[0:02:39] Voice 7: On January 9th, the Sheldon-Wilk Islands Forum met.

[0:02:43] Voice 13: meeting were Adam Olsen,
[0:02:44] Voice 7: Elizabeth May, Gary Holman, Paul Brent,
[0:02:48] Voice 7: LTC trustees from Main Island, Gabriela,
[0:02:51] Voice 7: North and South Pender, South Spring Island,
[0:02:54] Voice 7: Chair Peterson was there, and Trustee Maberly.
[0:02:57] Voice 7: Topics that were discussed were anchorages
[0:03:00] Voice 7: and derelict boats.
[0:03:02] Voice 7: Bill C-33, which has been passed in the House of Commons,
[0:03:06] Voice 7: will give the powers to the minister of transport to direct on anchorages uh adam and elizabeth
[0:03:13] Voice 7: discussed um a joint press conference they believe that they need to give this matter
[0:03:19] Voice 7: for more media attention uh also at the meeting gary roman asked adam if there is a way forward
[0:03:27] Voice 7: for tiny homes uh adam is requesting a meeting with the new housing minister
[0:03:32] Voice 7: and the Minister of Municipal Affairs to discuss that.
[0:03:37] Voice 7: Steve, Averly and I had a meeting with Adam towards the end of January
[0:03:42] Voice 7: to discuss the F1 lots on Galliano.
[0:03:45] Voice 7: It was a quick, short, 30-minute meeting.
[0:03:49] Voice 7: I had been reviewing the OCP going back to 1972,
[0:03:53] Voice 7: so it's a long and complex history.
[0:03:56] Voice 7: Adam requested this meeting, and it was prompted by F1 lot owners
[0:04:02] Voice 7: here on galliano they've been calling his
[0:04:04] Voice 8: office and writing emails there will be future meetings

[0:04:11] Voice 7: any updates i've also been working through some more orientation down with
[0:04:16] Voice 7: us um other trustees and other items and i look forward to seeing them at the council meeting
[0:04:22] Voice 7: in march and i just want to give a special shout out to our staff um they've been working very

[0:04:57] Voice 4: there and making it close to 400 for the day so i thought that was a great event for the community
[0:05:05] Voice 4: so i thank you for that um secondly i want to introduce uh ken thomas uh counselor for the
[0:05:12] Voice 4: pelican nation and um you know i thought it was would be a good time to get um the pelican to

[0:06:13] Voice 4: We occupied a lot down Whaler Bay, all the way around Tommy Harbor.
[0:06:19] Voice 4: well i just wanted to introduce myself and and show up and say hello um you know another thing
[0:06:29] Voice 4: we're talking about with um carbon sensitive sites um you know we deal with a lot of erosion
[0:06:36] Voice 4: things like that we work with parks and archaeologists and trying to figure out what
[0:06:43] Voice 4: to do about these eroding areas and we've got a few ideas coming up and we uh i hope pretty soon
[0:06:53] Voice 4: before the next storms that came and died and whatnot so you know and then be awesome to have
[0:06:59] Voice 4: the the teamwork from the trust too so you know so i think it's opening doors to help each other

[0:09:24] Voice 18: uh trust council is in march is coming up uh in nanaimo and that will of course be
[0:09:31] Voice 18: really quite focused on the budget but i think the other big topic there is going to be the
[0:09:36] Voice 18: bylaw enforcement review that's been requested by trustees well i think those two items will
[0:09:41] Voice 18: probably dominate the trust council meeting um i just wanted to let everyone know my plan uh next
[0:09:51] Voice 18: month is to come and spend uh the night after the tuesday meeting here on galliano and so i'll be
[0:09:59] Voice 18: here all day wednesday until i think it's at 8 15 ferry to head to salt spring so if anybody wants

[0:11:55] Voice 4: because nobody in the community seems to be aware that this is bad.

[0:13:09] Voice 16: December motion to bring back application GLRZ2022-1 on change. I am not necessarily
[0:13:19] Voice 16: opposed to your decision, but the process. To ensure transparency, I expect that the mover
[0:13:28] Voice 16: of any motion to describe the context
[0:13:32] Voice 4: and their rationale for the motion, and that the
[0:13:37] seconder also
[0:13:38] Voice 4: publicly voice their rationale. I also expect for the community to understand
[0:13:47] some of the issues
[0:13:48] Voice 16: that the chair would seek greater clarity and discussion for any motion,
[0:13:54] Voice 16: motion, especially one that overturns a decision by a previous LTC or a motion that is not
[0:14:01] Voice 16: tabled in the terms of the meeting to supporting documentation.

[0:14:54] Voice 4: law to Wise Island because they are almost the exact same island in size.
[0:14:59] Voice 4: Just wanted to put that out there as well so that bylaw could be utilized as well.

[0:15:32] Voice 4: i'm here because i've seen the world through many years and i've seen development through many phases
[0:15:41] Voice 4: and unplanned development is a tragedy and a travesty um as new trustees your position
[0:15:51] Voice 4: is not a political office it's actually a job and i believe your job is to guide development
[0:16:00] Voice 4: interests with reference to the community plan and into the community plan galliano
[0:16:07] Voice 4: galliano includes large areas of forest other islands do not the galliano plan limits
[0:16:15] Voice 4: development to preserve and protect the amenities of the tourist this is increasingly important
[0:16:21] Voice 4: during climate change galliano's plan calls for environmental sensitivity and a cooperative
[0:16:27] Voice 4: road network this would mitigate some of the risk of fire and other human impacts in the forest
[0:16:34] Voice 4: as well as provide access for owners and others beyond think access corridor fire is a health risk
[0:16:45] Voice 4: health risk and a property destroyer any human development in the forest increases the risk
[0:16:53] Voice 4: power lines cause fires the development of the forest has been a contentious issue for 30 years
[0:17:01] Voice 4: years. And now we have new trustees. Welcome to your new
[0:17:08] Voice 4: job. All
[0:17:11] Voice 16: jobs have a job description. One of your job
[0:17:15] Voice 16: descriptions is to comply with the code of conduct. In your
[0:17:21] Voice 4: first meetings, there's some, I was happy to note that Lisa
[0:17:26] Voice 4: refused herself when issues of higgers came up. Ben in his
[0:17:31] Voice 4: first meeting did three actions I'd like to comment on. The
[0:17:36] first action was to make a notice motion about non-enforcement of illegal accommodation
[0:17:46] Voice 4: second was to invite an identical reapplication of a previous uh application that was turned down by
[0:17:56] Voice 4: a previous lpc and the third was to invite a letter from a member in the audience that was
[0:18:01] Voice 4: seeking abeyance of an enforcement.
[0:18:06] Voice 4: These were all non-agenda items with no previous history,
[0:18:10] Voice 4: so they only came from Ben.
[0:18:13] Voice 4: Considering enforcement actions by the trust against this trustee,
[0:18:17] Voice 4: these introductions breach the code of conduct.
[0:18:22] Voice 4: Therefore, Trustee Maverly must not be permitted
[0:18:25] Voice 4: to introduce or vote on any issues that impact
[0:18:29] Voice 4: or may impact the forest zone.
[0:18:32] So he must recuse himself or be recused.
[0:18:37] I'd like to make another comment
[0:18:38] Voice 4: about the main non-enforcement issue
[0:18:42] Voice 4: as it might've been introduced
[0:18:44] Voice 4: even encouraged by the local director
[0:18:47] Voice 4: to reduce the tax on affordable housing.
[0:18:51] Voice 4: And since there are illegal accommodations
[0:18:54] Voice 4: in the Forest Zone that will likely not improve
[0:18:59] Voice 4: prove the stock of affordable houses,
[0:19:03] Voice 4: that all enforcements in the forest zone
[0:19:08] Voice 4: not be included in any non-enforcement.
[0:19:13] Voice 4: Therefore, all non-enforcement of illegal habitation,
[0:19:18] Voice 4: the forest zone would not
[0:19:20] Voice 18: be excused.

[0:19:35] Voice 17: my name is john lonsley i live on spot my road at the north end um i am speaking to you today
[0:19:46] Voice 17: because once again uh the crystal mountain application to rezone the forestry lot is on
[0:19:52] Voice 17: the agenda for today's meeting i want to be clear about what is on the table here and what this
[0:20:00] Voice 17: proposal is this proposal is for a community facility where there has never been any
[0:20:11] Voice 17: formal request from the community at large and where there is considerable
[0:20:17] Voice 17: opposition within the community for the proposal which has been demonstrated on multiple occasions
[0:20:26] Voice 17: in many different ways. For example, it was demonstrated by a petition signed by I believe
[0:20:34] Voice 17: 174 community members obtained over a two-week period opposing the proposal and I would also
[0:20:42] Voice 17: also say that the opposition was demonstrated quite clearly at the community information
[0:20:47] Voice 17: meeting that occurred in September of last year. The organization that is putting forward
[0:20:59] Voice 17: this proposal provides service largely to clients who have no other connection to Galliano
[0:21:09] Voice 17: Island except that they are clients of Crystal Mountain. The proposal is at odds with the
[0:21:20] Voice 17: Galliano Official Community Plan and that's why there are some fairly significant OCP
[0:21:30] Voice 17: amendments attached to it and it seeks to create a visitor accommodation
[0:21:40] Voice 17: facility on forestry zone land which I believe would be unprecedented for
[0:21:47] Voice 17: Galeano. So I would like to request of our local trustees today that they not go
[0:22:04] Voice 17: along with the planners recommendation to proceed to a public hearing on this
[0:22:12] Voice 17: proposal at this time but rather that they undertake to meet with those in the communities
[0:22:22] Voice 17: who remained very concerned and in opposition to what is being advanced here in the approval
[0:22:31] Voice 17: process. I would very respectfully submit to the two of you in that regard that this is your
[0:22:44] Voice 17: mandate to represent your constituents and it may be perhaps somewhat different than the agenda
[0:22:54] Voice 17: of the items trust staff in this matter. Thank you very much for your consideration and for
[0:23:01] Voice 17: for this.

[0:23:31] Voice 4: many years.
[0:23:50] Voice 4: So I'm concerned about three things. I think one of them is
[0:23:55] Voice 4: is the lack of enforcement of our bylaws.
[0:23:58] Voice 4: And for some reason, I've never understood.
[0:24:05] Voice 4: We have a forest lot zone, which is, what, 60% of the island,
[0:24:11] Ben?
[0:24:12] 42.
[0:24:14] 42%, yeah, a large chunk of the site.
[0:24:17] Voice 4: And there was a path made, part of the bylaws exists,
[0:24:23] Voice 4: and it says no buildings, no buildings,
[0:24:25] Voice 4: except a building with no sides on the wall, right?
[0:24:30] Voice 4: But there has been many, many problems, and many have some of those problems.
[0:24:38] And this lack of enforcement is a real problem, because I do what Hugh just said about forests.
[0:24:44] We need our forests. Forests may be the savior of this whole global
[0:24:48] Voice 4: warming, at least certainly health care.
[0:24:51] Voice 4: So we have these pilots, they're in place, and they've never been enforced.
[0:24:55] Voice 4: So the enforcement problem on this island has been proved.
[0:25:01] and so we need to start enforcing it
[0:25:04] Voice 4: so now i want to address ben's motion about affordable
[0:25:08] Voice 4: housing and not uh not telling us that not to enforce the violence and i have a really problem
[0:25:18] Voice 4: with that one because i'm okay with that i understand we need affordable housing on this
[0:25:22] Voice 4: island but it should only be on residential properties that do have dwelling rights there
[0:25:28] Voice 4: is no running rights on that course at all and in order to get those running rights they have to
[0:25:35] resolve it's
[0:25:36] Voice 4: a clear there's a way to do this you should not be building on the course lots
[0:25:40] Voice 4: and that you lose on yourself in the residential use right so some people have done that i've
[0:25:47] Voice 4: always done that um the women's has done that but in the meantime there's always a legal building so
[0:25:52] Voice 4: So with your bylaw, with your proposal sets up a situation
[0:25:58] Voice 4: where anybody in the forest law zone could have buildings
[0:26:01] and rent them
[0:26:02] Voice 4: out and do whatever they want.
[0:26:03] Voice 4: It could be the one forest, right?
[0:26:06] Voice 4: In your particular, I shouldn't point at you,
[0:26:08] Voice 4: in your particular case, you do have buildings down there
[0:26:12] Voice 4: which are helpful people for the four bylaws.
[0:26:15] Voice 4: Like Bear and I think Gordito and other people.
[0:26:19] Voice 4: I don't know how you get around this,
[0:26:20] Voice 4: but i'm totally against um the idea of people on the porch which do not have running lights
[0:26:28] Voice 4: to be able to have trailers and stuff like that i think it's a very bad move to decide to do that
[0:26:33] Voice 4: and you know i've heard on maine it isn't just maine which doesn't have that situation at all
[0:26:38] there's really some problems with having trailers all over the place without septic fields without
[0:26:44] of water
[0:26:44] Voice 4: without all those things in place so i would i would like you to just limit the uh
[0:26:54] Voice 4: non-important non-important thing to it's only on that presidential
[0:27:05] Voice 4: it's there maybe you could be grandfathered in some way
[0:27:08] Voice 4: but but to to to expand it would be crazy okay so i guess that's my main point
[0:27:34] The Chair is going to deal with that when it comes to
[0:27:42] Voice 4: discussion or, well not discussion,
[0:27:45] Voice 4: but certainly for voting on a motion when Ben, for instance, has illegal buildings on
[0:27:52] Voice 4: those affluent lots.
[0:27:55] That
[0:27:55] Voice 4: actually does business on behalf of us.
[0:27:58] Voice 4: because so does richard when it's business on behalf of us
[0:28:05] i don't understand this how can you possibly have a vote and i know it's a chair what's your position

[0:28:19] Voice 18: because uh this is kind of new territory for me but i have had some uh some talks with senior

[0:40:00] Voice 3: uh almost half the island was owned by a forestry company and then it was uh it was sold uh so the

[0:40:10] Voice 3: there to to look at i hope mr chairman that you uh have looked at the
[0:40:15] Voice 3: history or look a little more deeply into what happened over the years but the fact that half
[0:40:21] Voice 3: half the island was in managed forest
[0:40:26] Voice 3: and then moved to an F1 destination
[0:40:30] Voice 3: that does not allow dwelling without a rezoning,
[0:40:33] Voice 3: was a sound planning principles
[0:40:41] Voice 3: enacted by the local trust committee at the time
[0:40:44] Voice 3: and was upheld by the BC Court of Appeal
[0:40:47] Voice 3: and was denied at the Supreme Court of Canada
[0:40:51] Voice 3: to appeal those bylaws so they stand and they're an important part of how the community has planned
[0:40:57] Voice 3: itself now i noticed that there a notice of motion was given at the last meeting about this bylaw
[0:41:02] Voice 3: but notice was not given to the community i noticed that you didn't the trustees did not put
[0:41:08] Voice 3: any information about this notice of motion in in your report either your reports in the active
[0:41:15] Voice 3: page that have come out since then so there is no this is a very very to uh open the zoning
[0:41:23] Voice 3: essentially it opens the the forest zone it would open the forest zone as well as
[0:41:29] Voice 3: uh other other zones to unlawful dwellings uh overthrows uh years of uh policy and planning
[0:41:40] Voice 3: of this one this local trust committee and a change of this nature should be part of a full
[0:41:48] Voice 3: scale uh official community plan review that's where this stuff should be done not uh not
[0:41:54] Voice 3: will be nearly from a notice of motion made with no notice in the community
[0:42:04] Voice 3: so that's really all i have to say but i urge you if you're going to support this
[0:42:09] Voice 3: take the stuff about the uh f1 area and any areas that don't permit a dwelling out of that out of
[0:42:18] Voice 3: that motion if you're going to go ahead i think it's probably better to have to refer it and have
[0:42:24] Voice 3: a more of a full-scale community conversation about this thanks very much thank you uh

[0:42:39] Voice 4: The fact that businesses are losing employees
[0:42:43] Voice 4: is not because we don't have houses.
[0:42:46] Voice 4: It's because people that have the houses aren't interested in renting them.
[0:42:51] Voice 4: Or if they are renting them, they're renting them on the weekends to Airbnb.
[0:42:56] Voice 4: So it's not about not having houses.
[0:42:59] Voice 4: It's about the people who don't rent them.
[0:43:01] Voice 4: So, criticism and enforcement might be best guided to the Airbnb market, so that speculators
[0:43:10] Voice 4: who buy properties and then rent them can't do it anymore, especially when they don't
[0:43:18] Voice 4: live here.
[0:43:18] Voice 4: Or if they do live here, the residents that have an accommodation are somehow discouraged
[0:43:23] from Airbnb
[0:43:24] Voice 4: and encouraged to rent locally.
[0:43:28] Voice 4: that is where people will have a place to stay and non-enforcement is a non-issue
[0:43:36] Voice 4: it's actually an enforcement about airbnb and the opportunistic leverage of property ownership
[0:43:44] Voice 4: over those who do not own properties the property owners who rent to airbnb versus somebody in their
[0:43:52] Voice 4: their community.
[0:43:54] Voice 4: So if those bylaws could be written,
[0:43:57] Voice 4: I would largely encourage those
[0:43:59] Voice 4: and enforcement policy over a non-enforcement policy
[0:44:04] Voice 4: because it actually leads strength, integrity,
[0:44:08] Voice 4: honesty, and transparency to the community plan
[0:44:14] Voice 4: and the job of the trustees.

[0:44:40] Voice 16: to reduce fire risk, to promote biodiversity,
[0:44:43] Voice 16: to improve water recharge, and generally
[0:44:47] Voice 16: to make the forest a forest that we can be proud of
[0:44:51] Voice 16: and that we can all enjoy.
[0:44:52] Voice 16: I'm also the chief engineer of the Trails Society, which has got quite a few owners of large forest parcels on board with public access.
[0:45:04] Voice 16: And if you go back to the year 2000, if you looked at a satellite photo of the island, you would see huge patches of clear cuts.
[0:45:12] Voice 16: And in the last millennium, the problem in our forest was probably that kind of harvesting.
[0:45:19] Voice 16: And if you look at some of the photos now, the entire island is green because there has
[0:45:25] Voice 16: been no fire cutting over the past 23 years.
[0:45:28] Voice 16: And on the other hand, we do need some harvesting to thin the forest that's overstocked.
[0:45:34] Voice 16: That's a fire hazard.
[0:45:36] Voice 16: A lot of work needs to be done in the forest.
[0:45:39] Voice 16: And the problem with our forest is that they are mostly neglected.
[0:45:43] Voice 16: So we need to encourage really good care of the forest.
[0:45:48] Voice 16: and that does include the best care of those people that live on the land thank you thank you

[0:47:26] Voice 8: island this is historic territory as well so i think that if we go back to the indigenous

[0:51:06] Voice 6: and the LTC um I am used to working in a very cold north tender hall and it is very important
[0:51:14] Voice 6: been here so thanks toasty i appreciate that anyways back to the agenda so um i'm introducing
[0:51:22] Voice 6: a development variance permit uh granting this variance will permit the construction of a stacked
[0:51:28] Voice 6: boulder smoke stabilization stabilization works to remediate a slide area which is from that
[0:51:35] Voice 6: atmospheric river we had back in november 2021 and um this stabilization stabilization work is
[0:51:43] Voice 6: is to provide protection for a water service line
[0:51:48] Voice 6: and also the gravel driveway
[0:51:51] Voice 6: and also from further erosion.
[0:51:54] Voice 6: There are actually two applications
[0:51:56] Voice 6: associated with this proposal.
[0:51:58] Voice 6: First is the DVP, which is on the agenda.
[0:52:00] Voice 6: The second is a development permit
[0:52:02] Voice 6: and the development permit will be addressed
[0:52:05] Voice 6: if this DVP is approved by the LTC,
[0:52:07] Voice 6: the DP will be delegated to staff.
[0:52:09] Voice 6: So the DP will be applicable to the service line and also the works within DPA 2, which is the shoreline and marine, and also the DPA 7, which is deep slopes.
[0:52:25] Voice 6: As part of the DP application, the applicant provided a number of professional reports.
[0:52:32] Voice 6: One was an environmental assessment report. There was also multiple geotechnical reports.
[0:52:40] Voice 6: and um recommendations from both reports actually helped to create um this this
[0:52:47] Voice 6: stack holder stabilization so the proposed development or the proposed stabilization
[0:52:55] Voice 6: it actually is a construction of two areas of stack folders riprap stabilization with a pocket
[0:53:03] Voice 6: of planting. And also in between those two areas, there'll be natural stabilization methods with pockets of native planting.
[0:53:14] Voice 6: So it's a mix of soft shore green works, or green shores, and also mix of the hard stabilization with the riprap.
[0:53:24] Voice 6: so the reason for this variance application is the slope stabilization structure is considered
[0:53:32] Voice 6: a structure in the land use bylaw and it needs a variance from the natural boundary of the sea
[0:53:38] Voice 6: so this variance is requesting a variance down to the natural boundary of the sea so to zero liters
[0:53:46] Voice 6: to date we have received no submissions in response to the notification and staff just
[0:53:53] Voice 6: wanted to note that there isn't any anticipated impact to the neighboring properties in addition
[0:54:01] Voice 6: based on the professional reports it was determined that using soft shore green shores
[0:54:10] Voice 6: with a mix of hard engineering solutions was the best option, rather than just using all softer options,
[0:54:18] Voice 6: which really wouldn't help to achieve the goal of stabilizing that bank.
[0:54:24] Voice 6: So staff have provided a recommendation to improve the variance.
[0:54:28] Voice 6: This is based on the fact that variance is minor and the construction has been deemed necessary by the geotechnical engineer.
[0:54:36] Voice 6: year the design facilitates some more natural protection using small aggregate and native
[0:54:42] Voice 6: plantings and the impacts to neighbors and also the surrounding environment are are minor so on
[0:54:49] Voice 6: page 20 of the agenda there's a recommendation there for the ltc to consider to approve the

[1:30:13] Voice 2: first reading today, will be to request staff to schedule a public hearing for bylaws number,
[1:30:19] Voice 2: for the two bylaws, before March 31st. And so the reason that that date is in place
[1:30:25] Voice 2: is because we have funding in place to support the from the project to support the public hearing
[1:30:34] Voice 2: before March 31st. So I can just give you again just a little bit of a an overview of the project
[1:30:43] Voice 2: so it's work that has sort of built upon a groundwater science project that was initiated
[1:30:55] Voice 2: a few years ago two or three years ago and that that data has been brought together to inform
[1:31:02] Voice 2: the development permit area boundaries for Galliano and there are also some additional
[1:31:11] Voice 2: some additional pieces in the land use bylaw that have been added that that recognize the
[1:31:20] Voice 2: the vulnerability of water on Galliano Island.
[1:31:24] Voice 2: So the land use bylaw amendments that have been proposed
[1:31:30] Voice 2: include some new different definitions,
[1:31:32] Voice 2: system requirements for new builds,
[1:31:36] Voice 2: an increase from 16,000 liters to 18,000 liters
[1:31:39] Voice 2: for secondary suites.
[1:31:40] Voice 2: And that 18,000 liters is a number that was identified
[1:31:45] Voice 2: through conversations with architects and builders,
[1:31:48] Voice 2: builders, as well as looking at how the sizes that these things come in what's practical.
[1:31:55] Voice 2: And that's a number that is also being proposed for North Pender.
[1:32:02] Voice 2: There are some, you know, just sort of language updates, just so that all the language sort
[1:32:09] Voice 2: of aligns with the DPA language and amendments to the OCP.
[1:32:14] Voice 2: and the other sort of significant piece for the land use bylaw are updates to regulations related
[1:32:24] Voice 2: to proof of water for subdivisions so there were proof of water related regulations for subdivision
[1:32:31] Voice 2: previously these have been updated and there's been considerable work over the last probably
[1:32:39] Voice 2: probably a couple of years, starting with the Salt Spring LTC and we've taken that and
[1:32:45] Voice 2: what Galliano is before you now is actually been quite refined.
[1:32:51] Voice 2: There's been provincial input and substantial discussion on our end around all the finer
[1:33:00] Voice 2: points in there.
[1:33:01] Voice 2: So with respect to sort of, there's some general amendments in the OCP, those include some
[1:33:07] Voice 2: some minor changes in the language.
[1:33:09] Voice 2: Again, there's sort of an alignment with the OCP
[1:33:12] Voice 2: and the LEB and some of the language that is in the BPA.
[1:33:18] Voice 2: There are a couple of maps that have been changed.
[1:33:23] Voice 2: So we've replaced Schedule D,
[1:33:25] Voice 2: which identified water resources,
[1:33:27] Voice 2: and it now has water regions.
[1:33:30] Voice 2: And that was part of our mapping work.
[1:33:35] Voice 2: and Schedule G, which was the DPA for elevated groundwater catchment, is now proposed to be
[1:33:42] Voice 2: replaced by the map for the groundwater recharge protection. And so that map reflects
[1:33:52] Voice 2: the five hectare critical aquifer coverage, which as I had sort of explained the methodology a
[1:33:59] Voice 2: little bit the previous LTC meeting the methodology is based on identifying the critical aquifer
[1:34:09] Voice 2: the critical aquifer areas and the extent to which each lot to be included in the DPA is covered
[1:34:21] Voice 2: by critical aquifer area and it was the five after coverage as opposed to the 10 20 or the two
[1:34:29] Voice 2: that was endorsed by the previous ltc after um engagement with the community so that's the map
[1:34:36] Voice 2: that's in there um and the dpa guidelines so galliano did previously have uh dpa guidelines
[1:34:44] Voice 2: for elevated groundwater catchment so these ones were the so some of what was previously included
[1:34:50] Voice 2: is included in terms of exemptions to the DPA.

[1:58:19] Voice 12: concurrent enforcement. Galliano has 10 open files for unlawful dwellings with eight of those on
[1:58:27] Voice 12: forest one zone lots or F1 lots and two on rural residential lots and there being no new complaints
[1:58:33] Voice 12: or files open for unlawful dwelling since 2020. There is a concern in all of the local
[1:58:40] Voice 12: trust areas regarding housing and the lack of available rental units and the majority of local
[1:58:45] Voice 12: trust areas have now adopted policies regarding deferred enforcement on lawful dwellings
[1:58:51] Voice 12: the recommended policy has been adopted by multiple local trust committees and is providing
[1:58:56] Voice 12: clear guidance on how to work with community when it comes to complaints and prioritize
[1:59:01] Voice 12: on health and safety environmental concerns uh those most concerned about lawful dwellings are
[1:59:07] Voice 12: concerned about the impacts of sewage disposal and risk contamination of wells and environmentally
[1:59:12] Voice 12: sensitive areas adoption of the recommended policy would provide consistency for by-law
[1:59:18] Voice 12: staff and how to deal with these sensitive housing matters but it would also provide
[1:59:23] Voice 12: consistent messaging for residents of the the trust area as a whole so as an alternative
[1:59:30] Voice 12: trustee mayberry's motion is still there and available for the trust committee to consider
[1:59:35] Voice 12: But I put forward the recommended motion because this has been the most detailed and fleshed out on multiple local trust areas.

[2:06:30] Voice 4: that way and that they have long-standing families that have been here for a long time
[2:06:36] Voice 4: but haven't been recognized by a nation and so for me um the standing resolution should reflect
[2:06:47] Voice 4: you know what what's happening right now so i'll read it out um because i guess i should do that
[2:06:53] Voice 4: it's a note of notice of motion to replace standing resolution two zero one nine zero five
[2:07:00] Voice 4: 3 standing with notice of motion for standing resolution that the local trust committee seek
[2:07:07] Voice 4: to engage in reconciliation with local first nations governments and island community by
[2:07:13] Voice 4: honoring the truth and reconciliation commission prc calls to action the united nations declaration
[2:07:19] Voice 4: on rights of indigenous peoples under draft principles that guide the province of british

[2:07:38] Voice 4: organizations introducing trustee staff and provide a schedule of known local trust committee

[2:07:50] Voice 4: advocacy activities for all local trust committee meetings invite local first nations to attend
[2:07:57] Voice 4: meetings as well as to provide nutritional welcome to their territories if they would like
[2:08:03] Voice 4: so that's a change from before it was they may invite and some changes as we will invite work
[2:08:11] Voice 4: with local first nations governments and organizations on cooperative initiatives
[2:08:16] Voice 4: including but not limited to language place names territorial acknowledgements
[2:08:21] Voice 4: and community education on Coast Salish and local First Nations cultures and cultural heritage and
[2:08:28] Voice 4: history. The difference there is I've added local organizations, local First Nations organizations
[2:08:34] Voice 4: to the standing resolution. Work with local First Nation governments and organizations
[2:08:41] Voice 4: on engagement principles for inclusive land use, marine use, and climate change planning,
[2:08:46] Voice 4: advocacy, protection and stewardship, and knowledge and information sharing protocols.
[2:08:53] Voice 4: Establish and maintain dialogue with local First Nations and organizations, now and into the future, based on respect and recognition of Aboriginal rights and titles, treaty rights, traditional rights, and First Nations traditional territories within the trust area.
[2:09:09] Voice 4: And direct staff not to take enforcement action against any Indigenous peoples in regards to their traditional inherent rights.

[2:10:34] Voice 4: fill more point right that's that's the one place so um so this is why i asked in the projects like
[2:10:42] Voice 4: um you know do we put do we how do we how do we do something here that's fair to um
[2:10:51] Voice 4: you know the boat access people and um and how do we move forward on the project you know because
[2:10:59] Voice 4: we don't have uh clarity we don't have any money um so what i'd like to see us do is is
[2:11:07] Voice 4: um have staff um look into do and we'll do the same look into the the um regular or the
[2:11:15] Voice 4: the bylaws on on the islands that you referred to in gambier and house on those islands and see what
[2:11:21] Voice 4: their their um regulations say right now and whether we can just adopt something that's
[2:11:29] Voice 4: already sort of cut and paste which makes our life easy and staff's life easy and um
[2:11:35] Voice 4: and the other thing is you know i i think there might be a motion here because
[2:11:40] Voice 4: if if we're trying to regulate places that don't have um the opportunity in essence to comply
[2:11:51] Voice 4: comply with the regulations that's meant for a large island that has access, I don't think

[2:38:17] Voice 16: do it but it didn't happen because we were stuck and where the trust was that these owners could
[2:38:24] Voice 16: not have building rights unless among other things they donated the road allowance and and you're not
[2:38:32] Voice 16: allowed to you're not required to donate road allowances unless

[2:38:37] Voice 16: so we had something that was off-key and it's been stuck and i believe this is an example of

[2:40:02] Voice 6: BC was a province, before Canada was a country, definitely before the Islands Trust.
[2:40:10] Voice 6: When I first came to the island, I started society. We started a
[2:40:14] Voice 8: society for one reason,
[2:40:16] Voice 8: just because we were, just like the lands that are happening with Mother Nature, our
[2:40:22] Voice 8: our identity was eroding, eroding fast.
[2:40:26] Voice 8: So when I talked to the elders, one of which was Charlie,
[2:40:30] Voice 8: he told
[2:40:31] Voice 7: me about the history
[2:40:31] Voice 7: and we started doing research and we found that
[2:40:35] Voice 8: this family had always
[2:40:36] Voice 6: lived on this island before.
[2:40:38] Voice 6: As a matter of fact, Henry Scottie Jorgensen
[2:40:41] Voice 6: and his wife, Sarah Joneo, he was
[2:40:45] Voice 8: the first settler
[2:40:46] Voice 8: to bring an indigenous woman onto this land.
[2:40:49] Voice 8: so henry jurors is our direct we're descended directly from henry jurors and scotty jurors
[2:40:57] Voice 8: and sarah and then they had five children and the first of those had attention that's how we all
[2:41:03] Voice 8: came to be on the side so imagine how you know this family has felt where they were taken off
[2:41:13] Voice 8: the cemetery committee when that used to be jerks imagine how we felt when we couldn't even put our
[2:41:21] Voice 8: uncle in that property because of the church telling us we can't put him there so we couldn't
[2:41:28] Voice 8: put him there we can't put it it was donated by his great great great grandfather to the people
[2:41:37] Voice 9: look at them and we can't put them there imagine
[2:41:42] Voice 8: how we felt when there was a committee formed to
[2:41:47] Voice 8: talk about an ocp that happened when island trust came together and then when i first read the
[2:41:54] Voice 8: bylaws or the the the act the society act or the island trust act there was one line that

[2:42:05] Voice 6: they would respect indigenous people and

[2:44:51] Voice 3: there are attempts in the course of developing pushing this moving this file off through the
[2:44:56] Voice 3: processes that um the claim was that this is not really a house it's not a real house
[2:45:04] Voice 3: it's a caretaker a caretaker lodging um which will have two people in it but it doesn't really
[2:45:11] Voice 3: qualify as a dwelling for some reason there's really no justification for this but at the same

[2:45:19] Voice 3: or 2275 gallons that are required per day for the dwelling were not calculated in
[2:45:26] Voice 3: the water budget because if they if if they did have calculate that against the house the rest

[2:45:40] Voice 3: part of the the retreat facility. So I just hope that
