[0:00:42] Voice 22: that's available for us. I'll just let you know what my thinking is. There's actually almost 13

[0:00:50] Voice 22: items that we need to reflect on in a few decisions and conversations, including any

[0:00:56] Voice 22: additional amendments to our budget and then trustee grove is prepared with a motion to

[0:01:04] Voice 22: approve sending out the budget for public consultation once we've finalized our

[0:01:09] Voice 22: discussion today we have an in-camera session that we're going to begin with and everything

[0:01:16] Voice 22: today i'd like to keep as brief as possible that one included however there are a couple of items

[0:01:22] Voice 22: that we should talk to you about,

[0:01:24] Voice 22: the CEO should talk to you about,

[0:01:26] Voice 22: and we will do that.

[0:01:28] Voice 22: I am inclined, because the public is aware of our schedule

[0:01:33] Voice 22: and knows that we're going in-camera first thing

[0:04:01] Voice 22: And on page 311 is the consent agenda item, which is the regional planning committee work program report.

[0:04:08] Voice 22: And unless there's somebody that wishes to speak to that and would offer you the opportunity to communicate directly with the chair, Laura Beshaken, on that, if you wish.

[0:04:38] Voice 22: but the first item on that 8.2.1 is the local planning services director's report and of course

[0:04:44] Voice 22: that report is in your package but i want to give that our senior uh planner in the organization

[0:04:50] Voice 22: the opportunity to speak to uh any other matters or what's important in that report that he wants

[0:04:55] Voice 22: to draw your attention to so david marler good morning and thank you to you and your team your

[0:05:01] Voice 22: rpms for the work that you do

[0:05:03] Voice 1: yes thank you and i don't have a lot to say the report knew

[0:05:08] Voice 1: all self-explanatory uh some of the items i was going to cover were covered by the ceo two days

[0:05:13] Voice 1: ago so i won't go over those the one thing i will say is that we do have an opportunity for

[0:05:19] Voice 1: a first nations grant for work on reconciliation uh it's not first nations grant it's actually a

[0:05:27] Voice 1: provincial grant uh called time and more and more so we will be working over the next couple of

[0:05:33] Voice 1: weeks to figure out what projects we have that fit and make an application and we'll be taking

[0:05:40] Voice 1: that through the executive committee and we should if we're successful we'll know by the next trust

[0:05:45] Voice 1: council i'll leave it at that if there's any questions on the report i'll answer them very

[0:05:50] Voice 1: good thank

[0:05:50] Voice 22: you any questions from the director deb morrison and uh trustee alan

[0:06:00] Voice 10: thank you um just about the last thing you said um i'm wondering if there is the opportunity

[0:06:08] Voice 10: to explore um so on north pender for instance we had a question about just options for co-governance

[0:06:17] Voice 10: or what that might look like like i'm wondering if there's something to explore in a grant effort

[0:06:21] Voice 10: like that yeah

[0:06:25] Voice 1: there's three categories of on the grants one of them appears to be infrastructure

[0:06:29] Voice 1: structure, the other one appears to be education and working collaboratively, and the third

[0:06:36] Voice 1: one is on planning.

[0:06:38] Voice 1: So what I would suggest, if you've got those ideas, just send me an email and I'll work

[0:06:43] Voice 1: with the regional planning managers and CEO and Lisa and we'll figure out what's the best

[0:06:48] Voice 1: options to put forward.

[0:06:57] Trustee Allen (probable): I'm just wondering, regarding the legislative updates on the top of page 315, what was the reasoning behind the province allowing staff to issue development permits?

[0:07:09] Trustee Allen (probable): What was the reasoning behind that?

[0:07:15] Voice 1: Yeah, so in the Local Government Act, all local governments in BC, except for local trust meters,

[0:07:22] Voice 1: had the ability by bylaw to delegate the issuance of development permits to their staff.

[0:07:29] Voice 1: There are a lot of reasons for that—I won't go into them right now—but Trust Council,

[0:07:35] Voice 1: when it put together a list of items to request of the Minister, this was one of them, the

[0:07:41] Voice 1: ability to delegate those.

[0:07:43] Voice 1: The next step now is that we need to figure out, first of all, what the by-laws would

[0:07:49] Voice 1: look like and which local trust committees, if any, would like to do that delegation.

[0:07:54] Voice 1: So, that is not going to happen until next year.

[0:07:57] Voice 1: That actual provision does not come into force until probably early 2022.

[0:08:04] Trustee Allen (probable): Can I have a follow-up question?

[0:08:15] Trustee Allen (probable): This is not going to be a requirement, per se, for local trust committees, if they do

[0:08:21] Trustee Allen (probable): not so desire at this point.

[0:08:26] Trustee Allen (probable): Alex Allen, we're having a hard time hearing you. Do you think you might speak up a bit?

[0:08:29] Trustee Allen (probable): I don't even know where my speaker is on this thing. No, I just wondered,

[0:08:33] Trustee Allen (probable): it's not a requirement for trust committees to do this, is it? Down the road? It's just an option

[0:08:45] Voice 1: Yeah, it's optional, so it's up to the local trust committee. We will be taking a

[0:08:50] Voice 1: report to you through the executive committee on the options and some of the benefits to it i'll

[0:08:57] Voice 1: just point out that the whole point of this is to try and streamline and simplify the process

[0:09:02] Voice 1: a lot of you don't permit your you're having to issue them if they're consistent with the

[0:09:08] Voice 1: guidelines so the intent here is that you've established the policy the direction and the

[0:09:13] Voice 1: guidelines through public meetings and bylaws and then staff would essentially issue assuming

[0:09:20] Voice 1: that you have delegated would issue permits based on the guidelines. That creates a streamlined

[0:09:27] Voice 1: approach to doing it. It makes it quicker. It is more efficient, and we can reduce the cost.

[0:09:33] Voice 1: There will be built into the by-laws an ability to appeal to the Local Trust Committee if the

[0:09:39] Voice 1: landowner disagrees with the staff position. Dan Rogers

[0:09:44] Voice 8: But just on that topic, the changes to the Interpretation Act are going to further complicate and make that whole process of doing that,

[0:09:58] Voice 8: because there is going to be an appropriate but new consideration related to underwritten and Indigenous rights that are going to make it challenging to,

[0:10:09] Voice 8: and not not being maybe not choosing my but it's going to make it a process where other

[0:10:15] Voice 8: considerations are going to be come into play as well so i think local trust committees are going

[0:10:21] Voice 8: to have to be properly um advised and have that full information about what the impacts of that

[0:10:28] Voice 8: might be in terms of of delegating that authority if in the context of with the changes to the

[0:10:33] Voice 8: interpretation act yeah

[0:10:39] Voice 1: and if i may i i think uh the amendments interpretation i think the islands

[0:10:45] Voice 1: trust and the work that we're doing i think we're already ahead of that it's actually uh saying

[0:10:51] Voice 1: putting into the interpretation act literally what the arms trust is doing so whether or not

[0:10:56] Voice 1: that's there we would definitely have to consider reconciliation in all of our recommendations and

[0:11:02] Voice 1: all of our work so i do agree that it you know the interpretation like now has

[0:11:07] Voice 1: qualified it a bit more it's clarified it and essentially says everything that is in our

[0:11:13] Voice 1: legislation has to consider that the rights and titles it's the first nations so yeah i agree

[0:11:20] Voice 1: with you but i also think anne's trust is already doing this thank

[0:11:27] Voice 22: you um any other questions for

[0:11:30] Voice 22: the director otherwise we'll move along okay so let's move to 8.2.3 which is on page 359 of your

[0:11:40] Voice 22: agenda package this is amendments to trust council's policy regarding bylaw compliance

[0:11:44] Voice 22: and enforcement i want to welcome warren dingman manager by law enforcement uh for being here today

[0:11:52] Voice 22: and thank you for trying to join us yesterday um i'm glad we've got you on today's agenda warren

[0:11:57] Voice 22: dingman over to you morning

[0:12:06] Voice 25: chair and council uh the request for decision before you is regarding

[0:12:10] Voice 25: proposed amendments to trust council policy 551 by the compliance and enforcement uh the proposal

[0:12:17] Voice 25: is to amend the policy to allow offense act prosecutions when there are serious contraventions

[0:12:22] Voice 25: permit areas are the land use permits and the delegation of authority to cancel debt

[0:12:29] Voice 25: incurred from bylaw notices to staff currently well for offense act prosecutions your land use

[0:12:38] Voice 25: bylaws all have references to these prosecutions and they've always been an option for local trust

[0:12:44] Voice 25: committees to pursue when it comes to serious bylaw matters it's just that they've never been

[0:12:49] Voice 25: used before there's been no established policy so and part of one of the reasons to bring this

[0:12:56] Voice 25: this before you is we currently for development permit areas we don't have means to issue bylaw

[0:13:02] Voice 25: notices or any other tickets in order to deal with serious contraventions in those development

[0:13:09] Voice 25: permit areas and there are times when there's multiple parties involved in the work including

[0:13:14] Voice 25: contractors and with the current process that we've been using a filing notice of claim

[0:13:23] Voice 25: claim. That's been your principal tool to deal with property owners and get them to

[0:13:29] Voice 25: comply with permit conditions and get the permit that they're required for that development

[0:13:34] Voice 25: permit area. However, there are these other parties, contractors who may do work in serious

[0:13:39] Voice 25: damage and development permit areas, and they have not been subject to enforcement or any

[0:13:44] Voice 25: type of prosecution. So with the proposed amendments, we would put in place a set of

[0:13:52] Voice 25: policies and procedures to ensure that there's a process to be followed

[0:13:59] Voice 14: and

[0:14:00] Voice 25: put before local

[0:14:02] Voice 25: trust committees certain conditions and and really put before local trust committee a report

[0:14:08] Voice 25: before any prosecution proceeded right and ensure that they are for only serious land use permit

[0:14:15] Voice 25: contraventions and that they've been screened by our legal counsel in order to ensure success in

[0:14:23] Voice 25: in those prosecutions and that they are absolutely necessary

[0:14:26] Voice 25: and that there's no other options in order to proceed.

[0:14:33] Voice 25: And considering the strong mandate

[0:14:35] Voice 25: that UNICEF has for environmental protection,

[0:14:37] Voice 25: there are times when I believe it is necessary

[0:14:41] Voice 25: that these Paul Fentz Act prosecutions should proceed

[0:14:45] Voice 25: when work has been done in developed permit areas

[0:14:49] Voice 25: without the necessary permits.

[0:14:50] Voice 25: And with the financial aspects to this policy change, proposed change, it would still need

[0:14:58] Voice 25: to go before a local trust committee for approval, just like any court action, and it would have

[0:15:03] Voice 25: to go before the executive committee for approval of that funding for any legal action against

[0:15:11] Voice 25: those who have contravened your land use bylaws.

[0:15:13] Voice 25: laws. The second set of proposals before you is for the by-law notice debt and allowing staff to

[0:15:22] Voice 25: cancel that debt. The current system that we have under the Local Government By-law Notice Enforcement

[0:15:29] Voice 25: Act, it allows a screening officer, for example, to deal only with disputed by-law notices in order

[0:15:37] Voice 25: to cancel them or to arrange compliance agreements this proposal would allow trust council to

[0:15:45] Voice 25: delegate the authority to cancel certain fines uh delegate that to staff there may be circumstances

[0:15:53] Voice 25: where a community member property owner has complied with ultimately the land use bylaw

[0:16:02] Voice 25: and it's coming to compliance with permits

[0:16:05] Voice 25: and it may be reasonable to cancel their debt

[0:16:09] Voice 25: that they've incurred from a bylaw notice

[0:16:11] Voice 25: and would give us the ability to do that

[0:16:14] Voice 25: without going to the local trust committee in each circumstance

[0:16:18] Voice 25: and ask them to improve such a cancellation of the debt

[0:16:23] Voice 25: or take it before the executive committee.

[0:16:28] Voice 25: I think that is the best summary of the proposals before you.

[0:16:51] Voice 7: So we've got the authority in our legislation to cancel a debt that exists.

[0:16:57] Voice 7: I was surprised about that.

[0:16:58] Voice 7: I know from work for the ministries, you can't forgive it.

[0:17:02] Voice 7: you have to through the financial administration act there's a lot of rules around that collection

[0:17:08] Voice 7: so i'm just a little bit surprised about that so

[0:17:14] Voice 25: i believe that we you do trust counsel you

[0:17:16] Voice 25: can delegate to staff member and this authority uh we have had it reviewed by legal counsel

[0:17:25] Voice 25: and that authority exists for you to do that uh i should note that with there's a lot of

[0:17:30] Voice 25: flexibility with bylaw notices that aren't available say with a municipal ticket information

[0:17:36] Voice 25: or that type of prosecution uh that may not be available in that circumstance like a municipal

[0:17:43] Voice 25: ticket uh there is no flexibility vote if that type of ticket is written it's really up to a

[0:17:50] Voice 25: judge to decide whether or not the offense occurred and probably whether or not the debt

[0:17:56] Voice 25: can be cancelled but with the byline notices there's increased flexibility to do that yeah

[0:18:02] Voice 25: if we can be just

[0:18:03] Voice 7: a follow-up question uh do we report this out in any way in terms of our

[0:18:08] Voice 7: financial statements for giving up a debt uh

[0:18:14] Voice 25: currently i don't know that we've done any

[0:18:15] Voice 25: financial reporting on the the uh monies collected from byline notices or any debts forgiven uh i

[0:18:22] Voice 25: believe i could in future put that into a trust council report in the semi-annual reports that

[0:18:27] Voice 25: come to trust council what i've been doing at this time is reporting the total number of

[0:18:31] Voice 25: file notices issued but not the uh the fine totals i was more interested in the debt waiving for the

[0:18:39] Voice 25: cancellation and the collection i could certainly include that in any future reports to trust

[0:18:45] Voice 25: council okay

[0:19:09] Voice 15: delegated to staff and staff said no we don't think the debt should be forgiven is there if

[0:19:14] Voice 15: we went ahead with this would there be a way for that uh property owner to then go to the ltc and

[0:19:21] Voice 15: a kind of appeal process i

[0:19:25] Voice 14: believe yes they could still do that laura you have to yes i

[0:19:32] Voice 25: believe we would still if they still were concerned that they should have to pay this debt we could

[0:19:37] Voice 25: still afford it to the ltc and have them consider the matter if the director of local planning

[0:19:42] Voice 25: services and myself can't foresee a reason why it should be cancelled okay

[0:19:54] Voice 2: of days um i i i like this idea for the simple reason that i think that any contractor working

[0:20:01] Voice 2: on the island should be aware of the local bylaws and that they shouldn't profit by breaking them so

[0:20:08] Voice 2: um if we can uh sort of hang responsibility and not just on the owner but also under the people

[0:20:14] Voice 2: that are doing the work i think it's a benefit to the community and i fully support this thanks

[0:22:25] Voice 26: It looks very likely that we will unlikely to get a first reading this term.

[0:22:32] Voice 26: And I just think to be adding more work to this project without any hope of it being anywhere near complete this term, I think is throwing good money away.

[0:22:45] Voice 26: way. It's unfair to burden the new trustees coming in next term with this project, which

[0:22:52] Voice 26: they may or may not want to pursue. And in the meantime, we are spending money and using staff

[0:22:57] Voice 26: time inappropriately, I think. So that's my point. Thank you.

[0:23:48] Voice 16: morning trust council i'm very pleased to be with you this morning and i'll just give you a succinct

[0:23:53] Voice 16: summary of what's been going on um just initially want to say that we welcome two new team members

[0:23:59] Voice 16: to trust area services we've got julian nickel who's returned to us in a temporary assignment

[0:24:04] Voice 16: as a engagement planner until the end of march and also tara tedesco has joined us in the community

[0:24:10] Voice 16: communication specialist temporary role until the end of March. We are continuing to recruit

[0:24:16] Voice 16: for a communication specialist. We did have a competition, but we're unsuccessful in finding

[0:24:20] Voice 16: a qualified candidate. So we are moving forward with trying to identify an individual. I have

[0:24:26] Voice 16: the opportunity to appoint someone because it's less than seven months, but so far haven't

[0:24:31] Voice 16: identified a qualified candidate. So we continue that recruitment process. Also want to let you

[0:24:38] Voice 16: know that we have provided the annual report to the minister and this year we've taken a new

[0:25:25] Voice 16: also in addition another highlight would be we are working hard on the trust programs

[0:25:31] Voice 16: committees living in the trust area mailing project so within this we're looking at sending

[0:25:36] Voice 16: and mailing to all new residents who have moved into the region perhaps as far back as about a

[0:25:40] Voice 16: year ago so that everyone could receive a letter explaining the island's trust and providing

[0:25:46] Voice 16: relevant materials that might be of use to a new resident within that package we're currently

[0:25:51] Voice 16: developing an island's trust brochure or rat card we would be providing some information on the

[0:25:56] Voice 16: conservancy we're looking at providing custom to each local trust area a list of frequently needed

[0:26:03] Voice 16: needed numbers so um primarily those that are not for island stressed although of course we provide

[0:26:07] Voice 16: our own but the ones that often new residents struggle to figure out the complexity of

[0:26:11] Voice 16: different jurisdictions this would provide that and we're contemplating whether to give a fridge

[0:26:15] Voice 16: magnet so put it right on your fridge as a new resident so we're working on that with the aim

[0:26:19] Voice 16: of doing the mailing by the by march is the goal so we could put the materials through trust

[0:26:23] Voice 16: programs committee for review in february so that's a big project involving multiple staff

[0:26:28] Voice 16: members providing advice um and we welcome if you want to be in touch with ideas please do reach out

[0:26:33] Voice 16: And finally, the dominant project of the term, in addition to reconciliation, but you'll be hearing from Ms. Will Cox in a little bit here, has been the policy statement project as we move through a procurement process to find a firm to assist with the next round of engagement.

[0:26:48] Voice 16: And I'm happy to announce that we have just this week completed that procurement process, and ISL Engineering and Land Services will be the firm working with us.

[0:26:58] Voice 16: we will have our kickoff meeting next week to finalize timelines and the approach with the

[0:27:03] Voice 16: aim of getting a engagement plan for approval to the executive committee no later than their

[0:27:08] Voice 16: january meeting possibly before so that's where we're at right now we're very pleased and looking

[0:27:14] Voice 16: forward to working with this firm to bring engagement to the islands and continue the

[0:27:19] Voice 16: conversations about the policy statement at this time we are not anticipating any first reading at

[0:27:25] Voice 16: march um so we would be looking beyond march for any you know possible consideration of first

[0:27:30] Voice 16: reading but we'll come back to the executive committee and council with an engagement plan

[0:27:35] Voice 16: that would identify options around moving to first reading i'm with that and i'll leave it at that

[0:28:39] Voice 10: that there isn't possible success to be had this term

[0:28:42] Voice 10: because there is progress that we can make.

[0:28:47] Voice 10: And I would encourage the executive committee

[0:28:50] Voice 10: to consider having the conversation around the trust policy statement

[0:28:56] Voice 10: to occur again in the Trust Programs Committee between now and March

[0:29:01] Voice 10: so that we can parallel the engagement process

[0:29:04] Voice 10: and continue conversations with trustees on that.

[0:29:07] Voice 10: Because I think we do have a lot of feedback from our communities.

[0:30:58] Voice 17: emergency measures so really thinking about community is what i've been doing the last few

[0:31:03] Voice 17: days so it's really nice to connect with each of you again after such a long time and all that

[0:31:08] Voice 17: we've been through in our communities so i'm here today just to provide you with this short report

[0:31:15] Voice 17: on the engagement that's happened over the last quarter and just to seek your feedback on how you

[0:31:22] Voice 17: would like to understand and know about the engagement that's happening if this is the

[0:31:27] Voice 17: type of report that you'd like to receive in the future in this kind of format or if something else

[0:31:33] Voice 17: works better for you. So your input and feedback into how things are working and what you're

[0:31:40] Voice 17: experiencing out in your community is really important because you're there on the ground

[0:31:44] Voice 17: and I can learn from that and understand what's happening for you. So clearly over the last

[0:31:51] Voice 17: quarter we've been doing lots of work to engage both at the policy statement level and continuing

[0:31:57] Voice 17: continuing relationship building and those mutually respectful relationships that we need to build, both with First Nations and now we also are reaching out to Indigenous people that are living on the islands and trying to create that connection and understand concerns and work with them on engaging on these important matters to do with land use and the work that we do in reconciliation.

[0:32:22] Voice 17: reconciliation so you can see from this report just going through that we have been creating

[0:32:28] Voice 17: further intergovernmental relationships with ministries to improve communications

[0:32:34] Voice 17: around reconciliation work that runs in parallel with what the ministries are doing and what we

[0:32:42] Voice 17: are also doing we have reached out at ubcm and successfully met with minister rankin

[0:32:50] Voice 17: who then appointed executive director to assist us with the work that we're undertaking.

[0:32:56] Voice 17: And that's a really important aspect of what we're doing

[0:33:01] Voice 17: because First Nations have asked us to enter into certain types of agreements with them

[0:33:06] Voice 17: that reflect DRIPA and to also help further our reconciliation efforts.

[0:33:13] Voice 17: So having that connection with an executive director at MER who's appointed by the minister will really help.

[0:33:19] Voice 17: We have continued our relationship with the executive director appointed by the former minister of Flynnrow and supported by the minister, Minister Conroy, and have had really successful meetings around the redrafting of our Crown land agreements, and also improving communications between both the Islands Trust and different ministry levels at Flynnrow,

[0:33:46] Voice 17: And also in regards to understanding more clearly our relationships with First Nations.

[0:33:54] Voice 17: So those are other important meetings that we've been having.

[0:33:57] Voice 17: Also working with the newly appointed staff at the CRD, who also are doing a similar role to myself.

[0:34:06] Voice 17: and also working with what's called a network of other staff

[0:34:13] Voice 17: that are in this role called the community of practice.

[0:34:16] Voice 17: So that's another group that just learning from each other

[0:34:20] Voice 17: about how to move forward in a good way.

[0:34:24] Voice 17: So obviously one of the really exciting aspects of what we're doing

[0:34:28] Voice 17: has been to work within Lewatosh

[0:34:32] Voice 17: and that is an economic development arm of Tsleil-Waututh First Nation

[0:34:37] Voice 17: on the heritage preservation overlay.

[0:34:41] Voice 17: So they have created some draft reports for us to review

[0:34:45] Voice 17: and the team is just working to review those now and refine them

[0:34:50] Voice 17: and hopefully we should be able to present those to you at March Trust Council.

[0:34:54] Voice 17: When I talked to them the other day,

[0:34:56] Voice 17: they were talking about how they were creating mapping

[0:34:59] Voice 17: with all of the different place names

[0:35:01] Voice 17: and gathering all of the public information that's out there but that is relevant to the

[0:35:06] Voice 17: Islands Trust area in regards to our connections with First Nations so that was just really

[0:35:12] Voice 17: exciting to think that we would have place name mapping added into our tapas systems

[0:35:18] Voice 17: so and also we have been as with the feedback from the policy statement there was a lot of

[0:35:25] Voice 17: a comment about connecting with Indigenous people on the islands so I have been focusing on that to

[0:35:31] Voice 17: ensure that we're doing that in a good way and reaching out to people to try to create those

[0:35:37] Voice 17: connections and it has been difficult with COVID so we are trying to do different things and adjust

[0:35:43] Voice 17: and be flexible to how we're reaching out to create those understandings with Indigenous people

[0:35:49] Voice 17: that are living on the islands who may not be necessarily band members of First Nations so

[0:35:55] Voice 17: So and I know you've been leading and doing good work about the policy statement with your community members.

[0:36:01] Voice 17: So it'd be wonderful for me to connect with you and hear what your feedback is and some of the concerns that your community members raise so that I can incorporate that into our engagement and work that we're doing with nations.

[0:36:13] Voice 17: So hopefully that gives you an overview of some of the important work I've listed out, different meetings that have happened.

[0:36:20] Voice 17: And if that's a helpful form of information for you,

[0:36:23] Voice 17: then just let me know and I'll continue doing that.

[0:36:31] Voice 17: have all been working to refine

[0:36:48] Voice 17: and how we would disseminate that information out to the public and also how we can ensure that trustees are involved in meetings and working on this important work of engagement and relationship building.

[0:37:00] Voice 17: So those are all things that we're now starting to turn our minds to so that we can come back to you in March with a report and talk to you about how to go forward with that in a way that works for you.

[0:37:42] Voice 22: the council has done and and and developed through staff the executive committee with the ministries

[0:37:54] Voice 22: of an executive uh director to work with lisa is significant and this is uh welcome and advanced

[0:38:03] Voice 22: is not only our work but the work of the province and it's a terrific and so i want to thank lisa

[0:40:48] Voice 17: the Interpretation Act and other acts that come forward and legislation and work, we will have to

[0:40:55] Voice 17: be flexible and understanding of how to adjust to that so with the cultural heritage overlay i think

[0:41:02] Voice 17: it creates certainty for applicants and it also creates certainty for our own staff in being able

[0:41:08] Voice 17: to understand and follow a process that would allow them to feel positive that they're following

[0:43:02] Voice 18: as it comes out of the summer field season. It was quite successful this year. There's been an

[0:43:08] Voice 18: increasing interest in conservation opportunities. And we've got, anecdotally, we have an increasing

[0:43:15] Voice 18: amount of queries about conservation opportunities from community members.

[0:43:20] Voice 18: We continue to process several covenants, the NAPTEP documents you see before you.

[0:43:28] Voice 18: There's reserve transfers that continue to require work, and you'll notice that as we

[0:43:36] Voice 18: move through the term, there's a significant complexity involved with processing this type

[0:43:44] Voice 18: of legal documentation as it all often involves several different sponsors as well as receivers

[0:43:54] Voice 18: we have hired a temporary part-time communications person carmen smith started a couple weeks ago

[0:44:01] Voice 18: under our covenant monitoring we've completed the annuals monitoring we get some very detailed

[0:44:08] Voice 18: reports about our public conservation covenants and nature

[0:44:12] Voice 18: reserves, as well as we do have an in-camera

[0:44:16] Voice 18: private covenant report as well. So we visit every single

[0:44:20] Voice 18: property every year. Part of the

[0:44:25] Voice 18: benefit of having the SAR grant money is

[0:44:29] Voice 18: that the staff are able to do a lot of

[0:44:33] Voice 18: that property management work on a more detailed level and do the

[0:44:37] Voice 18: the type of work that they'd hoped to be able to do but never had the funding or the staffing

[0:44:41] Voice 18: to do.

[0:44:42] Voice 18: So there's been work on invasive species impacts, including parrot's feather mitigation projects,

[0:44:49] Voice 18: bullfrog and of course those sheep, not mentioning any island in particular.

[0:44:57] Voice 18: So that's been really encouraging for our staff.

[0:45:01] Voice 18: Yeah. In the communications department, you'll see that the HERA newsletter is coming more frequently.

[0:45:07] Voice 18: It was a wonderful article about previous trustee Louise Bell and her impact on the trust and Islands Conservation as a whole.

[0:45:31] Voice 18: and the relationship they can have with the ITC.

[0:52:46] Voice 16: recommendation you have along with a proposed amended policy if we were asked to assess to

[0:52:52] Voice 16: reinstate the program in january we would be getting with advertising with nominations

[0:52:56] Voice 16: expected in april and then any recommendations from trust programs committee would come to you

[0:53:02] Voice 16: in june of next year i understand the rationale from trust programs committee was such that they

[0:53:08] Voice 16: They felt that offering it once a year would allow for potentially a bigger pool of nominations

[0:53:13] Voice 16: at one time, would reduce administrative time needed to administer the program, and also

[0:53:19] Voice 16: that trustees by the final year of the term are well familiar with their role as trustees

[0:53:23] Voice 16: and their community needs and the potential projects in the area.

[1:12:49] Voice 8: fulsome i'll use the word fulsome as opposed to meaningful but full some work on the budget that's

[1:12:55] Voice 8: been um provided by uh by the trust council uh that partnership did not occur um and uh

[1:13:04] Voice 8: the discussion at the Financial Planning Committee

[1:13:08] Voice 8: in cooperation with the Director of Trust Area Services

[1:13:12] Voice 8: was there was no partnership on the horizon

[1:13:16] Voice 8: that we could see coming forward.

[1:13:19] Voice 8: And there was a concern that the type of work

[1:13:21] Voice 8: that we were talking about doing here

[1:13:23] Voice 8: was not going to be doable for the amount of money

[1:13:26] Voice 8: that had been put in the budget.

[1:13:31] Voice 8: if we were going to remove anything

[1:13:33] Voice 8: anything from the trust area services about the proposals, this was the one that probably

[1:13:38] Voice 8: could be let go because it wasn't clear that we had a way forward without a meaningful

[1:13:45] Voice 8: and substantial partner.

[1:13:47] Voice 8: I don't ever want to speak against taking concrete action on climate change, and I regret

[1:13:55] Voice 8: it.

[1:13:55] Voice 8: In fact, as we actually said in the meeting, it's a shame that Trustee Morrison wasn't

[1:14:00] Voice 8: there to sort of provide her her high level wisdom about about these types of issues

[1:14:04] Voice 8: but that was the rationale that was why financial planning committee uh removed it from the budget

[1:14:11] Voice 8: and i was supportive of that at that time uh but i guess i'd be interested to hear any other

[1:22:49] Voice 30: effect. I think the effect of taxes generally on our islands is underappreciated. It was mentioned

[1:22:58] Voice 30: by one of the delegates yesterday that, you know, we have a lot of people on these islands who

[1:23:04] Voice 30: are at or below the poverty line. We are below the median income levels generally,

[1:23:12] Voice 30: early, and payment of taxes is harder for people. So we have to be very conscious about every dollar

[1:23:19] Voice 30: we spend here. Thank you.

[1:24:10] Voice 29: important that if a trustee requires some technical electronic support to do their job,

[1:24:17] Voice 29: that they have the resources of the collective council to do that. But a blanket for all

[1:37:47] Voice 27: I can say that prior to this existing council, we had a larger window of time between the election results and the first council meeting when we deliver the hardware, which allowed us then to petition or survey the incoming council and determine the exact number that were going to bring their own device.

[1:38:13] Voice 27: That allowed us then to purchase the product that we needed, be very responsive to the need.

[1:38:20] Voice 27: This existing council, we didn't have that window.

[1:38:24] Voice 27: So we did, in fact, go and purchase the full set, which we don't actually agree with either,

[1:49:54] Voice 5: In addition, I think for broad circulation, there is a paragraph from the briefing from

[1:50:02] Voice 5: our own director of admin services, a very poignant paragraph. That paragraph begins,

[1:50:09] Voice 5: begins, the current draft 2020-23 budget generates significant tax increases not seen at Islands

[1:50:20] Voice 5: Trust in recent history, and ends large draws from surplus in the budget have historically

[1:50:30] Voice 5: kept tax increases artificially low.

[1:50:33] Voice 5: In the middle of that short paragraph, the Director of Admin Services refers to the previously

[1:50:45] Voice 5: flagged by staff as unsustainable, and that comes from our own respected Director of Admin

[1:51:53] Voice 8: a very responsible budget, given the way that the activities of the Trust have become markedly

[1:52:02] Voice 8: more complex in the last number of years, with climate change and reconciliation.

[1:52:06] Voice 8: And it overlooks the fact that a lot of the work and staffing that has increases that have come along have been a response to that and often are funded by grants as opposed to taxes.

[1:52:28] Voice 8: I've heard people quote that same paragraph from the director.

[1:52:34] Voice 8: It's true.

[1:52:35] Voice 8: We cannot live off our surplus surplus in perpetuity unless we continue to generate surplus.

[1:52:45] Voice 8: But remember, as was pointed out, these are tax monies we've already requisitioned from the public that we have promised them that will deliver something that we weren't able to deliver for a particular reason.

[1:52:59] Voice 8: So that money was there, and it needed to be used at some point.

[1:53:09] Voice 8: So we are probably getting close to the end of that runway in relation to the use of the surplus, and we'll have to be cognizant of that in the future.

[1:53:19] Voice 8: I actually, having been through the Financial Planning Committee in all of the iterations, feel that this budget is responsible, and frankly, it should not be characterized in the way that my friend, Trustee Cahill, just did.

[1:53:38] Voice 8: I think it should be understood what it achieves and what the objectives of it are and how it came about.

[1:53:49] Voice 8: So that's my view of it, and I'll be voting in favour of this.

[1:53:52] Voice 8: And if

[1:53:53] Voice 8: asked by the public, I'll tell them that I voted in favour of it because I approved the budget.

[1:53:58] Voice 8: That doesn't mean that I won't consider modifications after I get commentary from the public, and we should always do that.

[1:54:06] Voice 8: But I approve at this stage, this budget, and look forward to the commentary that we receive.

[1:54:40] Voice 31: current manager of administrative services. So, you know, I have a problem. I have voted for the

[1:54:48] Voice 31: budget in the past, but I'm not going to vote for this budget.

[1:54:55] Voice 31: I'm not going to vote for this

[1:54:58] Voice 31: budget because it's been too long that the surplus has been ignored and that this kind of growth

[1:55:04] Voice 31: that's that's happened because of the surplus and the fact that it's been around so long

[1:55:10] Voice 31: um you know a nine million dollar budget when our last actuals was around 7.7 million

[1:55:15] Voice 31: is inappropriate and uh you know i always hear that oh it's become more complex everything has

[1:55:21] Voice 31: become more complex well life has become more complex and many other agencies ministries

[1:55:28] Voice 31: companies have managed to deal with that complexity without ballooning budgets far beyond

[1:55:34] Voice 31: inflation so i'm not going to be voting in favor of this budget that's going to be my protest

[1:55:39] Voice 31: in respect of how the trust has dealt with the formation of its budget and its financials over

[1:55:46] Voice 31: over the past number of years, thanks.

[1:56:40] Voice 29: on these islands in terms of the lack of justice for how these islands were procured in the first

[1:56:44] Voice 29: place and the ongoing and long-lasting ramifications of that sooner or later those

[1:56:50] Voice 29: costs are going to be paid and right now they're being paid in in ways that are not healthy outcomes

[1:56:58] Voice 29: for a lot of people so the way that this is being presented and talked about i'm having a real issue

[1:57:07] Voice 29: with here folks and i will be voting for this draft budget even though the whole approach really

[1:57:14] Voice 29: is something that is is untenable okay

[2:01:26] Voice 21: to acknowledge and celebrate the exceptional work of their colleagues. Nominations are submitted

[2:01:30] Voice 21: through the year and winners are selected by a panel of employee volunteers to be awarded each

[2:01:34] Voice 21: December. A selection of these awards are presented each year at Trust Council in December

[2:01:40] Voice 21: as they represent feats of dedication, determination or commitment to the Trust

[2:01:44] Voice 21: object. This year we have two awards to share with you today. The first is the Champion Award

[2:01:51] Voice 21: and nominated for Championing the Islands Trust Policy Statement or Strategic Goals

[2:01:59] Voice 21: And I am pleased to announce the 2021 Champion Award winner this year is David Marler.

[2:02:10] Voice 21: He was nominated by Lisa Wilcox, and she had this to say.

[2:02:14] Voice 21: Creating understanding and developing new and innovative processes

[2:02:17] Voice 21: are key to the success of reconciliation within the Islands Trust.

[2:02:21] Voice 21: David's demonstrated this innovation over the past year,

[2:02:23] Voice 21: and I'd like to nominate him for this Innovation Award.

[2:02:26] Voice 21: award. David was instrumental in helping to shape and change the Heritage Preservation

[2:02:32] Voice 21: Overlay Initiative. He took concepts that I had developed and created tangible solutions

[2:02:36] Voice 21: to how they could work within the Local Government Act and the Islands Trust planning process.

[2:02:41] Voice 21: He created a positive atmosphere of collaboration that built a foundation for seeing what was

[2:02:45] Voice 21: possible and encouraged the creativity that was needed to weave together an innovative

[2:02:49] Voice 21: process that over the next years could create certainty for First Nations, Islands Trust

[2:02:53] Voice 21: trust staff, and other agencies.

[2:06:12] Voice 29: different islands and different needs the term triage was used and we talked about community

[2:06:18] Voice 29: island communities being in intensive care and needing triage i received my first responder

[2:06:24] Voice 29: under medical license this year. And here's my advice. Don't get to that point where you're

[2:06:28] Voice 29: making those kinds of decisions in that kind of way without that strategic data-based approach

[2:06:34] Voice 29: to how we're dealing with these issues. So this is a request that the Islands Trust look at the

[2:06:41] Voice 29: outcomes, for ecosystems, for residents, for justice in the way that we do this work and

[2:06:55] Voice 29: to ask the province to receive what will be the most anticipated email of their month

[2:07:01] Voice 29: because it allows a collective provincial funded response in 2021 with everything we've

[2:07:11] Voice 29: learned since the founding of the islands trust to help thank you for your consideration thank you

[2:07:20] Voice 22: very much scott uh trustee laura patrick the

[2:07:27] Voice 19: i sort of see islands as sort of the canary in the

[2:07:30] Voice 19: coal mine a coal mine we we know that there's these these impacts on housing and and workforce

[2:07:38] Voice 19: is happening everywhere but for our islands it's worse the commute is harder it's harder to bring

[2:07:44] Voice 19: workers too. Right now, traveling around Salt Spring and various businesses is a window of

[2:07:50] Voice 19: quotes and I'll read one of them. There's like over a hundred on the quotes. There is nothing

[2:07:56] Voice 19: for the average working family. We worked full time. My partner works in the trades. He is paid

[2:08:01] Voice 19: well. We have no options. If our current rental were to go away, we feel stuck. We feel scared

[2:08:08] Voice 19: for our children's future. I have a letter here from the Hospital Foundation. It says,

[2:08:14] Voice 19: The operations of Lady Minto Hospital have been negatively impacted by a shortage of staff, due in large part to the lack of available and affordable housing on Salt Spring.

[2:08:25] Voice 19: As such, the board of the Lady Minto Hospital Foundation supports any initiative which will seek to bring systemic resolution to this issue.

[2:08:34] Voice 19: We understand that a diverse housing typology is necessary, not only for healthy community, but specific to our mandate, the furtherance of housing, the staff necessary for the hospital's long-term sustainability.

[2:08:51] Voice 19: So I'm asking that you would support, and if your island is also experiencing these, to add your island to the list of declaring that we have a housing equity and workforce shortage.

[2:09:04] Voice 19: I see the second ask as this is a section of the Islands Trust Act and no case and I debated this morning how it could be interpreted.

[2:09:13] Voice 19: I'll tell you how I'm interpreting it is that this this is not about advocacy.

[2:09:19] Voice 19: This is we can actually tell the lieutenant governor and consul that we are islands need special attention and that we need their help to create something that works.

[2:09:30] Voice 19: It doesn't have to be in the Islands Trust.

[2:09:32] Voice 19: trust. It is the islands that are experiencing this, and it very much supports the mandate

[2:09:38] Voice 19: of the Islands Trust that we have to have a healthy community as the basis of protecting

[2:16:57] Voice 19: A statement like this helps to bring that this is a crisis and that will help further those conversations when we are in those opportunities with ministers.

[2:17:18] Voice 31: of this, and principally because where has the consultation been with respect to our islands?

[2:17:34] Voice 31: engagement for my island is crucial. And we've had no public engagement. You know, I think that

[2:17:43] Voice 31: the majority of people on these islands speak for all islands. Most of the structures on the island

[2:17:50] Voice 31: are single family homes. And it's just, it's history. But this is pretty disparaging for

[2:17:56] Voice 31: two single family homes. And there's been a lot of barriers to multi-unit homes throughout time

[2:18:04] Voice 31: on these islands, including by levels of government.

[2:18:08] Voice 31: I just, I'm sorry, I can't support something

[2:39:46] Voice 29: and so we're making decisions in a non-strategic way too often putting this down this the layer

[2:39:54] Voice 29: of representative democracy in the committee and then coming back up we've already allowed for

[2:39:58] Voice 29: islands that have different approaches and different responses from their community members

[2:40:03] Voice 29: the letters of support that perhaps the public is not aware of that have come in in the past

[2:40:09] Voice 29: week and some of them have been added as addendums from the gabriola chamber of commerce from the

[2:40:13] Voice 29: medical field from business owners individuals who have lived and grown up on this island whose

[2:40:20] Voice 29: parents and grandparents lived on these islands there's an urgency here and um if if you believe

[2:40:29] Voice 29: that your island it doesn't work then don't opt in that element is already there case longer

[2:40:41] Voice 7: yeah thank you i'm going to speak in support of this motion i had some like the idea of having

[2:40:48] Voice 7: a special housing agency for the Island Trust area.

[2:40:52] Voice 7: I have no problem with that.

[2:40:53] Voice 7: And there can be exploration of funding, et cetera.

[2:40:57] Voice 7: My concern rests with the source of the motion,

[2:41:02] Voice 7: which is the Section 8.2.E of the Island Trust Act.

[2:41:06] Voice 7: Because if you read that, that section says,

[2:41:09] Voice 7: make recommendations to the LGIC respecting determination,

[2:41:13] Voice 7: implementation, and carrying out the policies
