[0:00:30] Voice 12: that the land and the waters on which we're living

[0:00:34] Voice 12: and working are the traditional, ancestral,

[0:00:36] Voice 12: ancestral and current territories of many Coast Salish First Nations and I was actually looking

[0:00:42] Voice 12: at which nations have territorial interests and rights here and I just wanted to read them out

[0:00:48] Voice 12: because I think often we skip by so quickly and say well Coast Salish peoples but these are

[0:00:55] Voice 12: different times and I want to take this space to just acknowledge that many many folks have

[0:01:02] Voice 12: been calling these islands home for a very long time um so the skidi were in the territorial area

[0:01:09] Voice 12: of cowichan tribes pomox first nation liakson qualicum uh seashells guamish

[0:01:31] Voice 12: Tla'aman, this is actually a treaty area for the Tla'aman people, it's Basit, Wiwaiqan,

[0:01:43] Voice 12: Wiwaiqai, Tla'alt, I think that's it.

[0:01:48] Voice 12: Justice, do you have any thoughts about the local knowledge of this?

[0:01:59] Voice 12: um yeah did you want to offer any thoughts about

[0:02:09] Voice 10: um just thank you chair for uh houses for volume out there

[0:02:16] Voice 10: good yeah okay uh thank you chair for taking the time to mention the name of all of those nations

[0:02:25] Voice 10: Certainly, we're in a different era in terms of the province's DRIPA declaration and the

[0:02:36] rights of

[0:02:37] Voice 10: First Nations, which of course are consistently being upheld by the courts.

[0:02:45] Voice 10: Just a bit of that.

[0:02:47] Voice 12: Yeah.

[0:02:48] Voice 12: Thank you.

[0:02:51] Voice 12: okay so we do want to acknowledge that while there's a historical relationship there is a

[0:02:58] Voice 12: present day relationship but we're still navigating how to do governance in in all of

[0:03:04] Voice 12: the islands that we're trusted to to make land use decisions from um so i'm joined today by

[0:03:11] Voice 12: your local trustees kim peterson sorry and our island planner steven claw thank you

[0:03:20] Voice 12: you. Catherine Boat, our minute taker, is in the background. Hello, Catherine. And we're

[0:03:27] Voice 12: supportive. This is probably the last meeting that Will in the office in the North Island

[0:03:34] Voice 12: will be helping us folks because she's retiring and we're all very sad. Will has been an incredible

[0:03:41] Voice 12: administrative support in all things in the North Island. So this meeting is being recorded

[0:03:48] Voice 12: and live stream just so that you know and it'll be uploaded about five days afterwards um i do

[0:03:54] Voice 12: want to just recall everyone that we have a protocol in place for how to address the local

[0:04:01] Voice 12: trust committee that's in the workplace and so the regular um principles and respect decorum

[0:04:07] Voice 12: and kindness let's all be kind to one another um i'll review sort of the meeting uh procedures

[0:04:14] Voice 12: Just a few things about agreement on the length of time and when what you can speak to.

[0:04:25] Voice 12: We are dealing with some applications today so the applicants will have time to speak to their application when we come to that part of the agenda.

[0:05:58] Voice 10: uh not a lot to report on the local uh trust committee front um we haven't had a meeting since

[0:06:05] Voice 10: since December 11th. But on the Trust Council front, of course, the Financial Planning Committee

[0:06:16] Voice 10: has been meeting in preparation for March's Trust Council budget deliberations and there's

[0:06:25] Voice 10: been a lot of work done there to try and reduce the potential tax increase and of course that

[0:06:33] Voice 10: will be finally decided by press council as a whole um the other thing that's been going on a

[0:06:40] Voice 10: lot a lot of meetings is the uh hiring committee for the new chief administrative officer who's

[0:06:46] Voice 10: in june so there's a lot of time that's been spent to to uh get ourselves set up for a good process

[0:06:55] Voice 10: for that so i'll leave it at that today

[0:07:07] Voice 12: but um as we are going to cover in the agenda the new rules passed down by the bc government

[0:07:15] Voice 11: church from rental is something that's super interesting and the trust area has not yet decided

[0:07:20] Voice 11: if it's something we're going to adopt so that will be i believe a discussion i just got the

[0:07:24] Voice 11: agenda this morning i'm 100 sure but on the

[0:07:27] Voice 12: trust council we'll definitely be talking about it and

[0:07:30] Voice 12: how it affects even if it's something we want so and it's a very very interesting because it's

[0:07:37] Voice 11: most when they there's new rules it's everything's grappled in and that's not going to be happening

[0:07:42] Voice 11: with this short-term rental it's all

[0:07:45] Voice 12: new so that's about

[0:07:47] Voice 12: it thank you yes in this agenda there is a

[0:07:52] Voice 12: report from staff uh about the implications of the new housing statutes bill 44 and the

[0:08:00] Voice 12: short-term vacation accommodations rentals bill um it's actually yes we'll discuss that when it

[0:08:07] Voice 12: come to it it's actually up to each local trust committee to decide if they want to opt in uh so

[0:08:14] Voice 12: we'll have that discussion um i i don't think there's any implications for liskiti but um

[0:08:21] Voice 12: definitely are

[0:08:22] Voice 12: seen on some other islands that don't

[0:08:24] Voice 12: have or they want

[0:08:26] Voice 12: those provincial

[0:08:29] Voice 12: sort of

[0:08:30] Voice 12: enforcement measures, they are

[0:08:32] Voice 12: choosing to opt in. So we have a chance

[0:08:34] Voice 12: to see how that's going to work on other

[0:08:36] Voice 12: islands, and there will be another

[0:08:38] Voice 12: chance every year to opt in

[0:08:40] Voice 12: or not. So anyway, we can get into that later.

[0:08:42] Voice 12: For my chair's report,

[0:08:45] Voice 12: I'm involved in the regional

[0:08:46] Voice 12: planning committee, and that's

[0:08:48] Voice 12: been doing some

[0:08:50] Voice 12: Good work. We've only got a modest budget request for $30,000 in the next budget to support the housing strategy action plan.

[0:09:01] Voice 12: So there's been a housing toolkit developed with a whole raft of policy options that a local trust committee can say,

[0:09:11] Voice 12: oh, we want that policy in our OCP. And so it sort of expands the toolkit for what is possible.

[0:09:18] Voice 12: and now we need to address the housing strategy so how are we going to work with the other level

[0:09:24] Voice 12: of government in the province to enact solutions that are appropriate for local rural islands so

[0:09:32] Voice 12: definitely not looking at a you know four plexus on every lot or to develop two densities on every

[0:09:39] Voice 12: lot that's not happening it's what is a strategy to address the current and future housing needs

[0:09:45] Voice 12: for local trust committees. By-law enforcement is sort of a theme for the Regional Planning

[0:09:52] Voice 12: and the Islands Trust if you've been watching. We did a voluntary request to the Ombudsperson's

[0:09:58] Voice 12: office to review the Islands Trust policies and practices and they've given us some really good

[0:10:05] Voice 12: suggestions that staff are going to be working to implement and that's going to staff will work with

[0:10:10] Voice 12: regional planning committee to review assess implement the recommendations through changes

[0:10:16] Voice 12: in policy practices and staff training and communication so that's probably going to

[0:10:21] Voice 12: roll out over the next year and a half um so it's going to be slow changes but um probably more in

[0:10:28] Voice 12: the area of communication like what is the bylaw complaints policy how does that work in practice

[0:10:35] Voice 12: and if you have issues like what is the process that people can follow um the province just on

[0:10:42] Voice 12: the housing front I don't know if everybody knows this because it just came out a month ago maybe

[0:10:48] Voice 12: the province has expanded the secondary suite incentive program so I don't know if that could

[0:10:54] Voice 12: apply for Laskiri but this is you can get up to forty thousand dollars in a forgivable loan

[0:11:00] Voice 12: to build a new secondary suite in your house and so that is a new support for the provincial

[0:11:08] Voice 12: government and includes regional districts so previously were excluded now regional districts

[0:11:13] Voice 12: are a part of that homeowners must be located on the same property and the unit must be rented out

[0:11:19] Voice 12: at below market rates which are set by bc housing so this is specifically to incentivize

[0:11:24] Voice 12: rental streets for housing and finally on the housing front not all i do but it's just been

[0:11:31] Voice 12: a busy month on that we are doing housing needs assessments but we received a grant from the

[0:11:39] Voice 12: deputy minister of housing for 127 000 to do those housing needs assessments so um that's not

[0:11:46] Voice 12: going to be money that comes out of local government or our island's trust budget so

[0:11:52] Voice 12: So all of the housing needs assessments are due to be updated this coming fiscal year.

[0:11:56] Voice 12: So that's going to save trust area residents about $110,000 that otherwise would have had to be put in the budget.

[0:12:02] Voice 12: So thankful to the province for kicking in some money there.

[0:12:07] Voice 12: And that's probably it for my report.

[0:12:12] Voice 12: Sorry, that was very housing focused.

[0:12:18] Voice 12: We don't have an electoral area director's report.

[0:12:21] Voice 12: i saw director fall and he was running for the ferry um he said there's no update on the wildfire

[0:12:29] Voice 12: urban interface program but he'll let us know as communications hold up i think he's going to a

[0:12:37] Voice 12: climate caucus or something anyway he was in a rush he said he sends his apologies all right

[0:12:45] Voice 12: so let's move into town hall um so this is your opportunity to address the local trust committee

[0:12:51] Voice 12: uh on three things matters that are relevant to local trust committee first so business that's

[0:12:57] Voice 12: on this agenda preferably um matters of regional importance or things that you see in the trust

[0:13:03] Voice 12: council area generally um so we do uh request that everyone directs comments to the ltc

[0:13:11] Voice 12: not to the audience or staff if we need to ask staff a question we can ask them a question

[0:13:16] Voice 12: or we'll check back for information and come back to you sometimes we don't have all the

[0:13:21] Voice 12: information right at our fingertips but I know your local trustees are very responsive and we'll

[0:13:26] Voice 12: try to get your answers speak to the issue at hand not to other individuals be clear concise

[0:13:32] Voice 12: and respectful I'll ask each speaker to limit themselves to three minutes until we've gone

[0:13:38] Voice 12: through everybody who wants to speak and then if you want to speak a second time put up your hand

[0:13:43] Voice 12: it will give you some extra time but if we go overly long I may have to just cut it short so

[0:13:48] Voice 12: we can all get back to our whatever we're doing today all right who would like to yes can I just

[0:14:19] Voice 11: favor of the recommendation of the staff recommendation in the report that states to

[0:14:24] Voice 11: proceed no further with the application, I believe that 7.1 on your agenda. I think the staff report

[0:14:31] Voice 11: is well set out i think it explains exactly why i feel this way i wrote a letter earlier um we've

[0:14:38] Voice 11: just been going through a huge ocp review in which the community really stated quite clear that they

[0:14:44] Voice 11: would like to reduce our carbon footprint um i think going ahead with something like this simply

[0:14:49] Voice 11: gives more leeway to more vehicles that can provide us with more carbon so i really do

[0:14:57] Voice 11: to support the staff reporting is well done thank you very much

[0:15:00] Voice 12: okay thank you um moving this way

[0:15:06] Voice 12: sir oh i'm i first of all would one of you tell sonja that we don't have a bylaw enforcement

[0:15:29] Voice 12: I'm here primarily to talk about the application and I support what Susan just said.

[0:15:37] Voice 12: To me, since there has been a community plan, we've not favoured private docks.

[0:15:45] Voice 12: to discourage them. We encourage communal dock or community docks or neighborhood docks.

[0:15:52] Voice 12: There is a public access to the grave fairly closely where that is, and that would be nice

[0:15:58] Voice 12: to have. I would support that. But basically, my point of view is that it doesn't add anything

[0:16:04] Voice 12: to the public to have a private dock. In fact, it takes away the availability of a small

[0:16:11] Voice 12: a small amount of foreshore from the public to wander on to do whatever they want, it's public.

[0:16:18] Voice 12: When there's a private dock over it and on it, it removes that piece from the public access.

[0:17:06] Voice 12: is your business so i can't constrain you as a member of the public from doing what you wish

[0:17:18] Voice 12: no prohibition against quoting from documents i received from an foi if you wish but i would say

[0:17:26] Voice 12: say that I would want you to keep your comments as a non-personal nature. And so we are here

[0:17:36] Voice 12: to speak about business. And so if your quotes are to do with the business of the trust,

[0:17:43] Voice 12: then we can address that. If not, they don't have a place here.

[0:25:48] Voice 12: if you think four feet wide and the island the size is imposing on on your face you know that's

[0:25:54] Voice 12: It's called a false bait, as it is a false bait.

[0:25:58] Voice 12: If anybody knows that Southwest comes in there, it's not a safe type for anybody.

[0:26:02] Voice 12: Scooty Bay is not a joke.

[0:26:03] Voice 12: It's got a rock right in the middle of it, but there's no room to do anything.

[0:26:32] Voice 12: in case of emergency and which has happened there's a launch to attest to i mean there's

[0:26:40] Voice 12: absolutely no reason to have to cancel this application and furthermore if you look around

[0:31:23] Voice 12: last four years of public consultation and said, basically, we're spending taxpayer money to ask

[0:31:33] Voice 12: the taxpayers how to spend their money, but we don't have a capacity in the month before the

[0:31:40] Voice 12: budget is legislatively required to be finalized to actually make those changes. So it was felt

[0:31:49] Voice 12: that the public consultation was it just wasn't feasible we're in a really tight year and so we've

[0:31:57] Voice 12: been looking at where to cut and of course the public is always welcome to write in and uh tell

[0:32:03] Voice 12: us what where they think the um budget decision should be going so all the meetings are public

[0:32:10] Voice 12: so that's the best we can do at this point all right so my understanding last year there was

[0:32:16] Voice 12: no public consultation my understanding of the public reason for that was because it was an

[0:32:22] Voice 12: election year even though privately the staff communicated to trustees that they just didn't

[0:32:28] Voice 12: feel it was necessary the year prior to that there was a public company completely ignored

[0:57:17] Voice 12: let me answer so we're doing measures like asking alternate chairs who live closer we're trying to

[0:57:23] Voice 12: move to more electronic meetings but as was seen this is not popular in many places Laskiti

[0:57:29] Voice 12: you've heard wants to have in-person meetings so why we're over budgeted I have explained

[0:57:36] Voice 12: explained several times and we've had email correspondence sir about this that a meeting

[0:57:41] Voice 12: facilitator was budgeted and was supposed to be doing some of the meeting minutes administration

[0:57:45] Voice 12: that person has not been in the role we haven't been able to find a suitable candidate and so

[0:57:52] Voice 12: the budget numbers are way off but they're consistent with what has been spent in previous

[0:57:56] Voice 12: physicals we're actually not over budget it was just the way everything was calculated for this

[0:59:41] Voice 12: overall for the year so the latest quarterly financial reporting um reports that were on

[0:59:49] Voice 12: on budget, where the money is spent is, you know,

[0:59:54] Voice 12: underspent here, overspent here, it balances out.

[1:30:00] Voice 12: don't and in considering an application for a dog environmental and social effects must be addressed

[1:30:06] Voice 12: um so so with regards to the environmental policies in the official community plan

[1:30:11] Voice 12: um there's several of these that are not met by the application um with regard to the social

[1:30:16] Voice 12: effects so the ocp does not provide much guidance as to what uh what things could be considered as

[1:30:24] Voice 12: social effects. So there's a couple of things that we could consider, consider wide variety

[1:30:30] Voice 12: things, I suppose. But there's a couple of things that I've mentioned specifically in the staff

[1:30:34] Voice 12: report. And one is just the impact of it to the existing use of the bay, where moorage is

[1:30:41] Voice 12: permitted in the zone currently. And the other is that it's been suggested the stock could be used

[1:30:48] Voice 12: for emergencies and so the application doesn't provide is this the application for a private

[1:30:55] Voice 12: doc and so it doesn't provide that information necessarily to ensure that it would be suitable

[1:31:02] Voice 12: for that purpose that there's those groups of people that are emergency service providers would

[1:31:10] Voice 12: be you know be secured to use the doc but there's an alternative in the staff report to request

[1:31:16] Voice 12: request additional information from the applicant to ensure or clarify whether the dock would

[1:31:21] Voice 12: be suitable for that purpose.

[1:31:24] Voice 12: At this point, there has not been any notice sent to the public with regards to this application.

[1:36:10] Voice 10: advance or deny this application. And so that's where I'm at at this point. I think we need more

[1:36:18] Voice 10: public process and we need more opportunity i think first to have that wider discussion and

[1:36:24] Voice 10: then out of that wider discussion that would inform how we proceed or not proceed with this

[1:36:30] Voice 10: particular application so that's that's where i'm at today thank you um

[1:37:46] Voice 8: the idea that we look at that before we look at my exact case makes so much sense.

[1:37:57] Voice 8: You know, I definitely had some worry on a statutory right-of-way that would be forever

[1:38:05] Voice 8: Forever on the property that I don't think it's very possible for myself or if we picked a couple of strategic places on that and for emergencies and other reasons why it might make sense to put in docs that right away should that should be one of the conditions of course because there has to be a way I from day one.

[1:38:28] Voice 8: developer has to be able to do it. I've never been, it's a very complicated thing, I've been painted with

[1:38:34] Voice 8: putting it in and bullying and I've never believed that and you know I don't want to go forward back

[1:38:42] Voice 8: on the past and all the work I did trying to respect the bio before I built the dock.

[1:38:48] Voice 8: Now we move forward, there's an application, some people say well he built it first so

[1:38:54] Voice 8: So, we've got to watch it.

[1:38:59] Voice 8: There's an application for an out of the case.

[1:39:01] Voice 8: There's a massive penalty for that.

[1:39:03] Voice 8: I've plugged my nose, paid it, just in the spirit of moving forward.

[1:39:11] Voice 8: But I do think a statutory right-of-way is a good idea.

[1:40:44] Voice 8: a post if that's what you got that the biologist was retained and the surveyors from conception

[1:40:53] Voice 8: every material that went in that doc and everything because it was important for me to meet

[1:40:58] Voice 8: and so i did everything i could and i think anybody else should to meet social environmental

[1:41:08] Voice 8: concerns do we do it at the time should there be a donation for future because i'm a big supporter

[1:44:05] Voice 12: The building of the dock that attaches from our land on the foreshore into the water,

[1:44:11] Voice 12: He's saying we could have accessed, we could have done the work to access water three years

[1:44:22] Voice 12: There's several processes.

[1:44:25] Voice 8: and when we did that, Phil, just to clarify, even before I did all that, the surveyors

[1:44:31] Voice 8: and the biologists agreed on exactly where that line is before i even took a tree down and did

[1:44:38] anything it was all mapped out all of the streams were picked where all the due diligence was done

[1:44:44] what happened after it all kind of blew up the first time is when the biologist and the

[1:44:51] Voice 8: and the surveyor looked at the wall they had a discrepancy of literally inches and instead of

[1:44:58] Voice 8: me saying no it's on you guys in the spirit of everything i just decided why don't i just make

[1:45:07] Voice 8: it right not let anything so it wasn't like i built that wall and then found out after

[1:45:12] Voice 8: oh my god like we had done everything we could stay within that and it was the top of the wall

[1:45:19] Voice 8: didn't change at all a couple of rocks were out a little bit in the when the biologist

[1:45:26] Voice 8: walked the natural boundaries of the sea for me with ribbons and said build here don't build there

[1:45:31] Voice 8: and then after the circuit we're talking inches that's all i needed and not with no complaints

[1:45:38] Voice 8: but it wasn't like oh he blazed him and built this thing and uh realized after he didn't get

[1:45:45] Voice 8: a survey so just

[1:45:55] Voice 10: a little bit to the point about the environmental and social concerns certainly when it comes to

[1:46:01] Voice 10: environmental there are professionals and i know you've hired them over the course of this project

[1:46:08] Voice 10: but i think that your point about the social concerns is has some merit in terms of

[1:46:18] Voice 10: there's no guidance in the it says right in the staff report the ocp doesn't give any guidance

[1:46:23] Voice 10: what could be considered social effect um and and so that's that ambiguity of course

[1:46:31] Voice 10: isn't helpful for someone uh making an application you know to try and meet the

[1:46:39] Voice 10: concerns when there's zero guidance in the ocp i've made a note of that um it's one of those

[1:46:47] Voice 10: things that maybe is a new moving target and an open to interpretation by the local trust

[1:46:53] Voice 10: committee of the day and and sometimes things are not big on purpose but i understand from

[1:46:58] Voice 10: the point of view of an applicant that's there's no helpful guidance there um

[1:47:06] Voice 12: well we're on that point yeah so a few comments um i did ask everybody in the day too by the way

[1:47:14] Voice 12: before i proceeded i had meetings

[1:47:15] Voice 12: with every stakeholder and every dealer so defining a

[1:47:19] Voice 12: community amenity or defining a social good that is the conversation that I

[1:47:26] Voice 12: think we're trying to have today and granted would have been helpful if it

[1:47:31] Voice 12: was on the OCP and before everything sort of unrolled but you know public

[1:47:36] Voice 12: discussions being what they are OCPs are kind of locked in time and the

[1:47:42] Voice 12: the opportunity to address that is when our communities change and people come forward

[1:47:50] Voice 12: with new things, climate change being one of them, housing concerns another, access

[1:47:55] Voice 12: or emergency exit.

[1:47:58] Voice 12: So things do need to shift.

[1:48:01] Voice 12: I guess the piece that I'm trying to remind everybody is that the OCP is your guideline

[1:48:09] Voice 12: and sort of your North Star.

[1:48:11] Voice 12: are these are the principles by which we want to govern ourselves right and it's your OCP this is

[1:48:17] Voice 12: not something I as an offline trustee am imposing on you it is your OCP it was created by this

[1:48:23] Voice 12: community and you're reviewing it which is great um and and I do agree that the the provision and

[1:48:32] Voice 12: you know I think by law 15 or policy 15 sort of the ambiguity of the public good

[1:48:41] Voice 12: or the social benefits and the environmental protection that's the direction that it's giving

[1:48:48] Voice 12: how it works out is this conversation today and maybe in the future and so that perhaps will roll

[1:48:56] Voice 12: back in and inform our ocp discussion for the future so this is real-time information this is

[1:49:02] Voice 12: great discussion to have and this is the right time to have it um so community amenities um it's

[1:49:11] Voice 12: It's a term that, you know, in the big cities, if a developer wants to build, you know, whatever, a 40-stage skyscraper and, you know, make a lot of money, they're often asked, well, what is the community amenity you're going to give?

[1:49:30] Voice 12: What's going to be the benefit to the community?

[1:49:32] Voice 12: You're going to make money.

[1:49:33] Voice 12: You're going to have your developer.

[1:49:35] Voice 12: That's what you do.

[1:49:36] Voice 12: What is the community trade-off?

[1:49:38] Voice 12: so if we can define that i think we're going to be closer to a conversation about

[1:49:47] Voice 12: rather than just yes no on the the what's in our bylaws right now but what does this community want

[1:49:54] Voice 12: in exchange for giving up you know public access to the foreshore if that's if that's the decision

[1:50:01] Voice 12: so just want everyone to think about that define that social good in our minds and and

[1:50:09] Voice 12: And what you're saying, perhaps a statutory right-of-way, a covenant, something that is, protects that as a semi-public access. I don't know. And I'm not going to impose my views here because I will be tarred and feathered if I do. I'm just saying, this is the conversation. This is the, it's sort of your community's decision, I think.

[1:51:26] Voice 11: So the decision here is, does the reasons that are given in the application justify or override the reasons the OCP has for not having a dog?

[1:51:45] Voice 11: the OCP, I mean our bylaw

[1:51:47] Voice 11: and bylaw infractions are not decided by trustees

[1:51:50] Voice 11: they are decided, it's community

[1:51:51] Voice 11: based, community process

[1:51:56] Voice 11: our population is growing

[1:52:02] Voice 11: the more bylaws are going to be broken

[1:52:51] Voice 11: this is something that should be given to the abc to figure out but my general talking people

[1:53:15] Voice 11: you know different ideas and talking about emergency docs but at the core of this it's

[1:53:20] Voice 11: a bylaw infraction that we're talking about and the rules have to be the same for everybody or

[1:53:26] Voice 11: It's not about whether there's moorings.

[1:53:27] Voice 11: It's not about whether the people who have the dot contribute to the community.

[1:53:31] Voice 11: I think that whether I like you or not, whether you're a good person or a bad person,

[1:53:37] Voice 11: I think that judging people by whether they have to follow the rules,

[1:53:54] Voice 11: against because I mean anybody came to Madeira Park there is a dog every I don't know 30 feet

[1:54:10] Voice 11: acceptance is I mean we're also talking about a precedent here right if we you know allow one dog

[1:54:18] Voice 11: are we going to allow more I know there's lots of places where people don't want dogs I mean

[1:54:21] Voice 11: you know, weather doesn't permit docks, you can lift them. There's options. I mean, you know,

[1:54:27] Voice 11: if they're not money, you can kind of do whatever you want. And we've received a lot of emails in

[1:54:32] Voice 11: support and against. But I mean, without a public hearing, we don't really know. It's often the

[1:54:39] Voice 11: people who are supporting the contentious issue that are going to write in opposed to people who

[1:54:46] Voice 12: were opposed i

[1:54:52] Voice 11: mean yes the doc is very to code and but that still doesn't give you an environment

[1:55:00] Voice 11: as possible it still doesn't give you a right to break the rules i mean these are just excuses i

[1:55:05] Voice 11: mean there's crown lounge there's four four four just

[1:55:16] Voice 11: so i mean i think that tim's point that as this is such a contentious issue that it should have

[1:55:22] Voice 11: have more of course public consultation but i also see that you know it is a sticky issue

[1:55:39] Voice 11: used by a lot of data decided by the community and they apply to everybody regardless of any

[1:56:00] Voice 12: possible. One of the things that I did notice with our first application and what was stated

[1:56:07] Voice 12: in those letters of opposition to our application previously was that we went ahead and put the dock

[1:56:15] Voice 12: in after the fact. Very few if any of those letters said there isn't a need for more dock space

[1:56:22] Voice 12: which i think is very important it's something that carl's brought up that the island is it's

[1:56:29] Voice 12: a small island with two access points one access point by transportation very and that's it it's

[1:56:39] Voice 12: not something where um again it's not something where people can come and go from as a whole

[1:56:46] Voice 12: any time, should anything happen to that dock, anything happen to that ferry, if there's

[1:56:53] Voice 12: a fire, if there's something that happens to the road, to the dock, it's a big problem.

[1:56:58] Voice 12: The island is basically shut down.

[1:57:02] Voice 12: More access points give the ability for people to come together as a community to get goods,

[1:57:10] Voice 12: food, people on and off the island.

[1:57:13] Voice 12: That's a given.

[1:57:15] Voice 12: and there isn't anybody that can deny that if they need to get off the island and the school's

[1:57:20] Voice 12: being built and the helicopter can't get there get here

[1:57:27] Voice 12: they get medical assistance with um our application we are willing to put in an easement on our land

[1:57:35] Voice 12: that allows in favor of the trust that allows access that is on title and it goes should we

[1:57:43] Voice 12: sell it goes to the next owner it's there and good to read okay it's something that uh there's no i

[1:57:54] Voice 12: mean you go through the ocp you can look at all sorts of things and say yes that works with a

[1:58:00] Voice 12: public doctor or a private doctor yes or no that doesn't work there's lots of things that um we can

[1:58:06] Voice 12: take and pluck out of there that meet our needs as an applicant um

[1:58:12] Voice 11: but

[1:58:13] Voice 12: i don't think that that's

[1:58:14] Voice 12: helpful i think that with the policy saying that dogs can be considered on a site-by-site basis

[1:58:20] Voice 12: that is applicable to our situation right now that's why we're here that's why you guys have

[1:58:25] Voice 12: accepted the application is because it is a site it's specific and this is you know social

[1:58:32] Voice 12: of considerations i would say are public consultation talking to people people coming

[1:58:38] Voice 12: here saying that they support it or they're against it i think that's the avenue forward

[1:58:44] Voice 12: should we delay the decision on what we do with this application based on

[1:58:50] Voice 12: the peers association's information to you guys i give that to you if you're willing to look at it

[1:58:56] Voice 12: uh as a greater issue than just our application um then i think that that's the other issue is

[1:59:04] Voice 12: one thing at a time if you do our application first and come back and say mr darwin when you're

[1:59:12] Voice 12: right peace association we'd like to consider that well that's kind of an interest so if you're

[1:59:18] Voice 12: considering the rate pairs associations delegation um ours should be secondary

[4:38:57] Voice 1: and reviewing your own regulations, then we'd recommend this be identified as a specific

[4:39:01] Voice 1: standalone project. Every year, the LTC has the ability to opt in to the principal residence

[4:39:07] Voice 1: requirement should you wish to do that. So it isn't that this is the only year to do that. You

[4:39:11] Voice 1: can wait to do an analysis, do some consultation with the community, and refine your own land use

[4:39:18] Voice 1: bylaw to better reflect the needs of the community with regards to this economic activity within

[4:39:25] Voice 1: in residential zones and in this case your land-based zone on luskeety right
