[0:02:15] Trustee Langereis: for this term my name is dan rogers and i would like to start by acknowledging that we're

[0:02:23] Trustee Langereis: very privileged to meet in the traditional territories of many coast salish people and

[0:02:30] Trustee Langereis: in particular uh on gabriola we are um honored and humbled to be able to live in the traditional

[0:02:37] Trustee Langereis: territory of this name of first nation i want i do want to say that i i've learned a lot about

[0:02:44] Trustee Langereis: what that means on gabriel um through the work of my fellow trustees um and uh through the work of

[0:02:52] Trustee Langereis: the staff and the work of the community as to as to um the importance of first nation both

[0:02:59] Trustee Langereis: both engagement in history and understanding and listening, et cetera.

[0:03:03] Trustee Langereis: So it's been an interesting journey, a wonderful journey,

[0:03:09] Trustee Langereis: and a necessary journey for me and I think for the community at large.

[0:03:13] Trustee Langereis: I have, over the last term, given my co-trustees,

[0:03:17] Trustee Langereis: an opportunity to make any acknowledgement they'd like to make,

[0:03:21] Trustee Langereis: and given this is our last opportunity to do that,

[0:03:23] Trustee Langereis: I would like to turn to Trustee Langer,

[0:03:26] Trustee Langereis: your accent see if he'd like to say anything about uh in terms of the acknowledgement yeah i'd also

[0:03:30] Voice 5: like to acknowledge my gratitude to be able to live on gay girl all these years in the territory

[0:03:36] Voice 5: of the senegal first nation and it's uh it's a beautiful island it's a beautiful place to live

[0:03:43] Voice 5: and hopefully we can take care of it the way the senegal first nation has done for millennia

[0:03:57] Voice 10: i've heard second hand um across the road at the museum with elder jill d manson and other

[0:04:03] Voice 10: elders listening there's tangible signs that things are changing and that the relationships

[0:04:10] Voice 10: are healing and that's the work that we have in front of us and i hope you contribute somewhat

[0:04:15] Voice 10: to that this term i live at will still be letson which is closer together between beaches and i

[0:04:21] Voice 10: want to give gratitude to the elders gary manson and general manson for helping me

[0:04:27] Voice 10: learn more about the place that i live thank

[0:04:29] Trustee Langereis: you um thanks this is uh this is the regular meeting

[0:04:34] Trustee Langereis: of the gabriel local trust committee uh it is being recorded um it is also uh being um live

[0:05:04] Trustee Langereis: someone came up to me from from gabriola and said i saw you on tv and i said well you probably mean

[0:05:10] Trustee Langereis: our live stream and we had a very nice chat it was a woman whose name i'd forgotten but she had seen

[0:05:16] Trustee Langereis: me at a gabriola local trust committee um and uh was visiting some friends and i know i know

[0:05:24] Trustee Langereis: walking around um some islands uh people recognize me and there's no reason they would know me other

[0:05:29] Trustee Langereis: than this so um uh so thank you uh so that we're doing that and and we're pleased to be able to do

[0:05:36] Trustee Langereis: that uh one thing i won't miss by not being a chair is hauling the equipment around and being

[0:05:42] Trustee Langereis: the technical guy that sets it up given that i have no technical ability whatsoever but i have

[0:05:47] Trustee Langereis: managed to make this happen um so far so we will see that it continues to work with me of course

[0:05:54] Trustee Langereis: are your local trustees so i have to see scott holborn um and trustee case langris it's always

[0:06:00] Trustee Langereis: been a pleasure to work with you and uh we have with our staff i see we have another staff member

[0:09:20] Trustee Langereis: to be here. And behind the scenes, believe it or not, we have staff that are trying to

[0:09:25] Trustee Langereis: make things work. So it's great to be able to be supported the way we are by our fabulous

[0:09:31] Trustee Langereis: administrative staff and overworked administrative staff of the trust. So welcome. We have an

[0:09:39] Trustee Langereis: agenda this is our business meeting of um uh october the 27th does anybody have anything

[0:09:47] Trustee Langereis: they wish to add or or amend for the agenda either trustee is there anything from you uh planners

[0:09:53] Trustee Langereis: okay so the first item on the agenda then we'll take the agenda approved as presented i just want

[0:10:02] Trustee Langereis: to i just need to pull up my um email for a second um get some information

[0:10:10] Trustee Langereis: the first item on the agenda is our rise and report uh which is from

[0:10:18] Trustee Langereis: our last meeting of of uh september the 29th and we simply had a report we considered the

[0:10:28] Trustee Langereis: appointment of the board of variance uh for the gabriel local trust area the terms um

[0:10:34] Trustee Langereis: had expired and we have appointed jack woodward laurie jackson and katherine verge to the board

[0:10:42] Trustee Langereis: of variance i don't know if any of you are familiar with the board of variance it's a

[0:10:47] Trustee Langereis: statutory body that's set up for allow applicants if they don't if they to either go directly if

[0:10:54] Trustee Langereis: they're looking for a variance in terms of their property to go directly or to take an issue if

[0:10:59] Trustee Langereis: they don't agree with the decision of the local trust committee to go to the board of parents

[0:11:04] Trustee Langereis: it's not used all that much um i can only recall two or three in my three or four trust uh local

[0:11:12] Trustee Langereis: trust committees over the last four years so but we did appoint those three people again uh thank

[0:11:18] Trustee Langereis: you to their for their volunteer service uh mr woodward and ms jackson were reappointees and

[0:11:24] Trustee Langereis: and Ms. Burge was a new appointee.

[0:11:27] Trustee Langereis: So the next item on the agenda then is reports,

[0:11:31] Trustee Langereis: and it's over to trustees for their reports.

[0:11:38] Voice 10: Thank you very much.

[0:11:39] Voice 10: There was an event,

[0:11:41] Voice 10: I kind of mentioned the event at the museum,

[0:11:43] Voice 10: there's been several events

[0:11:44] Voice 10: as they do some culturally appropriate work

[0:11:49] Voice 10: with the petroglyphs there,

[0:11:50] Voice 10: and I thank the museum and the Elders for that work.

[0:11:54] Voice 10: I attended on Sunday a health and wellness collaborative.

[0:11:58] Voice 10: So that collaborative now is up to 52 island organizations,

[0:12:02] Voice 10: which is really staggering when you think about it.

[0:12:05] Voice 10: It's an opportunity, somewhat an informal association,

[0:12:08] Voice 10: and they held a meeting, sort of a workshop.

[0:12:12] Voice 10: There were three areas of discussion, truth and reconciliation,

[0:12:17] Voice 10: climate change, which David Miller from Island Futures

[0:12:20] Voice 10: and the Community Investment Co-op held.

[0:12:23] Voice 10: emergency preparedness with director Vanessa Craig who's here with us today gave a talk on

[0:12:30] Voice 10: that and there were some discussions really excellent format and a good three-hour event

[0:12:37] Voice 10: to kind of discuss where that organization is

[0:12:40] Voice 10: going and how all these things are interconnected

[0:12:42] Voice 10: and some good solutions came out of it so that was the that was this past week and that's my

[0:12:48] Voice 10: my last report. Thank you,

[0:12:54] Voice 5: I don't have a lot to report, but I did

[0:12:57] Voice 5: attend the unveiling of the

[0:12:58] Voice 5: petroglyphs at the museum on

[0:13:01] Voice 5: Saturday, and it was a really

[0:13:02] Voice 5: nice ceremony. It was some beautiful

[0:13:05] Voice 5: petroglyphs, and the ceremony

[0:13:07] Voice 5: in which Jared Hooper was

[0:13:08] Voice 5: given an advantage for his work in

[0:13:10] Voice 5: copying the petroglyphs from around the

[0:13:13] Voice 5: island. So it was a very

[0:13:15] Voice 5: moving event.

[0:13:15] Voice 5: uh event uh the only other thing is that i want to congratulate the two new trustees who made some

[0:13:22] Voice 5: toby elliott they are going to be stepping up here in the next while i wish them all the best in the

[0:13:29] Voice 5: next for the next four years so congratulations that's it thanks very

[0:13:35] Trustee Langereis: much um so this is my uh

[0:13:41] Trustee Langereis: last meeting and it's the of the local trust committee uh chair for gabriel and it's been a

[0:13:49] Trustee Langereis: fabulous four years um i know we said a few of our goodbyes last meeting but um we didn't we weren't

[0:13:55] Trustee Langereis: sure we were going to have another one so i won't repeat a lot of those other than just acknowledge

[0:14:00] Trustee Langereis: what it what a great privilege it's been to be able to be the chair of gabriela and we get to

[0:14:05] Trustee Langereis: know the island a little bit i wish i was explaining to someone that it's often hard to

[0:14:12] Trustee Langereis: get to know the island too much unless you come and stay for a little while because we get off

[0:14:16] Trustee Langereis: the ferry I come to the meeting I go home I get on the ferry and I travel back I come from Keats

[0:14:22] Trustee Langereis: Island which is right across there where this is actually the most challenging island for me to get

[0:14:27] Trustee Langereis: to even though it's I can see it if I go and down to Twin Beaches I can see Keats Island across the

[0:14:34] Trustee Langereis: way on a clear day I did bring my boat once in July and that was a really great experience so

[0:14:39] Trustee Langereis: i wish i got to know more and i will inspire me to come back um it is an amazing place because

[0:14:45] Trustee Langereis: there's and the island's trust office is here i want to acknowledge all the work of the islands

[0:14:49] Trustee Langereis: the offices that are here and the admin staff i hope to pop over them later and say goodbye to

[0:14:54] Trustee Langereis: them it's been a pleasure to work with um planner zupanich and all the planners and of course we

[0:14:59] Trustee Langereis: have the best recorder that i've ever run across here um she uh has written most of our motions

[0:15:08] Trustee Langereis: before we actually say anything it's really fun to be able to get to know you um and so i wanted

[0:15:15] Trustee Langereis: to just say a couple of things and i'm saying all of this because what happens is some local

[0:15:20] Trustee Langereis: trust committees do their meeting their their trust reports at the beginning and some do it at

[0:15:24] Trustee Langereis: the end um but i find people leave the meeting so uh if i did if i said all those things at the end

[0:15:31] Trustee Langereis: of the meeting unless you watched recording you wouldn't see them and uh so while you're all still

[0:15:35] Trustee Langereis: I know some of you will stick to the end, but I wanted to just report a few things about

[0:15:43] Trustee Langereis: the trust generally.

[0:15:46] Trustee Langereis: The election on October the 15th led to 15 new trustees.

[0:15:57] Trustee Langereis: Now two of those are returning trustees, including soon to be trustee elect Gates, and one from

[0:16:05] Trustee Langereis: denman who had served eight nine years ago um david graham but that means there are 13 brand

[0:16:11] Trustee Langereis: new trustees uh along with 11 returning trustees so it's a fairly hefty turnover

[0:16:18] Trustee Langereis: uh i wish them luck in trying to work their way through the many issues that this trust council

[0:16:24] Trustee Langereis: has left for them to work through including governance and trust policy statement and

[0:16:30] Trustee Langereis: and the issues of climate change and housing emergencies that we've declared.

[0:16:35] Trustee Langereis: I do know, I want to also acknowledge you are two people who are successful.

[0:16:41] Trustee Langereis: I know them, I've gotten to know them both over the last four years,

[0:16:44] Trustee Langereis: and I know they will do the island proud.

[0:16:48] Trustee Langereis: And I know that they had an introduction meeting on Tuesday night

[0:16:54] Trustee Langereis: where they got to know each other a little bit, and that was over Zoom.

[0:16:59] Trustee Langereis: So that's going to be, it's always a very steep learning curve for new trustees to understand what the, how the trust work because it's not simple and anybody who tells you it is all we can fix this just by doing that they, it is a very complicated organization because of the tension between local autonomy and and regionalized and generalized governance.

[0:17:23] Trustee Langereis: That's only one reason also because we it is a region that encompasses in excess of 30 fair stations that we try to have relationships with.

[0:17:36] Trustee Langereis: And of course it's much loved by many and and and tends to be subject to abuse by by those who love it so much because it gets used a lot.

[0:17:48] Trustee Langereis: So it's a very complicated place. And I wish them luck in trying to figure it. I encourage them to listen carefully to staff who understand it and have the depth of knowledge to give good advice and then make good decisions.

[0:18:03] Trustee Langereis: The first formal trust council will be on November the 17th, when the trustees will be sworn in.

[0:18:12] Trustee Langereis: And then they just the other thing to notice is note is that the new executive will be chosen on November the 19th.

[0:18:22] Trustee Langereis: And also the representatives the trust can find this trust conservancy.

[0:18:26] Trustee Langereis: That is a matter of some controversy, because people say it's not enough time.

[0:18:30] Trustee Langereis: i fully expect it will occur in any case despite the concerns about that um and the person who

[0:18:38] Trustee Langereis: sits in my chair will be chosen probably the following week from amongst the uh the executive

[0:18:45] Trustee Langereis: that's chosen there are

[0:18:46] Voice 1: three vice chairs in one

[0:18:47] Trustee Langereis: chair uh and they sit and listen to trustees and

[0:18:52] Trustee Langereis: talk about who where what works best and then the assignments are chosen um at least my experience

[0:18:59] Trustee Langereis: was on a cooperative basis uh i do know these two came to me fairly quickly in the process and asked

[0:19:05] Trustee Langereis: me if i would lobby to come to gabriel uh which i did um i don't know why they did that i think it

[0:19:11] Trustee Langereis: was the previous trustees who suggested it anyway there's a process that falls and it's not

[0:19:15] Trustee Langereis: surprising it involves a lot of conversation so that's what's going on in the trust there's a lot

[0:19:22] Trustee Langereis: going on it's a very it's a very busy time a lot of local trust committees are are sort of

[0:19:27] Trustee Langereis: cancelling the november meetings because of a delay in getting the meeting started

[0:19:34] Trustee Langereis: but it will start going and it will start moving again and the work of the trust and of the local

[0:19:40] Trustee Langereis: trust committees will continue happy to answer any questions about that so that's my report is

[0:19:46] Trustee Langereis: as the chair about what's happening at a trust council level i'm going to actually now turn it

[0:19:54] Trustee Langereis: over to the electoral area director um and director craig it's been a pleasure working with you as

[0:20:00] Trustee Langereis: well you are the most diligent director i have run across in all of my local trusts that you're

[0:20:04] Trustee Langereis: always in some form or another at this meeting and it's been a real pleasure with you and i know

[0:20:11] Trustee Langereis: you're re-elected and and um working your way through maybe icc hierarchy and you're very

[0:20:18] Trustee Langereis: committed would you like to come up here and and so you can have your it can be or you're happy to

[0:20:22] Trustee Langereis: sit there i

[0:20:23] Voice 4: can i can just sit here okay so making everybody shift around so um thank you for four

[0:20:29] Voice 4: years of working together i've been really impressed with the thoughtfulness of the

[0:20:34] Voice 4: discussions and um working individually with all of you so thank you for all of your work

[0:20:42] Voice 4: um just a couple of uh updates just because um it's been we've been in a bit of a hiatus through

[0:20:48] Voice 4: the election as well so at huxley park you would see the shade structures and installed

[0:20:53] Voice 4: and fixing around part of the park is in the process of being installed uh the rdn and i

[0:20:58] Voice 4: know i've been um asked about this by trustees in the past they were hosting a tree planting party

[0:21:03] Voice 4: at the end of november to start getting those trees planted that um that was part of the

[0:21:08] Voice 4: agreement with the island's trust for replacing some of which or two at least a two to one ratio

[0:21:14] Voice 4: over replacing trees that were moved uh the posac meeting that had to be rescheduled is now

[0:21:19] Voice 4: scheduled for november 28th and a 6 30 p.m start at the aggie hall so we're going to be trying to

[0:21:26] Voice 4: see if an evening meeting schedule works well for members of the public i just wanted to let you

[0:21:34] Voice 4: know um just because of it's a parks issue the armenian previously went through an alternative

[0:21:39] Voice 4: of approval process for a change the little qualicum river regional park and i mentioned

[0:21:43] Voice 4: this before but as it turns out some of the necessary information wasn't distributed at

[0:21:48] Voice 4: the time just the information that they could actually go and view the documents so we're

[0:21:53] Voice 4: redoing the aap so the new deadline will be november 28th the first one was successful but

[0:21:59] Voice 4: just to make sure that everything is carried out properly we're redoing it uh arty and staff are

[0:22:05] Voice 4: applying for a grant to create a fuel management prescription for distanso bay regional park and

[0:22:10] Voice 4: cox community park both of those areas were identified as higher fire risk in the area of the

[0:22:16] Voice 4: community welfare resiliency plan compared to other areas across the rdn so it's it's it's

[0:22:21] Voice 4: looking across the rdn at the highest risk areas and and unfortunately areas in the island gabriel

[0:22:28] Voice 4: seem to be rising to the top of the pile first it was a 707 and now it's cox and distanso

[0:22:33] Voice 4: So we just increased the number of rebates available

[0:22:37] Voice 4: for residents wishing to either exchange their wood stove

[0:22:40] Voice 4: for a more efficient one,

[0:22:41] Voice 4: or just switch to a different form of heating,

[0:22:43] Voice 4: such as heat pumps or pellet stoves.

[0:22:46] Voice 4: And the inaugural meeting for the R&D board is November 8th.

[0:22:50] Voice 4: So that's my update.

[0:25:51] Trustee Langereis: say that um almost without exception in fact I can't even think of an occasion where well maybe

[0:25:57] Trustee Langereis: one um that that Gabriel has proven itself to be a very um a very respectful civil place to come

[0:26:06] Trustee Langereis: I've enjoyed hearing the dialogue and the conversation and the commentary from the

[0:26:11] Trustee Langereis: community uh the last thing is of course um is that we ask that you uh speak you speaking and

[0:26:18] Trustee Langereis: following up on that in an appropriate fashion as i like to say uh speak in a way and address

[0:26:25] Trustee Langereis: yourself in a way that you're would make your grandmother proud and somebody said to me you

[0:26:29] Trustee Langereis: haven't met my grandmother but if you could ask you to do that in a way that you would imagine

[0:26:35] Trustee Langereis: uh your kids and your grandfather your grandmother would make you proud and that they'd be happy

[0:27:23] Voice 7: and uh i won't reiterate all the stuff about why the housing crisis is a crisis and how do you do

[0:27:29] Voice 7: that affects the community i would just like to remind you of a couple of things that affect your

[0:27:33] Voice 7: consideration of that um draw your attention back to the interview with the center that took place

[0:27:40] Voice 7: after the last committee during which your bylaw enforcement person who i believe is sitting over

[0:27:45] Voice 7: there that we haven't met uh um noted that there are possibly hundreds of illegal dwellings on

[0:27:53] Voice 7: gabriela um that's a significant portion of our community and the lack of clarity around how many

[0:28:00] Voice 7: such dwellings there are really inhibits the ability of the trust community and the community

[0:28:06] Voice 7: at large to address the problems and issues that surround that. Without an accurate census

[0:28:13] Voice 7: of how many such dwellings there are, it's really difficult to properly allocate resources,

[0:28:20] Voice 7: to properly consider community concerns about real issues like water, sewage, things like that.

[0:28:29] Voice 7: so the proposal that I believe you're considering later today allowing enforcement of sewage and

[0:28:37] Voice 7: public health things is I think really important for allowing people who reside in illegal or

[0:28:42] Voice 7: non-compliant dwellings to advocate on their own behalf that they be housed in appropriate

[0:28:49] Voice 7: circumstances and receive value for the money that they're paying to those rural elites in

[0:28:54] Voice 7: our community who are in possession of those suites uh and are taking that as a source of

[0:29:00] Voice 7: profit to them without any ability for tenants who are in fear of losing their housing to complain

[0:29:05] Voice 7: about their health and safety conditions um and so i think those two considerations the the correct

[0:29:11] Voice 7: census of such dwellings and the ability of tenants to advocate on their own behalf you know

[0:29:16] Voice 7: are really important for you to consider uh and i would further remind you that taking the step

[0:29:22] Voice 7: of suspending enforcement of bylaws is something that this local trust committee has done before

[0:29:28] Voice 7: on april 11th 2019 the gabriel island local trust committee adopted a standing resolution

[0:29:36] Voice 7: to direct staff to not to not enforce section b62 of gabriel island land use bylaw number 177

[0:29:49] Voice 7: which regulates public markets operated indoors.

[0:29:53] Voice 7: That was a conflict in the community.

[0:29:56] Voice 7: And it was a conflict in the community around.

[0:30:00] Voice 7: long-standing and basically essential avenues for the community to engage collectively in its public

[0:30:07] Voice 7: life this is while yes different in scale and scope in some ways similar in that it leads to

[0:30:16] Voice 7: the heart of the community's functioning and the suspension of the bylaw which limits the community

[0:30:22] Voice 7: and the community's ability to act and our administration's ability to act

[0:30:26] Voice 7: uh is it's good to remove the barriers for the community's essential functioning and in doing so

[0:30:36] to seek to establish better

[0:30:38] Voice 7: processes and i think the the feedback that you got from the advisory

[0:30:42] Voice 7: planning commission to was really good in that it limits the the length of that bylaw and gives

[0:30:47] Voice 7: clear instructions to the incoming council on how to consider the implementation of uh of that

[0:30:53] Voice 7: standing resolution and i encourage you in the strongest possible terms uh that i can use politely

[0:30:59] Voice 7: to uh uh to issue the directions to suspend enforcement of illegal dwellings with the

[0:31:08] Voice 7: caveats and limitations uh put forth given the uh in the proposal before you today and i think

[0:31:15] Voice 7: that's everything i need to say thanks so that wasn't commentary on your no that was something

[0:31:20] Voice 7: Do

[0:31:20] Voice 10: you think it's really on fire?

[0:31:21] Voice 10: Yeah, there's a few things on fire.

[0:32:09] Voice 4: difficult issue it is a bylaw and we're actually trying to suspend that bylaw temporarily but i

[0:32:17] Voice 4: really want to reiterate what i said in my letter that a two-year um or two-year deferment is really

[0:32:27] Voice 4: not adequate because many of our dwellings will never be compliant with the bylaw as it currently

[0:32:35] Voice 4: stands and so i think we need to look at the final change it to reflect what really is going on in

[0:32:43] Voice 4: community and to that end make the deferment not time limited

[0:32:53] Voice 4: um further to that i just want

[0:32:55] Voice 4: to thank all of you for your service over the past four years um i think there have been some

[0:33:02] Voice 4: really challenging issues that you've wrestled with and it's been really impressive to see how

[0:33:53] Voice 4: We've heard a lot of commentary from all sides

[0:33:56] Voice 4: that referred to two ABCs twice.

[0:34:06] Voice 4: And so I know that trustee elect Susan Yates and I would like to get on with the work of the OCP review and with bringing our official communities up to speed with the current context of the community and what we're struggling with today.

[0:34:22] Voice 4: so i think this if you pass this it would support that because it would give us the

[0:34:27] Voice 4: reunion so we don't have to keep debating it and we can move forward into proactive

[0:34:35] Voice 4: community-wide planning that reflects the need for community so yeah i encourage you to we've

[0:34:41] Voice 4: had lots of commentary and i'm going to add to that um super appreciate it if you could take

[0:34:46] Voice 4: action on this uh item today and again thank you so much thank you very much

[0:35:23] Voice 8: the people who are living in what has been referred to as substandard um alternate

[0:35:33] Voice 8: non-compliant illegal dwellings um they they draw attention to a significant class issue in that the

[0:35:50] Voice 2: people who are um benefiting

[0:35:54] Voice 8: and pushing for certain kinds of institutional housing or

[0:35:59] Voice 8: things like that in

[0:36:04] Voice 2: many cases have never experienced the kind of insecurity that it's

[0:36:11] Voice 8: caused by living in your car at the end of the case for example young woman who's been living

[0:36:16] Voice 8: there for a month you know it you know the people that own the property i mean are they in

[0:36:25] Voice 8: communication with her do they know about the drug deals that go on around her it's not a safe

[0:36:30] Voice 8: environment but it's maybe more safe than some of the other substandard non-compliant illegal

[0:36:35] Voice 8: situations and people in that situation don't often have efficacy to speak to the elites

[0:36:43] Voice 8: who have high levels of education who have high levels of power in the society

[0:36:52] Voice 8: like we're talking about the elite we're in the one percentage and

[0:36:57] Voice 2: uh those people are not

[0:37:02] Voice 2: trustee elliott of course we know the author of the

[0:37:06] Voice 8: words until there's no longer first class

[0:37:10] Voice 8: and second class citizens of any nation so the quality of making the decisions for the people

[0:37:20] Voice 8: who are in the lesser classes uh what can we learn from salisbury i mean they've built some

[0:37:25] Voice 8: institutional housing we've looked at this bylaw i mean it's still illegal if you suspend the bylaw

[0:37:30] Voice 8: it's still illegal to live in this situation so if you want to examine the issue we have to know

[0:37:44] Voice 8: how many people are living in tents under jars in cars in vans in trailers without running water

[0:37:55] Voice 8: and they have to have a voice where it's safe safe for them because i'm quoting you here sir

[0:38:01] Voice 8: safe for them to speak because it hasn't been i can speak to that and uh you know you said

[0:38:10] Voice 8: that you sent a letter out into the universe of the trust and i mean it may get lost you

[0:38:14] Voice 8: don't know it's not and you may not have the language to speak to you people i mean i say

[0:38:22] you people with

[0:38:22] Voice 8: all due respect i mean i know that you've all been working really hard this

[0:38:26] Voice 8: four years of this contentious things going on and i want to thank you tenacity and your intelligence

[0:38:34] Voice 8: to leave the people wouldn't get as good um you know i hope you're i hope you can maintain your

[0:38:40] Voice 8: health away from this it must have been a real slog and thank you for working on it um but

[0:38:46] Voice 8: there are a lot of people that really especially right now i mean if you can never dry your socks

[0:38:51] Voice 2: get

[0:38:52] Voice 8: bungled, there are so many consequences to the whole housing insecurity.

[0:39:00] Voice 8: If you've never experienced them, I mean, you're very fortunate.

[0:39:04] Voice 8: But there are some people who are living in really, really difficult circumstances.

[0:39:10] Voice 8: This biocultural engineering that we're all playing with here, with all the reports and the forms and everything, it's life and death.

[0:39:16] Voice 8: It's life and death for trees, it's life and death for ecosystems, and it's life and death for people.

[0:39:21] Voice 8: and you people have a great responsibility and i know you take it very seriously but there are a

[0:39:29] Voice 8: lot of people that do not have a voice in this community and they're really heading they're

[0:39:33] Voice 8: heading into winter it's getting damp and cold and they're hungry and wet and they're insecure

[0:39:39] Voice 8: and they're and they face all kinds of abuse from all kinds of people anonymously because they have

[0:39:45] Voice 8: no advocacy thank you very much for bringing that up because that's an excellent point that's

[0:39:51] Voice 8: something we need to be an advocacy for the people and we need to look at salt springs experience

[0:39:57] Voice 8: because there are 15 years ahead of us as as they're uh or 15 or 20 years in development

[0:40:02] Voice 8: and you have their have they solved their housing crisis by the standards uh you know you all are

[0:40:09] Voice 8: experts in this so maybe you can speak to that later in the process thank you very much for your

[0:40:14] Voice 8: work thank you for allowing me to talk for a moment and uh thanks for trying to uh sort of

[0:40:20] Trustee Langereis: and if i might just say one thing uh thank you for your commentary and i think it's well taken

[0:40:26] Trustee Langereis: i will say that letters of trust don't end up in the ether they end up in our hands so

[0:40:33] Trustee Langereis: uh i just don't want anybody to believe writing to us as a as a futile exercise because we certainly

[0:40:40] Trustee Langereis: you may not like you always like the outcome but we always read it and so thank you for that though

[0:40:48] Voice 10: early in the term um we did some work with the community social worker and people for

[0:40:53] Voice 10: health community because we wanted to get an idea of how many people would be angela

[0:40:57] Voice 10: yeah it's the community social worker and phc so working with

[0:41:02] Voice 10: organizations that

[0:41:03] Voice 10: offer direct service to people who are unhoused critically housed yeah so um we keep the numbers

[0:41:11] Voice 10: that we had then this was 2018 2019 it was 65 individuals and that doesn't count

[0:41:22] Voice 10: critically unhoused so that would be from homeless to

[0:41:25] Voice 10: um not having sufficient services so

[0:41:29] Voice 10: unsafe housing so that number was 65 then um a lot of times four years ago two to three years

[0:41:36] Voice 10: ago a lot has happened before the pandemic

[0:41:39] Voice 10: and i would encourage the incoming trustees of them on

[0:41:42] Voice 10: all islands to come to grips with this and deal with it because it's been sort of unofficial and

[0:41:49] Voice 10: even that number is leveled in and i'm sure it's a level

[0:41:52] Voice 8: compared to what it is now

[0:41:53] Voice 8: so the current

[0:41:54] Voice 8: bylaws allow some really inhumane circumstances and they allow it to be perpetuated so something

[0:42:07] Voice 8: something has to change, but with any, if any way of advancing compassion knows that

[0:42:12] Voice 10: this has to change.

[0:42:13] Voice 10: And in attempting to do some of the work, we've reached out to some of those individuals to make sure those voices are included in the process.

[0:42:20] Voice 10: That is not an easy thing when you're doing community engagement. It's easy to lose those voices.

[0:42:26] Voice 10: It's important that you go out and talk to them if they're willing, because a lot of people have been involved in the process and not seen change.

[0:42:32] Voice 10: and that that well

[0:42:34] Voice 8: the people who

[0:42:34] Voice 10: make these decisions are

[0:42:36] Voice 8: in a separate class of people who

[0:42:38] Voice 8: are affected by it that's my that's my immediate situation okay so

[0:43:50] Trustee Langereis: has recently as the last six months and thanks to the good work of trustee Colburn amongst others

[0:43:59] Trustee Langereis: has passed a resolution about a housing emergency and has urged the province to

[0:44:04] Trustee Langereis: to do something specific related to this region because we know it's a multi-faceted solution

[0:44:09] Trustee Langereis: as we walk look around the trust different solutions are emerging some of the building

[0:44:16] Trustee Langereis: housing uh affordable housing projects that we we see it here and other elsewhere well

[1:15:22] Voice 5: but the suite doesn't have a building permit so now there again it's un you know it's a

[1:17:46] Voice 5: is um a motor home or a travel trailer with no hookup on a lot no water and no hook up to a

[1:17:55] Voice 5: septic are we you know what's the situation what's the intent does he intend to allow for that to be

[1:18:00] Voice 5: a potential deferral or not um it could also be on the lot that's vacant or it could be on a lot

[1:18:07] Voice 5: where there's a principal drawing and then the travel trailer is there and it's unhooked so

[1:18:13] Voice 5: that's another situation there is the issue of float homes and boats but my understanding from

[1:18:18] Voice 5: the definition and the bylaw of both and a vehicle are not structures that's it's a definition the

[1:18:28] Voice 5: only exception is a vehicle used for a sale of food products in a commercial zone so basically

[1:18:36] Voice 5: a structure doesn't include a float home doesn't include a vehicle that brings the question what

[1:18:42] Voice 5: is the vehicle we don't define that the motor vehicle act defines it and it has a number of

[1:18:48] definitions but basically

[1:18:50] Voice 5: it would appear to be that it is a vehicle with a motor or a trailer

[2:06:00] Voice 5: taking over you know single-family homes apartments whatever and they're reducing the stock of rental

[2:06:07] Voice 5: property and also increasing the cost for renters and the other thing i related this is personal

[2:06:15] Voice 5: is that multiple property ownership is a problem, mind you.

[2:06:23] Voice 5: It should, you know, if residential property should be owned by one person only,

[2:06:28] Voice 5: you shouldn't own three residential properties.

[2:06:33] Voice 5: That would be one way, as a society, we could reduce the inequity that occurs right now

[2:06:39] Voice 5: because you get these wealthy people, they buy properties all over the place.

[2:46:49] Voice 4: post-development of up to 24 units of affordable rental housing squarely within that new development

[2:46:56] Voice 4: permit area for environmental protection and the purpose of the development variance from

[2:46:59] Voice 4: an application is to consider the variance to the parking requirement for parking areas

[2:47:06] Voice 4: as shown in the site plan to be sited as close as zero meters to the setback which is a 1.5

[2:47:14] Voice 4: meter setback to the front lot line which is providing the ministry of transportation

[2:47:17] Voice 4: station road to Paisley Road. The two subject properties are both owned by the

[2:47:22] Voice 4: Gabor Law Housing Society. They're approximately two hectares combined

[2:47:27] Voice 4: size at the end of Paisley Road. And the scope of the development is shown in

[2:47:33] Voice 4: figure two for the development permit area and for the EVP application, which

[2:47:39] Voice 4: is construction of up to 24 dwelling units, a common house, bicycle storage

[2:47:43] Voice 4: large areas, water treatment, which is a total of up to 6.3%

[2:47:49] Voice 4: lot coverage for the law one, and up to 8.4% total coverage

[2:47:54] Voice 4: for law two for buildings and structures to 32 vehicle parking

[2:47:58] Voice 4: spaces, 30 bicycle parking spaces. The proposal is for

[2:48:02] Voice 4: approximately 67, 6,770 square meters of true removal or

[2:48:07] disturbance, which is 34% of confined lot area and 13,000

[2:48:12] square meters

[2:48:13] Voice 4: of forest retention 66 of the confined library so in summary the application

[2:48:19] Voice 4: is compliant with the island stress policy statement the proposed development complies

[2:48:23] Voice 4: with the objectives and policies of the official community plan and the development permit

[2:48:27] Voice 4: guidelines in the land use file it meets all the land use bylaw siting regulations except

[2:48:32] Voice 4: for the required variance that's under consideration today for the proposed striking

[2:48:37] Voice 4: and given that the parking areas in this particular development would not adversely

[2:48:41] Voice 4: impact adjacent property owners and we've received no correspondence or concerns up to

[2:48:47] Voice 4: this point in time staff are recommending approval of the dbp and dp the applicant submitted an

[2:48:56] Voice 4: environmental overview report which is the bulk of the application for the package before you

[2:49:01] Voice 4: our preliminary arborist report as well as the landscape architecture plan to support the

[2:49:06] Voice 4: application for the development permit specifically and those are in attachment three

[2:49:10] Voice 4: and the citing of the development and recommendations for measures to protect

[2:49:15] Voice 4: the coastal dunks for ecosystem are included in the dpa draft development permit area

[2:58:45] Voice 6: the end and there is the potential that we'll have to come back and have an amended or a new

[2:58:49] Voice 6: development permit but presuming we get the full funding uh and potentially it happens quickly then

[3:01:40] Voice 6: these orange trees that either have been identified because of their proximity to buildings or where

[3:01:48] Voice 6: we have to do grade changes uh where our you know our effort is to keep them um but obviously they

[3:01:53] Voice 6: need uh it depends a little bit on underground root structure um and what happens through the

[3:01:58] Voice 6: excavation process whether there's any kind of impact on the trees and requires a post

[3:02:04] Voice 6: excavation assessment by the um uh you know by the arborist you know our intent is to keep as

[3:02:10] Voice 6: many of them as we can um but you know there are you know a few things that are a little bit out

[3:02:14] Voice 6: of our control one example is in this zone here where we know there's a hydro pole somewhere there

[3:02:20] Voice 6: and an underground power line running you know towards uh the buildings um and so it's a bit

[3:02:27] Voice 6: dependent on hydro whether we can keep those two trees and you know i could explain all the

[3:02:32] Voice 6: different trees too but that's the general uh item these ones are the ones that are a little

[3:02:36] Voice 6: bit more kind of root rot we have a trail going through so partly it's a safety assessment you

[3:02:40] Voice 6: know through that zone um so it's just being really clear that you know that there may be some

[3:02:46] Voice 6: scattered removal of trees within this tree protection zone because of uh

[3:02:50] Voice 6: because of those tree conditions ultimately and

[3:02:53] Trustee Langereis: so as i read that if we go to the middle

[3:02:56] Trustee Langereis: of the development and there's a hexagon or um yeah that one it looks like all of those trees

[3:03:10] Voice 6: other factors we've tried to leave that cluster as large as we can and we're pretty confident we'll

[3:03:21] Voice 6: center of the site you know a sort of a utility channel you know which compresses it on one edge

[3:03:26] Voice 6: the parking on the other but with careful work we we should be able to retain that stand and it's

[3:03:31] Voice 6: really important you know for the overall feel of the site as well as you know uh you know for

[3:03:36] Voice 6: the society and having that kind of that green sort of middle of the of the site which was always

[3:03:41] Voice 6: our intent and

Chair Rogers called the meeting to order at 10:32 am, welcomed the public and introduced 
Trustees, Staff and Recorder.  Chair Rogers, Trustee Colbourne and Trustee Langereis 
acknowledged that the meeting was being held in the territory of the Coast Salish First Nations. 
2. APPROVAL OF AGENDA 
By general consent the agenda was approved as presented. 
3. RISE AND REPORT - Closed Meeting September 29, 2022 
The Gabriola Local Trust Committee appointed Jack Woodward, Laurie Jackson, and Kathryn 
Berge to the Board of Variance for the Gabriola Island Local Trust Area for a three-year term 
effective September 29, 2022.

4.1 Trustee Reports 
Trustee Colbourne reported the following and his attendance at the following meetings 
and events: 
 Petroglyph events, thanked Gabriola Museum and Snuneymuxw First Nations Elders 
for their work; and 
 Health and Wellness Collaborative workshop.

4.2 Chair's Report 
Chair Rogers reported the following:  
 Acknowledged and thanked everyone for the privilege of being Chair on Gabriola; 
 Thanked Staff for their work; 
 15 new Trustees and 11 returning Trustees elected in recent election; 
 Trust Council will be on November 17, 2022 when Trustees will be sworn in; and 
 New Islands Trust Executive and representatives of Islands Trust Conservancy will be 
chosen on November 19, 2022. 
4.3 Electoral Area Director's Report 
Vanessa Craig, Regional District of Nanaimo (RDN) Electoral Area B summarized the 
report and noted the following: 
 Thanked Trustees for their work over the last 4 years; 
 Huxley Park shade structures installed and installation of fencing to commence 
soon; 
 A tree planting party is scheduled for the end of November for Huxley Park; 
 Parks and Open Space Advisory Committee (POSAC) meeting November 28, 2022 at 
the 6:30 pm at Agricultural Hall; 
 Re-doing the alternative approve process for Little Qualicum River Regional Park; 
 Applying for a grant for Fuel Management Prescription report for Descanso Bay 
Regional Park and Cox Community Parks; 
 Increasing rebates for wood stove exchanges or alternative heating; and 
 RDN Board meeting November 8, 2022.

5. TOWN HALL 
A member of the public supported a census to identify how many residents were living in illegal 
dwellings on Gabriola as they consider the suspension of enforcement on illegal dwellings. They 
noted the previous enforcement suspension of a bylaw on April 11, 2019, when the LTC 
suspended bylaw enforcement of public markets due to a conflict in community around long 
standing and essential avenues of public life, urged Trustees to support the suspension of 
enforcement for non-compliant dwellings to remove barriers to community’s essential functions 
while working to improve them. 
A member of the public supported the deferment of bylaw enforcement on non-compliant 
dwellings and noted that a 2 year deferment was not adequate as many dwellings will never be 
compliant with bylaw as it currently stands.  The bylaw needs to be updated to reflect the needs 
of the community. 
A member of the public thanked Trustees for their leadership and encouraged them to take 
action on the deferment of enforcement for non-compliant dwellings. There has been 
community commentary, as well as, Housing Advisory Planning Commission (HAPC) and the 
Advisory Planning Commission (APC) referrals, which have provided community feedback. 
Supported an Official Community Plan (OCP) review to bring OCP up to current context with 
current challenges. 
A member of the public noted class issue of people living in substandard, alternative non-
compliant, illegal dwellings and elites that have never experienced housing insecurity and are

benefitting from and pushing institutional housing. Requested a census to examine the issue 
and advocacy for those experiencing housing insecurity. 
o Trustees noted that People for a Healthy Community (PHC) and Angela Pounds, Community 
Social Worker did a report on the critically unhoused and those in substandard housing a 
few years ago, however, an updated report was needed to reflect current conditions and 
housing emergency. 
6. MINUTES 
6.1 Local Trust Committee Minutes dated July 28, 2022 - for adoption - to be distributed 
The following amendments to the minutes dated July 28, 2022 were presented for 
consideration: 
 Page 2, Trustee Langereis reported on the following, 2

 Page 5, 8.1 GB-DVP-2022.2, replace “two density zones” with “split density zones”.

7.2 Draft Standing Resolution on Enforcement of Non-Compliant Dwellings - for discussion 
After reviewing correspondence, HAPC and APC minutes, Town Hall commentary and all 
feedback, Trustees Langereis and Colbourne put forward alternate motions for 
consideration. 
PROPOSED MOTION 
that the Gabriola Island Local Trust Committee formally consults the community on the 
intent and wording of the following draft standing resolution, including consideration of 
any sunset clause to the resolution:

That, subject to section 2, bylaw enforcement staff defer enforcement on the unlawful 
residential use of a building on a lot if, on the date the resolution is adopted,   
a) the building is occupied as a residence, and  
b) enforcement would cause undue hardship to the occupants of the building.  
That bylaw enforcement staff undertake enforcement action on unlawful residential use 
of a building if:   
a) there is more than one unlawful residential use on the lot, or  
b) enforcement staff reasonably determine:  
i. there is a risk of danger to the health and safety of the occupants,   
ii. that sewage is not being disposed of in an approved septic or sewage 
disposal system,   
iii. that use of the septic or sewage disposal system connected to the building 
exceeds the sewage system’s capacity, or  
iv. there is sewage contamination of wells, streams or other nearby 
waterways.  
That this standing resolution does not override enforcement for contravention of other 
provisions of the land use bylaws.    
That the local trust committee periodically request statistics from enforcement staff on 
the number of complaints and deferrals to ascertain the effectiveness of the bylaw 
enforcement deferral.

a) that the Gabriola Island Local Trust Committee note that given the lack of housing 
options on Gabriola, Bylaw Staff will defer enforcement on all existing non-
compliant dwellings being used for residential purposes except in the following 
circumstances:  
i. It is determined that there are risks to health and safety; 
ii. It is determined that sewage is not being disposed of in an approved septic 
or sewage disposal system; or that septic or sewage disposal systems are 
beings used in excess of capacity or ability as a result of non-compliant 
dwellings; 
iii. It is determined that there is contamination of wells or other drinking water 
sources;  
iv. Non-permitted residential uses are in environmentally sensitive areas;  
v. That the Gabriola Island Local Trust Committee may give direction to 
resume enforcement on activities on any property that poses risk to the 
health and safety of residents. 
b) Nothing in this enforcement policy should be interpreted as giving permission to 
violate the Land Use Bylaw and the Gabriola Island Trust Committee may change 
this policy at any time and may give direction to expand enforcement activities at 
any time. 
c) The Gabriola Local Trust Committee will review this standing resolution at a 
minimum of once per year with updates from the Bylaw Compliance and 
Enforcement Manager to measure results and impacts, as amended.

 LTC has received community and Advisory Committee feedback, hoped to pass 
Standing Resolution to protect people and environment, while moving forward with 
an OCP review; 
 Incoming LTC may reverse Standing Resolution if they do not support; 
 Supported concept of: complaint, deferral of enforcement, report to LTC and LTC 
make a decision; 
 Requested adding water zones to item iv. of the second proposed motion; 
 The second proposed motion did include trailers, felt no reason to distinguish from 
other non-compliant dwellings; 
 Residential use for a building is a more accurate description rather than non-
compliant dwelling; 
 Dwelling included all types of residences, even those that are not considered a 
“building”; 
 The second proposed motion addresses most of LTC concerns; 
 Supported the word “existing” so as not to incur new non-compliant situations; 
 Standing Resolution is only part of the solution to address housing crisis; and 
 Reminded public about the Density Donation Project.

Acting Planning Manager Zupanec summarized the report which introduced a combined 
Development Permit (DP) and Development Variance Permit (DVP) application for LTC 
consideration. 
 
  Trustees noted the following: 
 Interested in a qualified environmental professional to develop impact assessment 
plan and a construction management plan. 
  Ian Scott, representative of the applicant noted: 
 The septic disposal waste water field area may reduce the calculated forest 
retention area based on recommendation from arborist post-installation, due to 
area root rot etc.; 
 Parking area material is permeable crushed gravel; 
 Interested in being as “shovel ready” as possible to be in best position to obtain 
funding; and 
 Intention of site plan is to leave clusters of trees in development area, however, will 
need post development arborist assessment to assess root structure and condition.
