[0:00:28] Voice 6: I want to begin by acknowledging that we're fortunate to be able to gather here today in the territories of both Salish people and the Malacca people, most specifically.

[0:00:42] Voice 6: My name is Tim Peterson. I'm elected on Mesquite Island. I'm the chair of the Galliano Island

[0:00:47] Voice 5: Local Trust Committee.

[0:00:48] Voice 5: committee with me, our local trustees, Ben Maberly, Lisa Cabrone, and our staff planner,

[0:00:56] Voice 5: Kim Stockdale, and Bruce Belcher. And online, I think Carly Blaney is our recorder. Is that right?

[0:01:30] Voice 6: relevant business and also dispension this is a place of employment and our staff have the right

[0:01:35] Voice 6: to a safe and respectful workplace um we've

[0:01:41] Voice 5: got uh town hall section coming up and uh when we get

[0:01:47] Voice 5: there i'll just remind you about that um but yeah with that uh we'll we'll launch the meetings and

[0:01:56] Voice 5: uh we're trying to business we have an agenda before us is there any changes to the agenda

[0:02:04] Voice 5: okay well we can take the uh approval

[0:02:10] Voice 6: of the agenda by you know consent today and then we'll

[0:02:14] Voice 6: three inter-trustee reports who'd like to go first

[0:02:19] Voice 5: all right with the no local trust committee meeting last month i could find the refocus

[0:02:25] Voice 5: and reflect on the past year i've been reviewing uh trust council and galliano ltc as well as

[0:02:31] Voice 5: application guides uh mid-january i did my first governance committee meeting i have an

[0:02:37] Voice 5: ex-official member uh pointed through my position at the alice trust conservancy

[0:02:43] Voice 5: Also, I attended an On Stress Preservancy meeting in late January, where I was elected

[0:02:47] Voice 5: to vice chair for the team.

[0:02:49] Voice 5: You know that Lisa Smith is the chair of the IT&C, and Kate Emmings is the manager of On

[0:02:55] Voice 5: Stress Preservancy, so it's safe to say that Galea is well represented at On Stress Preservancy.

[0:03:04] Voice 5: So also, I've been taking extra time to prepare myself for Trust Council in March, including

[0:03:12] Voice 5: turning into other standing committee meetings,

[0:03:14] Voice 5: financial planning committee meetings,

[0:03:17] Voice 5: regional planning,

[0:03:18] Voice 5: also watching the executive committee meetings.

[0:03:21] Voice 5: And mid-January, I attended Long Island Town Hall,

[0:03:26] Voice 5: hosted by Elizabeth Megan.

[0:03:27] Voice 5: It was a great turnout, we had about 40 people here,

[0:03:32] Voice 5: and topics that were discussed were chemical weapons bans,

[0:03:37] Voice 5: environmental racism,

[0:03:39] Voice 5: which is Elizabeth's private members' bill,

[0:03:41] Voice 5: We can talk about agriculture, the heritage bill, looking at government and international

[0:03:50] Voice 5: pressure around a seasquare in Gaza, talk about pipelines, protection of wetlands, and

[0:03:58] Voice 5: watercourses.

[0:03:59] Voice 5: We talked about anti-trump laws, and the list goes on.

[0:04:02] Voice 5: One of the key takeaways for me was how approachable our Member of Parliament is.

[0:04:08] Voice 5: all it takes is a letter to her and you can see her swing into action i encourage anyone to reach

[0:04:15] Voice 5: out with their concerns reach out to her reach out to me i'll proceed come on in front of the

[0:04:19] Voice 5: hour it's been pretty quiet lately um in the bus office on mondays from 9 to 11. i could go on

[0:04:25] Voice 5: but it feels like a year's worth of events since my last trustee report so i'll leave it here for

[0:04:31] Voice 5: Mayor Mrakas, Thank you, thank you so one of the things we've been working on since the last trust meeting i've been working on this for a few months so i've been.

[0:04:44] Voice 5: Mayor Mrakas, Consulting with the CRD director CRD and I was stressed out to see if it's possible to craft a housing agreement that the CRD could register on title to see if we could facilitate the building of.

[0:04:57] Voice 5: Mayor Mrakas, cottages for long term housing.

[0:05:01] Voice 5: So that's something that's underway. I'm looking forward to seeing what Kim has to say that came out of that meeting that you guys had with staff there.

[0:05:08] Voice 5: The other thing I want to sort of acknowledge, and I do this at every meeting, is the passing of some of our elders.

[0:05:16] Voice 5: We had three pass in the community since the last meeting, Betty Brannon, Margie Head and Jeannie Sobey.

[0:05:22] Voice 5: and it's you know when your elders pass it's sort of

[0:05:27] Voice 7: it's

[0:05:28] Voice 5: striking in a way that i looked at genie

[0:05:30] Voice 5: selby and she was in her mid-90s and um she's born on the island right raised on the island

[0:05:38] Voice 5: and you sort of reflect back and i'm gonna visit a genie many many times at the north end

[0:05:45] Voice 5: and you you realize the loss of being able to see galliano through her eyes right that that

[0:05:52] Voice 5: vast knowledge, that book

[0:05:54] Voice 5: she had in her head

[0:05:56] Voice 5: and she grew up, if you go to the

[0:05:58] Voice 5: North End Hall and you see her name there

[0:06:00] Voice 5: as a child when she had to go to school

[0:06:02] Voice 5: at the North End Hall

[0:06:04] Voice 5: and the sultry was there, all of those

[0:06:06] Voice 5: things, how this island has changed

[0:06:08] Voice 5: in her lifetime, so

[0:06:10] Voice 5: you know, Jeannie's striking

[0:06:12] Voice 5: close to home, so thanks for that

[0:06:15] Voice 5: Yeah

[0:06:17] Voice 5: And next up is the Chair's

[0:06:19] Voice 5: report

[0:06:22] Voice 5: as

[0:06:22] Voice 5: As Dr. Cabrillo alluded to, the Financial Planning Committee

[0:06:26] Voice 6: has been meeting a lot in preparation for the Trust Council budget discussions in March and in NIMO.

[0:06:34] Voice 6: and uh between the recommendations of the governance committee um to move towards uh

[0:06:42] Voice 6: an integrated uh um corporate planning process which will integrate the strategic planning

[0:06:51] Voice 6: function uh with the finances and allow for sort of more rational long-term planning for projects

[0:06:57] Voice 6: that may not be completed in a fiscal um and so the financial planning committee working group has

[0:07:04] Voice 6: been really doing the heavy lifting on on that and helping us set up how we might make these

[0:07:11] Voice 6: processes more integrated and really more rational in terms of the long term

[0:07:16] Voice 5: um

[0:07:17] Voice 6: financial and

[0:07:19] Voice 6: strategic goals of trust council um in uh january i went to the salish sea symposium in vancouver

[0:07:28] Voice 6: We were hosted by Transport Canada.

[0:07:31] Voice 6: It was a pleasure to meet Penelope, Elder Kathleen Johnny there,

[0:07:37] Voice 6: who did a great presentation on plant garden restoration.

[0:07:42] Voice 6: And

[0:07:42] Voice 5: that was great meeting her.

[0:07:45] Voice 5: We had some good talks with her.

[0:07:48] Voice 5: There were some last wonderful

[0:07:51] Voice 6: parts of the program in terms of the sort

[0:07:58] Voice 6: of awareness and responsiveness of the federal departments to the realities and the needs of

[0:08:05] Voice 6: the residents and and frankly the other good things in the sailors the area um there's a real

[0:08:16] Voice 6: there's a real tendency by those federal governments to prioritize

[0:08:20] Voice 6: the economic activities over the natural world in our area and of course we know between

[0:08:30] Voice 6: between shipping and anchorages and, of course, dangers around tanker spills.

[0:08:38] Voice 5: Some pretty significant issues, as well as all the other human activity.

[0:08:45] Voice 5: I

[0:08:46] Voice 6: did, though, have a chance to speak really briefly to the Deputy Minister of Transport

[0:08:53] Voice 6: and then the following day to the Interim Assistant Deputy about

[0:08:57] Voice 5: the issue of more employees.

[0:09:00] Voice 5: which are in some areas becoming increasingly dense

[0:09:04] Voice 5: and moving well beyond that Transport Canada's designation

[0:09:10] Voice 6: as a minor works.

[0:09:12] Voice 6: So I posited the question of what numbers

[0:09:15] Voice 6: and what concentration in one area

[0:09:17] Voice 6: does do more activities collectively beyond minor works?

[0:09:24] Voice 6: And so the question went in.

[0:09:28] Voice 6: I didn't get any answers,

[0:09:29] Voice 6: but they certainly heard that there is, you know, there needs to be a point past which it's not just okay to let the conglomerated unlimited numbers in areas.

[0:09:43] Voice 6: And I did request that they consider interagency meeting with the local government, regional districts, province, federal departments.

[0:09:54] Voice 6: We'll see if that gets any traction or not. But I used the opportunity there to do that.

[0:10:00] Voice 6: and i'll leave that at that for my chair's report today i

[0:10:05] Voice 5: don't see anything from

[0:10:08] Voice 5: see our electoral area director here today mr brett but maybe he'll show up sometime this season

[0:10:15] Voice 5: and then the next session is first nations report and you have some information about the

[0:10:20] Voice 5: elected elections so today is the election of um chief of council on canalis island so

[0:10:26] Voice 5: uh especially for staff by the end of the week we should know who's who's elected and

[0:10:31] Voice 5: where contacts are going to be moving forward

[0:10:38] Voice 5: and

[0:10:38] Voice 6: so the next section is town hall's session and i will be looking for

[0:10:45] Voice 6: gopads and folks who want to address the local trust committee on issues uh pertaining to the

[0:10:53] Voice 6: business of the local trust committee ideally issues on the agenda but uh and i'll just remind

[0:10:59] Voice 6: everyone to respect the language speak to the issues uh non-individuals and keep your comments

[0:11:06] Voice 6: brief i'll be giving a warning at three minutes and ask you to wrap up and if there's plenty of

[0:11:13] Voice 6: time then we can have a second round and so that i'll just look

[0:11:17] Voice 5: for two hands i think i saw one

[0:11:19] Voice 5: right here yes sir so i would like to talk about the student's property uh development permit

[0:11:27] Voice 5: uh variance permit please yeah yeah go ahead at this time right now but

[0:11:37] Voice 6: uh it yeah okay

[0:11:42] Voice 5: okay so my name is martin swan um thank you mr chairman for allowing me to say a few words

[0:11:50] Voice 5: I'm speaking on behalf of the adjacent property owners.

[0:11:53] Voice 5: My wife, Shannon, might own the property to the western side of the Schoon's property.

[0:12:00] Voice 5: And so we've been working closely with the voice sergeants who are on the eastern side of the Schoon's property.

[0:12:10] Voice 5: We've owned our property since 2014.

[0:12:12] Voice 5: They've owned their property since 1991.

[0:12:14] Voice 5: 1991. And we put our comments together concerning the proposed EVP. So we provided a letter

[0:12:24] Voice 5: that was signed by all four people in the two households. So to move into what I'd like

[0:12:32] Voice 5: to say is we find as the adjacent property owners that there's an atrociously high number

[0:12:39] Voice 5: of bylaw violations that have been in existence on that property for almost 20 years 15 to 20 years

[0:12:46] Voice 5: anyhow um the um the person that was involved is deceased um it's not a reflection on anybody

[0:12:56] Voice 5: that's sitting in this room right now it's a situation where uh that person mr john schoonz

[0:13:02] Voice 5: decided to go ahead with the development of the development permit and um and he

[0:13:09] Voice 5: the outcome was that it affected the rights and well-being of the neighbors

[0:13:15] Voice 5: he had some interesting practices um he was very confident in what he did uh he'd often joke with

[0:13:23] Voice 5: neighbors about well you know the anchors were that my uh float is way out in front of your house

[0:13:29] Voice 5: Or, you know, don't dig too much there because you'll find a wall that I knocked the top off and buried it.

[0:13:35] Voice 5: There's a wall there on your property.

[0:13:38] Voice 5: Or another one was, first thing I had to do was put up all those fences and gates and hedge and everything to hide so people couldn't see what I was doing on the property.

[0:13:49] Voice 5: And this was sort of the mindset of the individual.

[0:13:53] Voice 5: individual. The bylaws were for other people to worry about. He had very little concern

[0:14:03] Voice 5: about those or how the development complied with any of the rules. I believe it's time

[0:14:11] Voice 5: to fix the mistakes. We were alarmed by the draft DBP, which basically sets out a plan

[0:14:23] Voice 5: where the um the variances will cover um the bylaw um setback um violations and will um

[0:14:37] Voice 5: i'll just ask you

[0:14:38] Voice 6: that okay um

[0:14:39] Voice 5: so so that was our concern is that it was just um a process where the

[0:14:45] Voice 5: there'd be an administrative fix and the in the process those um um bylaw provisions would be

[0:14:53] Voice 5: essentially got it to be um virtually useless they'd be going in some instances going right

[0:15:00] Voice 5: down to zero and i think to respect you know you're trying to control the uh agenda and so

[0:15:06] Voice 5: forth i'll pause and let someone else speak and then i'd like to be picked up again certainly

[0:15:14] Voice 5: I didn't know I saw Teo here.

[0:15:16] Voice 5: Okay.

[0:15:17] Voice 5: I'm Teo.

[0:15:19] Voice 5: I'm from the past one.

[0:15:20] Voice 5: And today I'd like to speak to temporary use permit and affordable housing.

[0:15:28] Voice 5: And clearly the original short-term rental permits have been issued and expired.

[0:15:37] Voice 5: And I've previously asked the trust if they had followed up on those TUPs to see if those individuals were still renting or actually complying with their legal agreement with the trust about living there for long-term rental.

[0:15:57] Voice 5: And so I know at least half a dozen that I don't know about and I suspect you may not know about.

[0:16:04] Voice 5: So there's a direct question to, I suppose, the staff or the, if they know of the disposition of the expired temporary use of short-term vacation rental communities.

[0:16:19] Voice 5: piece commentary yeah

[0:16:24] Voice 3: so um when a tup is approved we have the ability to put in if it's approved for

[0:16:31] Voice 3: three years we have the ability to get a reminder for that you should be set for two and a half

[0:16:36] Voice 3: years and at that point we check in with the applicant to see if they like to renew or if

[0:16:41] Voice 3: it's expiring to reapply and so we are aware of when one does um expire we keep an eye to see if

[0:16:50] Voice 5: they continue the use you keep an eye i'm sorry to see if they continue the use if they for example

[0:16:57] Voice 5: if it expires and if it becomes uh to our knowledge that they're continuing the use we

[0:17:04] Voice 5: send that to bylaw enforcement okay so you've checked on the expired to your piece is what

[0:17:10] Voice 5: you're saying we we do we have a more i mean now that i understand that many have extended

[0:17:17] Voice 5: and so

[0:17:19] Voice 5: now their second three-year term is over and the same thing applies i suppose is that when

[0:17:24] Voice 5: it expires you send a message and if

[0:17:26] Voice 5: you believe that there are some that are operating without a

[0:17:29] Voice 5: tup certainly get in contact with warren dateman or bioenforcement officer and he'll look into that

[0:17:35] Voice 5: for you so only in your inquiry is your testing there's no on the ground in investigation or

[0:17:43] Voice 5: inquiry or even a survey of the internet to see if they're still advertising or any other active

[0:17:51] Voice 5: response to what might be an infraction because uh clearly there's an issue in front of the trust

[0:18:00] Voice 5: and the trustees about infractions and uh second statement i'd like to make is about the intent of

[0:18:08] Voice 5: of the Islands Trust, the community plan

[0:18:11] Voice 5: and the limits set within the community plan

[0:18:15] Voice 5: that theoretically the trustees are representing.

[0:18:19] Voice 5: And then when there are infractions

[0:18:22] Voice 5: and or lack of information about certain values

[0:18:25] Voice 5: that are of interest to the trust,

[0:18:27] Voice 5: I would encourage them to, thank you,

[0:18:30] Voice 5: I'll conclude, to spend more energy and time

[0:18:34] Voice 5: I'm investigating these because six or more significant post-size houses available to rent

[0:18:41] Voice 5: would be a large impact on rental availability on Gabriela. So in allowing TUPs and or promoting

[0:18:51] Voice 5: TUPs, clearly there must be some more follow-up when they expire, especially when there are

[0:18:59] Voice 5: benefits thank you thank you

[0:19:02] Voice 5: add a

[0:19:03] Voice 5: quick comment certification rentals will be discussed later on

[0:19:06] Voice 5: the agenda the province has um processed bill 35 which addresses shortification rentals provincial

[0:19:15] Voice 5: wide and so that will be a topic this ltc will be addressing and how that new bill new legislation

[0:19:23] Voice 5: will affect Gallaudet. So that is an ongoing conversation.

[0:19:29] Voice 5: Okay, thank you. And I saw a hand here next.

[0:19:34] Voice 4: My name is Richard Beauchamp. I'm the two property owners to the east of Mr. Schoon's

[0:19:39] Voice 4: property. I've lived there with my wife, Dorothy, since 1982. So we've been a long time

[0:19:45] Voice 4: residents of Gallaudet. And I will take you on record to reiterate exactly what Mr. Swan

[0:19:50] Voice 4: one has spoken about. I've read his proceedings and entirely endorse that and support it.

[0:19:56] Voice 4: And I really can't comment much more on what a retired professional engineer puts down

[0:20:01] Voice 4: on paper. But I appreciate the opportunity to put my name and my wife's name forward

[0:20:06] Voice 4: in terms of supporting his concern.

[0:20:09] Voice 4: Okay, thank you for that.

[0:20:11] Voice 6: And Jane over here, and then I'll come back this way.

[0:20:14] Voice 5: Just a comment on truck communication. In the last term, I also asked that only a

[0:20:20] Voice 5: allow interpretation rental one on a property where there is a full-time resident so that's

[0:20:26] Voice 5: those are the galleons uh so and all the tup's it's quite a long time ago they are not they're

[0:20:33] Voice 5: no longer in that um i did want to make a quick comment or question about where things are in

[0:20:44] Voice 5: uh with indigenous uh communities because we have several things that are that are backed up

[0:20:51] Voice 5: awaiting consultation so i'm wondering what form that consultation

[0:21:00] Voice 5: some of the

[0:21:02] Voice 5: applicants can expect uh some information regarding that

[0:21:12] Voice 5: we had a big contact we had a meeting with a month or two ago where we introduced a number

[0:21:18] Voice 5: of applications um we understood at that time we were only allocated 30 minutes so we could

[0:21:24] Voice 5: only introduce the topics we couldn't have a full discussion and gather their suggestions

[0:21:31] Voice 5: or opinions on them um in light of specifically Connecticut going through elections we've been

[0:21:37] Voice 5: respectful of that as they're going through transition so we are going to staff are going

[0:21:43] Voice 5: to send another email hopefully at the end of this month to catch base um to get the to see if they

[0:21:49] Voice 5: have the opportunity or time to look at those applications and also the groundwater sustainability

[0:21:55] Voice 5: project in order to find together the comments and those do are there some guidelines now from

[0:22:01] Voice 5: in the province about how they would see a safe place at the local government level?

[0:22:06] Voice 5: Well, the guideline from the province is to consult, right?

[0:22:09] Voice 5: And so the island's trust, we go above and beyond that.

[0:22:13] Voice 5: So internally, so there's no necessarily provincial requiring outlining the steps,

[0:22:21] Voice 5: but generally what happens is we try to, specifically for a rezoning application,

[0:22:26] Voice 5: when we receive a rezoning application,

[0:22:29] Voice 5: application and when we get to the point where we're drafting bylaws which you try to send an early referral letter just

[0:22:35] Voice 5: letting the local first nations know what the application um after first five or the final

[0:22:43] Voice 5: official referral if you will and then we send another

[0:22:50] Voice 5: Another notice right before the public hearing to notify them in the past.

[0:22:55] Voice 5: Great.

[0:22:56] Voice 5: In the back, Sandy.

[0:22:58] Voice 5: Yes, I came here today to hope that you will deny the application.

[0:23:03] Voice 5: We have the application in Montague.

[0:23:07] Voice 5: The best incentive for compliance with local bylaws is when somebody is about to sell their

[0:23:11] Voice 5: property.

[0:23:13] Voice 5: There's nothing to continue with the practice by the new owner.

[0:23:18] Voice 5: otherwise it will also serve to encourage others to be safe i'm in support of the neighbors and

[0:23:24] Voice 5: the water system operators and users who have noted the many infractions and disturbances

[0:23:29] Voice 5: regarding this child and i believe it is the responsibility of the state to bring the estate

[0:23:35] Voice 5: to bring the property into compliance the mandate of the items first gets served by denying the

[0:23:41] Voice 5: application i have a comment on another matter i think that there are provincial guidelines for

[0:23:47] Voice 5: engagement with first nations i think they're still in effect and uh so you might want to refer

[0:23:53] Voice 5: to those as well for local governments to be able to do that

[0:23:59] Voice 6: um indeed i think as uh

[0:24:04] Voice 6: stopped i'll mention there are some provincial guidelines and uh i think most of us recognize

[0:24:11] Voice 6: that you know the official referral process is woefully inadequate and uh has a long way to go

[0:24:18] Voice 6: i think even to approach respectful so when when the planner mentions that we go up beyond the

[0:24:25] Voice 6: provincial um standard i think that's that's a fair statement the province is pretty it's pretty

[0:24:32] Voice 5: uh uh lackluster they're sort of bare bones but um go to this gentleman here my name is lauren

[0:24:41] Voice 5: I represent the Montague Improvement District. We supply a safe and secure potable water

[0:24:48] Voice 5: source to a lot of the residences in and around the student's property. We are in receipt

[0:24:54] Voice 5: of a letter from those residents on the arm that serves the student's property. I realize

[0:25:00] Voice 5: that the variances that the property owner has applied for is not applied to the rear

[0:25:06] Voice 5: of the property where the uh the previous um don scoons erected a fence and hedge at the rear of

[0:25:14] Voice 5: the property that happens to be um on what we believe is road allowance and right over top of

[0:25:20] Voice 5: our montague improvement district infrastructure so um while our concern is not with any of the

[0:25:25] Voice 5: other variances it is with this particular because we need to be able to access number one our

[0:25:30] Voice 5: infrastructure for repairs and for ongoing maintenance and improvements when when being

[0:25:36] Voice 5: necessary and uh we just want to make sure that whatever happens or transpires that that

[0:25:42] Voice 5: the islands trust people do not look past the fact that there is a there is a breach

[0:25:49] Voice 5: or a or an illegal barrier put there which impedes our ability to service our infrastructure

[0:25:57] Voice 5: So I just want to bring that to your attention. I want to make sure that we have unfettered access to that infrastructure, regardless of who owns

[0:26:04] Voice 5: the property, right?

[0:31:32] Voice 5: benefit. Maybe as suggested, move the hedge and the fence to ensure that MID has access

[0:31:41] Voice 5: to its infrastructure and services. Secondly, I would encourage the trustees to look closely

[0:31:51] Voice 5: at some of the recommendations surrounding the accessibility building. Don't approve

[0:31:58] Voice 5: any of the minor setback variances requested. Put those into abeyance until the nature issue

[0:32:07] Voice 5: of lot coverage and use of the accessory dwelling can be addressed. Then deal with the setbacks

[0:34:13] Voice 5: When someone stands on that parking lot, we can see the toes of their shoes when they're on the edge because the parking lot goes right to the property lot.

[0:34:27] Voice 5: The other thing I'd like to point out on this area photograph is the float. There's a development

[0:34:34] Voice 5: permit for the float, but the current regulation for float size is 35 square meters. This float is

[0:34:42] Voice 5: 1.9%, so over 90% larger than what was in the rules. But I would ask that the development permit

[0:34:54] Voice 5: for the float we looked at,

[0:34:56] Voice 5: because I know that that float is bigger

[0:34:59] Voice 5: than what was specified in there.

[0:35:01] Voice 5: And I also know that Mr. Dingman is going after people

[0:37:41] Voice 5: situation so i just like to point that out

[0:39:20] Voice 5: field and all that. I call it the flat top. It's basically an aircraft carrier with grass on it

[0:39:26] Voice 5: And the deer used to run across it and jump over the six foot fence and come right into our yard.

[0:39:31] Voice 5: It's a problem with what sits there right now.

[0:39:34] Voice 5: Then there's the point four law, which is just by the accessory building.

[0:39:40] Voice 5: That law's purpose is to hold the back of the soil so they can put the illegal accessory building on it.

[0:43:18] Voice 5: need to do when you're dealing with setbacks. And so I selected five criteria that were applicable

[0:43:24] Voice 5: to the spoons law. And I applied that five criteria to 14 violations, which means I took

[0:43:32] Voice 5: a lens five lenses and looked at 14 violations so i'm basically assessing those violations 70

[0:43:40] Voice 5: different ways and the outcome of that assessment was so clear that this is not reasonable that

[0:43:48] Voice 5: there the the violations um should not be um picked up in the development experiment

[0:43:54] Voice 5: experiment and um and the analysis shows that and i would ask that um that the islands trust um look

[0:44:02] Voice 5: at that um the other thing is since i've compiled a list of suggested actions i suggest that the um

[0:44:12] Voice 5: island stress denied the proposed evp is written request vital enforcement to remove all the

[0:44:17] Voice 5: previous review all the previous dvps bps bes for conformity because the paperwork doesn't match

[0:44:25] Voice 5: what's really there request staff to compile an exhaustive list of violations on the property

[0:44:31] Voice 5: we're not even congruent on what the violations are they're numerous request staff to carry out

[0:44:37] Voice 5: setback variance impact assessment like what i did but i'm just a property engineer i believe

[0:44:43] Voice 5: they need to carry out their own and recommend corrective action review the existing quote

[0:44:48] Voice 5: sites with the enforcement officer review the authenticity of designating the structure as an

[0:44:54] Voice 5: accessory building order a geotechnical report to assess the safety of removing the rock retaining

[0:44:59] Voice 5: walls located in dpa 7. order environmental study on how to mitigate the impacts in the epa 2 area

[0:45:07] Voice 5: initiate a development permit to define the physical work that will be undertaken to bring

[0:45:12] Voice 5: the property into compliance with all applicable violence file an authoritative letter untitled

[0:45:19] Voice 5: advising prospective purchasers that the entire property is under regulatory review

[0:45:25] Voice 5: and removal of structures in the setback areas may be required somebody's going to get sued

[0:45:30] Voice 5: the authorities keep the adjacent property under surprise of the progress made so this doesn't

[0:45:36] Voice 5: just sort of fall into the uh the backdrop um and i've got a request for um a number of documents

[0:45:44] Voice 5: so that i can verify um development permits um there's three documents on title that i

[0:45:50] Voice 5: i can't get so i would like to be able to look at that and so i can provide the appendix a

[1:24:53] Voice 6: lot lines um so that's deciding uh the existing woodshed pump house within zero meters in the

[1:25:01] Voice 6: front lot line and the existing dwelling within 6.7 meters for front line so concerns with either

[1:25:09] Voice 6: of those that

[1:25:11] Voice 5: one as well i thought was closer to minor not in the instant of course um i do

[1:25:17] Voice 5: think the idea of having to move the home uh i think that's a fact i think it needs it i think

[1:25:23] Voice 5: it's fine i don't think it's a major uh major concern and with the pump code um it is oversized

[1:25:31] Voice 5: from what it should be it's more than 10 square meters isn't it it would be oversized in terms

[1:25:38] Voice 5: of being exempt from the setback requirement but because it's over 10 meters squared it has

[1:25:46] Voice 5: to work it has to be setbacks yeah and i think due to the nature of the small lot as well the

[1:25:52] Voice 5: placement of the well your choices get pretty limited we have a lot of uh spacing conflict

[1:25:58] Voice 5: with septic and all that too so it would be um i do find that one um okay um do we move on to

[1:26:13] Voice 6: there's four here um and this is to the uh setbacks of at least six meters from

[1:27:43] Voice 5: the problem on meter planning because we end up in situations like this and we need to make a

[1:27:50] Voice 5: decision not to bring this back into um i don't know yeah at least impactful

[1:28:03] Voice 5: talking about 50 years from now we're talking about 100 years from now and what's going to

[1:28:12] Voice 5: to a property down the road this whole area is considered like an estuary a lot of outflows a

[1:28:18] Voice 5: lot of water going to that part putting those um rock walls in it has influenced that already

[1:28:26] Voice 5: so how do we make the best choices here i am not a geotechnical person that is not my thing but i

[1:28:33] Voice 5: don't think that we have the location to make that decision we need to get through there yeah

[1:51:12] Voice 5: The site of where the proposed TUP area is located is actually on the residential portion

[1:51:18] Voice 5: of the property and it's actually not visible from the visitor accommodation use of Bodega

[1:51:26] Voice 5: Ridge.

[1:51:27] Voice 5: The applicant is requesting, as I mentioned, temporary employee accommodation use and as

[1:51:34] Voice 5: a condition of the TUP, the recreational vehicles will be required to connect to a water system

[1:51:40] Voice 5: and also a new septic system.

[1:51:45] Voice 5: A temporary use permit, the purpose of this is to allow a use

[1:51:49] Voice 5: that's not currently permitted by zoning,

[1:51:52] Voice 5: and it also allows the permit to include certain conditions,

[1:51:56] Voice 5: which this unwrong permit does have.

[1:52:00] Voice 5: The LTC also has the option to amend the temporary use permit

[1:52:04] Voice 5: to add in additional more restrictive conditions,

[1:52:08] Voice 5: And I have included one of those in the staff report on page 73, and a draft condition that

[1:52:17] Voice 5: the LTC may want to include in is compliance with the screening and landscaping regulations

[1:52:25] Voice 5: of the Galliano-Water Land Use By-law.

[1:52:29] Voice 5: The applicant has mentioned that they're hoping to make this use permanent in the future with

[1:52:34] Voice 5: permanent buildings.

[1:52:35] Voice 5: and at that time when those permanent structures go in there will be a requirement to comply with

[1:52:42] Voice 5: this lab use bylaw regulation so that will certainly be a requirement down the road

[1:52:46] Voice 5: um the applicant's rationale uh the applicant provided a letter that's attached to the staff

[1:52:54] Voice 5: report and the rationale for the temporary employee housing use is in order to properly

[1:53:00] Voice 5: services and needs of this growing business. The project will also contribute to the local

[1:53:05] Voice 5: community by providing amenities to local residents in the area and on the island without any, sorry,

[1:53:16] Voice 5: providing amenities to the local residents. Additionally, by providing staff housing,

[1:53:22] Voice 5: which is so needed on Galliano and actually most of the Gulf Islands here. So it's really,

[1:53:28] Voice 5: really important to provide this um the tup notice was circulated and we received an overwhelming

[1:53:38] Voice 5: amount of correspondence with this application um i think we were just under 70 pieces of

[1:53:45] Voice 5: correspondence um 65 of those were in support of the application five of those were in opposition

[1:53:52] Voice 5: The opposition was related more so to the visitor accommodation use, but there was also

[1:53:58] Voice 5: concerns regarding water and potential septic field requirements.

[1:54:04] Voice 5: So I thought I'd just mention those as well.

[1:54:06] Voice 5: The correspondence that was received after the close or when the agenda was posted was

[1:54:15] Voice 5: circulated to the trustees.

[1:54:18] Voice 5: So staff have recommended approval of this temporary use permit and that's based on the fact that the TUP would provide a temporary solution for lack of affordable employee housing on Galliano Islands.

[1:54:33] Voice 5: The TUP also meets the OCP objectives. There were an overwhelming amount of support for the application.

[1:54:42] Voice 5: application, and the TEP is supportable when we adapt it to a number of Galliano businesses.

[1:54:50] Voice 5: recommendation on page 70 of the agenda to approve the issuance of the

[1:54:56] Voice 5: TEP for a period of three years.

[1:54:58] Voice 5: There are also alternatives the LTC may consider, and those are outlined on page 74 of the agenda.

[1:56:08] Voice 5: property bodega cove came with a staff house that's on the sorry another corner of redlands

[1:56:12] Voice 5: which we made into a staff house which is on the waterfront which isn't ideal for numerous reasons

[1:56:19] Voice 5: like it's close to neighbors uh we have a very robust well at the ridge property where this site

[1:56:25] Voice 5: is versus the waterfront where i don't think anyone should ever be overconfident in their

[1:56:29] Voice 5: or their water supply in such a location.

[1:56:32] Voice 5: And then the other properties that think

[1:56:34] Voice 5: geranium has even less.

[1:56:36] Voice 5: It has a new business that we're opening

[1:56:37] Voice 5: that will service all the more thin

[1:56:39] Voice 5: with groceries and a cafe.

[1:56:42] Voice 5: So this isn't just for off-island tourists,

[1:56:45] Voice 5: it's also going to help out the community.

[1:56:49] Voice 5: As far as water use though, we've got a lot of water.

[1:56:52] Voice 5: And if anything, our net water is gonna go down this year

[1:56:55] Voice 5: because we've moved all of our commercial laundry

[1:58:05] Voice 5: accommodations and uh it was good to hear about the water as well you know figuring out the water

[1:58:12] Voice 5: use and and um so yeah i mean this is something i campaigned on i mean this is the type of um

[1:58:20] Voice 5: you know for tup's this is what we were looking to have and um yeah i'm ready to move ahead with

[1:58:26] Voice 5: this one um so i'm going to make the motion that the galliano island local trust committee approved

[1:58:32] Voice 5: issuance of temporary use permit gl tup20233 keeper for a period of three years so we'll just

[2:25:48] Voice 5: We've had this conversation with them and they just don't seem to want to go down there.

[2:25:53] Voice 5: road which is remarkable concerning that dining homes being increased use of tiny homes is

[2:26:00] Voice 5: isn't but you know you see it in every community now so yeah and then we're getting that to that

[2:26:06] Voice 5: point is the uh the bc building code and there's been a lot of uh a lot of requests to update that

[2:26:13] Voice 5: to make tiny wellington specifically tiny homes on wheels um you know easier to comply with those

[2:26:21] Voice 5: codes and the products came out a few months ago and essentially said no yeah which doesn't make

[2:28:33] Voice 5: items trust that many years ago when i was on the lpc where we felt that for a long time

[2:28:38] Voice 5: it will get and uh nothing has happened it's like years and years and it's so frustrating but i mean

[2:28:46] Voice 5: i'm not blaming anybody i'm not blaming any of you because i'm not blaming my own health even

[2:30:43] Voice 5: to go through, but it's doable. At least we know it's doable, right? And if it was trust

[2:30:52] Voice 5: led or what, you know, if it was led a different way, I think it's doable as well. I think

[2:30:58] Voice 5: know it's it's quick easy affordable most and you know how much it was you better put up with

[2:31:06] Voice 5: the official reporting of affordable housing right you've got some five hundred thousand dollars

[2:31:11] Voice 5: yeah oh it seems that now it's probably six fifty yeah yeah

[2:31:29] Voice 5: and have a mobile home that belongs to a affordable housing society that would have a relationship

[2:31:40] Voice 5: with the landowner and the people involved in the flood,

[2:31:44] Voice 5: for it will happen because for the society,

[2:31:48] Voice 5: and allow them to put pads here as long as they have enough water,

[2:31:52] Voice 5: and as long as it couldn't be used for STVR

[2:31:56] Voice 5: or anything like that, and once that agreement between those two

[2:32:00] Voice 5: partners was breached, then the mobile home

[2:32:04] Voice 5: would go back. Well, this is exactly why I'm working with Paul Brent

[2:32:08] Voice 5: and staff on seeing whether the CRD should develop an agreement that they can register

[2:32:15] Voice 5: on title so that that's feasible, so that's doable, because it's really difficult to get

[2:32:21] Voice 5: it with housing groups because you're, I mean, geez, we're all dealing with volunteers.

[2:32:26] Voice 5: Everybody is, you know, every housing group is a volunteer group, and so we're loading

[2:32:30] Voice 5: this onto them.

[2:32:31] Voice 5: So if we can develop one through the CRD that they can register on title and say, you know,

[2:32:37] Voice 5: you can do exactly that CRD would register on title for you know for the 10 years or whatever

[2:32:43] Voice 5: it is that you're doing and we can move ahead with that but hopefully this we we can find some

[2:32:50] Voice 5: headway here well this is the process we're working through right hoping having the CRD on

[2:33:02] Voice 5: side involved in the housing agreement will give them incentive to participate a little bit easier

[2:35:07] Voice 5: um review going on at the property from the point of view that a prospective owner

[2:35:13] Voice 5: would not assume that what you saw on the property was necessarily what was going to um

[2:35:19] Voice 5: remain you may have maybe kate wouldn't take it off but it would be on the onus of the owner to

[2:35:25] Voice 5: take new orders but it just seems that either this or either the state or the ltc or the realtors are

[2:35:35] Voice 5: open to lots and right now because we've been um party to um prospective purchasers walking along

[2:35:43] Voice 5: the property and they they simply aren't aware nor is the realtor really telling them everything and

[2:35:50] Voice 5: i don't think they know a lot but it would seem to me that an authoritative letter on title

[2:35:55] Voice 5: would make it very clear to the realtors that you know it's a beautiful piece of property

[2:36:06] Voice 5: done in a situation like this okay we just like hope nobody gets sued no i don't believe that

[2:36:18] Voice 5: issues that it can be delivered but if you have questions about that process i would

[2:36:24] Voice 5: really recommend speaking with one of them officer and there is also information regarding this

[2:36:40] Voice 5: in my i'm sincerely saying that it's really to protect the other parties i don't think

Trustee Gauvreau provided a report that included a description of meetings she recently 
attended. She noted that Galiano was well represented at the Islands Trust Conservancy. 
Trustee Mabberley provided a report that described recent consultation with the Capital 
Regional District and Islands Trust staff regarding an agreement that would facilitate affordable 
home ownership. He acknowledged the passing of three Elders since the last Trust Committee 
meeting.

 Noted the Financial Planning Committee had been meeting frequently in anticipation of 
the March Trust Council meeting 
 Described the integrated corporate planning process to which the Trust Council is

6. FIRST NATION REPORT 
It was noted that today is the election of Chief and Council on Penelakut Island. 
7. TOWN HALL AND QUESTIONS 
Town hall was held and the following comments were made: 
 The Trust is made aware when a Temporary Use Permit expires and monitors to see if 
there is continued use; bylaw enforcement followed up with all those whose Temporary 
Use Permits have expired 
 Islands Trust staff met with members of Penelakut Tribe and introduced a number of 
applications; staff will follow up at the end of this month to see if Penelakut has had the 
opportunity to review the applications 
 The official referral process outlined by the Province is inadequate and the Islands Trust 
attempts to go above and beyond it 
 
The following comments were made regarding GL-DVP-2023.5 (Scoones): 
 
 Support was expressed for denying GL-DVP-2023.5 (Scoones) as an incentive for other 
property owners to respect bylaws, and given concerns raised by neighbours and water 
operators 
 It is the responsibility of the estate to bring the property into compliance 
 An illegal barrier (hedge and fence) impedes service infrastructure supplied by the 
Montague Improvement District that wants to ensure unfettered access 
 The accessory building should be moved 
 Some of the bylaw infractions have impact beyond the property line 
 To receive a variance, the landowner should provide a community benefit 
 Islands Trust staff should compile an exhaustive list of violations on the property, carry 
out a setback impact study, review existing float size, examine the authenticity of 
designating the structure as an ‘accessory building’, order an environmental study 
regarding development in the ecologically sensitive areas, and file a letter on title 
advising prospective buyers that the area is under review

15.2 GL-DVP-2023.5 (Scoones) - Staff Report 
Planner Belcher reviewed the staff report related to GL-DVP-2023.5 (Scoones). The 
applicant noted that, as the executor of the estate to which the property belongs, she is 
required to sell the property. Discussion was held and the following comments were 
made: 
 
 Concern was expressed about the fence and pump house near the district water 
line 
 The fence should not have been erected, and perhaps the Montague 
Improvement District can put a structure on the property (e.g. a manhole-cover 
sized cap that notes “Property of Montague Improvement District – do not 
remove”) 
 The sale agreement of the property should include a provision that ensures the 
fence will eventually be moved

 A future owner might assume that everything within the fence would belong to 
them, however, the fence lies on the Ministry of Transportation and 
Infrastructure’s right of way

 It is not fair to reject the application and not provide a path forward for the 
applicant 
 Pulling down the rock walls would likely create more damage 
 The accessory building was especially contentious with the neighbours and 
addressing it might be a plausible path forward 
 The applicant should seek a compromise with the neighbours, and might 
consider producing a record of neighbourhood consultation 
 The Local Trust Committee should specify on what exactly the applicant should 
follow up

Town hall was held and the following comments were made: 
 Concern was expressed about the impact of climate change (e.g. heavy rains) causing 
damage to the GL-DVP-2023.5 (Scoones) property 
 The previous owner of the Scoones property was a skilled builder who worked on many 
successful projects and would have applied his skills to the subject property 
 The bylaw infractions described in GL-DVP-2023.5 (Scoones) would be the responsibility 
of the new property owner if the property sold 
 The Islands Trust does not have authority to add an authoritative letter on title to notify 
prospective buyers of non-compliance 
 It is perhaps time to change the Galiano Island Official Community Plan to allow for the 
creation of mobile home parks 
 Creating a mobile home park could be a project initiated by the Local Trust Committee, 
or someone could come forward with a rezoning application to do so 
 A lot of requests have been made to allow tiny homes to comply with the British 
Columbia Building Code, and the Province has said “no” 
 The Regional Planning Committee’s Affordable Housing Toolkit on the Islands Trust 
website outlines options that the Local Trust Committee can consider 
 GL-TUP-2023.3 (Keefer) is a good example of getting quick, easy and affordable housing 
– the applicant had a septic field engineered for four trailers and got a water license 
with the Vancouver Island Healthy Authority 
 GL-TUP-2023.3 (Keefer) application has received a lot of interest from other islands
