[0:00:34] Voice 5: uh want to be respectful of their connection to this place since time immemorial
[0:00:40] Voice 5: um my name is tim peterson i am elected on the ski island i'm the chair of the
[0:00:45] Voice 5: harvey island local trust committee i'm joined today by uh trustee local trustees grant scott
[0:00:50] Voice 5: and alex allen and together we make up the hornby island uh local trust committee i think that
[0:00:57] Voice 5: daniel harbour is going to try and join us on zoom but he did send me a message that he may have
[0:01:05] Voice 5: some difficulty connecting because he's on a ferry and so he did send me a couple of notes

[0:02:54] Voice 4: members of our advisory planning committee as well that's right glad to hear that
[0:03:01] Voice 4: we'll be very helpful in uh bringing the initial recommendations together marvelous
[0:03:09] Voice 5: okay so i'm just about to the end of my comments here um this meeting is an official forum for the
[0:03:16] Voice 5: the local trust committee to make decisions about land use planning matters and to discuss
[0:03:20] Voice 5: relevant business and i'd like to also add this is a place of employment and for our staff here
[0:03:27] Voice 5: and for the staff that are working um electronically everyone has the right to a
[0:03:32] Voice 5: safe and respectful workplace and uh so with that we do have an agenda before us today which is short
[0:03:40] Voice 5: because this is a special meeting not a regular business meeting and before we continue i'll just
[0:03:48] Voice 5: check and see if there's anything burning that must go on this agenda not seeing anything i'll
[0:03:57] Voice 5: take it by consent the agenda is adopted as presented and we have one business item and that

[0:05:52] Voice 4: have always appreciated Will's undivided attention, her willingness, if you will, to go to extra
[0:05:58] Voice 4: kilometers, even on weekends. And in the pandemic, virtual meetings, hybrid meetings, as if she was
[0:06:05] Voice 4: born for the job, Will became our air travel controller. She helps us land, she helps us take
[0:06:10] Voice 4: off, all in that calm and soothing air travel controller voice. Even when we feel that we can't
[0:06:16] Voice 4: land a plane, there's Will. Trust you, Alan, you're good right now. That's good. You can go straight

[0:06:59] Voice 4: And it's uncertainty around our land use bylaws. It's uncertainty around the laws that we have to live under.
[0:07:05] Voice 4: And it's certainly uncertainty around the short-term vacation rentals and housing for all kinds of different people.
[0:07:12] Voice 4: Young people don't want to come live here. Older people don't want security. People come from off the island as visitors.
[0:07:18] Voice 4: so that's why there's a number of people in this room and i'm hoping at this meeting we
[0:07:22] Voice 4: can move along to create some certainty so um there won't be the feeling i know there
[0:07:28] Voice 4: is in this world why you're here so i want to thank you for coming out okay thank you for that
[0:07:35] Voice 5: and now i'll go to the planet who's uh got a report here and some recommendations
[0:07:42] Voice 3: Thank you, Chair. I wanted to ask whether or not you wanted to present your reports from the Electoral Area Director first, because that update might be more timely than the staff-to-staff discussions that we've had.
[0:07:55] Voice 3: It could come up steadily in regional districts, so if that would help preface the report presentation, I wonder if that would be helpful to the Local Trust Committee.

[0:08:04] Voice 5: sure and i've got uh i just received uh an update from daniel harbour he's got a
[0:08:10] Voice 5: terrible interconnection please deliver my report so uh with that um shortened to the point uh
[0:08:20] Voice 5: number one at the march meeting this the cbrd board supported pursuing working with islands
[0:08:26] Voice 5: trust staff to explore a potential short-term vacation rental business licensing program for
[0:08:33] Voice 5: horty island number two further supported that this topic be one for key discussion at our
[0:08:40] Voice 5: elected official joint islands trust cbrb meeting in june uh three we expect budgets to be allocated
[0:08:47] Voice 5: based on the outcome of those discussions and four in related matter the electoral area services
[0:08:55] Voice 5: committee decided not to opt into the provincial program for short-term vacation rental pending
[0:09:01] Voice 5: pending further analysis over the coming year or two and uh uh my report is that it is great that
[0:09:13] Voice 5: from the last uh we're gonna go out of the local trust committee meeting a few weeks ago the wheels
[0:09:19] Voice 5: are in motion so that's from um regional director Daniel Arbor and sorry you can't join us virtually
[0:09:27] Voice 5: virtually by Zoom, but appreciate that he's sent us that information and
[0:09:32] Voice 4: now over
[0:09:34] Voice 5: to Tana Zucanek.

[0:09:36] Voice 3: you so much. So this report is based on the last resolution of the local trust committee
[0:09:41] Voice 3: requesting a specific reporting cap on your official community plan LUB review project that
[0:09:48] Voice 3: deals with one specific topic. As you know your OTP review has a number of themes and topics in
[0:09:54] Voice 3: which you have recommendations in some direction as to how we're going to proceed however this
[0:09:58] Voice 3: particular piece with the vacation rentals was the one that was holding things back because of
[0:10:03] Voice 3: the new need to introduce virtual legislation where we cautioned that this was unintended
[0:10:08] Voice 3: consequences if you proceeded with not permitting these outright in your zoning and losing the
[0:10:14] Voice 3: non-conforming status so this report is solely looking at that one issue it is not an update
[0:10:21] Voice 3: and all the other pieces of your OCP review
[0:10:23] Voice 3: because we need clarity and direction
[0:10:26] Voice 3: on how you wish to proceed with this piece
[0:10:28] Voice 3: so we can better understand
[0:10:30] Voice 3: how the rest of those elements of your review
[0:10:33] Voice 3: will be addressed under this one project
[0:10:36] Voice 3: because there is potential
[0:10:38] Voice 3: that things start to get divided or stretched out
[0:10:41] Voice 3: if there's more complexity with one topic
[0:10:43] Voice 3: that it holds up your other issues
[0:10:44] Voice 3: related to secondary suites,
[0:10:47] Voice 3: systems and setbacks, chickens, roosters, et cetera.
[0:10:50] Voice 3: So that's why this report is narrowly focused on just the vacation rental element, seeking your direction today so that for your April business meeting, you can look at the project charter with certainty that it reflects how this project's moving forward in the next year.
[0:11:07] Voice 3: So that's just to preface. I know there's been some community concern around what this report is or isn't reporting back on.
[0:11:14] Voice 3: So this is straight out of your resolution from your last meeting to deal with this particular issue.
[0:11:19] Voice 3: you so i won't go through the report step by step everybody's had a chance to go through it i'll
[0:11:23] Voice 3: focus in specifically on the options can i ask you to speak up i'm so sorry i will definitely
[0:11:30] Voice 3: try to interject uh of course i'm trying to project to the chess committees well if you're
[0:11:37] Voice 3: okay with me i'll try to project in this direction and please interject if you can't hear me just a
[0:11:47] Voice 3: quick sign motion up to your ear and that should i'll cue in that i need to speak okay thank you
[0:11:54] Voice 3: so i was just saying that i won't be going through the report in detail because most of you
[0:11:59] Voice 3: the elected officials have had a chance to review it i'm going to focus in on the options to leave
[0:12:03] Voice 3: as much time as possible for the ltc to discuss and ask questions around those particular options
[0:12:10] Voice 3: okay so we've identified um and security analysis provided you with some background information
[0:12:16] Voice 3: around the context of the new provincial legislation and how it relates because the
[0:12:22] Voice 3: province is asking, regardless of whether or not you're one of the mandatory communities that needs
[0:12:27] Voice 3: to enact changes, they're asking all local governments to consider how to become more
[0:12:32] Voice 3: aligned to this provincial approach to return more housing to the long-term residential housing
[0:12:38] Voice 3: housing market over time. So we've identified four discrete potential options, not limiting
[0:12:47] Voice 3: it to those four, but four categories of options for the local trust committee to consider
[0:12:52] Voice 3: in terms of policies and regulations. These specific tools to implement, such as legitimate
[0:12:58] Voice 3: licensing, which has been referenced, haven't been identified here because it is simply
[0:13:03] Voice 3: a tool. It is not the directive that the local trust committee needs to give. It is a tool
[0:13:08] Voice 3: to implement policies and regulations so we can talk a bit more about the business licensing tool
[0:13:15] Voice 3: and how it fits into any of these potential options so the first option that the local
[0:13:20] Voice 3: trust committee can consider is is to maintain the current policy and regulatory approach that
[0:13:27] Voice 3: friend beyond has embedded in your ocp and lev which permits vacation rentals as a right use
[0:13:33] Voice 3: in the various zones that you have and not opt in to the provincial principal residence
[0:13:39] Voice 3: requirement which is voluntary for these communities to consider anyone who is operating
[0:13:47] Voice 3: would need to register with the province sometime this year is expected once that registry is
[0:13:53] Voice 3: established that is intended to allow the local government and the province to work together to
[0:13:59] Voice 3: track operator use the density of operators in any geographic area to allow for monitoring and
[0:14:06] Voice 3: compliance so that registry in essence might be an attractive alternative to the business life
[0:14:13] Voice 3: thing with the regional district to some extent we're not quite sure but that more information
[0:14:18] Voice 3: on that registry will be coming out this year so we'll be looking to that so that option basically
[0:14:25] Voice 3: basically means proceed no further with changes to your OCP or LUV as part of this project
[0:14:33] Voice 3: that you currently have underway, which means we need to update your project charter which
[0:14:37] Voice 3: is attached to this report and remove that from the scope. So there will be no community
[0:14:44] Voice 3: dialogue or discussion or bylaws that reflect changes. So that's the first option. As we
[0:14:51] Voice 3: we come back with a project charter that takes out any mention of vacation rental policies or
[0:14:56] Voice 3: regulations being updated or changed. I can assist with any resolutions to enact this if you decide
[0:15:05] Voice 3: you want to proceed with that particular approach. So the second option is to maintain what you have
[0:15:14] Voice 3: similar to the first option, no change in policy or regulatory approach, but consider opting in
[0:15:22] Voice 3: to the provincial requirements because you determine that for this island it is important
[0:15:27] Voice 3: to ensure that those vacation rentals are owned and operated by the actual principal owners of
[0:15:35] Voice 3: the property uh or residents of the property so that is a potential deadline of march 31st
[0:15:44] Voice 3: every local government can opt in by march 31st of each year and that would then take effect in
[0:15:50] Voice 3: November 1st of that year so it's not necessarily a rush for a local trust committee to opt in this
[0:15:57] Voice 3: year however for those that have clearly decided this is appropriate such as Gabriel Island they
[0:16:03] Voice 3: did opt in just recently so we will find out if the ministers accepted their opt-in after March
[0:16:09] Voice 3: and then all vacation rental operators will need to be ensuring compliance by November 1st of this
[0:16:16] Voice 3: year this option could be time sensitive for you today if you're very confident that that's the
[0:16:23] Voice 3: direction you want to go you have the option to indicate opting in today in order to start that
[0:16:31] Voice 3: process this year by november otherwise you can reconsider this every year and as we understand
[0:16:39] Voice 3: that the province will leave that window of opting in open indefinitely for each local government
[0:16:45] Voice 3: to decide how to proceed if this option is of interest to you we would still need to
[0:16:55] Voice 3: keep this as part of your social community plan land use file review we would need to ensure that
[0:17:01] Voice 3: the draft bylaws are clear about the principal residence requirements even though the province
[0:17:07] Voice 3: has enforced that piece your regulations your policy directives need to be fully aligned with
[0:17:13] Voice 3: that so there can be no ambiguity even though the province would supersede your regulations
[0:17:19] Voice 3: we still don't want to draft something that doesn't clearly align with that principal
[0:17:24] Voice 3: residence approach so your project charter would just need to be tweaked a little bit keep it in
[0:17:31] Voice 3: but specify the rationale for how limited the changes would be strictly to ensure principal
[0:17:36] Voice 3: the principal residence requirement is clear are there any questions about those two options
[0:17:44] Voice 3: before I move on to the other like
[0:17:48] Voice 4: to ask you how many islands of the 13 islands in the Islands
[0:17:53] Voice 4: Trust have opted in I
[0:17:55] Voice 3: only know of Gabriel for the northern region and to be honest I'm not tracking
[0:17:58] Voice 3: Salt Spring but the chair of Salt Springs here and
[0:18:04] Voice 5: Galeano for that matter um I'm actually not
[0:18:08] Voice 5: I'm not aware. I know Salt Spring and Galliano have not decided to opt in at this time.
[0:18:16] Voice 5: And I'm not aware if there's other islands.
[0:18:19] Voice 5: But in fact, I didn't know the Gabriel, but Renee probably has more information.
[0:18:23] Voice 3: Chair, the chair, we are the director of planning services is collecting information from the local trust areas on which ones are opting in.
[0:18:35] Voice 3: i don't have a final number because the deadline is the end of march so i think local trust areas
[0:18:42] Voice 4: are still having that discussion and making that decision um so we'll find out which is just next
[0:18:47] Voice 4: week we'll find out who has decided that thanks yeah okay um there's beyond principal dwelling
[0:18:58] Voice 4: there's also a host that's recognized within the provincial regulations so can you just clarify
[0:19:06] Voice 4: find out the principal host are they living in the house or how does that play out so from what
[0:19:12] Voice 3: we understand the principal residence even if the host is not the owner on title of the property if
[0:19:17] Voice 3: the host is if that's their principal residence that is still applicable what we haven't received
[0:19:24] Voice 3: clarity on from provincial staff is whether or not the host has to physically be on site
[0:19:28] Voice 3: during um the operation of the vacation rentals um because there's there's definitely two ways
[0:19:36] Voice 3: to interpret that and we just don't have that clarity absolute clarity and we're suspecting
[0:19:41] Voice 3: that the cases that no they would not physically need to be on site during that use uh they are
[0:19:47] Voice 3: permitted to travel or to to be off sites for x number of period of time it's their principal
[0:19:53] Voice 3: a full residence though and that piece would be enforced by the province in terms of how that's
[0:19:58] Voice 3: declared how that's followed up on so we there's still a few pieces that we don't have full clarity
[0:20:05] Voice 3: on but we're anticipating that's all going to come quite quickly now as local governments are
[0:20:10] Voice 3: scrambling the ones that are mandated to do this to figure this out okay so the the third option
[0:20:20] Voice 3: is slightly more robust in the types of conversation you might need to have for some potential
[0:20:25] Voice 3: changes, your community has undergone extensive engagement, extensive consultation, extensive
[0:20:32] Voice 3: feedback to the local trust committee on ways to address this one particular land use.
[0:20:39] Voice 3: So you have a plethora of recommendations at your disposal to look at incorporating
[0:20:45] Voice 3: and tweaking your regulations to reflect those changes that people wish to see perhaps to
[0:20:52] Voice 3: vacation, how vacation rentals are addressed in the community.
[0:20:56] Voice 3: So this option speaks to making either some minor or major changes to how they're regulated
[0:21:04] Voice 3: on the island at this time.
[0:21:06] Voice 3: And then also doubling that with opting in or opting out of the principal residence retirement
[0:21:11] Voice 3: as that was one of the recommendations, I think, from the APC as well.
[0:21:15] Voice 3: call anyway so those are things that you could consider is to amend your project charter with
[0:21:21] Voice 3: a little bit more specificity about what you're expecting to see to ensure that these regulations
[0:21:27] Voice 3: reflect the intent of the community moving forward to provide that certainty and so there's some
[0:21:34] Voice 3: examples in the staff report about things around the minimum lot sizes the requirement for proof
[0:21:39] Voice 3: of septic and water being part of those requirements um the zones that the use is
[0:21:46] Voice 3: permitted in perhaps there's some restrictions or additions or subtractions that you want to
[0:21:51] Voice 3: consider there um how many rentals per parcel those are all things that you've discussed that
[0:21:59] Voice 3: the communities reported back to you on that you can now decide is this the time is this the project
[0:22:05] Voice 3: to do that work in conjunction with the other things that need to be amended
[0:22:10] Voice 3: related to housing secondary suites
[0:22:13] Voice 3: and the other more minor changes.
[0:22:15] Voice 3: So if you feel confident that yes,
[0:22:18] Voice 3: this is what you would like to do,
[0:22:20] Voice 3: then the project charter needs to specify that.
[0:22:22] Voice 3: You may not be capable today of clarifying that piece,
[0:22:26] Voice 3: but in April, we would expect to be able to report back
[0:22:30] Voice 3: to the community on exactly what it is
[0:22:32] Voice 3: that you're willing to do
[0:22:34] Voice 3: based on the input that you've received to date.
[0:22:37] Voice 3: So we're not suggesting that you need more information
[0:22:39] Voice 3: because we suspect that you have significant volume of analysis on which options the community
[0:22:44] Voice 3: would like to see reflected in the regulations but this piece would require more dialogue i think in
[0:22:52] Voice 3: terms of clarity around the extent of amendments that you might want to consider and then whether
[0:22:58] Voice 3: or not you wish to dovetail that we have the principal residence requirements as well um so
[0:23:06] Voice 3: So there, any questions about the third option?
[0:23:13] Voice 4: Right.
[0:23:13] Voice 4: Well, it seems to me that the best way to deal with this is to get a drug.

[0:23:21] Voice 4: It seems to me the best way to deal with the complexities of these issues.
[0:23:28] Voice 4: And they're quite baffling, I imagine, to you, because they're quite baffling trying to figure out.
[0:23:35] Voice 4: So we don't live with this stuff all the time.
[0:23:38] Voice 4: but the way i see it is if we get on with drafting the revisions to the official community plan
[0:23:47] Voice 4: can you hear me now and the land use violence

[0:23:57] Voice 4: so if we get on with drafting the official community plan and the land use bylaws
[0:24:05] Voice 4: If we do that, based on the recommendations of the Five-Street Planning Commission, which we've had now for a couple of years, if we do that, we have a context to understand where all this stuff comes into our bylaws.
[0:24:20] Voice 4: Right now, we're talking about them like they're silos, and I find it incredibly confusing because we don't have anything to relate it to.
[0:24:28] Voice 4: so i think from a community development point of view we need to get that's our priority is to get
[0:24:34] Voice 4: the ocp and the land use bylaw it's a draft when it goes to first reading if that's to us then it
[0:24:42] Voice 4: goes to the public then we can have all the input into it from from public meetings and the rest of
[0:24:48] Voice 4: it so that's where i kind of sit with this right now let's get on with the ocp and land use bylaw
[0:24:55] Voice 4: review based on what information we have now from the from the advising planning from your
[0:25:00] Voice 4: center and all the work you guys have done over the years on it so get that's the key
[0:25:05] Voice 4: can you address that
[0:25:14] Voice 3: so this is this is one key piece of that ocb lab review that we will be happy to provide you with
[0:25:22] Voice 3: the draft um based on the input that you've received to date however we need you to confirm
[0:25:30] Voice 3: to what extent you want the changes to the vacation rental use to be are we keeping the
[0:25:37] Voice 3: number of zones the parcel size the limits as drafted currently principal residence requirement
[0:25:44] Voice 3: this is all part of today's discussion is are you comfortable with what clearly in your regulations

[0:26:31] Voice 3: time we don't want to have to re-refer I mean we will absolutely recommend that you re-refer
[0:26:36] Voice 3: for significant changes but there should be full confidence at first reading that the bylaw is
[0:26:42] Voice 3: as close to what you intended it to be as possible,
[0:26:46] Voice 3: barring any additional feedback.
[0:26:48] Voice 3: So we appreciate the need to get a draft on the table
[0:26:53] Voice 3: so people can understand how this relates.
[0:26:55] Voice 3: I just want to caution that the current baseline,
[0:26:59] Voice 3: what you have is, let's start with that.
[0:27:02] Voice 3: You already have regulations in place and policies in place.
[0:27:05] Voice 3: Now just please identify which of those need to be changed.
[0:27:09] Voice 3: And I will do my best to ensure
[0:27:11] Voice 3: sure that when we present the draft file that it's very clear and it's not ambiguous uh what
[0:27:16] Voice 3: it is that is happening versus what you have now we can find ways to communicate that so that it's
[0:27:21] Voice 3: really uh easy to track the changes that you're considering at the draft stage before you give
[0:27:28] Voice 3: first reading so that at first reading there is no question what it is what your intention is for
[0:27:35] Voice 3: this particular venue specifically we have clarity and direction for the housing and secondary suites
[0:27:40] Voice 3: and the other issues this is the only one that really needs a bit more confirmation so that
[0:27:47] Voice 3: there's no risk or chance of those draft bylaws misinterpreting your direction misinterpreting
[0:27:54] Voice 3: their community's expectations for what was going to be presented to them um or the work that we're
[0:28:01] Voice 3: doing parallel with comox first nation in terms of engagement as well so that's a whole separate
[0:28:07] Voice 3: connected piece of this project that i'll give you a brief update on once they go through okay
[0:28:12] Voice 3: um so this piece as well i did want to mention before i forget this particular options most
[0:28:19] Voice 3: important implication is that any change that the local trust committee determines that they wish to
[0:28:27] Voice 3: make will result in non-conforming operators losing their ability to continue to operate
[0:28:38] Voice 3: as of may 2024. so if the local trust committee determines they want to make
[0:28:43] Voice 3: just a change to the minimum lot size for those owners who are currently enjoying this vacation
[0:28:49] Voice 3: rental use um option when the regulations are adopted they will no longer be protected to
[0:29:00] Voice 3: continue because the province has decided that this particular type of land use will not be
[0:29:06] Voice 3: protected once you're non-conforming you're illegal and therefore they're just going to
[0:29:12] Voice 3: enforce upon those so that's why number three option three requires absolute clarity
[0:29:19] Voice 3: so that people know that this is the change may impact their operating.
[0:29:26] Voice 3: And it could be just a minor change or a minor tweak
[0:29:29] Voice 3: because of a recommendation you considered or wanted to incorporate.
[0:29:33] Voice 3: But to a number of users, they can be what actually eliminates
[0:29:38] Voice 3: that small economic component of their zone from being undertaken in the future.
[0:29:44] Voice 3: so that's why option three just is a bit more fulsome in that clarity so that we
[0:29:51] Voice 3: can manage the expectations of the community communicate and be very
[0:29:54] Voice 3: transparent about what happens if this is adopted so it's all fine
[0:30:00] Voice 3: in the draft process but once that bylaw is adopted there might be implications for some
[0:30:05] Voice 3: operators and that is legitimate there's no compensation to those people that is the way
[0:30:11] Voice 3: local governments can operate and make decisions and changes in the community but it is important
[0:30:17] Voice 3: to have that transparent discussion about what this means for a certain percentage of operators
[0:30:22] Voice 3: The same applies for option four in terms of potential implications to future non-compliant
[0:30:35] Voice 3: operators.
[0:30:36] Voice 3: So option four is a bit more direct in that you would eliminate from the zoning the outright
[0:30:45] Voice 3: permitted use and require that anybody in the future that wants to operate a vacation
[0:30:53] Voice 3: vacation rental would require a valid temporary use permit issued by the local trust committee
[0:31:00] Voice 3: in combination with registry with the province. So the temporary use permit, or the TEP as we call
[0:31:07] Voice 3: it, can also be combined with the principal residence requirement or just be a standalone
[0:31:12] Voice 3: application that you apply for. It's valid for three years. You can renew it for an additional
[0:31:19] Voice 3: three years and then you have a cycle of applications there's a fee associated with
[0:31:26] Voice 3: each application it's at the discretion of the local trust committee to issue those applications
[0:31:31] Voice 3: for those permits but there are guidelines as we currently already have um that might be more
[0:31:40] Voice 3: robust or might be more um there might be some changes to those guidelines with the LTC considered
[0:31:47] Voice 3: are a part of this project and every operator would be held to that requirement that they have
[0:31:53] Voice 3: to meet those guidelines and the expectation is they have to meet those guidelines for the duration
[0:31:58] Voice 3: of their permit as well so there would be at any point in time that permit could be revoked if
[0:32:03] Voice 3: there seemed to be a contravention unlike the zoning where there's law enforcement that might
[0:32:08] Voice 3: pick in uh it might take time to seek voluntary compliance with the permits it's a bit different
[0:32:14] Voice 3: So option four also requires a bit of clarity if the LTC decides to proceed this route.
[0:32:21] Voice 3: There's an element of communication and education around the obligation to understand the implications, the timing of the application,
[0:32:34] Voice 3: making sure that if you are staying with the May to September timeline for this type of the land use,
[0:32:40] Voice 3: that people are actually applying for those permits in time for that season to begin.
[0:32:45] Voice 3: That we have the administrative capacity to actually undertake a review of up to 100, 160 applications,
[0:32:53] Voice 3: batch them, have the local trust committee look at them, issue them.
[0:32:56] Voice 3: So it would be quite a process, but it's not impossible.
[0:32:59] Voice 3: It would just be a unique opportunity to really brainstorm an efficient way to undertake this
[0:33:07] Voice 3: particular approach.
[0:33:09] Voice 3: Again, business licensing could still be an element of option 1234.
[0:33:16] Voice 3: It's just the tool, but we need the direction of what is the underlying policy and regulations
[0:33:24] Voice 3: to enact this use that that business license would support.
[0:33:28] Voice 3: same with the temporary use permit so there's a lot of customization for the temporary use
[0:33:33] Voice 3: permit that you can consider a lot of people a lot of oversight can make clear that it's
[0:33:39] Voice 3: appropriate for that particular location it's a great way to ensure on a case-by-case basis that
[0:33:45] Voice 3: the use is appropriate for that site and as land ownership changes business models change
[0:33:53] Voice 3: a use might disappear and eventually it reverts back to residential use whereas with zoning it's
[0:33:59] Voice 3: sort of an inherent geographic stamp of residential and vacation rental use sort of in perpetuity of
[0:34:08] Voice 3: that zone so it's a little bit of a different approach and that's that's what's up for
[0:34:13] Voice 3: discussion today it's whether or not this particular tool is appropriate so that's the
[0:34:19] Voice 3: fourth option is related to vacation rental if you wanted to choose this which was already in
[0:34:26] Voice 3: your project charter at one point then it was taken out we would need to still amend your
[0:34:31] Voice 3: project charter today or get direction to amend it so that it's very clear that the OPP and the land
[0:34:38] Voice 3: use bylaw would be anticipating a fully compliant temporary permit process and the building would
[0:34:44] Voice 3: it be removed. So the other parallel piece to this project that we're doing to give you an update on
[0:34:58] Voice 3: of course is while we're holding back on drafting the other elements of your bylaws until we hear
[0:35:03] Voice 3: about this particular one because this one's major, we have an update related to the First
[0:35:10] Voice 3: Nations engagement which is a fundamental piece of this review as well. The Comox First Nation
[0:35:15] Voice 3: has been in dialogue with staff for over a year on this, not just this project, but all the work
[0:35:21] Voice 3: that happens on Hornby Island and this project being the catalyst to ensure that we actually
[0:35:27] Voice 3: are doing the deep listening that we need to do to reflect back recommendations to you
[0:35:32] Voice 3: about how to proceed with this project in a way that reflects the Indigenous interests
[0:35:38] Voice 3: interests in these topics but also other topics related to your OCP. So as of yesterday the
[0:35:45] Voice 3: capacity agreement has been finalized and planned and so that now kickstarts a parallel process
[0:35:53] Voice 3: for staff to work with the staff at Comox First Nation to ensure that we bring to you the
[0:36:00] Voice 3: recommended steps for policy potential policy updates and regulatory updates that you can
[0:36:07] Voice 3: consider as part of this project or separate to this project um as when it's appropriate but
[0:36:14] Voice 3: ideally we would fit those in to uh pull some ocpluv review as they become clear so at every
[0:36:22] Voice 3: business meeting you should anticipate an update from staff on um where we're at with that uh that
[0:36:32] Voice 3: piece of the project so we'll be working what might feel like behind the scenes but actually
[0:36:37] Voice 3: not at all. We're just working in tandem with their scheduling to identify all the potential
[0:36:44] Voice 3: improvements that you can consider as you go forward. So this project, in terms of the
[0:36:50] Voice 3: outcome, will of course be a draft OCP bylaw, a draft land use bylaw, and the third critical
[0:36:58] Voice 3: piece is one of the most wholesome engagement opportunities we've ever had with Comox in
[0:37:04] Voice 3: in terms of land use planning issues being analyzed from ages that start to finish what's
[0:37:11] Voice 3: inside your scope of authority and so that's a really unique opportunity for the community to
[0:37:16] Voice 3: also have some clarity around as of 2024 2025 what the nation's top priorities are that they wish to
[0:37:25] Voice 3: see embedded in your community planning authority and jurisdiction within their territory so we're
[0:37:32] Voice 3: really excited about that commencing as of April 1st and bringing you regular updates on that
[0:37:39] Voice 3: process so the project charter is all marked up in your agenda package only for the purposes of
[0:37:46] Voice 3: showing you the extent of the changes that I would like to have prepared for your April business
[0:37:53] Voice 3: meeting so that there's no question anymore it was very out of date now it's been in a holding
[0:38:12] Voice 3: So the idea is that today, you're able to discuss and ask questions of staff, anything that you need, determine whether or not you're ready to advance with direction around the scope of changes you'd like to see so that I can amend your project chart or bring it back to you.
[0:38:29] Voice 3: and have absolute certainty about what it is I'm drafting for the OCP,
[0:38:35] Voice 3: what it is I'm drafting for the land use file,
[0:38:37] Voice 3: so that you can then do any referrals that you wish to do prior to first reading.

[0:38:45] Voice 3: before they're given first reading, that you can identify for me
[0:38:50] Voice 3: what level of community engagement you're expecting to undertake in this project,
[0:38:55] Voice 3: because right now your project charter is very vague, or not vague,
[0:38:59] Voice 3: it's very clear it's very um low on the community engagement because so much engagement has already
[0:39:05] Voice 3: happened that we we were quite confident that once you got the bylaws you would be ready to advance
[0:39:11] Voice 3: them to a public hearing with only one community information meeting identified in this older in
[0:39:16] Voice 3: this existing project charter so we want to gauge your appetite for whether or not that's still
[0:39:21] Voice 3: valid depending on what you choose today i need to understand the work plan and then advise you
[0:39:27] Voice 3: of your budget what's left to work with what it is that you'd like to do because there is no
[0:39:33] Voice 3: actual budget for the next fiscal because this project's work was not determined to have to
[0:39:39] Voice 3: extend for another fiscal year for engagement we anticipated that you would simply be in the
[0:39:45] Voice 3: legislative review process which is all internal costs for uh by the island trust so i can prepare
[0:39:56] Voice 3: to the best of my ability once we hear about the level of changes that you wish to make
[0:40:03] Voice 3: to that this vacation rental component of your major project if you wish to keep it within the
[0:40:08] Voice 3: associated review if you want to take it out and separate it and just focus on what you have
[0:40:14] Voice 3: outside the scope of that particular use and i'm happy to try to answer any questions you
[0:40:21] Voice 3: have about either the options or if there's other options that you're contemplating or you've heard
[0:40:25] Voice 3: the community discuss and this is the appropriate time to do that thank you and

[0:41:27] Voice 4: of the cbrd there's a possibility of opting in and opting out but those are all questions that
[0:41:34] Voice 4: we can consider over the next year we've got time to do that but when i look at this document here
[0:41:42] Voice 4: on page 11 it says that we should right now have been for our ocp and land use bylaw review we
[0:41:51] Voice 4: We should now have it finalized, and we're not there.
[0:41:55] Voice 4: There's always going to be complex reasons, like you just heard, why it's difficult to do that.
[0:42:01] Voice 4: But we have to keep moving on it because there's First Nations issues are going to change over the years.

[0:50:15] Voice 3: we want some clarity on today yes there are other parallel dovetailing types of tools like the
[0:50:21] Voice 3: registry like business licensing but i don't have absolute certainty of clarity how those will help
[0:50:28] Voice 3: your community until I understand what it is the maximum that you're willing to do under your
[0:50:35] Voice 3: jurisdiction and your authority. Use that to the best of your ability and then we can advise you
[0:50:41] Voice 3: on how those other tools will help you and your community to move forward. So temporary use
[0:50:47] Voice 3: permits are absolutely a tool whether it's appropriate for this particular instance and case
[0:50:51] Voice 3: that is up to you to decide and to direct staff whether or not you want to see that option

Regrets: Daniel Arbour, Electoral Area Director 1. CALL TO ORDER Chair Peterson called the meeting to order at 11:40 a.m. He acknowledged that the special meeting was being held on the territory of the Coast Salish First Nations. He introduced trustees, staff, recorder, and members of the public and announced that Director Arbour was unable to connect to the meeting, but that he had forwarded his report. He noted that the meeting was being livestreamed and recorded; but that if the livestreaming connection became unstable, that it would be disconnected to preserve bandwidth for remote participants. He requested that members of the public refrain from using WIFI to preserve bandwidth. He acknowledged the imminent retirement and incredible service of long-time Gabriola office administrator Wil Cottingham, especially noting her amazing technical meeting support throughout the Covid crisis. Trustee Scott acknowledged all the local Advisory Planning Commission members present and noted all the work they had recently completed. Trustee Allen read from a personally written letter to acknowledge and thank retiring administrator Wil Cottingham and to express gratitude for her seven years of dedicated, exceptional service. 2. APPROVAL OF AGENDA ADOPTED Hornby Island ADOPTED 2 Local Trust Committee Special Meeting Minutes March 22, 2024 The following additions to the agenda were considered: Add item 3.1: Electoral Area Director’s Report. Move staff report to item 3.2 By general consent the agenda was approved as amended. 3. BUSINESS ITEMS 3.1 Electoral Area Director Report Chair Peterson delivered the report from Regional Director Daniel Arbour, noting the following: The Comox Valley Regional District (CVRD) Board recently supported working with Islands Trust (IT) staff to explore a short-term vacation rentals (STVR)s business licensing program for Hornby Island; this business licensing will be a key discussion topic at the upcoming IT/CVRD June 2024 meeting; and it is an expected outcome of these discussions that there be a budget allocation. The Electoral Areas Service Committee decided not to opt in to the Provincial STVR Program, pending further analysis. 3.2 Review of New Provincial Short-Term Rental Accommodation Act and Options for Hornby Island Official Community Plan Review Project - Staff Report Planner Zupanec presented the staff report that asks trustees to consider four possible options for realigning the Hornby Island Official Community Plan (OCP) Project with new provincial regulations regarding STVRs, noting the following: The intent of the new provincial STVR regulations is to move some STVRs into long- term rentals; so even though Hornby Island is exempt from some of the mandatory requirements in the new legislation, the Province still wants all local governments to review their local bylaws with that general intent in mind. The four categories of options presented in the staff report do not exclude other possible options. Business licensing for STVRs is not a policy directive of the Local Trust Committee (LTC), but rather a tool to help implement several different options. The first option would be to allow Hornby to maintain their existing permissions of STVRs and to not opt-in to the new principal residence requirement; though STVR operators would still have to register their businesses when the new provincial registry becomes operational sometime this year. This registry may be an attractive alternative to CVRD business Licensing. The second option would be to consider opting in to the principal residence requirement with a deadline of March 31 of each year. Gabriola Island has opted in recently. The third option would be to compile, and then include, several specific detailed desired amendments to STVRs in the current OCP Project draft bylaw and to include this with opting in or staying out of the principal residence requirement. This option would result in any non-conforming operators losing their ability to operate without ADOPTED Hornby Island ADOPTED 3 Local Trust Committee Special Meeting Minutes March 22, 2024 compensation because non-conforming operators will no longer be protected by not conforming protection clauses; so, each amendment would have to be very carefully considered. The fourth option, to eliminate geographical zoning for STVRs in-perpetuity and require that they be managed through customized local Temporary Use Permits (TUP)s and provincial registration, also has implications for approximately 180 STVR operators on Hornby who could lose their non-conforming status if they cannot acquire a TUP. The principal host of a property who is not the owner of the property can be considered a principal resident; it is uncertain if that principal host must be on site; though it is considered unlikely that they must be on site. The First Nations Capacity Agreement has been finalized and signed and it is important that the Hornby OCP Project reflect First Nations input. Staff updates will be ongoing. If STVR issues are separated from the current Hornby OCP Project, they could constitute a future or current minor project. If Hornby opts in to the principal residence requirement, it is improbable that a local TUP could supersede this. Communities in the province that are not mandated to have the principal residence requirement are able to wait and see how the requirement plays out. CVRD STVR business license discussions will be affected by the anticipated extent of the numbers of STVRs that the LTC may allow to operate in the future on Hornby. Trustees spoke on the following: Enforcement and administrative issues for the new Provincial STVR Registry, TUPs for STVRs, and business licenses for STVRs. Problems with TUPs have already been discussed extensively. Which APC recommendations could be included in possible future TUPs. Communities that do not opt in to the provincial principal residence requirement for STVRs could end up attracting numerous out-of-community operators. Local needs for STVR income to help pay mortgages, insurance, and property taxes. The contentiousness of the STVR issues on Hornby. Increasing numbers of visitors to Hornby affecting Hornby and Denman Island residents’ quality of life. The APC recommendations for STVRs included a principal residency requirement. By general consent the meeting was recessed at 1:08 pm and reconvened at 1:20 pm. Planner Zupanec noted the following: The process of opting out after opting in to the principal residence requirement is unclear and may be complicated. APC recommendations are currently already included in OCP Project charter and the LTC is being asked to confirm the direction it wishes to take to advance this project. ADOPTED Hornby Island ADOPTED 4 Local Trust Committee Special Meeting Minutes March 22, 2024 HO-LTC-2024-005 It was MOVED and SECONDED, that the Hornby Island Local Trust Committee request staff to prepare draft amendments to the Official Community Plan and Land Use Bylaw Review Project Charter to reflect: a) Option 3: not opting in to the principal residence requirement and incorporating the Advisory Planning Commission recommendations but excluding the temporary use permit. b) Updated project engagement plan with K’ómoks First Nation; and c) Updated work plan, community engagement plan and associated budget. A trustee requested an amendment to the motion to remove the phrase “but excluding the temporary use permit.” Trustees discussed Option 4: the use of TUPs for STVRs and whether they would be supplemental to or a replacement of zoning bylaws. A trustee clarified that TUPs would be an addition to zoning. DEFEATED Trustees reconsidered that the question of TUPs for STVRs could be postponed to next meeting; and brought back the original motion. CARRIED ADOPTED Hornby Island ADOPTED 5 Local Trust Committee Special Meeting Minutes March 22, 2024 HO-LTC-2024-006 It was MOVED and SECONDED, That the Hornby Island Local Trust Committee request staff to bring forward the updated Project Charter for the Official Community Plan and Land Use Bylaw Review to the April 26, 2024 regular business meeting for Local Trust Committee endorsement. CARRIED The Chair noted that the next meeting of the LTC would be held in person at Room to Grow on April 26, 2024. o A Trustee added that Room To Grow was a small venue to hold the number of persons present as at the current meeting. o Administrator Cottingham added that the Hornby Hall had been unavailable for rental. o A member of the public added that hybrid meetings would not be possible at Room to Grow. It had to be all electronic or all in person. 4.
