[0:02:42] So just recurring that from Andrew Allen, where he had one

[0:02:47] Voice 7: of the quarterly meetings of Trust Council.

[0:02:51] Voice 7: And I think it was a pretty good meeting, as those meetings are.

[0:02:56] They're exhausting, especially for chair and

[0:02:59] Voice 7: vice chairs who are trying to bring in 26 verbose trustees, members of the public, the weather, you know, strange sleeping situations.

[0:03:10] Voice 7: and we pulled it off um you might have explained that well i always bring my pillow but if i could

[0:03:18] Voice 7: bring my mattress i would so i don't know about you but it's got a tricky bag mattress is really

[0:03:23] Voice 7: an important thing that informs how successful you are during these proceedings when you're working

[0:03:31] Voice 8: one thing i found interesting it was a camera where we produced some legal

[0:03:37] opinions as to the

[0:03:38] authentic trust thing that we

[0:03:40] often quote as we protect

[0:03:41] trust area, local

[0:03:44] amenities, and

[0:03:45] Voice 7: the natural environment

[0:03:46] Voice 7: for residents and the

[0:03:48] Voice 7: population we see. That's it in a nutshell.

[0:03:51] Voice 7: And

[0:03:52] Voice 7: we've been wrestling, I think,

[0:03:54] since day one. A,

[0:03:56] what does it mean? B,

[0:03:58] is there a priority between those

[0:04:00] three requirements, the

[0:04:02] natural

[0:04:02] Voice 7: trust, the trust area,

[0:04:04] Voice 7: the area, the amenities and the natural environment.

[0:04:11] Voice 7: And, you know, that's always been a question.

[0:04:14] Voice 7: And I know that the review that they had last term,

[0:04:16] Voice 7: you were a part of that term.

[0:04:18] Voice 7: There was, the consultants identified some confusion

[0:04:21] Voice 7: amongst trustees as to what the heck does it mean?

[0:04:24] Voice 7: Is it all?

[0:04:24] Voice 7: So anyway, we had a chance in Canberra

[0:04:26] Voice 7: to look at our legal opinions,

[0:04:28] Voice 7: which are client privileged documents

[0:04:30] Voice 7: documents between Islands Trust and the Loyal Spice of Canberra.

[0:04:34] But we were able to come out of Canberra and at least I think bring some clarity to the fact that there are three distinct areas where we have jurisdiction and where we have to do our work.

[0:04:47] Voice 7: The trust area, Islands Trust area, which includes the lands of the islands and the, not the water,

[0:04:54] Voice 7: That's a provincial, and in some cases a federal area of responsibility with the land under the water to mid-chamber throughout the trust period.

[0:05:06] Voice 7: That's one. The unique amenities, unique amenities pretty much involve us,

[0:05:16] Voice 7: Our towns, our villages, our economic areas, our houses, our driveways, the things that

[0:05:26] Voice 7: we do on these islands, including our recreation, whatever that means for each island.

[0:05:31] Voice 7: And then, of course, the natural environment.

[0:05:34] Voice 7: The natural environment, though it's hard-pressed to really identify a natural environment that

[0:05:39] Voice 7: hasn't been modified by either last or first nations or even mother nature herself with

[0:05:45] Voice 7: you know used to be a mile of ice on top of him i mean that's not that's an interesting

[0:05:53] Voice 7: perspective i think the question whether there was a priority amongst these three was was not

[0:06:00] Voice 7: there was there is not a priority they're all really important we have to look at each

[0:06:04] Voice 7: and we have to balance the decisions that we make based on those three areas

[0:06:10] Voice 7: Once we, as the local trust committee, have done that, have addressed those three areas

[0:06:15] Voice 7: with whatever we do, whatever bylaws we make or whatever policies or changes that we make,

[0:06:21] Voice 7: then we've done our job.

[0:06:23] Voice 7: I thought, okay, that's clear for me, it's clear for you, and the discussion will probably

[0:06:30] continue for the next 50 years, as to what it means.

[0:06:33] Voice 7: So I thought that was interesting, and that's the end

[0:06:38] Trustee Maude (probable): you went to the fund meeting

[0:06:40] Trustee Maude (probable): yeah

[0:06:44] Trustee Maude (probable): congratulating since it's my third week of

[0:06:46] Trustee Maude (probable): honest trust travel so

[0:06:48] Trustee Maude (probable): might be a little dazed and confused

[0:06:50] Trustee Maude (probable): but we had lots to do

[0:06:51] Trustee Maude (probable): two weeks ago I was at UDCM

[0:06:54] Trustee Maude (probable): which is the Union of British Funding and Scholars

[0:06:56] Trustee Maude (probable): which is a week long set of meetings

[0:06:58] Trustee Maude (probable): the primary

[0:07:00] interface that we go for

[0:07:02] is to have times

[0:07:04] with the provincial government bureaucrats

[0:07:06] and ministers,

[0:07:08] Trustee Maude (probable): really, a lot of time, a lot of energy,

[0:07:15] but we have focused things,

[0:07:16] where we now have the Minister of Transportation

[0:07:21] Trustee Maude (probable): agreeing finally after 20 odd years

[0:07:24] Trustee Maude (probable): to set up what they call a highways task force

[0:07:27] Trustee Maude (probable): for the islands.

[0:07:28] Trustee Maude (probable): I don't know why they chose the word task force,

[0:07:31] Trustee Maude (probable): but basically it's gonna be a group of Miles Trust

[0:07:34] Trustee Maude (probable): trust and ministry staff to talk about road priorities, protections, and such.

[0:07:41] So instead of doing this ad hoc, we have an issue.

[0:07:45] What are we going to do about it?

[0:07:46] We're actually going to meet regularly and have hopefully really positive

[0:07:51] outcomes for the islanders.

[0:07:54] We've been asking and asking for it, and

[0:07:56] Trustee Maude (probable): it took five minutes with the

[0:07:58] Trustee Maude (probable): ministry to go, let's make it happen.

[0:08:00] Trustee Maude (probable): So that was one little thing.

[0:08:04] Trustee Maude (probable): our nurse practitioner just left the island a couple of weeks ago we can't info and so

[0:08:11] Trustee Maude (probable): a nice like in the in the elevator type discussion with the minister of health

[0:08:16] Trustee Maude (probable): and and sort of raising awareness on the islands the challenges of health care and and he really

[0:08:23] Trustee Maude (probable): seemed to get it and those things that makes it really worthwhile um last week was a trust

[0:08:30] Trustee Maude (probable): Council, as Trustee Guerin was saying, and it was interesting. We spent a half a day developing

[0:08:38] a mission statement for the

[0:08:41] Trustee Maude (probable): House Trust. 50 years we haven't had one. And by June, we actually had

[0:08:52] Trustee Maude (probable): one. We voted on it. Hands up, it was done. Within the hour, it was posted to the House Trust

[0:08:59] Trustee Maude (probable): website everybody was quite excited excited we actually did something well that lasted 22 hours

[0:09:06] Trustee Maude (probable): and and that got rescinded so we're we're back in the thinking stage again it's just

[0:09:14] Trustee Maude (probable): sometimes you take two steps forward sometimes you take two steps back but

[0:09:18] Trustee Maude (probable): and certainly by the third day we had power problems and internet problems and all sorts

[0:09:24] Trustee Maude (probable): of fun which then rolled over to to last friday with north pander i can just go on half an hour

[0:09:29] Trustee Maude (probable): what happened at that meeting but we're lucky we actually managed to make it happen um and then

[0:09:35] Trustee Maude (probable): we're here today and i really want to thank the advising advisory task force for their work the

[0:09:43] Trustee Maude (probable): the amount of information you've generated over these past couple of months and the amount of

[0:09:51] Trustee Maude (probable): of energy that you're putting into this stuff is overwhelming is the oftentimes within your

[0:10:00] Trustee Maude (probable): office these things move in a slow snail's pace and you guys are the roadrunner and i really

[0:10:06] Trustee Maude (probable): appreciate like the thought and the insight and the time that you're putting into things

[0:10:10] Trustee Maude (probable): and hopefully that this meeting and future meetings this is all going to bear fruit for

[0:10:15] Trustee Maude (probable): you guys because this is the stuff you need so we really thank you for that um and i think i

[0:10:21] Trustee Maude (probable): better just be quiet now. Because I can go on and on and on

[0:10:25] Trustee Maude (probable): because we've been having so much. It's great. So I don't

[0:10:30] Trustee Maude (probable): know our electoral drift does not seem to have joined us.

[0:10:34] Trustee Maude (probable): Unfortunately, because there are quite a few regional district

[0:10:37] Trustee Maude (probable): issues that I think we're gonna be touching on today. So we'll

[0:10:40] Trustee Maude (probable): move on to what we call public comments. So as you know, we're

[0:10:46] Trustee Maude (probable): very busy with the rules here. It's supposed to be two minutes

[0:10:49] Trustee Maude (probable): but put your hand up if you could just let you give your name and we'll go through the room and

[0:10:56] Trustee Maude (probable): we'll make this happen so ma'am you were first

[0:11:01] Voice 7: you i'll stand up and take

[0:11:03] Voice 7: the mask off um i'm here today to address the issue of cross-island fairy traffic um i'm a

[0:11:11] Voice 7: member of a group called forensic denim forest i'm not speaking on behalf of them today speaking

[0:11:17] Voice 7: on behalf but based on the considerable work that we have done since last february

[0:11:24] Voice 7: some of the accomplishments we've stopped the tree cutting at gravel bay those trees were

[0:11:30] Voice 7: not only scheduled to be cut but they were also damaged which is serious we

[0:11:37] Voice 7: then did a legitimate survey a very comprehensive survey of denman islanders and we had over 450

[0:11:45] Voice 7: responses to that survey about how people are experiencing the congestion and the speeding

[0:11:53] Voice 7: and all of the problems related to the cross-island traffic.

[0:11:57] Voice 7: In May, we held an event in the back hall to release those statistics with the data

[0:12:04] Voice 7: that we collected from the survey.

[0:12:07] Voice 7: We made a donation to the varied advisory committee in May.

[0:12:13] Voice 7: and then we spoke at the

[0:12:15] Voice 7: BC public meeting

[0:12:16] Voice 7: and then in June

[0:12:21] Voice 7: we sent a very comprehensive

[0:12:23] Voice 7: package, it was 52 pages

[0:12:25] Voice 7: and we sent that package

[0:12:27] Voice 7: to over 40 people

[0:12:29] Voice 7: including yourselves and

[0:12:31] Voice 7: politicians, ministry officials

[0:12:33] Voice 7: BC fairies, etc

[0:12:34] Voice 7: and that package included a lot

[0:12:37] Voice 7: of very comprehensive research

[0:12:39] Voice 7: that we had done including the results

[0:12:41] Voice 7: in our survey, statistics that we had collected about numbers of vehicles from BC 50s, letters

[0:12:49] Voice 7: from seven positions resident on Gannon Island, as well as community groups including the Climate

[0:12:56] Action Network,

[0:12:57] Voice 7: etc. The first response that we had to our package was a very enthusiastic and

[0:13:06] Voice 7: supportive response from one of the Hornby Island trustees. So we know that there are people on

[0:13:16] Voice 7: Hornby Island that are also troubled by us, Denman Island, being the speed bump to Hornby.

[0:13:24] Voice 7: And we know that there are, we believe strongly that there are solutions to this during the

[0:13:31] Voice 7: the summer months. So this is what we continue to advocate for. Why we think this is a land use

[0:13:37] Voice 7: issue, and this is really the crux of what I want to say, is because the detrimental effects

[0:13:43] Voice 7: to human health, non-human health, and ecosystem damage are huge. We have studied those and listed

[0:13:54] Voice 7: of those. Animals get killed on the road. People cannot cycle, walk, ride their horse,

[0:14:01] Voice 7: have their children out on the road safely. We have so many testimonials from Denman Island

[0:14:08] Voice 7: residents. This is a land use issue. BC Ferries' job is to move cars across the water. We get that.

[0:14:15] Voice 7: Ministry of Transportation doesn't seem to be responsive to helping solve this. But what we

[0:14:22] Voice 7: heard from denman island residents when we did our survey was that people don't want this situation

[0:14:29] Voice 7: to exist and to accelerate anymore we're done being the speed bump to hornby so we believe

[0:14:37] Voice 7: that there are solutions but we need your help we need the help of our local trust committee

[0:14:43] Voice 7: to support this issue as the land use issue because it's the, you know,

[0:14:49] fairy-to-fairy impacts that are causing a lot of harm

[0:14:55] Voice 7: and a lot of stress

[0:14:56] Voice 7: and a lot of polarization, I think, between our community

[0:15:00] Voice 7: and the community of Maundy Island.

[0:15:03] Voice 7: We don't feel that these problems are being represented

[0:15:08] Voice 7: by the fairy-to-fairy community either.

[0:15:11] Voice 7: it so we really we really would like your help and to find ways that we can bring this forward

[0:15:18] Voice 7: to find a solution thank you very much okay

I ignored the items trust, couldn't figure it out, whatever, until I started hanging out with these guys, because I was awakened by the non-happening of Blackberry, you know, or I always think that was Peppermint, which I put back when I first introduced myself to you guys.

[0:16:23] Voice 7: on, but I have

[0:16:24] Voice 7: a hard time sometimes deciphering the written stuff. But I'm well aware of this Silence Trust

[0:16:34] Voice 7: Act. And I have to say that David Graham kind of stole my under ear, which

[0:16:44] Voice 7: um my point was going to be about this this different phrases of the

[0:16:53] Voice 7: i'm struck at 1974 and in my general observation headlining kind of everything i see it say

[0:17:05] Voice 7: say of IT that their mandate is to preserve and protect the trust area, unique amenities

[0:17:13] Voice 7: and environment. That's all in the headline today. So I will look up to get the entirety

[0:17:21] Voice 7: of this report. The next part, for the benefit of the residents of the trust area. So as

[0:17:31] as I and David already interpret unique amenities to housing.

[0:17:41] And our housing is not unique, and that's

[0:17:45] how

[0:17:45] Voice 7: it works here on an island where we have very little water

[0:17:50] Voice 7: to come out of wells.

[0:17:52] Voice 7: We've figured out over the years how to live here.

[0:17:57] Voice 7: And we're unique, and we have a lot

[0:18:02] Voice 7: unique housing and further needs okay for unique housing uh and the province in general

[0:18:15] Voice 7: or generally which i totally can see because you

[0:18:19] Voice 8: know there's a lot of housing everywhere

[0:18:24] Voice 8: so if

[0:18:25] Voice 7: we at least took care of our own people maybe it'll take some of the pressure off i just

[0:18:33] Voice 7: for there was a housing down at um um so the province generally in cooperation with

[0:18:47] Voice 7: municipalities regional districts and improvement districts now i understand that to mean that

[0:18:56] Voice 7: that in addition to whatever rules you call it, you know,

[0:19:12] Voice 7: that we also have to follow those requirements of the municipality.

[0:19:20] Voice 7: You are our municipality, or whatever you have to be.

[0:19:24] Voice 7: So we're not part of the municipality, but we're part of the regional district.

[0:19:28] Voice 7: So we come over and above the Islands Trust and we have to fit in with the regional districts

[0:19:35] Voice 7: and the improvement districts.

[0:19:38] Voice 8: Okay.

[0:19:39] Voice 8: Then it says other persons, who's other persons, and then it says comma organizations and the

[0:19:53] government of British Columbia.

[0:19:54] Well, that makes sense.

[0:19:55] I don't know who these persons or organizations are,

[0:20:02] Voice 7: my point is for the residents of the trust area and the uniqueness of us and the way we like to

[0:20:12] live and try to live and i'd like to quote john howard who says island

[0:20:19] Voice 7: communities are the original

[0:20:22] Voice 7: alternative societies some vision of victorian belonging

[0:20:28] Voice 7: with social lessness and independence based on cooperation, which is, he also says, there's

[0:20:38] Voice 7: a marked individuality, which we should like to think corresponds with our own, their ultimate

[0:20:47] Voice 7: separateness of character, even when

[0:20:51] Voice 7: they lie in our tentacles.

[0:20:56] Voice 8: So

[0:20:56] Voice 7: that's unique, I think I'm speaking more than myself, and I'm happy.

[0:21:33] Voice 7: about that later in the meeting um i do want to as the chair point out there's a problem with some

[0:21:40] Voice 7: of the minutes that you're going to be looking at i hope that i'll get a chance to speak at that

[0:21:44] Voice 7: speak to that when we come to accepting the minutes for the heavy apc um i want to speak

[0:21:50] Voice 7: specifically on an item that's coming later in the agenda today it's a bylaw enforcement staff report

[0:21:57] Voice 7: uh schedule a dem and island land use bylaw number 186 contraventions and penalties

[0:22:03] Voice 7: specifically 1.3.5 uh asks for a fine for non-permitted use in any zone

[0:22:12] Voice 7: That seems unnecessarily vague and very general, and it could very easily and far too easily be used against housing.

[0:22:24] Voice 7: So I would like to suggest that you remove that.

[0:22:29] Voice 7: 2.1.2, non-permitted use of dwelling for vacation rental slash paying guests.

[0:22:36] Voice 7: i suggest that you remove paying guests um because as the housing crisis continues to worsen

[0:22:44] Voice 7: um i know specifically the number

[0:22:46] Voice 9: of situations where people are renting rooms

[0:22:49] Voice 9: to people and uh that would qualify them as a paying guest same thing for a roommate could

[0:22:55] Voice 9: be qualified

[0:22:56] Voice 7: as a paying guest so i'm asking if you could remove paying guests do you mind if i

[0:23:02] Voice 7: sure so what you're looking at those are suggestions to be considered by a local

[0:23:08] Voice 7: trustee i understand okay good i'm suggesting that you don't consider those maybe that's

[0:23:16] Voice 7: better than than i suggest you remove i suggest you don't consider uh putting paying guests in

[0:23:23] Voice 7: there because that is closing the last availability for um people who are desperate for housing um

[0:23:31] Voice 7: And

[0:23:32] Voice 9: for a number of our elders who are finding that that actually

[0:23:35] Voice 7: is a way to meet

[0:23:37] Voice 9: various people's mutual need.

[0:23:41] Voice 7: Also, at the end of that staff report,

[0:23:44] Voice 9: staff is asking for bylaw number

[0:23:45] Voice 7: 247 to be passed.

[0:23:49] Voice 7: Under bylaw number 247, 1.C states, quote,

[0:23:55] Voice 9: by deleting Schedule B in its entirety and replacing it with a new Schedule B attached to and forming part of this bylaw.

[0:24:07] Voice 7: sure how you're supposed to consider adding that when it doesn't even appear in the agenda package. Thank you.

[0:24:31] Voice 7: exactly our elected trustees are advocating on behalf of Denman Islanders.

[0:24:36] Voice 7: Not suggesting that you're not, I'm just going to ask a couple questions and hopefully

[0:24:40] Voice 7: you can clarify them.

[0:25:34] Voice 9: we've got a lot of housing studies we have people working really hard to actually make housing

[0:25:39] Voice 9: happen and we they seem to be getting stymied um i'm hoping that maybe things are changing now

[0:25:46] Voice 9: but I would also like to know that hopefully with some forward momentum on maybe allowing

[0:25:52] Voice 9: secondary suites or whatever tweaking that we're going to do that there's really strong protection

[0:25:58] Voice 9: that it doesn't become STPRs and I would like to know what our elected trustees are doing is there

[0:26:04] Voice 9: any pushback against Hornby Island and what I would classify as an addiction to STPRs and how

[0:26:10] Voice 9: it negatively negatively affects all the islanders from ferry service to the enjoyment of our island

[0:26:17] Voice 9: to even detrimental effects to housing because there is stv arts going on on denman some legal

[0:26:23] Voice 7: some illegal you know what is really being done on our behalf um yeah and i would just like to

[0:26:31] Voice 9: out that personally i find very availability is pretty good come in september with the

[0:26:37] Voice 9: exception of rush hours there is you know and you know perhaps we could work with the residents

[0:26:42] Voice 9: of hornby uh because it points out there's a lot of animosity and polarization uh the residents

[0:26:49] Voice 9: of hornby island in my opinion are not the issue it is some of the visitors the guests

[0:26:55] Voice 9: the people who have become uh who

[0:26:59] Voice 7: rely on the commodification of housing um so thank you thank

[0:27:06] Voice 7: care we posed a number of questions i'm happy to answer um regarding the request to the province to

[0:27:15] Voice 7: um look at the innocent it's basically a municipal tree cutting by line by the dinosaurs i did vote

[0:27:21] Voice 7: against him i didn't have any background as a new trustee and recommendation from staff

[0:27:27] Voice 7: i believe it was poorly awarded wasn't something that i could get behind and i voted against it

[0:27:34] Voice 7: That's not to say I'm not against policies that could help people understand the importance of trees, what they already do.

[0:27:44] I'm a big advocate of education. I'm not a big advocate of regulation.

[0:27:50] The second question,

[0:27:51] Voice 7: please help me.

[0:27:54] Voice 7: Well, this idea that it's a land use, I like that.

[0:27:58] Voice 7: I think that's something that the local trust city can certainly put some work to.

[0:28:04] Voice 7: BC Ferries is always throwing up their hands saying, can we just move people and highways?

[0:28:09] Voice 7: We just make sure the roads are safe.

[0:28:10] Voice 7: But nobody has really looked at the impact of people traveling across our island as if we were a bridge.

[0:28:18] Voice 7: So that's interesting.

[0:28:19] Voice 7: The third question was housing.

[0:28:23] Voice 7: Well, just, you know, yeah.

[0:28:24] Voice 7: What is being done to ensure that?

[0:28:26] Voice 7: This local trust committee created the housing advisory committee specifically to carry on the work of creating this local trust committee that had put money into some work.

[0:28:41] Voice 7: And those consultants produced a report that had some recommendations.

[0:28:46] Voice 7: So that becomes part of the HAPC's request from the local trust committee to consider those.

[0:28:52] Voice 7: So I think we're doing as much as we possibly can at this point.

[0:28:58] Voice 7: And the fourth one?

[0:29:02] Voice 9: Well, just, yeah, just kind of what is, you know, when looking at, you know, the need for housing inventory,

[0:29:10] Voice 9: what is being done to make sure that that inventory goes to long-time debtors?

[0:29:14] Voice 9: Yeah.

[0:29:15] Voice 9: STBRs.

[0:29:15] Voice 9: Keep it from being STBRs and go to the people that need it, whether it's a room in a house,

[0:29:19] Voice 7: whether it's a, you

[0:29:21] Voice 9: know, whatever it is.

[0:29:21] Voice 7: So I've been on the island for 30 years, and I think your lawyer can attest, we have never

[0:29:28] Voice 7: allowed short-term vacation.

[0:29:30] Voice 7: You do allow bed and breakfasts, it's quite a different impact on your neighbors when

[0:29:35] Voice 7: there's a resident or someone responsible for the behavior of your guests in a dwelling.

[0:29:40] Voice 7: But we have never, and primarily I think because we've seen what's happened to Hornby and the

[0:29:46] Voice 7: residential areas, which have been taken from a corporate perspective, the commodification

[0:29:50] Voice 7: of housing.

[0:29:50] Voice 7: So we're on it, and I have no interest at all in pursuing the legality of short-term education until sometime in time.

[0:30:00] Voice 9: trustee are you having that discussion with the hornby island trustees no

[0:30:04] Voice 7: that's they have their

[0:30:05] Voice 7: own laws we have our own laws we work independently as far as the laws of each island are independent

[0:30:10] Voice 7: and exclusive to those islands i get that but is there not you know our fac is it joining the fac

[0:30:18] Voice 7: and i feel that you know personally i feel really you know almost

[0:30:21] Voice 9: handcuffed by the fact that hornby

[0:30:23] Voice 9: island they currently have a chairperson that in my opinion is really advocating for increases in

[0:30:30] Voice 9: the short-term vacation rental they want to extend the the holidayers into the shoulder seasons

[0:30:36] Voice 9: they have little regard uh for denman islanders involved they have little regard even for more

[0:30:42] Voice 9: of the islanders that are trying to voice opposition and saying that enough is enough so

[0:30:48] Voice 9: if you guys as our elected trustees aren't going to have that hard conversation

[0:30:52] Voice 9: conversation with the warranty trustees who are we to add

[0:30:56] Voice 7: who's going to advocate for us

[0:30:58] Voice 7: the regional planning manager through the chair um that there's also an opportunity when bylaws

[0:31:07] Voice 7: are being created that the bylaws are referred to other local communities in the area for the

[0:31:14] Voice 9: opportunity to comment and have these conversations so that's another area i will suggest could be

[0:31:20] Voice 9: looked into as well to encourage some conversations together

[0:31:25] Voice 7: opportunity to comment on bylaws which could affect us i

[0:33:34] Voice 7: it's not safe to be on the road i just cycled here now i have i watched 24 cars come racing past me

[0:33:41] Voice 7: and i put my gas right off the road and i've been on the road i know that there would have

[0:33:46] Voice 7: been great confusion because the two ferries are happening uh it is not safe for walkers the first

[0:33:54] Voice 7: but at eight o'clock both have now the neighbors are used to walk that eastern stretch regularly

[0:34:01] Voice 7: they don't know it's just not safe and that doesn't mean nobody what happens on the farm

[0:34:07] Voice 7: uh i spent two hours waiting to get off island midweek midday last week

[0:34:16] Voice 7: wednesday because of the unitary work you told me on the boat we get slammed by hornby why the

[0:34:23] Voice 7: at our favorite cars coming off for me once the summer's over why do they have the large boat i

[0:34:31] Voice 7: realize that's a big issue but it's not a major impact on them to be the chance they all rush

[0:34:37] Voice 7: they rush like crazy i live on the morning time under dispatch and we're oblivious to it but we

[0:34:43] Voice 7: just stay off the road enough where we could be happening in the block or like that um so it

[0:34:55] Voice 7: interesting transport um it's a bit about easy to you know uh just treat it as well it really is

[0:35:48] Voice 5: i have seen some changes because i believe um what they've been discussing um so i'm thankful

[0:35:56] Voice 5: for that but i feel that there isn't any i feel as a genuine resident that we're stuck with the bridge

[0:36:04] Voice 5: and and there's no attendance um so bc ferries promised us that there would be a flagger of the

[0:36:12] Voice 5: village and that they have permission to work beyond terminal space they did not provide that

[0:36:19] Voice 5: i saw two two flyers at the parking lot which is not necessary really in my mind one could have

[0:36:26] Voice 5: been up in the village yes it's not 100 all the time required but when it is it really interferes

[0:36:33] Voice 5: with our emergency workers getting through that village um traffic the the whole focus with bc

[0:36:39] Voice 5: ferries in Bradley Bay and my argument is traffic flows both ways we have to deal with them in west

[0:36:46] Voice 5: and who can't deal with them in west there's no point in dealing with them in east

[0:36:51] Voice 5: and then west affects most of our residents and um more importantly emergency staff just trying

[0:36:58] Voice 5: to get through there and there's been a number of times where I've parked at the guest house to walk

[0:37:04] Voice 5: um a passenger down to the ferry because it's just too dangerous and um i just i don't know

[0:37:13] Voice 5: as a lot of people where to go with this um we talked to um a family part of the friends

[0:37:19] Voice 5: of the floor because i felt i could be a voice um and trying to reach out maybe even to policing

[0:37:25] Voice 5: any anybody to help this situation because that was one of the survey results um was

[0:37:33] Voice 5: how dangerous the roads are, and how can we fix this?

[0:37:37] Voice 5: So I'm hoping in October they'll come back with something.

[0:37:42] Voice 5: But what I've seen during the summer with no-flyer helping out there,

[0:37:46] Voice 5: I'm a little bit concerned.

[0:37:49] Voice 5: And with the Fair Advisory Committee, there's about 12 people.

[0:37:52] Voice 5: Part of it's part of that.

[0:37:55] Voice 5: But I feel that their voices have been stymied,

[0:37:58] Voice 5: unless they agree with what Karen Ross has said.

[0:38:00] Voice 5: I think she has a conflict of interest there,

[0:38:02] Voice 5: which in my mind is very unfortunate because of her high foreign enhancement community blah blah

[0:38:08] Voice 5: and enhancing tourism enhancing all that situation um i think we're in a real pickle

[0:38:15] Voice 5: because she doesn't inform us she doesn't communicate even the last meeting was not posted

[0:38:21] Voice 5: when leo simons put on the dental board that it was not a zoom meeting she replied after the fact

[0:38:28] Voice 5: I was ready to go to Hornby that morning. I did not know that it had been canceled or changed to a Zoom meeting.

[0:38:35] Voice 5: Even BC Ferries hadn't put it up on their bulletin board, which they apologized.

[0:38:41] Voice 5: But, you know, this is what's going on. It's almost like there's no work.

[0:38:47] Voice 5: And I think it's obvious for the reasons why, because the push is to replace the Bain Sound Connector.

[0:38:54] Voice 5: it's in writing in their documentation replace the main sound with an 80 vehicle ferry how are

[0:39:01] Voice 5: we going to manage 80 vehicles crossing at one time i i don't see how this is going to work

[0:39:07] Voice 5: we can only get to capacities in that parking lot at the current state so i don't know if

[0:39:17] Voice 5: trustees can help us but we need somebody to be a voice out there to the ministries and um because

[0:42:34] the denver friends of the forest issue with the tree

[0:42:38] Voice 7: cutting at brown bay and i had

[0:42:43] Voice 7: originally applied and speak to the july meeting of this of this committee

[0:42:52] So I presented, I think it's about 50 pages of background material in support of a through-tropic solution,

[0:43:06] solution, like direct sailing from a vector island to one.

[0:43:17] Amongst that background

[0:43:18] Voice 7: material were a lot of passionate letters of support, with stories

[0:43:25] stories like we've heard today about

[0:43:28] Voice 7: the danger and intolerable aspects of the existing ferry

[0:43:38] Voice 7: system.

[0:43:39] Voice 7: And the ferry corporation response has always been you want to do this with more traffic

[0:43:48] Voice 7: and more graphic, it solves more of these problems than other problems.

[0:43:57] Voice 7: So in that material that I put together, there have been a couple of

[0:44:06] Trustee Maude (probable): events subsequent to not fit in that package

[0:44:14] Trustee Maude (probable): package that I wanted to draw your attention to. And one

[0:44:20] Voice 7: of them was actually the rediscovery

[0:44:24] Voice 7: of a study that was done in 1997 by Gerald Hodge called The Living Friend and the Impact

[0:44:37] Voice 7: of food traffic on Denman Island.

[0:44:39] Voice 7: And this Gerald Gawage was a resident of both Denman

[0:44:47] and subsequently Hornby and he

[0:44:51] Voice 7: was a qualified planner

[0:44:55] Voice 7: and he wrote this really detailed analysis

[0:45:00] Voice 7: of a sense typical analysis of the traffic situation.

[0:45:07] Voice 7: And he was also quite poetic, I guess you could say that.

[0:45:16] Voice 7: He, in fact, introduced a couple of his chapters

[0:45:20] Voice 7: with the quotes that came from John Fowles

[0:45:25] Voice 7: and we read them out for him.

[0:45:27] Voice 7: Yeah, the quote from John Fowles

[0:45:32] Voice 7: that particularly appeals to me is that,

[0:45:35] Voice 7: that there is a marked individuality of islands,

[0:45:41] Voice 7: which we should like to think corresponds with our own,

[0:45:46] their obstinate separateness of character,

[0:45:50] even when they lie in archipelagos.

[0:45:52] Voice 7: The obstinate separateness of character

[0:45:55] Voice 7: is a really appealing aspect of islands to me.

[0:46:01] Voice 7: So

[0:46:02] Trustee Maude (probable): this was uncovered. It had been

[0:46:09] Voice 7: lost, essentially, for some period of time.

[0:46:14] Voice 7: So this is something that has come up since the July meeting.

[0:46:19] Voice 7: meeting. Another thing that many people have interpreted is that the proposal for a direct

[0:46:34] Voice 7: sailing would threaten links between Danube and Hornby. And there are, it's been pointed

[0:46:43] Voice 7: of there are really important both commercial and social links

[0:46:48] Trustee Maude (probable): that are well established long

[0:46:51] Trustee Maude (probable): established and uh i

[0:46:55] Voice 7: believe that they can be they can be satisfied by uh a direct sailing

[0:47:04] that it's a scheduling problem and so we're we're committed to maintaining

[0:47:10] retaining relations

[0:47:12] Voice 7: between Denman and Hornby.

[0:47:16] Voice 7: So that's something

[0:47:17] Voice 8: that's come up there as well.

[0:47:27] Voice 8: Yeah, perhaps

[0:47:30] Voice 7: the biggest change that came up

[0:47:36] Voice 7: subsequent to the January or July information

[0:47:41] Voice 7: was the trust council meeting

[0:47:46] Voice 7: meeting in June of this year. The meeting opens with a trustee round table in which

[0:47:59] Voice 7: all trustees get to speak and bring people up to date on happenings on their own island.

[0:48:07] Voice 7: And this particular one got quoted in the Gabriola Sounder, which is a newspaper, and the writer wrote for that newspaper that Hornby

[0:48:30] Trustee Maude (probable): trustee, this is a quote,

[0:48:32] Trustee Maude (probable): Hornby trustee Alex Fallon bemoaned the ferry situation which is worsening with the proliferation

[0:48:41] Trustee Maude (probable): of unregulated short-term vacation rentals and which has Hornby residents

[0:48:47] Voice 7: asking for a ferry

[0:48:49] Voice 7: direct to their island bypassing the Denman Islands debunk proposed tree cutting and road

[0:48:58] Voice 7: road building to many. Proposed street cutting and road building to make extra ferry line-up lanes

[0:49:08] Voice 7: to accommodate the increase in Hornby destined to vehicles is distressing to Denman residents

[0:49:15] Voice 7: and Hornby residents are not happy about that either. But the Allen commented that temporary

[0:49:23] Voice 7: re-use permits are a curse but they just make short-term vacation articles go on forever.

[0:49:31] Voice 7: So there is support on Hornby Island by their own more of their own trainees.

[0:49:45] Voice 7: So I guess what I would like to do is maybe just one last,

[0:49:52] Voice 7: Oh, no, no, the policy, or the OCP, our own OCP, which the existing system violates.

[0:50:10] Voice 7: And so I want to read a few sections from our OCP.

[0:50:17] Voice 7: And this is under the heading of Marine Transportation.

[0:50:25] Voice 7: Advocacy Policy 7, and of course, British Columbia Ferry Services Incorporated, is encouraged to

[0:50:37] Voice 7: 1. Maintain ferry service at the levels and vessel

[0:50:42] Trustee Maude (probable): capacity being offered at the time of adoption

[0:50:46] Voice 7: of this plan

[0:50:48] Voice 7: and

[0:50:49] Trustee Maude (probable): avoid responding to seasonal peaks with

[0:50:52] Voice 7: larger land-based facilities and larger vessels.

[0:50:58] Voice 7: Two, is

[0:51:00] Trustee Maude (probable): encouraged to develop strategies to manage vehicle traffic demand and diversify

[0:51:07] Trustee Maude (probable): traffic loads rather than expand vessels

[0:51:11] Voice 7: or parking and staging areas.

[0:51:14] Voice 7: areas, which is what the ground is all about, and thirdly, to address the effects of varied

[0:51:25] Voice 7: parking and staging so that the social, aesthetic, and commercial functions of the island are

[0:51:33] Voice 7: preserved while the negative visual,

[0:51:36] Trustee Maude (probable): environmental, and social impacts are reduced.

[0:51:39] Trustee Maude (probable): So this is a document that guides

[0:51:45] Voice 7: your decision making, and BC Ferries may not even be aware unless it's brought to their attention.

[0:51:58] Voice 7: It has to be brought to their attention by somebody. So I think there's a job

[0:52:04] Voice 8: to do there.

[0:52:07] Voice 8: In the end, I'll come back to 1995, when this committee was

[0:52:22] Voice 7: represented by Roxana Mandrick

[0:52:26] Voice 7: Lundviksen, and they wrote to BC Ferries

[0:52:34] Voice 8: 1995, remember this, we believe

[0:52:43] Voice 7: between Hornby Island and Vancouver Island is the only long-term

[0:52:48] Voice 7: permanent solution which satisfies trust policies as well

[0:52:54] Voice 8: as the interests of the community

[0:52:59] Voice 8: that go on deaf ears at the

[0:53:02] Voice 7: ferry corporation apparently.

[0:53:04] Voice 8: apparently.

[0:53:05] Voice 7: But had they acted on that, then the tree cutting and grafting bay would never

[0:53:13] be necessary.

[0:53:14] Voice 8: It wouldn't have been a problem at all. So the

[0:53:26] Voice 7: friends at Denman Forest,

[0:53:29] Voice 7: their request, and by the way, the Denman Island Residents Association asked a motion at their last

[0:53:39] Voice 7: meeting to request that the Ministry of Transportation and Infrastructure study

[0:53:51] Voice 7: long-term plans based on Rocks

[0:57:23] Voice 7: It pains me that we have that 60 kilometer an hour speed limit on East Road and

[0:57:29] Voice 7: Edmonton, because if we didn't, for all 50 or less, we wouldn't be able to drive

[0:57:34] around in electric

[0:57:35] Voice 7: golf carts, as some communities are, and really lower the

[0:57:40] Voice 7: chance of getting clobbered by a vehicle immensely.

[0:57:45] Voice 7: So that's my personal feeling.

[0:57:47] Voice 7: It sounds like it's been a wish of them and others for a very, very long time.

[0:57:53] I heard somebody suggested back in the 1930s there was documentation to support

[0:57:59] Voice 7: an Army-only barrier.

[0:58:02] Voice 7: My only suggestion to the various groups that are looking at this is we've got to get Army on the side, too, because it makes it difficult to argue that one island is advocating for someone else's transportation system without their support.

[0:58:19] Voice 7: A few days ago, Saturday or whatever day that was, I reached out to the only person I knew on board that might give me some background.

[0:58:27] Voice 7: I unfortunately talked to Karen Ross, who I know personally, and I know that she's very involved in Pisces, which is an economic enhancement group.

[0:58:39] And, you know, no surprise, she said, well, nobody from Hornby is advocating for their own ferry.

[0:58:45] area, that's the basic idea, you'd

[0:58:48] need a ferry that would hold 200 cars to

[0:58:53] that we get with the current system.

[0:58:57] Voice 7: absolutely Little River would be an insane suggestion.

[2:30:32] Voice 7: uh we've been tasked to consider all things housing we're very grateful to have this

[2:30:36] Voice 7: opportunity to make recommendations for change for our island um you can see our terms of reference

[2:30:44] Voice 7: as we understand them to be uh which i gave you a separate document today on that matter

[2:30:50] Voice 7: we're still looking for to have that put into public record um we've met every week since

[2:30:58] Voice 7: july 3rd every tuesday at five o'clock in this room um all members of the community are welcome

[2:31:04] Voice 7: we have had a cross-section of about 50 community members have attended our meetings or submitted

[2:31:11] Voice 7: something in writing um we've had some folks who come every week and we have other folks who've

[2:31:18] Voice 7: only come once. We've had very extensive conversations discussing

[2:31:23] Voice 7: all things housing. It was brought to our attention the

[2:31:28] Voice 7: requirements of Section 473 of the Local Government Act. We

[2:31:32] Voice 7: encourage you to familiar or encourage our trustees to

[2:31:36] Voice 7: familiarize themselves with Section 473 of the Local

[2:31:40] Voice 7: Government Act. In part it states, quote, an official

[2:31:44] Voice 7: community plan must include housing policies of the local

[2:31:47] Voice 7: local government respecting affordable housing, rental housing and special needs housing.

[2:31:53] Voice 7: We are very concerned that this is another winter is coming. We have many members of

[2:31:59] Voice 7: our community who are in dire situation with housing. I personally know seven single parents

[2:32:06] Voice 7: who are looking for housing on Denman. Unfortunately, housing for single parents is really hard

[2:32:12] Voice 7: to find. It's far easier to find a room rather than a place. Four of those single parents that I know

[2:32:23] Voice 7: are in temporary inappropriate and inadequate housing with their children.

[2:32:33] Voice 7: This has long-ranging effects. So here we are another winter coming and that's our status quo.

[2:32:41] Voice 7: So official

[2:32:43] Voice 9: estimates are that over 120 community members here now are living in precarious housing.

[2:32:48] Voice 9: You'll see later in the agenda, there's some stats provided

[2:32:52] Voice 7: by Islands Trust from the 2021 census,

[2:32:57] Voice 7: which facts that 13.5% of our community is currently living in inadequate housing.

[2:33:03] Voice 7: Those are not all rentals, obviously.

[2:33:06] Voice 7: Some of those are going to be people who own their own home, but their home is falling into disrepair.

[2:33:11] Voice 7: however if we had different bylaws that allowed land sharing they might find themselves in

[2:33:17] Voice 7: completely different position those folks so it's all very interconnected um housing has a

[2:33:25] Voice 7: significant impact on all people in many ways that i've covered in my written report um we have

[2:33:35] Voice 7: several requests uh of things that we would like over this next few weeks while we prepare our

[2:33:43] Voice 7: report well if the first was we're asking for an extension so that we can submit our report

[2:33:48] Voice 7: in november um we hope that this is acceptable to the local trust committee um we are requesting

[2:33:57] Voice 7: that you the devon island local trust committee

[2:33:59] Voice 9: make a standing resolution requiring bylaw

[2:34:02] Voice 9: enforcement officers to make an appointment with a minimum of 24 hours notice before conducting

[2:34:07] Voice 9: any site visit to investigate

[2:34:08] Voice 7: a bylaw complaint at any person's home whether their home is lawful

[2:34:12] Voice 7: or unlawful we have a request that you um this dem and i local trust committee contact the cbrd

[2:34:21] Voice 7: the comox valley regional district district to collaborate on services that may help people get

[2:34:27] Voice 7: through this winter season. We are still looking for information about the density bank. We feel

[2:34:36] Voice 7: that this is very important. This is a significant limitation on the ability to allow new densities

[2:34:46] Voice 7: on Denman. As by our calculations, there is only eight densities left in the density bank,

[2:34:54] Voice 7: But as you'll see on page 164 of your agenda package, the information provided by staff doesn't add up.

[2:35:07] Voice 7: In one spot, it says that there are 14

[2:35:09] Voice 9: densities left.

[2:35:10] Voice 9: In another spot, it says there are 33 densities left.

[2:35:13] Voice 9: This is on your staff report, page 164.

[2:35:18] Voice 9: We've been requesting this information for a number of months.

[2:35:21] Voice 9: we still have yet to hear anything from staff um we're wondering if there's a problem with coming

[2:35:30] Voice 9: up with the numbers would that be in the staff report then like is

[2:35:37] Voice 7: uh that we can get from staff we're also looking for the total accounting uh you know on this date

[2:35:45] Voice 7: these densities went into the density bank on this date these densities were removed

[2:35:58] Voice 7: And if there is not an ability, if staff is unable to update the numbers or give us an

[2:37:02] Voice 7: interact with all members of the community so we're requesting if that that wording could

[2:37:09] Voice 7: please be reflected in the minutes rather than the current wording um

[2:37:22] Voice 7: there are rumors going around on Denman that the planner has been having private meetings

[2:37:29] Voice 7: with community members and or housing groups about the housing review. Although as I recall

[2:37:46] Voice 7: how those meetings actually happened. Is this a false rumor or is this a true rumor?

[2:37:51] Voice 7: um have staff been meeting with uh community members and if so is there any sharing of

[2:38:01] Voice 7: information that we can have we've been very open and very uh diligent about submitting our

[2:38:08] Voice 7: information on regularly we from the housing abc uh we understood that relationships are important

[2:38:16] Voice 7: and yet we haven't heard from staff, except in response when we've made requests.

[2:38:23] Voice 9: Although we still have requests floating out there, such as from July

[2:38:28] Voice 7: how do we get community submissions into public record?

[2:38:32] Voice 7: That's one of the things that continues to hang out there.

[2:38:45] Voice 7: And to look at all things housing. We are looking to the trustees for completion on these items that we've been requesting.

[2:58:22] Voice 9: my situation in 2020 my landowners received a letter from by law enforcement in march of 2020

[2:58:33] Voice 7: was a phone call was made uh there was a discussion with the then violent enforcement

[2:58:39] Voice 7: officer uh that they would follow up and make an appointment and then on july 29th 2020

[2:58:46] Voice 7: two enforcement officers

[2:58:49] Voice 9: one from violence trust one from the agricultural land reserve

[2:58:52] Voice 9: showed up unannounced without having made an appointment so the letter in march did not and

[2:58:59] Voice 9: And there was a conversation, a phone conversation afterwards.

[2:59:01] Voice 9: There was no warning that there was going to be an investigation.

[2:59:05] Voice 9: When I

[2:59:06] Voice 7: asked the bylaw enforcement officer why we hadn't been notified, he told us that

[2:59:11] Voice 7: he didn't know he was coming, which I found very strange since he was there with another

[2:59:15] Voice 7: bylaw enforcement officer from the ALR.

[2:59:21] Voice 7: So there is some gray area in here where people, and that was the case for the other eight

[2:59:28] Voice 7: people who were enforced on that day there

[2:59:34] Voice 9: time there was any enforcement action against unlawful housing on denman however the fear

3.1 Trustee Reports 
Trustee Graham reported that the recent Trust Council meeting included a discussion of 
the Islands Trust preserve and protect mandate. It was clarified that there are three 
elements of jurisdiction: Trust Area that includes lands and land under the water to mid-
channel; unique amenities that include residents, villages, housing, economics, and 
recreation; and natural environment - with no element taking priority and decisions to 
be balanced between them. 
3.2 Chair's Report 
Chair Maude reported on his attendance at the following: 
 The Union of BC Municipalities convention which provides an opportunity to 
interface with provincial government staff and ministers. One outcome of these 
discussions was that the Minister of Transportation has agreed to set up a 
highways task force for the islands to address road priorities and protections. 
 Trust Council quarterly meeting in September where discussion included 
crafting a Vision Statement for Islands Trust, with more work to be done on this. 
 North Pender and Mayne Islands Local Trust Committee (LTC) meetings. 
3.3 Electoral Area Director's Report - none 
4. PUBLIC COMMENTS 
 Cross-island ferry travel problems of speeding and congestion across Denman Island are 
an ongoing and increasing issue. Friends of Denman Forests has organized to oppose the 
proposed tree cutting for parking expansion at the Gravelly Bay ferry terminal.  This is a 
land-use issue with detrimental effects to human and ecological health; and the LTC was 
asked to help by advocating for solutions.  
 The stated Islands Trust preserve and protect object is to protect the Trust Area and its 
unique amenities and environment for the benefit of the residents of the Trust Area. 
Unique amenities equals housing. Residents of the Trust area have unique needs for 
housing. 
 Two of the proposed Land Use Bylaw (LUB) No. 186 Contraventions and Penalties listed 
in Schedule A of the October 3 Staff Report were opposed: 1.3.5 Non Permitted Use in 
Any Zone – too vague and might be used against housing infractions; 2.1.2 Non 
Permitted Use of Dwelling for Vacation Rental/Paying Guests – paying guests might 
include those renting a room for housing. The draft Bylaw No. 247 attached to the Staff

protections against the negative effects of STVRs on Denman Island?

o the municipal tree cutting bylaw was voted against as an educational approach 
rather than regulation was preferred, and it was clear that the Province would 
not support it; 
o the concept of the cross-island ferry traffic being a land-use issue is something 
the LTC will be considering; 
o STVRs are not a permitted use on Denman Island. B&Bs, where the 
owner/operator is on premise, are allowed. There is opportunity to comment on 
how Denman Island is affected by Hornby Island bylaws when they are referred 
to the Denman Island LTC for comment. 
 Cross-island ferry traffic has increased significantly over the years and even 
includes mid-week traffic now. Residents can no longer safely walk or bike on 
the ferry traffic roads. LTC consideration of this concern as a land-use issue was 
supported. 
 Multiple agencies, ministries, BC Ferries and the Ferry Advisory Committee 
(FAC) have been contacted regarding the cross-island ferry traffic and are not 
taking responsibility or helping. Denman West ferry terminal traffic is also a 
problem and promised flaggers were not provided in the village where 
congestion could interfere with emergency responders. Concern was expressed 
with the lack of FAC communication and the proposed replacing of the cable 
ferry with a larger vehicle capacity ferry. The LTC was requested to advocate for 
solutions. 
 Bylaw Enforcement Officers should not be given the ability to fine for setbacks 
as listed in the proposed Schedule A of the draft LUB No. 186 Contraventions 
and Penalties. 
5. DELEGATIONS 
5.1 Denman Island's Official Community Plan and Through Traffic - Graham Brazier 
Graham Brazier’s presentation included background documents provided in the agenda 
material. Additional submissions for the record included: “The Impact of Through Ferry 
Traffic on Denman Island, January 1997” by Gerald Hodge, PhD., and an updated 
document “Presentation to Local Trust Committee (October 3, 2023) by Graham Brazier 
on behalf of Friends of Denman Forests.”  
He outlined the violations of OCP policy from the existing cross-island traffic system, 
noted that the links between Denman and Hornby Islands are well established, and 
stated that the concern can be satisfied by a direct sailing to Hornby Island from 
Vancouver Island. He asked the LTC to adopt a motion in support of the recommended 
solution of a direct sailing between Hornby Island and Vancouver Island as 
recommended by former Trustees Mandryk and Ludvigsen in l995. 
 
Trustees supported the proposed initiative, observing an additional concern of the 
existing speed limit on the primary road utilized by cross-island ferry traffic. They noted 
the need to gather support from Hornby Islanders to help ensure a successful outcome.

Chair Maude thanked the Housing Advisory Planning Commission (HAPC) for their work 
to date on this referral.  
Regional Planning Manager Jamurat advised that corrections to the minutes, as 
proposed by HAPC Chair da Silva, may be submitted to staff for processing; and advised 
that all correspondence from the community received by the HAPC will either be 
attached to the minutes or with the final report for the public record. 
7. BUSINESS ARISING FROM MINUTES 
7.1 Follow-up Action List dated September 26, 2023 
A Trustee requested a status update on the July 25, 2023 Activity no. 6: “Staff to send a 
letter to First Nations to identify how they would like to be engaged on Denman Island’s 
Housing Review Project.” 
Planner Chadwick responded that this activity is in process with completion estimated in 
the next few weeks. She reported that K'ómoks First Nation has requested a 
comprehensive package of requests for comments, including the Islands Trust Policy 
Statement, be forwarded as one package and not for each matter separately; and that 
working with this protocol is taking time. She advised that a letter has been distributed 
to all First Nations identifying major projects in progress, ensuring that K'ómoks First 
Nation is aware of the Housing Review project. 
A Trustee recognized the need to respect the requested protocol and commented that 
awaiting LTC consultation with First Nations should not delay the HAPC production of 
the Housing Review project referral report. 
8. APPLICATIONS AND REFERRALS 
8.1 DE-DP-2023.2 (2191 Tristone Road) - Staff Report 
The Staff Report asks the LTC to consider a Development Permit (DP) application being 
sought retroactively for construction of a vehicle culvert crossing that occurred within 
Development Permit Area 4 – Streams, Lakes and Wetlands. The Qualified 
Environmental Professional (QEP) retained by the applicants recommends a third culvert 
to improve the crossing.  
It is noted in the Staff Report that, had the applicant enquired about a DP before the 
works were completed, the works likely would have been exempt under Section 4.4.2(1) 
of the Denman LUB No. 186 and not required a DP, as Provincial Section 11 and Riparian 
Areas Protection Regulation assessments and permits do not apply to works that have 
already occurred. 
A Trustee noted that the QEP recommends inspection follow-up and enquired as to how 
that will be accomplished. Planner McCargar responded that the QEP will complete a

post-construction monitoring report that will be filed with the provincial government 
and is not a part of this process.

that the Denman Island Local Trust Committee approve issuance of development permit 
DE-DP-2023.2.

A Trustee remarked that time and money could have been saved had the applicant 
discussed the proposed development prior to the work being initiated; and he used this 
opportunity to remind community members to consult with planners when considering 
developments.

9. LOCAL TRUST COMMITTEE PROJECTS 
9.1 Denman Housing Advisory Planning Commission (HAPC) Reporting - verbal update 
from HAPC Chair 
9.1.1 Denman HAPC Progress Report 
HAPC Chair da Silva presented the progress report that included a number of 
requests for the LTC to consider. The Denman Housing APC Terms of Reference 
– July 25, 2023 was submitted for the record in order to update, publish, and 
complete the Terms of Reference for the HAPC Housing project referral.  
Discussion and responses included the following: 
 Staff have not had meetings with community members since July to 
discuss the project. 
 Staff is working on drafting a staff report to address the updated 
Density Bank numbers and will provide this to the HAPC as soon as 
possible; HAPC will forward their information on this topic to staff. 
 The referral report from HAPC is anticipated to be brought forward at 
the next LTC meeting. The HAPC was encouraged to prioritize changes 
to the LUB first, then address possible changes to the OCP, and then 
consider possible advocacy changes, in that order. 
 There is no update on plans to collaborate on services to help with 
housing and other safety needs throughout the coming winter; 
however, it was noted that Trustee Borthwick has assisted with this 
initiative in the past. 
 Bylaw Enforcement Compliance & Enforcement Manager Dingman 
clarified the current Bylaw Enforcement policy regarding investigation, 
providing notification to property owners, and arranging a mutually 
agreeable site visit to satisfy provincial requirements and staff safety; 
and explained the current Standing Resolution that withholds

enforcement against unlawful dwellings with some exceptions. There

north property boundary in order to reduce expenditures and as the adjoining 
neighbouring property believes it is not necessary.

to prepare an amendment to the section 219 restrictive covenant on title for 1151
