[0:00:22] Trustee Maude: I want to begin the meeting by acknowledging that we are fortunate to be able to gather together in locations across the territory of the Coast Salish People.

[0:00:31] Trustee Maude: I'm David Maude, I'm elected on Main Island, and I'm the chair of the Pentagon Local Trust Committee.

[0:00:36] Trustee Maude: I'm joined today by Pentagon Trust's Aaron Campbell and Dan Morrison, who's online today, joining us from up the hill.

[0:00:45] Trustee Maude: Together we make up the Pentagon Local Trust Committee. This meeting is being live streamed.

[0:01:47] Trustee Morrison: quick notes about things that have been going on thanks for all those who have phoned and checked

[0:01:51] Trustee Morrison: in and on different issues um that they're concerned about or that they are just watching

[0:01:57] Trustee Morrison: as we go through. Thanks also to the National Parks for organizing the Parks Canada Visitor

[0:02:05] Trustee Morrison: Experience Strategy Meeting that I attended last month just to talk with many different community

[0:02:11] Trustee Morrison: members around what the National Park is in our community and how we can better engage with them.

[0:02:18] Trustee Morrison: So really encourage folks in the community to get involved with the National Parks.

[0:02:22] Trustee Morrison: they really are looking to to work with the community so please do that um and then maybe

[0:02:29] Trustee Morrison: the last thing just about um as we go forward in our various projects i really encourage folks to

[0:02:38] Trustee Morrison: share the pender post that i shared has a bunch of different links for june around the meeting

[0:02:45] Trustee Morrison: in june so please do share that out in social media um and you know as broadly as possible

[0:02:51] Trustee Morrison: as the people know that that June meeting is coming up really try to get that word out

[0:02:57] Trustee Morrison: and I think also a nod to our chair I know that it was a difficult meeting I hear with the our

[0:03:06] Trustee Morrison: passing of our land use bylaws maybe we'll come back to that but thank you for championing the

[0:03:11] Trustee Morrison: work we've done and we always do that with the you know intent and desire to engage and listen

[0:03:17] Trustee Morrison: them with First Nations. And I know that was a concern expressed in the group.

[0:03:40] Voice 7: couple of weeks with having dealt with the dialogue, reviewed the last set of meetings,

[0:03:50] Voice 7: and I had wanted to echo what Deb was saying and thanks to yourself and Kim, members of the public,

[0:04:02] Voice 7: to get educated on something with Zoom meetings and respond when they see something.

[0:04:10] Voice 7: And so that was quite interesting. I was sending an email from the side of the highway trying to find out what was,

[0:04:16] Voice 7: was what all this happening at the executive community um which was fun and uh yeah i just

[0:04:22] Voice 7: heard have heard lots um from people positively about finishing that pilot review uh and in the

[0:04:29] Voice 7: hopes that we will start to look at uh housing as a as a project

[0:04:35] Voice 7: thank you

[0:04:39] Trustee Maude: i hope so this is friday so this must be north bend this is my fourth meeting this week so

[0:04:46] Trustee Maude: So it's all been a little bit of a blur.

[0:04:49] Trustee Maude: But yes, on Wednesday, we did get through the NACU and OCP updates.

[0:04:56] Trustee Maude: There was a moment of maybe brief terror.

[0:05:03] And you can thank the organization for doing due diligence.

[0:05:08] When the violence got to the executive committee,

[0:05:11] Trustee Maude: two of the members of the executive

[0:05:14] Trustee Maude: had drilled down and noticed that there had not been a revival in the First Nations referrals,

[0:05:23] Trustee Maude: and they were unwilling to go back to North End for updating.

[0:05:30] Trustee Maude: And what happened is we took a lunch break, and the Islands Trust organization collectively just went nuts

[0:05:41] Trustee Maude: and went through all the files because if there was

[0:05:46] Voice 6: that the

[0:05:51] Trustee Maude: response I don't know where they

[0:05:53] Trustee Maude: found it but it was found someplace else and and by after lunch um the proper documentation

[0:05:59] Trustee Maude: was in place it was circulated to the executive and it was enough to satisfy to pass the bylaws

[0:06:05] Trustee Maude: us so it's you know we don't just understand things and uh there were a few hours of terror

[0:06:14] Trustee Maude: and certainly um trustee campbell was was passing on that terror and but we got it done so i'm very

[0:06:22] Trustee Maude: very happy um and uh it's the next step for the local trust committee um otherwise it's just

[0:06:29] Trustee Maude: as i've been kind of busy um it's only been a few brief days since we've previously met so nothing

[0:06:36] Trustee Maude: huge to report just that we're trying to do the good work of the trust thank you all right um i

[0:06:43] Trustee Maude: saw um regional director brett yesterday and he sends regrets but he assures us he's in the meeting

[0:06:50] Trustee Maude: trying to secure housing for the southern gulf islands so he said that was a greater cause so

[0:06:55] Trustee Maude: So hopefully we all agree with that.

[0:06:57] Trustee Maude: And now we'll start at the town hall session.

[0:06:59] Trustee Maude: And so briefly, if you just put up your hands and identify yourself for the reporter.

[0:07:05] Trustee Maude: We try to keep it reasonably short, but speak at will and we'll proceed.

[0:07:55] Voice 5: not a report he's speaking on one topic okay

[0:07:57] Voice 2: i'm i'm just uh i want to speak on housing certainly and uh uh because i'm uh brent's

[0:08:06] Voice 2: alternate i'm not as up-to-date on some things as well that's what i'd like to be but just briefly

[0:08:12] Voice 2: me on housing i spoke to brent he wanted to pass on that the crd is looking to try and get

[0:08:21] Voice 2: money from senior governments for multi-unit and there's some negotiations what will happen

[0:08:28] Voice 2: anything like we don't know but you just want to let you know that things are being discussed that

[0:08:33] Voice 2: way the crd is pursuing subsidies for secondary suites and other accessory dwelling units

[0:08:42] Voice 2: and i think you're probably aware that bc has set aside funds for 3 000 units at up 40 000 a bottle

[0:08:50] Voice 2: um what brent and i have been talking about on housing is what we call four a's and i'll just

[0:08:58] Voice 2: briefly go over those the first one is housing has to be acceptable by that i mean it has to

[0:09:06] Voice 2: be connected to proper services whether it's septic or sewer water power parking and that kind

[0:09:14] Voice 2: of thing it has to be affordable the whole process that we're trying to push is for affordable

[0:09:23] Voice 2: housing affordable generally we're talking about the bottom third now we need other housing as well

[0:09:29] Voice 2: but that's the critical one that's harder to get and we want to be creative

[0:09:39] Voice 6: find solutions like that. The solutions, the third day

[0:09:46] Voice 2: is all that. We're probably looking at alternate housing

[0:09:51] Voice 6: because it floats in a little

[0:09:58] Voice 2: board arena, but we're going to, if we're going to do this, because I think everybody knows costs are crazy for traditional housing.

[0:10:07] Voice 2: And the last A is available. It has to be available. Traditional housing could take two, three, four years to build. Just the nature of things. It's no blame, but it's just the way things are. The need is now. The need is not, well, the need will be down the road, but we want to try and find things now.

[0:10:29] Voice 2: Now, the CRD is supposed to have a report within grant advises within three weeks to deal with its position on trailers and tiny homes, and he's he's not sure what's going to happen but staff have been spending a lot of time on it, because he's pressed them on, on the on the forays.

[0:10:53] Voice 2: sort of thing. So we should have something on that. And I understand that staff at both the

[0:11:02] Voice 2: trust level and the CRD are working together on working their way through the trust money

[0:11:12] Voice 2: and the CRD trying to work with staff or staff working to find the funding. So

[0:11:18] Voice 2: So Brent just wanted to pass on these comments and stress that the CRD wants to work with the trust to find solutions.

[0:11:31] Trustee Maude: I will acknowledge that the CRD staff and the Outskirts staff have been working very closely together,

[0:11:39] Trustee Maude: but also the political bodies.

[0:11:40] Trustee Maude: is that there seems to be a very cohesive symbiotic relationship

[0:11:45] Trustee Maude: that's making things work a lot more

[0:11:47] Voice 6: smoothly than it has in

[0:11:51] Voice 6: the past.

[0:12:08] Trustee Morrison: I just wanted to really stress the communication, and I think we've done this through official channels, but just stress the communication to Paul that we'd really love to have him virtually or in person at the meeting in, is it, sorry, is it June 25th or 24th, 26th?

[0:12:27] Trustee Morrison: day um yeah so we would really love to have him there and if you can pass that message on because

[0:12:33] Trustee Morrison: i agree with everything david just said about you know working tightly together around the

[0:12:38] Trustee Morrison: housing issue one of the things that's really important is for paul also to be working with

[0:12:42] Trustee Morrison: the community and listening to the community and what they share um fully so it'd be really

[0:12:47] Trustee Morrison: great to have him at that meeting thank you

[0:12:59] Trustee Maude: didn't pass a motion we will all

[0:13:00] Trustee Maude: kids are in the cooperative measures okay perfect now we'll move on okay

[0:13:09] Voice 5: would just maybe follow up with with what rob has been speaking about and ask the north pender ltc if

[0:13:17] Voice 5: they would consider um adding the housing accelerator funding to your housing programs

[0:13:28] Voice 5: I think it's a quick thing the deadlines are coming up fairly quickly salts when you just jump on board

[0:13:34] Voice 5: Making its way ahead for the forgetting the funding. So what I understand

[0:13:40] Voice 5: Tender has gone as we've already got secondaires to be zoning that we're ahead of many of the items on that

[0:13:52] Voice 5: He is putting together

[0:13:55] Voice 5: These are grants for incentives to legalize and

[0:13:59] Voice 6: incentives

[0:14:02] Voice 5: for new bills or for new.

[0:14:05] Voice 5: I'm sort of looking over at staff, but it's all up to staff to get us on to the Housing Accelerator funding on North Hender.

[0:14:14] Voice 5: And that could be part of, I would think that will be part of your discussion on major projects and housing projects today.

[0:14:20] Trustee Maude: Certainly, yes. Spencer, do you have a brief comment on that?

[0:14:23] Voice 3: What I would say is that staff have had discussions regarding the funding program and the timelines are really tight.

[0:14:34] Voice 3: There's a lot of work to do to prepare the community with respect to the application.

[0:14:42] Voice 3: So the reality is that those timelines are just not realistic because the deadlines within, can I speak?

[0:14:48] Voice 3: Yeah, sorry.

[0:14:48] Voice 5: the

[0:14:49] Voice 3: deadlines are like within weeks or less uh salt spring and uh one other island main

[0:14:57] Voice 3: are pursuing that funding uh those are the two islands that have done significant work over the

[0:15:06] Voice 3: last few years to prepare themselves to be at this point with collecting community profile

[0:15:12] Voice 3: profile information, the baseline information around housing and the action plan items.

[0:15:18] Voice 3: The trust is also working on a staff, we're working on a toolkit, which is combining all

[0:15:25] Voice 3: of the work that's been done to date on the various types of housing, be it, you know,

[0:15:30] Voice 3: the work I did on Galliano last term with the two traditional rezoning projects where

[0:15:35] Voice 3: the 12 and 20 units uh you know the various forms of alternative housing uh what zoning tools can be

[0:15:43] Voice 3: used or zoning amendments could be made to uh you know enable more uh uh a broader range of housing

[0:15:53] Voice 3: so all of those things are being worked on and i think that staff have some ideas around what

[0:15:58] Voice 3: we could be doing in the short term to prepare uh for those funding opportunities in the future

[0:16:05] Voice 5: great um

[0:16:06] Voice 5: my thank you chair my point uh was that yes the housing action plan is huge but could it

[0:16:14] Voice 5: be quite small could it be focused on as an initial or a small thing that focused on the

[0:16:20] Voice 5: fact that we have secondary suites in our zoning uh i i yes so and you do have to have a housing

[0:16:25] Voice 5: action plan we're a bit behind on that but i wonder if it could be very focused to get

[0:16:31] Voice 5: get in to work with crd and see if there's an opportunity so you might be saying something like

[0:16:37] Voice 5: ask staff if there's an opportunity to just focus on something quick and small

[0:16:43] Trustee Maude: i i believe that the you know is that the staff have done sort of a pretty thorough review

[0:16:50] Trustee Maude: um kind of chat which has sort of been leading the charge and the what the consistent message

[0:16:56] Trustee Maude: i've heard back and said this is one of these government projects where it was

[0:17:01] Trustee Maude: announced with a very very short

[0:17:02] Voice 6: timeline and it was

[0:17:04] Voice 6: it was for the just to have water ones and and we were on both salt spring and main island where we

[0:17:15] actually had the currently they really

[0:17:17] Trustee Maude: wanted to do this program and and when planet shadow

[0:17:20] Trustee Maude: went up there it was just basically we're not there and the community agreed is um i know when

[0:17:27] Trustee Maude: when she laid it out is that unless you're absolutely 100% prepared to apply it wasn't

[0:17:33] Trustee Maude: worthwhile to try so so

[0:17:35] Voice 5: we missed it on earth pending we

[0:17:36] Trustee Maude: i would say missed it because the

[0:17:39] Trustee Maude: opportunity the window was so narrow that it came out of left field is um i was actually at the

[0:17:46] Trustee Maude: meeting when it was announced is because the planner chadwick was sitting there as a planner

[0:17:52] Trustee Maude: and she got this email announcing this program we have no advance notice no anything and i think

[0:17:57] Trustee Maude: what perhaps that was what maybe eight weeks ago six weeks ago it was it's very very raw very very

[0:18:05] Trustee Maude: narrow and there was there was absolutely no anticipation of it coming and

[0:18:09] Voice 6: what i would

[0:18:17] Voice 3: to see if we can do a trust-wide application versus what has been decided upon is that it's

[0:18:25] Voice 3: better to focus on Maine and Salt Spring as they are so much

[0:18:28] Voice 3: farther ahead with all that ground

[0:18:29] Voice 3: work that's required and so that's

[0:18:33] Voice 6: just the reality of where the work is at.

[0:18:38] Voice 6: Trustee Morrison you have anything to add?

[0:18:41] Voice 6: um

[0:18:42] Trustee Morrison: i did actually ask when the initial announcement came out i asked about north

[0:18:46] Trustee Morrison: penter participating in this with staff and like iterated a little bit on it

[0:18:50] Trustee Morrison: um and uh yeah i i agree with what brad's saying the amount of information that's being requested

[0:18:57] Trustee Morrison: by this um we just weren't really in the right place to be doing it i also am really disappointed

[0:19:03] Trustee Morrison: that the trust didn't wasn't able to go for a trust wide because that's the best way forward

[0:19:07] Trustee Morrison: I think, and then to localize it through the LTC engagement. So it's a problem because the CRD

[0:19:15] Trustee Morrison: is also holding a giant portion of this work and responsibility. And so the CRD wasn't coordinated

[0:19:23] Trustee Morrison: enough with the trust overall to be able to really move forward for us in the Southern Gulf Islands.

[0:19:29] Trustee Morrison: Regardless of whether we're part of the accelerator, we will pursue what we need to do

[0:19:33] Trustee Morrison: inside the north pender ltc going forward to try and make sure that we're not in that situation again

[0:19:54] Voice 6: there is another intake coming up

[0:20:17] Trustee Maude: the time we can do that by consent um that's local trust being minutes dated may the death

[0:23:33] Trustee Maude: tup 2022.5 um for sketch and we have a staff report thank

[0:23:41] Voice 3: you chair so this is uh representing

[0:23:42] Voice 3: presenting uh uh this application which was first presented in March to the local trust committee at

[0:23:50] Voice 3: that time the local trust committee deferred the decision on the on the temporary use permit

[0:23:55] Voice 3: application for the storage of six storage containers the subject property at 1101 Andrew

[0:24:02] Voice 3: place the local trust committee requested that the applicant submit a plan to wind down or cease use

[0:24:11] Voice 3: use of these uh temporary use uh to the local trust committee by the end of April we received

[0:24:17] Voice 3: correspondence from the applicant with that uh regarding that uh and uh also staff have added

[0:24:25] Voice 3: a condition in the in the draft permit uh requiring uh consistent fencing with the fencing

[0:24:33] Voice 3: that already exists there to be placed along the one uh uh side edge of the of the uh area that is

[0:24:41] Voice 3: not currently screened and the applicant sent a note this morning requesting that the local trust

[0:24:46] Voice 3: committee if you consider approval of the permit that you relax the condition around

[0:24:52] Voice 3: maintenance of the existing trees as some of them have expired i think i want to walk through all

[0:25:01] Voice 3: the details of the application everything else is the same as it was when i presented in march all

[0:25:06] Voice 6: right

[0:28:32] use permits in a situation where they could be just continually renewed because there

[0:30:52] Voice 7: somewhere where it's easy to find rentals or live here as I have since 1995. This is a housing,

[0:31:00] Voice 7: I had no trouble since 1995 renting a house to put my possessions in and all of a sudden actually

[0:31:06] Voice 7: 2007 when the um uh the Airbnb moved in in a very substantial way on tender I kept hearing other

[0:31:18] Voice 7: people not finding a place to rent and then it came my way um I really had no choice uh there

[0:31:27] Voice 7: There certainly wasn't time to apply to the LCC to use the land for a park road, and I had to find a place to live and get out.

[0:31:44] Voice 7: And it really was, it was a very crying time and it was expensive.

[0:31:49] Voice 7: And if I could have found some other way of dealing with it, I wouldn't have spent that money.

[0:31:53] Voice 7: I can't answer at the end of the TUP if I have the means I will put it out somehow

[0:32:00] Voice 7: properly if I don't have the means I will apply for another extension of the TUP and it is temporary

[0:32:08] Voice 7: in that every three years the Public Tax Committee can judge whether I have misused the land

[0:32:16] Voice 7: or not and I have no intention of doing so and I didn't for 25 years

[0:32:24] Trustee Maude: thank you. I can say from my perspective, I didn't do it well. And if there was one spot that was remote and benign and seriously not an impact on the community, I would suggest it's the property that you're using.

[0:32:53] Trustee Maude: sort of had to go see for myself to understand what the problem was and i kind of agree with

[0:32:59] Trustee Maude: with kristin campbell it's i don't think a lot of the concerns that were raised were actually

[0:33:05] Trustee Maude: about the containers on the block there seemed to be some other overreaching issues and and so

[0:33:12] Trustee Maude: So what is before us is the issues of the containers and their situation.

[0:33:20] Trustee Maude: I can certainly understand Trustee Campbell's perspective.

[0:33:24] Trustee Maude: We don't want a broad situation where you say, okay, there's permitted all crops on the island

[0:33:36] Trustee Maude: because that might get a little bit out of hand in inappropriate locations.

[0:33:40] Trustee Maude: So I just, I sort of get that side of things.

[0:33:44] Trustee Maude: But then I also, I look at the staff report that is recommending not approving, and there seems to be a great many rules on that side of the ledger too.

[0:33:58] Trustee Maude: So it's difficult for me, for somebody who is not from Bender Island, to sort of be sort of the decider.

[0:34:07] Trustee Maude: and i'm not sure it sounds to me that trustee morrison is lying on on to not issuing the the

[0:34:16] Trustee Maude: tup and trustee campbell is sort of leaning towards issuing it which sort of puts me in the

[0:34:21] Trustee Maude: middle so not unlike the last meeting it kind of would be nice to find some sort of compromise

[0:37:24] Trustee Morrison: disagrees with that stance they're like fairly strongly in opposition to this I do see it as

[0:37:30] Trustee Morrison: a housing related issue because I know Mr. Sketch was displaced. I've talked a lot about this and

[0:37:35] Trustee Morrison: visited that site multiple times. So I'm aware of that. The challenge that we face with the TUP

[0:37:41] Trustee Morrison: like this is literally, and this is not a personal issue with Mr. Sketch. I appreciate all the work

[0:37:48] Trustee Morrison: that he's done on, you know, with the trust and detail in many ways. It's about how we are

[0:37:56] Trustee Morrison: are understanding our OCP, implementing it for our community, or we're cherry picking what we

[0:38:03] Trustee Morrison: choose to implement or not. And I think with relation to housing, it becomes, you know,

[0:38:10] Trustee Morrison: part of the larger housing conversation, but then does everybody like, is this like a stance that

[0:38:17] Trustee Morrison: we're taking that in the housing crisis, we allow everybody to do whatever they want on land as they

[0:38:22] Trustee Morrison: are, and I'm not saying that's what you're doing. I just want us to think carefully about that

[0:38:27] Trustee Morrison: because there is, the housing crisis is not going to resolve itself in the next three years. I can

[0:38:33] Trustee Morrison: tell you that right now. So if we pass the TUP on this basis, we're going to say it's going to be

[0:38:38] Trustee Morrison: there for six to eight years, um, as things are like built out as there's more, you know,

[0:38:44] Trustee Morrison: possibility. And so we have to be aware of what, of what we're doing a little bit more broadly on

[0:38:51] Trustee Morrison: on the landscape so um and you know i've had a lot of different conversations with folks who are

[0:38:57] Trustee Morrison: very sympathetic to mr sketch's perspective and still disagree with this context because it reaches

[0:39:03] Trustee Morrison: our ocp and so from my perspective that's really what it's coming down to it's you know i'm i'm

[0:39:09] Trustee Morrison: incredibly sympathetic

[0:39:11] Voice 9: to the issue so

[0:39:16] Voice 6: i guess the question would be is there more are there

[0:39:23] Voice 7: more benefits to looking at changing our OCP to allow to almost backtrack to a more rural time

[0:39:33] Voice 7: on Bender Island when things were less regulated as far as housing and forms of housing were

[0:39:43] Voice 7: concerned and how people will use the land specifically

[0:39:49] Voice 6: given what we're going through with

[0:39:56] Voice 7: housing

[0:40:00] Voice 3: uh just to clarify mr sketch has had two rezoning applications one looking at uh

[0:40:07] Voice 3: specifically amending uh the land use byline cp to allow storage on his particular property

[0:40:14] Voice 3: that was rejected by the local trust committee and the second one was a more broad approach

[0:40:22] Voice 3: approach of looking at relaxing standards around storage of goods and use of property

[0:40:30] Voice 3: in that way, in the absence of having a dwelling on the property. So I would be careful to

[0:40:38] Voice 3: separate housing and storage of goods on a property, and it's a bit of a unique case

[0:40:44] Voice 3: in this situation i would also uh just advise that the local trust committee does not need to

[0:40:54] Voice 3: work towards consensus here and at some point if your discussion is over and you have uh different

[0:41:01] Voice 3: opinions then that's okay and that's reflected in the vote and for mr god here the chair

[0:41:09] Voice 3: has chosen or been

[0:41:11] Voice 3: told to be the

[0:41:13] Voice 3: decision maker in those cases

[0:41:15] Voice 3: so

[0:41:17] Voice 3: that's just a bit of staff advice

[0:41:19] Voice 3: so we don't just continue to

[0:41:21] Voice 3: reach consensus if you don't agree

[0:44:22] Voice 7: And I guess at the end of the day, that comes down to that part of it is out of our control for him.

[0:44:35] Voice 6: um stipulations i don't know but

[0:44:43] Voice 6: better than nothing

[0:44:44] Voice 7: i guess in a sense for for him um and maybe more comforting to the people that

[0:44:52] Voice 7: have um sent letters of opposition but yeah i

[0:45:01] Trustee Morrison: guess the other thing to consider is you know

[0:45:04] Trustee Morrison: one of the things that we could do as a community level is you know zone land that the community's

[0:45:10] Trustee Morrison: already named as appropriate for this type of use right so there are industrial lots on pander where

[0:45:17] Trustee Morrison: storage of materials are appropriate and we have talked in the past about that um and to me that is

[0:45:24] Trustee Morrison: uh you know that's a compliance agreement um for a bylaw to have him move his materials to

[0:45:29] Trustee Morrison: to those sites i understand that mr sketch doesn't want to do that and and i know i've had those

[0:45:35] Trustee Morrison: conversations with him but from a community planning perspective that is the better move

[0:45:40] Trustee Morrison: um and you know happy to consider that as options um it's it's a dilemma because it's not

[0:45:49] Trustee Morrison: straightforward that this is storage it's about accessible storage for for mr sketch and you know

[0:45:56] Trustee Morrison: That is an ask that is different than just straight up,

[0:46:02] Trustee Morrison: can I put things on the property without a building permit?

[0:46:06] Trustee Morrison: And so first, I guess one of the questions I have for both of you too

[0:46:14] Trustee Morrison: is have you read into the entire history of the file?

[0:46:16] Trustee Morrison: Because it's been extensive for what Brad just said

[0:46:19] Trustee Morrison: about all of the different attempts.

[0:46:22] Trustee Morrison: And that's the other thing that the community is perceiving

[0:46:25] Trustee Morrison: in the correspondence that we're getting and it's not we're not getting only correspondence from

[0:46:30] Trustee Morrison: stanley lake just to be clear like it's from other people in the community too um because now it's

[0:46:35] Trustee Morrison: become a different issue slightly of well but you're just trying to find ways to work around

[0:46:40] Trustee Morrison: the bylaw right and so then it becomes a question about well okay can everybody find a way to work

[0:46:48] Trustee Morrison: around the bylaw with a tup and so that's also an issue for us in terms of the credibility of

[0:46:55] Trustee Morrison: of even having an OCP and implementing it.

[0:46:57] Trustee Morrison: So I think that's also a dilemma for me now

[0:47:00] Trustee Morrison: that because it's, there's been like,

[0:47:02] Trustee Morrison: however many attempts it is at different methods to do this,

[0:47:07] Trustee Morrison: it's become a different issue as well, an additional issue.

[0:48:09] Voice 7: right decision but where are we going with this issue as well for the future and so i've been

[0:48:33] Voice 7: use a piece of property that he already has that is arguably somewhat undevelopable

[0:49:45] Trustee Morrison: and there is no clear statement and i understand why too like this is not to mr sketch's fault

[0:49:52] Trustee Morrison: like understand why he's in a situation like this so um one of the thoughts and and there have been

[0:49:59] Trustee Morrison: community members that have reached out around possibilities of him moving his containers onto

[0:50:05] Trustee Morrison: a property that already has an existing building permit there are some options available but they're

[0:50:10] Trustee Morrison: not the option that mr sketch would like because he would like to use his own property i do

[0:50:15] Trustee Morrison: understand that too but you know our rules are the way they are for reasons that have historic

[0:50:20] Trustee Morrison: merit to them. And if we're going to change them, then that's a community-based process

[0:50:24] Trustee Morrison: about how we do that. And so from my perspective, I'm like, like, it seems a reasonable thing that

[0:50:32] Trustee Morrison: we actually add that into part of the conversation about how are people handling, you know,

[0:50:37] Trustee Morrison: downsizing or shifting accommodations as part of our housing conversation that we're likely to

[0:50:44] Trustee Morrison: to engage in and that we work with bylaw around a compliance agreement that is respectful and

[0:50:52] Trustee Morrison: humane to like find a way you know to shift you know these containers to alternative properties

[0:50:58] Trustee Morrison: for the foreseeable future while we sort out the larger picture of what's going to be done

[0:51:03] Trustee Morrison: but I really caution us to do that as a community in conversation and not unilaterally through

[0:51:09] Trustee Morrison: to TUPs because I just feel that's disrespectful to the community on a whole.

[0:53:46] Trustee Morrison: understand has um been sort of interested in because he has his own property that he's using

[0:53:53] Trustee Morrison: right now in you know against our land use bylaws and wants to be legalized um and I do appreciate

[0:54:00] Trustee Morrison: that he's tried to find ways to to make it legal i understand that but it it does just seem like

[0:54:06] Trustee Morrison: it's you know it's more about the financial component of having property that's unused

[1:05:38] Voice 3: submitted by a neighbor expressing concerns with the various based on habitat impacts

[1:05:45] Voice 3: as well as impacts to potential wildlife corridors overall inappropriateness of the development

[1:05:53] Voice 3: involvement and also the impact of sight lines from that particular resident's home a number of

[1:06:00] Voice 3: other letters have been submitted by neighbors expressing support for the application there

[1:06:06] Voice 3: has been a septic assessment provided a letter that concludes that the septic can occur in the

[1:06:13] Voice 3: existing location and so no variants or specific

[1:06:19] Voice 6: measures are required with respect to that

[1:06:26] Voice 6: and i think one key point

[1:06:30] Voice 3: is that with respect to the two permits that

[1:06:34] Voice 3: you're considering approval of here uh with development variance permits the local trust

[1:06:40] Voice 3: committee has full discretion as to whether to approve the permit or not or to seek amendments

[1:06:48] Voice 3: there are aspects of the application that you don't like with respect to the

[1:06:52] Voice 3: the development permit, you have less opportunity to have full discussion as the Local Government

[1:07:15] Voice 3: applicant can demonstrate that they're reasonably meeting those guidelines, then the development

[1:09:08] Voice 7: house um and ultimately really what we're looking for is making that house that um if we did any

[1:09:15] Voice 7: addition to this place or sort of any alteration to it because of the original construction of the

[1:09:24] Voice 7: original building that's there right now there is one strict footing and i think i don't know

[1:09:30] Voice 7: four or five pad footings that hold it up and really what we're looking for is is a comfortable

[1:09:36] Voice 7: building that feels safe um and that would be built to like a um uh an uh energy um statement

[1:09:47] Voice 7: that that is like near net zero net zero already so um ultimately it's it's a new house that's

[1:09:55] Voice 7: about 20 bigger and if you look at where the original house is now and what the proposed

[1:10:01] Voice 7: this house is

[1:10:01] Voice 7: it's like we've tried um as much as possible to going through the guidelines um

[1:10:09] Voice 7: you know looking at all the herbaceous woodlands intertidal all those recommendations about what

[1:10:15] Voice 7: what is is sort of trying to achieve and we tried to meet basically all of them which

[1:10:22] Voice 7: i think we pretty much met all of them um so ultimately um we we feel that um it's reasonable

[1:10:35] Voice 7: what we've designed is a reasonable space to live in um it's modest we've maintained the balance uh

[1:10:42] Voice 7: for needs of the client while minimizing the impact on ecology on the neighbors

[1:10:53] Voice 7: we maintain as much of the neighbors view with one way or the other um we've notified and consulted

[1:11:00] Voice 7: with the neighbors to discuss the project prior to your notification that this is happening so

[1:11:07] Voice 7: we're trying to be a little proactive that way we need simplicity of the house for compliance

[1:11:26] Voice 7: and watering or gardening with some of the new trees that we're planting

[1:11:37] Voice 7: five gary oaks and i think there's another four arbutus trees that are in pots kind of

[1:11:44] Voice 7: Gareth J. ready to get planted as well as part of what they're trying to achieve, and in that respect, trying to keep the tree impact minimum for the new build and reduce the visual impact of the house.

[1:12:09] Voice 7: away from the trees as much as we can and kind of keeping it in that area where we could still

[1:12:17] Voice 7: drive around get a fire or emergency crews in if we really need to maintain with an accessible

[1:12:23] Voice 7: the ecosystem maintaining dpa6 for the intertidal and i guess just to wrap up

[1:12:32] Voice 7: we feel that with these items in mind and the design of this project with the variances

[1:12:43] Voice 7: don't really challenge the overall intent of the bylaw it is a unique property okay quite

[1:12:51] Voice 7: challenging and we feel that there's been a lot of thoughtful design and intense intentionality

[1:12:58] Voice 7: and putting the package together um so unique for sure challenging definitely

[1:13:05] Voice 6: um any kind of addition

[1:13:12] Voice 7: renovation would be cost prohibitive just based on structural components so

[1:13:19] Voice 7: So we feel that we have a great opportunity here to do what we've requested with minimal

[1:13:26] Voice 7: impact and a high degree of excellence design-wise and visual-wise thoughtfulness and consideration.

[1:20:41] Voice 3: to start that baseline of information collection which there is a summer student hired to start

[1:20:49] Voice 3: doing uh trust-wide community profile work and collecting and pulling some of that starting

[1:20:55] Voice 3: information together there's been a lot of work done on maine with respect to assessing

[1:21:04] Voice 3: the bylaws that could kind of be built on, and the toolkit that's being developed. Staff would humbly suggest, I guess, that you consider, instead of doing groundwater as your minor project, direct staff to create a terms of reference around a new minor project that is

[1:21:25] Voice 3: essentially starting to pull together all those components of housing analysis and background

[1:21:33] Voice 3: that can be done as an in-house kind of project for the next year.

[1:21:41] Voice 3: Then moving you to a place where you're better prepared to proactively move on some of these

[1:21:48] Voice 3: other larger trust initiatives perhaps after that year having all of that background information

[1:21:56] Voice 3: documented and then looking at a major project to then start implementing some of that stuff

[1:22:02] Voice 3: having taken the time to one understand what the issues are and the where the problems lie

[1:22:45] Voice 3: work there but it could be framed as a minor project because it doesn't need a bunch of funding

[1:25:06] Trustee Morrison: stuff that's supporting our existing dpas and we can't effectively update it I have problems with

[1:59:30] Voice 7: um a project which identified groundwater availability for future planning that's

[1:59:35] Voice 7: different and uh it's it's um the the the issue of saltwater improving on the waterfront plots

[1:59:46] Voice 7: or near the waterfront is a screening one there's very little information

[1:59:50] Voice 7: more than one

[2:00:00] Voice 7: waterfront owner with so little saltwater entering problems and what to do about it there's just a

[2:00:06] Voice 7: blank and with housing pressing that project should be number one we've got an expert in-house

[2:00:16] Voice 7: who can get consultants and

[2:00:18] Voice 6: identify i think on main island you said chairman that

[2:00:30] Voice 7: along with the groundwater for some waterfront subdivisions

[2:00:35] Voice 7: withdraw from inland.

[2:01:38] Trustee Morrison: so I was one of the instigators of the water study that eventually became a larger effort across the southern Gulf Islands.

[2:01:51] Trustee Morrison: And my intent with creating, you know, understanding and knowledge around that is not necessarily that it turns into regulation, but that it allows us to make better informed decisions on the applications that we see, that we have more information to make those decisions.

[2:02:12] Trustee Morrison: decisions and that um if we as a community understand that information better that we

[2:02:19] Trustee Morrison: will see our way into a regulation if we think it's necessary so i think that that information

[2:02:26] Trustee Morrison: needs to sink into our community a little bit better because i think if we go directly to

[2:02:30] Trustee Morrison: bylaws we're going to have a lot of people up in arms about like you know have we really thought

[2:02:34] Trustee Morrison: it through in the context of our own community very well so it's not that there is an intent

[2:02:40] Trustee Morrison: to not do bylaws or to do bylaws it's that we need to understand the information as a community

[2:02:46] Trustee Morrison: better and we need to think about it in the context of and learn about it more deeply across

[2:02:53] Trustee Morrison: the issues that are pressing so people can still use that information right now you know we've done

[2:02:59] Trustee Morrison: I thank the staff for like you know addressing the concerns I had in the fall about getting

[2:03:04] Trustee Morrison: that information up and visible to the community and that's part of the ongoing work I understand

[2:03:11] Trustee Morrison: on the broad water you know information sharing effort that's still out coming from that project

[2:03:19] Trustee Morrison: but building out regulations for it is not necessarily the only way to go here and it's

[2:03:28] Trustee Morrison: not that I'm anti-regulations I would say that's the line that Erin and I generally

[2:03:31] Trustee Morrison: sit on either side of i probably have a little more regulation than him but um but i want to

[2:03:38] Trustee Morrison: make sure that those regulations are going to be something that's really going to be one enforceable

[2:03:42] Trustee Morrison: and two that it's going to be meaningful to how we want to live on this

Chair Maude called the meeting to order at 10:01 a.m. He acknowledged that the meeting was 
being held in traditional territory of the Coast Salish First Nations. 
 
2. APPROVAL OF AGENDA 
By general consent, the agenda was approved as presented. 
 
3. TRUSTEE REPORT 
 Trustee Morrison expressed appreciation to everyone who contacted her regarding 
concerns/issues. Encouraged involvement with National Parks Visitor Strategy meetings. 
Emphasized the importance of people to share information at the upcoming June meeting. 
Acknowledged Chair Maude’s efforts in a difficult meeting regarding Bylaws and spoke to the 
importance of engaging with First Nations. 
 Trustee Campbell reported last two weeks rather quiet. Regarding Bylaw review:  thanks to 
Chair Maude, Planner Stockdill and community - a lot of positive and negative feedback. 
Suggestion is to examine housing as a project. 
 
4. CHAIR'S REPORT 
 Chair Maude spoke to the Official Community Plan (OCP) proposed updates. Appreciation for 
ensuring due diligence completed. First Nations referral brought a lot of important information 
back to North Pender. Proper documentation is in place to pass Bylaws.

5. ELECTORAL AREA DIRECTOR'S REPORT 
 Rob Fenton (Director Brent’s alternate) gave Director Brent’s regrets – he is in a meeting 
regarding housing. Capital Regional District (CRD) is looking for available funding from 
governments – pursuing subsidy for secondary suites, etc. Detailed the 4 A’a:  Acceptable:  
connected to services; Affordable: critical; Alternate housing; e.g. tiny homes; and Available. 
CRD looking to work with LTC towards solutions. 
 Invitation for Director Brent to attend June meeting – listen to the community and work with 
LTC on housing. 
 
6. TOWN HALL AND QUESTIONS 
 Speaker:  questioned NPLTC accessing Housing Accelerator Fund. Salt Spring Island is on board 
and Mayne Island as well. Got zoning for secondary suites. 
 Planner Smith detailed there is a lot of work to do within the community and the application 
closure date was too close. Islands Trust (IT) is working on a tool kit – collecting everything that 
has been accomplished and working to prepare for future funding projects/applications. 
 MaryBeth Rondeau:  important to develop a housing action plan – be focused.   
 Chair Maude stated funding announced with a short time line and need to be 100% prepared. 
Planner Smith spoke to effectiveness of focusing on Salt Spring Island and Mayne Island at this 
time. 
Trustee Morrison:  volume of information being requested. Looking at total Trust area and then 
focusing on specific communities is a good option. Continue to pursue what NPLTC needs to do.

submitted plan for cease of use was unclear as to what actions would be taken and

Applicant referred to a letter sent this morning to NPLTC. Added would make 
application for a Building Permit if financially able but not able to at this time.

13.3 NP-DVP-2023.2 and NP-DP-2023.1 (Ensing)  
 Planner Smith reviewed staff report. Biologist report included stating development is 
reasonable. One letter received with concerns regarding habitat impact and sight lines; 
a number of letters in support. Explained that a Development Variance Permit (DVP) 
allows more discretion with approval while a Development Permit (DP) gives less 
discretion so LTC should start with that decision. 
 Applicant:  efforts to make house more comfortable, safe and efficient. Development of 
proposed structure is in line with biologist’s recommendations. It is a unique property 
and there has been consultation with neighbours. Owners planting trees to minimize 
impact.

 Tricky lot – appreciate what has been proposed 
 Least impact 
 Bylaws dictate height allowances 
 Least impactful rebuild as it largely uses existing footprint for house

Planner Smith discussed options for projects. There is a Trust wide focus on 
housing. Could begin with a Minor Project to develop Terms of Reference then 
go on to a Major Project to address implementation.

meetings/events across Trust 
- Better communication with community

- Staff recommended:  email to Staff with a specific ask and how best to address 
- Better co-ordination needed at Trust level for these communications

interconnectivity of groundwater and housing.
