[0:00:38] Voice 4: Peterson. I'm the chair of the Galliano Island Local Trust

[0:00:42] Voice 4: Committee. I'm coming to you today from the territory of the

[0:00:46] Voice 4: Qualicum Peoples and joining me are Galliano Island Local

[0:00:52] Voice 4: local trustees Ben Maberly hello Ben and Lisa Gavreau and we have our planner Kim Stockdale

[0:01:05] Voice 4: here as well as where as well as Carl Oblini our recorder and our able tech staff from the South

[0:01:14] Voice 4: office hosting the meeting today so we have an agenda before us and I'll look to trustees to

[0:01:37] Voice 4: And so the first item of business is trustee reports.

[0:01:43] Voice 4: Trustees, one of you go first and great, Trustee Gavreau.

[0:01:52] Voice 9: Right on, all right, so since the last LTC meeting,

[0:01:56] Voice 9: I attended one Island Trust Conservancy meeting, it was very uplifting, we received a Nature

[0:02:02] Voice 9: Reserves monitoring report, property monitoring specialist Murphy presented the report, topics

[0:02:11] Voice 9: like danger tree cutting on Gabriela, eelgrass mapping is always a hot topic, and we were

[0:02:20] Voice 9: entering into phase two of the project.

[0:02:22] Voice 9: project. Director Frater updated us that the Alliance of Canadian Lands Trust has a grant

[0:02:29] Voice 9: for which the Island Trust Conservancy will be making an application. I'm also pleased

[0:02:35] Voice 9: to announce that I have been appointed as the Island Trust Conservancy's representative

[0:02:39] Voice 9: to the Governance Committee. I'm looking forward to working with other trustees, especially

[0:02:45] Voice 9: our chair, Tim, who is also a member of the committee. Last week we attended Trust Council

[0:02:53] Voice 9: We set meeting dates for the upcoming year.

[0:02:58] Voice 9: June's council meeting is going to take place on Salt Spring Island.

[0:03:01] Voice 9: We discussed meeting in person versus electronic meetings.

[0:03:05] Voice 9: During our first term, the face-to-face meetings were, I have to say, extremely helpful in me learning the ropes.

[0:03:14] Voice 9: I'm very thankful that we actually voted for the in-person meetings for that first term or first year.

[0:03:18] Voice 9: the upcoming year we might adopt at least one electronic meeting perhaps in the September.

[0:03:26] Voice 9: Highlight for me at Trust Council was a short but important discussion on the draft of the

[0:03:33] Voice 9: Trust Council Housing Strategic Action Plan. Part of this action plan is a housing options toolkit.

[0:03:42] Voice 9: This toolkit will support LTC's land use planning around housing options.

[0:03:49] Voice 9: It should lead to procedures for processing development applications for affordable or multi-family housing, zoning and policy options, project work plans, build-out analysis, much, much more.

[0:04:03] Voice 9: It's kind of a one-stop shop for all the workings of affordable housing in the trust area.

[0:04:09] Voice 9: If you want to know the housing policies for each of the islands in the trust area, it's in there.

[0:04:16] Voice 9: It's a great toolkit.

[0:04:17] Voice 9: kit. Kudos to Trustee Maberly who moved the motion to approve the plan. This plan will greatly

[0:04:24] Voice 9: improve housing strategy for the trust area. Also at Trust Council, we were working on our

[0:04:32] Voice 9: vision statement again. Conversations were deep and frank. At the previous LTC meeting, I asked

[0:04:38] Voice 9: the community to reach out to me if they wish to discuss the vision statement. I received a few

[0:04:43] Voice 9: emails and I've had a couple of really great chats about what the vision statement for the

[0:04:48] Voice 9: honest trust should look like. I encourage anyone who wishes to discuss it further to reach out to

[0:04:53] Voice 9: me. I want to hear your ideas so that I can better represent you at Trust Council and at these LTC

[0:04:58] Voice 9: meetings. My office hours are Mondays from 9 to 11. That's all for me. I could go on. It's been

[0:05:17] Voice 11: and um i think she pretty much covered up covered off everything that uh happened there there's the

[0:05:23] Voice 11: beginning of the financials which we'll be dealing with in the march meeting um but uh yeah like i

[0:05:30] Voice 11: say uh thanks lisa um so on november 24th i also attended the wisconsinic leadership council meeting

[0:05:37] Voice 11: at Poets Cove on Pender Island.

[0:05:41] Voice 11: Good meeting, actually lots of people there.

[0:05:43] Voice 11: All the park commissioners, doc commissioners

[0:05:46] Voice 11: and CRD staff were there and had some good discussions

[0:05:50] Voice 11: around the path forward with the West Scenic

[0:05:54] Voice 11: and creating partnerships with the CRD and parks.

[0:06:00] Voice 11: And so it was good introductory discussion

[0:06:03] Voice 11: and looking forward to see where we move forward on that.

[0:06:06] Voice 11: And the other thing at the request of some of the public last meeting, I met with Modi in regards to Murchison Bay, met them on site and went over the items that we discussed.

[0:06:24] Voice 11: They agreed, and I see they've already done it, is they've widened the trail, the shoulder for the trail.

[0:06:32] Voice 11: but they are opposed to putting no posts there or a barrier there but they didn't seem to be

[0:06:41] Voice 11: opposed to maybe the the whoever's in charge of the trails putting a little fence alongside that

[0:06:50] Voice 11: that trail so at least there's a some sort of barrier but they pointed to the fact that you

[0:06:56] Voice 11: you know, as they get off the road front

[0:06:57] Voice 11: is it's private property

[0:06:58] Voice 11: and you'll see the two signs

[0:07:01] Voice 11: that they put there as well.

[0:07:03] Voice 11: Had a discussion with them

[0:07:04] Voice 11: about the yellow lines as well.

[0:07:06] Voice 11: And as you know, even at Trust Council,

[0:07:09] Voice 11: we, you know, the yellow line thing

[0:07:13] Voice 11: It was at the SGI forum yesterday as well.

[0:07:15] Voice 11: It was a big topic there.

[0:07:16] Voice 11: So hopefully we're getting enough pressure

[0:08:00] Voice 4: um yeah so we did have trust council last week uh a couple of uh residents of galliano came and

[0:08:11] Voice 4: and spoke to trust council in the um in the public comment uh section and i think i thank those folks

[0:08:18] Voice 4: for making the trip to do that as in addition to the budget and the other

[0:08:26] Voice 4: items that were mentioned by the trustees we we had a joint session with

[0:08:31] Voice 4: the sound San Juan County counselors so we have a transporter agreement with

[0:08:38] Voice 4: essentially information sharing and joint advocacy when appropriate so that

[0:08:44] Voice 4: was good to rekindle that um relationship um also they uh there was a uh motion brought by um

[0:08:56] Voice 4: trustees patrick and falk uh to institute some new policy around the regular um

[0:09:04] Voice 4: uh regular performance review for the cao so that that was good work as well appreciated all of that

[0:09:11] Voice 4: and I think I will leave it there today don't believe we have electoral area

[0:09:25] Voice 4: director Brent joining us today so the next section would be First Nations

[0:09:34] Voice 4: report and I would just mention here that trustee Maberly and myself and some

[0:09:42] Voice 4: staff members were invited to a meeting of the penelakut chief and council the end of november

[0:09:48] Voice 4: and that was uh i think a positive step forward in relationship building and uh we have uh asked

[0:09:56] Voice 4: asked for some comment on a couple of specific uh items and looking forward to to getting that uh

[0:10:03] Voice 4: relationship um up to a better and a higher level and uh and to hearing um the views of the nation

[0:10:10] Voice 4: on the business of the LTC that's applicable.

[0:10:19] Voice 4: So if there's nothing else to add there,

[0:11:36] Voice 5: finally got it unmuted thank you very much mr chair a couple of items um i'd like to raise

[0:11:42] Voice 5: and there seems to be some confusion to what Moti is suggesting asking islanders to do

[0:11:51] Voice 5: vis-a-vis the Murchison Cove road repairs.

[0:11:56] Voice 5: The Galliano Parks and Recreation Commission, which I am a member, contacted Moti,

[0:12:03] Voice 5: And they did respond, as noted by Trustee Maberly, to put in the gravel path to restore the Sturtees Bay Trail.

[0:12:15] Voice 5: And they told us that they would also be installing some flexible steel reflective strips along the inside curve.

[0:12:25] Voice 5: But as of our meeting last week, there was nothing from MOTI to indicate that they wanted the Parks and Recreation Commission to put some sort of a fence between the newly laid trail and the edge of the MOTI repairs.

[0:12:45] Voice 5: pairs. So that's a little confusing. The second item I'd like to raise is in connection with the

[0:12:54] Voice 5: information that staff is presenting in applications. And in particular, the applications

[0:13:02] Voice 5: are, when they are represented on maps, they seem to be represented in a complete absence of any

[0:13:13] Voice 5: any knowledge or indication of what the land uses are around the particular parcel of land

[0:13:21] Voice 5: in question. Here's the latest example. On page 22 and 23 of your current package,

[0:13:30] Voice 5: when talking about District Lot 85, there is a note for Nature Protection Park Area Number 3,

[0:13:41] Voice 5: And a suggestion that the narrow strip just north of the roadway might be considered for shore access.

[0:13:55] Voice 5: Well, just to the south of that roadway, which is a shore access, is a community park.

[0:14:04] Voice 5: So what staff seems to be suggesting is that for park area number three, you would have a shore access, a butting of shore access, a butting, a community park.

[0:14:20] Voice 5: So if there was information showing land uses on the southern border, perhaps it might better inform the advice that staff is making to trustees.

[0:14:34] Voice 5: So if we could get a little more clarity on what exists around parcels of land that are

[0:14:40] Voice 5: up for subdivision, I'm sure it would be appreciated.

[0:14:44] Voice 5: Thank you.

[0:15:20] Voice 11: because that would be pushing onto private property,

[0:15:22] Voice 11: but they didn't request that parks do that.

[0:15:25] Voice 11: They were just sort of tossing out ideas about a barrier.

[0:15:30] Voice 11: They just said that they weren't going to put a barrier there.

[0:17:02] Voice 12: but i may have missed it but at any rate um i did want to address the uh the same topic that

[0:17:11] Voice 12: that Steve Rybak raised the second topic,

[0:17:15] Voice 12: which was the application,

[0:17:18] Voice 12: the rezoning applications for DL 86 and 85.

[0:17:25] Voice 12: I have written to the trustees about this.

[0:17:29] Voice 12: Hopefully you got it, you've read it.

[0:17:34] Voice 12: My concerns are well welcoming.

[0:17:38] Voice 12: I'm really glad that to see rezoning applications

[0:17:40] Voice 12: for these properties it's been a long time since they've been um you know they've been an f1 and

[0:17:48] Voice 12: i know that the owners have wanted to uh rezone i've wanted to use them for residential purposes

[0:17:54] Voice 12: um and it's good that they're trying to bring them into compliance and i also uh kind of like

[0:18:01] Voice 12: the idea of the transfer of land the exchange of land with the uh in return for density that

[0:18:10] Voice 12: to which they otherwise would not be entitled, larger density in the rural residential heritage forest model.

[0:18:20] Voice 12: The land is being proposed to be transferred to the Penelakiv tribe.

[0:18:25] Voice 12: That could be a first step toward creating an indigenous protected area on Gowliana, which would be very positive.

[0:18:34] Voice 12: Unfortunately, the lot layouts, as they are configured in the staff report on the maps, they really don't conform to any policies within the OCP or the Rural Residential Heritage Forest model that's being used,

[0:18:58] Voice 12: on which they're being used to,

[0:19:01] Voice 12: which is the basis for part of that proposal.

[0:19:06] Voice 12: As you know, currently the only option in the OCP

[0:19:09] Voice 12: for rezoning F1 for residential use is to go to F3,

[0:19:15] Voice 12: which is one dwelling accessory to forest

[0:19:18] Voice 12: with a minimum density of one dwelling per maximum density

[0:19:25] Voice 12: of one dwelling per 50 acres

[0:19:27] Voice 12: and a sustainable forestry covenant signed with a third party acceptable to the LTC.

[0:19:33] Voice 12: The old rural residential heritage forest rezoning option,

[0:19:38] Voice 12: which permits the creation of five acre lots for every 20 acres in the F1,

[0:19:49] Voice 12: it was removed from the OCP in 2009 on the advice of legal counsel.

[0:19:55] Voice 12: However, trustees have subsequently used that model for some F1 rezoning, some significant F1 rezonings that created five acre residential lots in exchange for land transferred to a conservation or recreation organization.

[0:20:13] Voice 12: And most recently, that's been BC Parks and the Capital Regional District.

[0:20:19] Voice 12: And I just want to point out that the staff used the term on the maps, donation, land donation.

[0:20:26] Voice 12: These are not donations.

[0:20:29] Voice 12: That language should be removed.

[0:20:32] Voice 12: This is an exchange.

[0:20:33] Voice 12: It is not a donation.

[0:20:35] Voice 12: It's a requirement.

[0:20:36] Voice 12: If a landowner wants density greater than one in 50 acres, one dwelling in 50 acres, they are required to, the old model required them to exchange land for that higher density.

[0:20:52] Voice 12: So that should be, I asked staff to change that designation on the map to reflect that it's a transfer of, at least a transfer of title or an exchange, not a donation.

[0:21:04] Voice 12: The problem with the maps is that the lot layout ignore a key requirement.

[0:21:13] Voice 12: They're drawing on the RFH model, but the key requirement of that model was that a large

[0:21:20] Voice 12: portion of available waterfront must be part of the land transfer and must not be part

[0:21:26] Voice 12: of the rural residential subdivision.

[0:21:28] Voice 12: It was in the bylaw to ensure intact preserved forest ecosystems of which waterfront is an

[0:21:35] Voice 12: integral part and to provide potential public access to waterfront the language is pretty

[0:21:41] Voice 12: clear on that point which is in my which i quote in my letter so the the the preservation and

[0:21:49] Voice 12: transfer of significant amounts of waterfront is precisely what the owners of adjacent district

[0:21:55] Voice 12: lot 79 did when they combined the two f1 rezoning options a few years ago and the result was the new

[0:22:05] Voice 12: crd park waterfront park excuse me next to the development area um and there's no there's no

[0:22:14] Voice 12: reason uh a similar transfer of waterfront should be followed for dl's 85 and 86 and uh when i

[0:22:23] Voice 12: raised the issue in july at the meeting in july the one one of the owners of 85 said well the

[0:22:29] Voice 12: The reason was that the people in the differences, the owners of District Lot 79 didn't want to live on their land.

[0:22:36] Voice 12: They wanted to sell the rural residential lots while our people want to live on our lots.

[0:22:41] Voice 12: Well, that's certainly not a valid reason for violating a longstanding policy, LTC policy, to secure public and ecological benefits from rezoning.

[0:22:54] Voice 12: So that's my main concern with this development.

[0:22:58] Voice 12: and I urge trustees to ask staff to work with the applicants

[0:23:04] Voice 12: to revise their proposal,

[0:23:06] Voice 12: to conform with LTC policy and precedents,

[0:23:10] Voice 12: to maximize ecological protection and the public interest.

[0:23:20] Voice 12: So I hope that that will be the result of the discussion

[0:23:25] Voice 12: that you ask staff to work with the applicants

[0:23:28] Voice 12: to revise that application, better conform the policy.

[0:23:32] Voice 12: Thanks very much.

[0:24:12] Voice 8: the 20 acres of proposed F3 land is not calculated in the 75-25 calculation.

[0:24:19] Voice 8: And I just wanted to ask if that is consistent with other previous rezonings,

[0:24:25] Voice 8: For example, the community forest or heritage forest rezoning model that Art referred to.

[0:24:33] Voice 8: That's my first question.

[0:24:35] Voice 8: The second is that I see that for District Lot 86, that it says that five lots are being rezoned to rural residential.

[0:24:47] Voice 8: And on the diagram, the map, I don't see five lots, I see three. So I just wondered if that could be clarified. Thank you.

[0:25:10] Voice 2: absolutely. So the F3 lot, that's not included in the 75 calculation. That is a separate, generally a separate policy. You can see the F3 rezoning option and policies in the OCP on page 16. So it's not included in the 75-25 calculation.

[0:25:31] Voice 2: calculation in terms of the error of the five lots if you want to point it out or let me know

[0:25:38] Voice 2: what page of the staff report and i'll make that change it would be an error because district lot

[0:25:44] Voice 2: 86 is just proposing at this time two uh rural residential lots and one uh small or small lot

[0:33:33] Voice 2: Back in July, there was a preliminary staff report presented to the LTC,

[0:33:45] Voice 2: and also preliminary engagement with First Nations.

[0:33:49] Voice 2: As Chair Peterson has mentioned, staff and LTC members had the opportunity to attend

[0:33:58] Voice 2: a Penelakut Tribe Chief and Council meeting that was in late November, and staff had an

[0:34:04] Voice 2: opportunity to present a number of applications, but specifically District Law 85 and 86.

[0:34:12] Voice 2: We had limited time, so unfortunately we couldn't go into discussion of both applications, but

[0:34:19] Voice 2: But we did provide chief and council with an overview of both applications and also a list of questions that we would like or we have proposed and hope we can discuss with Penelope at a future date.

[0:34:36] Voice 2: And those questions are actually found on page 19 of the agenda there.

[0:34:40] Voice 2: So in terms of where we're at with District Law at 86, I thought it was important to bring back this application because the LTC hasn't or this application hasn't been on the agenda for over about six months.

[0:34:57] Voice 2: So I thought it'd be great to bring it back and to have a discussion between the LTC staff and the applicant and perhaps give the applicant some items to work on until we have that formal referral back or those comments back from Penelaket.

[0:35:14] Voice 2: In terms of the preliminary layout plan on your screen, so this is option three that the applicant has provided to the LTC and staff.

[0:35:28] Voice 2: As you can see, the larger yellow lot here, that's the proposed Forest 3 lot, and that lot would have one dwelling unit and would have a sustainable forestry covenant registered on the property.

[0:35:42] Voice 2: And that sustainable forestry covenant is deemed a community benefit in terms of this portion here.

[0:35:51] Voice 2: I notice, yes, this is land donation on there. This is, again, a map from the applicant.

[0:35:57] Voice 2: So I'll see if they can make that change to land exchange or transfer.

[0:36:02] Voice 2: So this portion here is a portion that perhaps can be transferred to a First Nation, particularly Penelakut Tribe has expressed some interest in that.

[0:36:15] Voice 2: The two lots in blue are the proposed rural residential lots.

[0:36:21] Voice 2: They're proposed to meet the minimum or the average lot size to their 2.1 hectares.

[0:36:28] Voice 2: And then the smaller lot here is proposed. That's the amenity lot.

[0:36:33] Voice 2: staff propose that to be a small lot residential lot.

[0:36:39] Voice 2: The LTC may want to consider, because there is that increase in density here,

[0:36:45] Voice 2: to perhaps restrict one or all three of these lots to only have one dwelling unit.

[0:36:53] Voice 2: Currently, the rural residential lots would permit one house and one cottage.

[0:36:58] Voice 2: the SL LAR lot I believe would also permit the one house and one cottage so the LTC may want

[0:37:05] Voice 2: to consider down the road restricting the cottage on those three properties that's something that we

[0:37:10] Voice 2: can talk about and discuss at a later date in the staff report I've put together just a table

[0:37:18] Voice 2: of where this 75 25 what would be included in those calculations I also mentioned that at this

[0:37:26] Voice 2: time the LTC may want to consider giving direction to staff to draft bylaws. The reason for that is

[0:37:33] Voice 2: it would give the LTC and also community members an example of what the draft bylaws may look like.

[0:37:41] Voice 2: It also when drafting bylaws it may identify areas where we need further information or where things

[0:37:47] Voice 2: may not work or may work. So I have put out a recommendation on page one of the staff report

[0:37:53] Voice 2: to proceed with draft bylaws if the LTC would like to do that.

[0:37:58] Voice 2: In terms of road access, this is certainly another item

[0:38:01] Voice 2: that we need further information from.

[0:38:05] Voice 2: Specifically, it's going to be up to the applicant

[0:38:09] Voice 2: to have those discussions with the Ministry of Transportation

[0:38:13] Voice 2: and Infrastructure and also BC Parks, First Nations

[0:38:17] Voice 2: and other future property owners.

[0:38:18] Voice 2: owners the major topics are I've heard mention of restricting access on this road this is going to

[0:38:27] Voice 2: that's ultimately going to be a decision made by MOTI because MOTI when we get to the subdivision

[0:38:35] Voice 2: stage that portion of road would actually be dedicated to the to the ministry so those

[0:38:40] Voice 2: discussions will need to be had with the ministry and to determine restricting vehicle traffic if

[0:38:47] Voice 2: they want to or if they don't want to. There's been currently no conversation that I'm aware of

[0:38:54] Voice 2: with the Ministry of Transportation and Infrastructure in terms of if they are willing

[0:38:57] Voice 2: to restrict or to keep it open. So that's one thing that will need to be discussed.

[0:39:03] Voice 2: The next item, as I mentioned, is the nature protection lot. Currently, there has been

[0:39:09] Voice 2: discussions with penelicate tribe to transfer that land to them also in terms of the amenity lot

[0:39:17] Voice 2: the applicants have expressed interest to not only donating proceeds of that lot to affordable

[0:39:25] Voice 2: housing societies but potentially to other non-profit societies and those are listed in

[0:39:31] Voice 2: the staff report this isn't a decision that the ltc has to make right now the staff report is

[0:39:38] Voice 2: which is flagging topics of conversation or issues that we'll need to address through this application process.

[0:39:49] Voice 2: In terms of the terms of reference, that was actually sent to the applicant back in 2021.

[0:39:57] Voice 2: And that outlines items that the applicant will have to complete.

[0:40:04] Voice 2: And I believe I've attached a copy of that to the staff report as well.

[0:40:09] Voice 2: and that terms of reference can be amended or changed if the application and requirements also

[0:40:15] Voice 2: change. So at this time, as I mentioned, staff have made a recommendation to prepare the draft

[0:40:23] Voice 2: bylaws. If the LTC feels like more information is required, there is an option to do that.

[0:40:31] Voice 2: I've put that in the alternative section that's on page five of the staff report or page 20 of

[0:40:39] Voice 2: the agenda. If there's specific information the LTC is requesting from the applicant it's always

[0:40:45] Voice 2: good to put that in a motion so it's formally in the minutes and that could be amending the

[0:40:54] Voice 2: site plan or providing further information on who may receive the transfer of land or also

[0:41:02] Voice 2: the donated monies for the amenity lot the ltc may also want to consider scheduling a community

[0:41:10] Voice 2: information meeting perhaps in the new year once we get all the required information or

[0:41:17] Voice 2: from the applicant it may be worthwhile scheduling a cim for both lot 85 and 86 to give an opportunity

[0:46:57] Voice 2: Lot 86. It was brought forward to the LTC back in July. And just like District Lot 86,

[0:47:06] Voice 2: the LTC requested staff to proceed with the application and include those preliminary

[0:47:14] Voice 2: engagements with First Nations. As we just mentioned, we've introduced this application

[0:47:20] Voice 2: to the Penelope tribe and we're waiting for their for further discussions on the application

[0:47:26] Voice 2: and perhaps a more formal response sometime in the new year similarly to the staff report with

[0:47:34] Voice 2: district lot 86 I've included the site plan that we have to date and color-coded it so

[0:47:43] Voice 2: So it's easier to mark areas where nature protection zoning may be, the rural residential zoning may be, and also the proposed amenity lot.

[0:47:55] Voice 2: In terms of the question raised about the nature protection or park area number three, staff was just pointing this out that there may, as part of the subdivision application,

[0:48:10] Voice 2: application, the applicant may have to satisfy a certain section in the Land Title Act. And it was

[0:48:17] Voice 2: more so a question to the applicant is, is that area, area number three, would that satisfy

[0:48:26] Voice 2: that section of the Land Title Act? It wasn't staff saying that it must, that area must be

[0:48:32] Voice 2: dedicated. It was more of a question between the applicant and MOTI to determine if that portion

[0:48:39] Voice 2: portion there as noted on their site plan is a requirement of section 75D of the Land Title Act.

[0:48:47] Voice 2: As part of the staff report, I also put together a table which outlines which portion would be

[0:48:53] Voice 2: included in the 7525 and which portion of the lots may be considered a community benefit.

[0:49:02] Voice 2: I've also listed some remaining questions that staff had for the applicant and this staff report

[0:49:09] Voice 2: has been forwarded to the applicant as well and those questions are around which agency or First

[0:49:16] Voice 2: Nation may be receiving the nature protection areas and also the proposed resource lot where

[0:49:24] Voice 2: the existing quarry is so I believe the applicant I'm not sure if they're able to provide an answer

[0:49:31] Voice 2: today or perhaps in the future but having a better understanding of who these or what portion of

[0:49:38] Voice 2: these lands will be transferred to whom specifically with that quarry lot another item is that staff

[0:49:45] Voice 2: proposed was in regards to that amenity lot and as you see on site on the site plan on page 22

[0:49:52] Voice 2: of the agenda that amenity lot is kind of in the middle the middle of the lot kind of in a corner

[0:49:59] Voice 2: there and is this the best place for this amenity lot would it be is that a desirable location

[0:50:07] Voice 2: So that might be something the LTC may want to consider is perhaps moving that amenity lot to the waterfront and moving one of the rural residential proposed lots away from the waterfront.

[0:50:20] Voice 2: um the majority i would say more than half of the um the district lot 85 if rezone and subdivided

[0:50:30] Voice 2: in relation to the site plan the majority of it would actually be privately owned so the ltc may

[0:50:39] Voice 2: want to consider that as well is requesting the applicant to perhaps update the site plan

[0:50:44] Voice 2: and moving around the rural residential lots perhaps moving them back away from the waterfront

[0:50:50] Voice 2: or moving the amenity lot to a more desirable location so that's just an item that staff has

[0:50:56] Voice 2: noted and that's something that we can work on as this application proceeds so again on page

[0:54:50] Voice 13: reason to slow down because you would waste money or something like that, we're okay with that. But

[0:55:00] Voice 13: Our big concern and the concern of DL85 is various things like this will come along and make these subdivisions drag out for many years.

[0:55:10] Voice 13: And this is especially a problem for some of the older members that own these lots.

[0:55:14] Voice 13: thoughts. As far as the amenity donation, there's already a legal decision blocking the trust from

[0:55:24] Voice 13: saying what specific organizations are allowed to receive land for donation due to not giving

[0:55:29] Voice 13: the donator the ability to donate to the organization. Basically, the courts, as far as I

[0:55:38] Voice 13: I understand, said that the donator needs to be able to have choice. If the only choice is to

[0:55:47] Voice 13: donate to affordable housing, if we very much support affordable housing and want to donate a

[0:55:54] Voice 13: large chunk to affordable housing, but if the trust dictates who somebody should donate to

[0:56:00] Voice 13: and what percentage they should donate, that isn't a donation, that is a payment.

[0:56:05] Voice 13: and it should be spelled out in the bylaws

[0:56:09] Voice 13: and I do not think it would be legally enforceable.

[0:56:15] Voice 13: All of the suggested donations that we want to do

[0:56:19] Voice 13: will make Galliano safer and more affordable for the poor.

[0:56:22] Voice 13: The fire department has a lack of volunteers.

[0:56:26] Voice 13: Recently, the North Island has had an influx of volunteers,

[0:56:30] Voice 13: including my wife and I,

[0:56:31] Voice 13: but it's already at risk of making it so that we lose fire insurance for the north end if we do not

[0:56:38] Voice 13: maintain that volunteer volume. So if the fire department doesn't have the funding that they

[0:56:50] Voice 13: can get from donations like this, that would mostly hurt the poor that cannot afford to

[0:56:56] Voice 13: to deal with the damages caused by fire.

[0:57:00] Voice 13: For the clinic, the lack of adequate healthcare

[0:57:03] Voice 13: where all islands could have a regular appointments

[0:57:06] Voice 13: on Galliano means that the people are going

[0:57:08] Voice 13: without putting their health on some,

[0:57:10] Voice 13: and in some cases lives at risk.

[0:57:12] Voice 13: Even though there's a program to ensure

[0:57:14] Voice 13: that the people get reimbursed for going off island,

[0:57:17] Voice 13: as far as I can tell,

[0:57:18] Voice 13: the majority of the island is unaware of this.

[0:57:41] Voice 13: program. This is not a problem for the wealthy, but a huge burden on the poor. So that is my

[0:57:50] Voice 13: concerns about the amenity. I want to be certain that the nature protection does not mean that

[0:57:56] Voice 13: property cannot be maintained. It is critical that the woods be thinned and abundant fuel load gets

[0:58:04] Voice 13: removed from the forest. This is advantageous to the island if that gets used for firewood,

[0:58:12] Voice 13: but the wood can be left in rot stacks in the property if desired,

[0:58:18] Voice 13: as with the remaining branches and so on. This also helps with the wildlife habitat.

[0:58:23] Voice 13: habitat. I also believe that Penelope would like to use this land for forage. Being legally able

[0:58:30] Voice 13: to make the forage plentiful for foraging is also beneficial for biodiversity of flora and fauna.

[0:58:39] Voice 13: If you don't mind, I would like to address the three letters that were sent to the

[0:58:46] Voice 13: the trust is that okay uh

[0:58:49] Voice 3: just as long as just stick to the content um we don't need to uh

[0:58:55] Voice 3: identify personalities or

[0:59:21] Voice 13: mobily impaired to the park in a scheduled way. This will not require any involvement

[0:59:26] Voice 13: from us, but it will require agreement from the Penelaket and BC Parks, as well as at

[0:59:30] Voice 13: least one of the local bus services. The next one I would like to address is regarding the

[0:59:37] Voice 13: two-thirds of the oceanfront um being um thinking that two-thirds of the oceanfront should be part

[0:59:43] Voice 13: of this um donation i think that the 75 donation is already bad for the interests of the trust and

[0:59:52] Voice 13: the galliano residents as i put in a letter to the trust recently however i think it is important to

[0:59:58] Voice 13: to know that the

[1:00:00] Voice 13: The reason products are required by law to mention when batteries are not included

[1:00:05] Voice 13: is because no one should be deceived when buying a product.

[1:00:09] Voice 13: People should reasonably be able to expect a product to work as specified.

[1:00:13] Voice 13: When purchasing a property, people should have a clear understanding of what is allowed and not allowed

[1:00:19] Voice 13: by specifying that subdivisions of F1 lots require that you donate three times the amount of land

[1:00:29] Voice 13: that you convert to residential, that's done. It's there and is readable. By insisting on

[1:00:35] Voice 13: conditions that are not written anywhere in the bylaws or acceptable subdivision routes available

[1:00:41] Voice 13: when purchasing properties, the trust is not being trustworthy. It would be intentionally

[1:00:47] Voice 13: and neglectfully hiding aspects of what is required for a subdivision. And this is obviously

[1:00:54] Voice 13: a big part of where we made the decision to buy the property, knowing and doing the due diligence,

[1:01:00] Voice 13: but having things changed on what is written in the rules should not, it doesn't make sense.

[1:01:07] Voice 13: Okay, in a letter to the trust, I've addressed concern that the previous monetary donation from

[1:01:13] Voice 13: the amenity was not recovered. I feel we can address this in an interim fix, but feel that

[1:01:19] Voice 13: the proper fix should be put in place. If I am correct, and the donation really is legally

[1:01:24] Voice 13: legally binding. If I'm incorrect, sorry, and the donation is really legally binding,

[1:01:29] Voice 13: I suggest that the trust should be required to legally go after that donation. Anything else

[1:01:36] Voice 13: suggests in the future the trust can decide to let people legally walk away with hundreds of

[1:01:40] Voice 13: thousands of dollars that belong to the community if they choose. Obviously, this would be a potential

[1:01:46] Voice 13: ingress for corruption. And finally, to the comment made earlier, our subdivisions are not

[1:01:57] Voice 13: based on the heritage forest proposal. They are based on what we understood from the trust staff

[1:02:06] Voice 13: that was required to subdivide. Nowhere in there did it state there was a basis on some unwritten

[1:02:13] Voice 13: or unavailable decisions from the past.

[1:02:19] Voice 13: They were not in the laws and they should not be applied.

[1:02:23] Voice 13: Otherwise, that is also another ingress for corruption.

[1:10:50] Voice 6: island as being a failed peacekeeper I was the last Canadian officer posted to Gaza in 1967 to

[1:11:00] Voice 6: join the UN emergency force while it still existed and it ceased to exist on the evening that I

[1:11:06] Voice 6: arrived so i'm interested in conflict resolution and conflict resolution always requires movement

[1:11:14] Voice 6: and it usually requires movement from both sides and galliano being comprised of people of course

[1:11:21] Voice 6: we've been sitting here for 30 years and we haven't yet had enough movement we're getting

[1:11:26] Voice 6: movement we're seeing uh it's a happy community you made good progress today on those rezoning

[1:11:32] Voice 6: applications. Thank you. But we still need movement. And I'm a forest owner, so I'm an

[1:11:40] Voice 6: advocate of movement by the forest owners. And the movement needed in the forest of Galliano

[1:11:47] Voice 6: has basically three components. And the first one is commitment to sustainable forestry.

[1:11:53] Voice 6: It doesn't need a 30-page covenant. It just needs a, yes, I'm committed. I'm not clear-cutting my

[1:11:59] Voice 6: property, and I'm going to look after it. And if I do any harvesting, it's going to be done

[1:12:05] Voice 6: gently. And by the way, harvesting is a good thing when you've got a plantation forest that's

[1:12:10] Voice 6: overstocked. These forests need to be thinned for fire safety and so they can healthfully recover

[1:12:18] Voice 6: towards old growth characteristics. So the first thing is sustainable forestry. The second thing

[1:12:24] Voice 6: is actually for the forest owners to get off their asses and get out in the woods and do some work.

[1:12:29] Voice 6: we've got forests that have been neglected for 30 years and in most most of the island the forests

[1:12:35] Voice 6: are neglected completely and the neglect is particularly a problem when you've got a young

[1:12:43] Voice 6: plantation forest that's full of brush and dead sticks and fallen trees and it needs some cleaning

[1:12:50] Voice 6: up to reduce the fire hazard and when you clean it up it it looks much better it the biodiversity

[1:12:56] Voice 6: diversity comes back. And if you're interested in land value, it's more valuable. The forest

[1:13:02] Voice 6: owners really need to smarten up on looking after the forest. And the third point is,

[1:13:08] Voice 6: if you're so lucky as to own a big chunk of forest, having other people walk through it is

[1:13:14] Voice 6: actually a pleasure. And I'd like to see the trail network in this island extended. And this requires

[1:13:20] Voice 6: movement by forest owners because we the forest owners own most of the island and we are getting

[1:13:27] Voice 6: good movement we're getting a number of quite a few of the forest owners have provided trail access

[1:13:35] Voice 6: and some are doing work in the woods to reduce fire hazard and of course nobody is doing any

[1:13:41] Voice 6: clear cutting because we don't do that anymore so we are having movement and the most spectacular

[1:13:47] Voice 6: example in the last few years is Wayne, who was talking to you a few minutes ago. This

[1:13:53] Voice 6: guy is a total hero of forest restoration. He's got 96 acres of 30-year-old plantation

[1:14:04] Voice 6: forest, and he's cleaning it up, he and Corrine, at a tremendous rate. And this is a wonderful

[1:14:10] Voice 6: example for all of us. And they recently opened Mystic Woods Trail into D'Neo's Yule Point

[1:14:15] Voice 6: Park. And again, another good example. And I'd like to see the trust encourage the forest owners

[1:14:23] Voice 6: all to move in these general directions. And this is totally in line with the object of the trust

[1:14:29] Voice 6: and protecting the coastal Douglas fir zone. And on the other hand, if the forest owners are going

[1:14:37] Voice 6: to move, which they haven't done yet sufficiently, we also need movement on the other side. And

[1:14:45] Voice 6: And we are seeing movement.

[1:14:48] Voice 6: I think it would be great to have more movement.

[1:14:51] Voice 6: For example, why can't people on 50-acre lots have a guest cottage?

[1:14:56] Voice 6: And why can't people on a five-acre lot, well, they can actually,

[1:15:02] Voice 6: if they rezone, give away three-quarters of their land,

[1:15:04] Voice 6: they can have a guest cottage.

[1:15:05] Voice 6: But we could do things like that.

[1:15:11] Voice 6: Allow guest cottages on 50-acre parcels.

[1:15:14] Voice 6: not. We could take all the existing legally subdivided parcels that were created in 1995

[1:15:23] Voice 6: and are presently not allowed to have a residence. Let's move the goalposts and say, yes, they

[1:15:29] Voice 6: can. If you have a legal parcel, of course you can build on it. All Canadians can. And

[1:15:35] Voice 6: by the way, we'll really appreciate it if you look after your forest, because people

[1:15:39] Voice 6: People who are resident on the island are much better motivated to look after their forest than people that are not allowed to be residents.

[1:17:08] Voice 13: the affordable housing um so while it's a donation it's they can claw it back i knew of one company

[1:17:22] Voice 13: and then a year later they clawed it back because that is the allowed time to claw it back

[1:17:28] Voice 13: and it cannot be stopped because it's a donation and not governed by the um the contract law

[1:17:45] Voice 13: um the idea of the dl85 having to choose a desirable location not only does it not make

[1:17:53] Voice 13: sense considering that the the lots lot owners have been there for a long time and they have

[1:17:59] Voice 13: their they have their campsites already existing and that's why the lots are broken up the way

[1:18:05] Voice 13: way they are. It is also an attempt, as I can see it, to claw more than is required by the

[1:18:14] Voice 13: official community plan or the bylaws. The bylaws specify that 75% must be donated

[1:18:21] Voice 13: out of the donated area, which is something that we're not even doing, but out of the donated area,

[1:18:27] Voice 13: area, the amenity lot is to be created. That doesn't have to be in a desirable location.

[1:18:36] Voice 13: Sure, it can be. We chose to do it because we think it's the best for all people involved,

[1:18:41] Voice 13: even though we will get minorly less money for the two lots. But I think it's really important

[1:20:05] Voice 8: And my understanding is that there are only two observation wells and they are both at the south end of the island.

[1:20:14] Voice 8: And I'm just wondering if these two rezonings, and there have been, of course, others in this area already, if this doesn't represent an opportunity to consider an observation well,

[1:20:36] Voice 8: so that there would be an opportunity to really monitor what is happening with the aquifer.

[1:20:44] Voice 8: And of course, how much density can be sustained as we go forward with ever longer and more extreme drought periods.
