[0:13:32] Voice 8: And I have a bit of a dog's breakfast here, but I'll try to be concise.

[0:13:38] Voice 8: First of all, I would like to congratulate Mike Richards in the other trust office.

[0:13:43] Voice 8: Mike and his family have lived here for a long time.

[0:13:47] Voice 8: And Mike has been working as the Islands Trust Grants Manager for a few years now.

[0:13:54] Voice 8: But he just is now the Islands Trust Conservancy Strategic Fund Development Specialist.

[0:14:02] Voice 8: And Trustee Elliott and I are both on the Honors Trust Conservancy, and I'm sure she's in happy

[0:14:09] Voice 11: mind that Mike Richards is now going to be helping us with that. So congratulations, Mike.

[0:14:19] Voice 11: Secondly,

[0:14:20] Voice 8: all three of us attended council on Pender at the end of September, a three-day

[0:14:26] Voice 8: council meeting. And the highlight for me was being on Pender Island and seeing how their

[0:14:32] Voice 8: fairfairies work, seeing

[0:14:34] Voice 8: how their community works, enjoying the incredibly beautiful timber

[0:14:39] Voice 8: frame building where we had our meeting, and being served beautiful local food by cooks

[0:14:46] Voice 8: on the island, and of course sitting at a table with my fellow trustees, most of whom

[0:14:53] Voice 8: were there in person, and having some pretty wholesome discussions about the budget, about

[0:15:00] Voice 8: about the interpretation of the mandate of the Islands Trust,

[0:15:04] Voice 8: about a vision statement,

[0:15:07] Voice 8: and more practically perhaps about bylaw compliance and enforcement.

[0:15:12] Voice 8: So all really good discussions.

[0:15:15] Voice 8: And, you know, I always come away from those three-day meetings

[0:15:20] Voice 11: feeling like I've learned a lot and I can learn a lot more

[0:15:23] Voice 11: and very grateful to meet in person.

[0:15:26] Voice 11: So next on my little pile of updates

[0:15:32] Voice 8: here is the Gabriola Health and Well-Being Study that came out on October 11th.

[0:15:40] Voice 8: And it is a really interesting look at social and cultural and even environmental well-being on Gabriola,

[0:15:52] Voice 11: Mudge and DeCourcy Islands.

[0:15:53] Voice 11: So all of our local task area.

[0:15:57] Voice 11: It's it's just a real it's

[0:16:00] Voice 8: almost like a work of love that the committee has put together in this report.

[0:16:06] Voice 8: And even though it focuses really on, you know, social and health well-being, it says a lot about how people approach environmental issues in this report.

[0:16:18] Voice 8: And it gives us a really good look towards the future as to how we can engage people to really care about where they live in this trust area.

[0:16:31] Voice 8: And I was interested and surprised to learn that apparently, according to the surveys, over 75% of people in this area actually attend or at least pay attention to local trust and regional district meetings.

[0:16:52] Voice 11: So that was pretty encouraging.

[0:16:54] Voice 11: But next

[0:16:57] Voice 8: on my list is Islands Trust Conservancy board meeting and Trustee Elliott and I are both on the Conservancy, which

[0:17:07] Voice 11: I'm very happy about.

[0:17:08] Voice 11: And we focused the last board meeting quite a bit on what we need to ask council

[0:17:15] Voice 8: for budget wise.

[0:17:17] Voice 8: so what is important for the conservancy what budget items that we submit to council do we

[0:17:25] Voice 8: really need to keep for the conservancy and i am delighted to say that at this point

[0:17:32] Voice 8: everything that we are asking for has so far not been knocked off the list so um i know that trustee

[0:17:41] Voice 8: Elliott and I will be going to the December council meeting with a

[0:17:46] Voice 11: slightly revised version

[0:17:47] Voice 11: of Ireland's Trust Conservancy wishes and we'll do our very best to take care of the

[0:17:54] Voice 11: Conservancy budget-wise. Next

[0:17:57] Voice 11: on my list, Trustee

[0:18:01] Voice 8: Elliott and I are also both on the

[0:18:02] Voice 8: Financial Planning Committee and again, you know, when we attend a Financial Planning

[0:18:12] Voice 8: committee meeting we have our own interests that we really want to protect and but often

[0:18:18] Voice 8: the discussions arise at the FPC meetings that someone will bring something up that I haven't

[0:18:27] Voice 8: even thought about and I really appreciate the fact that we have these wholesome discussions

[0:18:32] Voice 8: they think it's a long meeting it's about three hours and it just gives me a better idea of

[0:18:40] Voice 8: what I need to think about for the whole trust area when it comes to budgets because we're

[0:18:47] Voice 8: talking about tax increases and how do we how do we sell that to the public how do we tell the

[0:18:53] Voice 8: public that in order to continue to do the work we do we cannot go with the zero percent increase

[0:19:01] Voice 11: we're always going to be needing some sort of increasing the budget to do the work that we do

[0:19:07] Voice 11: um

[0:19:09] Voice 12: so last

[0:19:12] Voice 8: on my list here

[0:19:13] Voice 8: is on monday evening i attended the regional district master parks

[0:19:19] Voice 8: trails and recreation plan meeting it was at the fire hall the new fire hall it was very well

[0:19:26] Voice 8: attended with a full house it was sort of um a world cafe style with three rotating tables for

[0:19:32] Voice 8: discussion one table on trails one on parks and one on recreation services i started out at the

[0:19:40] Voice 8: trails table and i was going to move to the parks table but i got enthralled by the discussion at

[0:19:47] Voice 8: the dress table so i kind of stuck around there um a lot of discussion about the village to the

[0:19:53] Voice 8: ferry trail how do we work with modi bc paris islands trust and the regional district to please

[0:20:00] Voice 8: please finally have something that gets us from

[0:20:04] Voice 11: the roots to the berry that it just isn't

[0:20:06] Voice 11: misery in the winter um no answers yet but

[0:20:11] Voice 8: i'm just going to keep keep working on it um

[0:20:15] Voice 8: the thing that was concerning me perhaps more immediately is the fact that the regional

[0:20:21] Voice 8: district is going to be replacing the driveway chips on the village pathway so we have the

[0:20:27] Voice 8: a paved area that goes to, what's it called?

[0:20:30] Voice 8: And then the driveway chips start across from the state park there,

[0:20:34] Voice 8: and they go out to Church Street.

[0:20:36] Voice 8: But they are miserable to walk on.

[0:20:39] Voice 8: They're horrible to try to do a stroller or a wheel, any sort of wheels.

[0:20:44] Voice 8: So they're going to remove those driveway chips

[0:20:46] Voice 8: because they never should have been there in the first place

[0:20:48] Voice 8: because the entire path was supposed to be path packed,

[0:20:52] Voice 8: which is what Maine, Pender, Salt Spring, Galliano, and Hornby

[0:20:56] Voice 8: all used on their pathways it is wonderful it drained

[0:21:00] Voice 11: it doesn't breathe over in the winter

[0:21:03] Voice 11: there's no snow to worry about or ice there's snow but no ice it's

[0:21:07] Voice 8: environmentally sensible

[0:21:09] Voice 8: it's not like asphalt which is very bad for the environment unfortunately they're replacing the

[0:21:16] Voice 8: driveway chips with more asphalt so i begged and pleaded and implored everybody who was there from

[0:21:24] Voice 8: the RDN to please put

[0:21:26] Voice 11: Pathpack down instead of paving. Not sure how successful I'll be. I'm

[0:21:33] Voice 11: going to write a letter sometime and see what happens. I know it sounds like just a little

[0:21:38] Voice 11: thing, but for me, it's a really big deal to have a path that's walkable and environmentally

[0:21:44] Voice 11: sensible. And I figure if we can use Pathpack even once on Gabriel, then everyone will see

[0:21:51] Voice 11: how perfect it is.

[0:21:54] Voice 11: Okay, so that's it from my

[0:21:55] Voice 11: fascinating talk.

[0:22:02] Voice 10: amazing. September 14th was our last

[0:22:04] Voice 10: meeting. Seems like there's been a lot

[0:22:06] Voice 10: going on

[0:22:07] Voice 10: since then and now.

[0:22:10] Voice 10: Indeed, we started

[0:22:11] Voice 10: when I left here, I ventured over to

[0:22:14] Voice 10: Vancouver for UBCM,

[0:22:15] Voice 10: the Union of British Columbia Municipalities.

[0:22:18] Voice 10: That's when all the 169

[0:22:20] Voice 10: local governments throughout British Columbia

[0:22:21] Voice 10: we get together and we have a chance to discuss common issues and advance the interests of all

[0:22:29] Voice 10: of the regional districts and municipalities and the arms trusts through debate. Vice Chair Elliott

[0:22:35] Voice 10: joined me along with the rest of the executive team, David Maud and Tim Peterson, as well as

[0:22:40] Voice 10: CAO and Laura Patrick also from Salisbury attended there. We did meet, we had a couple of ministers

[0:22:47] Voice 10: meetings, which was kind of the highlight of things, really, Minister Kang and Minister

[0:22:54] Voice 10: Fleming. And we had positive receptions by both ministers to the issues that we brought

[0:23:00] Voice 10: to them and look forward to discussions with them developing some of the commitments, particularly

[0:23:08] Voice 10: Minister Fleming made about some working together. And there's 11 months left, which

[0:23:16] Voice 10: is what's interesting because at the time we'll pass by quickly um and so then of course trust

[0:23:21] Voice 10: council and uh trustee yates has uh provided you the highlights there um great well

[0:23:29] Voice 3: those are my

[0:23:30] Voice 10: highlights oh well i think

[0:23:32] Voice 10: it's all very similar to my own um it's really important that we get

[0:23:37] Voice 10: together and advance the business of council and uh there was lots of good debate and challenges

[0:23:42] Voice 10: just and we're planning now already for the December meeting and so just quickly scanning

[0:23:52] Voice 10: here yeah essentially I was on Gambier Island meeting last week and financial all of the

[0:24:00] Voice 10: committees now are meeting in preparation for the work that they're doing and advancing

[0:24:05] Voice 10: recommendations to council which of course will be in December so that's it for me it's a pleasure

[0:24:11] Voice 10: for me to be here with you today um so our next item on the agenda is the electoral area

[0:24:17] Voice 10: director report now in our package we have uh the uh she provided regrets she's unable to join us

[0:24:26] Voice 10: today and we do have a memo from her from september 14th which i think we even received

[0:24:32] Voice 10: late in our last meeting and provided highlights and um she wanted to make sure that everybody was

[0:24:37] Voice 10: well aware of the community uh health and well-being service of gaviola and the last event

[0:24:43] Voice 10: in that was yesterday or sorry on monday yesterday um the 25th so hopefully everybody

[0:24:51] Voice 10: had attended that and that's gone well and we look forward to seeing um the director here at

[0:24:57] Voice 10: a future meeting so with that unless there's anything else anybody would like to add then

[0:25:03] Voice 8: I'll just add one little thing.

[0:25:05] Voice 8: I did have a chance to talk to Vanessa Craig, our regional director, on Monday night at the Master of Parks Trails meeting.

[0:25:14] Voice 8: And also Elaine McCullough, who is the senior parks advisor for the RDN.

[0:25:19] Voice 8: And I asked them point blank, how is it that we ended up with this trail with the weird black fences that had to be torn down later and half driveway chips and half asphalt?

[0:25:31] Voice 8: and they they said no one knows why they were supposed to use path path no one knows why

[0:25:39] Voice 8: and

[0:25:41] Voice 11: i thought that is just i just have to follow up on that no one knows why that mistake was me

[0:25:48] Voice 11: that's

[0:25:50] Voice 10: not what i served by the contractor presumably well

[0:25:52] Voice 11: and you know i was really

[0:25:53] Voice 11: grateful for director craig's franknessy on that um but yeah i

[0:26:02] Voice 11: item um we're looking forward to the annual protocol meeting right on um it's been bumped

[0:26:10] Voice 11: from i think it's gonna happen last week but it will be november 23rd so um rltc or trustees have

[0:26:19] Voice 11: added some items to the agenda and then their staff will have others they're hosting a meeting

[0:26:23] Voice 11: this is the opportunity to discuss these joint issues but in this agenda package also is is a

[0:26:31] Voice 11: an item of new business for me about elected officials coffee chats so we've been working on

[0:26:39] Voice 11: so myself and staff and director craig talking about how we host community discussions with

[0:26:47] Voice 11: the RDN electoral area director and local trustees so that's also on the agenda

[0:26:54] Voice 11: for a protocol meeting so just wanted to flag that for the future thank

[0:27:00] Voice 8: you for bringing that up

[0:27:02] Voice 8: trustee Elliott because there are lots of times when people have questions for both the regional

[0:27:06] Voice 8: district and for

[0:27:08] Voice 11: the islands trust and it'd be great to discuss them or things are not they're

[0:27:12] Voice 11: they're falling in the gap because they don't deny the road jurisdiction it requires a cooperative

[0:27:16] Voice 11: approach so that's that's always been the challenge with the nature of our government

[0:27:21] Voice 11: structure okay

[0:27:24] Voice 10: thank you trustees um so the next item on our agenda 3.4 standing um uh opportunity

[0:27:31] Voice 10: for 13 reporting for the nations the name will particularly be of interest um but we don't have

[0:27:37] Voice 10: anything today that i'm aware of and so uh we'll head to the other well

[0:27:43] Voice 11: i just wanted to um

[0:27:45] Voice 11: i don't know how we get these reports but uh it it would be useful to start having some

[0:27:52] Voice 11: information what i what i would note is that the new administration is undertaking their own

[0:27:59] Voice 11: community revisioning process similar to our official community plan revision. It's sort of a

[0:28:10] Voice 11: community plan and I'll note they have a meeting on October 30th in which they can share final

[0:28:17] Voice 11: needs. It's obviously for Senate members, not for us, but I would like to discuss either here or in

[0:28:25] Voice 11: First Nations relationship going, how we might as an LTC or as a larger community

[0:28:32] Voice 11: indicate our support for their process. We so often go to the nation with our agenda,

[0:28:40] Voice 11: what we're asking and what we want and this would be a wonderful opportunity to say

[0:28:45] Voice 11: wow your community is going through a visioning process and setting priorities.

[0:28:52] Voice 11: just want to acknowledge that and and send our support so i'll be putting together a

[0:28:58] Voice 11: um sort of a gift basket um some squashes that i've grown with the co-op and um and i'll put

[0:29:08] Voice 11: it out to the community that if anybody wants to put together some local gabriola

[0:29:13] Voice 11: um produce or um gifts and perhaps we can just send that and say here's here's a start

[0:29:26] Voice 11: for relationship building i have tried in many different ways to be put on their agenda

[0:29:31] Voice 11: as a delegation it's they simply have too many priorities and and things going on but i think

[0:29:38] Voice 11: a gift that is just an expression of friendship, an expression of the fact that they are treaty

[0:29:48] Voice 11: partners and undertaking their own community process might be a good idea. So I don't know

[0:29:57] Voice 11: I don't know if I'm looking for support from the LTC or not.

[0:30:00] Voice 11: it's something I'd like to undertake and I'll work with

[0:30:02] Voice 11: with Rob and Kathy

[0:30:03] Voice 11: on the best way to go with that

[0:32:08] Voice 11: individual and a real resident i'm very concerned that the rules supporting center stage holdings

[0:32:16] Voice 11: development permit application that is gvdp 202.1 are outdated and were not even written

[0:32:24] Voice 11: in collaboration or consultation with First Nations.

[0:32:28] Voice 11: I'm referring to the existing Islands Trust Policy Statement

[0:32:32] Voice 11: and the Gabriola Official Community Plan and Land Use Bylaws.

[0:32:37] Voice 11: In addition, the Gabriola LTC signed a protocol agreement

[0:32:41] Voice 11: with us in the name of First Nation.

[0:32:43] Voice 11: The Gabriola LTC has a responsibility to live up to those commitments.

[0:32:49] Voice 11: I strongly request that the Gabriola LTC delay making any decision

[0:32:54] Voice 11: about this development for an application until the SFN has clearly

[0:32:59] Voice 11: indicated that the permit to cut trees would not negatively affect the cultural

[0:33:04] Voice 11: or spiritual importance of the proposed areas. If the Gabriel LTC decides to go

[0:33:11] Voice 11: ahead and approve this DP application I urge you to decide firstly that the DP

[0:33:18] Voice 11: must include a requirement for a Heritage Conservation Act permit to be

[0:33:24] Voice 11: be obtained with the active participation of an SFN knowledge keeper familiar with the site

[0:33:30] Voice 11: prior to issuing any permit. And secondly, ongoing monitoring of the tree cutting by an SFN

[0:33:37] Voice 11: archaeologist should the HCA permit be approved. Thank you for your time and consideration. I'll

[0:33:44] Voice 11: email a copy of these remarks to the Northern Office right away and to the trustees.

[0:48:37] Voice 11: available as to register on-site based water practitioner letter of insurance compliance

[0:48:43] Voice 11: a fire inspection letter a guest manual a standard home inspection report as well as property

[0:48:49] Voice 11: insurance we've also provided the last name and contact information of an operations manager who

[0:48:55] Voice 11: lives up here and will be available 24 7 to respond to neighbor and ltc concerns regarding

[0:49:01] Voice 11: regarding the commercial vacation rental.

[0:49:04] Voice 11: Staff would like to make a brief correction

[0:49:06] Voice 11: to the staff report.

[0:49:08] Voice 11: There's a note on page 25 recommending

[0:49:11] Voice 11: that a groundwater pumping test be conducted

[0:49:14] Voice 11: between July and November over a minimum four hour period.

[0:49:22] Voice 11: this information has since been found to be inaccurate

[0:49:24] Voice 11: and references some past recommendations

[0:49:54] Voice 11: tests, and therefore assessing the impacts of the commercial

[0:49:58] Voice 11: vacation rental use by neighboring wells or water bodies is not going to be possible at this time

[0:50:05] Voice 11: so that's just for clarification just update staff also note that since

[0:50:14] Voice 11: um you said that the um the conventional requirements is the 12 hour um it's guidance

[0:50:20] Voice 11: so the cellular requirements but yeah there's there's a guidance document that i can share

[0:50:26] Voice 11: So, this hasn't been asked by William Shulbaugh, but you're saying that it's still, you still

[0:50:37] Voice 11: consider the existing law full test is acceptable?

[0:51:15] Voice 11: that home inspection report. A notice was sent out to surrounding property owners 10 business

[0:51:20] Voice 11: days in advance of this meeting and an advertisement providing notice that the application was placed

[0:51:25] Voice 11: in April of Sounders October 18th edition uh this time staff have not received any correspondence

[0:51:31] Voice 11: either in opposition or in favor of the tech and yeah please let me know if you have any questions

[0:51:37] Voice 11: things are here as well to speak to their application so that was only seven days ago

[0:51:46] Voice 11: October 18th is that that's a is that enough time yeah that's

[1:03:09] Voice 10: But you've made that decision. I just would suggest that as time goes on, if this temporary use permit thing and vacation rental thing is working out, a long-term rental would be, I think, beneficial to the community as well.

[1:03:27] Voice 10: I'm reviewing all the information that you had in the document, particularly around the fire pit that you have.

[1:03:35] Voice 10: have um what i'm a deputy fire chief on my own island and fire pits are a problem because people

[1:03:42] Voice 10: aren't aware that in fire season they can't have any fires and you haven't noted that in your fire

[1:03:50] Voice 10: safety plan and stuff like that so i think that what you should do and of course it's up to you

[1:03:56] Voice 10: to determine to do that is you should have consult with the fire department although they told you

[1:04:00] Voice 10: that it's all safe and everything but consult with the fire department about the regulations

[1:16:42] Voice 6: So my question is are those all questions to be discussed with the ARC branch or is it only A

[1:16:50] Voice 6: is with the ARC branch and then B and C are issues you're dealing with with the trust

[1:16:55] Voice 6: getting an opinion from the trust legal counsel?

[1:16:58] Voice 11: Through the chair yes that's correct so we can

[1:17:01] Voice 11: staff to have the discussion and the follow-up of the art branch so

[1:17:41] Voice 11: art sites is to be done including vegetation so

[1:17:47] Voice 6: um then i think the d wasn't staff to refer to sfn

[1:17:53] Voice 6: yeah and my question to the chair now i'm getting the process um whether that referral has

[1:18:01] Voice 6: has sent out and whether there's a time limit on the response.

[1:18:06] Voice 10: So the latter has been sent out, and in fact, I even had a phone call with them.

[1:18:10] Voice 10: There was no time limit on the response, and quite frankly, that's the whole waiting

[1:18:15] Voice 10: for it.

[1:18:18] Voice 6: Right.

[1:18:19] Voice 6: So my concern about that is that our experience with the First Nation on some other issues

[1:18:29] Voice 6: is sometimes they don't respond at all.

[1:18:33] Voice 6: yeah so that's something that we take into account over some period of time yes all right

[1:18:41] Voice 6: the other thing i wanted to do um there was some discussion in one of the meetings about

[1:18:50] Voice 6: the accuracy of the state folks there was thought maybe they weren't accurate and that caused some

[1:19:00] Voice 6: concerns well i just i'm not sure what the proper protest is but i did

[1:19:04] Voice 6: uh on our site inspections on the property with our engineer um two engineers actually

[1:19:13] Voice 6: he sent me an email with a an excerpt from the geohazard report from terratech which was

[1:19:23] Voice 6: um the company that did your slope criteria for the island for the whole island

[1:19:30] Voice 6: and in that report was a map of the feed slopes on our site and the email from our engineer

[1:19:42] Voice 6: indicated that he attached the schedule and confirmed the discussion we had on site that

[1:19:49] Voice 6: there is very little land actually in red and greater than 80 percent so what i wanted to

[1:19:55] Voice 6: us submit this if there's a proper way to do it to show that the mapping on our site for the state

[1:20:03] Voice 6: slope is actually accurate in terms of our engineers site inspection and he points out

[1:20:10] Voice 6: and it becomes quite clear there that there's very little uh of our land that is slopes in

[1:20:17] Voice 6: excess of 80 percent i didn't want to put that into perspective that's

[1:20:21] Voice 10: fair that you could receive

[1:20:23] Voice 10: that at any point in time there's additional information for your application all right

[1:20:29] Voice 12: the um the health challenge i think what i wanted to i won't take too much time

[1:20:48] Voice 6: to do this but

[1:20:50] Voice 6: i am concerned that the discussions that would have occurred with respect to the april 20th

[1:20:59] Voice 6: april 14 2021 letter of the first nation um

[1:21:04] Voice 12: that letter very

[1:21:10] Voice 6: inaccurately depicts

[1:21:11] Voice 6: the issues in the letter and I don't know how much that influences the decision making of the

[1:21:18] Voice 6: trust with respect to our DP application but if it doesn't influence it then I think we really need

[1:21:25] Voice 6: to have the opportunity to provide the information that shows which of those areas are not correct

[1:21:32] Voice 6: and I had prepared some material which again I understand the proper process might be just

[1:21:39] Voice 6: submitted yeah through the planner to get it to you yeah but um it's it's fairly comprehensive but

[1:21:47] Voice 6: in essence what it says is that the the four issues with the first nation engraved in that

[1:21:55] Voice 6: letter um were that we performed unauthorized work on the site and continued to do that despite

[1:22:09] Voice 6: despite a request to stop work.

[1:22:12] Voice 6: The second item was that we had disturbed artifacts.

[1:22:17] Voice 6: The third was the inference was perhaps we had misled the heritage branch regarding the

[1:22:22] Voice 6: registration of covenants.

[1:22:24] Voice 6: And the fourth one was that it was the Ministry of Transportation who requested the AIA update,

[1:22:32] Voice 6: not the First Nation.

[1:22:33] Voice 6: So I have put together the material to show that the work that we performed on the site was done with the knowledge and approval of the heritage branch, that we did stop work voluntarily.

[1:22:54] Voice 6: voluntarily. It was our position. We had no obligation to stop work. It was our private

[1:23:00] Voice 6: land and we were allowed to work on it as long as we abide by the Heritage Protection

[1:23:06] Voice 6: Act requirements. And the second issue with respect to the disturbance of artifacts, to

[1:23:15] Voice 6: the credit of the First Nation, they didn't claim the damage had been done. They claimed

[1:23:20] Voice 6: that had been reported to them that damage had been done.

[1:23:25] Voice 6: With respect to that issue,

[1:23:28] Voice 6: we had our archaeologists come on site to do an inspection.

[1:23:35] Voice 6: We had, I think, the First Nation inform the Heritage Branch.

[1:23:41] Voice 6: They sent out their enforcement officer to do an inspection.

[1:23:45] Voice 6: Both of those reports confirmed that there was no damage to any sites.

[1:23:51] Voice 6: and and i do want to just if i can find it read one provision

[1:23:57] Voice 6: i think i mentioned the last report and i'll submit it but the enforcement officers not only

[1:24:04] Voice 6: confirmed that all the sites were intact and have not been affected but they also confirmed that in

[1:24:10] Voice 6: their opinion being kind of an exemplary in managing the sites so that issue for us is

[1:24:18] Voice 6: very important because the public record may reflect that we had damaged sites or hadn't

[1:24:31] Voice 6: stopped work or in some way had been offensive to the First Nations interests. So it's from

[1:24:36] Voice 6: that perspective that personally we're very

[1:24:41] Voice 12: upset internally that

[1:24:46] Voice 6: this information hasn't

[1:24:51] Voice 6: been responded to and so that's why I took the time to prepare the documents to show that

[1:24:56] Voice 6: in each of these cases everything in that letter that was pointed out is

[1:25:02] Voice 7: either inaccurate or

[1:25:03] Voice 7: or just wrong so

[1:25:07] Voice 6: that's important to me with respect to the covenants themselves

[1:25:13] Voice 6: which I think is relevant to what the committee's concerned about that letter indicated that they

[1:25:21] Voice 6: They had been informed by the Heritage Branch that they thought covenants had been registered when, in fact, they had not.

[1:25:29] Voice 6: I have all the correspondence here, including the letter required by the Trust and given to the Trust,

[1:25:40] Voice 6: where the Trust acknowledged that there was no need to register covenants until the subdivision occurred,

[1:25:46] Voice 6: until allots were traded that would have these sites on them.

[1:25:50] Voice 6: and we've provided that undertaking to the trust um so the suggestion that there's misinformation

[1:25:58] Voice 6: or some deliberate intent to misinform the branch about registration of covenants

[1:26:03] Voice 6: is absolutely incorrect the additional information that i have will show

[1:26:10] Voice 6: that in conversations with the heritage branch they confirmed they didn't expect these to be

[1:26:16] Voice 6: registered until the covenants were until the subdivision was

[1:26:20] Voice 6: completed. The trust covenant itself, the initial covenant

[1:26:25] Voice 6: requires covenants on subdivision. So all of the

[1:26:30] Voice 6: correspondence, and sorry, the last thing is, we had the

[1:26:35] Voice 6: heritage branch, we submitted the draft covenants, they

[1:26:39] Voice 6: approved them. And the understanding we've had with the

[1:26:43] Voice 6: trust with the MOTI and the heritage branch is that covenant would be registered at the time

[1:26:53] Voice 6: of subdivision one of the problems is until you know where the lots are we wanted to put

[1:26:59] Voice 6: individual covenants on each lot and the point I make about that is this that it's my understanding

[1:27:06] Voice 6: from the heritage branch that the legislation under the Heritage Protection Act binds all

[1:27:15] Voice 6: owners on private land, subdivided land, any land.

[1:27:19] Voice 6: And it's my understanding that that legislation, it doesn't matter whether the trust issued

[1:27:29] Voice 6: a DP on the site, those sites are protected by the Heritage Protection Act.

[1:27:36] Voice 6: So I think what I'm trying to say is, number one, the accuracy of the slope stability assessment on our site is accurate, as confirmed by our engineer who was on site.

[1:27:53] Voice 6: And the steep slopes represent an extremely small portion, probably less than 5% of the bluff we're talking about.

[1:28:01] Voice 6: So and in fact probably on those steep slopes it's quite likely there may be no trees to come off

[1:28:10] Voice 6: because they're so steep the trees don't grow there. The other point I want to make about

[1:28:17] Voice 6: removing trees, I made it but I don't have it in writing, the intent isn't to remove 1900 trees.

[1:28:25] Voice 6: That report was done to say that if we removed that many it was still stable. The

[1:28:34] Voice 6: On the other side of the coin, we do have some concerns about removing trees and fire

[1:28:39] Voice 6: departing, and I just had an article that I'll submit through the planner where the

[1:28:46] Voice 6: catastrophe in Hawaii, that there's a lawsuit there now against private landowners for not

[1:28:54] Voice 6: looking after their property and maintaining it to avoid fire.

[1:28:58] Voice 6: So, and I think the other point I make is that the forest assessment report makes it

[1:29:04] Voice 6: it clear that the standard they used to determine the maximum trees was a number of stands per

[1:29:13] Voice 6: hectare, the same formula used for the 707. And the reason behind that is because that's

[1:29:21] Voice 6: the level of trees that creates a healthy forest on Gabriel. So although we're not intending

[1:29:28] Voice 6: on removing that number of trees, although the number on the steep slopes is maybe zero

[1:29:35] Voice 6: but nominal. Even if we did, the slopes are stable, and it would be in line with creating

[1:29:46] Voice 6: a healthy forest. I think that's probably all I want to make, specific points I want

[1:29:55] Voice 6: to make, just to address any misunderstandings that have occurred.

[1:29:58] Voice 6: So, thank you.

[1:30:00] Voice 10: for the synopsis, I'll call it, but what was critical is that that information that you're

[1:30:04] Voice 10: referencing end up with staff so that we can read it and analyze it and come to our own conclusions

[1:30:34] Voice 10: come to us as a recent package then we can do that analysis ourselves to come to some understanding

[1:32:01] Voice 6: covenants the branch having approved the covenants there's no room for us to make a mistake and the

[1:32:12] Voice 6: consequences for making a mistake under the heritage protection act are huge so from our

[1:32:20] Voice 6: point of view we're talking about removing some trees on a steep slope very small you know trustee

[1:32:29] Voice 6: Elliot pointed out that on the north face there's there's a site up at the top that looks like it

[1:32:35] Voice 6: might be in a steep slope area I can tell you those sites are on level ground at the bottom

[1:32:41] Voice 6: of the flows not impacted by tree removal at all in fact as I said before the buffer around those

[1:32:50] Voice 6: sites wouldn't allow interference and so we are bound by the obligations of the heritage

[1:32:59] Voice 6: protection and we have agreed in addition to that to enter the covenants and the purpose of those

[1:33:06] Voice 6: covenants wasn't it's not for us we know our obligations and their legislator the covenants

[1:33:13] Voice 6: were asked for by the heritage branch so that when the lots are created the subsequent owners

[1:33:20] Voice 6: have direct knowledge of where it is on their title that's where the covenants are intended

[1:33:25] Voice 6: intended to be. And that's why it's on subdivision. So I think that's the point I wanted to make

[1:33:31] Voice 6: and I hope that clarifies.

[1:40:04] Voice 7: I've also included in these statistics a houseboat in Dakin Bay

[1:40:08] Voice 7: that is not legally to be in use at this time.

[1:40:11] Voice 7: and it's actually been abandoned by its lawful owner and Transport Canada is aware of that.

[1:40:18] Voice 7: The majority of the files involve the use of a travel trailer as a residence with only

[1:40:22] Voice 7: four files dealing with non-compliant secondary suites. I've broken the numbers down for you for

[1:40:28] Voice 7: the current open files and the years that they were open. Three new files were opened since the

[1:40:35] Voice 7: resolution was adopted. Two of these files were opened after receiving a complaint and one was

[1:40:41] Voice 7: open for action based on online advertising of the use of travel trailers for residents

[1:40:47] Voice 7: within your land use by law you have regulations that stipulate when the travel trailers can be

[1:40:53] Voice 7: used as a residence as a temporary dwelling unit as long as the building permit is in place that's

[1:41:01] connected to

[1:41:01] Voice 7: a sewage disposal system so with the adoption of this standing resolution it hasn't led

[1:41:09] Voice 7: to an increase in the use of travel trailers as residences and is not resulting in proliferation

[1:41:14] Voice 7: complaints regarding non-compliant secondary seats. The event's number of

[1:41:19] Voice 7: files were opened in 2021

[1:41:21] Voice 7: and this may have been a result of the COVID pandemic changing liver arrangements for families

[1:41:25] Voice 7: and influx of new residents to rural areas especially on Bunch. For the majority of the

[1:41:31] Voice 7: files there are no concerns from staff about the proper disposal of sewage as most property owners

[1:41:36] Voice 7: ensure that the proper services are provided more than one property owner has stated it will be

[1:41:42] applying for building permits for dwelling with the building current place as previously stated

[1:41:48] Voice 7: it will be lawful to use that travel through as a temporary residence and the regulations provided

[1:41:55] Voice 7: in that section contain considerable flexibility for those who should develop probably properties

[1:41:59] Voice 7: and establish a full-time residence so as there are no trends towards increased number of non-compliant

[1:42:05] Voice 7: dwelling that is not recommended that be any changes to current violent enforcement policies

[1:42:10] Voice 7: at this time however the alternative recommendation and the option only to the local trust meetings

[1:42:16] Voice 7: that they would say in standing revolution if they wish okay

[1:42:24] Voice 10: necessary for us to have a motion to receive information if that's what you want to do because

[1:47:47] uh summer rankings are there's only a legal counsel and uh it lasted shorter than i expected

[1:47:55] over an hour, and in the end, Mr. Poling and his legal counsel rely on the previous court

[1:48:02] decision from 15 plus years ago, or maybe 17 years when all of that, the operation was

[1:48:09] lawful non-conforming, and now lawful non-conforming arguments aren't supposed to be considered

[1:48:15] by adjudicators, and

[1:48:17] Voice 7: plus the previous local trust committee amended land use bylaw to

[1:48:23] Voice 7: permit home industries such as the one that mr coley operates so he's allowed to operate the

[1:48:28] Voice 7: business but there's certain regulations that he must comply with those regulations so that's why

[1:48:35] Voice 7: he's given violations it's an awful for a shed that's in the setback that he needs to develop

[1:48:40] Voice 7: a very experimental form which actually wasn't part of the previous our case but the adjudicator

[1:48:45] Voice 7: So I'll use that in. I can forward the decision to the trustees.

[1:48:52] Voice 7: And

[1:48:52] Voice 10: then there's other violation notices which are yet to be reviewed.

[1:48:56] Voice 7: That's correct. Yes. I mean, at some point,

[1:49:00] Voice 7: Islands Trust has spoken with Young Anderson about this,

[1:49:03] Voice 7: made wish to do a judicial review of some of these decisions because they just,

[1:49:10] Just in their opinion, the adjudicators are not seeing the jurisdiction and it may be

[1:49:19] necessary to take it to the Supreme Court on the judicial review, just to clarify what

[1:49:25] Voice 7: they can and cannot do.

[1:49:27] Voice 8: Okay.

[1:49:28] Voice 8: And that wouldn't change the outcome for summer rain, but it would clarify what, more

[2:20:15] Voice 4: a little bit of an update and where we are at with things and and then we can go from there so um

[2:20:22] Voice 4: there's there's uh sort of two two things that i'm i'm i put forward as recommendations um related to

[2:20:30] Voice 4: this this report one is uh to endorse the community engagement plan for the uh the official community

[2:20:38] Voice 4: community plan and land use by-law review project and I'll just you know also say that you can

[2:20:45] Voice 4: endorse it now it can always be changed so that's something to keep in in mind and there's also a

[2:20:51] Voice 4: recommendation for a special meeting before the end of the year to discuss things related to the

[2:20:57] Voice 4: process so that's just an opportunity if trustees see see a value in having a meeting outside of

[2:21:06] Voice 4: an ltc meeting just to review where we're at with the process um and have discussions about uh

[2:21:14] Voice 4: how we want to move forward there as all as i will explain as we go through we do have

[2:21:19] Voice 4: a few things in motion right now in terms of the community engagement piece and um um and i'm just

[2:21:26] Voice 4: putting that out there as an opportunity for a check-in if needed um so the background of the

[2:21:32] Voice 4: report really goes through there were a whole number of resolutions that were passed at the

[2:21:37] Voice 4: July 25th meeting so I wanted to provide you with a bit of an update of where things are at

[2:21:44] Voice 4: so the LTC endorsed there was a discussion about different options for engagement and three

[2:21:54] Voice 4: different options were proposed to the uh the ltc um and the option they that was chosen was uh

[2:22:02] Voice 4: option two with a few caveats um and that was looking at sort of a a bit of a structured

[2:22:09] Voice 4: community engagement process that sort of emphasized um a community led process

[2:22:16] Voice 4: process. So we've worked with comments that were provided to us by trustees as well as

[2:22:28] Voice 4: the APC and some of the actions that have been taken so far, and you'll see that as

[2:22:37] Voice 4: I go through the engagement plan as well, include an open call for submissions connected

[2:22:43] Voice 4: to available funds we've made funds available to community groups to host community events related

[2:22:49] Voice 4: to the gabriel the gabriela visioning process so that's an opportunity for community members to

[2:22:56] Voice 4: think broadly about what what they they want to see for the community um by by 2050 um so we now

[2:23:06] Voice 4: have those those funds available we we did have a early deadline in in october and um we we had

[2:23:13] Voice 4: limited applications um and we've we've extended that to november 10th and we are getting there's

[2:23:19] Voice 4: quite a bit of um interest in community and um last time i checked we had nine submissions for

[2:23:25] Voice 4: that so we're also going to have an opportunity um to have a community conversation before that

[2:23:31] Voice 4: deadline so that others that are interested will be able to get some more information and apply.

[2:23:39] Voice 4: The Gabriel Local Trust Committee had requested that staff provide options for First Nations

[2:23:46] Voice 4: engagement so this has been a bit of a conversation we're working towards developing

[2:24:34] Voice 4: relationship building element to this which is chief and council and um um and and our trustees

[2:24:41] Voice 4: and trustee elliot has has been exploring options to support that process and um robin

[2:24:51] Voice 4: has been engaged in in these discussions as well um as you know how we move forward with

[2:24:59] Voice 4: engagement with with the different nations is different in in each area we've got different

[2:25:05] Voice 4: types of issues and we've got different relationships so that's why it takes a

[2:25:09] Voice 4: little bit of time to to get it right so we are taking that time but i do assure you that we are

[2:25:14] Voice 4: we are moving forward so the there were a couple of resolutions related to the

[2:25:23] Voice 4: Advisory Planning Commission so the the July 20th report was was sent to them

[2:25:34] Voice 4: for feedback related to the to the engagement office options and and the

[2:25:40] Voice 4: engagement process uh and staff were also requested to schedule orientation meetings

[2:25:46] Voice 4: so the orientation there have been two there were two meetings in august those were as far as i know

[2:25:51] Voice 4: the the the the only two meetings that have have have occurred since july and um staff we see or

[2:26:00] Voice 4: there were the feedback was um the minutes from those meetings were in the september uh meeting

[2:26:07] Voice 4: agenda and staff did um uh uh planner zupanak attended the first and i attended the the second

[2:26:16] Voice 4: and feedback that we received again we've taken and um it has it has informed the process that

[2:26:25] Voice 4: we've got moving forward so um they were very supportive of encouraging a community-led pro

[2:26:32] Voice 4: process. They were also pointing out the need for communications, actually, you know, what

[2:26:40] Voice 4: is an OCP, you know, what is land use, that sort of thing. So we, when I, again, when

[2:26:47] Voice 4: I go through the engagement plan, I can get into a few details about some of the things

[2:26:54] Voice 4: that we've done to sort of address that in the process that we've got, that we've kind

[2:26:59] Voice 4: of designed to support the community-led process and related communications.

[2:27:11] Voice 4: There were a couple of resolutions relating to the Housing Advisory Commission.

[2:27:18] Voice 4: So the direction there was to have them review the Housing Options and Impacts Review

[2:27:26] Voice 4: review previous process and provide some some feedback related to the OCP review they have

[2:27:34] Voice 4: yet to meet they do they do now have a scheduled meeting I believe it's um November the first and

[2:27:40] Voice 4: so um both myself and um and uh Chloe will be attending that meeting um there was a resolution

[2:27:53] Voice 4: related to a soft launch of the project of the OCP engagement process and project in September.

[2:28:04] Voice 4: So it was identified that the Gabriel Fall Fair would be the appropriate place to do that.

[2:28:10] Voice 4: So we were able to launch a project website just before the Fall Fair and create posters and postcards.

[2:28:23] Voice 4: that were leading people to the web page.

[2:28:28] Voice 4: We had a survey asking residents

[2:28:32] Voice 4: how they would like to be engaged in the process.

[2:28:35] Voice 4: And all of that was very well received.

[2:28:39] Voice 4: The survey was also an entry for a draw prize,

[2:28:47] Voice 4: prize, which included many amazing things that Chair or that Trustee Elliott had gathered

[2:28:55] Voice 4: from local makers and growers. So it was quite a, quite a wonderful prize and people were

[2:29:05] Voice 4: very eager and anxious to have an opportunity to win that and also provide their feedback.

[2:29:11] Voice 4: So I think we got well over 100 surveys filled out. So we've got some really good information

[2:29:16] Voice 4: moving forward around how people are interested in being engaged in the process.

[2:29:25] Voice 4: Yeah, there's some information on our website related to that event,

[2:29:29] Voice 4: and the website will continue to be a place that residents can go

[2:29:35] Voice 4: to get further information on the project.

[2:29:38] Voice 4: So I've provided you with a little, just a little bit of a breakdown of the two phases in terms of timing.

[2:29:49] Voice 4: As you can see by the little colorful graph on in the staff report, we are in phase one, which is the Gabriel.

[2:30:00] Voice 4: visioning phase and this is our our community-led engagement phase so when I

[2:30:07] Voice 4: when I get to the engagement process I'll kind of walk you through where

[2:30:11] Voice 4: we've been in where we plan to go with that and then there's phase two which is

[2:30:15] Voice 4: is the the sort of nuts and bolts of the OCP process and there'll be different

[2:30:22] Voice 4: opportunities for community engagement at that point in time so so rationale

[2:30:28] Voice 4: from our recommendations which is around endorsing the engagement plan and uh and having potentially

[2:30:34] Voice 4: having a meeting in in december to connect and talk about the ocp uh is well we know that

[2:30:41] Voice 4: community engagement is critical and it's been something that um trustees have been talking

[2:30:46] Voice 4: about from the the onset of this project um and um you know we'll we'll do our best to keep it

[2:30:52] Voice 4: on track and having a clear plan is helpful for that.

[2:30:59] Voice 4: And as I mentioned before, sometimes the LTC meetings can be quite long and there's some

[2:31:08] Voice 4: complicated applications.

[2:31:12] Voice 4: So if that's the case for November or if there's interest in doing a check-in later

[2:31:21] Voice 4: later in November or such then

[2:31:26] Voice 4: trustees can make a decision whether that's something they'd like staff to

[2:31:29] Voice 4: organize. So I'll just

[2:31:33] Voice 4: have we can have a look at the engagement plan and I'll sort of

[2:31:38] Voice 4: step you through a little bit what

[2:31:41] Voice 4: has been identified for phase one and then phase two

[2:31:46] Voice 4: so as I've mentioned before we are in phase one

[2:31:50] Voice 4: Phase one has involved the launch of our website, the soft launch of the project in general, which occurred at the fall fair.

[2:31:59] Voice 4: We have a plan to have, because information sharing and communications and education was really something that's been brought up many times by the APC and also the trustees,

[2:32:11] Voice 4: trustees. We're going to develop a communications plan. We've got Morgana has organized bi-weekly

[2:32:22] Voice 4: meetings for us so that we can, I can connect with the two Island based trustees as well

[2:32:32] Voice 4: as Chloe in the Northern office and Morgana and we can talk about the next thing basically

[2:32:41] Voice 4: and by doing bi-weekly meetings we can have work plans set up and figure out who does what we may

[2:32:49] Voice 4: want to want to engage some other community members in the delivery of some of the content

[2:32:54] Voice 4: it's an opportunity to check in and see what what kind of information the community might need in

[2:33:00] Voice 4: the moment and be able to deliver it within a couple of weeks that's the hope at least so

[2:33:05] Voice 4: you know this is this process is something we've never done before in the trust area

[2:33:10] Voice 4: so it's a bit of a pilot and it'll be exciting to see how it all comes together.

[2:33:17] Voice 4: So in terms of the community-led engagement process, we like I said had launched an

[2:33:23] Voice 4: application process for funding up to $600 to fund events and the money can go towards

[2:33:31] Voice 4: towards supporting those events, so venue costs, facilitation, note-taking, if there's refreshments, those sort of standard meeting type costs.

[2:33:48] Voice 4: Like I said, there's been some great feedback.

[2:33:53] Voice 4: interesting to see the variety of groups that have gotten gate have gotten application forms

[2:34:00] Voice 4: in of the of the nine that I scanned just the other day so we may have we may have received

[2:34:05] Voice 4: more by now all of the groups that receive funding will will be required to fill in an

[2:34:12] Voice 4: engagement template and that's an opportunity for us to to help those groups focus their feedback

[2:42:24] Voice 4: So out of that, what we'll glean from the visioning phase, all of those things that are land use focused will inform the phase two, the OCP review.

[2:42:53] Voice 4: And, you know, we have indicated in the feedback form that if they do have specific, you know, sort of encourage them to think about land use as well.

[3:06:19] Voice 11: And so I think it would be proactive and a good move strategically to seek the province's

[3:06:29] Voice 11: support and say, we are continually being put in these positions where we can't dictate

[3:06:39] Voice 11: to landowners how to care for Indigenous cultural heritage, but how can they step in to support

[3:06:56] Voice 11: a better process or wait for legislation, which could take 10 years to change?

[3:07:02] Voice 11: And I look at the example of from the summer, the city of Nanaimo went through a rezoning

[3:07:10] Voice 11: application and um the Howard Johnson an area that wasn't well wanted to be rezoned

[3:07:22] Voice 11: went to third reading um strong objections from the nation and um seemed to proceed anyways and

[3:07:32] Voice 11: then at that point the province stepped in and said we're going to appoint a facilitator because

[3:07:36] Voice 11: because this is a gray area that you need help negotiating.

[3:07:42] Voice 11: It's not clear cut because of the limits of our legislation

[3:07:46] Voice 11: and the Local Government Act.

[3:07:47] Voice 11: And because none of that is updated

[3:07:49] Voice 11: to align with the principles of the Declaration Act.

[3:07:53] Voice 11: So I don't want to see us get into that position.

[3:07:58] Voice 11: And even if it was a letter just saying we need support

[3:08:02] Voice 11: from this Gabriel LTC or from the Islands Trust in general,

[3:08:08] Voice 11: legislative reform is on the horizon but it could take decades

[3:08:24] Voice 11: tools so what we heard at ubcm is there are certain non-legislative tools and then

[3:08:48] Voice 11: Well, we can't do this. And so therefore, it looks like we don't care. It looks like we're just missing the underlying right.

[3:08:56] Voice 11: So I would just like to see us write a letter requesting their support in a greater direction.

[3:44:11] Voice 11: approaches with the province there has not been necessarily consistent approach especially so to North and to West right we're dealing with three different offices, in some cases, for issuance of these tenures or special permissions or leases on Crown land as well where people are applying for a lease over Crown land to exercise specific activity.

[3:44:35] Voice 11: So we've had a range of situations and that's where our interrelations and our ability to

[3:44:44] Voice 11: have these discussions with those agencies is really important to identify when there's

[3:44:48] Voice 11: a problem because you know in some cases we've had really great staff on that end say well

[3:44:53] Voice 11: no we will not issue this permission or this permit or this lease if it's in direct contradiction

[3:45:00] Voice 11: to your local regulations so that's been stated before as well so it's it seems to be a bit

[3:45:09] Voice 11: inconsistent in some cases over the last decade but hopefully the trend is moving towards the

[3:45:14] Voice 11: point of the referrals is to identify where there's an issue those issues have to be resolved

[3:45:19] Voice 11: before the problem is able to issue its permits and it can be a conditional i mean the permits

[3:45:23] are typically conditional on local government approval so it'll say right in fine print

[3:45:28] Voice 11: Yes, they've issued it, but that doesn't mean that that individual can't actively use that marine or land area because they are under a general bylaw.

[3:45:44] Voice 11: So the provinces cover themselves in that way.

[3:45:47] Voice 10: So they don't use the same language that we use, which would be subject to.

[3:45:51] Voice 10: They just say, here's the

[3:45:53] Voice 10: lease, but you've got to get them each other.

[3:46:23] Voice 10: than an individual because there's more strength in the government saying no this is wrong yes

[3:46:29] Voice 10: but that would be a different story i guess but those documents are public already and then the

[3:46:37] Voice 10: government doesn't redact them but would we have to redact them because we're using them for a

[3:46:41] Voice 10: different person for which information was collected the whole privacy of information

[3:46:47] Voice 11: i'm not aware of what the provincial reduction policies are but for it to appear on

[3:46:52] Voice 11: an ltc agenda there should be no reason why personal information is being shared right

[3:46:59] Voice 11: because you're not making a decision um planning that or you're providing input to another agency

[3:47:08] Voice 11: so i think there's some sensitivity around making sure that we just start attaching things and i'm

[3:47:13] Voice 11: not sure what other people attach to their provincial applications that may be sensitive

[3:47:19] Voice 11: sensitive information that is important for the province to receive and for the referral agencies to receive, but isn't still as public information.

[3:48:39] Voice 11: And the original intent of the first draft bylaw was to be like a filling zone, a holding ecological protection zone

[3:48:47] Voice 11: for property that may exist already or may come into existence with various rezonings or

[3:48:56] Voice 11: amenity zonings or exchanges or whatever. And the original three properties that were talked about

[3:49:03] Voice 11: at that time were part of the Coates Marsh, Burns Acres, and Elder Cedar. But it was not

[3:49:12] Voice 8: ever meant to be a zone specific to elder cedar so i find this really confusing that the intent

[3:49:21] Voice 11: of this zone now appears to be which consists of rezoning of elder cedar that is that was never my

[3:49:30] Voice 8: belief or intention or even because it was me and one other person who brought it to the to the

[3:49:38] Voice 8: previous trust committee and then and ian pox developed a really really good draft bylaw

[3:49:45] Voice 11: which seemed to say exactly what i would have wanted it to say and now that bylaw seems to

[3:49:52] Voice 11: be limited down to just rezoning for elder cedar that just doesn't make any sense to me

[3:50:02] Voice 11: there is a history of staff reports that the ltc is considered regarding a specific issue and the

[3:50:08] Voice 11: reasons why you'd like to air down and pull out any other proposals if you would

[3:50:15] Voice 11: go back to the reports and any questions sometimes

[3:50:22] Voice 11: that's one of five for the ltc on a number of occasions how to proceed forward

[3:50:30] Voice 11: when those challenges or

[3:50:31] Voice 12: else the project can be parted because i'm not even sure don't do cedar

[3:50:48] Voice 11: Okay, so just to give you an example, we have another possible zone coming up. It's the community

[3:50:55] Voice 11: service zone or something like that. And it's just a holding zone. There aren't any parcels

[3:51:02] Voice 11: specific to it at this

[3:51:04] Voice 8: time, but it's something that should maybe be in

[3:51:07] Voice 11: our land use bylaw

[3:51:07] Voice 11: and our OCP. So the original idea of an ecological protection zone would be a holding zone

[3:51:14] Voice 11: for areas of sensitive ecosystem that might come into play as rezonings and development occurs.

[3:51:25] Voice 11: It was never meant to be specific to Elder Cedar and I actually don't see the point of it unless

[3:51:31] Voice 11: it can be an ecological protection zone in our land use bylaw as a holding zone for sensitive

[3:51:41] Voice 11: to be consistent. So in this case the Elder Cedar Nature Reserve requires zoning that reflects

[3:51:48] Voice 11: that exact purpose and it doesn't have that right now. So it was determined at some point

[3:51:53] Voice 11: in time in the past that this particular project would apply to that parcel. It was an appropriate

[3:51:59] Voice 11: way to actually not just have an arbitrary floating zone but actually apply it to a piece

[3:52:04] Voice 11: of land which is the whole point of the exercise. We can create and craft a zoning language for

[3:52:10] Voice 11: parcels as they come up quite quickly so it's not that we're in the dirt though um examples

[3:52:16] Voice 11: for that as they come up and then we customize them so they actually reflect the subtle

[3:52:23] Voice 11: uniqueness of those parcels and adequately address those individual characteristics or

[3:52:29] Voice 11: land use issues um so this particular project has evolved significantly over time as certain

[3:52:36] Voice 11: issues can come up but the ltc has been at the helm of those decisions all the way through so

[3:52:42] Voice 11: i'm not sure this is the time to provide a recap of all your decisions related to it but it sounds

[3:52:48] Voice 11: like you're ready to have that chronology and timeline presented back to you what point were

[3:52:54] Voice 11: these decisions made because these bylaws you know we're actively working with sunama to talk about

[3:53:02] Voice 11: the draft bylaws and if the LTC is not confident that both bylaws are moving forward then we're

[3:53:08] Voice 11: we're wasting our time and potentially their time because we even have mention of capacity funding

[3:53:15] Voice 11: that you endorsed going directly towards this conversation so

[3:54:02] Voice 11: in your ocp and it is applied to the elder cedar as a working practice and it would need to be

[3:54:10] Voice 11: amended and changed to match whatever future by watch parcel comes in because of course we there's

[3:54:17] Voice 11: no way that the two of those would likely be the same i think there will always be some subtle

[3:54:21] Voice 11: changes or differences and the itc has commented on this particular parcel and how they wish to

[3:54:29] Voice 11: see it applied because they have a management plan for it so why not make the zone very specific

[3:54:35] Voice 11: since it is only applying to one parcel right now and it just issues that we discussed around

[3:54:41] Voice 11: why those other two pieces of different notes and we can revisit that if we need a refresher

[3:54:47] Voice 11: but we before we leave today i think it'd be important for the planner to know if there's any

[3:54:52] Voice 11: there is a confidence in those silos okay
