This is a continuation of our electronic special meeting of the Denman Island Local Trust Committee, where we'll be discussing the Denman Island Farming Regulations Review Project.

[0:02:30] Trustee Fast (probable): an official forum of your local trust committee make decisions about land use planning matters and
[0:02:34] Trustee Fast (probable): discuss relevant business it's a continuation uh from the meeting of october the 6th and uh we'll
[0:02:40] Trustee Fast (probable): just um call the meeting to order uh now and um anybody got any problems with the agenda as we
[0:02:49] Trustee Fast (probable): we have resumed.

[0:03:05] Trustee Fast (probable): to the Denman Island Farming Regulations Review Project.

[0:03:15] Planner McCargar (probable): So after the break from the last meeting,
[0:03:18] Planner McCargar (probable): so last meeting I presented the staff report
[0:03:21] Planner McCargar (probable): with a number of recommendations on amendments to bylaw 228 and 229 and the LTC requested that
[0:03:31] Planner McCargar (probable): we take a recess and come back with some more information on setbacks from water courses
[0:03:37] Planner McCargar (probable): so I provided a memorandum that was included in the agenda package which is also posted online
[0:03:45] Planner McCargar (probable): So I went through and did a little bit of background research, and I've included just some of the background and kind of an explanation of why that language was included in the way that it was.
[0:03:58] Planner McCargar (probable): And it seemed to me, so back in 2017-2018 when this project was initially getting started, there was a lot of concern around feedlots.
[0:04:09] Planner McCargar (probable): And so the language was really trying to reflect setbacks from watercourses in relation to feedlots.
[0:04:17] Planner McCargar (probable): Then as the project moved forward and with recommendations from the Ministry of Agriculture,
[0:04:23] Planner McCargar (probable): feedlot was entirely removed from the bylaw and it was more generally addressing agriculture and intensive agriculture.
[0:04:32] Planner McCargar (probable): culture. So we've included a table which shows the tables on
[0:04:39] Planner McCargar (probable): page 46 of the agenda package or page two of the memo. And it
[0:04:43] Planner McCargar (probable): looks at the language in the proposed bylaw 229, the
[0:04:48] Planner McCargar (probable): recommended change and then the current language in the land use
[0:04:52] Planner McCargar (probable): bylaw that's currently adopted. Staff recommendation is that
[0:04:57] Planner McCargar (probable): fencing being excluded from the setback requirement at this
[0:05:00] Planner McCargar (probable): time in order to support a full range of acceptable agricultural uses and one of the the big reasons
[0:05:09] Planner McCargar (probable): for that is just uh there wasn't it was really out of scope for this project to look at um kind
[0:05:16] Planner McCargar (probable): of more comprehensive setback requirements so there wasn't a proper community consultation done
[0:05:22] Planner McCargar (probable): and also there is the agricultural environmental code of practice which is uh in effect in bc and
[0:05:30] Planner McCargar (probable): regulate setbacks in agricultural areas so there is kind of that extra there is that level of a
[0:05:38] Planner McCargar (probable): water course protection that already exists provincially so my staff recommendation is
[0:05:45] Planner McCargar (probable): that the language in the bylaw would read 30 meters for buildings and structures associated
[0:05:52] Planner McCargar (probable): with agriculture except for a fence and it would be the same for the minimum setback from the
[0:05:59] Planner McCargar (probable): natural boundary of the sea if there's any other questions i also included in the memo just um
[0:06:07] Planner McCargar (probable): there was so in the questionnaire that went around to denman the denman community back in
[0:06:12] Planner McCargar (probable): the spring of 2022 there was a question that related to water courses and setbacks and it
[0:06:22] Planner McCargar (probable): really just asked would you support updating denman islands development permit area number
[0:06:26] Planner McCargar (probable): number four, to include requirements for fencing and other measures to keep livestock and poultry
[0:06:31] Planner McCargar (probable): out of the waterways.
[0:06:32] Planner McCargar (probable): So I included that there so you can see that the majority, 78% of respondents, are interested
[0:06:39] Planner McCargar (probable): in kind of a more comprehensive review and would look to that, to revisit that at a future
[0:06:49] Planner McCargar (probable): project and the denman island advisory planning commission also concurred that um that when the
[0:06:57] Planner McCargar (probable): denman land use bylaws updated and revised that this would be a priority issue and consideration
[0:07:04] Trustee Fast (probable): thank you very much planner mcarger and uh that's a priority issue for the next time that it's
[0:07:10] Trustee Fast (probable): reviewed i i assume i see you nodding uh that's in case anybody can't see the video um i see uh

[0:07:23] Trustee Critchley (probable): Yes, I just wanted to ask for your view on the proposed motion that I had forwarded by an email.
[0:07:32] Trustee Critchley (probable): And just so that people know what I'm talking about, the motion would be that the Deminal Local Trust Committee request staff to insert into proposed bylaw 229 following section 1.8.
[0:07:48] Trustee Critchley (probable): a marginal note stating that setbacks for fences are set out in part four of the Code of Practice
[0:07:57] Trustee Critchley (probable): for Agricultural Environmental Management under the Environmental Management Act.
[0:08:04] Trustee Critchley (probable): So this would just draw attention to the fact that there are these other setback requirements.
[0:08:12] Trustee Critchley (probable): requirements and because by using the word excluding fences in our bylaw we some unsuspecting
[0:08:22] Trustee Critchley (probable): reader might think well there is no regulation on that point so that was my concern there was
[0:08:28] Trustee Critchley (probable): to put that in and I should mention that I did review the the code of practice for agricultural
[0:08:34] Trustee Critchley (probable): cultural environmental management and it is quite extensive the code and it's also has quite
[0:08:43] Trustee Critchley (probable): detailed sets of setbacks for various circumstances and i can see the complexity of this issue
[0:08:53] Trustee Critchley (probable): especially with regard to keeping of livestock and the numbers of livestock would would vary and
[0:09:01] Trustee Critchley (probable): would change the setback uh so yes it seems like this is is more complicated than i thought and
[0:09:10] Trustee Critchley (probable): and uh would require some some further uh study i would know note that it was suggested that this
[0:09:18] Trustee Critchley (probable): could be a project in the future of uh deminon local trust committee but as i'm thinking about
[0:09:24] Trustee Critchley (probable): all this it seems to me this is one of these types of projects that is is uh very well suited to an
[0:09:32] Trustee Critchley (probable): overall trust um view and that perhaps regional planning would be the body to take it up because
[0:09:41] Trustee Critchley (probable): setbacks for agricultural purposes vis-a-vis uh wetlands and streams is something that uh is
[0:09:48] Trustee Critchley (probable): is throughout the honest trust a concern.
[0:09:51] Trustee Critchley (probable): And I think we should be,
[0:09:53] Trustee Critchley (probable): I couldn't understand why there would be any difference
[0:09:56] Trustee Critchley (probable): on any Island in the required setbacks there
[0:10:00] Trustee Critchley (probable): following our duty to preserve
[0:10:02] Trustee Critchley (probable): and protect the natural environment.
[0:10:04] Trustee Critchley (probable): So that's kind of a long winded introduction
[0:10:09] Trustee Critchley (probable): to asking for your views on the proposal for that motion.

[0:10:25] Planner McCargar (probable): so there are information notes throughout some of the
[0:10:30] Planner McCargar (probable): land use bylaws it's it's not uncommon and there are some in the denman land use bylaw currently
[0:10:35] Planner McCargar (probable): it's it's kind of a a practice that we're moving away from um the and some of the advice that i
[0:10:42] Planner McCargar (probable): received not on this specific one but when i was talking with a lawyer in the past is just
[0:10:47] Planner McCargar (probable): that really a land use bylaw should stand on its own and that the information notes are just not
[0:10:54] Planner McCargar (probable): not really recommended and and not um not really used that widely in other jurisdictions but that's
[0:11:03] Planner McCargar (probable): you know not to say that it's not possible to do it here um one of my hesitations is just that there
[0:11:10] Planner McCargar (probable): are many other regulations that apply provincially that we we won't reference and we don't reference
[0:11:16] Planner McCargar (probable): um so by singling this one out yeah i just kind of have some some concern around that um
[0:11:24] Planner McCargar (probable): and then i yeah if that is the direction that the ltc wants to go i think i would suggest removing
[0:11:31] Planner McCargar (probable): part four uh just to keep it a little less specific in case the regulations did change
[0:11:37] Planner McCargar (probable): in the future um yeah that's those are that's kind of my thoughts so it's um it's it's within
[0:11:46] Planner McCargar (probable): the realm of possibility it's yeah but not uh not typically recommended yeah
[0:11:54] Trustee Critchley (probable): follow up on that yep go ahead david so um if we were to do that would it be a motion to
[0:12:04] Trustee Critchley (probable): amend the bylaw or is it really it's outside of the bylaw because it's not a
[0:12:09] Trustee Critchley (probable): provision of the bylaw per se it's just more of an of a formatting matter it's

[0:15:42] Trustee Busheikin (probable): unsure about it. I have heard the advice not to have the information notes and that a bylaw
[0:15:47] Trustee Busheikin (probable): should really be about bylaw things and additional information should be done as part of an outreach
[0:15:54] Trustee Busheikin (probable): or education or communications program, but what I kind of, because I also, I went down a bit of a
[0:16:02] Trustee Busheikin (probable): rabbit hole over the last five days or so, and also found this document, actually a farmer sent
[0:16:08] Trustee Busheikin (probable): me there, so farmers are aware of it, and looked at, you know, various things, and it is quite
[0:16:14] Trustee Busheikin (probable): comprehensive, and I feel like if we were going to have an information note, I'd rather have it
[0:16:19] Trustee Busheikin (probable): somewhere more general because this applies to a lot more than setbacks and setbacks from water
[0:16:26] Trustee Busheikin (probable): courses there's a lot in the document and if anything it should be somewhere more along with
[0:16:32] Trustee Busheikin (probable): maybe even the OCP with policies that but I also think then I'm like oh where to put it and is that
[0:16:38] Trustee Busheikin (probable): and there's other many other regulations that so many activities on Denman need to follow that we
[0:16:47] Trustee Busheikin (probable): We don't have the information notes because it gets overwhelming.
[0:16:52] Trustee Busheikin (probable): And so that's an abbreviated version of all the twists and turns my thinking has gone.
[0:16:58] Trustee Busheikin (probable): And so I would like to leave it out.
[0:17:03] Trustee Busheikin (probable): I think it could not have the effect we want in that it could suggest that this is the
[0:17:10] Trustee Busheikin (probable): only part of that best practices document that we think is worth pointing out.

[0:17:26] Trustee Busheikin (probable): yeah i have heard from various planners and in various circumstances concerned that information
[0:17:32] Trustee Busheikin (probable): notes aren't um don't belong in a land use bylaw and although i i do think they have a place
[0:17:42] Trustee Busheikin (probable): place, I am, I'm wary. That's, that's what I think, but I, you know, I hear legally speaking
[0:17:50] Trustee Busheikin (probable): there's, I don't know, but I, with this one, I just don't feel that there's a good reason to,
[0:17:54] Trustee Busheikin (probable): or enough good reasons to keep it in compared to the concerns.
[0:17:59] Trustee Fast (probable): And it's Sue Ellen here. I'm, I'm also thinking, I like the idea of referring it to the regional
[0:18:06] Trustee Fast (probable): planning committee or something like that. And, and I'm not familiar enough with the local
[0:18:14] Trustee Fast (probable): denman uh farming community and how they get information or whether they would phone a planner
[0:18:19] Trustee Fast (probable): an island's trust planner over some topic like this or whether they would go to uh agricultural
[0:18:26] Trustee Fast (probable): uh sources um and i'm going to ask uh ioni smith um uh in a moment i'll ask you about
[0:18:35] Trustee Fast (probable): if you have any suggestions for where's a good place for farmers to get this kind of information
[0:18:40] Trustee Fast (probable): information. But meanwhile, I'm not in favour of adding it to the bylaw because it's something
[0:18:50] Trustee Fast (probable): that gets outdated as regulations change, and then it's incorrect in our bylaw. So I'll just,
[0:18:59] Trustee Fast (probable): that's my concern. But anyway, I'm going to ask a consultant, since she's been kind enough to
[0:19:04] Trustee Fast (probable): to join us here. Do you have any suggestions for us, Ione Smith?
[0:19:09] Voice 4: Sure. So the farmers tend to
[0:19:13] Voice 4: usually get their information from the regional agrologists with the Ministry of Agriculture and
[0:19:16] Voice 4: Food. The regional agrologists are best used for those types of specific questions around
[0:19:21] Voice 4: regulations and planning. And even though this is the code is part of the Ministry of Environment's
[0:19:27] Voice 4: Environmental Management Act, the regional agrologists are really well versed in the
[0:19:30] Voice 4: in the code of practice. So those are the best go-tos for Denman Island. The regional agrologist
[0:19:36] Voice 4: is Tom O'Dell. And I know for a fact that he has a lot of information about the code. There's also
[0:19:42] Voice 4: the agricultural planner, Reid Bailey, with the Minister of Agriculture and Food, who would be a
[0:19:47] Voice 4: good person for farmers to talk to. So my understanding is also that as a next step,
[0:19:52] Voice 4: the external referral would include some of those individuals for reviewing the draft bylaws. So
[0:19:59] Voice 4: So that's also an opportunity to get some feedback as to, you know, how to proceed with some of this language.
[0:20:05] Trustee Fast (probable): Thank you very much. And I'm going to go to Trustee Critchley now. You've got your hand up, David, please go ahead.
[0:20:12] Trustee Critchley (probable): Yes, thank you. I just wanted to respond to a couple of things that have been said about this.
[0:20:18] Trustee Critchley (probable): Yeah, I would agree as a general proposition that it's probably not good practice to be littering bylaws with information notes.
[0:20:27] Trustee Critchley (probable): However, in this particular case, I'll make the following points.
[0:20:34] Trustee Critchley (probable): Number one, we are talking about setbacks from watercourses and streams, wetlands.
[0:20:42] Trustee Critchley (probable): These are the most critical habitats that we have on these islands.
[0:20:45] Trustee Critchley (probable): And our duty to preserve and protect should be focused on them, if nothing else.
[0:20:54] Trustee Critchley (probable): Secondly, I think that here we have in the bylaw a specific section that is dealing with setbacks
[0:21:05] Trustee Critchley (probable): and we say except fences. So it's not just a matter of a lack of information
[0:21:15] Trustee Critchley (probable): in the bylaw, it's a matter that the bylaw wording can be misleading to somebody reading it.
[0:21:23] Trustee Critchley (probable): they think, oh, here's all the setbacks I need to be concerned about, because this is an
[0:21:29] Trustee Critchley (probable): agricultural bylaw. Here they are, you know, distance for structures, etc. And they would
[0:21:39] Trustee Critchley (probable): have no clue. I mean, most people are not sophisticated to know the existence of the
[0:21:46] Trustee Critchley (probable): Environmental Management Act, or the Code of Practice for Agricultural Environmental Management.
[0:21:53] Trustee Critchley (probable): you know many people aren't yes bigger farmers will be but other people will pull out their
[0:21:58] Trustee Critchley (probable): local denman bylaw that deals with agriculture matters and consult it for matters of setbacks
[0:22:05] Trustee Critchley (probable): and when they see that fences are accepted then they will think naturally oh well there's no
[0:22:13] Trustee Critchley (probable): regulation on that therefore i'll put my fence and let my animals graze right up to the edge of this
[0:22:20] Trustee Critchley (probable): this wetland. That would be very wrong. So it's not just a matter of a lack of information, but
[0:22:27] Trustee Critchley (probable): an implied misleading information in the bylaw in this circumstance. And that's why I think it is
[0:22:36] Trustee Critchley (probable): very important that it be included. So I'm going to make this motion, and if it doesn't get seconded,
[0:22:42] Trustee Critchley (probable): it will at least be on the record. So I'm going to move that the Denman Island Local Trust Committee
[0:22:47] Trustee Critchley (probable): amend proposed bylaw 229 by inserting following section 1.8 an information note stating that
[0:22:59] Trustee Critchley (probable): setbacks for fences are set out in the code of practice for agricultural environmental management
