities list, but it not

[0:30:06] Voice 1: being 100% a natural, the facilitation, I guess, being a bit of a different undertaking

[0:30:18] Voice 1: than land use planning.

[0:30:22] Voice 1: We wanted to bring that to your attention, Robert, and just get your input and see how

[0:30:26] Voice 1: how we might best make use of Planner Smith's time

[0:30:30] Voice 1: in a way that's fair and reasonable.

[0:30:32] Voice 1: So that's basically where we are.

[0:30:34] Voice 1: I don't know if you don't mean to put you on the spot,

[0:31:02] Voice 7: seem to indicate it sounds like if we don't we don't coordinate this nobody will so it

[0:31:06] Voice 7: sounds like it's a like it's a needed project but uh my my only suggestion to brad and then

[0:31:12] Voice 7: to the ltc as well is uh um to extend the scope of the project a little bit or maybe not limit

[0:31:19] Voice 7: the scope of the project by including in it potential land use changes at least consideration

[0:31:25] Voice 7: of any potential land use changes and that gets it gets it firmly within the scope of the local

[0:31:30] Voice 7: trust committee's jurisdiction there may

[0:31:33] Voice 7: not be any ultimately land use changes coming out of it

[0:31:36] Voice 7: there may be some advocacy policies added to the ocp but who knows there could be some zoning

[0:31:42] Voice 7: changes as well so that was my suggestion to brad and to the local trust committee and

[0:31:48] Voice 7: brad seemed to think that was a good a good approach as well i

[0:31:51] Voice 1: think that makes a lot of

[0:31:52] Voice 1: the sense because what was discussed was the actually preponderance of some private parking

[0:31:57] Voice 1: and how best to make use or you know for the for the for the the owners of that parking

[0:32:03] Voice 1: themselves they were in attendance so that's a great suggestion thank you yeah

[0:32:07] Voice 7: if you elevate it to a top priority i can put in a budget request for the next fiscal year

[0:32:13] Voice 7: starting you know the april 1st fiscal year and uh i assume it would be a pretty small a small

[0:32:19] Voice 7: budget a couple of thousand maybe um cover some meeting expenses and um if there are any land use

[0:32:28] Voice 7: changes at least at least cover the cost of getting that process started um so right now

[0:32:35] Voice 7: you've got the three top priorities the two you're dealing with or one you've just dealt with today

[0:32:40] Voice 7: the other one coming up um there's still a bit of work to do on brad's part to get those to executive

[0:32:45] Voice 7: and to the minister and get it back to the local trust committee ultimately and then the other one

[0:32:50] Voice 7: is the the groundwater project which you'll be getting a report on the february meeting sort of

[0:32:56] Voice 7: the final report of the data and mapping outcome of that project and then use the local trust

[0:33:04] Voice 7: committee will have the opportunity to consider if you want to move on to the implementation phase

[0:33:08] Voice 7: phase of that project. North Bender and Galliano have kept that as a top priority to look at

[0:33:15] Voice 7: implementation options. Maine has decided not to at this point. So that's something

[0:33:21] Voice 7: to consider at the February meeting. And yeah, in terms of getting it on a top priority,

[0:33:28] Voice 7: it's a matter of just amending your top priorities in your work program. And we anticipated having

[0:33:35] Voice 7: having that as a discussion item
