[0:02:38] Voice 3: that we're respectful of that um my name is tim peterson i'm elected on mesquite island and i'm
[0:02:46] Voice 3: the chair of the harvey island local trust committee with me are uh trustees alex allen
[0:02:54] Voice 3: and Grant Scott, and I see our regional director Daniel Arbors here today.

[0:03:05] Voice 10: Sure. Yep, I'm Ian Cox. I'm Planner 2 in the Northern Office and have recently been reassigned to the foreign BLTC support.

[0:05:20] Voice 3: to account accordingly um have a meeting decorum paid but we don't need to get into that uh i don't
[0:05:29] Voice 3: think at this point unless uh unless you give me a cause to refer to it um our first item is
[0:05:37] Voice 3: the approval agenda so i'll look to trustees is there any changes to the agenda sought for today

[0:06:51] Voice 9: of the things that I'm concerned about is what they're doing inside
[0:06:57] Voice 9: Coogan Bay Park with the new camping and the parking in there.
[0:07:01] Voice 9: And you want to log in, it looks like they're going to be taking it out of there.
[0:07:04] Voice 9: That's some of the best old-world trees on Hornby Island.
[0:07:09] Voice 9: And the way they're going to have the road come right up along the Timavik Trail,
[0:07:13] Voice 9: it just doesn't make any sense to me.
[0:07:16] Voice 9: sure there's a way they could do that park extension which i think is a good thing
[0:07:21] Voice 9: uh rather than do it that way so uh english the parks folks are really concerned about that
[0:07:28] Voice 9: yeah i'd like to get together with you sometime and figure out what we can do about that
[0:07:33] Voice 9: and the second concern again is uh interviewing is the closure of uh the outdoor education center
[0:07:40] Voice 9: i mean that that has been a institution on the island since stone houses landed as a
[0:07:49] Voice 9: lodge yeah so
[0:07:51] Voice 4: it's been an important part of education for the whole of this part of the
[0:07:56] Voice 4: island people coming over here kids
[0:07:57] Voice 9: so i don't know what we can do about that whether we can
[0:08:01] Voice 9: lobby from the trust for that but i think we should is there any i don't know follow-up
[0:08:06] Voice 4: is that where you thought the i think you were
[0:08:09] Voice 4: asking us is that where you thought the tower
[0:08:12] Voice 4: should be
[0:08:21] Voice 9: so anyway that's an issue we could discuss later the issue around glamping uh is one of the island
[0:08:28] Voice 9: here now it's uh there's uh you
[0:08:32] Voice 4: know it's a very interesting way of of having people thumbing the
[0:08:35] Voice 4: outlets lower impact um and it's uh it's something of of interest that i met with some of the folks
[0:08:42] Voice 4: that are proposing or doing it get
[0:08:47] Voice 9: their insights on their issues so that's the one thing we should
[0:08:51] Voice 9: talk about um and the whole ongoing thing about the short-term requirements
[0:08:56] Voice 4: alone you might have
[0:08:57] Voice 4: read is stopping
[0:08:59] Voice 9: all of them except they have got food to grandfather you understood we couldn't do
[0:09:04] Voice 9: but i think that's something we should look into to see if that's a possibility
[0:09:08] Voice 4: so anyway these
[0:09:08] Voice 4: are the things that have been rattling around in my world thank you uh trustee allen um i don't
[0:09:17] Voice 4: have much rattling on my work right now um
[0:09:20] Voice 7: i had a nice respite since the last meeting um i will say
[0:09:28] Voice 7: that i'm looking forward to working with my colleagues this term uh this year i guess and um
[0:09:34] Voice 7: My big word of the day of the year is going to be collaboration. I want to work with
[0:09:37] Voice 7: more groups and not be so isolated. I feel like I'm sort of staring at my computer way too much
[0:09:43] Voice 7: and not getting out there as much. So yeah and I'm looking forward to hoping we can solve,
[0:09:50] Voice 7: you know, making everybody happy regarding location rentals and all these other issues
[0:09:55] Voice 7: we have on our island right now. And it'd be nice to be able to actually do stuff and get
[0:09:59] Voice 7: things done and every time we get a chance we get a curveball toss in our direction which was the
[0:10:05] Voice 7: tower and then you know then we had raw so we continually have these things thrown that we know
[0:10:10] Voice 7: never know that they're going to come our direction and then everything gets held and you
[0:10:13] Voice 7: realize how slow things take so hopefully we won't have any curveballs this year other than the ones
[0:10:17] Voice 7: we had last year and uh get things done thank you okay
[0:10:23] Voice 3: thank you uh so for my chair's report um
[0:10:27] Voice 3: I'll just mention that as part of the Islands Trust Financial Planning Committee, we've been having a series of meetings and more to come in preparation for the Trust Council session in March to consider the budget.
[0:10:41] Voice 3: it um as well as i'm also on the governance committee where we're looking at um we're
[0:10:51] Voice 3: looking at
[0:10:51] Voice 3: the government's governance report of uh 2022 and uh going through the various
[0:10:58] Voice 3: recommendations and making uh prioritizing the the actions that we we see as uh actionable
[0:11:08] Voice 3: sooner rather than later and continuing that work.
[0:11:13] Voice 3: I attended the Sailor Sea Symposium last week in Vancouver
[0:11:18] Voice 3: where I met Regional Director Carver.
[0:11:22] Voice 3: And I'd say it was, there was a lot of positive,
[0:11:26] Voice 3: but there was a lot of frustration as well.
[0:11:30] Voice 3: It's put on by Transport Canada
[0:11:32] Voice 3: and trying to get the federal government
[0:11:38] Voice 3: to really understand, I think, the issues of coastal communities
[0:11:43] Voice 3: and, in my case specifically, those in the Salish Sea on our islands.
[0:11:48] Voice 3: It's a challenge to get the message across.
[0:11:53] Voice 3: But hopefully, as I've tried to make
[0:11:57] Voice 3: some personal connections,
[0:11:59] Voice 3: got some email addresses of some officials,
[0:12:02] Voice 3: and I'm going to be pursuing that work and trying to build some relationships
[0:12:07] Voice 3: so that we at least have an ear and i think that's kind of
[0:12:11] Voice 3: the best way to start to hope to try and
[0:12:14] Voice 3: and get some attention paid to our issues and then finally i just mentioned i mentioned shortly ago
[0:12:22] Voice 3: but press council is coming up in march where all the 26 trustees from all the islands will get
[0:12:27] Voice 3: together and the main item is considering um our budget for the for the 24 25 this year so i'll
[0:12:36] Voice 3: leave it at that and we have a spot on our uh regular agenda for the electoral area uh director's
[0:12:44] Voice 3: report and daniel arthur is here so if you'd like to address uh please do yeah

[0:12:53] Voice 11: stand here so hopefully everybody can hear me is that okay hey uh thanks the committee for having
[0:12:59] Voice 11: me on the agenda um i just have a few items for your four and then i'll let the tribune be out
[0:13:05] Voice 11: door and drive it up um quite reluctantly but uh because of the new provincial framework people
[0:13:14] Voice 11: know i haven't been involved with the stvr issue on the island because up to this point it's been
[0:13:19] Voice 11: very much an island stretch issue as it is for us in the rest of the areas it falls under planning
[0:13:24] Voice 11: but when the new provincial rules the province has granted a number of new powers to local
[0:13:30] Voice 11: local government um and it's becoming clear to us of the regional district that there's an
[0:13:35] Voice 11: opportunity for us to look um at our engagement not only where we are but potentially in in
[0:13:41] Voice 11: assistance to the island stress should that be desired specifically the new the new powers is
[0:13:47] Voice 11: is finally after decades of advocacy regional districts will now have um the the ability to
[0:13:55] Voice 11: issue business licenses and uh and at my initial meeting uh on this my feedback was i may not want
[0:14:02] Voice 11: to issue business licenses for small businesses in rural areas and stuff like that but stvrs and
[0:14:07] Voice 11: industry all like where where we know there's issues and it could be better regulation
[0:14:11] Voice 11: we could look at this so when trustee allen talks about collaboration i think this year this could
[0:14:17] Voice 11: be a good one and and i've been following it it's not like i've followed the deliberations on rb this
[0:14:22] Voice 11: because I've read the reports from BNPC.
[0:14:24] Voice 11: I've had some initial engagement recently
[0:14:27] Voice 11: with the short-term rental association.
[0:14:30] Voice 11: So I'm alive to the issues, but superficially,
[0:14:35] Voice 11: but I'd be quite willing to delve more into it with you.
[0:14:39] Voice 11: And we have budget next week.
[0:14:42] Voice 11: And if there is interest from the committee,
[0:14:44] Voice 11: so I'll put it that way.
[0:14:45] Voice 11: Unless you tell me not to do it,
[0:14:47] Voice 4: I
[0:14:48] Voice 11: could try at the last second to fight
[0:14:50] Voice 11: to put some money in the feasibility budget
[0:14:52] Voice 11: for us to work together.
[0:14:53] Voice 11: to look at a PBR.
[0:14:55] Voice 11: It wouldn't be a huge sum,
[0:14:56] Voice 11: but it would allow to resource our staff
[0:14:59] Voice 11: and maybe consultants and to,
[0:15:02] Voice 11: my planning staff is already aware I'd like to do that.
[0:15:06] Voice 11: So unless you see otherwise, I can at least see your market.
[0:15:09] Voice 11: It doesn't mean we'll spend it,
[0:15:10] Voice 11: but it'll be there if we decide in June
[0:15:12] Voice 11: that we want to pursue it more.
[0:15:18] Voice 11: And the other ones, Boat Ramp.
[0:15:22] Voice 11: So that project, the committee knows the funds were secured last fall, and I just wanted
[0:15:29] Voice 11: to make the committee aware that Comarch Association will be engaged early on in this project because
[0:15:35] Voice 11: it's right on the seashore.
[0:15:36] Voice 11: So I actually met with KFM yesterday and that's already come up.
[0:15:42] Voice 11: That will make sure that it's done to their satisfaction.
[0:15:47] Voice 11: The City already is also looking at creating a housing authority.
[0:15:51] Voice 11: So we're doing a feasibility around that.
[0:15:54] Voice 11: Some people are aware of the regional district has one, some of their resort municipalities
[0:16:00] Voice 11: do as well, like this one.
[0:16:02] Voice 4: So
[0:16:03] Voice 11: we're doing a feasibility.
[0:16:06] Voice 11: There's a lot of people here involved in housing, especially on the side of the roof, but that's
[0:16:10] Voice 11: I do.
[0:16:13] Voice 11: But here at the R&B in Denman, it's not contemplated that it would be included in that work, but
[0:16:18] Voice 11: i've asked is that we do some thorough consultation to see if if the islands had an interest in that
[0:16:24] Voice 11: um that's it next week is uh three days of budget so thank you to higher up i seek for all the care
[0:16:31] Voice 11: and um deliberations like going to present anything with that budget so they're often
[0:16:37] Voice 11: enough to do outdoor next week along with all the other budgets across the valley that's my report
[0:16:42] Voice 11: that mr chair thank you very much
[0:16:45] Voice 3: and uh could be in the outdoor area sir can i ask him yeah
[0:16:49] Voice 3: uh but go ahead i was also gonna ask if you're gonna be around for a little bit if we might

[0:17:18] Voice 11: McDonald I think she's been the treasurer on the organization there's already a letter from
[0:17:22] Voice 11: Gord Campbell who's reappeared on the scene it's also heard news I think there's people that are
[0:17:27] Voice 11: going to want to help or at least look at what could be done so I've for myself it's just initial
[0:17:32] Voice 11: right it's not core to CRE but I've also reached out to a school trustee Chelsea McAnulty and
[0:17:38] Voice 11: and we're going to meet next week and with sheila i'll meet in the next few days or
[0:17:42] Voice 11: so and
[0:17:43] Voice 9: you'll bring that issue up with them
[0:17:44] Voice 11: yeah again and i can share with the two
[0:17:46] Voice 11: through the committee if you want uh i don't know the size of the problem whether it's a
[0:17:50] Voice 11: done deal or whether there's a portion of this is like 24 or 48 hours ago so thanks
[0:17:57] Voice 7: so regarding the budget for next week what's what sort of amount of money are we talking about that
[0:18:03] Voice 7: You could help for feasibility.

[0:18:06] Voice 11: so for the feasibility of, like, in my belief, if we're going to do a real collaboration between the two, like that, I mean, you
[0:18:13] Voice 11: have staff here, but a real collaboration, I'm thinking like 30 grand.
[0:18:17] Voice 11: But what I have in my budget for Hornby is about 8,000, right?
[0:18:23] Voice 11: So if the committee or staff want to provide feedback before, I think that discussion is on Wednesday.
[0:18:29] Voice 11: that's a little quick but even if it's informal um because that legislation is hard to decipher
[0:18:35] Voice 11: a lot of it is actually coming in force this summer but at the rd we're like very few people
[0:18:41] Voice 11: are going to be ready by the summer to actually address the complexity of what's coming down
[0:18:46] Voice 11: so you know in the rest of the rural areas uh vacation rentals are not permitted in our land
[0:18:52] Voice 11: use violence but we have a ton of that so for us it's like an opportunity maybe to
[0:18:59] Voice 11: bring a regulation for vacation rental and the rest of our lives but they already could probably
[0:19:04] Voice 11: learn more because only has had it for you know 10 12 years and everybody agrees everybody left
[0:19:10] Voice 11: out two temporary east permit all these things haven't really worked so but with these new powers
[0:19:15] Voice 11: maybe there there's some solutions that that could be looked at that could benefit both rb but also
[0:19:20] Voice 11: the rest of the district i'd be quite happy if you have that desire and i understand we're two
[0:19:25] Voice 11: different institutions but i'd be quite happy to drag the cvrd into it and see if we can do something
[0:19:31] Voice 11: so do you need emotion on this or do you want to that's at the discretion with you
[0:19:35] Voice 11: emotion always house because then i when i do when i push for that next week i could say that
[0:19:39] Voice 11: at least in principle that the trust committee is support well i think that i was just going
[0:19:45] Voice 3: say we could we could consider that business a new business on the fly i'm all right with that um
[0:19:55] Voice 3: certainly in terms of the regulatory framework around short-term vacation rentals
[0:20:01] Voice 3: if the regional district is interested at least pursuing the idea and seeing the feasibility
[0:20:08] Voice 3: around business licensing that can have a significant effect
[0:20:13] Voice 3: on how we may be able to approach it.
[0:20:16] Voice 3: I don't know if you know, but our previous to the province's regulations
[0:20:23] Voice 3: that all came out in the fall, we had what we thought was a pretty simple
[0:20:28] Voice 3: and easy solution to having some limitation,
[0:20:33] Voice 3: and that's all out the window now because of that new regulation.
[0:20:38] Voice 3: So I think we need to at least investigate every potential tool as we go forward in the process here.
[0:20:46] Voice 3: Yes.
[0:20:47] Voice 3: That'd be a good place to use that $8,000 to refer it to the APC.
[0:20:53] Voice 12: Yeah.

[0:20:53] Voice 3: we can talk about this more, but I want to get us back on track with the rest of our business here.

[0:21:24] Voice 3: or comments to the elected officials um not the other participant or staff uh and speak to um the
[0:21:33] Voice 3: issues ideally that are on today's agenda or otherwise in a more general sense in the
[0:21:39] Voice 3: jurisdiction of the local trust committee and uh be concise and respectful as i mentioned earlier

[0:22:12] Voice 4: the vacation rental licensing that's something that the community's been asking about having
[0:22:20] Voice 4: having licensing for that sector probably since 2010, so the government allowing it
[0:22:29] Voice 4: through the regional district is fantastic news in that the regional district will extend
[0:22:35] Voice 4: themselves to at least reviewing whether that's an option for us is a really great collaboration.
[0:22:42] Voice 4: So fully supportive of that and hope that the trust will make that collaboration and
[0:22:48] Voice 4: communication with the cdr today um because time is short if uh the legislation comes in and then
[0:22:56] Voice 4: so it'll be uh important to make that a priority um the second point that i wanted to talk about
[0:23:05] Voice 4: is the um
[0:23:10] Voice 4: oh sorry i was trying to talk about uh there is no mic no um so the second point that i want the
[0:23:17] Voice 4: The first point I made was supporting the licensing
[0:23:20] Voice 4: at the CVRD, investigating that for vacation rentals.
[0:23:24] Voice 4: The second point that I wanted to bring up
[0:23:26] Voice 4: was the Hi-Seek application
[0:23:31] Voice 4: through the Wellesley Consulting Group
[0:23:33] Voice 4: and Catherine Ronan,
[0:23:34] Voice 4: the lead of the Hi-Seek Board on Housing.
[0:23:38] Voice 4: The intention is that the application to Crown Alliance,
[0:23:42] Voice 4: which includes housing and cemetery extension and delineating that property for community use
[0:23:55] Voice 4: is expected to go in within the next month and so Catherine is away she asked me if I could convey
[0:24:02] Voice 4: that very much she would like the trust to be watching for that and being as supportive as
[0:24:07] Voice 4: possible around the application and the uh following acquisition of property for uh housing
[0:24:18] Voice 4: so those are my two points thank you today thank you mr
[0:24:21] Voice 7: so yeah i tried to email catherine as soon
[0:24:26] Voice 7: as she was away so um i just want to clarify so basically in the next month we're just going to
[0:24:31] Voice 7: hear that are you your name from the promise or is it just going to be another stage before we're

[0:24:38] Voice 4: I was involved in putting that application in which may or may not be the case
[0:24:45] Voice 4: I would ask the trust for a letter to put in with the application to me that would seem logical
[0:24:51] Voice 4: um I haven't been working on that file I would hope that that would be something that you would
[0:24:57] Voice 4: consider maybe relatively quickly or have already done you know when announcement's returning um
[0:25:03] Voice 4: maybe 10 more days next week and the next week just
[0:25:08] Voice 10: through the chair i'm staff is meeting with
[0:25:11] Voice 10: catherine probably on the sixth or so that's my
[0:25:14] Voice 10: understanding this uh
[0:25:16] Voice 10: how many date that we set to discuss that application
[0:25:19] Voice 10: yeah and the support

[0:25:21] Voice 10: crown lands and uh the crown line referral that will that would get plus whatever else is

[0:26:14] Voice 6: to borrow justin clark's remarks made during yesterday's extraordinary hearing in vancouver
[0:26:20] Voice 6: in federal court mr clark took on isid and rogers in applying for the removal of a cell tower
[0:26:27] Voice 6: erected after concurrence obtained under fraudulent representations by Rogers Communications was rescinded.
[0:26:36] Voice 6: This matter is about due process in placing a cell tower in a community, Salt Springs advocate told the court,
[0:26:43] Voice 6: but Rogers submission was riddled with misleading and inaccurate information.
[0:26:52] Voice 6: Specifically, Rogers asserted there was a public meeting, Mr. Clark informed the judge there was not.
[0:26:58] Voice 6: Though Salt Springs model siting policy requires a public meeting, as does ours, the consultation process was not successfully completed, he emphasized, and most certainly did not comply with the model protocol.
[0:27:13] Voice 6: a call. So what constitutes public process? Community-based dialogue, Mr. Clark argued.
[0:27:22] Voice 6: An in-person public meeting must be held in order to fulfill all requirements, yet consultation
[0:27:30] Voice 6: was not fulfilled to the satisfaction of those affected. Both our OCP and model siting policies
[0:27:38] Voice 6: required, to borrow again from Mr. Clark, a fair representation and accurate description.
[0:27:45] Voice 6: We thought we were fighting a single tower. Now we learn of eight antennas earmarked for the Rogers
[0:27:52] Voice 6: Tower here. Heads up, Hornby. Salt Spring's latest nine antenna towers is now draped with 22 panels,
[0:28:03] Voice 6: panels, each skewing injurious electromagnetic radiation 24-7. Mr. Clark called Rogers' conduct
[0:28:12] Voice 6: deplorable. We emphatically agree. The island's trust is required to assist the proponent in
[0:28:20] Voice 6: achieving compliance within 120 days. Even with extensions, would it be reasonable to assert
[0:28:28] Voice 6: that 15 months of equivocation and delay is unreasonable and vexatious.
[0:28:37] Voice 6: Even worse, the August 22 Rogers formal application was kept from this community,
[0:28:44] Voice 6: but not from any other off-island agencies until after the LTC elections were held
[0:28:52] Voice 6: without this hot-button issue being disclosed.
[0:28:56] Voice 6: Next came the planner who blocked our trustee's legitimate call for a vote of non-concurrence.
[0:29:05] Voice 6: Mr. Clark reported that the Salt Spring community spent $10,000 on a lawyer and got nowhere with both ICED and the trust.
[0:29:14] Voice 6: I see more nodding heads.
[0:29:17] Voice 6: Procedural fairness was not followed, Mr. Clark asserted.
[0:29:20] Voice 6: Our lawyer agrees.
[0:29:22] Voice 6: As Carla Kalkin reminded the trust planners and our LTC in her December 23 legal opinion, repackaging cannot rebuild public trust in a process broken beyond resurrection.
[0:29:37] Voice 6: resurrection. I like that resurrection. Ms. Calkin found that our OCP's advocacy policies
[0:29:44] Voice 6: remain unaddressed, specifically to provision that Industry Canada is encouraged to prohibit
[0:29:51] Voice 6: commercial microwave towers on Hornby Island. Most importantly, our OCP also requires all
[0:30:00] Voice 6: public service and utility installations on the island should be for servicing Hornby Island only.
[0:30:08] Voice 6: I submit that a proposed tower with eight antennas on an island less than 12 square miles
[0:30:15] Voice 6: violates this unequivocal stipulation. In closing, our trustees appear to prefer
[0:30:25] Voice 6: to duck their responsibilities by asserting, I said, supremacy. But as Mr. Clark reminded the
[0:30:31] Voice 6: the federal court, ICED has jurisdiction, but does not have unfettered power. Remember,
[0:30:40] Voice 6: an earlier rejection of the TELUS tower here was not challenged by ICED. Our lawyer is an expert
[0:30:48] Voice 6: on trust procedures. Her legal opinion concluded that our LTC is under no obligation to wait for
[0:30:55] Voice 6: requests from Rogers to determine non-concurrence. It is well within the authority of the LTC to
[0:31:00] Voice 6: to finalize its assessment, and to recognize the breach of trust that has occurred that cannot be
[0:31:06] Voice 6: fixed through another meeting or notification measures. If not, Mr. Clark lamented the prominent
[0:31:15] Voice 6: unsightly tower looming over his community, his word, inducing tangible anxiety and stress
[0:31:23] Voice 6: over detrimental health effects among the infirm, those with pacemakers, and the very young.
[0:31:30] Voice 6: The condos forced on this community over our strenuous objections present an ugly welcome to arriving residents and visitors alike.
[0:31:40] Voice 6: Does the trust really want to up the ante with another permanent debacle?
[0:31:45] Voice 6: My message is simple. Enough.
[0:31:49] Voice 6: In my 15-page submission to ICED earlier this week, on behalf of the concerned residents of Hornady Island,
[0:31:56] Voice 6: I called on Minister Champagne to 1. Discipline Rogers, SitePath, and Brian Gray for obstructing fair process, and 2. Dismiss this and all further applications for cell tower siting on Hornby Island.
[0:32:13] Voice 6: I call on our trustees to honor their oath to protect their constituents, including all the voiceless ones, and vote for non-concurrence today. Thank you.

[0:33:10] Voice 4: banned this particular tower and anything like it.
[0:33:13] Voice 4: In fact, the application for this tower
[0:33:15] Voice 4: should never have been accepted by a trust.
[0:33:19] Voice 4: To repeat what Will said,
[0:33:21] Voice 4: Industry Canada is encouraged to prohibit
[0:33:23] Voice 4: commercial microwave towers and satellite antenna on Hormelian.
[0:33:27] Voice 4: 5.5.3 transmission towers should be allowed
[0:33:33] Voice 4: provided the towers are below the height for which Transport Canada requires navigation lights and should be regulated to protect the visual amenity of the residential neighbourhood.
[0:33:43] Voice 4: This is a 24-storey tower. It's in the flight path of our medevac helicopters. Lots of small planes fly on this line. This tower must be festooned with lights for safety, and I'm sure that will be.
[0:33:57] Voice 4: So we've got a 24-story tower for students with lights, and we'll see it from every corner of this island.
[0:34:04] Voice 4: All public service and utility installations on the island should be for servicing Hornby only.
[0:34:11] Voice 4: Do you really think a few dozen cell users is going to justify a half-million-dollar expenditure on a tower that won't even give a complete cell tower?
[0:34:20] Voice 4: Maybe not even that much in an improvement over what we have.
[0:34:23] Voice 4: um this tower is sticking two to three hundred percent above a forest um this tower is clearly
[0:34:33] Voice 4: for strategic purposes to improve roger's bottom line we're sticking right out here they need us
[0:34:38] Voice 4: they don't care about us it's not to provide us with cell towers cover or cell coverage it is to
[0:34:45] Voice 4: improve their bottom line increase their network and that's obvious to a kindergartner um i just
[0:34:54] Voice 4: wanted to talk about the safety issue which is another issue we hear about my son works his ass
[0:34:59] Voice 4: off for the fire department on this island he'll be the guy hauling people off the mountain he will
[0:35:04] Voice 4: rappel down cliffs to rescue people and there's a very good chance he will show up at your house if
[0:35:10] Voice 4: you phone 9-1-1 he carries a cell phone he doesn't want a cell tower he says there's no need for a
[0:35:16] Voice 4: cell tower if you really want to improve the safety of our emergency people you will forget
[0:35:21] Voice 4: Forget about the old technology of cell towers and give our people satellite phones.
[0:35:26] Voice 4: They will be good through all kinds of issues where our cell towers go down without the unsightly.
[0:35:33] Voice 4: Why are we catering to corporate Canada to give us a cell tower we don't want, we don't need, and it's not safe?
[0:35:44] Voice 4: As far as I'm concerned, our official community plan is our law.
[0:35:51] Voice 4: It clearly states, to anyone who cares to read it, that this tower is not applicable for our island.
[0:35:58] Voice 4: It is not allowed. If you really want cell towers on this island, you must go back to the community plan
[0:36:03] Voice 4: and do the revisions required to make that tower application consistent with our laws.
[0:36:10] Voice 4: If not, you are breaking the law. And that's all we have between us and corporate exploitation.
[0:36:16] Voice 4: and you know if you want to turn hornby island into disneyland ignore our laws but if you want
[0:36:22] Voice 4: to protect this island and withhold your commitments your obligations and your responsibilities you
[0:36:29] Voice 4: must vote non-compliance and let us carry on with the business of creating safe housing safety how
[0:36:36] Voice 4: about half of our population doomed to be living in campers that are covered in black mold in swamps
[0:36:42] Voice 4: That's where the safety issues lie. That's where our energy shift goes. Not in half million dollar corporate entities that we don't need. Thank you.

[0:37:28] Voice 4: patient. So here's after more than a year of a screwed up process looking at erecting a
[0:37:37] Voice 4: fifth generation tower in the middle of our service area. Surely by now it's become obvious
[0:37:46] Voice 4: that the cell phone is tracking our society into a mind-numbing virtual reality, sucking the light,
[0:37:54] Voice 4: creating an addiction acting as a propaganda device so little respect has been given to
[0:38:03] Voice 4: due process in this um this power application and to preserving and protecting what is natural
[0:38:12] Voice 4: what is sacred acknowledging the frequency of the planet that all life is attuned to how cleverly
[0:38:22] Voice 4: orchestrated this proposal as being so as to minimize any real consultation or education
[0:38:28] Voice 4: with the Hormony residents. Hiding behind Safety Code 6, that doesn't amount to safety at all.
[0:38:36] Voice 4: Unless you're a large man with a large head, children aren't even considered in this.
[0:38:44] Voice 4: And so little regard for the living environment around. Introducing a military-style technology
[0:38:52] Voice 4: designed for the Internet of Things and surveillance of every action and every interaction, making
[0:39:00] Voice 4: the cell phone a trap.
[0:39:01] Voice 4: And now we hear the future of the World Wide Web will be in the future controlled by corporate
[0:39:10] Voice 4: governments.
[0:39:11] Voice 4: We're considering introducing a technology that will bombard the sun with electromagnetic
[0:39:20] Voice 4: pulses.
[0:39:20] Voice 4: and it's the pulse that affects the body and the immune system in the cells and it's definitely
[0:39:32] Voice 4: known to cause cancer. It disrupts the natural immune system for every living thing. Come on folks,
[0:39:40] Voice 4: all this is easily found on the internet. There's study after study and this is a very
[0:39:48] Voice 4: difficult thing to study. It's a new thing because everybody isn't the same, every situation isn't
[0:39:55] Voice 4: the same, but we know it causes cancer. And if we erect this big tower, there'll be no safe place
[0:40:08] Voice 4: on Hornby Island for those of us who want to shelter from this radiation. Call me a conspiracy
[0:40:16] Voice 4: terrorist if you want, but do your own research and let's have a discussion about the findings.

[0:40:29] Voice 4: has it there's one over there and one over there that's like saying we're already screwed so we
[0:40:35] Voice 4: might as well be royally screwed some say we need to do this for the kids for god's

[0:43:56] Voice 4: users. The soccer field, off-island teams come and try and beat our hornby team that's been put
[0:44:01] Voice 4: together from a lot of our new islanders. Our community school, the school hours and after
[0:44:09] Voice 4: school hours are high we've got a beautiful school we stood up for that and got it the pickleball
[0:44:16] Voice 4: basketball badminton spark maker space the island that's our island workshop where they're proposing
[0:44:24] Voice 4: to put the water testing the depot to reduce reuse in the garbage space the recycled pre-store
[0:44:33] Voice 4: pre-store happy volunteers with a big learning curve for our visitors the community hall many
[0:44:40] Voice 4: Many, many things like today are used for with the community hall.
[0:44:44] Voice 4: It's going to be in this historic something or other, which is great.
[0:44:49] Voice 4: Little theater out there, outside performances, the home support building run by Vihai, Vihai does its call.

[0:45:28] Voice 4: I know they're working on the housing site where the proposed cell tower site is.
[0:45:33] Voice 4: is this island this land is earmarked for years we've talked about housing there the hornby island
[0:45:41] Voice 4: residence and rate paris building our local government under the cbr i want and it's a
[0:45:48] Voice 4: society i think um new art center and it will be open soon and 90 finished anyway and i hope to
[0:45:57] Voice 4: hear its name soon room to grow we can hold meetings and use the zoom equipment there
[0:46:02] Voice 4: very handy the preschool kids five days a week and the aides we have adequate self-coverage
[0:46:12] Voice 4: we've said that more than enough and self-companies will never think we have enough
[0:46:19] Voice 4: self-coverage they've already proposed or told us that this cell tower will not cover all the
[0:46:26] Voice 4: corned beef. So if you get a broken leg or fall down a cliff out there, you probably don't have
[0:46:32] Voice 4: cell coverage. But you know what? We've saved people before and we'll save them again. We do
[0:46:38] Voice 4: not want cell towers over us. And that cell tower is surrounding all the places I've told you about.
[0:46:46] Voice 4: We have our community plans and dreams in front of us. We want to have planned green spaces around
[0:46:54] Voice 4: us. We are a tourist destination and we advertise a getaway experience. This is our drawcard and
[0:47:02] Voice 4: that is why we live here and we love this little unique island. We have been working to get the
[0:47:09] Voice 4: much-needed housing where Rogers Telecommunication has applied for the site of Crown Land.
[0:47:17] Voice 4: The tower is not needed and not wanted from a lot of us.
[0:47:22] Voice 4: We have chosen this site for housing and we have been getting our ducks in a row and have been in touch with the BC government and First Nations.
[0:47:31] Voice 4: Of course, our ducks are not always in a row.
[0:47:34] Voice 4: As you can see, things can upset real quickly, like what's happening at Tribune Bay right now.
[0:47:40] Voice 4: But people are on it, all kinds of people.

[0:53:58] Voice 4: and another, the island stress model policy
[0:54:01] Voice 4: policy was switched by a planner who has secretly left.
[0:54:05] Voice 4: And this is everything that we found out through Victoria.
[0:54:10] Voice 4: Whose strategic interest does it serve
[0:54:12] Voice 4: to have a tower on the island?
[0:54:14] Voice 4: It is not needed.
[0:54:15] Voice 4: It's not needed here, not wanted.
[0:54:18] Voice 4: It's not economically viable
[0:54:19] Voice 4: and it's
[0:54:21] Voice 5: environmentally dangerous.
[0:54:22] Voice 5: Look at the science we have.
[0:54:25] Voice 5: It is the owners, the people who want to stick us

[1:10:50] Voice 10: bringing people to the island in a very short window and we're not taking up any kind of

REPORTS 3.1 Trustee Reports Trustee Scott reported on the following: ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Minutes February 2, 2024 Proposed logging in Tribune Bay Park for a new road and extension is concerning because that area of the park contains some of the oldest growth trees on Hornby Island. The recent closure of the Tribune Bay Outdoor Education Centre is an important issue for discussion. Glamping is an interesting way to bring people to the island and needs further discussion. The possibility of halting all short-term vacation rentals on Hornby has been generating a lot of concern. Trustee Allen reported on the following: Looking forward to working with colleagues and four different groups in-person this term. Hoping to help make people happy with the situation regarding short-term vacation rentals and other important issues. Curveball issues such as the proposed cell tower have stalled progress on other issues; and it is hoped that more progress can be made this term. 3.2 Chair's Report Chair Peterson reported on the following: Attending meetings of the Islands Trust Financial Planning Committee in preparation for budget considerations for 2024/2025 at the upcoming Trust Council meeting in March. Attending meetings of the Islands Trust Governance Committee to review and prioritize the recommendations contained in the 2022 Governance Report. Attendance at the Salish Sea Symposium last week in Vancouver put on by Transport Canada; trying to get the federal government to understand the transport issues of coastal communities can be challenging; relationship building with Transport Canada officials will be worked on going forward. 3.3 Electoral Area Director's Report Director Arbour reported on the following: The new provincial housing rules have granted several new powers to local governments, including allowing regional districts to issue business licenses; and there is an opportunity this week to request Comox Valley Regional District (CVRD) funds to initiate a collaboration project between the CVRD and the Hornby Local Trust Committee (LTC) regarding possibilities for business licensing for STVRs within the Hornby Local Trust Area. The Hornby Boat Ramp Project funds were secured last fall and the project will engage Kómox First Nation (KFN) early on. ADOPTED Hornby Island ADOPTED 3 Local Trust Committee Minutes February 2, 2024 The CVRD is looking at creating a housing authority and would like to consult with Denman and Hornby Islands on their willingness to be a part of it. Thank you to the Hornby Island Residents and Ratepayers Association (HIRRA) and the Hornby Island Community Economic Enhancement Corporation (HICEEC) for their information that will contribute to the CVRD draft budget deliberations next week. The closure of the Tribune Bay Outdoor Education Centre has been sudden news to everybody; upcoming meetings with various parties will seek to clarify the issues surrounding the closure. 4. PUBLIC COMMENTS Members of the public asked about or made statements on the following: In support of prioritizing a CVRD and Hornby Local Trust Committee (LTC) collaboration regarding possibilities for business licensing on Hornby Island, given that the Hornby Island Community Economic Enhancement Corporation (HICEEC) has long wanted this for short- term vacation rentals. Karen Ross updated that the HICEEC application for use of crown lands for housing and a cemetery extension is expected to go in this month. Katherine Ronan is designated as responsible for this application and is requesting that the LTC support it. o Planner Cox noted that planning staff have a meeting scheduled with Katherine Ronan on February 6 th to discuss zoning considerations and what may be required in terms of Islands Trust approvals. o Joanne Ovitsland clarified that the application for crown land for the cemetery will be a separate application. In an extraordinary federal court hearing yesterday, Salt Spring Advocate Clarke argued that Rogers had failed to fulfill their obligations to consult with the community as per existing protocols and had behaved poorly. Clarke asserted that Innovation, Science and Economic Development Canada (ISED) had jurisdiction, but not unfettered power, over the proposed Salt Spring cell tower which will contain 9 antennas and 22 panels. In my 15-page submission to ISED earlier this week on behalf of the Concerned Residents of Hornby Island (CRHI), I called on the Minister to discipline Rogers, SitePath, and Brian Gregg for obstructing fair process and to dismiss this and all further applications for cell tower siting on Hornby Island. Our Official Community Plan requires that all public services and utilities installations on Hornby Island should be for servicing Hornby Island only. Trustees should honor their oath to protect all their constituents and vote for non-concurrence today. o Chair Peterson reminded that members of the public who wished to speak for a longer time could be better served by speaking as a delegation, for which they would be allotted 10 minutes. This 24-story cell tower will need to be covered with lights, visible over the entirety of the island, because it is in the flightpath of the medivac helicopter. This cell tower is to improve Rogers’s general cell coverage and bottom line, not to better service Hornby. For better emergency response, Hornby should be getting satellite phones. ADOPTED Hornby Island ADOPTED 4 Local Trust Committee Minutes February 2, 2024 Erecting a fifth-generation tower in the middle of Hornby’s main community service area will cover Hornby Island with unhealthy electromagnetic pulses. This military-like installation is designed for the “internet of things” and the surveillance of everything. The current cell tower site is a bad site and is too close to the ball park; the bike track and bike trail; the golf course; Joe King Clubhouse; the kitchen and warming center; the weight room; the soccer field; the community school; the pickle ball, basketball, badminton and Spark maker space which is also proposed for a water testing site; the free store; the community hall; the home support building, the outdoor performance area; the outside market; the credit union; the medical clinic; the natural history building; the proposed community housing site; the Hornby Residents and Ratepayers Association building; Room to Grow; and the pre-school. Trustees need to tell the provincial government that the site is inappropriate. Fiber optics gives you a much better system than what the tower can offer. Please vote for non-concurrence to the proposed cell tower because it is the right thing to do. Expressed concern whether planning staff had followed proper legislative process throughout the history of the file. The Official Community Plan states that no such tower can exist on Hornby. This is undisputed as based on documents obtained through the Freedom of Information Act. The law allows trustees to vote non-concurrence at any time. Housing advocate April Lewis updated that the Hornby Island Housing Network and the Hornby Island Housing Society have developed a draft Housing Strategy document that will be ready for community feedback soon. In addition, a Community Profile Project for Hornby and Denman Islands was completed and can be accessed online at communityprofile.ca. Please advise us of any errors or omissions in the community profile. Advisory Planning Commission (APC) Secretary Joanne Ovitsland noted that the APC housing and short-term vacation rentals (STVR)s recommendations, submitted two years ago, have been stalled and now complicated by the new provincial housing regulations. While business license possibilities are welcome, there are now 10 to 15% more short-term vacation rentals (STVR)s being listed this year than last. Should housing and STVRs be separated to allow for a more efficient process? Rogers’s cell tower proposal should be null and void if it is going against existing laws. Many parents cannot come to this meeting if there is no childcare available. In support a cell phone tower free Hornby Island for safety and health reasons. Many people on Hornby have spent a lot of time on their research and presentations regarding this issue. My cell phone already works well in most places on Hornby. Does the Islands Trust have any input into road quality issues? o Chair Peterson responded that Trust influence over roads issues was limited to letter writing. Microwave radiation is damaging to human and plant cells and is a weapon of assault. Children’s brains are compromised by microwaves. Safer cell phone technologies exist but have been suppressed. There is no public support for this cell tower at this meeting today. ADOPTED Hornby Island ADOPTED 5 Local Trust Committee Minutes February 2, 2024 5. DELEGATIONS 5.1 Stuart Amos regarding the Agricultural Land Reserve and A1 Zoned Properties Stuart Amos, speaking on behalf of the following farms and owners of Agricultural Land Reserve (ALR) designated, A1 Islands Trust-zoned property on Hornby Island: Little Tribune Farm: Nikki Pierce and Stuart Amos; Lerena Vineyards: Daniel Goodman and Rebecca Goldman; 80 Acre Wood: Mike Holmes, Wilfredo Sánchez Vega, and Kristen Berg; Fossil Beach Farm: Aileen Fearman and Jeff Zamluk, noted the following: The current delegation is a follow-up to that of the last meeting. Farm owners want clear Islands Trust rules that reflect current ALR rules. Glamping, currently allowed by the ALR for agri-tourism, is a low impact and good way of bringing people to the island that does not take away from local housing or STVRs, and that provides crucial farm income. Chair Peterson deferred LTC discussion of the ALR regulations issues to later in the meeting, under Item 13.1. 6. APPLICATIONS AND REFERRALS 8.1 HO-3400-02-2022.1 (Rogers Communications) - Innovation, Science, Education and Development Canada (ISED) Antenna Systems Consultation Process - Memorandum ADOPTED Hornby Island ADOPTED 6 Local Trust Committee Minutes February 2, 2024 Planner Cox updated Trustees with the following information contained in the Rogers Communications Memorandum: That a recent letter from Ken Pungente, Coastal Offices Director for ISED, indicated that consultation processes between a proponent and a land use authority (LUA) can be extended past the default ISED 120 days in the case where a LUA has requested additional public consultation and notification. Staff recently reviewed a new public notification proposal prepared by the proponent who intends to send out the expanded notification area information on February 2 nd , which is today. There is no specified timeline for this new notification process per the guidance from Mr. Pugente noted above. o A member of the public noted that public responses to the new notification were requested by the proponent by March 8, 2024. o Planner Cox to provide clarity for the LTC on whether Rogers will bring this newly compiled public response information directly back to the LTC prior to the anticipated BC provincial Crown Lands referral. To be added as an update to the Follow Up Action List. The Local Trust Committee (LTC) can submit a letter of non-concurrence at any time, though staff would not be recommending this approach considering the LTC has requested additional notification; should difficulty arise in communication between the LUA and a proponent, the proponent may seek assistance from ISED as an intermediary and/or request dispute resolution.. There is some risk of the above to the LTC in deciding upon non-concurrence before the proponent’s new public consultation process is completed, given that the new process was requested by the LTC. Chair Peterson noted the following: That a letter of non-concurrence would need to provide rationale deemed acceptable by ISED. That the Province is only involved with the Rogers application because they want to use a piece of crown land, rather than private land, for the site of their proposed cell tower. If the Province rejects Roger’s application, Rogers will need to find a new piece of land and start over again with the public consultation process. Trustees noted the following: ISED has the final say on whether a cell tower would be placed on Hornby or not. The previously proposed cell tower had no lighting, but the new proposed tower has full lighting. LTC objections to the crown land site that Rogers is applying for seems more defensible than LTC objections to Roger’s consultation processes. By general consent the meeting recessed at 1:16 pm and reconvened at 1:50 pm ADOPTED Hornby Island ADOPTED 7 Local Trust Committee Minutes February 2, 2024 Chair Peterson finalized that, given Trustee agreement, a letter of support for Katherine Ronan’s applications for crown land for community housing and a cemetery extension could be done by Resolution Without Meeting. 9. LOCAL TRUST COMMITTEE PROJECTS - none 10. CORRESPONDENCE - none 11. NEW BUSINESS 11.1 Childcare for Local Trust Committee Meetings Trustee Allen noted that regular LTC meetings, especially as they were held on Fridays, were difficult for parents of younger children to attend; and that available childcare could support families to attend more meetings. Chair Peterson noted that it would be important to know if LTC funds were available for this purpose, and to have an estimate of cost. HO-LTC-2024-01 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee ask staff to explore funding for childcare during Local Trust Committee meetings and report back at the next possible opportunity. CARRIED 11.2 Comox Valley Regional District Business Licensing. HO-LTC-2024-02 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to send a letter to the Comox Valley Regional District Director in support of funding for a feasibility study concerning business licensing for short-term vacation rentals on Hornby Island, by February 6 if possible. CARRIED Chair Peterson noted that he would also be writing a letter of support before the February 6 th deadline, so that if the Staff letter was delayed, Director Arbour would have something to work with. 12. REPORTS 12.1 Trust Conservancy Report - none 12.2 Applications Report dated January 26, 2024 ADOPTED Hornby Island ADOPTED 8 Local Trust Committee Minutes February 2, 2024 Planner Cox clarified that the Temporary Use Permit (TUP) HO-TUP-2020.3 for water extraction and sales at the Co-op was approved by the LTC in 2020, but the permit has never actually been issued because one of the conditions of the permit, receipt of a water license from the Province, has not occurred. It is anticipated by planning staff that this license will be forthcoming and that no current action is required. 12.3 Trustee and Local Expense Report dated December, 2023 Received for information. 12.4 Adopted Policies and Standing Resolutions Chair Peterson questioned the current relevance of Standing Resolution no.7 from 2020: o Planner Cox responded that this COVID emergency response measure from 2020 that allowed for expanded patio space licenses by the Liquor Control Branch had been wound down by the branch. Staff could look further into it. A Trustee questioned the slow progress of Standing Resolution No.5 “First Nation Relationship Building.” o Chair Peterson responded that there were some Band Council elections held in January 2024. Letters to newly elected Band Councils within a month or two of elections could be considered. o Planner Cox updated that Staff was actively engaged with Kómox First Nation (KFN) and that Trustees could engage KFN through current projects. Advocacy First Nation engagement protocols will be updated shortly by the Regional Planning Manager. A Trustee noted that Standing Resolution No.8 needed to be updated to reflect the new resolution HO-LTC-2023-046 that removes the end-dates from previous standing resolutions to conditionally defer bylaw enforcement of unlawful permanent dwellings. o Planner Cox acknowledged the need for updating this item. A Trustee requested that Planner Cox look into current Advisory Planning Commission (APC) appointments because two of the APC members were coming to the end of their term. 12.5 Local Trust Committee Webpage 12.6 First Nations Relationship Building Update – verbal Planner Cox, speaking on behalf of Regional Planning Manager Jamurat who sends apologies for being unable to attend the meeting, provided the following First Nations relationship-building update: Regional Planning Manager Jamurat and other Islands Trust Staff met virtually with Kómox First Nation (KFN) Chief, Council and Staff on January 18, 2024 and shared ADOPTED Hornby Island ADOPTED 9 Local Trust Committee Minutes February 2, 2024 information on the current planning projects for Hornby, Denman, and Lasqueti Islands; and the major works underway by Islands Trust Conservancy and Trust Area Services. KFN has indicated that they are interested in participating in Denman and Hornby generally and in the Trust Policy Statement work. Capacity funding contained within project budgets will finance ongoing discussions with KFN. Planner Zupanec was also present at the virtual meeting with KFN with information regarding the Hornby Official Community Plan and Land Use Bylaw Review Project. Director Claire Frater of Trust Area Services and the Acting Senior Policy Advisor Mary Storzer were also present at the virtual meeting. Discussions went very well. A Trustee expressed some concern that the Capacity Funding for First Nations relationship building of $12,000 for Hornby was excessive given that other Trust Islands also needed funds. o Chair Peterson noted that Capacity Funds came from the Province specifically for First Nations relationship building; any funds not used by Hornby would go back into the pool of funds for that specific use by other Trust Islands. o Planner Zupanec noted that $12,000 was set aside from the Hornby LTC Project budget for capacity funding with the Nation and has not yet been accepted. It would be prudent not to mislead KFN by removing funds just when plans for future work have been successfully set in motion. 13. WORK PROGRAM 13.1 Active Projects Report dated January 26, 2023 The Local Trust Committee (LTC) discussed the possibility for including the alignment of Agricultural Land Commission (ALC) regulations with local Trust regulations into the current Hornby Official Community Plan (OCP)/Land Use Bylaw (LUB) Review Project. Planner Zupanec advised that a draft resolution to include the agricultural regulations issues could be prepared by planning staff for consideration at the next LTC meeting. o Planner Cox added that better clarity around current agricultural regulations could be provided by planning staff before consideration of a resolution. o A Trustee considered that this upcoming planner review of existing agricultural regulations across jurisdictions may be appropriate for Advisory Planning Commission (APC) referral. 13.2 Future Projects Report dated January 26, 2024 ADOPTED Hornby Island ADOPTED 10 Local Trust Committee Minutes February 2, 2024 HO-LTC-2024-03 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee ask staff to add Future Projects Report Number 4 to the Official Community Plan/Land Use Bylaw Review Project. CARRIED Planner Zupanec clarified that Item No. 4 on the Future Projects Report, regarding the consideration of zoning amendments to allow chickens (but not roosters) in all zones and the consideration of excluding cisterns from setback regulations, would be added by Staff to the draft charter of the Hornby Official Community Plan (OCP)/Land Use Bylaw (LUB) Review Project for Local Trust Committee (LTC) endorsement at the next regular LTC meeting. 14.
