[0:02:01] Voice 12: ideas from everyone present and then once we've got some ideas started we're going to send out a
[0:02:08] Voice 12: poll I think that that's what I'd like to propose anyway that we send out a poll so we hit as many
[0:02:12] Voice 12: people in the community as possible to hear from everyone as to what you want us as your LTC to
[0:02:19] Voice 12: to focus on for the upcoming year.
[0:02:21] Voice 12: Now, there are a couple of things to bear in mind.
[0:02:25] Voice 12: First council made a resolution
[0:02:28] Voice 12: that we can only have one minor project at a time.
[0:02:33] Voice 12: So whatever ideas come out at the end of the process here,
[0:02:37] Voice 12: we can only move ahead with one.
[0:02:39] Voice 12: Once that's been completed, we can take another one.
[0:02:41] Voice 12: And I think it'd be a good idea for us to do this each year,
[0:02:44] Voice 12: at the beginning of each year,
[0:02:45] Voice 12: or whenever a project is closed,
[0:02:47] Voice 12: we'll come back to you and ask you what your what it is that you want us to focus on because we're
[0:02:52] Voice 12: here to represent what you need and want from us the other thing that i want to mention is there
[0:02:58] Voice 12: was a resolution passed by trust council that the trust policy statement will be coming back
[0:03:03] Voice 12: to communities for six months review and input and we're anticipating that to happen later this year
[0:03:10] Voice 12: and included in that will be um reconciliation uh housing and climate change so i would ask that
[0:03:19] Voice 12: if you have recommendations for those three items that they don't be raised as the immediate
[0:03:29] Voice 12: concern because they are going to be dealt with later on this year through the tps process and
[0:03:35] Voice 12: then once the tps process has been completed then we can see how it affects rsvp and how it affects
[0:03:40] Voice 12: any minor projects that you want us to focus on does that make sense so that's my recommendation
[0:03:46] Voice 12: I don't know how dad feels about that and I don't know how you feel about that oh
[0:03:50] Voice 2: yeah if I can just
[0:03:51] Voice 2: add to that there's some only allow the minor one minor project but there are also major projects
[0:04:01] Voice 2: but a major project can only be approved by the by the council by the trust council and funding
[0:04:08] Voice 2: you know we have to ask for funding to do a major project and that only happens once a year and so
[0:04:14] Voice 2: this year there is no major project but we need to plan for if we want a major project for next year
[0:04:21] Voice 2: we would then have to put an application in that would have to convince convince the the group that
[0:04:30] Voice 2: that um that is a priority for
[0:04:35] Voice 9: the trust and
[0:04:36] Voice 2: that they're willing to fund it just so you know that
[0:04:39] Voice 2: that's an option as well. So can you bring the my yes.
[0:04:45] Voice 15: Can you just give an example of what a major
[0:04:47] Voice 15: project would be?
[0:04:49] Voice 12: A major project would be anything that would cost more than than $5,000
[0:04:53] Voice 12: in staff time or resources. So things like an OCP amendment, a major bylaw change, I guess.
[0:05:07] Voice 12: yeah something like that something that's going to take up a significant amount of time or money

[0:05:36] Voice 2: agreements that we could have that I will ask you if you agree to, is that all ideas are welcome.
[0:05:43] Voice 2: And that when we're brainstorming, there's creativity involved. And we need to be feeling
[0:05:50] Voice 2: free to actually come up with ideas. And we want everybody to be able to participate.
[0:05:56] Voice 2: And so it's important that when somebody has an idea, that there's no critiquing of the idea.
[0:06:01] Voice 2: we'll do the critiquing we'll do the evaluation later on right but when we're doing the
[0:06:05] Voice 2: brainstorming we're just saying here's what somebody wants here's something that some
[0:06:11] Voice 2: one person or several people desires to see you know change and so if we can agree that we will
[0:06:19] Voice 2: not critique ideas as they come up we'll just say great so if somebody says you know i think we
[0:06:26] Voice 2: should get a airstrip on south pender that you know and everybody should have access to use a
[0:06:32] Voice 2: a plane on it right i think nobody's going to say oh that's the stupidest idea i've ever heard right
[0:06:37] Voice 2: like that's just not realistic i don't want that we're not going to do that we're just going to say
[0:06:42] Voice 2: cool hey we're going to put it on the list we've got flip charts and we're going to put populate
[0:06:47] Voice 2: that with the ideas without evaluating them okay that way what we're doing by doing that is we're
[0:06:55] Voice 2: creating a safe atmosphere for everybody because people might think that their idea is not a good
[0:07:00] Voice 2: good idea or somebody's not going to think it's a good idea and they might be holding back for that
[0:07:04] Voice 2: so let's have fun let's be easy on each other like what i say is let's be hard on issues
[0:07:10] Voice 2: and soft on people right we treat each other with respect we can vehemently disagree about
[0:07:17] Voice 2: the issues but we're respecting each other and so uh yeah so so we'll uh not try try not to get
[0:07:32] Voice 2: too deeply into what exactly, you know, how exactly is going to be done, like I want this
[0:07:39] Voice 2: thing, and so what I want to start with is all this detail, you know, I want, you know, like
[0:07:47] Voice 2: what, yeah, I haven't got an example in mind right now, but so the thing is to get all the ideas on
[0:07:55] Voice 2: the table that are what you want to see changed or what you see as an issue and then you we want to
[0:08:04] Voice 2: hear like the basic idea not the how to do it we're going to talk more about how to do it later
[0:08:12] Voice 2: so i find the format of us looking at the uh what is it called the the whole list of projects you
[0:08:19] Voice 2: know the main minor and major and and all that a little bit constrictive for this exercise that
[0:08:24] Voice 2: we're doing right now. So I want to kind of release us from that a little bit. We know it's
[0:08:28] Voice 2: there. We know that's where we're going to end up, you know, to select projects that we're going to
[0:08:33] Voice 2: do. We need to do a lot of work between now and then to define exactly what that is. But what is
[0:08:39] Voice 2: it we want to accomplish? That's what we're here for today. That's what we want to hear from you
[0:08:44] Voice 2: today. What do you want to accomplish? And usually when there's an action that needs to happen that
[0:08:55] Voice 2: people want to have happen or enough people want to make it happen that we do make it happen
[0:09:00] Voice 2: that means there's the currently that's not happening i define that as the problem right
[0:09:07] Voice 2: there's the problem what is the problem that we're trying to overcome what is the thing that we're
[0:09:13] Voice 2: trying to change but the thing that we're trying to change is because we have a problem with
[0:09:19] Voice 2: something the status quo so as a facilitator today i will ask you to help you how you know
[0:09:28] Voice 2: when you come up with an idea i might ask how will that you know how will that fixing that problem
[0:09:33] Voice 2: improve either your life or the community or the environment or the rural character etc
[0:09:40] Voice 2: so that we can find out how does this solution change something because we want to be very clear
[0:09:48] Voice 2: about what we're doing because what I have a pet peeve about is making changes charging ahead
[0:09:54] Voice 2: getting really excited on projects without first having defined very clearly why and
[0:10:01] Voice 12: what we have
[0:10:01] Voice 12: a question based on what you just said and I see other people have questions too so I would I would
[0:10:09] Voice 12: like to say I I for my answer in the beginning this this meeting here should just be about
[0:10:15] Voice 12: everybody have ideas so but now we're saying and you didn't want to have critiquing but now you
[0:10:21] Voice 12: want to ask questions so I think I think
[0:10:25] Voice 2: to to to only facilitate getting the idea but not a
[0:10:30] Voice 12: conversation because that could elicit a conversation I
[0:10:34] Voice 2: don't think conversations are a
[0:10:35] Voice 2: problem okay
[0:10:36] Voice 12: um so I see the lady behind I can't quite see you you had a you were

[0:10:41] Voice 12: I was just, so for the minor projects, what is the end date that the ideas could be in?
[0:10:47] Voice 12: Because just hearing this for the first time, you know, kind of want to go back and think about it.

[0:10:52] Voice 12: And the same thing with a major project.
[0:10:55] Voice 12: So what are the, what is the last deadline for input?
[0:11:00] Voice 12: And then how is this going to be canvassed for the rest of the people who aren't here at the meeting?
[0:11:03] Voice 12: Like reaching out to the rest of the.
[0:11:05] Voice 12: So like I
[0:11:06] Voice 12: said, meeting here will be to put ideas on the board.
[0:11:09] Voice 12: We'll then put a poll together and a survey that'll go out to everybody and I'm hoping that by the May meeting we'll have some results in. If we don't, we'll extend it.
[0:11:21] Voice 12: Can I just ask a question about how you would conduct this survey? Because I remember when there was a survey about STBRs, I think that people who were not living on this island and, you know, from North Pender actually were able to answer that survey. Am I correct about that?

[0:11:40] Voice 13: was a mail-out survey, Heather, that went to every property owner.
[0:11:44] Voice 13: But if you were a property owner, if you lived in Victoria, you'd still be a participant in the survey.
[0:11:49] Voice 13: So that's how it was done.
[0:11:50] Voice 12: So there were no other comments allowed from anybody else?
[0:11:53] Voice 13: Not that I'm aware of.
[0:11:54] Voice 13: If staff could correct me on that.
[0:11:56] Voice 13: But it was a mail-in survey just to people who are registered property owners.
[0:12:00] Voice 12: I would like to know what staff says about that.
[0:12:02] Voice 12: Because I remember somehow somebody saying that comments were coming from elsewhere.
[0:12:08] Voice 12: were but you may be right now i mean i think there might
[0:12:11] Voice 13: have there i think it might have initially
[0:12:12] Voice 13: been one of these monkey doodles or some of these ones that were i think that the trust uses from
[0:12:17] Voice 13: time to time on things but that was not the one that was the one that became the with the
[0:12:22] Voice 13: conclusions that were drawn from in the staff report were based on the mail-out survey okay
[0:12:26] Voice 13: and my only my only suggestion to that was
[0:12:29] Voice 12: um to make sure there's no confirmation bias in that
[0:12:32] Voice 12: that survey make sure that there are there is um plenty of there are plenty of options yeah and not
[0:12:39] Voice 6: just
[0:12:40] Voice 12: the ones that absolutely yeah for sure so we'll we'll work on we'll work with staff on on
[0:12:46] Voice 12: developing this to make sure that that happens so i'm going to ask in the interest of time dag that

[0:13:39] Voice 2: we're taking in more and more information and we're giving out more and more
[0:13:42] Voice 2: information, adding more, more and more ideas.
[0:13:45] Voice 2: And it's kind of wide open, right?
[0:13:47] Voice 2: We're just opening up and the idea is to, is to get as much as possible.
[0:13:51] Voice 2: So the peak of creativity is when we got everything in the world,
[0:13:54] Voice 2: that's what we're doing. And after that,
[0:13:57] Voice 2: then we start to narrow everything down and focus.
[0:13:59] Voice 2: And so the brainstorming part of this is the spreading out and getting
[0:14:04] Voice 2: everything. After that, we're going to start narrowing it down.
[0:14:07] Voice 2: and i think that the survey fits into that and further i personally i think we should have
[0:14:14] Voice 2: another meeting like this after we've had all the ideas and we looked at it all and we can look at
[0:14:20] Voice 2: it and try to organize it and say this fits with that and all that kind of stuff and then then we
[0:14:25] Voice 2: should have another meeting where we then do this where we narrow everything down and say here's how
[0:14:31] Voice 2: we prioritize here's what's more important to me here's what some of this might look like i would
[0:14:36] Voice 2: would like to see it this way or that way you know this is a way to achieve this this solution
[0:14:41] Voice 2: or that's in a way so having that just I think that takes a discussion in person personally
[0:14:47] Voice 2: and I think the survey is adding to that and helping that process but it's not the process
[0:14:53] Voice 2: in my view that's another
[0:14:55] Voice 2: tool I'd
[0:14:56] Voice 12: just like to clarify the initial survey going out would be to
[0:14:58] Voice 12: gather more information from the residents that aren't present in this room

[0:15:54] Voice 15: second one i'm i'm uh in reaction to uh one of my neighbors whose property was vandalized recently

[0:16:10] Voice 15: like that that might be considered and then the third one may already be an initiative that's
[0:16:16] Voice 15: underway you mentioned about housing but uh wondering about workforce housing in collaboration
[0:16:21] Voice 15: with north pender there's some different ideas of trying to create forms of alternative housing for
[0:16:28] Voice 15: people that don't own or can't find somewhere that's my three ideas for that brilliant thank
[0:16:34] Voice 12: you okay um who would yes yes i'm caroline from the hag down point road and uh i would really
[0:16:42] Voice 12: like to see some regulations on blasting there seem to be absolutely none on blasting on blasting
[0:16:49] Voice 12: right and the second one that i have is uh i i see that there's a minor um thing on on the evils
[0:16:57] Voice 12: the raptors nest but i'd like to see some very specific um regulations about what can and cannot
[0:17:03] Voice 12: be done around the raptor's nest

[0:17:32] Voice 11: been identifying right ahead as suggestions come in the fact that hey you don't have any
[0:17:37] Voice 11: jurisdiction over it because i would throw on there i'll get rid of the freighters that are
[0:17:41] Voice 11: angry and local partners but you have no jurisdiction so it's a great idea but it's
[0:17:46] Voice 11: It's really good to narrow that, like when someone makes a suggestion and say,
[0:17:52] Voice 11: Iowa's trust has no jurisdiction, or it does have jurisdiction, we can actually do something
[0:17:56] Voice 11: in the project about it.
[0:17:57] Voice 12: I hear what you're saying, but in this forum, we're going to open
[0:18:01] Voice 12: it up to any idea, because we don't know what could be done, and there are, like, we're working
[0:18:07] Voice 12: also with Adam Olson, and we're working with various levels of government as well, in different
[0:18:12] Voice 12: So there may be something that comes on this that is applicable.
[0:18:16] Voice 12: So we're not going to restrict people right now. When we start filtering through this, we will filter it through the lens of what we are within our jurisdiction of handling for a minor project.

[0:18:35] Voice 12: i i think that asking to have islands trust identify what exactly their jurisdiction is

[0:19:07] Voice 11: number one prime objective and that's what you've got jurisdiction over yeah so that's you know if
[0:19:13] Voice 11: you keep it in that kind of a context rather than i'm not saying get rid of it but i'm just saying
[0:19:17] Voice 11: that you know don't get people's hopes up on a certain particular issue when you've got absolutely
[0:19:22] Voice 11: no jurisdiction to anybody right correct
[0:19:24] Voice 12: but we can walk our way through this list after the
[0:19:27] Voice 12: brainstorming and identify what is within our jurisdiction what is outside our jurisdiction

[0:19:40] Voice 2: to get uh work on which i think will take a long time is to get a kind of a flow chart graphic kind
[0:19:47] Voice 2: of picture of where the authorities lie for all the different things and that the whole trust
[0:19:54] Voice 2: will benefit from having that and all of us that live on tender would have a benefit of that so
[0:19:59] Voice 2: then we can see yeah that thing we can touch only through advocacy that thing we can do directly
[0:20:07] Voice 2: that thing we can't do at all and once once we see that and everybody can see it and if if there's
[0:20:13] Voice 2: disagreement about it then that will come forward and we can have discussion about clarifying that
[0:20:17] Voice 2: then i think that will smooth our work going forward a lot and we won't be confusing ourselves
[0:20:23] Voice 2: For now, for this brainstorm, I suggest that it's OK to just put everything on just like the airstrip for now.
[0:20:31] Voice 11: And I just follow up to that is the fact one thing that's in your jurisdiction,
[0:20:35] Voice 11: I'll put a suggestion up there for is improved communication and education of the self-employed population.

[0:23:08] Voice 12: I don't know about South Pender, but I know some on North Pender.
[0:23:12] Voice 12: And I'd like to see something that very small buildings,
[0:23:17] Voice 12: things that um just very small bedroom type um structures would be allowed for for guests or
[0:23:26] Voice 12: um trailers would be like small travel trailers or travel trailers would be allowed on people's
[0:23:33] Voice 12: property to be used as uh for for guests that might come um and I think that maybe that was
[0:23:41] Voice 12: addressed by adam olson i don't know um but i i think now that would be those if a like a bunky
[0:23:49] Voice 12: type um situation would be a guest cottage and i know that um under one acre people aren't allowed
[0:23:58] Voice 12: to have those types of things i suppose we would be able to build a 200 or 100 square foot building
[0:24:03] Voice 12: because we have two acres but it's not something that's going to be used year round so i just you
[0:24:09] Voice 12: know i'd like to have something like that be be possible or yeah i know okay i'm gonna i'd just

[0:26:08] Voice 13: precluded them and it seemed like there was a concern that somehow there might be something

[1:13:59] Voice 14: entertained our development variance permit uh thank you for taking the time to discuss this
[1:14:04] Voice 14: application today when last we met back in may of 2022 i was here to request support for our
[1:14:10] Voice 14: subdivision applications for the property specifically relating to non-farm use exclusion
[1:14:14] Voice 14: this application is an extension of the various conditions required in order to subdivide the
[1:14:18] Voice 14: property for the two families that currently own it allow me to provide a quick overview
[1:14:22] Voice 14: of the purpose behind today's discussion to better frame the overall context of that request
[1:14:27] Voice 14: our clients own the almost 20 acre property not too far away from where we meet it today
[1:14:32] Voice 14: They are lifelong friends and, a little over a decade ago, were introduced to the property
[1:14:36] Voice 14: and fell in love with it.
[1:14:37] Voice 14: Although oddly configured, with a little under half the property in the agricultural landscape,
[1:14:42] Voice 14: the land use by-law still allowed for two homes and two cottages to be built on the
[1:14:47] Voice 14: residential portion when it suited their needs for their young families wanting to get out
[1:14:50] Voice 14: of the city.
[1:14:51] Voice 14: Over a period of five years, they designed, applied for permits, built these buildings
[1:14:55] Voice 14: and have used them regularly since.
[1:14:57] Voice 14: Neither home was designed with the intent of maxing out the areas available through
[1:15:01] Voice 14: the land use bylaw but instead as an architectural expression of waterfront living during their
[1:15:06] Voice 14: ownership of the property they've been very good about the upkeep of the land and maintenance of
[1:15:09] Voice 14: the buildings while having a limited impact on those around them over time it became apparent
[1:15:14] Voice 14: that clarifying the ownership structure of this property was important changes to family dynamics
[1:15:18] Voice 14: and the pressures of estate planning as they age necessitate a better delineation between the two
[1:15:23] Voice 14: ownership groups that realization is what brought them back to us with the request of exploring a
[1:15:28] Voice 14: more formal and permanent method of clarifying the title of each home as such we move forward
[1:15:32] Voice 14: with a very complicated process of submitting a subdivision application and seeking approvals
[1:15:36] Voice 14: from the various agencies that have had oversight of the matter it's important to note that the
[1:15:42] Voice 14: purpose of this subdivision is simply to formalize what's already been built on the property for the
[1:15:46] Voice 14: two owners there's no redevelopment or construction activity contemplated beyond any exploration
[1:15:51] Voice 14: required to meet all the conditions set forth by the various agencies in response or application
[1:15:56] Voice 14: This development variance application is for the existing infrastructure which fall within setback boundaries of the subdivided lots, along with the relaxation and the minimum frontage required for the newly created lots.
[1:16:09] Voice 14: Allow me to start on the setback aspect of this application. I've received a few questions with respect to the setback relaxation as this type of request can elicit understandable concern among makers.
[1:16:20] Voice 14: When the property was originally built out, there were multiple buildings and required supporting infrastructure.
[1:16:25] Voice 14: Unfortunately, the potential for unknown interior setbacks wasn't taken into account when we
[1:16:30] Voice 14: were doing this original layout.
[1:16:32] Voice 14: There's no construction contemplated for the subdivision.
[1:16:35] Voice 14: This is simply a paperwork exercise for the purposes of keeping the existing cisterns
[1:16:48] Voice 14: and propane tanks in the location where they already are.
[1:16:51] Voice 14: We're requesting that these are allowed to remain in the current locations rather than
[1:16:54] Voice 14: being relocated to clear potential new setbacks that would be generated should a subdivision
[1:16:58] Voice 14: ultimately be approved it's also worth noting that these variances have to do with internal
[1:17:04] Voice 14: setbacks and have no bearing on neighboring lots the area in question is roughly 200 feet from the
[1:17:09] Voice 14: nearest property line on the subject of the variance of the minimum frontage requirement
[1:17:14] Voice 14: for the newly created lots the portion of the property that is in the agricultural land reserve
[1:17:19] Voice 14: fronts all but 26 feet of the road our application preserves this portion of the property without any
[1:17:25] Voice 14: modifications as common to the two southern rural residential portions this can be seen on the
[1:17:30] Voice 14: submitted proposed subdivision plan if you have your agendas you can see how we've proposed to
[1:17:35] Voice 14: divide this no request for modification to the boundary of the portion of the property is being
[1:17:40] Voice 14: suggested therefore requiring a variance to the frontage bylaw requirements i've also had some
[1:17:45] Voice 14: comments with respect to the precedent-setting nature that this application might have
[1:17:50] Voice 14: to this point i would suggest that there are a lot of checks and balances and layers of approval in
[1:17:55] Voice 14: place that would allow another application to be viewed and discussed on its own individual merits.
[1:18:00] Voice 14: I hope that our application can also be viewed under those terms. Should we get support for the
[1:18:07] Voice 14: DBP application, we would then work through the remaining conditions as part of the subdivision
[1:18:11] Voice 14: process. We still have conditions to work through with MOTI, the ALC, BHA, effectively every possible
[1:18:18] Voice 14: acronym you can imagine. We have been working through this process since our first subdivision
[1:18:24] Voice 14: to Moti years ago and I'm hopeful that you can view our application on its merits and give it

[2:28:34] Voice 15: reinforce that it's not a transparent process that it's only determined by a small group of
[2:28:40] Voice 15: people and show up at the meetings yeah plus the other consideration was the fact that if you do
[2:28:45] Voice 15: operate your meetings under robert's rules of order they don't allow them that's correct so
[2:28:53] Voice 2: yeah i have a bit of a different perspective on it i find it can be useful tools and they
[2:28:58] Voice 2: in my experience they haven't shut down or sort of eliminated other opinions or anything like that

[2:31:25] Voice 2: some of the difficulties the historic difficulties of the trust are directly related to the structure
[2:31:31] Voice 2: being too strict too too narrow and preventing people from actually having human conversations

[2:31:47] Voice 15: There are many people that don't come to these meetings that feel strongly about things, and they
[2:31:52] Voice 15: don't come because the same people tend to come to these meetings, and those are the same people that are open to expressing their opinions publicly and feel strongly about certain issues.

[2:32:04] Voice 15: other people that own and have a stake that feel excluded.

[2:32:30] Voice 15: went to the extent of doing the research to see that in fact under robert's rules

[2:32:40] Voice 15: of stuff if you want to do it but it just seemed to be in contradiction of the your

[2:33:18] Voice 15: an example but there was a very heated meeting about one two two and one two three and Diane
[2:33:22] Voice 15: Anne from Whale, which came and spoke, had great anxiety.
[2:33:28] Voice 15: She said she's very uncomfortable about speaking in this environment.
[2:33:31] Voice 15: The room was very clear in terms of where the opinions were being expressed.
[2:33:35] Voice 15: Yet she finally was able to express a contrary opinion that she felt very strongly about.
[2:33:42] Voice 15: But a lot of people don't, they can't.
[2:33:45] Voice 15: They can't put themselves in this environment or they've already disengaged because they don't think their voice is heard.
[2:33:52] Voice 15: so if i you know i don't i want to don't want to beat this i'm just saying that it's if you're
[2:33:59] Voice 15: limiting if you want to take some indication from the people in the room and you very much
[2:34:04] Voice 15: contextualize it to the people in the room it shouldn't apply to more than the people in the

[2:34:58] Voice 15: everybody that owned property here lived here but that's not not the case and so you commented i
[2:35:02] Voice 15: think about about uh approaching people on the basis of property ownership and emailing or
[2:35:10] Voice 15: mailing out to them so that you know that's fair and transparent and that gets everybody that has
[2:35:16] Voice 15: a property here informed because we often hear people saying oh i didn't know about that or i
[2:35:23] Voice 15: you know why didn't anybody tell me you know all these things when you're doing what you
[2:35:30] Voice 15: what you do that is within the legal construct of the ltc but unless you're really engaged in it
[2:35:38] Voice 15: and you're following all the notices.
[2:35:40] Voice 15: You may not even know that a meeting has come up
[2:35:43] Voice 15: or there's a chance that there's an opinion.
[2:35:45] Voice 15: So that's one sure way to get everybody that has a vested interest

South Pender Local Trust Committee Special Meeting March 25, 2023 ADOPTED Page 1 of 6 pages South Pender Island Local Trust Committee Minutes of Special Meeting Date: Location: March 25, 2023 South Pender Fire Hall 8961 Gowlland Point Road, South Pender Island BC Members Present: Tobi Elliott, Chair Kristina Evans, Trustee Dag Falck, Trustee Staff Present: Kim Stockdill, Island Planner Pat Todd, Recorder Public: There were approximately nineteen (19) members of the public present. 1. CALL TO ORDER Due to the delayed ferry schedule, Chair Elliot and Planner Stockdill did not arrive until 11:00 a.m. However, as a quorum was present, the meeting commenced with Trustee Evans as Chair. Chair Evans called the meeting to order at 10:11 a.m. She acknowledged that the meeting was being held in traditional territory of the Coast Salish First Nations. It was suggested that while agenda is likely to be adopted as presented, the meeting will begin with the Town Hall. 2. APPROVAL OF AGENDA By general consent, the agenda was approved as presented. 3. MINUTES 3.1 Local Trust Committee Minutes Dated February 3, 2023 The following amendments to the minutes were presented for consideration: Pg. 2,5 th Paragraph: Gord Duncan – first sentence to read: “...Trustees and added that as Bylaw 123 has not been adopted it should not be used in planning reports.” Pg. 3, 4 th Paragraph: Heather – correct last name to Haryu A D O P T E D South Pender Local Trust Committee Special Meeting March 25, 2023 ADOPTED Page 2 of 6 pages Pg. 3, 4 th Paragraph: Heather Haryu – last sentence to read: “...and that people living outside of the general area affected by the application should not be discussing the house size.” Pg. 3, 7 th . Paragraph: Evans – correct LTC email address to read: southpenderislandlocaltrustcommittee@islandstrust.bc.ca By general consent, the minutes were adopted as amended. 4. BUSINESS ITEMS 4.1 SP-DVP-2023.2 (Johnson) The owners’ representative reviewed the variance application. It was noted that when the property was purchased there was an allowance for two residences. The owners requested to subdivide the property into two lots. Variances requested would allow infrastructures to remain in place, i.e., propane tanks and septic systems. Discussion It was stated that variances are site specific. Planner Stockdill clarified that where a driveway abuts a road frontage, it would reduce from 20m to 6m. The property will remain as two lots through the Covenant. A Park Dedication is required only if subdivision creates three or more lots. There was a question as to whether the LTC was satisfied that Covenants would protect properties from further subdivision or development. It was assured there would be no more houses or subdivisions. Subdivision approval would be based on the conditions of Covenants being met. The application for variances is only one step in the subdivision process. SP-2023-007 It was Moved and Seconded, that the South Pender Island Local Trust Committee request staff to amend the Development Permit application DVP-2023.2(b) by decreasing the frontage of proposed Lot 1 and Lot 2 from 20.12 metres to 6 metres. CARRIED SP-2023-008 It was Moved and Seconded, that the South Pender Island Local Trust Committee approve issuance of Development Variance Permit application SP-2023.2(b) as amended. CARRIED South Pender Local Trust Committee Special Meeting March 25, 2023 ADOPTED Page 3 of 6 pages SP-2023-009 It was Moved and Seconded, that the South Pender Island Local Trust Committee exempt proposed Lot 1, resulting from the subdivision of 8790 Gowlland Road, from the 10 percent frontage provision of Section 512 of the Local Government Act. CARRIED Chair Evans recused herself from the meeting at 11:58 a.m. to preclude any conflict of interest regarding the next application. 4.2 SP-DVP-2023.3 (Evans) Planner Stockdill reviewed the application to vary the maximum floor area for a proposed dwelling. The building plans submitted in 2021 were in compliance; however, the bylaws have since been changed. The applicant mentioned that the additional floor area is a crawl space/storage area and is below-grade. Adding a space would increase the floor area to 2800 sq. ft. Discussion Many spoke in support of the application. There were questions regarding the floor space if it is below-ground. It was suggested to work with the neighbours on this issue rather than through bylaws. The applicant expressed the opinion that there is no conflict of interest with Chair Evans, as she has no financial interest in the property. SP-2023-010 It was Moved and Seconded, that the South Pender Island Local Trust Committee approve the issuance of Development Variance Permit application SP-DVP-2023.3 (Evans). CARRIED Chair Evans rejoined the meeting at 12:07 p.m. 4.3 Town Hall - Work Program Review Chair Evans outlined that the Town Hall was an opportunity to collect ideas/issues from the attendees, and that Trustee Falck would act as facilitator. Trustee Falck addressed the process involved, stating that all ideas are welcome and will be critiqued later, as well as to focus on what the community would like to accomplish. He further stated that ideas will be collected and a poll/survey will be sent to the property owners for further input. South Pender Local Trust Committee Special Meeting March 25, 2023 ADOPTED Page 4 of 6 pages The Islands Trust Policy Statement will be coming back to the community later this year. The key points are on reconciliation, climate change and housing. It was mentioned that the Local Trust Committee is looking to identify one minor project for the upcoming year, adding that a major project would require a funding request and Trust Council (TC) approval, and may be planned for next year. Public Comments Need for deer population control Rural Block Watch program Work Force for Housing – working with North Pender Blasting regulations Specific regulations of what can and cannot be done around eagle nests Identifying IT jurisdictions regarding ideas Improving communication and education Working with various government agencies that may fit with LTC policies Creating a flow chart of ideas and identifying jurisdiction Three emails received to revisit Bylaws 122 Reconciliation activities Bunkies (small buildings for guests and working people) currently not allowed on sites less than 1 acre Affordable housing, such as secondary suites and apartments over garages, and initiatives to expand housing options Options to create housing, such as secondary suites that have a low-impact solution Water issues, such as fire fighting emergencies, having only one evacuation route, and the Emergency Preparedness Plan Some basic things that could be done with the Fire Smart program, such as an educational process for community that the North Pender Fire Department is working on Issues on the Groundwater Study, including a number of things to assist with in understanding the issue, awareness of limitations, and management The Fire Department’s investigation into water supplies during a fire, identifying forest fires as low–hazard, wind and snow as critical factors, and difficulty in reaching residents during an emergency when trees are down and power is out Necessity in knowing how to care for one’s property and balancing forest safety Hosting a Fire Smart meeting for the community Emergency Preparedness Plan being worked on Consequences when the bridge breaks down Fire Suppression and education on forest management for a healthy green forest Protection of big trees Speaking with BC Hydro regarding clearing power lines and areas to decrease outages, including trees that have been tagged for removal since 2021 South Pender Local Trust Committee Special Meeting March 25, 2023 ADOPTED Page 5 of 6 pages Issues regarding upcoming meetings, such as the use of emails to send out information, notices posted according to legislative policies, and a preference of two weeks’ notice before the next meeting Review of Official Community Plan’s revisions Lack of a dedicated location to airlift a person off the island in cases of emergencies Climate change and fossil fuel usage Issues around solar usage, including education and grants Community program for solar usage and rain collection A Welcome Package for new property buyers that includes detailed information regarding water, forests, etc., as necessary to know before building on the property The meeting recessed 11:03 a.m. to 11:15 a.m. (Chair Elliott and Planner Stockdill arrived.) Second portion of Town Hall discussion (12:08 p.m.) Making amendments clear and understandable The requirement for water storage in Bylaw 122 was not brought forward to the community The need for transparency Revisiting Short Term Vacation Rentals (STVRs), possibly for a time period every year More discussion regarding footprint of house vs. square footage Moving forward to identify LTC items, which are a purview of other agencies Surveys Chair Evans noted that the LTC is still looking for members for the Advisory Planning Commission (APC). There was a question raised as to the residency requirement. Planner Stockdill will look into this matter. SP-2023-011 It was Moved and Seconded, that the South Pender Local Trust Committee approve travel expenses to MLA Adam Olsen’s office for the Southern Gulf Islands Forum meeting. CARRIED SP-2023-012 It was Moved and Seconded, that the South Pender Island Local Trust Committee draft a letter requesting the Provincial Government to recapitalize the Island Coastal Economic Health funding and make it a permanent fund that can be accessed by all communities within the Trust Area through Adam Olsen’s office. Other Business SP-2023-013 It was Moved and Seconded, that South Pender Island Local Trust Committee request staff to report back with results of today’s Town Hall meeting with priorities and options. CARRIED Chair Evans reported that the Fee Bylaw would raise applications cost by 2% effective April 1, 2023. Points of discussion regarding straw polls: Not allowed under Robert’s Rules Trying to get information out ahead of time for consideration to aid discussion Need to hear people’s point of view Expanding engagement with community – straw poll can be limiting Can be a useful tool, but not happening within the structured experience of LTC LTC Policies to be followed Robert’s Rules too strict and narrow People feel strongly about this but do not come to the meetings and therefore feel excluded Straw polls include only those in the room Identifying methods to connect with people ”outside” the room Complexities within each community Meeting procedure could be a project 5.
