[0:00:07] Trustee Rogers: i can't believe i said that um regular meeting of the main island local trust committee and
[0:00:14] Trustee Rogers: uh welcome uh to to our regular meeting um i i want to start by i always struck as i come across
[0:00:26] Trustee Rogers: because I don't I don't live in the southern Gulf Islands but what a
[0:00:29] Trustee Rogers: fantastic place that
[0:00:30] Trustee Rogers: we live in the Salish Sea and the southern Gulf Islands and uh this uh the traditional
[0:00:36] Trustee Rogers: territory of the Coast Salish I think all sometimes as I'm coming across the uh the
[0:00:41] Trustee Rogers: straight the of people paddling and the connections between Tawasin and Richmond and all those
[0:00:47] Trustee Rogers: areas over there where anyway it's beautiful I want to acknowledge that we're very privileged
[0:00:51] Trustee Rogers: to be able to meet and live and work and play
[0:00:55] Trustee Rogers: in traditional territory,
[0:00:56] Trustee Rogers: in particular, of course, this is the territory
[0:00:58] Trustee Rogers: of the Sarasota First Nation.
[0:01:02] Trustee Rogers: And it's a good week to keep in mind that history
[0:01:06] Trustee Rogers: as we head towards Truth and Reconciliation Day on,
[0:01:10] Trustee Rogers: it's Friday, I believe, isn't it?
[0:01:12] Trustee Rogers: Although I think I've seen some stuff
[0:01:14] Trustee Rogers: and I guess I don't, I may not as up as I should be
[0:01:17] Trustee Rogers: at this summer calling this Truth and Reconciliation Week.
[0:01:20] Trustee Rogers: so i think um and i think that's appropriate and so it's always good to keep in mind that history
[0:01:26] Trustee Rogers: as we continue to find out some of the history of this for this area very interesting history
[0:01:33] Trustee Rogers: my name is dan rogers and i am the chair of the main island local uh trust committee uh had the
[0:01:41] Trustee Rogers: privilege of being the chair for almost four years now i recognize many of the faces although not all
[0:01:47] Trustee Rogers: all here today. It's good to be here again in person. We had a couple of years of virtual
[0:01:53] Trustee Rogers: meetings. I was talking to someone who said, I recognize you from TV. I never thought that I
[0:02:01] Trustee Rogers: would become well known because of our Zoom meetings. This meeting, my connection to the
[0:02:10] Trustee Rogers: The Allens Trust is from Alcotsam House Sound, as I live on most of the time on Keats Island
[0:02:16] Trustee Rogers: and some of the time in Vancouver.
[0:02:21] Trustee Rogers: I'll just introduce the people you're going to see today.
[0:02:24] Trustee Rogers: Of course, your local trustees, Trustee Janine Dodds and Trustee David Maude are with me.
[0:02:31] Trustee Rogers: Between us, we make up the local trust committee.
[0:02:33] Trustee Rogers: me we you'll hear us talk about various issues that are on our agenda and and we may have some
[0:02:40] Trustee Rogers: decision points today and we discuss those and decide those one of the things I think often is
[0:02:46] Trustee Rogers: not well understood by people in the communities is that we actually don't talk about the issues
[0:02:53] Trustee Rogers: that are on our agenda between meetings generally speaking we might talk about some process issues
[0:02:58] Trustee Rogers: but generally if you hear us in our conversations as we go along today sound like we might be
[0:03:05] Trustee Rogers: surprised by the position that someone else has or the information that's has because we haven't
[0:03:09] Trustee Rogers: talked about it beforehand and that's because any two of us make a quorum and our rules of the
[0:03:15] Trustee Rogers: local government act are that if you have a quorum you have to have a public meeting if you're going
[0:03:20] Trustee Rogers: to be talking about an issue so anyway that's just one of the peculiarities of the of the islands
[0:03:27] Trustee Rogers: trust uh to my to the the far end of the table to your left and my right is uh planner university
[0:03:34] Trustee Rogers: chadwick you'll hear us talking nurse universe has a couple of reports and of course you know
[0:03:39] Trustee Rogers: pat everybody knows pat he's our reporter um has been you'll see the three of us this meeting as
[0:03:46] Trustee Rogers: you saw me set up is being recorded um on this camera uh and as also um and the speaker for the
[0:03:55] Trustee Rogers: for the camera for the setup is is in the camera itself it won't be that big an issue in this
[0:04:03] Trustee Rogers: this hall um but it is it's a good it's a good uh speaker and a microphone however it uh it does um
[0:04:13] Trustee Rogers: uh if there's any background noise it does pick that up and could be problematic
[0:04:18] Trustee Rogers: so that but it is in there and it's also being live spring stream as we speak so there may be

[0:04:41] Trustee Rogers: that's occurred um with the trust over the last well basically since the pandemic although we were
[0:04:48] Trustee Rogers: heading in that direction anyway but it sort of made us so that's my introduction um we do i will
[0:04:55] Trustee Rogers: have a couple things to say uh before we get to the talk so i'll just say it right now because
[0:05:00] Trustee Rogers: the town hall's the first thing on the
[0:05:02] Trustee Rogers: agenda anyway is um we will have a town hall and we have
[0:05:06] Trustee Rogers: to speak uh so that's the opportunity to speak to the to the local trust committee about an issue
[0:05:12] Trustee Rogers: that's on our agenda something you think should be on our agenda or something that um uh is within
[0:05:17] Trustee Rogers: the realm of the work that we do and we look forward to hearing your comments regarding that
[0:05:22] Trustee Rogers: I would ask you, as I've always asked you, and I found me and Alan particularly willing to do this and open to this, is that we have sort of three basic rules of speaking in public.
[0:05:35] Trustee Rogers: This is a workplace for everybody here, and it also should be a safe place for everybody that's in the community hall.
[0:05:41] Trustee Rogers: So we ask you to speak to the local trust committee.
[0:05:45] Trustee Rogers: It's us that make the decisions.
[0:05:47] Trustee Rogers: And if there's a question that's appropriate to turn to a planner or staff person, we'll ask the planner to respond.
[0:05:55] Trustee Rogers: It's not an opportunity for you to engage in debate with each other.
[0:05:59] Trustee Rogers: There's lots of opportunities for that on the island.
[0:06:02] Trustee Rogers: The second thing I ask you to do is to speak to issues and not people.
[0:06:07] Trustee Rogers: It's important that that's the way conversations can go down the toilet quickly is that people start to talk about other people and characterize other people.
[0:06:18] Trustee Rogers: So talk about the issues that are on our agenda and are in our package.
[0:06:22] Trustee Rogers: And the third thing we ask, of course, is that you speak appropriately, appropriate language, appropriate commentary.
[0:06:31] Trustee Rogers: I've often I've said a number of times speak in a way that your grandmother would be proud of you.
[0:06:35] Trustee Rogers: and then someone said you don't know my grandmother and uh in any case you get the
[0:06:41] Trustee Rogers: drift uh that as long as you're you know polite and and uh appropriately and everything will go
[0:06:48] Trustee Rogers: fine um and as i said that my experience has been uniformly the main island the happy island is
[0:06:54] Trustee Rogers: trusty mod always reminds me and it has always supported with those uh general rules um okay
[0:07:03] Trustee Rogers: Okay, with that, I'll turn to the agenda.
[0:07:05] Trustee Rogers: And the first question is,
[0:07:06] Trustee Rogers: do either of the trustees have anything you want to add
[0:07:08] Trustee Rogers: or, yes, go ahead.
[0:07:10] Trustee Rogers: I

[0:07:14] Voice 13: uses on the foreshore, just a general discussion.
[0:07:18] Voice 13: And 13.3, arranging a meeting
[0:07:21] Voice 13: with our by-law officers, CRD and Islands Trust.

[0:07:25] Trustee Rogers: so I'm going to put by 13.3 by-law officer.

[0:07:29] Trustee Rogers: meetings with both CRD and Islands Trust.
[0:07:31] Trustee Rogers: And the other one was uses.
[0:07:32] Trustee Rogers: uses uses on the question for sure question okay uh that's fine with me that are if you trust him
[0:07:40] Trustee Rogers: on anything uh either either of you want to rearrange it to deal with okay so then uh with
[0:07:47] Trustee Rogers: that amendment we'll take the agenda approved as amended and we'll now turn to uh still some
[0:07:53] Trustee Rogers: we're we're uh actually in some forms we're now calling this community comment period but um uh
[0:08:01] Trustee Rogers: uh it's still called the talent hall in question so and this is your opportunity to speak to us
[0:08:05] Trustee Rogers: and so I turn to you and ask is there someone who wishes to speak the
[0:08:10] Voice 2: town hall I'll just remind you
[0:08:11] Trustee Rogers: if you're an applicant on the agenda I think we only really have the one application which is the
[0:08:16] Trustee Rogers: housing society you'll have an opportunity to address the staff report when we get to that
[0:08:21] Trustee Rogers: issue so anybody else wish to speak to the uh to the local trustee

[0:08:27] Trustee Rogers: please go ahead and go ahead
[0:08:29] Trustee Rogers: Thank
[0:08:30] Voice 5: you. I've spoken to you too many times. So my wife and I own a hedgerow farm on the island, and we have for quite a while.
[0:08:39] Voice 5: Like all the farmers on the island, we are suffering from the lack of being able to get people to work on the farm.
[0:08:44] Voice 5: All the big farm owners are finding it. To dig a little deeper into that, of course, is because they can't find long-term, secure, affordable rental housing.
[0:08:52] Voice 5: And I think that the Trust has been working on this for a long time. I don't think anyone would debate anymore that there's a need for affordable rental housing in the community.
[0:09:00] Voice 5: But what I wanted to say was that I was at BC Housing in the 1990s.
[0:09:05] Voice 5: One of the best jobs I've ever had.
[0:09:07] Voice 5: I was the CEO of the agency before I left there to work at a better job.
[0:09:11] Voice 8: But
[0:09:11] Voice 5: in the 1990s, we had a housing crisis similar to what's going on right now around the province.
[0:09:17] Voice 5: I was talking to representatives who went to the UBCM last week.
[0:09:20] Voice 5: And it's a crisis everywhere in the province right now.
[0:09:22] Voice 5: Just trying to get affordable, long-term, secure housing.
[0:09:25] Voice 5: housing so when i was at bc housing during that period of time we built thousands and thousands
[0:09:32] Voice 5: of units around the province and communities big and small they could range from up to 50 units
[0:09:37] Voice 5: down to 10 or 15 if it was a smaller community and it was a it was a fun time because these were
[0:09:43] Voice 5: opportunities to house create housing for people in those communities that were living there
[0:09:47] Voice 5: seniors low-income families people with disabilities and we did a pretty good job but i
[0:09:52] Voice 5: But I can honestly say that during that time, pretty well every housing development that
[0:09:57] Voice 5: went into a community faced some initial concerns from local residents, and they were valid
[0:10:01] Voice 5: concerns.
[0:10:02] Voice 5: People would raise issues around things such as, would this depress my property value over
[0:10:08] Voice 5: time?
[0:10:09] Voice 5: Would there be issues with who's being housed there?
[0:10:11] Voice 5: Would there be issues with the design and maintenance of the building?
[0:10:14] Voice 5: And we had to spend a lot of time on that.
[0:10:17] Voice 5: It's a very difficult conversation to have in communities, because those are really strong
[0:10:20] Voice 5: fears that people bring when housing development is built. Now I can say with great expertise on
[0:10:27] Voice 5: this because we studied this extensively that a year or two later after the housing was built
[0:10:33] Voice 5: and we had to work really diligently to try to address those concerns as they went into the
[0:10:37] Voice 5: community particularly on site you would find that all of those concerns had basically dissipated
[0:10:43] Voice 5: they'd gone away. Studies would show that over time the value of property in the neighborhoods
[0:10:48] Voice 5: which did not go down and that you would see investments into this housing because you get
[0:10:53] Voice 5: money into the housing community into the community it comes from other levels of government so it's
[0:10:58] Voice 5: an investment into the community in terms of maintenance for the housing and staff that are
[0:11:03] Voice 5: that are working at the housing development so it was a real community asset and you would see that
[0:11:08] Voice 5: over time this became a way because particularly in the future people would see there's my
[0:11:13] Voice 5: grandmother in there or there's a family on the island or there's you know somebody that's
[0:11:17] Voice 5: suffering more real difficulty in trying to find something that was appropriate so i really wanted
[0:11:22] Voice 5: just to address this because i know there'll be people in the room for example that are concerned
[0:11:25] Voice 5: there is nothing that cannot be dealt with through the judicious application of the design to meet
[0:11:32] Voice 5: the standards that people want and address things such as siting vegetation water everything else
[0:11:37] Voice 5: and secondly that the property values don't go down and it just becomes a community asset and
[0:11:43] Voice 5: couple of years later when you see somebody you know in that housing development they may begin
[0:11:47] Voice 5: to say okay now i get it so i i only wanted to say that i haven't spoken to the housing at this
[0:11:52] Voice 5: point in time but this summer's been particularly difficult for us on the farm trying to find people
[0:11:58] Voice 5: who work on it and every time we create dedicated long-term affordable rental housing we can find
[0:12:04] Voice 5: other rental housing stock in the community that's freed up when those people go into it
[0:12:07] Voice 5: and it helps us all thank you very much for the next sure
[0:12:12] Trustee Rogers: the court just would like your name
[0:12:19] Trustee Rogers: thank you mr others who else would like to speak to the local trust me yes mr mackie go ahead

[0:12:28] Voice 3: just want to build on those comments um the housing agreement that you have before you're
[0:12:34] Voice 3: you're considering the first second and third reading on the wording in it basically means
[0:12:40] Voice 3: that it's affordable for anybody in the one bedroom who burns between sixty thousand and seventy
[0:12:46] Voice 3: seven thousand dollars a year if you're in a two bedroom it's affordable if you earn between eighty
[0:12:52] Voice 3: five thousand dollars and one hundred and twenty two thousand dollars i have a farm on this island
[0:12:58] Voice 3: as well i'm not going to pay those kinds of wages that person's not going to have any opening in
[0:13:04] Voice 3: this and i think what we're looking for is a community amenity that is going to help local
[0:13:11] Voice 3: businesses not just those businesses that can afford to pay a 60 to 70 000 wage and that's
[0:13:20] Voice 3: that's my concern on is this actually a community amenity and is this something the community should
[0:13:26] Voice 3: reinvesting it i have other personal concerns because i'm a neighbor and i'm trying to keep
[0:13:32] Voice 3: those two discussions separate but they can't be separated really and my concerns as a neighbor
[0:13:39] Voice 3: um run into the same sorts of things sorry i'm speaking directly to a person in the crowd um
[0:13:46] Voice 3: are related directly to things you're talking about the fear of the property values the fear
[0:13:50] Voice 3: of downstream flooding the fear of the the trees being cut down over time the lack of protection
[0:13:59] Voice 3: on our boundary with our farm zero buffers so our farm operations are going to be affected by
[0:14:07] Voice 3: the housing and I'm still not getting the kind of assurance I need to know that I can continue
[0:14:13] Voice 3: to do business and do it in the way that I'm doing it so so it's a bit it's a bit tricky for
[0:14:19] Voice 3: me to speak personally on what I need and to speak as a community member on what the community needs
[0:14:26] Voice 3: but I think my interests are actually in line with the broader community we've got a renter
[0:14:34] Voice 3: household community across the southern gulf islands that's earning a median income of about
[0:14:39] Voice 3: thirty eight thousand dollars fifty percent of the people who are renter households are earning
[0:14:44] Voice 3: less than that 80 to 90 percent of the renter household population is going to be shut out of
[0:14:52] Voice 3: this development and i don't think that's a worthwhile investment for the local government to
[0:14:57] Voice 3: to do it's it's a i think it's not the best use of resources time and money and the the consultant
[0:15:06] Voice 3: that's working with the housing development they've produced a report that says this kind
[0:15:12] Voice 3: of housing is the most expensive way to meet the core housing need on the southern gulf islands
[0:15:19] Voice 3: so i don't know why we're having this this debate we should be doing things that are much more in
[0:15:24] Voice 3: line with what uh what what we've been talking about all along and are supported by the
[0:15:30] Voice 3: consultant that's working for the housing society which is working with local people getting some
[0:15:36] Voice 3: of those um cottages that aren't being used used start doing some some rough and ready development
[0:15:43] Voice 3: to make places rental ready and build those smaller units that are more feasible on the
[0:15:50] Voice 3: gulf islands i think we can reach the renter household community that way so so that's
[0:15:56] Voice 3: that's kind of my two cents worth as a farmer on the other side of this room for you
[0:16:02] Voice 3: that's how it works and
[0:16:03] Trustee Rogers: again i i ask you we're not here if you want to go have a conversation
[0:16:07] Trustee Rogers: with mr robertson but a conversation with mr robertson please speak to us
[0:16:11] Trustee Rogers: that's okay uh we'll let it go yes go ahead sir sure

[0:16:16] Voice 4: on the comments of the previous two speakers i'm the farm on the other side of this property um
[0:16:22] Voice 4: and i think my concerns in line with my other neighbors have been the same since the beginning
[0:16:27] Voice 4: and it has nothing to do with a portable house.
[0:16:29] Voice 4: Our concern is this site.
[0:16:30] Voice 4: This site is inappropriate and is left to look at all.
[0:16:34] Voice 4: You're planning and debating putting 30 times the density
[0:16:37] Voice 4: beside us in an area with a history of water insecurity.
[0:16:41] Voice 4: From having owned the property next door
[0:16:44] Voice 4: and witnessed last winter,
[0:16:45] Voice 4: my colleague shared video footage of almost a foot of water
[0:16:48] Voice 4: running over the proposed housing site.
[0:16:50] Voice 4: There's no type of solvable solution,
[0:16:54] Voice 4: solution, you know, setting aside water as we heard earlier, that would address that flow. The only amenities I can see as far as this property is concerned, and it's been a shifting range of targets, which is why I think this ended up back before the community, would be water insecurity for the downstream neighbors. We've had water supply issues, we're now putting all this extra demand on. It's property insecurity with runoff and surface flow over the site, the wetland there is currently serving a role
[0:17:24] Voice 4: to mitigate the flood waters that come down mount park um by removing that when we asked
[0:17:30] Voice 4: and pointed out it was a weapon we were told a few meetings ago well it's not a good way
[0:17:34] Voice 4: by the applicants and we're going
[0:17:36] Voice 4: to make it better and we've heard that kind of language
[0:17:38] Voice 4: in the florida everglades and other places just because this land is free to them does not mean
[0:17:43] Voice 4: it should be used for this project it is not suitable for this degree of housing that area
[0:17:48] Voice 4: was previously protected by a covenant due to its vulnerability to these type of activities
[0:17:52] Voice 4: and the farmer on the other side who spoke previously, Tim,
[0:17:55] Voice 4: we saw what happened to their property
[0:17:57] Voice 4: when they removed the forest cover.
[0:17:59] Voice 4: Currently the proposal includes removing forest cover,
[0:18:02] Voice 4: replacing the constructed soils
[0:18:03] Voice 4: and essentially creating a large septic field
[0:18:05] Voice 4: and greenwashing that as conservation.
[0:18:08] Voice 4: If I was a donor to the society,
[0:18:10] Voice 4: I'd be concerned at this point about good money after that.
[0:18:13] Voice 4: I'm surprised as is Tim
[0:18:14] Voice 4: that we're still having this conversation
[0:18:15] Voice 4: after seeing the footage of the outflows last winter
[0:18:18] Voice 4: and simply just feel that this is not the right site
[0:18:22] Voice 4: for this project like tim and like the previous speaker i see a need for housing on this island
[0:18:27] Voice 4: this is not the place to build it we're far more interested and excited than the proposals put
[0:18:31] Voice 4: forward by the island trust such as the flexible housing which distribute the footprint of housing
[0:18:35] Voice 4: on this island and actually meet our affordable housing goals as a neighbor i don't need the
[0:18:41] Voice 4: income requirements to live in this affordable housing as in i don't earn enough to live in
[0:18:46] Voice 4: affordable housing next door so i really question the numbers that are being quoted here at the
[0:18:50] Voice 4: table and uh we've been told before that it's for for our servers and that creates this kind
[0:18:56] Voice 4: of attitude of servitude in terms of housing we need to create community here we need to build
[0:19:00] Voice 4: places to care for our elderly and for people here who are working in professions that do not meet
[0:19:05] Voice 4: uh some of these numbers of the property values in this unit thank you yes
[0:19:11] Voice 6: sir i'm glenn mcleod
[0:19:14] Voice 6: I also live on Maple Drive, 392 Maple Drive, with respect to another speaker, I also have
[0:19:22] Voice 6: some experience in the value of real estate.
[0:19:25] Voice 6: I've been a realtor on that for 33 years.
[0:19:29] Voice 6: I can say with some confidence that the properties on Maple Drive that will be adjacent to this
[0:19:35] Voice 6: project and downhill, in my estimation, will be worth less than they were when they were
[0:19:42] Voice 6: adjacent to a forest.
[0:19:44] Voice 6: it's just a no-brainer as far as my professional opinion goes
[0:19:49] Voice 6: my main concern aside from the impact on my neighbors in respect to their quiet enjoyment
[0:19:57] Voice 6: of their property is water both on the surface and beneath the surface and the effect that this
[0:20:06] Voice 6: this project will have on that supply of water.
[0:20:09] Voice 6: There is new video footage posted on the internet
[0:20:14] Voice 6: yesterday showing the torrent of water
[0:20:16] Voice 6: that came down that property last winter.
[0:20:19] Voice 6: We have yet to post footage showing the effect of that water
[0:20:24] Voice 6: on the other side of Maple Drive.
[0:20:26] Voice 6: Stay tuned, it's pretty dramatic.
[0:20:29] Voice 6: I haven't heard anybody address that flow.
[0:20:32] Voice 6: Perhaps people didn't get in there
[0:20:34] Voice 6: to see that torrent of water.
[0:20:35] Voice 6: The little that I've heard is, well, we're just not sure who's going to be responsible
[0:20:42] Voice 6: for any damage that might occur from that abundant supply of surface water.
[0:20:50] Voice 6: Beneath the surface is also a concern of mine.
[0:20:54] Voice 6: We've lived on Maple Drive for a couple of decades now, long enough to see the way that
[0:21:00] Voice 6: water moves on these acreages up behind us. It comes down off of Mott Park and streams,
[0:21:06] Voice 6: is directed through culverts, comes onto the onto the acreage and spreads out. It focuses in
[0:21:14] Voice 6: certain areas and we'll see one of those areas in the footage online, but eventually it finds
[0:21:22] Voice 6: its way to the bottom of those 10 acre parcels and spreads out and largely sinks into the ground,
[0:21:29] Voice 6: stuff that doesn't sink into the ground gathers up spills out onto maple drive it goes down onto

[0:39:31] Voice 6: thing coming at us so we may see a whole lot of real estate coming to the market in the coming
[0:39:38] Voice 6: years these decades take these changes take a decade in our experience with that flood of real
[0:39:45] Voice 6: estate listings comes a flood of rental units and that again that burgeoning supply will drive
[0:39:52] Voice 6: five rents down. And I don't know enough about the finances here to Nico does predict what this will do to a project that's being built now to be rented later. So I say, beware, because prices are going down, rents are going to go down. The other thing is the trust is working on a project that I applaud, which is this flex housing experiment that's going to create

[0:47:32] Voice 16: um it presents the uh the housing agreement um for uh for release um and uh
[0:47:41] Voice 16: so the housing agreement has come back um um after being updated uh
[0:47:49] Voice 16: in about June, there had been at times a discussion around Sean Deque's being on the housing agreement.
[0:47:57] Voice 16: One of the significant changes that was discussed here was the shift to a more flexible approach to the housing rental structure.
[0:48:14] Voice 16: structure. The other key piece in the staff report is around the, well, I guess there's
[0:48:26] Voice 16: two, there's the decision around the amenity as has been identified previously. That was
[0:48:31] Voice 16: kind of a point of stall, essentially, with the process is defining what the amenity that
[0:48:43] Voice 16: that would support the development on what to
[0:48:48] Voice 14: define
[0:48:49] Voice 16: as and there's been a lot of
[0:48:52] Voice 16: conversation around that point. There's been conversation around other potential
[0:48:57] Voice 16: things like water conservation, potentially looking at those as many amenities staff
[0:49:06] Voice 16: staff and come back and identify that looking at those would be fairly complicated.
[0:49:13] Voice 16: I we looked at water and that it seems that would be quite a complicated process.
[0:49:19] Voice 16: And the LTC had also requested staff look into the idea of an additional conservation component
[0:49:29] Voice 16: and talking with the land conservancy that that too would be quite a complicated and
[0:49:35] Voice 16: lengthy process and the the land and and really they're not really the size of the land that
[0:49:41] Voice 16: potentially be offered it's not really substantial to um to actually um uh stimulate interest in that
[0:49:49] Voice 16: that way of going so the ruling about those additional things the the things that um sort
[0:49:59] Voice 16: remain um is the um the donation of land for affordable housing and that's essentially what
[0:50:06] Voice 16: the apc's resolution suggests that the donation of land um is sufficient to meeting amenity
[0:50:13] Voice 16: provisions in the ocp um so the donation of land that would mean that um that the land would have
[0:50:20] Voice 16: to be subdivided and um the title of that lot three um moved to the housing society or another
[0:50:28] Voice 16: another society, you know, that would be,
[0:50:31] Voice 16: the company can be worded in such a way
[0:50:33] Voice 16: that that plot to a party
[0:50:40] Voice 16: that would take on the responsibility
[0:50:42] Voice 16: of providing affordable housing.
[0:50:44] Voice 16: A step down from that would just be the rezoning
[0:50:46] Voice 16: of the land, which would actually get the LTC
[0:50:50] Voice 16: in a fairly sticky place,
[0:50:52] Voice 16: with no guarantee of transfer of land.
[0:50:56] Voice 16: There has been previous discussion around the demonstration that building is being provided on the land.
[0:51:04] Voice 16: And that had been sort of in the original covenant had one of the earlier drafts and had indicated that interest.
[0:51:19] Voice 16: But it hasn't actually, at that point, really defined what that would mean, if it was all
[0:51:26] Voice 16: houses, partial houses.
[0:51:27] Voice 16: So that, if we were to go back to discussing that, there would need to be a really clear
[0:51:33] Voice 16: decision on what constitutes the demonstration of building being provided, which could be
[0:51:38] building a land, which could be obtaining the funding,
[0:51:43] Voice 16: whatever point, and we've discussed
[0:51:45] Voice 16: that a little bit in the past um with that sort of discussion on the table the um the housing society
[0:51:53] Voice 16: had um come back with a uh some wording in the covenant that um spoke to uh an expiration um
[0:52:04] Voice 16: expiration of whatever restriction there may be on lot two while with you know if for example
[0:52:09] Voice 16: for example, the government identified that X amount of buildings would have to be built if those were not provided, then there would be an expiration of that particular restriction to allow after five year period from subdivision to allow for the building
[0:52:30] Voice 16: a lot to do for it so that that wording is still in the um the draft cousin covenant that you have
[0:52:37] Voice 16: before you is the covenant that uh uh the housing society is provided so that's that's that's where
[0:52:43] Voice 16: it's coming from um an update to previous and um and uh basically if if it is defined that the
[0:52:54] Voice 16: donation of land for affordable housing is the amenity then that that particular clause is is
[0:53:03] Voice 16: then made redundant because uh with the transfer of land you're you would then be um you would then
[0:53:11] Voice 16: be recognizing that as the amenity that's allowing the bonus which is the additional lot for
[0:53:16] Voice 16: of development. So, um, staff recommended recommendations for
[0:53:27] Voice 16: us to move forward, um, is to the communities that the
[0:53:32] opportunities are that ABC was going to get the
[0:53:35] Voice 16: opportunity to
[0:53:37] Voice 16: provide some perspective that we haven't had legal advice
[0:53:45] Voice 16: land donated for the food and affordable housing could be received as as the amenity of the
[0:53:58] Voice 16: staff recommending that that be a consideration um um the restrictions um there are a lot
[0:54:11] lot
[0:54:12] Voice 16: of restrictions have been placed on plot two and three through the covenant that focus on land
[0:54:19] Voice 16: preservation and alleviation the housing agreement again the housing agreement is
[0:54:26] Voice 16: is quite restrictive and it is very similar as um the steroids have indicated to the housing
[0:54:32] Voice 16: agreements that have been going up for um a number of other um projects in the islands just um
[0:54:42] Voice 16: and uh like i said if you know if it is identified that the management line of
[0:54:48] Voice 16: the amendment there is um essentially that uh there the restriction on um
[0:54:56] Voice 16: on the building is kind of that causes um so it should be rewritten to uh indicate that um
[0:55:06] Voice 16: that block two development can't occur until after subdivision and transfer plan if that's the
[0:55:12] Voice 16: That's the direction that the LCC would like to go.
[0:55:15] Voice 16: There are, of course, alternatives
[0:55:17] Voice 16: to what's been recommended.
[0:55:20] Voice 16: The LCC could define the amenity required
[0:55:23] Voice 16: for admitting the development of LCT as something else,
[0:55:26] Voice 16: but I would really urge you to be really clear.
[0:55:33] Voice 16: Like, I mean, we've been around it so many different times,
[0:55:35] Voice 16: so we really need to have a really clear sense
[0:55:39] Voice 16: of what that would be.
[0:55:42] Voice 16: And the other thing is that there is a recommendation in here, it's a staff recommended resolution to schedule a community information and public hearing for the 31st.
[0:55:57] Voice 16: So that's their other interest for the process to move forward before the end of term.
[0:56:05] Voice 16: Now, there had been previously a resolution around having the CIM and the public hearing separate.
[0:56:20] Voice 16: And I think given the conversation in the room, I actually think staff, I would like to change my recommendation and recommend that a separate CIM and public hearing may be the way to go.
[0:56:36] Voice 16: So, you know, and then the date of so the date of you
[0:56:42] Trustee Rogers: say your recommendation is what a separate.
[0:56:45] Trustee Rogers: Well, I thought we were doing. Well,
[0:56:48] Voice 16: we were and I, and so I had, I changed the, I had changed recommendations together and then I went back to what you originally, originally said at the last so I would say, yeah, I would just stay with separate.

[0:57:08] Voice 16: the last opportunity for this local trust committee to make a decision on the on the
[0:57:15] Voice 16: proposal that there there is a LTC meeting on the 24th. There won't be as far as I know,

[0:57:29] Voice 16: So, if you were to go with public hearing, if you want to go with a separate CIM and public hearing, then I would suggest that you do that, one of those, combined with the other two.

[0:59:10] Trustee Maude: Basically, you sort of become a lame duck session where, you know, I might be pushing an opinion or something that doesn't really count because I'm at that point on my way out the door.

[0:59:31] goes it's that i certainly hope to be elected and i very much like to be sitting at the table there
[0:59:36] but if i wasn't

[1:00:37] Trustee Rogers: going to have the swearing in on November 1st of the new trustees and we found out that the
[1:00:41] Trustee Rogers: act didn't allow that we've now moved our trust council to where the swearing in will take place
[1:00:47] Trustee Rogers: to the middle of november which means i and i i'm on the job until my replacement comes off anyway
[1:00:56] Trustee Rogers: um so that's just my way of explanation why we're sort of they all came to light last friday
[1:01:03] Trustee Rogers: afternoon anyway um i so i sort of feel like um i i was wondering about whether i should be doing
[1:01:11] Trustee Rogers: that on the other hand there is some real benefit given that i got all the history of this

[1:01:33] Trustee Rogers: have to do third reading if you if you're still feeling like you don't want to do it it's just

[1:02:28] Voice 13: the scenario was that you had three trustees who none of them returned to your local trust
[1:02:33] Voice 13: committee that doesn't mean the following trust committee cannot still make the ultimate decision

[1:02:40] Voice 13: the the actual final decision on this pilot will be the next local trust committee right so i

[1:06:04] Voice 13: bc-wide income figure and there is no our incomes here i think they're quite correct the expectation
[1:06:14] Voice 13: expectation of the rental rates on this property are way exceed what the normal rents are you know
[1:06:19] Voice 13: so I guess that would be an opportunity or what do we do about that because we know that they're
[1:06:26] Voice 13: not realistic and we know that there's only two of these units that are deep subsidy and we keep
[1:06:31] Voice 13: saying this word affordable and actually make made them take it out of the trust policy statement and
[1:06:36] Voice 13: these are attainable units but in terms of I know affordability is a third people's income but what
[1:06:40] Voice 13: the average person thinks of in terms of rentals especially on an island is much lower than
[1:06:45] Voice 13: expectations in an urban area
[1:06:47] Voice 11: all the time to do if i might speak to this in the housing agreement
[1:06:52] Voice 11: is to create a structure within which the bc housing funding can have their rental structure
[1:07:02] Voice 11: embedded in here and it doesn't con conflict with the housing agreement or the cmhc funder
[1:07:07] Voice 11: and their housing um rents are able to be accommodated into the housing agreement and
[1:07:15] Voice 11: what we've been hearing here about numbers being bandied about is not quite actually the way it is
[1:07:21] Voice 11: so how it looks is if you have four units and you've got rents for those four units
[1:07:29] Voice 11: the average of those four units has to be below what is in the housing agreement so there will
[1:07:35] Voice 11: be an opportunity as the planner said to have rents that are low to meet the needs of that
[1:07:41] Voice 11: those those families are those uh tenants and you can have a higher and they will be below
[1:07:50] Voice 11: as the wording is in here um according to cmhc um i can't recall exactly the wording but that's what
[1:07:59] Voice 11: is so it's to accommodate the needs of the island contrary to what we're hearing it is to accommodate
[1:08:07] Voice 11: the needs of the island and it has been very well presented by the planners on other islands and
[1:08:14] Voice 11: is in the housing agreements that have been accepted on other islands as well
[1:08:18] Voice 11: and if we want if you want to have more information about this we're happy to give it to

[1:08:24] Trustee Rogers: yeah i i should like to add that all the potential funders are explicitly
[1:08:31] Trustee Rogers: concerned with affordable housing and they put rules in place in conjunction with their funding
[1:08:36] Trustee Rogers: to ensure that the housing is affordable and the formulas are different enough that the one
[1:08:42] Trustee Rogers: umbrella spanning all of those possibilities is what we need in housing to ensure that there will
[1:08:48] Trustee Rogers: be one in here but it will be more restrictive than housing by definition by the mandate of
[1:08:54] Trustee Rogers: those agencies and they are all looking for affordable housing i

[1:09:02] Trustee Rogers: a couple questions
[1:09:03] Trustee Rogers: one about that i'll come back to that though i wanted to just make sure i understand uh the
[1:09:09] Trustee Rogers: the covenant um so my understanding what you said uh planner chadwick was um one of the one of the
[1:09:19] Trustee Rogers: idea is we came up with was that we asked a question as to whether or not it would make
[1:09:27] Trustee Rogers: some sense that if the housing never got built whether the lot three would be could be flipped
[1:09:32] Trustee Rogers: over to some sort of a conservation property and what is my understanding is that you went to the
[1:09:38] Trustee Rogers: conservancy the iowa's trust conservancy and they basically said yeah we probably wouldn't be
[1:09:42] Trustee Rogers: interested because it's not a big enough piece of property to be basically interested in yeah i mean
[1:09:48] Trustee Rogers: might have been some other options but it is a i
[1:09:50] Voice 16: mean we can do further pursuit of course

[1:09:52] Trustee Rogers: i mean there might have been other options like a park or a water of nature to put in nature
[1:09:58] Trustee Rogers: protection given what it is um i guess i saw that as sort of a when i call it gift over if the bill
[1:10:07] Trustee Rogers: if the housing wasn't going to become if the prediction we just heard that there was going
[1:10:11] Trustee Rogers: to be so much rental on maine that there would be an oversupply and therefore it never got built
[1:10:15] Trustee Rogers: um that that they're and they and therefore the housing society or a successor said well we don't
[1:10:22] Trustee Rogers: need it anymore there might be a gift over but that's not what i'm hearing uh that then you
[1:10:27] Trustee Rogers: didn't think that that was a reasonable alter at
[1:10:30] Voice 16: this point in time so i mean like that conversation
[1:10:33] Voice 16: can be had at any other point in time with the the housing society because how the society needs
[1:10:39] Voice 16: to be willing to to go yeah
[1:10:42] Trustee Rogers: but my point is this is the point in time where you might make that
[1:10:46] Trustee Rogers: agreement because five years down the road if they're not going to build a house then they
[1:10:49] Trustee Rogers: then they're sitting on a piece of property now granted it's zoned in a particular way
[1:10:54] Trustee Rogers: that's only useful for uh a housing development yeah go ahead
[1:10:59] Voice 13: well then as was pointed out
[1:11:00] Voice 13: you know it's it also has significant covenants so right well we have this vision of it sitting
[1:11:05] Voice 13: near untouched that's also not a bad thing in terms of the protection of that property so tell
[1:11:12] Trustee Rogers: me again about about if we agree or if we come to the same conclusion the apc it does that the
[1:11:20] Trustee Rogers: donation of the land is is they're recommending that we declare that to be the amenity what
[1:11:27] Trustee Rogers: happens to that clause in the section 219 covenant because i sort of i sort of assumed that that
[1:11:32] Trustee Rogers: clause would stay yeah
[1:11:33] Voice 16: no so if they decide that the donation plan is the amenity then you have
[1:11:40] Voice 16: your amenity to provide your your benefit right so once the donation lens is is made well once
[1:11:48] Voice 16: you've subdivided the the donation event lens made and if that's what you've identified to be
[1:11:54] Voice 16: your community amenity then the benefit should be allowed to move forward that's that's the way it
[1:12:01] Voice 16: would i
[1:12:02] Trustee Rogers: mean i'll be frank i'm not sure why we could do that given that we already seem to have
[1:12:08] Trustee Rogers: the housing society and the landowners agreement that they wouldn't start building until we had
[1:12:13] Trustee Rogers: five units and all they really cared about was have a have a sunset clause on that why would we
[1:12:19] Trustee Rogers: well
[1:12:19] Voice 16: you could go in that direction too that's the that's that's the decision to be made right

[1:12:24] Voice 16: the decision to be made is if it's decided that the amenity is the the donation of land
[1:12:31] Voice 16: land, then everything else sort of falls away. You don't need to put any more. I mean, you
[1:12:37] Voice 16: can't, you could, but I guess you could put restrictions on, but, but, but actually, no.
[1:12:43] Voice 16: So if that's being defined as the amenity, then you don't need to be making the restrictions.
[1:12:48] Voice 16: But if you still want to move with like the provision of land, then that clause is still
[1:12:53] Voice 16: worth contemplating. So if you, so basically, if you're saying that the amenity is something
[1:12:59] Voice 16: something other than then the donation of land then you need to define what that other thing is
[1:13:05] Voice 16: and then that's where that clause comes into play because you're needing that thing whatever it's
[1:13:12] Voice 16: defined as to be in place before that because that's what's being defined as the amenity
[1:13:17] Voice 16: to be in place before the um building a lot too forward and so that's where then having a
[1:13:39] Trustee Rogers: I'm sort of thinking about all that simply because I understood that you know where this all arose
[1:13:44] Trustee Rogers: was because we go we don't want just another piece of land that doesn't get built on that's

[1:15:39] Trustee Rogers: went oh what if that's not the model anymore from pc housing or what if what if there's not
[1:15:44] Trustee Rogers: enough money because there were so many applicants and so many so many disappointed
[1:15:49] Trustee Rogers: pointed out people that they didn't the money wasn't there they thought we better have some
[1:15:53] Trustee Rogers: flexibility but my understanding at the end of the day is this is all since the trust is in this
[1:15:58] Trustee Rogers: unique scenario right um because we do the zoning and we want to make sure that we're giving if
[1:16:04] Trustee Rogers: we're going to give something up we want to make sure that we're getting something that's a community
[1:16:08] Trustee Rogers: benefit but at the end of the day the real test on on what i would understand that the rents and
[1:16:15] Trustee Rogers: everything else will come from the funder uh not from us and we're basically putting a a framework

[1:17:59] Trustee Rogers: Any of the funding bodies will have maximum LFN levels under which you build the project, but the project has to be sustainable.

[1:18:14] Trustee Rogers: It's a six-year lifetime in these models.
[1:18:17] Trustee Rogers: So it has to be a coherent financial structure
[1:18:21] Trustee Rogers: that has stability over time.
[1:18:22] Trustee Rogers: We see housing, many of the projects
[1:18:25] Trustee Rogers: with operating grants and bridge that gap.

[1:18:38] Trustee Rogers: five rent year to income, more than 30% taxable, and two at low market or

[1:18:49] Trustee Rogers: So that package of rents is intended to create enough income,
[1:18:53] Trustee Rogers: perhaps with an operating system to make the entire system viable.

[1:36:18] Trustee Rogers: Our position is that the definition of the plan is the amenity, and we concur that once the donation is in hand, the amenity to the community has been provided.
[1:36:28] Trustee Rogers: There need not be any additional restrictions on building a lot, too.
[1:36:32] Trustee Rogers: This recommendation will provide the security the donor requires and recognizes the goodwill of the donor and his family.
[1:36:39] Trustee Rogers: So while there have been concerns expressed from the neighbors about the impact of development
[1:36:47] Trustee Rogers: on the land, all of the work on this project has been and will continue to be informed
[1:36:53] Trustee Rogers: by the work of experienced professionals.
[1:36:56] Trustee Rogers: These concerns have been expressed with energy and a considerable level of detail.
[1:37:00] Trustee Rogers: However, none of the ways in which these concerns have been expressed will solve the problem.
[1:37:06] Trustee Rogers: remaining in the status quo means that it continues to be an overland water issue
[1:37:14] Trustee Rogers: what we're endeavoring to do is to build a development with the least possible
[1:37:17] Trustee Rogers: impact and with the benefit of improving the quality of the land
[1:37:26] Trustee Rogers: there's broad community support for this project there's been several hundred letters addressed
[1:37:31] Trustee Rogers: in the ltc's report 224 people signed the petition submitted in may of this year
[1:37:37] Trustee Rogers: we have strong membership support we've raised tens of thousands of dollars in direct community
[1:37:42] Trustee Rogers: support in addition we've received support from multiple levels of government federal provincial
[1:37:46] Trustee Rogers: and at the crd level there's a recognition from all levels of government that the need for
[1:37:52] Trustee Rogers: affordable housing is urgent in fact reaching a crisis level and without the land there will

[2:08:21] Trustee Rogers: it was an interesting um we spent a fair amount of time working through
[2:08:28] Trustee Rogers: what to do with the governance report but what was interesting is that in my view this is only
[2:08:32] Trustee Rogers: my personal opinion probably the most important step i'm taking is the creation of the governance
[2:08:37] Trustee Rogers: committee uh that was you know that that they will be the the new committee the governance
[2:08:42] Trustee Rogers: rather you sit on that no we don't um we'll be the ones that will take the governance report
[2:08:48] Trustee Rogers: that came out in march uh and implement some of the changes to the the trust as we go forward
[2:08:58] Trustee Rogers: so there was that there was quite an interesting a little short presentation from the province
[2:09:05] Trustee Rogers: related to their coastal marine strategy that's in the works of the province.
[2:09:13] Trustee Rogers: I don't know if you've been following this at all, but there was some lobbying that went on.
[2:09:19] Trustee Rogers: And as it turns out, B.C. is one of the few jurisdictions in North America that doesn't actually have a coastal marine strategy,
[2:09:27] Trustee Rogers: either by regulation or as a strategy because a lot of the east coast does and a lot of the
[2:09:33] Trustee Rogers: western united states and there was a big push by i want to say west coast environmental law
[2:09:40] Trustee Rogers: but it might have been somebody else um that to develop it and the province is now committed to
[2:09:44] Trustee Rogers: it so we have an update of where they're at in terms of the strategy and i think
[2:09:50] Trustee Rogers: the idea in the long run will be that um there will be more guiding principles and perhaps more
[2:09:58] Trustee Rogers: guidance to communities and first nations and uh people on the coast as to how the uh how this
[2:10:07] Trustee Rogers: how the coastline is going to be protected uh going forward in the future but it's an
[2:10:11] Trustee Rogers: early it's early days it's very early days related to that um what else did we do with
[2:10:18] Trustee Rogers: trust but
[2:10:19] Voice 13: with the policy statement we went through that a lot of it actually was really
[2:10:23] Voice 13: really well done right so lots of
[2:10:26] Trustee Rogers: changes so if you've also been following the policy statement
[2:10:29] Trustee Rogers: review process um it's basically hit another pause it hit a pause in the summer of 2021
[2:10:38] Trustee Rogers: and we've now done a fair amount of work on it in the last um the last three months after our fair
[2:10:44] Trustee Rogers: the community engagement process and now we uh have sent it back to the staff to redraft that
[2:10:53] Trustee Rogers: document a policy statement document if the idea is it probably won't come back to trust council
[2:10:59] Trustee Rogers: till sometime in early 2023 um with a recommended uh a new recommendations it's intended to be
[2:11:08] Trustee Rogers: be simpler, clearer, without some of the restrictive issues around, as restrictive around docks
[2:11:17] Trustee Rogers: and around foreshores and around desalination.
[2:11:20] Trustee Rogers: In fact, the whole issue of desalination currently has been taken out.
[2:11:24] Trustee Rogers: So some of the things that we heard from the public, both from Maine and other islands
[2:11:28] Trustee Rogers: that were causing a lot of concerns have been removed or will are proposed to be modified.
[2:11:33] Trustee Rogers: also we're working on trying to figure out ways to bring First Nations and Indigenous people into
[2:11:40] Trustee Rogers: into a more I don't want to use the word co-governance it seems like it's not the right
[2:11:46] Trustee Rogers: term but more of a co-decision-making process where they feel that they're
[2:11:51] Trustee Rogers: that they are part of the process that affects them so people so we're continuing to work towards
[2:11:58] Trustee Rogers: um uh that's the last trust council of this term um i'm actually not running again so it's my last
[2:12:06] Trustee Rogers: trust council and uh so the um uh and i have a couple more executive committee meetings i
[2:12:14] Trustee Rogers: apparently have two more meetings on main island um that i am coming for so it's not goodbye yet
[2:12:20] Trustee Rogers: from me uh but the uh we're moving towards the october um 15th election uh there's on some
[2:12:30] Trustee Rogers: islands with a lot of candidates i know there's there's salt spring there's seven or eight uh
[2:12:35] Trustee Rogers: seven on mesquite island of all places um uh four on denman uh there's the only two islands that
[2:12:45] Trustee Rogers: the only two other groups that had acclamations were saturn and uh my my area abraham they had
[2:12:52] Trustee Rogers: they were acclaimed so there will be elections on um 10 of the 12 islands where uh we'll see who uh
[2:13:00] Trustee Rogers: is uh elected and you'll have a new trust council but i think it's fair to say i think there's eight
[2:13:05] Trustee Rogers: or nine retirements people doing so there's going to be probably about the normal 50 percent so
[2:13:11] Trustee Rogers: so we're working towards that and the executive committee will continue to do its work
[2:13:16] Trustee Rogers: i think we have one more financial planning committee meeting that's just to set up the
[2:13:20] Trustee Rogers: next budget process um which is complicated on a on a year when everything turns over
[2:13:27] Trustee Rogers: um that's about all i can tell you really that's my report so over to the local trustees
[2:13:33] Voice 13: i just want to say that um i haven't don't think i've been to any any events lately but a lot more
[2:13:40] Voice 13: more questions from the community. So people who don't
[2:13:43] Voice 13: understand what their rights and their responsibilities and
[2:13:47] Voice 13: rights are on the foreshore, discovering that after many
[2:13:51] Voice 13: years, they aren't actually supposed to be putting cement
[2:13:54] Voice 13: steps down there or building a seawall without getting
[2:13:57] Voice 13: invariants. Huge concerns on Wooddale desire, actually by
[2:14:03] Voice 13: the CRD by officer to get together with the honest trust
[2:14:07] Voice 13: by law and the trust count and the trust committee um so a lot of pressures right now over
[2:14:14] Voice 13: housing that is i would call substandard but in most in most cases that's what people have
[2:14:21] Voice 13: um so we're really i'm really noticing the difference with the increase of population
[2:14:27] Voice 13: increase of development um lack of elbow room i would call it that there are a lot of minor well
[2:14:33] Voice 13: Well, we can call it a lot of frustrating issues are coming up now in individual communities.
[2:14:38] Voice 13: I'm getting far more phone calls, far more emails asking about the process.
[2:14:43] Voice 13: And of course, not being a municipality and trying to explain how much bylaw officers can or will do is really complicated.
[2:14:51] Voice 13: So that's the biggest change. It's quite a bit quieter on the island since Labor Day.
[2:14:56] Voice 13: A lot of people obviously have gone back on home.
[2:14:59] Voice 13: um and obviously too we got through the summer without the water districts running out of water
[2:15:04] Voice 13: uh one of the trust council delegations spoke about the concerns about the amount of water
[2:15:10] Voice 13: specifically that were shipped into galliano the trucker the trucks i mean she said three but i i
[2:15:16] Voice 13: talked to the water the bulk water carrier came here with two loads is what he told me to fill
[2:15:22] Voice 13: people's cisterns so clearly the water districts did not have any serious leaks this year which i
[2:15:27] Voice 13: think is fabulous news it means that our water districts of which 90 of our community relies on
[2:15:34] Voice 13: we're able to maintain the water for the huge number of people over here this summer so
[2:15:41] Voice 13: kudos to everyone for being cautious with water and i think water rainwater collection of course
[2:15:46] Voice 13: is part and parcel every bit of increased density that we have allowed in my time so that's mostly
[2:15:53] Voice 13: what i'm finding is that there really is a need with so many new people to somehow have
[2:15:58] Voice 13: a community gathering sometime early in our new term to talk about you know how things function
[2:16:04] Voice 13: on the island what you can and can't do in your community your little neighborhood did you mention
[2:16:09] Voice 13: the first nations no that was this morning at night which way
[2:16:15] Trustee Maude: there's something community
[2:16:17] Trustee Maude: in the community

[2:17:00] Trustee Maude: sort of a community gathering with First Nations here. It was
[2:17:05] Trustee Maude: a really fascinating event. It was primarily the L.A. family, and it was very, very well
[2:17:15] Trustee Maude: all conducted um hopefully we're going to see these things more and more frequently um then
[2:17:21] Trustee Maude: the following week we had uh one with japanese families um and with uh quite a few delegations
[2:17:28] Trustee Maude: coming basically to to look at main island they had a little ceremony over the museum
[2:17:34] Trustee Maude: this is the japanese garden some of the homesteads and such it's sort of it's reconciliation of a
[2:17:40] Trustee Maude: different time in a different form um of something that was really tragic what happened to this island
[2:17:47] Trustee Maude: and really affected the community and um it was quite touching that um that uh really was
[2:17:56] Trustee Maude: was an event that was put together by the families by the community and it was just it was really it
[2:18:03] Trustee Maude: wasn't i don't think because i know after a lot of people it was very um
[2:18:07] Voice 15: and
[2:18:08] Trustee Maude: again hopefully the
[2:18:09] Trustee Maude: person of many such events um i guess the only other thing that happened on it was our fall
[2:18:15] Trustee Maude: fair sort of came back to being a fall fair again this time it was tremendously well well attended
[2:18:22] Trustee Maude: um the weather was great lots and lots of people here and and the feedback was it was an
[2:18:28] Trustee Maude: overwhelming success so and and and of course our first stop across the road is coming together
[2:18:35] Trustee Maude: it's uh despite we
[2:18:36] Voice 13: rezoned it we temporarily used permanently we did quite a bit yeah and
[2:18:40] Voice 13: now the deck is coming the deck is coming mostly well they're all volunteers despite

[2:18:45] Trustee Maude: actresses here i need to stop yeah yeah
[2:18:47] Voice 13: so so that's exciting the trip shop is slowly coming
[2:18:50] Voice 13: together hopefully before the winter rains so i

[2:19:05] Trustee Rogers: things they've done is they've sent it out to all of the trust committees for any comments or

[2:19:15] Trustee Rogers: is does the local trust committee wish to do anything with

[2:19:22] Trustee Maude: and third it's a it's a great document so i would just say compliments so i don't i don't have

[2:19:45] Trustee Maude: some of the the parcels they have are minuscule um like a third of an acre a half acre and such

[2:19:57] Trustee Maude: don't want the smaller um properties for acquisition but um the work that they've
[2:20:03] Trustee Maude: done over the years has been phenomenal yeah
[2:20:07] Voice 13: i think it's it sometimes i think people wonder
[2:20:12] Voice 13: under what Islands Trust does for the communities
[2:20:15] Voice 13: other than collect taxes and doing land use planning,
[2:20:18] Voice 13: but what they do do is they fund,
[2:20:20] Voice 13: and our tax dollars fund the Islands Trust Conservancy.
[2:20:23] Voice 13: And that's really where the, to me,
[2:20:25] Voice 13: the preserve and protect shows in our communities
[2:20:28] Voice 13: with what the Islands Trust Conservancy
[2:20:31] Voice 13: has been able to do.
[2:20:31] Voice 13: So they have 1,366.7 acres, hectares of protected land,
[2:20:38] Voice 13: a lot of it by covenant,
[2:20:39] Voice 13: it but that the amount of activity that's going on in my years with the trust through the
[2:20:44] Voice 13: conservancy is quite amazing kudos to them it's very interesting yeah

[2:20:53] Trustee Rogers: reading through the list of properties as they're protected and when they're protected is pretty
[2:20:59] Trustee Rogers: amazing uh i looked for you know there's a few of them made um and uh elsewhere so would you like to

[2:26:03] Voice 13: directly to the main island owners of waterfront boats, living on their property, their rights on their property, their responsibilities.

There were approximately sixteen (16) members of the public in attendance.
1. CALL TO ORDER
Chair Rogers called the meeting to order at 1:04pm. Chair Rogers acknowledged that the
meeting was being held in traditional territory of the Coast Salish First Nations and noted Friday
is Truth and Reconciliation Day.
2. APPROVAL OF AGENDA

3. TOWN HALL AND QUESTIONS
Peter Robinson, Hedgerow Farm, spoke to the difficulty of getting workers due to lack of
affordable housing. While working with BC Housing in the 90’s he was involved with the
construction of a number of units throughout the province. Concerns of neighbours were
addressed and after housing was in place for a few years concerns disappeared and the
investment into the community was evident.
Tim Mackie, Maple Drive, questioned the Housing Agreement currently before the Local Trust
Committee (LTC) and the actual affordability based on rental scale - income. He raised a
number of concerns regarding development: clearing of trees; flooding and expense of project
to meet housing needs.

Nikko Preston, Village Bay Road, stated concerns with the site, not the project. Issues include
flooding, water demand, surface water flow and removal of forest cover. Suggestion to
distribute housing footprint. Also questioned the required income of future tenants.
Glen McLeod, Maple Drive, questioned impact on property values for those next to
development as well as water impact on neighbours, both surface and ground water. Mt. Parke
has significant run-off – impact demonstrated on a video from storm 2021. (which was
forwarded to LTC). As the area is served by wells, concerns for quality and quantity of water
with increased demand.
Chair Rogers noted video footage would have been more helpful if available earlier.
Lise McLeod asked what Trustees would suggest to ensure compensation/mitigation if
wells/property is damaged by impact of project.
Trustee Maude cited this would be outside of LTC scope.
Trustee Dodds noted that there are multiple reports from experts. The LTC takes advice from
the Planner who considers all documents/reports. There are a number of further agencies that
monitor and manage the project: Ministry of Health, Ministry of Transportation and
Infrastructure (MoTI), Housing Society, various Provincial authorities.
Regarding question of income - $60,000 to $70,000 is the cap.
Tim Mackie addressed the Covenant and noted the Wet Land Pan for restoration has been
downgraded and doesn’t include Lot 1. Further questioned rental formula and wording of
Agreement.
Planner Chadwick clarified that the rental rates as identified in the housing agreement are
flexible. The average of the combination of rates is to be 30% of the average of incomes in each
income category. As a results there may be rates that are higher and ones that are lower
dependent on the income of the household. Chair Rogers stated questions would be very
appropriate for Community Information Meeting (CIM) and Public Hearing (PH). Change to a
bylaw requires a PH and the Housing Agreement and Covenant are likely to be part of PH so
community has complete package.
Glen McLeod spoke to the changing housing market – peaks and valleys. An increase in supply
will drive rents down. Supportive of flex housing which will add to market.

The Advisory Planning Commission (APC) has recommended that donation of land is
sufficient to meet Amenity requirements.
Discussion:
Holding CIM and PH prior to election;
Chair Rogers informed LTC that swearing in of elected Trustees will occur mid-
November;
Question of driveway to Lot 2 coming off Lot 1 – not noted in Covenant: this will be
addressed as an Easement on Title;
Housing Agreement – rental fees to reflect island incomes;
CHMC and BC Housing rules and formulas ensure affordability;
Covenant: if not built could lot become a Conservation parcel;
Conservancy may not be interested;
Zoning and Covenants protect lot;
Financial structure: rents will be as low as possible to meet program requirements;
and
Number of issues to work on beyond Islands Trust (IT) scope.

Dan Brown, on behalf of Mayne Island Housing Society (MIHS) stated:
Appreciation to Advisory Planning Committee (APC) and Planner’s efforts;
In agreement with recommendations proposed within Staff Report;
Reports/work done by experienced experts;
Plan to develop with least possible impact; improve water situation;
Extensive support of community and government; and
Housing Agreement designed to meet requirements of project and funding
agencies who are all committed to provision of affordable housing.
Chair Rogers recommended that Housing Agreement and Covenant be as compete as
possible prior to PH.

12.6 Chair's Report
Chair Rogers spoke to the Virtual Trust Council meeting held last week. Work continues
with Governance Report and a Governance Committee has been formed. There was a
presentation by the province regarding the development of a Coastal Marine Strategy.
IT Policy Statement Review has been sent to staff to redraft: to simplify language, clarify
and bring First Nations more into decision process. Elections to be held on 10 out of 12
islands on October 15, 2022.
12.7 Trustee Report
Trustee Dodds reported that questions from community have increased. Issues include
responsibilities and rights on foreshore, concerns regarding Wood Dale Drive,
substandard housing. Added that more population brings more development which
increases frustrations. Water Districts maintained during the summer. Suggested a
community information session to detail “How things function.”
Trustee Maude spoke to a recent gathering with First Nations which was followed by a
get together with Japanese families. Historical perspectives were fascinating and
touching. Fall Fair was an overwhelming success and renovations to Thrift Store are
coming together.
12.8 Islands Trust Conservancy Report - None
12.8.1 Islands Trust Conservancy Plan
LTC complimented the document. Accomplishments over the years are most
impressive. IT Conservancy a steward of the “preserve and protect” aspect of
IT.

13.1 Water Storage Tank Siting Safety
There have been concerns raised regarding safety/inspection of storage tanks.
Understanding is that tanks for over 300 gallons require a building permit.
Planner Chadwick will investigate and report back to LTC.
13.2 Uses on Foreshore
Discussion as to how best to explain what’s allowed/not allowed on foreshore – what
are the rights and responsibilities: could prepare an information package to mail out to
residents.

15. TOWN HALL
Deb Foote spoke to alternate times for meetings with community: evenings, weekends.
This is difficult due to staff travel and time. Meetings can be taped and accessed through IT web
site.
Nikko Preston questioned MoTI and water issues: management of run-off, storm water. Is
there a plan?
MoTI would identify actions required during subdivision process and CRD would also address
through Building Permit process.
Tim Mackie stated that ditches on Lot 1 moved water to Lot 2 and Lot 3 which in turn directed it
onto Maple Drive. Questioned liability to current owner and whether development may
exacerbate the affect.
Chair Rogers reviewed the process. Prior to 2

readings of Bylaw(s) there is a CIM and a
PH after which LTC votes on Bylaw(s). There are a number of layers of approvals required for
