[0:02:49] Trustee Evans (probable): was vice chair and our last meeting was really just orientation. Our next meeting, which is on

[0:02:56] Trustee Evans (probable): Monday, is to go over the current programs and to go over the current budgets for this fiscal year

[0:03:03] Trustee Evans (probable): to report back to the Financial Council. And as I've been elected as chair on the Trust Programs

[0:05:23] Trustee Elliott: been elected as a trustee before but I'm quite familiar with processes I was on our HAPC with

[0:05:31] Trustee Elliott: on Gabriela Island the housing Advisory Planning Commission very involved in collecting Community

[0:05:36] Trustee Elliott: feedback and engagement on different issues biodiversity housing and water so that's sort

[0:05:42] Trustee Elliott: of my experience but um and I've uh so I'm the liaison to the Conservancy board we've had two

[0:05:49] Trustee Elliott: two board meetings so far um one very significant donation recently was the donation of link island

[0:05:58] Trustee Elliott: in the gabriel the local trust area in its entirety it's about 25

[0:06:02] Trustee Elliott: hectares and uh it's a wonderful acquisition for the conservancy so we're very excited about that

[0:06:10] Trustee Elliott: and celebrated swift family and enamel a couple of weeks ago um i'm also on the regional planning

[0:06:15] Trustee Elliott: planning committee and we just held our first meeting on February 1 so if you want to look at

[0:06:20] Trustee Elliott: the uh it was quite a full agenda and um there's going to be lots happening in terms of strategizing

[0:06:28] Trustee Elliott: housing options and solutions sort of collecting the best of what we've learned and attempted over

[0:06:34] Trustee Elliott: the last 20 years in the different LTAs and putting all that information together so that

[0:06:39] Trustee Elliott: was a really exciting uh piece of work um i

[0:06:45] Trustee Elliott: don't know if you've got any questions

[0:06:48] Trustee Elliott: just email me um i do make it a point my my last name is two l's and two p's so

[0:06:55] Trustee Elliott: please if you're gonna email me make sure that those are both there so that i get your

[0:06:59] Trustee Elliott: correspondence um i just wanted to make a note about correspondence we do try to read everything

[0:07:07] Trustee Elliott: that comes in, you know, even late. The gentleman submitted something just now, but it really does

[0:07:15] Trustee Elliott: help if you can submit your correspondence or your letters in the notification period, and that way

[0:07:21] Trustee Elliott: it gets in the agenda and just helps us to keep track of everything. So that's one thing. And

[0:07:28] Trustee Elliott: I just wanted to chat about meeting decorum when we get to town hall, which is coming up next. I

[0:07:37] Trustee Elliott: directors do we no okay so that's so yeah so we're going to move on to town hall and questions

[0:07:45] Trustee Elliott: and sort of these three principles which you probably can't read it's a bit high up there

[0:07:52] Trustee Elliott: guide all of our meetings um and in the last four years uh as we've met you know online and

[0:08:00] Trustee Elliott: virtually in hybrid meetings we're still trying to maintain the same level of mutual respect

[0:08:05] Trustee Elliott: but cordiality and listening to one another.

[0:08:10] Trustee Elliott: So I'll just go through the, when you're addressing your LTC,

[0:08:14] Trustee Elliott: we ask that you direct your comments to the LTC and not to one another,

[0:08:19] Trustee Elliott: that you speak to issues and not to people or personalities.

[0:08:23] Trustee Elliott: Don't make it personal. Let's talk about the issues.

[0:08:26] Trustee Elliott: Speak to issues that are on the agenda for the meeting,

[0:08:31] Trustee Elliott: or if they're more broadly, you know, related to trust counsel,

[0:08:34] Trustee Elliott: So we'll certainly bring them up for consideration.

[0:08:37] Trustee Elliott: And if we're talking about an application later on in the meeting,

[0:08:42] Trustee Elliott: the first town hall is your opportunities to speak to that application.

[0:08:46] Trustee Elliott: Members of the public will not be able to speak up when trustees are talking to the applicant.

[0:08:52] Trustee Elliott: So just making that clear.

[0:08:55] Trustee Elliott: And yes, be clear, concise and respectful.

[0:08:57] Trustee Elliott: respectful. Every LTC seems to have different times for how long we can allow people to go on.

[0:12:05] Voice 18: been rather fraught with

[0:12:06] Voice 18: controversy and peril. And if

[0:12:09] Voice 18: the trustees are unable to initiate, or unwilling to

[0:12:14] Voice 18: initiate things not from by themselves, not from the floor,

[0:12:17] Voice 18: I'd like to request that our trustees conduct a review of the

[0:12:21] Voice 18: the legislation that's been passed in the previous administration and perhaps take it

[0:12:29] Voice 18: to an advisory planning commission because it looked like most of the legislation was

[0:12:33] Voice 18: passed against the majority wishes of the south kansas residents that's done thank you

[0:13:04] Voice 6: Okay, so I am addressing the SPVR TEP application for Castle Road.

[0:13:11] Voice 6: I serve as the President of the Strata Council at this moment.

[0:13:16] Voice 6: i'm also an adjacent owner to that property so wearing those two hats it was a surprise to see

[0:13:24] Voice 6: this reapplication after the original application was turned down at this time last year and with

[0:13:30] Voice 6: very short notice given to the strata owners we're once again having to send our letters to the ltc

[0:13:36] Voice 6: to register concerns and opposition notably some municipalities require strata corporation approval

[0:13:44] Voice 6: approval as a condition for obtaining a license for short-term vacation rentals the applicants

[0:13:50] Voice 6: have no agreement nor understanding with the strap owners and certainly no no approval the property

[0:13:56] Voice 6: is one of 28 strata lots and lies on a private road that is owned and maintained by all owners

[0:14:03] Voice 6: as part of the common property and 65 of the owners went on record at our most recent AGM

[0:14:12] Voice 6: opposing STVRs on Castle Road.

[0:14:16] Voice 6: Castle Road Council or Strata Council can provide trustees

[0:14:20] Voice 6: with the meeting minutes, including the record of that vote.

[0:14:24] Voice 6: With this reapplication, the same concerns exist regarding security,

[0:14:28] Voice 6: noise, privacy, fire danger, excessive water use,

[0:14:33] Voice 6: having a commercial use in a residential zone,

[0:14:36] Voice 6: operating an STVR by an absent owner,

[0:14:39] Voice 6: owner, with no guarantee that their rules will be followed. In addition, there are no

[0:14:45] Voice 6: guarantees that the conditions of the TUP will be followed. With bylaw enforcement so

[0:14:51] Voice 6: slow and ineffective, there really are no protections for the neighbourhood. Who monitors

[0:14:56] Voice 6: all the rules and conditions? As an adjacent property owner, I would be greatly affected.

[0:15:02] Voice 6: My peace of mind, sense of security, freedom from the burden of having to be vigilant, as unknown guests come and go any time of day or night.

[0:15:13] Voice 6: These are hugely significant impacts for nearby residents.

[0:15:18] Voice 6: Most Strata full-time residents have only one home, their Castle Road home.

[0:15:23] Voice 6: Many have built their homes and some long-term residents have been here for more than 20 years.

[0:15:30] Voice 6: We've invested in this quiet neighbourhood with the knowledge that bylaws regulate the conditions for home-based businesses.

[0:15:38] Voice 6: No changes that the applicants have made with this reapplication in any way mitigate these serious impacts.

[0:15:46] Voice 6: A permit to run an STVR as an absent owner in this context should not be granted.

[0:15:53] Voice 6: This application has already caused conflict in our normally peaceful neighbourhood.

[0:15:57] Voice 6: In itself, it creates a conflict of use, one that advantages a non-resident applicant over

[0:16:05] Voice 6: the interests of the majority of strata owners.

[0:16:08] Voice 6: A commercial use in a residential zone, the TUP would permit a usually prohibited use

[0:16:16] Voice 6: in the bylaws on home-based businesses.

[0:16:20] Voice 6: No applicant should expect to receive a TUP.

[0:16:23] Voice 6: It is a special permit that should be granted only when all the conditions on the ground are favourable.

[0:16:30] Voice 6: When all the potential harms and negative impacts for all of those affected have been considered and weighed.

[0:16:37] Voice 6: Because it occurs in a strata that overwhelmingly opposes it, that should be enough to warrant a refusal.

[0:16:45] Voice 6: Very recently, it has come to the attention of the Strata Council that two unresolved questions remain to be addressed in this application.

[0:16:52] Voice 6: application. One is that as a commercial operation, doesn't this application require a water

[0:16:59] Voice 6: license? And as a commercial operation and STVR, how will this use impact the Stratus

[0:17:07] Voice 6: governance? Until these two questions are answered, I feel it is premature to even consider

[0:17:13] Voice 6: the application. However, if the decision is to refuse the application, these questions

[0:17:19] Voice 6: are moved and in my view the application should be refused outright thank

[0:17:28] Voice 11: you miss montague she

[0:17:49] Voice 4: wanted to thank the trustees for their service

[0:17:51] Voice 4: and I appreciate your commitment to the South Pender community.

[0:17:55] Voice 4: And secondly, I'm looking over the meeting agenda,

[0:17:57] Voice 4: and I got very excited to see new strategic initiatives

[0:18:00] Voice 4: that I understand you could choose to explore.

[0:18:05] Voice 4: Specifically, I'm interested in the issues of affordable housing

[0:18:08] Voice 4: and groundwater sustainability,

[0:18:10] Voice 4: and I think others might also share those concerns.

[0:18:13] Voice 4: So I would urge you to maybe explore those issues.

[0:18:17] Voice 4: Okay, moving on.

[0:18:18] Voice 4: So this is in opposition to the TUP.

[0:18:21] Voice 4: application and I'd like to say that over the years I really enjoyed living in and working with

[0:18:27] Voice 4: and getting to know this community. I volunteer on the fire department and it's always great to

[0:18:32] Voice 4: meet other residents who volunteer and make a difference while serving our community.

[0:18:37] Voice 4: For the record again I'd like to oppose the TUP application as an absent owner commercial

[0:18:43] Voice 4: enterprise in a rural residential neighborhood. All of the issues as set out in my letter still

[0:18:50] Voice 4: still stand and remain unmitigated.

[0:18:53] Voice 4: But further to that, I'd like to reiterate some of the comments from a neighbor's letter here

[0:18:58] Voice 4: because they are hugely relevant.

[0:19:02] Voice 4: It was said that most will appreciate a significant difference between an absent STVR owner

[0:19:07] Voice 4: and the situations where residents have a secondary suite, an extra bedroom,

[0:19:12] Voice 4: or a cottage on the property that they rent out.

[0:19:15] Voice 4: This extra income helps committed residents financially while offering a world residential

[0:19:23] Voice 4: experience to visitors and retains a connection to the community by the homeowner being present.

[0:19:32] Voice 4: I understand that the LTC has the authority to grant the tub but has no authority to rescind it.

[0:19:38] Voice 4: Instead, the neighbours and the neighbourhood are left to deal with a lack of accountability

[0:19:43] Voice 4: and oversight.

[0:19:45] Voice 4: To be allowed, I would assert that there is no preserve and protect here, and ultimately

[0:19:51] Voice 4: the only one to benefit will be the applicant.

[0:19:54] Voice 4: I encourage the committee to deny outright the tough application on the grounds of the

[0:19:59] Voice 4: operation of a commercial owner-absent short-term vacation rental clearly conflicts with many

[0:20:06] Voice 4: of our land use values and vision statements of the OCPs, and that the neighbors overwhelmingly

[0:20:12] Voice 4: overwhelmingly oppose this commercial use and I'd just like to leave you with one thought here

[0:20:17] Voice 4: community over Commerce thank you

[0:23:21] Voice 12: the application for the house on Canal Road, the 5,000 square foot house. I moved to Pender

[0:23:30] Voice 12: 50 years ago, ended up in a pioneer home. It was about 1,500 square feet, had about

[0:23:37] Voice 12: 500 square feet of outside space, and it was one of the bigger homes on Pender at that

[0:23:43] Voice 12: time. So over the years, I've watched as houses have got bigger and bigger and bigger. A 5,000

[0:23:49] Voice 12: square foot home in my estimation is not part of our rural character and very environmentally

[0:23:56] Voice 12: it's going to take a lot more materials furnishing and heat to keep up the applicant has indicated

[0:24:03] Voice 12: they want a four-bedroom home i worked as an architect and one of the houses i was asked to

[0:24:10] Voice 12: do was in a national park one of the most restrictive building codes and we had a 16

[0:24:16] Voice 12: 16 foot height ceiling from floor to the top 434 square foot envelope and I was able to design a

[0:24:26] Voice 12: four-bedroom home in that amount of space so that's one-tenth of the space that is being asked

[0:24:33] Voice 12: I looked at the applicant's drawings could be done at 3500 square feet and first of all I wanted to

[0:24:39] Voice 12: say i compliment the design i think the look of the building is quite good um i took a look at it

[0:24:48] Voice 12: and i i looked at at the um drawings on the website for the meeting and i couldn't see a lot

[0:24:57] Voice 12: of it because it was pretty fuzzy but i could figure out

[0:25:00] Voice 19: and

[0:25:01] Voice 12: with um making some of the rooms

[0:25:03] Voice 12: a bit smaller and some of the function a little bit better, it could easily be done in 3500 square

[0:25:10] Voice 12: feet if the loft wasn't included. And I want to give an example. I looked at the master bedroom

[0:25:18] Voice 12: and ensuite 600 square feet and I thought that's a lot of space for a bedroom and ensuite. That is

[0:25:26] Voice 12: is more space than the four bedroom home

[0:25:29] Voice 12: I did in the National Park.

[0:25:33] Voice 12: So if the loft is important,

[0:25:37] Voice 12: then maybe the trustees could consider

[0:25:39] Voice 12: a 3,500 square foot home,

[0:25:42] Voice 12: plus the 750 square foot cabin size,

[0:25:46] Voice 12: put those together and put a restriction on the loft

[0:25:49] Voice 12: so that no cabin or other major buildings could be built.

[0:25:53] Voice 12: So that's just a suggestion.

[0:25:56] Voice 12: they put out as reasons that they have a daughter in university and a mother who also needs a caregiver, mothers in the 80s.

[0:26:05] Voice 12: By the time the building is built, neither of those people are likely to be around after five or 10 years.

[0:26:12] Voice 12: And so you're going to end up with a 5000 square foot home for two people.

[0:26:17] Voice 12: It makes no sense environmentally, economically or socially.

[0:26:21] Voice 12: I urge the trustees to reject the application, ask the applicants to redesign the building more in keeping with the real lifestyle.

[0:26:30] Voice 12: And if interested, I'm happy to sit down with them and work with the applicants to help sketch up an alternative.

[0:27:29] Voice 9: I know that staff report there is an option for trustees to consider the work plan at a separate meeting,

[0:27:36] Voice 9: and I would recommend that option, and that there be a provision for discussion with the community in developing this plan.

[0:27:42] Voice 9: There are many items on the current work plan that were not supported by the community.

[0:27:47] Voice 9: In a case in point, in the recent Land Use By-law changes, 122, which were very controversial and resulted in making numerous property owners non-conforming with respect to dwelling size and setbacks,

[0:28:01] Voice 9: We'd like to see our trustees revisit this bylaw and make this a priority on your work plan.

[0:28:09] Voice 9: For myself, welcome, and especially Toby, welcome to South Penn.

[0:28:22] Voice 9: So, a couple of my comments are similar to the ones that Jane made with regard to the work plan.

[0:28:26] Voice 9: i think it's very important to understand that this is um these are items that have come before

[0:28:32] Voice 9: us in the past um some of them with transparency some of them without transparency some of them

[0:28:38] Voice 9: without due consideration with um with the community so those things um need to that

[0:28:45] Voice 9: That needs to be reviewed, discussed, and in the traditional self-prender way, debated.

[0:28:53] Voice 9: So we'll go there.

[0:28:57] Voice 9: With regard to the development variance permit, you know, I think that here part of it is

[0:29:05] Voice 9: that these people have submitted an application on 3.3 acres in an area that is not visible

[0:29:14] Voice 9: to anybody else um i believe they have letters of support from their neighbors and additionally

[0:29:21] Voice 9: they are addressing all of the things that we said when we talked about reduction of house size

[0:29:29] Voice 9: that need to be addressed staying in your home accommodating people who your your parents all

[0:29:36] Voice 9: that kind of stuff wider hallways bigger rooms accessibility everything else so is it the

[0:29:44] Voice 9: right size i don't think that that's up to us to decide quite frankly

[0:29:48] Voice 9: that is up to the people who

[0:29:50] Voice 9: are addressing their own needs and what they feel those needs are and how they're going to

[0:29:56] Voice 9: to address them.

[0:29:57] Voice 9: So I would encourage

[0:30:00] Voice 9: encourage the LTC to consider this application on that basis and that basis alone. With regard to

[0:30:09] Voice 9: the STVR application, I'm not going to get into the yes, no, maybe so. I am a person who lives

[0:30:17] Voice 9: within the area that's impacted. Maybe, again, maybe this is something that needs to be revisited.

[0:30:26] Voice 9: how do maybe there are areas where we shouldn't have stvrs maybe that's the way we should be

[0:30:32] Voice 9: looking at it

[0:30:34] Voice 9: it's a you know there aren't any good examples because you have them in magic lake

[0:30:39] Voice 9: so um but maybe that's maybe that's the way we need to to reconsider that um the idea that not

[0:30:53] Voice 9: gulf islands is a place for tourism and it's almost impossible for the normal family to be

[0:31:00] Voice 9: able to afford to stay in the commercial options that we have available on south panda um review

[0:31:08] Voice 9: the changes um with regard to bylaw 122 i totally agree we

[0:31:13] Voice 9: need to sit down as a community and work

[0:31:15] Voice 9: through that one again there are a lot of um oh sorry one other thing on the stvr application

[0:31:20] Voice 9: It is not, the water storage is not representative of what our bylaw says, what they proposed.

[0:31:29] Voice 9: So I'll leave that with you.

[0:31:32] Voice 9: Read the application, read the bylaw.

[0:31:37] Voice 9: And I think that, oh, so bylaw 122.

[0:31:42] Voice 9: There were a number of places where the discussion was controversial.

[0:31:48] Voice 9: controversial. For myself, the controversy is around two areas where the community was never

[0:31:55] Voice 9: informed and never consulted. And those are the increase in water storage and why it was changed

[0:32:03] Voice 9: from rainwater to freshwater. Nobody, we didn't have that conversation. And the other one is the

[0:32:09] Voice 9: increase in the height restriction, which was done again without consultation to the community

[0:32:15] Voice 9: and without any consideration of the topography of this island and what people have to deal with

[0:32:24] Voice 9: when they buy a piece of property that's not to say that they can't deal with it but we need to

[0:32:29] Voice 9: be able to to um think about those rethink those things there's my notes thank you very much

[0:33:37] Voice 15: to comment on at this point is the tup application um to me um first and foremost the consideration

[0:33:48] Voice 15: for the trustees should be on the views of the residents and property owners uh in the castle

[0:33:55] Voice 15: road subdivision i'm very impressed with that group and the cohesion of that group in terms

[0:34:02] Voice 15: to look at this carefully and and coming out with a clear view of what the community finds acceptable

[0:34:10] Voice 15: with two-thirds of the people there and i think that has to be given high value the other element

[0:34:17] Voice 15: of that application that i think is important is um this is um a variance from our bylaws

[0:34:26] Voice 15: And I think the bar needs to be set very high when we move away from the bylaws to have a commercial operation within a residential area.

[0:34:36] Voice 15: I think that that's something we want to be careful about setting precedence on.

[0:34:40] Voice 15: And in my view, this case does not merit that kind of exception.

[0:34:48] Voice 15: and I support the community's general overview to deny that application, so thank you.

[0:36:34] Voice 3: out of that wheelchair so we have to have our wider hallways our wider doorways our wider

[0:36:41] Voice 3: staircase we have to put in that elevator now that we this is not a luxury item for us this

[0:36:49] Voice 3: is what we need to do i do stained glass i need my studio at one point in time i won't be able

[0:36:56] Voice 3: to do stained glass anymore but we're not ready to roll into the grave yet we want to live a life

[0:37:01] Voice 3: where our quality of life in our home is such that we're not restricted with our own access.

[0:37:11] Voice 3: There's days when my husband is using two canes to walk around, so the fact that

[0:37:18] Voice 3: somebody who does not live with us and does not know what we're going through right now

[0:59:13] Voice 5: square meters and that's 3 500 square feet so the proposal is the applicants are asking to increase

[0:59:20] Voice 5: that floor area to 530 square meters and that's just over 5 700 square feet um the proposed

[0:59:30] Voice 5: The proposed dwelling is a two-storey structure, multiple bedrooms, studio space, office, as well as features to facilitate an elderly parent with mobility issues and also living space for their caregiver.

[0:59:48] Voice 5: There's also space for other family members to stay in the home, so this is a multi-generational dwelling unit.

[0:59:54] Voice 5: The house also includes design features to accommodate the mobile.

[1:00:00] Voice 5: issues. It's wider doorways, wider stairs, as well as a larger garage to assist with unloading

[1:00:09] Voice 5: and unloading. So the property is over three acres in size. It's very heavily wooded.

[1:00:16] Voice 5: You can't actually see the building site from the road or from the two neighboring properties.

[1:00:23] Voice 5: The houses, I believe, are about 200 meters away. So you can't actually see the proposed

[1:00:28] Voice 5: proposed dwelling unit from the neighboring houses and there is a it's a bare land strata

[1:00:33] Voice 5: with a driveway easement up to the proposed building area and the site is the site is

[1:00:40] Voice 5: currently cleared in preparation for the issuance of the dvp which would then lead to the issuance

[1:00:45] Voice 5: of the building permit sorry as we know um the ltc is still waiting for minister's approval

[1:00:59] Voice 5: approval of proposed bylaw 123 in anticipation of that bylaw approval I have prepared a checklist

[1:01:09] Voice 5: document that would be used for future applications to incorporate the building design and citing

[1:01:16] Voice 5: guidelines although since they're not adopted this application did not have to take those into

[1:01:20] Voice 5: consideration although the proposal actually did address a number one number of those guidelines

[1:01:25] Voice 5: lines, and those are included in the staff report. So in terms of impacts on the neighboring

[1:01:30] Voice 5: properties, as I mentioned, they're pretty minimal, given the size of the lot, also the

[1:01:35] Voice 5: location of the billable area, and the thick vegetation of the property. We received, I want

[1:01:43] Voice 5: to say, three letters of support, maybe, well, and we heard from multiple members in the room.

[1:01:50] Voice 5: So there is an overwhelming amount of support for this application. So staff have provided a

[1:01:56] Voice 5: recommendation to approve the development variance permit based on the rationale that the variance is

[1:02:02] Voice 5: reasonable and the increased floor area would facilitate a family to live together and also

[1:02:07] Voice 5: to age in place and the impacts on the neighboring properties are minimal as well so on page

[1:02:15] Voice 5: 12 of the agenda is the recommendation to approve the ltc also has other options laid out on page

[1:02:23] Voice 5: page 17 of the agenda that is to either request further information from the applicant or another

[1:06:12] Voice 25: house somebody wants a medium house somebody wants a big house those are personal needs and

[1:06:18] Voice 25: personal choices and we i don't feel like we have to agree on that and we can't argue about if

[1:06:25] Voice 25: somebody's right in their choice or not that's really going beyond in my view what we should

[1:06:31] Voice 25: be considering we should be considering things that isn't causing harm is it working against

[1:06:38] Voice 25: the mandate of the trust to protect the environment and so on. There is some argument

[1:06:44] Voice 25: that you're using more building materials but then there's also the argument that newer houses are

[1:09:30] Trustee Elliott: least amount of disturbance. And as you stated, clustering and keeping sort of everything

[1:13:13] Voice 5: this application was brought to the previous trustees last year around this time

[1:13:20] Voice 5: at that time the proposal was a maximum of four guests and as we know generated a fair

[1:13:25] Voice 5: amount of correspondence in support and also not in support so at that time the trustees of that

[1:13:33] Voice 5: last year decided to deny the application and hoped that the neighbor or the applicant would

[1:13:40] Voice 5: address the neighboring the neighbor's concerns and also try to mitigate efforts

[1:13:48] Voice 5: put mitigated efforts in place so the applicant has now reapplied for a stvr tup stvr

[1:13:57] Voice 5: and has amended their application the first point is they're reducing the number of guests from

[1:14:04] Voice 5: four adults to two adults and potentially two children and this reinforces the intent of only

[1:14:12] Voice 5: renting to one one party they installed a privacy screening deer fence along the western and eastern

[1:14:20] Voice 5: and hotlines and also they installed a 1200 12 000 liter cistern which is connected to the

[1:14:30] Voice 5: water system to provide a secondary water source store water source and storage during the summer

[1:14:36] Voice 5: so the current residential use of the property conforms with zoning as this is a commercial stvr

[1:14:46] Voice 5: use it doesn't conform with the zoning regulations therefore they had to apply to for a tup

[1:14:56] Voice 5: when reviewing temporary use permits and there are guidelines in the official community plan

[1:15:02] Voice 5: and staff have attached a checklist addressing how the application has either complied or not

[1:15:09] Voice 5: complied with those guidelines one of the items is groundwater use so there is a potential for

[1:15:16] Voice 5: or increased water use resulting

[1:15:45] Voice 5: that states that they need to retain these cisterns which equal to a capacity of about 14 000 meters

[1:15:53] Voice 5: um there certainly is as we've heard some potential um impacts to the surrounding and the

[1:16:00] Voice 5: direct neighbors and also to the community and those could be noise from the guests also

[1:16:05] Voice 5: potential nuisance it could potentially change the neighborhood character there could be in increased

[1:16:12] Voice 5: increased traffic as well um to address some of these concerns staff did recommend on page one of

[1:16:20] Voice 5: the staff report to reduce the number of days the stbr could be in use from May 1st to September 30th

[1:16:27] Voice 5: to 60 days although hearing about the the concerns the neighbors still have the LTC may want to

[1:16:35] Voice 5: consider reducing that further potentially to 30 days. The LTC

[1:16:43] Voice 5: also has an option to issue the permit for a three year maximum.

[1:16:48] Voice 5: You also have an option to reduce that time period to

[1:16:51] Voice 5: either one year or two years. So that's an option the LTC could

[1:16:55] Voice 5: consider. In terms of consultation, we certainly heard

[1:17:00] Voice 5: from a number of um neighbors and also the community some in support and but there is

[1:17:08] Voice 5: an overwhelming amount of people who are not in support of the application so the ltc should

[1:17:13] Voice 5: certainly take that into consideration when you're deciding on on the outcome of this tup

[1:17:19] Voice 5: so when staff drafted the staff report it was based on the comments received at that time

[1:17:27] Voice 5: and so the recommendation by staff is to first amend the draft tup by reducing the number of

[1:17:35] Voice 5: days from may 1st to september 30th from 90 days to 60 days as i mentioned the ltc could certainly

[1:17:42] Voice 5: reduce that further and the second recommendation was to approve the uh the amended tup there all

[1:17:49] Voice 5: are also alternatives the ltc may want to consider considering the amount of correspondence we've

[1:17:55] Voice 5: received in the last week one of those is to request for further information from the applicant

[1:18:01] Voice 5: the second is to issue the permit as drafted the third is to add additional conditions

[1:18:08] Voice 5: on the stdr use and the fourth is to deny the application um so i'm just going to leave it at

[1:18:15] Voice 5: that the applicant is actually um joining us through zoom and so um you may want to turn

[1:19:29] Voice 13: application in relation to the square footage and being able to all be together and be in the

[1:19:33] Voice 13: community we really do want to be a part of the community we really do as time allows start to

[1:19:40] Voice 13: transition to full-time residency over on pender we do not plan to bring their earnings away from

[1:19:46] Voice 13: the island we plan to utilize for their services and to continue to develop our our home and

[1:19:51] Voice 13: property um and the main reason for application is we wanted to make sure we were following rules

[1:19:56] Voice 13: um and to ensure that we were obtaining the necessary permits through the parties at b

[1:20:01] Voice 13: we do know that with an stvr permit there are a lot of feelings and sentiments

[1:20:06] Voice 13: especially when it comes to short-term rentals and accessibility to housing

[1:20:11] Voice 13: But due to the square footage of our home and the mentions by Kim prior, our home is small, and it's very special, and it doesn't fully suit a lot of families in relation to the cost of the rental on the basis of full-time residency there.

[1:20:31] Voice 13: We have gone to the water systems as discussed, so I won't take up further time on that, but we are excited to hopefully move forward.

[1:20:41] Voice 13: Our goal is, as mentioned by Kim and our discussions with the trustees and with our community,

[1:20:46] Voice 13: we've tried to have have been that we are aiming towards single or couple travelers looking for an ecologically conscious opportunity.

[1:20:56] Voice 13: opportunity as Audrey's points had made out earlier that the majority of units available for

[1:21:00] Voice 13: rent on South Pender and even on the North Penders are quite costly and because our dwelling is

[1:21:06] Voice 13: smaller and because our location is smaller and unique we have the ability to offer a favorable

[1:21:12] Voice 13: and attractive unit with the hopes of longer term stays of weeks to months at a time. Our goal isn't

[1:21:19] Voice 13: to have a revolving door and our hopes is to be there as much as possible and as our son

[1:21:24] Voice 13: moves towards graduation to move there full-time um so we really appreciate everyone's consideration

[1:21:30] Voice 13: and thoughts and the efforts that have gone in by robin and we'd be happy to answer any questions

[1:22:09] Voice 13: i did um issue responses to every um letter that was received and and made common and brought it

[1:22:15] Voice 13: into our changes and we did the same again this year so they will be available on the forum if

[1:22:19] Voice 13: if able secondary to that we did research and speak with bc front desk and with the water

[1:22:27] Voice 13: rights provisions and we do not need a commercial license and have received formal confirmation of

[1:22:32] Voice 13: that or registration of the well secondary to that we did obtain confirmation in relation to

[1:22:39] Voice 13: commercial use of the road as the road can be used by any residential use which because the use would

[1:22:46] Voice 13: be residential although considered a commercial use for permitting it wouldn't be used for the

[1:22:51] Voice 13: operation of a business back and forward um and because of that there's no further insurance

[1:22:57] Voice 13: provisions required and we have obtained that in writing and forward that on as well

[1:23:02] Voice 13: so we have to our best of our ability this week address some of those concerns um and just to

[1:23:06] Voice 13: make mention finally i i wasn't aware of the the unrest by a few of the neighbors in relation to

[1:23:13] Voice 13: the fencing choice um and we are working that depending financially we did invest over 50 000

[1:23:18] Voice 13: last year in renovations but um budget-wise our hopes is to put in a more formal and long-term

[1:23:24] Voice 13: fence option um as it appears that the discussions prior don't meet the request so just to kind of

[1:23:30] Voice 13: oversee our long-term plans there too okay

[1:24:31] Trustee Evans (probable): situated very closely together. That's not common on the rest of South Pender. So the impact to

[1:24:37] Trustee Evans (probable): neighbors is immediately apparent um having been in stdr situations myself both operating and

[1:24:49] Trustee Evans (probable): beside them um i can i i think i'm pretty well situated to look at both sides here the impact

[1:24:57] Trustee Evans (probable): when there are impacts they can be great um and the best way to that i feel to mitigate them as

[1:25:07] Trustee Evans (probable): if you are present. You don't necessarily have to be within the house, but you should be close by.

[1:25:13] Trustee Evans (probable): And that helps offset a lot of the anxiety of neighbors and also helps to control any

[1:25:22] Trustee Evans (probable): unruly guests. So for myself, this is a very difficult position to be sitting in, but

[1:25:34] Trustee Evans (probable): but with the area also being a strata

[1:25:39] Trustee Evans (probable): and there also being existing positions

[1:25:46] Trustee Evans (probable): of two-thirds of the strata opposing it,

[1:27:25] Voice 25: catherine you found from the uh in your last letter that you know it's it's not um it doesn't

[1:27:31] Voice 25: have to be a commercial water license for the well and i agree with the rationale for that

[1:27:37] Voice 25: that the road, similar, whatever use your dwelling has,

[1:27:46] Voice 25: that road use is probably covered kind of thing.

[1:27:49] Voice 25: I don't think anything other than that,

[1:27:51] Voice 25: unless the strata forbid it.

[1:27:56] Voice 25: But I don't see that preventing us

[1:27:58] Voice 25: from making a decision either way.

[1:28:00] Voice 25: and to me the biggest factor here is that this is the first temporary use permit for STVRs

[1:28:19] Voice 25: on South Pender and historically you know we've gone from no restrictions to full prohibition

[1:28:27] Voice 25: prohibition on stvrs in the last term um so this this use permit will have you know have to be a

[1:28:39] Voice 25: well well there is no there's no example that we can follow there's nothing been done before

[1:28:44] Voice 25: so we have no president here that we can look to um i consider the recent bylaw to forbid stvrs

[1:28:54] Voice 25: to have some value but i don't think it was um fully flushed out type of thing i think it could

[1:29:00] Voice 25: have been more nuanced and i think what's kind of come up from from this application

[1:29:06] Voice 25: is that the the difference between uh the owners operators living either on the property or very

[1:29:14] Voice 25: nearby versus being absent like us in off island i think there might have been better if that

[1:29:22] Voice 25: bylaw would have drafted some differentiation in the way that those two different scenarios

[1:29:27] Voice 25: were treated and I think that's the opportunity in front of us right now to sort of indicate

[1:29:34] Voice 25: our thinking on it and my thinking on it is that the intentions being good

[1:29:45] Voice 25: is great and that would be a requirement in my view from the applicants which I feel fully

[1:29:52] Voice 25: be convinced that we do have their goodwill and wanting to work with it here and address

[1:29:58] Voice 25: all the concerns that have been mentioned.

[1:30:00] Voice 25: but to me the issue is the lack of control by not being here and that I have also seen STVRs

[1:30:07] Voice 25: use them and you cannot control that you cannot control it there doesn't matter what anybody says

[1:30:14] Voice 25: you can have all the will in the world to want to do it a certain way but there's no way you can

[1:30:20] Voice 25: fully control that so that to me is the crux of the issue and maybe in the future we can look at

[1:30:29] Voice 25: making some additional changes to the bylaw along those lines but for now I think you know

[1:30:39] Voice 25: that's what's guiding my thinking here is with the community being as strong opposition as

[1:30:47] Voice 25: the indication we've had from here today and from the letters sent in with the lack of control to

[1:30:55] Voice 25: to upkeep the promises, I think it's not ready to go forward.

[1:31:39] Trustee Evans (probable): had to sit by and suffer. And that's what I'm struggling with. If the management company

[1:31:46] Trustee Evans (probable): is unable to correct the situation then the residents are left to suffer and that that is

[1:31:54] Trustee Evans (probable): that that's come down to to being my um my crux point as well can

[1:32:07] Voice 13: be people there say in the may june kind of came from when people would most likely visit or the

[1:32:56] Voice 13: parents reside half time on their boat off of Pender in in the from about April through till

[1:33:02] Voice 13: October. So proximity to the dwelling during those timeframes would be close. We did engage

[1:33:10] Voice 13: both a cleaning service that does cleaning, but also property management, a secondary property

[1:33:15] Voice 13: manager who is a contact just as a further 24-7 for call-outs, and the property management company

[1:33:22] Voice 13: on island through Dockside. So there would be three emergency professionals who are accessible

[1:33:28] Voice 13: in addition to family members within half an hour's reach to an hour's reach at most

[1:33:34] Voice 13: that would prohibit any sort of partying of that nature and if something like that were to arise

[1:33:41] Voice 13: the we'd have the police involved immediately just just to kind of make note of kind of to

[1:33:48] Voice 13: tend to that basis because that's a concern of ours too and definitely being far away but that's

[1:33:55] Voice 13: our hopes is to be there at least a week a month as we've been trying over the past year or longer

[1:34:03] Voice 13: for the summer months for two or three months at a time so coming in to check on the property

[1:34:08] Voice 13: ensure the maintenance would be integral to us too thank

These minutes follow the order of the agenda, although the sequence may have varied.  The electronic 
meeting was livestreamed, recorded, and made available for electronic public attendance.  
1. CALL TO ORDER 
Chair Elliott called the meeting to order at 11:00 a.m.  She acknowledged that the meeting was 
being held in traditional territory of the Coast Salish First Nations. 
 
2. APPROVAL OF AGENDA 
By general consent, the agenda was approved as presented. 
 
3. TRUSTEE REPORT 
Trustee Evans reported she has been appointed to the Financial Planning Committee and the 
Trust Programs Committee. The next meeting of the Trust Programs Committee will consider 
budget recommendations to be made to the Financial Planning Committee. Trustee Evans 
noted she would put up a poster regarding upcoming Islands Trust Conservancy Webinar  
series on the Hall poster board. 
 
Trustee Falck reported he has attended several training sessions for newly elected Trustees. 
He expressed support for transparency, open communication and the importance of public 
input. 
 
4. CHAIR'S REPORT 
 
 Chair Elliott reported she has been appointed Vice Chair of Executive Committee. Chair Elliott 
was a member of the Gabriola Island Housing Advisory Planning Commission regarding

biodiversity, housing and water availability. Chair Elliott attended two Islands Trust Conservancy 
meetings, a Regional Planning Committee meeting and an Islands Trust Conservancy celebration 
event with the Swift Family regarding the acquisition of the Link Island Nature Reserve. Chair 
Elliott encouraged members of the public to contact her at telliott@islandstrust.bc.ca. 
 
5. ELECTORAL AREA DIRECTOR'S REPORT – None 
 
6. TOWN HALL AND QUESTIONS 
Chair Elliott reviewed the meeting decorum guidelines and opened the town hall portion of the 
meeting at 11:08 a.m.  
Rick Friesen welcomed new Trustees and spoke to the last 4-year term as being fraught with 
controversy and peril. Mr. Friesen requested Trustees to review bylaws that were adopted 
during the last Trustee term and perhaps to be considered by an Advisory Planning Commission. 
Liz Montague expressed concerns regarding application SP-TUP-2022.1 (9890 Castle Road) who 
presently serves as President of Strata Council and noted she is an adjacent property owner. Ms. 
Montague’s concerns include that the Strata is not supportive of the TUP application, security, 
noise, fire risk, absentee STVR (short term vacation rental) property owner, privacy, water use, 
commercial use in a residential zone and impacts to nearby residents. Ms. Montague asked 
whether the commercial use would require a water licence and how would the STVR use impact 
the strata’s insurance and requested the LTC to deny the application. 
Rebecca Eagen welcomed new Trustees and expressed support to include affordable housing 
and groundwater sustainability in the LTC strategic priorities list. Ms. Eagen expressed concerns 
regarding application SP-TUP-2022.1 (9890 Castle Road) including an absentee STVR property 
owner, commercial use in a rural and residential neighbourhood, neighbourhood opposition and 
requested the LTC to deny the application. 
Gord Duncan welcomed the newly elected Trustees and added that as Bylaw 123 has not 
been adopted, it should not be used in planning reports. 
Robert Dill expressed concerns regarding SP-DVP-2023.1 (9825 Canal Road) including the 5,000 
square foot size of the house and associated impacts of building materials, heat and furnishings. 
Mr. Dill expressed support for the design of the proposed house. Mr. Dill requested the LTC to 
deny the application and encourage the applicants to design a building that suits the rural 
character of the island.  
Donna Spalding presented a submission on behalf of member of the public (Jane) and welcomed 
the new Trustees, and asked the LTC to consider the LTC work plan at a separate meeting with 
community input. There are many items on the current LTC work plan that were not supported 
by the South Pender Island residents including recent land use bylaw changes that resulted in 
numerous dwellings be non –compliant. The member of the public asked Trustees to reconsider 
Bylaw 122.  Donna Spalding spoke on behalf of herself and expressed support for public input on 
the LTC work plan. Ms. Spalding expressed support regarding application SP-DVP-2023.1 (9825 
Canal Road) including recommendations for aging in place, neighbour support, that it is not 
appropriate to regulate the size of the house and encouraged the LTC to approve the 
application. Ms. Spalding spoke to application SP-TUP-2022.1 (9890 Castle Road), advised the

proposed water storage does not follow legislation, encouraged the LTC to consider whether 
there are appropriate areas on South Pender Island for STVRs and noted STVRs are needed to 
support tourism in the Gulf Islands. Ms. Spalding requested the LTC to review Bylaw 122 with 
community input regarding water storage and submitted a piece of correspondence 
Paul Petrie welcomed newly elected Trustees, expressed that he looks forward to working 
collaboratively and spoke to conservation of Brooks Point Park. Mr. Petrie expressed concerns 
regarding SP-TUP-2022.1 (9890 Castle Road), including impacts to neighbours, a commercial 
STVR operation within a rural neighbourhood and requested the LTC to deny the application. 
Applicant for SP-DVP-2023.1 welcomed new Trustees and spoke to the application (9825 Canal 
Road). The applicant spoke to the importance of the house design to be wheelchair accessible 
and appropriate for her multi-generational family. 
Heather Haryu welcomed newly elected Trustees and spoke to the Development Variance 
process.  Ms. Haryu expressed support for application SP-DVP-2023.1 (9825 Canal Road) and 
that people living outside of the general area affected by the application should not be 
discussing the house size. 
Michael St. Cyr expressed support for application SP-DVP-2023.1 (9825 Canal Road). 
Debbie Friesen expressed support for application SP-DVP-2023.1 (9825 Canal Road) and 
expressed concerns regarding the past practice of Trustees meeting outside of a formal meeting.  
Trustee Evans encouraged members of the public to write letters for transparency and public

Lee Pullen expressed support for a straw poll of the members of the public in attendance 
regarding whether there is support for application SP-DVP-2023.1 (9825 Canal Road). 
Chair Elliott thanked the member of the public for the straw pole suggestion and Trustees 
agreed not to hold a straw poll regarding application SP-DVP-2023.1 (9825 Canal Road) at this 
time. Trustee Evans expressed support for considering whether straw polls should be used as a 
mechanism to gauge public support at a special meeting.  
A member of the public asked whether there would be guidelines regarding who would be 
eligible to vote in a straw poll. 
A member of the public expressed support for a straw poll as an informal mechanism to see 
whether there is public support.

 Planner Stockdill presented a staff report dated January 26, 2023 regarding a 
Development Variance Permit application to increase the maximum floor area of a 
proposed dwelling unit at 9825 Canal Road. 
 
Applicant spoke to the application.  
 
In discussion the following items were noted: 
 A minimal number of trees were removed at the building site; 
 The reasons provided for the need to build a 5,000 square foot residence for a 
multi-generational family are valid; 
 The building site location on the property will provide the least environmental 
impact; and 
 The proposed design of the attached garage reduces the overall footprint of 
buildings on the site.

Development Variance Permit application SP-DVP-2023.1 (9825 Canal Road).

13.2 SP-TUP-2022.1 (Ellis)  
Planner Stockdill presented a staff report dated January 25, 2023 regarding a Temporary 
Use Permit (TUP) application for a Short Term Vacation Rental (STVR) within an existing 
dwelling at 9890 Castle Road. 
 
Applicants Catherine and Andrew Ellis spoke to the application.  
 
In discussion the following items were noted: 
 The applicants have done a lot of work to address concerns; 
 Considerable opposition to the application has been received by the Strata Council 
and nearby residents; and 
 Impacts from STVR’s can be largely mitigated when the property owner lives on or 
nearby the property. There is no precedent to follow for STVR applications within 
the South Pender Island Local Trust Area. There should be policy regarding absentee 
property owners included in STVR guidelines. Applicant Catherine Ellis advised there 
would be three emergency contacts available at all times to respond to any 
emergencies. 
 
The electronic meeting ended due to a power outage and recorder Sarah Shugar left the meeting at 
12:35 p.m. Staff recorded the meeting and the minutes were completed from the meeting recording.
