[0:00:01] Voice 5: Okay,

[0:00:01] Voice 1: we're going to call

[0:00:02] Voice 5: the meeting to order.

[0:00:33] Voice 2: Before we begin, I want to acknowledge the St. Jocelyn and all the Man of Speaking people on whose territory we exist.

[0:00:40] Voice 2: We work to be increasingly mindful of our commitment to work more inclusively with our neighbors.

[0:00:44] Voice 2: I would like to acknowledge the Saturna, specifically the First Nation governments,

[0:00:49] Voice 2: with whom we are committed to building a stronger working relationship.

[0:00:52] Voice 2: SACIM, SARTLEP, SAER, KAKUCHIN, MALLAHAT, and PANALIPEP TRAIN, AND ALSO WITH THE INDIVIDUAL

[0:00:58] Voice 2: LEADERSHIP OF FIRST NATIONS LIVING ON OUR HOMES.

[0:01:02] Voice 2: SO WE HAVE AN AGENDA BEFORE US.

[0:01:06] Voice 2: DO YOU NEED ANY CHANGES TO THE AGENDA, TRUSTEE MIDDLETON?

[0:01:10] Voice 2: NO, THANK YOU, CHAIRMAN.

[0:01:12] Voice 2: OKAY.

[0:01:13] Voice 2: SO WE SHALL THEN PERHAPS SUGGEST THAT WE APPROVE.

[0:01:17] Voice 2: ONE SECOND.

[0:01:18] Voice 2: I

[0:01:18] Voice 1: THINK IT'S IN HERE.

[0:01:20] Voice 1: I DIDN'T SEE IT.

[0:01:23] Voice 1: but our um

[0:01:27] Voice 1: our main priorities i just quickly went through it thinking it was in here but i just haven't i

[0:01:36] Voice 2: we could probably address it if it's a main priority um issue at that time

[0:01:43] Voice 2: what is that time i don't

[0:01:44] Voice 1: see it in here

[0:01:45] Voice 1: years. I think time

[0:01:55] Voice 5: is money trusted medicine. So

[0:01:58] Voice 1: can we, we

[0:02:01] Voice 1: can, I mean, it's not really new business, but can we add main

[0:02:07] Voice 1: priorities to the new business? Or and everybody in the room

[0:02:13] Voice 1: will be thrilled about the new priorities.

[0:02:17] Voice 4: I guess

[0:02:19] Voice 1: just new

[0:02:21] Voice 1: business for sake of sake of our union so 15 15

[0:02:25] Voice 3: yeah

[0:02:25] Voice 2: new priorities or maybe we have a tough we

[0:02:30] Voice 2: have

[0:02:30] Voice 1: a top priorities list oh there it is sorry top creditors report i apologize we can strike

[0:02:36] Voice 1: that it's already in there at 14.1 good i thought i thought i

[0:02:40] Voice 1: had seen it but then i couldn't see it

[0:02:42] Voice 1: this time but there we go

[0:02:44] Voice 2: so brad could you mark one demerit point for trustee middleton

[0:02:47] Voice 2: then okay thank you so we're going to approve the agenda by consent trustee report i have nothing to

[0:02:56] Voice 1: report um can you give the chair's report then i have nothing to report do you have something

[0:03:04] Voice 1: to report well i

[0:03:06] Voice 1: guess the other thing is the um working as the member of the parks liaison

[0:03:13] Voice 1: liaison committee. We are seeking to reach a compromise about installation of benches

[0:03:23] Voice 1: and a speaking greeting box, which is ongoing. I myself think it's, you know, a reasonable

[0:03:38] Voice 1: thing to do other my co-chair thinks otherwise and we're now embroiled in a negotiation shall

[0:03:44] Voice 1: we say with with parks over quite what to do about this um so i guess stay tuned for that

[0:03:50] Voice 1: because i think there'll be more news on on that front um and then otherwise just the formation of

[0:03:59] Voice 1: the uh the member of the the first standard standing committee on governance of the

[0:04:07] Voice 1: alice trust council when we have our first meeting next week july 29th yes and i guess

[0:04:13] Voice 2: most people would know that we have we made a motion at last trust council and uh to have the

[0:04:19] Voice 2: province review the trust in its entirety its mandate the act its structure the organization

[0:04:26] Voice 2: itself so we're looking to hear back from the province so now we're on to town hall

[0:04:32] Voice 2: my questions are there any questions from members of the public all of you no questions okay great

[0:04:40] Voice 2: so we'll move on to our community information meeting we're doing very very well here in

[0:04:45] Voice 2: respect of the official community plan and land use bylaw minor amendments project

[0:04:51] Voice 2: Brad can you take us through quickly

[0:04:59] Voice 5: putting the pressure on your liquid it's very nice it's neat more

[0:05:07] Voice 2: just for this meeting very good

[0:05:08] Voice 2: just filling time okay yeah i put mine on i've just got an alligator right then this isn't this

[0:05:15] Voice 2: isn't a chinese knockoff okay this is one i bought about 40 years ago i

[0:05:21] Voice 3: lost 133 and 134

[0:05:23] Voice 3: or in response to your minor amendments project

[0:05:28] Voice 3: with your OCP and your land use by-law.

[0:05:31] Voice 3: And the purpose of the by-laws is to address

[0:05:34] Voice 3: some minor issues with zoning and some warning changes

[0:05:39] Voice 3: to your consistency with everything in the by-laws.

[0:05:43] Voice 3: So today we're having a community information meeting

[0:05:47] Voice 3: and then followed by a public hearing on those by-laws.

[0:05:53] Voice 3: I think

[0:05:54] Voice 2: they're good just for clarity's sake the big ones are we're going to rezone the land

[0:06:03] Voice 2: around money park money lake that's a park that is a park we're going to legalize the shed that's

[0:06:12] Voice 2: in the on the school grounds because I guess it wasn't legal well it wasn't zoned as a school

[0:06:22] Voice 2: it

[0:06:22] Voice 1: wasn't zoned as a school it's still residential the lot was split into

[0:06:26] Voice 1: yeah so now it's all

[0:06:27] Voice 1: community amenity school right or will be after the passenger yeah and

[0:06:34] Voice 2: then the uh

[0:06:36] Voice 2: the other one was my brain is not working well here do you remember there

[0:06:40] Voice 1: was a just a couple

[0:06:41] Voice 1: issues when we meet when we created okay so outstanding was the fact that all the parkland

[0:06:46] Voice 1: hadn't been turned into park zone as it had been on the other islands and that was pending

[0:06:52] Voice 1: the taxation resolution, I think.

[0:06:54] Voice 1: And so we just went ahead and made all park,

[0:06:56] Voice 1: national park reserve lands.

[0:06:58] Voice 3: It's a previous project.

[0:06:59] Voice 1: It's a previous one.

[0:07:00] Voice 1: No, that was a previous one,

[0:07:01] Voice 1: but there were a couple of errors

[0:07:02] Voice 1: in that we didn't capture all the,

[0:07:04] Voice 1: there was, I think, a marine zone

[0:07:06] Voice 1: and some of the small islets didn't get,

[0:07:09] Voice 1: didn't get captured in the park zoning.

[0:07:11] Voice 1: So that was just a minor amendment here

[0:07:13] Voice 1: that we caught up with.

[0:07:14] Voice 1: Anyway,

[0:07:14] Voice 2: King's Islet was also,

[0:07:17] Voice 2: it was zoned as a,

[0:07:19] Voice 2: I think Wilderness Reserve has most of the islands that are no-touch islands,

[0:07:24] Voice 2: except there's been a house there for about three decades.

[0:07:27] Voice 2: It was improperly zoned, so we fixed that.

[0:07:29] Voice 2: Those are the three things.

[0:07:32] Voice 2: That's it. I think we're going to move to a public hearing,

[0:07:34] Voice 2: unless I have a lot of questions from some people.

[0:07:38] Voice 2: Hello, you guys in the back.

[0:07:41] Voice 2: I'm not seeing any hands.

[0:07:43] Voice 2: I'm going to read this, so I'll try to make it quick.

[0:07:46] Voice 2: This public hearing is made to be pursuant to Section 465 of the Local Government Act

[0:07:51] Voice 2: in order to consider the following proposed bylaws.

[0:08:26] Voice 2: Members of the Local Trust Committee may, if they wish,

[0:08:28] Voice 2: ask questions of you following your presentation.

[0:08:31] Voice 2: However, the main function of Local Trust Committee members

[0:08:33] Voice 2: is to listen to the views of the public.

[0:08:34] Voice 2: It is not the function of the committee members

[0:08:36] Voice 2: to debate the merits of the proposed bylaws

[0:08:38] Voice 2: with individual citizens.

[0:08:40] Voice 2: Everyone will be given a reasonable opportunity

[0:09:31] Voice 2: notice, make whatever decision it deems proper with respect to the bylaws that is the subject

[0:09:36] Voice 5: the public hearing.

[0:09:42] Voice 5: Any submissions written or otherwise? Hearing

[0:09:45] Voice 2: none, I guess we should try to advance the bottom, should we not?

[0:09:52] Voice 3: I also have to do a statutory version here in this notification.

[0:10:01] Voice 3: Okay. Do

[0:10:02] Voice 2: a better job

[0:10:02] Voice 3: than I did, okay?

[0:10:03] Voice 3: I will, I'm sure.

[0:10:07] Voice 3: so just bear with me after a copy of this

[0:10:10] Voice 3: notice a copy of the public notice was advertised in two

[0:10:14] Voice 3: consecutive editions of the driftwood on july 6th and july 13th 2022 all of those additional

[0:10:25] Voice 3: public hearing market available during this public hearing and is located on the island's

[0:10:30] Voice 3: Trust website. Proposed bylaws 134 and 134 will amend the Saturna Island Official Community Plan

[0:10:36] Voice 3: bylaw number 70 and Saturna Island Land Use Bylaw number 119 by making minor amendments that will

[0:10:42] Voice 3: prepare you for bylaws and address the long-standing inconsistencies with respect to zoning and land

[0:10:48] Voice 3: use designations. The proposed bylaws will refer to Saturna Island Parks and Recreation Commission,

[0:10:54] Voice 3: Capital Regional District Building Inspection, Capital Regional District Regional Parks and

[0:10:58] Voice 3: community services and main north and south bender local trust committees for coming it was also

[0:11:05] Voice 3: referred to california first nation lake california first nation lyons and first nation malab first

[0:11:11] Voice 3: nation huichin first nation penelope tribe semi-annual first nation tsunamis first nations

[0:11:18] Voice 3: to name this first nation first of first nations first nations watson first nation

[0:11:27] Voice 3: There has been one public submission received as of today's date.

[0:11:33] Voice 3: Thank you.

[0:11:39] Voice 2: So shall we move with motions?

[0:11:42] Voice 2: If you like making some motions.

[0:11:46] Voice 2: In the

[0:11:47] Voice 3: second part, remember it's here.

[0:11:50] Voice 3: You can speak to the submissions and then you need to call three times your speakers.

[0:12:00] Voice 2: I'll have to open them, because I didn't get those notes, I knew you sent them to me, but

[0:12:06] Voice 2: I didn't.

[0:12:08] Voice 3: I

[0:12:08] Voice 2: thought I had enough.

[0:12:10] Voice 3: No worries, you're required to call three times for speakers.

[0:12:15] Voice 2: Yeah, just a sec.

[0:12:17] Voice 5: Not in my computer, so let's take a look at this thing.

[0:12:25] Voice 5: So on page two, you have, here

[0:12:30] Voice 3: in the public, you need to meet up.

[0:12:33] Voice 3: and then you can close your board meeting

[0:12:35] Voice 3: and then you can move into

[0:12:36] Voice 5: back into your room.

[0:12:38] Voice 5: Got it, thanks.

[0:12:45] Voice 5: Thank God the print is small here.

[0:12:46] Voice 5: Okay, that's you.

[0:12:55] Voice 5: This

[0:13:05] Voice 2: is going to be a little repetitive.

[0:13:06] Voice 2: Submissions can be made at any time

[0:13:08] Voice 2: during until the close of the hearing.

[0:13:09] Voice 2: If any submissions are received during the meeting,

[0:13:11] Voice 2: we will pause prior to closing

[0:13:12] Voice 2: to ensure the LTC has time to review those submissions.

[0:13:15] Voice 2: The submission should be made email to

[0:13:20] Voice 2: vicphsuv at analysttrust.vc.ca.

[0:13:23] Voice 2: I invite members of the public who wish to speak to line up, please state your name prior

[0:13:27] Voice 2: to making comments after your presentation to the LTC the trustees may ask you questions,

[0:13:32] Voice 2: but they're primarily here to listen and will not debate issues I will call three times

[0:13:36] Voice 2: for speakers before closing the hearing at which point no further written or oral submissions

[0:13:40] Voice 2: can be made.

[0:13:45] Voice 5: Okay, so we will now

[0:13:47] Voice 5: call three times and

[0:13:48] Voice 3: I think you could jump down to.

[0:13:50] Voice 3: we will

[0:13:51] Voice 2: now proceed to close publication

[0:13:54] Voice 3: just you are required to say three times are there any speakers that wish to speak to these

[0:14:03] Voice 5: bibles yeah

[0:14:04] Voice 2: we will now proceed to close the public hearing please note after the public

[0:14:10] Voice 2: area closes the local

[0:14:11] Voice 3: i'm sorry to not interrupt you need to say three times like you need to

[0:14:16] Voice 3: repeat it three times i know i'm telling you okay

[0:14:18] Voice 2: i will call three times your speakers

[0:14:20] Voice 2: we're closing the hearing at which point no further written or all submissions can be

[0:14:25] Voice 2: made asking once for any more speakers says here long pause 10

[0:14:30] Voice 5: seconds asking a second time for

[0:14:37] Voice 5: any more speakers asking the third time for any more speakers

[0:14:43] Voice 2: this is now the final opportunity

[0:14:47] Voice 2: for you to hand in a written submission to the local trust committee meeting committee once

[0:14:52] Voice 2: the hearing is closed no additional submissions will be accepted so we're now closing the public

[0:14:59] Voice 2: hearing.

[0:15:00] Voice 5: Yes. Please

[0:15:02] Voice 2: be advised that

[0:15:02] Voice 5: we are now

[0:15:02] Voice 2: in the post-public hearing stage of the

[0:15:04] Voice 2: legislative review of the proposed bylaws 133 and 134. Sterling Island Local Trust Committee can

[0:15:10] Voice 2: no longer receive information pertaining to the proposed bylaws. However, you can still submit

[0:15:14] Voice 2: any outstanding questions or comments directly to the planner. DLTC may give further readings

[0:15:19] Voice 2: of the bylaw or defeat the bylaw or make minor amendments that do not affect the user density

[0:15:23] Voice 2: without further notice of hearings. Okay, so we're now going to reconvene the meeting so that we can

[0:15:29] Voice 2: consider options regarding the bylaws. Thank you. I missed that.

[0:15:34] Voice 3: No worries. It's just as required by the statute.

[0:15:37] Voice 2: So if you

[0:15:37] Voice 3: don't do that, someone could speak with you.

[0:15:40] Voice 2: Right. And we have a pretty feisty crowd in here today.

[0:15:43] Voice 2: It's just good

[0:15:44] Voice 3: practice.

[0:15:46] Voice 2: Okay. Agreed.

[0:15:47] Voice 3: So I did send you both an email with two other minor amendments that you could consider and

[0:15:55] Voice 3: to provide the resolutions to do that so if you do decide to make those minor amendments you need to

[0:16:01] Voice 3: make those resolutions and pass them and then you would need to give a third reading to the

[0:16:18] Voice 5: excellent

[0:16:19] Voice 1: so i think it's a the resolutions you provided have to be made first to correct

[0:16:25] Voice 1: This is my issue, so I guess I'll go ahead and say that the result of the

[0:16:29] Voice 1: Saturna Island Local Trust Committee meant subsection 15.1.38 of the

[0:16:34] Voice 1: Saturna Island Line of Spiral No. 119 by replacing the reference to

[0:16:41] Voice 1: section 2.16 with section 2.15.

[0:16:49] Voice 1: I'm reading how Brad would do this, so I imagine he'd just send it on to

[0:16:53] Voice 1: you for convenience.

[0:17:07] Voice 3: Okay.

[0:17:08] Voice 2: I will second that. We're going to do them separately. Any discussion? All in favor?

[0:17:15] Voice 2: Passes. I'm going to read the next one that the Saturna Island Local Trust Committee

[0:17:20] Voice 2: events subsection 2.14.2 of this eternal land use bylaw number 119 to

[0:17:25] Voice 2: read steps heaves gutters

[0:17:27] Voice 2: cornices sills chimneys or other similar features comma may project up to one meter into the setback

[0:17:32] Voice 2: or 0.5 meters in the case of a side yard setback area three meters or less in width and balconies

[0:17:40] Voice 2: decks and sun shades may project up to one meter into the required setback area i second that

[0:17:50] Voice 5: any discussion i'll

[0:17:52] Voice 2: call the vote all in favor

[0:17:59] Voice 3: okay all very

[0:18:03] Voice 1: well affected and uh fully discussed i will move that the saturn island

[0:18:07] Voice 1: local trust committee proposed bylaw number one three three cited as turn island official

[0:18:12] Voice 1: Official Committee Plan by-law number 70-2000,

[0:18:15] Voice 1: amendment number one, 2021,

[0:18:18] Voice 1: be read a third time as amended.

[0:18:21] Voice 3: No, it doesn't need to be amended

[0:18:23] Voice 3: because it's the OCP by-law.

[0:18:24] Voice 2: Oh, that's, okay.

[0:18:26] Voice 2: So that

[0:18:27] Voice 3: was just-

[0:18:27] Voice 3: Right, okay.

[0:18:28] Voice 2: Okay, so I'll second that and I'll call the vote.

[0:18:31] Voice 2: All in favor?

[0:18:33] Voice 2: Saturna, I'm gonna move that Saturna

[0:18:35] Voice 2: and Local Trust Committee proposed by-law number 134,

[0:18:37] Voice 2: said it is Saturna Island land use by-law number 119, 2018,

[0:18:41] Voice 2: Amendment number one, 2021, as amended,

[0:18:45] Voice 2: be read a third time.

[0:18:48] Voice 5: Second that.

[0:18:50] Voice 5: Call the question, in favor?

[0:18:54] Voice 1: Move that the Secretary of the Island Local Trust Committee

[0:18:56] Voice 1: proposed bylaws number 133 and 134

[0:18:59] Voice 1: be forwarded to the Secretary of the Islands Trust,

[0:19:03] Voice 1: 133 and 134, as amended, I guess I should say,

[0:19:06] Voice 1: be forwarded to the Secretary of the Islands Trust

[0:19:08] Voice 1: for executive committee approval.

[0:19:11] Voice 1: I'll second that, and I'll call the question,

[0:19:13] Voice 1: all in favor?

[0:19:13] Voice 1: All in favor? Passes.

[0:19:16] Voice 2: And that the Citerno Island Local Trust Committee proposed bylaw number 133 is amended to be forwarded to the Minister of Municipal Affairs for approval.

[0:19:25] Voice 2: Second.

[0:19:27] Voice 2: All in favor?

[0:19:29] Voice 2: In favor.

[0:19:29] Voice 2: Great. Super. Thank you very much, Brad.

[0:19:32] Voice 2: Yes, thank you.

[0:19:33] Voice 2: Done and dusted. So you can see why it's very important that trustees know how to lead and speak.

[0:19:39] Voice 2: That's one of our biggest roles.

[0:19:44] Voice 2: minutes so we have some minutes for adoption and changes then

[0:19:50] Voice 1: that's new uh we i think did we not

[0:19:53] Voice 1: adopt these already i guess not i don't think so so let's

[0:19:57] Voice 2: just adopt them by consent because

[0:19:58] Voice 2: i'm fine with it sure no section 26 uh rwms so follow-up action list dated july 2022

[0:20:07] Voice 2: and two on pages and a lot of that is completed we have our two aligning the First Nations

[0:20:21] Voice 2: not First Nations sorry the whale watching yes

[0:20:27] Voice 1: we'll have resolutions so we should we'll fix

[0:20:29] Voice 1: those before the end of the term so we'll come up with something for the October meeting that

[0:20:35] Voice 1: that would be useful, and we'll actually conclude that then.

[0:20:38] Voice 1: So,

[0:20:39] Voice 2: okay, and we also have the report

[0:20:42] Voice 2: about the GW Solutions Water Report

[0:20:45] Voice 2: and the answering of those specific questions.

[0:20:47] Voice 2: It's in play, and yeah,

[0:20:52] Voice 2: everything else is looking very, very good.

[0:20:56] Voice 3: It's not posted, and we'll see.

[0:20:58] Voice 3: I will still, for October 20th,

[0:20:59] Voice 3: hear your discussion with the people.

[0:21:03] Voice 1: I had a discussion with the people, right, okay.

[0:21:11] Voice 5: okay right on

[0:21:18] Voice 2: to delegations there's clearly no delegations today uh correspondence the

[0:21:24] Voice 2: only piece of correspondence we got related to the public hearing so that's fine applications

[0:21:31] Voice 2: and referrals for information do we want to just briefly talk about the potential application

[0:21:37] Voice 2: coming up i think we should in the public meeting and that's in respect of a a rezoning of some 77

[0:21:45] Voice 2: seven acres and uh pay density transfer that's associated with that uh so the application is

[0:21:55] Voice 2: going to be made shortly yes

[0:21:58] Voice 1: because that's in the top priorities i want to reference that so

[0:22:03] Voice 1: um so

[0:22:05] Voice 5: that's not in the current list of course um so is there anything you want to just say about

[0:22:14] Voice 2: that um i just think that we have covered off as we're looking nature trust of british

[0:22:21] Voice 2: columbia is looking to to purchase some some land on the island and as a condition of that

[0:22:30] Voice 2: in order to get some additional funding to make this thing close there would be a density transfer

[0:22:39] Voice 2: to another party of 10 or 11 densities,

[0:22:44] Voice 2: other parties, I should say plural,

[0:22:47] Voice 2: with the remaining densities,

[0:22:49] Voice 2: which might be four or five going into our community

[0:22:51] Voice 2: amenity density reserve.

[0:22:53] Voice 2: And we'll just have to wait for that application.

[0:22:56] Voice 2: We've seen a very similar thing like that before progress,

[0:23:00] Voice 2: but it unfortunately never came to completion

[0:23:03] Voice 2: because the parties couldn't agree on stuff.

[0:23:05] Voice 2: stuff so how many densities did you say there are 10 going to one person there may be another one

[0:23:15] Voice 2: going to another person and then the remainder would be four or five okay four or five to go

[0:23:21] Voice 2: to the community amenity density reserve and this seems to be something that everyone

[0:23:27] Voice 2: at least amongst the parties is in favor of and will help complete the purchase of land and i

[0:23:35] Voice 2: think you know it's it's a good purchase and that it will expand the breadth and scope of our park

[0:23:45] Voice 2: land so onward to work programs report so we have our top priorities list on page 24 and 25 or 25

[0:23:58] Voice 2: anyway that i can see and it's to consider a number of minor mms the ocp so that's pretty

[0:24:05] Voice 2: much should be done when the minister signs off on it and

[0:24:12] Voice 5: so is

[0:24:14] Voice 2: everyone just make note of the fact

[0:24:16] Voice 2: that this

[0:24:17] Voice 1: application becomes a yes well we'll take the baby brad's guidance so basically we're

[0:24:22] Voice 1: not going to i guess add any further work for the remainder of the term in terms of any kind

[0:24:31] Voice 1: of projects or my normal major and so i just uh was wondering if it would be helpful if we

[0:24:39] Voice 1: referenced that any available snap time that might normally be devoted to fulfilling the top

[0:24:45] Voice 1: priorities be diverted to processing what we expect to be a couple of the zoning transfer

[0:24:57] Voice 1: and or transfer of densities through the catter or not through the catter I guess it would be

[0:25:03] Voice 1: well i think it is technically through the counter but um would that be helpful i think

[0:25:10] Voice 3: if there are applications then they shouldn't show up in your projects let's see if they were being

[0:25:16] Voice 3: sponsored by the local trust committee moving that forward then i think we would but i think staff

[0:25:23] Voice 3: will just well we don't have applications in progress now but when they are submitted we will

[0:25:29] Voice 3: begin to move forward just as expeditiously as possible

[0:25:34] Voice 1: expeditiously I love that word

[0:25:36] Voice 1: is there any benefit to the local trust committee it's obviously the applications have to be

[0:25:42] Voice 1: forced to be sponsored but we we could stay in terms of facilitating the purchase of

[0:25:48] Voice 1: of on island property because there's that other one that we talked about as well that looks like

[0:25:54] Voice 1: in play to support the Nature Trust in BC in acquiring land holdings.

[0:26:02] Voice 1: R

[0:26:03] Voice 3: .P.M. Kachima's view was that they should be submitted as applications.

[0:26:06] Voice 3: Okay.

[0:26:07] Voice 3: And if you were seeking to, well, we're

[0:26:11] Voice 1: talking about two different things here.

[0:26:12] Voice 3: I understand there's the Mr. Illio's property.

[0:26:20] Voice 3: Right.

[0:26:32] Voice 2: So

[0:26:33] Voice 3: that would

[0:26:36] Voice 2: be the priority one.

[0:26:37] Voice 2: The

[0:26:37] Voice 3: other one is the

[0:26:39] Voice 2: buyer's property.

[0:26:40] Voice 2: That's a lower priority.

[0:26:42] Voice 3: And I would say that that is truly application driven and the benefit is

[0:26:46] Voice 3: it's primarily to the applicant

[0:26:48] Voice 3: versus if you're looking to have some kind of

[0:26:52] Voice 3: fee sponsorship of the other one

[0:26:56] Voice 3: and that would be most exactly approval.

[0:27:00] Voice 3: I think maybe yes,

[0:27:01] Voice 3: Kajima's perspective was that they should both be

[0:27:07] Voice 3: for the nature trust,

[0:27:08] Voice 3: the one should still come to us as an application,

[0:27:10] Voice 3: not LTC driven as a project.

[0:27:13] Voice 3: Okay.

[0:27:13] Voice 2: Well, I guess the minutes could reflect the chair's remark that we believe that the nature trust with the applications relating to the transfer of land to nature trust are of high importance to this to sit around and just leave it at that.

[0:27:29] Voice 2: is that okay yes yeah good okay so we have a projects list that hasn't changed

[0:27:38] Voice 2: and uh it's fine by me is it fine by you it's shoreline review which probably isn't it's going

[0:27:45] Voice 2: nowhere it's uh well we haven't

[0:27:48] Voice 1: done anything with it so um shall we just remove it i guess

[0:27:54] Voice 1: we may as well because we didn't we didn't really test well i guess it was centered around the whole

[0:27:58] Voice 1: issue of hydrophones and shoreline structures when there was a solar panel issue and so I think we

[0:28:07] Voice 1: kind of dealt with it through the official community plan interpretation. Are you going to remove it?

[0:28:12] Voice 1: Yes I'll move that we remove shoreline review from the project's report. Great. I'll second that.

[0:28:24] Voice 1: Yes, I'll say so. We remove that move that shoreline review be removed. So turn LTC projects report.

[0:28:35] Voice 2: All the question

[0:28:37] Voice 5: all in favor.

[0:28:39] Voice 2: I'd be all of us.

[0:28:40] Voice 2: So we have an applications report, I guess it's just for information I haven't seen much change.

[0:28:50] Voice 5: Well, I guess we have the application for an 11 lot subdivision that's come in.

[0:28:55] Voice 5: That's good.

[0:28:59] Voice 5: Is O&H still working

[0:29:02] Voice 2: with Moti at the moment?

[0:29:05] Voice 2: They've changed so many people.

[0:29:07] Voice 2: I think O&H is still there.

[0:29:09] Voice 2: Okay.

[0:29:09] Voice 2: Good.

[0:29:10] Voice 2: Okay.

[0:29:11] Voice 2: We have our LTC expense summary, and there we go.

[0:29:18] Voice 5: We spent nothing.

[0:29:21] Voice 5: so that's good we're very thrifty here we have standing

[0:29:26] Voice 2: resolutions they're all good

[0:29:29] Voice 2: for information no changes we have a web page that i know you've been working on very very diligently

[0:29:39] Voice 2: um that's correct right well thank you very much on behalf of all our wonders you're welcome we

[0:29:45] Voice 2: have a conservancy report for

[0:29:47] Voice 5: information there's no new business there's upcoming

[0:29:55] Voice 2: meetings and i'm

[0:29:56] Voice 2: I'm going to ask.

[0:30:00] Voice 2: our planner should we be setting a meeting sometime between now and say october 15th

[0:30:09] Voice 2: to address the applications so as to move them along at least the one application

[0:30:19] Voice 3: until the application is actually submitted

[0:30:22] Voice 3: before it's difficult for me to speak to it okay so let's really ultimately with the applicants

[0:30:28] Voice 3: at this point together well i'm

[0:30:32] Voice 2: going to suggest that we have a we schedule a meeting

[0:30:35] Voice 2: or further on uh before october 15th what's your time you look like good

[0:30:43] Voice 1: in september

[0:30:44] Voice 1: just to wait in august a little bit so um you too

[0:30:47] Voice 3: okay okay

[0:30:51] Voice 2: this october do you have an open

[0:30:54] Voice 2: spot in october that you would prefer are

[0:30:56] Voice 3: you talking about to receive a report on the application

[0:31:00] Voice 2: yeah or anything to move it along so i

[0:31:03] Voice 3: understand that you want to move along but it's also

[0:31:06] Voice 3: yeah i do

[0:31:12] Voice 2: realize that rpm kojima recommended we set a meeting so i'd like to set a meeting and i

[0:31:18] Voice 2: want to make sure that it's

[0:31:20] Voice 3: the fourth week of September. Okay,

[0:31:26] Voice 5: so fourth week of September would

[0:31:31] Voice 5: be

[0:31:42] Voice 5: Yeah, we can do that. I don't think

[0:31:51] Voice 3: there would be a lot on that agenda.

[0:31:59] Voice 3: around summarizing the groundwater work today and CIM on the fees by law, which I know people take

[0:32:07] Voice 3: a lot of the time. Do

[0:32:09] Voice 3: you

[0:32:11] Voice 2: have a date you prefer?

[0:32:13] Voice 5: For me? Yeah.

[0:32:24] Voice 2: 29th

[0:32:24] Voice 1: works. So if something, so if staff report would be presented on the presumed applications,

[0:32:31] Voice 1: applications, what is the next step that the local trust committee would do, presuming

[0:32:38] Voice 1: you would make a certain recommendation on the staff report to either proceed or not

[0:32:42] Voice 3: proceed?

[0:32:44] Voice 3: Would

[0:32:45] Voice 1: there need to be an additional follow-up or involvement by the LTC?

[0:32:50] Voice 1: I know we're talking theoretically on this application so far, but if we directed you

[0:32:56] Voice 1: to then proceed as to some other step that the LTC needs to do?

[0:32:59] Voice 1: We

[0:33:00] Voice 3: would proceed with drafting by-laws, staff would then draft by-laws and any by-laws.

[0:33:07] Voice 3: Separating the two applications, of course, so there would be separate reports.

[0:33:14] Voice 3: We would be seeking LTC's direction to draft by-laws and then those by-laws would come back to the LTC presumably at the next meeting.

[0:33:23] Voice 3: uh and then we go through uh referrals agency referrals so you would definitely

[0:33:34] Voice 3: be into the

[0:33:35] Voice 3: next term of these applications proceeding there's a number of steps involved with the

[0:33:43] Voice 3: first nation referrals and agency referrals with those bylaws would there

[0:33:50] Voice 1: be any benefit to keeping

[0:33:51] Voice 1: in the october meeting just to basically initiate the referral process which would then

[0:33:57] Voice 1: continue

[0:33:58] Voice 2: in october so

[0:34:00] Voice 3: i

[0:34:01] Voice 2: think the 22nd something tells me that the trust council

[0:34:06] Voice 3: is

[0:34:07] Voice 2: on the 22nd

[0:34:08] Voice 1: september yeah so we agreed then that we keep the for the time being we keep the

[0:34:14] Voice 2: We

[0:34:15] Voice 1: need

[0:34:16] Voice 2: to give time for Brad to do his report with the 29th to the, okay, so let's schedule it for the 29th of September.

[0:34:27] Voice 2: Are

[0:34:27] Voice 5: you good for the 29th of September?

[0:34:32] Voice 5: Yes.

[0:34:35] Voice 5: Good.

[0:34:36] Voice 5: So

[0:34:36] Voice 2: I am moved that the Saturna Highland Local Trust Committee schedule this next meeting for September

[0:34:43] Voice 5: 29th.

[0:34:45] Voice 5: I second that.

[0:34:49] Voice 5: All in question?

[0:34:51] Voice 5: All in favor?

[0:34:52] Voice 1: Good.

[0:34:52] Voice 1: And that's, I think we wouldn't normally try to put

[0:34:57] Voice 1: you in the buying brand about the speed

[0:34:59] Voice 1: with which you have to turn things around.

[0:35:00] Voice 1: But our understanding is that some of the wording

[0:35:03] Voice 1: of the shelf currently shelf bylaws can be utilized

[0:35:08] Voice 1: in this against your ethical application.

[0:35:13] Voice 3: Yeah.

[0:35:13] Voice 3: So it's difficult.

[0:35:17] Voice 3: Okay, perfect.

[0:35:21] Voice 1: Fair enough.

[0:35:22] Voice 1: when

[0:35:22] Voice 3: i don't see the fire let's make all that complicated okay okay yeah

[0:35:28] Voice 1: very good thank you

[0:35:29] Voice 1: yeah

[0:35:30] Voice 2: good okay we're back to the town hall for

[0:35:32] Voice 5: anybody that wants to speak okay there is no

[0:35:39] Voice 5: closed meeting i'm gonna ask

[0:35:41] Voice 2: that you make a motion to adjourn i move that we adjourn this

[0:35:45] Voice 2: meeting and i'll second that thank

[0:35:48] Voice 1: you very much staff for all of your work

[0:35:51] Voice 3: yes

[0:35:52] Voice 1: thank you for

[0:35:53] Voice 1: coming um and thank you members of the public for sitting

[0:35:59] Voice 2: here and listening to this

[0:36:00] Voice 2: did

[0:36:02] Voice 1: we vote so

[0:36:08] Voice 3: just to clarify

[0:36:10] Voice 3: the members hello mr first yes to see it um are you the gentleman with the property on

[0:36:21] Voice 3: on the other property that you're looking to resume into the college

[0:36:25] Voice 3: do you want to discuss

[0:36:26] Voice 3: that meeting or do you want to discuss that application uh in your meeting um i think not

[0:36:35] Voice 1: i think we wanted to end the meeting and then have opportunity to discuss for them to each

[0:36:39] Voice 1: party to discuss with you your guidance or to seek your guidance on how best to proceed with trustees

[0:36:48] Voice 1: um do you do you care does it make any difference if we're present doesn't that create some

[0:36:54] Voice 1: potential

[0:36:55] Voice 3: okay

[0:36:56] Voice 1: fair enough

[0:36:57] Voice 3: meeting with yourselves and me and talking about your business

[0:37:04] Voice 3: so what have

[0:37:05] Voice 3: you got a conversation but

[0:37:07] Voice 1: i think we all know what it is so yeah we both

[0:37:13] Voice 1: In the case of Mesotech, there's a technical issue that I'm not fully conversing in that

[0:37:18] Voice 1: I think you need to take your guidance on.

[0:37:20] Voice 3: So the issue there is that the bylaw states a minimum subdivision size to get that additional

[0:37:30] Voice 3: density, which would be a separate density.

[0:37:36] Voice 3: And so, you cannot vary, you can't take a variance from, for example, to for density.

[0:37:44] Voice 3: So then we would need to zone that property to create either the current zoning,

[0:37:53] Voice 3: but with a minimum size that's smaller than what's allowed for all the other properties, or some new zone.

[0:38:01] Voice 1: is there i think where we had the discussion earlier this is much earlier was that

[0:38:09] Voice 1: if if one if there was a subdivision creating two separate lots if there was an additional density

[0:38:15] Voice 1: purchased using the current mechanisms that we have that that would not trigger or require

[0:38:20] Voice 1: and zoning. Is that true or is that not right?

[0:38:24] Voice 3: I would have to talk to our BNPJ about how your density bank works.

[0:38:29] Voice 3: So, yeah.

[0:38:31] Voice 1: Yeah, it basically, it's never, it's been used as a conduit, as a pipeline,

[0:38:37] Voice 1: where one party purchases a density and it moves.

[0:38:41] Voice 1: But because we have the density cap, density cannot be created, of course.

[0:38:49] Voice 3: it's still enough with a lot of size that's smaller than the animal blood size and you buy

[0:38:54] Voice 3: them to simplify okay that's

[0:38:57] Voice 3: the problem and

[0:38:58] Voice 1: so I guess that would be the purpose of it I suppose

[0:39:01] Voice 1: that the meeting is that you yourself Mr. Tejeda and our planner can discuss what an option

[0:39:08] Voice 1: may be to move forward with that which I think as you point out with the conversation between

[0:39:14] Voice 1: between yourself and the potential applicant.

[0:39:17] Voice 3: What was your address, sir?

[0:39:19] Voice 3: Well, I think this is still .

[0:39:23] Voice 3: What's your address, sir?

[0:39:25] Voice 3: Just to.

[0:39:26] Voice 1: Just me and Mr. Tejada, I was asking for your street address.

[0:39:31] Voice 1: Sorry.

[0:39:32] Voice 5: Well, this is street address.

[0:39:33] Voice 5: The street address is 111.

[0:39:37] Voice 5: It is a location that was originally designated as 101

[0:39:41] Voice 3: one thing um and uh are part of that partial as we designated as

[0:39:51] Voice 5: 100.

[0:40:13] Voice 3: they're technically not supposed to have that conversation outside

[0:40:20] Voice 1: this is

[0:40:21] Voice 3: why it's good to appreciate

[0:40:22] Voice 1: you all coming so we can kind of do this um in this

[0:40:26] Voice 1: setting so that's good so you you happen to be first order of business just by the roll of the

[0:40:32] Voice 1: dice i think yeah no by all means sit right up front if you wish there's no problem

[0:40:44] Voice 3: yeah you

[0:40:45] Voice 1: know i think if there's a

[0:40:46] Voice 1: dead city i don't have it there's no issue

[0:40:48] Voice 1: No, it's the issue is, is the law big enough to receive the additional

[0:40:55] Voice 3: zoning, the minimum lot size is no subdivision plan may be improved less loss graded by the

[0:41:03] Voice 3: subdivision average 2.02.

[0:41:06] Voice 3: Yeah, that's the same game.

[0:41:09] Voice 3: We need to create a site specific regulation, which I would understand what sort of zoning

[0:41:13] Voice 3: to allow for a lot of size that would allow the creation of two lots that don't average that

[0:41:22] Voice 3: and that

[0:41:24] Voice 1: violates the ocp and says that we're creating a density so therefore we would need

[0:41:29] Voice 1: to import the density as well as rezone the two logs is that right

[0:41:33] Voice 3: yeah preliminary understanding

[0:41:35] Voice 3: but i'm going to go to off the door to better understand so i don't want to make it simple

[0:41:41] Voice 3: simple if it, like I don't, I wouldn't want to suggest that rezoning isn't required

[0:41:47] Voice 3: though understanding from our fan Kojima, how the linkages work with like provisions

[0:41:54] Voice 3: in particular around not allowing a variance around density. And so I would need to

[0:42:06] Voice 3: understand how that would fit in and if you are amending this bylaw in any way then you need to

[0:42:11] Voice 3: have a resulting application yeah because

[0:42:14] Voice 1: i think if i'm going to comment correctly with the parents

[0:42:16] Voice 1: application which is the most recent instance where in fact densities were purchased i think

[0:42:21] Voice 1: it was two do you recall they purchased two densities and a lot size was 9.8 and their

[0:42:28] Voice 1: And their minimum lot size was not sufficient to accommodate the subdivision into three

[0:42:36] Voice 1: lots.

[0:42:37] Voice 1: But what seemed to, and I don't believe there was a rezoning there, but Robert can of course

[0:42:42] Voice 1: speak to this because he'd be familiar with that case because it went on for

[0:42:45] Voice 3: quite a while.

[0:42:45] Voice 3: I don't want to make it simpler than it is, if there is a rezoning application and if

[0:42:52] Voice 3: If you

[0:42:52] Voice 3: require, I wouldn't want to indicate the thickness of this.

[0:42:56] Voice 3: I don't want to really clarify that.

[0:42:58] Voice 3: The first step

[0:42:59] Voice 3: is to have the application.

[0:43:00] Voice 1: Now, what would the application be for?

[0:43:03] Voice 1: Would it be for simply a subdivision?

[0:43:07] Voice 3: I think they would need to apply for rezoning.

[0:43:10] Voice 3: Rezoning, okay.

[0:43:11] Voice 1: You'll check with Robert, though, right?

[0:43:12] Voice 1: First, it does seem that way.

[0:43:14] Voice 1: Yes.

[0:43:14] Voice 1: So would it be possible that I can connect you both,

[0:43:18] Voice 1: such that you're able to have this conversation,

[0:43:20] Voice 1: perhaps once you followed up with Robert.

[0:43:22] Voice 1: And

[0:43:23] Voice 3: we have had an initial conversation.

[0:43:25] Voice 3: We've had a good conversation.

[0:43:26] Voice 3: I'm still puzzling around the idea.

[0:43:29] Voice 3: One of the is that we're not

[0:43:36] Voice 3: seeking to do anything different with the land,

[0:43:41] Voice 3: with either side.

[0:43:43] Voice 3: The land is divided by a pane of road.

[0:43:46] Voice 3: we we occupy and we treat our side of the property

[0:43:53] Voice 5: uh separate from

[0:43:57] Voice 5: the other side of the

[0:43:58] Voice 3: property which currently is occupied and has been developed by our land

[0:44:06] Voice 3: partners for the four all four acres um we don't we're not seeking to do anything more with it we

[0:44:15] Voice 3: don't intend to what is done

[0:44:17] Voice 5: now is in part of the

[0:44:19] Voice 5: existing provisions we're in a situation where

[0:44:30] Voice 3: both sides see the need to anticipate maybe not being here for as long as we hoped to be here

[0:44:40] Voice 3: and yet we're caught in a situation where quite frankly if the need arose there's no way that we

[0:44:49] Voice 3: we could, on either side, deal with the property in some way.

[0:44:58] Voice 3: So we just don't understand why we would be seeking density

[0:45:04] Voice 3: when we wouldn't be endeavoring to add to the density.

[0:45:10] Voice 3: The challenge is that by seeking

[0:45:13] Voice 2: subdivision,

[0:45:15] Voice 3: so right now, you're right, your property is the house of the product,

[0:45:19] Voice 3: so it's all legal in respect of the zoning.

[0:45:21] Voice 3: But when you separate them into two lots, then your minimum

[0:45:27] Voice 3: lot size for doing that subdivision in the by-lot is 2.02 hectares of an average lot.

[0:45:36] Voice 3: So each lot you create needs to be an average of five acres, but your property is only 4.17 acres in total.

[0:45:44] Voice 3: So you might be left with a parcel that's, like I see on the map, one smaller than the other one.

[0:45:51] Voice 3: So you may

[0:45:52] Voice 3: be left with one that's 1.8 acres and

[0:45:56] Voice 1: the other one that's

[0:45:57] Voice 3: 2.4 acres.

[0:45:59] Voice 1: And those are

[0:46:00] Voice 3: far smaller than what the by-law currently allowed.

[0:46:04] Voice 3: And so

[0:46:05] Voice 1: the bylaws are very clear that

[0:46:08] Voice 3: so to be allowed to create those parcels that are

[0:46:16] Voice 3: smaller than what the bylaw says, you have to either seek different zoning to find a

[0:46:22] Voice 3: zone that would allow your average lot size, or you need to amend the bylaws to allow your

[0:46:29] Voice 3: lots to have a smaller average than others.

[0:46:32] Voice 3: there are a couple of site-specific laws that have done that, but to do that you need to apply

[0:46:37] Voice 3: through the rezoning process to amend the bylaw. That's what

[0:46:41] Voice 3: the rezoning, that's what the process

[0:46:44] Voice 3: does. It allows you to amend the bylaw. So and

[0:46:50] Voice 1: I think if the one question that I know you'll

[0:46:53] Voice 1: see clarity from is it's my understanding is because the bylaw restricts lot size because

[0:46:59] Voice 1: because creation of a lot is creating a dense basic place for a new family to live, and it's a cat, such that the densities are counted for by the remaining law sizes that we have which can be divided into five acres.

[0:47:14] Voice 1: So this would be creation of a new family's home, quote unquote, I know it's not in actuality in actuality there's a house already there, but that's the way the Bible sees it is you can therefore create a density.

[0:47:26] Voice 1: However, it may be possible, and again, as Brad has said, this requires interpretation

[0:47:34] Voice 1: from the regional planning manager, it may be possible to acquire a density to satisfy

[0:47:40] Voice 1: the dictates of the official community plan and have a subdivision, therefore, of smaller

[0:47:46] Voice 1: lot sizes.

[0:47:47] Voice 3: We still need to amend the by-law to allow for a minimum lot size.

[0:47:52] Voice 1: We'd have a site

[0:47:52] Voice 3: -specific by-law.

[0:47:55] Voice 3: I think maybe what was happening would need to be paid for through that that's that's

[0:48:02] Voice 3: does that make more sense well I'm trying to get it yeah

[0:48:07] Voice 5: so you

[0:48:08] Voice 3: right now you have one

[0:48:09] Voice 3: lot on the other side and you have two densities because each dwelling the cottage is considered

[0:48:14] Voice 3: each discount as a dwelling so

[0:48:16] Voice 1: if you've separated

[0:48:17] Voice 3: those then technically you could build a house

[0:48:21] Voice 3: and cottage on one and a house and cottage on the other because you don't you have one house

[0:48:26] Voice 3: and one cottage right right now if you if you subdivide the laws and then you have the house

[0:48:33] Voice 3: on one you would be able to build another cottage here in accordance with the rural general by law

[0:48:39] Voice 3: so uh and on the other one it would be the same thing you could build a dwelling of any size

[0:48:46] Voice 3: and so right now you have two densities on the property the house and the cottage are

[0:48:51] Voice 3: re-counted what is that process from the cost uh that's well the the fee is forty five hundred

[0:49:00] Voice 1: dollars i think six hundred

[0:49:02] Voice 3: dollars somewhere in there yeah that's

[0:49:05] Voice 1: the rezoning is it not right

[0:49:06] Voice 3: and then the density

[0:49:08] Voice 1: is a market based

[0:49:11] Voice 1: So I would suggest before making such applications to seek clarity through our planner and the

[0:49:19] Voice 1: regional planning manager about what would be the preferred way forward rather than speculatively

[0:49:24] Voice 1: spending the money on the rezoning.

[0:49:27] Voice 3: Yeah, or we can at least help you to shape what you're seeking to apply for.

[0:49:31] Voice 3: Right.

[0:49:32] Voice 3: And also you would need to separately seek subdivision approval through the

[0:49:38] Voice 3: ministry of transportation so there would be one process to work with the trust around the density

[0:49:45] Voice 3: and the minimum lot size that uh it's contrary to what you want to create and you would also

[0:49:52] Voice 5: need to apply to the

[0:49:54] Voice 3: ministry of transportation

[0:49:55] Voice 5: to improve the actual

[0:49:56] Voice 3: subject this

[0:50:03] Voice 5: is what it is

[0:50:06] Voice 3: right

[0:50:07] Voice 1: yeah so would it be possible for you to have that conversation with um with mr kojima

[0:50:17] Voice 1: okay that's great and so then would you then get back to me or paul would you get back to

[0:50:23] Voice 1: Mr. I

[0:50:23] Voice 3: need to clarify what you would need to apply for and what that process would look like

[0:50:35] Voice 3: for you to achieve what we want. We're always getting back to the point of whereby if we were

[0:50:42] Voice 3: required to purchase

[0:50:44] Voice 5: density and spend the money for that

[0:50:48] Voice 3: that even if the property we would put

[0:50:51] Voice 3: the property on the market we could not recover the cost of that density from the sale of our

[0:50:59] Voice 3: property just current conditions wouldn't permit it neither would the nature of the land

[0:51:05] Voice 3: the

[0:51:05] Voice 4: key

[0:51:06] Voice 3: point is that if you're creating two lots you're going to get up value from the creation of

[0:51:13] Voice 3: the new law well you're missing

[0:51:16] Voice 3: something too daniel the other portion is the house that you

[0:51:21] Voice 3: have that is under the 900 square under the thousand square feet once that lot is created

[0:51:26] Voice 3: separately that lot the house

[0:51:28] Voice 1: can be any size

[0:51:29] Voice 3: that's the cottage size which is well it won't

[0:51:32] Voice 3: be a cottage anymore it'll be a house and then you can build a

[0:51:36] Voice 4: bigger house and it will become

[0:51:38] Voice 4: the accessory and that's why

[0:51:39] Voice 3: you need one density because you're creating

[0:51:41] Voice 3: one extra lot of you're creating two lots out of one it's easier to die

[0:51:55] Voice 3: i'm joking but i'm not joking it is easier to die well

[0:52:00] Voice 1: it's a succession issue and we're certainly

[0:52:03] Voice 1: as a local trust committee we've shown ourselves to be certainly sympathetic to that issue

[0:52:08] Voice 1: but i think it sounds perhaps more complicated than it may in fact prove to be and i think

[0:52:13] Voice 1: you're in good hands with our planner who will talk with somebody well experienced in our

[0:52:18] Voice 1: official community plan and give you a path forward now whether that path is palatable or

[0:52:23] Voice 1: not i can't speak to but you will learn in

[0:52:26] Voice 5: very short order what that would be thank you yeah so

[0:52:35] Voice 5: So

[0:52:36] Voice 1: did you want to speak to the potential,

[0:52:40] Voice 1: or we can still do some of the theoretical,

[0:52:43] Voice 1: but highly likely application from?

[0:52:47] Voice 1: I

[0:52:47] Voice 3: think it would be helpful to have a brief conversation

[0:52:49] Voice 3: so that I understand where it is at now.

[0:52:52] Voice 1: Okay.

[0:52:53] Voice 1: Would you care to give an update as to the status of?

[0:52:58] Voice 3: Yeah, we're about to make a application for a refund.

[0:53:03] Voice 3: problem. And I learned you're very likely a little better than

[0:53:10] Voice 3: I am the process we went through earlier. Yes, Mr. Hall.

[0:53:14] Voice 4: Yeah, that's right.

[0:53:15] Voice 3: No. But don't mind the excitement.

[0:53:18] Voice 3: That's

[0:53:18] Voice 4: for this layout. Just right here.

[0:53:20] Voice 4: It starts right there. Yeah. Yeah.

[0:53:24] Voice 3: And that was another

[0:53:26] Voice 3: mission. Yeah. Put it up to 1.29. Yeah. Anyway, what

[0:53:33] Voice 3: What I'd like to do is make an application.

[0:53:35] Voice 3: Can I use the, there's a whole series of covenants

[0:53:39] Voice 3: and some don't mean a damn thing.

[0:53:42] Voice 3: There's two for hydro that do mean something

[0:53:44] Voice 3: for the hydro wires going through here

[0:53:46] Voice 3: and an anchor they have on here.

[0:53:49] Voice 3: Other side, can I use those covenants again

[0:53:51] Voice 3: in the next application?

[0:53:52] Voice 3: Can I use the information from the original application

[0:53:54] Voice 3: for us to overchange the-

[0:53:57] Voice 3: Yeah, I would suggest you try to cut and paste

[0:54:02] Voice 3: as much as you can if you've already documented a whole bunch of that stuff whatever

[0:54:06] Voice 1: is still

[0:54:07] Voice 1: relevant

[0:54:07] Voice 3: it's still yeah it's relevant and it's also very straightforward yeah

[0:54:15] Voice 3: yeah so i

[0:54:16] Voice 3: would think that yeah whatever way you need to cut them based on a matter from

[0:54:20] Voice 3: your previous application it

[0:54:22] Voice 1: will be a new application i

[0:54:23] Voice 3: certainly wouldn't uh

[0:54:26] Voice 3: undertake a whole bunch of extra work if a bunch of information is already there

[0:54:30] Voice 3: and this makes it a shortcut for us so that would be quite useful yeah all

[0:54:39] Voice 4: right and then you would

[0:54:40] Voice 4: be taking

[0:54:40] Voice 3: uh densities from ilio's property and purchasing them to get your lot configuration

[0:54:48] Voice 3: that you're seeking before maybe not as many lots because i think you're a tenner well i didn't like

[0:54:54] Voice 3: the number of lots that was their original application that was one of them

[0:54:57] Voice 3: this is right and

[0:54:59] Voice 3: the other owner really wanted you to take more densities than we were watching

[0:55:03] Voice 3: yeah that's quite a lot satisfied with what we're looking at right now

[0:55:08] Voice 3: and then the leave some

[0:55:11] Voice 3: flexibility for lot size you know that also leaves abilities to

[0:55:16] Voice 3: being particles that are common and then ilio's parcel he is seeking to subdivide this his house

[0:55:24] Voice 3: portion off and hide it onto his other lot and then sell the reps is that correct yeah that's

[0:55:31] Voice 1: my understanding of it i believe he has been now informed of the section uh 99 i think that you

[0:55:36] Voice 1: informed me about yes in terms of the subdivision and so he's i don't think his zoning in any way

[0:55:44] Voice 1: changes does it that's not his application he's simply making a subdivision application and then

[0:55:49] Voice 1: stripping the densities off it by by selling the densities i think that doesn't have to tell you

[0:55:56] Voice 1: what he has to do which is so your your application um is is basically one to acquire the densities

[0:56:05] Voice 1: and then rezone that property into rural i guess generally would be right for us and so you would

[0:56:12] Voice 3: be your partner in the rezoning would be the nature trust is that correct no i'm not mr

[0:56:18] Voice 3: i think

[0:56:20] Voice 1: you know this part i'm not sure because i i don't know if he's

[0:56:25] Voice 3: so he so he's going to do a subdivision get his house and then that's all he has

[0:56:32] Voice 3: and then he would be so the the co-op that can take it in in the sense that

[0:56:37] Voice 3: be the nature trust organization yeah then

[0:56:40] Voice 1: you can purchase it and

[0:56:42] Voice 3: they've been seeking

[0:56:43] Voice 3: yeah i think so that would do yeah so that's the moral

[0:56:50] Voice 3: we're surrounded pretty much by parks now and it's working that way and they depart

[0:56:57] Voice 3: after this uh appropriation by the native trust will probably have to turn over 50

[0:57:04] Voice 3: you so

[0:57:04] Voice 1: i think my understanding differed a little bit from about my understanding was that mr

[0:57:12] Voice 1: bernalami needed to take the funds that you provided in purchasing the densities in order

[0:57:18] Voice 1: to meet the purchase price expectation of his land partners to allow the nature trust to actually

[0:57:25] Voice 1: So

[0:57:25] Voice 3: there's three of you, right?

[0:57:28] Voice 3: Yeah, there are four of them.

[0:57:31] Voice 3: Right, but there's the Nature

[0:57:36] Voice 3: Trust, there's ILEO, and

[0:57:38] Voice 3: there's ILEO's group, and there's...

[0:57:41] Voice 3: So it's a three-way...

[0:57:44] Voice 3: So it's

[0:57:45] Voice 5: funny how complicated that is.

[0:57:48] Voice 3: It's pretty complicated.

[0:57:50] Voice 3: But I think with, I see yours more straightforward in that there's, we'll need to figure out

[0:58:00] Voice 3: all these densities transfer and all these different pieces.

[0:58:03] Voice 5: There'll be a bunch of things to work on.

[0:58:05] Voice 5: Yeah, there's a bunch of

[0:58:05] Voice 1: things to work on because

[0:58:06] Voice 3: the excess is going to go through

[0:58:09] Voice 3: the trusses into the land bank and that'd be a trip.

[0:58:12] Voice 3: Yeah,

[0:58:13] Voice 1: so all of that we'll

[0:58:14] Voice 3: need to figure out.

[0:58:15] Voice 1: But ultimately,

[0:58:16] Voice 3: I think the first step, again, is to have the

[0:58:18] Voice 3: and

[0:58:19] Voice 1: then we can start those conversations.

[0:58:21] Voice 1: You have to

[0:58:22] Voice 3: make it repeat.

[0:58:23] Voice 3: That's where

[0:58:24] Voice 1: we can start.

[0:58:27] Voice 1: Because I think it could be very simple because I don't think

[0:58:31] Voice 1: that they would be involved with nature trust.

[0:58:33] Voice 1: That would be because anyone now has the right under the OCP

[0:58:37] Voice 1: to sell densities using the pipeline mechanism

[0:58:40] Voice 1: regardless of what you're going to do with the land down the road.

[0:58:44] Voice 1: but mr money a famous example is the interior of eastwall you know all those densities transferred

[0:58:51] Voice 1: but the zoning didn't change the zoning doesn't need to change you just could never build it

[0:58:55] Voice 1: because you don't have the density and so i guess it would be the simplest that's possible that you

[0:59:00] Voice 1: would deal with helio to purchase the densities what he then does in terms of selling that land

[0:59:07] Voice 1: or subdivising that land is his issue, his project, I would think, right?

[0:59:12] Voice 3: That's one way to, if you want, if you want the simplest

[0:59:16] Voice 5: route to get rid of those densities,

[0:59:18] Voice 3: versus, I mean at some point those lands would need to be resolved, but I see what you're saying, that could be then a future application.

[0:59:26] Voice 2: That's what happened before with the Perez.

[0:59:27] Voice 1: They simply just went on a bi-dense visit and then the counter would be a separate mechanism because that has to be trans,

[0:59:34] Voice 1: those densities would have to therefore be,

[0:59:37] Voice 1: I mean, because technically they still have value.

[0:59:40] Voice 1: And so I don't think it's a done deal

[0:59:42] Voice 1: that they necessarily transfer to the land,

[0:59:45] Voice 1: to the density bank.

[0:59:47] Voice 1: That's the part I'm a little unclear.

[0:59:49] Voice 1: Nature Trust would have to agree to that.

[0:59:51] Voice 1: Exactly, that would be a subsequent transaction.

[0:59:54] Voice 1: I'm fully aware of what's being proposed.

[0:59:56] Voice 1: Okay.

[0:59:57] Voice 1: So thank you for that, that's great.

[1:00:00] Voice 1: to question and offer some clarity there um

[1:00:07] Voice 1: okay

[1:00:13] Voice 5: yeah

[1:00:15] Voice 3: okay we we were told months ago that the deal was on the foreign

[1:00:20] Voice 5: in real

[1:00:20] Voice 3: picture right and then

[1:00:21] Voice 3: neil popped up a week ago and said well i know that he was on me

[1:00:31] Voice 5: yeah

[1:00:31] Voice 3: so i mean i think it might be worthwhile to maybe when you submit your occupation too

[1:00:37] Voice 3: for all of us to sit down mark and kajima as well to perhaps sit down and we can have a discussion

[1:00:43] Voice 3: yeah one half way forward makes the

[1:00:47] Voice 3: most sense yeah yeah

[1:00:48] Voice 3: we'll see what the next stage is because

[1:00:50] Voice 3: And you would be seeking to rezone your property as well, right, at this time?

[1:00:55] Voice 3: I'm not sure what the subdivision is.

[1:00:58] Voice 3: Just rezone.

[1:00:59] Voice 3: Just ban for rezone.

[1:01:01] Voice 3: So at

[1:01:01] Voice 1: this time, you hold on.

[1:01:02] Voice 1: I'm

[1:01:03] Voice 3: 83 years old.

[1:01:04] Voice 3: What the hell am I going to do for the next five years?

[1:01:06] Voice 3: So

[1:01:06] Voice 5: at this time, you're just

[1:01:07] Voice 3: looking to get the density and all that right?

[1:01:09] Voice 3: So you're going to build a subdivision?

[1:01:12] Voice 3: That's what you've got to do.

[1:01:15] Voice 5: That's helpful for me.

[1:01:17] Voice 3: That's all right.

[1:01:17] Voice 3: I was going to make a promise to somebody that I would retire by 85, because I missed eight.

[1:01:24] Voice 1: Just a quick question. If your zoning would not allow the amount of density you transfer onto it,

[1:01:34] Voice 1: theoretically, could you transfer that density? Because I think what the bylaw previously did

[1:01:39] Voice 1: is it rezoned and then have the density transfer onto it.

[1:01:50] Voice 1: I think a rezoning to rural general is something that you would have to do as a part and parcel of this, but this is for discussion with you guys back at home base there.

[1:02:02] Voice 3: I have a better understanding and I'll go back to my manager. He does a lot of things.

[1:02:06] Voice 3: I think we'll have a discussion next week when I'm in the office.

[1:02:10] Voice 3: Okay.

[1:02:10] Voice 5: Can we go back to this?

[1:02:11] Voice 3: Yeah, we'll go back to this.

[1:02:12] Voice 3: Some first steps to the third.

[1:02:14] Voice 1: Yeah, because the other, by the way, transfer of the zoning,

[1:02:17] Voice 1: that was part of how it worked is your forest general went from here

[1:02:22] Voice 1: to Ron Hall's rural general, and you got the rural general.

[1:02:27] Voice 3: The labels portion that I added to it, so that's a little chunk of rural,

[1:02:32] Voice 3: industry, et cetera, that should be organized later.

[1:02:38] Voice 1: So Mr. Kojima, he'd give guidance

[1:02:40] Voice 1: and he would understand the simplest way forward

[1:02:43] Voice 1: is what

[1:02:43] Voice 3: everyone's after here.
