[0:01:05] Trustee Fast (probable): So I want to say I'm Sue Ellen Fast, elected on Bowen Island, also called Kualakam, and chair of the Denman Island Local Trust Committee, because I'm on the executive committee.

[0:02:59] Trustee Fast (probable): project staff report so i'm going to turn it over now to uh planner mccarger please go ahead marlis

[0:03:07] Planner McCargar (probable): Thanks, everyone. I'll just give a pretty brief summary of this report. We met at the last

[0:03:15] Planner McCargar (probable): Denman Local Trust Committee on September 27th and discussed the bylaws at length at that meeting.

[0:03:24] Planner McCargar (probable): The first reading was rescinded. So first reading of this Bylaw 228 Official Community Plan

[0:03:33] Planner McCargar (probable): amendment bylaw was initially given first reading in 2018 and then the project was kind of put on

[0:03:41] Planner McCargar (probable): pause and reinvigorated this year and then a number of changes have been made so that was

[0:03:47] Planner McCargar (probable): first reading was rescinded and the LTC discussed a number of changes to make to that bylaw so you

[0:03:55] Planner McCargar (probable): You can see them in the report there.

[0:03:59] Planner McCargar (probable): And then moving to the By-law 229, which is the land use by-law amendment, that first reading of that was rescinded at the last meeting.

[0:04:09] Planner McCargar (probable): A number of changes were discussed and resolutions were passed for a variety of amendments that you can see in the report there.

[0:04:18] Planner McCargar (probable): The amendments have now been made. So I'm presenting the bylaws back to the LTC with the recommendation that they're given first reading and second reading and that referrals are made to the agencies that are listed.

[0:04:37] Planner McCargar (probable): There's a number of agencies and First Nations listed in the report there.

[0:04:43] Planner McCargar (probable): So referrals would go out and then direction to schedule a public hearing and community information meeting after the referral response period is complete.

[0:05:06] Trustee Fast (probable): It says September 27, 2022. And I think that might have been July. Should that be July?

[0:05:12] Planner McCargar (probable): So there was, there was a special meeting held in July 27th, 2022, where we, these bylaws were first presented, they weren't given any

[0:05:22] Planner McCargar (probable): readings at that time, there was likely

[0:05:24] Planner McCargar (probable): discussion, and then at the last meeting, which was September 27th.

[0:05:44] Trustee Critchley (probable): Thank you. So I've got a number of things that I just wanted to check, check in on and make sure that we're on the same page and doing, writing what we're intending.

[0:05:54] Trustee Critchley (probable): So first of all, I'll start on page 23 of the agenda.

[0:06:00] Trustee Critchley (probable): Paragraph 1.8 down at the bottom.

[0:06:02] Trustee Critchley (probable): And the second dot, it says, this is talking about minimum setbacks from the natural boundary of the sea.

[0:06:09] Trustee Critchley (probable): The second one says 30 meters for buildings and structures, comma, including fencing, comma, associated with agriculture, comma, except for a fence or used to accommodate domestic animals other than household pets.

[0:06:28] Trustee Critchley (probable): I'm just really having difficulty understanding that one where it says including fencing and says except for a fence.

[0:06:49] Planner McCargar (probable): agriculture and then except for a fence used to accommodate domesticated animals other than

[0:07:29] Trustee Busheikin (probable): under the stream or lake, it simply has that same phrase, but this, the including fencing

[0:07:43] Trustee Busheikin (probable): isn't there. And I believe that was the, I mean, I remember discussing this like five years ago and

[0:07:54] Trustee Busheikin (probable): that fencing would be allowed because farm, I just remember farmers being, oh, well, it's the

[0:07:59] Trustee Busheikin (probable): the sea here i yeah farmers saying well we already there's actually fencing already up

[0:08:05] Trustee Busheikin (probable): and animals graze and i think that they're allowed to like the the ministry of ag allows them to do

[0:08:12] Trustee Busheikin (probable): that to you know have a fence and graze animals and i'm kind of thinking when in doubt consistency

[0:08:20] Trustee Busheikin (probable): is good so the bullet for one the bullets for 1.7 and 1.8 yeah i i know that's not very conclusive

[0:08:29] Trustee Busheikin (probable): I'm just not sure. And I don't think just taking the or is necessarily correct because it might include buildings and structures used to accommodate domesticated animals other than household pets.

[0:08:48] Trustee Busheikin (probable): So I guess if I can sum up all that. Sorry, it was a little rambly.

[0:08:52] Trustee Busheikin (probable): my preference without having more background information is to take out the words including

[0:08:56] Trustee Busheikin (probable): fencing and make it the same as what we do for the streams lakes and wetlands the streams and lakes

[0:29:03] Planner McCargar (probable): it really uh i think it i agree that it kind of confuses things and i don't know we don't actually

[0:29:09] Planner McCargar (probable): define what a household pet is um so i think i would propose that for for both 1.7 and 1.8

[0:29:20] Planner McCargar (probable): we end at except for offense and delete used to accommodate okay

[0:29:31] Trustee Fast (probable): that makes it much clearer and uh also um this presuming that we uh go ahead with the

Planner McCargar presented a brief summary of the Staff Report that asks Trustees to 
consider the proposed Bylaw Nos. 228 and 229 as discussed at the previous Local Trust 
Committee (LTC) meeting.  
Trustees discussed the draft bylaws with the following noted: 
 Some minor typographical errors were pointed out in draft Bylaw No. 229 for 
correction by staff; 
 Fencing regulations contained in draft Bylaw No. 229 Schedule 1, 1.7 and 1.8 were 
considered to be unclear and more information to inform a decision would be 
useful.

Chair Fast recalled the meeting to order at 10:15 am. She acknowledged that the meeting was 
being held in traditional territory of the Coast Salish First Nations, in particular the K'ómoks First 
Nation.

5.1 Denman Island Farming Regulations Review Project - Memorandum 
Planner McCargar outlined the project background and process to date. She 
summarized the Memorandum that responds to the Local Trust Committee (LTC) 
request for additional information regarding setbacks from watercourses. She reported 
that the Memorandum includes the recommendation that fencing be excluded from the 
setback requirement at this time, in order to support a full range of acceptable 
agricultural uses. 
She advised that: 
 a comprehensive review of setback requirements and Development Permit Areas is 
out-of-scope for this project;  
 the majority of community survey responses and the Advisory Planning Commission 
supported a more thorough review of the setback regulations in the future; and 
 setbacks for the protection of water on farmland are set by the BC Ministry of 
Environment through the Agricultural Environmental Management Code of Practice 
which can provide a measure of confidence in watercourse protection until the LTC

undertakes a more comprehensive project to evaluate setbacks to watercourses 
across Denman Island. 
 
A Trustee suggested that the incoming LTC might consider referring a request for review of the 
comprehensive setback requirements to the Regional Planning Committee, as these are 
regulations that could be relevant to the Islands Trust as a whole. 
 
Trustee Critchley recommended that an information note referencing the BC Ministry of 
Environment Agricultural Environmental Management Code of Practice setback regulations be 
inserted into proposed Bylaw No. 229 following Section 1.8 for clarity.  
Trustees, Consultant Smith and staff discussed the matter with the following points noted: 
 the Islands Trust is moving away from the practice of inserting information notes as the 
Land Use Bylaw (LUB) should stand on its own;  and there are many other regulations that 
apply provincially not referenced as information notes; 
 this proposed information note might be interpreted to mean that this is the only part of 
the Code of Practice document that should be considered; 
 an information note can become outdated as Provincial regulations change; 
 farmers generally ask questions and solicit input from the Regional Agrologist, who is well 
versed in the Code of Practice and can answer specific questions about farming and 
setbacks; 
 the Planner for the Ministry of Agriculture and Food is another source of information and 
will have an opportunity to comment on the proposed bylaws through the formal referral 
process that will be conducted as a next step; 
 Trustee Critchley argued that an information note is warranted in this case as: 
o Watercourses are the most critical habitats and it should be the duty of the LTC to 
protect them; 
o The proposed Bylaw setback regulations include the wording “except for fences” which 
can be misleading, and many community members are not familiar with the Code of

That the Denman Island Local Trust Committee amend proposed Bylaw No. 229 by inserting 
following Section 1.8 an information note stating that setbacks for fences are set out in the Code 
of Practice for Agricultural Environmental Management under the Environmental Management 
Act. 
There being no seconder, the motion did not move forward.

It was MOVED and SECONDED, 
that the Denman Island Local Trust Committee Bylaw No. 229 cited as “Denman Island Land Use 
Bylaw, 2008, Amendment No. 1, 2018” be amended as follows: 
In Sections 1.7 and 1.8 delete the current text in its entirety and replace with “30.0 
metres for buildings and structures associated with agriculture, except for a fence.”

words “and on properties in the Agricultural Land Reserve without a Temporary Use 
Permit.”; 
 In 1.9, adding the words “, under Commercial,” after “by adding”; 
 In 1.17, Table 1, item 12, adding words “where permitted by a Temporary Use Permit.” 
after the word “Act”.; 
 In 1.23, Table 2, item 8, changing the text after the word “(1) cabin” to “on a property 
over 4 HA and classified under the BC Assessment Act as “Farm.”, and then continuing 
with the following sentence beginning with “Should.”; 
 In 1.24, Table 3, item 6, adding, in the second and third columns, the number one; 
 In 1.24, Table 3, item 7, adding 410 m

Information Meeting and Public Hearing for Bylaw Nos. 228 (Official Community Plan) and 229 
(Land Use Bylaw) after the referral response period is complete. 
 
A Trustee suggested that these two meetings should be held separately especially given the important 
issue of secondary dwellings on agricultural land. Other Trustees commented that community members 
often prefer combined meetings held on evenings or weekends for convenience and preferred to leave 
that decision to staff and the incoming Local Trust Committee.

Trustees discussed communications relating to this project, suggesting that the incoming LTC

6. ADJOURNMENT 
Ione Smith expressed her appreciation to everyone and noted that it is a pleasure to work with 
Denman Islanders. Trustees thanked her, appreciating the meaningful work that she advanced.  
Trustee Busheikin noted that her time as a Trustee is ending; she has considered the work to be 
significant, and has enjoyed working with everyone. 
Trustee Critchley also thanked staff for their professionalism, skill and patience; and his 
colleagues for respectful disagreements, diligence and carrying out their duties as Trustee and 
Chair during this term.
