[0:00:39] Trustee Maude: I'm newly elected as the Vice Chair of the Linus Trust.
[0:00:44] Trustee Maude: Joining us is Erin Canigal, who also is new to the Trust.

[0:02:09] Trustee Maude: staff members are in their own homes our staff have the right to a safe and respectful workplace

[0:02:16] Trustee Maude: stuff. So first thing we're going to do is we're going to
[0:02:18] prove the agenda as circulated, if anybody has any additions, or
[0:02:23] anything with that.

[0:02:43] Voice 9: our second meeting because we did a meeting just to schedule meetings which is a thing um so but
[0:02:48] Voice 9: it's our first student person meeting so welcome um to the new year uh we are not entering the new
[0:02:54] Voice 9: year on the note that i would love to because there are as you can see there are going to be
[0:02:59] Voice 9: a number of concerns in the town hall raised that i am glad to see folks here to name that
[0:03:05] Voice 9: i do also encourage folks who do want to share to write in because when you write in we have
[0:03:13] fiscal correspondence it
[0:03:14] Voice 9: helps our argument immensely when we go to the province the crd to
[0:03:20] Voice 9: and for call in the crd to take issues forward it just helps a lot so please do write in um i
[0:03:28] Voice 9: have posted the last couple posts various email addresses and things and this one that i just
[0:03:33] Voice 9: for this morning for the post also included a number of things for people to use quick references
[0:03:39] Voice 9: in terms of things that have been going on we had a couple trust council meetings they've been great
[0:03:42] Voice 9: uh just getting to know the new trust council um there are some concerns around the budget
[0:03:49] Voice 9: this year so weigh in heavily we'll talk about that a little bit later um and i also really
[0:03:56] Voice 9: appreciate the adjustment of the council and of everyone for the half an hour later start
[0:04:02] Voice 9: the reason for that is i got appointed to the north american commission on for environmental
[0:04:06] Voice 9: protection and the meetings stop at 10 30. so i literally just got off the meeting in the other
[0:04:12] Voice 9: room so i'll always be here at nine but i have those meetings just before this one so i apologize
[0:04:16] Voice 9: for that change and thank you for the adjustment
[0:04:22] Voice 5: obviously very new to this and it's uh it's gotten
[0:04:27] Voice 5: gotten off. It seemed like a very slow start into it with not having a meeting until coming into
[0:04:34] January when you first went to trust council in November. But it's
[0:04:39] Voice 5: just been a lot of fun really
[0:04:42] Voice 5: to get to converse with people and talk to them about how they feel about the island and the
[0:04:47] Voice 5: island's trust and what concerns are moving forward. And I think it's sort of evidence in
[0:04:54] Voice 5: in that we have about a 170 page agenda for today
[0:04:57] Voice 5: for our regular meeting,
[0:04:59] Voice 5: and probably 90% of the people in the room
[0:05:02] Voice 5: aren't here for what's on that agenda,
[0:05:05] Voice 5: because we've had stuff that's come up
[0:05:07] Voice 5: in the last 10 days on Pender
[0:05:08] Voice 5: that is very important to people.
[0:05:11] Voice 5: And so it's a good indicator
[0:05:15] Voice 5: that people are willing to get involved
[0:05:17] Voice 5: and willing to come and talk to us
[0:05:21] Voice 5: and give us an idea of how folks are feeling
[0:05:23] Voice 5: on the island and i do want to echo what what jeff is saying about writing in it's been very
[0:05:30] Voice 5: very interesting for somebody like myself with no real background of it to see how those letters go
[0:05:36] Voice 5: through different levels of government and the responses that come back on them and that people
[0:05:41] Voice 5: are hearing about this at all different levels and willing to
[0:05:45] Voice 5: respond and get and at least give
[0:05:48] Voice 5: an opinion um if not get directly involved so um i think that it bodes well for our four years of of
[0:05:56] Voice 5: uh um forgiveness and through our term and it'll be uh it'll be good to work with everybody

[0:06:20] Trustee Maude: um they know my friends on pender allen um my aunt was a postman down at port washington many many
[0:06:28] Trustee Maude: many years ago and he can't um so sort of it all feels like family to me um this latest trust
[0:06:37] Trustee Maude: council it's it's an interesting one it's a very invigorated one there are some wonderful very
[0:06:43] Trustee Maude: talented people sitting around the table and i think the next four years will be quite exciting
[0:06:48] Trustee Maude: for islands trust we have a lot of stuff on our table um including the trust policy statement
[0:06:54] Trustee Maude: review the governance review possibly a management review where we've asked for the promise to a
[0:07:00] Trustee Maude: review of the trust as a whole so there's a lot of balls in the air and they're very important balls
[0:07:05] Trustee Maude: so this term is going to be quite interesting, but also which sort of segues over to our CRD
[0:07:14] Trustee Maude: presentation. We have an engaged CRD director who I think is going to help us work together
[0:07:21] because we all describe the Gulf Islands governance model as being fairly dysfunctional
[0:07:27] Trustee Maude: and it's a lot of it's because we don't really talk a lot. I think we have a commitment from
[0:07:33] Trustee Maude: Paul um to sort of be involved in the issues he of course is a previous trust trustee so he
[0:07:39] Trustee Maude: understands how we make the sausage on our side he's trying to figure out how to make it better
[0:07:44] Trustee Maude: sausage on his side and between the two of us our organizations I think is good it's going to be a
[0:07:50] Trustee Maude: good four years so I'll leave it at that thank you turn

[0:07:58] Voice 7: board but principally like why i'm here seriously is to make sure that we don't work across purposes
[0:08:05] Voice 7: that the right hand knows what the left head is doing and it's certainly in the past we've seen
[0:08:10] Voice 7: a situation where the trust and the crd seem to be moving in two different directions and so
[0:08:16] Voice 7: i'm going to be liaising with all of the local trust committees across the southern gulf islands
[0:08:22] Voice 7: and everybody else and we're going to try to work together to get important things done
[0:08:27] Voice 7: on these islands and so that's that's my mission and whether it's housing whether it's supporting
[0:08:34] Voice 7: our medical clinics whether it's transportation whether it's the environment we need to work
[0:08:39] Voice 7: together to and all agencies of the government province trust crd we haven't been very effective
[0:08:47] Voice 7: and uh so that's certainly my commitment it's commitment of our mla it's the commitment of our
[0:08:54] Voice 7: our mp and and so we got to do a better way better job of what we've been doing so yeah that's why

[0:09:04] Trustee Maude: you very much all right so we move on to what i guess is going to be interesting for
[0:09:09] Trustee Maude: the biggest town hall um so if anybody wants to put their hand up and be acknowledged and
[0:09:16] Trustee Maude: we'll go forward from there is that the one thing i was saying is that
[0:09:20] Trustee Maude: we have a brief period of time so if you could be sort of to the point and uh i'm assuming there's
[0:09:26] Trustee Maude: lots of people want to speak and we'll sort of get through as much as we can so gentlemen there

[0:09:39] Trustee Maude: i say anything that was my error i must say
[0:09:42] Trustee Maude: so i'll just i'll start off by just saying i want to begin the meeting by acknowledging that we're
[0:09:46] Trustee Maude: fortunate to be able to gather today in the locations across the traditional uh territory
[0:09:50] Trustee Maude: of the Coast Salish people. I just, I missed that in my introduction. I do apologize.
[0:09:55] Voice 21: Tony Irving, fourth generation Pender Islander, descendant of the Spalton family,
[0:10:03] Voice 21: also a citizen of the Métis Nation of BC, which makes me sensitive to indigenous issues.
[0:10:11] Voice 21: My mother was an Aang from St. Thurman Island, and as David knows, my mother's mother was a
[0:10:20] Voice 21: model from the island. So I have three feet roots here in the islands. My great-great-grandfather was a
[0:10:27] Voice 21: 18 member, first member of the first legislative assembly in British Columbia and I have a
[0:10:36] Voice 21: single sailor ship so they go pretty deep. So I'm kind of sensitive about stuff around Pender.
[0:10:42] Voice 21: My dad was one of the first trustees on Pender Island in the 70s.
[0:10:48] Voice 21: Um, you know, we talked about issues, Preserve and Protect was pretty big, my dad as a youth
[0:10:57] Voice 21: hand logged on the island, he taught me what that was like when you chop a tree down with
[0:11:03] Voice 21: a double fitted axe and a cross saw, cross cut saw, and, um, we talked a lot about logging.
[0:11:12] Voice 21: He did not like industrial logging, it is wasteful, destructive, and sadly on Kendra
[0:11:20] Voice 21: Island has become a very divisive issue. I stay away from the Facebook Panther Island forum because
[0:11:26] Voice 21: it's super divisive. I tend to keep a fairly low profile because I know what it's like to
[0:11:32] Voice 21: stick your neck out around here and so I'm a little disappointed that the preserve and protect
[0:11:40] Voice 21: seems to have gone adrift because it's causing division in the island. We have incidents like
[0:11:47] Voice 21: 4815 Schooner Road, a logging taking place in what to, I think, ain't reasonable why it looks like a watershed for the Madison Beach Conservation Area.
[0:12:01] Voice 21: Big trees in there. I didn't see the logging trucks leave, but I know a number of people here did see them leave.
[0:12:08] Voice 21: Although the eagle's nest might have been gone, there are certainly trees there that would have been potential routes.
[0:12:18] Voice 21: nest or heathering nests. And that's what I find really sad is that the trees leave the island and
[0:12:25] Voice 21: here we all are now to speak to that and not all of us maybe but a lot of us. I would just like to
[0:12:33] Voice 21: say that I really am hopeful and encouraged the Islands Trust to get some teeth to and the sad
[0:12:43] Voice 21: thing is, is once you start talking about this, you can help and start logging your properties.
[0:12:50] Voice 21: I really don't understand why I first arrived here in 1954 as a visitor with my parents,
[0:12:59] Voice 21: and I've lived here for over half my life, and it just turns my stomach when I see people buy a lot
[0:13:06] Voice 21: by clear-cutting edge to edge. You know, if you want a view, if you're staring at trees falling
[0:13:12] Voice 21: on your house. There's beautiful land in Alberta that has everything from flat land, prairie to mountain peaks, and you can go live there if you want kind of the ocean view.
[0:13:22] Voice 21: But if you're moving to Canada Island, I firmly believe you have to adjust, or any of the qualified ones adjust to Canada's rip era. We cannot destroy this place. Thank you.

[0:14:10] Voice 9: Recently, a business has been shut down.
[0:14:13] Voice 9: A local business was a home-based baking.
[0:14:18] Voice 9: It was in my neighborhood.
[0:14:21] Voice 9: Quality bread, I would add, and very cleanly presented.
[0:14:28] Voice 9: I mean, this looked very wonderful.
[0:14:30] Voice 9: I've bought bread here all the time.
[0:14:33] Voice 9: My son's really angry at this.
[0:14:35] Voice 9: shut down because it was one of his pleasures
[0:14:37] Voice 9: of coming to Bender.
[0:14:39] Voice 9: Now, I have no idea
[0:14:41] Voice 9: why.
[0:14:43] Voice 9: It apparently was to do with
[0:14:45] Voice 9: some health regulations,
[0:14:47] Voice 9: which baffles me totally.
[0:14:50] Voice 9: More people have
[0:14:51] Voice 9: gotten sick from commercial
[0:14:53] Voice 9: kitchens than have gotten
[0:14:55] Voice 9: sick from any other type.
[0:14:57] Voice 9: A commercial kitchen can have
[0:14:59] Voice 9: all the equipment in the world, and if
[0:15:01] Voice 9: the counters are dirty, you're still
[0:15:03] Voice 9: going to get some problems.
[0:15:05] Voice 9: so it's a matter of how it is handled not what it looks like and what it is commercial or not
[0:15:14] Voice 9: but i have no objection to this product quite the contrary it was cleanly presented
[0:15:20] Voice 9: yet it's been shut down now i know this is not in the trust review it was some other agency that did
[0:15:29] Voice 9: But this is a meeting, and I would like to say I am not the only one who's been upset
[0:15:37] Voice 9: by this particular thing, which could affect a lot of this kind of business on Canada.
[0:15:45] Voice 9: Now, this is part of the rural quality of the island.
[0:15:51] Voice 9: It's one of the things we look forward to, and I don't see that being very well preserved
[0:15:59] Voice 9: by these inane and totally illogical.
[0:16:05] Voice 9: I'm really made angry by stupidity and so I'm angry a lot.
[0:16:11] Voice 9: But, you know, these kind of regulations don't make sense.
[0:16:15] Voice 9: Shut down a valuable business that really contributed
[0:16:19] Voice 9: and made life a little pleasanter.
[0:16:21] Voice 9: And I'm here to voice my opposition to that.

[0:16:43] Voice 9: to everyone and then respond or because there's multiple things that we can respond to and

[0:16:58] Voice 9: are at least four or five issues here

[0:17:01] Voice 9: people who want to speak what i would suggest is that we listen to everyone and then we
[0:17:05] Voice 9: each respond to whatever we hear because otherwise we could be here for two hours okay fair enough i

[0:17:11] Voice 9: that might be the way and then there are a lot of things that i want to say

[0:17:35] Voice 1: Trustees, thank you for serving the community, both in your role as local trust area trustees and in your role as trust area councillor.
[0:17:45] Voice 1: There's very important work to be done this term in both the upper council level and in the LTC level of the Trust Area Federation.
[0:17:54] Voice 1: We welcome Island Planner Brad Smith, who is an agrologist and is familiar with the
[0:18:01] Voice 1: Agricultural Capability Class Ratings for soils used in the Canada Land Inventory mapping
[0:18:09] Voice 1: relied on by the Agricultural Land Commission.
[0:18:14] Voice 1: The Canada Land Inventory includes some 2,000 data points for North Pender ground-truthed
[0:18:22] Voice 1: in the 1980s.
[0:18:23] Voice 1: We look forward to agricultural soils being described in staff reports in terms of the more useful agricultural capability class rather than soil mineral descriptions.
[0:18:35] Voice 1: I briefly address the agenda items respecting, first, an application fees bylaw, which would
[0:18:43] Voice 1: raise fees substantially, and two, delegation of decision-making for natural environment
[0:18:50] Voice 1: development permit areas, DPAs, by the LTC Corporation to staff of the local planning
[0:18:57] Voice 1: service.
[0:18:58] Voice 1: First, the application fees draft bylaw.
[0:19:03] Voice 1: The draft, my total thing is one page, three minutes in.
[0:19:07] Voice 1: First, the application sees draft by-law.
[0:19:10] Voice 1: The draft by-law includes allowance for a 20% surcharge where an application is made after the fact.
[0:19:19] Voice 1: I ask that consideration be given for situations where the landowner makes changes which would need LTC permission,
[0:19:26] Voice 1: but where other circumstance requires that the change be made immediately,
[0:19:31] Voice 1: so necessitating an application after the fact.
[0:19:37] Voice 1: Secondly, I ask that the LTC not delegate to staff its own responsibility for decision-making
[0:19:44] Voice 1: for natural environment DPA development permit areas.
[0:19:49] Voice 1: Section 4 of the Islands Trust Act states in part that the LTC corporation is continued,
[0:19:56] Voice 1: That is to say, it exists in order to carry out, preserve, and protect objects.
[0:20:02] Voice 1: The direction of Section 4 is no mere piety, legally, and must be taken seriously.
[0:20:09] Voice 1: Preservation and protection of natural environment entities, which might otherwise be overwhelmed
[0:20:14] Voice 1: by the built environment, is the heart of the Act.
[0:20:20] Voice 1: Note that Council's current Trust Policy Statement by the law, which should securely
[0:20:25] Voice 1: implement trust area policies to preserve and protect natural entities, too often fails to do
[0:20:31] Voice 1: so. The culprit is Council's delegation of the implementation of trust area policy
[0:20:38] Voice 1: to the local trust areas, where each local jurisdiction may choose to give reason not
[0:20:45] Voice 1: to implement a policy. The act of delegation introduces a second layer of potential for
[0:20:52] Voice 1: conflicting interests. Please do not proceed with a local bylaw to delegate LTC decisions
[0:20:59] Voice 1: on natural environment DPAs to staff. Thank you.

[0:21:12] Voice 9: name is Joyce Thayer, and as some of you may know, we've been
[0:21:17] Voice 9: in front of the press for the last six months dealing with an issue on the interpretation of the
[0:21:23] Voice 9: existing bylaw
[0:21:25] Voice 12: as it relates to the building of farms on rural residential land. Something that
[0:21:33] Voice 12: we say should never have been approved and is not
[0:21:37] Voice 15: contemplated by the Act. We have made submissions
[0:21:41] Voice 15: on this and there have been changes made to the proposed bylaw to deal with this.
[0:21:48] Voice 9: No changes have
[0:21:49] Voice 19: been made to the existing bylaw yet and we've
[0:21:53] Voice 12: also requested and received a legal commission
[0:21:57] Voice 12: of a legal opinion to determine whether or not the bylaw was correctly
[0:22:02] Voice 9: interpreted
[0:22:04] Voice 9: so i just want to say we're not going away we're here we're watching what's going on and hope
[0:22:11] Voice 9: that there'll be some
[0:22:13] Voice 15: positive resolution to this in the near future because this should not
[0:22:18] Voice 15: be dragged on. Nobody
[0:22:22] Voice 19: is aware of any similar building ever being built on that type of lot
[0:22:28] Voice 19: and it set a precedent that is untenable. So secondly, I would like to speak to the issue
[0:22:37] Voice 19: of delegation of authority. I am concerned when something like this particular
[0:22:43] Voice 15: application was
[0:22:45] Voice 15: approved without the trust being aware that it was happening and it was so
[0:22:49] Voice 15: unusual and
[0:22:51] Voice 19: it was not until the neighborhood saw the building being
[0:22:54] Voice 19: constructed that we became aware it was happening it's it's really important
[0:22:59] Voice 19: that the planners and the
[0:23:01] Voice 9: trustees are on the same page and are aware of what's
[0:23:05] Voice 9: going on and if you're going to delegate you need really clear policies on what
[0:23:11] Voice 9: comes back to the trust and how they're kept aware of what's going on and I'm
[0:23:19] Voice 9: particularly concerned as well because I saw there's a suggestion that the staff
[0:23:25] Voice 9: don't have to attend the meeting like it's really important that they be aware
[0:23:30] Voice 9: of the island they be aware of issues and they understand how unusual an

[0:35:28] Voice 12: two-story building that actually looks like a huge home is noise light and interference with
[0:35:39] Voice 12: other owners privacy the the noise apart from the building the building we all build we all
[0:35:46] Voice 12: create noise but the we don't know exactly what will be done in this building but we're told it
[0:35:51] Voice 12: will be something like a side read the indication is of a very commercial nature although the owner
[0:35:57] Voice 12: has said to the islands trust and documents that we obtained through an FOI request that
[0:36:03] Voice 12: it will be for private consumption but the plans that we've seen are housed tasting rooms still
[0:36:10] Voice 12: offices not at all the kind of farm building that was applied for anyway there's noise coming from
[0:36:19] Voice 12: that operation or we anticipate there will be noise there will be lighting beyond anyone's
[0:36:26] Voice 12: contemplation at a time when we're
[0:36:27] Voice 12: talking about the need for dark skies just the other days you
[0:36:31] Voice 12: can see did a fabulous piece on um not just the interference with our environment and a very
[0:36:39] Voice 12: first range of birds and animals and on light skies but also the uh interference with human
[0:36:45] Voice 12: sight uh more light affecting our our vision and then uh the security cameras that are being
[0:36:52] Voice 12: installed as we speak are pointed at in directions by this gentleman that interfere with the other
[0:37:00] Voice 12: landowners the security cameras may cover his property but they're also beaming into neighbors
[0:37:06] Voice 12: and that is certainly a breach of privacy so there are many issues coming out of that many
[0:37:12] Voice 12: trees beautiful trees were cut down there was no other farm-like building in place so all of the
[0:37:18] Voice 12: the issues that are coming up from five, you know, key points, whether it's logging, or flow of dirt
[0:37:28] Voice 12: off of hillsides, building buildings that shouldn't be there, all of these things that people have
[0:37:35] Voice 12: spoken to, they all intersect. It's all about protection and preserving our community. And what
[0:37:41] Voice 12: we have found, and you've heard it again, everyone is just people coming in who have no intention
[0:37:47] Voice 12: of locating in our community participating in our community this is where we get people been
[0:37:54] Voice 12: here for decades this is where we live we care about it so that is why we're all just speaking

[0:53:13] Voice 19: stolen land, left alone by Indigenous laws.

[0:55:46] Voice 18: live on Pirates Road logged his area and had no real understanding of what that did to our well.
[0:55:57] Voice 18: So our well and people along where I live, the wells went down six feet because the riparian zone
[0:56:06] Voice 18: no longer exists because the trees have been logged. So I want the trust to really focus
[0:56:15] Voice 18: on the mandate of preserve and protect
[0:56:18] Voice 18: and start putting in laws
[0:56:21] Voice 18: that don't let people buy eight acre lots,
[0:56:26] Voice 18: 10 acre lots and log them and then sell the land back.
[0:56:31] Voice 18: So that's my request to the trust
[0:56:35] Voice 18: to begin to focus on the environment.
[0:56:39] Voice 18: That's what the trust is about.
[0:56:41] Voice 18: but these islands are really not for people.
[0:56:44] Voice 18: They are for preserve and protect the environment.

[0:56:53] Voice 18: even on Greenland is being destroyed in the world.

[0:57:06] Voice 18: So trust, please put environment as your first mandate and act on it.

[0:58:17] Voice 5: election process and getting to sit down and talk to people and hear where they're at with things is
[0:58:24] Voice 5: that there's a concern for our environment and protecting what it is that we have had and what
[0:58:32] Voice 5: we currently have against what sort of what the future looks like

[0:58:37] Voice 5: we go into it and and it
[0:58:40] Voice 5: But being new coming into it and trying to navigate through what is possible, I feel for everybody that has spoken because it seems very, almost in a sense, hopeless being in this position where you don't necessarily see what the tools are that you have to affect the change.
[0:59:07] Voice 5: and it does seem like activism in a sense is something that has died in in our society people
[0:59:18] Voice 5: were very very outwardly vocal in the past um and like 60s and 70s and stuff like that like that
[0:59:27] Voice 5: created change and that created where people were able to get up in front of the news and
[0:59:35] Voice 5: and get exposure for issues,
[0:59:39] Voice 5: we've turned to dealing with things on Facebook.
[0:59:44] Voice 5: And really, it's a microcosm issue
[0:59:50] Voice 5: in the broader scheme of, say, Canada.
[0:59:55] Voice 5: You know, the Gulf Islands are small,
[0:59:58] Voice 5: but we tend to...
[1:00:00] Voice 5: to take a small approach as well to what it is that we try to get changed and I think we can do
[1:00:10] Voice 5: some things and we can push at the trust council level to try to get a tree cutting authority if
[1:00:18] Voice 5: that is the direct the direction to go to get it there will be provincially there will be rules
[1:00:24] Voice 5: and regulations involved in that as to what we can we can and we can't do um and it's a big
[1:00:34] Voice 5: it's a big topic there are personal rights and freedoms for people to buy a lot and clear-cut
[1:00:40] Voice 5: it edge to edge and that is their right the way that it's set up for um having having land and
[1:00:52] Voice 5: being able to do whatever they want and we have to find a way i think to educate people
[1:00:58] Voice 5: on the local level somebody was saying you know to know that a piece of property has been sold
[1:01:03] Voice 5: and to educate the people that bought that piece of property as to what it is that they're buying
[1:01:09] Voice 5: the place on 4815 schooner it's right in the advertisement for sale that that property would
[1:01:18] Voice 5: has excellent merchantable timber i think is the words that are on like it was it
[1:01:23] Voice 10: was it was sold
[1:01:25] Voice 5: as a piece of property to to lock and that there would be funds that you could recover from that
[1:01:32] Voice 5: and that and that is something that is public and that is something that people can see
[1:01:37] Voice 5: and it didn't take more than about two emails to see that that was how it had been sold and so
[1:01:45] Voice 5: So when we have those things, we do as a community need to do better for our community and defend why we all moved to this island.
[1:02:02] Voice 5: Nobody moved here historically to log a piece of land.
[1:02:09] Voice 5: island. I love the idea of people putting their places into covenants and being able to control
[1:02:16] Voice 5: what the future of that piece of property is going to be. For my father and I, when we bought
[1:02:23] Voice 5: the old airstrip, which is an agricultural piece of land that wasn't being used as agriculture,
[1:02:28] Voice 5: we agreed to ourselves that there's a whole section of trees along the side of the watershed
[1:02:33] Voice 5: and that we won't ever go in and touch unless it's to clean up dead standing
[1:02:39] Voice 5: people have to make those decisions to to do those things for themselves but we as an island
[1:02:46] Voice 5: also have to work to educate people we as trustees need to work to see what we could what we can do
[1:02:54] Voice 5: to get teeth to be able to protect what the uniqueness and the environment is that we live in
[1:03:00] Voice 5: and see see how that can be balanced and not turn into phenom or whistler or into a place where we
[1:03:09] Voice 5: have regulated ourselves back into a corner where the only people that can afford to live here
[1:03:14] Voice 5: are very very wealthy people um because we've driven the prices of the property up so high that
[1:03:23] Voice 5: no one can ever afford to be here and it's it's an overwhelming it is an overwhelming
[1:03:31] Voice 5: position to be in and i think that you know conversations for deb and i to have will be
[1:03:37] Voice 5: how do we affect a positive change for us and how do we work towards that and and make sure that
[1:03:43] Voice 5: that people are educated coming here to respect where they're moving to um yeah if we if i don't
[1:03:54] Voice 5: know that we can get control of that from the provincial government i've seen an email from
[1:04:00] Voice 5: adam olson and his feelings on it and it to me it seems like there is a certain amount of work
[1:04:06] Voice 5: that needs to be done on the trust itself before we would be able to get that kind of authority

[1:04:56] Voice 9: walter morrison he followed him and then had the wet sort on gambier island i come from a family
[1:05:01] Voice 9: who has a logging history on this coast who has a settler colonial history on this coast
[1:05:06] Voice 9: and i was still raised and taught that the environment is something to protect
[1:05:11] Voice 9: that we don't go for industrial logging if we can avoid a period actually not just on the islands
[1:05:17] Voice 9: but period that we think about different ways to engage in that activity and I've spent four years
[1:05:24] Voice 9: for the concern around forestry digging into all the like appropriate polite diplomatic ways
[1:05:30] Voice 9: to try and engage in the issue around forest management I would not and I will never frame
[1:05:37] Voice 9: it strictly as tree cutting because that's not the issue we're naming here we're naming forest
[1:05:43] Voice 9: health we're naming ecosystem health water health we're naming issues of community consultation
[1:05:51] Voice 9: before we see any type of clear cutting we're just we're naming a community ethic a representation
[1:05:57] Voice 9: that we have in this area frankly i am deeply frustrated with the multiple level of government
[1:06:07] Voice 9: problem that we're facing. And I have been told multiple times that we have to go this way,
[1:06:11] Voice 9: or that we have to go that way, and it has to be trust counsel, but trust counsel doesn't always
[1:06:14] Voice 9: agree on what the mandate is, all these things. And here we continue to see. So just to be clear,
[1:06:22] Voice 9: we are now talking about Clisson Road, Pirates Road, Schooner Road, multiple lots across Magic
[1:06:31] Voice 9: Lake. This is not a one-off effort. It's not a short period of time. I talked with Adam Wilson
[1:06:36] Voice 9: in a few weeks ago about this he and i agree about like the problem statement the challenge is what
[1:06:43] Voice 9: do we do right so in terms of what we do there's an issue we talk about it we bring it up as a

[1:06:56] Voice 9: see it again and again so i move that the north pender local trust committee prohibit logging
[1:07:02] Voice 9: on all areas of Mark Packer Island to facilitate appropriate intergovernmental decisions to be made about forest protection on the island.

[1:14:43] Voice 22: uh there is no new cutting going on the cutting happened last week so no more trees are coming
[1:14:49] Voice 22: coming down uh there's no plans to cut any more trees at this time there are trucks going in to
[1:14:56] Voice 22: load up the lumber that has been cut the majority of the lot is outside of any development permit
[1:15:02] Voice 22: area so there were currently no current permit required uh to do any type of development or tree
[1:15:09] Voice 22: cutting there were two uh Raptor nest DPAs on the property the previous property owners when they
[1:15:19] Voice 22: were getting the property prepared for sale did get a biologist report that exempted one of those
[1:15:26] Voice 22: areas from any tree cutting however there is the one area where they will need to get a permit
[1:15:33] Voice 22: for the work that has been done or to do any new work within the one dpa uh so the
[1:15:42] Voice 22: the current owners were under the impression that an application had been somehow applied for or
[1:15:48] Voice 22: or processed through Islands Trust.
[1:15:51] Voice 22: There may be some confusion there
[1:15:52] Voice 22: as to the original property owners
[1:15:55] Voice 22: believing that that exemption was broader
[1:15:57] Voice 22: than what it may have been.
[1:16:00] Voice 22: And that's an issue that the seller and the buyer
[1:16:03] Voice 22: are going to have to sort out.
[1:16:05] Voice 22: But there is a contravention where they do need a permit.
[1:16:08] Voice 22: The new owners are cooperative.
[1:16:10] Voice 22: They have every intention
[1:16:12] Voice 22: of going through the application process
[1:16:14] Voice 22: to apply for any necessary permits and to do any necessary remediation that the ltc requests
[1:16:23] Voice 22: there's a small stream on the property which they are aware of and they're trying to maintain and
[1:16:29] Voice 22: i can see no threat to that stream they want to make sure that it's clear and clean they're fully
[1:16:35] Voice 22: aware that it goes down to medicine beach and then there are setback regulations and you know
[1:16:41] Voice 22: setbacks are required for many wetlands on that property so just right now they're
[1:16:48] Voice 22: you seem very conscious and cooperative and acknowledge that any necessary permits
[1:16:57] Voice 22: should have been applied for before any of the work was done but they believe that process
[1:17:03] Voice 22: process had at least been initiated by the previous owners now do you have any sort of
[1:17:09] Voice 22: feedback as to the business statements that were made the dpas were not reinforced so any dpa
[1:17:17] Voice 22: complaint that we receive we open the file and investigate we take whatever enforcement action
[1:17:23] Voice 22: can take and we request and sometimes need to demand that people apply for permits
[1:17:30] Voice 22: now unfortunately we can't at this time issue any uh violation ticket or bylaw notice for work
[1:17:38] Voice 22: that's done without a permit that's not something the province has given really any local government
[1:17:43] Voice 22: clear ability to do uh we're still you know
[1:17:47] Voice 22: have a request in to the province to try and rectify that
[1:17:50] Voice 22: so that there'll be some clear mechanism that gives local governments like island stress clear
[1:17:56] Voice 22: authority to issue you know uh contravention tickets of some type uh viola notice whatever
[1:18:04] Voice 22: it may be that you know you've contravened the mama and here's your penalty for doing that
[1:18:09] Voice 22: right now the option is legal action by the local trust committee either a charge under the offense
[1:18:15] Voice 22: act because work was done by both the contractor and the property owner without a permit or a
[1:18:20] Voice 22: notice of civil claim in bc supreme court if they don't get the proper uh permit that they are

[1:18:29] Voice 4: understand i would just add that it's my understanding that there's been efforts at ubcm
[1:18:36] Voice 4: by regional districts and incorporated areas to seek more powers through the development permit
[1:18:43] Voice 4: authorization process and that blanket tree cutting development permit area has not been
[1:18:50] Voice 4: the courts have not uh allowed that the development permit areas need to be to be
[1:18:57] Voice 4: specifically focused to a particular environmental protection and so a blanket tree protection
[1:19:02] Voice 4: mechanism uh has not been uh authorized uh municipalities have within the community
[1:19:08] Voice 4: charter additional broader powers that allow them to create tree cutting permit uh regulations that
[1:19:15] Voice 4: the regional districts and the islands just does not have and so i think in the longer term the
[1:19:23] Voice 4: the advocacy obviously that's not gonna be the quick solution
[1:19:27] Voice 4: that you're looking for in this motion,
[1:19:29] Voice 4: but well, it's unenforceable in the sense
[1:19:35] Voice 4: that we don't have the enforcement authority
[1:19:39] Voice 4: to regulate logging except in those DPA areas.

[1:19:47] Voice 4: and recognizing that up to now the province

[1:20:56] in most cases do you want to look at expanding those do you want to look at reviewing those as
[1:21:03] a project and the third is what has been talked about is also advocating for
[1:21:09] Voice 8: more powers they're
[1:21:10] Voice 8: trying to get the powers of um like a tree cutting bylaw that a municipality has the sort of three
[1:21:18] Voice 8: levels in which this issue is incapable can i
[1:21:25] Voice 9: just get one clarification so for the
[1:21:29] Voice 9: current dpas that exist because i looked them up right away when i heard about this so um for the
[1:21:36] Voice 9: current dpas that exist are you saying that there has been no encroachment by logging into those
[1:21:41] Voice 9: those current setbacks or raptor nest areas so
[1:21:45] Voice 22: through the chair yes there are contraventions
[1:21:47] Voice 22: there they have cut in areas that if both were not exempt would be a contravention require a

[1:23:06] Voice 4: or integrity to to house the nest that's in the that's in the osprey so the the osprey tree still
[1:23:14] Voice 4: has the structural integrity to potentially host a future nest so it is deemed not exempt
[1:23:22] Voice 4: but the eagle tree because the condition of the tree essentially has no eagles nest now and does
[1:23:28] Voice 4: not have the capacity to sustain a nest in the future the language in the development permit
[1:23:34] Voice 4: permit guidelines allow an exemption for that.

[1:30:55] Voice 5: something that we sit down and we and we actively try to craft something that actually does work
[1:31:01] Voice 5: then for sure we put consideration into both sides of the argument to be able to draw a line
[1:31:08] Voice 5: and that gives us the ability to actually hopefully affect a change at our level in in a in a very

[1:31:22] Voice 5: finally going to give you this ability so it would be really hard it would be really hard for me to
[1:31:31] Voice 5: support the motion based on the fact that it can't be enforced knowing that going into it so

[1:31:50] Voice 9: mandate does say that we're supposed to preserve and protect in these islands so i think we're well

[1:32:23] Voice 9: but we have a lot of concerns in community about about how effective and I think I think even in
[1:32:30] Voice 9: in our organization we have a lot of concerns about what authorities do we have right now or not
[1:32:35] Voice 9: to be able to effectively enforce our mandate and to be and so like at this point I feel like
[1:32:42] Voice 9: Like, we have to be making, like, fairly fierce political statements that we can take forward and understanding clearly, like, we can add all sorts of language to this in terms of how we communicate it, but we understand clearly it's a political statement and it's, you know, not enforceable in this moment, but that we need other levels of government to step the frick up, right?

[1:47:11] Voice 5: i don't know the ramifications of what that is i just know to speak to that part of it from being
[1:47:17] Voice 5: being a farmer um that that is probably where there we have to look at what the proposed
[1:47:26] Voice 5: bylaws are as well for how to how to control that development on rural land and whatnot because

[2:01:52] Voice 16: of 90 days from May 1st to September 30th. And they would like to retain the number of guests
[2:02:00] Voice 16: of 11, which is eight adults and three children. In the previous issued temporary use permits,
[2:02:08] Voice 16: I should mention that there was no restriction on the number of days during the summer months
[2:02:14] Voice 16: and the applicants have agreed to add that in to that permit.

[2:03:10] Voice 16: And there's been no enforcement issues for those three SCVRs.
[2:03:16] Voice 16: So that use in that neighborhood has been in use for over five years.
[2:03:21] Voice 16: So the neighborhood is used to those three SCVRs in operation.
[2:03:25] Voice 16: The next item is on page 39 of the agenda.

[2:03:31] Voice 16: And this is regards to the number of guests allowed for short-term vacation rentals in Magic Lake Estates.

[2:03:54] Voice 16: it's L3 and that's on page 40, limiting the number of days during the summer months to 30 days.
[2:04:02] Voice 16: The applicant is requesting the 90 days for that period.
[2:04:08] Voice 16: So there has been no correspondence received in terms of the notification, and staff, as you can see at the beginning of the staff report, is supporting the TUP application.
[2:04:23] Voice 16: And this is due to the fact that although the number of guests exceeds the TUP guideline, if a TUP is approved, it would be an opportunity for larger families to stay.
[2:04:38] Voice 16: day. And also, as I mentioned before, there has been no complaints received from the neighbors
[2:04:45] Voice 16: concerning the number of guests of 11. So that would be eight adults and three children.

[2:13:01] Voice 8: the changes are minor they would address vital enforcement issues with rvs currently on sydney
[2:13:07] Voice 8: island and would provide the opportunity for owners to use their lots with their recreational
[2:13:15] Voice 8: vehicle while they get knowledge of their lot and plan the siting of their dwellings

[2:13:47] Voice 6: they go in and do things like they're cutting we've had we've had that in the in the past where
[2:13:52] Voice 6: they've taken down a few trees and it's the it's the wrong trees because the sun is a little
[2:13:58] Voice 6: different over here and so they take down a few more and then and then all of a sudden we've got
[2:14:02] Voice 6: this this bare lot we've got one of those right now um really what we're trying to do here is
[2:14:09] Voice 6: is encourage the owners to make better decisions.

[2:14:17] Voice 6: for expanding the use of recreational vehicles.

[2:40:58] Voice 8: own, they have their own fee and charge that the board, the ITC board

[2:42:42] Voice 7: And so the rationale for one of the rationales, principal rationales, was to take pressure off general taxpayers for funding these things.

[2:43:07] Voice 7: I would have expected to see some difference in terms of an acknowledgement that general property taxes levied by the trust would go down.

[2:46:37] Voice 8: So this is for consideration of a bylaw to delegate issuance of most development permits to staff.
[2:46:45] Voice 8: There's a template bylaw, that's what the bylaw that's attached, that was endorsed by Trust Council, along with a policy by new staff in addition to the bylaw.
[2:46:59] Voice 8: Delegation bylaws have now been adopted by Galleon and Salt Spring Local Trust Committees.
[2:47:06] Voice 8: As I said last term will trust me consider the delegation by law, the only development
[2:47:15] Voice 8: permit area proposed not to be delegated, the former character permits, the design ones
[2:47:22] Voice 8: the driftwood centers, the one that periodically comes to the local trust committees vendor
[2:47:29] Voice 8: over the years, staff are recommending proceeding with the bylaw trust councils and doors the
[2:47:36] Voice 8: template uh north bender has been prioritized because of the volume of permit applications
[2:47:43] Voice 8: and delegation would approve improve the efficiency of processing development permits
[2:47:48] Voice 8: and in particular north bender has now scheduled fewer business meetings
[2:47:54] Trustee Maude: to just reduce delays so we were just discussing um the the trees and that dpa under this would
[2:48:04] Trustee Maude: that dpa permit that they would be applying for would that be processed by staff the dp would be
[2:48:11] Voice 8: that dp would be processed by staff i don't want to speak to the specifics of it because we don't
[2:48:16] Voice 8: want it but based on policy if they didn't comply with all the guidelines we would refuse it and
[2:48:25] they would they then appeal to the local trust committee so it's it's intended that the routine

[2:48:33] Voice 8: um especially last term for north pender a former trustee got quite frustrated
[2:48:38] Voice 8: having these routine development permits for geotechnical development permits on sydney
[2:48:43] Voice 8: island for example those would you know they tick all the boxes on the form those um would

[2:48:52] Voice 5: staff i think for myself i i can't really pass something i don't understand
[2:49:03] Voice 5: in a sense and and to not be not at least put my best foot forward and being involved in what
[2:49:12] Voice 5: is going on on the island would be poor for me so i think that i don't know if you if we can
[2:49:22] Voice 5: push it off for a while to make a decision like that or if uh if you just say no and bring it
[2:49:31] Voice 5: back and then at a future time i'm not sure how you move ahead to something like that but you can

[2:50:19] Voice 9: of look at that but we should always get a report on which ones have been processed by staff even if
[2:50:24] Voice 9: like in the future so that we know we have we're in the loop on what's being approved um but there
[2:50:30] Voice 9: were just so many things it was brutal that were

[2:50:36] Voice 9: because they were just like in our dps like we didn't have really a decision to make

[2:53:51] Voice 2: groundwater implementation project got to last term and and

[2:54:02] Voice 2: recommendations, there's there's three recommendations in front
[2:54:05] Voice 2: of you what is related to the revision of the project charter so if you are wanting to move
[2:54:13] Voice 2: forward with the project we will need to update the project charter um the project um went as far
[2:54:20] Voice 2: as uh as the drafting of bylaws um but because we weren't able to find uh time because the focus
[2:54:29] Voice 2: sort of the focus was very much on the land use bylaw review so in uh the trustee meetings uh
[2:54:36] Voice 2: there wasn't a lot of time to actually delve into the details of the groundwater project and in
[2:54:42] Voice 2: addition to that we we we did try to schedule some some um focus time um but but uh we weren't able
[2:54:49] Voice 2: to do that either so um because we weren't able to have those focused decisions um the uh the
[2:54:56] Voice 2: the project sort of slowed down.
[2:55:00] Voice 2: It has been moving forward on Galliano
[2:55:03] Voice 2: and they're actually moving to first reading
[2:55:04] Voice 2: at their next meeting.
[2:55:06] Voice 2: And the good news for North Pender
[2:55:07] Voice 2: is that we can integrate what we've learned
[2:55:10] Voice 2: from Galliano's process into North Pender's process.
[2:55:16] Voice 2: And we did learn like a lot of things
[2:55:20] Voice 2: that worked really well.
[2:55:21] Voice 2: And in particular was the opportunity
[2:55:25] Voice 2: opportunity to have the focus discussions with the with the LTC in Galliano and to have a very
[2:55:32] Voice 2: focused community meeting where we were able to put up maps and talk to individuals and have
[2:55:38] Voice 2: presentations and conversations so um the other two recommendations there for you are to um to
[2:55:45] Voice 2: organize a special meeting for the LTC so we can go through all of the details of the groundwater
[2:55:50] Voice 2: water sustainability implementation project and the options for the groundwater protection
[2:55:56] Voice 2: development permit area. So there's two parts to the project. There's the part that focuses
[2:56:02] Voice 2: on, there's a portion of it that's amendment to the land use bylaw. And so that portion
[2:56:10] Voice 2: The second portion focuses on system requirements for new builds and updates to proof of water regulations.
[2:56:20] Voice 2: And so because you're already moving through a land use bylaw review process,
[2:56:25] Voice 2: process, the LTC supported the recommendation to incorporate the proposed, those proposed pieces into the land use bylaw review process. So those will be included in that process. But if we are to have a special meeting for the LTC to focus on the project as a whole, that'll be an opportunity to provide some details on that piece, independent of the other conversations that are having.

[2:57:03] Voice 2: the ocp amendments and so in terms of the ocp amendments there are two kind of parts i guess
[2:57:11] Voice 2: one is a general amendment so basically updates to objectives and policies to focus on groundwater
[2:57:18] Voice 2: sustainability and acknowledge um indigenous indigenous cultural knowledge um there is um
[2:57:26] Voice 2: um the update to groundwater regions um update to some of the um some of the policies just to
[2:57:35] Voice 2: better align with um um with the uh the the potential of um of uh of incorporating a uh
[2:57:46] Voice 2: development permit area and so this the second sort of the major part of this is the creation
[2:57:51] Voice 2: of the Delaware permit area and attached to this to this staff report is a memo that provides
[2:58:00] Voice 2: details on the process that staff used to basically connect the scientific research
[2:58:14] Voice 2: research pieces to planning.
[2:58:18] Voice 2: So that method is identified and it basically looks
[2:58:22] Voice 2: at how critical recharge areas were identified
[2:58:30] Voice 2: and how those were, and it comes up with a number
[2:58:33] Voice 2: of options for development permit areas,
[2:58:38] Voice 2: which look at lot coverage.
[2:58:41] Voice 2: So I won't go into detail on that unless you'd like me to
[2:58:44] Voice 2: now but we can that's something that we could go into more we would go into more detail in a more
[2:58:49] Voice 2: focused meeting um so the other piece as i as i mentioned was um um we found on on galliano was
[2:59:01] Voice 2: um having a an in-person community information meeting um so william shelva the senior fresh
[2:59:09] Voice 2: water specialist and myself, we went over to Galliano with big maps of the recharge areas.
[2:59:22] Voice 2: Some of them had detailed science on it, some of them were very simple. We had the information
[2:59:28] Voice 2: presented at different levels and we also had the different options for development permit areas
[2:59:36] Voice 2: is out there on big maps and providing opportunity
[2:59:40] Voice 2: for people to have discussion.
[2:59:41] Voice 2: So the staff is recommending
[2:59:45] Voice 2: that that would be a very good step
[2:59:48] Voice 2: if you decide to move forward with this project.
[2:59:52] Voice 2: So I will just leave it at that
