[0:01:16] main island and chair of the federal trust committee

[0:01:22] Voice 6: to change that i'm joined today by north pender island trustees aaron campbell and deb morrison

[0:01:28] Voice 6: and uh together we make a plan around the local trust committee uh this meeting is being live

[0:01:41] Voice 6: manager of island's trust summit office um we have brad smith who is our island planner

[0:01:46] Voice 6: um we'll be joined a little bit later on by warren dingman who's about a manager of violent

[0:01:50] Voice 6: enforcement um this meeting is the official forum for your local trust committee to make decisions

[0:01:56] about land use planning matters and discuss relevant business i want to add this place

[0:02:47] Voice 6: so it is there but it but

[0:02:49] Voice 6: it's you just think it's a little bit yeah it's fine yeah okay cool all right all right so by

[0:03:08] Voice 3: meeting in april and going six weeks in between

[0:03:17] Voice 3: almost kind of got out of out of the rhythm of some things but to spend a lot of time

[0:03:24] Voice 3: meeting with people pretty much every weekend seems to be an opportunity to get together with

[0:03:30] Voice 3: somebody and chat about different things that are going on in the island and a lot of stuff about

[0:03:35] Voice 3: housing people are really concerned about what what we can do or what they'd like to see happen

[0:03:42] Voice 3: all those still tree tree cutting point with folks um

[0:04:02] Voice 2: so first i apologize if folks have not

[0:04:05] Voice 2: i haven't been as responsive on email um i've been really ill for the last month i'm just

[0:04:11] Voice 2: recovering from pneumonia um so i apologize for that um and uh but somehow still in all of that

[0:04:20] Voice 2: i went to the uc housing summit um in vancouver i was one of the uh stressed um delegates to that

[0:04:26] Voice 2: that was super interesting.

[0:04:27] Voice 2: That was very urban focused solutions to housing.

[0:04:31] Voice 2: There was a small contingent of folks

[0:04:33] Voice 2: that were working on more rural solutions for housing.

[0:04:36] Voice 2: So some really great ideas in that space.

[0:04:41] Voice 2: I think the conversations over the last six weeks,

[0:04:47] Voice 2: so six weeks have been around those different issues.

[0:04:52] Voice 2: Some of the sort of enforcement concerns

[0:04:54] Voice 2: having like follow-up conversations with folks around that um the you know different strategies

[0:05:02] Voice 2: on how we think about forest management on the island um and how we bring into play folks with

[0:05:08] Voice 2: fire smart like so there's a really interesting conversation going on around different forms of

[0:05:14] Voice 2: fire smart and how we understand that because like saturnia fire smart has been really different than

[0:05:20] Voice 2: and how do we handle it here on this island so really thinking um and how do we pull a conversation

[0:05:25] Voice 2: together of all those different actors on that space so it'll be interesting part of our

[0:05:29] Voice 2: conversation today hopefully um so thanks to all the various letters and emails and feedback from

[0:05:35] Voice 2: all those different fronts it's been really helpful to think about that with folks so thank

[0:05:39] Voice 2: you all

[0:05:40] Voice 6: right from chair's perspective we've we've again been quite busy and lots of running around

[0:05:48] Voice 6: lots of dealing with issues where it's great everybody is working together so well um we we

[0:05:55] Voice 6: just had a meeting a couple of weeks ago of quite a few of the southern golf house trustees um the

[0:06:02] Voice 6: crd director um senior crd staff and senior isles trust staff and the theme of the meeting was was

[0:06:12] Voice 6: was we're getting oftentimes sort of an urgent

[0:06:18] sort of spin on regulations versus

[0:06:21] Voice 6: our rural communities.

[0:06:22] Voice 6: And what was great was everybody who was at the meeting

[0:06:26] Voice 6: and the other authorities with BHA, CRD,

[0:06:28] Voice 6: and I was dressed acknowledged and said,

[0:06:30] Voice 6: yeah, you know, maybe we've gone a little bit too far.

[0:06:33] Voice 6: And there was a willingness to talk about discretion

[0:06:38] Voice 6: and kind of making it a little bit more world.

[0:06:41] Voice 6: I know that on Pender you've had issues with people selling bread and cookies and soups and all that.

[0:06:48] And

[0:06:48] Voice 6: the senior manager seemed to be, within reason, quite genuinely surprised.

[0:06:56] Voice 6: On Main Island, our one that we hang our hat on was outhouses.

[0:07:04] Voice 6: And it's great because outhouses are good because everybody understands.

[0:07:09] Voice 6: there's a difference between an outhouse in oak bay and an outhouse on main island and

[0:07:14] Voice 6: in oak bay it's not normal i mean how it is and and it was it was great between the crd

[0:07:20] Voice 6: the islands trust and and then v hop all said how houses are not an issue is it yes technically

[0:07:27] Voice 6: speaking if you go down the rabbit hole they're not they're not because they're not specifically

[0:07:32] Voice 6: handled within the legislation they're not permitted but they're saying we do not enforce

[0:07:36] Voice 6: outhouses do not worry about outhouses outhouses are cool so it was it was nice to be able to have

[0:07:42] Voice 6: like half day meeting and everybody came just to a reasonable agreement of common sense

[0:07:50] Voice 6: because oftentimes it's hard to get common sense and it was it was very positive so that that was

[0:07:57] Voice 6: my habit the last couple of months but we've also

[0:08:00] Voice 6: trust council i think we we did the budget since

[0:08:02] Voice 6: to our last meeting that was a good process um we went a year ago when we did it it was a difficult

[0:08:11] process like we literally went down to the last hour and

[0:08:14] Voice 6: a lot of stress and a lot of emotions

[0:08:17] this this one

[0:08:18] Voice 6: was a much more smoother process and i think it set sort of the the foundation for

[0:08:24] Voice 6: next year's budget process which will be the first time this trust council's been involved in the

[0:08:28] Voice 6: whole process that it will be really really nice and smooth and informative and i think a happier

[0:08:36] place um we've been doing a lot of issues on housing recently um

[0:08:42] Voice 6: i'm unfortunate because um

[0:08:45] Voice 6: i remember local trust committee on main island that's done a lot of housing stuff over the past

[0:08:51] Voice 6: years but i'm also the chair on denman island which has had housing on its radar for literally

[0:08:57] Voice 6: early decades and this is the year that they're actually making giant steps and and so they've

[0:09:02] Voice 6: just set up a housing advisory committee um so much energy in that community and so much positive

[0:09:09] Voice 6: and between Maine and Devon they seem to be sort of forging the road forward um to to show how it

[0:09:17] can be done and other level trust committees

[0:09:20] Voice 6: are going to be sort of gathering in behind and so I

[0:09:22] Voice 6: think there's going to be a lot of positive news in the next year or so about housing on the gulf

[0:09:27] Voice 6: islands where you know we haven't really been making a lot of progress so i know i'll end up

[0:09:32] Voice 6: asking it's a happy place thank you we don't have anything from our crd director um although i know

[0:09:43] Voice 6: he's been very busy they uh he of course participated in our meeting but also the

[0:09:49] Voice 6: the latest um crisis on saturn that between the local trustees adam olson and director brett have

[0:09:58] Voice 6: been dealing with this um highways that cut a whole bunch of trees down on the side of east

[0:10:04] Voice 6: point roads um it was a strange situation because what happened is there were a few trees that they

[0:10:12] were

[0:10:12] Voice 6: worried because east side road where it is basically there's road oceans right low bank maybe

[0:10:17] Voice 6: four feet above sea level um and so there's a row of trees and there were some concerns about some

[0:10:22] Voice 6: trees falling over and maybe disrupting the road so they had an arborist come over and he identified

[0:10:27] Voice 6: i think it was 12 trees but it was appropriate to take out so they contacted them who's the

[0:10:34] Voice 6: contractor who contacted capital tree services who came over and they took the 12 trees out

[0:10:39] Voice 6: and another 46 um and everybody started to pull their hair out and i i will say the the saturn

[0:10:50] island trustees led the charge and animals and paul brent were very very very very vocal

[0:10:56] and very very strongly represented the ministry and i will say the ministry came back very

[0:11:02] apologetic and and i don't there was an email chain there i don't know how long it went on

[0:11:08] and

[0:11:09] Voice 6: they went through the whole process.

[0:11:11] Voice 6: They said this was absolutely wrong, all that.

[0:11:14] Voice 6: They've made the contract to go back

[0:11:16] Voice 6: and as part of the problem was they fell all the trees

[0:11:19] Voice 6: into the ocean, which is so, and they just left.

[0:11:23] Voice 6: So they made the contract to come back with a crane

[0:11:26] Voice 6: and a logging truck to remove all the trees.

[0:11:28] Voice 6: The trees have gone to First Nations for firewood

[0:11:31] Voice 6: and it just cost the contractor a lot of money.

[0:11:34] Voice 6: But the difficulty is because the deciding

[0:11:37] Voice 6: is probably they can't have any remediation because these are legacy trees that basically

[0:11:43] Voice 6: have grown up in the in amongst the rocks and all that and you're not going to plant a ceiling and

[0:11:48] Voice 6: have it come back and so we're there's it's tough but that's what's happening other islands and then

[0:11:55] Voice 6: i just i will give sort of kudos a to the trustees being animals but also to to very much sort of to

[0:12:03] Voice 6: paul brent who went out and documented it and then he was the first person ringing the bell

[0:12:08] Voice 6: and really standing up for his community so all righty um so we'll move on down to town hall um

[0:12:16] Voice 6: there's only four people here so but i don't think i have to to read the long

[0:12:21] Voice 6: the laundry list of rules but we just like it to be short and simple and to the point and

[0:12:28] Voice 6: um when you get up if you just put your hand up and identify yourself for the minute taker

[0:12:34] Voice 6: and we'll pop through this. So does anybody have anything to contribute to Donald?

[0:12:39] Voice 3: I just could you repeat the number of trees that were actually cut now?

[0:13:26] Voice 4: In regard to the report,

[0:13:28] Voice 4: commenting on the

[0:13:31] Voice 3: wording of the report, and I don't know at

[0:13:33] Voice 3: what stage you are in consideration of all this, but I

[0:13:37] Voice 3: i think it was taken from the galliano um it's a suggestion that um on lots larger than

[0:13:47] three acres for north bender that you consider increasing the example amount at the moment

[0:13:54] it is five trees per hectare and if a lot

[0:14:01] Voice 3: has a house and a cottage and realistically

[0:14:05] Voice 3: particularly on larger lots people tend to use firewood for leading but in the staff report you

[0:14:13] Voice 3: calculate for a 20 centimeter tree and say a 40 centimeter tree per 50 feet or whatever how many

[0:14:19] cords of wood that is how many units matter by a cubic feet so the public can understand what

[0:14:26] they're allowed

[0:14:27] Voice 3: to cut on their lawn and is it likely to to satisfy the need for firewood which

[0:14:32] Voice 3: i think is a really important consideration thank

[0:14:37] Voice 6: you thank you anybody else all right thank you

[0:14:41] very much um so we don't have a community information meeting we do not have a public

[0:14:47] meeting or public hearing we do have some minutes quite a few minutes that just need to be adopted

[0:16:10] package um with uh concerns over forestry um there's 48 listed here which are on our website

[0:16:19] has been circulated trustees and

[0:16:21] Voice 6: some other stuff has counted subsequently so i don't know if you

[0:16:28] Voice 6: want a discussion just receiving a package i have

[0:16:31] Voice 2: a quick question

[0:16:32] Voice 6: absolutely um

[0:16:34] Voice 2: so um

[0:16:36] Voice 2: my question is around how we're thinking about correspondence more generally it's not

[0:16:45] Voice 2: specifically about the forestry correspondence it's how we're thinking about correspondence

[0:16:49] Voice 2: in our decision-making process and because i've been asked questions about that related to community

[0:16:56] Voice 2: community um and so i'm wondering if we can just have a like five or ten minute conversation about

[0:17:03] Voice 2: like what is the impact of correspondence on our decision making based on just to make that

[0:17:08] Voice 2: transparent because um there is a feeling right now in some parts of our communities that

[0:17:18] Voice 2: correspondence sways us fully one way or another and of course it's a component of our decision

[0:17:24] Voice 2: making but um like how do we take it into account with staff information with our understandings of

[0:17:34] Voice 2: our community with like the mandate of the trust i guess is the question so i would love to hear

[0:17:38] Voice 2: folks and thoughts about that um because i don't have a good because we're a new council i don't

[0:17:44] Voice 2: have a good understanding of how you think about course so

[0:17:49] Voice 6: like from my personal perspective

[0:17:52] is that it all feeds the conclusion of the discussion.

[0:17:58] It's that everything that comes across my desk,

[0:18:02] whether it be a staff report,

[0:18:04] whether it be a town hall meeting,

[0:18:06] whether it be email correspondence,

[0:18:09] it all feeds

[0:18:11] Voice 6: basically my decision-making process.

[0:18:16] Voice 6: The only thing that bothers me are the form letters.

[0:18:20] Voice 6: and we haven't seen that on

[0:18:23] Voice 6: Pender Island but on other islands

[0:18:24] Voice 6: we've seen that where people

[0:18:27] Voice 6: basically copy and paste an email

[0:18:28] Voice 6: and we'll get 80 of them

[0:18:30] Voice 6: and it's just like this is really burning through my time

[0:18:35] Voice 6: and so

[0:18:36] Voice 6: sometimes

[0:18:38] Voice 6: honestly if I'm speaking

[0:18:40] Voice 6: outright wrong I'm more

[0:18:42] Voice 6: likely to be a little bit not happy

[0:18:44] Voice 6: about that and it might

[0:18:45] Voice 6: actually sway me to be going in the other direction

[0:18:49] Voice 6: because

[0:18:49] Voice 6: if people

[0:18:51] Voice 6: i'm not going to say wasting my time because in the public process you never waste anybody's time

[0:18:56] Voice 6: but when you're just copying and pasting you're not meaningfully contributing to the conversation

[0:19:03] Voice 6: um so i just but i i would say that everything has impact and very much encourage people to

[0:19:12] participate in any way they can and whether it be a town hall whether it be in sending emails

[0:19:20] Voice 6: mails or even bending your ear to the coffee shop because if we don't know the whole perspective

[0:19:27] because everybody brings something unique to the table then you know we're not making the

[0:19:31] right decision um and so it's it's and you know any effort um to to sort of dampen people's voices

[0:19:40] and that's one of the things that as a chair i've done at almost every one of the ltcs i've let

[0:19:47] let people speak too much and I have had people yell at me saying you shouldn't be letting people

[0:19:53] speak so much but to

[0:19:56] Voice 6: me I really like to tell somebody sorry your two minutes is up it's time

[0:20:00] Voice 6: to sit down because you know you have something to say you're part of the process and you know

[0:20:06] Voice 6: I'm allowed to babble on for an hour so you know for me to give you another five minutes to

[0:20:12] Voice 6: contribute to what I'm trying to make a decision making process I'll have a problem with it and

[0:20:16] Voice 6: and some people do and i and i have been spoken to sometimes in very severe ways by people saying

[0:20:23] Voice 6: you're not supposed to be doing that but i i think it's all part of the process um and as

[0:20:28] Voice 6: long as people are polite and respectful and contributing to the process bring it on so

[0:20:33] Voice 6: that's where i'm at i i appreciate

[0:20:41] Voice 3: the emails because that's doesn't or that stops people from

[0:20:45] Voice 3: attacking me in the grocery store but at the same time it's very much a similar similar approach in

[0:20:54] Voice 3: that i spent a lot a lot of time just listening to what folks have to say and i and i would have

[0:21:03] Voice 3: to admit though that when somebody knew or i see a new name on an email or something like that it

[0:21:10] Voice 3: does it's kind of like i'd like to hear what this this person has to say because i quite often you

[0:21:18] Voice 3: do see that it's not like it's the same people that are that are emailing about a certain issue

[0:21:24] over and over and over again where you can see that you've gotten you know three or four emails

[0:21:29] from the same person pertaining to the same subject

[0:21:32] Voice 3: and valid you don't discount how those

[0:21:36] Voice 3: those people feel but then when you see a new a new name that pops up in your email chain it's

[0:21:42] Voice 3: like okay like cool let's let's see how this person feels about it they call it the grocery

[0:21:47] Voice 3: store and getting that whole you know you may not know who i am but i voted for you discussion and

[0:21:53] Voice 3: you look at a person like who they are but then to hear what they have to say and and what their

[0:22:01] Voice 3: perspective is on it i do enjoy the engagement aspect of listening to their body and i do think

[0:22:10] Voice 3: that if there is some value to people taking the time to lend a voice something so yeah

[0:22:22] Voice 2: so i think

[0:22:24] Voice 2: i really value written communication because especially when it's an email form sent to south

[0:22:30] Voice 2: ireland because we all say and i think it's really important from a transparency point of view that

[0:22:36] Voice 2: we all see community thinking so whenever i talk with people i often just send an email

[0:22:43] Voice 2: to all of

[0:22:43] Voice 2: us so some of the things that we've you know just been checking out while we're like starting here

[0:22:49] Voice 2: i don't hear that don't write and so from my perspective i really encourage each of us when

[0:22:58] Voice 2: we are talking to people to like send things in an email because i need to hear that too i need

[0:23:03] Voice 2: to hear directly and i do hear some of that in the conversations but like we know different

[0:23:07] Voice 2: people will like out themselves to us differently depending

[0:23:10] Voice 7: on how they hold it or

[0:23:11] Voice 2: not right so

[0:23:12] Voice 2: that's totally fair i understand that but we are both we are all three you're elected officials

[0:23:18] Voice 2: and we need to be in the loop

[0:23:20] Voice 3: i think i think people in our

[0:23:25] Voice 3: community at least there's is a

[0:23:27] Voice 3: comfort level in approachability with folks and there are people that want to be able to

[0:23:33] Voice 3: to give you their opinion in the hopes that you they elected you to be their champion yes in a

[0:23:41] Voice 3: sense right and they don't want to put their name to a correspondence and they don't want to see the

[0:23:47] Voice 3: entire island having a look at you know their name or their address or whatever information

[0:23:53] Voice 3: ends up going on their email and that becomes difficult to know how to balance some of that

[0:24:01] Voice 3: stuff where their opinion is no less valid um but but i agree but like in everything it's like you

[0:24:10] Voice 3: want right write it send me an email you know you can even just summarize what what this whole

[0:24:17] Voice 3: discussion has been in a couple of quick notes and send it in so that everybody else sees it

[0:24:21] Voice 3: but people are still reluctant or they feel like they've

[0:24:26] Voice 3: gotten it off their chest and that's like

[0:24:28] Voice 3: okay i'm

[0:24:29] Voice 6: good but one of the things that you've noticed i've done quite a few of the tree cutting

[0:24:34] Voice 6: emails i've been addressed to me individually and it's not clear if it's been sent to anybody else

[0:24:38] Voice 6: and i forwarded the basically the ltc because it's sometimes people bcc or they they send the same

[0:24:49] Voice 6: email like three separate times and so if anything that where there's an issue before us and and i

[0:24:57] Voice 6: don't think that you've you've received the loop i basically just always forward into the to the

[0:25:01] Voice 6: federal lpc because that way everybody can say everybody's on the same table so yeah

[0:25:08] Voice 2: and i and

[0:25:08] Voice 2: i hear you because i know that there are folks that don't like to be more public in their things

[0:25:16] Voice 2: and but you know in those situations like nothing personally i always tell them to go and talk to

[0:25:21] Voice 2: as well um and the approachability thing like i've heard that like the people won't approach

[0:25:28] Voice 2: me sometimes like and not

[0:25:30] Voice 2: that you're saying that i

[0:25:31] Voice 5: just want to

[0:25:31] Voice 2: name it that people have said to me

[0:25:34] Voice 2: like that they won't approach me because i'm all that that's narrative says put out there that's

[0:25:37] Voice 2: not who i am you know like so just i would really encourage people to be reaching out to me directly

[0:25:46] Voice 2: because i really appreciate the conversation i

[0:42:01] Voice 1: And so that included update of definitions, the addition of system requirements for all new bills and updates to subdivision regulations related to potable water.

[0:42:11] Voice 1: water. So those are all in the land use bylaw amendments that I understand is going to public

[0:42:16] Voice 1: hearing shortly next week. So really what we're, we're, we're focusing on here is where do we go

[0:42:39] Voice 1: So in our public meeting, which I felt was a real success, we were able to provide some information on the methodology, contributing to the development of the development permit area possibilities, the possible boundaries for the development permit area.

[0:55:37] Voice 6: thumbs up thumbs down we actually have the in-depth and then the public knows we're going to

[0:55:47] Voice 3: sort of the public engagement of that and then there is public here while we're trying to figure

[0:56:04] Voice 3: a local trust committee to basically piggyback a minor project off of an island that is feels

[0:56:14] Voice 3: feels like we've gone is going to do a housing yeah

[0:56:24] Voice 3: forever but there's only probably minor uniquenesses to what we're dealing with

[0:56:50] Voice 3: prepared with some help prepared toolkit planning committee on housing so it's entirely feasible or

[0:57:00] Voice 3: understandable the local trust committee that looked at looked at the full range of options

[0:57:08] Voice 3: for amendments for housing really just wanted to focus on one thing and there was felt there was

[0:57:16] Voice 3: you know it's pretty broad consensus in the community around that didn't need a lot of

[0:57:20] Voice 3: engagement just do that as your minor project um you could do that as you're something like

[0:57:25] Voice 3: that as your major project you just won't need a lot of money for it well that's another question

[0:57:29] Voice 3: right you say it doesn't project it's a big business case for six thousand dollars to hold

[0:57:35] Voice 3: some community meetings on public so it wouldn't yeah it doesn't necessarily make major and

[0:57:48] Voice 2: i think the other thing just to name around that is like when we had

[0:57:51] Voice 2: instigated the water study well 2019 i feel like we started down that path

[0:57:56] Voice 3: feels like it

[0:57:58] Voice 2: and so when we instigated that we instigated that and like how many other

[0:58:04] Voice 2: islands joined in on it so like one of the reasons it took a long time is because it wasn't

[0:58:13] Voice 2: we instigate a housing effort and it becomes more of a larger regional planning we still have to

[0:58:19] Voice 2: whole lot of pieces that we want and how we want to do it um because it may start to take on a

[0:58:25] Voice 2: life of its own in terms of a reach on the

[0:58:28] Voice 4: chair i'm also hearing from you that a major project is

[0:58:31] Voice 4: done by the regional planning team which is not me so uh if you're looking at doing that

[0:58:39] Voice 4: i would i would imagine at the beginning of a housing project it would be like what i did on

[0:58:47] Voice 4: main island drafting the word for for uh chairman the trustee mod on his island uh the first step

[0:58:56] Voice 4: was a discussion paper that uh you know did the best job it could in evaluating the existing

[0:59:01] Voice 4: housing stock the you know all bunch of data around that and then looks at a bunch of different

[0:59:07] Voice 4: uh options around flex housing or changing of violence etc i think since that paper was written

[0:59:13] Voice 4: there's been a whole bunch of work that if i was doing the work i would also be looking to feed

[0:59:18] Voice 4: into so whatever works being done on other islands i think we would try to capture that work rather

[0:59:23] Voice 4: than reinvent it uh the challenge there is that you only get one minor project and so you're if

[0:59:30] Voice 4: you you're gonna have to choose water or dpa review or affordable housing at least for for

[1:02:08] Voice 2: like larger collective effort and like more about getting those resources and asking for them and

[1:02:13] parallel it with the sustainability education

[1:02:18] Voice 2: informed

[1:02:18] Voice 5: conversations about that

[1:10:28] Voice 3: the way the legislation was set up for liquor and cannabis um local governments have to provide

[1:10:43] Voice 3: you'll get a liquor license application or change.

[1:11:02] Voice 3: that this is an appropriate location and scale of either liquor or cannabis and

[1:11:11] Voice 2: with the cannabis one that happened and we had it also i think happened during covet around the

[1:11:16] Voice 2: changes in liquor licenses to allow for outdoor things that happen

[1:11:23] Voice 2: actually i kind of like it because what it does is it makes it active consent from local government

[1:11:28] Voice 2: right so it's not uh nothing personal but it's not a bureaucratic kind of like paper exercise

[1:11:35] Voice 2: in the background it makes it more transparent to communities something is changing in the use

[1:11:40] Voice 2: or activity in the space and basically the province doesn't have a really good mechanism

[1:11:44] Voice 2: for communicating with local communities so they use local governments to do that communication

[1:12:36] Voice 4: so if one of these passes that threshold they're required to submit an application

[1:12:41] Voice 4: feed to us and then we go through the process we did this on saturn recently with the expansion of

[1:12:47] Voice 4: the pub or the restaurant portion of the winery in saturn where they were we were required to hold

[1:12:55] Voice 4: a public hearing as our way of demonstrating that the local government has engaged and in some cases

[1:13:02] Voice 4: there might be a store proposed near a school or some other uh thing where the local government

[1:13:09] Voice 4: may have legitimate concerns over the site use of that land and their role as land use approvers

[1:13:18] Voice 4: is what triggers their role in determining if that land use is appropriate for that particular

[1:13:24] Voice 4: location i think the difference is like a shoe store doesn't need a provincial license

[1:13:29] Voice 3: to operate for sure the province you know from their office in victoria vancouver or whatever

[1:13:35] Voice 3: ever before they issue a license they want to know what the local community thinks and this

[1:13:39] Voice 3: is their mechanism the

[1:13:43] Voice 4: application form has a bit of a preamble which does a bit of description on

[1:13:47] Voice 4: both purpose and reason and process which will probably help to further your understanding

[1:13:54] Voice 2: one of the reasons i was curious to see this was because of the conversation the last few

[1:14:00] Voice 2: months around docs no docs in our like i just bought our uh policy statement type stuff that's

[1:14:17] Voice 2: islands where local consultation related to provincial or federal obligations around docs

[1:14:26] was not done to the satisfaction of the neighbors

[1:14:32] Voice 2: in and so what i don't see here is i don't see something that says and i know these are

[1:14:40] Voice 2: standing resolutions but like i'm curious like the public consultation i've super fed them through it

[1:14:46] Voice 2: so i understand the cell tower i understand the like cannabis licensing liquor licensing

[1:14:51] Voice 2: see i don't understand if dogs are licensed why we're not having that actively consent to us in

[1:14:57] Voice 2: that way because it doesn't

[1:16:04] Voice 2: know letter writing is like deeply frustrating in some ways but it is something we can follow up with

[1:17:34] Voice 2: is the jurisdiction of dock licensing is the province right and the zoning is in the hands

[1:17:45] Voice 2: of the audience trust but because the jurisdiction of the licensing is in the province which is

[1:17:50] Voice 2: getting argued reasonably i think like we keep getting argued by local people who don't like

[1:17:55] Voice 2: regulation to say well but that's the province's business why are we zoning for our docks or not

[1:18:00] Voice 2: not something for dogs right like we shouldn't have any say in it because it's a problem

[1:18:04] Voice 2: but the problem is that the problem problems with licensing practices are not allowing for actual

[1:18:12] Voice 2: real authentic community consultation because they're not

[1:18:15] Voice 2: doing that kind of active force

[1:18:17] Voice 2: consultation that they do with cell towers they're they're like they have they were like

[1:18:21] Voice 2: it was a whole thing like the cell towers where they had to like you know show that there was a

[1:18:25] Voice 2: public consultation we're leaving it like that's just not happening with dogs and so if it was

[1:18:30] Voice 2: happening with dogs we wouldn't have to zone around i think but yeah

[1:18:34] Voice 4: i would i would describe

[1:18:36] Voice 4: it as uh you both have some jurisdiction over doc approval one is through zoning where the local

[1:18:43] Voice 4: government has the jurisdiction in this case of the island's trust and the province has the has

[1:18:49] Voice 4: also has a decision to make you need both of those decisions uh for example in galliano they allow

[1:18:56] Voice 4: docks but everywhere around galley i know they have a development permit area so any work within

[1:19:01] Voice 4: in the foreshore requires a development permit so uh if you want a dock it might be permanent

[1:19:08] Voice 4: it might be allowed but you need to go through the process of getting a development permit with

[1:19:13] Voice 4: a professional providing guidance around you know citing of your pilings and all of those things

[1:19:20] Voice 4: would say that there's it's a joint uh jurisdictional it's

[1:19:25] Voice 3: three three levels so there's a federal role on navigation uh there's a provincial role tenure

[1:19:38] Voice 2: and i do understand that like i have looked at that a lot the problem is i'm a person who

[1:19:45] Voice 2: buys waterfront property and i want to understand that it's a freaking nightmare and so like how do

[1:19:51] Voice 2: do people who are in the space understand how to navigate it in a way that is more user-oriented

[1:45:43] Voice 4: is some basis of fact to back that up that there was some confusion at the time of sale

[1:45:47] Voice 4: sale around those DPAs and the requirement to meet any regulatory obligations.

[1:45:55] Voice 4: The property owners are working on submitting a DP application and in fact it was just received

[1:46:00] Voice 4: this morning and they've hired an off island registered professional biologist who specializes

[1:46:09] Voice 4: He visited the site last Thursday and will be providing a report in due course with respect

[1:46:15] Voice 4: respect to site remediation and future testing tree protection in the DPA area and that report

[1:46:23] Voice 4: will recommendations in that report will become primary content of the conditions within the

[1:46:33] Voice 4: development permit for future restoration of that site and provincial forestry staff have visited

[1:46:39] Voice 4: the property and they concluded that there were no violations with the regulations and so then

[1:46:46] Voice 4: with respect to the forestry management options as you know right now you have a suite of

[1:48:24] Voice 4: the province

[1:48:25] Voice 4: has not been very uh there hasn't been

[1:48:27] Voice 4: much appetite to open up the community charter to

[1:48:29] Voice 4: do that or the government not withstanding certainly could be passed again uh you could

[1:48:36] Voice 4: also advocate for provincial agencies uh to establish stricter forestry management practice

[1:48:41] Voice 4: on private lands but really i think trust council level through a request for decision

[1:48:53] Voice 4: so really this is just some information for the local trust community to consider

[1:48:57] Voice 4: uh any work around uh dpas would obviously uh need to be a project of a minor project and so

[1:49:06] Voice 4: you need to consider that uh in your deliberations around what project you want to pursue uh first

[1:53:30] Voice 4: their property designated as pmfl and there's a bunch of requirements around forestry management

[1:53:36] Voice 4: planning and such that you need to get that if you do get pmfl status that uh local government

[1:53:43] Voice 4: and regulations and development permit area requirements do not apply and that's specified

[1:53:49] Voice 4: in the pmfl legislation so on galliano

[1:53:52] Voice 4: there's a number of properties that are within the pmfa

[1:57:49] Voice 4: logging is legal and uh if not for the presence of the dpa they could have done all of that

[1:57:56] Voice 4: and so it's really only that dpa that unique kind of nesting uh location that protects

[1:58:05] Voice 4: or was meant to protect those trees obviously well

[1:58:08] Voice 2: and we see that on pirates like the the

[1:58:10] Voice 2: property on pirates didn't have the dpa in that sense so it like is a huge area that was bad

[1:58:15] Voice 2: and so i think that's a larger issue for like trust council frankly like that level of issue

[1:58:22] Voice 2: you know we don't all agree but it's been out there we have some very

[1:59:14] Voice 4: for example if you looked at coastal douglas first development permit area you could probably you

[1:59:20] Voice 4: DPs require a specific ecological value to be protected,

[1:59:25] Voice 4: which is why the one in Galliano is potentially a challenge

[1:59:30] Voice 4: because it just looks to protect everything.

[1:59:32] Voice 4: But I think you can demonstrate that Coastal Douglas Fert

[1:59:36] Voice 4: is an apparel ecosystem and it's an ecological value

[1:59:38] Voice 4: that would be appropriate to set DPs.

[1:59:44] Voice 4: where now all of a sudden you need a development permit

[2:25:54] Voice 3: of portability that flags areas of uh fresh water vulnerability there are known uh areas on

[2:26:04] Voice 3: on any other saltwater intrusion.

[2:26:06] Voice 3: I've spoken to, I know, three waterfront lots.

[2:26:11] Voice 3: In one case, the owner has to use reverse osmosis

[2:26:16] Voice 3: desalination every summer, every summer.

[2:26:19] Voice 3: On the other two, there is saltwater intrusion.

[2:26:22] Voice 3: One person manages by boiling what comes out of the well

[2:26:27] Voice 3: to get so many liters of fresh water for drinking.

[2:26:32] Voice 3: and the other commented that um perhaps reverse of course this desalination might be a fix

[2:26:40] Voice 3: and i asked would you consider that from the ocean or from the well and we got into a sticky point

[2:26:49] Voice 3: it is not understood by the public but putting the reverse of most desalination exacerbates the

[2:26:56] Voice 3: problem and could encourage encroachment of sea water in other people's wells in the surrounding

[2:27:03] Voice 3: area so to the depletion of surface water in an area of substantive groundwater vulnerability

[2:27:15] Voice 3: could have an impact on the groundwater underneath not immediately immediately but i'm really

[2:27:20] be

[2:27:20] Voice 3: thinking of upping the density on McKenna Road quite arbitrarily without any of the proper

[2:27:27] Voice 3: thinking. And let's think about the ground water and the surface water and the ground water

[2:27:37] Voice 3: and the potential for saltwater intrusion. And I know that there is expertise available to us

[2:27:44] Voice 3: either by consultants or by staff to inform the public on those matters and inform you

[2:27:50] Voice 3: and your decisions and they should be front end in a zoning time not leave it to some some other

[2:29:53] Voice 3: it could have taken 2 million, fixed the problem really, really well instead of draining it.

A long-time property owner on Saturna Island has applied to have his property rezoned 
to allow for two lots to be created on the waterfront rather than inland.  
Trustee Morrison advised this is an ongoing dilemma, getting referrals with no context 
and the policy needs to be revisited. 
Trustee Campbell advised all the information is needed to make a decision.

Planner Chadwick reported on the Groundwater Project.  She stated the regulations are 
included in the Land Use Bylaw and will be going to a public hearing.  She also inquired 
of the LTC how to move forward with the Official Community Plan amendments, and 
what the recommended boundaries should be.   
Trustee Campbell asked what an amendment would mean and stated it can’t be moved 
forward simply.  He questioned whether a local project can piggyback on another major 
project. 
Trustee Morrison asked if it would be a minor or major project, but that it needs more 
discussion. 
Regional Planning Manager Kojima advised the focus could shift from the Development 
Permit changes to a communication project.

CRD and Fire Smart are requested to be added to the Agenda.

18. TOWN HALL 
Mary Beth Rondeau addressed the Groundwater issue 
Michael Sketch added further to speaker Rondeau’s comments.  He stated there are 3 
waterfront lots which have reverse osmosis.  He was not sure if it was from the ocean or a well.  
He further stated that ocean water cannot be de-salinated safely, and feels the public should be 
informed of this issue. 
Kathy Kronk feels that the Province, the CRD and Islands Trust are not doing their part.
