[0:00:52] Voice 5: uh we have one item on the agenda which is the major project it's the draft proposal for the
[0:01:01] Voice 5: uh 2024-25 budget uh process starting on page two and uh regional planning manager

[0:01:21] Voice 3: confirmation that unfortunately um trustee uh grant won't be able to but grant scott won't
[0:01:27] Voice 3: be able to make it today. So we won't, we won't see him tuning in for this one. But he's okay

[0:02:07] Voice 3: of everyone's time today so the purpose of our meeting is to recap or or run through some of
[0:02:16] Voice 3: the aspects of Hornby RLTC's major project proposal that's going forward as a business
[0:02:26] Voice 3: case for the next fiscal year, so 2024-2025. And the project request and direction that we received
[0:02:34] Voice 3: from the LTC was to look at First Nation relationship building and aspects for the
[0:02:45] Voice 3: the next fiscal year and move that into a major project request. So there's three outstanding
[0:02:50] Voice 3: areas that I wanted to check in with you on and get your feedback on because I understand there
[0:02:57] Voice 3: wasn't any conversation at the last when this report was brought forward. So this will really
[0:03:03] Voice 3: help me inform the business case that I'll be preparing and submitting in the next steps of
[0:03:09] Voice 3: this process going through the budget process to the Financial Planning Committee and the
[0:03:15] Voice 3: the Regional Planning Committee as well. So those three aspects I'm going to talk to you about are
[0:03:20] Voice 3: going to be the scope of work and a couple key questions there to check in with you on.
[0:03:25] Voice 3: The level of involvement and what that looks like for priorities and the types of activities and
[0:03:32] Voice 3: actions that I want to get your feedback on to make sure we haven't missed anything.
[0:03:37] Voice 3: So for the first aspect that I wanted to check in with you on is about the confirmed proposal
[0:03:45] Voice 3: proposal and scope of the and what we're looking for is desired results so staff recommends that
[0:03:54] Voice 3: we take a broader approach so there was direction given back in June that this this work could
[0:04:02] Voice 3: include specific aspects like conversations about traditional knowledge mapping with Comox First
[0:04:09] Voice 3: Nations how we use covenants what I'm suggesting is that's that's too specific because of where
[0:04:16] Voice 3: we're at right now if we don't have any um if if the ltc hasn't established any conversations or
[0:04:22] Voice 3: you know just asking comox are you interested in having this conversation with us um or meeting
[0:04:29] Voice 3: them for coffee or anything like that that's probably jumping ahead a little bit too much
[0:04:34] Voice 3: so what i'm suggesting overall this this approach be for next year's work is to really just focus
[0:04:41] Voice 3: on the relational aspects. Reaching out to Comox's chair and council to have those conversations.
[0:04:51] Voice 3: If there's a meal to have with them and to talk about what their interests are and what your
[0:04:56] Voice 3: mutual interests are, let's do that first and then worry later on about any specific aspects.
[0:05:03] Voice 3: So that's going to be the scope, basically the scope of this work. So what I'm asking for your
[0:05:09] Voice 3: direction on is does that scope make sense and what I've described as some examples of what that
[0:05:18] Voice 3: could be for this work would be like phone calls meetings any sort of activities and I'm leaving
[0:05:26] Voice 3: that up to chair and trustees to to think about and to decide on but identifying that in a more
[0:05:33] Voice 3: general way for this business case um to allow that that time to happen and um and the related
[0:05:40] Voice 3: budget for that to happen so does that does that make sense to you in terms of the way forward for
[0:05:46] Voice 3: this next year yeah
[0:05:50] Voice 7: how do we do that fine through the chair um go ahead well you know in terms of
[0:05:56] Voice 7: those specifics that we that we included
[0:06:01] Trustee Allen (probable): in our motion um like i've you know in terms of what you
[0:06:06] Trustee Allen (probable): you recommend in terms of broader approach identified by the LTC? Frankly, I really want
[0:06:11] Trustee Allen (probable): to know what they want, where they want to go, how they want to do it. So one of them is work
[0:06:16] Trustee Allen (probable): with Comox First Nation to determine how they wish to be engaged. That's what I think is the
[0:06:22] Trustee Allen (probable): beginning. I don't think we should be directing it, frankly. Because back in 2014 and 2018,
[0:06:31] Trustee Allen (probable): we've had elected to elected meetings, and they've been really great. And then unfortunately,
[0:06:38] Trustee Allen (probable): Because what's going on here is we all know that what happened down at the Thatch is still an open wound.
[0:06:45] Trustee Allen (probable): And, you know, then it got opened again by the BC Ferries.
[0:06:50] Trustee Allen (probable): And you read the articles, you go to Clomox First Nations website, and there it is, right?
[0:06:54] Trustee Allen (probable): You know, right at the beginning, Oranby Island indigenous midden desecrated in BC Ferries thermal construction.
[0:07:02] Trustee Allen (probable): Right there, the news up on our page.
[0:07:06] Trustee Allen (probable): So we are not looking good.
[0:07:10] Trustee Allen (probable): um so instead of us driving that i really think that we should see what they want to do and i
[0:07:17] Trustee Allen (probable): know we send a letter out i don't think i saw the letter that went out and claire indicated that at
[0:07:22] Trustee Allen (probable): the trust council that she's not heard a response is that correct chair peterson or renee i haven't

[0:07:40] Voice 5: further information on that um but i i appreciate uh what you have to say there trustee allen that
[0:07:48] Voice 5: that same line uh the bullet work with komox to determine how they wish to be engaged
[0:07:54] Voice 5: um was was the thing that i had highlighted there um and yes i absolutely appreciate that these
[0:08:04] Voice 5: these issues around the the ancestral burial sites um and the the disturbance of them around
[0:08:12] Voice 5: the terminal area and the thatch pub area that's that's uh significant and as you say you know an
[0:08:21] Voice 5: open wound a painful painful situation
[0:08:22] Voice 7: um i think what so we need to we need to do some reaching out
[0:08:36] Voice 5: to exactly like to determine as we say how how they wish to be engaged um in terms of
[0:08:43] Voice 5: the and i don't know if i'm uh anticipating too quickly here um uh manager uh gemra but uh
[0:08:55] Voice 5: there's two options laid out here um
[0:09:01] Voice 7: and there's uh
[0:09:07] Voice 5: one is to focus on actions to initiate and
[0:09:09] Voice 5: continue relationship building and two is to explore the interest to initiate a memorandum
[0:09:15] Voice 5: of understanding or protocol agreement um from my perspective i think option one leads to option two
[0:09:24] Voice 5: i wouldn't want to rule out option two um but i think to get to option two the first step to
[0:09:35] Voice 5: option two is is is to start with option one uh from my perspective so i think we need to
[0:09:43] Voice 5: I'd like us to leave the door open
[0:09:48] Voice 5: if the nation wants to
[0:09:51] Voice 5: work towards a memorandum of understanding or a protocol agreement
[0:09:54] Voice 5: that would be wonderful but I think we don't come in

[0:10:02] Voice 3: any maybe preconceived ideas
[0:10:05] Voice 5: yeah we don't come in with preconceived ideas and we don't
[0:10:08] Voice 5: come in saying hey do you want a memorandum of understanding I think we need to start
[0:10:11] Voice 5: um work on that relationship and uh you know being mindful that that that the events of the
[0:10:22] Voice 5: past couple years on hornby and that um have as trustee allen said it's essentially an open wound
[0:10:30] Voice 5: and so we need to be we need to be open and listening um and really mindful in our approach
[0:10:38] Voice 5: so that's my thoughts we're on the same page

[0:10:47] Trustee Allen (probable): same brain here um i felt that exactly i thought let's not rush into and i've also looked at other

[0:11:00] Trustee Allen (probable): familiar with friendship accord it's it's a really interesting way that first nations are
[0:11:07] Trustee Allen (probable): engaging with other with um there's nova scotia there's a lot of i could send this to you but it's
[0:11:14] Trustee Allen (probable): And basically, it's like, it's a toolkit in terms of dealing with First Nations.
[0:11:20] Trustee Allen (probable): It starts with why do you want to form a partnership?
[0:11:22] Trustee Allen (probable): What benefits do you hope to see from a stronger relationship?
[0:11:25] Trustee Allen (probable): What is your current relationship with these communities?
[0:11:27] Trustee Allen (probable): Are there issues or conflicts?
[0:11:29] Trustee Allen (probable): What are the potential areas where we could collaborate?
[0:11:32] Trustee Allen (probable): So these are all things that I think we need to go and approach them right from the get-go
[0:11:38] Trustee Allen (probable): at the beginning, and then let them steer this.
[0:11:42] Trustee Allen (probable): Let them, you know, as they say, grab their own paddle, and then we will jump in.
[0:11:45] Trustee Allen (probable): and join them um so i i look at it as different stages and the fact that um their terms are only
[0:11:53] Trustee Allen (probable): two years and
[0:11:55] Voice 7: i know i know it was brought up in multiple years this
[0:11:59] Trustee Allen (probable): whole initiative i don't i'd
[0:12:03] Trustee Allen (probable): see it more of a shorter term like just engage with this particular council right now so you
[0:12:09] Trustee Allen (probable): know just basically how can we help better represent their interests and uh and improve
[0:12:15] Trustee Allen (probable): the referral process I wrote down and more education stewardship regarding heritage sites
[0:12:22] Trustee Allen (probable): and also the place names. Shigal Spit is actually called Plak Dau and then I was noted that we're
[0:12:32] Trustee Allen (probable): not following their cultural heritage policy and that's what was Chief Rempel brought that up
[0:12:38] Trustee Allen (probable): in the beginning of the whole thatch
[0:12:40] Voice 7: issue and so I didn't get a chance to even look that up
[0:12:45] Voice 7: because we just got
[0:12:47] Trustee Allen (probable): out of trust council so yes i would like us to see us go start with
[0:12:53] Trustee Allen (probable): number one and then uh see what unfolds so through
[0:13:00] Voice 3: the chair um so i i can absolutely um
[0:13:04] Voice 3: work that um that direction into the proposal in the business case to keep them both here and
[0:13:13] Voice 3: and explain, keep them both as part of this overall business case, talk about first, we're
[0:13:21] Voice 3: going to do this, then if that happens, and we get to this piece, I can even change that wording
[0:13:28] Voice 3: and not word it in a way that sounds very, I wanted to move away from the wording of a protocol
[0:13:34] Voice 3: agreement, because like you said, Trustee Allen, there are other ways to talk about what works,
[0:13:40] Voice 3: um along with Comox First Nations and what they're interested in so I can even um make that
[0:13:46] Voice 3: wording maybe not call it something like a memorandum or or protocol maybe don't use those
[0:13:52] Voice 3: words but get uh convey what you explained about um exploring those ways of of moving forward
[0:14:00] Voice 3: together with Comox First Nations so I can do that that helps me thank you um what I'd also
[0:14:08] Voice 3: like to cover or ask so what I'm also capturing is and we'll have time to identify some more
[0:14:18] Voice 3: actions what I wanted to check in with you on is what I'm hearing today I'll describe as examples
[0:14:26] Voice 3: of some maybe some interests or areas that we could talk about but I think the idea and the
[0:14:34] Voice 3: the approach um what i'm hearing is nothing specific it's more about talking about some ideas
[0:14:39] Voice 3: as um comox first nation might be interested in in talking about um so really leaving that piece
[0:14:47] Voice 3: up to how the conversations unfold so we won't um we're not going to have a list of things we
[0:14:54] Voice 3: we need to talk about that's not the intent the intent is to really just form these initial
[0:15:00] Voice 3: conversations in a relationship, right? So I'll capture that as well. So that helps me. Thank you.
[0:15:08] Voice 3: The other aspect I wanted to flag and bring up for the LTC is the part of the LTC's commitment
[0:15:21] Voice 3: to the project. So what I'll be suggesting in the business case is, and I wanted to get your
[0:15:28] Voice 3: confirmation on is that this is a priority for the ltc it really needs to be something and i'm
[0:15:35] Voice 3: hearing that today it really needs to be championed and led by the hornby ltc in reaching out to chief
[0:15:42] Voice 3: and council staff will be here to support and that's what i'm working through is identifying
[0:15:48] Voice 3: and making sure that you have the staff report to say hey we're going to do a meeting or let's
[0:15:54] Voice 3: do a workshop and we we have the resources and the people and the time to do that for you right
[0:15:59] Voice 3: and to support you in those conversations so that's why it helps but I do want you to also
[0:16:05] Voice 3: recognize and get that confirmation which I think I have today and I'm hearing it is that this
[0:16:11] Voice 3: project is a priority and it could be a priority over the next couple fiscal years so I'm saying
[0:16:17] Voice 3: that in the business case in a way to identify that could be in addition to next year it could
[0:16:23] Voice 3: It could take a couple of years and it's ongoing.
[0:16:25] Voice 3: These conversations are ongoing.
[0:16:27] Voice 3: And I just wanted to take the pulse of that piece.
[0:16:32] Voice 3: I didn't want to speak out of turn through the business case.
[0:16:35] Voice 3: So I just wanted to check in with you on that as well.

[0:17:55] Voice 5: as we noted earlier, it's a little abrupt, I think, to start suggesting that.
[0:18:04] Voice 5: So indeed, if they suggest some kind of an alternative arrangement to those sort of more
[0:18:10] Voice 5: more formal government-y type agreements,
[0:18:16] Voice 5: then it sounds like Trustee Allen's open to that.

[0:19:09] Trustee Allen (probable): a two-day session with them and i just want to quote what she said as leaders in our community
[0:19:16] Trustee Allen (probable): chief and council believe it is imperative to develop strong relationships with our neighbors
[0:19:20] Trustee Allen (probable): on both a political and administrative level by participating in these sessions we're all
[0:19:26] Trustee Allen (probable): working toward our own version of reconciliation reconciliation calls for community action this is
[0:19:32] Trustee Allen (probable): an opportunity for us to be the catalyst for change our fundamental objective was to create
[0:19:37] Trustee Allen (probable): a collaborative process which would enable us each of us to engage openly and constructively
[0:19:43] Trustee Allen (probable): about our relationships to assess both the positive and negative attributes and uh and of
[0:19:49] Trustee Allen (probable): course they their their um byline or what is it is actually moving forward dare i say it i can't
[0:19:56] Trustee Allen (probable): pronounce the first nations word but yeah she kind of summed up basically what i felt back then and
[0:20:07] Trustee Allen (probable): what I still feel and hopefully that's what the new chief feels too.

[0:20:15] Voice 3: Trustee Allen I would like to if could I get a copy of that because I
[0:20:19] Voice 3: would like to include that as part of the business case too. I think that captures the intent here

[0:20:57] Voice 3: we can put together and you can give us some some ideas of things that the ltc can talk about
[0:21:05] Voice 3: out together. If there's any learning pieces you would like to pursue, like, you know, let's learn
[0:21:11] Voice 3: about different kinds of ways we can talk about this as we have our conversations with COMACs,
[0:21:17] Voice 3: right? Maybe there's friendship accords, there's other things out there. It allows that time for
[0:21:23] Voice 3: us to get together and talk about what are some good things or what are some things that we would
[0:21:27] Voice 3: like to pursue. So that's, that's, those are some of the ideas that I, that could happen.
[0:21:32] Voice 3: in um and if that's something to suggest what i'll do is i'll capture these ideas so that we start to
[0:21:38] Voice 3: we don't lose them as we we begin this work so that could be an opportunity for example so that
[0:21:44] Voice 3: that sounds good thank you i have that that direction that's good okay and the
[0:21:49] Voice 3: yeah no i
[0:21:51] Trustee Allen (probable): didn't want to talk about what's what's wrong about this whole scenario is that our development
[0:21:57] Trustee Allen (probable): approval permit process is just totally in conflict with the whole heritage you know the
[0:22:06] Trustee Allen (probable): whole cultural heritage policy and that's a huge thing and i don't know you know we can't bring it
[0:22:10] Trustee Allen (probable): up but we wouldn't have had that whole thing going on with that they would have stopped building but
[0:22:16] Trustee Allen (probable): apparently all the boxes were ticked and they can carry on no matter how upset first nations were
[0:22:21] Trustee Allen (probable): about that and that really troubles me but that's another bigger conversation um at a higher level
[0:22:27] Trustee Allen (probable): but so but i'll just say but it's just it's lurking there you know it's always lurking that
[0:22:32] Trustee Allen (probable): so and i don't know how yeah i don't know where to begin with that one to be honest and that's
[0:22:39] Trustee Allen (probable): what i'm struggling with in terms of reaching out and maybe they will they will start the
[0:22:46] Trustee Allen (probable): conversation and then we'll find out how they like us to deal with that because i have no idea

[0:22:54] Voice 5: well, and one of the things that that that brings up for me is last term when we had the reconciliation working group as a as a sub subcommittee.
[0:23:10] Voice 5: the whole notion that we as trustees are working inside this colonial system
[0:23:21] Voice 5: and we're trying to work and reach out to First Nations whose systems and ways of doing things
[0:23:31] Voice 5: don't necessarily mesh with our constructs and that there's going to be that tension.
[0:23:39] Voice 5: But the ways absolutely reaching out and having those tough conversations is the only way we're going to be able to sort of adjust our processes in a way that's essentially less offensive, I suppose, is one way of putting it, more in harmony with sort of the way that they might do business.

[0:25:06] Voice 5: uh i think uh both trustee allen and i agree that the the most reasonable starting point is to
[0:25:15] Voice 5: is to reach out and before we say, oh, we think we should have a protocol agreement or something
[0:25:24] Voice 5: else that we need to reach out sort of with an open mind and find out what they're thinking and
[0:25:32] Voice 5: how they want to work on trying to build a relationship before we sort of come with a
[0:25:37] Voice 5: framework saying this is how we're going to do step one, step two, et cetera. So that's sort of

[0:26:38] Voice 3: The process itself is also, I'm unsure of how to navigate it and I've been speaking with Director Cermak on how best to present this.
[0:26:52] Voice 3: So I'm still pursuing this coming as a business case to the Financial Planning Committee and the Regional Planning Committee, and suggesting that other potential sources might be the best way, using existing funding, the existing funding program on the Islands Trust Reconciliation Capacity Program,
[0:27:16] Voice 3: program, as opposed to requesting new capital money, for example, might help with the success
[0:27:23] Voice 3: of this project moving forward. So those are some of the aspects I'm also flagging as part
[0:27:29] Voice 3: of the business case. I just want you to also be aware of that, that I'll be identifying some
[0:27:36] Voice 3: other areas of funding sources to work on. The final point that I wanted to check in with you on
[0:27:45] Voice 3: was just that so including both like a step one and a step two in the work that would be happening
[0:27:52] Voice 3: over the next year and potentially the next couple years the cost estimate or sorry not the cost the
[0:27:58] Voice 3: budget estimate will reflect that and I'm also mindful to take your feedback on some of the ideas
[0:28:06] Voice 3: and help illustrate that in the business case when talking about that budget estimate so we
[0:28:12] Voice 3: we really have a good idea of, or I can explain that approach and match that with the budget
[0:28:19] Voice 3: estimate. It's not a fine science because we're dealing in ranges and we haven't pursued some of
[0:28:26] Voice 3: these activities before, right, and these actions. So I have the clarity, I believe, to be able to

[0:30:32] Voice 3: It'll be more than that, in that I'm actually estimating with the two pieces and the kind of work that could be involved, it could be more closer to about $10,000 to really make sure we have some time and the space.
[0:30:50] Voice 3: if we're contributing to Comox First Nation for example for their capacity and their time
[0:30:56] Voice 3: we need to account for that and I my initial numbers that I provided in that first step
[0:31:05] Voice 3: didn't include maybe as much of that as I did more more research since this report saw you last so
[0:31:12] Voice 3: that's how that would be reflected you might see a number closer to a range of five to ten or twelve
[0:31:19] Voice 3: thousand dollars to be able to allow that that space to happen um i might i might get uh no we
[0:31:26] Voice 3: have this much to to provide you through the existing funding sources and i'll bring that back
[0:31:32] Voice 3: and it sounds like we can we'll do our best to work within that okay

[0:32:45] Voice 5: there's a good chance that uh the proposal will be advanced but at a lower uh lower figure than
[0:32:52] Voice 5: initially proposed so that's that's just sort of how things seem to be rolling i know last year
[0:32:59] Voice 5: uh a lot of committees were asked to essentially chop a few thousand here and a few thousand there
[0:33:07] Voice 5: off a number of projects and that's sort of how things roll out. So I would just encourage you to

[0:33:21] Voice 5: to meet those requests and still be able to proceed in the way that the LTC would like to

CALL TO ORDER Chair Peterson called the meeting to order at 8:48 am. He acknowledged that the meeting was being held on the territory of the Coast Salish First Nations. He introduced himself, Trustees, Staff, and Recorder; and welcomed members of the public. He noted that Trustee Scott would be delayed in attending the meeting. 2. APPROVAL OF AGENDA By general consent the agenda was approved as presented. 3. BUSINESS ITEMS 3.1 Major Project: Draft Proposal for 2024/2025 Budget Process - for direction and endorsement Regional Planning Manager Jamurat presented the staff report, titled “Major Project Proposal Endorsement for 2024/2025 Budget Process” dated September 8, 2023, which recommends that Trustees endorse the proposal for First Nation Relationship-Building as a Major Project for budget consideration for the 2024/2025 fiscal year. Regional Planning Manager Jamurat offered that the Major Project could start with only Option 1: to focus on actions to initiate and continue relationship-building; or could also include Option 2: to explore the interest to initiate a Memorandum of Understanding (MOU) or protocol agreement with K’ómoks First Nation; and that the Major Project could extend over two years. Trustee Allen noted the following: ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Special Meeting Minutes September 29, 2023 It is important that K’ómoksFirst Nation (KFN) lead the terms of engagement. The 2018 Thatch situation, at which a KFN ancestral remains site was disturbed, was recently recapitulated for KFN when BC Ferries mistakenly removed an arbutus tree near the BC Ferries terminal site without consultation with KFN; as noted on the KFN website with the August 22, 2023 Chek News story “Hor nby Isl an d Indigenous midden ‘desecrated’ in BC Ferries terminal construction. It is not known if any responses to the introduction letters recently sent out to First Nations by the Director of Trust Area Services have been received. ‘Friendship Accord’ is an interesting new way that First Nations are engaging that should be explored. The focus should be on how to better represent First Nations’ interests by improving the First Nations referral process; expanding education stewardship of Cultural Heritage Sites; inclusion of First Nations place names; and proper adherence to First Nations’ policies on Cultural Heritage Sites. A 2018 letter from KFN Chief Rempel summarizes KFN’s vision for collaboration and reconciliation. o Regional Planning Manager Jamurat requested a copy of the hard copy letter to be included in the Major Project business case. Trustee Scott joined the meeting at 9:13 am. Planner Jamurat noted that the Major Project budget estimate could range from $5000 to $12,000, and include capacity funding for First Nations engagement; and that this business case would be reviewed by the Financial Planning Committee at their budget deliberations meeting on October 18, 2023. Planner Jamurat clarified that ‘Friendship Accord’ exploration would be included in Option 2. HO-LTC-2023-042 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee endorse the proposal for the First Nation Relationship Building Major Project, including Option 1 and Option 2.
