[0:02:03] Voice 12: right i hope you all can hear me um the past month's been quite busy
[0:02:08] Voice 12: uh last week we attended trust council a few notable items that came out of that meeting
[0:02:13] Voice 12: for the final approval of the 2023-24 budget.
[0:02:19] Voice 12: This was a challenging budget year,
[0:02:22] Voice 12: as the province of D.C. approved a new collective agreement
[0:02:27] Voice 12: that resulted in salary increases outside of Trust Council's control.
[0:02:31] Voice 12: Similar to what all SGI communities faced,
[0:02:36] Voice 12: Island Trust was also affected by high inflation,
[0:02:39] Voice 12: strange due to labour shortages and managing staff retention.
[0:02:45] Voice 12: Even taxes low and consideration for funding an IT program, trust program,
[0:02:52] Voice 12: made our decisions difficult and challenging. It's true that keeping taxation as low as possible
[0:03:01] Voice 12: or officially by drawing on a surplus fund may prove to be compounding issues to keep
[0:03:07] Voice 12: taxation down in the next budget cycle. Notable motions
[0:03:12] Voice 12: that were asked were the establishment
[0:03:15] Voice 12: of an accessibility committee. More than 900,000 British Columbians live with a disability.
[0:03:21] Voice 12: New government regulations under the Accessible British Columbia Act
[0:03:26] Voice 12: seeks to remove barriers and create accessible standards throughout the province.
[0:03:32] Voice 12: The
[0:03:33] Voice 4: province of BC mandated
[0:03:34] Voice 12: that more than 750 public sector organizations form accessibility
[0:03:38] Voice 12: to share. Organizations include school districts, post-secondary institutions, public libraries,
[0:03:48] Voice 12: and your friendly neighborhood local government. Allen's Trust is included. A motion was passed
[0:03:55] Voice 12: to form a reconciliation learning group. This learning group will support the development
[0:04:00] Voice 12: of positive and productive relationships with First Nation leaders and will culturally
[0:04:06] Voice 12: The learning group will be an effective means for sharing information, increasing understanding
[0:04:12] Voice 12: of their reconciliation work on behalf of the Yarmouth Trust, anticipated outcomes would
[0:04:17] Voice 12: include updating the reconciliation action plan, and staff expect Trust Council to receive
[0:04:24] Voice 12: a number of requests from First Nations, Trust Council as well, sorry, bylaw compliance officer
[0:04:36] Voice 12: made a presentation on bylaw enforcement policies and practices. He was accompanied by presentations
[0:04:44] Voice 12: from the VC office of the Ombudsperson and the Attorney General's Office. Ms. Hansel
[0:04:52] Voice 12: adopted a motion to request an independent review of bylaw enforcement policies and practices
[0:04:59] Voice 12: by the VC office of Ombudsperson. This is to seek advice around best practices to already
[0:05:06] Voice 12: strengthened our current policies present presentations gave an overview of our firm
[0:05:12] Voice 12: and help verify um the trust council's role about the season i'd like to thank the staff for the
[0:05:23] Voice 12: work uh putting in putting this agenda package together thank you thank you and that's all for

[0:05:41] Voice 12: couple of subjects that i was going to talk about um you know this is a budget trust council meeting
[0:05:48] Voice 12: so uh that's the bulk of the budget uh getting that approved i you know i think we've got to
[0:05:54] Voice 12: thank the work of the financial planning committee for their work and the recommendations coming
[0:05:58] Voice 12: forward to uh keep the increase as low as possible and um you know there's going to be a um a pull-off
[0:06:06] Voice 12: action with the financial planning committee and the trust council to try and figure out how the
[0:06:12] Voice 12: budget process can be um made better for that the better way to put it um so that's going to be
[0:06:21] Voice 12: going on ongoing into that into the next trust council meeting and we'll get some more information
[0:06:25] Voice 12: on that um the ombudsman review which is i think a long time coming um trust council also dropped
[0:06:35] Voice 12: this request for a training authority um that's been bouncing back and forth with trust council
[0:06:41] Voice 12: for a number of years and um was put to bed at this council meeting a couple other things we
[0:06:49] Voice 12: a great um delegation um a lady from denman island i believe we talked about human rights for housing
[0:06:57] Voice 12: it's very compelling um i think it struck home with a lot of us so just sort of the position
[0:07:03] Voice 12: that people are in um in relation to for the government regulation and this need for this
[0:07:09] Voice 12: need for housing um so i i was really um that was sort of highlighted the meeting for me to hear
[0:07:15] Voice 12: that that person speaks um
[0:07:19] Voice 11: i
[0:07:21] Voice 12: attended the something about finance forum yesterday
[0:07:23] Voice 12: um during that meeting there's always a multitude of things housing is always one of the issues this
[0:07:30] Voice 12: is a common theme it's going to be a common thing probably was a common theme through
[0:07:33] Voice 12: to here and james four years and uh i don't suppose it's going away but there's a lot of
[0:07:41] Voice 12: discussion too around um the relationship between world law violence and crb regulation
[0:07:49] Voice 12: and the hurdles that some
[0:07:54] Voice 8: not just uh people building houses but especially commercial
[0:07:59] Voice 12: businesses it's
[0:08:01] Voice 8: becoming one of the hottest topics at any meeting
[0:08:05] Voice 12: these days is is how
[0:08:07] Voice 12: regulation is effectively killing local businesses. If you look on Galliana, we have
[0:08:15] Voice 12: five restaurants that aren't open, battling their way through this regulatory system.
[0:08:24] Voice 12: So the goal is to sit down with the CRE and to find out why this is happening
[0:08:32] Voice 12: and what the, whether there's solutions to it.
[0:08:37] Voice 12: So that'll be an interesting conversation.
[0:08:40] Voice 12: The other thing is the Southern Gulf Islands Forum,
[0:08:43] Voice 12: you know, they talk about the freighter anchorages as well.
[0:08:46] Voice 12: Anybody who's been around in the boats,
[0:08:48] Voice 12: I mean, you know, amongst the islands and that,
[0:08:50] Voice 12: have noticed that there's freighters anchored everywhere.
[0:08:53] Voice 12: And why they increase, who's in charge,
[0:08:57] Voice 12: it's the Port Authority that's in charge.
[0:08:59] Voice 12: but you know there's a lot of concerns. If you look at Trincomalee, you know just up at
[0:09:05] Voice 12: Trincomalee there's routinely six freighters anchored up there. You think well that's not
[0:09:09] Voice 12: a big deal that this boat's anchored but if you can imagine the size of that anchor plowing around
[0:09:16] Voice 12: on the ocean bed down there there's a lot of damage being done. Some of these are in harvesting
[0:09:22] Voice 12: seeing grounds of the local first nations so there's a lot of concerns there um so that's
[0:09:28] Voice 12: that was pretty much it for me um yeah nice to get that financial trust council out of the way
[0:09:36] Voice 12: thank you trustees um now it's time for the chair's report i'll just add a little bit um to
[0:09:46] Voice 12: the to the report about the trust council meeting last week um trustee mabry was talking a bit about
[0:09:53] Voice 12: the the long-term planning in terms of changing the budgetary process so
[0:09:59] Voice 14: as a lot of people might
[0:10:00] Voice 14: know there's now a governance committee of trust council and uh the governance committee one of
[0:10:06] Voice 14: the things that it
[0:10:07] Voice 12: is uh taking as a high priority is the recommendation to develop more long-term
[0:10:13] Voice 12: corporate planning which
[0:10:16] Voice 14: is more of a phrase than that i think um that the corporate part of this
[0:10:22] Voice 14: is the thing to really emphasize but more of a long-term alignment of strategic planning
[0:10:29] Voice 14: and budgetary so that we kind of have a better idea early in the term what we're going to try
[0:10:34] Voice 14: to accomplish during
[0:10:35] Voice 3: the four years and how we're going to fund it more really more looking at like
[0:10:41] Voice 3: a four-year strategic and financial plan that is that is aligned and joined up and so that's one
[0:10:49] Voice 3: the things the governance committee is going to be working on and maybe by next budget time that
[0:10:55] Voice 3: will be in place maybe not but we'll see it's going to be a lot of work and it's a new direction
[0:11:00] Voice 3: for trust council to try and really think about aligning those two major uh parts of what trust
[0:11:08] Voice 3: council does i'll also add that the policy statement amendment project um charter review
[0:11:15] Voice 3: view was approved by council and we haven't seen the new draft yet but it will reflect
[0:11:21] Voice 3: um the 32 resolutions of trust council between the june and september trust council meetings last
[0:11:28] Voice 3: year so
[0:11:28] Voice 12: i expect there will be some substantial changes um from the previous draft and
[0:11:35] Voice 3: also the
[0:11:36] Voice 3: timeline for public consultation the request of the trust programs committee is to have a
[0:11:42] Voice 3: a six-month window between the draft coming to trustees and the committee and then coming back
[0:11:49] Voice 3: to council for further review and potentially approval so that there's a longer timeline to
[0:11:57] Voice 3: really get out into community and really get some feedback and
[0:12:00] Voice 14: really try to not do what happened
[0:12:04] Voice 14: with the last draft which was to make people feel like it people a lot of people felt it was rushed
[0:12:09] Voice 14: and that the
[0:12:10] Voice 3: consultation wasn't done well
[0:12:13] Voice 14: and that the community wasn't listening to.
[0:12:16] Voice 3: And so we really want to try and avoid that
[0:12:17] Voice 3: if at all possible this time.
[0:12:21] Voice 12: Really positive thing that happened
[0:12:23] Voice 12: is late in last term,
[0:12:26] Voice 12: Islands Trust finally got a seat
[0:12:28] Voice 12: at the DFO Shellfish Agriculture Advisory Committee.
[0:12:34] Voice 12: It's been
[0:12:34] Voice 3: something that's been a long time coming
[0:12:37] Voice 3: coming and uh they know there's a lot of critics of the advocacy or advocacy and the secretariat
[0:12:45] Voice 3: function of trust council but having attended the baines uh channel lambert or bain sound
[0:12:51] Voice 3: lambert channel forum a few times and being involved with um other trustees and other
[0:12:57] Voice 3: groups are really really kind of putting the pressure on dfo to get some accountability
[0:13:02] Voice 3: ability around all the ghost gear and uh and why why is it the taxpayer should pay for the cleanup
[0:13:09] Voice 3: of this gear when the people that are profiting are not paying for it so i'm really hoping that
[0:13:14] Voice 3: there's there's going to be some action on that and it's a really positive step that we now have
[0:13:20] Voice 3: uh uh my co-trustee on the skiddy michaela laroney is is the pointy for that and uh
[0:13:26] Voice 3: David
[0:13:27] Voice 12: Graham is the alternate. So I'm really happy that we finally have a seat at that table. I cannot hurt.

[0:13:37] Voice 9: I'm just going to conclude my chair's report and turn it over to our electoral area director, Paul Brent,
[0:13:45] Voice 14: if you'd like to.
[0:13:46] Voice 14: uh sure i'll keep this short
[0:13:49] Voice 12: our focus yeah the principal focus southern gulf islands is housing
[0:13:55] Voice 11: and the
[0:13:55] Voice 12: next one is housing and the next one is housing so that's where i am focused right now
[0:14:01] Voice 12: and i'm also focused on another side of housing is when we talk about affordability people have
[0:14:06] Voice 12: to have jobs and as ben was talking about we have a problem with southern gulf islands it's
[0:14:13] Voice 12: uh relates to uh crd does its building inspection so yeah i'm taking the blame for
[0:14:21] Voice 12: some of the problems we're having it's a complex and costly building code we got problems with
[0:14:27] Voice 12: island health so um cre and the islands trust and the province through our mla adam olson
[0:14:37] Voice 12: we're going to go at this collectively and so collectively is a good idea
[0:14:44] Voice 12: um yeah we're just we're we're threatening businesses we're threatening people with
[0:14:48] Voice 12: bankruptcy and we're impeding employment on these assignments we've got an affordability problem
[0:14:55] Voice 12: and on the one hand we're blocking it with how we do our building inspection on the other hand
[0:15:02] Voice 12: And we're deprived of people of incomes in order to have.
[0:15:05] Voice 12: So we're really not working very well.
[0:15:07] Voice 12: And so my job in tandem with Lisa and Ben and others and Adam Olson is going to be to change that culture.
[0:15:19] Voice 12: Make it so that CRD, at least I have some control over it, is out there helping people, not putting up barriers.
[0:15:28] Voice 12: if there are barriers in the building code the attitude is we're building inspection we're here
[0:15:34] Voice 12: to help you rather than to be a barrier a regulatory barrier very frustrating but that's
[0:15:41] Voice 12: what i'll be working on with these characters thank you paul

[0:15:52] Voice 14: section is moving into town hall and questions we've got a 20-minute schedule and uh i just

[0:17:00] Voice 10: nelson i'm a full-time resident of wise island on a lot 25. um this is regarding the last two pages
[0:17:08] Voice 10: of today's agenda i just wanted to thank uh bylaw manager mr dingman for his recommendations for
[0:17:13] Voice 10: wise island i would like to quickly clarify and state a few points in reference to his report
[0:17:20] Voice 10: my main concern is the 7.5 meter setback from the sea i have printed an aerial view of my property
[0:17:26] Voice 10: i would hope it is well documented that half of my properties within this setback
[0:17:31] Voice 10: does not work more fair small wise island properties need a full review and sensible
[0:17:36] Voice 10: reduction in these distances or certain structures i also think that suggesting all property owners
[0:17:42] Voice 10: could go with the EDP process, the comply with originally implemented unworkable setbacks
[0:17:47] Voice 10: is an unfair option, both from a financial standpoint.
[0:17:54] Voice 10: It seems that the Islands Trust has spent a considerable amount of resources in water
[0:17:58] Voice 10: taxis, by-law enforcement, fines, meetings, and forced stress on homeowners, all based
[0:18:04] Voice 10: on someone's complaint for dislike of solar panels, and I am quite confused by this and
[0:18:10] Voice 10: how long this has progressed.
[0:18:11] Voice 10: I don't think there's a greener or more environmentally friendly power supply than solar.
[0:18:16] Voice 10: I understand that Biola must act on complaints,
[0:18:19] Voice 12: but it must be taken into consideration why this island has no hydro-connected power.
[0:18:24] Voice 12: Solar panels are a necessity.
[0:18:28] Voice 10: I would like to add there's not one solar array that would be located in the marine splash zone for the obvious reasons sea water and expensive solar arrays do not mix well.
[0:18:41] Voice 10: some owners have unfortunately started to remove trees and others are contemplating trees
[0:18:47] Voice 10: to get more sunlight to panels which i think is more harmful to the environment than being
[0:18:52] Voice 10: sited and set back my request is the last resolution should be adopted in the
[0:18:58] Voice 10: terminus point one this would be most desirable further bylaw enforcement on these vital
[0:19:03] Voice 10: structures to just use a very valuable resources and i would also finally ask to revert the gambit
[0:19:10] Voice 10: to refer the gambler by the 114 for passage island which was previously written to the apc
[0:19:17] Voice 12: for applicability to lands island again thank you for that and on this end yes please oh thank you
[0:19:28] Voice 12: uh chairman i would like to raise the uh question of probity for a
[0:19:35] Voice 10: trustee with a known or perceived
[0:19:38] Voice 10: conflict of interest to introduce a motion and then have to recuse themselves
[0:19:45] for the
[0:19:48] Voice 12: discussion it creates a situation where a motion mover cannot participate
[0:19:54] Voice 12: in the following necessary dialogue dealing with necessity, terms, conditions, and other
[0:20:02] Voice 12: rationale.
[0:20:03] Voice 12: It leaves a motion open to be subverted.
[0:20:08] Voice 12: So I don't know what the situation is.
[0:20:12] Voice 12: If the motion is necessary to change a policy, a resolution, or
[0:20:20] Voice 3: whatever, then should not
[0:20:23] Voice 3: a trustee without a conflict of interest be
[0:20:31] Voice 12: introducing that motion. And secondly, if
[0:20:38] Voice 12: there
[0:20:39] Voice 10: is a motion, I
[0:20:43] Voice 12: would expect that there should be a staff assessment of the replacement
[0:20:49] Voice 12: of any standing resolutions, et cetera,
[0:20:53] Voice 12: with Island Trust policies and procedures
[0:20:56] Voice 12: to ensure consistency and resource impacts.
[0:21:01] Voice 12: If any, it can be just a simple checklist
[0:21:05] Voice 12: or it could be something in detail,
[0:21:07] Voice 12: but let's ensure that changes are going to be made.
[0:21:10] Voice 12: They are going to be consistent,
[0:21:12] Voice 12: especially with the new trust policy statement
[0:21:17] Voice 12: in the offer.

[0:21:26] Voice 14: advantage of staff advice um that's an important thing first i'll remember as far as the conflict

[0:21:38] Voice 14: conflict that's um that's uh perceived for real it's up to the the trustee to make the
[0:21:45] Voice 14: determination um we we can't uh assume guilt um it's not function of this ltc but solely the
[0:21:55] Voice 14: trustee to make the determination of what's appropriate for them um
[0:21:59] Voice 3: in terms of uh of uh
[0:22:03] Voice 3: participation in motions so um this is a kind of a new area for island stress it's certainly
[0:22:08] Voice 3: new for me i've sought advice uh from staff and then they've they've gotten
[0:22:13] Voice 14: some legal advice and
[0:22:15] Voice 14: And so I'll just
[0:22:16] Voice 14: reiterate that it's not the LTC's function
[0:22:20] Voice 14: to act upon any of that.
[0:22:23] Voice 14: So
[0:22:24] Voice 3: I hear your concerns and in terms of the process,
[0:22:29] Voice 3: I also hear what you're saying,
[0:22:31] Voice 14: but again, it's not up to the LTC
[0:22:33] Voice 14: to make that determination, so.

[0:22:41] Voice 12: Okay. I'm here on two parts. Partially on my behalf and partially on

[0:22:54] Voice 10: I can go to the LTC meeting. They need to be told that the groundwater sustainability
[0:22:59] Voice 10: bylaws
[0:23:00] Voice 14: should be stopped at first because of the double falsehood that one elevated
[0:23:08] Voice 14: preferential will recharge areas.
[0:23:11] Voice 14: are all critical, and two, that all the large forest lots need to be in
[0:23:18] Voice 10: a DPA to protect to recharge on the small elevated portion of the property.
[0:23:24] Voice 10: In the water supply field, the critical recharge areas are correctly defined as a subset of preferential recharge areas, which are in...

[0:23:53] Voice 12: um subset of the preferential recharge areas which are endangered by industrial or agricultural
[0:24:00] Voice 12: contamination or else are simply unable to meet potable water demands for downslope resident
[0:24:05] Voice 12: neighborhoods most of galliano has no critical recharge areas because of very light maximum
[0:24:12] Voice 12: population density and absence of contamination issues since the bylaw
[0:24:17] Voice 14: would prohibit cutting
[0:24:19] Voice 14: cutting more than five trees of 20 centimeters diameter
[0:24:22] Voice 14: per hectare per year.
[0:24:25] Voice 14: This transparency, this is a transparently
[0:24:29] Voice 14: unscathed attempt to regulate tree harvesting
[0:24:32] Voice 14: by
[0:24:32] Voice 12: improperly taking advantage of the local public concern
[0:24:35] Voice 12: about the water supply while collecting DPA appliance fees.
[0:24:40] Voice 12: As most of Galliano's elevated recharge areas
[0:24:44] Voice 12: are typically overstocked,
[0:24:45] Voice 12: second growth Douglas fir plantations,
[0:24:47] Voice 12: they need serious

[0:26:24] Voice 12: everything applying to forestry we happen to be an exception from the forestry lots for the

[0:26:35] Voice 12: are not and all of their groundwater is only usable by them but they still have to pay a fee
[0:26:41] Voice 12: to have um all these studies and that doesn't seem a fair approach of the way of doing groundwater

[0:28:38] Voice 8: The limitation of the use of land is the power of zoning. The forest zone has changed the most,

[0:29:06] Voice 8: This group of owners has the most conflict with the community plan.

[0:35:35] Voice 7: this except in all cases very significant new business was presented allowing for no initial
[0:35:40] Voice 7: public input before the lpc undertook action on the demos again this in itself wouldn't be such
[0:35:47] Voice 7: a problem if the two remaining trustees either requested that further information be procured

[0:36:43] Voice 7: bylaws were created for a reason often this reason benefits either the community or the
[0:36:48] Voice 7: environment these individuals could apply for a development permit that is a possibility that
[0:36:53] Voice 7: it's not there isn't a solution development permits are for the community better planning
[0:36:57] Voice 7: rather than an individual allowing the individual individual an opportunity just to hack in and set
[0:37:03] Voice 7: its stairs or pour concrete into sensitive foreshore areas or installing a giant solar
[0:37:08] Voice 7: panel in a neighbor's view there is the opportunity for discussion and protection
[0:37:12] Voice 7: of sensitive ecosystems rather than the wild wild west mentality which this lcc seems more inclined
[0:37:18] Voice 7: to embrace than others i would also ask that you refrain from spending public money on a limited
[0:37:23] Voice 7: project such as the proposed wise island file overview but rather something that can benefit
[0:37:27] Voice 7: the entire community such as the coastal double square protection or shoreline model protection
[0:37:32] Voice 7: by law also engaging with the community around setting projects can be very informative perhaps
[0:37:37] Voice 7: only holding a community event that provides an opportunity for the public to offer insight

[0:53:34] Voice 13: of sustainability roundtable discussions as an indigenous knowledge holder along with other
[0:53:40] Voice 13: indigenous knowledge holders from throughout the island trust region with the support and
[0:53:46] Voice 13: guidance of planner chadwick and lisa wilcox through the length through a lengthy and thorough
[0:53:50] Voice 13: process they provided us with the space to have our voices heard regarding our connections to
[0:53:53] Voice 13: waterland cultural practices and teachings that have been a part of who we are as indigenous
[0:53:59] Voice 13: people for generations we all had time to review consider provide input request edits and approve
[0:54:05] Voice 13: the draft document that was created in collaboration with the other agencies involved and by law 283
[0:54:13] Voice 13: it has been suggested that uh line p the letter p land owned by a person with a federal indigenous
[0:54:23] Voice 13: status living in their traditional territory with proof of indigenous family lineage
[0:54:28] Voice 13: be exempt from any requirement for a development permit i ask you who would stand to gain from this
[0:54:33] Voice 13: motion any indigenous person who is taking action to preserve our land waters and culture for our
[0:54:39] Voice 13: future generations will not be in favor of including this motion water fresh and salt is
[0:54:46] Voice 13: sacred to our people for many reasons and proposing that indigenous people be exempt from requiring
[0:54:50] Voice 13: permit to develop in one of our most sacred resources the dpas is baffling to me you have
[0:54:58] Voice 13: to be living under a rock to not see the impacts colonization development and human activities
[0:55:02] Voice 13: these are having on our waters both fresh and salt and the fight that people are having throughout
[0:55:06] Voice 13: the world to protect these resources i'm not about to cry i'm just not breathing it's okay
[0:55:14] Voice 13: why would developing on or in the area of one of these of one of our most sacred resources be
[0:55:21] Voice 13: something an indigenous person would want to proceed with indigenous people and allies all
[0:55:27] Voice 13: over the world are fighting to protect these natural resources and it's being suggested in
[0:55:30] Voice 13: this document to exempt indigenous people from requiring a permit so they can proceed for their
[0:55:34] Voice 13: own selfish reasons and not consider our future generations and what that impact would these
[0:55:39] Voice 13: actions would have this proposed inclusion would not serve indigenous peoples as a collective but
[0:55:44] Voice 13: only as individuals i would like you to reconsider changing that terminology thank you thank you for

[1:03:35] Voice 7: bylaw enforcement complaint and through that process the applicants decided to apply for a
[1:03:41] Voice 7: TEP and also a DBP. As I mentioned earlier, the applicants did apply to the executive
[1:03:48] Voice 7: committee for fee sponsorship and that was successful. So both the fee applications were
[1:03:54] Voice 7: refunded to the applicant. So as the property is zoned Village Residential 2, which is a
[1:04:02] Voice 7: residential use, the proposed uses and the current uses don't comply with zoning. So
[1:04:07] Voice 7: that's why we're going through the process of a temporary use permit. And just like the
[1:04:11] Voice 7: name um really the purpose of a temporary use is to test out this proposed zoning or use it sorry
[1:04:19] Voice 7: in the hopes that if it is successful and it is a good location that perhaps will go through a
[1:04:25] Voice 7: resuming application uh tup can be issued for up to three years and renewed once for an initial
[1:04:32] Voice 7: of three years um in terms of the conditions in the tup an ltc can make them more restrictive by
[1:04:41] Voice 7: adding more conditions but you can't take conditions out to the temporary use permit
[1:04:46] Voice 7: and so when the ltc receives and members of the community receive this draft tup in your mailbox
[1:04:53] Voice 7: or you see it online it's more of a shell excuse me and there might be additional conditions added
[1:04:58] Voice 7: at the meeting um in terms of any type of land use consideration uh there is the property is
[1:05:06] Voice 7: a limited size and it reduces the ability to locate the buildings and structures on the property
[1:05:11] Voice 7: and also limits the ability to move the community art center as far away as as from residential
[1:05:18] Voice 7: properties on the flip side though it's in a great location because it's close to the sturdiest
[1:05:24] Voice 7: bay commercial hub and also the ferries um the most um potential impacts is to the direct
[1:05:32] Voice 7: uh residential neighbors um and staff have included a condition for the ltc to consider
[1:05:40] Voice 7: to request the as a condition request the applicant to install events um there's a couple
[1:05:48] Voice 7: of recommendations on the property but the one that staff is really recommending is potentially
[1:05:53] Voice 7: essentially a fence that runs along the western boundary that would buffer the the work um the
[1:06:02] Voice 7: workshop or the workshop and also the use of the dwelling from the neighboring property
[1:06:08] Voice 7: and that is recommendation number one a in terms of the DPP as I mentioned it's legalizing some
[1:06:15] Voice 7: existing structures um impacts to neighbors are quite minor and it's also we're deciding
[1:06:21] Voice 7: of two sisters. So staff are recommending approval. Miss the most important thing. We received, I think, over 75 letters in support of this application. And it was amazing to see, we received a letter from a 12 year old, I've never seen that before. And also a piece of artwork signed by a bunch of six or seven year olds. So I'm just saying to the LTC, if this is declined,

[1:06:57] Voice 7: if you go to page 13 the staff is approving the issuance of
[1:07:02] Voice 7: the tup but the ltc may want to consider adding that condition of the construction of the fence

[1:08:13] Voice 12: People familiar with Galleon Island are almost certainly aware of the little yellow house
[1:08:18] Voice 12: in certain places across from the store.
[1:08:22] Voice 12: For most of us, I'm sure it has been a place where artists have lived and produced their art,
[1:08:28] Voice 12: such as Kloba Tours, Ruth Willing, Josef and Hopkins, Bartholomew's building house, and more.
[1:08:36] In 2016, my parents were looking for a
[1:08:40] Voice 12: place here so they could be close to me and my family and my mother saw Yellow House listed online for sale.
[1:08:49] Voice 13: I'm an artist and I've lived here for over a decade
[1:08:53] Voice 12: and because my parents are from Turkey, we knew that there would be times that the house would be unoccupied.
[1:09:02] Voice 12: So my parents were very supportive
[1:09:04] Voice 7: of the idea of us using the house to exploit the processes from which they worked there.
[1:09:10] Voice 7: Things don't always work out the way we planned, so my father's help made it impossible for them to come.
[1:09:17] Voice 7: Realizing that the house would be empty most of the time, we explored our options.
[1:09:22] Voice 7: So we came to a conclusion
[1:09:24] Voice 12: that we would like to share the space with other artists and community members.
[1:09:28] Voice 12: It was always felt to us that this was what the house wanted.
[1:09:33] Voice 12: Thus, Yellow House Arts Center Society was born.
[1:09:37] Voice 12: We have received immense
[1:09:38] Voice 12: support and we're very grateful and thanks to everyone who wrote letters and are here today.
[1:09:47] Voice 12: We've been able to facilitate dancers, musicians, painters, cover rappers, artists of all ages.
[1:09:54] Voice 12: and very importantly we have become involved with the process of reconciliation to community members
[1:10:02] Voice 12: that have been here since time immemorial.
[1:10:06] Voice 12: While we have grown to the point that our land use has become an issue,
[1:10:10] Voice 12: we are not ready to
[1:10:11] Voice 12: commit to a permanent rezoning at this time.
[1:10:14] Voice 12: We are taking the time to develop a plan that we think balances the comfort of our neighbors
[1:10:20] Voice 12: for the community's desire to have a safe and accessible place to make and share art for this
[1:10:26] Voice 12: purpose we're applying for the cbp it is our intention to address any concerns that arise
[1:10:32] Voice 12: promptly and continue to be a good neighbor thank you for your consideration we're happy to answer

[1:33:56] Voice 5: related to the subdivision regulations for potable water and cisterns for new builds.

[1:35:18] Voice 5: staff report that's presented for you identifies changes that staff have made to address those
[1:35:24] Voice 5: so you can see in um related to fire protection that related uh under emergency actions
[1:35:36] Voice 5: The fire protection measures has been added as a single as a focused item and then there has been an additional exemption and we did have conversation with Trustee Maberly about this one as it was of particular interest to him and we sort of arrived at what you see before you which is the exemption would be

[1:42:46] Voice 2: And they speak to, yes, protecting areas of recharge that is impacted by contamination and what they're mostly referring to is agricultural practices.
[1:42:58] Voice 2: But there's also the other hand to that, which is protecting recharge areas to support the quality and not to have a degradation of enhanced recharge.
[1:43:11] Voice 2: And so in the case of Galliano, due to the nature of the island and its geography, the concern is not so much on the contamination, especially from nitrates and other agricultural contaminants,
[1:43:29] Voice 2: but protecting the recharge areas to continually support base flow to streams and inflow to
[1:43:38] Voice 2: fractured bedrock aquifers and to help mitigate the withdrawals, which is part of the definition
[1:43:47] Voice 2: in the critical aquifer recharge area from the definition that Mr. Kiefer is pulling from.
[1:43:54] Voice 2: So I would say that it's not the full story. And indeed, our approach was looking more at protecting the highest recharge, the richest recharge on the island, which is supporting not only well owners, but I have to double down on the fact that it's also supporting the sensitive ecosystems on the island,

[1:44:25] Voice 2: I will agree with the submission that densely populated,
[1:44:32] Voice 2: or densely planted young second growth that is unmanaged

[2:42:12] Voice 1: in regards to section 2.14 of the land use bylaw

[2:42:25] Voice 1: for that contravention.
[2:42:28] Voice 1: The report before you summarizes the bylaw enforcement activities
[2:42:32] Voice 1: and it also gives you your enforcement options

[2:42:38] Voice 1: um i would just there there have been i think in the reference in the report here there's six
[2:42:45] Voice 1: current open files there's five hours five files that have been closed um and primarily yes dealing
[2:42:52] Voice 1: with the solar panels but also with some decks and other small structures in the setback from the sea
[2:42:59] Voice 1: i would like to point out that um the complaints come from more than one individual and there has
[2:43:07] Voice 1: been a concern from multiple complainants over the encroachment on the setback from the sea
[2:43:14] Voice 1: not just for the solar panels but also for for some other structures and also as I reference
[2:43:21] Voice 1: in the report there really is a proliferation of those solar panels around the island and
[2:43:27] Voice 1: when I've observed them in the past they were just they were too numerous to all pursue all of them
[2:43:34] Voice 1: uh but um it's uh as some of the complainants would state it's come a bit of an eyesore
[2:43:41] Voice 1: with with the number of solar panels that have been put up um and overall the enforcement
[2:43:47] Voice 1: activities have not been about trying to prohibit the use of the solar panels but to ensure that
[2:43:53] Voice 1: there are uh you know lawfully cited uh panels you know they're not you know there's other options
[2:44:01] Voice 1: and locations where they can be sited on the property
[2:44:04] Voice 1: in order for people to draw power from them.
[2:44:12] Voice 1: So, yes, at the previous meeting, the issue was raised
[2:44:15] Voice 1: and you may wish to do a wise island bylaw review
[2:44:20] Voice 1: and in consideration of that, the report was prepared.
[2:44:24] Voice 1: And so you have the two recommendations,
[2:44:27] Voice 1: one and two at the beginning of the report,
[2:44:29] Voice 1: but you also have the option if you wish to proceed,
[2:44:32] Voice 1: You could close those current files, it's not recommended, but that is an option that is available to you, or you can go forward with the two recommendations and defer that enforcement until you can complete the review of the bylaws for Wise Island.

[2:45:44] Voice 1: islands that have 15 meter setbacks which is considerable but the 7.5 meter setback
[2:45:50] Voice 1: you know isn't actually very large and it's also a development permit area
[2:45:56] Voice 1: that is set for galliano and well wise island and if you do a lot of work in those areas you
[2:46:03] Voice 1: may also need a development permit so there are areas on the majority of these lots where yes
[2:46:09] Voice 1: they can place their solar solar panels so that they're not in the setback and in fact that's
[2:46:14] Voice 1: That's what many landowners have done.

[2:46:24] Voice 12: Not really too many questions, I am not favorably against the current bylaw enforcement.
[2:46:35] Voice 12: Bylaws are often open due to complaints from the community.

[2:47:06] Voice 12: at our OCP through the lens of the day for a lot of issues but I believe that is the most efficient
[2:47:14] Voice 12: a democratic and cleanest way to reach a consensus

[2:54:26] Voice 12: However, when you talk about legal rights, we talk about the 276 cases that have been before the Supreme Court, and all of them, the First Nations people at one, there is legal precedent. And there is, it should make your life easier if you do that, if you think about that.
[2:54:41] Voice 12: So indigenous people have been listening and we've had to go through everything that the white person has said.
[2:54:50] Voice 12: We've had to live on deserts, we've had to live, we've had to go to school, we've had to go to school, but all of a sudden they're stopping.
[2:54:58] Voice 7: You know, I'm on the First Nations Fisheries Council and we're looking apart at UNDRIP and we're seeing where every case is identified in UNDRIP.
[2:55:06] Voice 7: And we are breaking that under

[2:55:16] Voice 7: Now, as it pertains to individual rights versus the whole of rights, we have a case in D.C. that I was personally a part of, and that's Willitson v. D.C.
