[0:01:01] Voice 9: I want to begin the meeting by acknowledging that we're fortunate to be able to gather
[0:01:06] Voice 9: together in locations across the Caribbean and Coast Salish people.
[0:01:10] I'm David Vaughan, elected on the main island, chair of the Northern Standard Island Local
[0:01:15] Trust Committee.
[0:01:16] I'm joined today by Denman Island trustees David Graham, Sam Borthwick.

[0:01:53] Voice 9: Warren Dingman, our violent enforcement manager, which will be joining us later on.

[0:02:29] to let you know that this meeting is an official forum for your
[0:02:31] Voice 9: local trust committee to make
[0:02:31] Voice 9: decisions about land use plans and discuss relevant business i want to add this place
[0:02:36] Voice 9: for employment despite the fact many staff are in their own homes our staff have the right to
[0:02:40] Voice 9: a safe and respectful workplace so we have an agenda for us does anybody have any conditions
[0:02:47] additions or
[0:02:48] Voice 9: deletions or anything else to add to that wonderful spectacularly thank you so by
[0:02:56] Voice 9: consent we will adopt the agenda as circulated excellent so the first thing on our agenda our
[0:03:04] Trustee Graham: trustee reports I can briefly talk about unless uh Samson talk about Trust Council so we did a
[0:03:11] Trustee Graham: meet last month and we approved our budget after a pretty full discussion on an attempt to reduce
[0:03:20] Trustee Graham: the impact on our local constituents community members um and nobody wants to be taxes but
[0:03:28] Trustee Graham: to be fair uh we do a lot of good work with the money that uh is collected from our insurance
[0:03:34] Trustee Graham: and the poultry amount is given to the province it's just that a poultry amount and considering
[0:03:40] Trustee Graham: considering that the protection of the Amish Trust area is for the benefit of the population
[0:03:46] Trustee Graham: of the entire province, they should pay more, which is fine.
[0:03:51] Trustee Borthwick: Thank you.
[0:03:54] Trustee Borthwick: Yeah, I mean, spring is very much sprung.
[0:03:58] Trustee Borthwick: I've had, so as trustee, I sit on the FAC, which has been suspended since last year for
[0:04:07] Trustee Borthwick: from my VC fairies.
[0:04:09] Trustee Borthwick: So that's been very frustrating
[0:04:11] Trustee Borthwick: to not sort of have enough forum
[0:04:15] Trustee Borthwick: to really feed back into those things.
[0:04:17] Trustee Borthwick: And we're certainly seeing the rise
[0:04:18] Trustee Borthwick: of that impact on the islands.
[0:04:24] Trustee Borthwick: But, you know, by and large,
[0:04:26] Trustee Borthwick: I mean, stuff is starting to move
[0:04:28] Trustee Borthwick: and definitely lots of other areas
[0:04:30] Trustee Borthwick: of my work are very busy.
[0:04:32] Trustee Borthwick: So yeah, I'm looking forward
[0:04:35] Trustee Borthwick: to the Trust Council was good.
[0:04:36] Trustee Borthwick: I think we got through
[0:04:38] Trustee Borthwick: some good bits and pieces
[0:04:39] Trustee Borthwick: and I'm looking forward to getting on with the work of the local trust committee, which is where my focus is at the moment.
[0:04:45] Voice 9: Excellent. Well, I guess trust council seems to be the theme today.
[0:04:51] Voice 9: We did get through budget at trust council.
[0:04:55] Voice 9: It was a lot of discussion, a lot of back and forth.
[0:05:01] Things like the galleon office, I think, got cut off and put back on the budget four or five times across the times.
[0:05:11] Voice 9: It's difficult. The only thing I'll note is, you know, at the end, we ended up with a 5.9% increase in taxation, which going across the local governments, and certainly down the southern islands, we actually were pretty good.
[0:05:26] Voice 9: I think Islands Trust was over 12%, or
[0:05:28] Voice 11: CRD
[0:05:30] Voice 9: was over 12% increase in their budget.
[0:05:32] Voice 9: So, it's tough times. We try and make the right decisions, but part of the difficulty is, like, everybody's house.
[0:05:43] Everything's costing more.
[0:05:44] Voice 9: It doesn't make any difference if we're buying pens or paper, if staff costs are going up,
[0:05:51] Voice 9: if we're bound by collective agreement, if there's problems to go to sheets on our behalf.
[0:05:57] And we're trying to do better things in better ways, but there
[0:06:02] Voice 9: are costs involved.
[0:06:04] Voice 9: It is what it is.
[0:06:06] Voice 9: I'm afraid next year there will be more budget increases
[0:06:09] Voice 9: because the pressures and demands are immense.
[0:06:13] And so we do the best that we can.
[0:06:16] Other than that, I'm
[0:06:18] Voice 9: involved in the committee
[0:06:21] Voice 9: that's working on hiring a new CAO for the organization.
[0:06:27] Voice 10: We've
[0:06:28] Voice 9: enlisted the help of the province
[0:06:30] Voice 9: and we have a facilitator helping us.
[0:06:32] Voice 9: talk about complicated
[0:06:34] Voice 9: it's
[0:06:36] Voice 9: it's been quite something
[0:06:39] but
[0:06:40] we're making progress
[0:06:42] we're getting that done
[0:06:44] yesterday
[0:06:46] we came down a short list of
[0:06:48] former firms to do the
[0:06:51] recruiting
[0:06:51] we don't have
[0:06:53] Voice 9: the short list of candidates yet
[0:06:55] Voice 9: on the recruitings
[0:06:56] Voice 9: and we're meeting
[0:06:57] Voice 9: I think on Friday
[0:07:00] Voice 9: planning hopefully to finalize that and then we'll finish it. The departments seem to think that
[0:07:07] Voice 9: within seven days of us selecting a consultant that they can actually get on the ground and
[0:07:12] Voice 9: start doing stuff. They've all lined up timelines of three to four months so it looks like there'll
[0:07:19] Voice 9: be a bit of a void there and we're discussing whether or not we're going to infill just
[0:07:24] just temporarily
[0:07:24] Voice 9: with staff from inside the organization
[0:07:29] or the province actually has this really cool list
[0:07:32] of CAO types that come in and do temporary stuff.
[0:07:37] Voice 9: So they've reminded of, I think it's five or six pages
[0:07:41] Voice 9: of independent people you can bring in as an interim CAO.
[0:07:46] And then there tend to be retired people
[0:07:49] Voice 9: who just want to come in and just work for three
[0:07:51] Voice 9: or four months and go back to retirement again.
[0:07:58] Voice 9: Other than that, we've had a couple of really good meetings with our local MPs in MLA, Adam
[0:08:06] Voice 9: Olson and Elizabeth May.
[0:08:09] Voice 9: We've done a big step on the southern half of this to establish this national marine
[0:08:16] Voice 9: reserve that Parks Canada has been working on for 10 or 12 years.
[0:08:20] Voice 9: years. Last meeting we had with Parks Canada came to the presentations and they informed
[0:08:26] Voice 9: us that we have a training of five years. And they said, well, we're now on phase four
[0:08:32] Voice 9: and five. So the indication was going to be coming up fairly quickly with public consultation.
[0:08:39] Voice 9: To a certain extent, it's high up here. I think the cutoff is Gabriel, but it's going
[0:08:46] Voice 9: to have some impacts because these marine reserves are tailored to the locations. On the east coast
[0:08:54] Voice 9: they were quite vehement about removing docks and mooring place and all that and creating a lot of
[0:09:01] Voice 9: problems there. Hopefully it's going to be more benign on our coast, which is most interesting.

[0:09:50] Voice 8: the information came from this group our community we've done some research and the
[0:10:00] Voice 8: federal government was offering a
[0:10:05] Voice 10: a grant, house grant, I think, for some reason,
[0:10:09] Voice 8: $94,000.
[0:10:13] Voice 8: And we
[0:10:15] Voice 8: would have been,
[0:10:15] Voice 10: we are,
[0:10:17] Voice 8: we're eligible, but it had to be applied for through his trust.
[0:10:23] Voice 8: And at that time, I think it was Leonard Chadwick who was voicing,
[0:10:31] Voice 8: is that, sadly, there wouldn't be enough time
[0:10:35] Voice 8: to have it ready for the deadline last year.
[0:10:39] Voice 8: But they would be all prepared, now that they know about it,
[0:10:44] Voice 8: to have it ready for this year.
[0:10:47] Voice 8: And I don't know if it was a yearly thing like that.

[0:11:19] Planner Chadwick (probable): yeah so an application did go in for denman island um and and main island because they were
[0:11:25] Planner Chadwick (probable): identified as the two uh the two communities on in the uh islands trust area that were
[0:11:31] Planner Chadwick (probable): the most ready to move forward with an application neither of them were accepted i also note that one
[0:11:37] Planner Chadwick (probable): one was also that salt spring island had also put in an application um so the effort i would say
[0:11:45] Planner Chadwick (probable): a great effort was made um to do that particular and i would say actually particularly on the main
[0:11:52] Planner Chadwick (probable): island side because um with main island um the crd the capital regional district was very heavily
[0:11:58] Planner Chadwick (probable): involved in that application because they've got a they've got a housing they've got a housing
[0:12:03] Planner Chadwick (probable): strategy strategy for the um the gulf islands so it's particularly surprising to us that they
[0:12:09] Planner Chadwick (probable): didn't get funding and yeah so I mean I did see a recent announcement made that there may be
[0:12:18] Planner Chadwick (probable): they may be providing some more funding for that program but there certainly hasn't been
[0:12:23] Planner Chadwick (probable): anything that's been identified publicly around the program development and I do have a direct
[0:12:31] Planner Chadwick (probable): line to one of the policy folks in CMHC. So as soon as she knows, I will know.

[0:12:55] Voice 8: My name is Rhianna Silva. I understand you mentioned Injust. Being here regularly for
[0:13:05] Voice 8: meetings it's very difficult on me i would rather be building my home than spending the last three
[0:13:11] Voice 8: years of my life doing this if i was putting on a show you would be far more entertained
[0:13:17] Voice 8: because you haven't seen me perform but these people have this is me speaking from my heart
[0:13:24] Voice 8: because i know who's homeless on this island and i'm sorry i'm having a very strong emotional
[0:13:30] Voice 8: emotional reaction, because this is not my show.
[0:13:33] Voice 8: I am being taken through so many hoops and run arounds in the last three years.
[0:13:40] Voice 8: And I would much rather not be here than be here.
[0:13:48] Voice 8: I'm here to speak today about the major
[0:13:51] Voice 8: project that we have that takes a lot of time and work for a minor project to be
[0:13:56] Voice 8: born, even more work for a major project to receive the go ahead and funding.
[0:14:01] Voice 8: thanks to years of work done by our community and former trustees denman currently has one active
[0:14:08] Voice 8: major project the housing review project the purpose of the housing review project is and
[0:14:14] Voice 8: i quote from page 46 of today's agenda targeted public engagement with first nations residents
[0:14:21] Voice 8: external agencies and local organizations to update the official community plan and
[0:14:27] Voice 8: land use bylaws with policies and regulations to strengthen housing options and affordability on
[0:14:32] Voice 8: the island everything that's not mentioned above is out of scope of this project stage two of this
[0:14:39] Voice 8: project involves phase one public engagement with a focus on identifying and prioritizing options
[0:14:45] Voice 8: for ocp and land use bylaw amendments check we've done stage one stage sorry phase one phase two
[0:14:53] Voice 8: Two, writing, review, and adoption of OCP and LUV amendments.
[0:14:56] Voice 8: That's where we are now.
[0:14:58] Voice 8: It's no small feat to get a major project funded by the Islands Trust.
[0:15:02] Voice 8: We will not see this kind of funding to fix housing bylaws for a long time to come.
[0:15:07] Voice 8: We have been waiting so long to get here.
[0:15:10] Voice 8: We are now in the final year of this major project.
[0:15:13] Voice 8: The money and staff availability will run out, and fairly soon.
[0:15:17] Voice 8: Trustees have asked staff to begin writing draft by-laws so that we can be reviewing and adopting
[0:15:22] Voice 8: OCP and land use by-law amendments in the coming months, yet still no draft by-laws have been
[0:15:28] Voice 8: written. Instead of steady momentum building all the work previously done, two separate items have
[0:15:34] Voice 8: been added to the project and are consuming staff focus, time and resources from what has been
[0:15:39] Voice 8: budgeted to Denman Island for a housing review. These new tools are the site suitability analysis
[0:15:45] Voice 8: analysis and the water availability assessment the site suitability analysis is a prototype which was
[0:15:51] Voice 8: developed on Northender staff have put much focus on developing this data tool and want to try it
[0:15:57] Voice 8: out on Denman it is widely suspected that this tool would recommend against allowing previously
[0:16:02] Voice 8: successful and Earth friendly Denman projects such as cobalt landing that would be terrible
[0:16:08] Voice 8: for our island we actually know what is suitable we who live here actually know better than any
[0:16:15] Voice 8: data tool where it's suitable to build and where it's not the water availability assessment is
[0:16:22] Voice 8: another draft tool that is already part of the islands trust's own freshwater sustainability
[0:16:27] Voice 8: strategy there is funding through that why are they piggybacking onto our limited funding
[0:16:35] Voice 8: This tool has been inappropriately rolled into the housing review.
[0:16:39] Voice 8: It belongs elsewhere, and in fact it already has a home elsewhere.
[0:16:42] Voice 8: You can find it at the Islands Trust website under programs
[0:16:45] Voice 8: slash freshwater dash sustainability, where it is part of the well-funded
[0:16:51] Voice 8: freshwater sustainability strategy.
[0:16:53] Voice 8: We were told a year ago by staff that these tools would not cause delay
[0:16:57] Voice 8: in the housing review, but they have been causing delay.
[0:17:00] Voice 8: The DEM and
[0:17:01] Voice 8: LTC is now being requested by staff to hold more meetings
[0:17:04] Voice 8: to introduce and discuss how these prototype tools may be used on Denman.
[0:17:08] Voice 8: And now, being asked to come up with a new housing action plan,
[0:17:13] Voice 8: we've already seen this in various forms.
[0:17:15] Voice 8: These tools and delays do nothing to support our community
[0:17:18] Voice 8: in meeting our housing or environmental needs or obligations.
[0:17:22] Voice 8: These tools and this plan will not build a house,
[0:17:25] Voice 8: nor will they make it affordable.
[0:17:27] Voice 8: These tools are out of the scope of the housing review project
[0:17:30] Voice 8: project with this clearly stated parameters which are on page
[0:17:35] Voice 10: 46
[0:17:38] Voice 8: of today's agenda staff focus on
[0:17:42] Voice 8: these tools is significantly delaying this major project the money spent on staff time focus
[0:17:48] Voice 8: meetings Etc is all time and money taken directly from our communities long-awaited housing review
[0:17:54] Voice 8: limited budget we have neither the time nor the money to spend on tools or plans that do nothing
[0:18:00] Voice 8: whatsoever to actually build homes. They don't advance or write bylaws, they don't actually or
[0:18:05] Voice 8: functionally protect the community, land or water of Denman. These tools are actually slowing down
[0:18:11] Voice 8: action and drafting Denman-Brown bylaw changes, which is the scope of the housing review project.
[0:18:18] Voice 8: Denman residents have been seeking legal housing options for decades. While our human right to
[0:18:24] Voice 8: housing is ignored and delayed by bureaucrats with toolkits. This is not the first Islands Trust
[0:18:30] Voice 8: housing toolkit that we have seen anybody who's been working with Islands Trust in the past
[0:18:36] Voice 8: decades. None of these housing toolkits have ever built a home on this island. I don't know about
[0:18:43] Voice 8: other islands, but on this island, none of them have built a home. We need to do what our community
[0:18:47] Voice 8: does and work together to bring people safely home. We have too many children, elders and sick
[0:18:54] Voice 8: people that are insulated from seeing the effects of these delays. But I am not insulated from this
[0:19:02] Voice 8: because people come to me. This is not my show. I am merely a spokesperson for people who can't
[0:19:08] Voice 8: come here because they see how hard it is and they see what is done to people who stand up.
[0:19:16] Voice 8: we need to end bureaucratic delays in housing our community please don't reassure me that we
[0:19:24] Voice 8: have lots of time we have only a few more ltc meetings before the funding runs out on this
[0:19:30] Voice 8: major project please don't tell me we'll find more money next year there are three more ltc
[0:19:35] Voice 8: meetings before winter we have homeless children they survived through this winter don't make
[0:19:43] Voice 8: to go another freaking winter before I would like it there's only three more LTC meetings before
[0:19:51] Voice 8: it's winter again and people will get sick or die again waiting for legal secure housing
[0:19:57] Voice 8: this right now this housing review is our opportunity for meaningful change
[0:20:03] Voice 8: through a simple but complicated in ways that only islanders know by law and OCP change people
[0:20:12] Voice 8: would have without homes have no more time we have to get this done it is a human rights obligation
[0:20:19] Voice 8: that we have to get right for denman community and ireland knock her off island data concerns
[0:20:25] Voice 8: and more bureaucratic reports i would ask you to please remove those items from the housing review
[0:20:35] Voice 8: they don't belong here they are out of scope if if they are worthy projects staff can seek
[0:20:41] Voice 8: funding through another project, minor or major, the fact that they're tacked on to this major
[0:20:47] Voice 8: project and slowing it down is inappropriate for our community. Thank you. Thank you very much.

[0:21:36] Voice 8: enforcement notification changes that were made last year they were stalled by staff in victoria
[0:21:41] Voice 8: have they moved to executive council and they passed and they passed have they going through

[0:21:49] Voice 8: to the minister now my
[0:21:51] Trustee Graham: ocp changes for the minister yeah
[0:21:53] Voice 8: so they so that
[0:21:54] Voice 8: is the update the status is that those changes that you made last year are in effect yeah well
[0:22:00] Trustee Graham: we added uh three i think that have environmental effects so if you build too close to a watershed
[0:22:07] Trustee Graham: it um ocean uh perhaps a stream those so those three plus uh short-term vacation rental and
[0:22:18] Trustee Graham: a missing sighting and use permit are the only things which can be used for a ticket i think
[0:22:24] Trustee Graham: everything else has to come through the local trust committee before it goes to court absolutely

[0:22:30] Voice 8: and can you explain why some denman residents were surprised
[0:22:34] Voice 8: by a visit from my law enforcement officer uh i surprised at their homes with no 24 hours notice
[0:22:41] Voice 8: or any notice on january 30th is there anything i
[0:22:47] Trustee Borthwick: spoke a little bit with uh manager jayman like
[0:22:51] Trustee Borthwick: on the day of um and well maybe i got a hold of him the next day um my the the explanation that
[0:22:59] Trustee Borthwick: i was given uh and i don't director jayman is not with us right yet so he can't correct me here
[0:23:05] Trustee Borthwick: um so the question was the the complaint that came in was that there was some machinery that
[0:23:11] Trustee Borthwick: was used to take down some trees on the lakeside and they weren't sure where exactly on the lake
[0:23:16] Trustee Borthwick: that that happened and so the bylaw enforcement officer was not in one direction trying to find
[0:23:23] Trustee Borthwick: out which property it had happened on um which is not an inspection through their through that

[0:32:41] Voice 4: i'm i apologize there's an addendum um thought it would have made it into the agenda package
[0:32:47] Voice 4: but that's fine um i i provided some analysis i just gave a brief introduction to the
[0:32:54] Voice 4: freshwater sustainability strategy document and where it came from um and i'm sure you've
[0:33:00] Voice 4: heard of that before uh i've provided some analysis with um uh like kind of a brief history
[0:33:07] Voice 4: of groundwater resource projects on Denman Island way back to the 70s and I provided some hyper
[0:33:16] Voice 4: length so if you're interested in those some of them are quite technical like a master's of
[0:33:22] Voice 4: science thesis and then I provided just a brief I wouldn't call it introduction but just I'm
[0:33:33] Voice 4: pointing you towards the uh uh um the islands trust aquifer conceptualization project and as
[0:33:40] Voice 4: well as the groundwater recharge potential mapping project both of which uh occurred on uh denman
[0:33:46] Voice 4: island in 2021 and and now we have uh completed the the consulting portion of the recharge mapping
[0:33:55] Voice 4: project and the aquifer conceptualization project across the island's trust area
[0:33:59] Voice 4: And staff are now working with our information services team to host them on a freshwater atlas that will be a mapping tool, but also an education tool to navigate people around those projects.
[0:34:21] Voice 4: They're both available. The consulting reports are both available to read on the Freshwater Sustainability page.
[0:34:30] Voice 4: The way that the consultant reports were written, we're pretty much looking at staff as the audience, so they can be a little bit complex.
[0:34:41] Voice 4: So staff are working to create a more public-friendly overview of those projects and supported by the Freshwater Atlas that can be used by anyone to explore those data.
[0:35:01] Voice 4: Currently, there's no planned freshwater sustainability strategy projects for Denman Island for the next fiscal.
[0:35:11] Voice 4: The Islands Trust Water Balance Project will commence next fiscal and Gabriola Island will be the case study for that.
[0:35:22] Voice 4: That's not to say that Denman won't be part of that development.
[0:35:27] Voice 4: element. We're likely going to look at many islands, the sea, the available data and do
[0:35:35] Voice 4: data gap analysis. And so it's not just focused on Gabriela, but Gabriela will be the case
[0:35:41] Voice 4: study. And then that project will help us determine next steps to advance the methodology.
[0:35:51] Voice 4: And, yeah, I think that's all I have to report on to give a, to address the resolution.

[0:37:51] Voice 4: like watershed resilience mapping

[0:37:58] Voice 4: which can also aid in determining where water is available.
[0:38:02] Voice 4: The water recharge mapping project has identified areas on Denman Island that are favorable for groundwater recharge.
[0:38:14] Voice 4: And so on other islands, we've been looking at developing a development permit area to protect those areas,
[0:38:22] Voice 4: as such as um as uh gabriola or sorry oh no my mind is blanking galliano thank you galliano is
[0:38:34] Voice 4: um is is in the process of developing a development permit area to to protect their critical recharge
[0:38:41] Voice 4: areas the the recharge mapping work that was done that project is the essential data
[0:38:48] Voice 4: for a water balance but it is not a water availability assessment we don't
[0:38:55] Voice 4: have that data yet on demo okay thanks very much yeah
[0:39:02] Trustee Borthwick: just sort of on that and
[0:39:03] Trustee Borthwick: I this is partly sort of coming out of there was a lot of talk at our last LCC
[0:39:12] Trustee Borthwick: meeting about water and and there was you know as we were preparing to the
[0:39:18] Trustee Borthwick: that's the uh our farm plan there's a lot of concern that there was not sufficient consideration
[0:39:24] Trustee Borthwick: for water taken into that um by a number of community members and um i we had a couple
[0:39:31] of people come forward saying you know there's quite a lot of historical um
[0:39:37] Trustee Borthwick: research of a variety
[0:39:38] Trustee Borthwick: of kind of types and i totally respect that this isn't you're looking at this through a
[0:39:43] Trustee Borthwick: a sort of a different lens and a more sort of comprehensive scientific approach but I was
[0:39:50] Trustee Borthwick: curious as to what to what extent if at all some of that knowledge that already exists on this
[0:39:57] Trustee Borthwick: island in terms of where freshwater mapping has been done and conducted or for local knowledge
[0:40:02] Trustee Borthwick: has been incorporated into even like initial provisional information gathering
[0:40:13] Trustee Borthwick: Yeah, thanks for
[0:40:17] Voice 4: that question through the chair. So the last major study of water availability
[0:40:24] Voice 4: on Denman Island was in 1994 for their water allocation plan, which was used by the province
[0:40:32] Voice 4: province to adjudicate surface water license, because at the time groundwater was not regulated.
[0:40:41] Voice 4: And now since groundwater has been regulated and the majority of water license applications
[0:40:49] Voice 4: or authorization applications are with groundwater, I'm not saying they're not considering the
[0:40:58] Voice 4: water allocation plan um but it it it's it's obvious with a 30 year old um uh water allocation
[0:41:08] Voice 4: plan that it's it's it's extremely outdated um doesn't have any of the recent climate
[0:41:15] Voice 4: modeling or predictions uh does not speak to uh any first nation um requirements or or interest
[0:41:24] Voice 4: interest so um the majority of the water availability is is site specific so it's
[0:41:38] Voice 4: almost like you know drill and ask questions later so there's there's been several cases of
[0:41:44] Voice 4: subdivision um going in on denman that have interacted with um saline groundwater so
[0:41:52] Voice 4: So recently we have new seawater intrusion risk mapping,
[0:41:57] Voice 4: which can inform areas where that can be a risk.
[0:42:03] Voice 4: And so it's not, it wouldn't necessarily be like a moratorium on development in those areas,
[0:42:10] Voice 4: but definitely inform the LTC and the applicants that there's the potential
[0:42:16] Voice 4: that groundwater resources can be impacted by seawater intrusion.
[0:42:23] Voice 4: as well as new development since 1994 and also build out analysis to determine in areas where there's going to be increased water use
[0:42:38] Voice 4: and how a changing climate is going to impact that and where we're going to be sitting in 2030 and 2050 and 2080
[0:42:46] Voice 4: has been the the three near-term dates that water balance assessment is looked at so like on on a
[0:43:00] Voice 4: planning standpoint we don't have the information to determine where there's available water
[0:43:07] Voice 4: um uh qualitatively speaking um you know residents know best on the water that they use and
[0:43:21] Voice 4: and and there's you know community knowledge of of where there's water issues and where there's
[0:43:28] Voice 4: water abundance and and i know some of the growers and producers i'm not too sure if you remember the
[0:43:34] Voice 4: presentation that i offered to the growers and producers um prior to the pandemic and we spoke
[0:43:40] Voice 4: deeply about water and at the time groundwater licensing and and and that sparked conversation
[0:43:45] Voice 4: with with many of them speaking to me about seasonal challenges with with um with with water
[0:43:52] Voice 4: resources and and that's another consideration of these older water allocation plans that they are a
[0:43:58] Voice 4: snapshot and they look at an annual water balance where modern day water balances are almost daily
[0:44:05] Voice 4: water balances so monthly they get average to to understand the challenges of of a changing climate
[0:44:14] Voice 4: and and seasonal water challenges and and so without undertaking that work um it's it will
[0:44:20] Voice 4: be a site-by-site analysis yeah
[0:44:23] Trustee Borthwick: and yeah and i thank you for that um i guess my my the part of
[0:44:30] Trustee Borthwick: my question here was um to to is to any like i understand we don't have a modern groundwater
[0:44:39] Trustee Borthwick: mapping uh uh survey um however we do have people who live here who who work uh in conservancy uh
[0:44:48] You know, people who are hydrologists of various
[0:44:52] Trustee Borthwick: stripes who do have current up-to-date, they walk in the forest every day, they survey various properties for various reasons.
[0:45:04] Trustee Borthwick: Is there any interface between our planning process and our staff and knowledge that already exists within community with people who are able to survey it on a day-to-day basis throughout the year as conditions change?
[0:45:19] Trustee Borthwick: because i i and obviously you have to go from reports i understand that that's that's part
[0:45:24] Trustee Borthwick: of how that's done and there's a certain you know standard that those surveys need to be done by but
[0:45:28] Trustee Borthwick: there is also knowledge here and what i was hearing in our last meeting was that we have
[0:45:34] Trustee Borthwick: a number of of community members who you know hold that knowledge and would they are keen to
[0:45:39] Trustee Borthwick: uh be available and i understand you don't necessarily uh have time to engage with every
[0:45:46] Trustee Borthwick: communities uh people who understand those bits and pieces on that kind of level of granularity
[0:45:52] Trustee Borthwick: i'm just wondering if there's any input from that body of knowledge into the work that you're doing
[0:45:58] Trustee Borthwick: um yeah if
[0:45:59] Trustee Borthwick: not then that's fine but
[0:46:01] Voice 4: i want to know no no great great question so through the chair
[0:46:06] Voice 4: where like a modern day water balance assessment is a community water champion groups is almost a requirement.
[0:46:22] Voice 4: You know, the desktop analysis can only tell us so much, but it and it can only be so powerful when it's leveraged by on the ground knowledge.
[0:46:34] Voice 4: it becomes extremely powerful so i can give you one example um salt spring island does not have
[0:46:41] Voice 4: a like an island-wide modern-day water balance but there was one done for one of the lakes
[0:46:47] Voice 4: lake weston and and so we have the the groundwater recharge mapping um which is one of the essential
[0:46:56] Voice 4: potential components to that and it was informed by a community-led freshwater catalog where they
[0:47:05] Voice 4: it's almost like a stream keepers where they determine that like the flow of the stream
[0:47:10] Voice 4: coming in a lake and and without that input it had been very difficult to undertake that
[0:47:18] Voice 4: water balance and that water balance is being used to adjudicate new uses on an existing
[0:47:24] Voice 4: existing community water supply so the the work that we're going to be doing on on Gabriola the
[0:47:32] Voice 4: reason why we chose Gabriola is because the regional district of Nanaimo has been actively
[0:47:39] Voice 4: working on water resources on Gabriola through their drinking water watershed protection plan
[0:47:44] Voice 4: that's one but the second one is is that through that plan they have let's say not formalized but
[0:47:52] Voice 4: but help organize and structure the data that's coming from the community,
[0:47:57] Voice 4: which is really important because if you have 10 either retired professionals
[0:48:05] Voice 4: or acting professionals undertaking work,
[0:48:08] Voice 4: you're going to get 10 different looks at similar data.
[0:48:12] Voice 4: So they have kind of structured that, and it's been really useful.
[0:48:17] Voice 4: And so we're going to be doing that analysis to see how useful it is for water balance and how we can then implement that on other islands using existing data or organizing community to collect new data to fill data gaps.
[0:48:36] Voice 4: um and and that's going to require coordination on island coordination and that's a big thing
[0:48:42] Voice 4: with water balance and that's why we're kind of low at the attack because i i don't find it useful
[0:48:49] Voice 4: to just hire a consultant to provide us a water balance assessment without community
[0:48:56] Voice 4: coordination makes no sense to me so so that that is a huge component and um and so on some islands
[0:49:05] Voice 4: will have champions at the LTC level but then on other islands that may not exist and we'll
[0:49:09] Voice 4: have to find water champions within community through conservation groups or whatnot.
[0:49:15] Voice 4: And yeah and so the data that we have collected can also be provided to those people to inform
[0:49:23] Voice 4: you know what they're studying like you know people who live on these islands are taking care
[0:49:29] Voice 4: of them and so and we're hoping that the the work that we're doing at the desktop level is going to
[0:49:36] Voice 4: help facilitate that as well um and and just one other uh part of this um there was a particular
[0:49:44] Voice 4: application for affordable housing or a community housing on on main island and uh there was a
[0:49:52] Voice 4: hydrogeologist a professional licensed hydrogeologist that was um helping with that
[0:49:56] Voice 4: application and uh they were able to take the the data that the islands trust is has generated from
[0:50:04] Voice 4: the recharge mapping project and they created their own water balance specifically for that use
[0:50:10] Voice 4: and that was really helpful for for that application it showed that there was a
[0:50:14] Voice 4: positive water balance and then it'd be a positive water supply um not to say that that housing was
[0:50:20] Voice 4: was built because of other reasons but but for for the for the water requirement it it the work
[0:50:27] Voice 4: from the honors trust made it favorable for them to show to the province that they had a positive
[0:50:32] Voice 4: water balance and then that it was helpful for their uh groundwater license application
[0:50:38] Voice 4: um so so that that's another aspect too on the professional level where where staff can share
[0:50:44] Voice 4: this information with a professional engineer geoscientist working on these projects and um
[0:50:51] Voice 4: yeah and that's really helpful um and and just one last comment is that for the water balance
[0:50:58] Voice 4: assessment um that we're working on and gabriel as a case study uh where we're quite um
[0:51:06] Voice 4: certain that that the province and also the regional district will be external
[0:51:10] Voice 4: members on that project so to kind of guide us through the work to say okay if you're going to
[0:51:16] Voice 4: undertake this work in this way it will be helpful for um you know for water authorizations so that's
[0:51:24] Voice 4: another aspect of it yeah
[0:51:29] Trustee Borthwick: and just and i don't want to dwell on this too much longer but i um
[0:51:33] Trustee Borthwick: the i guess what i'm sort of trying to drill it down to i'm not intended uh is um how can i
[0:51:42] Trustee Borthwick: And is it useful to you for me to try to encourage and empower community knowledge holders here already before?
[0:51:54] Trustee Borthwick: And I understand we're not yet doing that water balance survey on Denman.
[0:51:59] Trustee Borthwick: um is there a is there a a vector for them to um receive that information from you to inform their

[0:52:54] Voice 4: again i i often find that um like these these mapping tools like the freshwater atlas that
[0:52:59] Voice 4: they're they're very explorative like you can you can zoom around and spin it and all that stuff um
[0:53:06] Voice 4: but what was helpful for the north pender ltc is that they requested from staff to create just pdf
[0:53:12] Voice 4: maps of like just for individual island just for their island to be located on on their ltc website
[0:53:18] Voice 4: under the the maps and app page or whatever so if uh if the ltc wishes to do so you can
[0:53:25] Voice 4: request staff to provide those pdf maps um one so that's how like
[0:53:35] Voice 4: aside from the freshwater alice that's something that the staff can provide uh the community just
[0:53:40] Voice 4: this simple PDF map of the different components of the projects that have already been done on
[0:53:50] Voice 4: Denman. One aspect of the water balance that is very difficult to reach is how much water is
[0:54:01] Voice 4: actually being used, the water demand side. And so that's kind of an area where we hope to interface
[0:54:10] Voice 4: face with community to understand how much water people are using and this can be you know like
[0:54:18] Voice 4: anonymous anonymously collected Denman Island is is is mapped in I think it's like eight different
[0:54:27] Voice 4: groundwater regions so if we start understanding in a particular groundwater region how much water
[0:54:33] Voice 4: is being used that's going to be extremely helpful in the future especially on the agricultural side
[0:54:40] Voice 4: Because water licenses are given out, but the requirement for metering and determining
[0:54:47] Voice 4: how much water is actually being used is sometimes not a requirement.
[0:54:54] Voice 4: So that's a significant part of the story, is to understand how much water is being used.
[0:55:02] Voice 4: and and we're hoping that that we can refine our estimates a lot better uh for for the southern
[0:55:11] Voice 4: gulf islands when we undertook groundwater availability assessment which is kind of like
[0:55:15] Voice 4: a component of a water balance study uh we just determined that or estimated from from research
[0:55:23] Voice 4: that each household will use 650 liters per day for dwelling in a groundwater well which is
[0:55:29] Voice 4: probably high um and so those kind of estimates are are very rough and and so to to understand
[0:55:40] Voice 4: that more it's like i think every island is different because um you know even though
[0:55:47] Voice 4: we're very similar the the culture on each island is quite different so so that that's
[0:55:54] Voice 4: that's a component where we're hoping to interface with water champions to
[0:55:58] Voice 4: have a better understanding of of how much domestics use how much agriculture use and
[0:56:03] Voice 4: in some cases how much industry uses if there's some larger industries that are using significant
[0:56:09] Voice 4: mountain water like breweries or water delivery or something like that um so i i i hope that helps i
[0:56:17] Voice 4: mean if if the lpc wishes to provide a resolution to for for staff to come back with pdf maps that's
[0:56:24] Voice 4: the possibility um yeah i see i see planner champion yeah

[0:57:48] most of those people and not uh you know because i guess clearly we don't have a fresh water mapping

[1:02:25] Voice 4: and there's there's resources there uh for the most part um outside of the planning sphere this
[1:02:33] Voice 4: is regional district work like to be completely honest through a drinking water and watershed
[1:02:39] Voice 4: of protection service and and we see that happening at the regional district in naimo and
[1:02:44] Voice 4: and now starting with the couch and valley because they have they have passed the service through a
[1:02:49] Voice 4: referendum um really that the next step for the island's trust is is undertaking a a
[1:02:58] Voice 4: tailor-made water balance assessment for damon island and and through that determining who the
[1:03:05] Voice 4: the who the the partners are and and it's it would be hopeful that those partners are from
[1:03:12] Voice 4: the island and and and are from conservancy groups or or local groups or or an ad hoc group or or
[1:03:20] Voice 4: whatever a new water balanced society if you will to to truly understand the the available water
[1:03:28] Voice 4: not just now and not just through like lived experience but you know like we need to leverage
[1:03:35] Voice 4: the science to understand the challenges of a changing climate and and that's and unless there's
[1:03:43] Voice 4: a lot of climate denying that's that's that's one aspect of it climate change denying but
[1:03:48] Voice 4: but if if we can truly come together and say we know that seasons are going to change we've seen
[1:03:54] Voice 4: it already storms are stronger drought periods are longer how is that going to impact the
[1:04:02] Voice 4: bountiful water we have right now in some areas because it may not be as so bountiful in 2080
[1:04:08] Voice 4: and and that that's where water balance assessment yeah and
[1:04:13] Trustee Borthwick: so you know and
[1:04:14] Voice 4: and i'm not trying to be
[1:04:15] Voice 4: a politician here but like if if if there's not a if there's if there's not a like a
[1:04:23] Voice 4: a stated desire from the ltc to undertake a water balance then then that likely won't be
[1:04:31] Voice 4: in the cards but you know we're undertaking water balance assessment this fiscal like we're in this
[1:04:37] Voice 4: fiscal right now 2024-25 and it's not out of the cards to have a water valve project that can be
[1:04:45] Voice 4: funded on denman island before your term's up and that's i mean i'm just speaking freely like i
[1:04:51] Voice 4: don't know i'm not a planner or a politician or a director but but that would be if we have that in
[1:04:57] Voice 4: mind then it's then there can be certain steps that we can undertake through the methodology
[1:05:02] Voice 4: to understand how we can integrate with community um to undertake a project like that that's good

[1:05:43] Trustee Graham: housing advisory planning commission and the ubc um work that was done at the pre with the previous
[1:05:49] Trustee Graham: local trust committee so these neighborhoods these small r1 neighborhoods um the people that
[1:05:55] Trustee Graham: live there know exactly when they run out of water they know when they've uh ordered water from
[1:06:01] Trustee Graham: the comox valley when the trucks arrive they have intimate knowledge of their water usage and uh
[1:06:09] Trustee Graham: when they are in crisis so for those people in those um parts of them and which are
[1:06:16] Trustee Graham: subject to lack of water. When they come to our community information meeting
[1:06:20] Trustee Graham: and they're reviewing our draft bylaws and our desires to do this, they will be giving us the
[1:06:27] Trustee Graham: feedback that will inform the local trust committee to design mitigation or adaptation or
[1:06:34] Trustee Graham: changes to what we're proposing, i.e. size of dwellings, where the water is coming from.
[1:06:39] Trustee Graham: It may be that in some of those areas, if someone wants an accessory dwelling unit,
[1:06:44] Trustee Graham: they're going to have to collect rainwater exclusively because there just isn't groundwater
[1:06:49] Trustee Graham: so this is kind of this is going to inform the local trust committee at the visceral level of
[1:06:56] Trustee Graham: those communities those people that live in those communities know exactly what their water concerns
[1:07:02] Trustee Graham: are they will let
[1:07:03] Trustee Graham: us know we're going to make sure they let us know because we're going to invite
[1:07:07] Trustee Graham: them to the community information meeting and that's where we will be coming for um what you're
[1:07:13] Trustee Graham: talking about is interesting work and i would rather wait and see how the work transpires on
[1:07:18] Trustee Graham: gabriel and what the results look like and what costs are and what the timing is i i always
[1:07:25] Trustee Graham: selected to be the first one to try these things i'm glad gabriel has stepped up and we'll have

[1:09:59] Planner Chadwick (probable): end of March, um, that I, you know, feel was pretty successful.

[1:10:07] Planner Chadwick (probable): Denman um the Denman project is consistently in my head and I've been working through all of the
[1:10:13] Planner Chadwick (probable): questions and challenges and so the report that you're going to get is going to be um
[1:10:18] Planner Chadwick (probable): it's going to be well well thought through and uh like I said I've already I've been working
[1:10:22] Planner Chadwick (probable): through it in the last uh the last day actually yesterday I spent all day on it so that I have
[1:10:27] Planner Chadwick (probable): um a very clear um idea of where it's heading um so what I so essentially what I you know what I'm
[1:10:34] Planner Chadwick (probable): we're recommending is that we hold a meeting in May to review some process options. And I'll give
[1:10:42] Planner Chadwick (probable): you a little bit of a taster of what that's going to be right now so that you can sort of know what
[1:10:49] Planner Chadwick (probable): to anticipate. I should have this report done fairly soon so we don't have to delay it too
[1:10:55] Planner Chadwick (probable): much. It'll allow us an opportunity to focus again as we did in our February 20th meeting.
[1:11:02] Planner Chadwick (probable): And I think before I go into that, I just wanted to just comment on a few things that were brought up earlier.
[1:11:12] Planner Chadwick (probable): With respect to the suitable land analysis, there seems to be this, I would almost say, myth that Coho would not be a good place.
[1:11:24] Planner Chadwick (probable): But in fact, and I'm not, we haven't, before we see the data, I can't be conclusive on this, but from my perspective, having been on the land and knowing it's on a rock, which wouldn't be a recharge area, it has water available to it, it wouldn't necessarily be just using that data identified as somewhere that's not suitable.
[1:11:46] Planner Chadwick (probable): But what makes Coho particularly suitable, and this is where the Denman experience comes in, is the fact that you've got a community that is committed to looking after each other.
[1:11:58] Planner Chadwick (probable): And that, I think, in terms of a suitable area for additional density or what have you, is hugely valuable to the extent that one of the options that I am going to suggest the LTC consider is to allow for development variants for proof of water if you have the same kind of conditions that COHO exists in,
[1:12:25] Planner Chadwick (probable): which is a you know clear contract with uh with those that are involved in that uh that housing
[1:12:30] Planner Chadwick (probable): development because it's a it's a very special place and uh and uh every time i go there i feel
[1:12:35] Planner Chadwick (probable): um i sort of feel hope for humanity actually um i would uh um further just want to say that um
[1:12:49] Planner Chadwick (probable): um you know any delays that we experience are are you know as staff we try to move these projects
[1:12:56] Planner Chadwick (probable): projects as fast as as much as possible and we are balancing a number of different things and in fact
[1:13:04] Planner Chadwick (probable): the the suitable land analysis is bit is this opportunity to bring together all the data that
[1:13:09] Planner Chadwick (probable): we have been gathering for many many years and additional data so it's quite an exciting project
[1:13:15] Planner Chadwick (probable): and Gabriel is going to be the next community to so not only are they sort of test driving the
[1:13:22] Planner Chadwick (probable): or being the guinea pig, I guess, for the development of the methodology for the water balance.
[1:13:32] Planner Chadwick (probable): But they're also going to be the first real test of how suitable land analysis will be used.
[1:13:39] Planner Chadwick (probable): So there again, Denman doesn't have to be the first. Gabriel is going to kind of pave the way.
[1:13:44] Planner Chadwick (probable): um so one of the things that i have been looking at all the options that uh that were identified
[1:13:52] Planner Chadwick (probable): supported by the the ltc at the the meeting we had on february the 20th and it and what i really am
[1:14:00] Planner Chadwick (probable): trying to look at is how can we move forward um in the most efficient way possible on these
[1:14:05] Planner Chadwick (probable): on these options and so what i've done is i've gone through it and i've characterized them into
[1:14:10] Planner Chadwick (probable): to three categories one is um advance immediately as an as a minor project and that's i think come
[1:14:18] Planner Chadwick (probable): up in marlis's report to you and so that's where as staff we're recommending you just fire on with
[1:14:24] Planner Chadwick (probable): getting rid of that tup requirement um because of the way that we operate because of the the
[1:14:29] Planner Chadwick (probable): various pulls on our time if you can get two planners working on this um um in the way you
[1:14:36] Planner Chadwick (probable): you know, one in a very focused way,
[1:14:38] Planner Chadwick (probable): which would be Marlis moving forward with that TUP,
[1:14:40] Planner Chadwick (probable): removing that TUP thing,
[1:14:41] Planner Chadwick (probable): and me continuing to do the rest of the work,
[1:14:44] Planner Chadwick (probable): you're gonna move towards the finish line in parts,
[1:14:50] Planner Chadwick (probable): but I think more efficiently and faster.
[1:14:53] Planner Chadwick (probable): So I'm very much encouraging you
[1:14:56] Planner Chadwick (probable): to support the removal of the TUP requirement
[1:15:01] Planner Chadwick (probable): as a minor project.
[1:15:02] Planner Chadwick (probable): project. The other remaining options I'm characterizing, I'm putting into three different
[1:15:13] Planner Chadwick (probable): categories. One is land use amendments that require limited analysis. So those are things
[1:15:21] Planner Chadwick (probable): like, I'm going through my list here. Well, one thing is reformatting the land use zoning
[1:15:30] Planner Chadwick (probable): regulations, because if we don't do that, it's going to make this process terribly inefficient
[1:15:35] Planner Chadwick (probable): because it's a very, very awkward, awkward bylaw to work with. But, but, but, but these things
[1:15:45] Planner Chadwick (probable): include things like, you know, explicitly permitting alternative forms of housing,
[1:15:50] Planner Chadwick (probable): the legalizing of existing housing. We talked about that happening on a site-specific basis.
[1:15:55] Planner Chadwick (probable): I'm just giving you and making sure the vacation rental positions are restricted to what the LTC intended, B&B.
[1:16:04] Planner Chadwick (probable): So there's a variety of lists of things that are not, you know, can be done in a fairly straightforward way.
[1:16:12] Planner Chadwick (probable): And we don't need to discuss them. We can discuss these in more detail when I present them to you.
[1:16:18] Planner Chadwick (probable): The next category would be OCP amendments that require limited analysis.
[1:16:23] Planner Chadwick (probable): And so those ones are things like permitting the reduction of minimum parcel size to facilitate donation for non-profits, ensuring OCP support.

[1:17:12] Planner Chadwick (probable): the habc identified things like changing references to the village uh village to downtown
[1:17:18] Planner Chadwick (probable): town dem and those sort of technical things could be done um fairly straightforward and then the
[1:17:23] Planner Chadwick (probable): the bigger piece though is this um options related to um um increasing density like all out so i i
[1:17:33] Planner Chadwick (probable): don't know if you if you remember um well there's two things happening here well what we we are
[1:17:39] Planner Chadwick (probable): developing very we we have initiated our um our um engagement with the comox and are beginning to
[1:17:47] Planner Chadwick (probable): develop that relationship and they're very very great to work with and um we will be we we in
[1:17:54] Planner Chadwick (probable): we have provided them now with fifteen thousand dollars of um of capacity funding to engage in
[1:18:01] Planner Chadwick (probable): this process um now i will point out to you that um it's it's important for us um just from a
[1:18:09] Planner Chadwick (probable): reconciliation point of view but it's also important um because the province has been
[1:18:16] Planner Chadwick (probable): demonstrating to us by sending things back like the conservancy plan and um other bylaws where
[1:18:25] Planner Chadwick (probable): they have not felt like we've done the right kind of engagement now i don't know that they know what
[1:18:30] Planner Chadwick (probable): that is and i think they're wanting us to figure it out and we have a real opportunity here with
[1:18:36] Planner Chadwick (probable): the comox both on denman and on hornby and with this project like i said we've met with them um

[1:19:14] Planner Chadwick (probable): Right. So the suitable land analysis, we have all the data that can help to inform the environmental protection point perspective and the water perspective and other perspectives.
[1:19:25] Planner Chadwick (probable): And, you know, they're interested in the protection of their cultural heritage sites. So that is potentially another layer to look at when looking at increasing density.
[1:19:39] Planner Chadwick (probable): So, an increasing density, which is basically ADUs just expanding the permissions outright.
[1:19:50] Planner Chadwick (probable): Salt Spring tried it, and they got pushback from one of the nations in a very strong way.
[1:19:59] Planner Chadwick (probable): So, we started off with this relationship with COMACS.
[1:20:03] Planner Chadwick (probable): We want to make sure that we do this appropriately, like, and well with them.
[1:20:08] Planner Chadwick (probable): So the pieces around how far do we expand the permissions for additional dwelling units and secondary suites, that's the stuff that's going to take the work.
[1:20:26] Planner Chadwick (probable): And so I think we shouldn't hold back the other work because we're going to have to do more detailed work on that piece.
[1:20:35] Planner Chadwick (probable): so we should so that's what I'll be proposing with timelines for you moving

[1:23:41] Planner Chadwick (probable): housing project, that is being done. There's needs assessment that's being done. We got water
[1:23:48] Planner Chadwick (probable): balance assessment on that. And that's, you know, here it says awaiting for a bit, you know,
[1:23:53] Planner Chadwick (probable): funding allocation um we've got consider first nations interest in in land use decision making
[1:23:59] Planner Chadwick (probable): um the increased housing options is the bulk of this project and all of all of the things that are
[1:24:05] Planner Chadwick (probable): um basically a checklist of all of the things are included in there um we've got minimized
[1:24:12] Planner Chadwick (probable): uh environmental impact on on on land use that's all land use as well so that's all included in
[1:24:17] Planner Chadwick (probable): this project i've included implement affordable affordability measures and that really speaks
[1:24:23] Planner Chadwick (probable): to the housing agreements piece and i will say i've had some further conversations with folks
[1:24:29] Planner Chadwick (probable): and um it is something that i am exploring on my end um um you know the ability for us to um
[1:24:39] Planner Chadwick (probable): i'm exploring that ability for us to administer housing agreements for um for adus because because
[1:24:45] Planner Chadwick (probable): Because I know it's a significant interest for Denman, but it's a significant interest for other islands as well.
[1:24:52] Planner Chadwick (probable): It's come up with the Gabriola housing project as well.
[1:24:57] Planner Chadwick (probable): I've got to provide education and engagement on building cost options and environmental alternatives.
[1:25:04] Planner Chadwick (probable): Now, those are, again, things that we can't do within the scope of this project, but we don't want to lose them.
[1:25:09] Planner Chadwick (probable): And then the last one here is advocate for support for infrastructure needs.
[1:25:13] Planner Chadwick (probable): Again, those are things we don't want to lose, like advocating for CVRDs and the province's support for cisterns purchase, for example.

[1:25:27] Planner Chadwick (probable): So there's things that, you know, we don't want to lose those good things.
[1:25:31] Planner Chadwick (probable): And so it's just an opportunity to capture it all on a page.

But if it's not captured, then it's not necessarily going to be done.

[1:26:59] Trustee Graham: actually the feedback that Sam and I got at our very well-intended open house. We have 5% of our
[1:27:04] Trustee Graham: community at the back hall. Nobody said, well, I think this TUP thing, we should think about this.
[1:27:12] Trustee Graham: Everyone that I've spoken to, including those of us that were responsible for it in the first place,
[1:27:18] Trustee Graham: have said it was inappropriate and we shouldn't have done it and let's just get rid of it.

[1:32:51] Planner Chadwick (probable): figure out, I mean, they have some very clear interests, and they're trying to figure out how

[1:33:01] Planner Chadwick (probable): start with, you know, we found in a number of cases, it's useful to start with staff to staff

[1:44:52] Voice 6: farm regulations review project has moved on the bylaws are forwarded to the minister
[1:44:56] Voice 6: so they're in review at that stage the LTC is being asked to review these potential projects
[1:45:03] Voice 6: we confirm one minor project priority for the 2004-2005 fiscal year, as well as clarify the scope and objectives of the project that's chosen.
[1:45:14] Voice 6: At the February meeting, so the last meeting, the LTC discussed the importance of the DPA-4, the Streams, Lakes, and Wetlands DPA, and considered whether it needs to be reviewed.
[1:45:27] Voice 6: There was a motion that was passed requesting staff to provide review and analysis of DPA-4.
[1:45:33] Voice 6: And after review of the motion, the request appears more suitable as a minor project.
[1:45:39] Voice 6: It would require a significant amount of staff time, and typically the fuel items are
[1:45:45] Voice 6: things that can be done really quickly, two hours.
[1:45:49] Voice 6: As a minor project, the LTC would have the ability to provide the scope and objectives
[1:45:54] Voice 6: as well as clear deliverables if that was the project that was chosen.
[1:46:00] Voice 6: The list of potential projects are the Subdivision Regulations Review Project, DAI By-law Review
[1:46:08] Voice 6: Project, which would likely be most suitable after this housing review project because
[1:46:13] Voice 6: it could require it might be a little bit of a course to do the dai review now uh there's the
[1:46:21] Voice 6: land use bylaw map amendment project which is related to a small map amendment with the
[1:46:28] Voice 6: farm regulations review projects there's the development permit area number four review project
[1:46:35] Voice 6: tups for short-term vacation rentals was on the list uh guest accommodation review project
[1:46:43] Voice 6: which could get included in the housing review project.
[1:46:47] Voice 6: There was some amendments to the land use file
[1:46:49] Voice 6: that was discussed at last meeting,
[1:46:52] Voice 6: and then a housing-related TUP review project.
[1:46:57] Voice 6: And so staff is recommending that the LTC
[1:46:59] Voice 6: choose the housing-related TUP review project.
[1:47:05] Voice 6: The VIU report and the HAPC both recommended
[1:47:09] Voice 6: that TUP regulations related
[1:47:11] Voice 6: related to the secondary dwelling units be reviewed and removed. TUPs are temporary,
[1:47:17] Voice 6: do not provide long-term housing solutions, and the owner's application process, as we
[1:47:24] Voice 6: know, can discourage property owners if it bears little uptake in the whole 12 years.
[1:47:34] Voice 6: So working in conjunction with the project lead, so with Planner Chadwick, there's an
[1:47:39] Voice 6: opportunity to advance a really small and important piece of the work ahead of the major project so
[1:47:45] Voice 6: like Marissa was saying it's something that could be done very quickly uh there's not like as you
[1:47:50] Voice 6: said there's maybe not a
[1:47:51] Voice 6: lot of analysis that needs to come but there
[1:47:54] Voice 6: is still with amending
[1:47:56] Voice 6: OCPs and LUVs there is still a process and a way that we need to do it so there is a bit of work

[2:18:15] Trustee Borthwick: actually hard um it's challenging to figure out how like who will listen because BC fairs is does
[2:18:25] Trustee Borthwick: not seem to be in any way interested in in addressing it um it's not financially viable
[2:18:31] Trustee Borthwick: for them instead they would like to expand the main sound connector which is an insane thing to
[2:18:37] Trustee Borthwick: do um yeah increasing capacity is is to me is short-sighted because it has all of these impacts
[2:18:45] Trustee Borthwick: that Arlene is concerned about, we also do have to recognize that Hornby has a separate agenda
[2:18:51] Trustee Borthwick: and different, not all, Hornby is not a monolith, like there are people on Hornby who would love to
[2:18:56] Trustee Borthwick: see much less tourism, but there are people on Hornby whose livelihoods depend on that.

[2:19:07] Trustee Borthwick: of, you know, is it right for the Dem and LTC to dictate what's economically viable for another
[2:19:13] Trustee Borthwick: another island and my to which my answer is well probably not never not really like we shouldn't
[2:19:18] Trustee Borthwick: be saying you can do you can have this business so you can't have this business i think that we
[2:19:24] Trustee Borthwick: need to find a way as neighbors to work together and talk about it be like well maybe you can't
[2:19:29] Trustee Borthwick: have all of this business because you have to recognize that you do have this bottleneck which
[2:19:34] Trustee Borthwick: is our island and you might not feel the pain of that but we do um but it's it's about trying to
[2:19:40] Trustee Borthwick: foster that dialogue in a way that's useful and helpful and it's uh it's hugely challenging and

REPORTS 3.1 Trustee Reports Trustee Graham reported that the Islands Trust 2024/25 budget was approved at Trust Council last month after much discussion and work to keep the impact on constituents as low as possible. Trustee Borthwick reported on the following: He also attended the Trust Council meeting last month and noted that there were some good components achieved in the approved budget. ADOPTED Denman Island ADOPTED 2 Local Trust Committee Minutes April 9, 2024 He advised that the Ferry Advisory Committee has been suspended since last year by BC Ferries and, as the Trustee sitting on the Committee, he is frustrated that there is no forum to discuss the community’s concerns and rising negative impacts related to ferry travel. 3.2 Chair's Report Chair Maude reported on the following: He noted that the Islands Trust 2024/25 budget was approved after much discussion with a 5.9% increase in taxation, which he considered reasonable especially in comparison with other local governments, and given rising costs. He is involved with the committee working to hire a new Chief Administrative Officer; progress is being made. He has had meetings with government officials regarding the proposed National Marine Reserve, which Parks Canada has been working on establishing. Public consultation will be conducted and while the Reserve may not extend as far as Denman Island, there may be impacts. 3.3 Electoral Area Director's Report – none. 4. PUBLIC COMMENTS Last spring it was reported that the Federal government was offering a housing grant and that while the application deadline might be difficult to meet this year, it might be approached next year more successfully. What is the status of this opportunity? o An application was made to Canada Housing and Mortgage Corporation for the housing grant; however, it was not successful. Additional funding opportunities through that program have not been identified at this time. Objection was made to adding additional items to the Housing Review project at this point in the process. The Suitable Land Analysis, Water Availability Assessment and a Housing Action Plan were not supported as a part of this project, are out of scope, and would cause delay in the Housing Review. The total of residential densities remaining in the Density Bank reported in Standing Resolution DE-2020-022 are incorrect. When will this be corrected? o The total is correctly reported in Standing Resolution DE-2023-073; the original Standing Resolutions was not amended, but a new Standing Resolution was added with the correct information. What is the status of the Bylaw Enforcement Notification bylaw changes made last year? o The changes, limited to environmental concerns, Short-Term Vacation Rentals and Siting and Use infractions were approved by Executive Committee. Can Trustees explain why Denman residents were surprised by a Bylaw Officer on January 30 th without notice? And what recourse is available to community members if the Bylaw Compliance and Enforcement rules are not followed? ADOPTED Denman Island ADOPTED 3 Local Trust Committee Minutes April 9, 2024 o A Trustee responded that his initial understanding is that a complaint was received about machinery cutting trees in the lake area and that the Officer was attempting to discover on which property it occurred. Community members may speak to Local Trustees or to make an administrative fairness complaint regarding staff contact the CAO. Is a secondary suite considered a home-based guest accommodation or Short-Term Vacation Rental? o Secondary Suites are permitted in certain zones and information on regulations can be found in the Land Use Bylaw or by speaking to a Planner. There are specific regulations regarding home-based guest accommodations. For example, must be contained within a principal dwelling unit, limit on number of bedrooms and beds, length of stay, etc. 5. DELEGATIONS - none 6. BUSINESS ARISING FROM MINUTES 7.1 Follow-up Action List dated April 2, 2024 A Trustee requested an update on the status of the February 13, 2024 activity regarding coordination of an introduction meeting between the Local Trust Committee (LTC) and K'ómoks First Nation Chief and Council. Planner McCargar will follow up on this inquiry with Regional Planning Manager Jamurat, who is tasked with organizing the meeting. 7.2 Groundwater - Memorandum Senior Freshwater Specialist Shulba presented the Memorandum that responded to a LTC request for the status of the Freshwater Sustainability Strategy (FWSS) with regards to the Denman Island Local Trust Area. He provided background on the development of the FWSS and related projects, identified focused work on Denman Island groundwater conditions (l970’s) and water allocation (1994), and the Islands Trust Area Groundwater Recharge Potential Mapping project (2021). The project reports data will be available in the Islands Trust Freshwater Atlas. There are no planned Freshwater Sustainability Strategy projects specifically for Denman Island at this time. ADOPTED Denman Island ADOPTED 4 Local Trust Committee Minutes April 9, 2024 In fiscal year 2024/25, the Islands Trust Area Water Balance project will commence with Gabriola Island as the case study island, which will help, determine next steps and methodology. Trustees continued the discussion with response from Senior Freshwater Specialist Shulba with the following noted: Water is of great importance to the Denman Island community and was a source of concern during the recent Farming Regulations Review. Trustees acknowledged the significant local knowledge of water on the island and asked how can that knowledge or existing mapping be utilized or how interfacing with the project can occur. Is there a simple methodology that could be shared with community groups to facilitate them being able to collect and report information in a useful way? o The next step would be for the Islands Trust to undertake a tailor-made Water Balance Assessment for Denman Island. A Water Balance Assessment could be funded before the LTC term concludes and would include consultation with the community. PDF maps of different projects that have been done on Denman Island can be requested. A Trustee noted that residents can contribute knowledge of their water usage, and community input on water issues can help inform LTC decisions. Observing the outcome and costs of the Gabriola Island Water Balance case study was considered as a next step to inform whether to advance a Denman Island Water Balance Assessment funding request. 8. LOCAL TRUST COMMITTEE PROJECTS 9.1 Denman Housing Advisory Planning Commission Reporting - verbal update There was no verbal update provided. 9.2 Major Project: Denman Housing Review Project - Staff Report Planner Chadwick reported that staff is recommending the LTC schedule a Special Meeting in May to review next steps for the Housing Review project. She anticipated the focus would include discussion of a draft Housing Action Plan and consideration of options from the Housing Advisory Planning Commission’s work and the February 20 th LTC Special Meeting to inform the drafting of related bylaws. Discussion included the following key points: A Special Meeting was supported with an expedited timeline requested. Some aspects of the proposed project amendments might be considered as a minor project, a process that would advance a piece of the work ahead of the major project. CARRIED Funding for the next phase of the project has been approved. Engagement with K'ómoks First Nation has begun on a staff-to-staff basis. The Suitable Land Analysis tool would help inform protection of their cultural heritage sites. Trustees expressed frustration that their repeated request for an introductory meeting with K'ómoks First Nation, a community that is important to this process, has not moved forward. Staff will bring this issue to the attention of Regional Planning Manager Jamurat. 9.3 Local Trust Committee Project Prioritization - Staff Report Planner McCargar summarized the Staff Report that asks the LTC to consider selection of a minor project for the 2024/25 fiscal year as the Farming Regulations Review project is in the final stages of completion. She outlined potential projects and provided rationale for recommending that review of the Temporary Use Permit regulations related to secondary dwelling units be identified as the minor project priority for the upcoming fiscal year. DE-2024-025 It was MOVED and SECONDED, that the Denman Island Local Trust Committee request staff to remove the requirement for a Temporary Use Permit in Section 5, Area 2 of the Land Use Bylaw and in any Official Community Plan references. CARRIED Trustees expressed their hope that this work can be expedited, given the limited scope and previously identified community support for removal of this requirement. CORRESPONDENCE (Correspondence received concerning current applications or projects is posted to the LTC webpage) 10.1 Email dated March 25 from H. Holm regarding Cross-Island Traffic LTC members discussed options to continue to seek a solution to the cross-island traffic concerns on Denman Island. They acknowledged that Trust Council does not generally advocate for specific island issues and, as BC Ferries has not been responsive to the concerns and plans to increase capacity, they considered that advocating at a provincial Ministerial level might prove the most effective. Trustees offered to discuss this strategy with Hornby Island Trustees who might consider initiation of the correspondence with the Minister to demonstrate the extent of concerns, with invitation to the islands as an option. Trustees appreciated the email from H. Holm and will respond. 11. NEW BUSINESS 11.1 Intent for C2C Funding Application - verbal update Staff reported that the previously discussed C2C funding application is not proceeding at this time, as the deadline did not allow sufficient time to align the proposed activities with the program objectives; if there is another funding opportunity the LTC will be advised with more time to prepare. 12. STAFF REPORTS 12.1 Short-Term Vacation Rental Enforcement Policy Update - Staff Report LTC members supported the recommended Staff Report resolutions, noting that the action combines three adopted Standing Resolutions into one policy and provides a distinction between Short-Term Vacation Rentals and home-based guest accommodation uses for clarity. DE-2024-026 It was MOVED and SECONDED, that the Denman Island Local Trust Committee rescind Standing Resolutions DE-2018-056, DE-2018-100, and DE-IC-2021.007. CARRIED DE-2024-027 It was MOVED and SECONDED, that the Denman Island Local Trust Committee adopt the following policy as a Standing Resolution: That the Denman Island Local Trust Committee direct staff to use the following policy in dealing with unlawful Short-Term Vacation Rentals (STVRs), or other forms of commercial vacation rentals: 1. There will be proactive monitoring, investigation, and reporting to the Local Trust Committee regarding Short-Term Vacation Rentals on Denman Island. Bylaw Officers will prioritize the investigation of Short-Term Vacation Rentals in the following manner: a) There are issues related to health and safety on the property; b) There are written complaints regarding nuisance issues such as noise or parking congestion related to Short-Term Vacation Rental operation; c) There are operations by persons who have not established a residential use on the same property as the Short-Term Vacation Rentals; and d) Accessory buildings or structures are being used as part of a Short-Term Vacation Rental operation. 3. It is understood that home-based guest accommodation home occupations complying with section 2.4 of the Denman Island Land Use Bylaw No. 186 are not interpreted to be Short-Term Vacation Rentals, or commercial vacation rentals, and that those home-based guest accommodations may be operated year around. CARRIED Following up on earlier discussion, the LTC requested additional information as follows. DE-2024-028 It was MOVED and SECONDED, that the Denman Island Local Trust Committee request a written staff report regarding Bylaw Compliance and Enforcement staff visits on Denman Island on January 30, 2024 that is appropriate for public contemplation. CARRIED 12.2 Trust Conservancy Report - none 12.3 Applications Report dated April 2, 2024 A Trustee requested a status report on DE-SUP-2022.2 given the length of time this file has been open. Planner McCargar will ask the Planner responsible for the file to follow- up on this request. 12.4 Trustee and Local Expense Report dated February, 2024 Received for information. 12.5 Adopted Policies and Standing Resolutions Trustees acknowledge the need for clarity with Density Bank updated densities and suggested that a comment be added to Standing Resolution DE-2020-022 such as “see updated resolution DE-2023-073.” 12.6 First Nations Relationship Building Update – none. 12.7 Local Trust Committee Webpage There were no changes or additions requested. 13.
