[0:00:25] Voice 5: information meeting and I believe Planner Smith is going to give us a summary.

[0:00:50] Voice 7: that I presented on October 20th, which more or less describes the application for trustees as

[0:00:59] Voice 7: well as the public can you see that yes

[0:01:08] Voice 7: was presented in october staff's thought

[0:01:13] Voice 7: resolution from the local trust committee directing staff to proceed with this application

[0:01:18] Voice 7: and to prepare job bylaws consistent with the option i'll describe in a moment here

[0:01:25] Voice 7: Here the application is to transfer 10 densities from one subject property to the other subject

[0:01:35] Voice 7: property.

[0:01:35] Voice 7: Let's turn on it to enable the donation of the portion of property, Payne Road, to the

[0:01:49] Voice 7: Nature Trust of BC.

[0:01:50] Voice 7: And so, staff recommended that the Local Trust Committee proceed, and we also agreed at that

[0:02:01] Voice 7: meeting to give the draft bylaws first reading, which the Local Trust Committee has done via

[0:02:11] Voice 7: RWM.

[0:02:12] Voice 7: And so, now we are here at the public hearing stage and community information stage.

[0:02:20] Voice 7: bridge and so uh yeah sorry sorry excuse

[0:02:25] Voice 8: me i don't know if it's true for everybody else but

[0:02:27] Voice 8: you're breaking up slightly every now and again i'm not sure if it's the headset or what i don't

[0:02:32] Voice 8: know if anybody else is having the same issue thank you i'll

[0:02:38] Voice 7: into the microphone is that better yeah okay so here are the subject properties uh located on

[0:02:44] Voice 7: on Payne Road and here on Narvaez Bay Road.

[0:02:49] Voice 7: This is the Crooks property.

[0:02:51] Voice 7: This is the Bertolama property.

[0:02:53] Voice 7: The proposal is to take 10 of the 15 rural general densities

[0:02:58] Voice 7: from this property here on Payne Road

[0:03:02] Voice 7: and transfer them to the property on Narvaez Bay Road.

[0:03:06] Voice 7: And with that exchange of densities,

[0:03:09] Voice 7: a majority portion of this parcel

[0:03:13] Voice 7: parcel is then transferring to the Nature Trust and so walking through the proposal there's

[0:03:24] Voice 7: 10 densities transferred and that reduces the future density potential on the Payne Road property

[0:03:35] Voice 7: and the Norvez Bay or the Norvez Road property gains 10 World General densities through the

[0:03:44] Voice 7: rezoning from forest general to rural general in that portion of property the applicant is

[0:03:49] Voice 7: proposing a boundary adjustment to retain their portion of their homestead on the

[0:03:57] Voice 7: Narvaez or on the Payne Road property which is more or less right here two hectare portion would

[0:04:04] Voice 7: be retained by the Bertolami family to retain their homestead and so they are also applying

[0:04:12] Voice 7: applying for a boundary adjustment, which would be dealt with at time of subdivision.

[0:04:18] Voice 7: The Local Trust Committee approved the Islands Trust Policy Statement guidelines, policies

[0:04:27] Voice 7: for the application at the, in the RWMs, was found to be consistent with the OCP changes.

[0:04:37] Voice 7: changes. And option three, which was proposed above, proposes that the designation and rezoning

[0:04:47] Voice 7: change on the crooks property from forest general to rural general as the most appropriate

[0:04:55] Voice 7: mechanism to avoid other impacts to broader components of the OCP. There was groundwater

[0:05:04] Voice 7: water supply considerations proposed.

[0:05:07] Voice 7: There have been, there's been feedback through the,

[0:05:12] Voice 7: through the process of sending it to agencies.

[0:05:16] Voice 7: The CRD is in favor of the application,

[0:05:21] Voice 7: as long as there's no broader impact

[0:05:23] Voice 7: to the mile harbor, the water service area

[0:05:27] Voice 7: that's already created there.

[0:05:29] Voice 7: So it would be up to Mr. Crooks to prove water

[0:05:34] Voice 7: at time subdivisions now the previous LTC left it the water just water

[0:05:44] Voice 7: specialists did propose for potentially looking at a community water system so

[0:05:50] Voice 7: that's something the LTC could turn my mind to there's the bluffs development

[0:05:57] Voice 7: development permit area within the Bertolami property.

[0:06:02] Voice 7: So that will need to have a DP issued

[0:06:07] Voice 7: for them to get their subdivision approved

[0:06:12] Voice 7: as part of the Bluffs guidelines.

[0:06:17] Voice 7: And there's a minimum or a maximum density covenants

[0:06:21] Voice 7: on a few of the associated properties,

[0:06:23] Voice 7: which staff don't see as a significant issue

[0:06:28] Voice 7: to this application.

[0:06:30] Voice 7: So that's more or less the summary of the project

[0:06:33] Voice 7: and the agencies here have all been referred to.

[0:06:37] Voice 7: Like I said, there was one piece of feedback

[0:06:40] Voice 7: from the CRD, Integrated Water Services

[0:06:44] Voice 7: and Island Health has no objections to the proposal.

[0:06:48] Voice 7: And there was one First Nations response to the referrals

[0:06:53] Voice 7: with the Lake Couch and First Nation

[0:06:56] Voice 7: saying that they have no concerns or comments at this time.

[0:07:00] Voice 7: so uh with that i'll pass it back to you to uh chairman and uh we can proceed

[0:08:23] Voice 4: see fit just in the general context of um of of comment on this application so I don't think we

[0:08:31] Voice 4: need to specifically treat it unless there's something you know that jumps right out to your

[0:08:36] Voice 4: attention um i do

[0:08:40] Voice 7: have it here in front of me now yeah so it is suggesting that instead of uh only

[0:08:46] Voice 7: uh having 12 densities on uh the crooks property why not have 15 or 16 to increase

[0:08:54] Voice 7: the opportunity for more housing to be developed i mean it's ultimately up to the applicant i think

[0:09:01] Voice 7: it that's what they're proposing that's what they see as a reasonable change on their land base

[0:09:07] Voice 7: uh there's also the groundwater considerations of more more lots requires more wells or water

[0:09:15] Voice 7: access which all has a bearing on approvals and future quality of life for residents and one of

[0:09:23] Voice 7: those other important pieces so i think it's a piece of feedback you can accept and consider

[0:09:30] Voice 7: or with whatever weight you decide in your public hearing deliberations you know and following that

[0:09:37] Voice 7: decisions you be presented thank you

[0:09:43] Voice 2: um so

[0:09:48] Voice 5: any other questions from the trustees oh

[0:10:11] Voice 4: expected hope outcome will be for today yeah

[0:10:18] Voice 7: information meeting and if there's any questions by members of the public this would be their

[0:10:22] Voice 7: opportunity to ask any questions of the applicants or staff or the trustees about the application

[0:10:32] Voice 7: and any aspect of it that they have a question about.

[0:10:37] Voice 7: Following the CIM, we have a public hearing scheduled.

[0:10:41] Voice 7: This is where the local trust committee

[0:10:44] Voice 7: will have the opportunity to hear from the public

[0:10:48] Voice 7: about what their perspectives are regarding the proposal.

[0:10:53] Voice 7: It's more of a one-way dialogue

[0:10:55] Voice 7: between members of the public

[0:10:57] Voice 7: and the local trust committee.

[0:10:59] Voice 7: And once that public hearing is completed, then at that time, the trustees can accept

[0:11:06] Voice 7: no further new information from the applicant or the public regarding the application and

[0:11:12] Voice 7: any information exchange needs to only flow through staff.

[0:11:17] Voice 7: And so then after the meeting, you have a staff report presented to you in the agenda

[0:11:24] Voice 7: agenda package which provides recommendations from staff regarding moving to next steps which is

[0:11:32] Voice 7: executive committee approval so all bylaws require islands trust executive committee approval

[0:11:39] Voice 7: all land use bylaw changes and then well with respect to in this case the ocp amendment

[0:11:46] Voice 7: amendment, the OCP bylaw 136 would also be sent to the minister of municipal affairs

[0:11:57] Voice 7: who has a approval role prior to the local trust committee then having the opportunity

[0:12:03] Voice 7: to consider whether or not to adopt the bylaws and put them into statute into the bylaw regulations.

[0:13:30] Voice 1: of elio's property so that's 12 lots in total do i have that correct um and the placement of the lots

[0:13:45] Voice 1: Since those two public roads are vastly different

[0:14:17] Voice 7: The exact layout of how those lots look

[0:14:24] Voice 7: would largely be considered at time of subdivision.

[0:17:44] Voice 5: Okay. This public meeting is being convened pursuant to Section 465 of the Local Government Act in order to consider the following proposed bylaws.

[0:18:00] Voice 5: 2000 amendment number one 2022 proposed bylaw number 137 cited as saturn island land use

[0:20:25] Voice 7: hearing binder available during this public hearing and it is located on the islands trust

[0:20:29] Voice 7: website under current applications for saturn island so just the per the purpose of proposed

[0:20:37] Voice 7: Proposed bylaws 136 and 137, if adopted, will amend the Saterna Island Official Community Plan bylaw number 70-2000

[0:20:45] Voice 7: and the Saterna Island Land Use Bylaw number 119-2018 to redesignate and rezone a portion of the subject parcel located at 104 Norvez Bay Road,

[0:20:57] Voice 7: currently designated forest land and zoned forest general, to a designation of rural and a zoning of rural general.

[0:21:05] Voice 7: In addition, 10 subdivision densities would be removed from the subject parcel located at 119 Payne Road and transferred to the subject parcel located at 104 Norvez Bay Road via a land use by-law amendment that would increase the subdivision density on the newly created rural general zone portion of 104 Norvez Bay Road to a maximum of 12 new lots.

[0:21:35] Voice 7: capital regional district planning and protective services building inspection and integrated water

[0:21:41] Voice 7: services island health the main island north and south pender island local trust committees

[0:21:47] Voice 7: for comment uh as i spoke to earlier two responses to those comments island health had no objections

[0:21:56] Voice 7: to the by-law amendments and CRD integrated water services

[0:22:01] Voice 7: recommended going forward,

[0:22:04] Voice 7: as long as there was no impact

[0:22:07] Voice 7: to the Lyall Harbor water service area.

[0:22:11] Voice 7: It was also referred to Couch and Trogs,

[0:22:14] Voice 7: Halong First Nation, Lake Couch and First Nation,

[0:22:16] Voice 7: Laiakson First Nation, Malahat First Nation,

[0:22:19] Voice 7: Paquichin First Nation, Penelakut Trog,

[0:22:22] Voice 7: Semiamu First Nation, Tsunami First Nation,

[0:22:25] Voice 7: Nation, Stonemus First Nation, Starslip First Nation,

[0:22:29] Voice 7: Say Out First Nation, Wausau First Nation,

[0:22:32] Voice 7: Sakem First Nation, and Wausonic Leadership Council

[0:24:08] Voice 1: of the possibility of transferring density a fifth by recent reporting at the

[0:24:17] Voice 1: symposium in Montreal on biodiversity success, a fifth of the species are extirpated in Canada

[0:24:23] Voice 1: so far. And one of the greatest problems is of contiguous habitat. And to have that

[0:24:31] Voice 1: part of Brown Ridge and Mount Fisher be able to be put together as the Nature Conservancy

[0:24:43] Voice 1: has worked i find that a very a very good use so we don't have just tiny pieces of land we have a

[0:24:50] Voice 1: contiguous area and that's a very valued um and important what would we say um use of this bylaw

[0:25:01] Voice 1: and so i'm very pleased about that and i am grateful to um elio to the large amount of work

[0:25:08] Voice 1: that's gone into this also paul brent i know was supportive of that and i'm very appreciative of

[0:25:13] Voice 1: that as has been lee and um i'd like to thank barry and jerry also for how this goes i'm not

[0:25:21] Voice 1: sure how the how on narva's bay road where i where i live how it will settle out but i'm very glad

[0:25:27] Voice 1: that an area has is receiving further protection um and i appreciate the efforts on everybody's

[0:25:34] Voice 1: been half this doesn't happen magically it involves a lot of administrative work
