[0:00:25] Voice 4: trips, kind of an outhouse replacement, which is very exciting for some people.

[0:00:30] Voice 4: The boat launch conversation continues to go on in terms of getting boat launch fixed.

[0:00:36] Voice 4: fixed, we're going to try and work with that in some areas.

[0:00:41] Voice 4: The convention happens in terms of me partnering and getting some funding,

[0:00:45] Voice 4: and that's been going on for years.

[0:00:48] Voice 4: And then in August, I'm actually, the membership,

[0:00:53] Voice 4: I'm on the Trust Programs Committee and the Investment Planning Committee.

[0:00:56] Voice 4: So in August, we talked about stewardship education and different webinars

[0:01:02] Voice 4: that we're going to be presenting next year.

[0:01:04] Voice 4: So I did put out an ask in Facebook, I don't know what Facebook is, but it was presented in terms of a very short survey questionnaire.

[0:01:14] Voice 4: Three questions is basically what you'd like to see in webinars, you know, in terms of anything from well water to...

[0:01:26] Voice 4: If people aren't on Facebook, I can give you a forward email address on September 15th.

[0:01:35] Voice 4: And then, the regional planning committee went on as well, and we've been working on a housing strategy toolkit, and we've got a very large report on gas analysis, which is basically what's missing in all the housing assessment reports.

[0:02:16] Voice 4: basically we had a meeting actually a seven hour meeting on wednesday staring at a computer it was

[0:02:22] Voice 4: really fun and uh basically we're working on the housing toolkit and housing strategy and we had

[0:02:28] Voice 4: this report regarding missing gaps in all our housing reports uh trust wide so i'm trying to

[0:02:36] Voice 4: get that forwarded to our local housing group and all of our items are coming up

[0:02:41] Voice 4: with a housing needs report again. It's a legislative requirement every five years

[0:02:48] Voice 4: where Salisbury Island is the only one that isn't up for that. It's a couple more years. So there's lots of

[0:02:55] Voice 4: things going on in that regard and if you didn't hear about the stewardship I told

[0:03:00] Voice 4: you because of my voice, basically you can, there'll be a questionnaire you can

[0:03:06] Voice 4: answer regarding what you'd like to see in webinars in the future and so if

[0:03:11] Voice 4: anybody is not on Facebook I can forward you the email connection for the

[0:03:15] Voice 4: questionnaire it's a survey monkey and I've talked enough and mumbled enough

[0:03:20] Voice 4: and I'll get my co-trustee here. Thank you.

[0:03:33] Voice 20: Ferries, I think it seemed to work very well this summer with the bigger ferry here, the Quinetza, on our side,

[0:03:41] Voice 20: and then the two ferries running on the other side.

[0:03:44] Voice 20: It seemed to work very well, and I think we're very fortunate that Karen had a lot to do with lobbying for that.

[0:03:52] Voice 20: So I'm now on the ferry advisory committee, and we'll be certainly encouraging the bigger ferry is here now until December,

[0:04:03] Voice 20: and then it'll kick in, I don't think you really know when it's going to kick in again for next year,

[0:04:09] Voice 20: but all the plans are to have it somewhere for next year, which is a good thing.

[0:04:15] Voice 20: So another local issue, Conservancy Hornby Island is organizing a forest fest for October the 28th, 29th,

[0:04:26] Voice 20: and like Herring Fest, it's kind of along that same theme,

[0:04:30] Voice 20: celebrating the amazing forest that we have on Hornby Island and there's some

[0:04:36] Voice 20: excellent speakers John Valiant's coming if you know him he he's a quite a BC

[0:04:42] Voice 20: author wrote The Golden Spruce and The Tiger and a number of other books he's

[0:04:46] Voice 20: gonna come and he just Fire Weather is his latest book that just came out a couple of

[0:04:50] Voice 20: months ago and if you want to scare the daylights out of yourself read that book

[0:04:56] Voice 20: And it was scary this summer, I've got to say, around the fire thing and water.

[0:05:01] Voice 20: And so these are all issues that we all have to deal with all the time.

[0:05:07] Voice 20: And thankfully, the Water Stewardship Group and others on the island are working on that.

[0:05:12] Voice 20: So on a good news environmental story, it's been an absolutely amazing year for coho and springs and fishing out here.

[0:05:23] Voice 20: And the herring seems to have been a pretty good herring spawn, which probably builds into that, you know, the herring.

[0:05:31] Voice 20: And therefore the cobalt springs are here, which begs this question, why?

[0:05:37] Voice 20: I don't think anybody really knows why, but they're very cyclical in nature.

[0:05:41] Voice 20: But anyway, it was a very good year, so that's a good news story.

[0:05:45] Voice 20: And there's still lots of fish out there. It's quite amazing.

[0:05:48] Voice 20: so i'll just i'll just repeat that thank you thank

[0:05:52] Voice 17: you um so for the chair's report i don't have

[0:05:56] Voice 17: anything terribly recent to report but i would just mention that the trust council back at the

[0:06:03] Voice 17: end of june um trust council started uh working towards the new corporate planning process which

[0:06:12] Voice 17: is attempting to integrate strategic planning and financial planning the work

[0:06:20] Voice 17: of setting up the new plan is ongoing but we conducted a SWOT analysis which

[0:06:28] Voice 17: is strengths weaknesses opportunities and threats and I think that was pretty

[0:06:33] Voice 17: good we had trustee sponsored request for decision on revamping the First

[0:06:43] Voice 17: Nations referral process which I think most of us recognize is fairly

[0:06:50] Voice 17: inadequate and try to look at ways to do that better and part of that is to

[0:06:57] Voice 17: actually we're engaging the First Nations themselves to find out how they

[0:07:03] Voice 17: They think we might do better if they have thoughts on that.

[0:07:08] Voice 17: So that was part of that busy council as usual.

[0:07:13] Voice 17: I've had the pleasure of having most of August off, however.

[0:07:17] Voice 17: So I'm going to conclude there and we'll go on to our next item.

[0:13:00] Voice 5: agenda on um the amended agenda is the request

[0:13:05] Voice 5: for letters of support from the trust for some

[0:13:09] Voice 5: housing initiatives that high seat is doing we've hired a consultant and there's two different

[0:13:16] Voice 5: applications for funding around affordable housing going in and the request is to our local

[0:13:24] Voice 5: governments, the regional district, and Islands Cross to be supportive of those

[0:13:29] Voice 5: applications. And so they're to the FCM, Federal Municipality

[0:13:39] Voice 5: Association, and also the Provincial Rural Economic Development, so it's called RECP. We will also be going to a public

[0:13:53] Voice 5: consultation and there will be four public consultations. The first one

[0:13:57] Voice 5: September 26th at the community hall and the posters will look like this and

[0:14:05] Voice 5: they'll be up and put around. So I brought this one to give to the minutes

[0:14:10] Voice 5: of the UN's trust but they'll be on Facebook and it's just got exactly where the

[0:14:16] Voice 5: consultations will happen. This one is called the economic development strategy

[0:14:21] Voice 5: as it's impacting into housing and this is from a grant from the island coastal economic trust so

[0:14:28] Voice 5: the consultants that have been hired are funding themselves through getting grants and looking for

[0:14:35] Voice 5: programs that would support that housing and so appreciation to the trust for considering writing

[0:14:43] Voice 5: letters of support to go with those grant applications and also for the amendments to

[0:14:48] Voice 5: to the ACP that the housing group has been talking about

[0:14:52] Voice 5: and to try to really expedite getting

[0:14:55] Voice 5: for the housing on that.

[0:14:56] Voice 5: So I don't know if you want this or not,

[0:14:59] Voice 5: but that's my poster that's coming on the consultations.

[0:15:21] Voice 1: right Tony yes 2013 the local trust committee put community housing on the

[0:15:29] Voice 1: work program that was ten years ago five years ago the local trust committee

[0:15:34] Voice 1: received housing needs assessment two years ago the local trust committee gave

[0:15:39] Voice 1: housing and a couple of other issues to the APC to work on six months later they

[0:15:44] Voice 1: came up with recommendations. 18 months has gone by since then. Having been a trustee I know how

[0:15:50] Voice 1: things keep coming up on the agenda and proactive planning often gets put aside

[0:15:55] Voice 1: so I don't want to be critical but I want to be encouraging and supportive and I spent the

[0:16:00] Voice 1: summer looking at the issue of housing providing with a paper with some history,

[0:16:04] Voice 1: some analysis, some suggestions of how to move forward and three things became

[0:16:09] Voice 1: clear to me. One is that despite the policies in the OCP there'd be no

[0:16:14] Voice 1: there's been no uptake in terms of actual permitted housing happening. Meanwhile, housing

[0:16:18] Voice 1: solutions have been informal, unpermitted solutions that aren't secure because of their

[0:16:28] Voice 1: illegality. So I think we need to go back, or you need to go back and look at what are

[0:16:33] Voice 1: the barriers for people to obtain and proceed with permitted housing. And the other conclusion

[0:16:42] Voice 1: conclusion I came to is that

[0:16:43] Voice 1: we need to have a whole comprehensive

[0:16:47] Voice 1: range of opportunities

[0:16:48] Voice 1: for housing. There's no one solution.

[0:16:50] Voice 1: There's a whole bunch of different things

[0:16:52] Voice 1: that the doors need to be open

[0:16:54] Voice 1: without huge barriers.

[0:16:55] Voice 1: On the one hand,

[0:16:57] Voice 1: we want to protect ecology and water

[0:17:00] Voice 1: and so on, but

[0:17:02] Voice 1: if the barriers,

[0:17:03] Voice 1: if in protecting those the barriers don't

[0:17:06] Voice 1: enable opportunities to happen,

[0:17:08] Voice 1: then things will just happen illegally.

[0:17:10] Voice 1: So I think it needs to

[0:17:11] Voice 1: find a better balance between accessibility to housing opportunities

[0:17:15] Voice 1: and accountability I think the fact that there's not been uptake and what we put out

[0:17:22] Voice 1: there shows that the barriers are maybe too strong so I've provided some

[0:17:28] Voice 1: suggestions and recommendations and really want to encourage you to get this

[0:17:33] Voice 1: you know on to the work program and get some actual things happening as Karen

[0:17:40] Voice 1: pointed out right now what Heisig is putting forward is not actually

[0:17:43] Voice 1: permitted in the OCP land you spy on. That's just one of the things I think

[0:17:47] Voice 1: needs to be addressed. So I just really want to encourage and support action

[0:17:51] Voice 1: after the ten years of this issue being on the work program for it to actually be

[0:17:55] Voice 1: tackled. Thank you.

[0:18:41] Voice 4: It gives a whole historical analysis on, you know, and I can speak to the frustration of being a trustee and getting anything done.

[0:19:36] Voice 16: with an arrogant corporation that mocks our democratic process and emphatically voiced

[0:19:42] Voice 16: concerns. Answer, consultation becomes collusion when distant trust officials correspond with a

[0:19:50] Voice 16: Rogers representative over a period of five months from June 10th to November 23rd, 2022,

[0:19:58] Voice 16: 22 without informing our community or our local trust committee of plans to

[0:20:05] Voice 16: impose a 63 meter cell tower on an environmentally sensitive island whose

[0:20:11] Voice 16: residents had overwhelmingly rejected a similar telus proposal in favor of the

[0:20:17] Voice 16: fiber optic network currently under construction that lesson had been learned

[0:20:22] Voice 16: too much public consultation in dangers corporate profits federal I said

[0:20:29] Voice 16: statutes mandate that local government regulations be followed for any proposed

[0:20:34] Voice 16: cell tower among a list of legal stipulations of which our lawyer has

[0:20:40] Voice 16: just reminded the trust is a mandatory face-to-face public meeting with the

[0:20:46] Voice 16: proponent. We're still waiting. The timing is suggestive. Rogers waited until we

[0:20:53] Voice 16: chose fire optics before pushing a cell tower whose untested 5G component

[0:20:59] Voice 16: requires fiber's bandwidth to operate. If both fiber and telecommunications

[0:21:07] Voice 16: towers seem needlessly redundant, if the trashing of our community process by

[0:21:14] Voice 16: Rogers and the trust feel insulting that's because they are canceling our

[0:21:20] Voice 16: trustees and delaying until the winter holidays to spring this announcement

[0:21:25] Voice 16: then refusing postpone until March was so incredibly cynical I lost her words

[0:21:31] Voice 16: at least polite ones does the trust have any shame is any of this necessary

[0:21:37] Voice 16: cell phone coverage is already available throughout much of orange for those who

[0:21:42] Voice 16: cannot tolerate dead zones Elon Musk's Starlink currently offers satellite

[0:21:48] Voice 16: connectivity as two residents in this room can confirm. Earlier this year Rogers

[0:21:55] Voice 16: signed contracts with Starlink and Link Global to provide additional satellite

[0:22:00] Voice 16: wireless service to rural communities. When will our trust officials look up

[0:22:06] Voice 16: but two superior alternatives to an obsolete, unsightly, and risky tower

[0:22:12] Voice 16: and a glaring lack of public consultation show that we are nowhere near concurrence.

[0:22:20] Voice 16: If I could make a motion, I would move to reject this irreparably flawed application

[0:22:24] Voice 16: from a bullying Toronto corporation outright, not reconsider it, throw it out.

[0:22:32] Voice 16: We can do so much better than this.

[0:22:35] Voice 16: We already are.

[0:22:37] Voice 16: Okay,

[0:22:44] Voice 10: With respect to the process, I just want to, for the tower proposal, I just want to summarize the timeline.

[0:22:54] Voice 10: So June 2022, the correspondence with the trust between the Rogers and Trust Committee.

[0:23:01] Voice 10: In September 8th, I believe, we passed our model strategy for Hartley Island,

[0:23:06] Voice 10: requiring that our process be followed, which Rogers refused to do. And then finally in November we were given

[0:23:13] Voice 10: a notification that this proposal was in place and you know it would appear that

[0:23:19] Voice 10: our trustees were completely in the dark of this whole process. It was happening

[0:23:23] Voice 10: behind their back. I just want to point out another problem. We had an election in

[0:23:28] Voice 10: there and if that election knew, if this community knew that we were, that this

[0:23:35] Voice 10: proposal was happening I believe that election would have had a different

[0:23:38] Voice 10: outcome or quite possibly we finally would have had the referendum on the

[0:23:42] Voice 10: tower that everybody's asking for to me the fact that the election happened

[0:23:48] Voice 10: without consultation to our community indicates there was election interference

[0:23:52] Voice 10: by the trust and I can see it as no other explanation now I want to talk

[0:23:59] Voice 10: about one other thing into this relating to the to the home sharing and the APC

[0:24:06] Voice 10: thing. In my hand, I have a staff report dated January 9th, 2017. And in it, it actually

[0:35:11] Voice 6: Fiber optics is a second option. Taxpayers on Harmony are already supporting this with their tax dollars.

[0:35:20] Voice 6: individuals can bump up the speed apparently to 5g with the blaster if they want other individuals

[0:35:28] Voice 6: can choose to opt out there will be no tower no trees need to be cut down the land rogers has

[0:35:37] Voice 6: proposed to use for their cell tower can still be used as earmarked for the working

[0:35:43] Voice 6: housing. Over 300 people have signed a petition saying no to Rogers Tower. Island Trust has

[0:35:54] Voice 6: a copy of that petition. We know Island Trust does not have insurance on cell towers. I

[0:36:05] Voice 6: have read many scientific reports on the dangers to health of all living things to do with

[0:36:13] Voice 6: with, I can't remember the initials, but it's to do with the magnetic field and radio waves.

[0:36:21] Voice 6: In my language, not the silicon.

[0:36:24] Voice 6: I'm hopeful that my honoured trustees have also found the time to educate themselves of these studies,

[0:36:31] Voice 6: and I hope they respect my concerns.

[0:36:34] Voice 6: concerns. Roger's rep did not follow the process, and others have spoken to this in the past.

[0:36:44] Voice 6: This community needed answers to these concerns, and the community has a right to be heard.

There was a long list of problems and my clients, because I was hired to fix the mess basically, but my clients hired engineers, an envelope engineer and a structural engineer to address the issue.

[1:18:06] Voice 3: and they were found to be not building up to code basically. They failed the rough

[1:18:13] Voice 3: structural etc etc. There's a whole list of problems. So they were fired, including

[1:18:20] Voice 3: the architect, you know, because they would not fix and pay for the problems.

[1:18:26] Voice 3: And there's a long list that has nothing to do with the debt. So I was hired to fix

[1:18:33] Voice 3: everything and also complete the job and I was given the plans at my request

[1:18:39] Voice 3: the architect gave me the plans issued for construction plans and those plans

[1:18:44] Voice 3: included the deck and I had no idea that the deck was never part of the original

[1:18:53] Voice 3: application because I came in the drywall was already on the walls okay so

[1:19:00] Voice 3: that's the stage we were at so i came in issued for construction plans i had a permit number

[1:19:05] Voice 3: sitting plan everything there and i had no idea that we were because i built it according to the

[1:19:13] Voice 3: plans that we were actually encroaching with some piers because we were built on concrete piers

[1:19:19] Voice 3: into the 15 meter setback boundary from the sea so we still we built we built it

[1:19:27] Voice 3: And we were at a stage where it was almost completely done, we were just decking on a few little sections, and then I noticed the bylaw officer, he came over, inspected it, he requested a survey, we provided the survey, and sure enough, you know, I asked him, well don't you have the same set of plans I do?

[1:19:50] Voice 3: and I showed him my plans, he says, you know, I'll go back to the office and I'll send you a copy of what we have.

[1:19:58] Voice 3: And that's the first time I saw that there was a difference.

[1:20:02] Voice 3: So we immediately asked, okay, what's the process, because the deck's done basically at this point,

[1:20:08] Voice 3: you know, it just doesn't, at that point it was done.

[1:20:12] Voice 3: What's the process, variance, application, et cetera, et cetera, et cetera.

[1:20:16] Voice 3: So, they requested us to get in touch with First Nations, we did, they said there was no issue, you don't need us to have that permit, they don't need to inspect because, you know, they weren't concerned about it.

[1:20:31] Voice 3: they asked for a green shores engineer to be brought on to assure you that this this deck

[1:20:40] Voice 3: was would interfere with the bank or erosion or anything like that would be a problem in the

[1:20:47] Voice 3: future and he determined in his report it was minimal impact if any because the way we built it

[1:20:55] Voice 3: and it only you know it was still firm enough quite quite a distance away from the bank

[1:21:00] Voice 3: so there's a report she has that and here we are so again my clients the homeowner had no idea I

[1:21:13] Voice 3: had no idea you know usually because when I build we entrust the architect to take care of all of

[1:21:20] Voice 3: that you know I was getting the plans the issue for construction permit number on it it was an

[1:21:29] Voice 3: honest mistake so yeah not that awkward i know any

[1:23:52] Voice 3: in that kind of character leasers out over them and it's all it's only 22 inches off the ground

[1:23:59] Voice 3: so it's not so towering thing or anything so they determined that you know we didn't we didn't

Trustee Allen reported on the following:

Trustee Scott reported on the following: 
 Input from members of the Hornby Island Ferry Advisory Committee contributed to 
B.C Ferries summer season use of the bigger ferry “Quinitsa” for Hornby Island, and 
of two ferries for Denman Island, which seems to have worked well. 
 Conservancy Hornby Island is holding a ForestFest event in October to celebrate 
local forests and ecosystems, to include guest speaker John Vaillant, author of Fire 
Weather. 
 An amazing year for coho and spring salmon around Hornby Island. 
3.2 Chair's Report 
Chair Peterson reported on the following: 
 The June Trust Council meeting included work on the new corporate planning 
process which integrates strategic and financial planning; and an initiative to 
improve the First Nations referral process. 
3.3 Electoral Area Director's Report 
None. 
4. PUBLIC COMMENTS 
Members of the public asked or noted the following: 
 Having a 3-minute time limit for members of the public to speak at a public meeting is 
unacceptable. In the past there were no time limits. 
o The Chair noted that the agenda allotted 15 minutes for the Public Comments period; 
and there were 9 speakers wanting to speak. 
o A Trustee noted that, in the past, meetings were extended to accommodate people 
who wanted to speak. 
o A Trustee noted that Public Comments had been moved from the end of the agenda to 
the beginning so that speakers would not have to wait so long to speak. 
 A representative from the Hornby Island Community Economic Enhancement Corporation 
(HICEEC) made a call for support from the Local Trust Committee (LTC), the Islands Trust, 
and the Comox Valley Regional District (CVRD) for two current HICEEC grant applications to 
fund affordable housing initiatives. There will be an upcoming public consultation event at 
the Hornby Island Community Hall. Further support is sought for rectifying language in the 
bylaws regarding the Public Use Zone, to make affordable housing in this zone possible.

 A former Trustee spoke on the history and insecurity of affordable housing on Hornby 
Island. Barriers to affordable housing remain strong; so, a range of solutions is needed to 
overcome them.  
o A Trustee acknowledged that the recent report “Housing and Land Use on Hornby 
Island prepared by Tony Law, dated August 2023” was comprehensive and appreciated. 
 Most residents overwhelmingly rejected a previous Telus cell tower proposal like the one 
that Rogers is currently proposing. Residents are still waiting for a face-to-face meeting with 
a Roger’s representative. Hornby already has decent cell phone coverage, with dead zones 
able to be serviced by Starlink. Rogers has recently signed contracts with Starlink, which 
indicates that the Roger’s cell tower proposal is obsolete. Trustees should reject the Roger’s 
application. 
 If a referendum on Roger’s proposed cell tower had taken place before the last LTC election, 
it could have changed the outcome of the election. 
o An applicant to the Advisory Planning Commission (APC) expressed concern about 
being denied appointment to the APC. The Chair reminded that the APC election 
process is done in camera. 
o A Trustee responded that it was not permitted to make public why a person was 
selected to be on the APC. 
o Planner Zupanec noted that government hiring, firing, and appointments were all done 
in camera, as a legislated requirement. 
o A member of the public responded that the secrecy surrounding Hornby APC 
appointments was a problem. 
  A current subdivision applicant expressed concern that Planning and Bylaw Enforcement 
Staff are targeting their application with bylaw contraventions, while letting other 
developments on the island with similar issues go ahead. 
 Starlink is fast and reliable, and the cost is coming down. Over 300 people have signed a 
petition against the Rogers cell tower proposal, which is unsightly, health hazardous, and 
obsolete. Trustees should educate themselves on the cell tower health studies. Trustees 
have the legal power to say ‘no’ to the tower. 
 There is a need for an environmental assessment of the Rogers Cell Tower proposal. 
  A representative from the Hornby Island Housing Society (HIHS) spoke on current 
affordable housing initiatives and issues. 
o A Trustee thanked them for all their work and congratulated that the HIHS was the first 
housing group to give feedback to the Regional Planning Committee. 
 A cell tower on Hornby Island is a massive fire and health risk. Trustees should work for the 
people who elect them and reject the cell tower proposal.  
 Overwhelming numbers of tourists in illegal rentals are killing the Hornby Island 
environment which the Trust has a mandate to preserve and protect. 
 Young people who are sustaining residents in their old age should not have to be living in 
campers. 
 
The Chair clarified that the LTC had the option to concur or not concur to the Rogers cell tower 
proposal; however, non-concurrence could be overruled by the Federal Government.

think that they would overrule this new Roger’s proposal.

8.1 Rogers Cell Tower Proposal - Staff Report 
Planner Thomaidis presented the staff report that recommends that Trustees require 
that Rogers align their proposal with the Hornby Antenna Strategy notification content 
requirements, which are more expansive than the default federal notification 
requirements. 
Brian Gregg noted the following: 
 Rogers was amenable to conducting expanded notifications. 
 Many current Telus customer residents had requested that Telus be permitted 
on the Rogers structure and a major update is that Telus is formally now part of 
the Rogers proposal and would be sharing the tower and adding their 
equipment to it. Customers of Telus and its subsidiaries such as Koodo, Public 
Mobile, Bell, and Virgin Mobile; along with Rogers and its subsidiaries such as 
Fido, and Chatter: nearly every service provider other than Freedom Mobile 
could be serviced.

It was MOVED and SECONDED, 
1. that the Hornby Island Local Trust Committee request that staff work with Rogers to 
ensure that any future written notification meets the Hornby Antenna Strategy 
notification content requirements; and  
2. that the Hornby Island Local Trust Committee request that staff work with Rogers to 
provide a list of addresses of property owners and residents not yet notified of the 
proposal, within a notification distance of ten metres for every one metre in height from 
the base of the proposed antenna structure; and request that Rogers send written 
notice of the proposal to these remaining property owners and residents; and  
3. that the Hornby Island Local Trust Committee request that Rogers send written notice 
of the proposal to the School District and ambulance services.

8.2 HO-DVP-2022.4 (5905 Maclean Road) - Staff Report 
Planner Thomaidis presented the staff report that recommends that Trustees approve 
the Development Variance Permit (DVP) application HO-DVP-2022.4, which seeks to 
rectify existing siting contraventions, because there are insignificant affects to 
neighbouring properties, public beach access, surrounding ecology, or the intent of the 
bylaw regulation. 
The applicant’s representative, who introduced himself as the new builder hired by the 
applicants to correct the errors of the previous builders, explained that unfortunate 
mistakes had been made by the original architect and builders, mistakes which the 
applicants had spent considerable time and money to correct. Kómox First Nation (KFN) 
had reviewed the application and determined that it did not require a Cultural Heritage 
Investigation permit. A representative from Environment Canada had also inspected the 
site and saw no issues.

9.1 Major Project proposal Endorsement for Fiscal 2024/2025 Budget Process - Staff 
Report 
Planner Thomaidis presented the staff report prepared by Regional Planning Manager 
Jamurat that asks Trustees to endorse the proposal for First Nation Relationship-
Building Major Project, for inclusion in the 2024/2025 Islands Trust budget.

that the Hornby Island Local Trust Committee endorse the proposal for First Nation 
Relationship Building-Major Project and that the Hornby Island Local Trust Committee 
request staff forward the proposal to the Islands Trust Regional Planning Committee and 
Financial Planning Committee for consideration of inclusion in the 2024/2025 Islands 
Trust budget.

9.2 Major Project: Hornby Island Official Community Plan / Land Use Bylaw Review 
Project – Memorandum 
Planner Zupanec updated Trustees that staff have been working on a draft capacity 
funding agreement with the staff from the K’ómoks First Nation (KFN) to allow KFN staff 
to review the scope of potential amendments to the Official Community Plan (OCP) and 
Land Use Bylaw (LUB) regarding First Nations references, housing options, and 
regulating short term vacation rentals.  
 
A Trustee expressed concern that the drafting of bylaws for the OCP/LUB Review Project 
was being rushed; and, that recent submissions and the Advisory Planning Commission’s 
(APC) key recommendations for housing information needed further consideration. 
 
The APC Chair commented that the housing recommendations in the recent submission: 
“Housing and Land Use on Hornby Island prepared by Tony Law, dated August 2023,” 
had been substantially included in the APC’s March 2023 recommendations document. 
 
The Chair clarified that Trustees wanted regulations regarding short term vacation 
rentals (STVR)s; but that they wanted the Temporary Use Permit (TUP) application for 
STVRs references removed from the Project Charter. 
 
HO-LTC-2023-039

that the Hornby Island Local Trust Committee direct staff to amend the Project Charter 
to remove references of temporary use permits for short term vacation rentals.

Trustees acknowledged the 48-page document from former Trustee Tony Law, 
submitted to the LTC on August 27, 2023, that 1) proposes a comprehensive approach 
to land use planning for housing on Hornby Island; and 2) provides a description and 
context for the error in the "Public Use Zone" which needs correction for the HICEEC 
proposal for community housing in the public use zone south-west of Central Road to be 
permitted.

that the Hornby Island Local Trust Committee direct staff to amend the current Land 
Use Bylaw Project Charter to correct the error in the Public Use Zone to provide for 
community housing.

11.2 Letter of support for the Hornby Island Community Economic Enhancement 
 Corporation (HICEEC). 
A Trustee expressed apprehension regarding extra content in the letter of support 
drafted by HICEEC for Trustee endorsement; and questioned the Trust policy and 
protocol regarding letters of support from Trustees. 
o Planner Thomaidis responded that the Regional Planning Manager could draft a 
letter of support, as has been done by LTCs in the past.

that the Hornby Island Local Trust Committee direct staff to prepare a letter of support 
for the Hornby Island Community Economic Enhancement Corporation regarding 
funding for affordable housing, under the Chair’s signature.
