[0:02:36] Trustee Elliott (probable): particular Thetis Island and Penelakut Islands and the Associated Islands and

[0:02:40] Trustee Elliott (probable): waters here are home to the Penelakut and Liaxin First Nations now the Thetis

[0:02:46] Trustee Elliott (probable): Island Local Trust Committee is committed to reconciliation and the acknowledgement of Indigenous

[0:02:51] Trustee Elliott (probable): place and history and to continue building relationships with the people of these lands

[0:02:57] Trustee Elliott (probable): and waters. The Hul'q'umi'num speaking peoples have maintained their connection to this area

[0:03:03] Trustee Elliott (probable): and we want to acknowledge that historical and present day relationship to the land and culture

[0:03:09] Trustee Elliott (probable): that continues to inform and hopefully shape our decisions today so that we can work together in a

[0:04:53] Voice 7: the cuber is now back in service with a new name which reflects the name of the penelakut tribe

[0:05:04] Voice 7: and the crew is now on a seven on seven off um so that uh they needed a whole

[0:05:13] Voice 7: other crew they've got four crews now and it seems to be working okay uh there's rumors that there'll

[0:05:19] Voice 7: be a new schedule coming out shortly we don't know for sure uh what else oh the thefts on the island

[0:05:26] Voice 7: there was apparently an arrest

[0:05:28] Voice 7: made of a young person that was causing some thieving around the

[0:05:33] Voice 7: island and that has since ceased okay and the only other thing has been obviously pretty cold and wet

[0:05:42] Voice 7: and snowy and

[0:05:44] Voice 7: much going on uh there was a rabbit sighting this morning at a quarter to five

[0:05:49] Voice 7: on the loose down by the garden there a rabbit yes

[0:05:56] Voice 7: well there could be because apparently two rabbits can make over four million rabbits

[0:06:28] Voice 8: spans beyond fetus but indeed I just want to also acknowledge and grateful to live and work

[0:06:35] Voice 8: in Koshyap's territory here in Sinaloa territory and Laiakson territory and you know I don't have

[0:06:46] Voice 8: have anything specific to report to me. I've attended the community forums, the Tika Tira

[0:06:52] Voice 8: forum, community groups gathering. There's an initiative to, I'm part of Pastors Week

[0:06:58] Voice 8: at Benton, to move towards a process of reconciliation, a more active reconciliation community. And

[0:07:08] Voice 6: so

[0:07:08] Voice 8: that's ongoing. There's a meeting on Friday, which unfortunately conflicts with the CAO

[0:07:12] Voice 8: HC committee meeting and yeah I was on Danbury electronically last week and

[0:07:20] Voice 8: we discussed one of the items on our agenda there today a very similar the

[0:07:25] Voice 8: smaller island bigger island smaller population than ours but indeed they

[0:07:30] Voice 8: discussed the housing legislative changes in there so I can share that

[0:07:37] Voice 8: with you later um otherwise nothing to report and

[0:07:42] Trustee Elliott (probable): were you at the salish sea symposium oh thank you

[0:07:45] Voice 8: for that reminder yes i was at the salish sea symposium that was almost two weeks ago now

[0:07:51] Voice 8: um that was the first gathering uh hosted by transport canada which as it turns out i didn't

[0:08:01] Voice 8: realize there was some confusion for me and others around the name uh calling it the coast salish uh

[0:08:07] Voice 8: strategy versus the Coast Salish Forum, which has been around for five or ten years, and

[0:08:13] Voice 8: that body run out of the University of Washington, which met every other year or every two years

[0:08:19] Voice 8: in Canada or in the U.S., accordingly, which has been a fantastic gathering of First Nations

[0:08:26] Voice 8: and co-governments, has actually ended.

[0:08:32] Voice 8: They don't have the capacity or the ability to continue that work because it was a huge

[0:08:36] Voice 8: undertaking.

[0:08:38] Voice 8: And so I don't know if it's a coincidence or on purpose, but this new co-sales strategy is slid in, which would be only Canadian content and only Canada, although there were people from Puget Sound and around.

[0:08:52] Voice 8: fact, those that attended the previous event of this were there.

[0:08:57] Voice 8: There's about six or seven hundred people posted in Vancouver, and what's significant

[0:09:04] Voice 8: about this event and what was important to me, which is why I wanted to attend, is how

[0:09:14] Voice 8: the work of Transport Canada and Canada generally, with respect to working with nations, is moving

[0:09:22] Voice 8: and advancing in significant ways and we're talking a lot about collaboration

[0:09:26] Voice 8: and working together and

[0:09:28] Voice 8: so this approach of strategy is intended to

[0:09:30] Voice 8: further that

[0:09:31] Voice 6: and

[0:09:32] Voice 8: the leadership that was there and spoke about the issues

[0:09:37] Voice 8: important to them and and of course important

[0:09:39] Voice 8: to us around environment and

[0:09:42] Voice 8: marine vessel traffic and orcas and anchorages and all sorts of things was

[0:09:50] Voice 8: was perfect it was really uplifting

[0:09:52] Voice 6: um

[0:09:53] Voice 8: and i'm not 100 sure how the huva app which is what they

[0:10:01] Voice 8: a lot of people are using it these days i don't like it because it doesn't remain a permanent

[0:10:07] Voice 8: archive of what happened it's a short one oh yeah

[0:10:09] Voice 8: so anyway i didn't attend that thank you for

[0:10:13] Voice 8: asking and of course we're getting ready for council i'll let

[0:10:16] Voice 8: you talk about that yes uh well

[0:10:25] Trustee Elliott (probable): i was remiss at the approval of the agenda i'd wanted to add a piece of correspondence that had

[0:10:43] Trustee Elliott (probable): i just wanted to acknowledge that we'd received that piece of correspondence

[0:10:55] Trustee Elliott (probable): news um there was there i i haven't attended the southern gulf islands forum lately but the last

[0:11:03] Trustee Elliott (probable): meeting that we had in person um september 11th we talked about waterways in a national marine

[0:11:09] Trustee Elliott (probable): and conservation area

[0:11:10] Voice 6: um

[0:11:11] Trustee Elliott (probable): derelict and abandoned vessels remediation fund that's in process now

[0:11:18] Trustee Elliott (probable): um and that i think the conversation is is can we shape a technical working group with um

[0:11:27] Trustee Elliott (probable): sanich and wasanich um leadership sort of informing um potentially leading to a first

[0:11:35] Trustee Elliott (probable): nations led port authority for the gulf islands these are very you know we're not involved in

[0:11:40] Trustee Elliott (probable): that conversation but i'm just sort of hearing that there is interest in in managing the waterways

[0:11:46] Trustee Elliott (probable): um with the first nations led perspective and and so that's i think that's really important work

[0:11:52] Trustee Elliott (probable): that um i'd like to keep an eye on for sure we are coming up to trust council in march is when

[0:12:00] Trustee Elliott (probable): when the budget has to be adopted.

[0:12:03] Trustee Elliott (probable): And so much of our conversation has been about

[0:12:05] Trustee Elliott (probable): how to spread the limited tax dollars that we have

[0:12:12] Trustee Elliott (probable): and address all the needs and challenges

[0:12:17] Trustee Elliott (probable): across the trust area in an equitable way.

[0:12:20] Trustee Elliott (probable): So I was happy to see that the Ministry of Housing

[0:12:24] Trustee Elliott (probable): and Municipal Affairs included the Islands Trust

[0:12:28] Trustee Elliott (probable): trust in funding housing needs assessments, because they've changed the legislation that

[0:12:36] Trustee Elliott (probable): housing needs assessments need to be updated and forecasting for 20 years.

[0:12:41] Trustee Elliott (probable): And so because we're included in that, we got a grant for the purpose of updating those

[0:12:48] Trustee Elliott (probable): housing needs assessments, which were needed in the Northern Gulf Islands anyways, actually

[0:12:52] Trustee Elliott (probable): northern and southern so that's going to be about a hundred and thirty thousand

[0:12:56] Trustee Elliott (probable): dollars and so that won't be taxed that's wonderful

[0:13:04] Voice 8: add to that because it's significant that there was no money that

[0:13:07] Voice 8: came with this we at the honest trust asked for money to do the work the

[0:13:12] Voice 8: province agreed to give us the money right because it's completely outside

[0:13:17] Voice 8: side of our budget to be able to do

[0:13:19] Voice 6: 14

[0:13:22] Voice 8: housing assessment reports for the initiative yeah so

[0:13:26] Voice 8: we're grateful to the public it is

[0:13:28] Voice 8: they're hearing our woes about a conference that

[0:13:32] Trustee Elliott (probable): is significant

[0:13:33] Trustee Elliott (probable): yeah um so budget conversations continue um we've got very lively discussion in the financial

[0:13:41] Trustee Elliott (probable): planning committee which both peter luckham and i are serving on and of course the other major

[0:13:48] Trustee Elliott (probable): update is the retirement of our chief administrative officer Russ Hotson

[0:13:54] Trustee Elliott (probable): Pillar that's probably old news now but we're working on the terms of reference

[0:14:00] Trustee Elliott (probable): for the hiring committee and and how that's going to be unroll getting input

[0:14:08] Trustee Elliott (probable): from council members and trustees on how that job description needs to shape up

[0:14:15] Trustee Elliott (probable): what is the vision for this trust area in the next five years what kind of leader or

[0:14:20] Trustee Elliott (probable): cao do we need in that role this is um very pertinent conversation right now because

[0:14:26] Trustee Elliott (probable): that person is the the the pinch point for all the work that needs to get done that trustees want to

[0:14:34] Trustee Elliott (probable): enact so it's very critical role he is retiring as of june so so it's quite crucial that we

[0:14:41] Trustee Elliott (probable): um have the process underway quickly um and i'll just share one thing uh i was at south pender

[0:14:49] Trustee Elliott (probable): chairing their ltc meeting on february 2nd just last friday and we had um a welcome and an opening

[0:14:58] Trustee Elliott (probable): by chief hereditary chief eric pelkey and he addressed our local trust committee and did a

[0:15:05] Trustee Elliott (probable): 30-minute presentation on a whole range of really interesting topics and stories everything from

[0:15:14] Trustee Elliott (probable): leaf net fisheries um how they were built and they were sustainable fisheries to um stories of you

[0:15:21] Trustee Elliott (probable): know his grandfathers and some of the yeah some of the important sites that um they're still

[0:15:29] Trustee Elliott (probable): still reclaiming and bringing youth back to the land.

[0:15:32] Trustee Elliott (probable): So the Wasanich Leadership Council is very active there

[0:15:37] Trustee Elliott (probable): and they're doing a lot of renaming and sharing of culture

[0:15:43] Trustee Elliott (probable): with Indigenous elders and youth.

[0:15:46] Trustee Elliott (probable): And the real key is language and youth.

[0:15:49] Trustee Elliott (probable): And so I just wanted to share that,

[0:15:51] Trustee Elliott (probable): that it was very moving to have a Wasanich leader perspective

[0:15:57] Trustee Elliott (probable): perspective on land use and the stories of the land there and so we might want to consider that

[0:17:00] Voice 1: payers and residents association um and it came to my attention late last night that somewhere

[0:17:07] Voice 1: in the minutes of previous meetings uh there's the possibility that at this meeting some discussion

[0:17:13] Voice 1: might take place over the original government's wish to change mental

[0:17:20] Voice 1: regulations and on that topic I would just like to suggest that from the

[0:17:28] Voice 1: standpoint of here we shouldn't have any changes in the immediate future and if

[0:17:35] Voice 1: the discussion should carry on any further of it that the residents of

[0:17:43] Voice 1: fetus island should have input um you know the other topic which is associated with um

[0:17:55] Voice 1: i'm new to the position and it's interesting to check through some of the budgets that were

[0:18:03] Voice 1: proposed online and i know that fetus island area g is that what we are here um is umbilically linked

[0:18:14] Voice 1: with ladies and not my own idea here but the feasibility of changing boundaries

[0:18:25] Voice 1: and now meeting what we might call the more isolated communities well somewhat

[0:18:34] Voice 1: more similar uses of the budget items we make some steps I think that it's

[0:18:45] Voice 1: that um could be looked into and i think part of the reason is that when we look at those budget

[0:18:53] Voice 1: items i realize that fetus island is a relatively small percentage of the population of this thing

[0:19:01] Voice 1: but the whole point is that we end up in some ways perhaps subsidizing some of the facilities

[0:19:11] Voice 1: in ladies to assault there that we really don't make any use of at the same time i think there's

[0:19:21] Voice 1: feeling that some of the isolated communities have completely different concerns as far as

[0:19:27] Voice 1: contact and what we would perhaps expect from the regional district so that's a whole separate issue

[0:19:36] Voice 1: really associated with islands trust but uh i put it on the table just to spark some interest

[0:19:42] Voice 1: that we will be looking into it a little bit excellent

[0:19:53] Voice 8: um i would suggest you know what would be really great in your new role is to get

[0:19:57] Voice 8: you know get together and have a conversation about the island's trust and the complexities

[0:20:01] Voice 8: of the regional jurisdictional landscape because um it strikes me on referring to

[0:20:08] Voice 8: ladysmith and salter you're probably more reflecting especially seeing this in the minutes

[0:20:14] Voice 8: um you're reflecting more upon the regional district authority and particularly with the

[0:20:20] Voice 8: recreational component that is actually not to do the album suspect absolutely if the regional

[0:20:26] Voice 8: director was uh had a report here at the um opportune moment to address uh him as well

[0:20:32] Voice 8: but let's have a conversation about the regional uh jurisdictional authorities there um we do

[0:20:39] Voice 8: operate as a federation of islands and so indeed there is a shared uh component amongst the islands

[0:20:46] Voice 8: not a bunch of Vancouver Island community stuff,

[0:20:50] Voice 8: but let's have a conversation sometime.

[0:21:07] Trustee Elliott (probable): Bill 44 or the STVR accommodation rental.

[0:21:11] Trustee Elliott (probable): They're two separate bills or both.

[0:21:17] Voice 1: that. The whole thing came up to me fairly late last night. I didn't realize I was going to be here. But I guess I'm looking for a status quo.

[0:54:24] Planner Zupanec (probable): inconsistent with or more permissive than the Bill 35, which is the Short-Term Rental Accommodation

[0:54:30] Planner Zupanec (probable): Act. You are being asked to review your bylaws and consider whether any updates are warranted.

[0:54:37] Planner Zupanec (probable): and i will give you a little bit of an analysis of the key elements of bill 35 that are also

[0:54:45] Planner Zupanec (probable): fleshed out in more detail in director surmax memo on page 39 onward there's quite a comprehensive

[0:54:53] Planner Zupanec (probable): package of information there so for your constituents this agenda package piece that's

[0:55:00] Planner Zupanec (probable): in your business meeting today is actually an excellent reference for background information

[0:55:05] Planner Zupanec (probable): information moving forward. So you may want to remind people to go back to this package to sort

[0:55:11] Planner Zupanec (probable): of wrap their head around what it is that's happening across the province and how local

[0:55:16] Planner Zupanec (probable): governments are being asked to respond. So there's a few key elements in Bill 35 in this table. I'll

[0:55:25] Planner Zupanec (probable): be moving through a few slides. The first section relates to business licensing and the opportunities

[0:55:34] Planner Zupanec (probable): there for your local trust area may be to consider short-term rentals being licensed

[0:55:39] Planner Zupanec (probable): with the Cowichan Valley Regional District. So that is of interest to some other local trust

[0:55:48] Planner Zupanec (probable): areas. They're currently pursuing that. The implications are that the Islands Trust doesn't

[0:55:54] Planner Zupanec (probable): have any authority to issue business licenses. This would require sort of significant cooperation

[0:56:00] Planner Zupanec (probable): cooperation and administrative support with the regional district, which you may or may not

[0:56:05] Planner Zupanec (probable): already have a relationship to do with. And we anticipate that there will be significant

[0:56:11] Planner Zupanec (probable): financial resources associated with this as well in terms of how this gets cost recovered

[0:56:16] Planner Zupanec (probable): and how the taxpayer base supports that extra service. So that's one piece of the

[0:56:23] Planner Zupanec (probable): the upcoming legislation that is not required it's an option that you may wish to consider

[0:56:31] Planner Zupanec (probable): the other piece is a provincial registry which will be clear across the entire province whether

[0:56:39] Planner Zupanec (probable): you decide to opt into the principal residence requirement or not this registry will be for

[0:56:44] Planner Zupanec (probable): all short-term accommodation rentals and that system will be shareable to local governments

[0:56:51] Planner Zupanec (probable): across the province and we're assuming based on the information that we have that it'll be

[0:56:59] Planner Zupanec (probable): available later in 2024 and it will be required whether or not you opt in that registration piece

[0:57:07] Planner Zupanec (probable): will be every host will need to ensure that they are taking place with the registration and the

[0:57:14] Planner Zupanec (probable): province can enforce on the registration so the local trust committee would not from what we

[0:57:19] Planner Zupanec (probable): we understand, be responsible for enforcing compliance with this element.

[0:57:27] Planner Zupanec (probable): The next piece is the principal residence requirement. And this is where there's some

[0:57:34] Planner Zupanec (probable): confusion about what does this mean in terms of opting in because there's a, the first deadline

[0:57:39] Planner Zupanec (probable): is this March 31st, 2024. It is an annual deadline. So at any point, the local trust

[0:57:46] Planner Zupanec (probable): trust committee every year can decide to opt in and it will take effect in November of that same

[0:57:54] Planner Zupanec (probable): year. So the vacation rental in the provincial requirement for several geographies, currently

[0:58:03] Planner Zupanec (probable): the Thetis local trust area and the whole islands trust is excluded, requires that the rental is

[0:58:11] Planner Zupanec (probable): is only taking place in the host's principal residence or a secondary suite within that

[0:58:18] Planner Zupanec (probable): residence or a secondary dwelling unit on that property. So this opt-in option does have a

[0:58:28] Planner Zupanec (probable): deadline coming up. We understand it might be, and it likely is, very early for you to be confident

[0:58:35] Planner Zupanec (probable): that you wish to opt-in at this stage. So you do have time to consider this because the next

[0:58:42] Planner Zupanec (probable): stopped in dates as we understand will always be the end of the fiscal each year. So the province

[0:58:47] Planner Zupanec (probable): would be enforcing the principal resident requirement as well as that registry requirement

[0:58:52] Planner Zupanec (probable): that we just talked about. This would supersede any government local government zoning that you

[0:58:58] Planner Zupanec (probable): have that permits these rentals to to take place differently and it appears the way we're

[0:59:04] Planner Zupanec (probable): interpreting it now is that it would permit the principal residence and a secondary suite or

[0:59:08] Planner Zupanec (probable): dwelling to be operated as a rental concurrently, so a maximum of two per lot. We're not clear

[0:59:16] Planner Zupanec (probable): whether or not the host whose principal residence it is actually has to be on site during that use

[0:59:26] Planner Zupanec (probable): being in place. That's still clarity to come. You are recommended to consider a number of factors

[0:59:36] Planner Zupanec (probable): before opting in, and that should include a housing needs report, the actual number

[0:59:41] Planner Zupanec (probable): of short-term rentals that your community is currently dealing with or managing or working

[0:59:49] Planner Zupanec (probable): with, your rental vacancy rates, if applicable, and there's a number of other factors that

[0:59:55] Planner Zupanec (probable): the planners can support you with if you decide to do a more comprehensive analysis.

[1:00:00] Planner Zupanec (probable): So with the three land use bylaws that you currently have, you have three different approaches to regulating this.

[1:00:08] Planner Zupanec (probable): In each case, Thetis Island, for example, you do permit these guest accommodations to take place based on the lot size, actually.

[1:00:20] Planner Zupanec (probable): So that home occupation piece is extended per every eight hectares of lot size.

[1:00:26] Planner Zupanec (probable): So there is an opportunity for somebody to have multiple rentals, which would not be consistent with the provincial legislation. So that's something that would need to be dealt with.

[1:00:37] Planner Zupanec (probable): For Valdez, you permit bed and breakfast, but they're very loosely defined with no clarity around limitations, whether these are self-contained spaces.

[1:00:48] Planner Zupanec (probable): So you may need to consider the implications of having some ambiguous bylaw language for that particular commercial use.

[1:00:58] Planner Zupanec (probable): And then in your associated islands, you do have clarity around the owner being in residence to operate that limited economic benefit up to 14 days, which is fine.

[1:01:13] Planner Zupanec (probable): You can actually be more restrictive than the provincial requirement, but you can't be more permissive.

[1:01:21] Planner Zupanec (probable): so there's some opportunity there to to do an analysis and see if there's any tweaks or changes

[1:01:27] Planner Zupanec (probable): that need to take place and then the sort of the last three sections of the bill 35 deal with legal

[1:01:35] Planner Zupanec (probable): non-conforming the provincial registry oh sorry that's duplicated see if we can ignore that and

[1:01:41] Planner Zupanec (probable): then provincial enforcement so in terms of the non-conforming status this is also of great public

[1:01:45] Planner Zupanec (probable): public interest, is that regardless of your decision to opt in or opt out or to stay as you

[1:01:53] Planner Zupanec (probable): are, there is a sunset clause that as of May 31st this year, if you do have any legal non-conforming

[1:02:03] Planner Zupanec (probable): short-term rentals that predate your current bylaws and have been in effect,

[1:02:07] Planner Zupanec (probable): they will no longer be permitted. So they will no longer benefit from that

[1:02:13] Planner Zupanec (probable): grandfathering as some people call it but we refer to it as legal non-conforming protection so we

[1:02:19] Planner Zupanec (probable): don't know how many you have in your trust area they all those properties will need to come into

[1:02:24] Planner Zupanec (probable): full compliance with with provincial regulations or local bylaws and that includes the principal

[1:02:32] Planner Zupanec (probable): residence requirement if you do decide to opt in in the future and then in terms of enforcement

[1:02:38] Planner Zupanec (probable): just to clarify the province would only be enforcing its own legislation not your local

[1:02:43] Planner Zupanec (probable): bylaws so there's some benefit to opting in if you're interested in ensuring that the provincial

[1:02:48] Planner Zupanec (probable): process takes care of the principal residence requirement and alleviates bylaw enforcement

[1:02:52] Planner Zupanec (probable): staff at the islands just from having to do that however it does not extend to the use of

[1:02:58] Planner Zupanec (probable): recreation vehicles or tents or yurts if that's something that your bylaws currently permit

[1:03:04] Planner Zupanec (probable): permit to be considered as a dwelling or as a secondary residence that could be rented,

[1:03:09] Planner Zupanec (probable): the province will not be enforcing on those elements. So there are a few options today that

[1:04:26] Planner Zupanec (probable): And, you know, at this point in time, I think through my analysis, I would not recommend that the opting in prior to a better analysis of the implications is provided to you. Chair Elliott called the meeting to order at 9:33 am. She welcomed the public and introduced 
herself, Local Trustees, staff and recorder. She acknowledged that the meeting was being held 
on the traditional territory of the Coast Salish First Nations, and noted that the Thetis Island 
Local Trust Committee (LTC) is committed to reconciliation and relationship building with First 
Nations.

3.1 Trustee Reports 
Trustee Hunter reported on the following: 
 The MV Kuper has been renamed, with the new name having been chosen by 
the Penelakut Tribe. The ferry is back in service and crewing issues solved. 
 The thefts occurring on-island have now ceased and an arrest has been made. 
 A rabbit was sighted loose outside on-island; a matter of concern should it 
multiply.

Trustee Luckham reported on the following: 
 He attended a Thetis Island Community Meetings (TICA) forum regarding an 
ongoing initiative to actively move forward in the process of reconciliation. 
 Last week he attended a LTC meeting on Gambier Island where discussion 
included the housing legislation changes that are also presented in this 
meeting’s agenda for discussion. 
 He attended the Salish Sea Symposium hosted by Transport Canada, where the 
discussion included advancing work in collaboration with First Nations on the 
many significant marine issues. 
 Preparation is in process for the next Trust Council meeting which will be held in 
March.  
 
3.2 Chair's Report 
 
Chair Elliott reported on the following: 
 She attended a Southern Gulf Islands Forum in September where discussion 
included an interest in managing waterways in a national marine conservation 
area with a First Nations perspective and derelict/abandoned vessel 
remediation funding. 
 Trust Council meeting in March will include discussion of adoption of the 
2024/25 budget and how to address all the needs and challenges in the Trust 
Area in an equitable way. 
 Islands Trust is grateful to the Province for agreeing to the request for a grant to 
update the Housing Needs Assessment, thereby eliminating the need to source 
funding for this through property taxes. 
 The Financial Planning Committee has been discussing the budget. 
 Islands Trust Chief Administrative Officer Russ Hotsenpiller will be retiring in 
June and a Hiring Committee is working on the terms of reference, vision, and 
various aspects of the position in consideration of a replacement. 
 She Chaired a LTC meeting on South Pender Island where a First Nation 
Hereditary Chief opened the meeting and provided a presentation on topics of 
interest. She suggested that this might be considered for a Thetis Island LTC 
meeting in the future. 
 
3.3 Electoral Area Director's Report - None 
4. PUBLIC COMMENTS 
 Gordon Prescott, President of the Thetis Island Residents’ and Ratepayers’ Association 
commented that the residents of Thetis Island should have input into the discussion of 
Provincial housing regulation changes. Additionally he raised concern that Thetis Island 
is linked with budget items which are not being used on this island, and suggested that 
boundary changes based on similar uses of budget would make sense. 
o Trustee Luckham invited the speaker to a conversation outside of this meeting 
to discuss and clarify how the Regional District and Islands Trust share

of the aquaculture lease. Staff responded that they will research and report back. 
 Trustee Luckham will continue to pursue September 5 Activity 1 inviting a First 
Nations elder to open a future LTC meeting. 
 Staff requested direction for how to proceed with November 7 Activity 1 regarding 
the draft Protocol Agreement with Cowichan Valley Regional District. Trustees 
supported reconsideration of a Letter of Understanding or Protocol Agreement that 
addresses current issues, and confirmed that a preliminary meeting with the new 
Regional Director to identify the scope of amendments would be warranted.

that the Thetis Island Local Trust Committee request Trustee Luckham to contact 
Director McClinton and invite him to the next Local Trust Committee meeting; and if

Plan) and 114 (Land Use Bylaws) – Memorandum 
Planner Thomaidis presented the memorandum that provides the LTC with bylaw 
referral responses from First Nations, agencies and the Advisory Planning Commission 
received to date for Proposed Bylaw Nos. 113 and 114. She responded to questions 
from Trustees regarding referral responses from First Nations and Fisheries & Oceans 
Canada.  
Options for moving forward with a Community Information Meeting and Public Hearing 
were considered, and it was suggested that an electronic meeting held in the evening 
would be well received by the community. Trustees discussed a preference for holding 
these meetings before the end of March if possible.

that the Thetis Island Local Trust Committee request staff to schedule an electronic

12.1 Housing Statute Changes to British Columbia Legislation – Memorandum 
The meeting paused due to technical difficulties at 10:40 am and resumed at 10:44 am. 
Planner Zupanec provided context and clarification of housing statute changes to BC 
legislation with preliminary analysis for LTC consideration of possible next steps and 
how to align with Provincial legislation. The presentation included an overview of new 
legislation affecting short term rental accommodation and housing statutes, potential 
opportunities and Thetis Island LTC implications. Due to technical difficulties, Trustees 
did not hear or see the Planner’s presentation, but the presentation was broadcast as 
part of the livestream.   
Trustees considered the background and speaking notes for Bill 44 and Bill 35 and 
determined that more time to consider the information would be necessary prior to a 
decision on an opt-in resolution.

include enough input from First Nations. The annual budget request has increased 
to $18,000 in order for ITC to re-do a plan that has more First Nations input.
