[0:00:31] Voice 11: My name is Tim Peterson. I'm elected on Mesquite Island.

[0:00:34] Voice 11: I'm the chair of the Galliano.

[0:00:36] Voice 11: local trust committee and with me our local trustee has been

[0:00:40] Voice 11: Maberly, Lisa Gavreau and our staff Kim Stockdale here today and together three

[0:00:48] Voice 11: of us make up the local trust committee and take a moment to acknowledge that

[0:00:53] Voice 11: we're meeting on the territory of Coast Salish peoples and the territory of the

[0:00:58] Voice 11: the Connecticut nation, and we're respectful of that.

[0:01:05] Voice 11: And we have a meeting agenda before us today.

[0:01:11] Voice 11: Is there anything anyone would like to attract?

[0:01:16] Voice 6: Kind of one thing I'd like to add,

[0:01:18] Voice 6: perhaps in our new business.

[0:01:20] Voice 6: I would like to discuss the Pascua-Lupus

[0:01:23] Voice 6: writing a letter of support for Galley.

[0:01:26] Voice 6: They have an application for the community housing fund for DC housing and I thought a support letter from the LTC could be included with their application.

[0:01:41] Voice 11: Okay, so any objections to adding that item to the new business? No.

[0:01:47] Voice 11: Alright, so we'll add that as item 18.1 and introduce us to that when we get there.

[0:01:56] Voice 11: there. Any other additions or amendments to the agenda before I conclude? All right, then

[0:02:17] Voice 10: to give a shout out to the Georgeson family. I had a celebration and a gathering for Rosemary

[0:02:24] Voice 10: Georgeson who passed a couple of weeks ago and it was nice to see the gathering of the boats in

[0:02:32] Voice 10: Georgeson bay and then the following day to hold a celebration of life up at the gun club

[0:02:39] Voice 10: and in true Georgeson fashion lots of good stories lots of good music and lots of good food so it was

[0:02:46] Voice 10: That was great. Yeah, good time. That was really nice.

[0:02:51] Voice 10: Thank you.

[0:02:58] Voice 6: This previous month, I've been working with trustees from Salt Spring and Gabriola

[0:03:03] Voice 6: on a letter to BC Housing, sorry, to the Minister of Housing.

[0:03:08] Voice 6: The letter is a response to the provincial government's announcement of the Homes for People Plan,

[0:03:14] Voice 6: which is a $16 billion plan to deliver more homes to people.

[0:03:21] Voice 6: The priorities of this action plan are to unlock more homes faster,

[0:03:26] Voice 6: deliver better, more affordable homes,

[0:03:30] Voice 6: helping those with the greatest housing needs,

[0:03:33] Voice 6: and creating a housing market for people, not for speculators.

[0:03:37] Voice 6: These are priorities that greatly benefit Galliano.

[0:03:41] Voice 6: Unfortunately, they're being left behind.

[0:03:44] Voice 6: Many parts of this action plan are not eligible for tests on the Gulf Islands.

[0:03:48] Voice 6: Our letter has been drafted, and it's currently with the Own Trust staff, and I expect it to go in the next few weeks.

[0:03:56] Voice 6: Early this month, I attended a Own Trust training session webinar called The Culture of Philanthropy.

[0:04:03] Voice 6: It was hosted by Strategic Development Specialist, Carla Hunk.

[0:04:07] Voice 6: The training session was geared towards trustees because we play an instrumental role in connecting

[0:04:13] Voice 6: people in our communities to good causes throughout the trust area.

[0:04:17] Voice 6: The conversation was particularly insightful for me and helped me better understand how

[0:04:23] Voice 6: the Galeano community has been able to achieve its goals.

[0:04:26] Voice 6: Our community has a robust amount of individuals who all contribute their time and expertise

[0:04:33] Voice 6: to make Galeano a great place to call home.

[0:04:35] Voice 6: Everything that we need matters, and we all steward these lands.

[0:04:40] Voice 6: As a trustee, I look forward to sharpening the tools I learned at this webinar.

[0:04:45] Voice 6: Of particular interest to me is how I can leverage my influence to promote kindness.

[0:04:52] Voice 6: This month of November brings Remembrance Day, and I wish to convey my respect and my admiration for those that I've chosen to serve.

[0:05:01] Voice 6: I remember today we acknowledge the courage and the sacrifice of those who serve this country

[0:05:06] Voice 6: and acknowledge our responsibility to work for the peace they fought hard to achieve.

[0:05:13] Voice 6: In my final thoughts from my report, I came across the Facebook post from a friend of

[0:05:20] Voice 6: mine this morning and they're commenting how one thing that they miss about the pandemic

[0:05:27] Voice 6: is that they weren't getting sick for three years I observed a fair number of

[0:05:32] Voice 6: people coughing and sneezing out while shopping at the various businesses at

[0:05:38] Voice 6: community events just wish to remind people to you're feeling unwell it's

[0:05:44] Voice 6: best to stay home currently there is a stomach flu going around and it's spreading

[0:05:49] Voice 6: it's crucial that we take precautions to avoid catching it thank you that's all

[0:05:55] Voice 6: Thank

[0:05:56] Voice 11: you. Okay, so next up is the Chair's report. I've been meeting with the Financial Planning Committee in the last couple of weeks in preparation for Trust Council December.

[0:06:08] Voice 11: So the pre-budget discussions, and also the governance committee met last week as well.

[0:06:18] Voice 11: Still working towards, well we've got some of the priorities, one of our top priority

[0:06:25] Voice 11: items was the Section 3 mandate discussion at Trust Council, and Trust Council did come

[0:06:34] Voice 11: up with a consensus statement on that, so that was one thing we actually got.

[0:06:38] Voice 11: the first thing

[0:06:39] Voice 1: we actually got to tick off our list

[0:06:40] Voice 11: at governance committee

[0:06:42] Voice 11: we're still working towards the new corporate planning process to integrate financial and

[0:06:49] Voice 11: strategic planning and there's another another number of other items on the governance committee

[0:06:58] Voice 11: committee work plan to address the recommendations from the government's report of 2022.

[0:07:09] Voice 11: Lots of questions. The BC government has been busily bringing in legislation to do with housing.

[0:07:17] Voice 11: housing, one of them being Bill 44, which is the one requiring a minimum number of units

[0:07:28] Voice 11: on certain lots and advised by our senior staff that it will not be applying to local

[0:07:36] Voice 11: trust committees.

[0:07:38] Voice 11: Apparently there's going to be a consequential amendment to the Honest Trust Act that's going

[0:07:44] Voice 11: to exclude this new section of the local government act from applying to local trust committees so

[0:07:48] Voice 11: that's uh uh there's could be more information coming out on on how that will play out but um

[0:07:57] Voice 11: the key information there is that that's not going to those minimum

[0:08:02] Voice 11: numbers of lots are not going to be applied in that stress area

[0:08:06] Voice 11: the other one is the builder divide around short-term rental accommodations act um

[0:08:13] Voice 11: This draft legislation, how it's particularly going to affect the trust area is not completely

[0:08:21] Voice 11: clear.

[0:08:22] Voice 11: There's a lot of legislation that hasn't been finished yet.

[0:08:27] Voice 11: But it seems that local trust committees will have the option to opt in to the principal

[0:08:34] Voice 11: residence requirement in Bill 35.

[0:08:38] Voice 11: five and LTC's could possibly amend their bylaws to ban short-term vacation

[0:08:49] Voice 11: rentals and in those cases where local trust committees decide to do that it's

[0:08:54] Voice 11: going to actually end the protection for non-conforming short-term vacation

[0:08:59] Voice 11: rentals so there are islands in the islands trust that have sort of had an

[0:09:04] Voice 11: open season completely open short-term vacation rentals so those islands that

[0:09:12] Voice 11: might be wanting to address issues around that previously of course prior

[0:09:22] Voice 11: to this legislation any any new local trust committee bylaws around short-term

[0:09:27] Voice 11: vacation rentals would not have affected existing ones the new provincial

[0:09:31] Voice 11: legislation is saying that they're the non-conformance or nieces that would be

[0:09:38] Voice 11: created through planning or further regulating short-term vacation rentals

[0:09:44] Voice 11: will apply to existing ones there's no sort of common parlance although there's

[0:09:51] Voice 11: discussion whether it's an appropriate term or not as grandfathered in is is

[0:09:56] Voice 11: often used but non-conforming uses is sort of the more legalese so that's has

[0:10:02] Voice 11: has potential to make some changes in some communities in the Islands Trust area.

[0:10:11] Voice 11: They're also looking at increasing fines for municipal ticket information for those areas.

[0:10:21] Voice 11: There's only three local trust committees in the Islands Trust that have that municipal

[0:10:27] Voice 11: municipal ticket information system, but what it means for those areas is that the fines

[0:10:34] Voice 11: are going to increase for illegal short-term vacation rentals, or can increase for illegal

[0:10:39] Voice 11: short-term vacation rentals, and of course it's not going to apply to hotels and motels

[0:10:44] Voice 11: and timeshares and fishing lodges and First Nations reserves and a number of other things.

[0:10:50] Voice 11: but so all these new bills coming out of the province are are still being

[0:10:57] Voice 11: evaluated on what parts of them may be applicable to local trust areas and be

[0:11:05] Voice 11: more information coming up provinces business is busily legislating away and

[0:11:10] Voice 11: and there we have it so that's it for me today I don't see our electoral area

[0:11:20] Voice 11: area director here today so i'm going to say we don't have a report from him today and next is

[0:11:27] Voice 11: the name standing item the first nations report and i'll look see if anyone's i don't see ken

[0:11:33] Voice 11: with us today so i think anyone unless anyone has any first nations topics

[0:11:38] Voice 10: to report on well okay

[0:11:41] Voice 11: so that brings us up to the town hall session um glad to see a few people came out today

[0:11:48] Voice 11: not lots just before we get into the town hall I'll just remind everyone I

[0:11:54] Voice 11: didn't want to know we're going to be our next time will be the community

[0:11:57] Voice 11: information meeting on the rezoning proposed bylaws 287 and 288 for Hayes

[0:12:08] Voice 11: and that's going to be followed by a public hearing right here which is going

[0:12:12] Voice 11: to happen right in the middle of our regular meeting so just with that I'll

[0:12:19] Voice 11: just look and see if there's anyone who would like to address the local trust committee and

[0:12:23] Voice 11: just remind to keep respectful and speak to issues and not individuals and ideally items that are

[0:12:32] Voice 11: the business of the local trust committee and even better on the agenda so with that i see a hand

[0:12:39] Voice 11: over here i have got uh

[0:12:41] Voice 9: two issues uh chair peterson stephen reibach 289 link letter uh my

[0:12:46] Voice 9: My first comment is further to my email to trustees

[0:12:50] Voice 9: regarding the Groundwater Sustainability Project

[0:12:54] Voice 9: and proposed land use exemptions.

[0:12:57] Voice 9: Please focus on land use exemptions

[0:13:00] Voice 9: and not land user exemptions.

[0:13:03] Voice 9: Do not go down the slippery slope of exempting

[0:13:08] Voice 9: or excluding groups of landowners or land users

[0:13:12] Voice 9: based on narrow definitions or characteristics real or implied. Adopting land user regulations

[0:13:22] Voice 9: rather than land use regulations has never been equitable and I don't believe ever will be.

[0:13:28] Voice 9: The second issue I want to raise relates to your agenda item 13.1 and the recent roadwork

[0:13:41] Voice 9: rehabilitation at Murchison Cove. I would just like the trustees to know that the Galliano

[0:13:52] Voice 9: Parks and Recreation Commission is contacting the Ministry of Transportation infrastructure

[0:13:58] Voice 9: to re-establish a safe pedestrian path on the inside curve of the new works to maintain

[0:14:05] Voice 9: the continuity of the Sturdy State Trail. And I am still a commissioner serving on the Works and Recreation Committee.

[0:14:16] Voice 11: Okay, thank you for that. Anyone else like to address? Yes, in the back.

[0:14:22] Voice 7: Hi, Jeff in Variety, 1506 Ellis Road. The last time I went to see my optometrist, she said,

[0:14:31] Voice 7: do you have any concerns and I said I'm being dazzled by headlamps and she said

[0:14:36] Voice 7: all my patients are saying the same thing regardless of age regardless of

[0:14:42] Voice 7: eyesight I'm finding I this is anecdotal but I think this concern shared a lot of

[0:14:50] Voice 7: people people we often pull over to the side of the road when a car is coming

[0:14:56] Voice 7: when there are no street lights, when cars are going up and down hills and you get completely dazzled.

[0:15:04] Voice 7: This is not on the agenda, maybe one day it should be. I think all levels of government should be finding a way to address this issue because I believe it's a safety issue.

[0:15:17] Voice 7: Okay, thank you for that. Jane?

[0:15:24] Voice 4: We haven't had, and this is not an LTC issue, but we haven't had the lines painted on our world for years now.

[0:15:31] Voice 4: They've just done some other islands, and it does contribute to this safety issue that Jeff was talking about,

[0:15:41] Voice 4: where the mill is and where the edge is. So I don't know whether that is something that maybe the LTC would be willing to write a letter to MOTI

[0:15:51] Voice 4: just to say that we really do need to have these mines redrawn and that it does pose a safety issue.

[0:16:00] Voice 4: I was driving up to go to a service on Pinella Hitch about a week and a half ago, and you could not tell where, this is 6.30 in the morning, it was dark, it was pouring rain, you couldn't see where the road was, and you know, we made it, but it is an interesting issue.

[0:16:25] Voice 10: And further to that, at our last Gulf Islands forum we highlighted that issue and I'm getting

[0:16:31] Voice 10: Adam Wilson to send a message to Highways about our concerns in the Gulf Islands because

[0:16:38] Voice 10: you're absolutely right, it's bad enough at night not being able to see, it's worse when

[0:16:44] Voice 10: you're not sure whether anybody knows where the centre of the road is and yeah it's really

[0:16:49] Voice 10: interesting i actually adjusted my headlines so that when i'm low beam the inside one tracks to

[0:16:56] Voice 10: where i need to see where my front wheel is because that's where i need to see because

[0:17:00] Voice 10: i'm completely blind with some of these headlights these days and uh yeah but the yellow line would

[0:17:07] Voice 10: make a huge difference at least you know you're on the right side of the road because quite frankly

[0:17:12] Voice 10: some of these people from vancouver have no clue what side of the road they're on

[0:17:17] Voice 11: yeah and then we

[0:17:18] Voice 11: do have a historic one later in the agenda around road safety and depending on the well of the local

[0:17:26] Voice 11: trust committee it may be appropriate to sort of bundle some of these safety issues together into

[0:17:32] Voice 11: into a letter to the ministry and certainly in september i believe i mentioned that executive

[0:17:39] Voice 11: committee did meet with the minister and and requested that the provisions in the memorandum

[0:17:47] Voice 11: of understanding that we have with between islands trust and and the ministry uh for a task force to

[0:17:53] Voice 11: address issues to do with ministry of transportation and the gulf islands um and the minister was

[0:17:59] Voice 11: receptive to that but uh that task force hasn't been established yet and perhaps that might be

[0:18:06] Voice 11: part of the ask if we wanted to uh to address a letter to the ministry around these safety issues

[0:18:12] Voice 11: So thank you for that.

[0:18:14] Voice 11: Was there anyone else that would like to address?

[0:18:23] Voice 8: It's great that Jeff introduced that issue of blinding lights.

[0:18:30] Voice 8: That's something that's bugged me for quite some time and it's good to see that raised

[0:18:36] Voice 8: and combined with the lack of yellow lights, yellow lines on the roads.

[0:18:41] Voice 8: I just wanted to make a couple of comments good to hear that galley is

[0:18:48] Voice 8: applying for community housing to the community housing fund hopefully that

[0:18:55] Voice 8: will proceed and we'll get some action on the at least one of the affordable

[0:19:02] Voice 8: housing projects because that's that's where they're at in terms of affordable

[0:19:07] Voice 8: housing. Purpose-built affordable housing is really the way to address the issue.

[0:19:13] Voice 8: We've got two projects on Galliano and they're waiting for funding so

[0:19:17] Voice 8: hopefully with the trustees support for Galliano's application that will help move it forward.

[0:19:24] Voice 8: On the issue of short-term vacation rentals, I'm a little confused

[0:19:29] Voice 8: about what the regime is on Galliano because my understanding is that we

[0:19:35] Voice 8: We already, on Galliano, we already essentially have a kind of a principal residence requirement

[0:19:42] Voice 8: for SPVRs.

[0:19:43] Voice 8: At least they can only be run as part of a home occupation.

[0:19:48] Voice 8: So I guess it's not really that much of an issue for Galliano now as long as the current

[0:19:58] Voice 8: while the current by-law is enforced,

[0:20:00] Voice 8: because the trustees removed the ability

[0:20:03] Voice 8: to ask for temporary use permits for absentee owners

[0:20:09] Voice 8: to run STPRs.

[0:20:11] Voice 8: So now they're strictly home occupation projects,

[0:20:16] Voice 8: which essentially is what the provincial legislation is

[0:20:21] Voice 8: trying to accomplish, I think.

[0:20:24] Voice 8: I'm not sure.

[0:20:25] Voice 8: I guess it won't have to be.

[0:20:29] Voice 8: The final comment I wanted to make was that the chair and his report mentioned the discussion

[0:20:36] Voice 8: about the trust council about the mandate and I have, unfortunately we don't have more

[0:20:45] Voice 8: reporting on what goes on at trust council, you have to rely on the driftwood which doesn't

[0:20:51] Voice 8: really circulate on Galliano anymore, and when I'm on the ferry, I buy it, try to get

[0:21:01] Voice 8: up to speed.

[0:21:01] Voice 8: But the discussion about the mandate and the redefinition of unique amenities that occur

[0:21:07] Voice 8: to Trust Council, that, to my way of thinking, is quite disturbing, because, you know, to

[0:21:15] Voice 8: To include tourism, to include housing, to include stuff that every other municipality has as an issue in the province, in the country, as a unique amenity, removes the meaning from the Islands Trust Act and the unique mandate of the Islands Trust,

[0:21:36] Voice 8: Trust, which was created to preserve and protect unique amenities, meaning the rural, environmentally

[0:21:47] Voice 8: sensitive environment of these southern Gulf Islands, of the Gulf Islands.

[0:21:53] Voice 8: So I think that the Trust Council is really on the wrong track when it tries to reinterpret

[0:22:00] Voice 8: the mandate so broadly to make it almost meaningless and I hope that the

[0:22:06] Voice 8: trustees will take another look at it. Thank you.

[0:23:02] Voice 5: amend the land use bylaw and also the community official community plan by

[0:23:09] Voice 5: rezoning and redesignation redesignating a portion of the subject property from

[0:23:16] Voice 5: rural residential to agriculture and this is to support a subdivision

[0:23:22] Voice 5: application down the road um so i'm just going to leave that there because i think it's a short and

[0:23:28] Voice 5: sweet application so um helps back to you

[0:25:22] Voice 11: 2022 and proposed bylaw number 288 cited as Galliano Island land use bylaw number 129

[0:25:30] Voice 11: pardon me, 1-27-1999, Amendment No. 2-2022.

[0:25:39] Voice 11: All persons who believe that their interest in property is affected by the proposed bylaws

[0:25:44] Voice 11: will be given a reasonable opportunity to be heard or to present written submissions

[0:25:49] Voice 11: respecting matters contained in the proposed bylaws.

[0:25:52] Voice 11: Those wishing to speak should commence their presentation by clearly stating their name and address.

[0:25:58] Voice 11: members of the local trust committee may if they wish ask questions of you following your

[0:26:02] Voice 11: presentation however the main function of the local trust committee members is to listen to

[0:26:39] Voice 11: submission to the Local Trust Committee may do so and all written submissions must be

[0:26:51] Voice 11: and right now. Your only opportunity to comment on the proposed by-laws is during this hearing

[0:27:27] Voice 5: um a copy of this notice was advertised in two consecutive editions of the driftwood

[0:27:33] Voice 5: on november 1st and november 8th of this year all notification requirements under the local

[0:27:40] Voice 5: government act has been completed it was also inserted in the november 2023 issue of the active

[0:27:48] Voice 5: active page as per the LTC standing resolution. There is a copy of the complete public hearing

[0:27:55] Voice 5: binder available, it's just over in the corner there if anybody would like to see it. And

[0:28:01] Voice 5: it's also located on the Islands Trust website. Hopefully the website is working right now.

[0:28:07] Voice 5: The purpose of the proposed by-law 287 and 288, as I mentioned previously, is to amend

[0:28:13] Voice 5: the Galliano land use bylaw and official community plan to rezone and

[0:28:18] Voice 5: redesignate a portion of the subject property from rural residential to
