[0:00:17] Trustee Fast: and this is I just want to begin by acknowledging that we're fortunate to be able to gather today
[0:00:23] Trustee Fast: in locations across the traditional territories, unceded territories usually of the Coast Salish
[0:00:28] Trustee Fast: people, especially the Comox for Hornby Island. I'm Sue Ellen Fast, elected on Bowen Island and
[0:00:35] Trustee Fast: chair of the Hornby Island Local Trust Committee. And I'm joined today by Hornby Island trustees,
[0:00:40] Trustee Fast: Alex Allen. Can you give a little wave? There we are. And Grant Scott. And together, we make up the
[0:00:48] Trustee Fast: Hornby Island Local Trust Committee. We're your elected Hornby Island representatives. I'm coming
[0:00:54] Trustee Fast: to you from Bowen Island, also called in the Swamish nation language, which is the territory
[0:01:02] Trustee Fast: I'm in. Today I haven't, so I'm the off island chair and the Alex and Grant are your local
[0:01:09] Trustee Fast: trustees. As you know, this meeting is being recorded. For those who can't attend today,
[0:01:15] Trustee Fast: the meeting will be available on the Islands Trust website in the next few days. And when we get to
[0:01:21] Trustee Fast: the town hall portion of the meeting, because this is a Zoom webinar, you can raise your hand

[0:01:51] Trustee Fast: I just want to introduce some people who may be joining us today.
[0:01:55] Trustee Fast: Director Arbour from the Regional District.
[0:01:59] Trustee Fast: We didn't hear from him, so I'm not sure if he'll be able to join us.
[0:02:04] Trustee Fast: But back to the staff, we've got Heather Carr, our Regional Planning Manager.
[0:02:08] Trustee Fast: And Heather is running the meeting and also is being our Regional Planning Manager.
[0:02:15] Trustee Fast: and we've got Stephen Ball who will be with us later today,
[0:02:21] Trustee Fast: Planner Ball and Catherine Vogt is our minute taker.
[0:02:25] Trustee Fast: So this is a regularly scheduled
[0:02:27] Trustee Fast: formal local government meeting.
[0:02:30] Trustee Fast: So we have a professional minute taker with us.
[0:02:35] Trustee Fast: This meeting is an official forum
[0:02:37] Trustee Fast: of the four year local trust committee
[0:02:39] Trustee Fast: to make decisions about land use planning matters
[0:02:42] Trustee Fast: and discuss relevant business like the core mandate
[0:02:46] Trustee Fast: mandate of the Islands Trust, which is to preserve and protect the islands for their unique
[0:02:53] Trustee Fast: attributes and the environment. And we're also going to treat it as a place of employment,
[0:03:00] Trustee Fast: despite the fact that staff and many of us are in our own homes. I would actually say,
[0:03:06] Trustee Fast: especially because we're in our own homes, this needs to be a safe and respectful workplace.
[0:03:11] Trustee Fast: place. That's part of the laws of British Columbia, as well as the other laws that we'll
[0:03:16] Trustee Fast: be following today. The Local Government Act and the Community Charter and perhaps other ones like
[0:03:24] Trustee Fast: the Islands Trust Act and others. So this is the way we run our meetings. And I hope everybody will
[0:03:30] Trustee Fast: help me keep it for as a safe, respectful meeting where we can make good decisions. Okay, so I'm
[0:03:37] Trustee Fast: going to go on to the um agenda part of our um meeting i just wanted to introduce a few things
[0:03:47] Trustee Fast: uh before i ask for additions or changes um we've got a guest with us today uh a delegation who'll
[0:03:54] Trustee Fast: be coming in by zoom and then we're going to go into a closed meeting so there'll be a little part
[0:03:59] Trustee Fast: where we're going to have to close the door uh the virtual door um to have a uh closed meeting
[0:04:06] Trustee Fast: meeting and that's 6.1 there you can read the description about it from the community charter
[0:04:13] Trustee Fast: which is another one of those provincial laws and then we'll come back we'll open the door
[0:04:18] Trustee Fast: and into the town hall session and we anticipate that will be around 11 30 and then we'll go on
[0:04:25] Trustee Fast: through the meeting and later on we're going to take a lunch break around 10 to 1 or I'll be
[0:04:31] Trustee Fast: checking in with people and um and then we're don't have to catch a ferry today but still i
[0:04:38] Trustee Fast: hope that we'll be uh done by two o'clock or thereabouts and i'd just like to uh having had
[0:04:44] Trustee Fast: some uh um not feeling 100 yesterday myself i would like to invite uh anybody as part of the
[0:04:51] Trustee Fast: meeting if you need a break let me know and uh because we have flexibility with zoom and uh we
[0:04:58] Trustee Fast: we need to take care of ourselves so we can not be distracted and we can make good decisions

[0:07:32] Trustee Fast: have a closed meeting following the public open meeting and uh we adopted minutes of the previous
[0:07:38] Trustee Fast: closed minute meeting uh at that time so that's uh where we are at and now we're into uh trustee
[0:07:49] Trustee Fast: reports so um who would like to start with their trustee report alex
[0:07:59] Trustee Allen: i i guess so because grant
[0:08:02] Trustee Allen: and jump up there um i guess i'll bring up the trust upcoming trust council which will be june
[0:08:09] Trustee Allen: 21st between 23rd it'll be electronic um and then tuesday evening on the 21st all those can
[0:08:18] Trustee Allen: yeah delegations and the public comments are always the interesting part of our trust councils
[0:08:22] Trustee Allen: and those are now held in the evening when we do our electronic version um it's going to be
[0:08:28] Trustee Allen: interesting as i've been keeping saying in my reports my written reports uh we've got the policy
[0:08:33] Trustee Allen: statement review um i don't know it's very i won't go into detail but i think i'll talk about it
[0:08:41] Trustee Allen: another day but uh it's very it's it's it's very what's going on is that we do have to address
[0:08:46] Trustee Allen: um where we're at islands trust that hasn't changed since the 70s and um you know the world
[0:08:54] Trustee Allen: has changed and we we've got to look at that and we also i will say that we are very fragmented and
[0:09:03] Trustee Allen: divided in both our communities and at the trust council level so i feel is it's particularly
[0:09:09] Trustee Allen: challenging times um when i was doing some reading and looking at news it's everywhere else emily
[0:09:16] Trustee Allen: adam also mentioned a good possibly like creating a citizens assembly which would be a really
[0:09:21] Trustee Allen: interesting thing in terms of addressing what's going on in this trust you know but as a writer
[0:09:27] Trustee Allen: noted that political vanity can get in the way and um people say why get the citizens to say anything
[0:09:34] Trustee Allen: because tasked to do with what i was elected to do was an actual fact they have a lot to say and i
[0:09:39] Trustee Allen: hope we will hear from that and then of course the governance review as well so uh why i'm bringing
[0:09:44] Trustee Allen: this up because i don't think it'll yeah it's going to be a big big meeting i'm sure both
[0:09:53] Trustee Allen: Both trustees can agree with that one.
[0:09:54] Trustee Allen: And I'm hoping we will not deal with it all in that meeting because it's a huge thing.
[0:10:00] Trustee Allen: And I think we've got to go very slowly on that one.
[0:10:02] Trustee Allen: So that's one thing.
[0:10:04] Trustee Allen: And then also coming up June 17th and Friday is the Bains Sound Lambert Channel Ecosystem Forum.
[0:10:11] Trustee Allen: And I'm sure Grant will go on about that because it's all about Grant.
[0:10:14] Trustee Allen: It's all about Herring.
[0:10:15] Trustee Allen: And I'm hoping to attend maybe going by Grant's boat, hopefully.
[0:10:22] Trustee Allen: Because the traffic is going to be terrible.
[0:10:23] Trustee Allen: here apparently because there's a bike there's a bike race on that saturday so anyways that's my uh
[0:10:29] Trustee Allen: my report and thank you very much thank

[0:10:44] Trustee Scott: the trust council issues um sue allen maybe you will as well what i want to talk about is
[0:10:49] Trustee Scott: is the issue on Hornby about the advisory planning
[0:10:53] Trustee Scott: commission's report to us.
[0:10:55] Trustee Scott: It's advisory.
[0:10:56] Trustee Scott: There's a lot of concern around what's perceived
[0:10:59] Trustee Scott: as us trying to overly control
[0:11:02] Trustee Scott: and restrict short-term vacation rentals.
[0:11:05] Trustee Scott: And I just want people to hopefully see people
[0:11:09] Trustee Scott: do understand that it's advisory.
[0:11:11] Trustee Scott: There's a community process involved
[0:11:13] Trustee Scott: before anything will change.
[0:11:14] Trustee Scott: There'll be community meetings on it.
[0:11:16] Trustee Scott: it'll go through a series of recommendations and changes as to how the official community
[0:11:23] Trustee Scott: plan and the line use bylaws will be changed to reflect what and we have to come to some
[0:11:29] Trustee Scott: consensus on the island and the i think the advisory planning commission has done a good
[0:11:34] Trustee Scott: job of trying of trying to do that is very very difficult to get consensus amongst the 900 or
[0:11:42] Trustee Scott: a thousand people on the island plus all the people that come in the summer their own own
[0:11:48] Trustee Scott: vacation property so it's complicated we do have some money that was allocated
[0:11:55] Trustee Scott: to help us do that so we'll be hiring someone to help us through that process and we're keen to
[0:12:02] Trustee Scott: get going on it but i want to assure people that alex none of us are going to impose anything
[0:12:08] Trustee Scott: thing that hasn't been well discussed on the island and the apc is the start of that process
[0:12:14] Trustee Scott: and so hopefully we'll be respectful of that um for what they've done so that that's uh and it's
[0:12:21] Trustee Scott: going to come up later on in the agenda as well but i i just want to reflect that's definitely
[0:12:25] Trustee Scott: an issue that's getting a lot of uh discussion on the island right now which is fair enough that's
[0:12:32] Trustee Scott: our job right to listen so the second thing is alex mentioned is this bain sound forum and it
[0:12:37] Trustee Scott: they've specifically chosen herring this year which is it's going to be very interesting and
[0:12:42] Trustee Scott: i'm one of the three uh presenters from my obvious interest in fisheries and the marine environment
[0:12:48] Trustee Scott: and so um i think it's going to be a very interesting meeting and i think it's next
[0:12:54] Trustee Scott: i'm not sure if it's going out on how they're putting it out to the public presumably they will
[0:12:59] Trustee Scott: and people can be able to tune into it so it's uh what's the date alex here i'm presenter and
[0:13:06] Trustee Scott: and I forgot, it's the 16th or 17th over in,
[0:13:10] Trustee Scott: it's over in Bains Sound.
[0:13:11] Trustee Scott: And I don't know if more people can go,
[0:13:13] Trustee Scott: but as Alex said, we'll be going over there to do that.

[0:13:54] Trustee Fast: with the trust policy statement and the governance review and other big topics projects on there
[0:14:00] Trustee Fast: as well as three trustee motions so um anybody wants to get a look ahead can look at the
[0:14:07] Trustee Fast: executive committee agenda from uh wednesday and see what's um coming uh and get a get an
[0:14:15] Trustee Fast: advanced look because the whole agenda is now in the in the approved and and um being put together
[0:14:23] Trustee Fast: um so this is partly just can i
[0:14:26] Trustee Scott: yeah could you tell could you tell people please where they can

[0:15:43] Trustee Fast: okay so um i'll just uh also mention that uh yesterday i was at a um i was supposed to be
[0:15:51] Trustee Fast: at a Climate Leadership Institute conference at UBC.
[0:15:56] Trustee Fast: That's why I was there Zooming
[0:15:57] Trustee Fast: into the executive committee meeting.
[0:16:00] Trustee Fast: But I couldn't stay.

[0:16:04] Trustee Fast: And then, and I think we're going to see more of this

[0:18:05] Voice 11: Kellett from the federal government. So I'm a negotiator on for the province on the Comox
[0:18:11] Voice 11: negotiations. And we wanted to provide an update of where the negotiations are and our public
[0:18:17] Voice 11: outreach that we're going to be doing throughout the summer and into the fall. So I do have a
[0:18:22] Voice 11: presentation. I just want to make sure I can do might take me a moment to basically all be perfect

[0:19:56] Voice 11: to um talk about how there's been a kind of a change in in our relationship with indigenous
[0:20:02] Voice 11: Indigenous people over the last few years were trying to build a new relationship, and that's
[0:20:05] Voice 11: going to be built on an awareness of the past. Mutual respect, a renewed fiscal relationship,
[0:20:10] Voice 11: a commitment to action. But I also wanted to emphasize that this is not just a government
[0:20:14] Voice 11: thing. It is something that local governments can participate in, non-profits, you know,
[0:20:20] Voice 11: school boards, people, you know, everyone can participate in reconciliation with Indigenous
[0:20:25] Voice 11: people. And in terms of Canada and BC, we have demonstrated our commitment through enactment
[0:20:33] Voice 11: of legislation for the federal government was Bill C-15, the United Nations Declaration on the
[0:20:38] Voice 11: Rights of Indigenous People. And in 2019, the province enacted the Declaration Act. And in this
[0:20:45] Voice 11: act, it sets out that we are trying to align our provincial legislation with UNDRIP. It also has
[0:20:52] Voice 11: a concept of shared decision-making within the legislation that allows the province and
[0:20:57] Voice 11: a First Nation to enter into a variety of different shared decision-making from consent
[0:21:02] Voice 11: to collaboration. So that's something that enables the province to do that with First Nations.
[0:21:08] Voice 11: But the focus of this government really is on negotiating long-term agreements
[0:21:12] Voice 11: with a focus on Indigenous self-determination and economic independence.
[0:21:20] Voice 11: So for BC and Canada and First Nations, we've been negotiating treaties for close to 30 years and we have four treaties implemented.
[0:21:31] Voice 11: So there's a definite shift in the approach to negotiating treaties.
[0:21:37] Voice 11: Previously, they were, you know, the old historic treaties where the seed release and surrenders,
[0:21:41] Voice 11: even what we call the modern treaties were more about in terms of rights and recognition,
[0:21:47] Voice 11: recognition where sometimes First Nations claimed it was more like an extinguishment,
[0:21:53] Voice 11: and that's not what we're trying to do. Today, we're doing a different approach,
[0:21:57] Voice 11: which is called a non-assertion. So the treaty will set out the rights of the First Nation that
[0:22:01] Voice 11: they assert and can act upon, and then any rights that are outside of treaty, they agree not to
[0:22:07] Voice 11: assert them. But we also have this ability to add in rights over time. So whereas the previous
[0:22:12] Voice 11: approach was more like a divorce you we both go our separate ways the approach now is a partnership
[0:22:19] Voice 11: it's a living agreement that can change over time it's not static so we can add things in in the
[0:22:25] Voice 11: future for example if there's a new right that is discovered potentially through the courts
[0:22:30] Voice 11: we actually now have a process to incorporate them into the treaty so it's a very different
[0:22:36] Voice 11: approach we're also looking at shared decision making so we have it in what we call the declaration
[0:22:40] Voice 11: Declaration Act, but in treaties too, we now have the ability to enter into these type of
[0:22:44] Voice 11: arrangements as side agreements to negotiate shared decision-making within the territory
[0:22:49] Voice 11: with the First Nation. Okay, move on to the next one. In terms of COMOX, it's been 28 years we've
[0:22:59] Voice 11: been in negotiations, and we signed the agreement in principle 10 years ago in 2012, and that
[0:23:05] Voice 11: basically sends out the basic elements of the treaty. So we've been negotiating for 10 years
[0:23:10] Voice 11: since then and in 2019 we signed an agreement to revitalize the treaty negotiations in a sense to
[0:23:17] Voice 11: try and reach a negotiator's understanding within two years. Obviously COVID put a dent in that one
[0:23:25] Voice 11: so we're still working forward but we are going to continue negotiations throughout the summer and
[0:23:30] Voice 11: fall and the intention is Canada and BC will provide what we call a closing landed cash offer
[0:23:35] Voice 11: in the fall and then beyond that we are hoping to have what we call the chief negotiators
[0:23:41] Voice 11: understanding which basically sets out the entire treaty all the side agreements all the appendices
[0:23:47] Voice 11: all the the concepts within the treaty the land the cash at that point we'd have we seek approval
[0:23:54] Voice 11: to initial the treaty once it's initialed that triggers ratification so comox will be will take
[0:24:01] Voice 11: the treaty to its members for a vote upon ratification by Comox, then BC
[0:24:07] Voice 11: ratifies, and then Canada ratifies. So we have a very ambitious timeline here in
[0:24:12] Voice 11: terms of looking at getting to the initialing in about a year's time, and
[0:24:16] Voice 11: that is quite ambitious. So this is the kind of the timeline we're talking about
[0:24:21] Voice 11: offer in the fall, initialing next summer, and then ratification process for
[0:24:27] Voice 11: Comox next fall, and then we go through. So I just want to make it clear too that
[0:24:32] Voice 11: And it's not, when we initially, it doesn't mean we're done.
[0:24:35] Voice 11: There's still a lot of implementation work that we do, in particular, the province, because we have to do surveys and get ready for land title and land transfers.
[0:24:44] Voice 11: There's a great deal of work setting out any interest that will continue on the land or Comox will replace them in interest.
[0:24:50] Voice 11: So by the time that work all goes through, we're probably looking at an effective date of around 2026.
[0:24:57] Voice 11: six. So this is a map of Comox's territory. You can see it extends quite a long ways north and
[0:25:05] Voice 11: south. The core territories of Comox are in the Comox Valley and the Sayward Valley. So I'm not
[0:25:11] Voice 11: sure if you can see my cursor down here. So the agreement of principle had lands up in the Sayward
[0:25:20] Voice 11: Valley. So we have the Comox Reserve and the oranges lands that were offered at the agreement
[0:25:26] Voice 11: of principle stage, so another chunk further down in the Salmon River. But the bulk of the lands
[0:25:32] Voice 11: tends to be in the Comox Valley. There is one small parcel on Hornby, I think it's 10 hectares,
[0:25:39] Voice 11: but the bulk is in the Comox Valley and particularly Union Bay. So there's a large
[0:25:45] Voice 11: chunk here which is a woodlot currently run by Comox and this pink is a property that the
[0:25:50] Voice 11: province purchased at around the same time as the agreement of principle called Sage Hills.
[0:25:54] Voice 11: The purple are the First Nation Indian Reserves currently, and then you can see a couple of up here, the slashed, that means it's park-like for this last portion.
[0:26:06] Voice 11: This is the old Forbidden Plateau Ski Hill, and then you have the Mount Washington Gravel Pit, the tip of Goose Spit, and then this is around Browns River on Percy Road, and then also Sandy Island.
[0:26:18] Voice 11: Island. So Sandy Island, Seal Inlet, so Tree Island. So those were the lands at agreement
[0:26:24] Voice 11: of principle. The intention is we will be adding to those lands in the closing offer.
[0:26:31] Voice 11: So once the treaty comes into effect, Comox will own the land and have jurisdiction over the land.
[0:26:36] Voice 11: So they'll have the authorities to make laws around management, zoning, and the development
[0:26:41] Voice 11: of their lands. And given the unique situation of the Comox Valley, in the sense that the vast
[0:26:48] Voice 11: majority of land here is private. If you look at the rest of the province it's about 90%
[0:26:53] Voice 11: public land and around 10% private land. It's almost flipped in this area where it's 86%
[0:26:59] Voice 11: private and 14% crown. So we are doing something very similar with Comox. If you have a treaty
[0:27:07] Voice 11: up north you'll see that the idea is that most of the lands are public unless the First Nation
[0:27:15] Voice 11: designates them a private because it's an incompatible use to public access.
[0:27:19] Voice 11: We're doing it differently in Comox because of the unique situation where
[0:27:22] Voice 11: most of the lands will be private except those ones that are explicitly set out to be
[0:27:27] Voice 11: either a park or public lands. So it's a little bit of a different approach here
[0:27:31] Voice 11: because of the unique situation here. We'll also have self-governance in the treaty so
[0:27:37] Voice 11: Comox will recognize Comox's right to self-government and to make laws.
[0:27:42] Voice 11: But we also have what we call a concurrent law model. So the federal provincial laws
[0:27:47] Voice 11: also apply at the same time.
[0:27:48] Voice 11: So Comox is not obligated to draw down
[0:27:51] Voice 11: their lawmaking authorities immediately,
[0:27:53] Voice 11: it's discretionary, so they can do it when they see fit,
[0:27:57] Voice 11: but there's no vacuum in the sense that provincial
[0:27:59] Voice 11: and federal laws continue to apply.
[0:28:01] Voice 11: So if they are not drawing down their power,
[0:28:04] Voice 11: there are still laws that apply.
[0:28:07] Voice 11: These are some of the lawmaking authorities,
[0:28:09] Voice 11: and this is just a few of them that Comox will have.
[0:28:12] Voice 11: So lands resources, adoptions, health services,
[0:28:15] Voice 11: post-secondary education culture and heritage child care so these are just a few of their
[0:28:20] Voice 11: lawmaking authorities so the intention is the offer will be in the fall we have launched a
[0:28:30] Voice 11: website we will be sending out letters to anyone who has an interest that may be on those lands
[0:28:36] Voice 11: so we're thinking about guide outfitters or trappers or water lines all those things we also
[0:28:41] Voice 11: be sending out letters to anyone who is adjacent to property that we're considering. We are doing
[0:28:48] Voice 11: local government presentations to all the local governments. We are also in events. We just did
[0:28:53] Voice 11: Market Days in Cumberland. We're doing Union Day or Bay Days in Union Bay this weekend as
[0:28:58] Voice 11: information booth just to get people aware that these negotiations are happening and what treaties
[0:29:03] Voice 11: treaties are um canada day bc nautical days will be at uh and the intention is we'll hold open
[0:29:10] Voice 11: houses in um september and we'd also like to talk to you get some feedback on when you think um if
[0:29:18] Voice 11: there'd be interest on the islands for us to hold open houses too and when when the appropriate time
[0:29:23] Voice 11: would be for that so these are the things um we're hoping to engage with the public on when we do
[0:29:31] Voice 11: these open houses and we will have a website and an email for people to email information to us or
[0:29:38] Voice 11: questions so these are the things we anticipate people will want to talk about so public access
[0:29:44] Voice 11: to lands for recreation foraging you know anything like that private property access
[0:29:50] Voice 11: make sure that they can access the property still water management wildlife management
[0:29:55] Voice 11: taxation is going to be how they can participate in reconciliation
[0:30:00] Voice 11: culture sites, arts and culture. So these are the things we're hoping to engage with the public
[0:30:05] Voice 11: more generally once we get to those open houses. And we're going to be trying to make announcements
[0:30:10] Voice 11: and have it on our website. And we're hoping that local governments too can make announcements too
[0:30:15] Voice 11: to let their constituents know that we're going to be opening houses because the more people
[0:30:19] Voice 11: involved, the better. So in summary, we're going to be doing the public engagement. We started in
[0:30:26] Voice 11: May. We're going to go all the way through to September. We're hoping to make the closing
[0:30:29] Voice 11: offer a joint offer Canada BC in the fall initialing 2023 ratification thereafter and
[0:30:36] Voice 11: then hopefully coming into effect by 2026 so that is pretty ambitious but we are quite focused on
[0:30:44] Voice 11: getting this and these are just the contact information and this will be the first treaty
[0:30:50] Voice 11: in about 10 years the last one was Slammin which I think came into effect in 2016 so this will be
[0:30:55] Voice 11: coming into effect almost 10 years later so this is quite something to celebrate in the valley in
[0:31:01] Voice 11: particular that this potentially is the first treaty especially under this government and we
[0:31:06] Voice 11: are looking forward to getting as much input from the people generally at the public as we can so
[0:31:12] Voice 11: that everyone is part of this and is happy to be seeing it happen and seeing all the huge benefits
[0:31:18] Voice 11: it's going to bring to the Comox Valley and the Sayward Valley. If there's any questions I'd be

[0:49:40] Voice 10: not be making changes to either one of those without that level of consultation thank you

[0:51:40] Voice 1: I wanted to comment on some of the APC recommendations.
[0:51:45] Voice 1: There were some good problems identified there, being the housing crisis
[0:51:50] Voice 1: and also kind of the lack of infrastructure for visitors to Hornby.
[0:52:00] Voice 1: The density recommendations seem like a really good idea.
[0:52:04] Voice 1: It kind of targets increased density in certain areas,
[0:52:11] Voice 1: and those will be tangible outcomes if we can gain more housing.
[0:52:18] Voice 1: You're going to relate them back directly to those changes.
[0:52:22] Voice 1: the issue I had with correlating directly as short-term rentals to the housing crisis and
[0:52:30] Voice 1: changing short-term rentals as in restricting short-term rentals will possibly create
[0:52:36] Voice 1: housing opportunities. That's true. It could create housing opportunities. It also could
[0:52:44] Voice 1: take away housing opportunities. It could add to the list of people that need housing.
[0:52:50] Voice 1: if you start to make restrict tourism then you're going to be affecting directly
[0:52:58] Voice 1: in a negative way to what degree would also be a guess but the local businesses on Hornby Island
[0:53:05] Voice 1: run by locals full-time residents with families with employees we have to know or take a guess
[0:53:14] Voice 1: at how that will negatively affect them at the same time and will that number they indicated
[0:53:18] Voice 1: of 30 families looking for housing will that grow and not shrink um what my idea was or
[0:53:28] Voice 1: recommendation what other people have said to me is that if there's a we can target those areas
[0:53:34] Voice 1: that lack the infrastructure for the residents in the same way that you want to target the density
[0:53:40] Voice 1: issue. If an area has short-term rentals or full-time residents or full-time renters or
[0:53:51] Voice 1: long-time residents, they all affect the infrastructure and the problems with pollution
[0:53:56] Voice 1: in the same way. You can't point at one to the other. Sorry for going over.
[0:54:02] Voice 1: They're two separate issues. And if we attack the infrastructure, that will help with tourism.
[0:54:08] Voice 1: and on the apc document it says that the current bylaws when they were enforced in 2019 we saw a
[0:54:15] Voice 1: reduction in the number of short-term rentals so we know those are restrictive already so that's
[0:54:21] Voice 1: what i wanted to say they're two different issues and let's attack them together thank you very much

[1:11:07] Voice 10: derived through the tourism industry started in the resort municipalities, primarily Whistler
[1:11:13] Voice 10: in Tofino. And it is a tourism sector-based initiative where fixed group accommodation
[1:11:24] Voice 10: providers need to come on side and work with Destination BC, who are the managers of the
[1:11:34] Voice 10: program for the Ministry of Finance. And that's been in place, I'm not sure exactly what year,
[1:11:42] Voice 10: in 1997, something like that. Don't hold me to that date. And it was always about destination
[1:11:50] Voice 10: marketing, destination BC. There's a little component that goes to big British Columbia
[1:11:57] Voice 10: tourism events like the Olympics or Winter Games or that kind of thing. But generally, it was going
[1:12:02] Voice 10: to municipalities and at that level in 2018 because of pressures for affordable housing
[1:12:12] Voice 10: there was a change to the legislation and all kinds of municipalities got on board because
[1:12:21] Voice 10: that change allowed some of the money to come out of tourism and into affordable housing
[1:12:26] Voice 10: At that point, High Seek, as being the eligible tourism entity on Hornby, was the potential recipient and did go through Destination BC and applied to become the eligible entity and were accepted.
[1:12:47] Voice 10: The normal procedure on the regional district side of it is to have it at an electoral area basis.
[1:12:55] Voice 10: Destination BC advocated for Hornby to delineate Hornby Island specifically out of Electoral Area A at the regional district.
[1:13:04] Voice 10: So at that point, High Seek was the tourism entity that was eligible for the program.
[1:13:10] Voice 10: Hornby became a geographic area isolated from the rest of the regional district.
[1:13:16] Voice 10: And basically, that's it in a nutshell, I think.
[1:13:21] Voice 10: Then you get into implementation of the program and what does it take for the Ministry of Finance to actually institute a tax.
[1:13:28] Voice 10: So we've been, I think we started in 29 with public consultations.
[1:13:34] Voice 10: The primary stakeholders being the tourism fixed roof accommodation providers on Hornby as identified by the Ministry of Finance, those that pay the 8% tax on accommodation, met and voted and 100% of Hornby, of those Hornby people were in favor of instituting, collecting and paying the tax themselves.
[1:13:56] Voice 10: And the momentum was around trying to mitigate the impacts of tourism, specifically in their mind, as it impacted affordable housing and workforce housing.
[1:14:09] Voice 10: And so Grant was at some of those initial consultations that we had hired a consultant from Tourism Vancouver Island.
[1:14:20] Voice 10: And he came and talked to stakeholders in the tourism sector, and it went sort of to the next stage when High Seek hired a consultant to help develop a five-year strategic plan and a one-year annual plan, which are requirements of the section, which have to get registered through Destination BC with the Ministry of Finance.
[1:14:45] Voice 10: So all of that information for Hornby is on the HI-SEEC website. And there is a tab there that says MRDT, the public consultation, and the information about it is on that website. So sorry, Heather, that could have saved you probably a lot of time just to look at that.

[1:15:24] Voice 10: And we expect about a four-month delay before that money comes back and will be implemented according to those registered plans.

[1:15:40] Voice 10: No, not at all. It goes into the registered fund and the fund is a tourism fund.
[1:15:46] Voice 10: So the opportunity for a portion of that to be affordable housing to the maximum, we pushed it as hard as we could.
[1:15:54] Voice 10: So a portion of the funds are affordable housing. We, through consultation, identified some of the other opportunities for tourism mitigation primarily.
[1:16:05] Voice 10: And we, you know, we just pressed the outside boundaries of what was possible in that program through the consultation program and what people wanted to see.
[1:16:15] Voice 10: We are contributing a small percentage to provincial tourism events as part of the program.
[1:16:21] Voice 10: that's mandatory pretty well because we asked for a three percent levy um yeah it's it's very
[1:16:30] Voice 10: regulated it's um not exactly what people here want to see i don't believe which is where probably
[1:16:35] Voice 10: alex is hearing you know what the heck but i think it really behooves the community to remember that
[1:16:41] Voice 10: this is not a tax on the residents of hornby this is a tax that the accommodation providers
[1:16:48] Voice 10: have voluntarily instituted to ask for money from the tourists that come here to try to make life
[1:16:55] Voice 10: better for the residents of Hornby. So, you know, it's very different than property taxes or
[1:17:02] Voice 10: something that we all pay together. You know, this is, and honestly, I have a rental property
[1:17:09] Voice 10: and people didn't know they were going to have to pay this 3%. And I say to them,
[1:17:14] Voice 10: this three percent is for the community of Hornby and I have gotten no resistance at all from the
[1:17:21] Voice 10: guests that I have about paying that people understand that there's a cost to tourism

[2:19:30] Voice 7: recommendations. We are, staff are recommending that the LTC endorse the project charter for the
[2:19:37] Voice 7: OCP LUB review project. And we're also recommending that a couple of other aspects of OCP review be
[2:19:48] Voice 7: added to the projects list, but aren't included in the project charter. So that's, that's the
[2:19:55] Voice 7: the bottom line. And I'll just kind of give some background on that.
[2:19:57] Voice 7: So as we've been talking about
[2:20:01] Voice 7: the APC, the Hornby APC has been working diligently for, I want to say about a year now,
[2:20:09] Voice 7: on reviewing the Hornby official community plan and land use bylaw regarding four topics,
[2:20:17] Voice 7: um housing stvrs short-term vacation rentals um indigenous language or first nations
[2:20:25] Voice 7: acknowledgements and language and riparian areas um they have provided um two uh reports um on
[2:20:37] Voice 7: indigenous language um and then well there's there's two reports one of them was about
[2:20:43] Voice 7: indigenous relations or language and one was about housing and short-term vacation rentals,
[2:20:50] Voice 7: so they kind of combined those two topics. They are meeting again and will be discussing the
[2:20:57] Voice 7: riparian area, so we don't have a recommendation yet from them on riparian areas. So when the
[2:21:05] Voice 7: project started, before the the OCP was referred to the APC, the official yeah we're getting a lot
[2:21:12] Voice 7: lot of acronyms. Before it was referred, there was discussion about, you know, the LTC had
[2:21:18] Voice 7: identified that they wanted, they wanted some things addressed in the OCP that they felt needed
[2:21:24] Voice 7: to be done. And staff at the time said, great, we don't have any staff capacity to work on this
[2:21:31] Voice 7: project right now. And so it was decided at the time to refer it to the APC. And the APC has
[2:21:38] Voice 7: has essentially been doing what staff would do if we had the staff capacity to do it.
[2:21:45] Voice 7: So while the APC has been reviewing these topics, there was also a business case put forward that
[2:21:54] Voice 7: the LTC outlined the need for this project, and there was $15,000 that was requested from Trust
[2:22:04] Voice 7: council to implement the project. And the way the business case was laid out, and you'll see it
[2:22:10] Voice 7: attached to the staff report, essentially it kind of lays all of that out. Given that there's not
[2:22:16] Voice 7: staff capacity, we've referred this to the APC and we want $15,000 to hire a consultant who would
[2:22:25] Voice 7: then be able to implement what the APC have recommended. Now, I drafted the business case.
[2:22:35] Voice 7: I'll just say that. I, staff, have drafted that business case. And my assumption when I drafted
[2:22:40] Voice 7: that business case was that what we needed a consultant for was drafting and processing
[2:22:47] Voice 7: a bylaw. You know, the deliverable of this project is, there's two deliverables. One is an
[2:22:55] Voice 7: OCP amendment bylaw and one is an LUB amendment bylaw. And there are particular
[2:23:05] Voice 7: legislated steps that have to be taken in order to process bylaws. And at our last meeting,
[2:23:12] Voice 7: I did a little whiteboard exercise, but I have that laid out in a slide here. I think I was
[2:23:21] Voice 7: thinking about presenting that last time but essentially first reading second reading um
[2:23:28] Voice 7: cim and public hearing are steps that these are all legislated steps that we have to take
[2:23:35] Voice 7: and in each of these steps so first reading a second reading each of each of these steps
[2:23:41] Voice 7: includes public engagement in the sense that um the bylaw will be on the ltc's agenda
[2:23:49] Voice 7: and the staff can come to the meeting and speak about the bylaw at town hall.
[2:23:56] Voice 7: There is already some built-in public engagement.
[2:24:01] Voice 7: Between first and second reading, there is this referral period where the bylaw goes out to First Nations
[2:24:08] Voice 7: and to various provincial agencies and whoever else might want to review it.
[2:24:13] Voice 7: And it's a minimum 60-day period in which the bylaw is up on the website, and the public can come and speak to the LTC if there's a meeting, or they can send written comments to staff, who then collect all of those comments and put them in a staff report.
[2:24:34] Voice 7: And those are accompanied when we, our staff report when we bring a second meeting.
[2:24:42] Voice 7: so my point being the the minimum legislative process has public engagement uh built into it
[2:24:52] Voice 7: and that is what the public hearing is for that's what the legislative public process is is the
[2:24:59] Voice 7: public hearing um and at islands trust we automatically have a community information
[2:25:07] Voice 7: meeting prior to that public hearing. It's built into our processes. It's not a legislative
[2:25:13] Voice 7: requirement, but we do it as a standard practice. And the LTC can ask for more community information
[2:25:23] Voice 7: meetings. And often we do have those throughout the process. And that can kind of go anywhere
[2:25:30] Voice 7: in the process up to the public hearing. After public hearing, the trustees aren't allowed to
[2:25:37] Voice 7: take public comment anymore. So that's why all the public engagement has to happen before public
[2:25:43] Voice 7: hearing. So the $15,000 in the business case assumed that the consultant would be hired to
[2:25:53] Voice 7: draft the bylaw and bring it to first reading and second reading and to the public hearing.
[2:26:02] Voice 7: and that their time would be used for that. And they would be part of the public hearing and they
[2:26:08] Voice 7: would present at the CIM. There wasn't an assumption in that business case that there
[2:26:14] Voice 7: would be a CIM prior to any of that. So we didn't assume a CIM before first reading and we didn't
[2:26:21] Voice 7: assume one here between the two readings. So at the last LTC meeting, there was some discussion
[2:26:30] Voice 7: about the need for more you know and in fact the idea of a pre-bylaw drafting workshop came up
[2:26:38] Voice 7: and when I drafted the project charter I heard that and tried to build it into a work plan and
[2:26:46] Voice 7: look at what that would what that would cost when I and I've attached my some of my budget
[2:26:52] Voice 7: assumptions to the staff report but essentially what I came up with was that any kind of workshop
[2:26:59] Voice 7: workshop on island that included a consultant, um, would cost about $5,000. So, and, and most
[2:27:09] Voice 7: of that is the consultant's time. Um, cause you are paying for their travel back and forth. You're
[2:27:15] Voice 7: paying for any accommodation that they have overnight as a result of it. Um, and you're
[2:27:20] Voice 7: paying for their prep work and, um, a, a, a report afterwards to sort of analyze what they've heard
[2:27:27] Voice 7: and, and then come and present that to the LTC. That's a third of your budget. And that's for one
[2:27:37] Voice 7: meeting, one workshop. So, so I've sort of laid out kind of two options. One is what it would
[2:27:48] Voice 7: look like if you, you know, how much more of the consultant's time would there be after one
[2:27:53] Voice 7: one workshop to draft bylaws and then process it, come to LTC meetings in person, for instance,
[2:28:02] Voice 7: because again, they have to travel each time they come to a meeting. And so I've laid out
[2:28:07] Voice 7: the options there. One of the things to consider, and I know this isn't ideal, but it saves money,
[2:28:13] Voice 7: is for the consultant to attend remotely, because then you're not paying for travel time or
[2:28:19] Voice 7: accommodation. So that's an option too. But anyway, so I want to lay all of this out. We have a
[2:28:26] Voice 7: particular recommendation based on the budget that you have and the business case that you put
[2:28:30] Voice 7: forward. I think you have discretion within your budget to do something different than what the
[2:28:38] Voice 7: business case lays out. You don't necessarily have to abide by that. However, it could be
[2:28:45] Voice 7: questioned at trust council like we got a business case and we approved a budget based on this
[2:28:52] Voice 7: business case but now we're finding that you did something else with this money right so there's
[2:28:57] Voice 7: still there might be a question however you still do have discretion to change the parameters of
[2:29:03] Voice 7: your project so then the question will be if you have the consultant do a workshop one workshop
[2:29:12] Voice 7: drop it's five thousand dollars if you have them do two it's ten and if you do have them do three
[2:29:16] Voice 7: it's it's your entire budget and and then who's going to draft the bylaw and and who has the
[2:29:23] Voice 7: capacity to do that and process it through the through the process um the actual bylaw drafting
[2:29:31] Voice 7: could be put on hold until their staff capacity um or you you go through another budget request
[2:29:41] Voice 7: in which you ask for more money next for next year to have an have the same consultant or
[2:29:48] Voice 7: another consultant drafting the bylaws and processing them um so yeah so that's kind of what
[2:29:57] Voice 7: i'm what i've been thinking
[2:30:00] Voice 7: of that. But you will also note from my recommendations that the project charter
[2:30:07] Voice 7: assumes your first four topics. It's the housing, STVRs, RAR, and First Nations. The LTC has,
[2:30:15] Voice 7: since that initial idea, added two more topics that they thought might want to be added to the
[2:30:22] Voice 7: the OCP project, those two topics could expand the scope of the project quite a bit because of
[2:30:31] Voice 7: all the things that we'd have to consider for those topics. And so the project charter does
[2:30:37] Voice 7: not include those topics. It assumes that you add those to your projects list and they get
[2:30:45] Voice 7: addressed in a different OCP project in the future. You have the option of including those
[2:30:52] Voice 7: in the current project, but you would need more budget and more time and it would expand the scope
[2:31:01] Voice 7: of your project, which is why we've recommended them as separate. So we've laid out our
[2:31:12] Voice 7: recommendation and we've laid out some options for you and glad to answer any questions.
[2:31:20] Trustee Fast: Okay. Thank you. And thank you for the slide because I can see that there's some things in the possible methods there that we may not have discussed, but we're getting more used to with the online meetings and the ability to attend meetings from remote without having to do all the travel can be a real cost saver.
[2:31:46] Trustee Fast: okay so trustees uh questions for the regional planning manager or um go ahead trustee i'll
[2:31:53] Trustee Fast: give trustee scott first chance this time go ahead trustee scott thank
[2:31:59] Trustee Scott: you thanks heather that was um
[2:32:01] Trustee Scott: i got lost a few times in there but i think i got the gist of it um it seems to me what we could do
[2:32:09] Trustee Scott: if if we go back and ask for more money to the trust council before we start this thing i think
[2:32:14] Trustee Scott: i got a really good idea what's going to happen um and we won't get it we won't get any more money if
[2:32:22] Trustee Scott: i think if we did this as phase one with the 15 000 and and then what we have is a a plan for
[2:32:30] Trustee Scott: phase two that we go and get some more money from trust council we'll have at least get part of the
[2:32:37] Trustee Scott: work done and we're in for a penny and we go back and ask them for a pound i think we're more likely
[2:32:41] Trustee Scott: can get the money the other thing i think we could do so that would be one suggestion maybe we do it
[2:32:46] Trustee Scott: in phases the second which i think is basically what you you mentioned there the second would be
[2:32:52] Trustee Scott: to look at i mean i think we're talking about a thousand dollar a day consultants here i mean
[2:32:59] Trustee Scott: i know there are very good people out there that um got all the credentials and could be quite
[2:33:06] Trustee Scott: quite willing to charge less than $1,000 a day,
[2:33:11] Trustee Scott: people who aren't necessarily working out of offices somewhere,
[2:33:15] Trustee Scott: but could still do the job, do the research we need,
[2:33:18] Trustee Scott: and package the stuff up and attend the public meetings.
[2:33:21] Trustee Scott: Also, maybe there's a way we can use staff to do part of this,
[2:33:27] Trustee Scott: to make it more efficient, but take some of the, you know,
[2:33:30] Trustee Scott: as you pointed out, I know you recently just got more staff,
[2:33:34] Trustee Scott: So maybe that staffing issue isn't quite as critical as it once was.
[2:33:38] Trustee Scott: So I don't know.
[2:33:40] Trustee Scott: Do you think we can fit any of those ideas into what to get this project going and started?
[2:33:49] Voice 7: Yeah, I mean, it is possible.
[2:33:51] Voice 7: You want me to answer?
[2:33:53] Voice 7: Yes, please.
[2:33:54] Voice 7: Okay.
[2:33:55] Voice 7: It is possible that you could get a consultant who charges less than $150 an hour.
[2:34:01] Voice 7: That's possible.
[2:34:02] Voice 7: You know, for any kind of process where we're seeking a consultant, we do have to go through a bidding process so that it is competitive.
[2:34:13] Voice 7: The one, you know, one of the, and one example is that often VIU students are used to work on our projects, not for free, but, you know, for less expensive than a professional consultant.
[2:34:28] Voice 7: And that is an option. However, you know, I've really thought that if you believe that the STVR issue in particular is going to be contentious, you really want a professional who knows how to deal with contentious public issues.
[2:34:49] Voice 7: And you don't want to, you know, they're, they're, they're facilitating and mediating a public meeting where people are angry. You want, you want somebody who's experienced and skilled at that, right? So in this particular case, I wouldn't recommend a lesser experienced person for that reason.
[2:35:11] Voice 7: um as you say it can be done in phases um you know no matter what i i would recommend and i
[2:35:20] Voice 7: i didn't include it in this staff report but i do think that if you in if you think that this
[2:35:26] Voice 7: project is going to go into next year and it probably will um and you want more than five
[2:35:32] Voice 7: thousand dollars to um be to impact this project you will need a business case and you probably
[2:35:39] Voice 7: probably should initiate the drafting of a business case today anyway, so that you could
[2:35:45] Voice 7: endorse that at your next meeting. So no matter what, if you think, yeah, but maybe that phase
[2:35:51] Voice 7: two looks even different if you are using the money in a different way than you thought you
[2:35:56] Voice 7: might this year.

[2:36:04] Trustee Scott: Yeah, just a bit of follow-up here. I spent a lot of my working life standing up in front of
[2:36:11] Trustee Scott: have groups of people talking about things that weren't universally loved so i don't know is there
[2:36:17] Trustee Scott: any role for us on the island who know the issues so that isn't a consultant standing up there but
[2:36:22] Trustee Scott: it's actually we're working with the issues that as we understand them is that a possibility or
[2:36:28] Trustee Scott: are you assuming or do we have to use the consultant to facilitate the meetings no you
[2:36:37] Voice 7: don't have to have a consultant mediate the meetings um but as the decision makers um in the
[2:36:44] Voice 7: end it's right it's a
[2:36:47] Voice 7: little bit of a
[2:36:47] Voice 4: conflict of interest
[2:36:48] Voice 7: yeah i mean you know i think it's
[2:36:51] Voice 7: i think it makes sense to have a meeting where the public can ask you questions as the decision

[2:38:29] Voice 7: Yeah, I mean, from a staff perspective, the reason that Gambier has a working group is because they've had a hard time forming and maintaining an APC because most of their, you know, the APC bylaws require that you have people who live on the island be on your APC.
[2:38:47] Voice 7: And most of the folks on Gambier don't live there full time. So they've formed this working group as more of a practical kind of workaround. From a staffing perspective, what I would say is that the working group takes a lot of staff time.
[2:39:03] Voice 7: we we uh put together all the meetings we communicate with them um you know the this
[2:39:12] Voice 7: project for hormy is being done under the premise that there isn't a lot of staff time to devote to
[2:39:18] Voice 7: the project at this moment um and and that was one thing i didn't address with trustee scott's
[2:39:24] Voice 7: comments is that yes the northern office is fully staffed for the moment and but we are actually
[2:39:31] Voice 7: anticipating a reduction in staff time in the near future and the south spring office is now
[2:39:38] Voice 7: not going to be fully staffed in the medium term which means that all the other offices have to
[2:39:45] Voice 7: help out so so islands trust is not fully staffed and and isn't going to be fully staffed for a bit

[2:40:53] Trustee Fast: has done is it up to us to direct staff request staff to give us some analysis on that like maybe
[2:41:01] Trustee Fast: some of the things are uh not won't won't work for some technical legal reason or something like
[2:41:08] Trustee Fast: that could we request um that and would that fit with this uh timing in terms of like i'm just not
[2:41:17] Trustee Fast: sure where that would fit into what you're proposing here and um uh and if we were to
[2:41:22] Trustee Fast: to initiate at this meeting, to initiate what Grant is calling phase two, if you could speak to that?

[2:41:34] Voice 7: typically the, yeah, so once the APC is done with their work, someone will have to review it and

[2:41:47] Voice 7: doable and is professionally recommended right and that will take several hours to do um
[2:41:56] Voice 7: again the business case assumed that that would be the consultant who would do that um not staff
[2:42:03] Voice 7: and um uh but that's built in to the assumption no matter what that work has to be done by someone

REPORTS 4.1 Trustee Reports Trustee Allen reported on the following: The upcoming Trust Council meeting from June 21 to 23 will be electronic, will invite public comments on the Tuesday evening of June 21; and will be a large, important meeting. Policy Statement Review in relation to the 1970’s Islands Trust Act. Community and Trust Council fragmentation regarding many issues. ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Minutes June 10, 2022 Attendance at the upcoming June 17, 2022 Baynes Sound/Lambert Channel Ecosystem Forum. Trustee Scott reported on the following: The recent Advisory Planning Commission (APC) report to Trustees regarding housing and short-term rentals (STRs) is advisory and much more community consultation will take place before any bylaws are changed. The APC has done a good job with their report given that STRs consensus is hard to achieve; and the issue is complicated. Attendance as a presenter at the upcoming June 17, 2022 Baynes Sound/Lambert Channel Ecosystem Forum which is focusing on herring this year. 4.2 Chair's Report Chair Fast reported on the following: Preparing the weighty agenda for the upcoming June Trust Council meeting which includes 3 Trustee motions, the Management Governance Review, and the Trust Policy Statement. This Executive Committee agenda package will be available to members of the public on the Islands Trust website today. Climate Leadership Institute conference at the University of British Columbia. The use of electronic meetings to mitigate anticipated ferry schedule disruptions, and disruptions due to illness. Upcoming Bowen Island Municipal Council meeting. 4.3 Electoral Area Director's Report-none 5. DELEGATIONS 5.1 Ministry of Indigenous Relations and Reconciliation – Delegation Chair Fast welcomed Sarah Cavanaugh, a negotiator with the Ministry of Indigenous Relations and Reconciliation, who was presenting an update on K’omoks Treaty negotiations and reconciliation. Sarah Cavanaugh introduced Melissa Quocksister, Treaty Communications; and noted that they would be later joined by Michael Blackburn, Federal negotiations Manager and Amanda Kellett, Acting Assistant Negotiator. Sarah Cavanaugh presented a series of slides which included the following: History of Indigenous relations and 30 years of treaty negotiations. Assertion and non-assertion rights within flexible First Nations Treaties, and the ability for First Nations to add rights in the future. Concurrent laws concept that allows First Nations to align their laws to Provincial and Federal laws over time. For K’omoks First Nation (KFN), a closing land/cash offer and a Chief Negotiators Understanding should be finalised this fall. KFN members-vote, government ratification, and implementing land transfers and other agreements will take until about 2026. The core territory of KFN is in the Comox and Sayward Valleys. In the Comox Valley, this includes the KFN Reserve; some woodlot land in Union Bay; a 10 Hectare ADOPTED Hornby Island ADOPTED 3 Local Trust Committee Minutes June 10, 2022 property on Hornby Island; a piece in the Forbidden Plateau ski area; the Mount Washington gravel pit; the tip of Goose Spit; some land on Brown’s River on Piercy Road; and Sandy Island/Tree Island. Sandy Island/Tree Island and Seal Islet had been negotiated many years ago and will continue to be a marine park. KFN has 2 large chunks of Agreement in Principal land within the Union Bay Kensington Estates properties complex: 680 hectares of Royston Forest and 840 acres of Sage Hills. These lands are set to become Treaty Settlement Land. Whereas about 90% of land in the entirety of BC is Crown and 10% private; in the Comox Valley it is 86% private and 14% Crown. A newly launched website; letters to interest groups; emails to stakeholders; presentations to local governments; and open house information events for members of the public will occur from May to September 2022. Local governments are being asked to request upcoming open houses. o Trustees requested an open House for Hornby Island and wished to include archaeological sites information. o Melissa Quocksister offered to prepare an information/historical brochure for Hornby Island. Trustees were invited to contact her or Sarah Cavanaugh for information. Jessie Levine could be contacted for specifically archaeological information. Contact information was on the KFN website. o Sarah Cavanaugh noted that she would be sending the presentation to Regional Planning Manager Kauer and requested that the presentation and contact information be added to the Islands Trust website for public information. o Melissa Quocksister clarified that K’omoks and Pentlatch were essentially the same. 6. CLOSED MEETING 6.1 Motion to Close the Meeting The regular meeting was recessed at 11:14 am. Electronic attendees were asked to leave the meeting. HO-LTC-2022-032 It was MOVED and SECONDED, that the meeting be closed to the public in accordance with the Community Charter, Part 4, Division 3, s.90(2) (b) for the purpose of the consideration of information received and held in confidence relating to negotiations between the municipality and a provincial government or the federal government or both and a third party and that staff and recorder attend the meeting. TOWN HALL ADOPTED Hornby Island ADOPTED 4 Local Trust Committee Minutes June 10, 2022 Members of the public noted the following: Regarding recent Advisory Planning Commission (APC) recommendations on STRs, the extensive community consultation that took place in the early part of the 2000’s on the Hornby Official Community Plan (OCP) and Land Use Bylaws (LUB) should also occur for any further changes proposed for the OCP and LUB. Extensive consultation involved meetings on Hornby, and in Victoria and Vancouver, to capture Hornby residents and off-island taxpayers. o Trustee Scott noted there would be community consultation upcoming. Trustee Scott is doing important lobbying work to improve Hornby ferry service. The Zoom meeting today is less preferable than an in-person meeting. STRs and local long-term rental housing shortages are two separate issues. Restricting tourism by taking away STRs could exacerbate the rental housing problems by negatively affecting local businesses and their workers. Every person affects Hornby pollution in the same way, regardless of whether they are a tourist or a local, so more focus should be put on proper infrastructure. It is concerning if upcoming community consultations are run by the APC because they are biased. They only want to enforce pollution rules on a 9% segment of Hornby residents while leaving the other 91% free from rules. o Trustee Scott noted that the LTC would be running future community consultations. o Trustees and Chair Fast discussed the term ‘biased.’ 8. MINUTES 8.1 Local Trust Committee Minutes dated May 6, 2022 - for adoption The following amendments to the minutes were presented for consideration: Under Item 8.4, first paragraph, 4 th bullet point on page 6, add at the end of the sentence a new sentence: ‘Trustee Allen volunteered to contact Claire Frater regarding signage.’ By general consent the minutes were adopted as amended. 8.2 Section 26 Resolutions-without-meeting - none 8.3 Advisory Planning Commission Minutes - none 9. BUSINESS ARISING FROM MINUTES 9.1 Follow-up Action List Report dated June 1, 2022 Trustee Allen noted that Claire Frater had recently expressed concern about the need to move forward with the Trustee requested power-point presentation on how the Islands Trust works, for the benefit of members of the public. Trustee Scott expressed disappointment that it had been two and a half years since the initial request and that many problems may have been averted if members of the public had had better understanding of the Islands Trust. Chair Fast noted the recent heavy workloads of the communications staff. 9.2 Municipal Regional District Tax (aka "Pillow Tax") - verbal update ADOPTED Hornby Island ADOPTED 5 Local Trust Committee Minutes June 10, 2022 Regional Planning Manager Kauer noted that Trustees had previously questioned that the pillow tax, instituted on June 1, 2022, had bypassed LTC consideration. The Hornby Island Community Economic Enhancement Corporation (HICEEC) had applied for the tax with help from the Comox Valley Regional District (CVRD). Trustee Allen noted that some in the community had brought the pillow tax issue up because they had not heard anything about it previously. Karen Ross explained how HICEEC had worked with Destination BC and the CVRD since 2018 to become an eligible entity for the Municipal Regional District (MRDT) pillow tax noting the following: The MRDT tax was instigated in the Whistler and Tofino resort municipalities in the late 1990’s. In 2018, legislation changed to allow some tourism money to go towards affordable housing, to mitigate the effects of tourism on local housing needs. Many municipalities applied for this tax offer. Fixed roof accommodation providers come together to work with Destination BC under the Minister of Finance. The taxing eligibility is usually applied to an electoral area; but Destination BC supported Hornby as an isolated area within the CVRD to be eligible for the tax. Implementation of the program involved public and stakeholder consultation; and a consultant from Tourism Vancouver Island was hired to speak about the program and another consultant was hired to develop a required 5-year strategic plan and an annual plan. The tax is collected by the fixed roof establishments and remitted to the Minister of Finance. The money goes into a registered Tourism Fund. A portion of this can go to affordable housing. Some goes to provincial tourism events. The information for the Hornby MRDT pillow tax is on the HICEEC website under the MRDT tab. This is not a tax on the residents of Hornby. Fixed Roof accommodation providers are levying this tax voluntarily to mitigate the effects of tourists on Residents. Trustee Allen noted that 2 attendees were notifying him that they were not able to get into the meeting. o Regional Planning Manager Kauer responded that they had been removed earlier for attempting to get into the meeting during the In-Camera segment and that they may need to use a different account to gain access. Nobody was presently being blocked. 9.3 Siting and Use Permit Bylaw No. 168 - Staff Report - for consideration of adoption Bylaw No 168, replacing the older Siting and Use Permit bylaw, had previously gone through three readings and executive approval. HO-LTC-2022-033 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee Bylaw No.168 cited as "Hornby Island Trust Committee Siting and Use Permit Bylaw No. 168, 2021", be adopted. CARRIED ADOPTED Hornby Island ADOPTED 6 Local Trust Committee Minutes June 10, 2022 9.4 Hornby Island Local Trust Committee Fees Bylaw No. 169 - Staff Report - for consideration of adoption Bylaw No. 169, replacing the older Fees bylaw, had previously gone through three readings and executive approval. HO-LTC-2022-034 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee Bylaw No.169, cited as "Hornby Island Local Trust Committee Fees Bylaw, 2022", be adopted. CARRIED 9.5 Entrance Sign Trustee Allen reported that he had recently found the original Denman/Hornby entrance signs images on a bicycle website; that Communications Trust Area Services Director, Clare Frater, had recently indicated that funding was available for entrance signs; and that K’omoks First Nations (KFN) could be requested to provide advice for updating language for the new signage. Chair Fast noted that there was progress being made towards a Trust wide entrance sign protocol, but that Hornby may want to initiate a solo project. Trustee Allen indicated that he would seek further input from other Trustees and Director Clare Frater at the upcoming Trust Council meeting. 10. APPLICATIONS AND REFERRALS 10.1 HO-DVP-2022.3 (Wyndham - 975 Mount Road) - Staff Report Planner Baugh presented the staff report which recommends that Trustees consider denying the applicant’s request for a waiver for a legal site survey. He clarified that the property had no buildable area that would not be within required setbacks. A suggested Biophysical Assessment to confirm previously mapped wetland features had already been submitted by the applicant with their variance application. The applicant spoke to the history of the property and the application. HO-LTC-2022-035 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee has determined that it is reasonably necessary that the applicant of HO-DVP-2022.3 (Wyndham) provide, as required by Section 2.7(1) of the Hornby Island Land Use Bylaw No. 150, a plan, a plan signed by a B.C. Land Surveyor, showing the location on the lot of all existing and proposed buildings, structures and sewage absorption fields in relation to lot and zone boundaries, watercourses, wells and the sea, and in relation to other buildings on the lot. CARRIED 10.2 HO-SUB-2022.2 (Aikman and Mace - 2066 Belcarra Road) - Staff Report ADOPTED Hornby Island ADOPTED 7 Local Trust Committee Minutes June 10, 2022 Regional Planning Manager Kauer presented the staff report prepared by Planner Mahikwa which asks Trustees to exempt one of two lots in the proposed subdivision from the 10 % minimum required lot frontage on a highway, as recommended by planners. o Trustee Allen asked if the dwelling classified as a duplex on one of the properties would be classified as a secondary suite; and asked if the other panhandle property nearby on Wetzel Road would impact this new panhandled property; and asked if the applicant was aware, that if the subdivision goes through, that the duplex may need to be partially de-commissioned. o Regional Planning Manager Kauer noted that the duplex issue would have been reviewed; and will research the other questions. HO-LTC-2022-036 It was MOVED and SECONDED, that per Local Government Act Section 512(2), the Hornby Island Local Trust Committee exempt the “Proposed Lot 1” in the proposed subdivision layout plan for HO-SUB-2022.2 from meeting Hornby Island Land Use Bylaw regulation 6.6(1), the minimum 10% lot frontage on a highway requirement. LOCAL TRUST COMMITTEE PROJECTS 11.1 Official Community Plan and Land Use Bylaw Amendment Project - Staff Report Regional Planning Manager Kauer presented the staff report which provides options to Trustees to process APC bylaw amendment recommendations and which recommends that Trustees endorse a project charter. She noted the following: The Islands Trust has built into its bylaw process the standard protocol, not legislatively required, of holding a Community Information Meeting (CIM) prior to a Public Hearing, after which Trustees can no longer take public comments. Trustees can request more than one CIM. The $15,000 budget for the bylaw amendment project assumed the hiring of a consultant to draft the bylaw and bring it to first and second reading and to Public Hearing. This did not assume a CIM. The cost for an on-island consultant led workshop meeting could approach $5000.00. If the consultant engaged remotely this cost could be significantly reduced. Actual bylaw drafting could be put on hold until staffing capacity was adequate, or an extra business case could be presented to Trust Council for additional funds. The current project does not assume the following two topics: review of development that may impact within the steep slope and sensitive Gary Oak ecosystems between Central and Euston Roads; and review of the aquifer classification system. ADOPTED Hornby Island ADOPTED 8 Local Trust Committee Minutes June 10, 2022 HO-LTC-2022-037 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to amend the project charter to include two consultant led workshops, one in-person in September and the second to be determined.
