[0:00:34] Trustee Fast: i'm assuming people will come in and uh i just want to uh begin the day by acknowledging that

[0:00:41] Trustee Fast: we're fortunate to be able to gather uh from areas around the coast sales territory into this

[0:00:46] Trustee Fast: uh denman island where um placed to each how did i do uh as

[0:00:55] Trustee Fast: a territory that's very special to the Comox people, their territory.

[0:01:00] Trustee Fast: And I'm Sue Ellen Fast, elected on Bowman Island, and I'm the vice chair of the Islands Trust.

[0:01:05] Trustee Fast: So I'm chair of the Denman Local Trust Committee, and I'm joined today by the Denman Local Trustees,

[0:01:17] Trustee Fast: And together we make up the Denman Local Trust Committee.

[0:01:44] Voice 7: Thank you, Mr. Chair. This is an application for a development permit for DPA number 5, which is your village development permit.

[0:01:53] Voice 7: And Marlis McCarter has left me to sort of help introduce this report, so hopefully I can answer any questions you have, otherwise I can get a whole number.

[0:02:02] Voice 7: So this is 43676 Denman Road. The development permit is for the construction of a veterinary clinic in Commercial Court, and there is a single-family dwelling in association with this redevelopment of the property.

[0:02:16] Voice 7: And the property is about 3 acres, as shown on Figure 1.

[0:02:24] Voice 7: The applicant is going to be constructing the clinic within an accessory building attached to the property, which is formerly a garage.

[0:02:34] Voice 7: We constructed it as a garage accessory to the building.

[0:02:37] Voice 7: There was a Citing and Use Permit in 2020 that was issued, and at that point it was strictly residential.

[0:02:43] Voice 7: That's why the development permit wasn't a part of this process.

[0:02:47] Voice 7: But the ownership of this has changed and so the modification to the plan shows the intended use of that accessory building for commercial purposes.

[0:02:57] Voice 7: So the staff report is pretty comprehensive in terms of outlining how this application complies with the guidelines of your development permit area.

[0:03:06] Voice 7: and the OCP and land use by law there's a draft permit attached that shows the specific conditions

[0:03:12] Voice 7: related to landscaping screening as well as parking requirements and that's really the

[0:03:19] Voice 7: extent of this DP the staff recommendation is to issue the development permit as is consistent with

[0:03:25] Voice 7: your guidelines if you have any questions I'm happy to try to answer them okay

[0:03:33] Trustee Fast: much and uh we've got the report in front of us starting on page 30 to page 46 and uh any

[0:03:40] Trustee Fast: questions for the planner go ahead justin christie yes

[0:03:44] Voice 2: so um looking through the regulations as best

[0:03:50] Voice 2: i can am i correct that we cannot impose any other additional conditions such as requiring

[0:03:59] Voice 2: requiring installation for sound in the vet clinic area, being mindful that vets operations may have some barking dogs from time to time.

[0:04:12] Voice 2: And the proximity of neighbors there is quite close, so it's a concern to me, but it may be that we can't do anything about it.

[0:04:20] Voice 7: It's a very small lot configuration adjacent to other residential uses.

[0:04:26] Voice 7: So that is a concern. The applicant unfortunately isn't here to hear these comments because it would have to be voluntary to say increase the installation requirements above and beyond what the building code currently requires for a commercial application.

[0:04:44] Voice 7: I'm not sure if it's similar for residential or not for commercial purposes for construction.

[0:04:49] Voice 7: And since there's no building permit inspection service to sort of follow up on that, it would strictly be voluntary at this point in time.

[0:04:57] Voice 7: Your DP does not contemplate a higher construction standard for the purposes of sound grouping. It's really a form of character.

[0:05:06] Voice 2: Right. And also on that topic, the Islands Trust does not have jurisdiction over the noise in any event.

[0:05:19] Voice 2: it. So that would, if there was undue amount of barking going on, that would be a noise

[0:05:28] Voice 2: complaint to the Comox Valley Regional District, who do have a noise bylaw that applies to

[0:05:35] Voice 2: Denman Island, as I understand it.

[0:05:36] Voice 7: That's correct, but it is permitted use. The commercial use is permitted, and so the

[0:05:42] Voice 7: noise bylaws come into effect through the zoning, or the noises are not consistent with

[0:05:48] Voice 7: the zoning that's permitted. So even though some people might say well commercial use is only

[0:05:54] Voice 7: limited to business hours so there shouldn't be any noise associated with that commercial use

[0:05:58] Voice 7: after. That could be really tricky. The zoning permits a wide variety of commercial uses

[0:06:08] Voice 7: and historically commercial zone that was applied from way back when and with very close proximity

[0:06:18] Voice 7: many residential uses so it's not ideal there's no offer to create a better space in that regard so

[0:06:27] Voice 7: it could be a potential language conflict with those nice issues and it's not enforceable

[0:06:33] Voice 2: yeah because in practice although it's been a number of those properties zoned

[0:06:38] Voice 2: commercially historically being used as dwellings at least either in whole or in part

[0:06:44] Voice 2: That is a concern. Is that clinic actually a designated ward within the commercial use, or are we using some interpretation of commercial?

[0:06:58] Voice 7: Let me check. It's in the site context to the staff report. It's in the site context to Attachment 1.

[0:08:09] Trustee Busheikin (probable): i'm half the floor i'll speak to the noise issue like i i don't think it's gonna be

[0:08:17] Trustee Busheikin (probable): actually problematic like i there's already a vet clinic running operated by the same people

[0:08:25] Trustee Busheikin (probable): are staffed by them next door um and i attend that vet clinic and um it's there's been no

[0:08:33] Trustee Busheikin (probable): issues with noise there and i've actually never when i was attending ever never you know there's

[0:08:37] Trustee Busheikin (probable): the odd barking but it's it's a busy area that people walk their dogs back and forth there all

[0:08:42] Trustee Busheikin (probable): the time back and forth from the guest house and um i don't think um you know and the animals come

[0:08:50] Trustee Busheikin (probable): they have an appointment and they go so if there's one barky dog it's not like a boarding facility

[0:08:53] Trustee Busheikin (probable): where there might be a few barky dogs that just like are there 24 hours.

[0:08:57] Trustee Busheikin (probable): So I don't actually see it as a challenge with the barking or the meowing.

[0:09:09] Trustee Busheikin (probable): If

[0:09:11] Voice 2: I could just play a little devil's advocate. Go for it.

[0:09:16] Voice 2: I'm concerned that if we are not compelled to do this and we do do it,

[0:09:22] Voice 2: But we then create a scenario where we don't know what the future use will be vis-a-vis a vet.

[0:09:32] Voice 2: And a vet could well have some sort of temporary board and while the dog is ill, for example.

[0:09:42] Voice 2: And that could be fairly extensive.

[0:09:46] Voice 2: I just don't know.

[0:09:47] Voice 2: Well, I mean, I did hear that when the adjacent premises were being used temporarily for vet

[0:09:54] Voice 2: purposes, that there was no intention to have boarded dogs there.

[0:09:58] Voice 2: And that was sort of set a, in a way, a mind's at rest, possibly, on it.

[0:10:07] Voice 2: But once it's established as a vet clinic and we've given it a permit for that very

[0:10:14] Voice 2: purpose that I'd be concerned if if it has some ability to put constraints on

[0:10:25] Voice 2: it do you favor do that just because of the I think unforeseen nature of issues

[0:10:34] Voice 2: that could arise there and the close proximity not only the one immediate

[0:10:41] Voice 2: neighbor but people behind it going to be an affordable housing with ten units

[0:10:47] Voice 2: or whatever so your

[0:10:52] Voice 7: development permit and only have conditions related to the purpose of the

[0:10:57] Voice 7: development program which is for my character the zoning you're able to set conditions of use

[0:11:04] Voice 7: within the zone right specific

[0:11:06] Voice 7: to different uses we don't see that in the way the land use bylaw

[0:11:10] Voice 7: set up that's not it's not really conducive to that because it's got a bit of an unconventional

[0:11:15] Voice 7: format with the checkboxes. So it's a little harder to lay it out, but other zoning guidelines

[0:11:22] Voice 7: would have conditions of use for different types of uses that could be more specific.

[0:11:26] Voice 7: So it looks like the commercial zoning doesn't specifically permit or specify veterinary

[0:11:34] Voice 7: clinic as a defined term in a commercial zone. So the closest thing I can find, and I have

[0:11:41] to

[0:11:41] Voice 7: confirm with the planner that this is how they interpreted it, is under personal services,

[0:11:46] Voice 7: which is a defined use, and it includes a broad range of services and health care, professional health care,

[0:11:54] Voice 7: and incidental retail sales that are commonly associated with those things.

[0:11:58] Voice 7: So under the broader umbrella of health, not just humans,

[0:12:04] Voice 7: it looks like that's how the commercial zone has been interpreted to allow for that type of a land use.

[0:12:11] Voice 7: and it's under that zoning then that you would have to specify conditions around hours of operation

[0:12:19] Voice 7: or limitations to overnight boarding, things like that,

[0:12:25] Voice 7: so that it would really just be a day clinic versus an overnight if that was the way to put it.

[0:12:30] Voice 7: It couldn't be through the development permit.

[0:12:32] Voice 7: I

[0:12:34] Voice 2: see. But if the proposed use is definitely permitted by the current zoning,

[0:12:44] Voice 2: that we basically have no options, we just have to approve the development program because it checks all the boxes, literally.

[0:12:52] Voice 2: But if it doesn't, if we can say legitimately that this isn't a use contemplated by the commercial zone,

[0:13:02] Voice 2: on a

[0:13:03] Voice 2: different interpretation than staff have given, then we would be to a rezoning process,

[0:13:11] Voice 2: at which point we may put on special conditions. Correct. So that it hangs

[0:13:19] Voice 2: really on whether that is a proper interpretation of personal services

[0:13:24] Voice 2: includes that clinic.

[0:13:26] Voice 7: Yeah so I can't pull it up on the screen here for you or anything to show you.

[0:13:31] Voice 2: Is it in the

[0:13:32] Voice 2: definition section of the bylaw? Yeah.

[0:13:34] Voice 7: Under definition and then page, in terms of a commercial and so on and so forth.

[0:13:53] Voice 7: There aren't other uses specified in the zone the way it's set up that would really be applicable.

[0:14:03] Voice 7: So I can check with the planner to clarify that I'm correct in that.

[0:14:10] Voice 7: This is where I...

[0:14:14] Voice 2: There's not a quick reading of that without putting too much of a lawyer hat on the thing.

[0:14:18] Voice 2: I'm not immediately seeing that that necessarily fits.

[0:14:24] Trustee Fast: I'm going to put myself on the list for a moment.

[0:14:30] Trustee Fast: Two things.

[0:14:32] Trustee Fast: One is just an example from Bowen Island, where we have a development called Artisan Square,

[0:14:38] Trustee Fast: which has multifamily housing with businesses in them.

[0:14:45] Trustee Fast: And we've had a vet clinic there for about, it must be 15 years or so,

[0:14:51] Trustee Fast: And it's in the bottom floor of a multi-use unit that includes residential.

[0:15:04] Trustee Fast: And it hasn't been a problem.

[0:15:05] Trustee Fast: And they do overnight.

[0:15:07] Voice 2: Sorry, they do?

[0:15:08] Voice 2: They

[0:15:08] Trustee Fast: do overnight boarding when needed.

[0:15:12] Trustee Fast: They also try to keep the dogs quiet.

[0:15:17] Trustee Fast: And I'm not sure what they've got in the way of, you know,

[0:15:20] Trustee Fast: Dogs that are in there are sick, and they want usually, but anyway, it hasn't been a problem on both.

[0:15:27] Trustee Fast: So that's just one example, and I don't know very much about it, except that I'm a patron of the clinic.

[0:15:32] Voice 2: Yes, I'm wondering if that building has more than, or has purposely put in insulation to control for something.

[0:15:41] Trustee Fast: It may very well have, because it's got a bunch of, I believe it's got a bunch of adaptations to be a clinic.

[0:15:50] Trustee Fast: and it's going to, I think it's had a few kind of remodelings, I'm not sure.

[0:15:55] Trustee Fast: But anyway,

[0:15:56] Voice 1: that's just an example.

[0:15:57] Trustee Fast: question for the trustees, I guess, is would a vet clinic be a benefit to the island in terms of farming?

[0:16:09] Voice 2: Oh, you know, I think a vet clinic is a benefit and would be welcomed,

[0:16:16] Voice 2: but I don't want to impose a potential nuisance on the next-door neighbors.

[0:16:25] Trustee Fast: Yeah, okay, I just wasn't clear on, I don't know the history, so I don't know, maybe you can tell, is it a part-time use?

[0:16:33] Trustee Fast: Do the people come from somewhere else, or the vets that have been using?

[0:16:38] Trustee Busheikin (probable): Does

[0:16:39] Trustee Fast: it make it a permanent use?

[0:16:40] Trustee Fast: I mean,

[0:16:40] Trustee Busheikin (probable): like right now they're operating out of a different building, and I don't know their plans.

[0:16:45] Trustee Busheikin (probable): Like it's a couple, they're both vets, they work for a Comox Valley vet clinic, and

[0:16:50] Trustee Busheikin (probable): they started this sort of outpost on Denman,

[0:16:54] Trustee Busheikin (probable): and it's just open on Tuesdays um and um and it's it's great to be very welcome yeah and I believe

[0:17:04] Trustee Busheikin (probable): I'm not sure that when they come over well now they live here but it used to be people were

[0:17:08] Trustee Busheikin (probable): coming traveling here and still actually it's not just that that couple that works at Buckingham

[0:17:14] Trustee Busheikin (probable): people come they commute here to staff the clinic on Tuesdays and I believe that they also

[0:17:19] Trustee Busheikin (probable): Also, when they're here, they will do visits to farms to deal with farm animals.

[0:17:29] Trustee Fast: I just haven't heard it mentioned, so I just want

[0:17:34] Trustee Busheikin (probable): bringing a service we had to go to town for to Denman, which I think is a really good thing.

[0:19:19] Voice 7: yeah so that's i think that's where it gets really tricky because that's the issue with

[0:19:23] Voice 7: residential zoning that commits agriculture for example and people are making complaints around

[0:19:29] Voice 7: the animals making noises at four o'clock in the morning when the residents next door are trying to

[0:19:36] Voice 7: sleep and a regional district comes in and says this is a permitted view right it is very difficult

[0:19:43] Voice 7: for us to say there's a threshold of tolerance for that noise during certain hours unless it's

[0:19:50] Voice 7: explicit in a condition of use in zoning that you can do all these residential things but if you're

[0:19:56] Voice 7: going to have the keeping of roosters uh that they need to be a no insulator crew that has to be

[0:20:03] Voice 7: We can't be free-ranging between 11 p.m. and 8 a.m.

[0:20:10] Voice 7: So it's really tough for a regional district to enforce a noise bylaw

[0:20:15] Voice 7: or the land use that's been set up to kind of create those conflicts.

[0:20:20] Voice 7: Got it.

[0:20:23] Trustee Fast: I'm going to put myself on the list and say,

[0:20:26] Trustee Fast: if anybody knows the issues of noise near residential areas,

[0:20:34] Trustee Fast: is it's going to be events that are in practice.

[0:20:36] Trustee Fast: Like, they will probably have thought about this.

[0:20:40] Trustee Fast: And I wonder, because it's their business

[0:20:45] Trustee Fast: and they've been doing it for a while.

[0:20:46] Trustee Fast: And secondly, if there's an issue,

[0:20:53] Trustee Fast: then would that be the time to consider a rezoning?

[0:20:58] Voice 7: So, through the chair, your assembly, Marla,

[0:21:01] Voice 7: does not have a lot of options built into the commercial zoning

[0:21:06] Voice 7: zoning or the industrial zoning. It is pretty basic. And so this would be considered a typical

[0:21:12] Voice 7: type of rural land use is to have a veterinary clinic for, you know, you're not at home office

[0:21:18] Voice 7: or office space. And so an office space could also be there for the delivery of animals

[0:21:25] Voice 7: to kind of check them out and send them on their way. I think what you're referring to

[0:21:28] Voice 7: is really that boarding element of veterinary clinics where they're in surgery and they're

[0:21:37] Voice 7: They're observing the animals overnight and providing for care, and there might be some more intense uses of the land based on that particular element of their service.

[0:21:50] Voice 7: So this is the closest thing you've got in your land use dialogue to permit this kind of use.

[0:21:55] Voice 7: and the planner, just in dialoguing with them right now,

[0:21:58] Voice 7: it was determined through an inquiry

[0:22:00] Voice 7: at the beginning stage of even purchasing the property,

[0:22:03] Voice 7: that the planners had determined

[0:22:05] Voice 7: that this was the best potential option

[0:22:08] Voice 7: for setting up the service.

[0:22:09] Voice 7: So that was the advice that they got from our offices.

[0:22:13] Voice 7: You know, this would really be the closest thing

[0:22:16] Voice 7: you could get to without it being explicitly mentioned

[0:22:19] Voice 7: anywhere in the zone.

[0:22:20] Voice 7: There's no mention of boarding even, or kennels.

[0:22:27] Voice 7: Operating a kennel or...

[0:22:28] Voice 2: There is somebody with a kennel.

8.2 Enforcement Policy on Unlawful Dwellings - Staff Report 
Bylaw Compliance and Enforcement Manager Dingman presented the staff report that 
responds to a request from the LTC to provide input on a suggested amendment to 
Standing Resolution No. 7 DE-2019-056/DE-021-015 proposed at the March LTC 
meeting. He provided an update on the current number of open files for unlawful 
dwellings on Denman Island and confirmed that Bylaw staff are not issuing eviction 
notices and further, it is not clear if Bylaw Compliance and Enforcement has the 
legislative authority to do so.  
Trustees discussed possible amendments to standing resolutions regarding unlawful 
dwellings and the following points were noted:

 The Trust Council Bylaw Compliance and Enforcement Policy references education 
and mediation as a means to achieve voluntary compliance, and this might be

residential tenancies was considered to be necessary in order to understand options 
which may or may not be available to Bylaw Compliance staff; 
 Including an end or review date in a standing resolution is optional; the resolution

 A report on current Denman Island Bylaw Compliance and Enforcement files was 
suggested; 
 Consideration was given to rescinding the standing resolution that addresses bylaw

9. APPLICATIONS, REFERRALS AND  BYLAWS 
9.1 DE-DP-2022.1 (MacDonald) - Staff Report 
Planner Zupanec presented the staff report that asks the LTC to consider a Development 
Permit (DP) application for the construction of a single family dwelling and a veterinary 
clinic located within the Development Permit Area No. 5 – Village (DPA 5). 
Discussion on the application followed: 
 A Trustee expressed concern that noise associated with current or future use of the 
commercial property might create the possibility of conflict with close residential 
neighbouring properties, and inquired if conditions can be set for soundproofing or 
other measures to mitigate potential concerns; 
 Staff advised that this type of development permit can only set conditions relating 
to form and character while zoning applications can set conditions on types of uses 
that can be more specific; 
 The zoning bylaw does not explicitly identify veterinary clinics as a permitted use, 
however staff have interpreted this use to be permitted in the zone within one of 
the general categories of permitted uses; the current owner was sent a confirmation 
letter in 2020 from the Islands Trust prior to the purchase of the property stating 
that the zoning permitted residential use and commercial uses that would include 
veterinary use. 
 
DE-2022-076

that the Denman Island Local Trust Committee approve issuance of Development Permit 
DE-DP-2022.1 for LOT C, SECTION 18, DENMAN ISLAND, NANAIMO DISTRICT, PLAN 
10674 (PID 005-242-193). 
 
Trustee Critchley stated that there is no disrespect intended toward the applicant, however 
expressed concern with possible future issues that could arise without conditions being placed 
on the commercial use. He would like to obtain a legal opinion to confirm that this Development 
Permit application is for a permitted use and if the Local Trust Committee is not obliged to issue 
it, then would be in favour of consideration of a rezoning application in order to set conditions 
to ensure a peaceful neighbourhood. 
 
Trustee Busheikin commented that staff have analyzed the definition of commercial activity and 
ascertained that this fits within the definition; the question of whether the plans satisfy the

requirements of the Development Permit Area is what is before the Local Trust Committee for 
consideration, and the Guidelines for DPA 5 appear to be satisfied.

Trustee regarding noise with the applicant. 
9.2 Denman Island Proposed Fees Bylaw No. 245 - for consideration of Adoption - Report

that the Denman Island Local Trust Committee Bylaw No. 245, cited as “Denman Island 
Local Trust Committee Fees Bylaw, 2022”, be adopted. 
CARRIED 
Trustee Busheikin stated that she voted in favour of this resolution in support of the 
collaborative work; however still thinks that some of these fees are too high and she is 
not comfortable with the degree that individual applicants are being asked to pay for 
permitting that should be covered by the tax base. She noted that it works against 
accessibility and affordability and she would be cautious about any further increases. 
10. LOCAL TRUST COMMITTEE PROJECTS 
10.1 Projects List - Staff Report 
Regional Planning Manager Kauer introduced the staff report that asks the LTC to 
consider any changes to the Top Priorities and Projects List prior to the end of the 
current term, confirm endorsement of the 2023/2024 budget case for the Housing 
Review project, and presents a reorganization by category of the Projects List. 
Trustees’ discussion included the following: 
 The status of the Model Cell Tower Strategy was uncertain and Trustees considered 
that review of the strategy would be helpful to inform a decision regarding its 
placement on the Work Program; 
 The status of the Development Approval Information Bylaw was uncertain; its 
completion is required to finalize the Development Procedure Bylaw No. 71; 
 The topic of travel trailers may be removed from the Projects List as it is included in 
the Housing Review Top Priority; and the topic of floor area limitation could be 
added to the Housing Review In Scope category; 
 There has been no interest in the Ocean Loop Geo-Exchange Systems potential 
project; 
 Additional support for community engagement in Phase 2 of the OCP and LUB 
Housing Review was considered and an increase to the Budget Funding Request 
Short-Form Business Case was suggested; 
 Staff will correct the name of the Denman OCP and LUB Housing Review to remove 
“and Short Term Rentals” in the Budget Funding Request Short-Form Business Case 
and elsewhere that it may appear.

informal manner starting in August, 2022 to develop an engagement plan for LTC 
consideration in the fall. Public engagement will take place in the fall/winter with a final 
report of recommendations provided to the LTC in March, 2023.

Activity Centre was passed at the May LTC meeting; staff will follow up on this issue.
