[0:04:07] Voice 8: discussion with folks about uh affordable housing and and the sort of what people would like to see
[0:04:13] Voice 8: or what they hope could be possible on the vendor um and i mean an opportunity possibly
[0:04:21] Voice 8: going in and looking at plum tree court and what they have approval for um so that's been sort of
[0:04:29] Voice 8: the main focus of of uh of talks and stuff with folks is is what we're going to do about housing
[0:04:36] Voice 8: specifically workforce

[0:04:57] Voice 6: a couple things related to work so first of all I've been really ill for the last month um I'm
[0:05:03] Voice 6: feeling okay now but it's been a hard year um so bear with me if I'm behind on correspondence
[0:05:11] Voice 6: on it and trying to keep up on it your best method which some of you have figured out is just to text
[0:05:16] Voice 6: me um so karen got that one down in there so so um i'm fine i'm i will be fine um but i have been
[0:05:26] Voice 6: dealing with some chronic respiratory problems um so uh also many of you have texted me or emailed
[0:05:36] Voice 6: me and i put a thing in the pender post related to the sale of my house so my house went up for sale
[0:05:41] Voice 6: and people are like what is going on yeah that's pretty much my question for my life right now um
[0:05:47] Voice 6: due to family um issues that i don't really want to get into in a public forum you can talk to me
[0:05:53] Voice 6: individually about um we had to sell our home and we're looking for a home because my my brother
[0:06:00] Voice 6: has moved in with us um and so because of that we have spent the last year trying to find appropriate
[0:06:07] Voice 6: appropriate housing ironically now that we're going to do a housing project um to make this
[0:06:11] Voice 6: all work and we have been unable to find anything on pender so we are moving to salt spring and i
[0:06:19] Voice 6: have checked with russ hossenbauer about it and i can maintain as the trustee here without living
[0:06:23] Voice 6: on the island um if you have any thoughts about that please don't take them to social media just
[0:06:28] Voice 6: email me um and i will try to address your concerns i've worked with a number of community
[0:06:34] Voice 6: members who are just like can I just say thank you to all of the different people who have reached
[0:06:38] Voice 6: out and helped me figure out this transition um hopefully it's not a long-term transition
[0:06:43] Voice 6: hopefully it's an intermediate step to something back here because this is my home um but uh
[0:06:51] Voice 6: community members have really helped uh try and figure out what that's going to look like
[0:06:55] Voice 6: so I have a place to stay when I come for a couple days at a time stay here work here take the
[0:07:01] Voice 6: meetings i also ironically we're having the pender trust council is on pender in september right
[0:07:08] Voice 6: after i moved off pender which was really frustrating but i will be here for at least a
[0:07:13] Voice 6: day in advance of that and the whole meeting so do um please let me know if you have anything
[0:07:18] Voice 6: it will mean that site visit type things have to be pre-planned i can't do the spontaneous hey can
[0:07:24] Voice 6: you walk out to my house and take a look at this that's going to be difficult to do so i will need
[0:07:29] Voice 6: to try and cluster those around monthly um visits or you know if there's something urgent just let
[0:07:34] Voice 6: me know um don't trust email phone me or text me okay

[0:07:42] Voice 6: life which i'm trying to navigate to continue to represent for everyone here um and i actually feel
[0:07:48] Voice 6: like it's manageable because i also shifted a radical amount of stuff in my professional life
[0:07:53] Voice 6: to make things work for this um so again thanks to all of the folks who stepped up to help with
[0:07:58] Voice 6: that um and as part of that i now have my own personal chef and my brother he's fabulous so
[0:08:08] Voice 6: i don't cook at home anymore which is um okay so on a trust run i've had a number of meetings
[0:08:17] Voice 6: with community around forestry around the clam bay situation that um that is a concern over there
[0:08:24] Voice 6: the agricultural building um and then i've also met with um a number of people on other types of
[0:08:34] Voice 6: issues i have a few meetings set up as well around country court i understand and um so do if you
[0:08:41] Voice 6: have some issue you want to talk more deeply with me about do just reach out and schedule something
[0:08:47] Voice 6: it's totally doable um i am tracking email reasonably well for those requests for meetings
[0:08:53] Voice 6: so you can try that but also a text to say hey I shot you an email with more depth is a good idea

[0:09:43] Voice 18: From Chair's perspective, greater trust issues, our trust policy statement initiative, which
[0:09:52] Voice 18: many of you will have participated in, is slowly progressing.
[0:09:57] Voice 18: It's interesting because when it first rolled out, we were going at lightning speed.
[0:10:02] Voice 18: it was like the the intended schedule i believe was um was it two years ago it was i think it
[0:10:11] Voice 18: was july 13th we were going to do first reading and we were going to do final and put it to bed
[0:10:15] Voice 18: by september 28th um now we're two years later and the next draft is supposed to be circulated
[0:10:22] Voice 18: in january um and i believe the last timeline i saw was sort of mid 2025 would be final adoption
[0:10:30] Voice 18: option so there's a lot to come um i've been told that um you and us will be quite pleased with the
[0:10:40] Voice 18: the latest draft that they've taken in all the input and they say it's quite a bit different
[0:10:45] Voice 18: than what was initially in the first draft um but it'll it'll be just like the last program
[0:10:51] Voice 18: will be circulated lots of times to comment and uh it'll help set our path forward um equally with
[0:10:58] Voice 18: with that path forward our governance committee is um going through line by line um issues
[0:11:05] Voice 18: i believe i saw the the september trust council which will be here there will be a preliminary
[0:11:11] Voice 18: report um will be um given to trust council with the first set of recommendations so that's
[0:11:18] Voice 18: something i think that on on north tender you know it's going to be happening in your
[0:11:23] Voice 18: backyard so i hope everybody attends and again we need the feedback we need sort of
[0:11:28] Voice 18: to to to know what what the people think because it's right now it's amongst i think there's 12
[0:11:34] Voice 18: people on the government's committee so we need to get that out more eyes and broader input um

[0:13:33] Voice 15: I sent to you this morning, the last minute of course, several documents.
[0:13:41] Voice 15: The May 5th of this year Memorandum Enhanced Forestry Management on Pender Island,
[0:13:47] Voice 15: the Galliano fact sheet, and the Toronto Star article about extending power to the Island Trust.
[0:13:54] Voice 15: I'd like to thank the trustees for unanimously requesting staff for forced remanagement options,
[0:14:01] Voice 15: and for Brad Smith, who's here, for providing that response when they fit.
[0:14:07] Voice 15: The first point is about enhancing DPAs.
[0:14:11] Voice 15: Given the clear cut on pirates, there were no DPAs, some need to be in place, and it's a cumbersome task to put DPAs in.
[0:14:22] Voice 15: The trust only has so many resources, so to cut through the bureaucracy, I think we need to follow what Galeano has done and put a DPA on the whole island.
[0:14:32] Voice 15: Looking at that fact sheet which I sent, it is very reasonable to cut down trees for a driveway, a home, or firewood.
[0:14:42] Voice 15: The next two points from the memorandum are about getting the province involved.
[0:14:48] Voice 15: As a local trust, you can request the province for more jurisdiction.
[0:14:53] Voice 15: Please do this.
[0:14:55] Voice 15: At the trust council level, as the memorandum states, last term the trust council directed the chief administrative officer to request that the province enhance the trust's jurisdiction over tree cutting bylaws
[0:15:10] Voice 15: to make its jurisdiction equal to that of municipalities under Section 8 of the Community Charter.
[0:15:18] Voice 15: A vote to withdraw this request was made at the March Trust Council meeting.
[0:15:24] Voice 15: Only four trustees voted against it, so it passed.
[0:15:28] Voice 15: This was so deeply disappointing.
[0:15:32] Voice 15: You are democratically voted into your positions as trustees.
[0:15:36] Voice 15: Deep down, I believe that all the trustees want to save our trees.
[0:15:42] Voice 15: But to vote against this or think it's working against your mandate to preserve and protect,
[0:15:50] Voice 15: is this an attempt to avoid contentious situations?
[0:15:54] Voice 15: No doubt there is conflict, but this comes with a job.
[0:15:58] Voice 15: Please stand up for what is right.
[0:16:03] Voice 15: the island's forest presented a delegation to the island's council on the 28th of june requesting
[0:16:09] Voice 15: them to reconsider that position as our local trustees you we need you to support this request
[0:16:18] Voice 15: and should it come up as a vote again to vote for stronger powers to protect our trees
[0:16:24] Voice 15: for you to have the responsibility to preserve and protect you also need effective tools
[0:16:30] Voice 15: We have tried to follow the route of getting the province to regulate tree cutting, and although Adam Olson has met with us and he does what he can, he's very supportive, his party is not in power and the NDP has indicated that it is up to the trust.
[0:16:50] Voice 15: the crd has also said that the trust with its mandate to preserve and protect should be doing
[0:16:58] Voice 15: what it can with the establishment and enforcement of dpas while working towards other levels of
[0:17:05] Voice 15: government doing their part the trust needs to take action now they need to use and enhance
[0:17:12] Voice 15: all the tools that they have so far i've talked about laws and i need to just talk about
[0:17:20] Voice 15: enforcement um education is great but there are a few people who are driven only by profit
[0:17:28] Voice 15: and greed and don't really care about trees the present situation results in some property owners
[0:17:34] Voice 15: finding it remunerative to ignore dpas and accept the requirement to repair the damage
[0:17:40] Voice 15: whether the damage is the destruction of a raptor's nest or the loss of an 80 year old tree
[0:17:46] Voice 15: it is not repaired by planting a sapling meaningful penalties should result from
[0:17:52] Voice 15: profiteering by ignoring dpas we look to you for your support and you can count on ours
[0:18:02] Voice 15: let's work together to preserve and protect it is the mandate
[0:18:08] Voice 7: Good morning. My name is Kathy Prompt. I'm
[0:18:25] Voice 4: a North Pender resident. I have two pages and then a couple of spaces over here.
[0:18:32] Voice 4: Recently, I have spent some time researching forests and their limit toward one-to-one.
[0:18:38] Voice 4: The research explains there is a tight connection between forests and a safe, abundant supply of water.
[0:18:44] Voice 4: Most studies are from the U.S. since our countries are so similar, I felt it relevant.
[0:18:51] Voice 4: In a peer-reviewed study, the U.S. has forested lands which make up 36 percent of its total land
[0:18:59] Voice 4: area.
[0:19:00] Voice 6: However, if those same forests produce 50 percent of the total surface water. With respect
[0:19:07] Voice 4: to people, over half of the U.S. population benefits from forests when they're drinking water.
[0:19:12] Voice 4: supply, approximately 150 million people.
[0:19:17] Voice 4: American utility
[0:19:18] Voice 4: companies are increasingly seeking ways to maintain forested lands to
[0:19:23] Voice 4: protect water quality and sustain water supply.
[0:19:27] Voice 4: Exertive growth, this is the rural development that is outside
[0:19:32] Voice 6: the density of a city and
[0:19:34] Voice 6: its suburban areas.
[0:19:36] Voice 6: exurban hasn't had the most largest sorry has had the largest development growth in the past
[0:19:43] Voice 6: four decades pender island is an example of an observant area north
[0:19:49] Voice 4: pender follows this trend
[0:19:51] Voice 4: canadian census data revealing that 50 new homes were built between 2016 and 2021.
[0:19:59] Voice 4: observing growth is the biggest threat to groundwater availability
[0:20:03] Voice 4: and quality even at low development density as trees come down to make room.
[0:20:10] Voice 4: Those listening to me today may say we don't need to worry about any of this we get lots of rain in
[0:20:15] Voice 4: the winter. This is true. However, this summer a water truck has been arriving daily on Pender
[0:20:21] Voice 4: delivering water to Pender residents carrying between two and four thousand gallons of water.
[0:20:27] Voice 4: I encourage people to be cautious with this normative thinking that our abundant rainfall
[0:20:34] Voice 6: will continue with the impacts of climate change. As I speak all over the world climate change is
[0:20:41] Voice 6: turning weather on
[0:20:42] Voice 4: its head. I give you the example of Tofino to provide you a cautionary tale.
[0:20:48] Voice 4: Recently on July 20th an article went into the Times columnist. Tofino is one of the communities
[0:20:55] Voice 4: is being impacted by the drought so much though that the residents no longer are allowed water
[0:21:00] Voice 4: outdoor spaces or gardens and if the situation doesn't improve the town is ready to declare a
[0:21:07] Voice 4: state of emergency which will suspend some businesses limited tourism and tank attraction
[0:21:13] Voice 4: bringing in water you see as of may 1st tofino only received 54 millimeters of rain and yes i
[0:21:21] Voice 4: have researched and recalculated this prescription volume to include the
[0:21:25] Voice 4: rain we received this past
[0:21:27] Voice 4: Monday. Typically, the average precipitation volume in Tofino is 249 milliliters. They have
[0:21:35] Voice 4: only received 20 percent of their expected rainfall. At a packed emergency town hall,
[0:21:42] Voice 4: Mayor Dan Law opened the meeting by recognizing the First Nations as protesters for defying
[0:21:48] Voice 4: important junctions in the 1980s and stopping old world logging on Mears Island where four creeks fill
[0:21:55] Voice 4: reservoirs and feed a seafloor pipeline that supplies torpedo industry as mayor law states
[0:22:02] Voice 4: we are subsisting on fog and dew and every night is feeding the creeks and our reservoirs
[0:22:09] Voice 4: it's a mature forest over there 40 years ago they refused to log that watershed and thank god they
[0:22:16] Voice 4: they did. Pender, like Tofino, is at a level 5 drought. What does this mean? From the BC
[0:22:22] Voice 4: government's point of view, the impacts are adverse. The impacts to socio-economic or
[0:22:27] Voice 4: ecosystem values are almost certain. The general response measures from the BC government's
[0:22:33] Voice 4: perspective is conservation and local water restrictions. Regulatory action is likely
[0:22:40] Voice 4: and possible emergency response.
[0:22:43] Voice 4: I repeat, a regulatory arrangement is like this.
[0:22:47] Voice 10: This
[0:22:48] Voice 4: is your window of opportunity.
[0:22:50] Voice 4: The island's trust
[0:22:51] Voice 4: opportunity
[0:22:52] Voice 4: to ensure Pender Island's drinking water
[0:22:54] Voice 4: and habitat remain intact.
[0:22:56] Voice 4: Intact habitat equals quality and plentiful drinking water.
[0:23:00] Voice 4: Maintaining a tree canopy and a native understory
[0:23:04] Voice 4: is paramount to achieving this.
[0:23:07] Voice 4: I have a copy of the article

[0:24:14] Voice 8: It dates me to Lot 2 on Pirates Road, which
[0:24:17] Voice 8: was heavily logged in 2020 and 21.
[0:24:21] Voice 8: Many of you would have seen pictures of the devastation.
[0:24:25] Voice 8: So what does it look like two years later?
[0:24:28] Voice 11: Well, it's an invasive plant garden.
[0:24:32] Voice 8: Thistles, tansy groundwork, broom and wood ground cells dominate the landscape.
[0:24:42] Voice 8: Under the trees, the understory, the birds, the habitat for countless creatures.
[0:24:49] Voice 8: The perpetrators have long ago sold and retreated back to Alberta.
[0:24:54] Voice 8: The new owners are nowhere to be seen, and shortly after purchasing the property listed
[0:24:59] Voice 8: it again with
[0:25:01] Voice 11: a $300,000 markup,
[0:25:04] Voice 7: devastation in the pursuit of the almighty dollar.
[0:25:09] Voice 8: We have spent countless hours removing invasives from our property, and now we will have to
[0:25:16] Voice 8: face an onslaught along our eastern border, which also includes our government that we've
[0:25:23] Voice 8: registered with the Amstrad Conservancy.
[0:25:27] Voice 8: The area is much brighter now, it is much drier, it's an open invitation for invasives.
[0:25:37] Voice 7: Furthermore, as
[0:25:39] Voice 8: the Broome becomes more established over the next two or three years,
[0:25:43] Voice 8: it will become a fire danger. Broome is known as a fire accelerant and it's the perfect conduit
[0:25:51] Voice 8: for potential fire to spread across that lot
[0:25:55] Voice 8: into the slash piles,

[0:27:02] Voice 7: do we deal with this situation how do we find a balance so
[0:27:06] Voice 7: we can live in harmony with the land
[0:27:09] Voice 8: although private property lines may be defined property
[0:27:14] Voice 8: rights may be defined by property lines the activities on that private property does not
[0:27:20] Voice 8: know any boundaries don't i also have rights a right to know when a water cause that enters my
[0:27:29] Voice 8: property is altered a right to enjoy the shade in the forest protection from fire danger from fire
[0:27:38] Voice 7: data enhancing activities with my rights also come obligations an obligation
[0:27:48] Voice 8: to speak up
[0:27:50] Voice 8: when my and my community's rights and values are violated. I ask how do we deal with these
[0:27:59] Voice 8: situations? Well I'm not sure. Some may say we need more education. Well we've been trying to
[0:28:07] Voice 8: educate for many years and I for one am getting impatient and feel a much stronger message needs

[0:29:27] Voice 5: We're seeing an alarming eroding of forest cover due to clear cutting, which in turn
[0:29:33] Voice 5: affects groundwater.
[0:29:35] Voice 5: A healthy, intact forest ecosystem provides shade, traps moisture, slows rainwater, or
[0:29:41] Voice 5: groundwater recharge, keeps wetlands wet, and acts on behalf of fire suppression.
[0:29:49] Voice 5: The larger an intact forest, the better due to its moisture trapping capability in the
[0:29:54] Voice 5: interior of the forest.
[0:29:55] Voice 5: separating continuous forests by clear-cutting
[0:30:00] Voice 5: deeply into it, as we have seen this year, increases the amount of edge which dries out
[0:30:07] Voice 5: far more quickly. This impacts groundwater, which directly impacts our drinking water
[0:30:13] Voice 5: and makes a forest more flammable. We're in a climate emergency dealing with a droughting trend
[0:30:19] Voice 5: with ever hotter, increasingly unpredictable summers. Risk of water shortage and fire is
[0:30:26] Voice 5: increasing with the rights of property owners to do as they wish on their property don't they
[0:30:34] Voice 5: have the responsibility to the rest of us affected by their decisions um are we and the creatures
[0:30:43] Voice 5: affected not worthy of consideration especially when these individuals choose to ignore dpas that
[0:30:51] Voice 5: are in place for good reason whose responsibility is it to oversee forestry issues and who
[0:30:58] Voice 5: who has responsibility connected to groundwater.
[0:31:02] Voice 5: These are not currently being dealt with
[0:31:05] Voice 5: in any effective way that can respond as quickly
[0:31:10] Voice 5: as our climate changes.

[0:32:21] Voice 6: i want to tell you about something that i think is important to bring into the conversation
[0:32:28] Voice 6: because i noticed that it's being held here at the church it's really interesting right
[0:32:35] Voice 6: everything we know about the church not being held in the middle of the forest
[0:32:39] Voice 6: or what was it for if we were sitting there talking right now and having this conversation
[0:32:45] Voice 6: this would be a very interesting discussion i would notice all of your eyes staring at me

[0:33:17] Voice 6: was broken I was standing under a cedar tree a massive cedar tree and I got I'm a songwriter
[0:33:24] Voice 6: so I'm trying to mess in those kind of shadow lands where a lot of maybe rational minds don't
[0:33:30] Voice 6: want to go but I go into those places often and I was sitting under the street in this messy messy
[0:33:35] Voice 6: place and I heard a rush of words come to me and I wrote them down I think it was the tree I know
[0:33:44] Voice 6: that sounds completely maniacal but I think it was the street talking to me. I wrote it down
[0:33:49] Voice 6: and I fashioned it into a song which I then released on our album and blah blah blah.
[0:33:56] Voice 6: I told somebody else that I know who is a scientist and psychologist about this experience
[0:34:03] Voice 6: and she said oh my god I had a similar experience and I wrote it down into a meditation for my
[0:34:08] Voice 6: clients. A month later I had a gig and she showed up at the gig because she wanted to hear this song
[0:34:17] Voice 6: She wanted to hear what I heard from the tree and how it compared to what she
[0:34:20] Voice 6: heard from the tree. I tell you this because it's kind of mind-blowing.

[0:34:28] Voice 6: these aren't just objects that look pretty on our land, right?
[0:34:31] Voice 6: These definitely serve all the things that we've talked about, water, land,

[0:34:39] Voice 7: something else that we haven't considered here.

[0:38:40] Voice 4: opportunity to be able to come and speak today on behalf of the association and its board of
[0:38:45] Voice 4: directors. I have two separate related issues to speak to. The first is regarding something that
[0:38:52] Voice 4: appears on page 26 of the agenda package of May 5, 2023. Under the follow-up action report,
[0:39:01] Voice 4: Action
[0:39:01] Voice 6: 16.1 states LTC
[0:39:04] Voice 4: to invite realtors,
[0:39:06] Voice 4: Kendra Islands Conservancy and fire department
[0:39:09] Voice 4: to discuss communications with new land owners.
[0:39:12] Voice 4: And I just think this is the marvelous idea
[0:39:15] Voice 4: and the Pendleton Conservancy would be most happy
[0:39:18] Voice 4: to participate in this.
[0:39:20] Voice 4: When I first moved on the island,
[0:39:22] Voice 4: I guess I had a pretty good realtor.
[0:39:24] Voice 4: I didn't realize it at the time
[0:39:26] Voice 4: because she told me about the fire risks
[0:39:29] Voice 4: and told me about the water restriction in the summer,
[0:39:33] Voice 4: told me about the DPA on our property,
[0:39:35] Voice 4: which we were very happy to have,
[0:39:38] Voice 4: because my understanding would mean that
[0:39:40] Voice 4: I didn't have to put a covenant on my property
[0:39:42] Voice 4: because DPA had protected for me.
[0:39:44] Voice 4: Now I'm starting to worry about that a little bit.
[0:39:46] Voice 4: But anyways,
[0:39:47] Voice 6: I think presenting information and education
[0:39:51] Voice 6: to new members of the community would likely provide them
[0:39:54] Voice 6: with an awareness and understanding of the various DPAs
[0:39:57] Voice 6: that may be on their property, why they are there,
[0:40:00] Voice 4: and the consequences of their violation.
[0:40:03] Voice 4: It would also educate
[0:40:07] Voice 6: them about the importance
[0:40:08] Voice 6: of the island's natural features, about fire risks
[0:40:12] Voice 6: and what are increasing with global warming
[0:40:16] Voice 6: and how healthy fire-resistant forests can mediate the risk of fire,
[0:40:21] Voice 6: on the
[0:40:21] Voice 4: maintenance of intact forests on regulating groundwater
[0:40:26] Voice 4: water and our drinking water and the maintenance of the rural environment that so many of us value
[0:40:32] Voice 4: however we're kind of confused about the fact that to the knowledge of uh the
[0:40:37] Voice 6: staff and the
[0:40:38] Voice 6: board of directors of the pen ron conservancy no trust staff has contacted us in any capacity
[0:40:44] Voice 6: about this
[0:40:45] Voice 4: item and yet the status of this item is indicated that's completed so we're just um
[0:40:52] Voice 4: I'm asking if you can please clarify what this is regarding and whether we should expect to be
[0:40:58] Voice 6: contacted by trust staff in the future regarding
[0:41:01] Voice 4: new
[0:41:03] Voice 5: landowner communication.
[0:41:06] Voice 4: Second item is the 4815 Schooner Way DPA permit application for remediation of the Raptor and Caring Nest DPA, which is coming to be as a result of the violation of this DPA.
[0:41:21] Voice 4: Now, this is an unusual situation for the Pender Island Conservancy to be at one of
[0:41:26] Voice 4: these meetings, but the Pender Island Conservancy, as many of you remember, was founded as part
[0:41:31] Voice 4: of a campaign to protect Medicine Beach and the unique and sensitive ecosystems found
[0:41:36] Voice 4: there.
[0:41:36] Voice 4: Three years ago, hundreds of our supporters and donators of the Pender Island community
[0:41:42] Voice 4: worked hard to create the Medicine Beach Sanctuary and to protect its increasingly rare saltwater
[0:41:48] Voice 4: marsh.
[0:41:49] Voice 4: As the managers of the Medicine Beach Sanctuary, anything that happens upstream from the sanctuary
[0:41:55] Voice 4: and its marsh are of concern to us due to the potential effects of the health of the
[0:42:02] Voice 4: marsh and the creatures that live there.
[0:42:04] Voice 4: The marsh is fed in part by a seasonal stream that begins, or at least used to begin, at
[0:42:10] Voice 4: the spring located in the property of 4850 Swindler Way.
[0:42:15] Voice 4: So it's part of our responsibility to the community and to the ecosystems we help
[0:42:19] Voice 4: permanently protect to try to ensure that recent ecological damage within the watershed of Medicine
[0:42:26] Voice 4: Beach Sanctuary is remediated. The
[0:42:29] Voice 6: significant violation of the raptor and heron nest DPA at
[0:42:33] Voice 6: 4815 Schooner Way will require significant remediation and I
[0:42:38] Voice 4: use the term remediation
[0:42:40] Voice 4: as opposed to restoration, because the
[0:42:43] Voice 6: restoration of a relatively intact and healthy habitat
[0:42:48] Voice 6: with trees that are over 100 years old, it does not happen overnight.
[0:42:53] Voice 6: It takes many generations for that to occur.
[0:42:55] Voice 6: So, as our written
[0:42:58] Voice 4: correspondence to you has described, effective and meaningful remediation
[0:43:05] Voice 4: must include planting, protecting, and ongoing maintenance of native trees, planting, protecting,
[0:43:12] Voice 4: and ongoing care of appropriate native understory shrubs, and in addition, significant service
[0:43:20] Voice 4: remediation will also be required to address significant disruption of soil permeability
[0:43:26] Voice 4: within the osprey nest tree root zone. I have to say that we were pleased to see the remediation
[0:43:33] Voice 4: report is very comprehensive and includes all of these measures. However, I think it's important
[0:43:39] Voice 4: that we point out that there have been repeated ongoing violations of the DPA since the logging
[0:43:45] Voice 4: that took place in January after trust and force staff visited the property and also between visits
[0:43:50] Voice 4: by the biologist as he has known that documented in his report. These ongoing violations of the DPA
[0:43:57] Voice 4: They clearly indicate an overlapped compliance or perhaps understanding on the part of the owners.
[0:44:04] Voice 4: Therefore, we strongly recommend to the trustees that they include as a condition of the development permit for remediation work in the DPA,
[0:44:12] Voice 4: the payment by the owners of a security deposit for the full amount of the estimated cost of carrying out the remediation plan.
[0:44:21] Voice 4: This deposit would be returned once the plan has been fully carried out.
[0:44:26] Voice 4: Our only intention here is to try to ensure that the remediation of the damaged ecosystem,
[0:44:31] Voice 4: at least within the DPA, is actually completed. A requirement to the deposit is not without
[0:44:38] Voice 4: precedence in the Gulf Islands. It is not new. We are aware of recent examples on North Kendra
[0:44:44] Voice 4: Island where a security deposit was required as a condition of approval of a development permit
[0:44:49] Voice 4: permit application for remediation following a DPA violation.
[0:44:55] Voice 4: In short, DPA violations must be taken seriously,
[0:44:58] Voice 4: as enforcing them is one of the few meaningful tools we have on our islands
[0:45:02] Voice 4: to help in the protection of habitat,
[0:45:05] Voice 6: preserve our watersheds,
[0:45:06] Voice 6: to reduce the fire risk through the maintenance of fire-resistant,
[0:45:13] Voice 6: sorry, healthy forests, and to slow the takeover of invasive species,
[0:45:17] Voice 6: and to preserve the natural environment that so many of us who live here cherish.
[0:45:22] Voice 6: So my second
[0:45:23] Voice 4: question is, will you require remediation laid out in the biologist report?
[0:45:29] Voice 4: And will you require a full deposit to ensure that the remediation work actually takes place in full according to plan and in a timely fashion?

[0:46:43] Voice 4: in the works and i want to make sure that the opinion
[0:46:47] Voice 6: covers the questions that we want asked
[0:46:51] Voice 6: i understand from what i understand it was framed in the way of the up the bylaw that's already
[0:46:59] Voice 6: been passed and we're comfortable that it addresses the issues we raised what we want to
[0:47:05] Voice 6: know is should that permit ever have been issued in light of the terms of bylaw 103 and the second
[0:47:15] Voice 6: thing we want to know is should that permit have been issued with respect to the fact that there
[0:47:21] Voice 4: was no ongoing horticulture taking place at the time the permit was granted so
[0:47:28] Voice 3: those are the two
[0:47:29] Voice 3: two critical issues that we want to address in that legal opinion.

[0:48:33] Voice 11: that it is the paramount in a statutory sense
[0:48:37] Voice 11: expression of public interest
[0:48:39] Voice 11: regarding a bylaw to be adopted, it's almost always required under the Local Government Act.
[0:48:49] Voice 11: And therefore the minutes of that public hearing should be clear and readable, and the public opinion expressed should be unambiguous.
[0:48:59] Voice 11: And I draw your attention to the meeting of, and the minutes we'll be adopting shortly,
[0:49:07] Voice 11: of May 13th, 2023, and in that agenda package, page 8,
[0:49:13] Voice 11: and very few people spoke to the land use bylaw.
[0:49:17] Voice 11: Regrettably, they gave their opinions at length
[0:49:21] Voice 11: in public information meetings previously,
[0:49:24] Voice 11: but very few people showed up to the public hearings.

[0:49:36] Voice 11: it says speaking sense in the minutes is for public hearing and then secondly the minutes are
[0:49:43] Voice 11: clear as i said unambiguous and i very few people spoke i was the second person to speak
[0:49:50] Voice 11: and i raised three concerns which i had raised before but i didn't care specifically and
[0:49:55] Voice 11: succinctly in the public hearing they are run together in a paragraph and i don't think anybody
[0:50:03] Voice 11: who didn't know the detail of that Bible could understand what on earth I was on about.
[0:50:08] Voice 11: There are three separate issues and it's in six or eight lines.
[0:50:13] Voice 11: And those those three issues need separated with a half sentence
[0:50:18] Voice 11: explainer of what it applies to in the Bible, which I make clear in my own opinion
[0:50:23] Voice 11: at a public hearing. And it's not in the minutes. And it's very unlikely
[0:50:29] Voice 11: believe that should there be contention over this model in the future the public hearing record will

[0:55:58] Voice 8: worn out and kind of faded and sort of not a thing and i think that people in general don't

[0:56:24] Voice 6: so a couple of things on this that i'm wondering what we can do here like specifics so one of the

[0:56:35] Voice 6: to like and i really don't know what the bureaucratic answer to this is but i would like
[0:56:42] Voice 6: to see a small working group of whoever's interested just weigh in on it like the

[1:15:36] Voice 6: so this is my understanding i'm going to explain my understanding correctly so yeah

[1:15:43] Voice 8: one-off like a dvp yeah um rather than post it in the website and in the agenda package which is
[1:15:49] Voice 8: also on the website it just goes in the agenda package so people can read it all together right

[1:15:57] Voice 8: the agenda package where it's uh like an ongoing application like a rezoning that's worked by uh
[1:16:04] Voice 8: default post of the web page or a project or if it's an application where it's going kind of
[1:16:13] Voice 8: ongoing over several meetings then the correspondence will get put on the web page

[1:19:31] Voice 6: but as of today in the meeting, to say, okay, any correspondent that came in between last week and
[1:19:37] Voice 6: this week gets just amended or addendumed on to the end of the package? So

[1:24:17] Voice 6: it wasn't related to it right and or it came in as the other things like happened because there
[1:24:24] Voice 6: was a whole net lens feud there so there was a bunch of correspondence that came in and i don't
[1:24:28] Voice 6: know that the original packets had all that correspondence attached to the original package
[1:24:33] Voice 6: so that's an example one right i'm not sure
[1:24:35] Voice 8: messages outside of the meeting okay how you
[1:24:40] Voice 8: deal with the agenda packages and then you know i got a better understanding yeah because i know
[1:24:48] Voice 6: that staff is taking time to like pull down old applications online that are dead or not dead but

[1:24:57] Voice 6: appear because that's where it started triggering
[1:24:59] Voice 6: for me as i went back to look at old applications online i'm like why aren't they there
[1:25:03] Voice 6: And so then I had to dig into WebDAV to find things and dig into my own files to find things.
[1:25:07] Voice 6: And so, and then when I found them, I know all the correspondence wasn't attached.
[1:25:12] Voice 6: I was like, where's the correspondence?
[1:25:13] Voice 6: Now I'm having to go through multiple months of things to try and find where the correspondence

[1:25:19] Voice 6: I went through email.
[1:25:19] Voice 6: So like, it took me hours and hours and hours, and you probably have a folder.
[1:25:23] Voice 6: Now I realize you probably have a folder and it was like, oh shit, just email, I've written
[1:25:27] Voice 6: a massive folder.
[1:25:27] Voice 6: But
[1:25:27] Voice 18: I think that's the best thing, is going back, is touch base with the planners and say, look,
[1:25:34] Voice 18: I want to look at Byron's Road,

[1:30:17] Voice 1: um there is sort of the developable area and then the buildable area outside of it
[1:30:23] Voice 1: um a construction area as part of the application a geotechnical assessment report was provided
[1:30:29] Voice 1: The report geotechnical assessment strata lot 79 Sydney Island BC meets the DPA guidelines, and that assessment report can be found as attachment three, and the DPA guideline checklist as attachment for the geotechnical just for background the geotechnical
[1:30:47] Voice 1: DPA was established to prevent development in hazardous areas. Area A is the shoreline banks
[1:30:52] Voice 1: area and Area B is the upland relatively level area. As land development and alteration will
[1:30:59] Voice 1: have different impacts on each geotechnical area, the development permit exemptions and guidelines
[1:31:03] Voice 1: are predominantly specific to each area. So the report supports development within geotechnical
[1:31:10] Voice 1: Area B and the proposed development area does not encroach into geotechnical Area A nor the
[1:31:16] Voice 1: sydney island shoreline dpas which are also on the property the draft permit includes recommendations
[1:31:21] Voice 1: that are derived from the geotechnical report and dpa guidelines which include requirements
[1:31:26] Voice 1: and conditions pertaining to construction tree removal and stormwater management
[1:31:31] Voice 1: so the recommendation on page one for the ltc to approve issuance of np dp 2023.2 is supported

[1:36:58] Voice 6: So I'm not opposed to this, but what I would highly recommend the Strata do is start to get into a more formal relationship, because what you're referencing is the Heritage Act and the DRIPA, the Declaration of Rights of Indigenous People, is parallel to that now, and it didn't used to exist.

[1:39:14] Voice 1: shows the most current TUP map for North Pender.
[1:39:19] Voice 1: The following development permit areas are on the property.
[1:39:23] Voice 1: So DPA 1, which is woodland ecosystems,
[1:39:25] Voice 1: DPA 5, cliff ecosystems,
[1:39:27] Voice 1: and DPA 10, riparian aquatic development.
[1:39:30] Voice 1: As there is no development as part of this application,
[1:39:33] Voice 1: a DPA is not required.
[1:39:36] Voice 1: However, a condition of the permit is to provide guests with information regarding the location of sensitive areas and how to avoid them.
[1:39:44] Voice 1: And then, as you'll see in attachment two, some photos were taken during the staff site visit and the cliffside area is well fenced and has signage that prevents guests from entering that area.
[1:39:56] Voice 1: you. So as per subsection 6.4.6 of the official community plan, the OCP, the applicant must
[1:40:05] Voice 1: demonstrate that the well has adequate quality and quantity of water for the STVR use when that
[1:40:11] Voice 1: property is being serviced by a private well, which is the case here. So as described in
[1:40:16] Voice 1: attachment 6, the TP guidelines, the initial water quality results for total coliform and
[1:40:22] Voice 1: non-coliform bacteria exceeded the safe limits for drinking water and so as was recommended by a
[1:40:28] Voice 1: qualified expert the well was shocked and retested and so the results from June 30th 2023 showed that
[1:40:34] Voice 1: the levels meet the standards for safe drinking water and so the owner was recommended to install
[1:40:40] Voice 1: a UV treatment system to maintain a bacteria level of zero which applicant has confirmed has
[1:40:45] Voice 1: occurred and then according to plumbing on tap who's retained for that work the applicant has
[1:40:52] Voice 1: has also purchased a 2,000-liter cistern to accommodate guests' water needs.
[1:40:58] Voice 1: So two letters have been received by neighbors in opposition to the application for the following reasons.
[1:41:04] Voice 1: They enjoy their property and they do not want an STVR beside them
[1:41:07] Voice 1: and additional congestion at recreational areas such as the swimming hole.
[1:41:12] Voice 1: In their opinion, there are too many B&Bs and STVRs on North Pender.
[1:41:16] Voice 1: That the residence is difficult for emergency service to locate due to its street address
[1:41:22] Voice 1: And they were under the impression that it would be a strictly residential property not used, not for this use.
[1:41:29] Voice 1: So potential issues from the proposed use include increased traffic on Pirates Road and noise in a residential area with a maximum of 11 guests.
[1:41:38] Voice 1: Pressures on the existing well to support a maximum of 11 guests.
[1:41:42] Voice 1: Impact on the availability of rental housing for long-term residents and impacts to the DPAs on the property.
[1:41:48] Voice 1: So the house is not visible from the road.
[1:41:50] Voice 1: it's like well it's like this gated entrance and then you go down the road to it the existing
[1:41:56] Voice 1: vegetation provides screening from the adjacent properties the property manager lives nearby and
[1:42:01] Voice 1: according to her the property will not be available for booking and if she's not there
[1:42:06] Voice 1: there's ample off-street park parking to accommodate a greater number of guests
[1:42:10] Voice 1: and according to the owner the maximum number of people 19 years or older per booking is eight
[1:42:16] Voice 1: and the installation of a UV treatment system and cistern to support the use are included as
[1:42:21] Voice 1: permit conditions and as stated previously the owners do not intend to rent the property full
[1:42:25] Voice 1: time they have I think the intention from my understanding is to use it more extensively
[1:42:31] Voice 1: during the winter they've installed fencing and signage to prevent guests from entering the cliff
[1:42:37] Voice 1: ecosystem and providing and providing information regarding the DPAs on the property as a permit
[1:42:41] Voice 1: condition. So the recommendation on page one for the LTC to approve issuance of NP-TUP 2023.4
[1:42:51] Voice 1: is supported as the application overall complies with the TUP guidelines. There are no other legal
[1:42:57] Voice 1: STVRs in the vicinity of the property. The property is adequately screened from the street
[1:43:02] Voice 1: and from neighbors and there are measures that can be taken should the STVR have an adverse
[1:43:06] Voice 1: impact on neighbors. And so I believe the applicant is intending the meeting in person

[2:14:34] Voice 6: type of industrial activity that is a concrete plant and is so much part of the community and
[2:14:39] Voice 6: business and some of the violence but to get it to be environmentally sound in the work that it's
[2:14:45] Voice 6: doing here so um i don't know how many times i've been out there but you know a few different times
[2:14:50] Voice 6: looking and checking that things are safe and like just understanding having conversations
[2:14:54] Voice 6: conversations. So even though the move was done, and we're just going to let that be part of
[2:15:00] Voice 6: history, that I think, you know, Aaron's been really good about working with us to try and
[2:15:05] Voice 6: ensure that these conditions are met. And that's what we wanted to see. Frankly, we wanted to see

[2:15:42] Voice 6: because it's a certainty issue both for the community and for business to know that that
[2:15:47] Voice 6: site is the site and that it's like going to be well done i like the addition of the well i'd like
[2:15:52] Voice 6: to see the well done i like the idea of the six-month rezoning purpose starting so we're not

[2:20:16] Voice 8: No longer has functioning raptor or nesting trees, and so it is exempt from DPA requirements but DPA site 2 is deemed to be a valid site with a functioning Douglas fir tree that could act as a nesting tree in the future and currently does not have a nesting tree.

[2:20:46] Voice 8: a permit so they've been required to seek a retroactive permit with the remediation and

[3:28:38] Voice 12: a boarding house or something on the properties secondly i don't think when these properties were
[3:28:50] Voice 12: were developed, that there was any intention other than single
[3:28:54] Voice 12: family residents. And so the utilities and the water and
[3:29:00] Voice 12: sewer is for single family use. And the proposal as I see it, is
[3:29:08] Voice 12: going to allow them to do up to 11 people at a time on it. And
[3:29:16] Voice 12: And our environmental system is just too fragile to have that type of use.
[3:29:26] Voice 12: It won't work, or it will work until I have problems with it.
[3:29:32] Voice 12: I personally have had occasion with building a house on property meeting with JCUS,
[3:29:41] Voice 12: us and they brought on a bunch of heavy equipment and worked on the grounds and almost immediately
[3:29:50] Voice 12: our water system you know even though they're 10 acre parcels
[3:29:54] Voice 12: but it affects our water system and it cost me several thousand dollars to bring
[3:30:00] Voice 12: uh well experts in to uh clean up our system so that's my concern and that's our concern and
[3:30:09] Voice 12: we don't we think it's overuse of the property it was never intended and uh so other than you
[3:30:18] Voice 12: know having more people around i don't mind that it's really 10 acres we don't uh see them or hear
[3:30:25] Voice 12: them really but to uh disrupt our sewer water systems if they weren't designed for so anyway

[3:30:54] Voice 11: the third meeting the 13th of may um and uh particularly a point made by by trustee morrison
[3:31:02] Voice 11: all this read this from the mass trustee morrison advised that we are only approving the land use
[3:31:09] Voice 11: file all this new planning funnel with the understanding that the zoning we are doing
[3:31:14] Voice 11: on alr land that happens to be the browning portion down here um is not enforced until
[3:31:22] Voice 11: until the ALR itself allowed for the change in use
[3:31:27] Voice 11: because the ALR rules
[3:31:30] Voice 11: superseded the Ireland Strathclyde Regulation.
[3:31:33] Voice 11: And I'd like to point out to the local trust committee
[3:31:38] Voice 11: or to Trustee Morris particularly,
[3:31:41] Voice 11: that that particular provision of section 46
[3:31:45] Voice 11: and the ALC Act is cherry picking one
[3:31:49] Voice 11: of about four or five provisions.
[3:31:51] Voice 11: The very first is that local government bylaws, in our case, local committee bylaws, shall not contravene ALC rules.
[3:32:03] Voice 11: And that is the dominant. But when they do, there is a provision that they have no force in effect.
[3:32:10] Voice 11: And I think to say it's OK to go ahead with a land use bylaw change, it simply has no force in effect.
[3:32:18] Voice 11: That argument has, in fact, been used by the chair of council in reply to a Galliano citizen who was concerned in 2017 about an unadopted bylaw.
[3:32:32] Voice 11: And that was the argument, that it was to take that little piece of Section 46 and say, it's OK, it just had an important effect.
[3:32:39] Voice 11: But let me be the devil's advocate and say, well, if indeed a bylaw which contravenes
[3:32:48] Voice 11: the ALC Act has an enforcement effect, then in fact, the industrial zoning on the sprouting
[3:32:56] Voice 11: lot for decades has had no enforcement effect because there is no use approved by the non-farm
[3:33:04] Voice 11: use approved by the ALC for that land.
[3:33:08] Voice 11: so why is it given industrial zone and um furthermore to add insults of injury uh since
[3:33:17] Voice 11: i've been checking this certainly since 2020 agriculture has not been a permitted use on this
[3:33:23] Voice 11: portion of ar and um i i understand that um the landowner wants to get on with their project
[3:33:31] Voice 11: and that's entirely reasonable
[3:33:34] Voice 11: to then make application
[3:33:35] Voice 11: but there is
[3:33:38] Voice 11: a
[3:33:38] Voice 11: we didn't have a professional agrologist
[3:33:42] Voice 11: looking at the consultant
[3:33:44] Voice 11: report depending on the exclusions
[3:33:46] Voice 11: and
[3:33:47] Voice 11: the Armour's Trust felt
[3:33:50] Voice 11: it was based on the consultant's
[3:33:52] Voice 11: report there was an equal value
[3:33:54] Voice 11: in inclusion and exclusion but in fact
[3:33:56] Voice 11: there was a huge slope impediment
[3:33:58] Voice 11: and inferior soil
[3:33:59] Voice 11: soil, which the Islands Trust staff didn't pick up or didn't realize, and through it
[3:34:07] Voice 11: went to the Land Commission.
[3:34:10] Voice 11: And they should, upon reconsidering, reverse that decision, whether they will or not is
[3:34:16] Voice 11: another issue.
[3:34:17] Voice 11: But at the moment, the land remains to the ALR.
[3:34:20] Voice 11: So for the Islands Trust to grant boat storage and accessory buildings is, to put it most
[3:34:28] Voice 11: simply premature and it would have been very simple just to pull that portion of the bottle
[3:34:34] Voice 11: out and then reintroduce it with a land use model amendment if and when the land commission excludes
[3:34:41] Voice 11: that portion so that's the end of my constructive criticism thank you very much if it needs to
[3:34:52] Voice 11: uh if if nothing is done uh for years and years and years there is a zoning which is is incorrect
[3:35:01] Voice 11: And a landowner assumes that the land use by-law is what they have to agree with, and by-law enforcement assumes the same thing, and they just carry on, and the AOC is simply left out.
[3:35:12] Voice 11: And just to finish that off, for you, Gregor, I suppose, the boundary between rural and agricultural land, reserve land, on that same portion,
[3:35:25] Voice 11: it's offset by about, I think I remember it's 30 meters, inland, so there is a strip on that parcel which is joint ALR and rural.
[3:35:37] Voice 11: Now the landowner could well assume that the rules for rural zoning apply to that land, and there's no need to have that confusion.
[3:35:51] Voice 11: confusion if the local trust committees is very careful about following the AOC first
[3:35:59] Voice 11: and the landowners second.
[3:36:04] Voice 11: As I said, in this whole issue came up before Trust Council, because I, in fact, went to
[3:36:12] Voice 11: trust council with a number of these examples in 2016 and then 2018 um a letter went to the entire
[3:36:22] Voice 11: of south and the trust council um saying that we won't do we will not adopt by adopt bylaws
[3:36:32] Voice 11: unless and until all terms of reference stipulated by the plan commissioner matt and that wasn't done

Strongly recommends requiring a security deposit from the property owners for the full amount of the estimated cost of the remediation plan. COMMUNITY INFORMATION MEETING 7.1 Communications with New Landowners Regional Planning Manager (RPM) Kojima spoke to a project of last term - a mail-out to all landowners with DPAs on property that was specific to each parcel’s ecosystem. The project took about six months and a budget for staff time to write letters, create information sheets, generate maps, collate, and create mailing lists. Discussion: Will need a way to identify new landowners Interested in a generic information package Newcomers lack understanding of the mandate and role of Islands Trust The LTC would like to see a small working group of interested community members to help with this project In the past, Pender Island had a community-based Welcome Wagon that would pull information from different sources and provide it to new owners Staff could help prepare information packages, as there are lots of materials available The LTC agreed to initiate a meeting or assist with organizing and bringing people together Could be a topic to discuss at the meeting scheduled for Saturday, October 21 A member of the public reported that some property owners did not receive DPA correspondence A member of the public expressed the importance of one-to-one conversations with land owners Need to have a better connection with property owners, local realtors, and off island realtors A member of the public stated that the forestry group has already started a project with the conservancy where they send someone out to the property to provide specific information about the property, such as invasive species, DPA areas, etc. 8. DELEGATIONS - none 12. CORRESPONDENCE Trustee Morrison requested clarification as to the organization and location of correspondence pertaining to applications. When Trustees are reviewing past files, it would be helpful if all the correspondence was in one location. RPM Kojima reviewed the process for correspondence for on-going applications. Rezoning applications would be posted on web page. Temporary Use Permit and Development Permit Areas, in the agenda package; distributed to the LTC by email; and filed in internal directory. Island Planner Smith advised trustees that they can request a copy of all of the correspondence for an application from staff if needed. Correspondence must be received one week prior to a meeting to be included in agenda package. Any correspondence received after that is sent to the LTC and raised by staff at the meeting. All of the correspondence is filed and saved as part of the public record. Discussion: The Committee asked the applicant whether the Sidney Island Strata Corporation has been in conversation with the Tsawout First Nation Applicant stated that there is an old Archeological Report that didn’t find historical evidence of archaeological material/artifacts Applicant stated that there is ongoing engagement with Tsawout First Nation on deer management Applicant stated their development is well over 30 to 40 metres offset from the foreshore area The Committee suggested that the Strata Corporation establish a more formal relationship with First Nations and make sure that the Sidney Island Strata are meeting their Declaration on the Rights of Indigenous Peoples (DRIPA) obligations. The applicant replied that they will pass this on to the Strata Council NP-2023-077 It was Moved and Seconded, that North Pender Island Local Trust Committee approve issuance of Development Permit NP-DP-2023.2 (Shaw) CARRIED 13.2 NP-TUP-2023.4 (Gu) Planner Caproff spoke to the application for a Temporary User Permit (TUP) to allow a Short Term Vacation Rental (STVR). Two neighbours submitted correspondence in opposition to the application as they felt the STVR will increase congestion at recreation areas, there are already too many existing B & Bs and STVRs on the island, the property is difficult to locate, and prefer the property be used as a residence only. Committee Discussion: The Committee asked if 2000 L was the actual cistern size – applicant unclear on cistern volume The Committee asked whether a TUP for STVR use was required outside of Magic Lake Estates; RPM Kojima confirmed a TUP is required for this use when the property owner does not reside on the property North Pender Island Local Trust Committee Regular Meeting July 28, 2023 ADOPTED Page 7 of 12 The Committee asked whether the well was sufficient for the proposed use and for fire-fighting purposes based on the groundwater region. Planner Caproff stated that it was not included and referred to the available aquifer vulnerability mapping Fire Department has mapped island for access points for water Trustee Morrison stated she would like to defer the application until the water quantity on-site was further reviewed, staff to contact the Fire Department, Senior Freshwater Specialist, and receive clarification on cistern volume NP-2023-78 It was Moved and Seconded, that North Pender Island Local Trust Committee defer this Application NP-TUP- 2023.4 (Gu) to the September 2023 Local Trust Committee meeting and direct staff to get confirmation from the applicant on the size of the cistern, refer the application to Senior Freshwater Specialist William Shulba for comment, and refer to the local fire department for comment. Committee recessed at 11:59 a.m. and resumed at 12:06 p.m. 13.3 NP-RZ-2022.1 (Sidney Island Strata Corporation) - Proposed Bylaw No. 232 RPM Kojima explained that the public hearing was held in March and it had been approved by the Executive Committee. NP-2023-079 It was Moved and Seconded, that North Pender Island Local Trust Committee Bylaw No 232, cited as ““North Pender Associated Islands Land Use Bylaw No. 148, 2003, Amendment No. 1, 2022”, be adopted. CARRIED 13.4 NP-TUP-2023.5 (Grimmer) Island Planner Smith spoke to the application for a Temporary Use Permit which is to be followed by a rezoning application (not submitted yet). Island Planner Smith reviewed the history of the application: All conditions have been met Environmental inspection completed No complaints or concerns raised Two new recommendations for consideration: storing excess concrete during rainfall, and installation of groundwater monitoring well The process would likely take 1 to 2 years for rezoning and that the Temporary Use Permit (TUP) could be approved for 3 years. CARRIED 13.5 NP-DP-2023.3 (Shave) Island Planner Smith provided an update on the application: DPA1 no raptors nest present; DPA2 may have a nesting tree Comprehensive report is included with a number of recommendations Trees removed without permission Could request a Security Deposit No estimate at this time for restoration/remediation NP-2023-081 It was Moved and Seconded, that North Pender Local Trust Committee defer NP-DP-2023.3 (Shave) and direct staff to obtain an estimate for a security deposit. CARRIED Bylaw Compliance and Enforcement Manager (BCEM) Dingman added that the file is being reviewed by Crown Counsel, information is confidential at this time and will report back after the review. He explained that Bylaw Compliance and Enforcement Officers gathered evidence regarding the contravention, and Crown Counsel will decide whether to go forward with prosecution. 13.6 Saturna Island Local Trust Committee SA-ALR-2023.1 Application Island Planner Smith advised that the applicant is applying to exclude a 12 hectare portion of the lot from the ALR and include a different 12 hectare portion of land in the ALR. A professional assessment concluded that the property to be included has higher quality soil than the land to be excluded. NP-2023-082 It was Moved and Seconded, that North Pender Island Local Trust Committee interests are unaffected by the Saturna Island Local Trust Committee SA-ALR-2023.1 Application. CARRIED 14. LOCAL TRUST COMMITTEE PROJECTS 14.1 Raptor Nest DPA Project Update RPM Kojima outlined the Minor Project. A Project Charter has been developed that establishes a timeline. The staff report highlights some of the risks associated with this project. The budget available for this fiscal year is $5000. The project will include North Pender Island Local Trust Committee Regular Meeting July 28, 2023 ADOPTED Page 9 of 12 mapping done by North Pender Island residents. A professional Biologist will need to be included in this project. NP-2023-083 It was Moved and Seconded, that North Pender Island Local Trust Committee endorse the Project Charter for the Raptor Nest Development Permit Area Project. CARRIED 14.2 Housing Access and Affordability Project RPM Kojima reviewed the draft business case for the allocation of funding and staff resources. A preliminary timeline is included in package. Discussion: The $10,000 budget includes costs for materials, meetings, and First Nations engagement. The expected budget for staff time remains unknown until the LTC provides more details about the project scope. Denman, Mayne, and Gabriola Island LTCs have been working on housing projects. Planner Narissa Chadwick could present information at the Community Information Meeting of October 21, 2023 Trustee Morrison would like to see options from other LTCs for consideration of viability on North Pender The Housing Tool Kit provided by Islands Trust staff includes mapping, land use suitability analysis, and examples from other islands and similar communities Staff resourcing included in Staff Report Start community discussion in September Would like to increase the budget to provide for community consultation costs and education materials NP-2023-084 It was Moved and Seconded, that North Pender Island Local Trust Committee endorse the business case for the Housing Access and Affordability Project with a modified budget of $15,000 and that staff forward the business case to the relevant committees and to Trust Council. CARRIED NP-2023-085 It was Moved and Seconded, that the North Pender Island Local Trust Committee Special Meeting scheduled for October 28, 2023 be moved to October 21, 2023. He has heard the plans and they sound feasible. The definition of Community Housing in the zoning bylaw is limited to duplexes because it says 2 families allowed. The Pender Islands Housing Society changed their name to be more inclusive. The applicant suggested changing “2 family” to “multi- family” with no change to density. RPM Kojima suggested that the Pender Islands Housing Society make an application to rezone and then seek a refund of fee from the Executive Committee. The rezoning application would be the fastest route to make these changes. Island Planner Smith advised that an Official Community Plan (OCP) amendment would not be needed. The LTC could move forward with a minor amendment to the Land Use Bylaw (LUB) to remove that language altogether or change it to multi-family dwellings. 15. He suggested advertising first to determine participation numbers. Islands Trust staff could advertise membership opportunities on the Advisory Planning Commission with a clear link to ground water feasibility and housing initiatives.
