[0:00:40] Trustee Fast (probable): that during our meeting. I'm Sue Ellen Fast. I'm elected on Newt Gwalachon or Gwalachon

[0:00:48] Trustee Fast (probable): which is also Bowen Island and I'm chair of the Hornby Local Trust Committee and

[0:00:53] Trustee Fast (probable): I'm joined today by Hornby Island Local Trustees Greg Scott and Alex Allen. So

[0:04:55] Trustee Fast (probable): And this is where I wanted to report on what your local trust committee passed in a closed meeting back on November 26th, 2021.

[0:05:09] Trustee Fast (probable): So we had a closed meeting and I'm actually going to rise to report.

[0:05:13] Trustee Fast (probable): Never get to do this.

[0:05:14] Trustee Fast (probable): It was requested by the Senior Policy Advisor, Wilcox, that the Hornby Island Local Trust Committee support the Comox First Nation Cultural Heritage Policy with the following motion.

[0:05:25] Trustee Fast (probable): It's a long one.

[0:05:26] Trustee Fast (probable): That the Hornby Island Local Trust Committee request staff to develop an internal policy for approval consideration by the Hornby Island Local Trust Committee that

[0:05:35] Trustee Fast (probable): initiates an internal information sharing process with the Comox First Nation so they may consider citing and use permit applications with the nation.

[0:05:44] Trustee Fast (probable): requires on receipt of a complete citing and use permit application

[0:05:48] Trustee Fast (probable): that staff forward to the Comox First Nation within 20 days

[0:05:51] Trustee Fast (probable): a copy of the citing and use permit application

[0:05:53] Trustee Fast (probable): with personal information redacted for Comox First Nation review,

[0:05:58] Trustee Fast (probable): requires any feedback from Comox First Nation be provided

[0:06:01] Trustee Fast (probable): in writing later than 60 days after the date

[0:06:04] Trustee Fast (probable): the citing and use permit application was sent to the Comox First Nation,

[0:06:07] Trustee Fast (probable): and states that despite this information sharing process,

[0:06:11] Trustee Fast (probable): the Hornby Island Local Trust Committee remains a decision maker

[0:06:14] Trustee Fast (probable): here, and we'll process siting and use applications as per the Islands Trust Act, its policies,

[0:06:18] Trustee Fast (probable): procedures, and by-law requirements, and that the Hornby Island Local Trust Committee rise

[0:06:24] Trustee Fast (probable): and report an open meeting on its decision on sharing of siting and use permits with

[0:06:29] Trustee Fast (probable): the Comox First Nation.

[0:06:30] Trustee Fast (probable): So that's what I've done.

[0:06:31] Trustee Fast (probable): So just to let you know about that level of cooperation and reconciliation that the Hornby

[0:06:38] Trustee Fast (probable): Island Local Trust Committee passed.

[0:06:39] Trustee Fast (probable): So that's all I have to rise and report, except that also at that meeting, I think we may have adopted minutes.

[0:06:59] Trustee Fast (probable): And trustee reports. So Alex and Grant, who would like to start this time and tell us about what you've been busy with since our previous meeting, which was February the 18th?

[0:07:12] Voice 1: Alex is my superior in this.

[0:07:14] Voice 1: He was elected first.

[0:07:16] Voice 4: Go ahead, Alex.

[0:07:17] Voice 4: Do you know that when you're called AA, you're almost first from day one?

[0:07:21] Voice 4: So you want me to go first?

[0:07:22] Voice 4: Is that what you said?

[0:07:23] Voice 4: I thought

[0:07:23] Trustee Fast (probable): you wanted to be up here by two.

[0:07:25] Voice 1: Just say it.

[0:07:26] Voice 1: Okay.

[0:07:27] Voice 1: So I have three things to report.

[0:07:29] Voice 1: First of all, the last trust council meeting was interesting, painful, and it dealt with three issues.

[0:07:40] Voice 1: And a lot of it's come out. You've got it through emails. It's been sent out. Paper copies. It's on three main issues. One is it was a management review done of the trust as a whole, and it was condemning as a bit heavy, but it said there's a lot of issues that the trust should look at on our prestige forum.

[0:08:00] Voice 1: the second thing is there's a policy review going on and that's been strongly criticized

[0:08:04] Voice 1: for a bunch of different reasons so that's been carefully looked at it's gone back to

[0:08:09] Voice 1: the drawing boards and i think the fundamental question is um there's preserve and protect

[0:08:16] Voice 1: then there's the community issues that of course affect that and how how far down the road does

[0:08:22] Voice 1: the trust go in some of these like water for example do we have to take over the water

[0:08:28] Voice 1: of management branching you know so there's a forestry how far do we have to go in forestry

[0:08:33] Voice 1: so all these questions are are coming out in this policy review and it's very interesting

[0:08:38] Voice 1: and people are taking it very seriously some people are saying it's getting way too restrictive

[0:08:42] Voice 1: uh so anyway so that that's going on right now the last budget review kind of touched on some

[0:08:48] Voice 1: of these other things but it was also very interesting about just how the budget's been

[0:08:52] Voice 1: going up there was a survey when i went around the budget and it generally said to hold it even

[0:08:56] Voice 1: and then so that that was so those three things really came out of the trust council meeting and

[0:09:02] Voice 1: that's there's a meeting coming up what is it it's in june

[0:09:06] Voice 1: june there was another meeting and then

[0:09:07] Voice 1: the elections there'll be another meeting in the fall and then the elections are in november and

[0:09:13] Voice 1: it's going to become an election issue for sure there's it's going to be people on all sides of

[0:09:18] Voice 1: that guaranteed it's going to be a very interesting election so the second thing i want to report on

[0:09:22] Voice 1: Karen and I and David Cushley are going down to Victoria on the 11th of May to meet with two cabinet ministers, Josie Osborne, what's the Minister of Transport's name?

[0:09:33] Voice 1: Rob Fleming.

[0:09:34] Voice 1: Yeah, Rob Fleming, to meet on the ferry issue.

[0:09:37] Voice 1: The main points, the main one we're pointing out that's interesting getting the most traction with them is the safety issue because what's happening in the summer is one lane going down to the ferry has become an extension to the ferry's parking lot, right?

[0:09:51] Voice 1: there's not enough room down there to put all the cars so that blocks off one lane so in the summer

[0:09:57] Voice 1: it's hot people are out of their cars they're moving around there's kids playing you know

[0:10:01] Voice 1: there's all it's a long way people can't be in their cars in this heat the bathroom facilities

[0:10:07] Voice 1: people walk a lot of people walk all the way down apparently last summer there were so many people

[0:10:12] Voice 1: went in the sewer backed up they couldn't handle the number of people down there so we're going to

[0:10:16] Voice 1: to be pointing all this out to the minister and we used when joseph karen and i met with

[0:10:23] Voice 1: minister osborne who was the mayor of the field and said look it's like your highway down down

[0:10:30] Voice 1: there was blocked for five hours each way on some days can you imagine the impact that would have

[0:10:36] Voice 1: on the people coming to the island and your people getting having to get the facilities medical

[0:10:40] Voice 1: that one really she said at the end that really made it real to me it was interesting wasn't it

[0:10:46] Voice 1: carroll you can talk about all the other stuff that made it real to her so we'll probably say

[0:10:52] Voice 1: that again just just to get through to her but we're going to talk about safety and liability

[0:10:57] Voice 1: because i think the promise is hugely liable if somebody's hurt when the ferry corporation

[0:11:02] Voice 1: is using that lane down there as an extension to the ferry parking lot so we're going to be

[0:11:07] Voice 1: pointing these things out and the solution as we've come to is there's only one they can't

[0:11:12] Voice 1: extent the parking lot there's nowhere down here to put it we simply need a bigger ferry to move

[0:11:16] Voice 1: people on and off the island faster that's that's that's the bottom line and that's the government

[0:11:22] Voice 1: the government has to provide the funding to the ferry corporation for that bigger ferry to deal

[0:11:28] Voice 1: with the issues already so uh then there's the thatch issue but i i think it's going to come

[0:11:34] Voice 1: more later. So those are the things that are rattling around in my world.

[0:12:00] Voice 4: Council is very interesting. We laughed, we cried, we united, we stand, we fight, we fall.

[0:12:07] Voice 4: As I wrote, if anybody reads any of my reports in the first edition, it is a very divisive group right now at the Trust Council level.

[0:12:15] Voice 4: It's really very interesting seeing that, especially with the return, because it's challenging because we've got some very big issues.

[0:12:24] Voice 4: And if we're not in agreement with some of us, it's just going to be interesting how we're going to proceed with all that.

[0:12:33] Voice 4: Yeah, so the governance review is huge, and I'm one of those on board that I do agree with it,

[0:12:41] Voice 4: having had three terms, seeing how the trust is being operated,

[0:12:45] Voice 4: and just how the communities feel about the trust.

[0:12:50] Voice 4: We are wondering what it's doing and why it exists, et cetera.

[0:12:55] Voice 4: and it's also an exciting time to

[0:12:57] Voice 4: change it and do something new and different

[0:12:59] Voice 4: because we are already a unique

[0:13:01] Voice 4: entity so let's

[0:13:02] Voice 4: keep it that way if we can

[0:13:06] Voice 4: what else

[0:13:08] Voice 4: I'm not going to talk too much

[0:13:10] Voice 4: because as you know

[0:13:11] Voice 4: I was going to report what I missed

[0:13:43] Trustee Fast (probable): going to just be brief as well. If you look at 15.1 in your agenda package, page 104, there's a, for those who are following online or whatever, the Trust Council decision highlights, I put them in there.

[0:14:01] Trustee Fast (probable): about. I thought that might be helpful. And this whole agenda is online. It's over 100 pages, if you look at the whole thing.

[0:14:11] Trustee Fast (probable): um uh yeah we get up that's on page 104 that's right so um i just wanted to report uh i am active

[0:14:22] Trustee Fast (probable): on the executive committee that's uh the four the three vice chairs and the chair so we're supposed

[0:14:28] Trustee Fast (probable): to implement um what trust council decides and uh and we also um vice chair these these meetings we

[0:14:36] Trustee Fast (probable): We sit as a chair, as the off-island chair on these meetings.

[0:14:40] Trustee Fast (probable): So I was on Gambier, for Gambier Island in Howe Sound.

[0:14:46] Trustee Fast (probable): We met in North Vancouver and in a community center recently.

[0:14:51] Trustee Fast (probable): We, I had Denman on the 22nd.

[0:14:56] Trustee Fast (probable): We met there for a farm meeting.

[0:14:59] Trustee Fast (probable): And then, and before that, we had a special, well, that was then.

[0:15:07] Trustee Fast (probable): 21st, sorry, my mistake.

[0:15:10] Trustee Fast (probable): And I've been in Bowen Island Council meetings where you'll be bored to hear,

[0:15:16] Trustee Fast (probable): but I won't tell you about them except to say that the municipal budget is looking at,

[0:15:21] Trustee Fast (probable): like, will probably be 7.8% increase this year,

[0:15:25] Trustee Fast (probable): just because of all the various costs and the infrastructure breaking down

[0:15:29] Trustee Fast (probable): and that kind of thing, lots of roads.

[0:15:32] Trustee Fast (probable): and then

[0:15:34] Trustee Fast (probable): we had a

[0:15:36] Trustee Fast (probable): what was that? I don't know exactly

[0:15:39] Trustee Fast (probable): okay and

[0:15:41] Trustee Fast (probable): I wanted to mention the

[0:15:43] Trustee Fast (probable): Howe Sound Community Forum which is like your

[0:15:45] Trustee Fast (probable): Bain Sound Forum, had that a couple of weeks

[0:15:48] Trustee Fast (probable): ago and that was very

[0:15:49] Trustee Fast (probable): interesting because

[0:15:52] Trustee Fast (probable): we can see how much change

[0:15:54] Trustee Fast (probable): is happening around the sound

[0:15:55] Trustee Fast (probable): but we're all now united under the

[0:15:58] Trustee Fast (probable): UNESCO Biosphere

[0:15:59] Trustee Fast (probable): Reserve as well so we're starting to think about

[0:16:01] Trustee Fast (probable): how can we work towards even more sustainably uh sustainable future together through the house on

[0:16:09] Trustee Fast (probable): biosphere region and then that's mostly where i'll stop except to say that i went to a couple of uh

[0:16:18] Trustee Fast (probable): workshops uh association of vancouver island and coastal communities uh was a convention um held

[0:16:26] Trustee Fast (probable): held in Victoria on April 1st, 2nd, and 3rd,

[0:16:31] Trustee Fast (probable): and also the Local Government Leadership Academy.

[0:16:35] Trustee Fast (probable): Both of these are gatherings of elected folks

[0:16:38] Trustee Fast (probable): from around different parts of British Columbia,

[0:16:40] Trustee Fast (probable): and all kinds of people are feeling the unrest on social media.

[0:16:46] Trustee Fast (probable): There was lots of information about how communities are,

[0:16:52] Trustee Fast (probable): especially elected officials,

[0:16:54] Trustee Fast (probable): are having difficulties with social media being social.

[0:16:57] Trustee Fast (probable): And also the convoys were more in people's minds at that time

[0:17:02] Trustee Fast (probable): than they had come down from.

[0:17:03] Trustee Fast (probable): Some communities are feeling it even worse.

[0:17:06] Trustee Fast (probable): Anyway, I'll just stop there and say that people are wondering

[0:17:10] Trustee Fast (probable): who's going to be running again

[0:17:11] Trustee Fast (probable): and that the situation all across BC is fraught for elected officials.

[0:17:19] Trustee Fast (probable): But there were lots of solutions, and I came out energized

[0:17:22] Trustee Fast (probable): and with more contacts in the other communities

[0:17:25] Trustee Fast (probable): that have problems similar to Bowen Island, anyway, not necessarily the same as the Trust,

[0:17:31] Trustee Fast (probable): although there was another organization, Squamish, that has been receiving a funded,

[0:17:38] Trustee Fast (probable): coordinated campaign against things that they're doing and some of their leaders.

[0:17:45] Trustee Fast (probable): So I'll just stop there and say no electoral area directors report,

[0:17:51] Trustee Fast (probable): and we'll move into the public comment aka town hall so who would like to make

[0:18:01] Trustee Fast (probable): a comment if you'd like to make a comment okay a couple people are here to

[0:18:05] Trustee Fast (probable): comment I'm just checking our guidelines specific to Hornby here and

[0:18:11] Trustee Fast (probable): inform trustees about topics relevant to our area and we've got ten minutes set

[0:18:48] Voice 17: am here because I am part of HI-SEEK right now,

[0:18:52] Voice 17: but I have also worked... Can you remind me what HI-SEEK is? Economic Community Economic Development.

[0:18:58] Voice 17: Thank you. I just wanted to be sure. I've also worked on affordable housing for the last 25 years

[0:19:05] Voice 17: and despite all that the island has done, we still are sadly needing much more affordable housing.

[0:19:14] Voice 17: After considering many different options, it seems that one option which might be the

[0:19:25] Voice 17: quickest and the cheapest and the most feasible is to acquire a piece of crown land and have

[0:19:32] Voice 17: it be a manufactured home park or a mobile home park, an MHP.

[0:19:39] Voice 17: Right. So, first of all, we looked at a piece of land which is in the PA zone, and realized that this adds a whole level of complication to getting this done quickly.

[0:19:56] Voice 17: We're thinking maybe

[0:19:57] Voice 1: we should move forward.

[0:19:57] Voice 1: I don't want to interrupt you, but when you say we, who would it be? Is that Hi-Seek?

[0:20:04] Voice 17: Just because, I mean, it's anybody who wants to work with me, but nobody wants to work with me very many.

[0:20:16] Voice 17: So first of all I would like to ask if it would be, if it is a long process to get a piece of land

[0:20:24] Voice 17: moved from PUA to PU, that's my first question, and the second question is no matter which piece

[0:20:31] Voice 17: of land we choose it's going to have to have some work done on it so that it could be acceptable as

[0:20:39] Voice 17: a manufactured home park and we want the zoning to be very flexible to allow our definition of

[0:20:45] Voice 17: a mobile home so that it can include things specific to the island like yours

[0:20:53] Voice 17: and we need to do this very quickly so it really is a plea to the trust to help us shepherd this

[0:21:00] Voice 17: project through so that we can have housing for people who are already living here who are working

[0:21:07] Voice 17: and who are camping in the bush and having campfires, which could endanger the whole island during the summer.

[0:21:49] Voice 6: I'm a 22-year resident of the island and an active volunteer. I sit on the High Seat Board with Catherine and I'm trying to work in housing as well as I actually sit on the Short-Term Rentals Association Board.

[0:22:04] Voice 6: There's numerous other boards I don't want to. Anyways, I'd like to thank you for this opportunity to speak to the Trust Committee. I'm here to speak about the recent APC process with respect to short-term rentals and the resulting report.

[0:22:16] Voice 6: First of all, I'd like to say that I do not have, personally, a short-term rental, so I don't feel like I'm in conflict, and I kind of look at this on a community-wide process.

[0:22:27] Voice 6: And I've looked at this from day one, because when I moved to Hornby, it's always been a topic.

[0:22:32] Voice 6: So in December of 2012, the Islands Trust outlined the community consensus on STR activity.

[0:22:37] Voice 6: This followed an intensive consultation process of stakeholders, which included meetings which I attended, both on Hornby and in Victoria.

[0:22:45] Voice 6: I didn't attend the one in Lower Mainland, and there was great efforts done by the Trust to have this come to a community agreement.

[0:22:53] Voice 6: So they really reached out. I'm sure it was a very costly process because of it, but that was one that I was actively involved in.

[0:23:00] Voice 6: And so at the end, five years after that, they did a follow-up review, the Trust did, and they conducted a survey they put out to the community.

[0:23:09] Voice 6: Again, you know, what is the thought about short-term rentals?

[0:23:12] Voice 6: is it something that we want continued here in the likes of that and the

[0:23:16] Voice 6: consensus was that vacation rentals are beneficial to the island and I

[0:23:20] Voice 6: confirm that it is beneficial to the island, that's my perspective. Recently

[0:23:26] Voice 6: as in the last year probably, members of the APC while extremely

[0:23:30] Voice 6: well-meaning and diligent approached the referral with a bias against vacation

[0:23:34] Voice 6: rentals, that's my opinion. Although looking at a wide variety of

[0:23:38] Voice 6: documentation they overlooked the importance of the true hornby local community input that was

[0:23:43] Voice 6: done in 2012 and in 2017. um regularly the only way major visions should be suggested to change

[0:23:52] Voice 6: any short-term vacation as a policy is through extensive community consultation prior to

[0:23:57] Voice 6: drafting any bylaws and i don't know if that's the process intended here but i actually feel like

[0:24:02] Voice 6: That needs to be done. The current process, I feel, was non-representative of grassroots input.

[0:24:11] Voice 6: The composition of the voting members of the AP excluded any actual stakeholders, SDV or stakeholders,

[0:24:17] Voice 6: business people, young people, long-term community members, multi-generational families who have families living here.

[0:24:23] Voice 6: They represent the future of the islands and do not see them living here simply as an elitist retirement haven.

[0:24:27] Voice 6: My concern is, when the trust is under fire like they are right now for the budget, why are we revisiting an issue that, as a community member, I feel like we've really done good community consultation already?

[0:24:40] Voice 6: And why are we looking at changing bylaws when we had good consultation already? And how much more money needs to be spent to do this?

[0:24:49] Voice 6: So, you know, I did read through your agenda package in detail, I read through the APC report in detail, and I feel like they used the list of names as consultation people, but they weren't.

[0:25:03] Voice 6: I don't think they were truly consulted, not everyone, maybe some of them were, but I do feel that it was approached from a perspective of bias, and I would like to see this revisited prior to bylaws being drafted.

[0:25:49] Voice 2: BC Transit is doing a review, a strategic plan for the Comox Valley on transit.

[0:25:56] Voice 2: And in 2014, the last time they did it, Hornby and Denman were not at the table.

[0:26:01] Voice 2: So we were missed in transit planning in the short term,

[0:26:06] Voice 2: and Denman had a dotted line across it for the long term.

[0:26:09] Voice 2: So we locally have initiatives where we've got transit started on our own without any assistance or support from BC Transit.

[0:26:19] Voice 2: Right now, they are redoing their strategic planning.

[0:26:22] Voice 2: And it's really important that the trust puts a position forward to them that, you know,

[0:26:30] Voice 2: we need to move people, not cars.

[0:26:32] Voice 2: We need to have a poverty lookout from people that can't afford or don't have a driver's

[0:26:40] Voice 2: license.

[0:26:41] Voice 2: The bus users tend to be the preschool, the teenagers, the young workers that don't have

[0:26:47] Voice 2: a driver's license yet, seniors that maybe can't drive anymore.

[0:26:50] Voice 2: more um and people going to work so it's really important that the trust is involved in that um

[0:26:57] Voice 2: position for us did

[0:29:01] Voice 2: Do vacation rentals provide rental housing? Because at the very best, it's reluctant landlords and unsatisfied tenancies for renters because they have to move out.

[0:29:13] Voice 2: The provincial government precludes fixed-term contracts. It's just a no-go. It's not the way to go about housing.

[0:29:21] Voice 2: I really would appeal to the Trust to look at the big picture and look at rezoning.

[0:29:27] Voice 2: If somebody comes forward with a project, that should be top priority.

[0:29:31] Voice 2: The work that Catherine is doing, this is public land.

[0:29:36] Voice 2: We should be able to put public housing on it.

[0:29:38] Voice 2: We've got to get that right up at the top of the list.

[0:29:41] Voice 2: 15-unit development like at the Thatch, we've got to really help those private individuals get housing on the market here.

[0:34:23] Voice 18: amount of time asking for resource people to attend the meetings, and we did have resource

[0:34:29] Voice 18: people attending regularly with voice, but no vote, as is required by our local government.

[0:34:37] Voice 18: The resource people I would like to have for the record were people from High Seat, so

[0:34:44] Voice 18: So Catherine Rowland attended, and then Rudy Rogalski attended regularly.

[0:34:49] Voice 18: We had two representatives from ISTRA, the Short-Term Rental Association,

[0:34:54] Voice 18: and that was Ray Therrien and Patrick Louie, who attended regularly for five months.

[0:35:04] Voice 18: April Lewis, or Sadie Chizanko, my aunt, a person under 30.

[0:35:11] Voice 18: Me, though.

[0:35:13] Voice 18: I attended from Hornby Island Housing Society, and we were in constant contact also with the chair around some documents.

[0:35:23] Voice 18: We had submissions from Tony Law, from Fred Hunt, from Ed Hefner, from Gina Ray.

[0:35:29] Voice 18: So, our feeling is that what we attempted to do, and I believe we have done, is to cast our door, our net, as wide as possible and keep the door open for people to attend.

[0:35:45] Voice 18: We believe that we were given this responsibility because the local trustees are responding to concern about housing on this island.

[0:35:55] Voice 18: And there is no doubt, there is no doubt that housing on this island is completely interrelated with short-term rentals.

[0:36:07] Voice 18: That is not something that some biased members of an APC came up with.

[0:36:12] Voice 18: That is a national conclusion.

[0:36:15] Voice 18: So we proceeded from there.

[0:36:17] Voice 18: We also believe, this is my second point, that this is the beginning, the very, very beginning of a process of community consultation.

[0:36:27] Voice 18: In 2017, yes, some people agreed that short-term rentals were a good thing.

[0:36:34] Voice 18: Since then, there have been other voices.

[0:36:38] Voice 18: And so our understanding is that these recommendations will be cast into language that will become part of the community discussion.

[0:36:46] Voice 18: And there will be abundant opportunity for all kinds of voices here.

[0:36:52] Voice 18: I think education and awareness about what it is the Trust does is really important.

[0:36:59] Voice 18: And education and awareness about what our task was is also really important.

[0:37:04] Voice 18: It is discouraging to already hear comments that underscore the work that seven very dedicated people did,

[0:37:13] Voice 18: trying hard to accommodate the voices of the community this is a community

[0:37:19] Voice 18: problem it will take a community to solve this problem and I hope that we as

[0:37:27] Voice 18: a community and the community groups in this community can work in concert to

[0:37:34] Voice 18: bring out more opportunities for available housing to understand what the

[0:37:39] Voice 18: issues are and to tackle some of the problems that are abundant and

[0:37:44] Voice 18: abundantly voiced in this community that's really all i had to say and i'm if it's appropriate would

[0:42:35] Voice 4: And I do understand the fact that vacation rentals, if it's not

[0:42:40] Voice 4: a vacation rental, it's not going to become a year-round housing. That's reality. And

[0:42:43] Voice 4: I do have a suggestion with the housing group I'd like to talk to in a break about another

There's a local trust committee. It's our responsibility to take that and do something with it. So that's the first thing. There is a process of public consultation.

[0:43:19] Voice 1: to take into account everything that you've said, you said earlier, there's no doubt about that.

[0:43:25] Voice 1: I mean, we'd be crucified if we tried to push it through without that public consultation.

[0:43:30] Voice 1: We're well aware of that.

[0:43:32] Voice 1: We also recognize the importance of this issue as well as getting the OPC fixed.

[0:43:37] Voice 1: We, Alex and I, put out for $15,000 to help us do this, to take the advisory planning commission report

[0:43:46] Voice 1: and to be able to set up the public consultation meetings and to work with

[0:43:51] Voice 1: the staff to be able to come back and say these are the recommendations that

[0:43:56] Voice 1: we feel the community can it's going to be hugely divisive as you know it's not

[0:44:00] Voice 1: going to be easy but that's the process that we have to go through and the whole

[0:44:04] Voice 1: Trust Council supported they recognized the validity of it if we can do it the I

[0:44:10] Voice 1: think the reason they passed it actually was we said others will be able to use

[0:44:14] Voice 1: it as a process to revise their everybody's got similar problems so

[0:44:20] Voice 1: that's what I'm looking forward to is this process to get the APC and the

[0:44:26] Voice 1: bias thing everybody's got I don't see the bias because I just look past it to

[0:44:31] Voice 1: say what are the people recommended what's the process we get to put in

[1:34:32] Voice 7: that all of the readings have to be done in public meetings, and all those agendas are

[1:34:39] Voice 7: So, public engagement can occur before first reading, and it can happen after, kind of

[1:34:48] Voice 7: anywhere in between, if it's discretionary.

[1:34:52] Voice 7: At Island's Trust, we typically do at least one community information meeting, and we will typically do one adjacent to a local care.

[1:35:39] Voice 7: A consultant, the average going rate for consultants at the moment is about $150 an hour.

[1:35:47] Voice 7: And so the entire $15,000, we used all of it for consulting time, would cover about

Chair Fast rose and reported that at the last in-camera meeting, in response to a request from 
Senior Intergovernmental Policy Advisor Lisa Wilcox for the Hornby Island Local Trust 
Committee (LTC) to support the K’omoks First Nation Cultural Heritage Policy, the following 
motion was passed:

1. that the Hornby Island Local Trust Committee request staff to develop an internal policy for 
approval consideration by the Denman Island Local Trust Committee that: 
a. initiates an internal information-sharing process with the K’omoks First Nation so they 
may consider siting and use permit applications with the Policy;

4.1 Trustee Reports 
Trustee Scott reported on the following: 
 Attendance at the last Trust Council meeting involved many differences of opinion 
regarding the Governance Management Review, the draft Trust Policy Statement, 
and the recently passed Trust budget. 
 Plans to attend an upcoming May 11, 2022 meeting in Victoria with Cabinet 
Ministers Josie Osborne and Rob Fleming to discuss ferry safety liability issues and 
the possibility for a larger ferry; Karen Ross and Denman Island Trustee David 
Critchley also plan to attend. 
 
Trustee Allen reported on the following: 
 Attendance at the last Trust Council meeting where there was much interesting, 
divisive, and challenging commentary. 
 Involvement with and support of the Governance Management Review. 
4.2 Chair's Report 
Chair Fast reported on the following: 
 ‘Trust Council Decision Highlights’ document on page 104 of the present LTC 
agenda.  
 Recent participation as Vice-Chair of the four-member Executive Committee of the 
Trust Council. 
 Chairing the Gambier Island Local Trust Committee meeting recently held in North 
Vancouver. 
 Chairing the Denman Island Local Trust Committee recent special ‘Farm’ meeting. 
 Chairing Bowen Island Council meetings whose municipal budget will likely be 
increased by 7.8 percent this year. 
 Recent attendance at the Howe Sound Community Forum as part of a biosphere 
region within the Unesco Biosphere Reserve.  
 Attendance at the April 1, 2 and 3, 2022 Association of Vancouver Island and Coastal 
Communities and the Local Government Leadership Academy Convention in 
Victoria.

4.3 Electoral Area Director's Report 
None 
5. TOWN HALL  
Members of the public commented on the following: 
 Acquiring Crown land for a mobile home park may be the quickest, cheapest, most feasible 
affordable housing solution. The land could be moved from the Public Use PU (a) zone to 
Public Use (PU) zone and the zoning could be made flexible, acceptable, and specific to the 
needs of Hornby Island. This rezoning needs to occur quickly to accommodate young people, 
elders and people living in the bush, whose campfires may endanger the entire island. 
 The present Advisory Planning Commission is biased against short term vacation rentals 
(STR)s and have overlooked 2012 and 2017 community consultation records of support for 
STRs. Why is the issue being revisited when it was so thoroughly addressed in the recent 
past? Also, the current meeting process of the APC is non-representative of a broad 
selection of the community.  
o Trustee Grant noted that there would be upcoming extensive community consultations 
on the APC recommendations. 
 Speaking as a designated speaking alternate for Electoral Area Director Daniel Arbor, Karen 
Ross reported that the Comox Valley Regional District (CVRD) was presently conducting a 
region wide review of BC transit services; that Denman and Hornby Islands were missing 
from the last 2014 review; and, that it is important that the Trust get involved given that 
many members of the Hornby public need local bus service. 
 The LTC needs to consider rezoning options for affordable housing projects as a top priority. 
 Regarding the Temporary Use Permit (TUP) for the smoke/fish shop, will the TUP be 
reissued? 
o Chair Fast invited the member of the public to contact a planner. 
 A petition regarding Seawright Road was in process. 
6. DELEGATIONS 
6.1 Wendy Burton for Advisory Planning Commission Recommendations 
APC Chair Wendy Burton presented the recently completed four-page APC report titled 
‘Housing and Short Term Rentals Recommendations from Hornby Island Advisory 
Planning Commission March 29, 2022,’ noting that considerable time had been spent 
seeking community input and that the following resource persons with a voice but no 
vote had attended the APC meetings regularly over 5 months: Sadie Chezenko and April 
Lewis, members of the Hornby Island Housing Society; Katherine Ronan and Rudy 
Rogalsky, members of the Board of the Hornby Island Community Economic 
Enhancement Corporation (HICEEC); and Patrick Lui, Secretary of the Hornby Island 
Short Term Rental Association (HISTRA); and, that written submissions were received 
from Tony Law, Ed Hoeppner, Gina Horvath, and Fred Hunt.

Regional Planning Manager Kauer presented the staff report on the updated Siting and 
Use Permit Bylaw 168 which removes outdated references and processes contained in 
the older Siting and Use Permit bylaw and which adds a new requirement that site plans 
within 1 meter of a required setback be professionally drawn rather than hand drawn by 
the applicant to reduce error.

Chair Fast, Trustees, and Regional Planning Manager Kauer noted the following: 
 The original ferry sign at Buckley Bay which included requesting visitors to Denman 
and Hornby to be protective of the sensitive ecology of the islands has been lost for 
many years and BC Ferries does not know what happened to it. 
 K’omoks First Nations had previously suggested that they be contacted for comment 
about welcome/entry signs after a sign is designed.

Regional Planning Manager noted that this bylaw regarding minimum average lot areas, 
had already gone through all three readings and executive and ministry approval, and 
was being presented to Trustees for final adoption.

9.2 HO-DVP-2022.1 – Hornby Island Resorts- update 
9.2.1 Staff Report dated February 18, 2022 
Regional Planning Manager Kauer presented the staff report which asks that 
Trustees approve the application from Hornby Island Resort for variances for a 
building height extension and a sewage disposal field setback decrease. 
The applicant joined the meeting after the presentation of the staff report at 
11:56 am and spoke on the application. 
Trustees expressed support for the height variance but concern about future 
wind and tide erosion of the proposed septic field variance; and, questioned if 
K’omoks First Nations had fully approved the variances, given that the staff 
report dated February 18, 2022 was being re-presented today without updates. 
o Regional Planning Manager Kauer responded that staff had received, only 
two days ago, an email correspondence from Todd Boychuk, K’omoks 
Director of Intergovernmental Relations, and could forward this email to 
Trustees if K’omoks First Nations approved the forwarding of the email; and, 
that she could confirm that the correspondence indicated K’omoks First 
Nation had no concerns with the variances.

Regional Planning Manager Kauer presented on a whiteboard the process of turning 
APC recommendations into formal bylaws within a budget of $15,000, noting the 
following: 
 that referral to First Nations and a Public Hearing and public readings of the bylaws 
were required by legislation, but that other or extra forms of public engagement 
were discretionary.  
 that hiring a consultant to draft bylaws at $150.00 per hour for 100 hours could take 
up the entire budget. There may be some limited capacity for a planner to draft 
bylaws. 
 Public hearings cost approximately $800.00; survey monkey is very low cost; First 
Nations expect money for their time spent looking at LTC referrals. 
 Part of the budget could go to a public meeting facilitator. 
 For online surveys, there was a system to ensure only one response per IP address. 
 
APC Chair Burton and Trustees agreed that a public information meeting was better 
held before any drafting of bylaws. 
 A member of the public noted that off island property owners needed access to the 
public engagement process.

with a detailed work plan based on the Advisory Planning Commission

that the Hornby Island Local Trust Committee endorse the following text for inclusion in 
the 2021-2022 Annual Report for approval by the Islands Trust Council and submission 
to the Minister of Municipal Affairs & Housing:  
 
The Hornby Island Local Trust Committee (HOILTC) held five regular business meetings, 
one Public Hearing, one special business meeting and one special meeting/in camera 
meeting in the 2021/22 fiscal year, for a total of eight meetings.  
 
Work for this period focused on advancing the HOILTC priorities to address freshwater 
sustainability, the Hornby Island Official Community Plan and Land Use Bylaw. The LTC 
gave three readings to an Official Community Plan amendment bylaw and adopted a 
Land Use Bylaw amendment focused on clarifying the minimum average lot area for 
subdivision.  
 
The HOILTC also amended their Meeting Procedures Bylaw to allow all LTC meetings to 
be electronic when needed.  
 
From April 1, 2021 to March 31, 2022, the HOILTC received and considered applications 
for six development variance permits, three development permits, and one temporary 
use permit. During the same time period staff also reviewed 16 siting and use permits, 
one crown lease referral, and one subdivision referral.

District Tax (MRDT) ‘Pillow’ tax.

Municipal Regional District Pillow tax needs support and approval from the Local Trust 
Committee on top of Comox Valley Regional District approval, or not.

planning staff for a pre-application meeting regarding the rezoning of a piece of land 
proposed for affordable housing, adding that people who are not the owners of a parcel 
of land can apply for its rezoning with the owner’s permission.

Regional Planning Manager Kauer clarified that land zoned agriculture is not necessarily 
also in the Agriculture Land Reserve and the two categories have different rules around 
second dwellings.
