[0:01:15] Voice 13: i'm elected on luskete island and i'm chair of the hornby island local trust committee
[0:01:21] Voice 13: i'm joined today by hornby island trustees grant scott and alex allen and together we make up the
[0:01:28] Voice 13: Hornby Local Trust Committee. Also joining us today is Daniel Arbour, Director of the Comox
[0:01:34] Voice 13: Valley Regional District's Electoral Area A. Welcome, Daniel. And we have some staff members
[0:01:41] Voice 13: joining us today. Catherine Vogt is our minute taker. Rene Jamarat is the Regional Planning
[0:01:48] Voice 13: Manager of the Islands Trust Northern Office. Sonia Zupanek is our Island Planner, and Will

[0:03:44] Voice 13: um so we'll move on to section four which is reports and that starts with the trustee reports
[0:03:55] Voice 13: So, uh, which of the local Hornby trustees would like to go first.
[0:04:02] Voice 11: Alex should, because he's the senior of us.
[0:04:06] Voice 11: A little bit older, he is, um, and on here, he's wiser.
[0:04:14] Trustee Allen: Stroke, stroke, stroke, grant.
[0:04:16] Trustee Allen: Um, well, he's older, but I guess I'm wiser.

[0:04:25] Trustee Allen: to acknowledge that I'm from, I am on the unceded territory of the Comox First Nations and other
[0:04:32] Trustee Allen: Coast Salish peoples, Cornby Island. And yeah, it's all about starting a new term and orientation.
[0:04:39] Trustee Allen: It's amazing how many orientations and webinars we've had this term. So it's been good actually,
[0:04:43] Trustee Allen: because I think probably Tim, you could probably say that we could have used that back a few terms
[0:04:50] Trustee Allen: ago. It's been really good. I've attended things I don't necessarily even have to attend, but
[0:04:53] Trustee Allen: but it was just interesting seeing the banter.
[0:04:56] Trustee Allen: So I'm on the Trust Programs Committee.
[0:05:02] Trustee Allen: Interesting enough, it was a tie, I and another individual,
[0:05:07] Trustee Allen: and then they had to pull a name out,
[0:05:08] Trustee Allen: and I'm vice chair, I'm not the chair, but that's okay.
[0:05:11] Trustee Allen: So I've been working with Christina Evans from South Tender,
[0:05:13] Trustee Allen: and I'll be vice chair of the Programs Committee.
[0:05:16] Trustee Allen: And then the Regional Planning Committee,
[0:05:17] Trustee Allen: I decided I'm making up for lost time
[0:05:19] Trustee Allen: because I wasn't on any committees
[0:05:21] Trustee Allen: for a couple of terms there.
[0:05:23] Trustee Allen: and i'm i'm just a member and we've got chair laura patrick who's amazing chair from salt
[0:05:28] Trustee Allen: spring island she will be the chair of that committee and um i'm looking forward to working
[0:05:34] Trustee Allen: with my fellow trustee grant scott and uh and you chair tim peterson and i'll say full disclosure
[0:05:41] Trustee Allen: tim and i bonded the first time we met two terms ago and uh we have very we have similarities we
[0:05:47] Trustee Allen: both we're both great cooks we're really funny i'm funnier than him but um and we like to do skits
[0:05:53] Trustee Allen: and whatnot and so yes and his lovely partner lisa so that's my full disclosure i've known tim
[0:05:58] Trustee Allen: for a long time and uh i'm really looking forward to him being our chair i think it's yeah i think
[0:06:03] Trustee Allen: it's going to be interesting times and uh yeah and to the staff and everyone else let's

[0:06:53] Voice 11: actually see you over there um you can't you can run but you can't hide um and daniel it's always
[0:07:00] Voice 11: good to see you on thank you so just the issues on the island um the tower um the cell tower is
[0:07:08] Voice 11: certainly a big issue that alex and i are being and daniel too are hearing a lot about
[0:07:14] Voice 11: uh pros and cons um the thatch is ongoing just getting it done you could see it as you enter
[0:07:20] Voice 11: the island we were uh heavy into planning for herring fest through the conservancy so early
[0:07:24] Voice 11: march so if you go to conservancy hornby island website you can find out a lot about what we go
[0:07:29] Voice 11: got a really exciting uh program coming up uh speakers actually the chief from up here
[0:07:35] Voice 11: of the Kittasu is going to come down they've done an amazing video on herring and so they're
[0:07:43] Voice 11: he's coming down the herring fest with a number of other people from up here so it's going to be
[0:07:48] Voice 11: a really interesting herring fest we're emphasizing more on first nations issues and we're going to
[0:07:54] Voice 11: have somebody speak about the the weirs in the in the in the Comox well it's the Puntlage really
[0:08:01] Voice 11: the estuary, you know, in front of the village there. So that's going to be interesting. Hopefully
[0:08:05] Voice 11: we're trying to getting someone from the Comox band to come and speak. So we'll see how that
[0:08:11] Voice 11: works out. Ferry advisory, of course, the ferry issue is huge. We've just, I was on it last term
[0:08:19] Voice 11: and Alex is going to go on this on as the trust rep for this term. So he'll be on the ferry advisory
[0:08:27] Voice 11: committee. Daniel, I think you're on there as well. And of course, we're all involved and I'll
[0:08:32] Voice 11: be on there whenever I'm needed. And I got elected to the Trust Conservancy. So I'm on there
[0:08:40] Voice 11: working. I'm going to a meeting next week. I'm looking forward to the first meeting down in
[0:08:44] Voice 11: Victoria with the folks of the Trust Conservancy. So I'll just leave it at that. And

[0:09:03] Voice 13: so for my chair's report i just want to uh say that i'm i'm actually delighted to be uh the new
[0:09:09] Voice 13: chair on hornby and i i look forward to learning more about issues that are important uh to hornby
[0:09:17] Voice 13: residents and hopefully uh get to spend a bit more time on hornby in the next four years
[0:09:24] Voice 13: uh hornby being my geographically closest uh island neighbor here from luskete i've actually
[0:09:32] Voice 13: spent a fair bit of time uh recreating and and a couple times performing over on hornby and
[0:09:38] Voice 13: i i do have some some friends over there and and uh looking forward to getting to know more of you
[0:09:46] Voice 13: and and uh delving into the important issues there so with that i'll pass it over to director arbor

[0:09:57] Voice 1: you, Chair, and thanks for inviting me today and congratulations to the three of you
[0:10:02] Voice 1: for your reelection at the Allen's Trust and I look forward to a good term working on issues
[0:10:09] Voice 1: of interest together. I think the model we followed the last four years was at least to
[0:10:16] Voice 1: have one formal meeting a year between the staff of the Allen's Trust and the CVRD and I think
[0:10:25] Voice 1: that's worked pretty well we managed to even have a little meeting i think on zoom uh during covid
[0:10:31] Voice 1: uh and so if that formats works well for this committee i'll uh i've already indicated to our
[0:10:36] Voice 1: staff that uh i look forward to our first meeting and and one of the things i requested is um
[0:10:42] Voice 1: whereas in the past it's just been us together if you're interested i was thinking maybe we
[0:10:46] Voice 1: could invite um some of the people involved around the housing issue uh the the um hornby allen uh
[0:10:53] Voice 1: housing society because at the CVRD we've in the past year we've completed a little study and
[0:10:59] Voice 1: there's a lot of questions around how we're going to either provide support or funding to that
[0:11:05] Voice 1: that kind of efforts initiatives around housing not only on Hornby but on Denman as well
[0:11:12] Voice 1: and this weekend I think there's a there's a meeting of the the housing network so I look
[0:11:19] Voice 1: forward to participate in that as well one remaining item that we have in common from
[0:11:26] Voice 1: the last term and it's been a on a slow cooker but it's progressing a little at a better clip at the
[0:11:34] Voice 1: CVRD right now it's around the contemplating septic regulation and sept in addition to septic
[0:11:43] Voice 1: education basically across the regional district so there was a study that was showcasing some of
[0:11:50] Voice 1: the the red hot areas and we know that in the last year and a half there's been some pretty
[0:11:56] Voice 1: bad neural virus outbreaks in the marine environment and so we'll probably have that
[0:12:03] Voice 1: topic as well when we meet and otherwise I'm always happy to hear initiatives I've been
[0:12:12] Voice 1: approached by a couple of members of the co-op board to look at maybe the downtown co-op area,
[0:12:21] Voice 1: the ringside area. So I'll take a meeting as well, I think this weekend, just to understand what they
[0:12:26] Voice 1: have in mind and whether there's any role for the CVRD. As you know, we mostly look after
[0:12:32] Voice 1: infrastructure and services and not so much the planning on the island. And lastly, on the
[0:12:39] Voice 1: personal front yeah i'm i'm just like you i'm getting back into uh the work and and the various
[0:12:43] Voice 1: committees and um i'm still a rep at the federation of community municipalities and we're in the
[0:12:49] Voice 1: process of renegotiating the bid um infrastructure funding agreements uh including the community
[0:12:56] Voice 1: building funds and we just recently received some climate related funding so a lot of activities
[0:13:03] Voice 1: and I spend a little bit of my time on that file for sure.
[0:13:07] Voice 1: So happy to answer questions
[0:13:08] Voice 1: or provide more comments if you wish.

[0:13:19] Trustee Allen: Are you meeting with a co-op board meeting
[0:13:21] Trustee Allen: on board member regarding?

[0:13:30] Trustee Allen: And I just want to caution you that
[0:13:31] Trustee Allen: this is actually on our work programs list.
[0:13:34] Trustee Allen: This is a revitalization, but we have to go,
[0:13:37] Trustee Allen: as you know, it has to be an iterative process
[0:13:39] Trustee Allen: and the individual has been contacting me
[0:13:42] Trustee Allen: and I've been holding back because it's larger
[0:13:45] Trustee Allen: than just the co-op, it's MOTI, it's the parks,
[0:13:48] Trustee Allen: it's all sorts of people.
[0:13:49] Trustee Allen: So I'll just be interested in,
[0:13:52] Trustee Allen: cause we would like to all have a formal meeting on this
[0:13:55] Trustee Allen: eventually when we get through a few other issues.

[0:14:02] Voice 1: because that same topic is coming up for me

[0:14:11] Voice 1: do want to see some improvement,
[0:14:13] Voice 1: especially around safety and walkability,
[0:14:15] Voice 1: active transportation
[0:14:18] Voice 1: and betterment of their core areas.

[0:16:49] Voice 6: I'm speaking with concerns about the proposed cell tower.
[0:16:55] Voice 6: And I think many Hornby people really understand the need for improved, significantly improved internet here.
[0:17:05] Voice 6: And we have the City West project coming in with fiber optics.
[0:17:10] Voice 6: And I guess in a nutshell, I would, I really appreciate that we have the Islands Trust in place here.
[0:17:22] Voice 6: and Hornby is seen as such a refuge for people whether it's local people it's part-time people
[0:17:29] Voice 6: it's people who come to visit and I think we walk a fine balance there between retaining our rural
[0:17:38] Voice 6: quality retaining you know protection for our sensitive environment here and having
[0:17:49] Voice 6: folks come in and want more and more conveniences and I would I just really
[0:17:56] Voice 6: speak for postponement of the proposed cell tower application until we have had
[0:18:05] Voice 6: City West in place for at least six months and we can see what that gives us
[0:18:10] Voice 6: and what we might need to add to the mix I have sent a letter to both of our you
[0:18:19] Voice 6: you know, Trustee Allen and Trustee Grant,
[0:18:22] Voice 6: which I think you have in your emails.
[0:18:25] Voice 6: And I have made some suggestions.
[0:18:30] Voice 6: I see that you have the possibility of amendments
[0:18:33] Voice 6: to the model strategy.
[0:18:35] Voice 6: And I have made some suggestions in my letter about that.
[0:18:39] Voice 6: So I just really support you in your work
[0:18:44] Voice 6: in preserving and protecting this place.
[0:18:47] Voice 6: I have been really amazed personally at how many people, young, old, very diverse opinion that had strong concerns about the tower.
[0:19:00] Voice 6: Primarily, I would like to see the notification area enlarged as it can be from the model strategy to a thousand meters circumference.
[0:19:14] Voice 6: And that would help to put our school and our hall and so many other places there within that area.
[0:19:24] Voice 6: So

[0:20:53] Voice 7: recycle depot and uh and we are a staff of seven people and if if you include the manager we're
[0:21:00] Voice 7: eight um and i say seven staff we're uh all part of the union qp local five five six and um i did
[0:21:08] Voice 7: ask our local um to um help us with a letter representing just us seven staff not not the
[0:21:16] Voice 7: entire local but uh since we're in very close proximity to this proposed tower um there's a
[0:21:23] Voice 7: lot of concern about it of course you know we we have to come this is basically our our work
[0:21:28] Voice 7: place and if you know if you've seen the topographical map it's extremely close
[0:21:33] Voice 7: and there's uh there's um concerns i it's hard for me for me to speak for all seven of us at
[0:21:38] Voice 7: at the same time but we do wonder what can be done to uh for something that is extremely close
[0:21:45] Voice 7: I mean, I know there needs to be choices with these things,
[0:21:49] Voice 7: but it's right in our face.
[0:21:51] Voice 7: And I just thought I would express that.
[0:21:54] Voice 7: Our local did send a letter on behalf of the seven of us,
[0:21:59] Voice 7: just asking about safety code six,
[0:22:04] Voice 7: and did get an answer from the consultant, Brian, sorry.

[0:22:09] Voice 7: And it was nothing we didn't expect,
[0:22:12] Voice 7: expect but uh but there is concerns about that um thanks i i just got into the meeting here just at
[0:22:19] Voice 7: the end of jan's uh talk there at the tail tail end but uh but i've read that i've talked to
[0:22:25] Voice 7: jan a number of times and uh and and i can concur with all those points too and uh and uh that's
[0:22:33] Voice 7: about all i can say but uh thank you uh

[0:24:55] Voice 9: to make this presentation to the Hornby Island Local Trust Committee today I am Margaret Birch
[0:25:01] Voice 9: a fourth generation resident on Hornby Island. My great grandparents settled on Hornby in 1903
[0:25:08] Voice 9: and farmed Maplehurst Farm for decades. Thomas and Margaretha Smith and my grandparents Betty
[0:25:16] Voice 9: and Lee Smith were part of the community when the community hall was first built in 1928

[0:25:36] Voice 9: My grandmother Betty was also one of the founding local trust committee members during the 1960s.
[0:25:42] Voice 9: I'm representing HIRA's Community Hall Committee to provide an update on the project to establish
[0:25:47] Voice 9: a Hornby Island Community Heritage Register, an approved project that was added to the work
[0:25:52] Voice 9: program list in December 2021. At the local trust committee meeting of December 2021,
[0:26:03] Voice 9: I provided a delegation presentation requesting to formalize an official list of places that
[0:26:13] Voice 9: local government identifies as having heritage value or character. Our aim was to establish a
[0:26:19] Voice 9: community heritage register for Hornby Island to recognize and celebrate historic places within
[0:26:24] Voice 9: the community. This would be consistent with the Community Heritage Register that is in place now
[0:26:30] Voice 9: for several years with Denman Island. We brought endorsement from the Higher Executive, Hornby
[0:26:37] Voice 9: Island Archives Committee and New Horizons Society. Research and support from Islands Trust
[0:26:44] Voice 9: is required to establish the Community Heritage Register. A motion was carried at the December
[0:26:52] Voice 9: 10th 2020 meeting to add the community heritage register to the projects list through 2022
[0:27:01] Voice 9: consideration to give it to advance this project was not possible given islands trust staff
[0:27:09] Voice 9: workload on the current local trust committee work program of priorities specifically the
[0:27:15] Voice 9: official community plan update however the community hall committee learned about the
[0:27:21] Voice 9: Comox Valley Regional District's
[0:27:23] Voice 9: Cornby Island Heritage Conservation Service By-law 317
[0:27:27] Voice 9: that can assist with funding up to $4,200 per year.
[0:27:32] Voice 9: Funding from the Comox Valley Regional District
[0:27:35] Voice 9: through the service by-law would cover the cost
[0:27:37] Voice 9: to prepare a cultural heritage statement of significance,
[0:27:41] Voice 9: which is the first step before a by-law
[0:27:43] Voice 9: or community heritage register can be developed.
[0:27:46] Voice 9: Funding is available for the 23-24 fiscal year
[0:27:50] Voice 9: beginning in April.
[0:27:53] Voice 9: Conditionally, the island's trust need to commit to establishing the permit process and administering the register ongoing.
[0:28:01] Voice 9: The first vision of the Hornby Island Community Hall came in 1922.
[0:28:07] Voice 9: The community island's social life was outgrowing the Hornby Island Schoolhouse that was built in 1891.
[0:28:14] Voice 9: Heritage conservation cares for a community's past, for present and future generations.
[0:28:19] Voice 9: The community hall and the schoolhouse are culturally significant, actively used community buildings that provide heritage value and character for Hornby Island residents and brings heritage tourism value to this rural island.
[0:28:32] Voice 9: A community heritage register for Hornby Island will strengthen the community's cultural and heritage connections to the island's most important buildings.
[0:28:39] Voice 9: It also opens possible opportunities to future funding, access to grants for structural improvements that both these buildings will need.
[0:28:51] Voice 9: And, of course, public and First Nations consultation will follow in the future, but a statement of significance specifically for the Hornby Community Hall is a necessary first step.
[0:29:01] Voice 9: Our request is for renewed support by the local trust committee to establish a community heritage register for Hornby Island, prioritizing startup of this project for the 23-24 budget year, so that we may access the CVRD funding to start the first step of the process, and redirect a modest staff time budget for Islands Trust planning staff to support this project to establishing the register.
[0:29:32] Voice 9: Our commitment is the Community Hall Committee will provide background research and support for a heritage conservation consultant to prepare the statement of significance and assist the Islands Trust planning staff when the time comes for public or First Nations and First Nations consultation.
[0:29:53] Voice 9: As land use planning is undertaken by Islands Trust, establishing a community heritage register falls within the mandate of
[0:30:00] Voice 9: Islands Trust. CVRD's Hornby Heritage Service By-law is only a funding mechanism provided by
[0:30:07] Voice 9: them for us for this work. Funding by the CVRD will support the preparation of a statement of
[0:30:13] Voice 9: significance in order to substantiate the property's inclusion on a heritage register.
[0:30:19] Voice 3: The
[0:30:19] Voice 9: register will need to be developed by the Islands Trust. Once the register is established
[0:30:24] Voice 9: by the Islands Trust, the Islands Trust can determine what kind of heritage permit process
[0:30:29] Voice 9: may be applicable and how the Islands Trust

[2:48:22] Voice 4: So this is an opportunity for the local trust committee to formally receive the application from Rogers for the proposed 63 meter tower on Hornby Island and discussion around how the more recently adopted protocol and strategy model strategy that was adopted by the LTC will apply.
[2:48:45] Voice 4: and next steps as the applicant has undertaken community consultation and notification that's
[2:48:52] Voice 4: consistent with the federal requirements and we understand there's significant community interest

[2:54:07] Voice 2: So I guess from the outset,
[2:54:10] Voice 2: having been through a tower proposal on Hornby previously
[2:54:13] Voice 2: for another client, as you all know,
[2:54:15] Voice 2: it was quite a different proposal.
[2:54:17] Voice 2: It was a Telus tower, not even a cell tower,
[2:54:21] Voice 2: was a different type of technology.
[2:54:24] Voice 2: So I bring that up only just to say I was mindful from the outset of trying to do our homework to make sure that we would propose a responsible location that hopefully, to the extent possible, would be supported by the community, as well as the Islands Trust's own land use bylaw.
[2:54:45] Voice 2: So just to kind of take you back to the beginning as to sort of what I was up against so to speak,
[2:54:52] Voice 2: Roger's initial specification for this site pointed to me trying to get a tower right next
[2:54:58] Voice 2: to the co-op and I knew from my prior experiences that that would not have been the type of location
[2:55:06] Voice 2: that the community would have responded well to and so I basically insisted that Roger's re-review
[2:55:15] Voice 2: their concept and consider whether there might be alternative locations you know further set
[2:55:22] Voice 2: back from some of those more visible parts of the community that might be better and then also
[2:55:28] Voice 2: did a bit of an analysis of the land use bylaw talked to some local stakeholders and people I
[2:55:33] Voice 2: know on the island and we arrived at identifying about four locations in the vicinity of basically
[2:55:40] Voice 2: the fire hall and the crown land where we're currently located the first concept just so that
[2:55:45] Voice 2: you are aware because i don't think this has been discussed really in a public venue is we actually
[2:55:50] Voice 2: tried in earnest to put the tower at the fire hall but it's a crown grant and the province wouldn't
[2:55:57] Voice 2: allow us to put the communication site on a crown grant and they have some policy reasons for that
[2:56:03] Voice 2: basically when there's a crown grant it's my understanding that that land is only to be used
[2:56:08] Voice 2: for this explicit purpose that it was granted which is in this case a fire hall and we looked
[2:56:15] Voice 2: at a few other locations generally in that vicinity and i think the reason we were attracted
[2:56:20] Voice 2: to that area other than that it actually does work quite well from a technical standpoint
[2:56:24] Voice 2: as well as through your land use bylaw basically there is existing similar infrastructure
[2:56:30] Voice 2: in the area there's the tower from the radio station across the street albeit you know i
[2:56:35] Voice 2: I acknowledge it's of a different scale, you know, a different type of service that it provides that is there, however, as well as I believe a communication site from the fire hall.
[2:56:46] Voice 2: And so we just sort of thought that, you know, that was a decent launching point for us to begin to talk to the Islanders Trust as well as the province about whether or not this would be a reasonable proposal to start with.
[2:56:59] Voice 2: So this is kind of, that takes us back to sort of how we arrived with this concept from the beginning.
[2:57:06] Voice 2: from there we did some detailed pre-consultations with the ministry of forests lands and natural
[2:57:11] Voice 2: resource operations which is the provincial entity that manages those crown lands where
[2:57:16] Voice 2: we're proposing the site we looked at multiple locations and part of me my i'm doing dad duty
[2:57:23] Voice 2: at the same time here um basically that location checked out uh as one that didn't have any other
[2:57:30] Voice 2: other known applications contrary to some other comments that we've heard there are no other known
[2:57:36] Voice 2: applications for that particular parcel nor any known conflicts for this proposal to move forward
[2:57:42] Voice 2: at least as a proposal so it seemed to be a reasonable candidate to begin to consult the
[2:57:48] Voice 2: community so from there we began to consult the island's trust staff first at the time it was
[2:57:55] Voice 2: heather cower who i had a video conference with as well as a bunch of emails and i think just
[2:58:02] Voice 2: your prior comments what happened here in terms of any lack of understanding of the
[2:58:09] Voice 2: local trust committee model antenna protocol is that that had not been adopted at the time of our
[2:58:17] Voice 2: discussions with heather cower and then of course she departed the islands trust and this file was
[2:58:23] Voice 2: handed over to sonia and so i think it's just through the different staff turnover and and
[2:58:29] Voice 2: frankly the multi-month uh pre-consultation that i went through that maybe there was a bit of a
[2:58:36] Voice 2: the handoff wasn't maybe done as clearly so there was no mal intent there i don't think anybody
[2:58:44] Voice 2: intended to to have any oversights um nonetheless we submitted our our crown application uh we've
[2:58:53] Voice 2: sent referrals to, I think, over 10 First Nations, some of whom we've heard back from,
[2:58:58] Voice 2: including the Comox Nation, which Heather Cowher advised was a key stakeholder amongst others.
[2:59:07] Voice 2: And to get, I guess, to the point, to fast forward to today, we did then go through the
[2:59:12] Voice 2: Innovation, Science and Economic Development Canada default consultation process,
[2:59:18] Voice 2: because we were not aware of there being this local model protocol, so to speak.
[2:59:24] Voice 2: To Sonia's point, that process, if you compare and contrast the model protocol
[2:59:29] Voice 2: to the federal default process that we've gone through,
[2:59:33] Voice 2: they're almost the same in terms of when you break it down
[2:59:36] Voice 2: into the components of what we have to do.
[2:59:39] Voice 2: There's newspaper notices, which through discussions with your trustees,
[2:59:44] Voice 2: We actually did notices in four local publications.
[2:59:50] Voice 2: There's a mail-out, which we can discuss whether or not that needs to be added to in some way.
[2:59:56] Voice 2: So it's a mail-out to within three times tower height is what the...
[3:00:00] Voice 2: the federal process requires we'll have to review more closely with your staff whether we need to
[3:00:04] Voice 2: add to that in any way and then we also although it's not stated in the federal process we did you
[3:00:11] Voice 2: know do a digital public meeting and I know that your model protocol does state a recommendation
[3:00:18] Voice 2: for for some kind of a public meeting or workshop and I think the format of it is sort of up for
[3:00:26] Voice 2: discussion so we did that as well and then in order to bring us into closer compliance with
[3:00:32] Voice 2: the model strategy sonia has recommended that we share this information at your committee here
[3:00:37] Voice 2: today which is why we're here so basically we've now gone through this federal process the the
[3:00:44] Voice 2: comment period for that first part of this closed on the 13th but i've been trying to give everybody
[3:00:50] Voice 2: assurance that that truly is just the start of this proposal frankly when we're proposing
[3:00:57] Voice 2: anything on crown land it on average can take over a year so we're I don't think we're even
[3:01:06] Voice 2: remotely close to being at a decision point just to kind of take the pressure off you know we're
[3:01:13] Voice 2: not in any way trying to give people an impression that the discussion's over and that we're pressing
[3:01:18] Voice 2: for a decision, so that's kind of where we're at.

[3:02:19] Voice 2: is a fairly small percentage of our sites to be honest with you it's probably i don't know one
[3:02:24] Voice 2: out of every 10 sites or something like that but i have dealt with it before and i did learn a fair
[3:02:29] Voice 2: bit on this particular application um basically uh it's it's my understanding that sort of through
[3:02:37] Voice 2: my prior comments there um like we were more than open to potentially going on to uh the fire hall
[3:02:44] Voice 2: um and i've also explored other other types of uh crown grants in the past um i've encountered
[3:02:53] Voice 2: another one in another file and the province has been quite clear that i guess because those lands
[3:02:59] Voice 2: lands are granted for a particular use, that the entities that are granted that land are
[3:03:06] Voice 2: not to sort of sublease or sublicense it out for other purposes, especially if there's
[3:03:13] Voice 2: any kind of a payment or profit from it.
[3:03:16] Voice 2: They listed some examples for me.
[3:03:18] Voice 2: I seem to recall they mentioned that the Crown Lands Officer alluded to, they've had cases
[3:03:24] Voice 2: is where you know small airports are sometimes crown grant in remote areas and often the
[3:03:30] Voice 2: operators have expressed a desire to have you know like a tenant or a coffee shop or a restaurant or
[3:03:36] Voice 2: something there and they're not even allowed to do that kind of a thing so that's basically my
[3:03:42] Voice 2: understanding of how crown grants work is you know it's only for that specific use which is a fire
[3:03:48] Voice 2: hall i tried to kind of debate that a little bit and said well surely there's ancillary uses there
[3:03:54] Voice 2: already there's you know um communication site for the the fire hall's needs i i believe there's
[3:04:01] Voice 2: probably other utilities such as power and and you know could could we be considered uh something
[3:04:07] Voice 2: similar uh but i was basically told uh that that was a losing debate and to move on respectfully
[3:04:17] Voice 2: So we were then given kind of, we came up with several options and this particular proposal seemed to be the one that at least the Crown had no concerns with us at making

[3:05:55] Voice 11: the school everything else now there's a lot of vacant crown land up behind there could could one
[3:06:02] Voice 11: of his one of those other four spots i realize roads and everything getting back there is more
[3:06:07] Voice 11: expensive but is it possible to move it further away from where there are existing facilities
[3:06:13] Voice 11: and people living and on the island that that's number one yeah

[3:06:49] Voice 2: alternatives locations that that that you think might be worth us exploring it would be good to
[3:06:55] Voice 2: know um approximately where those might be um so we can can see if it checks out uh with the crown
[3:07:03] Voice 2: And then, you know, the other comment, as you all know, I've probably alluded to this before, but the further we get away from supporting infrastructure, existing access roads and power, basically the more land we have to clear to build an access road and a power line into the facility.
[3:07:23] Voice 2: So, you know, there's kind of an ecological footprint trade-off, so to speak.
[3:07:27] Voice 2: So we do try.
[3:07:29] Voice 2: It's not just about the cost.
[3:07:31] Voice 2: I know sometimes people interpret it as such.
[3:07:34] Voice 2: Certainly there are cost realities.
[3:07:36] Voice 2: I'm not pretending otherwise, but there is some merit from a land use standpoint to try
[3:07:41] Voice 2: to be at least near, you know, existing roads and power lines so that we're not unnecessarily,
[3:07:46] Voice 2: you know, cutting down trees to build this infrastructure.
[3:07:49] Voice 2: The other thing to consider, and I know it's probably not a popular topic, so I won't sort of press on it too much, but in some ways, there is already existing radio communications infrastructure right there, equally as close, if not closer, to the buildings.
[3:08:05] Voice 2: This proposed facility is about 120 meters, I think, off of Central Road into the subject property.
[3:08:12] Voice 2: So, you know, compared to other similar uses in the area there is already, I would say a fairly substantial setback that's over 300 feet through a forested area.
[3:08:23] Voice 2: So, so there is that too.
[3:08:27] Voice 2: But yeah, we'd be I think open to to exploring any, any specific suggestions.
[3:08:33] Voice 2: suggestions. Just bearing in mind, obviously, the trade-offs and effectively, you know, we couldn't
[3:08:40] Voice 2: commit to it right away. That would require, I guess, everything to be started over, right? We'd
[3:08:45] Voice 2: have to resubmit the application, redo the consultation, re-notify all the First Nations,
[3:08:51] Voice 2: you know, resubmit to the Crown, so on and so forth. So I would say in order to do that,
[3:08:57] Voice 2: it would have to probably have some substantial merit as to you know it being clearly better for
[3:09:05] Voice 2: the vast majority of people but we're not opposed to to reviewing ideas okay

[3:15:14] Voice 2: worst meeting I've ever been to but it certainly was one of them you know we basically what we
[3:15:19] Voice 2: typically do and what we try to do there is you know at the request of the community come rent
[3:15:23] Voice 2: rent out a space, put up some poster boards and have staff on hand to walk around the room and
[3:15:29] Voice 2: discuss in kind of a friendly format. Very quickly, people showed up with a megaphone,
[3:15:34] Voice 2: set up chairs in the middle of the room, told us they weren't going to follow the format.
[3:15:38] Voice 2: And, you know, some of them said some fairly disparaging things. All of the content on our
[3:15:44] Voice 2: boards was crossed out at the end of the meeting, we noticed, and there was even with permanent ink
[3:15:48] Voice 2: and there was swear words on them and all this kind of stuff. So, you know, that happened
[3:15:52] Voice 2: specifically on Hornby but you know that no physical harm or anything like that but it
[3:15:57] Voice 2: sort of left me with a fairly I guess disparaging feeling and then more recently there's been other
[3:16:06] Voice 2: meetings elsewhere and not too far away from Hornby I won't get into the details but some of
[3:16:13] Voice 2: these people that are that may be involved in Hornby I have reason to believe from folks that
[3:16:19] Voice 2: that I know have taken it to a more assertive level

[3:25:18] Voice 2: three towers sited directly beside one another they tend to be co-located or clustered in the
[3:25:23] Voice 2: same area and don't cause interference as long as the frequencies are are different i think for the
[3:25:29] Voice 2: radio station over in that direction mount jeffrey is more likely to block their signal than
[3:25:33] Voice 2: the you know a couple meter wide uh lattice tower that's a couple hundred meters away
[3:25:41] Voice 2: but we'll get them a formal response directly from from rogers on that just to give comfort
[3:25:46] Voice 2: but yeah there should be there should be no uh basis for that in my opinion as far as i can tell

[3:28:34] Voice 2: with us especially if we're directly beside a taller mountain like mount jeffrey no aircraft
[3:28:42] Voice 2: aircraft should probably be flying that low in that location it would be unsafe for other reasons
[3:28:47] Voice 2: so I would I would imagine it seems to me based on other similar instances unless there's a flight
[3:28:55] Voice 2: path or airport zoning or like an airport runway in the vicinity that which I'm not aware of
[3:29:01] Voice 2: I find it likely that they will not require marking or lighting and I can I'm basing that
[3:29:09] Voice 2: on making hundreds of similar applications you know i obviously we defer to them as the regulator
[3:29:14] Voice 2: it's it's up to them but i it doesn't seem to me like the type of site that would probably require
[3:29:23] Voice 2: any marking or lighting but we do have in our consultation materials of some verbiage around
[3:29:29] Voice 2: you know we will comply with nav and transport candidates requirements but
[3:29:33] Voice 2: it just doesn't seem likely to me in this spot as and as for um environmental concerns
[3:29:40] Voice 2: i mean i'm not an ecologist don't and i don't want to uh to position myself as such
[3:29:47] Voice 2: but we have talked to some environmental qualified environmental professionals on other projects
[3:29:53] Voice 2: and to your point i've been advised that it's sometimes towers
[3:30:00] Voice 2: particular in urban areas where there's already a lot of light and sometimes birds can be confused
[3:30:04] Voice 2: by that it's the the towers with flashing lights that can sometimes cause confusion as well as wind
[3:30:10] Voice 2: towers with turbines on them that can cause you know bird deaths but if you were to walk by any
[3:30:15] Voice 2: sort of typical cell tower at least according to the environmental professionals we've talked to
[3:30:22] Voice 2: we're not aware that there's any substantive evidence to suggest that you know birds are
[3:30:27] Voice 2: colliding or dying or being attracted to a typical cell tower so to speak the other comment would be
[3:30:35] Voice 2: to the best of my knowledge and actually I recently made an inquiry about this from a
[3:30:40] Voice 2: regulatory standpoint cell towers exempt is the wrong word here but cell towers
[3:30:47] Voice 2: generally are not defined as a designated project under the impact assessment act
[3:30:55] Voice 2: uh so it's more like more impactful projects like oil and gas or mining and some of those
[3:31:02] Voice 2: other larger scale linear type developments that require an impact assessment cell towers
[3:31:08] Voice 2: generally speaking unless we're clearly within say like a riparian setback or other designated
[3:31:16] Voice 2: zone generally we're not required to to do any environmental assessments

[3:34:47] Voice 2: actual plans there's no actual proposal submitted so you know for rogers uh what what are we
[3:34:55] Voice 2: supposed to do i guess really um i'd welcome any comments on that but i don't i don't think that
[3:35:04] Voice 2: this there's any way reason or to believe

[3:35:07] Voice 2: hinder or prevent a housing development

[3:37:13] Voice 2: directly competing with one another um you know one doesn't replace a need for the other the fiber
[3:37:19] Voice 2: line to your home or your business isn't going to help you if you're out on your boat or on the
[3:37:23] Voice 2: trails or your car breaks down you need to make an emergency call you know unfortunately a lot of
[3:37:28] Voice 2: people aren't conveniently located right next to their landline or fiber connection when those
[3:37:33] Voice 2: things happen so there's a lot of good reasons to have both mobile service as well as fiber service
[3:37:39] Voice 2: And I would say they're complementary to one another, don't compete with one another directly, and that most communities desire to have both mobile as well as fiber service.

[3:38:37] Voice 13: So this is my very first Hornby meeting, but I have been doing some reading of correspondence and some other materials.
[3:38:47] Voice 13: So one thing that I'm not clear on, and I'm not sure whether you can answer this succinctly or not, or whether staff has some subsidiary information.
[3:38:58] Voice 13: I have heard a dissatisfaction about the fact that the Hornbees consultation protocol, model, strategy, whatever the proper terminology is, and the default Industry Canada one, which was used.
[3:39:21] Voice 13: And I understand that there was a miscommunication or a timing factor in that information not getting to you in a timely manner, which is water under the bridge, and that's unfortunate.
[3:39:34] Voice 13: What I am not clear on is what the industry standard default lacks that is in the Hornby protocol strategy,
[3:39:51] Voice 13: strategy, and whether you feel it would be reasonable to approach making up the difference
[3:40:04] Voice 13: in those public consultation models, whether that's something that you think is doable,
[3:40:13] Voice 13: whether you think that's something that's a reasonable approach. I'm just looking at this
[3:40:20] Voice 13: from, as I say, from the perspective of what I've been privy to in public correspondence and stuff.
[3:40:28] Voice 13: And so it's the one thing that stands out for me that I haven't heard really addressed in this
[3:40:36] Voice 13: conversation. What is the difference? And is there a willingness to make up the difference,
[3:40:43] Voice 13: in other words, to fulfill the Hornby's protocol, despite the fact that, you know,
[3:40:49] Voice 13: to the best of your information at the time you did what you thought was correct so do you want

[3:42:14] Voice 2: meetings or you know we've already discussed that matter i think the other aspect in there that i
[3:42:20] Voice 2: need to take a close look at and maybe through sonia is whether we've fulfilled the the
[3:42:28] Voice 2: notification radius requirements so like in the iset process it's tied to the height of the tower
[3:42:35] Voice 2: it's like a three time radius of three times the height of the proposed structure
[3:42:40] Voice 2: and i don't know exactly what it says within the model protocol but there might be a difference
[3:42:47] Voice 2: there um and yeah like it's there's plenty of time here um i i think i'll if i'm reading between the
[3:42:56] Voice 2: lines correctly i think every it's been a hot topic um i think everybody already knows about
[3:43:03] Voice 2: it i would be amazed if anybody that's actually living on hornby island right now hasn't heard
[3:43:07] Voice 2: about this through social media and some of the other means so sure if i need to stuff some more
[3:43:16] Voice 2: envelopes and send out another round in the mail um we can do it to to try to align with that
[3:43:22] Voice 2: protocol or whatever the gaps may be but i don't know that it would really make a material

[3:43:46] Voice 2: screenshots there was a poll it was pretty popular i think about 200 people voted on it i don't know
[3:43:51] Voice 2: if you saw the results of that um and uh yeah we've heard from a lot of people i'll provide
[3:43:57] Voice 2: provide a summary of of that at some point when the timing is is appropriate certainly amenable
[3:44:03] Voice 2: to bridging the gaps where it's there's been absolutely no intent and it's not to our benefit
[3:44:08] Voice 2: to be seen as trying to skip a reasonable process oh

[3:44:19] Voice 13: clarity on that because uh uh I mean I I'm not a resident resident of Hornby I don't I don't take

[3:44:42] Voice 13: industry standard that if that's uh if that's something you are willing to you know commit

[3:45:41] Voice 13: and i i'm i i certainly don't know whether that's going to uh uh make a substantive difference on

[3:48:16] Voice 2: word out and we extended the comment period by i believe a couple weeks to accommodate for the
[3:48:22] Voice 2: holiday season and then in our minds i knew this but i understand that others maybe didn't and this
[3:48:26] Voice 2: is where people felt concerned by that um i fully knew that this was really just the tip of the
[3:48:31] Voice 2: iceberg in terms of the process um
[3:48:34] Voice 3: because yeah oh dear we seem to have uh i think greg seems to be

[3:51:23] Voice 11: and get on with it. I know that you've had a lot of problems in other places. And I think if you
[3:51:30] Voice 11: approach the island effectively um you can overcome that will there be pushback of course
[3:51:36] Voice 11: there will be but i think a good attempt at that and as far as anyway so i i just want to leave it
[3:51:42] Voice 11: at that plenty of time i don't think it's a very good answer that's what people want to hear they
[3:51:48] Voice 11: want to hear you say you're going to come to the island do the communication strategy on the island

[3:52:53] Voice 2: we've undertaken to date that's something we want to do but we're not clear that there is
[3:53:01] Voice 2: necessarily a requirement for an in-person public meeting and i have reason to believe that

[3:53:15] Voice 2: hopefully that can be taken into account as well at the end of the day we want to do the

[3:53:27] Voice 2: will continue to do so and so moving forward we can try to find some creative ways to uh to ensure

[3:56:07] Voice 2: however i have been to hornby many times i have some friends that live there
[3:56:11] Voice 2: and that are there every day and i would also say carefully if that is such a concern your
[3:56:24] Voice 2: land use bylaw suggests otherwise it specifically permits this use i believe
[3:56:32] Voice 2: and i could share that with you but we didn't arrive at this proposal haphazardly
[3:56:39] Voice 2: and without careful analysis so that's also what i believe to be a fact that might need to be

[3:59:32] Voice 4: with the rogers applicant and providing analysis on next steps and a review of the work that's been
[3:59:39] Voice 4: done to date in terms of consistency with the model and after you've received that information
[3:59:44] Voice 4: there's there's room for discussion about what if anything still needs to be
[3:59:48] Voice 4: completed there's nobody asking for concurrence today so there's no
[3:59:52] Voice 4: decisions to be made this is strictly information sharing for your benefit but
[3:59:56] Voice 4: I think some direction to staff that that's something that would be helpful

[4:04:04] Voice 4: an unreasonable request. It comes out of our application workload for you. It's not part of
[4:04:08] Voice 4: your project workload so there are we have no control over the types of applications that we
[4:04:13] Voice 4: have to direct staff towards supporting on your behalf because they come in when they come in and

Thank-you to all Advisory Planning Commission (APC) members for their hard work over the last term. 4.2 Chair's Report Trustee Peterson spoke on the following: Looking forward to being the new Chair of the Hornby Island Local Trust Committee and learning about issues of concern to the Island. 4.3 Electoral Area Director's Report Director Arbour spoke on the following: Congratulations to Trustees Allen, Scott and Peterson on their re-elections to the Islands Trust. In the last term, the format of at least one meeting per year between Islands Trust staff and the Comox Valley Regional District (CVRD) has worked well, and it is hoped that members of the Hornby Island Housing Society could be invited to attend as well to better plan for funding opportunities. Ongoing work on septic regulation and education across the CVRD; and recent contamination outbreaks in the local marine environment. Open to suggestions for initiatives in the Hornby Coop area. As a representative with the Federation of Canadian Municipalities, recent negotiating of infrastructure funding agreements for community building and climate change funds. Many local communities are wanting to see safety and walkability improvements in their busy neighborhood core areas. 5. PUBLIC COMMENTS Members of the public spoke on the following: Congratulations to returning Trustees Scott and Allen, and welcome to the new staff. The proposed cell tower should be delayed until 6 months after the City West fibre optic line is in place; and the notification area requirement in the Model Cell Tower Strategy should be enlarged to a 1000 metre circumference to include the school and community hall. Hornby’s rural quality of life should not be sacrificed for convenience. The Hornby Depot staff of 7 requested that CUPE Local 556 send a letter of concern of a safety code 6 regarding the extreme closeness of the proposed cell tower to the depot and have received a response from Brian Gregg. DELEGATIONS 6.1 Hornby Island Community Hall Committee and/or Hornby Island Residents and Ratepayers Association (HIRRA) regarding Establishing a Community Heritage Register for Hornby Island Margaret Birch, member of the HIRRA Community Hall Committee, delivered a power point presentation on the efforts to date to establish a Community Heritage Register on Hornby Island, noting the following: The Heritage Register would recognize and celebrate historic places on Hornby: the Community Hall, School House, and Room to Grow would be prioritized; future consideration could be given to private heritage homes and historic barns. Funding from the CVRD of $4200.00 to prepare the first step ‘cultural heritage statement of significance’ is available from April 2023. The Community Hall Committee is seeking renewed support from the Local Trust Committee (LTC) and a modest amount of time and budget from planning staff to enable the accessing of the CVRD funds. The Heritage Register and the establishment of a Heritage permit process will need to be developed and administered by the Islands Trust. Trustees discussed the feasibility of taking on the Heritage Registry as the chosen small project for the current term. Further discussion was deferred to agenda Item 10.1. 7. APPLICATIONS AND REFERRALS 9.1 Denman Island Local Trust Committee Referral for Response regarding Bylaw Nos. 228 and 229 Planner Zupanec explained that the two Denman Bylaws represented years of work on aligning regulations on Denman land within the Agriculture Land Reserve (ALR) with new Agriculture Land Commission (ALC) regulations; and clarified the regulations of farming activities outside of ALR land. ADOPTED Hornby Island ADOPTED 4 Local Trust Committee Minutes January 20, 2023 HO-LTC-2023-001 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee requests staff to advise the Denman Island local Trust Committee that their interests in proposed Bylaw No 228 and 229 are unaffected. CARRIED By general consent, the meeting was recessed at 12:19 pm and reconvened at 12:28 pm. By general consent, Trustees addressed agenda Items 13 and then 11 before Item 10 to allow for Consultants’ availability. Consultants Patricia Maloney and Sharon Horsburgh joined the meeting at 1:16 pm. 10. LOCAL TRUST COMMITTEE PROJECTS 10.1.1 Comprehensive Official Community Plan Review - Staff Report Planner Zupanec presented a status update report on the Official Community Plan (OCP) and Land Use Bylaw (LUB) Review project. Consultant Maloney and Trustees discussed the previous electronic public engagement and next steps in the consultation process. Planner Zupanec noted that there was approximately $5000.00 remaining in the budget for consultants’ engagement with the APC and one more electronic meeting with the community. Very recent correspondence from the community was requesting that the APC engagement be expanded to include other community groups. APC Chair, Wendy Burton was invited by Trustees to speak to the proposal to invite outside groups to the upcoming meeting between the APC and Consultants. She noted the following: members of the community had been invited to attend APC meetings and correspond with the APC throughout their referral process, especially members of the Hornby Housing Society, Hornby Island Community Economic Enhancement Corporation (HICEEC), and Hornby Island Short Term Rentals Association (HISTRA) were invited and did participate with a voice but no vote throughout the entire APC meetings process. the APC have been silenced and excluded for months from the discussion by not being able to communicate directly with the consultants. HO-LTC-2023-002 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request the members of the Advisory Planning Commission to meet with the project consultant by March 15, 2023 to review consultant recommendations on the OCP/LUB Review project and provide input on priority amendments to the OCP and LUB for LTC consideration. CARRIED ADOPTED Hornby Island ADOPTED 5 Local Trust Committee Minutes January 20, 2023 HO-LTC-2023-003 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to work with the consultant to schedule and advertise a second electronic Community Information Meeting prior to February 28, 2023, but after the Advisory Planning Commission meeting, to solicit public input on options to regulate Short Term Vacation Rentals. CARRIED HO-LTC-2023-004 It was MOVED and SECONDED, that a summary report be prepared by the consultant and submitted to planning staff by March 30, 2023 to clearly identify specific policy and regulatory changes recommended to advance improvements to the Official Community Plan and Land Use Bylaw in the four topic areas included in the review project. CARRIED HO-LTC-2023-005 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to prepare an update to the Hornby Island Official Community Plan and Land Use Bylaw Amendment Project Charter v. 2.0, dated September 9, 2022 to reflect the revised timeline and deliverables of the project. CARRIED Planner Zupanec noted that an $8000.00 business case for March Trust Council approval, if approved, would allow forward movement on existing LTC projects. Consultants Patricia Maloney and Sharon Horsburgh left the meeting at 1:56 pm. 11. CORRESPONDENCE Correspondence received concerning current applications or projects is posted to the LTC webpage 11.1 Letter dated December 1, 2022 from E. Hoeppner of Aquarian Systems Ind. regarding Siting of Water Cisterns Planner Zupanec noted that other Trust jurisdictions had excluded cisterns from setbacks in their LUB for greater siting flexibility on small lots; and that Initiating a small LUB amendment for cisterns could be accomplished with minor public engagement within the fiscal year within the $5000.00 budgeted for a single yearly allowable minor LTC project. HO-LTC-2023-006 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee ask staff for analysis on resources and funding in adding ‘Heritage Registry’ and ‘Excluding cisterns from the setback requirement’ and adding to the projects list by next meeting. CARRIED By general consent, the meeting was recessed at 12:53 pm and reconvened at 1:16 pm. 12. NEW BUSINESS ADOPTED Hornby Island ADOPTED 6 Local Trust Committee Minutes January 20, 2023 12.1 Local Trust Committee Meeting dates for 2023 - for consideration HO-LTC-2023-007 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee schedule its regular business meetings on the following dates in 2023: March 24, May 5, June 16, September 8 and November 3. CARRIED Planner Zupanec advised that in-person meetings were dependent upon meeting venues being booked far in advance of the actual meeting. Chair Peterson offered that he was very amenable to in person meetings and acknowledged that it was easier to pivot from an in person to an electronic meeting, but almost impossible the other way around. 12.2 Local Trust Committee Projects and Priorities - Staff Report Planner Zupanec presented the staff report which asks Trustees to review and endorse the current Active and Future Projects List-previously called the Top Priorities and Projects List; or provide direction for any changes to it. A Trustee noted that the four-corners issue was missing from the list. HO-LTC-2023-008 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee advise staff to defer item 12.2 until the next regular meeting. CARRIED A Trustee requested that the-updated Projects list for next meeting, including the Four- Corners item, be provided to Trustees prior to the next meeting by email. Consultant Brian Gregg joined the meeting at 2:20 pm. 12.3 Rogers Cell Tower Proposal – Update Planner Zupanec introduced the Consultant for Rogers Communications, Brian Gregg, noting that he had undertaken the community consultation and notification portion of the application process for the proposed 63 metre tower on Hornby Island, consistent with Federal requirements; and that he could answer to Trustees the extent to which the Islands Trust Model Cell Tower Strategy was not aligned. A Trustee questioned that the Islands Trust Model Cell Tower Strategy had been voted on and adopted by the Hornby LTC in September of 2022, so why was it overlooked by the consultant who defaulted to the Federal strategy instead? The consultant explained that prior to the departure of the previous Islands Trust Regional Planning Manager, ROGERS was not informed that the strategy had just been adopted by the LTC. Consultant Brian Gregg noted the following: Previous experience with the Hornby community on a Telus application for a Cell Tower on Hornby informed the consultant that extra time and attention would be needed to ensure a responsible, acceptable location for the tower. ADOPTED Hornby Island ADOPTED 7 Local Trust Committee Minutes January 20, 2023 The consultant insisted that Rogers re-review its proposed locations for the benefit of public acceptance. A first proposed Firehall location was rejected by the Province based on strict Crown Grant regulations that permit only one user on the land. The present proposed site for the Cell Tower has been vetted through consultation with the Ministry of Forests, Lands, and Natural Resource Operations (FLNRO) as having no other known applications or conflicts. Many months of consultation with the former Islands Trust Regional Planning Manager, Heather Kauer took place before the Hornby LTC adopted the Model Cell Tower Strategy. The manager did not inform ROGERS upon their departure that the strategy has just been adopted by the LTC. The Rogers application file was handed to Acting Regional Planning Manager Zupanec, who was also working under the original advice of staff that the Federal consultation process was in effect. Besides the Crown Application, referrals have been sent to 10 First Nations. K’ómoks First Nation, identified as a key stakeholder, has responded. The Innovation, Science and Economic Development Canada default federal consultation process was then initiated because we were unaware of their being a local protocol model. The federal default and local protocol model are almost the same, involving newspaper notices, Trustees discussions, notices in 4 local publications, mail-out notifications to anyone within a radius of 3 times the proposed Tower height, the last of which is the Federal requirement but could be added to. ROGERS exceeded Federal requirements by conducting a digital public meeting, which complies with the LTC strategy. Planner Zupanec has advised of ROGERS needing to introduce the project at this LTC meeting to comply with the local protocols. The comment period for the public meeting formally closed on the 13 th but a Crown application can take over a year, so there is no pressure to end public discussion. Approximately 130 total public comments have been received to date; roughly 1/3 support, 1/3 oppose, and 1/3 neutral or asking for information. Trustees asked the following questions and Brian Gregg provided the following answers: What is the difference between a Crown Grant and Crown Land? o The Province is clear that entities that are granted land for a specific purpose are not to sub-lease that land, especially if profit is involved. Small airports in remote areas are prohibited from even having a café on them. On general Crown lands, where there are no designated uses, one must submit a license application and wait while the Crown sends out multiple referrals The Tower is too close to the depot, school and community hall. Can it be pushed back further into the Crown land? o The present proposed location is not the only possibility. It was chosen for existing road and power accessibility to minimize the ecological footprint and avoid having to cut trees. A new location would necessitate an entirely new application process so would need substantial merit. What was the response from K’ómoks First Nation? ADOPTED Hornby Island ADOPTED 8 Local Trust Committee Minutes January 20, 2023 o They essentially provided a non-comment while asserting their rights to the land into the future, which is a common response. If there is opposition, they are usually quite clear. What was Rogers Communications’ response to the community request to hold a public meeting at the Hall about the Cell Tower? o An in-person meeting is reasonable but a prior public meeting experience on Hornby was disorderly. Also, security threats are a concern. A Trustee had been unable to get into the electronic public meeting session; and off-island residents may have also missed it. o Another electronic session could be provided. How much coverage would the Cell Tower provide and how many customers were with Rogers? o It was not personally known how many Rogers customers there were, but Telus was applying for co-location of the Cell Tower which would cover Telus, Rogers. Bell, Fido, Public Mobile, Chatter and many other subsidiaries. Carriers are required to cooperate on Cell Towers. The only locations on Hornby that may not be reliably covered are the upper portions of Mount Geoffrey and the seawater level point of Helliwell Park. Coverage maps can be provided on request. Could the Cell Tower cause broadcasting interference for the radio station? o A letter from the radio station was received by Rogers who responded. Basically, the 2 systems are on different frequencies and should not interfere. What about 911 calls? o He was not personally sure if Cell Towers on Lasqueti or Texada could route 911 calls; but a Cell Tower on Hornby would allow 911 calls for anyone with a cell phone, with or without a cell plan. What about migratory and other birds and the impact of 24-7 lighting of the Tower. o Rogers had applied to Transport Canada for no marking and lighting and expect to be agreed to because no aircraft would be likely to fly so low because of the height of Mount Geoffrey. Birds are most likely to be confused by flashing lights and wind turbines. Cell Towers are not generally required to conduct environmental impact assessments. The site of the Cell Tower had been proposed for a significant Community Housing project so there would be a lot of public resistance. o Rogers does not want to conflict with a housing application; but no application existed prior to Rogers’ application. Also, the lot is 200 acres and Rogers only needs a small 15x15 meter compound with underground electrical wiring to the site. Could the application be paused until after fibre-optic had been established? o Fibre-optic is a wonderful service but does not replace the need for mobile cell service. Chair Peterson asked what the Federal consultation standard lacks as compared with the local trust consultation protocols and could Rogers make up the difference? o Brian Gregg responded that the main difference is that the Hornby protocol requires a public information session which Rogers has done. The notification radius process may be different and further notification could be done. There is plenty of time to fill any gaps and apologies are offered if the process seemed ADOPTED Hornby Island ADOPTED 9 Local Trust Committee Minutes January 20, 2023 rushed. A large amount of effort over many months has already gone into the process. HO-LTC-2023-009 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to work with applicant Rogers on a report regarding steps the applicant has taken to date and their consistency with the Model Cell Tower Strategy. CARRIED Trustee Scott abstained. Planner Zupanec noted that time spent on a summary report by planning staff would be considered routine for applications processes and would not detract from staff work on other Hornby major and minor projects. Chair Peterson thanked Consultant Brian Gregg for presenting and answering questions. Consultant Brian Gregg left the meeting at 3:45 pm. By general consent, the meeting was recessed at 3:46 pm and reconvened at 3:51 pm. 12.4 Possible Amendments to the Model Strategy for Antenna Systems Chair Peterson spoke on his recent letter to Planner Zupanec regarding the recent Salt Spring Island Local Trust Committee resolution that added more robust First Nations and BC Archaeological Branch requirements to their Tower Siting protocols. Trustees received Chair Peterson’s letter for information. 13. Planner Zupanec noted that Trust Area Services was taking the lead in communications with K’ómoks First Nation. ADOPTED Hornby Island ADOPTED 10 Local Trust Committee Minutes January 20, 2023 HO-LTC-2023-010 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee requests that staff write a letter to the K’ómoks First Nation new Chief and Council reintroducing Trustees and Staff; and provide a schedule of Local Trust Committee meetings for the upcoming year, as well as provide an update of current projects and advocacy activities. CARRIED A Trustee added that the letter should begin by congratulating the new Chief and Council on their recent election. 13.5 Local Trust Committee Webpage 14.
