[0:00:00] Voice 4: us and so i would like to call the meeting to order um uh approval of agenda i was had a few

[0:00:07] Voice 4: words with the cao uh only moments ago about the probable necessity um to uh appoint or elect

[0:00:14] Voice 4: a vice chair for this committee it's not identified in the um in the um in the policy and so i think

[0:00:23] Voice 4: think that we should do that out of necessity, especially given the situation that I find

[0:00:31] Voice 4: myself in right at the moment. And so if that's all right, I'd like to add that to the agenda.

[0:00:36] Voice 4: Is there anything else outside of what's on the agenda here? Obviously, it can be reasonably

[0:00:41] Voice 4: free-flowing in terms of discussion. There's a couple of important items that we need to make

[0:00:46] Voice 4: decisions on, which are identified at 5.3 and 5.5. Is there anything from anybody, if you can

[0:00:52] Voice 4: can just shout out it's hard for me to see hands right okay

[0:00:55] Voice 9: i've got a question i've got one yeah

[0:00:58] Voice 4: i

[0:00:58] Voice 9: think we need to discuss the cao hiring committee policy with regards to the standing committees

[0:01:08] Voice 9: um i think i think we have to send the policy out so i'd like to add this to the to the agenda

[0:01:14] Voice 9: send the policy out to trust council to approve amendments so that we can do certain things so

[0:01:20] Voice 9: So that would include, like you said, the the addition of the changes to the chair and adding in standing committees versus the named committees,

[0:01:32] Voice 9: because this should this should be run by trust counsel for approval to changes to the policy rather than as just making changes to the policies on the fly without their without their input.

[0:01:45] Voice 4: Sure. Maybe I'll turn to the CEO for his advice, but I think that we have some flexibility.

[0:01:51] Voice 4: I'm going to challenge

[0:01:52] Voice 9: that. I'm going to challenge you going to the CAO for this process because this was already challenged at Trust Council and it was voted against. So I would strongly recommend that you do not turn to the CAO for advice during this meeting.

[0:02:06] Voice 5: I would like to make a point of order, please, if I may.

[0:02:11] Voice 4: Sure. We're at approval of agenda here at this point. Go ahead.

[0:02:14] Voice 4: Yes.

[0:02:17] Voice 5: In the interest of having an orderly meeting and ensuring that issues are dealt with in an appropriate and reasonable way, this is a complex territory we're headed into, and I would like to refer to Section 90, Sub 1, Sub M.

[0:02:39] Voice 5: not

[0:02:39] Voice 7: entered any numbers please re-enter your meeting id followed by town

[0:02:43] Voice 5: uh i hope that wasn't

[0:02:47] Voice 5: directed to me but uh as i was saying section 90 sub 1 sub in of the local government act provides

[0:02:56] Voice 5: quote the consideration of whether a council meeting should be closed under a provision of

[0:03:02] Voice 5: Subsection.

[0:03:06] Voice 5: All right.

[0:03:08] Voice 7: Goodbye.

[0:03:12] Voice 3: Goodbye.

[0:03:14] Voice 5: What

[0:03:14] Voice 3: I'm trying to say.

[0:03:16] Voice 3: Okay.

[0:03:17] Voice 3: Tim's having trouble with his connectivity.

[0:03:21] Voice 3: Trustee Peterson.

[0:03:26] Voice 3: Go ahead,

[0:03:27] Voice 3: Trustee Bernardo.

[0:03:29] Voice 5: Okay.

[0:03:29] Voice 5: It's a little hard talking over this.

[0:03:32] Voice 10: All right.

[0:03:34] Voice 5: I'm going to try it again here.

[0:03:38] Voice 5: I think it's in the interest of an orderly meeting

[0:03:42] Voice 5: that we have a discussion about whether or not

[0:03:45] Voice 5: this meeting and subsequent meetings

[0:03:47] Voice 5: should be held in camera or not,

[0:03:49] Voice 5: given the nature of the issue.

[0:03:52] Voice 5: And I am referring to section 97.

[0:03:56] Voice 10: Mr. Chair, this is not satisfactory.

[0:04:00] Voice 10: Can you

[0:04:00] Voice 5: please bring this to an end, this business?

[0:04:05] Voice 6: Mr. Marler has his hand up.

[0:04:07] Voice 6: i believe he's going to mute mr peterson thank you

[0:04:11] Voice 7: welcome yeah just give me a minute

[0:04:16] Voice 7: where

[0:04:17] Voice 8: is he just give me a minute david yeah okay i've muted him all right i did have some

[0:04:29] Voice 8: comments that might help you on this discussion uh i

[0:04:33] Voice 5: would like to actually finish what i was

[0:04:35] Voice 5: going to say before anybody entertains that

[0:04:38] Voice 4: okay so trustee bernardo um we're on meeting agenda

[0:04:45] Voice 4: adoption go ahead right

[0:04:47] Voice 5: right thank you and my point of order is this which is i think this body

[0:04:51] Voice 5: needs to consider whether or not these meetings uh should be held uh publicly or uh in camera

[0:04:57] Voice 5: that discussion itself ought to take place in camera and my authority for that is i'm referring

[0:05:03] Voice 5: referring to section 90, sub one, sub N

[0:05:05] Voice 5: of the Local Government Act, which provides that,

[0:05:08] Voice 5: quote, the consideration of whether a council meeting

[0:05:10] Voice 5: should be closed under a provision of this subsection

[0:05:13] Voice 5: or subsection two, end quote,

[0:05:16] Voice 5: is itself a matter that may be probably held in camera.

[0:05:19] Voice 5: And I would like to move that the meeting

[0:05:26] Voice 5: or at least that discussion about whether or not

[0:05:31] Voice 5: the meeting should be held in camera,

[0:05:32] Voice 5: itself be held in camera further to the subsection I just referred to so that we can discuss the

[0:05:38] Voice 5: advisability of that issue. Thank you.

[0:05:43] Voice 4: So if you want to add a discussion about the in-camera

[0:05:47] Voice 4: opportunities for conversations, we can add that to the agenda. Where on the agenda do you want to

[0:05:52] Voice 4: add that? Because I think that today is an administrative function to get this process

[0:05:56] Voice 4: started. Certainly some meetings will be out of necessity held in camera, but not all should be.

[0:06:04] Voice 4: and certainly we can have a discussion about that although i think that the merits of that

[0:06:08] Voice 4: needs to be because you're not talking about people directly um or anything that would

[0:06:13] Voice 4: jeopardize the organization um that conversation about the necessity to go on camera could be

[0:06:18] Voice 4: held in public but

[0:06:19] Voice 5: point of order mr chair i don't think it's helpful to prejudge the outcome

[0:06:25] Voice 5: of the discussion by making declarations about what's appropriate or what isn't i just want to

[0:06:29] Voice 5: have pretty much as a first item of on the agenda a discussion of and this is a procedural question

[0:06:37] Voice 5: a discussion of how our procedure should operate with respect to the in-camera issue and for that

[0:06:43] Voice 5: discussion you know whether we do or do not proceed uh with some or all of the meetings

[0:06:51] Voice 5: in camera that is to be decided by this committee in discussion and further to section 90 of the

[0:06:58] Voice 5: the Local Government Act.

[0:06:58] Voice 5: That discussion itself may be held in camera

[0:07:02] Voice 5: and I'm saying it ought to be,

[0:07:03] Voice 5: that's why I've made that motion.

[0:07:04] Voice 5: And I would like us to have that as number one item

[0:07:08] Voice 5: on the agenda,

[0:07:10] Voice 5: because it's a fundamental procedural point.

[0:07:14] Voice 4: Okay, so that's fine.

[0:07:17] Voice 4: So then what we're going to do is adjust the agenda,

[0:07:19] Voice 4: the public agenda that we have before us,

[0:07:22] Voice 4: the first item prepared to do that,

[0:07:25] Voice 4: to discuss necessity for in-camera discussion.

[0:07:30] Voice 4: Is that all right?

[0:07:31] Voice 4: Thank you.

[0:07:32] Voice 4: So at 5.0, whoever's keeping track of it,

[0:07:36] Voice 4: we'll add opportunities for in-camera discussion.

[0:07:41] Voice 4: So is there anything else that needs to be added?

[0:07:43] Voice 4: So there was a point of order, Christina Evans,

[0:07:45] Voice 4: you had the floor at that moment.

[0:07:47] Voice 4: Is there more that you'd like to say at this time?

[0:07:52] Voice 9: No, just that I'd

[0:07:53] Voice 9: like to add that item up

[0:07:55] Voice 9: for discussion as well.

[0:07:57] Voice 4: Okay, so 5.0 in-camera discussion.

[0:07:59] Voice 4: All right, so is

[0:08:00] Voice 9: there anything else?

[0:08:01] Voice 9: The point that

[0:08:02] Voice 9: I raised, the point that I raised.

[0:08:04] Voice 9: Oh, please raise it again.

[0:08:06] Voice 9: The point that I raised was that we need to have a discussion around the CAO hiring committee policy with regards to changes to that policy and having it referred back to Trust Council for adoption, hopefully by RWM, prior to us just making random on the fly changes.

[0:08:28] Voice 9: to policy. I don't think that's good practice.

[0:08:32] Voice 4: Fair enough. So then following 5.0, let's put

[0:08:36] Voice 4: another new business item to talk about CAO, HC committee policy amendments. Is that what you

[0:08:46] Voice 4: would like to have?

[0:08:48] Voice 9: Yes, please. And I'd like to have that at the beginning because what we're

[0:08:53] Voice 9: talking about are changes to the policy and that affects everything else that we're discussing.

[0:08:57] Voice 9: Sure.

[0:09:03] Voice 4: So the preferences of the committee is to which new item comes first. We could debate that as well. I think that I'm just thinking on the fly here. So certainly if we want to discuss the policy as the first item of business, the in-camera conversation opportunity as the second item of business.

[0:09:25] Voice 4: no

[0:09:25] Voice 10: other way around

[0:09:26] Voice 4: oh other way around okay i thought you were asking for that to be the

[0:09:30] Voice 4: first priority so okay so then the amended agenda then would um start out at 5.0 with uh

[0:09:38] Voice 4: in-camera discussion and the second item would be policy amendments and then we would follow

[0:09:42] Voice 4: through with the remainder of the agenda that was presented to us thank you okay anything else to

[0:09:49] Voice 4: amend to the agenda then i'll take it by general consent if that's all right with the committee

[0:09:55] Voice 4: that the agenda be adopted as amended.

[0:09:59] Voice 4: And so the first item of business that we have is a roundtable.

[0:10:07] Voice 4: Do the members of the committee want to go around the room

[0:10:11] Voice 4: to have any initial brief remarks on the business before us today?

[0:10:17] Voice 9: I would prefer not to have any remarks on the business today in public

[0:10:21] Voice 9: until we've had the in-camera discussion.

[0:10:23] Voice 9: caption

[0:10:24] Voice 4: anybody uh does anybody have anything that they want to say today in the round table

[0:10:31] Voice 5: yes just very briefly um that uh i just want to make the point that this is extremely this first

[0:10:37] Voice 5: meeting of the hiring committee is extremely important uh and just speaking personally just

[0:10:42] Voice 5: for myself i can't think of anything that's more important over the next little while um

[0:10:47] Voice 5: in the management of the islands trust than this committee doing the best possible job it can in

[0:10:54] Voice 5: in terms of developing the proper hiring process

[0:10:58] Voice 5: for engaging a new CAO.

[0:10:59] Voice 5: A new CAO, I mean, that is a position

[0:11:03] Voice 5: of paramount importance in this organization.

[0:11:08] Voice 5: And we're all familiar with differences of view

[0:11:14] Voice 5: within the Islands Trust about its future direction.

[0:11:18] Voice 5: That's why this process, the hiring process,

[0:11:20] Voice 5: needs to be absolutely transparent,

[0:11:23] Voice 5: fully accountable to Trust Council.

[0:11:25] Voice 5: Council and I view this particular meeting as vital in terms of getting us on the right track

[0:11:33] Voice 5: in organizing our work so that we do our job properly. We have a duty here. Thank you.

[0:11:41] Voice 4: So thank you. So I'm going to have to pause myself because I have to send you all through

[0:11:46] Voice 4: the x-ray machine at the airport and so I'm just going to if you want to continue a round table

[0:11:51] Voice 4: and then we'll pick up the business when I return in a moment.

[0:11:59] Voice 7: okay

[0:12:03] Voice 6: is everybody happy just pausing for five minutes that's probably best okay fair enough

[0:12:17] Voice 1: never been through an x-ray machine before well

[0:12:22] Voice 6: here's your first chance um

[0:12:24] Voice 1: well i mean i have

[0:12:25] Voice 1: but this is not

[0:12:27] Voice 6: from that angle i

[0:12:29] Voice 1: know interesting um maybe i will make some remarks uh oh no trustee

[0:12:41] Voice 1: luck comes not here or chair luck when

[0:12:43] Voice 6: we

[0:12:45] Voice 1: come out of the machine

[0:12:47] Voice 6: his phone doesn't get zapped

[0:12:50] Voice 6: well

[0:13:03] Voice 1: probably just broadcast top security uh information

[0:14:50] Voice 10: hi

[0:14:51] Voice 7: sir how many bins do you have today

[0:14:54] Voice 7: it's great it's great right i'm just gonna do a quick look inside in assessing your bags any

[0:14:59] Voice 7: Any fragile or shrugged objects?

[0:15:02] Voice 7: No, not.

[0:15:03] Voice 7: Yeah, this one.

[0:15:04] Voice 7: This is the one.

[0:15:05] Voice 7: You can have two.

[0:15:08] Voice 6: I'm in the middle of a meeting.

[0:15:09] Voice 6: Oh, yeah.

[0:15:10] Voice 2: Unfortunately, sir.

[0:15:12] Voice 2: Yes, David Marler.

[0:15:13] Voice 2: Yes, please mute him.

[0:15:15] Voice 2: Any

[0:15:16] Voice 7: fragile or shrugged objects?

[0:15:17] Voice 7: No

[0:15:18] Voice 2: other large electronics like a knife.

[0:15:19] Voice 7: The one we shouldn't

[0:15:20] Voice 2: be listening to.

[0:15:21] Voice 8: Who do I need to mute?

[0:15:23] Voice 2: Chair Luckham, please.

[0:15:25] Voice 2: Oh, okay.

[0:15:25] Voice 2: Yeah, absolutely.

[0:15:26] Voice 2: I don't have

[0:15:26] Voice 2: access to my phone at this very instant,

[0:15:28] Voice 2: and I'm not worried about anything that's said there.

[0:15:32] Voice 9: But this, yeah.

[0:15:40] All right, muted.

[0:16:12] Voice 9: I don't know if you can hear me, but you've muted me too.

[0:16:16] Voice 8: Yeah, apologies.

[0:16:18] Voice 8: I may have muted a couple of people accidentally.

[0:16:23] Voice 8: I can hear you, Christine.

[0:16:25] Voice 9: Okay.

[0:16:29] Voice 9: But again, I don't think that this is an appropriate place

[0:16:32] Voice 9: to be holding this conversation

[0:16:33] Voice 9: because even though Chair Luckin's been muted,

[0:16:35] Voice 9: we wouldn't have been on his end.

[0:16:37] Voice 9: Good point.

[0:17:05] Voice 4: Okay, my apologies for all of that.

[0:17:07] Voice 4: I got the joy of being having the full body starts today but they let me go and let's continue.

[0:17:16] Voice 4: I

[0:17:16] Voice 9: was going to request, I don't know if you can hear me?

[0:17:20] Voice 4: I can hear you.

[0:17:21] Voice 9: If you've got us on speaker on there could you take us off speakerphone in a public space?

[0:17:27] Voice 3: Yes I can switch you to my Bluetooth earpieces so I will do that right there.

[0:17:45] Voice 3: Can you still hear me?

[0:17:47] Voice 4: Yeah.

[0:17:48] Voice 4: Yeah I can't hear you.

[0:17:50] Voice 4: Bear with me a second. This isn't far from the ideal situation, I recognize that.

[0:18:19] Voice 3: Can you hear me now?

[0:18:22] Voice 6: Yes, I can.

[0:18:28] Voice 3: Yeah, just say that one more time. I

[0:18:33] Voice 4: don't think it is off. David, do you have any advice about how to switch the audio to a Bluetooth device from here? One, two, three.

[0:18:45] Voice 8: yeah uh under where it says mute there should be a an arrow at the side yeah i'm on my phone

[0:18:54] Voice 8: i'm not seeing

[0:18:56] Voice 3: it we're

[0:18:58] Voice 9: all still muted i think no

[0:19:02] Voice 3: you know now

[0:19:03] Voice 9: that i'm sure

[0:19:04] Voice 3: you're not trustee

[0:19:05] Voice 3: evans you're not we

[0:19:08] Voice 1: can hear you so

[0:19:10] Voice 4: now that i'm through security i'm just going to find a

[0:19:13] Voice 4: a spot where i can switch to my laptop and have some privacy and um and then i can for sure

[0:19:21] Voice 4: accomplish a clean bluetooth connection apologies to the committee wasn't my plan for today

[0:19:31] Voice 4: so

[0:19:45] Voice 1: are we able to go back into the round table or as

[0:19:49] Voice 4: long as we're not discussing anything in

[0:19:51] Voice 4: camera so go ahead

[0:19:52] Voice 1: i'm fine um so uh thank you committee for meeting um we're nine trustees is

[0:19:59] Voice 1: that correct we've got four chairs three vice chairs and the chair of trust council

[0:20:05] Voice 1: or eight i

[0:20:09] Voice 10: really

[0:20:11] Voice 1: don't see a need to go back into the policy for the composition of this committee

[0:20:17] Voice 1: I think the work is urgent. The process is equally important and how we do it, but we have policy and procedures laying that out for us. And the timeline is very short. So I think getting on with the actual work at hand is the most important thing. And I don't see a need to amend the terms of reference for this committee.

[0:20:40] Voice 1: But because we've got really strong, able chairs and a really good representation of Trust Council here.

[0:20:50] Voice 1: So that's my perspective on the process.

[0:20:53] Voice 1: This year, we have seen a lot of discussion on process.

[0:20:59] Voice 1: And my frustration is that the work before us keeps getting delayed as we talk about how to do the work.

[0:21:07] Voice 1: So I agree with you, Trustee Bernardo.

[0:21:10] Voice 1: I know there's nothing more important before us than the hiring of a new CAO,

[0:21:17] Voice 1: but I would submit that getting to that work is the most important thing at this point.

[0:21:28] Voice 4: Is there anybody else that wishes to speak at the roundtable?

[0:21:40] Voice 3: Am

[0:21:40] Voice 4: I able to be heard here?

[0:21:42] Voice 5: Yes.

[0:21:43] Voice 5: I can hear you.

[0:21:44] Voice 4: Okay, so we concluded the roundtable.

[0:21:49] Voice 4: I'm going to assume that we have.

[0:21:50] Voice 4: And so the first item of business then was 5.0, which is the discussion about the necessity to have these discussions in camera.

[0:22:00] Voice 4: And, Trustee Bernardo, you cited sections of the policy.

[0:22:09] Voice 5: To correct the point, what I quoted was Section 90 sub 1 sub n of the Local Government Act.

[0:22:15] Voice 4: I see that's correct, yes.

[0:22:17] Voice 5: Of the community charter.

[0:22:20] Voice 5: Yeah.

[0:22:20] Voice 5: Which, which, sorry, sorry about that. I got the wrong, I mentioned the wrong statutes.

[0:22:28] Voice 4: So is the committee prepared to get advice from the Director of Legislative Services with respect to this discussion and the necessity?

[0:22:36] Voice 4: Well, first

[0:22:37] Voice 5: of all, I've made a motion that this debate about whether or not the meetings ought to be held in camera itself ought to be held in camera, because that's permitted under subsection N, which I've just quoted.

[0:22:54] Voice 5: So subsection

[0:22:56] Voice 3: N is...

[0:22:57] Voice 3: Can we consider

[0:22:57] Voice 5: that first, that issue, before we...

[0:23:01] Voice 4: What specifically is N?

[0:23:02] Voice 4: Yeah, tell us what subsection N is, because that's what I need to understand.

[0:23:08] Voice 5: Section 90 is the provision that talks about when a meeting may properly be closed to the public.

[0:23:19] Voice 2: There's a list of reasons. What specifically is N?

[0:23:22] Voice 5: Yes, and I've said it several times now. I'm going to repeat it.

[0:23:25] Voice 5: The consideration, and it's like section 90 has all the, or signing sub 1 has all these reasons.

[0:23:33] Voice 5: reasons when

[0:23:34] Voice 5: you can hold a meeting in camera. One of them is, quote, the consideration of

[0:23:39] Voice 5: whether a council meeting should be closed under a provision of this subsection or subsection

[0:23:44] Voice 5: two. So the very debate as to whether or not something ought to be held in camera is itself

[0:23:52] Voice 5: a valid reason to go into camera to have that discussion. And I think given the nature of

[0:24:00] Voice 5: of the issues we have here,

[0:24:01] Voice 5: that's the prudent way to proceed.

[0:24:04] Voice 5: There are all sorts of sensitivities

[0:24:05] Voice 5: that are going to be coming out even in the discussion

[0:24:08] Voice 5: about whether or not our meetings ought to be held in camera.

[0:24:12] Voice 5: So what I'm talking about here is a two-step process.

[0:24:16] Voice 5: We go into camera to discuss what the procedures

[0:24:20] Voice 5: we should follow as a hiring committee

[0:24:22] Voice 5: in terms of whether or not our meetings going forward

[0:24:25] Voice 5: and all the business should be covered in camera.

[0:24:28] Voice 5: uh is that clear or does any further explanation required um

[0:24:37] Voice 3: that does seem clear um i would like

[0:24:41] Voice 3: to get advice from the legislative director can

[0:24:45] Voice 4: you please switch one

[0:24:46] Voice 9: of your devices

[0:24:47] Voice 9: yeah

[0:24:48] Voice 4: i'm trying to get that sorted out there we go yeah i would like advice on that the your

[0:24:54] Voice 4: interpretation of the nature of

[0:24:55] Voice 9: the necessity point of order can you please switch off your

[0:24:59] Voice 9: one of your devices can you switch off your phone we can't hear you

[0:25:07] Voice 4: we're getting feedback yeah okay

[0:25:09] Voice 4: thank you sorry um yes that's

[0:25:17] Voice 5: great thank you and you're muted now you're muted

[0:25:19] Voice 10: okay

[0:25:22] Voice 4: so can you hear

[0:25:24] Voice 4: me now yes

[0:25:25] Voice 5: thank you okay

[0:25:27] Voice 4: it looks like it's even coming through my earphone so that's a good thing

[0:25:30] Voice 6: honest to god okay

[0:25:33] Voice 4: go ahead um i would like to hear from the director of legislative services

[0:25:37] Voice 4: is about the interpretation of going in camera at this point you discuss going in camera it seems

[0:25:41] Voice 4: like a mobius loop to me but director of legislative services david marlin

[0:25:45] Voice 8: yeah no uh

[0:25:46] Voice 8: trustee venado is absolutely correct that is an option under section 90n what i would suggest is

[0:25:53] Voice 8: that you're going camera under section 90n but you also um indicate that you're going to win camera

[0:25:58] Voice 8: under 90 A and C. A is about discussion about an identifiable individual and C is

[0:26:06] Voice 8: labor relations. That way if you decide you want to stay in camera and continue

[0:26:11] Voice 8: discussion you don't have to come out and pass another resolution to go back

[0:26:14] Voice 8: in camera. So then the sections are A,

[0:26:19] Voice 4: C and N.

[0:26:20] Voice 8: Correct I have the resolution I can show it on

[0:26:23] Voice 8: screen if you're ready. Can

[0:26:25] Voice 4: you put it on the screen thank you. Absolutely.

[0:26:29] Voice 8: in a minute i

[0:26:34] Voice 5: can add that this is helpful because in fact subsections a and c are items that i

[0:26:39] Voice 5: anticipated we would be discussing within in camera yeah

[0:26:45] Voice 8: so it's on the screen now you should

[0:26:46] Voice 8: be able to see it you

[0:26:51] Voice 4: want to make that motion trustee bernardo yes

[0:26:53] Voice 5: i move that the meeting

[0:26:54] Voice 5: be closed to the public under subsections uh 90 sub 1 sub a sub c and sub n of the community

[0:27:04] Voice 5: charter to enable a discussion regarding personal information about an identifiable individual who

[0:27:12] Voice 5: holds or is being considered for a position as an officer employee or agent of the municipality or

[0:27:17] Voice 5: another position appointed by the municipality labor relations or other employee relations

[0:27:26] Voice 5: that's it you want to

[0:27:29] Voice 8: say and to determine whether consideration of council meetings

[0:27:33] Voice 8: meeting should be closed under provision of subsection yes

[0:27:37] Voice 5: you know what I'm going to start

[0:27:39] Voice 5: over because uh it refers to municipalities and Council we should be referring to this committee

[0:27:44] Voice 5: yes we can do that I will just start over I move that uh the meeting be closed to the public under

[0:27:51] Voice 5: subsections 90 sub 1 sub a sub C and sub N of the community charter um there's something blocking

[0:28:00] Voice 5: blocking the text for me to read here of the community charter for discussion regarding

[0:28:04] Voice 5: personal information about an identifiable individual holds or is being considered for

[0:28:10] Voice 5: a position as an officer employee or agent of the islands trust or another position appointed by

[0:28:17] Voice 5: the islands trust labor relations or other employee or other employee relations and to

[0:28:25] Voice 5: to determine whether the consideration

[0:28:28] Voice 5: of this committee's meetings should be closed

[0:28:31] Voice 5: under provision of those subsections.

[0:28:34] Voice 5: We'll

[0:28:38] Voice 4: have a seconder for that motion.

[0:28:41] Voice 4: And David Marley, your hand is still up.

[0:28:43] Voice 8: Yeah, I'll take it down, sorry.

[0:28:45] Voice 4: I'll second.

[0:28:46] Voice 4: Thank you, Trustee Patrick.

[0:28:48] Voice 4: Just to speak further to the motion, Trustee Bernardo.

[0:28:52] Voice 5: No, I said what I have got to say about it.

[0:28:56] Voice 4: Okay, is there any further discussion

[0:28:59] Voice 4: from the committee members on the motion okay so I think in all honesty I have to

[0:29:08] Voice 4: say that in my circumstances here at the very present moment I have complete

[0:29:14] Voice 4: privacy and so I'm not concerned about the conversation being overheard but

[0:29:18] Voice 4: that that may change I don't have control over the dynamics of that and so

[0:29:23] Voice 4: therefore I would want to keep anything in camera as short as possible so and if

[0:29:28] Voice 4: I step out it's because I feel that that security space has been breached and I would advise you of

[0:29:34] Voice 4: that. I actually in the flurry of adding items to the agenda and changing policy I do believe

[0:29:41] Voice 4: that the necessity of a vice chair would be necessary and I would like to actually at the

[0:29:48] Voice 4: discretion of the chair not appoint a vice chair but appoint a member of or we can vote for it if

[0:29:52] Voice 4: If you wish, have a member of this committee stand in if the chair is unavailable.

[0:29:57] Voice 4: And is there any discussion?

[0:30:00] Voice 4: Otherwise, I'll just ask for somebody to self-appoint them, or just raise your hand

[0:30:07] Voice 1: if

[0:30:07] Voice 4: you're interested in providing the role of a chair in the event that I'm unavailable.

[0:30:12] Voice 4: Somebody?

[0:30:15] Voice 4: Laura Patrick has raised her hand, and I'm not seeing any others.

[0:30:20] Voice 4: Is the committee going to approve by general consent the, let's say, the stepping in as

[0:30:27] Voice 4: chair for this particular meeting in the event that the chair is unavailable?

[0:30:31] Voice 4: is there any concerns with that then

[0:30:34] Voice 3: I

[0:30:36] Voice 4: can make a chair ruling that trustee

[0:30:38] Voice 4: Patrick can assume the role of the chair if the chair is unavailable so let us

[0:30:42] Voice 4: continue to the vote on the in-camera then if there's no further discussion

[0:30:46] Voice 4: all those in favor all right raise your hands electronically so I'm seeing four

[0:30:55] Voice 4: or five hands up here so lower your six hands lower your hands and I think that

[0:31:02] Voice 4: that carries but i'll just ask are there any opposed uh trustee elliott uh one opposed okay

[0:31:09] Voice 4: so then that carries so now we are in camera and so now uh in camera

[0:31:14] Voice 4: let me

[0:31:15] Voice 8: uh stop the recording

[0:31:16] Voice 8: please thank

[0:31:17] Voice 4: you and

[0:31:28] Voice 8: this has to stop the live stream just give me a minute what is that just

[0:31:33] Voice 8: give me a sec all right

[0:31:35] Voice 4: thank you um

[0:31:38] Voice 9: before we begin

[0:31:39] Voice 10: uh before

[0:31:42] Voice 9: we begin because we're going to

[0:31:43] Voice 9: to be talking about the cao in here i don't think the cao should be present sure

[0:31:52] Voice 4: the context of that

[0:31:54] Voice 4: we're talking about the committee process not about an individual um the cao

[0:31:58] Voice 9: point of order

[0:32:00] Voice 9: point of order in order for us to have free and open dialogue
