[0:04:05] Trustee Fast (probable): everybody's got a right to a safe and respectful workplace and all voices are welcome and the more
[0:04:11] Trustee Fast (probable): we can have a input from everybody then the better the discussion and the better the decisions so we

[0:07:59] Trustee Morrison (probable): conversations in Facebook to be really valuable, and so have been thinking more about how to use
[0:08:05] Trustee Morrison (probable): that space to communicate going forward. So really enjoyed that, and also noticed that
[0:08:11] Trustee Morrison (probable): uh trustee mcconkey put up a salish sea governance uh space for people to keep tabs on and and keep
[0:08:18] Trustee Morrison (probable): aware of work across the region so i did put that in the pender post this month um and flagged it
[0:08:24] Trustee Morrison (probable): for folks so you can keep track of all different issues going on um and just a huge thank you ben
[0:08:31] Trustee Morrison (probable): as a colleague it's been really great working with you on this ltc and i know we haven't always
[0:08:36] Trustee Morrison (probable): always agreed but it's been really good I think respectful conversation and and I've learned a lot
[0:08:42] Trustee Morrison (probable): so it's been really awesome to work with you so yeah I think going forward we'll we'll have a few
[0:08:49] Trustee Morrison (probable): conversations today but again just really I know it's been a challenging term we we can't forget
[0:08:56] Trustee Morrison (probable): that we have dealt with a global pandemic during this term switching over to virtual formats like
[0:09:03] Trustee Morrison (probable): like just the stress that everybody has been under
[0:09:05] Trustee Morrison (probable): on so many different fronts.

[0:10:21] Trustee Fast (probable): um the upcoming uh uh trust council uh meeting is beginning to uh be on boarded people are starting
[0:10:34] Trustee Fast (probable): to get their um orientation materials especially new uh newly elected folks so the first meeting
[0:10:41] Trustee Fast (probable): is november 17th to 19th in victoria where we'll get to meet each other and uh and um
[0:10:50] Trustee Fast (probable): begin to find our way into our new relationships with new folks and elections and things like that
[0:10:57] Trustee Fast (probable): will be held for committee chairs and executive committee sorry executive committee and that kind
[0:11:05] Trustee Fast (probable): of thing then there's an online trust council and that one will be hybrid too and both of these I
[0:11:12] Trustee Fast (probable): I think the public can attend.
[0:11:14] Trustee Fast (probable): The next one is December 6th to the 8th.
[0:11:18] Trustee Fast (probable): That'll be online.
[0:11:19] Trustee Fast (probable): And then local trust committees meetings all across the trust area will resume in 2023 in the new year.

[0:12:33] Voice 12: My name is Joyce Thayer. I'm a full time resident on Pender Island.
[0:12:37] Voice 12: I live on North Pender on the area of Clambay Road by Hope Bay.
[0:12:44] Voice 12: And I have made a number of submissions to the trustees on the issue that I'm addressing today.
[0:12:53] Voice 12: Briefly, Trustee Fast, what happened is there is a, what we consider to be an over-height building that's been approved in our area that we feel was incorrectly approved.
[0:13:09] Voice 12: We have worked diligently with the trustees to amend the new bylaw to make sure this would not happen, but we're left with the old bylaw now.
[0:13:20] Voice 12: And we've been told that to amend the bylaw to address this issue, to clarify it, I want to make clear, we're not asking to amend it, but to clarify it, we'll take a full amendment process.
[0:13:34] Voice 12: process so what we've suggested is that to address this issue because it's going to drag on now it's
[0:13:44] Voice 12: going to be before the new year before the new trust Council meets that we'd ask for a legal
[0:13:50] Voice 12: opinion on the interpretation of that issue we feel it's something that should have been done
[0:13:57] Voice 12: before the permit was approved we're not criticizing anybody here we're just looking
[0:14:03] Voice 12: for a solution moving forward and we feel after we did an foi request on the documents we've
[0:14:11] Voice 12: reviewed them where if we remain confirmed that it was an incorrect interpretation so we're asking
[0:14:20] Voice 12: moving forward that the trustees go back ask their legal counsel for an opinion on this
[0:14:27] Voice 12: and clarify what we feel is a mistake and again this is not a criticism of anybody it's a way of
[0:14:37] Voice 12: moving forward without having the bylaw amended so thank you again for your consideration and if

[0:15:50] Voice 10: is michael sketch i live on north pender island um and i'd like to
[0:15:55] Voice 10: make comment on uh what to me were some surprising uh new initiatives or changes in the land use by
[0:16:02] Voice 10: law staff report for the project and in addition a resolution and I wonder if this isn't the one
[0:16:12] Voice 10: that Deb Morrison was speaking to and the extent of the new project I think it's number four for
[0:16:20] Voice 10: North Pender being the browning marina to driftwood corridor and I understood from the last meeting
[0:16:31] Voice 10: I think it was that Deb Morrison felt this was not about a village, but rather specifically about a transportation plan.
[0:16:40] Voice 10: And the project description is now present and future uses of that land, which, by the by, is in the Agricultural Land Reserve, and tacked on the end, a transportation plan.
[0:16:56] Voice 10: and I wonder if the trustees could have a bit of a discussion about that and resolve the wording.
[0:17:02] Voice 10: There is consequence, of course, for the next term. And secondly, there's a recommendation
[0:17:11] Voice 10: from staff, which as far as I know is new, to omit the setback distances, specifically from
[0:17:19] Voice 10: from sewage disposal fields on North Tender
[0:17:22] Voice 10: from various entities, one being a well.
[0:17:26] Voice 10: And the rationale is that the province
[0:17:30] Voice 10: already deals with this.
[0:17:32] Voice 10: And in the Trust Policy Statement project,
[0:17:39] Voice 10: many people have, or some people,
[0:17:42] Voice 10: a lobby has said,
[0:17:43] Voice 10: said, we do not need all these prescriptive policies
[0:17:50] Voice 10: in the trust policy statement because another government
[0:17:55] Voice 10: entity already deals with it.
[0:17:57] Voice 10: For instance, the Land Commission or the Vancouver
[0:17:59] Voice 10: Island Health Authority Department of the Environment.
[0:18:02] Voice 10: But on the ground, what is missing in the land use bylaw
[0:18:06] Voice 10: then is the potential for bylaw enforcement for infraction
[0:18:11] Voice 10: locally.
[0:18:11] Voice 10: locally. And secondly, that the land use bylaw or trust policy statement can be more restrictive
[0:18:20] Voice 10: than the, if necessary, on a Gulf Island, than the provincial regulation. And I asked the local
[0:18:28] Voice 10: trust committee going forward to rethink the recommendations of staff really very, very
[0:18:33] Voice 10: very carefully. I'll give one example. In 2012, Phil was placed about 200 truckloads on ALR land.
[0:18:42] Voice 10: A consultant who was working on the property at the time complained to the local trust committee
[0:18:47] Voice 10: and the staff replied that because there is no soil bylaw, bylaw enforcement doesn't
[0:18:57] Voice 10: um uh appear to be possible and nothing was done uh there are other examples um so it it appears
[0:19:05] Voice 10: to be really important that the land use bylaw contains core items um there are so many examples
[0:19:13] Voice 10: but but we all know what they are and they deal with water and valuable uh environmental entities
[0:19:20] Voice 10: um and i'll leave it at that if i may i i ask that the ltc this this session not move this uh
[0:19:29] Voice 10: land use bylaw project ahead significantly or at all and leave it for the next term because there
[0:19:35] Voice 10: are some some real concerns in the the latest staff report recommendations for the land use
[0:19:43] Voice 10: bottle review thank you very much thank
[0:19:46] Trustee Fast (probable): you michael and uh i'm going to um ask there we go
[0:19:54] Trustee Fast (probable): robin has uh pulled you back thank you robin anybody else among the attendees who would like

[0:32:36] Voice 11: There have been a number of number of changes have been made to the proposal.

[0:37:50] Voice 2: their existing deck. The extension, as you can see here, is this hashed area. And that would add
[0:37:57] Voice 2: an additional 360 square feet of deck space and the reason why the applicants chose that location
[0:38:04] Voice 2: is that it would have a limited impact on the environment there would be no requirement for
[0:38:10] Voice 2: the removal of any trees and also it's an area that wouldn't impact the neighbors nor their view
[0:38:16] Voice 2: or very minor impact too and this is a really interesting um lot in the sense that it's not
[0:38:23] Voice 2: not a typical rectangular lot and for a rectangular lot it's pretty it's easy to determine the front
[0:38:30] Voice 2: lot line the rear lot line and the side lot lines but with this property the front lot line
[0:38:36] Voice 2: it's actually the shortest lot line that abuts a roadway and so that as you can see on the screen
[0:38:43] Voice 2: here in the staff report on page 30 the front line is actually this line here at the very top
[0:38:49] Voice 2: The other two lot lines that abut the roadways are considered exterior side lot lines.
[0:38:57] Voice 2: So those have a setback of 4.5 meters.

[0:39:47] Voice 2: on the neighboring properties are minimal as the location of the deck is screened by a fence
[0:39:53] Voice 2: and also vegetation. You can see that here on the screen. This is a picture that I took while
[0:40:03] Voice 2: on a site visit. And this is a southern property line here. So there is a fence and quite a bit
[0:40:09] Voice 2: of vegetation. And the red circle is the location of the proposal of the deck there, the new
[0:40:15] Voice 2: extension and this is the area of the house that's located in the the rear lot line setback so there
[0:40:22] Voice 2: were dvp notices circulated to the surrounding property owners and residents we have the
[0:40:29] Voice 2: applicant also provided three letters of support as part of the application process two of those
[0:40:36] Voice 2: letters of support are from direct property our neighbors so the neighbor to the south and the
[0:40:43] Voice 2: neighbor to the west they are supporting this variance application no other submissions were
[0:40:48] Voice 2: received due to the notice other than the three that were included in the application process
[0:40:53] Voice 2: or package pardon me so staff have made a recommendation which is on page page 27 of
[0:41:03] Voice 2: the staff report and that's to approve the issuance of the development variance permit

[0:46:27] Voice 2: use permit for a short-term vacation rental or an stvr the purpose is to rent out a single family
[0:46:37] Voice 2: dwelling unit located in magic lake it's on y'all lane and it's a waterfront property it's a
[0:46:43] Voice 2: three-bedroom home that has a floor area of 1500 square feet and the maximum number of guests
[0:46:50] Voice 2: permitted by the draft permit and also what the applicant has requested is six people and that's
[0:46:58] Voice 2: also compliant with the TUP guidelines. They plan to rent out less than 25 weeks of a year
[0:47:05] Voice 2: and will not rent out more than 30 days from May 1st to September 30th in a calendar year and again
[0:47:13] Voice 2: Again, that complies with one of the TUP guidelines.
[0:47:17] Voice 2: There is also significant screening from the neighboring properties.
[0:47:23] Voice 2: This is a site plan here.
[0:47:25] Voice 2: There is fence and extensive vegetation actually all around the property that provides some privacy for the SDBR and also the neighboring properties.
[0:47:35] Voice 2: The applicant's rationale is that their jobs are now requiring them to be more on the mainland.
[0:47:43] Voice 2: and they wish to rent out their home part-time their goal is to eventually to move to pender
[0:47:48] Voice 2: full-time um but they're not yet in a position to do so and their intent is really just to rent
[0:47:55] Voice 2: to families and to couples and they continue to use their property as much as possible
[0:48:03] Voice 2: um so in term of uh terms of cumulative impacts we refer to the tup guidelines um in the ocp
[0:48:11] Voice 2: and those state that a short-term vacation rental should not be there should be no more than two
[0:48:18] Voice 2: within a 200 meter distance and in this circumstance the closest TUP for a short-term
[0:48:25] Voice 2: vacation rental is 400 meters away. In addition if this application is approved it would be the
[0:48:33] Voice 2: 10th TUP issued in Magic Lake and a policy 6.4.18 in the OC states that there should be a maximum
[0:48:43] Voice 2: of 20. So that would be in compliance. So in terms of potential impacts of short-term vacation
[0:48:49] Voice 2: rentals on the neighboring properties are ones that we are already aware of. And those are the
[0:48:55] Voice 2: potential for noise or nuisance from renters. Of course, there could be an increase in traffic
[0:49:01] Voice 2: and also it could potentially change the the neighborhood character by having the short-term
[0:49:07] Voice 2: vacation rental use in a neighborhood location although given that the number of guests is small
[0:49:14] Voice 2: it's limited to six and also there is a limit on the days that the use could be operating during
[0:49:20] Voice 2: the summer months may 1st to september 30th and the maximum is 30 days and because there's privacy
[0:49:26] Voice 2: screening and vegetation that the impacts on neighbors hopefully would be quite minimal.
[0:49:33] Voice 2: So in terms of consultation, there were TUP notices circulated to neighboring property
[0:49:42] Voice 2: owners by mail and also hand delivered. And it was published, the notice was published in the
[0:49:48] Voice 2: Driftwood newspaper as well as posted on the community bulletins. We did receive one letter
[0:49:54] Voice 2: of support for this application that was circulated to the LTC unfortunately it was not attached to
[0:50:01] Voice 2: the staff report but it is a part of the public record staff did speak to two neighbors that
[0:50:07] Voice 2: wanted to remain anonymous and their concerns were more so for STVRs in general and not per se
[0:50:16] Voice 2: to this one specific application and I should mention as you can see on my screen here lot one
[0:50:22] Voice 2: which is a direct neighbor to this property there was a short-term vacation rental TUP issued for
[0:50:29] Voice 2: that property for the last five years and it actually expires next month but that property
[0:50:36] Voice 2: was sold in in spring of this year so that short-term vacation rental is no longer in use
[0:50:43] Voice 2: so lot one there's no longer a short-term vacation rental use on that property I just wanted to
[0:50:48] Voice 2: mention that staff did speak to a third uh person who wanted to write a letter but unfortunately
[0:50:55] Voice 2: could not so i mentioned to him that i would express his concern and really it's with regards
[0:51:01] Voice 2: to um who who monitors the use and if there's a concern what are the options so the tup permit
[0:51:13] Voice 2: permit states that the permit itself must be posted to the front of the property. So it has
[0:51:19] Voice 2: the contact information for the STV operator. And of course, if there is any concerns that the
[0:51:25] Voice 2: applicant is not compliant with the TUP, then at that point, you get the bylaw enforcement
[0:51:33] Voice 2: involved with that. So there are a couple of things the LTC may want to consider. There is
[0:51:42] Voice 2: options of adding more restrictive conditions. So the LTC could potentially restrict or pardon
[0:51:50] Voice 2: me, issue the permit because it's drafted right now for three years. So the LTC could
[0:51:56] Voice 2: reduce that to two years as an option. But staff had made the recommendation as seen
[0:52:03] Voice 2: on page 46 that the North Pender LTC should approve the issuance of the temporary use
[0:52:10] Voice 2: use permit application NPTUP 2022.3 and as the draft permit as the permit is drafted right now
[0:52:18] Voice 2: that would be issuance for three years and the rationale for staff supporting this is that the
[0:52:24] Voice 2: size of the dwelling the guest capacity of six they all comply with the TUP guidelines also
[0:52:31] Voice 2: the limiting the number of days during the summer months those comply with the TUP guidelines
[0:52:37] Voice 2: guidelines. There's been one letter of support. And the permit provides or outlines all the
[0:52:44] Voice 2: conditions that are required through the the OCP guidelines. So I'm going to leave it there.

And then the other comment is, you know, well, how about, why don't we defer it till next, till you get Aaron and the next chair in and then give Charlie and folks a month to address these concerns?

[1:02:17] Voice 1: that's coming from because not once on our street did bylaw have to show up to shut down a party
[1:02:22] Voice 1: there were no big parties at that house we live here virtually full time and that it with unless
[1:02:29] Voice 1: it's speaking to another short-term vacation rental that isn't on our street that was not the
[1:02:35] Voice 1: case for the one directly next to us it was run as a b b the owners were there almost all the time
[1:02:41] Voice 1: and not once were the police called or bylaw or any to the thing to that effect so i just want
[1:02:47] Voice 1: you to take that into consideration as far as the the uh the previous applicant next to us that was
[1:02:53] Voice 1: never the case there was never noise complaints and we were their immediate neighbors so i don't
[1:02:56] Voice 1: know where that's coming from as far as our application uh we are pender's our home we love
[1:03:03] Voice 1: it it's it's we've we've kind of cut all our ties from the city for as far as home and and set up
[1:03:09] Voice 1: our roots here uh we love our home we don't want it to become a party home and we don't want it to
[1:03:16] Voice 1: to affect the relationship that we've already built
[1:03:19] Voice 1: with all of our neighbors.
[1:03:20] Voice 1: We are, you know, we're very fire conscious,
[1:03:23] Voice 1: we're very water conservative,
[1:03:24] Voice 1: and we just want to do what's best for our community,
[1:03:28] Voice 1: but we also need to use this opportunity
[1:03:31] Voice 1: that we could potentially have
[1:03:33] Voice 1: to bring in some additional much needed income.

[1:29:01] Voice 2: for buildings and structures with some exceptions

[1:29:07] Voice 2: and 7.6 meters from the natural boundary
[1:29:11] Voice 2: of a lake, wetland or stream.
[1:29:13] Voice 2: And so increasing the setbacks without any
[1:29:16] Voice 2: like an in-depth analysis could create situations
[1:29:19] Voice 2: of legal non-conforming siting for buildings and structures.
[1:29:24] Voice 2: In addition, wetlands and streams
[1:29:25] Voice 2: are not currently well mapped.
[1:29:27] Voice 2: And so if that's something the LTC wants to review,

[1:29:34] Voice 2: where you can dedicate time doing a extensive analysis

[1:30:00] Voice 2: part of the future projects list the second item is in regards to the setback of septic septic
[1:30:08] Voice 2: systems to uh wells and sea so it's actually the sewerage system regulation that um regulates
[1:30:17] Voice 2: setbacks of septic tanks and and sewage systems to a well and this is um outlined in the regulation
[1:30:25] Voice 2: regulation that a setback for a sewage system should not be less than 30 meters from a well.
[1:30:32] Voice 2: And this regulation actually also includes items or situations where exemptions are permitted.
[1:30:39] Voice 2: And this is when a property owner hires a professional to provide their professional
[1:30:46] Voice 2: advice as to why the setback should be reduced. So it's a professional reliance model. And this
[1:30:54] Voice 2: is all through island health so staff do not recommend amending proposed bylaw number 224
[1:31:01] Voice 2: to include setback regulations for septic tanks to well because it's captured under the sewerage
[1:31:08] Voice 2: system regulation and their specific rec or exemptions that are based on that professional
[1:31:13] Voice 2: reliance model and i include a situation in my staff report that says if the ltc does include
[1:31:21] Voice 2: include a 30 meter setback for a septic tank or system to a well and the property owner actually
[1:31:33] Voice 2: receives a professional report that outlines a strong rationale for a reduction to that setback
[1:31:39] Voice 2: well then it meets the sewerage system regulation but it wouldn't meet the setback in the land use
[1:31:44] Voice 2: bylaw so really it adds an unnecessary permit process for the property owner in addition to
[1:31:50] Voice 2: they would have to pay for that application fee for a DVP or BOV.
[1:31:55] Voice 2: And that's actually the same for a setback to marine bodies.
[1:31:59] Voice 2: The sewerage system regulation, they have a standard of 15 metres
[1:32:04] Voice 2: of horizontal distance from marine bodies.
[1:32:09] Voice 2: And I'm actually going to jump to topic number four, outhouses,
[1:32:12] Voice 2: because it also references the sewerage system regulation.
[1:32:16] Voice 2: So outhouses, also known as privies, they used to be included
[1:32:20] Voice 2: in the sewerage system regulation through Island Health,
[1:32:26] Voice 2: prior to 2004, an outhouse was considered a sewerage system.
[1:32:32] Voice 2: But after 2004, the sewerage system regulation was changed

[1:40:25] Voice 2: almost everything in a building. So it says the space on any story of a building between the
[1:40:33] Voice 2: exterior walls and required firewalls, including this space occupied by interior walls and
[1:40:41] Voice 2: partitions and essentially excludes exits elevators and other enclosing assembly assemblies
[1:40:49] Voice 2: so it's actually quite inclusive whereas the uh the definition in the north pender land use bylaw
[1:40:57] Voice 2: it excludes those areas that are less than 1.5 meters um that wouldn't be defined as a story
[1:41:06] Voice 2: So I just wanted to leave that information there with the LTC, again forward it to the next LTC to kind of chew on the information, if you will, and go from there.

[2:31:45] Trustee McConchie (probable): consider to be misguided propaganda now the trust kind of left especially during the policy statement
[2:31:52] Trustee McConchie (probable): And it just kind of, we just left it out to hang.
[2:31:54] Trustee McConchie (probable): I don't, I think one of the communications people
[2:31:57] Trustee McConchie (probable): was on maternity leave during that time.

[2:35:00] Trustee Fast (probable): find out uh collaboration was really the theme so i can talk more about that if anybody's interested

[2:35:53] Trustee Morrison (probable): work with the Islands Trust Conservancy and how that's part of the larger Islands Trust work
[2:35:57] Trustee Morrison (probable): that kind of communication would be really helpful because people are proud of the work that they've
[2:36:01] Trustee Morrison (probable): have done here but it's not clear that that's actually part of the larger work of the Allen's
[2:36:06] Trustee Morrison (probable): trust and um to Ben's earlier communication comment like this is a proactive thing that we
[2:36:11] Trustee Morrison (probable): can be communicating about to understand what is the value proposition of the trust frankly

[2:37:33] Trustee Fast (probable): an incoming uh third appointed member uh of islands trust conservancy board as well so it's
[2:37:41] Trustee Fast (probable): a more it's a it's an interesting board it's a balanced one between uh three and three so quite
[2:37:48] Trustee Fast (probable): a different animal and uh but i i look forward um if i'm involved in the honest trust conservancy

[2:38:45] Voice 11: that sort of thing.
[2:38:46] Voice 11: So I had some discussions with well, director of finance,
[2:38:49] Voice 11: Claire Freider, director of trust area services about this,
[2:38:53] Voice 11: and also Kate Emmings, ITC manager.
[2:38:57] Voice 11: Kate also brought up another new obstacle to this,
[2:39:02] Voice 11: which is changes to the Professional Governance Act
[2:39:04] Voice 11: by the province.
[2:39:05] Voice 11: There requires that applied biology involve a registered professional biologist in many
[2:39:13] Voice 11: cases.
[2:39:14] Voice 11: And in discussions with Claire, she felt that the most effective or her advice was the most
[2:39:21] Voice 11: effective approach would be for trustees to support, encourage, prioritize getting the
[2:39:30] Voice 11: environmental grants program in place when it comes to trust council or getting it on trust
[2:39:36] Voice 11: council's agenda because that would implement the recent changes to the islands trust act and would
[2:39:43] Voice 11: allow for financial assistance directly to community groups and would create a budget
[2:39:51] Voice 11: to provide for that so that was her advice um however if you do want the wording for a resolution
[2:39:58] Voice 11: for the procurement policy it's there and then the second one was to encourage protocol more
[2:40:04] Voice 11: protocol agreements with first nations or again prioritize protocol agreements with first nations
[2:40:09] Voice 11: and claire also supports that and so the wording for that resolution is there

CALL TO ORDER Chair Fast called the meeting to order at 10:00 am. She acknowledged that the meeting was being held in traditional territory of the Coast Salish First Nations. 2. APPROVAL OF AGENDA Add: Correspondence from Joyce Thayer to Section 13.1 Land Use Bylaw Project. Add: Amendment for North Pender LTC Minutes of August 13, 2022 to Section 15.2 New Business. By general consent the agenda was approved as amended. 3. TRUSTEE REPORT Trustee McConchie congratulated Trustee Morrison, Chair Patrick, Chair Fast and all others who were successful in their elections and wished them luck. He acknowledged their care about the islands and said he would support them as an ex trustee. He also acknowledged Regional Planning Manager Robert Kojima, Planner Kim Stockdill and Islands Trust staff for their work over the past few years and through the changing times. Trustee Morrison thanked all who participated in the elections and stated that the conversations were helpful and valuable and that she will consider the use of Facebook going forward. She commented positively on the use of the Pender Post, respectful conversations and working with Trustee McConchie. She said the term had been challenging on various fronts including the global pandemic. TOWN HALL AND QUESTIONS Joyce Thayer, a fulltime North Pender resident, stated that an over height building in the Clam Bay Road area has been incorrectly approved. She suggested that a legal opinion be sought and is looking for a solution going forward. Michael Sketch, a North Pender resident, asked that trustees resolve the wording regarding the Browning Marina to Driftwood corridor in the Project’s List. Michael Sketch requested the Local Trust Committee (LTC) rethink the staff recommendations in the staff report to omit the setback distances from sewage fields and stated the bylaw is missing the potential for enforcement. CARRIED Discussion occurred regarding the review process and to flag the item for Trust Council. 12.2 NP-DVP-2022.1 (Regan) - Staff Report Planner Stockdill provided an overview of the staff report and commented that the applicant provided three letters of support from neighbours. The applicant, Heather Regan, spoke to the fact that the siting of the deck would increase neighbour privacy and did not require the removal of trees. CARRIED 12.3 NP-TUP-2022.3 (Schrodt) - Staff Report Planner Stockdill provided an overview of the staff report which included: o The application is for a short-term vacation rental (STVR) of a three bedroom single family dwelling; o The application complies with Temporary Use Permit (TUP) Guidelines; o There is significant privacy screening, it will only be rented to families and couples and the owners will use the property whenever possible; o The closest TUP is 400 meters away and would be the 10 th TUP where the policy states a maximum of 20; o One letter of support is in the public record and staff spoke to two anonymous neighbours who expressed concerns for STVRS in general; o Staff spoke to a third person and offered to relay concern regarding who will monitor the property and what the options are if there is an issue; and o The permit must be posted to the front of the property. Trustee Morrison reported that she received phone calls from several residents who had difficulty emailing letters to oppose the TUP; The applicant, Charles Schrodt, reported that he has an agreed contact who lives on the island full time for any concerns or complaints; Discussion occurred regarding the length of TUP approvals, compliance and bylaw enforcement; Discussed past problems experienced with STVRS and building trust with elderly neighbours; It was reported that the applicant canvassed the neighbourhood; Charles Schrodt provided history on a direct neighbour’s B&B and stated that over several years there were no instances of loud parties or police being called; Planner Stockdill reported the anonymous callers are not direct neighbours; Discussion occurred on the difficulty for decision making while addressing anonymous concerns; Planner Stockdill reported there is an LTC policy that anonymous correspondence should not be considered; Discussion occurred regarding bylaw enforcement as the means to address problems and that TUPs cannot be revoked; It was requested that a specific description of what constitutes community engagement should be put in the Transition Report for the next Trust Council; and It was requested that during the next LTC term, communication can be done highlighting good examples of STVRs. CARRIED 13. LOCAL TRUST COMMITTEE PROJECTS 13.1 LUB Review Project – Staff Report Planner Stockdill reported on some items contained in the Staff Report, including: Wetlands and streams should be in a separate project for better analysis; An overview was provided on the topic of setbacks for sewage systems and permitted exemptions through a professional reliance model through Island Heath; Staff are recommending not to include outhouses in the LUB. Discussion occurred on an existing outhouse in Stanley Point area. Planner Stockdill agreed to flag this item for discussion with Island Health and include it in the Follow-up Action List; Trustee Morrison requested that, as an additional piece for the LUB project, she would like a means of communication for multiple jurisdictions so there are numbers to phone as opposed to waiting for bylaw enforcement. Chair Fast agreed this would be helpful to the islands as well as bylaw enforcement; It was noted for discussion going forward that once the bylaw is finalized, problematic items could be identified for clearer communication; An overview was provided on Item 3 of the Staff Report including the CRD definition of floor area. Areas less than 1.5 metres in height would not be defined as a storey and this item is forwarded for the next LTC; Outdoor lighting in residential setting should be regulated in nuisance bylaw under CRD. Discussion occurred on the Dark Sky initiatives and it was requested that the Bowen Island Dark Sky bylaw language be brought forward for the next LTC; Driftwood Centre item is flagged to bring forward to the next LTC. A request was made that the meaning of lots of water (flooding in November vs water in August) and quality of water be considered; Planner Stockdill presented on Item 8 - McKinnon Road. A request was made that the calculation show total square footage maximum. Discussion occurred on the need for communicating the Trust’s authority to shift zoning and to make clear roles, responsibilities and mandates. Planner Stockdill agreed to the request; and Planner Stockdill raised item #5 regarding agri-tourism and the definition of ‘Farm’. She reported the newest letter received will be on the project webpage and that letter writers are recommending the LTC request a legal opinion to avoid further issues relating to the interpretation of current Bylaw 103 which is being corrected through Bylaw 224. Discussion occurred regarding: o the help of the legal review to address the current situation and to inform changes to the draft bylaw; and o the stated purpose for farm use on building plans is an enforcement issue. NP-2022-126 It was Moved and Seconded, that North Pender Island Local Trust Committee request staff to adjust Priority Project item 7 to read “coordination on a transportation plan for the Driftwood to Point Browning Corridor”. Chair Fast commented that this may be something for Trust Council to address. Discussion occurred regarding communicating locally and a request was made that this issue be put on the agenda and to consider repurposing a couple of meetings to community information meetings. 14.6 Islands Trust Conservancy Report – None Chair Fast, as vice chair for the Islands Trust Conservancy, provided an oral report that: There has been a lot accomplished this term; Deadline is approaching for people making tax decisions and donations; Information is available regarding current campaigns; There was discussion and collaboration at the Union of BC Municipalities meeting which was attended by provincial ministers, the chair of the Agricultural Land Commission and the Green Party leader; Discussion occurred on communication about local conservancy groups and Islands Trust Conservancy and that the Islands Trust Conservancy could be more visible on the support of both the local conservancy and Islands Trust Conservancy; and Chair Fast reported that recent elections will change the Islands Trust Conservancy. 15. NEW BUSINESS 15.1 Resolution Wording - Staff Memo RPM Kojima provided an overview of the memo dated October 27, 2022. NP-2022-127 It was Moved and Seconded, that North Pender Island Local Trust Committee request that Trust Council review procurement policy 6.5.3 to provide a method for local trust committees to compensate community members who provide environmental data to Islands Trust. CARRIED NP-2022-128 It was Moved and Seconded, that North Pender Island Local Trust Committee request that Trust Council prioritize and support the creation of protocol agreements with First Nations. CARRIED 15.2 Amendment for North Pender LTC Minutes of August 13, 2022 It was reported that the minutes of the August 13, 2022 LTC meeting require amendment to the resolution regarding accessory buildings/structures. The term “uses” was omitted in the resolution. CARRIED North Pender Local Trust Committee Regular Business Meeting October 27, 2022 ADOPTED Page 9 of 9 NP-2022-131 It was Moved and Seconded, that North Pender Island Local Trust Committee request staff to schedule a short electronic meeting about scheduling around early December. CARRIED 18. TOWN HALL Michael Sketch of North Pender Island made the following comments: With regards to Rural Residential (RR) Zoning and over height buildings, one approach might be to require farm tax status as a condition before consideration of zoning permission; With regards to the LUB project, the waste transfer facility zone (McDonald farm area) is shown on the OCP map schedule but it is not shown on the LUB map schedule; Planner Stockdill responded that the land use amendment for waste transfer facility is in proposed bylaw 229; With regards to the Hamilton Road Industrial zoned property in the ALR, there is no non- farm use for that particular piece of ALR allowed by the ALC to date. The current LUB allows for boat storage and current wording is accessory buildings, but that permission is not given by ALC; and Trustee Morrison responded that she is aware of the zoning on Hamilton Road and a confirmation letter is expected from the ALR or it will be pulled from the bylaw. She asked that this item is noted for the new trustee’s information. 19. CLOSED MEETING – None 20.
