[0:00:01] Good morning. Good morning. Thank you all for joining us today at the regular meeting of the Denman Isle Local Trust Committee.
[0:00:09] I want to begin the meeting by acknowledging that we're fortunate to be able to gather today
[0:00:12] in location of the Trust Territory of the Coast Salish People. I'm David Maude, elected from the
[0:00:17] Main Isle and chair of the Denman Isle Local Trust Committee. I'm joined today by Denman Isle
[0:00:21] of trustees, David Graham.
[0:00:23] It's not supposed to be on that side.
[0:00:25] We just got an offer.
[0:00:27] Together we become a Devon Island Local Trust Committee.
[0:00:29] This meeting is live, being live streamed
[0:00:31] and recorded for those who are unable to attend in person.

[0:01:10] join us later by Zoom when it's time to present their staff reports. This meeting is official
[0:01:14] forum for you to trust me to make decisions about land use planning matters and discuss
[0:01:18] relevant business. I want to add it's a place of employment. It's like many staff
[0:01:22] are in their own homes. Our staff have the right to a safe and respectful workplace.

[0:01:40] rise report um with our appointments for the apc um so at our last meeting we were in canada of
[0:01:49] course um for our housing advisory planning commission um so the following people were
[0:01:57] appointed at that time that's judy armstrong richard day carla newford rain silva and
[0:02:04] uh pamela willis virginia spinney and rosa tell us okay that's why you guys we at least one of
[0:02:14] the names so they were appointed we much appreciate their service and look forward to
[0:02:18] receiving all the recommendations um so we'll go

[0:02:25] Trustee Graham: i guess the only
[0:02:27] Trustee Graham: trust business that i was involved in was i attended the financial planning commission
[0:02:32] Trustee Graham: committee meeting uh via zoom and um we really look at the unwanted uh financial statements
[0:02:38] ending in 2023 we approved
[0:02:42] Trustee Graham: that to go to trust council later on this month
[0:02:47] Trustee Graham: and it was uh well it was scheduled to go to three and i think we finished at 12 30 so that
[0:02:52] Trustee Graham: just tells you it wasn't a very contentious or exciting meeting which is good when you're
[0:02:57] Trustee Graham: talking plenty um yeah
[0:03:01] Trustee Borthwick (probable): i mean the main thing that has happened here most recently is we
[0:03:06] Trustee Borthwick (probable): uh work with the fac uh advisory commission so we had bc berries were here last week
[0:03:14] i think it was last week uh feels longer than that to do a public engagement and to talk about
[0:03:23] crappie bay to talk about fairies over the course of the summer uh and we had our our my first full
[0:03:29] Trustee Borthwick (probable): full FAC meeting, which I think is good.
[0:03:33] Trustee Borthwick (probable): There's some good discussion and there's a lot of,
[0:03:35] Trustee Borthwick (probable): it was really good to see a lot of
[0:03:37] Trustee Borthwick (probable): Devon Islanders come out.
[0:03:38] Trustee Borthwick (probable): I think it was 170 people in theory
[0:03:41] Trustee Borthwick (probable): attended the engagement.
[0:03:43] Trustee Borthwick (probable): And I think there was another 90 on Hornby
[0:03:47] Trustee Borthwick (probable): on Saturday, which I didn't attend.
[0:03:51] But lots of really good discussion.
[0:03:53] There's a lot of misinformation that's out there still.
[0:03:57] dealt with so i think there's there's a lot more like communication that needs to happen and you
[0:04:02] know having those conversations but um there's some really good talk and i mean i will we'll
[0:04:10] see how it goes in terms of like demon has been very clear in communicating their feelings about
[0:04:16] Trustee Borthwick (probable): what's been happening and what what's going to happen potentially um we will see what bc paris
[0:04:22] does with that information we i think there was there was a lot of good things said we'll see how
[0:04:29] how it goes and there's a lot of kind of waiting to see how this summer goes with the
[0:04:34] change and how the fairies are organized so um
[0:04:37] Trustee Borthwick (probable): there's a lot of stuff to look forward to there
[0:04:39] Trustee Borthwick (probable): but i i think it was a good meeting we'll see how we'll see how it all plays out in the long run

[0:04:52] to sort of be on denman today you guys the cool island is you know like i was sitting out here

[0:05:17] it's nice to be engaged it's like last meeting i was here i was

[0:05:24] Voice 6: i left my my cable there somebody comes in brings my cable it's like you know
[0:05:30] Voice 6: okay now this is

[0:05:38] Voice 6: it really, this is a great item, it was yesterday somebody sent me some pictures of
[0:05:45] Voice 6: stuff, a bunch of people up picking rocks on the Farmer's Field, you know, so cool.

[0:05:57] Voice 6: that would make me truly alive because I do appreciate that, it is, I really enjoy
[0:06:03] coming here, I really enjoy the meetings, I really enjoy the community. I don't have a huge deal to
[0:06:08] report from the big house.
[0:06:12] Voice 6: I think the main thing coming around the islands right now is some issues
[0:06:17] Voice 6: with the Ministry of Transportation highways, particularly with tree cutting. We had an
[0:06:23] incident on um with a view road um where the the contractor uh with highways had gone and
[0:06:33] assessed some trees i think they're supposed to take down nine trees and they ended up at 58.
[0:06:39] and and and literally took this beautiful so it's it's asphalt a little strip and it's water so it
[0:06:48] was a little strip where the trees were and they just devastated it um and and and important and
[0:06:54] highlands people are as most as upset as anybody but we need to work on our agreements i understand
[0:07:00] what a similar thing happened to gabriola um we've
[0:07:03] Voice 6: had a small instant over intended and so we've um
[0:07:07] from a trust level um we're looking at having meetings with ministry of transportation
[0:07:12] and the infrastructure highways basically to review our protocol agreements figure out what's
[0:07:19] missing and make sure that we have more communication taking place because you know
[0:07:25] these little things become big things um
[0:07:28] Voice 6: and i think that's one person one of my themes is that
[0:07:32] Voice 6: we're trying to open up dialogues um we did meetings uh recently um down island with capital
[0:07:39] Voice 6: regional district with background health authority and without trust executive with the local trustees
[0:07:45] to open up concerns and and have dialogues going on hopefully we'll get extended throughout the
[0:07:50] trust because we are all together is we're not separate governments all over the place we're
[0:07:59] different governments with different mandates there's
[0:08:03] Voice 6: not a lot of overlap so we need to make
[0:08:06] Voice 6: sure that we're all working together with the same thought processes because you know if our trust
[0:08:11] Voice 6: wants to do something and the regional district doesn't want to do something well that's not going
[0:08:15] to work we all need to work together so that's my goal for this term is to to get us all governments
[0:08:21] working together to
[0:08:23] Voice 6: achieve common goals thank you thank
[0:08:26] Trustee Graham: you absolutely one thing i forgot and
[0:08:29] Trustee Graham: thank you to staff after bringing these so in the library after this meeting i will put current
[0:08:34] Trustee Graham: updated land use bylaw in paper form and official community plan in paper form uh so recently
[0:08:41] Trustee Graham: updated as early as may 3rd uh for the lu land use bylaw and march 6th for the official community
[0:08:47] Trustee Graham: so that's that's good we always
[0:08:49] Trustee Graham: have that in the past
[0:08:53] Trustee Graham: okay cool thanks yeah because

[0:09:31] comments we call it down south town hall so if you have anything about the housing
[0:09:38] reports all that we're going to do is Planner Chatter is going to present it and then
[0:09:44] basically we can have interaction back and forth to sort of really discuss that
[0:09:49] deeply so rather than at town hall you're just making a statement if you
[0:09:52] want to hold off until then i think that'll work better for everybody for communication so at this
[0:09:58] point if anybody has anything else they want to talk about you want to raise your hand and
[0:10:02] identify yourself and go away and uh i've been on a
[0:10:07] Voice 11: 4905 true place i did have a place for a
[0:10:10] Voice 11: couple of decades on being on island david cove wasn't named after you i know that um uh i think
[0:10:19] Voice 11: because i think people know me i love tennis and i'm watching the french open so i may not stay
[0:10:24] here for a full discussion housing any diversion from getting on with the idea of having affordable
[0:10:35] housing on them any kind of planning that's going to deter from getting to that point

[0:10:42] Voice 11: than later seems to me to be not wanted not needed and we just need to get along with it
[0:10:48] Voice 11: That's all I really have to say about that, but I will say it for a few minutes before I get back to you.

[0:12:41] Voice 3: So, everything that Rheanne has, I'm learning from Rheanne, what's been going on for the last 20 years with all the planning and all the stuff, I'm tired of it, because people are suffering right now and dying and getting disease as a result of not being able to have a safe place to land and be and get healthy.
[0:13:03] Voice 3: critical housing is critical like so critical hence my emotion this is why i would get a
[0:13:09] Voice 3: pot very often because it's straight after the metal like it regarding the unique amenities
[0:13:18] Voice 3: on denver island which includes all of the services that we provide to each other
[0:13:23] Voice 3: um informally the rock picking our food bank is a mutual aid organization where we all contribute
[0:13:33] Voice 3: contribute money to it, and some of us, most of us,
[0:13:36] Voice 3: come and use it at some time or another, if not consistently.
[0:13:40] Voice 3: This is a deeply interconnected community,
[0:13:42] Voice 3: and what affects one person affects us all,
[0:13:45] Voice 3: in some way, shape, or form.
[0:13:47] Voice 3: So as we go into this discussion
[0:13:49] Voice 3: with all the beautiful information
[0:13:50] Voice 3: that you've been reviewing and reading the stuff
[0:13:53] Voice 3: that Virginia and Rhiannon put together for you,
[0:13:55] Voice 3: thank you for reading that,
[0:13:56] Voice 3: thank you for paying attention to that, it's critical.

[0:14:05] Voice 3: background is social work, so I'm

[0:14:24] Voice 3: I'm going to ask you to fast forward one year in your imagination.
[0:14:28] Voice 3: What would a Demine resident notice is different in their lives, in their wellness,
[0:14:34] Voice 3: of the human right to housing, their trajectory for health improving or declining? So critical
[0:14:42] Voice 3: issue and I'm sorry to take up all the time for housing there's lots of other
[0:14:46] Voice 3: things like farm all that stuff it's really important too but without our
[0:14:51] Voice 3: people being well this community is disintegrating and it's going to get
[0:14:54] Voice 3: galled up through gentrification and none of us want that to happen I will
[0:15:07] Voice 3: save my comments that staff report I do have a couple of things waiting to be
[0:15:17] Voice 3: I'm curious where on the agenda is the housing apc referral discussion because in order for us
[0:15:23] Voice 3: to meet you need to make a referral but I don't see that on the agenda for today and I know I'm
[0:15:29] Voice 3: anxious to meet as the housing apc and other members might be so I'm wondering if you can put
[0:15:35] referral on the agenda it is part of the
[0:15:37] Voice 15: staff report it's one of them but it's one of the
[0:15:40] Voice 15: resolution so
[0:15:40] Trustee Graham: we will be discussing that because it's a resolution it's a resolution of status
[0:15:46] Trustee Graham: for tory and that opens up the discussion group to formulate that okay

[0:15:54] Voice 3: would like to ask that the request for setting a youth permit uh that that be referred to has an
[0:15:59] Voice 3: abc as well because that does affect um potentially uh becomes a viable issue for anybody living in

[0:20:30] I am a little concerned that we're over halfway into our first year now, and we haven't drafted
[0:20:36] a – like, I know it's on our follow-up action list.
[0:20:38] There is the Director for First Nations.
[0:20:40] is in charge of that i think it's and i know we've just got a new communications person who's
[0:20:45] going to be dealing with a lot of those relationships but i think it's really important
[0:20:49] that we have that conversation we open that dialogue just from a i for me it's a it's a
[0:20:56] matter of respect if we want to walk the walk with with reconciliation we need to be uh treating them
[0:21:02] Trustee Borthwick (probable): as our colleagues in government and pretty sensitive or not not pretty sensitive they
[0:21:12] Trustee Borthwick (probable): they have a significant role.
[0:21:14] Trustee Borthwick (probable): And I think it's very important
[0:21:15] that
[0:21:15] Trustee Borthwick (probable): we're actually having that conversation.

[0:22:55] referral feedback stuff from the province that I thought was pretty impressive.
[0:23:05] They actually gave a whole bunch of very detailed feedback in a positive way. I just, I thought it
[0:23:15] worthwhile to sort of note, because normally when we
[0:23:17] Voice 6: feed things back to the province, it's
[0:23:19] Voice 6: kind of blah blah blah. Where this individual took a lot of time to sort of go down
[0:23:24] of the details and and sort of like really encourage a lot of what was happening in this so
[0:23:31] um i just thought that was worthy of note um anyhow

[0:23:37] Voice 6: with or trustees how do you want to begin maybe
[0:23:43] Trustee Graham: if staff could just give us a brief okay thumbnail as

[0:24:05] Planner McCargar: hi i'm marlis mccarger and i will just um give you a really brief intro to this staff report and to
[0:24:13] Planner McCargar: the review the denman farm implementation review project so this is a report regarding the denman
[0:24:25] Planner McCargar: and farm implementation project and the project seeks to enhance and preserve farming activities
[0:24:30] Planner McCargar: on the island through updates to the official community plan and the land use bylaw regulations
[0:24:37] Planner McCargar: the project was initiated back in 2018 so you probably noticed that both proposed bylaws 228
[0:24:47] Planner McCargar: and 229 were given first reading in May of 2018, and then some community engagement took place
[0:24:55] Planner McCargar: during 2018-2019. The project was then put on hold. Planning staff resources were allocated to other
[0:25:04] Planner McCargar: projects and applications, so it was put on hold for a couple of years and then revitalized in
[0:25:11] Planner McCargar: In 2021, a consultant was hired through funding from the Agriculture and Agri-Food Canada and the Investment Agriculture Foundation of BC.
[0:25:24] Planner McCargar: The consultant continued on with the work that had been done back in 2018 with more community engagement and then recommended amendments to the proposed bylaws.
[0:25:37] Planner McCargar: So, the bylaws were presented as amended at the July 27th LTC meeting in 2022.
[0:25:46] Planner McCargar: The LTC requested some more information, staff did some more analysis, and returned in the
[0:25:56] Planner McCargar: fall.
[0:25:58] Planner McCargar: Both bylaws were then given first and second reading.
[0:26:03] Planner McCargar: First reading was rescinded and then given second reading in the fall of 2022.
[0:26:10] Planner McCargar: And that brings us to today, which there's been a bit of a pause in the project due to elections and we had an extended referral period that went out to First Nations and agencies

[0:27:30] Planner McCargar: I'm not sure what happened there, but my sense is that it was kind of a GIS error.

[0:27:42] Planner McCargar: And then for the By-law 229, so for the land use by-law,
[0:27:51] Planner McCargar: There are just a couple of small minor amendments that are being proposed, and that's based on feedback that we received during the referral period from the Ministry of Food and Agriculture.
[0:28:07] Planner McCargar: You can see in the table on page 24, staff outlined the referral, by-law referral response, and then if that, if those comments led to any of the changes in the proposed by-laws.
[0:28:26] Planner McCargar: And I think that's it. I did include also a timeline just to kind of give a sense of where we are at in the process.
[0:28:37] Planner McCargar: So this report recommends a few amendments and then also just outlines the referral responses that we've received to date.

[0:28:55] Planner McCargar: The LTC could consider proceeding without the amendments, so no additional amendments.
[0:29:02] Planner McCargar: The LTC could choose to further amend proposed bylaw 228 and 229 and then give second reading again.

[0:49:19] Voice 15: report so um this this housing work is a bit of a journey and it is for the entire the entire housing
[0:49:27] Voice 15: uh island stress um um you know many of the islands are struggling in similar ways and um
[0:49:34] Voice 15: and the island's trust as a whole is trying to get our our ducks in a row on house so it's happening
[0:49:41] Voice 15: at the at the island stress level through the regional planning committee um and that's where
[0:49:49] Voice 15: where some work is being done to support the work that's happening at the LTC level.
[0:49:54] Voice 15: And a lot of research is happening.
[0:49:57] Voice 15: And when I say research, like I said, a lot of diving down into what's being done.
[0:50:01] Voice 15: We don't want to be doing that anymore.
[0:50:03] Voice 15: There's a lot of really good work that's been done in the past.
[0:50:07] Voice 15: We do need to, I mean, because things are changing all the time,
[0:50:11] Voice 15: we do need to, there are some facts that we need to bring to light.
[0:50:16] Voice 15: is it probably going to shift annually but it is important to get the information um but it uh it
[0:50:23] Voice 15: should not hold the process back um one of the intentions with this staff report was really
[0:50:29] Voice 15: to bring together um to reflect on all the work that has been done bring it together
[0:50:35] Voice 15: so it's it's easily accessible um for the community now but also into the future because
[0:50:41] Voice 15: all this work there's a lot being done but there's nothing that's pulled it all together
[0:50:45] Voice 15: So that was, that was one of the, that's one of the processes and purposes of this report,
[0:50:54] Voice 15: in addition to identifying some steps to move forward with housing.
[0:51:01] Voice 15: So in the nations, you know, one of the very first steps for us now with the trust in supporting
[0:51:11] Voice 15: our conciliation is to allow or to invite First Nations to make comment at the beginning of
[0:51:19] Voice 15: projects. In the past we've gone to First Nations once we've been through a process and that's
[0:51:26] Voice 15: something that we've been told time and time again is not appropriate. They want to know at the
[0:51:31] Voice 15: beginning of a process so that's one of our first steps here. Then the other one, the other thing
[0:51:39] Voice 15: that became very clear even in the outset of this of this project is that he's really wanted to make
[0:51:45] Voice 15: sure that the community's engaged in particularly the housing apc so that's one of these really
[0:51:51] Voice 15: important first steps for the community is to make sure that this report and you know other
[0:51:56] Voice 15: information will help the agency as a staff i will help the apc to find out what information we need
[0:52:04] Voice 15: to be able to go through, to look at offices of the community.
[0:52:10] Voice 15: So this report identifies some potential things to start to look at,
[0:52:14] Voice 15: and there may be others that are not captured in this report.
[0:52:20] Voice 15: The other thing, so myself and Renee spent a day on the island a few weeks ago,
[0:52:27] Voice 15: or I can't remember exactly when, it's all over, but not being here,
[0:52:30] Voice 15: not being here, it's the time.
[0:52:32] Voice 15: We spent some time with David and Sam and also got to go spend some time with Lord Meshachin up on their property,
[0:52:41] Voice 15: took a little bit there. So we went around the island a bit, looked at a few things, had a lot of good discussions.
[0:52:49] Voice 15: And one of the things that sort of emerged for me that I had some discussion with David and Sam about is that, you know,
[0:52:58] Voice 15: know, it's clear on them. And I myself to that there is housing
[0:53:04] Voice 15: that's there there's a happening that's not captured in materials
[0:53:09] Voice 15: that can't be captured by the consultant or staff person. And
[0:53:12] Voice 15: that's why we are putting in a recommendation for us to, to
[0:53:16] Voice 15: engage with them and housing action group to just capture
[0:53:21] Voice 15: that need. What so that, you know, there's a couple of
[0:53:25] Voice 15: purposes it's it's it's one to um to provide information to this process legalizing what
[0:53:32] Voice 15: the illegal circumstances that people might be existing in um but it's also looking forward and
[0:53:40] Voice 15: to the potential for funding in the future making a case or whatever it might be right without
[0:53:46] Voice 15: Without numbers, you know, you need to get the numbers in order to get the funding.
[0:53:54] Voice 15: So it's sort of just anticipating that.
[0:53:58] Voice 15: And I'm not going to guarantee that there's funding coming, but it's good to be prepared.
[0:54:05] Voice 15: So that's one of the other steps where we want to have some conversation about.
[0:54:09] Voice 15: um um a project charter is necessary for this and basically what a project charter does is it
[0:54:17] Voice 15: it's it identifies all the steps in the process and the amount of staff time that's allocated
[0:54:24] Voice 15: um so it what it will do is it'll identify um when public engagement whether you want
[0:54:30] Voice 15: the public engagement to happen you know before you hear from the abc or after the apc look for
[0:54:35] Voice 15: part and that's why i sort of left that i left it i didn't provide a project charter because i wanted
[0:54:40] Voice 15: to have a discussion of public engagement when you want to have a public engagement um and then
[0:54:44] Voice 15: and then it really identifies like the period of time that that uh that bylaws will be you know
[0:54:51] Voice 15: options will be considered decided bylaws will be drafted so it's very much uh it's just really
[0:54:57] Voice 15: identifying the technical process and right now um because i'm involved in a number of projects
[0:55:02] Voice 15: identifying staff time, we need to kind of organize the timing of things with the timing of other projects that I'm involved in.
[0:55:13] Voice 15: So it's a bit of a technical thing, but very important process.
[0:55:18] Voice 15: And again, I didn't provide that at this meeting because I thought we need to have some discussion about what the interest is with respect to public engagement and the timing of that.
[0:55:27] Voice 15: that. Um, the business case. So this is all part of the Trust
[0:55:37] Voice 15: Council process is that in order to allocate funding and staff
[0:55:43] Voice 15: time to launch projects, you need to submit each LTC if
[0:55:48] Voice 15: they're interested in doing a larger project or continue on
[0:55:51] Voice 15: larger project needs to submit business case, which will
[0:55:55] Voice 15: identify how much is needed as well as as funnily so that's that you know that's one of the
[0:56:04] Voice 15: that's that's the rule of that business case so it's kind of a again it's a sort of technical
[0:56:08] Voice 15: process thing but necessary for these larger projects and with that you know I did I mentioned
[0:56:16] Voice 15: the water availability assessment and I'll speak to that a little bit more when I talk about the
[0:56:21] Voice 15: suitable land analysis um so we're just looking at the report here like i said i you know one of
[0:56:28] Voice 15: the things i really wanted to do was really just capture with all everything that's happening in
[0:56:32] Voice 15: lander somewhere so somebody five years from now can pick it up and all they have to do is look at
[0:56:37] Voice 15: the last five years as opposed to the last 30. so i did get through that giant stack of
[0:56:44] Voice 15: of information and there's obviously a lot of passion
[0:56:48] Voice 15: and a lot of very intelligent sort of people
[0:56:52] Voice 15: who've been working on this for a long time.
[0:57:00] Voice 15: So, let's see what else do I need to point out here?
[0:57:06] Voice 15: Yeah, so that's sort of that, right?
[0:57:10] Voice 15: I don't think we'll go through it.
[0:57:11] Voice 15: And so through all of that material,
[0:57:14] Voice 15: And we've done this also at the trust-wide level, we went through, my colleagues went
[0:57:21] Voice 15: through about 50 reports and pulled out key recommendations and needs and it's really
[0:57:30] Voice 15: to make a point that a lot of things that have been said in the past are still relevant
[0:57:39] Voice 15: now and what we really need to be doing is getting it done.
[0:57:44] Voice 15: um so in terms of me i mean you're all here to understand the needs i pulled out some of the
[0:57:50] Voice 15: key ones that came out from my review of the documents clearly seeing yourselves
[0:57:55] Voice 15: our families um you know the people who work and volunteer on the islands um
[0:58:03] Voice 15: um and there's this there's also this um like i said so this hidden hidden homeless potentially
[0:58:09] Voice 15: potentially homeless. I mean, again, I mean, coming in, I don't know, I don't, I don't know, in the community, you know, what that reality is, but definitely, many of the reports have spoken to that, many people have spoken to that person here at LTC.
[0:58:29] Voice 15: The statistics tell us are a number of people in need, which means that they are paying
[0:58:36] Voice 15: well beyond what they're able to pay in their inadequate housing.
[0:58:40] Voice 15: So, you know, statistics tell us that they're 105, but those are the statistics that I've
[0:58:47] Voice 15: recorded.
[0:58:47] Voice 15: So, I'm at a higher than that, given that there's a lot out there that wouldn't be
[0:58:53] Voice 15: held by staff.
[0:58:57] Voice 15: So some of the housing needs considerations that I've identified that popped out is obviously affordable housing in any way, whether it's rental or whether it's ownership.
[0:59:08] Voice 15: Ownership feels like it's completely unattainable. However, like we're working on right now, we've developed a relationship with Habitat for Humanity.
[0:59:19] Voice 15: So that could be an option I haven't discussed, they've got different regional groups so we haven't picked up that conversation with this regional group but if that's of interest to the trustees that's something that we can certainly look at.
[0:59:40] Voice 15: Legalizing in-distance housing seems to be a real key thing for an island, and everybody's smiling and nodding, so I think that's where our focus needs to be, big time.
[0:59:52] Voice 15: And, you know, speaking to a mix of housing options, so, you know, so we legalize that.
[1:00:00] Voice 15: that we're legalizing? What are we allowing? Are they, you know, single units? Are they
[1:00:05] Voice 15: secondary suites? Are they, I can't remember, but different types of housing arrangements,
[1:00:14] Voice 15: like, you know, where you have communal kitchen, sleeping houses, sort of thing.
[1:00:20] Voice 15: You know, what is the type of housing that's being supported? There doesn't seem to be
[1:00:29] Voice 15: on any of what most of these islands um you know multi-family um big developments um
[1:00:40] Voice 15: there isn't there isn't an important so the the updating of housing is is particularly important
[1:00:46] Voice 15: this is something that i i'm learning myself um as i get into this work as i start to talk with
[1:00:51] Voice 15: um middle funders the work that i've done with um with main island is that um having really
[1:00:57] Voice 15: really understanding, the funders want to know
[1:01:01] Voice 15: that you really understand your housing need.
[1:01:03] Voice 15: I mean, we could say on all of these islands
[1:01:05] Voice 15: that there's absolutely whatever you build at,
[1:01:08] Voice 15: you know, there will be people.
[1:01:12] Voice 15: But having a clear idea of that,
[1:01:16] Voice 15: and that's the kind of information that the funders want.
[1:01:18] Voice 15: So if we can get that easily, it would be good.
[1:01:22] Voice 15: It's good.
[1:01:23] Voice 15: Again, it's looking ahead for potential opportunities.
[1:01:27] Voice 15: We're lucky, we've got Taryn, our very enthusiastic co-op student, so she's going to do a deep dive into the stats and do that quantitative piece for them, like what we've seen with stats, but that doesn't, you know, that doesn't tell the whole story, there's, like I was saying, we know that that doesn't tell the story, so what we need to know is the sort of community-based information, so working with the community to figure that out, capture that.
[1:01:59] Voice 15: So, in terms of thinking of housing, we've sort of kind of broken it down into, in the report, three questions.
[1:02:14] Voice 15: Where is it appropriate to put housing?
[1:02:15] Planner McCargar: And again, I
[1:02:16] Voice 15: mean, sometimes it organically, you know, it organically exists,
[1:02:19] Voice 15: exists and in which case we need to at least identify what additional supports those might need, because if it is in an area where there is no water, well that's not very healthy for people to be living, right? So, you know, what would it take?
[1:02:40] Voice 15: And we are at the trust-wise level, starting to do, we are doing what we're calling suitable
[1:02:48] Voice 15: land analysis, and that's basically taking all of the information that we know about
[1:02:52] Voice 15: the islands, so where the saltwater infusion is, the islands that shouldn't be destroyed,
[1:03:01] Voice 15: destroyed, where there's, like, slope challenges in an earthquake,
[1:03:12] Voice 15: boulders would fall on that sort of thing, and overlaying that on a map.
[1:03:19] Voice 15: So the data that we collect around the lake water, and we do now have the
[1:03:27] Voice 15: the recharge data for Denman Island. So what that information tells us is where on the island water is basically being captured and sort of where the best places on the island are for that.
[1:03:44] Voice 15: The water availability assessments will place another layer which looks at how much of that is used.
[1:03:54] Voice 15: So what is the ratio between how much is captured and how much is used?
[1:04:01] Voice 15: That's the additional layer.
[1:04:02] Voice 15: And that information, I mean, that may happen at a trust-wide level, but with Cabriola, Salt Spring, and Denman and Hornby,
[1:04:15] Voice 15: we want to use, like there's this next step and we are encouraging that the business cases for those islands do include that analysis.
[1:04:24] Voice 15: It may be that the Trust Council decides that they want to do it as a Trust Council project,
[1:04:31] Voice 15: and the RPC may decide that they want to put that forward.
[1:04:35] Voice 15: But I think if it exists in all the business cases, then we'll find a way to make it happen.
[1:04:40] Voice 15: And it is valuable, very valuable data.
[1:04:42] Voice 15: We've used that in the case of Maine, where we created this flexible housing regulation,
[1:04:52] Voice 15: regulation which allows for an additional or additional or more than one additional
[1:04:58] Voice 15: larger uh larger lots of smaller units within a maximum floor area of all instead of having one
[1:05:09] Voice 15: three thousand square foot home you could have three one thousand um and what so what that
[1:05:17] Voice 15: analysis has enabled us to do is just identify the areas which if we're going to say they're
[1:05:22] Voice 15: allowed to happen you know you know outright in some places we're not going to put them we're not
[1:05:28] Voice 15: going to support it where there isn't any water you don't really want to be putting more people
[1:05:33] Voice 15: where they're not um and other things or where it's going to be in on salt spring they've tried
[1:05:44] Voice 15: to they're trying to put through a bylaw where they're allowing additional liquids everywhere
[1:05:50] Voice 15: and that's causing a lot of tension in the in the community because they recognize that
[1:05:56] Voice 15: really shouldn't be putting more people and again when i talk to when i talk about putting more
[1:06:02] Voice 15: people it's really creating the opportunity for um for additional dwellings whereas um those the
[1:06:12] Voice 15: active building of the following is extremely costly so it's not so if you if you if you
[1:06:19] Voice 15: provide the opportunity for secondary streets or additional dwellings you're not going to see
[1:06:25] Voice 15: a huge influx of building because these things are very very expensive to build
[1:06:31] Voice 15: um in the south the the capital of the hill district is providing a developing a program
[1:06:37] Voice 15: that we may be able to take advantage of if we get funding from the federal government
[1:06:43] Voice 15: um to provide subsidies to build these units so so in the case of denman if if there was an
[1:06:51] Voice 15: an opportunity for funding for this kind of thing, the the
[1:06:55] Voice 15: biology allowed, you cannot take the funding for a lab to build
[1:07:00] Voice 15: housing, or to improve housing. And so the bulk of this report
[1:07:11] Voice 15: is really identifying a number of OCD and land use bylaw
[1:07:14] Voice 15: options, things to start looking at in terms of changing changes.
[1:07:19] Voice 15: And these have been, again, developed from having a good look at a lot of the things
[1:07:24] Voice 15: that have already been recommended through the reports, as well as going through the
[1:07:30] Voice 15: Land Use By-law and the OCP.
[1:07:32] Voice 15: So I mean, the OCP already speaks, there is housing in both, and the OCP actually speaks
[1:07:41] Voice 15: very directly to this the idea of um supporting more affordable affordable housing options um
[1:07:50] Voice 15: with a in consideration of environmental implications in general so that information
[1:07:56] Voice 15: is already in that so these these recommendations support some of what's already in there and there
[1:08:03] Voice 15: will also be need to be changes to accommodate some other options and alternatives um and i
[1:08:11] Voice 15: don't know if you want me to go through these um or if you're happy if there are particular
[1:08:17] Voice 15: questions that you have about the options thank you i
[1:08:23] Trustee Graham: appreciate your your capturing the essence
[1:08:26] Trustee Graham: um there's very little time in colorado for this and i presume that's because we're not we're not
[1:08:32] Trustee Graham: making some big decisions here we're moving this forward through our housing advisory planning
[1:08:37] Trustee Graham: commission uh that was our intent of creating
[1:08:41] Trustee Graham: that was that the bulk of the work the time that
[1:08:44] Trustee Graham: was going to be spent looking at the recommendations that flow through from the housing study and then
[1:08:50] Trustee Graham: the accumulated data that that um has gone through and it just gives the hapc a starting point
[1:09:00] Trustee Graham: to really dive, dig, twist, turn, remove and pack.
[1:09:07] Trustee Graham: So just to make some comments, I'd be happy to.
[1:09:17] Trustee Graham: First of all, I wanna just address the fact
[1:09:20] Trustee Graham: that we're getting some feedback from people on Demand
[1:09:24] Trustee Graham: who feel the trust has lost its focus
[1:09:27] Trustee Graham: on preserve and protect and is moving into a development
[1:09:31] Trustee Graham: housing for everybody, population explosion.
[1:09:34] Trustee Graham: And I wanna say that sounds like it's a fear-based reaction
[1:09:39] Trustee Graham: and it's not based in reality,
[1:09:40] Trustee Graham: but it's a fear-based that is real for those people.
[1:09:45] Trustee Graham: So let's just take two minutes and look at where we're at.
[1:09:48] Trustee Graham: On Denman right now, we have almost 25% of our land
[1:09:51] Trustee Graham: protected through either provincial regulation,
[1:09:54] Trustee Graham: through the largest provincial park in the Gulf Islands.
[1:09:57] Trustee Graham: A, Denman Conservancy has done an amazing job of capturing and having lands under their control.
[1:10:06] Trustee Graham: So that's 25%, and that's actually quite high on the trust.
[1:10:11] Trustee Graham: If you look at all the other islands, we were at about 15% when I was a trustee 10 years ago, so we've improved quite a lot.
[1:10:18] Trustee Graham: What's left? Well, a whole bunch of land is in the agricultural land reserve, and that adds another layer of protection.
[1:10:26] Trustee Graham: Well, some would say, well, farmers could just wipe everything out and grow food.
[1:10:31] Trustee Graham: And that's true. I live on what was once a farm.
[1:10:35] Trustee Graham: 30, 40 years ago, it was a forest because the farm was no longer profitable and became forest.
[1:10:41] Trustee Graham: Then it was whacked as a resource and we were left with stumps.
[1:10:47] Trustee Graham: I arrived 30 years ago. I now walk through a beautiful recovering forest.
[1:10:51] Trustee Graham: So nature, given an opportunity, will rebound.
[1:10:56] Trustee Graham: So having a farm doesn't stop protection.
[1:11:00] Trustee Graham: Concrete stops protection.
[1:11:02] Trustee Graham: Industrial waste stops protection.
[1:11:04] Trustee Graham: Open mining stops protection.
[1:11:07] Trustee Graham: So we're not really in that bad a position.
[1:11:11] Trustee Graham: Let me just continue on this idea that we're straying from preserve and protect.
[1:11:15] Trustee Graham: Every time we look at adding something to the land,
[1:11:18] Trustee Graham: we are very cognizant of what is the impact and how can we mitigate the impact but you're never
[1:11:24] Trustee Graham: going to make humans uh non-impactful we are a messy species we are just that's just who we are
[1:11:33] Trustee Graham: so other than taking everybody off the island and turning it into a preserve which is not going to
[1:11:38] Trustee Graham: happen um this is this is our reality we will have an impact our job is to minimize that impact and
[1:11:46] Trustee Graham: and make sure that we're doing the best job that we can um the concern that i hear that people say
[1:11:52] Trustee Graham: oh not
[1:11:52] Trustee Graham: another study well let's just put that in context the reason that we need to have data
[1:11:58] Trustee Graham: is if we're going to go after government funding and there's a lot of money being put forward by
[1:12:04] Trustee Graham: the fence and by the province and maybe even some of the regional district they require their they
[1:12:11] Trustee Graham: they require the studies.
[1:12:14] Trustee Graham: You don't even get to play in the game
[1:12:15] Trustee Graham: unless you've got the tools that they wanna look at.
[1:12:18] Trustee Graham: So it's important that we at least allocate some money
[1:12:22] Trustee Graham: to get those studies.
[1:12:24] Trustee Graham: It's not gonna stop or slow down what we're doing right here
[1:12:28] Trustee Graham: looking at the recommendations from the housing review
[1:12:32] Trustee Graham: and the data that's been accumulated over at least 30,
[1:12:35] Trustee Graham: 40 years.
[1:12:36] Trustee Graham: That's not gonna, it's just adds a possibility
[1:12:39] Trustee Graham: of getting on site pumping.
[1:12:42] Trustee Graham: and it can't, you know, who doesn't want to spend
[1:12:45] Trustee Graham: somebody else's money and build some housing here?
[1:12:46] Trustee Graham: That would be great.
[1:12:48] Trustee Graham: Let's face it, Dem and Green's not gonna happen
[1:12:50] Trustee Graham: without outside funding.
[1:12:52] Trustee Graham: Pepper Lane's not gonna be reinvigorated
[1:12:55] Trustee Graham: without outside funding.
[1:12:57] Trustee Graham: So unless, I don't know anybody that's ready
[1:12:59] Trustee Graham: to write a check for $8 million or $6 million.
[1:13:02] Trustee Graham: I don't know who those people are.
[1:13:05] Trustee Graham: So outside funding is important.
[1:13:08] Trustee Graham: At the same time, we have an example with Coho,
[1:13:11] Trustee Graham: No, no outside funding, self-funded.
[1:13:15] Trustee Graham: So it is possible to do it ourselves.
[1:13:18] Trustee Graham: It's just why lose the opportunity to have outside funding.
[1:13:24] Trustee Graham: Water is the limiting factor, obviously,
[1:13:27] Trustee Graham: but there's very little discussion about framework capture.
[1:13:32] Trustee Graham: And in the current climate reconfiguration of the planet,
[1:13:39] Trustee Graham: it and we're we're in it right now who knows how long this drug is going to last relying on
[1:13:45] Trustee Graham: groundwater is scary because it's crappy most anybody with a deep well will tell you they
[1:13:50] Trustee Graham: have to do a lot of work to get that water to be potable where it's drinkable but the rain does
[1:13:55] Trustee Graham: fall in the winter my goodness it really does and so we need to start shifting our ideas about
[1:14:02] Trustee Graham: punching holes in the dirt and really thinking about capturing rainwater and coho believe it
[1:14:07] Trustee Graham: or not have done all of their drinking water and their household water comes from the rain
[1:14:13] Trustee Graham: and they didn't know that they had their zoning allowed them to punch the hole in the ground and
[1:14:18] Trustee Graham: disperse that land that water to the 15 houses but they looked at the cost and they looked at
[1:14:24] Trustee Graham: the cost of developing their own cisterns and having more control of their individual water
[1:14:28] Trustee Graham: needs on their own conservation mindset and they said let's go with let's go with capturing the
[1:14:34] Trustee Graham: brand. So there's a blueprint of a really very interesting and very progressive idea.
[1:14:42] Trustee Graham: Brain capture. How do you beat the price of land? Well the only way I can see is to share the land.
[1:14:53] Trustee Graham: That's the only way. So instead of one person owning that land, a bunch of people could own
[1:14:57] Trustee Graham: the land. Or one person renting that land, a bunch of people rent that land. So we're talking about
[1:15:01] Trustee Graham: about land share a lot, the ability for something to happen.
[1:15:04] Trustee Graham: But that main island that distributed square footage
[1:15:07] Trustee Graham: is exactly a land share tool.
[1:15:10] Trustee Graham: So that's great.
[1:15:13] Trustee Graham: And the legalizing of the current housing options on Denman,
[1:15:20] Trustee Graham: this is something that should have happened
[1:15:21] Trustee Graham: a long, long time ago.
[1:15:23] Trustee Graham: Like islanders have been looking after islanders forever,
[1:15:26] Trustee Graham: for as long as I've been on this island.
[1:15:29] Trustee Graham: force them to do that illegally is cruel it causes stigma it causes fear and it removes
[1:15:36] Trustee Graham: opportunities for people who would like to do that but they don't want to break the law
[1:15:41] Trustee Graham: so this is this is a really powerful thing that we need to look at so those are those are kind
[1:15:46] Trustee Graham: of drawback i'll be happy to make those recommendations when we're ready yeah um
[1:15:56] i mean i would absolutely echo a lot of what david said to say i
[1:15:59] I think land sharing is a super important part of this.
[1:16:02] I think housing agreements are a very powerful tool
[1:16:05] to achieve that and to build that
[1:16:08] into what's happening on any given property.
[1:16:11] I'm very wary of looking at subdivision
[1:16:15] because subdivision,
[1:16:19] what subdivision does is it doubles the amount
[1:16:22] Trustee Borthwick (probable): of plots they can sell.
[1:16:25] Trustee Borthwick (probable): So what it does is by increasing the options

[1:17:47] And we have $18,000 put aside for our housing project that is part of this project.

[1:24:10] Voice 15: It's all got to do with what changes we're making here to facilitate and support the housing.

And what it does is it tells the next trust council, the next LTC, there's unfinished business, it allows you to allocate time.

[1:27:35] hey we're all here to just talk let's not play off the handle and do we have a process for
[1:27:40] deciding who's talking that's all that needs to be done

[1:28:56] exists it's it's effectively free we just need to legalize it that's the that's the first step
[1:29:03] and that's going to make a huge difference right off the bat then we can start to get fancy with
[1:29:08] it then we can start thinking about how are we going to develop things how are we going to make
[1:29:11] it possible for another co-owner you know how are we going to make it attractive for someone to
[1:29:16] to offer land to use in that way.

[1:33:40] Voice 3: hear that the staff were here discussing housing with people but the denman island housing action
[1:33:45] Voice 3: group was not contacted it's good to see us mentioned in the report but again why
[1:33:52] Voice 3: have we not been contacted by staff to have these discussions that's good
[1:33:57] Voice 3: concerning to see us mentioned but not engaged and yet you were here engaging
[1:34:06] Voice 3: so that's kind of insulting I've been working on this for over two years the

[1:50:49] Voice 5: So the world is changing.

[1:51:52] Voice 5: And we've talked about that second generation, that third generation that we're moving into,
[1:51:57] Voice 5: to people who are still unhoused, and it's really painful.
[1:52:03] Voice 5: So when I hear things like, you know,
[1:52:06] Voice 5: one of the obstacles to moving forward, you know,
[1:52:09] Voice 5: it shouldn't be an obstacle, but I see, you know,
[1:52:12] Voice 5: why am I concerned as an environmentalist and as a mother
[1:52:16] Voice 5: when I hear, you know,
[1:52:17] Voice 5: that there's a suitable land use analysis?
[1:52:20] Voice 5: Why doesn't that make me feel excited, you know,
[1:52:23] Voice 5: that we're working together?
[1:52:24] Voice 5: And so I think it's simply not because I'm against
[1:52:28] Voice 5: against a review of suitable land analysis but because i'm frightened again i go right back into
[1:52:36] Voice 5: that reptilian fright around who's defining suitable and how do we look at it so you know
[1:52:44] Voice 5: is it happening in a way that's going to move us forward or is it happening in a way that's going
[1:52:50] Voice 5: to obstruct movement so when you were speaking to that the first thing that came to mind was
[1:52:55] Voice 5: well you know on the ridge where they put the people and i thought oh my gosh if that suitable
[1:53:01] Voice 5: land use um overlay was used in terms of decision making cocoa wouldn't be there right and so one of
[1:53:09] Voice 5: the reasons why coho had to make the concessions that they did was to kind of tease into bylaws and
[1:53:16] Voice 5: be accepted by um trust and i remember at the time when they were talking about okay there's
[1:53:22] Voice 5: going to be no cars in the upper area we're going to only rain water collection and we're going to
[1:53:26] Voice 5: you know put everybody in a horseshoe so there's you know 98 groups whatever it is but everybody's
[1:53:31] Voice 5: going to be in 16 lots right beside each other and i thought oh that's really progressive and
[1:53:36] Voice 5: beautiful but really all of those decisions were shaped on trying to get permission and that's
[1:53:42] Voice 5: so i just want to say that what that proves is twofold one is that when you allow for a
[1:53:51] Voice 5: cracking the wall the water finds its way through and and and and built a new channel and so that's
[1:53:58] Voice 5: really what i'm looking for is ways of building um new channels for denman but looking at historical
[1:54:05] Voice 5: success and you know as partly housing action committee we've looked at all kinds of things
[1:54:11] Voice 5: so when i see any of successful examples of people working together to build safe and
[1:54:16] Voice 5: sustainable communities whether that's um health and harm reduction or whether that's
[1:54:20] Voice 5: environmental sustainability or whether that's community empowerment
[1:54:24] Voice 5: through business and opportunities to move forward that we've seen
[1:54:28] Voice 5: in CoCo. So what I would say here is when I hear people
[1:54:33] Voice 5: specifically in ERISA speaking about statistics and numbers and the importance of that
[1:54:37] Voice 5: required for allocation of funding, yeah, that's
[1:54:43] Voice 5: awesome. And we're going to need that funding. And like you say, David, we are going to need
[1:54:47] Voice 5: those numbers. However, the
[1:54:51] Voice 5: housing action person save time right save time and money let's make it legal to exist and find
[1:55:01] Voice 5: ways to empower solutions that are super super
[1:55:04] Voice 5: basic so instead of getting caught up in how are
[1:55:07] Voice 5: we going to control population we look more at how are we going to manage resource and how are
[1:55:13] Voice 5: we going to support the reduction of harmful land use and so I look at things like solutions based on super
[1:55:22] Voice 5: duper basic land use commitments around water and around sewage and that's
[1:55:30] Voice 12: about it you know
[1:55:32] Voice 5: like I actually am a trained environmental technologist I went to school for environmental
[1:55:36] Voice 5: science. I'm a park operator. I work for BC Parks. I'm passionate about our rural community
[1:55:44] Voice 5: and keeping it that way. I'm also the person that goes out, like I was just telling David
[1:55:49] Voice 5: yesterday, my morning, which I did not have extra time, was to go and visit somebody who's
[1:55:55] Voice 5: near Cameron Lake, who went there as a refugee from Denman because she had nowhere and she was
[1:56:01] Voice 5: pushed off and she was desperate. And now she's near Cameron Lake in a trailer, four kilometers
[1:56:06] Voice 5: from the fire that's coming in with these other bombers flying over her house and she's just gone
[1:56:14] Voice 5: from a trauma situation here and now all of a sudden is in a trauma situation there with no
[1:56:22] Voice 5: no no no options she's just sobbing to me you know in a beautiful way in a heartfelt way in an
[1:56:29] Voice 5: honest way where do i go what do i do and this is a woman like i'm 50 right this is a woman who's
[1:56:37] Voice 5: my peer and has never had a home because she's been trying to live on denman and and has a
[1:56:43] Voice 5: community here and that's safe to hear and raise kids here so um i
[1:56:49] Planner McCargar: would just say
[1:56:50] Voice 5: that there are
[1:56:50] Voice 5: so many working houses and if we reduce our expectation around control to a place that
[1:57:01] Voice 5: really meets our bottom line around providing safe affordable and permanently stable
[1:57:08] Voice 5: able to get in and keep the foundations that were legal, I think we'd really save a lot
[1:57:15] Voice 5: of money and time, and then we'd continue to work on the other pieces that are so important
[1:57:21] Voice 5: around acquiring funding and making inroads with government, and I love the focus idea
[1:57:28] Voice 5: of thank you plans, and I want to make sure that those are shifted in a way that's empowering

[1:59:19] Trustee Borthwick (probable): a lot of nuance and a lot of subtlety in terms of getting the information that we need to make informed decisions, but not, you know, there's a lot of that information, which by necessity cannot be delivered to a government.
[1:59:33] Trustee Borthwick (probable): Again, one of the utilities I hope to see from ABC is that they have the tools and TLA and the various bodies that exist on demand.
[1:59:46] We have the ways to make sure that we're in the legal hope to ask them.

[2:00:04] on how we can cater to situations that we can't
[2:00:10] and shouldn't directly seek to monitor
[2:00:14] with a person walking onto that property and examining it.
[2:00:16] And that's a very complicated question,

[2:00:22] and the other groups have suggestions on.

[2:00:28] that we can capture in a lot so that it's protected um and that that's going to be complicated i don't

Trustee Graham reported:
that he attended a Financial Planning Committee meeting where the unaudited
March 31, 2023 financial statement was considered and approved to go
forward to the next Trust Council meeting; and
that hard copies of the Denman Island Official Community Plan (OCP) and Land
Use Bylaw (LUB) are now in the Dora Drinkwater Library for the community’s
information.
Trustee Borthwick reported on a Ferry Advisory Committee meeting with BC Ferries to
discuss summer ferry plans. The meeting was well attended by Denman Island
community members.
4.2 Chair's Report
Chair Maude commented that he is honoured to be Chair of the Denman Island Local
Trust Committee (LTC) and that he enjoys the community.
He described incidents of tree cutting by Ministry of Transportation and Infrastructure
(MOTI) that are the subject of discussions on other islands. He noted that improved
communications and work on the protocol agreement would be advisable.

5. PUBLIC COMMENTS
Any diversion or planning that would deter or delay moving forward with the idea of
affordable housing on Denman Island is not necessary or needed.
Housing is critically needed and affects everyone; forward thinking is needed; without
the well-being of people, this community will disintegrate with gentrification.
Clarification was requested as to where the referral to the Housing Advisory Planning
Commission (HAPC) discussion appears on the agenda. Request was made to include the
Siting and Use bylaw enforcement issue with the HAPC referral.
Looking into the future, status quo means things will be worse.

Staff will follow-up to ensure that all HAPC members have received the documents
as listed in the April 25 activity.
A Trustee recognized the importance of initiating a dialogue between the LTC
members and K'ómoks First Nation and asked that the April 4 activity to initiate the
process be expedited.

10. LOCAL TRUST COMMITTEE PROJECTS
10.1 Denman Island Farming Regulation Review Project - Staff Report
Planner McCargar presented an overview of the Staff Report that provides background
on the project, asks the LTC to consider minor amendments to Proposed Bylaw Nos. 228
and 229, and provides information on referral feedback received to date.
By general consent the meeting recessed at 10:42 am and reconvened at 10:55 am.
Discussion included the following points:
The Staff Report proposes that the LUB Schedule B Zoning Map be added to a
future projects list to ensure the approximately five properties that are
designated Agriculture in the OCP and are in the ALR are zoned correspondingly.
A Trustee inquired if that might be incorporated into the amendments being
considered at this time.
o Staff responded that it would be possible; however, it would extend the
timeline for completion of the project by a few months.
The process that gives different numbers to bylaws and their amending
documents was explained in response to a Trustee’s proposal that an alternate
method might be considered to make it easier for the public to understand.
A Trustee indicated that while he is willing to participate in the vote on the
Farming Review recommendations at this time, he expressed a desire to
understand the history of the project in a more complete manner. A meeting
with staff will be arranged.

10.2 Denman Major Project - Housing Review Project Preliminary Report
Planner Chadwick presented the Staff Report that provides project background, options,
and potential next steps for LTC consideration.
Trustees’ comments included the following:

Concerns heard that the LTC is moving away from the Preserve and Protect
mandate toward development were addressed;
Public concern has been expressed regarding additional studies being
undertaken for this project; however, funding requires information provided
through studies and will not delay recommendations and review of the data;
Water needs to be considered with rainwater capture encouraged;
Land share concept can relieve some land price pressure; and housing
agreements are an important part of this discussion;
Legalizing current unlawful housing in cases where housing is providing safe and
secure accommodation was supported;
Caution regarding use of subdivision to address housing needs was expressed as
this can lead to selling of smaller parcels and an increase in land price.
Staff solicited input as to preferences for community engagement on the project:
The use of a professional facilitator was not felt to be necessary;
An interim report by the HAPC at the July LTC meeting would be useful.
Chair Maude opened the floor for public comments:
The human right to housing is being delayed and denied; this project is into its
second year. A report needed for potential funding does not need to be
included in the Housing Bylaw Review project. An updated Housing Needs
Assessment should be done separately from this project. Reports of actions
being taken by other rural areas to address housing, including tiny home parks,
would be useful. Proposals for housing agreement templates would be helpful.
The LTC was asked to stay focused on the Housing Bylaw Review to expedite
action.
Coho Housing is an example of living with water limitations, conserving water
and the forest by using water cisterns which is the way of the future. Will there
be a count in this review of those experiencing homelessness?
o Staff responded that the LTC is being asked to consider requesting the
Denman Housing Action Group (HAG) to help gather community based
information relevant to the understanding of the housing need.
The LTC was encouraged to work with community groups including the HAG to
gather information to produce a report that might be used for potential funding
possibilities. These groups have been successful with funding opportunities
based on information already existing.
Concern was expressed with the use of the Suitable Land Analysis tool identified
in the Staff Report as who defines “suitable” is questionable and it might hinder
advancement of the project. The LTC was encouraged to legalize currently
unlawful housing and create water and sewage solutions that are basic, safe and
legal.
Discussion continued with the following noted:
A Trustee commented that the Suitable Land Analysis would be a useful tool;
however, cannot be the only tool utilized to determine the suitability of

residential use. Additionally, he suggested that the HAPC might provide options
for legalizing housing that does not include onsite inspections.
Staff advised that an updated Housing Needs Assessment would not diminish
the staff time focusing on this project.
A Trustee questioned the inclusion of Short Term Vacation Rental (STVR) review
with this project, stating his understanding that this had been eliminated from
this project previously.
o Staff responded that this was included in the business case submitted to
Trust Council for funding; however, confirmed that the project will not
be focusing on STVR issues. Technical amendments can be addressed in
the process.
A Trustee recognized that for many years housing has been an unresolved issue
on Denman Island and confirmed this LTC’s commitment to the issue of housing.
He asked the community to be patient with the process that does take time.

that the Denman Island Local Trust Committee request that staff send a letter to
relevant First Nations to ask how they would like to be engaged in the development of a
housing action plan for Denman Island.

11.1 Letter dated May 6, 2023 from S. Carballeira regarding Re-Classification of Application
A Trustee spoke regarding the letter which describes the requirement for a subdivision
process to accomplish what is a sale of property and lot line adjustment and informs the
LTC that evidence he has provided to staff is not being accepted as evidence that the
property is designated legal non-conforming status with the onsite buildings pre-dating
the formation of the Islands Trust.
A Trustee proposed that the LTC might address the legal non-conforming issue as OCP
Policy 30, first bullet allows that the LTC may consider bringing into conformity dwelling
units that were in existence but did not comply with the policies at the time of its
adoption in 2009, provided that the applicant provides written evidence to the
satisfaction of the LTC that the dwelling units were constructed prior to the date of
adoption of the OCP.
Discussion of the matter followed:
A letter provided by the applicant, written by Kathy Rieder, was provided
electronically for the LTC’s consideration.
Trustees considered the information provided in this letter to be satisfactory
evidence that the cottage and main house of the subject property were in

existence in 1973, and suggested they have adequate information to vote on
their acceptance of the evidence at this time.
Trustees were advised to defer their decision by Regional Planning Manager
Jamurat to allow time for staff review, noting that the Planner assigned to this
file is not in attendance and in consideration of the application process that is
necessary to advise a response to MOTI.

that the Denman Island Local Trust Committee request staff to consider Denman Island
Official Community Plan Policy 30 regarding applicant Steve Carballeira’s subdivision
application number DE-SUB-2022.1 and the particular aspect of the existing secondary
dwelling and its age of construction with regards to the letter Kathy Rieder submitted to
Steve Carballeira and the opportunity for the Local Trust Committee to vote on whether
the evidence is satisfactory.

It was pointed out that the Density Bank numbers are not correct and are in need of updating in
the Standing Resolutions report and elsewhere. It will be difficult for the HAPC to consider their
Housing Review referral without updated information and staff was requested to expedite the
correction of the information.
