[0:00:59] Trustee Fast (probable): community information meeting just to catch everybody up and you can share your views

[0:01:03] Trustee Fast (probable): then in the public hearing that follows. We want to hear from you about what you think about Denman

[0:01:10] Trustee Fast (probable): Community Land Trust Association's rezoning DERZ 2017.1 that's Pepper Lane and proposed bylaws

[0:01:19] Trustee Fast (probable): 233 and 234 and you'll hear more about this. I want to begin though to acknowledge with respect

[0:01:26] Trustee Fast (probable): that we're meeting digitally and on and about the unceded territories of the Comox and the

[0:01:35] Trustee Fast (probable): Qualicum First Nations. I'm coming to you from Nuhlelehwem or Quelacum. These are a couple of

[0:01:42] Trustee Fast (probable): names for Bowen Island in Alkitsam, Howe Sound. And I'm one of the vice chairs of Islands Trust,

[0:01:49] Trustee Fast (probable): so I'm the chair of the Local Trust Committee. And with me today are your Denman local trustees,

[0:06:48] Trustee Fast (probable): we've got a the community information portion of the meeting this is about bylaws 233 and 234

[0:06:55] Trustee Fast (probable): regarding Denman Community Land Trust Association and Denman Seniors Affordable Housing Project

[0:07:01] Trustee Fast (probable): Pepper Lane and so first off I'm going to ask planners Sonia Zupanets to come back with us

[0:07:07] Trustee Fast (probable): and present a little bit of information and answer any questions until around 7 15 because we did

[0:07:14] Trustee Fast (probable): have another community information meeting earlier hopefully people's questions were answered there

[0:07:19] Trustee Fast (probable): so this is more like a catch-up quickly before we go into the public hearing please take it away

[0:07:25] Planner Zupanec (probable): you so much good evening everybody as the chair mentioned i'm going to be doing a

[0:07:30] Planner Zupanec (probable): quick review of the proposal and any new information that needs to be presented prior

[0:07:36] Planner Zupanec (probable): to the public hearing. So I'm going to share my screen and pull up a few presentation slides.

[0:07:42] Planner Zupanec (probable): Let me just bear with me. Okay. So tonight's process is to inform you of the overview of

[0:07:57] Planner Zupanec (probable): the proposal. If you are unfamiliar with it, we'll give you a quick brief snapshot,

[0:08:01] Planner Zupanec (probable): but we did have an in-depth community information meeting at the beginning of this month. I'll also

[0:08:07] Planner Zupanec (probable): be presenting some new information to consider and the whole point is so that you can determine

[0:08:13] Planner Zupanec (probable): determine whether your interests are affected by the two proposed bylaws that are being considered

[0:08:18] Planner Zupanec (probable): by the local trust committee and then you can prepare your submission at the public hearing

[0:08:24] Planner Zupanec (probable): which will be commencing after this presentation in terms of whether or not you submit a written

[0:08:29] Planner Zupanec (probable): or a verbal present submission to the LTC. So we'll be looking at the two proposed bylaws 233

[0:08:36] Planner Zupanec (probable): which is to amend your Denman Island official community plan and 234 to amend your land use

[0:08:42] Planner Zupanec (probable): bylaw. I will also briefly go over some details of the restrictive covenant that is tied to this

[0:08:48] Planner Zupanec (probable): rezoning application and has important information in it and just some minor issues related to the

[0:08:55] Planner Zupanec (probable): housing agreement which is not subject to this public hearing but is part of this rezoning

[0:08:59] Planner Zupanec (probable): package so it's also important that this information is available to you before the public

[0:09:04] Planner Zupanec (probable): hearing. So as many of you know this is the four acre parcel in Denman on Denman Island that is

[0:09:12] Planner Zupanec (probable): is the subject of this rezoning application

[0:09:14] Planner Zupanec (probable): just off of Denman Road.

[0:09:17] Planner Zupanec (probable): The application is to subdivide the parcel into two pieces

[0:09:22] Planner Zupanec (probable): and rezone each of the pieces in order to allow

[0:09:26] Planner Zupanec (probable): for the seniors affordable housing development

[0:09:29] Planner Zupanec (probable): on what would be the new affordable housing zone R4-2

[0:09:35] Planner Zupanec (probable): and the remainder of the parcel would be

[0:09:37] Planner Zupanec (probable): within the agricultural land reserve still

[0:09:40] Planner Zupanec (probable): still as an A15 sub zone.

[0:09:47] Planner Zupanec (probable): So the applicant has submitted a site conceptual site plan

[0:09:51] Planner Zupanec (probable): and detailed information with their application.

[0:09:53] Planner Zupanec (probable): This is a proposed conceptual layout of the four units,

[0:09:58] Planner Zupanec (probable): which would, or the four duplexes,

[0:10:00] Planner Zupanec (probable): which would house the eight units

[0:10:03] Planner Zupanec (probable): of senior supportable housing and the access to the lot,

[0:10:07] Planner Zupanec (probable): as well as the parent parcel in behind,

[0:10:10] Planner Zupanec (probable): which would retain the existing homestead

[0:10:12] Planner Zupanec (probable): currently on the property so in brief summary uh the changes to the denman official community plan

[0:10:20] Planner Zupanec (probable): include a number of new policies pertaining to the affordable rental housing and rental tenure

[0:10:27] Planner Zupanec (probable): housing for this particular application and for the r4 zone in general to anticipate a subsequent

[0:10:36] Planner Zupanec (probable): subsequent application for rental affordable housing.

[0:10:40] Planner Zupanec (probable): And it also requires new dwellings to comply

[0:10:43] Planner Zupanec (probable): if they are approved through rezoning application

[0:10:47] Planner Zupanec (probable): to the BC energy step code requirements.

[0:10:52] Planner Zupanec (probable): It also amends the land use designation for the parcel

[0:10:56] Planner Zupanec (probable): as shown on this map

[0:10:57] Planner Zupanec (probable): from the sustainable resource designation

[0:11:00] Planner Zupanec (probable): to a residential designation.

[0:11:02] Planner Zupanec (probable): So that's just the portion

[0:11:03] Planner Zupanec (probable): for the seniors affordable housing.

[0:11:05] Planner Zupanec (probable): the remainder will remain as a sustainable resource designation the changes to the land

[0:11:13] Planner Zupanec (probable): use bylaw are more detailed because they deal specifically with the zoning provisions of this

[0:11:18] Planner Zupanec (probable): new zone the r42 zone and that regulates the siting the size the use the density parking

[0:11:24] Planner Zupanec (probable): regulations it also specifies the new regulations for the a15 subzone as well as new home occupation

[0:11:33] Planner Zupanec (probable): patient regulations for the R4 zone. So after the close of the public hearing this evening just to

[0:11:41] Planner Zupanec (probable): remind everybody the LTC has the ability to give second or third reading to the bylaws as presented

[0:11:48] Planner Zupanec (probable): or they can direct staff to make minor amendments to one or both of the bylaws as long as those

[0:11:57] Planner Zupanec (probable): amendments don't affect the use of the land or the density of the land and then they can give

[0:12:03] Planner Zupanec (probable): of those subsequent readings or they can ask for more information of staff or the applicant in

[0:12:08] Planner Zupanec (probable): which case this may trigger the need to return back to a second public hearing or they can proceed

[0:12:14] Planner Zupanec (probable): no further so those are the options that any local government has after the close of a public hearing

[0:12:19] Planner Zupanec (probable): if the bylaws are given second and third reading just to remind all of you the process after that

[0:12:26] Planner Zupanec (probable): is to forward those bylaws to the islands trust executive committee for approval and the ocp bylaw

[0:12:33] Planner Zupanec (probable): at that point must be forwarded to the provincial minister of housing for approval as well only at

[0:12:40] Planner Zupanec (probable): that point can the bylaws be considered for final reading by the local trust committee and final

[0:12:45] Planner Zupanec (probable): readings considered adoption so i'd like to quickly summarize some of the recommended changes that

[0:12:52] Planner Zupanec (probable): staff will be making to the local trust committee if they do proceed to the next step of considering

[0:12:59] Planner Zupanec (probable): considering these bylaws for further readings.

[0:13:02] Planner Zupanec (probable): So we'll start with bylaw 234,

[0:13:05] Planner Zupanec (probable): the land use bylaw amendment,

[0:13:07] Planner Zupanec (probable): the current plan that's in place

[0:13:10] Planner Zupanec (probable): at the very end of the bylaw,

[0:13:12] Planner Zupanec (probable): there's a map, this map,

[0:13:15] Planner Zupanec (probable): and it has an incorrect citation for the zone.

[0:13:17] Planner Zupanec (probable): It's no longer called the multifamily zone.

[0:13:20] Planner Zupanec (probable): It is, it looks like this,

[0:13:22] Planner Zupanec (probable): it's called the affordable rental housing zone, R42.

[0:13:25] Planner Zupanec (probable): So this would be the map that would be recommended

[0:13:27] Planner Zupanec (probable): to replace the map that's currently in by-law 234.

[0:13:33] Planner Zupanec (probable): The other change for this particular by-law,

[0:13:37] Planner Zupanec (probable): this is a specific regulation provision for the R4-2 zone

[0:13:45] Planner Zupanec (probable): that regulates the maximum size,

[0:13:47] Planner Zupanec (probable): the floor area of a senior's affordable dwelling unit.

[0:13:51] Planner Zupanec (probable): And it's currently listed at 60 square meters.

[0:13:54] Planner Zupanec (probable): And the applicant has requested

[0:13:55] Planner Zupanec (probable): an increase to 65 square meters.

[0:13:58] Planner Zupanec (probable): so the LTC would be considering this as well. So on top of the two bylaws that are being considered

[0:14:07] Planner Zupanec (probable): we also have a restrictive covenant that ties the owner the operator of the affordable housing

[0:14:14] Planner Zupanec (probable): portion of the lot to a number of conditions and this is an important tool because it requires

[0:14:20] Planner Zupanec (probable): a vegetative buffer and fencing prior to construction of the property and that's a

[0:14:26] Planner Zupanec (probable): a condition of the Agricultural Land Commission. It also currently requires fencing to mitigate

[0:14:31] Planner Zupanec (probable): noise and dust along the property boundary between the affordable housing parcel and 3716 Denman

[0:14:37] Planner Zupanec (probable): Road. It also requires the installation of a data logger in the well to take readings and monitoring

[0:14:44] Planner Zupanec (probable): the condition of that well. And it requires the construction of those dwelling units to meet

[0:14:51] Planner Zupanec (probable): step two of the energy code requirements in the province so there are a few little changes to

[0:15:00] Planner Zupanec (probable): the restrictive covenant that we'll also be asking the ltc to consider as part of the process for the

[0:15:06] Planner Zupanec (probable): bylaws to move forward and one the one condition regarding the agricultural land reserve exclusion

[0:15:13] Planner Zupanec (probable): a condition of the land being removed from the agricultural land reserve for affordable housing

[0:15:20] Planner Zupanec (probable): was that vegetative buffer and fencing had to be installed in the location shown on the site plan

[0:15:26] Planner Zupanec (probable): and so the restrictive covenant covenant requires that but the applicants requested a bit of

[0:15:32] Planner Zupanec (probable): flexibility in the covenant wording itself in order to allow some fencing changes if they are

[0:15:39] Planner Zupanec (probable): approved by the ALC so staff would be recommending this particular wording these wording changes to

[0:15:47] Planner Zupanec (probable): be considered by the local trust committee if they decide to move forward with the bylaws

[0:15:50] Planner Zupanec (probable): Another potential change that they might consider is currently the fencing requirement for noise, dust, and privacy is along this red portion shown on the screen.

[0:16:02] Planner Zupanec (probable): And so the LTC may be asked to consider changing the covenant wording to require fencing along the entire southern property line and driveway portion for all the other adjacent properties in this location.

[0:16:17] Planner Zupanec (probable): Now, as I mentioned, the Housing Agreement By-law, which is By-law 239, is an administrative by-law.

[0:16:22] Planner Zupanec (probable): it's a firm agreement with the operators of the affordable housing portion of the parcel

[0:16:28] Planner Zupanec (probable): to rent the units under certain conditions and I've listed those here so there's no changes to

[0:16:36] Planner Zupanec (probable): that but the applicant is requesting a minor change section 1e of the agreement currently has

[0:16:45] Planner Zupanec (probable): the following text and the applicant's requesting that at the very end of this

[0:16:52] Planner Zupanec (probable): affordable housing stipulation for maximum rent that they also provide this text here that the

[0:17:00] Planner Zupanec (probable): rent does not include any sums received by way of institutional rent subsidy or rent assistance

[0:17:07] Planner Zupanec (probable): available from time to time and the intent of adding this text to the housing agreement is

[0:17:14] Planner Zupanec (probable): that it reflects a similar formula of the bc shelter aid for elderly residents program

[0:17:19] Planner Zupanec (probable): And it would benefit the operator in some cases by allowing it to receive greater revenues through higher rents, while at the same time charging the tenants no more than that 30% threshold.

[0:17:32] Planner Zupanec (probable): So the applicant's requesting that this be included if the bylaws proceed to the next ratings, that the housing agreement bylaw also be amended.

[0:17:40] Planner Zupanec (probable): And these are details that can be sorted out post-public hearing, because this particular bylaw isn't subject to a public hearing.

[0:17:47] Planner Zupanec (probable): The other potential change that the local trust committee may consider is the definition of a qualified occupant within the housing agreement.

[0:17:58] Planner Zupanec (probable): It may be expanded so that it include but doesn't limit on reserve and off reserve status and non-status or self-identifying Indigenous Inuit or Métis people.

[0:18:07] Planner Zupanec (probable): And this is a recommendation of our senior intergovernmental policy advisor at the Islands Trust.

[0:18:12] Planner Zupanec (probable): trust. So that was a whirlwind run through of a complex multi-year rezoning application.

[0:18:21] Planner Zupanec (probable): This is your final opportunity to submit or ask any questions of the proposed bylaws that are

[0:18:28] Planner Zupanec (probable): being considered at the public hearing. And I am more than happy to answer any questions that you

[0:18:34] Planner Zupanec (probable): might have. And at the close of the question period, it will then be an opportunity for you

[0:18:41] Planner Zupanec (probable): to provide your input to the local trust committee so this is the last chance for

[0:20:59] Voice 3: senior housing that it be um that it be restricted to people who are in a certain category of health

[0:21:09] Voice 3: and I have I have a concern about who makes that decision is the decision made

[0:21:17] Voice 3: by BC Housing or is a decision made by the society itself about you know that

[0:21:27] Voice 3: anyway the question comes from someone who lives in the house becoming ill and

[0:21:34] Voice 3: wanting to die at home which is the right of anybody who rents or anybody

[0:21:38] Voice 3: who owns that it be certainly a serious situation in a community where we don't

[0:21:47] Voice 3: have alternate care for people dying no palliative care or other housing options

[0:22:15] Planner Zupanec (probable): of specifications within there around the tenancy and that is solely at the discretion of the

[0:22:21] Planner Zupanec (probable): operator and that's the in this case would be the the denman community land trust association to make

[0:22:27] Planner Zupanec (probable): that determination and those requirements are currently part of that bylaw which is not subject

[0:22:34] Planner Zupanec (probable): of today's public hearing, but as an administrative bylaw.

[0:22:39] Planner Zupanec (probable): So it's agreed upon, those terms and conditions

[0:35:45] Planner Zupanec (probable): The purpose of bylaw number 234 to amend the land use bylaw is to rezone the subject property parcel to two new site-specific A15 and affordable housing R42 zones to allow for subdivision and an increase in density in the R42 zone, permitting seniors affordable housing duplexes by way of a residential rental tenure zone and changing the proof of potable water requirements required at the time of subdivision.

[0:36:24] Planner Zupanec (probable): and regulating the siting size, lot coverage, parking, signage and several other land use

Chair Fast called the meeting to order at 7:00 pm.  She welcomed the public, introduced 
Trustees, staff, and recorder; and acknowledged that the meeting was being held in traditional 
territory of the K'ómoks and Qualicum First Nations. 
2. COMMUNITY INFORMATION MEETING - Bylaw Nos. 233 & 234 
 
Regarding DE-RZ-2017.1 - Denman Community Land Trust Association (DCLTA) - Denman 
Seniors Affordable Housing Project (Pepper Lane) 
 
By general consent the agenda was approved as presented. 
Planner Zupanec provided a brief overview of the proposal noting that an in-depth presentation 
was conducted at a recent Community Information Meeting; and advised that new information 
is available for consideration. She noted that the Public Hearing will occur following this session 
and explained that comments received prior to the close of the Public Hearing will be reviewed 
by the Trustees. 
She provided the following updates for information and Local Trust Committee (LTC) 
consideration: 
 Plan No. 1 is updated with current text in the Land Use Bylaw; 
 The applicant has requested the following changes: 
o an increase in maximum floor area to 65 m
2
 from 60 m
2
; 
o allowing flexibility in the Restrictive Covenant wording to permit vegetative buffer and 
fencing changes if approved by the Agricultural Land Commission;

o consideration of a change in the Restrictive Covenant wording to require fencing to 
mitigate noise and dust along the entire southern property line and both lengths of the 
driveway; 
o Housing Agreement text amending the affordable housing stipulation for maximum rent 
to reflect a similar formula of BC’s Shelter Aid for Elderly Renters; 
 The definition of qualified occupant may be expanded on the advice of the Islands Trust 
Senior Intergovernmental Policy Advisor so that it includes, but is not limited to, on-reserve 
and off-reserve status and non-status and/or self-identified Indigenous, Inuit or Native 
people. 
2.1 QUESTION AND ANSWER SESSON 
 The criteria for living in the proposed senior housing is restricted to those in a 
certain category of health; who makes that decision? What if a tenant has serious 
health issues and a desire to die at home during residency? 
o Tenancy eligibility conditions are specified within the Housing Agreement and 
carried out by DCLTA. The terms and conditions in the Housing Agreement are 
agreed upon by the LTC and DCLTA. This question can be considered by the LTC 
in their review of the draft Housing Agreement.
