[0:00:07] Voice 5: always begin by acknowledging how fortunate we are to be able to gather on the traditional
[0:00:11] Voice 5: territories of the coast salish peoples i'm going to read speak from my heart but i think that claire
[0:00:18] Voice 5: brader provided us last night about this national day of truth and reconciliation is excellent so
[0:00:26] Voice 5: read what she shared with us. So tomorrow is the day, but the day honors the children who never
[0:00:33] Voice 5: returned home and survivors of residential schools, as well as their families and communities.
[0:00:39] Voice 5: September is historically a painful month for Indigenous peoples because it was the month when
[0:00:44] Voice 5: children were torn away from their families to return to residential school. The last residential
[0:00:49] Voice 5: school closed in 1996, and the effects of the system and the colonialization are still deeply
[0:00:55] Voice 5: deeply felt in the communities today.
[0:00:58] Voice 5: Public commemoration of the tragic and painful history
[0:01:01] Voice 5: and ongoing impacts of the resolution of schools
[0:01:04] Voice 5: is a vital component of the reconciliation process.
[0:01:12] Voice 5: So I always, whenever I speak to things that's been,
[0:01:16] Voice 5: it's been an amazing journey for me in the past four years
[0:01:19] Voice 5: and the opportunities that the trust has given us
[0:01:22] Voice 5: to deeply learn about past and what's happened.
[0:01:27] Voice 5: And it's been a deeply new personal experience.
[0:01:32] Voice 5: And I always, that's reconciliation is that it starts,
[0:01:35] Voice 5: I would say it starts here.
[0:01:36] Voice 5: It starts in our hearts as we open our hearts to learn
[0:01:40] Voice 5: and how our actions is what we can individually do
[0:01:44] Voice 5: that then grows to what we do as a committee
[0:01:46] Voice 5: and what we do as an organization.

[0:02:02] Voice 5: Okay. I'm Laura Patrick. I'm elected on Salt Spring Island. I'm chair of this local trust committee, and I'm honored to be joined today by Trustee Deb Morrison and Trustee Ben McConkie, and together we make up your North Pender Island local trust committee.
[0:02:16] Voice 5: This meeting is an official forum for your local trust committee to make decisions about land use planning matters and discuss relevant business.
[0:02:22] Voice 5: I also want to add that this is a place of employment, despite the fact some of our employees may be coming from their own homes.
[0:02:30] Voice 5: They have the right to a safe and respectful workplace.
[0:02:34] Voice 5: This isn't like we are live streaming and we are recording and sometimes the Wi-Fi and other things go sideways.

[0:04:33] Trustee McConchie (probable): and challenging terms in the history
[0:04:36] Trustee McConchie (probable): of trustees for North Pender.
[0:04:38] Trustee McConchie (probable): With local election season upon us,
[0:04:40] Trustee McConchie (probable): I'd like to recognize the hard work and efforts
[0:04:43] Trustee McConchie (probable): of my co-trustees, Deb Morrison and Chair Patrick.
[0:04:45] Trustee McConchie (probable): It has been a challenging and rewarding term,
[0:04:47] Trustee McConchie (probable): as I just mentioned,
[0:04:48] Trustee McConchie (probable): and I appreciate the thorough and thoughtful deliberations
[0:04:50] Trustee McConchie (probable): we've had during our meetings.
[0:04:52] Trustee McConchie (probable): I have a tremendous respect for anyone who dedicates their life to public service, and I'd like to congratulate those candidates who have put their names forward to be trustees next term.
[0:05:03] Trustee McConchie (probable): I, personally speaking for myself as trustee, have heard from the community that our land use bylaw review required further consultation before taking the bylaws to first reading.
[0:05:11] Trustee McConchie (probable): As a result of this, the future of this project will be determined by the next set of trustees.
[0:05:16] Trustee McConchie (probable): In that spirit, I believe it is important that you ask the candidates the following
[0:05:21] Trustee McConchie (probable): questions to ensure they take a stance and reveal their understandings of the complexities
[0:05:26] Trustee McConchie (probable): of governing North Panther Island.
[0:05:29] Trustee McConchie (probable): First question.
[0:05:30] Trustee McConchie (probable): What amendments would you make to the land use bylaw as proposed by our trust committee?
[0:05:37] Trustee McConchie (probable): Would you take the current bylaws to first reading after the new term begins?
[0:05:41] Trustee McConchie (probable): If you were to propose amendments, what specifically would you revise and why?
[0:05:47] Trustee McConchie (probable): Another question. What is your position on the trust advocating the province for more
[0:05:51] Trustee McConchie (probable): regulations regarding tree cutting? If you're against this advocacy work, can you please
[0:05:56] Trustee McConchie (probable): explain your reasoning? The trust council will resume work on the policy statement in the new
[0:06:01] Trustee McConchie (probable): term. What direction will you provide a trust council to revise the outdated policy statement?
[0:06:06] Trustee McConchie (probable): What should be included in the policy statement in your opinion? And lastly, what is your position
[0:06:12] Trustee McConchie (probable): regarding the local trust committee's implementation of a groundwater potential implementation of a
[0:06:18] Trustee McConchie (probable): groundwater development permit area if you're not in favor of a groundwater development permit area
[0:06:24] Trustee McConchie (probable): can you please explain your reasoning and what you would do as a trustee protect to protect
[0:06:29] Trustee McConchie (probable): groundwater as well as our reservoirs the trust will begin its governance review committee work
[0:06:34] Trustee McConchie (probable): in the new term what is your vision for how the islands trust trust governance should be
[0:06:39] Trustee McConchie (probable): structured or improved and i i mean there's a lot of hard questions but i really think it's
[0:06:44] Trustee McConchie (probable): important if a trustee can't answer those questions or a candidate excuse me um i i
[0:06:49] Trustee McConchie (probable): i would certainly hope that they would become more educated in the workings that we work
[0:06:54] Trustee McConchie (probable): extraordinarily hard on because we've just made a decision to not make this about our term but make
[0:06:59] Trustee McConchie (probable): this about the continuity between our two our different uh terms so i just wanted to mention
[0:07:06] Trustee McConchie (probable): that thanks for letting me take all the time here and i hope folks get a chance to ask these
[0:07:10] Trustee McConchie (probable): questions in the community in the upcoming election thank you for listening to my report
[0:07:16] Voice 12: yeah so uh that's been a bit of a fun term um i do want to point out that one of the things that
[0:07:25] Voice 12: happened in this term at trust council which we aren't always noticing in the local trust space
[0:07:31] Voice 12: was they'd been actually advocated, I think, in January of the very first year of the term
[0:07:37] Voice 12: for virtual meetings. And this was prior to COVID. And so the irony is that there are lots
[0:07:44] Voice 12: of challenges like in doing that at the time and lots of, you know, resistance for various reasons
[0:07:50] Voice 12: that I think had reason. And then given how COVID impacted the world, things just radically
[0:07:55] Voice 12: turned around a dime. Suddenly we're all doing virtual meetings. But the thinking was there
[0:08:00] Voice 12: before that so i think that that's a really good thing um i also really enjoyed working with this
[0:08:04] Voice 12: trust council or this local trust committee and um just having a more civilized space on north pender
[0:08:12] Voice 12: because i know that you know we've had difficulties on our fender having civil discussion
[0:08:17] Voice 12: and i actually i'm glad that both these gentlemen are in the room because the last meeting i heard
[0:08:21] Voice 12: um one of the people in the meeting say and quote somebody else in the meeting that historically
[0:08:27] Voice 12: Historically, they actually had been very much at odds with, and maybe in values and everything else are actually very much at odds with, but that they're listening to each other is really immensely important.
[0:08:37] Voice 12: So I'm really happy for the civilized debate that we're having here, even while we disagree.
[0:08:43] Voice 12: Disagreement's not an issue.
[0:08:44] Voice 12: Listening to each other, definitely important.
[0:08:48] Voice 12: In terms of things that are going on in the world, we actually have had a meeting relatively recently, so I think the updates for that are pretty good.
[0:08:55] Voice 12: we'll talk about the future meetings shortly um and i don't think given that i'm running for trust
[0:09:00] Voice 12: again i don't think it's appropriate for me to talk about the election right now but um please
[0:09:05] Voice 12: do vote i think that's something i can say please get out and vote be informed please ask questions
[0:09:11] Voice 12: and be informed about all the candidates thank
[0:09:15] Voice 5: you for patrick and uh i absolutely enjoyed getting
[0:09:22] Voice 5: to know north pender i'm getting up at 5 20 in the morning and trying to get out of the house
[0:09:29] Voice 5: and catch a ferry and all the equipment and all of that but you know like this morning i walked
[0:09:34] Voice 5: out of the house and the sky and the stars were the most brilliant i have seen them in a long
[0:09:39] Voice 5: time i stopped halfway to the car and just looked up but it's it's been like whales and everything
[0:09:46] Voice 5: else that i've had to experience every trip has had nature jumping out at me at some point
[0:09:52] Voice 5: along the way and it's been very fun to get to know you and to know work closely with the trustees
[0:09:58] Voice 5: here. I should add, we had a, not to bring in the candidate things, but yesterday there was
[0:10:08] Voice 5: something on Salisbury, but before it, the former CEO of Islands Trust, Linda Adams, gave
[0:10:14] Voice 5: just an overbrief of how local government works on the island. And
[0:10:20] Voice 1: I know I've
[0:10:20] Voice 5: heard a lot of
[0:10:21] Voice 5: people say wow they learned something from the audience that was watching this on what is the
[0:10:26] Voice 5: crd what is the island stress how they work so my secret powering representation for having someone
[0:10:33] Voice 5: do that on the islands because that's a good question to people is exactly how does this work
[0:10:39] Voice 5: and it does um so the the trust council they just did meet in uh september here and the trust council
[0:10:50] Voice 5: did make some direction to staff on some of the next provisions of the Trust Policy Statement,
[0:10:57] Voice 5: which will be picked up by the next term. So I think they're going to be in a good place to
[0:11:02] Voice 5: carry on with the Trust Policy Statement as they get up and running. The first meeting of the new
[0:11:08] Voice 5: term of Trust Council has been moved. There were some hiccups. I don't know what happened there.
[0:11:15] Voice 5: there. It's affected a lot of people, including me, but that's
[0:11:19] Voice 5: the thing. We all were affected. But the meeting is going to be
[0:11:22] Voice 5: November 17, 18 and 19. This is an in person meeting. I know
[0:11:27] Voice 5: they are typically live streamed as well. But it's going to be in
[0:11:31] Voice 5: Victoria on those dates. So if you're interested in that
[0:11:34] Voice 5: meeting, pay attention to those dates. And that's really my
[0:11:38] Voice 5: report.

[0:11:39] Voice 12: I add one last thing?
[0:11:40] Voice 5: I totally forgot
[0:11:40] Voice 12: that we had Trust Councils. So I was actually, I helped facilitate the session on the Trust Policy Statements, Chair of the Trust Programs Committee. And it was really helpful, I think, to just compile and synthesize the thinking that's gone on this term so that it can carry forward into the next term.
[0:12:00] Voice 12: I really do encourage folks to attend the first meeting of Trust Council. It's in Victoria,
[0:12:05] Voice 12: it's not that far away if you can manage it, and to submit delegations. And if you can,
[0:12:10] Voice 12: we'll try to get information out about those because it's a little bit later,
[0:12:14] Voice 12: we'll have a little more time to get those delegations out, but approximately three weeks.
[0:12:19] Voice 12: So just really make sure you get a delegation in because I
[0:12:22] Voice 12: think there's a lot of folks that have
[0:12:23] Voice 12: opinions about the Trust Policy Statement and they should be heard by the Council.
[0:12:28] Voice 12: Council. So really encourage that early and frequently, frankly. And then the moving of
[0:12:39] Voice 12: the meeting. So the moving of the meeting was some type of technical when Wednesday's fall
[0:12:46] Voice 12: problem. So it has been moved. I will be there. I know many of you know that I'm going to the
[0:12:51] Voice 12: United Nations meeting in Egypt this year, but I've worked it out with the chair of the trust
[0:12:57] Voice 12: tonight will be there so um i'm glad it landed on the 17th that way all
[0:13:04] Voice 5: right okay so um now we
[0:13:08] Voice 5: we're gonna remove the item about meetings which is the uh we have two things we have the scheduled
[0:13:13] Voice 5: meeting for the october 1st and then the upcoming meeting so trustees did you yes
[0:13:19] Voice 12: so october 1st
[0:13:21] Voice 12: meeting first yes okay do you want to talk to that at all um
[0:13:25] Trustee McConchie (probable): there's not not much to talk about other
[0:13:28] Trustee McConchie (probable): Other than October 1st proved to be challenging for our chair to attend.
[0:13:32] Trustee McConchie (probable): It proved to be challenging for staff to attend.
[0:13:35] It proved to be challenging because Mr. Willingham passed away this week.
[0:13:40] Trustee McConchie (probable): Ellen Willingham's husband, he was a big part of the Anglican Church,
[0:13:47] Trustee McConchie (probable): and he's having a service here, and they requested to have it here on Saturday.
[0:13:50] Trustee McConchie (probable): And apparently there's also a precedent that if there is a funeral,
[0:13:53] Trustee McConchie (probable): it takes precedent over any other event.
[0:13:56] Trustee McConchie (probable): So then, therefore, I'd like to move that North Penner Island Local Trust Committee reschedule the October 1st community information meeting to whatever you're available for.

[0:14:36] Voice 12: So I agree that there's too many complications to try to organize that meeting in a timely, thoughtful way.
[0:14:45] Voice 12: And I also had a deep conversation with staff about this.
[0:14:49] Voice 12: And because of the complexity of the land use bylaw, it's actually, and the fact that it's going to roll into the next term,
[0:14:54] Voice 12: it's better that that community information meeting, now that we know that it's going to roll,
[0:14:59] Voice 12: Be have all the new trustees listening to that conversation, so we don't
[0:15:02] Voice 12: want community members to have to come out twice on the same topic, and so it can be more thoughtful and coordinated.
[0:15:08] Voice 12: With all the new trustees there, so you know we
[0:15:11] Voice 12: wanted to get as much wrapped up as we can into the biology for it, we pass it forward, but that particular issue seems to be like more of a sticky issue and we really want the new trustees to hear from you, the people who live there okay.
[0:15:23] Voice 12: Okay. And I see new trustees hoping that I'm one of them.
[0:15:30] Voice 12: And then one other piece is if we go ahead and do this,
[0:15:35] Voice 12: I really want to make sure that we put it on file, like on the record,
[0:15:38] Voice 12: that we send a direct communication to anybody who has contacted us about
[0:15:42] Voice 12: from McKinnon Road to make sure that they know that they're being heard
[0:15:47] Voice 12: still, but that it's going forward into the next term.

[0:24:58] Voice 11: it in the context of bylaw 103 and what we're asking is two simple things one to add a definition
[0:25:08] Voice 11: of farm stating farm means a farm operation on a lot that is zoned for agriculture as a principal
[0:25:16] Voice 11: permitted use that makes it clear that it has to be zoned for agriculture before it can be
[0:25:24] Voice 11: considered a farm and the second is to change section 3.4.4 of bylaw 103 to delete the word
[0:25:35] Voice 11: farm and substitute the word agricultural because it's become clear that the planners
[0:25:43] Voice 11: continue to interpret section of the Act that allows farming to be a use on rural residential land.
[0:25:53] Voice 11: They interpreted horticulture and livestock keeping to be farming.
[0:25:59] Voice 11: And that means that the Right to Farm Act then kicks in and would apply,
[0:26:05] Voice 11: and would overturn most of the zoning that goes on in that section.
[0:26:10] Voice 11: So it's really important that this be done and it be done now, so that ongoing, there isn't any confusion about whether or not farming is allowed on rural residential lands.

[0:26:29] Voice 11: We're not changing anything. We're just clarifying that for the purposes of zoning, farming does not take place on rural land.

[0:34:43] Voice 1: Thank you, Chair Patrick. So the development permit application is to permit
[0:34:49] Voice 1: development and land alteration that includes restoration planting to protect a significant
[0:34:54] Voice 1: archaeological site an ancestral burial site from erosional laws and sorry and loss which is located
[0:35:02] Voice 1: within the development permit area shoreline sorry shoreline development permit area part
[0:35:09] Voice 1: of the associated islands on little shell island which is located just off cm harbor
[0:35:18] Voice 1: Referencing figure two in the staff report, the development would include or does include construction of a stack boulder wall, seawall up to 1.5 meters high and approximately 22 meters in length.
[0:35:32] Voice 1: And that would be contiguous with the shoreline on either side of the northern projection of the small island.
[0:35:38] Voice 1: And it would also include backfilling of the seawall, placement of topsoil, and restoration planting of the area with native species.
[0:35:47] Voice 1: So the applicants were required to contract, or they did contract, sorry, an archaeological impact assessment late last year after they purchased the island for a survey of the registered archaeological site.
[0:36:03] Voice 1: and that involved the participation of the Say Out First Nation
[0:36:06] Voice 1: and identified evidence of erosion of soils and exposed remains
[0:36:11] Voice 1: and made recommendations for urgent mitigation to protect the site
[0:36:17] Voice 1: from further erosion and potential loss of remains.
[0:36:24] Voice 1: So a site alteration permit was issued under the Heritage Conservation Act
[0:36:30] Voice 1: Act in December of last year for those measures, and in communication with staff, the SAO requested
[0:36:37] Voice 1: the protection of the works be expedited due to the critical exposed state in some areas.
[0:36:45] Voice 1: With that urgency, the works were initiated on August 29th of this year, and as such,
[0:36:51] Voice 1: the issuance of this permit will be retroactive if approved. The applicant provided an update on
[0:36:57] Voice 1: the 22nd of this month noting that it has been progressing slow but steadily and that the
[0:37:04] Voice 1: structural components the rock and drainage sorry the rock wall and drainage should be completed by
[0:37:10] Voice 1: the end of this week and then planning sorry planting would be undertaken subsequent to that
[0:37:15] Voice 1: a separate archaeological impact assessment to survey the balance of the island to determine
[0:37:23] Voice 1: a possible location for a future dwelling is pending or it's underway and that may generate
[0:37:29] Voice 1: a future dp application so both the geotechnical report and environmental assessment were submitted
[0:37:37] Voice 1: in support of the application and those have been attached to schedules to the proposed efe
[0:37:42] Voice 1: with an overall condition that the um the work substantively comply with all the recommendations
[0:37:47] Voice 1: in those reports, and also another condition to limit the height and cumulative length of the seawall
[0:37:55] Voice 1: so that it is consistent or compliant with the land use bylaw regulations has been added.
[0:38:01] Voice 1: A DPA checklist confirms that all relevant DPA guidelines have been met,
[0:38:06] Voice 1: and staff's recommendation is for issuance of the development permit,
[0:38:10] Voice 1: and the rationale in support of that recommendation is that it is consistent
[0:38:15] Voice 1: consistent with the express priorities of the SAIL First Nation and that the application
[0:38:20] Voice 1: is based on professional geotechnical assessment and environmental assessment, both of which
[0:38:26] Voice 1: meet the relevant objectives and guidelines of the DPA, and that all recommendations of
[0:38:31] Voice 1: those assessments have been incorporated into the proposed DPA.

[0:49:01] Voice 1: I mean, basically, these are the requirements that sit within the actual development permit area.
[0:49:07] Voice 1: So, staff was not being heavy-handed or overly bureaucratic by requiring these.
[0:49:12] Voice 1: And I would say that you, speaking to streamlining, if we are in a point of time, let's say, for instance, you would set your delegation bylaw and give a third reading and approve it, this would have not been a retroactive permit.

[0:54:06] Voice 12: what it should look like. Granted, it should be much more streamlined and we're working on that.

[0:55:22] Voice 12: missed it have you accounted for the um increased two things one the increased intensity of storms
[0:55:30] Voice 12: were likely to receive here that seems like it in the engineering the way it was done and then to
[0:55:36] Voice 12: the um increased sea level rise issues that we're facing they're minimal in this area relative to
[0:55:42] Voice 12: other areas but they are here and productive so can you comment on any of that yeah that's it's
[0:55:47] Voice 13: not necessarily something that we went or when we approached rising geotechnical it's not something
[0:55:52] Voice 13: that we had thought about beforehand and so you know as I also read their report it's not clear
[0:55:58] Voice 13: that that's specifically mentioned yeah but based on the location of this small peninsula on little
[0:56:06] Voice 13: shell the currents the tidal action the waves even human impact because it is a very small
[0:56:14] Voice 13: island that a lot of kayakers and people tend to stop on based on a lot of these natural factors
[0:56:19] Voice 13: and human factors, that's primarily the basis for this construction design.
[0:56:25] Voice 13: And the green shores had been discussed with RISEX just, you know,
[0:56:29] Voice 13: between the amount of time that it takes sometimes to develop that style of shore protection
[0:56:33] Voice 13: and just the imminent danger that these remains are in right now,
[0:56:38] Voice 13: it was just determined that a boulder-style seawall would provide, again, longevity
[0:56:44] Voice 13: and long-term protection as opposed to green shores that may eventually,
[0:56:48] Voice 13: even in time also break down yeah

[1:00:04] Voice 6: which is the strata corporation for the southern portion of sydney island
[1:00:09] Voice 6: um and what they're proposing is an amendment to the associated islands land use by law
[1:00:14] Voice 6: and what they've applied for it's an amendment to the regulations in the associated land use
[1:00:19] Voice 6: associated islands land use by law as it would affect just sydney island
[1:00:23] Voice 6: and the impetus for the application is issues that have arisen on Sydney Island over the last
[1:00:31] Voice 6: few years with the use of recreational vehicles, RVs, as temporary accommodation
[1:00:38] Voice 6: for straddle homeowners on the island and issues that have arisen both with Strata Corporation
[1:00:45] Voice 6: about this and then also through by-law enforcement as well. So the current by-law
[1:00:52] Voice 6: is a prohibition on the use of recreational vehicles on sydney island and strata corporation
[1:00:57] Voice 6: has gone through an extensive consultation process internally and uh there's an attachment that
[1:01:02] Voice 6: details that and that determines as well here today you can talk more about that
[1:01:07] Voice 6: um and staff have been in contact with the strata council periodically over the last year or so to
[1:01:14] Voice 6: discuss options for addressing this issue we discussed another number of options including
[1:01:20] Voice 6: including just compliance agreements
[1:01:22] Voice 6: with individual straddle lot owners,
[1:01:26] Voice 6: approaching the local trust committee for review
[1:01:29] Voice 6: of like an LTC initiated review of the bylaw,
[1:01:34] Voice 6: just leaving it up to individual straddle lot owners
[1:01:36] Voice 6: to apply for temporary use permits
[1:01:38] Voice 6: for their use of their RVs,
[1:01:40] Voice 6: or making a land use bylaw amendment application
[1:01:45] Voice 6: by the straddle lot corporation.
[1:01:46] Voice 6: And that's the option they've chosen.
[1:01:48] Voice 6: There's also a number of other sort of issues or potential amendments that were raised by
[1:01:55] Voice 6: Estrada as part of this application, including use of sleeping cabins or monkeys.
[1:02:02] Voice 6: The one permitted accessory storage building current bylaw may not be adequate for the
[1:02:13] Voice 6: use of owners looking at options for developing their lots and then there's also an issue with the
[1:02:21] Voice 6: in some existing hunters cabins as they're referred to on the island in this common
[1:02:27] Voice 6: property they're coming to the end of their life and so um potential amendments for that as well
[1:02:35] Voice 6: um so the report goes through the you know the various options for approaching this
[1:02:43] Voice 6: but essentially the recommendation is that the LTC proceed with considering an amendment
[1:02:50] Voice 6: to the associated alliance land use bylaw
[1:02:53] Voice 6: and that it consider this bylaw would look at
[1:02:58] Voice 6: allowing RDS as a temporary alternative to a dwelling but limit the length of time
[1:03:05] Voice 6: that they could be used. Also amend the zoning to permit the hunters cabins on the common property
[1:03:14] Voice 6: to have a common kitchen. That would also provide some alternate accommodation
[1:03:18] Voice 6: for owners prior to building. And also look at amending the current regulations
[1:03:26] Voice 6: for the storage building, it's very limited in what it can be used for currently, storage
[1:03:35] Voice 6: building to be constructed prior to building the dwelling, and looking at expanding that
[1:03:39] Voice 6: and allowing washrooms, toilets, obviously connected to a septic system, so that that
[1:03:49] Voice 6: could be constructed prior to the dwelling being constructed.
[1:03:54] Voice 6: So, as I
[1:03:54] Trustee McConchie (probable): said, the recommendation
[1:03:55] Voice 6: is to direct staff to proceed with developing a draft by-law
[1:04:01] Voice 6: if they want to the local trust committee.

[1:04:37] Voice 7: on a number of levels we want people to get to know their properties before they start developing
[1:04:42] Voice 7: because what we see is we see other than the perimeter zones that you're not allowed to cut
[1:04:47] Voice 7: trees we see these these clear cuts happening and and uh it's because people are in a rush to get a
[1:04:54] Voice 7: house built and they don't really know where they want to build a house so they just clean an entire
[1:04:59] Voice 7: lodge or close to an entire lot and make makes a mess of the island um we want to avoid that
[1:05:04] Voice 7: our our bottom line here is we want to have alternate accommodations pre-built
[1:05:08] Voice 7: uh not forever but for for a fixed period of time and the island came up with a recommendation of
[1:05:15] Voice 7: four years and that typically would give somebody an opportunity to be there um several several
[1:05:22] Voice 7: seasons and several several years to um to review and decide on their on what they want to do with
[1:05:29] Voice 7: their property and where to site their house and and uh structure um uh as i walked in the door
[1:05:38] Voice 7: or today, I think Trustee Morrison was reading my mind
[1:05:44] Voice 7: because she mentioned a review
[1:05:47] Voice 7: of the official community plan,
[1:05:49] Voice 7: and that couldn't be more appropriate as well
[1:05:54] Voice 7: for our circumstances.
[1:05:56] Voice 7: The island's changed in many ways.
[1:05:58] Voice 7: It started off, well, it was 10 or 15 years ago,
[1:06:02] Voice 7: it started off as a millionaire vacation home island,
[1:06:06] Voice 7: and there was no modest buildings on there at all.
[1:06:10] Voice 7: It was anything that was built there was multimillion dollar.
[1:06:13] Voice 7: And think of the context of that 10 years ago,
[1:06:15] Voice 7: or 10 years ago, everything's a million dollars now.
[1:06:19] Voice 7: But the island has changed significantly
[1:06:22] Voice 7: from having zero full-time residents
[1:06:24] Voice 7: to now having about 20 full-time residents.
[1:06:26] Voice 7: And that trend seems to be continuing.
[1:06:30] Voice 7: So the demographic has changed significantly.
[1:06:32] Voice 7: the island stewardship has changed significantly too.
[1:06:38] Voice 7: We have a protocol with the Say What Nation
[1:06:41] Voice 7: for reburial, for example.

[1:11:18] Voice 7: right we were in that position when we built we started off my wife and i wanted a one bedroom

[1:11:31] Voice 7: were not there to have a another two bedroom monkey for example that would allow us to

[1:16:29] Voice 7: of those exist online there's two there's two remaining one was taken down because it was
[1:16:34] Voice 7: unserviceable and the other two getting close to so would that if the changes to this would allow

[1:16:41] Voice 6: but it would allow uh kitchen facilities cooking facilities

[1:20:10] Voice 7: complaints um on on trailers or recreational vehicles that have been tolerated some of them
[1:20:17] Voice 7: have been there for years uh and and some of them barely use some of them some of them use regularly
[1:20:23] Voice 7: So, there was general agreement on the island that we don't want RVs on there forever, but there is a time and a place for them.
[1:20:35] Trustee McConchie (probable): So, that's interesting. So, one person went around your island making complaints about an RV and categorizing things.
[1:20:43] Trustee McConchie (probable): We don't know anything about that one person on North Pender going around with petitions and stuff.

CALL TO ORDER Chair Patrick called the meeting to order at 10:00 am. She acknowledged that the meeting was being held in traditional territory of the Coast Salish First Nations and spoke to Friday being the National Day for Truth and Reconciliation. 2. APPROVAL OF AGENDA Item 16 to be discussed after Item 4. By general consent the agenda was adopted as amended. 3. TRUSTEE REPORT Trustee McConchie expressed appreciation and thanks to Local Trust Committee (LTC), staff, everyone who participated and stated that this term has been rewarding, challenging and historical. He detailed a number of questions voters should ask candidates. Trustee Morrison spoke in appreciation of the thoughtful discussions and that participants listen to each other. Noted the importance of being informed when voting. She encouraged attendance at the first Trust Council meeting as there will be discussion regarding the Trust Council Policy Statement. 4. CHAIR'S REPORT Chair Patrick reported that Trust Council directed staff to review Trust Policy Statement: to clarify some terms, definitions, etc. The first Trust Council meeting will be November 17-19 and A D O P T E D North Pender Local Trust Committee Regular Business Meeting Minutes September 29, 2022 ADOPTED Page 2 of 8 will be an in-person meeting in Victoria. She spoke to enjoying the opportunity to get to know North Pender and to work with the Trustees. 5. TOWN HALL AND QUESTIONS Dorothy Murdoch spoke to proposed changes for C2 zoning for rental housing and offered a number of suggestions. At the August Special Meeting maps had changed with no notification. Water from Driftwood Center identified as an issue with no consultation. She spoke against removing Tourist Accommodation and would request LTC reconsider and reinstate. Joyce Thayer referred to a number of submissions she had made regarding Bylaw No. 103 and is asking LTC to add: definition of a farm and in 3.4.4 substitute word farm with agriculture. This would clarify farming not allowed on residential lands. Michael Sketch raised 2 points: 1. LUB Project – policies missing in Official Community Plan (OCP). Need to check Trust Policy Statement is reflected in OCP. Asked if LTC will amend OCP which limits development in areas with water issues. 2. CORRESPONDENCE Correspondence received concerning current applications or projects is posted to the LTC webpage 12. APPLICATIONS AND REFERRALS 12.1 NP-DP-2022.3 (Little Shell Island) Planner Testemale reviewed the application. The land is a significant First Nations historical site which is being compromised by erosion. He noted the reports and efforts taken to date by the owner and that all guidelines and conditions in the application have been met. The work has been initiated as there is urgency to protect the area before winter storm season as requested by the Tsawout First Nation. He added that LTC approval of application is retroactive – as staff was unable to add application until this meeting. The applicant and consultant verified that work is progressing, revegetation will be with native plants and work to date satisfies the Development Permit. Discussion: Concerns raised regarding retroactive approval; LTC should be notified immediately when First Nations are a party to an application in light of reconciliation efforts; Need to streamline process to protect Archaeological sites; Geotechnical and Environment Reports completed; If Delegation Bylaw had been in place, application could have been completed earlier; Critical to protect archaeological sites; Recognition of owner reaching out to First Nations; Construction design based on human and natural factors – boulder style sea wall; and Permit addresses need to maintain/repair with climate change impacts. CARRIED The applicant expressed appreciation for support and assistance of Planner. 12.2 NP-RZ-2022.1 (Sidney Island) RPM Kojima reviewed the application which is for an amendment to North Pender Associated Island Land Use Bylaw (LUB) regulations. Recommendation is to amend North Pender Associated Islands LUB to allow recreational vehicles for accommodation for a limited time period, to allow kitchens in hunters cabins/sleeping cabins and to increase maximum floor area for storage buildings. Applicant (delegated by Stata) spoke to changes on island. Need for owners to spend time on property to determine best building site and to be able to stay on site while building. There are no visitor accommodations on the island. Recommendation is for alternate accommodation period to be 4 years. RPM Kojima stated that as proposed there is no need to change OCP. The last review in 2013 included significant amendments for Sidney Island. Discussion: Years ago owners tended to build large dwellings for families/visitors; Cottages have not been permitted – converted to dwellings; Most lots approximately 2 acres; Demographics of island have changed; Interest in smaller houses with bunkies; Consider aggregate square footage; and Stata Council can regulate usage. NP-2022-116 It was Moved and Seconded, that the North Pender Island Local Trust Committee request staff to prepare a draft bylaw to amend North Pender Associated Islands Bylaw No. 148, 2003, as it pertains to Sidney Island, to allow residential use of recreational vehicles for a limited period, to permit kitchens in existing hunters’ cabins, and to amend the maximum floor area of permitted storage buildings.
