[0:03:16] Voice 12: Galliano LLC held a public hearing for Chris Martin.
[0:03:20] Voice 12: It was held by us on May 6 at the Lyons Hall.
[0:03:26] Voice 12: Also in May, Galliano's trust hosted a watershed security strategy session.
[0:03:32] Voice 12: as part of the Island Trust's
[0:03:34] Voice 12: fresh water sustainability strategy.
[0:03:36] Voice 12: It was highlighted that watershed security
[0:03:39] Voice 12: and fresh water sustainability projects
[0:03:41] Voice 12: are critical to understand those limits
[0:03:44] Voice 12: and climate change impacts.
[0:03:47] Voice 12: So Galliano Maze brings us Roots of Pericastweed,
[0:03:53] Voice 12: provides a great opportunity for us
[0:03:55] Voice 12: to review our emergency plans.
[0:03:59] Voice 12: Some of the problems that we face
[0:04:00] Voice 12: in our Gulf Islands are wind storms,
[0:04:05] Voice 12: power outages, wildfires, earthquakes. Your plan should include where your family needs
[0:04:12] Voice 12: an emergency. If you have pets or farm animals that have to be moved or taken care of,
[0:04:18] Voice 12: they're not three to more than the last that we still need. The Galleon Emergency Program is a
[0:04:25] Voice 12: volunteer-run program. Please consider joining the program. There are seven different roles
[0:04:33] Voice 12: that are available and then he will provide some training there will also be a new flyer

[0:05:23] Voice 10: harbor and when the japanese left the island you know there's four families here up until that
[0:05:32] Voice 10: point there right here it happened the other one is if you look at a lot of the names they're
[0:05:39] Voice 10: global first nations names and they attended the school because their parents at the time
[0:05:47] Voice 10: built this school so they wouldn't have to attend the residential school on canal island and um
[0:05:56] Voice 10: you know that's you think about how many people have affected you look at those names and think
[0:06:01] Voice 10: about how many people have affected um you know that's it's amazing to think that they had the
[0:06:09] Voice 10: um the will and the fortitude to pick that up and and to save those kids from that experience
[0:06:18] Voice 10: um one of the names that you see up there a lot is crocker and um i'm really pleased to um have
[0:06:29] Voice 12: Michelle Crocker here from the Connecticut Nation and so I'm going to turn my time over to Michelle.

[0:06:39] Voice 12: I'm Michelle Crocker and I am Edwin Crocker's oldest daughter. I'm one of 11 and my grandfather
[0:06:49] Voice 12: was Arlie Crocker and he had 17 sisters and my dad had 11. There's like 250 Crockers from this island
[0:06:58] Voice 12: alone and we have been completely bypassed by the island's trusted completely so i want to
[0:07:04] Voice 12: say that you're not in post-sailing territory you're in an elegant territory this is my
[0:07:11] Voice 12: land and not only do we have those families from this end of the island we have the georges
[0:07:17] Voice 12: the ellards the elliots the joes the forays the banes the browns and peters all of these people
[0:07:26] Voice 12: are still descended here there's lots of people here now i don't know if you have to drag in 300
[0:07:31] Voice 12: indians just pretty that we are from here i've been completely bypassed on any sort of violence
[0:07:36] Voice 12: trust issue so i have to put that complaint forward one of the people that have been
[0:07:43] Voice 12: completely disrespected on this island was right steven who is a crocker descendant and
[0:07:49] Voice 12: owned land here he was driven all down we could say we had a positive conclusion to that
[0:07:54] Voice 12: that particular issue but it was not positive it's lucky so i i just have to say these things
[0:08:00] Voice 12: because i've asked my band to put in a judicial review of island strength because of how we've
[0:08:08] Voice 12: been treated on this island and it goes deep how many years has this been going the 70s
[0:08:14] Voice 12: there was supposed to be an assessment and an evaluation who assessed and evaluated this trust
[0:08:20] Voice 12: us and every five year review did that ever happen so i think that we need to and my i'm just more
[0:08:28] Voice 12: than from the native side of this island my grandmother was a schofield my mother is a
[0:08:33] Voice 12: schofield cook descendant cook's farm and the conservancy property is also connected and we're
[0:08:40] Voice 12: related to everybody on this island so i just need to bring that forward for your information
[0:08:47] Voice 12: for you to discuss after the fact however you want to do this but i've asked now to move forward
[0:08:53] Voice 12: with this and now that you know we're slowly making head roads into being noticed but you're
[0:08:59] Voice 12: in inelegant territory not wholesale just so you can thank you thank you michelle

[0:09:57] Voice 3: in preparation for june trust council which is next week on on gabriola and uh
[0:10:04] Voice 3: looking forward to actually having the trust council meetings out on islands again
[0:10:08] Voice 3: in for the time in about i guess it was mark 2020 on the salt springs last time we actually met
[0:10:14] Voice 3: on an island so lots of this zoom technology and and it's it's uh it's nice that we have that
[0:10:22] Voice 3: option but there's nothing like actually meeting in person on the islands if
[0:10:27] Voice 12: you have those people
[0:10:28] Voice 12: coming like this in sanemo or any of those i
[0:10:32] Voice 3: believe there are some some elders from sanemo

[0:10:36] Voice 3: gabriel seems to have a pretty as far as it goes uh seems to have a pretty
[0:10:43] Voice 3: regular contact and then a decent relationship going going
[0:10:47] Voice 12: on there i think certainly better
[0:10:48] Voice 12: than a lot of than a lot of the islands have yeah um so

[0:10:59] Voice 3: from uh very electoral area director brent today um so that takes us right into the first
[0:11:08] Voice 3: town hall and question period so just remember remind everyone um keep it brief i i will deploy

[0:11:27] Voice 3: and to be respectful speak to speak to the issues not personalities and that uh ideally that we're
[0:11:36] Voice 3: addressing the business of the local trust committee and not things well out of our
[0:11:41] Voice 3: jurisdiction so with that i'm going to look for two hands of people who'd like to
[0:11:46] Voice 3: to ask questions or address a local trust meeting.

[0:12:01] Voice 12: and I just would like things that the trust deals
[0:12:06] Voice 12: with to be fair.
[0:12:07] Voice 12: And one of the things that stops things from being fair
[0:12:10] Voice 12: is ambiguity in the rules, such as we understand
[0:12:14] Voice 12: that we need to with the subdivision that we're proposing we'll need to donate to the affordable
[0:12:21] Voice 3: housing which i have absolutely no problem with but there's no mention anywhere in the trust
[0:12:27] Voice 3: in the bylaws about how much needs to be donated and if there's any difference
[0:12:34] Voice 12: between how much
[0:12:34] Voice 12: needs to be donated from the amount of the donation to
[0:12:40] Voice 3: the affordable housing comes from
[0:12:41] Voice 3: from when you're increasing, say, from a four to one
[0:12:43] Voice 3: that doesn't allow four penny dwellings
[0:12:46] Voice 3: to, say, in our proposal,
[0:12:48] Voice 3: we wanna have five dwellings in the end,
[0:12:51] Voice 3: and the trust is asked, the staff is asked
[0:12:53] Voice 3: if we need to have seven.
[0:12:56] Voice 3: But I don't know how much needs to be donated,
[0:13:00] Voice 3: and that's nowhere near bylaws,
[0:13:02] Voice 3: so depending on
[0:13:02] Voice 12: the scale of the different subdivisions,
[0:13:05] Voice 12: there's complete ambiguity,
[0:13:07] Voice 12: and that can lead to favoritism and other things
[0:13:10] Voice 12: because it's just not started so i would like things like that to be a little more sold out
[0:13:16] Voice 12: thanks okay thank you for that um i was just going to check in with
[0:13:21] Voice 12: the comment on um yeah we did receive your email this morning and i'll have to have that
[0:13:29] Voice 12: checked with you later on so when we typically are historically with f1 properties they have
[0:13:36] Voice 12: been re-zoned in a number of ways. One is what you're doing which is the 75% which is donated
[0:13:46] Voice 12: and then the 25% of that land is then re-zoned to rural residential and through that process there
[0:13:54] Voice 12: was usually a requirement for a community benefit. In the past for these 75-25 re-zonings
[0:14:04] Voice 12: where it results in a rural residential zone in the past it's been that at least one of the
[0:14:12] Voice 12: rural residential lots should be donated towards affordable housing so that would be either that
[0:14:18] Voice 12: lot would be reserved for affordable housing or the money from the sale of
[0:14:22] Voice 12: that lot would go to
[0:14:23] Voice 12: community housing now another major reason an f1 lot is to um rezone it from f1 to f3
[0:14:32] Voice 12: which would allow one dwelling unit but the majority of that lot would have to be registered
[0:14:38] Voice 12: or a sample forestry covenant would have to be registered and through that um avenue um
[0:14:46] Voice 12: affordable housing has never been a requirement and so we've only been a requirement to 75 25
[0:14:51] Voice 12: option it is up to the ltc to consider that but that's how your application is different from
[0:14:57] Voice 12: from others that perhaps are on the agenda.
[0:14:59] Voice 12: They're going to go from F1 to F3,
[0:15:03] Voice 12: and then your application is doing primarily the 75-25
[0:15:08] Voice 12: from my understanding.
[0:15:09] Voice 12: My point is that it's just not clear
[0:15:12] Voice 12: between how much we need to donate compared to CRD,
[0:15:16] Voice 12: who is basically creating more.
[0:15:19] Voice 12: So it's not clear,
[0:15:21] Voice 12: and I think that lack of clarity is not helpful.
[0:15:27] Voice 12: so i think it would just be good to know how much did we need to donate
[0:15:31] Voice 12: for example um if we had uh then utility or
[0:15:36] Voice 10: whatever we call it ocean front how much
[0:15:42] Voice 10: would we need to donate that or
[0:15:45] Voice 3: do we need to donate all of it and
[0:15:47] Voice 3: does it matter if we create
[0:15:47] Voice 3: 50 lots or just one box and it's always the same it just fell out so i think that's all yeah and
[0:15:53] Voice 12: each application is looked at on its own merits and then the ltc makes that decision so there's no
[0:16:00] Voice 12: template if you would of how much exactly you need to donate it's really up to the ltc to figure out
[0:16:04] Voice 12: if they're satisfied that whatever you're donating or contributing satisfy the requirement for
[0:16:10] Voice 12: community benefits yes um i would just like to say that when we hear these land donations that have
[0:16:20] Voice 12: have to be sent back into rezoning.
[0:16:27] Voice 12: They should be coming back to Penelope First Nation,
[0:16:29] Voice 12: first and foremost.
[0:16:31] Voice 12: And we will be working on it.
[0:16:33] Voice 12: Also, proposed bylaw amendment
[0:16:38] Voice 9: on
[0:16:40] Voice 9: as living in their traditional territory
[0:16:50] Voice 9: of indigenous family lineage.
[0:16:52] Voice 9: I would support this

[0:16:55] Voice 9: the amendment. I think it's very important.

[0:17:05] Voice 12: would like to remind everyone that the 75-25 is not ambiguous. It seems there's actually a bylaw that was originally in play, where 75% was donated to nature protection.
[0:17:20] Voice 12: And then that would be by the, you know, for the sports and the earmark of it for my husband, I think it'd be useful for the LPC to refer back to that file, which is no longer in our minds.
[0:17:31] Voice 12: That is the precedent that you're using. And with how applicants move forward, because you would understand that there was a specific percentage of shoreline that hadn't be given to the 75% line.
[0:17:46] Voice 12: it's not just like pulling out of your hat whatever you feel like there was something there
[0:17:49] Voice 12: we should still be using it if we're going to go by that person thank you for that
[0:17:57] Voice 12: sorry yeah i just gave a listen to that i think the 75 percent is very clear um i was just talking
[0:18:03] Voice 12: about the part that gets taken out of the 75 percent to raise money there's no clarity on
[0:18:09] Voice 12: and it's going to be relevant okay
[0:18:13] Voice 3: yeah and i just say encourage you to you know connect back
[0:18:16] Voice 3: and think about her um because because they're they're definitely i mean there are there are
[0:18:22] Voice 3: advisers but they're also the ones that have got the legislative experience to

[0:18:50] Voice 12: I was going to make a couple of comments. One is the issue of using the word donation
[0:18:54] Voice 12: is actually not fully descriptive of what the land transfer is.
[0:19:02] Voice 12: It's actually an exchange, an exchange, it's an exchange of land for extra density, which
[0:19:13] Voice 12: you would otherwise be entitled to.
[0:19:17] Voice 12: So to use the word, it's not really a donation as such, it's an exchange in return for extra
[0:19:23] Voice 12: density.
[0:19:24] Voice 12: I think people should use that language in some way or other.
[0:19:28] Voice 12: It's more precise.

[0:20:03] Voice 12: Realize it's post-public hearing, I will say nothing about that application.
[0:20:06] Voice 12: However, I will point out that the minutes of the public hearing, the recent public hearing on May the 6th, I believe,
[0:20:16] Voice 12: are not accurate at the end, where it says that there being no submissions, no earlier
[0:20:24] Voice 12: submissions, Chair Peterson closed the public hearing on 343. That is not accurate. That
[0:20:30] Voice 12: is not accurate. There were more submissions. The trustees chose not to hear them. And if
[0:20:37] Voice 12: you're rightly accurate in these minutes, you can certify that's a fair and accurate
[0:20:42] Voice 12: in summary. There were more submissions about the track feed determined that hearing from
[0:20:50] Voice 12: people twice was sufficient to hear their position on the issue, something like that.
[0:20:58] Voice 12: They are just not accurate, should not stand. Another item that I thought was interesting
[0:21:04] Voice 12: in the that stood out for me in the minutes it's the minutes of the uh apc uh where let me see if
[0:21:13] Voice 12: i can find it here um talking about where they were reviewing the various work uh work programs
[0:21:20] Voice 12: and projects and they came to the issue of parking um it was noted that roadside parking and park
[0:21:27] Voice 12: side of the safety issue the body was a higher property spanish phil's dock was mentioned but
[0:21:32] Voice 12: is is limited benefit to galliano it is part of mlg and its expropriated land there would be no
[0:21:38] Voice 12: direct interest here due to the cost now clearly there's nobody on the apc from the north end this
[0:21:46] Voice 12: part of the island because parking at spanish field stock is a serious problem and dealing
[0:21:52] Voice 12: with it would be a serious benefit to the residents of the north end on holiday weekends
[0:21:57] Voice 12: i've come up with 40 cars parked along the road uh very narrow roadway very dangerous and some of
[0:22:03] Voice 12: them actually protrude halfway into the suvs recruiting halfway into a lane so that is a
[0:22:09] Voice 12: serious issue that should not be dismissed the way the agency has gone thanks very much thank you yes
[0:22:16] Voice 12: yeah
[0:22:17] Voice 10: i'll address that a little bit further um you know the way that they are it's already managed
[0:22:21] Voice 10: that facility for quite a number of years and um this was an issue that we had discussed many times
[0:22:29] Voice 10: with not only with small ground carvers but um with the fire departments as well over you know
[0:22:36] Voice 10: the the issue of cars blocking that lane um the problem we ran into is is that um cars are on
[0:22:46] Voice 10: moody right here on the highway and so the modi is the authority and they showed a little desire to
[0:22:53] Voice 10: to address the concerns that we have and you have to be accurate i drove up here the other day and
[0:22:59] Voice 10: there was a large pickup who was blocking the entire lane and you're going this is this is
[0:23:07] Voice 10: great right i mean so it is it is of importance um um some of us at the supplement don't forget
[0:23:16] Voice 10: that that exists right and uh you know uh the problem is unless we have a direct link to lody
[0:23:26] Voice 10: and i could get them to do something um it's very difficult uh one of the things we get at the south
[0:23:31] Voice 10: then when we ran into this problem is as the harvard authority donated money to um modi
[0:23:41] Voice 10: um to do the parking at sturgis bay so that part that was the same issue you know we were running
[0:23:47] Voice 10: into a problem near the ferry and um you know we had approached modi to approach bc ferries
[0:23:57] Voice 10: we approached uh a bunch of different organizations on how to solve this problem and the harbour
[0:24:04] Voice 10: authority at the end of the day donated ten thousand dollars and shamed bc ferries and
[0:24:08] Voice 10: modi into actually um doing that project there so you know i think they have to be creative
[0:24:15] Voice 10: but um but certainly um as far as i'm concerned modi has a responsibility to to make sure that
[0:24:23] Voice 10: the parking up here is not restricting access for the north end residents and you know you know my
[0:24:35] Voice 10: belief is that they should you know there's lots of road frontage and make it parking but you know
[0:24:42] Voice 10: the problem you run into is everybody that parks there they're not here for galliano they're here
[0:24:46] Voice 10: for re-ion and here for the outer ions which don't belong to our cat's face. So it's an interesting
[0:24:55] Voice 10: dynamic and we tried to come up with a creative solution up here but we just couldn't.
[0:25:02] Voice 10: Modi was just not having any part of it so it's not like we didn't try and certainly
[0:25:08] Voice 10: it's not an issue that I forgot about.
[0:25:12] Voice 12: What was the harmful authority that gave you money for the...
[0:25:18] Voice 10: Yeah, so we gave money to the service-based project to bring the other proponents to the table.
[0:25:25] Voice 12: You
[0:25:26] Voice 10: couldn't do that up here?
[0:25:28] Voice 10: Well, we don't manage this facility anymore.
[0:25:31] Voice 10: And so it's hard to get members from the south end to do that.
[0:25:37] Voice 10: We attempted to do it. So the CRD now runs that facility.
[0:25:40] Voice 10: So I think that's a discussion that we should have with Paul Brent.
[0:25:43] Voice 10: I see whether through a grant aid or something like that, we can try to get Morty back to

[0:41:29] Voice 11: the community uh it's uh we'll get into this a little bit in the statement but it's very
[0:41:33] Voice 11: important for the community I'm absolutely persuaded that this is the right path forwards
[0:41:37] Voice 11: for the community and so that's what we're here uh to talk about today

[0:42:08] Voice 11: window where you provide a prepared statement uh which is why this is gonna be a little bit
[0:42:13] Voice 11: i wouldn't but i want to you know i want to present what we provided in accordance with the
[0:42:18] Voice 11: the requirements of the of the delegation and i'm hoping that if there is any

[0:42:23] Voice 11: that if any of my colleagues and friends and neighbors suddenly promised that they might
[0:42:27] Voice 11: have a chance to add in those as well the statement was prepared in the course of a
[0:42:31] Voice 11: quick afternoon in order to hit your delegation timeline requirement so the wise island community
[0:42:37] Voice 11: community association represents all 48 Wise Island property owners.
[0:42:42] Voice 11: Wise Island is boat access only, relies on solar power for energy generation, and
[0:42:47] Voice 11: relies on direct ocean access for each property for
[0:42:51] Voice 11: our community for volunteer fire response and for emergency situations.
[0:42:56] Voice 11: What does that mean in practice?
[0:42:57] Voice 11: That means that most properties are accessed from the water with stairs and
[0:43:02] Voice 11: walkways to get to the cabins from the shoreline.
[0:43:04] Voice 11: that means most properties depend primarily upon solar power for lighting and electrical
[0:43:09] Voice 11: devices because the only alternatives are running a generator or a wind turbine
[0:43:13] Voice 11: that means when there's a fire unwise which has happened on a few very memorable occasions in
[0:43:21] Voice 11: the last 30 years the community's fire pumps need to be immediately brought to the property
[0:43:25] Voice 11: physically taken down to the water and put out the fire and that's happened successfully twice
[0:43:34] Voice 11: That's been successful on each occasion, as I said, and all White Islanders trained and
[0:43:39] Voice 11: reminded every year after our AGM on how to continue to protect the island with our fire
[0:43:46] Voice 11: protection equipment.
[0:43:47] Voice 11: That means when there's a health emergency, as has also happened on a number of occasions,
[0:43:52] Voice 11: and is particularly an issue with aging owners, that emergency services or other owners need
[0:43:57] Voice 11: to be able to get the individual to the water and on the boat to Ganges.
[0:44:05] Voice 11: Altogether this means that Wise Island faces a set of health, safety and sustainability factors
[0:44:10] Voice 11: that are unique to a small off-grid boat access site. The direct and unprecedented application
[0:44:16] Voice 11: of Galleon's bylaw 127 to Wise Island by enforcement in recent years has created a
[0:44:22] Voice 11: number of critical issues that need urgent attention particularly when it comes to solar
[0:44:26] Voice 11: power and water access we believe after a year a year and a half of discussions now
[0:44:33] Voice 11: that we have a path forwards on this a proposed wise island small residential zone that would
[0:44:39] Voice 11: slot right into galliano's bylaw 127 after a number
[0:44:43] Voice 11: of further community meetings and consultations
[0:44:45] Voice 11: in recent months we've developed that proposed document for your consideration we've sent it to
[0:44:50] Voice 11: you and to the planners we have some additional copies here today and we're happy to engage on
[0:44:56] Voice 11: that this path forward has the support of our community the most recent annual general meeting
[0:45:01] Voice 11: of the community association two unanimous resolutions were approved by the members
[0:45:05] Voice 11: and it was a pact yeah if there were any one of our neighbors here today who hosted and we
[0:45:14] Voice 11: clearly were running out of room for all the owners who were there and we had two unanimous
[0:45:19] Voice 11: resolutions that were approved confirming support for our neighbors for dealing with issues arising
[0:45:24] Voice 11: rising for bylaw 127, and second, that we needed to take proactive steps to resolve the mismatch
[0:45:31] Voice 11: between Galliano zoning and a boat access off-grid island with small lot sizes. We have those minutes
[0:45:37] Voice 11: and those resolutions here with us today, but what was really noteworthy again was the unanimous
[0:45:41] Voice 11: support. Wise Islanders, in their united interview with the Galliano SLR, does not work in its current
[0:45:47] Voice 11: form when Islanders are being told that the items essential to the safety and use of their properties
[0:45:52] Voice 11: are not permitted under the Galeano bylaw, which was, of course, drafted to suit the needs of a very different island.
[0:45:59] Voice 11: After that AGM, we engaged in dialogue with your predecessors, the predecessor LTC,
[0:46:04] Voice 11: and it's very nice to see former trustees, one of whom we'll talk about here today,
[0:46:10] Voice 11: as well as former Chair Rogers, who spoke to a number of lives.
[0:46:15] Voice 11: A large delegation of Wise Islanders attended the LTC meeting on September 6th
[0:46:20] Voice 11: to present the issues and to highlight the need for resolution.
[0:46:23] Voice 11: Those discussions were very helpful to all parties, we thought, and at that meeting, the trustees added Wise Island to the Galliano LTC project.
[0:46:33] Voice 11: So let's talk about the proposal, just in brief, but let's touch on it and what the Wise Island Small Lot Residential Zone could look like.
[0:46:40] Voice 11: That proposal would effectively be added to Galliano By-law 127 as a substitute for Section 5.3, which is currently the Galliano Small Lot Residential Zone.
[0:46:51] Voice 11: to develop the proposal we started with section 5.3 and then drew upon the key elements of the
[0:46:57] Voice 11: zoning adjustments made for passage island in house sound a few years ago in light of
[0:47:02] Voice 11: challenges similar to those faced by wise island we were fortunate to have one of our one of our
[0:47:08] Voice 11: neighbors who had been through his family involved in some of that and that was a a great help to us
[0:47:14] Voice 11: in terms of having a leg up on moving forward so those provisions that we drew from uh are set out
[0:47:20] Voice 11: again years ago here by law 114. we kept the proposal very simple and it's one page long
[0:47:26] Voice 11: to try to cut through the perceived complexity on this issue and to generate a conversation
[0:47:30] Voice 11: the wise island slr permits some solar power stairs and walkways within the key front setback
[0:47:36] Voice 11: areas from a wise island perspective this proposal is a starting point and not necessarily an end
[0:47:43] Voice 11: point we're happy to talk through the rationale the detailed elements and the proposal of staff
[0:47:49] Voice 11: at any time we think it's very important that this is what we're asking for today is for you
[0:47:55] Voice 11: to give us the opportunity to work forward on this this will come back to you as a group to approve
[0:48:00] Voice 11: or not approve but we'd like to be able to move forward and to at least have the opportunity to
[0:48:05] Voice 11: put something before you that you would then have the opportunity to approve or not improve
[0:48:10] Voice 11: we do strongly believe that there's a practice forward here uh to find a way that will address
[0:48:16] Voice 11: the needs of the community so we would ask you today to approve motions to take two actions
[0:48:20] Voice 11: uh firstly you'll take the wide island zoning project from the project list and resolve to put
[0:48:25] Voice 11: it next up on your current two projects around crystal mountain and the groundwater matters
[0:48:31] Voice 11: have been completed we understand based on our conversations and my conversations most recently
[0:48:35] Voice 11: with the chair the importance of those projects and recognize the resource challenges that limit
[0:48:41] Voice 11: limit your ability to tackle more than two issues at a time,
[0:48:44] Voice 11: but we do believe that there is an urgent need here
[0:48:48] Voice 11: and there's momentum to sort this issue out.
[0:48:50] Voice 11: Second, we would urge you to consider
[0:48:52] Voice 11: the staff's previous recommendation,
[0:48:54] Voice 11: which we thought was absolutely right,
[0:48:56] Voice 11: to suspend enforcement while this project awaits its turn
[0:48:59] Voice 11: in your list.
[0:49:00] Voice 11: An interim suspension to allow this proposal
[0:49:02] Voice 11: to be reviewed and considered fully in due course
[0:49:06] Voice 11: and to come back for final approval at the LTC here
[0:49:10] Voice 11: would make the most sense for Wise Islanders
[0:49:12] Voice 11: and would also, I think really crucially,
[0:49:14] Voice 11: allow the LTC to manage your workload
[0:49:17] Voice 11: and the resources for your staff.
[0:49:20] Voice 11: So again, this is not final.

[0:50:43] Voice 12: currently the ltc can only have one minor project and right now that is the groundwater project
[0:50:52] Voice 12: um it could potentially be moving forward in the next couple of months which then would open up a
[0:50:59] Voice 12: the project later this fall uh the else what i would recommend to the ltc is not just looking at
[0:51:05] Voice 12: uh amending bottle 127 in the south by wise island but doing perhaps tweaks for all of
[0:51:12] Voice 12: bile we're going through all the bottle 127 for technical amendments um now this could take at
[0:51:19] Voice 12: least up to a year to complete so it would take some time and there's no guarantee or the ltc may
[0:51:26] Voice 12: find that you may want to work on other projects other than the by-law review. But that is
[0:51:33] Voice 12: one option the LDC could consider as an end-use by-law review later this fall after the groundwater
[0:51:39] Voice 12: project is done. And then we can look at amending the by-law to address the concerns that Mr.
[0:51:46] Voice 12: we uh mentioned today and also perhaps address other technical technical amendments for others
[0:51:59] Voice 12: um the property owners do you have an option to also come forward with something application
[0:52:07] Voice 12: what you could do is put forward um amendments to the landing file but you would take on that

[1:47:08] Voice 12: should be two hectares so i apologize for that i'm getting a bit of a background on this lot
[1:47:16] Voice 12: this is district lot 14 and as i mentioned it's approximately 85 hectares an area and it's
[1:47:23] Voice 12: currently zone forest one there are four buildings located on the property that have a floor area of
[1:47:32] Voice 12: approximately 650 square feet one of those is currently being used as a dwelling there is one
[1:47:40] Voice 1: other
[1:47:41] Voice 12: building with a floor area i believe it's actually under 300 square feet and that's located
[1:47:47] Voice 12: in the area that's currently used as a sawmill off of Pallback Road.
[1:47:53] Voice 12: So in 1999, the previous property owner actually stratified these five building envelopes.
[1:48:01] Voice 12: So there's now strata launch one to five, with the majority of the property being common property.
[1:48:09] Voice 12: Staff are not quite sure how the property owner was able to register this building status of division,
[1:48:17] Voice 12: but we believe that it's um in compliance with the number of these sections of the strata
[1:48:22] Voice 12: mafia there are two large water tanks near the existing sawmill area that are
[1:48:28] Voice 12: can be used for fire emergency there's also three wells located on the property
[1:48:36] Voice 12: where the uh the larger of the four buildings are located and only one of those wells is in use
[1:48:44] Voice 12: use. So under the applicant's rationale, the property was purchased in 2017 with those
[1:48:49] Voice 12: existing five buildings and that sawmill area in place. And as I mentioned, the intent is
[1:48:55] Voice 12: to rezone that degraded area where the sawmill is located to a site-specific forest industrial
[1:49:03] Voice 12: zone. This would increase the availability of approved late industrial zoning on Galliano
[1:49:10] Voice 12: um and also implementing our restrictive sustainable forestry covenant on her meaning
[1:49:17] Voice 12: f3 portion of the property so the applicant is a
[1:49:21] Voice 12: willing to register that sustainable
[1:49:23] Voice 12: forestry covenant as well as a covenant to restrict the dwelling
[1:49:32] Voice 12: and also to prohibit any further subdivision and there's um
[1:49:37] Voice 12: more of a rationale in the
[1:49:39] Voice 12: staff report and there's also attached to the staff report a letter from the applicant
[1:49:46] Voice 12: uh currently in the ocp the subject property is date designated for us um you can see on page 55
[1:49:57] Voice 12: of the agenda in the ocp there are a number of course policies one of those actually outlines
[1:50:07] Voice 9: provides
[1:50:07] Voice 12: a situation where dwellings are permitted circumstance and number two
[1:50:12] Voice 12: it states land whose owners grant to the cilia forest foundation no longer
[1:50:18] Voice 12: i think around anymore so basically the land or the owner grants to the ltc and another currency
[1:50:29] Voice 12: um to manage the land in accordance with the sustainable forest practices and prohibiting
[1:50:36] Voice 12: subdivision of the land um into lots less than 20 hectares and may be rezoned to permit
[1:50:44] Voice 12: one accessory dwelling per 20 hectares if the lot complies with land transfer transportation
[1:50:52] Voice 12: 0. So again, it says that it allows one dwelling unit per 20 hectares. It doesn't say one dwelling
[1:51:00] Voice 12: unit per lot. So staff's interpretation of that, that in the forest designation, currently
[1:51:07] Voice 12: the subject property, 85 hectares, could have up to four dwellings based on the interpretation
[1:51:15] Voice 12: of the current policy of the OCP.
[1:51:19] Voice 12: The property is also mentioned in schedule C
[1:51:23] Voice 12: of the road network map,
[1:51:25] Voice 12: and it's identified the subject property
[1:51:28] Voice 12: as a possible area of emergency access
[1:51:30] Voice 12: to connect the 6 Allison Road community
[1:51:34] Voice 12: to the community to the east.
[1:51:36] Voice 12: Of course, there is a hydro property there,
[1:51:39] Voice 12: so it may not be feasible for that emergency access
[1:51:43] Voice 12: access across the subject property is something the LTP can consider and also make a condition
[1:51:48] Voice 12: of the rezoning if this proceeds. But staff would have to definitely research further to see if the
[1:51:56] Voice 12: emergency access would even make sense in that location. And that's also similar to Schedule E
[1:52:02] Voice 12: currency trail map. It has identified that there could be potentially a public trail across the
[1:52:10] Voice 12: property. Church of the Land Use By-law, as I mentioned, is currently zoned Forest 1,
[1:52:15] Voice 12: and Forest 1 does not permit dwellings, so the applicant is going to propose to rezone the
[1:52:22] Voice 12: majority of the property to site-specific Forest 3 zone, and that Forest 3 zone would then allow
[1:52:28] Voice 12: those four dwelling units. And then that
[1:52:31] Voice 12: other two hectares, which is currently where the sawmill is
[1:52:34] Voice 12: located would be rezoned to in the forest site specific for industrial zone and the applicant
[1:52:42] Voice 12: as indicated in the letter is willing to reduce some of or take away some of the uses that's
[1:52:49] Voice 12: currently permitted in the act of reporting industrial zones and so i've listed that on
[1:52:54] Voice 12: page in eight of the staff report um if this proceeds we will require a groundwater assessment
[1:53:01] Voice 12: As mentioned in the staff report, there is also a registered archaeological site on the
[1:53:11] Voice 12: northern tip of the property near the foreshore.
[1:53:15] Voice 12: The applicant has currently has an archaeological branch for further information, so we will
[1:53:22] Voice 12: potentially we could add a covenant as a condition to be so many bbc logical brands requires that
[1:53:31] Voice 12: in terms of consultation if his application proceeds there's a list of personations and
[1:53:39] Voice 12: agencies that we would refer this application out to as soon as possible so my my recommendation
[1:53:48] Voice 12: recommendation on page one of the staff report was actually to request for the LTC to request
[1:53:54] Voice 12: staff to draft laws. At this time, though, I think that staff would like to bring this application
[1:54:02] Voice 12: back as preliminary staff report back with additional information. One of those items
[1:54:07] Voice 12: that staff should report on is if an OCP amendment is followed would actually be required. That's
[1:54:18] Voice 12: at that. So staff would actually like to bring us back with that information. But the

[1:57:24] Voice 12: advised me that his experience enables him to put aside his personal biases.

[1:59:08] Voice 10: into the south mega point side, and then there's also the ability to put emergency access all
[1:59:15] Voice 10: way up to pollier as well those roads exist so it's not like um you know we're building new roads
[1:59:21] Voice 10: um there's on the pollier path side of the property there are four lots right now
[1:59:33] Voice 10: that um are landlocked um in their ability to build their cottages
[1:59:38] Voice 10: this starts with um mary wilson's and those properties they have a property up on the top
[1:59:48] Voice 10: is adjacent to this property i would like to see an access for those
[1:59:53] Voice 10: four properties so that they could um build their cottages i'm going to think this
[2:00:00] Voice 10: only time we get to ask for that um if the application goes by and there isn't access
[2:00:06] Voice 10: granted to these four properties then that property is landlocked for good because this
[2:00:11] Voice 10: would be in a forestry government and that wouldn't be possible at that point

[2:00:26] Voice 10: this actually piece of property is it touches polar pass road right where galley on the way

[2:00:42] Voice 10: acres for one of the housing organizations on the island to look at i don't think it's it would

[2:00:57] Voice 12: the sustainable forestry president it actually would and there's no policies in our economy

[2:01:34] Voice 10: sustenance on this lot as well that ended in 2017 when the uh the owners that have it now

[2:36:50] Voice 12: or very few um bylaw issues and then all of a sudden there's this mass non-conformity
[2:36:59] Voice 12: i would suggest that the mass non-conformity reflects more on the bylaw than it does
[2:37:05] Voice 12: on Wise Island itself. We heard in various other applications people talking about emergency
[2:37:13] Voice 12: access, emergency access, emergency access, an animal corridor. We would like an animal
[2:37:18] Voice 12: corridor to get down and off the island. I don't mean it to be silly, but the basis
[2:37:29] Voice 10: of these complaints
[2:37:30] Voice 12: are based off of a
[2:37:32] Voice 10: whimsical complaint
[2:37:37] Voice 12: by one or two people that are
[2:37:40] Voice 12: unfortunately I think would appear using Islands Trust as a weapon against their neighbor for
[2:37:48] Voice 12: whatever complaint it might be and I don't think it's a good use of your time
[2:37:53] Voice 12: is gobbling up a lot of our time so to put it to bed somehow help us help ourselves so that we can
[2:38:02] Voice 12: just get out of this and and make it fair and equitable and we can have solar panels to power
[2:38:09] Voice 12: off the island okay uh yes yeah um my name is lucy smith i am the chair of the phoenix
[2:38:22] Voice 12: I can't speak on their behalf because I have not gone to the board yet, but I would just
[2:38:28] Voice 12: like the LTC to consider given the climate crisis, which the Islands Trust has recognized,
[2:38:36] Voice 12: given that our OCP under the climate change section recognizes the importance of solar
[2:38:42] Voice 12: energy. Given the provincial announcement just a few days ago that they're trying to encourage
[2:38:51] Voice 12: solar and wind on especially communities that are off-grid, that it could be very sensitive
[2:38:58] Voice 12: and responsive to the importance of encouraging solar energy on the White
[2:39:03] Voice 12: Side, which is an off-grid island. And also given that the Islands Trust
[2:39:08] Voice 12: Council itself has a resolution to support solar energy a few years ago because we went there and
[2:39:17] Voice 12: they passed a resolution on that. So I just like to be very sensitive to this reality
[2:39:21] Voice 12: on Wise Island. I didn't come here to speak about that. I was kind of shocked by it. But we don't
[2:39:28] Voice 12: want to encourage these people to go diesel. We don't want to encourage them to take the trees
[2:39:33] Voice 12: we want to encourage them to go solar and there we are so let's do what we can to make that happen
[2:39:41] Voice 12: as fast as possible rather than them being um charged with bylaw increases i get that they
[2:39:48] Voice 12: aren't really going to buy a lot but let's fix it well thank you okay thank you for having me yes

[2:40:05] Voice 12: a few projects that are complete, and just ask if we could be next on the line.

[2:40:49] Voice 12: two options in the official community plan for rezoning for bowling use in the f1 zone one of
[2:40:57] Voice 10: that
[2:40:57] Voice 12: one one was to go to f3 the minimum lot size of 50 acres and that's what uh former trustee
[2:41:05] Voice 12: rockefeller and her family are proposing to do there is another there was another option which
[2:41:12] Voice 12: has continued as local trust committee practice to agree that forest landowners who were willing
[2:41:23] Voice 12: to exchange 75 percent of their land and transfer that to a some kind of conservation
[2:41:31] Voice 12: organization maybe maybe in the future indigenous organizations
[2:41:45] Voice 12: would have the right to a higher density than one in 50 acres that for every 20 acres that are
[2:41:54] Voice 12: transferred there would be a right to a five acre house right there were certain things in that
[2:42:00] Voice 12: in that precedent or in that practice involving that it should be no more than it should cover
[2:42:15] Voice 12: that the dwelling should cover no more than one third of the waterfront and that one lot
[2:42:23] Voice 12: be uh dedicated to affordable housing one way or the other sale and that's what
[2:42:30] Voice 12: the model would be like panorama kind of around the states up at the top of the
[2:42:35] Voice 12: political drive did that recall therapy i think the first lot sold went to the
[2:42:40] Voice 12: galleon island housing society front stage drive um seniors housing but it's important
[2:42:51] Voice 12: important to realize that don't confuse the f3 with the what's called the rural residential
[2:43:00] Voice 12: heritage forest option where there are many more things involved and they are well both
[2:43:07] Voice 12: have their complications but it's important not to confuse between doing apples and oranges
[2:43:14] Voice 12: uh comparison and start to want new conditions on a proposal that as far as i can tell uh actually
[2:43:23] Voice 12: does conform with the uh official community plan by proposing to go to uh
[2:43:30] Voice 12: sustainable sustainable forestry government
